[0:01] Yeah. [0:25] It's just a sample just to see what was on the agenda. [0:30] I'm just doing a sample one tonight. [0:37] Coming in. Yeah. I'm going to open the [0:48] [Music] [0:52] flag of the United States of America and to the republic for which it stands. One [0:58] nation under God, indivisible, with liberty and justice for all. [1:10] Does anybody have anything they need to add to the agenda? [1:15] If not, I need a motion to make a motion to accept the agenda as read. Motion by [1:20] Sher Linda, second. Second by Cynthia. All in favor? [1:26] Um, I need a motion to approve the minutes of the regular meeting May 14th. [1:32] I make a motion that we approve the minutes as needed as printed on May [1:36] 14th. Motion by Sharon. Do I have a second? Second by Angela. All in favor? [1:42] I [Music] [1:46] chair. Citizens call. [1:51] Do I have any citizens call for business? [1:55] call for business or to where we can just speak up speak out. This is when [1:59] you do. All right. I got a few things I'd like to kind of bring up and ask [2:03] about. Uh I know Danny resigned from his spot. Kind of curious what was going on [2:09] with his. I know Kendrick put a letter of intent. I have a couple letters. [2:15] Did we ever publish that or open it up to the public or anything or We don't [2:22] need to do that. We just um if there's vacancy and you're interested, you just [2:27] send a letter of intent. Isn't Is there not a uh time frame that is supposed to [2:34] be filled or No, right. No time frame. Yeah. Fred, you might dumb. [2:41] So [2:45] it's a mayor mayoral appointment um subject to consent by the council [2:54] and the council once the appointment is offered or it's nomination I guess the [3:02] council can only reject that if they pass a resolution that finds that [3:07] someone simply does not meet the minimum imum requirements of the position. [3:13] Um, it's not unusual for one to stay open for a while. It really is. I've [3:18] been doing this a long time and it's uh it's not unusual especially given that [3:24] this happened what the end of the year I think. Yeah. Yeah. With uh the weather [3:29] and winter and everything else, but I noticed it's only attempted. So, but [3:34] there is no time frame involved. No. And I just had a couple letters of it in the [3:38] last few months. And as far as publishing it, I mean, it's been [3:41] announced. Yeah. And I do think there was something posted. [3:46] It would have either in the minutes or I I mean, I'm just that he resigned. Yeah. [3:52] Yeah. [3:55] So, who who appoints him? Is it the council or is it left up to the mayor? [4:01] It is one of the it is one of the powers of a mayor to [4:06] to appoint someone subject to the consent of the council. But that consent [4:13] can only be withheld if they pass a resolution that specifically finds that [4:18] in their opinion the person does not it I think the language is is not fit for [4:25] the office and that has been interpreted meaning [4:29] let's use city clerk as an example doesn't meet a residency requirement or [4:34] isn't bondable you know there's some basic fundamental [4:39] requirement of that position that they the council feels they don't fit or meet [4:45] um like if they weren't a citizen or didn't res [4:51] and I'm very familiar with that because that change in the law I live through um [4:57] we had a situation in Humble that was pretty ugly that basically kind of [5:01] resulted in that law change or we were part of other people that helped change [5:07] that law. So, is there there a way that we can [5:12] change [5:15] how it's uh or who makes the decision of who is [5:21] that's state law. That's state law. Absolutely. State statute. I'm just [5:24] going to throw my opinion out here and I know a lot of citizens here in Florida [5:28] feel the same way. Very important. Laart feel the same way. There's a just like [5:33] in the White House, there's a lot of buddy system and I'm going to take you [5:37] over you because you're my friend and blah blah blah. But that's just my [5:41] opinion and others around here and they really don't care for how the city's [5:45] being run in that sense. So the position is filled only for the remainder of that [5:51] unexpired term and then they must stand for election. It's not a full term. It's [5:56] just whatever is remaining of that term and that's when you have a chance to [6:00] change that. Is that the election? Yeah. Assume the terms just came up. [6:05] It's it's the way it is. I mean that's that's what the law says. What I'm all [6:10] I'm saying is my opinion is like some of the people in here is I'm going to use [6:15] Angela. We know it's a buddy system or we we believe it's a buddy system of how [6:21] you got in versus others that we feel are more confident or [6:28] Yes. I mean that's my opinion and others of [6:32] the city. So I'm just throwing that out on the ballot like everybody else does. [6:37] All right. I'm going to move on unless somebody else got something to say on [6:41] that. Nope. citizens that I spoke to in the town [6:49] feel that we need more training with the fire department [6:55] with the things that have been going on lately. [6:58] Uh people that were over at the other the fire recently, they said it was a [7:03] mess. I spoken to some other volunteers from other fire departments. [7:10] They said that they asked multiple times. Do you want to call in [7:17] backup? We'll bring out tankers. Makes told them no. We're waiting for the tank [7:22] for the tower to fill. We are trying to take care of the people [7:28] here. I understand we want to try to do it ourselves, but sometimes you got to [7:31] do what you got to do. So, I don't I don't know what we're [7:37] doing for training anymore. I used to be on it. I know what we used to do. Does [7:41] everybody have to be certified that's on the fire department on the volatic? No, [7:47] nobody has to be certified. You got to be okay by the chief. And does the chief [7:51] got to be certified? Does the chief need to be certified? He He Yes, he is. He [7:58] doesn't have to be. It's a volunteer system. To my understanding with other [8:02] volunteer fire departments, we have been invited. Not we. The fire department has [8:09] been invited multiple times for free training and no one from the heart [8:16] showed up. To me, that's unjustifiable. Even if [8:20] just one person went, they could bring it back and share that with the rest of [8:25] the department. So I guess my next question is are what [8:31] are we doing to for our training just blowing out [8:37] whistles or what are we doing for training? Not doing that [8:43] and nobody can do it because they got this. [8:48] Another problem is half of our fire hydrants are buried in the ground. And [8:53] if there's a fire, they have to go and uny them like they did with Mr. Adair's [8:59] fire. They had to dig that fire hydrant out in order to access it. That [9:04] shouldn't be right. Somebody needs to be doing maintenance, doing maintenance on [9:10] them. I don't think they dig that one out. No. [9:13] No, they didn't dig that out. No. But no way. [9:18] Okay. Then where did all the dirt come from that was piled up around the fire [9:22] hydrant? That was when they dug the hole for the telephone pole. [9:27] Okay. Well, that's my my misunderstanding then. I was told they [9:30] had to say we don't have any in ground. Uh there's several that look really [9:37] questionable whether you can access them or not. And couple of them are here on [9:43] Main Street. One of them's down by Vicky's house. [9:48] You just might have them drive around and look at them. Well, you have to go [9:52] through and flush them. So, that's I haven't seen the fire hydrant flushed in [9:57] the 10 years I've been. They were just flushed in April. Yep. So, [10:04] every one of them? Yep. [10:10] Cuz we have to flush them. The one on my corner never flush. They [10:15] flush my backside that question. Mm. Um, cuz you weren't home. I think when the [10:21] fire department comes up, I've watched them fight four fires in this town. [10:27] They drive up on scene. They don't do a perimeter check. They don't look. [10:35] The fire down there's house. Fire was shooting out of the back of the house. [10:39] They didn't even know it until somebody came up to them and said, "The fire's in [10:46] the back of the house and they're sitting there with a water hose spraying [10:49] water on the front of the house and [10:54] it's doing absolutely no good." And then they pow-wowed in the driveway for 10 [10:59] minutes and then went running in the back. Now, what kind of good does that [11:03] do? I wasn't there, so I can't. And then and [11:08] then they drain our water tower. No, they didn't drain it. We did not lose [11:13] pressure on our tower at all. Cuz if we had them, you'd had a boil order. You [11:18] cannot lose pressure on the tower. How many hours did we go on this fire? Oh [11:24] god. We didn't run out of water. No. And I even called Larry Tony, who is our [11:30] supplier, and we had no pressure drop whatsoever in our tower. [11:36] How many hours do we go on this fire? I have no clue. [11:41] Too long. I know. But it was it was too long from [11:47] the time till about 6:00 the next morning and then they got called out [11:51] three other times from Yeah. Well, the house was full of clothes. That was one [11:56] problem. So, it's just like a hay bell smoking. [12:00] So, yes, water was put everywhere. There's a lake around there. So, they [12:02] wouldn't lack water. And it was full of stuff, you know, [12:09] not put anybody down, but it was full of stuff. Took lots of water and ours is [12:15] smolders and smolders. Didn't they have two uh layers of [12:19] shingle on there and then metal on top of it? Hard to get the water through the [12:22] metal. Yeah. [12:28] How you put through a tin roof? I wasn't there, so I [12:32] can't tell. I seen a video of it. I wasn't there either. If we had had any [12:36] wind any win at all. Yeah. You lost when we' have lost the whole South. [12:42] Harrison. No, you would have. Oh, yeah. We would have had it here. You wasn't [12:46] there. You don't know the situation. How long do we wait before we call in mutual [12:50] aid? How long do we let a house burn before we call in mutual aid? [12:56] We called in when we needed, but we didn't need it. We was getting the water [12:59] was needed. It was just full of stuff. Like I said, we had a bunch of [13:02] bystanders which next time we'll be escorted off. They're in the way and [13:07] we'll run our mouth. They don't know the facts and I don't have to disclose that [13:11] with you. That's between me and the land owner. So, I really can't be telling you [13:15] much. Well, I'm I talked to some of the other [13:19] volunteers. Well, that's them. This is us. We got our procedure. It sounds like [13:23] they've had a whole lot more training than what this town has. So, they [13:27] probably know a little bit more than what we do cuz we don't do our damn [13:29] training. Okay, we're done. We're done. This is old fight when you're done. This [13:33] is not a personal. This is not a personal The whole town is [13:38] trying. But it's not the point of this particular item on the agenda. You've [13:42] made your point. This is not a time to be discussing or arguing about it. When [13:46] is the time? Well, this is the time you guys give us this. If you want to do it, [13:52] then you need to you need to ask for a point on the agenda where there is an an [13:58] actual issue for the council to decide. We're looking out for the city. You [14:03] you've made your point. I'm assuming it's been received that you would like [14:09] to have more training for the fire department looked into. That's been [14:13] That's what I got. That's been brought up for years now. What has it gotten [14:17] done? We got two burnt houses down. Multiple people knowing that we are not [14:25] capable of taking care of things and you're telling me that we've come up [14:30] here as citizens and speak to the council which is supposed to be working [14:34] for the citiz [14:38] what what we want to know what we're going to do. you I think I mean you guys [14:44] have received his comments. I assume you'll look into it. Yes. I [14:50] think you're wrong about training. I've been Humbled City attorney for almost 40 [14:54] years and I would say it's a really good department, but I don't think they do a [14:58] lot of training like like you're talking about. In fact, I almost know that. [15:02] Well, I've been on the fire department. I know what we did on training. Then [15:07] I've talked to people that were on fire. I'm not going to argue about that. [15:10] council was going to argue about Sean Reynolds come over here and look at our [15:14] fire department. See what he thinks about it. I that is Mark's decision. He [15:21] is our fire and you're our mayor. Craig, most council meetings, the public [15:26] discussion, citizens discussion, they usually get five minutes at a time. And [15:31] she's being nice enough to allow you. He can have my five minutes. [15:37] is all these citizens are trying to say something to you guys and you're pretty [15:41] much saying sit down and shut up. No, if you have an issue, put it in writing. [15:46] Submit it. No, submit it in writing because that's how you get stuff [15:51] discussed. This is just going around like this and making arguments and never [15:55] arguing about training. We're not arguing about nothing. Yes, you are. [15:58] You're arguing with Mark. You're arguing with me about how much I'm talking to [16:01] you. I know. So if you put your concerns on in writing, this is how you handle [16:06] something like this. Write down these are our concerns. One, training. Two, [16:12] are the hydrants being flushed? Yes, they are. Three, did we run out of water [16:17] and lose pressure? No. But if you if you consolidate it and and summarize it, [16:23] then you can address things in an orderly fashion where things are [16:28] addressed and can be answered. But to have a free-for-all discussion that [16:33] flows back and forth and becomes circular with no end. [16:37] Like I said, to what point does this discussion need to continue? You've made [16:40] your point. I assume the council will follow up. Hopefully next month you'll [16:45] have a report back. Good. And that's the way the procession work, but it ends. It [16:51] doesn't need to take 15 minutes to have this discussion going round and round. [16:56] Well, it's it's a major concern with the city with as citizens. Point made. Okay. [17:03] But this is not how you handle stuff in a in a council meeting is what I'm [17:07] saying. You're not here every time. I'm here almost every time. No, [17:13] I've never seen you have that. I have been here almost every time. I have been [17:18] here almost every time. Can I ask? And it's not even my job [17:23] description to be here every time. Oh, you got a job description? I do, as does [17:28] everybody in the in the city. You're an attorney? Yeah. Good. [17:33] Can I ask one more thing? One more. I know at when I was on the fire [17:38] department, I got kicked off at one point there. [17:42] There was a firefighter that got sent to the hospital. That's supposed to be [17:46] county. [17:49] Are we back on the city with them? I don't know what you're talking about, [17:56] Mark Wagner Jr. back when you guys kicked me off of it. We didn't kick you [18:02] off. That's not the council's job. That is Mark Bark's department. [18:08] Okay. Was the Let's forget all that. Is he city and county? Cuz last I knew he [18:13] was just county. Uh county. Just county. Mutual aid was with the [18:20] ladder truck. So that's rule rig. [18:25] Okay. Now we're done. Any other citizens call for business? Jerry, [18:36] I just want to know what I can do to take care of that piece of property. [18:41] Can I stay in a camper as sleeping quarters only [18:47] and park it on my property? For how long? To clean up that mess. [18:55] Cuz normally we give a time limit. Yes. So understood. I mean when when they [19:00] have granted the variance, they give a time limit on it. So how long do you [19:05] need? [19:08] Well, no. What? What's really reasonable? I got people that will help [19:12] me. It'll probably be at least a couple months, won't it, Jerry? [19:18] I'm sure if I do it myself. Yeah. If I was a if my insurance comes through and [19:24] I can hire, say Ray Maloney to do it, he can do it in a day. Well, I know when [19:28] our house burnt, our big twotory house burnt, I had three months to get it tore [19:34] down. 90 days. Okay. Should we go from there? It was a [19:38] big twotory house. Come back and get an extension. Come back if needed. Yes. [19:43] Yeah. And Fred will write up some for us and we'll have you sign it. Okay. But [19:48] I'll need a motion by the council for this. I'll make a [19:54] motion that we give Jerry 90 days to live on the property and then to come [20:00] back if he not completed by then. Yeah, that's a hardship. Okay. Water. I have a [20:07] motion. How How are utilities going to be hooked up and are you on? All it's [20:12] going to have is electricity in it. Okay. The house across the street also [20:16] belongs to me, my mother and father-in-law, but he passed away. But [20:21] it's a small house and it it's just easier if I sleep somewhere else. Yeah, [20:27] I could rent a house downtown somewhere, but the travel time I could use to do [20:32] the cleanup if I'm right next door. So basically you just need like an [20:36] electrical plug in and your gray water and black water you'll just move it out. [20:41] I go in and shower and we eat there with her. Oh, so you won't even have that. [20:48] So this is a lot simpler than the other [20:51] ones that we're hooking in. Yeah. Okay. Yeah. No problem. Okay. So I have a [20:56] motion by Ron. Do I have a second? Second by Cherylyn. Any more discussion? [21:01] All in favor? Okay. and Fredo gets them wrote up and [21:06] Michelle will get a hold of you and we'll get you in here and signed and but [21:10] you can go ahead and bring in. Okay. Okay. Thank you. Mhm. Any other citizens [21:15] call? Yes. I have issue with the dogs running in the park. Okay. And the same [21:19] old people, same old dogs and the city don't want to do anything [21:23] about it. And I called Penny. I've sent pictures. [21:27] I've called Michelle and you've called me and you and I tried to get a hold of [21:32] Anua but she won't answer and I've talked to Sheridan over the years. Same [21:37] old people, same old dogs. Those pictures in that video has been [21:41] sent to animal control, but it don't do any good. You know that. Well, I don't [21:46] know yet. I mean, you can imagine I'm like [21:49] invisible. And they run over there and torment my dogs, which has never been [21:53] loose, never even on leash, always in a pin or in the backyard. And they come [21:59] over and then my dogs are buddy head to toe because they're agitating my dogs. [22:03] Okay? And they do it on the weekends when they know they can get by with it. [22:06] And I holler and scream and they still don't want to know. And Gary Bradley, [22:11] everybody knows Gary Bradley. Okay. I've had Wagner's dogs down at my [22:16] house repeatedly over the years, which they've never even had a dog ticket. And [22:21] I don't know how many times I've picked up diesel. [22:25] But why do certain people get tickets and certain people don't? Um, and [22:30] there's other type of opinion about and she nobody can [22:34] answer me. [22:38] I mean, no, but I will start shooting them or start [22:43] poisoning them. I'm not I'm not kidding. When I have to pick up somebody else's [22:48] dog in my yard, it's already happen. And I pick up my dog [22:53] here. Thank you. Thank you. Any other citizens call? I got problem. Yes, [22:59] Carrie. Um, with this new firework law where fireworks can be sold year round, [23:08] there is some people that is shooting fireworks off at night in my end of the [23:14] neighborhood. Is that legal to be doing in within city [23:19] limits? No. Fire department. [23:25] I don't I I don't think that the county has any restriction on shooting [23:31] fireworks any time of the year. I I think that's right. Right. But but the [23:35] ordinance here is Yes. It's only through those dates that we approve [23:42] before. Right. So we got certain people that will blow them off two weeks before [23:47] the court and get by with it because they do it long enough for the law not [23:50] to get out here. And even if the law came out here, they say, "Oh, no, no, [23:53] put that up. the same people that does it [24:00] and again we can't do nothing about it. So it is against the law to be shooting [24:03] them off right now. It's against a city ordinance. Yes. Within the city limits. [24:07] Yes. Thank you. Till what? 27th 27th to the 5th. I think that's what it was. I [24:14] think that's what we did. And the county won't take care of that. Yeah. Huh. [24:18] They'll just have them put them out. Yeah. See the county won't handle it. [24:21] They're going to have to have a city. We don't have a city call. All right. So [24:26] then it's just the way we do it. It's a free-for-all. Free. We are. You can call [24:31] the sheriff. Sheriff tell them. Yeah. No, they won't. They'll tell them to put [24:34] it out. They won't enforce our ordinances. [24:38] I tell you, they will tell them not to do it. That's it. But that's all they [24:43] can do. And I've been in the middle of that one before. some more. Yeah. [24:49] Well, a lot of times just sheriff showing up will be enough to scare them [24:53] to shut them down. Yeah. I I tried shutting down a party one night at him [24:56] house and it made it worse after sheriff lock left. They got worse. It was a [25:01] rental house. Yeah. It was our rental house and they went over and asked who [25:05] who called the sheriff. The sheriff that the new deputy told him and then they [25:10] turned up the music even louder in the city. Huh? In the city limits. [25:16] Yeah. Do we have a noise? Uh, can't do anything about that. Got to [25:22] have a Yeah, we can do anything about [25:27] All right. Any other citizens call? [25:32] I have one more question. I don't mean to be keep bugging you. Um, I want to [25:37] know one thing. Who else knows Michelle's job? like 100% if something [25:45] were to happen to her and I hate to put it in that terms but I've had two [25:52] aneurysms one that burst and I had a stroke so anything can happen to anybody [25:57] at any time and I need to know who knows Michelle's [26:02] job 100% we have an assistant city clerk who Penny knows Drisco Driscoll yeah Oh, [26:12] she has she's been our assistant for quite a while. Yeah. You call up here [26:16] and she's like, "I don't know. You'll have to wait till Michelle gets back." I [26:19] can't look that up. You got to wait till Michelle gets back. I can't do that. You [26:23] have to wait till Michelle gets back. [26:27] Every time Every time I call or I call for Tim or I come up, [26:35] what question are you asking? I mean, that's what we need to know. Um, [26:40] somebody with a little bit more training to back Michelle up to help the citizens [26:46] when we called in her can I say something? Yeah, gets to work [26:51] 30 hours a month. Okay. And that's not very much time a week in the office. I'd [26:56] love to have her 40 hours. The city can't afford that. So Teresa is always [27:00] working on pins and needles, afraid of making a mistake. And I have told her [27:04] numerous times all mistakes can be fixed. But that is just who she is. [27:09] She's nervous. That's who she is. She's a very, very sweet lady. She is will [27:14] visit with anybody, but her knowledge of wanting to come out and answer questions [27:18] she is very uncomfortable with because she's afraid of saying the wrong thing. [27:22] How long she been doing the job? Teresa's [27:25] she's probably know she's probably been with us for 10 years because she was [27:28] city treasure. She was treasure. Yeah. She's just she's not in here enough. [27:33] She's in here two days a week, you know, four hours. And I mean, that's just not [27:38] enough. And she drives from where? Out here somewhere. And she's also a [27:43] Bronson. But when I go away on vacation, I mean, [27:47] she's got it covered and I come back to a clean desk. The other ones before her, [27:51] I mean, I wasted my time while going on vacation. And she's helped me a lot on [27:55] the computer when I come in. Yeah. She is just She's not speedy with it. I [27:59] mean, she doesn't have as much time and years that I have in it, right? And [28:04] she's she's just real doubtful and I'm trying to build her confidence up. Okay. [28:10] So, it's not that she probably doesn't know, just that she's she doesn't know [28:14] how to answer. Yeah. Yeah. Okay. Yeah. I have Well, I think I know one of the [28:19] questions was Tim was having problems with his meter and I asked her um if she [28:27] knew when they were going to come down and put in the new meter. [28:33] I wouldn't know that. I would work I think even if a work order had been put [28:39] in. Yeah. I wouldn't know that until I reached out to somebody on maintenance [28:43] to ask them, hey, you know, when are you guys going to do this work order? I [28:47] wouldn't know that. I make the work order. We both make the work orders. We [28:50] hang it up. If they've got something else that takes priority over those work [28:53] orders, they've got to do that first and then they'll come. So, I I never know [28:57] when a work order is going to be completed or if if it got completed, you [29:01] know, I don't look through them each day. Yeah. Okay. I have work orders. The [29:07] other concern I have is about wagon boys riding all over town, hot riding their [29:10] trucks. Does anybody else have that problem? They're doing what? Hot riding [29:14] their trucks all over town. Don't tell me. Well, maybe I haven't had [29:19] any Michelle, you know that they've been turned in for 10 years since she's 15 [29:23] now they're driving, right, Michelle? Yeah. There's nothing there's nothing we [29:27] can do about it cuz we don't have a cop. Exactly. And if you see [29:32] on [29:36] But again, I'm going to take care of that problem on my own, too. No. Just [29:41] have video. They can't prove it. Just we're going to move. Okay. I'm sure the [29:45] attorney's sitting here eating it all. The other thing is about water bills. [29:49] How much more you going to keep raising their sewers and waters? I mean, we [29:53] can't take much more than property taxes. To be totally honest with you, [29:58] the city I mean, we've got a $ 1.5 million sewer project. Yeah. That should [30:02] have been fixed a long time ago with we put money in towards something like [30:06] before he came in office. That's for the for something and then it all [30:10] disappeared. I don't have a number. No, that is for that money was set aside for [30:14] the lagoons because it is very they have no we have a separate account. No, you [30:20] told us you didn't know where it went either. Michelle said money gets moved [30:23] around. How many citizens do we have in in our heart? 490. [30:28] No. Yes, we do. 293. We're down something like that. Everybody's moving [30:34] out. Okay. The sewer. Okay. This is how this is [30:38] going to work. Okay. We are trying to upgrade our lip stations and we've had [30:42] numerous meetings, public meetings on our sewer lift stations. We tried to do [30:47] the whole entire town. I cannot remember the dollar amount. The sewer stations is [30:50] 1.5 million. Kansas Water Office gave us a grant for 750,000. [30:56] We got approved for a loan through KDHE. However, before we can touch that loan [31:03] to pay for them, KDHE is saying your sewer rates need to be at this amount or [31:09] you cannot have that money. Yeah. You guys keep moving around accounts like [31:13] this many. All we do is monthly transfers. We move [31:17] the sewer reserve fund over to a separate bank. And that's something this [31:21] mayor started. They never did that in the past and it was all the money was in [31:24] one working fund and they just spent it wherever they wanted to. We've got [31:28] several separate accounts that can't be touched unless it's just for sewer or [31:33] for electric or for water. We've got separate accounts for all that stuff. [31:37] It's going to take us forever to get that done. No. No. Hopefully not. We [31:42] will. The loan with that we have, we will start once we activate that loan, [31:47] we will start making payments on it. And it's a 20-year loan. I We all live here. [31:52] I don't want to pay that. I don't want to pay what we're paying now. But in [31:57] order to fix our issues, we've had an employee that put in Daniel 70 hours [32:02] last week babysitting two lift stations. We can't do that. I know it needs it [32:07] needs fix. Yeah. Yeah. We We can't be without it. We We've got to get the [32:11] money somewhere. Yeah. And if the sewer lift stations don't get fixed and we got [32:15] sewer spilling all over the ground, then we got fines from the state of Kansas. [32:19] Is it the or is it the little bit of everything? [32:24] They're They're 25 years old. But if we did the whole system, it would be over [32:30] $7 million. How can we get grants? We did. We're trying. She gives grants to [32:34] everybody else and donate it. Well, because a lot of those got stopped. [32:38] Yeah. Did you not buy Kelly's pocket? No, that's not a lot of those grants [32:46] dollars. I'll tell you something. Last last year, we tried to get a CBDG grant. [32:54] to help with this. Y they decided they were going after walking trails and they [32:59] decided that's a government that has nothing to [33:03] do with us. And I sat in on numerous meetings with these people trying to get [33:09] something this year. We got some [33:14] a lot of money. It is a lot of money taxes would property tax 12 or 13%. My [33:20] owners at 3 or 4%. No. [33:27] Okay, I think we're done. We're going to move on. [33:33] Um, unfinished business, the speed bumps. [33:39] Um, you guys have got that information. Yeah. And also, can I share Larry called [33:46] and said, and I know I think Fred said he was probably against this, but Larry [33:51] said um he used to work on construction before and he knows how to build the [33:57] mold or the framing for speed bumps cuz they had to make [34:01] speed bumps for construction work out on the highways. I said, "Yeah, but I think [34:05] it's got to have the yellow markers on and he said, "Well, we could probably do [34:08] that with fluorescent paint, but he would fill the structures and fill it in [34:12] with um cold patch or whatever material they use to make those speed bumps, [34:17] too." So, and I don't know anything about a cost on that. [34:22] Larry just is offering to Does that patch break down after? Yeah. [34:28] I'm just Yeah, I don't have to get the signs. Yeah. Yes, we still need signs. [34:34] I'm just throwing that out there because Larry offered I let him try before we [34:39] purchase these. But we're still going to have to [34:42] purchase the signs when he does it. So we can put them up at the park. Yeah. [34:50] Fred says it's okay. There's nothing. When I was talking to Michelle, my my [34:55] concern was if you didn't know what you're doing, you don't want to just [34:59] throw a bump out there and then have cars get damaged. And you I think I some [35:04] because I did a fair amount of research on it. It can't be any more than 6 in in [35:10] height at any point or something around that [35:17] versus the hump issue kind of thing. So if he's had experience and and he's been [35:25] knows what he's doing. Okay. Anyway, I told him I mention it to [35:29] you guys so we can either I can't see this. [35:34] Even if we try one, we're still going to have to have sign. Yeah. So, we can go [35:38] ahead and purchase the signs and then for that [35:43] sign because you you just you can't have somebody hitting one at full speed not [35:47] knowing it's there. That's going to damage something. And we'll need signs [35:51] going both ways, too. So, there's I have six. I see six. [35:56] Yeah. Yeah. Has the city got enough money if a drunk has arrested two packs? [36:04] As long as I got signs up. Oh, we only need three. I looked at that [36:10] again. Yeah, we only need three. That's an [36:14] insurance. Yeah, it looks like they're three. [36:17] Whatever. I read that question. Can a citizen of the city put speed, [36:25] but do we want to wait until we talk about the law enforcement? I mean, are [36:29] we going to need the speed bumps? It's up to you. That's up to you guys. The [36:34] speed bump is is is kind of a self enforcement. Yes. I mean, it's not going [36:39] to hinder anything. I don't I want to go speed. [36:45] I know. So, do we want to do we want to set a dollar amount for Larry to try [36:50] this or just try one and see what it does? Well, we got cold patch down [36:53] there, don't we? Uh-huh. Yeah, we'll just see what it does. I want to see. [36:56] Okay. But we got to have the signs first. Yeah, sir. [37:02] Make a motion we have a motion by Ron. Do I have a second? I'll second it. [37:07] Second by Charlotte. Any more discussion? All in favor? Yes. [37:12] And then we get the signs. Well, then we can have try. [37:19] All right. Um, thank you. Next order of business. I do have [37:24] another letter of intent for the council is from Cindy Mley. [37:30] She is back here. There she is. Um, I know they are new to the town. They [37:38] came from Moran. Iola. Sorry about that. Um, [37:46] so that is our second letter of intent. So now that I have a couple, I'll [37:50] probably be making the decision probably by the next meeting. [37:56] Yes. You said last meeting that you would have a decision made today. I [38:03] know. And but I got this new letter, so I'm going to send it back in to send let [38:10] the council get to know her any questions they might have. Well, you [38:15] tell me we can't interview them. Well, you can talk to them. Well, that's the [38:19] same as interviewing a formal like to come in at a council [38:24] meeting and be but you you're free to call somebody up [38:30] and talk to whatever ask them questions. I mean, you can talk to them all you [38:36] want. Okay. So, I know they're new to town, so and I'm sure she's willing to [38:42] talk to anybody that wants to talk to her. Okay. [38:47] inner letter of intent. Yes. What do you have in it? Are we going to see it? [38:52] Well, I just have one. I didn't make copies. It just says I would like to put [38:57] in for the open seat for the city council [39:00] and our phone number. Okay. Okay. [39:06] All right. Um CDBG engineering requirement. [39:12] That's you. Well, [39:17] I met a couple weeks ago with Nate, Carolyn, and Michelle to talk about um [39:23] CDBG grants that would basically pull up the tile floors. There are some girl [39:30] that are loose, kind of a safety hazard, and replace that with like CET flooring. [39:36] We also talked about adding in um automatic door openers for the cap [39:41] accessibility for the entrance and the entrance to the gymnasium. [39:46] Um and we we kind of talked about some of the requirements because CDBG has a [39:51] lot of different kinds of requirements to it. Um you guys went through that [39:55] process several years ago. Um that was before my time. Oh, and I guess I should [40:00] introduce myself by the way. Sorry. I'm Vicki with Thrive County. Um, I'm a [40:05] grant writer and I also brought Jessica Thompson who's our deputy director [40:09] because she answered any questions I don't know. So, so sorry about that. Um, [40:15] anyway, we kind of talked about it and uh since we met, a couple things came up [40:22] that that uh they thought that I should probably talk to you guys as a group [40:26] about. Um, the main thing there's a couple things that need to happen before [40:31] we can submit an application. One is you need to fill out a preliminary [40:36] application online. And I think I I said um you know, it's pretty simple. It asks [40:42] a few questions about what are you doing, why are you doing it, you know, [40:45] pretty simple answers, but if you need help with that, we're more than help [40:50] happy to kind of walk you through that process and and and kind of answer some [40:53] of those questions for you. Um the other thing that you will need is a public [40:59] hearing. Um, and we were going to do that tonight, but then we found out [41:04] something else that kind of delayed it. So, uh, that's again a pretty simple [41:08] process. It's just a matter of, um, you know, just just kind of letting the city [41:13] know, the residents know what you're doing and why, and they can discuss it, [41:17] um, at that time. Does it require publication though? Yes. Okay. Yes. [41:22] Yeah. Um, so the big thing, the reason why I'm [41:26] kind of here is um, you guys had quotes for this work and um, and I even [41:33] calculated it uh, total. Oh, there's also a 10% match from the city and you [41:39] also will need to kind of hire a grant administrator. Thrive doesn't do that, [41:42] but again, we can help you with that process to do that. And they'll charge [41:46] generally charge a fee of about 10% to 10 to 12 and a half%. And um, that'll [41:52] have to be bid. So hopefully it'll be 10% because they'll be competitive, [41:56] right? So um but the estimates that you had for that came up to be about [42:03] $65,000. So it's not going to be a huge project [42:08] hopefully. And this is for a smaller project. That's what this this CDEG is [42:13] designed for. The problem is that um unfortunately we can't use the bids that [42:18] you got. So, they require a preliminary engineering or architectural report um [42:25] by a licensed professional engineer or architect before the application be [42:29] submitted. And that's how you'll get kind of the cost estimate as they'll [42:33] look at it all and kind of tell you here's kind of what we think it'll cost. [42:37] And then if you're move forward with the process, if you get the award, then put [42:42] it out for bid. The problem is if you use the bids you got as that that [42:48] estimate, those people those companies can't do the work. There's a a [42:54] restriction that they have on that. Um and [42:59] and then that cost I did message um the guy with the department of commerce and [43:05] that cost can be included as your matching funds or part of the grant [43:10] application in the end. Um, another thing that you will need to pay for is [43:17] an environmental review, but that can be done after the grant award. Um, you just [43:22] have to fill out a form that says, "Hey, you will do this if awarded the funds." [43:26] So, and that, you know, that is something the city does have to pay for [43:31] with local funds, but the other one can be part of the grant. Um so I think [43:37] those are pretty much that pretty much catches us up in uh information as to [43:42] where we are. So pretty much um to move forward we'll need the uh preliminary [43:49] engineering and architectural report that will give us a cost estimate that [43:53] we can use for the public hearing. And hopefully if we can get that all done um [43:59] the sooner the better. So hopefully we could have maybe the public hearing in [44:03] July. And is that in that engineering or architecture? It's either or. It's just [44:11] basically a cost estimate. Yeah, they're basically it says that they will um [44:18] uh analyze the need, determine the most appropriate solution alternatives and [44:22] provide. There's no engineering study or anything. Okay. Okay. So maybe an [44:26] estimator. Yeah. Yeah. It shouldn't be too big of a deal hopefully. But So, um, [44:33] do you guys have anybody anybody you use? I mean, I'm assuming BG Consultants [44:39] can do that work. Yeah, BG Consultants or or um some other architecture firm [44:46] can can do that. [44:50] I I I mean when I talked to Michelle about this BG who came to mind, but I'm [44:55] sitting here thinking sometimes Rick Zingray who's an architect in Fort [45:01] Scott who does a lot of city work around here. Okay. What's that name again? Z I [45:07] N G R E. I think Rick Zingray. I I think he's still working. He's not [45:12] battling. Uh I mean we're all getting old [45:18] been a while since I've seen but anyway he he's pretty reasonable and if all [45:22] you're needing is an estimator he he might be more reasonable than BG at [45:26] their rates but it's worth a phone call you need he's in the book in in Yates in [45:31] Fort Scott. Okay. He's done a lot of work for the Iola housing authority when [45:38] they were redoing a lot of stuff. He's done work for Humble. He's done work [45:43] for just he's done a lot of work over here [45:47] and he kind of caters to smaller communities like this. So [45:53] and he's an AIA certified architect. So he would fit the bill. Okay. Got it. [46:02] Is there a timeline on this? There's the deadline is November, but I believe it's [46:07] like sort of it's first come first serve. So once the funds are out there [46:13] Yeah. So we were trying to get in on the head end of it [46:19] and say we would um get this does that disqualify us from future CBD jeep to [46:28] whatever it is CDBG grants for a period of time. Uh so you can't have more than [46:35] one going on at a time. So, if it takes you a year to do this, then you can [46:41] apply for another one next year. But if it takes you two years to do it, then [46:46] you can't apply for one until you're done with the project. [46:58] Anything [47:06] else? No. Anybody else have any more questions on it? [47:12] Give them a call. All right. We will get into it. Okay. All I can do you ready [47:17] for the next step? Okay. Sure. Will. Is that a 10day notice on the publication [47:21] do you think? I can't remember. I think so. Here. [47:27] All right. Um the sewer charge days before the hearing. Okay. Sorry. Sewer [47:33] charge variance. Um we have sorry GIS I skip [47:42] GIS system code. [47:52] Is this the one that they said if we want to go with it, we can get the they [47:55] can help us with the grant to get it? But then they also say they wanted us to [48:01] recruit people or I don't have the email with me. Um it [48:07] would be more successful if several communities went together. You're right. [48:12] Yes. Well, the only thing I can see that they're going to do is it's simple. Take [48:18] your cell phone over there, take a picture of that map, send it to your [48:22] email, pull it up on your computer, and there it is. Why spend $13,000 for [48:28] something you can do right now in a minute, less than a minute? Those guys [48:33] can pull these up on their phones. Save us $13,000. [48:43] I mean, that's common sense to me. That's my opinion. Well, I'm not for [48:48] doing it anyway. We can't I mean that $13,000 we could spend somewhere else. [48:54] I mean, Penny's put a lot together. She knows where a lot of these are. She's [48:57] designed her own map. Yeah. The map that we had wasn't up to date. The lines [49:03] aren't where they say they are. It would be more convenient, but I think we're [49:07] beyond that point right now. We're not big enough to do it. We're not big [49:10] enough. Financially, I don't think we could afford to do it. It's a wonderful [49:14] program, but it's not I just don't think it stable. We can always go back to it [49:18] later. Like we can always go back. We don't have to do it right now. We can go [49:22] two years from now. [49:29] I think we ought to just put this on hold. Okay. [49:34] That's what we'll do. Is that what everybody else wants to do? That's what [49:38] it'll be. Okay. Right. Now we're moving on to the sewer [49:44] versions. Um can I copy? [49:50] Okay. Um [49:56] I wrote a letter. Yeah. She's asking for variance for a property that um [50:05] she just wants water on, not sewer. and she wants to not pay the sewer [50:14] charges for the water because it doesn't have any dwellings on [50:20] it or anything and she's going to use it for a garden. [50:28] Is there a meter there now? Water there now. There is meter and water. [50:33] She's one that turned on symbol water test for water. [50:38] Well, the only thing with this is if we do it for one, we got to do it for [50:41] everybody. Yeah. And how many other properties in town have water? [50:48] Well, with four shut them off with the I don't know anything about this. Yeah. [50:55] But I'm saying we kind of went through this with TLC as I recall too. Yes, we [51:00] did. But this is a a vacant lot with no structure on it that has no sewer [51:06] attachment or anything. It's it's just a hydrant versus a house that has an [51:12] outside hydrant that is for a garden. Correct. Okay. Yeah. I think there's a [51:16] distinction between that situation and this one. Three other people though that [51:19] just had garden spots with a spet and it on a lot with the house. Nate. Okay. And [51:27] if a house would ever go in there then obviously There's a meter on there. [51:30] They'll still have to pay a meter charge and they still have to pay for water, [51:33] but they won't have a sewer charge because it's not going down the sewer. [51:37] Yeah. There's no sewer service. So, yeah. Okay. [51:46] You could almost create a separate water charge point in your ordinance for [51:52] something like that and define exactly what what would qualify. [51:58] vacant lot, no other structures. [52:07] So, do I need a motion on this? [52:11] I think we should um notify the people who have the same situation and offer [52:18] them the same conditions because that was the reason they they turned it off [52:24] and I don't think that would be fair. Well, the ones that turned it off, they [52:28] didn't want to pay the interchange. No, they didn't want to pay because they [52:34] but they didn't want to either. They could keep it. We told them they No, we [52:38] told them mine's right there behind me, but she didn't want to pay for the [52:40] meter. No, they didn't want to pay the sewer charge. Yeah, they didn't pay that [52:44] either. They came in and asked and and you guys wouldn't bend on that. You [52:48] said, "No, if you got water, you got to pay sewer." [52:52] So, they shut them off. Cuz I fill in the pool. Then I'd say let's not do it. [52:57] Just leave it the way it is, I guess. [53:02] So then you're saying that I got a water meter across my street, my my house. I [53:08] if I turn that on, I have to pay sewer charge for water that's not even going [53:12] down the sewer. That's what they evidently told the other people. I mean, [53:17] that's stupid. I know. I agree. I mean, why would I want to pay $40 some [53:23] dollars just to my water my garden [53:28] out of my meter? To me, if the lot's vacant and the meter's already on there [53:32] and it's val or go back and put an ordinance in there [53:38] and make an ordinance and if you have a vacant lot, this is what we charge you. [53:42] And if you don't have vacant lot, this is what we charge you. We can go with [53:46] that route, too. We can do an ordinance for the vacant launch with the meters on [53:50] it just for the garden or we can do none or we can do it the way we're doing it [53:55] now. There's another option. You got options to these ideas. Well, that's why [54:00] most of them are shut off, right? Cuz they don't want to pay the sewer. But if [54:03] you come up with say like an ordinance like Fred suggested like or we could do [54:08] say, "Hey, this is what we're charging you for the baking with the on [54:16] So keep in mind the more restrictions we have. [54:20] This is a we're we're coming up with the solution. Well, see a lot of them the [54:25] problem was the mine was on their house too and they didn't want to put in a [54:30] separate meter. They all had they all had separate [54:34] meters. They all had with a separate meter and when they didn't do this they [54:38] would have to pay for two meter charge meter. But they had to [54:43] regardless of whether they wanted to or not. To follow up with what Angela was [54:47] saying is if you created a a new category of water consumer [54:54] that is only available for a vacant pot with a outside hy with a hydrant and a [55:01] separate meter where they would pay the applicable water rate and the meter [55:06] charge. It's a new user. It's a new consumer and [55:10] it's more volume that you're selling, [55:17] right? And and you wouldn't have to have people come all the time for asking for [55:22] and then if you want to see the property, then you know, you're more [55:25] than welcome to be like, "Okay, that one has, you know, go by." And then you [55:31] probably need to address too that it was a vacant lot, but they decide they want [55:34] water on it. Who's going to pay for putting that in? [55:38] You're going to have to have to outline all [55:41] that. They're going to have to have a meter and we'll and you need to tell [55:44] them how many foot they can have the meter from the street. Otherwise, you're [55:47] going to have people coming in here wanting [55:50] two acres. Is isn't that basically a new tap? Yeah. [55:58] I know. But we have to that that's the option. So need to know they need to [56:02] know what the full options are before well we have to get the ordinance like [56:06] if we want to go with the or like get in the ordinance we have to build the [56:09] ordinance. Yeah. So you want to see what Frank can come up with as far as you can [56:15] go ahead and approve if you want to and then I'll come up with something that [56:19] cuz she's already got one there. Well, a lot of them have them there. [56:23] Yeah, like Cynthia said the other ones have there too. I think we should reach [56:27] out to them and let them know that we are making this consideration and give [56:33] them that that option. [56:37] But they have the meter there. [56:42] Yeah, but I'm sure she's on the water garden. [56:45] Well, not right now, but what is I if if you approve it, I would love to turn it [56:52] on and pay that. And honestly, we know the water's probably going to stop [56:56] raining. So, I would I would like to use this as soon as possible if if approved. [57:04] And that would be a residential rate, right? Yes. Yes. [57:14] So, right now with this being in front of us, we need to Do you want to make a [57:19] motion to grant this? Do you want to wait? Anyone? [57:25] She'd like to be able to use it now. Well, then you'll make motion. [57:34] You can make a motion. You need to get the Yeah, we'll get the rest of it. Fred [57:38] needs to draw something up on it. Yeah. And our computer system will handle it [57:44] on fill in the water. Sure, Michelle. Yeah. Okay. So, we've got to make a [57:49] motion that we could this here pending what the forest deal comes up with. [57:55] Well, what you approve it tell me to come back with something that kind of [58:00] takes care of it. Takes care of everything. It she says it's going to [58:04] turn hot and dry here real fast. Yeah, it will. It will. So, do I have a motion [58:08] to approve this? I'll make a motion we approve it. Okay. I have a motion by [58:12] Sherman. Do have a second. Second. Second by Ron. Any more discussion? All [58:16] in favor? Okay. Now, now Fred, [58:22] we'll have you go back up. Okay. [58:32] Okay. Um, next we need to [58:39] we the roof is done or getting done um back in [58:47] May of 24 when we decided to go with this bid. Um you guys had decided of [58:53] where the funds were coming out of. Um [58:58] this is being brought back before you because we need to resend this vote. [59:04] And instead of just taking 10,000 out of fitness, we can take 15. [59:13] And then the other it's like it's close to 35,000. [59:19] We can take five out of water, sewer, electric, and general. So that would [59:25] cover the whole expense. But when you voted, you voted to take the 25 out of [59:32] the electric fund and and all of our funds are looking pretty good. So I just [59:37] seem to spread the spread it around. [59:42] So, I need a motion to resend this vote. [59:52] Make a motion resend this vote we made back [59:56] in 20 24. Okay. I have a motion by Ron. Do I have a second? I'll second. Second [1:00:02] by chairman. Any more discussion? All in favor? [1:00:07] All right. Now I need a motion to take the funds out of 15,000 out of fitness, [1:00:15] 5,000 out of each of water, sewer, electric, and general. Right. [1:00:24] I can make a motion. We take um 5,000 out of explorer and serve in general. [1:00:32] Thank you. And then 15 out of fitness. 15 out of fitness. Fitness. Fitness. [1:00:38] Okay. Okay. I have a motion by my wrong. Do I [1:00:41] have a second? I'll second. Second by shar. Any more discussion? [1:00:52] Law enforcement. Ron, you're up. Yeah. We need a cop. We need him bad because [1:00:58] there was a couple Yes. Just the other day, wife and I was sitting out on the [1:01:01] front porch and this car was coming down by the [1:01:05] church, little gray car. Next thing you know, this big old truck [1:01:10] come flying around and passing right on Main Street. [1:01:14] And in the evening and in the early morning, I guarantee you biggest share [1:01:20] of them people that go through town are flying between 50 and 60 miles an hour [1:01:24] for the school. I don't know if everyone's good or not. Just anybody. [1:01:28] Yeah. I mean, they fly up and down Harrison. Yeah. It's all over. We need [1:01:35] to do something. All right, Fred. So, I was going to [1:01:39] bring this up under my thing. No, no, no. I'm glad you did because it [1:01:45] it uh does yours much better. So, I've talked [1:01:50] to a couple of you people. You people I've talked to a couple of you. Um, I'm [1:01:55] not sure if I ever addressed the whole council or not, but I have had this idea [1:01:58] in my head for a long time that there has to be a way to work a deal with the [1:02:03] county. And I had Michelle run some numbers a [1:02:08] while back about what you have spent on law enforcement over the last several [1:02:13] years and what that has brought in as far as traffic funds [1:02:20] and with what those budget numbers were. I think you could probably [1:02:27] offer the county almost a full-time position without having any of that. [1:02:34] Um, [1:02:37] don't even have to furnish them a car. Yeah. Without all that other stuff [1:02:42] that you now and I keep hearing things like, well, they can't afford. Those are [1:02:48] just roadblocks to be worked around. I mean, I I've [1:02:52] I've spent 40 years priding myself on thinking outside the box. I have an [1:02:58] appointment with the sheriff next Wednesday. Okay. I've told him I have no [1:03:02] authority. I'm just there to brainstorm to see if something couldn't be worked [1:03:07] out. And I typed up a list of things I would like you two to come up with [1:03:12] before then. And I went off and left it in my printer. But it's basically what [1:03:16] hours would you like somebody here regularly? If it's morning and evening, [1:03:21] school time, what what's what's our wish list? The [1:03:25] second one was uh what specific days would be a good to have him here? Fourth [1:03:32] of July, uh heart days, whatever. Let's see. Um, [1:03:39] and then random things like I had to ask the sheriff today to have someone here [1:03:43] for court this afternoon, which he graciously sent over his his under [1:03:49] sheriff uh on a day he was extremely thin on his on his crew because three of [1:03:56] them were subpoenaed into court. And so he was run in a really tight chip, but [1:03:59] he still sits. But anyway, in talking with him just on the phone and setting [1:04:04] up this meeting, he seems receptive. new sheriff in town. Your situation's [1:04:10] different. I would like to just be have your blessing, I guess, to go [1:04:17] see if there's something that we could work out. If the answer is no, you're no [1:04:21] worse off. But the problem here is finding a quality person for a part-time [1:04:28] job. Um, secondly, keeping them [1:04:34] and the uncertainty of what that budget item is [1:04:39] going to require. I mean, it gets out of hand as I think we've experienced [1:04:45] and not having the the personnel issues, not having the all the associated costs. [1:04:52] And I've asked you to list go through and get a true picture of what it costs [1:04:57] the city to hire somebody. I don't know, but like I I think probably our [1:05:02] insurance goes up from a liability standpoint because law enforcement [1:05:08] that wouldn't be the case. Your share of FICA, your health insurance, um [1:05:12] retirement, retirement, the Yeah. caper, the certifications, the training, the [1:05:20] ammo for the firing. If we could strike a deal that says we'll pay X number of [1:05:26] dollars. this is what we want as we know we're going to have coverage these [1:05:31] times. These are the other times we would like coverage and you're going to [1:05:35] be on call for when we need you, you know, if if there's a situation, right? [1:05:41] The thing about having law enforcement, if you don't [1:05:44] have 24/7, they're going to they're going to break [1:05:47] the law when no one's here. That's just that's [1:05:51] the way it is. And so if you don't have somebody here, you're not going to get [1:05:55] somebody a ticket. But if but if there's a regularity to it and then also a [1:06:00] randomness to it, at least people know there's there's a law enforcement [1:06:06] element in town. And with what I think we could offer, I think he could supply [1:06:13] that and probably help his department a little bit too because it would give him [1:06:19] more manpower to supplement other things. [1:06:23] Yeah, there's going to be some give and take. We got a lot of things to work [1:06:25] out, but I would I don't want to go in there if I don't have your support to at [1:06:29] least explore it. What about you said like the traffic violations would go [1:06:34] through district court and we'd keep animal code here. That's my assumption [1:06:39] because I don't think they want to have to send somebody over here for court [1:06:42] every day, right? And the the dollars that you told me we collected in in [1:06:47] traffic fines was minimal. Mhm. So the code enforcement which is Penny which is [1:06:53] basically for the last several years has been what [1:06:57] 80% of our dock we can handle that in in here. So you'd lose the you lose the [1:07:03] fine money that was going for the traffic but in in comparison [1:07:10] it's a nice trade-off I think. Well also let me why I have okay attorney's fees [1:07:15] for courtapp appointed we wouldn't have to do those anymore. I don't know what [1:07:19] we've gone unreimbured for jail fees. I know we don't always collect those back [1:07:23] cuz when people don't pay, they don't pay. We don't have that anymore. That's [1:07:27] all in the county. Not only that, if the judge does issue a warrant, there's a [1:07:31] possibility we won't have the the individual brought out here because [1:07:35] they're not there to transport back and forth. I just had that phone call and I [1:07:39] called Fred immediately. It's like, well, you call the sheriff. We worked it [1:07:43] out. Yeah. Uh, and it worked out okay, but it was still [1:07:48] a bit of a beg to get somebody here for court, which was um, [1:07:54] nice to have. Let's just say that. It's got to be better than not having to cop. [1:07:58] Yeah. And and and the truth is, you know, small towns can't afford it. You [1:08:04] really can't. And I I've almost, if this works, I'm tempted to pick up the phone [1:08:10] and call Moran and say, "You guys need to do this, too." Mhm. Um well gas is [1:08:15] the same way is it? Well I didn't have a constable or anything [1:08:20] I think I think there would be a in this short distance there would be a good [1:08:26] area here to patrol. The things I wanted to say too you wouldn't have to worry [1:08:29] about vacation and all that. So it's a lot of these benefits of what eats [1:08:34] alive. But my main concern is will they and can they enforce our city [1:08:39] ordinances? Well, you're paying for a ser. Yes, that there's a workaround [1:08:43] around that. That's that's that's one of the frustrating things I hear when [1:08:48] people just say, "Well, we can't do it." Well, [1:08:51] let's find a way to do it instead of saying we can't. Yeah, there's a way to [1:08:55] do that. I haven't quite sorted it out, but if nothing else, they they become a [1:09:00] deputy. I mean, there's a way. interlocal government agreement I I [1:09:05] think would probably be also work to just say they are now part of LAR uh [1:09:12] hours you could still probably have that like we had before so I think it would [1:09:15] be a terrific idea I think it's worth checking into so your homework before [1:09:19] next Wednesday at 1:00 okay is to sit down and I I apolog I [1:09:25] nicely typed it's so neat and it's sitting in my printer oh yeah so I'll [1:09:30] I'll email it to you tomorrow okay that'll work But I would like to know [1:09:35] just of what it is you're looking for as far as numbers of hours, dates. Um, and [1:09:42] then I think you guys need to get a handle on what you guys have spent over [1:09:45] the last several years. And I think you're going to be surprised. We got a [1:09:48] car sitting up there. I was going to say, what are we going to do with that [1:09:52] $35,000 car that Well, that's part of the poker chips on my side. That's part [1:09:57] of the poker chips on my side. We came out good on the last one, and I'm sure [1:10:00] we do the same this time. But you're probably still paying insurance on it, [1:10:03] right? Yeah, we have to. Yeah, that's my point. It's it's a drain. [1:10:09] And I think this might be a longer term solution if and again, new new sheriff [1:10:16] in town, new ideas, right? Not so many preconceived [1:10:21] notions. We can outline the holidays where we want coverage and all that. [1:10:25] Yeah. Yep. So, are you guys okay with him going forward? Yeah, [1:10:30] and I talked about I have no authority. I've been upfront with you. I said I [1:10:34] have no negotiating authority. I'm just here to explore ideas. So, well, we we [1:10:38] need some coverage. You got three daycarees that come down there and go to [1:10:41] our park and they're not going 20 mph down that road. Yeah. And I'm worried [1:10:45] about some kids life. So, we need this. [1:10:50] If we can work something like that out, it'd be great. Yeah. If you need me to [1:10:54] help with time to put in on it, I will. Okay. So, Brad get all get together. [1:11:01] We'll get that done. All right. The next order removal bid for 406 South [1:11:08] McKenley. [1:11:12] Only got one bid. I know. [1:11:17] Um from Ray and it's $1,200. $1,200. That's pretty. [1:11:25] So I need a motion to accept. I'll make a motion. [1:11:29] Motion by Ron. Do I have a second? I'll second it. Second by [1:11:37] second by chairman. And all in favor? How are we paying for this? Um it will [1:11:41] come out of [1:11:45] general that's under because last month we we [1:11:50] did two. Yeah. Yeah. We did two of them last month. Yeah. Yeah. So, it'll come [1:11:54] out of general. [1:11:58] All right. Moving on. All in favor? Oh, all in favor. Sorry. [1:12:04] Okay. Fred, that was my [1:12:10] shot my on that one. Um Roy is not Oh, hi Roy. I was going to say you're not [1:12:15] here. How are you? I'm good. I'm good. Nothing new here. Good. [1:12:20] Um um you'll see Wait a minute. We got a [1:12:24] water hydrant. Yeah. Larry Tony stopped in the office today. Very upset. Um [1:12:30] their water hydrant or their fire hydrant, water hydrant, whatever you [1:12:34] want to call it. The blue one. Somebody attempted to turn on whatever is they [1:12:39] broke it. So he was in town this afternoon fixing it. They're having a [1:12:43] meeting tomorrow night. Public wholesale is. And he said he'll have Roy report [1:12:48] back to me. He's probably going to ask for some reimbursement [1:12:54] on it. Okay. Who tried to do that? I don't [1:12:59] know. I I don't know. Maybe Roy will find out more tomorrow night. I'll find [1:13:04] out over by the water [1:13:10] straight east. Okay. Jog over Taylor. That one right there on the corner. [1:13:15] Yeah. He said it was broken and Okay. Right away somebody going to hit that [1:13:18] thing. That's like 4 foot down the ditch. Yeah. That's weird. Okay. Okay. [1:13:24] Okay. All right. Penny, I have her monthly her Yeah. Her monthly report. [1:13:31] Anybody wants to read it? Mark, you're up. We have the minutes. [1:13:36] Yeah. We'll get back on the whistles when it kind of was raining. We want to [1:13:40] hear from y. Okay. That's all we got going right now. [1:13:46] Um, thank you guys. Work orders. [1:13:52] Michelle, you're up. Only thing I got on the work orders, they're not always [1:13:55] putting an address on there. [1:14:01] Okay. Okay. I told Michelle, is it on all of them or just part of some? [1:14:09] Okay. Okay. I received a insurance check on um Jerry Jerry [1:14:17] Adair's place. He knows that we have this check. I didn't know what it was [1:14:22] for, but state law says all Kansas communities have a 15% lean ordinance on [1:14:30] their homeowners insurance. And this check is for a little over 9,000. [1:14:36] And what we're what the city is entitled to do with this is to hold on to it [1:14:40] until the city is satisfied with the clearing of his property and then [1:14:45] release the funds to him. If it he doesn't get done in a timely manner, the [1:14:49] city can go in and pay somebody to do it and he'll get the difference. Okay. But [1:14:55] it also when I was looking at our ordinance and I found that out from the [1:14:58] insurance lady because I haven't seen one of these in 12 years that I've been [1:15:01] here like what do I do with this? I also found [1:15:06] that with these, it's in our fire ordinance. [1:15:11] Um, we have to [1:15:18] [Music] uh we have to open a fund as the fire [1:15:22] insurance proceed fund. All monies receive received as provided by this [1:15:27] article should be placed in said fund and deposited in an interest bearing [1:15:31] account. Well, I've talked to Fred about it after CO. I mean, I've been here [1:15:36] almost 13 years, and this is the first one I've ever seen. And he suggested a [1:15:41] separate line item in QuickBooks that this is fire fun. This is Jerry's money [1:15:47] whenever he gets the property cleared. Yeah. [1:15:52] After we talked, I I had another thought. Do you have a fund or an [1:15:56] account with the state for like your excess money that's they they invest? [1:16:02] Okay. Not with the state. Well, you can just stick it in there and get some [1:16:05] interest on it. When does that [1:16:09] has to be cash within so many days? After 180 days, six months, [1:16:17] they did the same thing to us. It's a handful. Yeah. And [1:16:23] when I got our h Well, when we had to have when we got the house cleaned up, [1:16:26] we got our money back plus interest. Yeah. And and that's the issue. So we [1:16:31] can find out. So we need we can find out what the state interest is and pay him [1:16:35] the difference. So [1:16:40] well, I think what I think you could find out what a local bank's interest [1:16:45] would be for count. Okay. But much, you know, it's $8 $9,000. I think it they're [1:16:52] supposed to get cleaned up within like 90 days or something. I did the [1:16:56] calculation. It's like $8 a month. So, my thought was it might be easier to [1:17:03] just put it in your fund, your general fund as a separate fund. Put Sorry, two [1:17:10] wrong terms there. Put it in your general account. Okay. as a separate [1:17:14] fund, which means it has a separate page and you track it separately. It's [1:17:17] segregated, but it's still comming. Yeah. And then if they want interest, [1:17:23] you write them a check for $24 from you. Okay. Okay. Because otherwise, you're [1:17:28] going to have to run into the bank and sign new cards and and you're going to [1:17:33] get 2% or 3% on your Well, when they just put it in a general fund, but our [1:17:39] checking account doesn't get interest. We just [1:17:47] I'm just asking that question. So his 90 days starts tonight. 90 days [1:17:52] starts tonight. Yeah. Your 90 days starts tonight. Thanks. [1:18:01] I'm going to ask you questions like [1:18:11] you know you put now because they've allowed Do you care if it's on interest [1:18:16] or not? That's what I like. No, I just I just want to get it done. Yeah, that's [1:18:20] my thought too. Yeah, I mean it's it's probably less than 20 bucks total. You [1:18:24] kept the whole $20. So, it's a lot of hassle to open up a whole new account. [1:18:32] So, in the 90 days when he if he's completed, can Penny okay that or does [1:18:38] the council need to go okay that before releasing this? I think if this is my [1:18:43] opinion. Y I think that's Penny's job. Okay. If [1:18:48] Kenny's happy, we're good. You're good. You're not Yeah. Get a hold of us [1:18:53] whenever you've got it all cleared. Yeah. Like And if she signs off on it, [1:18:58] she'll cut you a check. Yeah. That's Yeah. The insurance company said you [1:19:01] were aware of all this and Yes. Okay. had a good adjuster. Okay. Okay. They [1:19:07] explained all that to me. Okay. Good. Yeah. That's what she told me. It's [1:19:10] like, okay, good. Okay. So, we'll do that. Okay. Um, [1:19:16] Kyle emailed me and he he would like to set [1:19:20] up the 2026 budget meeting Monday, July 7th at 6:00 with our budget hearing then [1:19:28] at the August meeting, council meeting. And the reason [1:19:33] why July 7th, yes, because if we have to exceed our RNR, it needs to be turned [1:19:39] into the county clerk by July 20th before. You have to simply [1:19:44] give the clerk a letter that says you're going to exceed the RNR by July 15th. [1:19:49] 15. Okay. Thank you. But you can have your you can have your hearing later. [1:19:54] It's just you have to give her notice because then she sends out a Yeah. Yeah. [1:19:58] But you should be getting like just talk to her today. You should be getting your [1:20:02] information from her to finish your budget like in the next day or two. She [1:20:05] said because you have a July one valuation that factors into that in your [1:20:11] budget worksheet. didn't matter. So, will July 7th work for everybody at [1:20:17] 6? It won't work. But what do you I can we have ball games that night? We're at [1:20:24] tournament that night. But we can I can call Who's doing this for you? [1:20:31] Um down there. Yeah. Okay. They're just coming to [1:20:35] discuss the budget. Okay. That's not your hearing. [1:20:40] Yeah. This is if we have to need to receive RNR, we can get this to right [1:20:45] because your notice for your hearing has to say whether or not you want. Okay, [1:20:48] I'm with you now. Sorry. It's on Monday. [1:20:58] Let this go by. Yeah. [1:21:09] You should have heard her couple. [1:21:15] I'll get two signatures. As far as [1:21:23] this last thing over there, right now I'm recording [1:21:28] this council meeting because I've had some citizens ask if we would live [1:21:31] stream and I personally do not want to live stream on Facebook because I get [1:21:37] sick and tired of comments on Facebook. I know you can turn them off. I don't [1:21:41] want nothing to do with Facebook on our videos. However, I am recording this to [1:21:46] see if I can post a video on our website, [1:21:51] our city website, like Iola does, you know, with a link of the day of council [1:21:56] meeting and people can get in there and view it at their own time and won't be [1:21:59] able to comment on it. They'll just sit there and watch it like watching a TV [1:22:03] show. But I didn't know how you guys felt [1:22:07] about that. Or like I said, I just had a few ask if we could live stream. I'm not [1:22:14] a fan of the live. No, I don't like Facebook. [1:22:19] Facebook. So, you okay with the just recording it and then we just put it on [1:22:24] our website? They can't comment on it. Well, it it' be a link and all they [1:22:29] could do is watch it. It's just a video file with that you put the link to the [1:22:33] video. It's pretty much just watching what we you just watch, right? You can't [1:22:38] comment. You can't And then if you have a concern, then they can come up like, [1:22:41] "Hey, that council meeting, this is what we heard." And then But I'm also [1:22:44] wondering, you know, how that this feed's going to be with hearing [1:22:48] everybody's Yeah. discussion. Yeah. This is just trial right now. We [1:22:53] may need, you know, an extra different sitting in here anyway. Yeah. And I [1:22:58] didn't I I'm fine with it. I am too. Go for it. That's it. Okay. [1:23:18] All right. Um do that. Anything else to discuss on the agenda? [1:23:26] So, did we buy a mower? Yeah, we did. Yeah, we did. Did I miss [1:23:30] the bill? We bought the mower. You guys approved [1:23:35] it. Yeah, we approved it, but I didn't see Yeah, we spent a lot less than what [1:23:38] we needed. It was on I think we put on the credit. Uhhuh. It was through Home [1:23:43] Depot. Yeah. Okay. I didn't see anything which I guess that's bills. I can email. [1:23:50] I never thought about that. I can email you, but it was a lot less than what you [1:23:52] guys like 3,900 or something. Have we heard anything on the other? Um, yes. He [1:23:59] says, "Yes." Um, they don't make that engine anymore, so it's going to be a [1:24:03] Kawasaki engine. Mhm. And RNR is just waiting on them to send it to them so [1:24:08] they can put it in. Sweet. Okay. So, [1:24:13] in a few days. All right. Nothing wrong with the [1:24:16] Kazaki. Anything else? If not, um, I need a [1:24:21] motion to go into executive for 10 minutes on non-elective. I need a motion [1:24:29] to go to executive for 10 minutes. Motion by [1:24:35] Angela. I do have a second. I'll second it. Second by Ron. All in favor? [1:24:43] Just second. We got to all get out of here. I got [1:24:53] I got pause on this turn. I forgot about that. That's going [1:24:59] to be all right. So, I need a motion to come back into my [1:25:05] session. Make a motion to come back. Motion by doing a second. Second by [1:25:12] Angela. All in favor? [1:25:16] coming back. Yeah. [1:25:22] Cherylyn Angela. Yeah. And everybody. [1:25:27] All right. So, do I have another motion? I make a motion that we give uh I can [1:25:34] state the amount, right? Yeah. That we give him a 50 cent an hour raise. [1:25:38] Keith. Keith. Yeah. I have a motion by Charlie. Do you have a second? Second. [1:25:43] Second by Angela. Any more discussion? Effective when? [1:25:50] So on this on this week? This week. Okay. [1:25:54] All in favor. All right. I have to. Yeah. Huh. [1:26:01] Okay. All right. [1:26:07] Treasures report. Anybody got any questions, comments, or kind? Sorry. [1:26:13] I I think we're doing pretty good, guys. Are we finished with BG? Cuz I seen an [1:26:18] email. We owe like a that 1,800. I think we've got the money in the I like missed [1:26:25] that. No, we've got the money in that. I know. I'm like, no, we've got the money [1:26:31] in that sewer fun. I did make a note just so I can keep [1:26:36] track of it so when we do get the grant money or loan money, we can get all [1:26:41] these stuff. the stuff paid back. Yeah, like you did the the power upgrade. [1:26:47] Yeah, we need to make sure we get this stuff paid back. [1:26:51] But I was just sharing it with you guys so you remember it, too. We appreciate [1:26:54] that. Okay. Anything else on treasure? Okay, we'll follow for audit. I need a [1:27:02] motion to approve the bills. Make a motion approve the bills. Motion [1:27:07] by Angela. Do I have a second? No, second. Second by Rolling. Any [1:27:11] discussion? All in favor? I'd like the bill for my own. I know. All in favor? [1:27:19] Motion to adjurnn. Okay. I make a motion to go home. Motion by Angelus, second by [1:27:25] Cherylyn. All in favor. All right, we're done. [1:27:29] All right. [1:27:45] May, I wanted to meet you. I'm Gail. My granddaughters are Austin's daughters. [1:27:51] Oh, really? Hi. Hi. How are you? I'm fine. I keep I keep like I'll see to [1:27:58] have the girls and I was like, one of these days we'll have something and I'll [1:28:01] see you and I go, these are your girls, too. Yeah, they are. There's [1:28:07] I know. They're growing up so fast. Yeah, she does. She's a cruel all the [1:28:13] way. All over. Yeah. Yeah. But I mean [1:28:20] Yeah.
