[4:06] >> [4:08] whereas, on february 4, 1986, four unarmed and peaceful sikh [4:17] students, baldhir singh, jhilman singh, [4:18] and harminder singh were killed [4:19] by state police in punjab, india, in an [4:21] unprovoked firing, while [4:23] participating in protest against the desecration of sikh [4:27] scripture "sri guru granth [4:29] sahib" considered by all sikhs to be the final, supreme and [4:31] living guru after the lineage of 10 sikh gurus; [4:35] and whereas, the state government [4:36] constituted a commission of [4:38] judicial inquiry headed by a renowned [4:41] jurist on this incident of extra-judicial killings. [4:48] >> the justice gurnam singh [4:51] commission of inquiry submitted [4:53] and not even a single perpetrator [4:54] has been brought to justice today. [4:57] families [4:58] have been fighting for the truth -- [5:00] [ inaudible ] [5:02] accountability and closure for over [5:03] 39 years. And -- [5:07] >> whereas, this incident has now [5:09] also received international [5:11] attention as dr. Cheema, member of [5:13] united nations global steering committee of osapg, has raised [5:18] it on various international [5:21] forums; and [5:22] >> now therefore I, gary singh, mayor [5:23] of the [5:26] city [5:27] of manteca on behalf of the city council [5:28] stand in solidarity and empathy with [5:29] the [5:32] families and victims [5:33] in their pursuit of justice. [6:11] we are [6:14] extremely grateful to [6:17] mayor mayor singh and the city council [6:20] to recognize the very fourth [6:23] as saka nakodar day [6:26] . Why? Why it [6:28] is important to remember these atrocities [6:32] ? It is black awareness [6:35] month too. [6:41] you know, our pains are the same. [6:42] our circumstances might be different. [6:44] my brother [6:51] , who was a pre-engineering student [6:52] who wanted [6:55] to be an electrical engineer [6:58] --he was 19 [7:01] . [7:04] and they were completely unarmed [7:07] doing a peaceful protest [7:10] . And there are rules [7:13] and regulations to open [7:16] the live fire . [7:19] you need a judicial permission . You [7:22] need to give a verbal warning [7:25] . You need to start [7:27] with a minimum amount of force. You [7:28] need to declare [7:31] the assembly unlawful. Nothing [7:34] was done. They [7:37] opened live fire , and my brother [7:40] , who was [7:42] in the five up front --he was the [7:43] first one who got martyred [7:46] that day for doing a [7:48] peaceful protest against the sacrilege [7:52] . It did not [7:55] end there. [7:58] the other two [8:01] --he was uncle of this [8:04] girl who is standing next to me [8:07] . And [8:10] singh. They were not shot at the same [8:13] point . They were shot [8:16] more than a kilometer away [8:19] . And [8:22] the farm where they were taking refuge [8:25] . Didn't end there. [8:31] a second year student. [8:34] he was -- [8:37] they challenge him by name. [8:40] the station [8:43] house officer and [8:49] --in his mouth and shot him [8:52] at point-blank. All four were brought [8:53] to [8:55] the hospital for autopsies [8:58] . They [8:59] date of their autopsies in the dark [9:01] of the night. And when the doctors [9:02] went to do [9:04] the autopsies , you will be [9:07] shocked to know that [9:13] ravinder was still alive. He [9:15] was still alive, so the doctors took [9:16] him to the hospital , tried to [9:19] treat him, but the police took over [9:22] , and they took him to another hospital [9:25] . If it [9:27] happened in tracy, we will take them [9:28] to sacramento [9:31] to a different hospital. [9:33] and when they went to the other hospital, [9:34] the doctors [9:37] --the [9:39] police made sure while they were taking [9:40] him to the other hospital that he [9:41] is [9:43] dead. It didn't end there. [9:46] next morning, my father , who was 39 [9:50] --only one from the [9:53] four families was [9:54] able to get into the city while the [9:55] city was under curfew. He went to [9:59] the hospital [10:00] , identified his son, asked for his [10:02] body for his [10:04] permission. He was told to go to the [10:05] police station . In the meantime, [10:08] police took all four bodies [10:13] . Kerosene fuel to burn them all. [10:17] my dad [10:18] sat in front of the police station, [10:20] started a [10:23] protest [10:26] . A commission [10:29] was constituted. [10:31] it was a retired high court justice [10:33] who gave his report to the state government [10:39] on the 31st of october, 1986. And [10:41] the rule of law states [10:42] once a report is submitted to the state, [10:44] and needs to be played [10:46] in the state assembly within six months [10:50] of submission . [10:53] and a report needs to [10:56] be issued. 39 [10:59] years. 39 years till this day [11:02] that report [11:05] hasn't been acted upon. [11:08] that is why it [11:10] is important to remember these days [11:15] . And then when my father applied underwriting [11:16] information for the report, guess [11:17] what [11:20] they told. [11:22] this never happened. We never killed anyone. [11:26] this has been brought [11:28] into both houses of the parliament [11:29] in india [11:34] . Upper and lower. The state assembly. [11:35] the governor [11:36] of the state. The president of india. [11:40] we went to the high court. Nothing. [11:44] so [11:45] that is when we came to the global [11:47] communities to raise the global awareness. [11:48] our [11:50] case -- [11:53] in 2022. U.s. Congress [11:56] declared february as [12:01] saka nakodar debuted on june 13th [12:02] of last year, california [12:04] state assembly recognized saka nakodar [12:05] day for the fourth of [12:07] february. And I am so , so thankful [12:08] to [12:11] you all to shed the light [12:14] on this atrocity. [12:16] declare itself as the biggest democracy. I believe today our city spoke [14:28] . America spoke. [14:30] and as long as we continue to speak [14:31] and recognize each other's pain and [14:33] love, no one can fail us and we will [14:34] never fail. What they [28:27] are using right now is the [28:30] vehicle fee fund [28:32] , however, without measure q being passed [28:35] , we would usually wait until the [28:36] beginning of [28:38] the budget season, but due to measure [28:39] q passing [28:43] and projected revenues for that and [28:45] the immediate need for the vehicles today [28:48] , we are putting it on [28:51] the agenda . It takes quite [28:54] some time to get a vehicle [29:00] . And it goes by purchase order date. [29:01] you [29:02] cannot get a purchase order date until it [29:03] passes. So if you're looking at [29:04] getting a vehicle through the regular [29:05] budget cycle, once a budget passes [29:09] , then we would be able to [29:17] put in a purchase order and get those [29:18] vehicles. And a lot of [29:19] the time there's --everyone is around [29:21] the same time trying to get vehicles. [29:23] and so that pushes out with who we [29:24] get [29:25] the vehicles from. We are [29:54] able to [29:57] get these vehicles on the ground [29:59] and into the police station as the [30:00] chief has said. [30:02] it takes a long time to get these [30:03] ordered and we are usually constrained [30:04] by [30:06] budget times. [30:08] so this was a great win for the city, [30:09] and we wanted [30:11] to show you that we needed this immediately. I [30:12] know there's been some accidents and [30:13] some things that happened with vehicles [30:15] and we have mishaps and worn out parts. [30:16] so [30:17] to be able to purchase when we actually [30:18] need them [30:20] immediately and not wait until a budget [30:21] cycle is very important. It [30:23] is not uncommon for an officer to arrive [30:24] in a [30:25] vehicle and that is only because there [30:27] is not a vehicle for the second [30:29] officer. So this is much better for [30:30] the city to get these [30:33] vehicles purchased and with the measure [30:34] q [30:35] funds coming sometime next year or [30:36] this year [30:42] --later in the year --we are able [30:43] to do [30:44] this. [36:19] these are developer fees that developers [36:22] will be paying. So [36:23] the items I'm bringing forth tonight [36:25] do not impact [36:28] regular users. [36:34] so with that cleared, I will go ahead [36:35] and [36:37] get started. [36:42] so as you guys are aware, these are [36:43] capacity fees. Any type of [36:44] fee structure that we put together require [36:46] a lot of data [36:51] . It feels like these are all kind of [36:52] coming in together around the [36:54] same time. But we have been working [36:55] on these for a long time. [36:57] it all started with the 2023 general plan [37:01] . The last time these capacity fees [37:02] were [37:03] looked at was back in 2008. So we [37:04] had to wait for the general plan [37:06] to tell us what the future growth [37:07] projections were. [37:10] the general plan for [37:13] 2043 was [37:15] approved back in july 2023 with the [37:16] general [37:19] plan approved [37:21] within started working on the master [37:22] plan. So the master plans for [37:25] the water system was approved on march 2024 [37:28] , [37:30] and with that, we then had to make [37:31] sure we had the most [37:33] recent and up-to-date information. [37:34] so we had to wait for a [37:37] lot of audit to be [37:40] caught up. So those are kind of the [37:42] data sources we got all the information [37:43] to plug into these rates. It wasn't [37:44] like [37:46] we were just waiting around [37:48] . There were lots of data. Lots of [37:49] reports. Lots of [37:51] studies that had to be before we could [37:52] move forward with these [37:55] capacity fee calculations [37:58] [ inaudible ] developers. [38:01] so there is [38:03] typically three different types of approaches [38:04] for putting together [38:07] a capacity [38:10] fee. There is a buy in [38:11] approach. There is an incremental [38:12] and there is a hybrid approach. For [38:13] the water system, because [38:16] we do have access [38:19] available capacity , the best [38:22] approach to [38:25] was the buy in approach. [38:30] when you're looking at an incremental [38:31] approach, that is where your system [38:33] is kind of maxed out. There is no [38:34] additional access [38:39] capacity. Then you would be looking [38:40] at an incremental approach. A hybrid [38:41] approach [38:42] would be you have some excess capacity. [38:43] you could be in trouble in the next [38:45] five years or so. Looking at our water [38:46] system, this was [38:54] feedback from our water master plan, [38:55] which showed we do have excess capacity, [38:56] and therefore the buy in approaches [38:58] the most accurate way to do it. I [38:59] do have [39:00] a little bit of math just to show [39:01] that a lot of numbers [39:04] went into this. [39:07] so just to kind of make it very simple, [39:10] it really comes down to what because [39:11] we [39:12] are using the buy in approach --it [39:13] comes down to what the value [39:15] of your system is divided by your [39:16] actual max [39:21] . So just a quick calculation to show [39:22] how some of these numbers are [39:24] put together. I'm not going to bore [39:25] you guys with it, but [39:27] the maxed demand is pulled directly [39:28] from our master plan. [39:31] the peak [39:34] factor was also derived from our master plan, [39:35] so we couldn't have [39:36] actually put these studies together [39:37] until we completed our master plan. [39:41] this is a typical [39:46] revised, updated cost for the capacity [39:47] fee for [39:50] a single-family home. [39:55] I just have a total current fee here [39:56] and [39:57] the proposed fee. So these fees are [39:58] meant to ensure that developers are [39:59] paying their [40:02] fair share [40:04] so that as we are looking at all of [40:05] our [40:07] user rates , developers are being [40:08] required to pay [40:11] their fair share. And if [40:14] you look at further down [40:17] had an eight [40:18] inch line, it is quite a significant [40:20] increase. But for the most part [40:21] single-family residential are going [40:23] to be another [40:24] three-quarter inch meter. That is [40:26] going up roughly $310 [40:29] , and I do want to [40:33] kind of stress that because these [40:35] fees were last looked at in 2008 [40:39] . They have been continually escalated [40:41] based on cpi. So being off [40:43] by $310 actually is very, very good [40:44] for [40:46] a great study that was looked at 15 [40:47] plus [40:50] years ago. [40:55] we are also adding a discount fee. [40:56] this is [40:59] a new fee we have been [41:02] looking at . And the whole idea [41:04] is that we do have some large estate lots. [41:08] they are inside the city limits. [41:11] but they may be on a well [41:14] , and if the well [41:17] goes bad , it is [41:19] really not fair to have those folks also [41:23] pay the same development fees as a [41:24] developer who is going to be going [41:25] in and purchasing large tracts of [41:26] land and [41:27] then putting undue stress on our system. [41:29] so we would still [41:32] recover those costs [41:34] when that land develops in the future, [41:35] but this would [41:36] be mainly for emergency -- emergencies [41:38] . There is very few [41:41] of these properties [41:42] that fall into this category. So we [41:44] do have some requirements [41:46] . First is that it does have to be [41:47] a [41:50] single-family residential [41:52] built prior to march 2024. That is when [41:53] the master plan [41:56] was adopted. [42:01] you must be within the city limits. [42:02] you also must have no [42:03] prior water connections. So if you [42:05] are a business and you want to put [42:06] in a car wash or a laundromat, this [42:08] would not apply to you. We would still [42:10] charge them the meter installation [42:11] fee. And then there [42:12] is a $500 administration fee just [42:14] for the city to track all of those [42:17] types of customers . [42:20] with that -- [42:21] >> [42:22] and you go back to that real quick? Can [42:23] you tell us what [42:28] those fees are currently if somebody [42:29] wanted to do that? [42:30] >> so those fees right now currently [42:32] if you wanted to do that you [42:33] would fall under the single-family [42:35] residential. And so they [42:38] would be paying roughly [42:41] --if [42:42] the proposed fees are in place, that [42:44] would be roughly $6000. [42:46] now that is just for capacity fees. [42:47] there [42:49] are other fees that would also apply [42:53] . And so some of those costs [42:55] would actually be north of $15,000 [42:59] . [43:08] so that is why you are not --these [43:09] properties are [43:11] very few and far in between. So we do want to be [43:21] good neighbors if our neighbors are [43:23] struggling with their wells and they [43:24] have --they [43:25] don't have potable drinking water, [43:26] we should try to come up with a mechanism [43:28] for them to connect to the city system. I think a lot of utility fees kind [51:49] of [51:51] go together because there is lots [51:52] of [51:53] crossover in terms of the documentation [51:55] that is needed. [51:57] I skipped over some of the other documentation [51:58] that is referenced [52:00] on the waterside, but there's typically [52:03] three different types of approaches [52:09] . We did take a different approach [52:10] on the [52:11] sewer side than we did on the waterside [52:13] because right now [52:16] we do --we don't have any excess capacity [52:19] in our sewer system. [52:22] so what we did [52:24] was we included all of the costs associated [52:25] with providing service to [52:28] future customers [52:30] . Rolled that all into an incremental [52:31] capacity increase. [52:33] so anything that is associated with [52:34] future development [52:37] and future growth [52:40] --they are paying their fair share. [52:41] nothing more. Nothing less. That is [52:43] what these fees are designed to do. [52:48] so this table I have here with all [52:49] of the [52:52] cost down took a lot of time [52:53] for consultants to go through and [52:55] figure out how [52:58] and what treatment process [53:01] is designed to address each [53:04] component. So whether it be the [53:07] flow, nitrogen , you have to [53:10] study the improvements [53:17] --what the improvements are intended [53:19] to do, and attribute those costs to [53:20] just those individual components. [53:21] so that took quite a bit of time. [53:22] and we couldn't do [53:24] it without having a plan in place. [53:28] once [53:31] we got all that information [53:32] , the calculation actually ends up [53:34] being pretty simple [53:40] . Just based on the amount [53:41] of contribution for each single family [53:43] home, we are able to calculate the [53:45] unit cost for each component. So if [53:46] you look at [53:49] the highlight in red here [53:52] , because the bulk of our needs [53:53] right now are at the treatment plant, [53:55] flow is really your [53:58] cheapest component [54:04] . We are struggling with nutrient [54:05] removal. So as you move to the left, [54:07] nitrogen is the most expensive component. [54:09] so just to kind of give you an idea [54:10] of how the different [54:13] needs have [54:14] grown. And nitrogen really is a new [54:16] requirement for us [54:17] that wasn't accounted for in the original [54:19] study back in 2008. [54:25] so taking all of that [54:28] , we are changing [54:31] the fee structure for the [54:34] sewer side. [54:36] so I can't give you a comparable between [54:37] existing and proposed. [54:40] but one that I can give you [54:42] comparable four is the single-family home [54:51] . Currently for a single-family home, [54:52] the capacity is $5964. That [54:53] is going to be going up roughly $1000. [54:55] $947 if you are counting it. [54:57] we have sat down and reviewed this [55:01] with the bia [55:07] . They didn't have any comments. They [55:08] did [55:09] ask some questions about why and how. [55:10] we went through the calculations with [55:11] them. I don't see them here tonight. [55:58] for commercial low strength, [56:04] we do have that calculated. It is [56:05] based on [56:06] their projected loading. So depending on [56:07] how much flow they are predicted to [56:08] use [56:10] to assess nitrogen, these are [56:13] the total costs. The [56:16] meter size is based on their water meter. [56:25] the reason for that is there is [56:26] no good way to measure wastewater [56:28] at those lower levels, so you use [56:29] the meter sizes [56:30] as a gauge for how much water they [56:31] are going to use, which means [56:33] a portion of that is going to be generating [56:34] your wastewater. [56:36] so that is the cost for promotional [56:42] strength. And the cost for medium strength [56:46] sewer capacity fees. Then we also have [56:49] the commercial high-strength [56:52] . [56:55] and we also added the discount fee [56:58] for our [57:01] friends who are inside the [57:04] city limits existing single-family homes [57:07] constructed prior to [57:10] march 2024. No prior [57:12] sewer connections . So this would [57:13] be folks [57:18] put on septic that their septic may [57:19] have gone bad and they cannot get [57:22] a permit because there is a separation [57:23] issue between their septic and [57:26] their well. There is [57:27] just a straight administration fee [57:29] of $500 for a [57:32] sewer connection. With that [57:35] , I will be happy to [57:38] answer any questions. Incrementally years ago, [1:03:04] but because increases were put off [1:03:05] for so long, we are now at a point [1:03:07] where we have to act. Our utility [1:03:09] funds can no longer keep up with [1:03:11] the cost of maintaining our aging system [1:03:12] , keeping [1:03:15] up with services [1:03:18] , demands, and making critical infrastructure upgrades [1:03:21] . It has been nearly [1:03:22] 15 years since the last adjustment. [1:03:28] and in that time, costs have gone [1:03:30] up while parts of our system [1:03:33] have aged past [1:03:36] their [1:03:37] lifespan. To make sure we're making [1:03:38] the right decision, we brought an [1:03:39] independent consultant to [1:03:40] assess what is needed to keep things [1:03:41] running safely and efficiently. While [1:03:42] these improvements we [1:03:45] risk breakdowns --without these [1:03:46] improvements we risk breakdowns. We do [1:03:54] reduce service and higher costs [1:03:55] down the road. Because customer rates [1:03:56] are what fund local and sewer projects, [1:03:57] we have [1:03:58] to propose these adjustments to ensure [1:04:00] we can continue providing safe, [1:04:01] reliable service, not just today but [1:04:03] for the years to come. [1:04:09] we have some [1:04:10] upcoming community meetings on rate [1:04:11] increases and handouts are available [1:04:12] at the back table for [1:04:13] more information. Residents are encouraged [1:04:15] to learn more about the proposed rate adjustments [1:04:17] and ask questions at upcoming community meetings [1:04:19] . [1:05:06] start with [1:05:09] council member breitenbucher. [1:05:12] >> okay. I wanted to [1:05:15] bring forward an item to look at [1:05:17] putting onto next meeting's agenda [1:05:21] . It is laura's [1:05:24] law. 2021 we sent a letter to the supervisors [1:05:27] asking to implement that [1:05:30] . It is a state law that [1:05:33] helps people [1:05:38] mental health. Enhances public safety [1:05:39] , reduces the [1:05:42] need for inpatient [1:05:43] commitment and incarceration. It is [1:05:45] known as aot [1:05:51] . It is a california law that allows [1:05:52] courts [1:05:53] to order community treatment for people [1:05:54] with severe [1:05:57] mental illness. A law was named after [1:05:58] laura wilcox, who was killed by person [1:06:00] with mental illness in 2001. Today [1:06:01] the [1:06:03] navigation center we had [1:06:06] --I was there when they took a call [1:06:09] from kaiser. They had a patient [1:06:12] that they were going to discharge. [1:06:14] they were asking 555 to take them. [1:06:21] there is an [1:06:24] issue there. And because we [1:06:27] don't have [1:06:30] the ability -- [1:06:31] if the person refuses, you cannot [1:06:33] force them. This [1:06:35] puts a tool in the box that allows [1:06:36] the court [1:06:38] to say, yes, this person needs help, [1:06:39] and it gets them help. Otherwise [1:06:41] these people get lost in the weeds. [1:06:45] so did you [1:06:47] have something? [1:06:48] >> yeah, mayor and [1:06:51] council. I wanted to add to that. [1:06:52] assisted outpatient treatment. What [1:06:54] makes it [1:06:57] unique is counties have to opt into [1:06:58] it. Cities cannot. [1:07:00] the county has to do it. So each [1:07:02] --all 58 counties in the state and [1:07:03] each one individually has to [1:07:06] do it. In 2021, the [1:07:08] council did send a letter to the board [1:07:09] of supervisors requesting that they [1:07:10] do [1:07:11] it. They decided not to and instead [1:07:14] stick with what is called their inspire [1:07:15] program, which is [1:07:18] voluntary treatment [1:07:24] . I know at the time they said that [1:07:25] they [1:07:26] would update us. We have not received [1:07:27] an update. I just wanted to give some [1:07:28] more background on what laura's law [1:07:30] is in case you may want to know. [1:07:31] >> [1:07:33] thank you. Because [1:09:20] there [1:09:21] were other cities that really liked [1:09:22] it and wanted it, but we were [1:09:25] able to do that and [1:09:27] pd vehicles tonight. We used funds [1:09:34] to outfit the equipment with radios [1:09:35] and sirens and all of that good stuff [1:09:37] that goes with the public safety [1:09:38] equipment. Putting that on hold to [1:09:40] add to this [1:09:45] . Those will be fully outfitted. And [1:09:46] then of course the police [1:09:47] department. I cannot say enough. Years [1:09:49] and years. I would also like to see a [1:15:48] council consensus to look into whether [1:15:50] maybe we can do an expedited process [1:15:51] or grandfather in. I have seen a lot [1:15:53] of this stem from the city of [1:15:54] berkeley on affordable housing or [1:15:56] housing options. Looking at [1:16:02] adu [1:16:04] s or converted spaces through an amnesty [1:16:08] program or fee deferral process. [1:16:11] people may already [1:16:12] have those. And they have done it [1:16:13] without permits allowing them to come [1:16:14] up [1:16:17] to code and actually bring it [1:16:18] to light instead of continuing to [1:16:20] being under the [1:16:23] radar there. [1:16:29] if we can start [1:16:31] a program I would like to see the [1:16:32] city attorney and city manager's office [1:16:33] kind of work together on some kind [1:16:35] of program that can work with the [1:16:36] rest of the staff and bring back to [1:16:38] us to kind of help get some of [1:16:41] these unpermitted adus [1:16:43] or whatever they may be in the city [1:16:44] running. And [1:16:47] so I think with that , maybe also [1:16:48] not [1:16:50] something that [1:16:51] I know government already starts dragging [1:16:53] and making it very difficult [1:16:56] with the process. I think it should [1:16:57] be [1:16:58] something that could be efficiently done. [1:17:03] just to get these individuals and [1:17:05] for us also as the safety purposes [1:17:06] and [1:17:07] code enforcement. To make sure everybody is [1:17:11] legal and everything is done appropriately. [1:17:12] I [1:17:13] don't know your thoughts on that.
