[5:41] » [snorts] >> Um, and they serve over 680 students in [5:45] the in the metro area. Um, [snorts and clears throat] [5:48] and so that's, you know, that's ongoing. We've had a lot of good feedback on [5:52] that. Um, the aquarium is uh a finalist in the in the special organization of [5:58] the year in environmental uh excellence for keep Oklahoma Beautiful. [snorts] [6:04] Um, we partnered with the arts at 302 for their Halloween themed art show. We [6:09] had Shipley over there. uh education went to visit Youth Services of Tulsa [6:14] and they'll be bringing uh their kids to the aquarium on uh Saturday, October [6:19] 25th, which already passed. That was last week. [snorts] Um and then as far [6:24] as the uh shark the new shark research center, um we're now finally to the [6:29] stage where we can waterproof. Um, [snorts] it was supposed to be this [6:32] week, but we're not 100% sure yet because we have a very large uh [snorts] [6:37] vessel that's uh was supposed to show up Monday and then was supposed to show up [6:42] Tuesday and now it's Thursday. So, they've had a lot of they're coming from [6:47] uh Canada. So, they're kind of uh the weather is kind of holding things up, [6:52] but >> [snorts] [6:52] » um we will need a crane. So, we're trying to, you know, orchestrate it with [6:56] a crane to be there when they show up. Um, [snorts] so that's kind of what [7:00] we're work that's our priority right now. Um, so we can get it craned off the [7:03] truck and then we got to figure out how we're going to get it in the building. [7:06] It's it's pretty heavy so and pretty bulky, but um and then it's got to go on [7:11] the second level. So that's going to be really interesting. [7:15] Probably didn't think that one through, but we're going to [snorts] get it. It [7:18] It's going to fit. [laughter] [7:23] But uh yeah, so um but the tank it took a long time to resurf to uh prep the [7:30] surface of that concrete tank and there was a lot of um imperfections that we [7:34] found along the way um that we [clears throat] had to have the company [7:38] come out several times to repair. [snorts] Um it's it's really common for [7:44] hidden pockets and and steel to be right under the surface. Um, we found a a [7:50] measuring tape embedded in the concrete. [laughter] [7:53] So, it happens. I mean, honestly, it's not I'm not uh it's not a strike against [7:58] the company. It's just every single pour is like that and every project I've ever [8:04] been on. So, it's some are worse than others, but uh yeah, you go along with a [8:08] hammer and and listen for hollow spots. And then we have uh magnets, rare earth [8:12] magnets that we go all over the whole tank. Um and so, yeah, it's a lot of [8:16] work. And then we have the salt uh vat in the back which is um an underground [8:21] vault basically. And so having to be in there prepping the surface um finally [8:27] it's done and ready for the waterproofing. So um soon as we get an [8:32] opportunity to do that, it'll look really good. It' be a good time to come [8:35] check it out. So and then our acrylic panels should be here soon, too. Um but [8:42] we probably won't install them right away. We'll probably set them in the [8:45] tank. Um that way we have access in and out of the tank through the window uh [8:49] openings and not have to use ladders. We're probably going to use the tank as [8:53] a staging area for um our you know PVC parts and things like that. So um and [8:59] that's pretty much all I have today. Anybody have any questions? He was a really interesting person and um and at the funeral uh the [10:44] rest of of his group um was there and they did several songs which was really [10:49] it was really touching. It was neat. Uh we are celebrating our third church [1:01:44] anniversary on November the 9th. It's at our 9:00 Sunday morning hour. We are [1:01:51] located on 111 South 3rd Street in Jinx on the corner of Third in Maine inside [1:01:57] of the Family Life Center of First Christian Church. And so we will be [1:02:02] celebrating there on the 9th of November, 3 years. And so we just [1:02:07] believe God to uh bless our celebration and we thank God for what he's done over [1:02:12] the three years that we've been in Jinx. So the land use map is the document that is part of the [1:08:37] comprehensive plan and in 2020 we adopted the uh horizon jinx [1:08:42] comprehensive plan and at that time we went through and said hey we think this [1:08:46] area should be single family residential or regional commercial etc. So, we've [1:08:51] made multiple probably 15 different times we've brought you amendments and [1:08:56] changed things. And the good news is it's a guide. It's not codified. It's [1:09:01] not the law. It is the um it's a guide for how land use develops or how a piece [1:09:08] of property develops in the future. So on um [1:09:14] item D uh one which was one and then item D [1:09:19] approved minor amendments to the comprehensive plan lend use map on page [1:09:22] 74 is letter A regional commercial to low inensity single family and um just [1:09:29] to simply put it we do not uh want that amended it should stay a regional [1:09:33] commercial and if anybody I like I say to the [1:09:38] public who come in for we've had probably over 40 hours of conversations [1:09:44] on this general area and um if you know if at some point someone wants to go [1:09:50] residential, we'll come back and ask you to amend it. If someone wants to do [1:09:54] regional, then it's all teed up for them and ready to go. So my recommendation [1:09:57] and request is to um approve B through [1:10:05] H with the exception of A. It's a zone change from commercial [1:10:58] shopping to RS3, which is residential single family and approval of major [1:11:04] amendment two for PUD 146 uh overlay. The general location is [1:11:10] north of 131st Street and west of Elm. We are on page 85 if you're following [1:11:16] along. And uh we welcome back Mrs. Hilton, I believe. [1:11:23] [clears throat] [1:11:29] » Thank you, Mayor Box, Council and Staff. Um, we talked recently in an internal [1:11:35] meeting that uh there's a lot of information in these cases and so I'll [1:11:40] try to simplify it, but this is actually one that was threepart. So when Mr. Bell [1:11:46] brought the original approval to you for what we call Glennwood [1:11:52] uh PUD 146, we said at that time we're going to approve one part and then there [1:11:58] will be two additional parts that we'll come back and approve later. So this is [1:12:01] the last piece to that puzzle. So the very and I'm going to talk in [1:12:05] generalities of the whole PUD first and maybe we'll use page 87. Brandon if [1:12:13] you don't mind really quickly. [1:12:19] So [clears throat] this table was [1:12:23] established with the UDO regulations and then how the PUD compares to that. And [1:12:28] so what you all approved in phase um the first time we got the amendment [1:12:35] phase one was the original PUD that you approved and then phase two was what is [1:12:42] uh what you've seen the most often and that's called crossfine that became that [1:12:47] private gated subdivision at the very top portion of that whole uh area. And [1:12:52] what we're talking about tonight is uh if you'll go back to that map Brendan I [1:12:57] appreciate it. Thank you. [1:13:01] There we go. So, the hard corner of Elm and 131st. So, you can see that little [1:13:08] flag shape um subdivision. That was phase one. And then above that was Cross [1:13:13] Vine. And then the applicant is asking to do less commercial on that hard [1:13:19] corner and instead of what was originally approved in the PUD was that [1:13:24] they would come back with multif family as a buffer. But they're asking to do [1:13:28] single family residential. So very similar to the very first project that [1:13:32] you included or sorry that is included but you all approved. It is Glenpole uh [1:13:39] school district. This particular area [1:13:44] um would be considered still starter homes. And the biggest thing that the [1:13:51] planning commission talked about was access through this commercial [1:13:57] subdivision and the residential subdivision. So originally they came to [1:14:01] staff and had they couldn't meet the spacing requirements and since 131st is [1:14:07] a secondary arterial, it needed to be I can't remember off the top of my head so [1:14:11] many feet from one uh access point to the other. And because that's going to [1:14:15] be a very very busy intersection to get the through the to get the commercial [1:14:21] traffic and the residential traffic to be more compatible but keep them off of [1:14:26] 131st Street or off of Elm. It makes more sense to allow access through [1:14:31] there. So in blue down at the very bottom that would be the primary [1:14:35] residential access and then there would be a commercial access further over [1:14:41] between 131st. And then but all residential projects, the original one [1:14:47] and the new one that you're looking at tonight would come through the blue box. [1:14:51] And then for amenities when they originally came in, uh they did not [1:14:55] provide an amenities package. So they came back and we'll go over that in just [1:14:58] a minute. But the amenities um they added a park for this one and they show [1:15:04] it here. So you can see another blue access over to the commercial and then [1:15:08] there's a red box for a park area that would be moved up to somewhere in this [1:15:13] northwest corner. So getting that park away from the commercial area and over [1:15:18] by that uh um dead end. And then there is a third access. You [1:15:25] can see another blue box. So, [snorts] those were the three accesses. [1:15:29] If you could look at um let me see if I got a better one. [1:15:36] Their amenities package. You can just go to the next page, [1:15:40] please. [1:15:43] So, this is the area. So, that white box is the area that we're talking about [1:15:48] approving tonight. And then they would have shared amenities and a shared HOA [1:15:53] with the box or the land um area that you see highlighted with the black lots. [1:16:00] So, I really need a pointer. The Can you zoom in a little bit? Or actually, will [1:16:05] you go to the next page? It's kind of zoomed in for us. Uh oh, it's flipped [1:16:10] though. Could you turn it? And then what you don't see is that access that [1:16:34] cuts over to the east that we saw in the other exhibit. They haven't updated this [1:16:39] one. But then there's the shared exhibits up here. You see a very large [1:16:43] pond and walking trail. This has a blue line stream through it. So, there's [1:16:47] certain things that they cannot do. So, they have a big area there. They have a [1:16:51] pickleball court and playground. And then they also show you their uh [1:16:56] exhibits for their entrance. And I think that's really about all I have to cover. [1:17:02] Again, this project and the hard corner residential wise are basically the same [1:17:07] product, very, very similar. So, what you originally thought might get uh [1:17:11] approved based on the PUD was some multif family and they're saying, "No, [1:17:16] we don't want to do multif family. We just want to do additional residential [1:17:19] and commercial on that hard corner." [1:17:26] » So, Marci, just to clarify, the people that live here would have to drive [1:17:30] through a parking lot to get in and out of their neighborhood. Does that exist [1:17:34] anywhere else? We talked about that at planning commission and it is not very [1:17:38] common. It doesn't it would probably be so that design is not done yet and I [1:17:46] don't think it would look exactly like a parking lot. There would be a dedicated [1:17:50] drive aisle and we do that a lot. So in AASO they have a brand new subdivision [1:17:55] where there is a dedicated drive aisle. Um, what it does is it keeps me from [1:18:01] having to drive out of the subdivision, go 300 feet, cross two more lanes of [1:18:05] traffic, and then go back up into the commercial area. So, it it sounds um [1:18:11] unconventional, but when you talk about transportation and access, it's a lot [1:18:16] more efficient. [1:18:24] » Question for Mrs. Hilton. >> Yeah. And so, again, that piece that [1:19:08] we just looked at that was the original middle piece comes right here and then [1:19:13] turn it that way. And this is the gated subdivision right across here. And there [1:19:18] is precedent to making the commercial corner smaller. [1:19:24] And I mean, we did it across the street at uh Yorktown. [1:19:28] It's not the similar, it's not like a mirror image, but if you see um the [1:19:34] southwest corner there at Yorktown, there's one little [clears throat] [1:19:37] subdivision that took up a portion of what was a commercial corner. We're going [2:17:19] to move on to item number six, consideration and appropriate action [2:17:24] relating to resolution number 887, a resolution authorizing the Jinx [2:17:29] Economic Development Authority to assist the city of Jinx in carrying out and [2:17:34] administering the Jinx River District Economic Development Project Plan [2:17:38] adopted by the city, approving and authorizing the execution of an economic [2:17:43] development agreement by and among the authority the city and Sey A Ram [2:17:48] Holdings LLC ratifying and confirming an economic development agreement buy and [2:17:53] among the authority the city and Tulsa premium outlets and between the [2:17:58] authority and the city pertaining to certain tax increment revenues approving [2:18:02] the use of assistance and development financing and containing other [2:18:06] provisions relating there too subject to approval of the city attorney as to the [2:18:10] final form. [2:18:18] » Uh, yeah, just I mean very briefly, so this is an agreement um Robert Patel's [2:18:24] group to build a dual branded I think it's a Hampton Homewood by Hilton um [2:18:31] hotel uh have a restaurant bar in it. Uh the proposed incentive would be 10 years [2:18:40] of the two cent sales tax tiff revenue. Right now it's currently being allocated [2:18:45] to Simon Properties for the DPO uh reimbursement. [2:18:49] They've consented to reallocating those dollars to go towards this incentive and [2:18:54] then also half of the 5 cent hotel tax. So 2 1.5 cents of the hotel tax um for a [2:19:03] period of 15 years. So 10 years for the sales tax portion, 15 years for the [2:19:08] hotel tax period up to a maximum reimbursement of 3,143,000. [2:19:14] Um it would cut off at at the end of that time period if they've not made it [2:19:18] to that amount. Uh if they make it to that amount earlier, then then that's [2:19:22] great. Uh some of the benefits that that we see to this to the city with that is [2:19:28] uh in generating the additional sales tax within the tiff district that also [2:19:32] provides uh access to matching funds from the state. So you'd have a [2:19:36] corresponding amount of sales tax that would be available for other tiff [2:19:39] projects. U the uh 5 cents of local hotel tax that's generated is also [2:19:45] eligible for those matching funds. So essentially you're having 2 1/2 cents [2:19:51] that's going towards an incentive and you're generating 7 1/2 cents that's [2:19:54] going towards other tiff projects within the city as well. And then you've also [2:19:58] got the advalorum value that would be generated that would be going towards [2:20:01] the the Tulsa premium outlets u part of it and and really then represents kind [2:20:07] of a an inertial building block uh to have some things going on. He's [2:20:12] indicated he's prepared to move forward very quickly. Um he's under the [2:20:18] agreement he'd be obligated to have a building permit in hand by the end of [2:20:22] the fiscal year. So the end of June uh anticipates about a 24-month build. So [2:20:27] he'd be obligated to complete the project no later than the end of 2028. [2:20:31] But based on his timeline hopefully maybe spring of 2028 he'd be in a [2:20:35] position to be open. So I'm I'm happy to answer any other questions you might [2:20:40] have. Any questions from Mr. [2:20:44] Emmens council any comments [2:20:50] Mr. Short? >> Well, I think you know the the uh value [2:20:55] of having this project uh is is there are several aspects in my opinion. Um [2:21:02] get some building going on the outlet mall uh structure uh or or pad sites. I [2:21:08] think the um to to Nate's point the inertia of that you know when we looked [2:21:15] at the projections the proforma numbers the amount of occupancy that he would [2:21:20] have to maintain to obtain uh within the the time period presented uh we would [2:21:26] have a a sizable occupancy which I think would generate significant uh halo value [2:21:34] for the city of Jinx. There would be a lot of human beings aggregating around [2:21:38] the outlet mall. Whatever we have uh in and around the outlet mall, including [2:21:43] restaurants and other entertainment venues, I think will benefit, including [2:21:46] the Oklahoma Aquarium. Um I think that those added benefits um economically [2:21:54] make the maximum of 3.1 million um very tolerable to to me in my opinion. Um I [2:22:03] think that um again, you know, if we hit these numbers, uh the sales tax benefit [2:22:10] that we get out of the grant, the state grant provides us additional operating [2:22:15] dollars that otherwise we uh would not have. And so if we can stimulate uh the [2:22:22] development of the outlet mall, we can further grow the the the sales tax [2:22:28] dollars that we're um enjoying right now. I think the deal is a little [2:22:41] too lucrative, but I I also don't think we're going to splitting hairs over a [2:22:46] couple hundred,000 if whatever the case may be. [2:22:51] Given the circumstances and the fact that we don't see any dirt moving over [2:22:55] there in the last year for reasons that we're all familiar with, I think this [2:22:58] might be a pretty good move. And the key thing for the public to know here is [2:23:02] that this performance is completely incumbent on the hotel provider has to [2:23:06] perform to even to generate these numbers and it's not to exceed. Um these [2:23:11] are very complicated agreements and most people typically don't understand the [2:23:15] inner nature workings of the tiff let alone something like this. Moving on to other business item number one, Mr. Shrout, city [2:24:00] manager report. >> Mayor and all members of council, the [2:24:05] uh month of October sales and use tax uh check, the sales tax collection check [2:24:11] was 1% more than the same month last year. Uh the use tax collection check [2:24:17] was 27% less than the same month last year. The total sales and use tax check [2:24:24] combined for the month was 5 a.5% less than last year, but overall through the [2:24:29] first four months of the fiscal year, sales and use tax collections are 20% [2:24:34] higher than the than last year during the same period. And for some context, [2:24:41] uh, every municipality in the Tulsa metropolitan area had a decrease in [2:24:46] combined sales and use tax year-over-year for the month of October. [2:24:50] Um and at our current 20% increase year to date, uh we remain far ahead of all [2:24:57] other municipalities in the metro fiscal year to date. So I think the the whole [2:25:03] metro saw a slowdown. Our sales tax was actually up 1%. But the use tax, meaning [2:25:09] what people are purchasing online, um that was down uh quite a lot at 27%. [2:25:15] And so I think um what we've seen both at the aquarium and with uh use tax [2:25:21] probably since the summer is is a slowdown in consumer spending uh in Jinx [2:25:27] and then there's been a slowdown in the Tulsa metro area uh going back at least [2:25:33] 6 months. So uh I think that we're doing well. Uh I think that most [2:25:38] municipalities are down and and we're we even had a 1% increase in sales tax. So, [2:25:44] um I think it's something that we'll watch, but so far we have a pretty good [2:25:48] start being 20% up for the first four months of the fiscal year. um at the [2:25:54] October 14th INCOG meeting, uh their um [2:26:01] transportation improvement plan for 2024 to 2027 was approved, which included um [2:26:07] the $ 1.7 million federal surface transportation block grant that we [2:26:12] received um for the utility relocation from 111th to Main Street on Lwood. Uh [2:26:19] and so again, I think you know it's uh we have we have obligated $420,000 to [2:26:26] that project and we received 1.7 million in federal funds. And so um we've talked [2:26:32] about that before, but I think it's another uh good time to bring up that [2:26:36] it's exciting. We get almost $2 million from the feds to do that utility [2:26:41] relocation on Elwood. Um, the Oklahoma Department of Transportation Main Street [2:26:47] Bridge prevent preventative maintenance project is now complete and we are uh [2:26:53] thankful that it was completed in a timely fashion and we uh thank everyone [2:26:58] for their patience uh since this started about 2 weeks after school began. Um, [2:27:04] but it is now complete. uh the Elm Street project. The contractor is [2:27:08] continuing to install the water lines across 116th Street and um all of the [2:27:14] soding at 121st and Elm is complete. Fire station number one is nearing [2:27:20] completion. Uh the contractor is working to install the remaining sod landscaping [2:27:25] and irrigation. The final painting of the interior of [2:27:29] the building is well underway and we anticipate that the fire station will be [2:27:34] operational in December or January of this year. We also have an apparatus [2:27:40] that the chief and um some members of his team are up in Wisconsin right now [2:27:46] inspecting and that will come down and uh be inspected then onsite here in [2:27:52] Jinx. And we expect that that will be put into service about the same time [2:27:57] that the fire station will have its grand opening. And we're going to have [2:28:01] some sort of push-in ceremony for the apparatus and uh ribbon cutting for the [2:28:06] fire station. Upcoming events, we have Veterans Day on [2:28:11] Tuesday, November 11th. City Hall will be closed. I believe there is a on [2:28:15] November 9th, mayor, a Veterans Day dinner, [2:28:20] » second annual. Um, city hall will be closed uh on [2:28:25] Thanksgiving for the Thanksgiving holiday, November 27th and 28th. And [2:28:29] then the Jinx public schools legislative lunchon is Friday, December 2nd from [2:28:35] 11:30 to 1 at the math and science building on the third floor.
