[0:07] Please stand for the pledge. [0:13] I pledge allegiance to the flag of the United States of America and to the [0:18] republic for which it stands, one nation under God, indivisible, with liberty and [0:25] justice for all. Councilmember Brent, could you give us [0:29] prayer, please? Bow heads, please. Heavenly Father, we thank you for this [0:32] day, the blessings of this day, and we thank you for the blessings you bestow [0:36] upon our city and and hopefully it leads continue. And Lord, we ask for your [0:42] wisdom and guidance as we do the work of the city as we [0:46] come from the time of Easter, may we always remember even throughout the year [0:50] the sacrifice that you gave with your son Christ so we could have everlasting [0:54] life. And we remember that completely through [0:56] the year. In Christ's name we pray. Amen. [1:02] » [clears throat] [1:11] » Ms. Lewis, could I get a roll call? Green? [1:15] Patrick? >> Yeah. [1:16] Gibson? Here. Fox? >> Here. [1:19] Allen? Here. Brent? Here. Simmons? Here. [1:29] All good. Adoption of the agenda, everybody had a chance to look over it. [1:34] If so, I need a motion and a second. I move to adopt the agenda. [1:40] Second, Gibson. All in favor? Aye. Aye. Any opposed? [1:48] Approve or correct work session minutes of March 11th, 2026, work session [1:52] minutes of March 16th, 2026, and regular session minutes of March 17th, 2026 and [2:00] special session minutes of March 30th, 2026. [2:05] Everybody's had a chance to look over that. I need a motion and a second. [2:09] Make a motion to accept, Your Honor. Second, Patrick. All in favor? Aye. Aye. [2:15] Any opposed? Aye. Moving on down to committee reports. [2:19] First up, we have community community development and code [2:23] committee. That's council members Allen and Simmons. [2:32] Go ahead. All right. [2:35] » [clears throat] >> I'm sorry. I'm just now [2:37] getting a chance to see this. Good night. [2:39] I'm just now seeing it. It was obviously available. [2:43] Um looks like a total of 31 uh [2:48] requests for permits. Am I not reading that right? [2:53] Am I? Yeah, 31 issued. [2:56] Uh 31 issued. Uh for [3:01] We collected $770 on those on those 31 requests. [3:10] So, you got That's it. Thank you, Mr. Allen. Mr. Simmons, do [3:13] you have any other? No, sir. No report. Next up, we have public relations and [3:18] public safety committee. That's council member Gibson. [3:23] Thank you, Mr. Mayor. I have the monthly report for the fire department from [3:28] February 24th to March 30th. The March fire department responded to [3:32] five fires in the city, one fire in the county. [3:36] We responded to nine hazardous situations in the city and two in the [3:39] county. We responded to 12 medical calls for the [3:42] city and two for the county. We responded to 18 non-emergency calls [3:47] in the city and three in the county. We responded to 16 public service calls [3:52] in the city and one in the county. We responded to two service calls in the [3:57] city, a total of 71 calls. And I also have the [4:02] annual report for the fire department for 2025. [4:08] March of fire department responded to 42 fire calls in the city, 34 in the [4:14] county. We responded to one overpressure rupture [4:19] explosion, overheat non-fire. We responded to two [4:24] uh 266 [4:27] rescue medical calls for for the city, six for the county. We responded to 35 [4:34] hazardous conditions in the city and two in the county. [4:37] We responded to 104 service calls in the city and six in the county. [4:42] We responded to 68 good intent calls in the city and nine in the county. [4:48] We responded to 64 false alarms in the city and 10 in [4:53] the county. Total calls of [4:56] 657. Uh mutual aid received two times, mutual [5:03] aid given eight times, casualties uh civilian zero, firefighter zero, [5:09] individual uh injuries with civilians zero, firefighters are [5:15] zero. Property uh and content loss 2 million [5:19] 41 and 70. Uh pro- property and content [5:24] saved 2 million 266,830. [5:29] That would be the end of my report. Thank you, Councilman Gibson. [5:35] Next up, we have Municipal Services and Personnel Committee. That's Councilman [5:39] Brent and Green. Uh yes, Your Honor. First, we have the [5:43] stormwater tip for the month. And that is properly dispose of all [5:47] rubbish and trash that is left in your yard on the street. [5:51] It will eventually end up in the closest ditch with which would either that or [5:56] the residue will end up in our ponds, lakes, streams. So, [6:01] try to keep that picked up cuz where water storm water flows, everything [6:04] goes. Um the only other thing I have is, you [6:08] know, later on the meeting we have our um [6:11] surfacing program um bids. Randy Ann will be going through [6:16] those. Uh but those are an agenda item later [6:19] on. Councilman Green, do you have anything [6:23] to add to that? No, not at this time. Okay. Thank you. [6:28] Thank you, Council member Brent. Mr. Green, thank you. [6:32] Next up, we have property, finance, budget, and audit committees as Council [6:36] members Pappert and Fox. [snorts] Uh [6:40] » [clears throat] >> halfway through the fiscal year [6:42] the end of March is halfway through the fiscal year. Uh revenues at 9.75 [6:47] million, expenditures 9.8. Uh according to Ms. Klingner, [6:51] everything's looking great. Um Also during [6:55] March, uh two grants were received. Uh the police department received a grant [7:00] for $80,000 approximately. And the airport received a grant for [7:04] approximately $200,000. [7:08] That's all I have. Thank you, Mr. Pappert. Mr. Fox, do you have anything? [7:13] Good. Moving on down, we have city administrator's report, Mr. Kerman. [7:18] Thank you, Mr. Mayor. Couple updates uh especially on on the LaPaz sinkhole from [7:25] the last meeting. Uh we had the city engineer's crews um come down right [7:29] away. Um they had attempted a fix previously uh [7:34] that was insufficient. Um Lamp Rynearson actually had Randy's crews open that [7:39] hole and create used a camera to create a 3D scan of the collapsed box and the [7:47] other junction boxes. If any of you have seen the pictures that Randy has from [7:50] under there, there's a very unusual um uh [7:55] conglomeration of different size and different types of pipes coming together [7:59] in those boxes. Um what this model is going to do is allow them to perfect the [8:03] geometry and hopefully design a precast structure, which is what they believe is [8:08] the fix that's necessary in the in the best way to protect the business that's [8:12] so close to it uh that can be dropped in there. Um [8:16] they're going to be on site. We are probably another week away from having [8:20] the geometry perfected on that 3D model. Uh the issue with the precast is that um [8:26] even under an expedited order, it could take 4 to 8 weeks for them to actually [8:30] cast and deliver the structure to us. We are trying to move this project along as [8:35] as quickly as we can. Uh there's a few other um [8:40] issues that we'll need to talk to the city engineer about about whether or not [8:44] um the work is too deep for local crews to do or whether or not that needs to be [8:48] bid, which could also cause some delay. So, I'll keep you updated as as we work [8:52] on that. I I expect that we're going to have uh updates at the next meeting and [8:55] probably the one after that as well on on the LaPaz hole. [8:59] Um an update uh also on on Cotton Street and Councilman Green had asked for some [9:05] updates on the situation out there. Uh ESS, who was the engineer that led that [9:09] effort, had created some um of the documents that detailed the parameters [9:15] and the widths of the construction easements, [9:18] um but they had not sent those on to our stormwater engineer, Christine Lubrick. [9:23] Uh she has reviewed those and uh returned them. And uh we expect to be [9:28] collecting signatures on those easements uh later this week uh with help from the [9:34] uh city attorney. I'm sorry, the uh city engineer here off the clock. [9:40] » [snorts] [cough and clears throat] [9:45] » Yes, also want to mention Eastwood. You know, [9:48] we've got a big FEMA project over there that we took out of the hands of one [9:52] engineering firm a couple of years ago that had missed a deadline or two [9:57] and sent that over to ESS. ESS is now working [10:01] in conjunction with the city engineer and they have secured all of the [10:05] easements that are necessary for that drainage mitigation work over there. [10:10] However, and this is this is fairly important because these are federal [10:14] funds. Two of the property owners have asked for appraisals of their easements [10:19] and then this is their right to do and we have to provide those. It's going to [10:24] be a little bit tricky both because the easements lay in a [10:28] flood plain, but more specific to these easements is that [10:31] there's an existing utility easement already there. Both of those things kind [10:36] of devalue the property so it can be challenging to find comparables that the [10:41] federal government will accept as adequate to to provide that feedback. [10:46] So, we're going to continue to work with those two property owners and hopefully [10:50] get those secured. Along the lines of easement acquisition, [10:55] the tap granted Miami and College, all of the easements are in but one [11:00] and that one is just hung up in corporate. We're told that it's [11:03] forthcoming, but their corporate office has been [11:06] taking their time with it. We really expect to have that soon. [11:10] Once those easements are here and recorded, then the right of way at the [11:14] state will clear them and issue the notice to proceed for the actual [11:19] construction to to begin on that on that tap grant which is for sidewalks and [11:23] improved crossing at the intersection. And then just one mention since we've [11:28] got some of our partners from MMU here tonight, Uh did get an updated list of [11:34] uh streets from the underground utilities from Grant Piper today to [11:38] complement any street work that we do in the future and we appreciate their [11:41] diligence sharing that information with us. So, happy to answer any questions [11:45] that you may have about these or any other items. [11:48] Mr. Chairman, one thing I know it it hadn't been brought up for a while, but [11:52] on College Street, um if you're heading east going up the street at Miami and [11:58] College, um no, I didn't Let me tell you back. If you're heading west, don't [12:03] forget about you know, they took out the turning lane. Yes. To Have we got any [12:07] update on that deal? I When we When we brought the city [12:11] engineer in to that part just to kind of function as a review agent, um we we [12:16] brought that up. It We're Again, we're not certain that MoDOT is going to allow [12:20] any additions to the scope of the grant, but that doesn't mean that that work [12:24] can't be still be completed by by the city itself. So, uh more than likely uh [12:30] what will happen based on that meeting that we had between ESS and Lamp [12:33] Rynearson and the city staff is that assuming that there's um that MoDOT [12:37] doesn't open the door to including that um the issue with the turn lane and the [12:41] and the signals and the funding, uh that they will complete the grant [12:45] requirements. ESS will complete the grant requirements to MoDOT's [12:49] expectations, and then Lamp Rynearson would come back and add or or or modify [12:54] as as necessary. Um that's kind of the plan now. We We should have a little bit [12:58] more information uh soon. Right now, we're really not getting any [13:02] construction feedback because right-of-way is still waiting for those [13:05] easements. Okay. Thank you. >> [snorts] [13:08] » Mr. Chairman, the uh smokestack property, I was out there last Monday. [13:11] That's the last time I've been out there. Has I mean, have they been Is [13:14] that ready to go yet? Uh it's very, very close. Um they're they're they're [13:18] breaking concrete uh in a couple areas now and working. I know the mayor's been [13:22] out there a couple of times uh talking with Randy uh as well as other staff. [13:26] And um yeah, it looks better and better every day. So, we're getting very close, [13:30] but I don't think as of today that I would call it complete yet. [13:32] » Okay. [13:36] Are those [snorts] improvements satisfactory to the school board? Or the [13:42] board, I guess. But, I mean, are we headed in the direction where [13:45] they'll they'll be satisfied? >> I hope so. I think the um [13:49] I think the discussion that the finance committee had with Randy out there after [13:52] their meeting um were the the that they were trying to [13:56] address that very issue. Um and and yeah, I I think from the top, [14:01] especially when you're standing up at the school property, it looks Randy's [14:04] crew did a great job. It looks a million times better. From the bottom, we've [14:07] still got that final um tier where the loading dock was, [14:11] uh and that's what he his crews are chipping away at right now. So, [14:15] um I'd say, depending on where you're [14:17] standing, uh it looks more acceptable than it may, [14:21] you know, if you're standing uh down the hill by the ramp. So, but I think that's [14:24] going to improve here very quickly uh as he continues to remove that loading [14:28] dock. Okay. Very good. [14:32] Is that your report? >> It was. I got another question for you. [14:35] So, go ahead, and then I'll ask you that question. [14:38] Thanks, Mr. Chairman. Thank you. Um my report was done by Mr. Pepper. [14:42] I'm just kidding. Um to answer your question about that, we [14:46] did I've been out there talking to Randy, um and it looks 100% better. [14:51] And they're busting up all the footings, all that stuff. I mean, he's actually [14:56] making a lot of progress. >> Okay. Um also, his crew went out and [15:00] kind of started mowing around the building and moved the pile. Um [15:05] hopefully, our plans or whatever is to get it where people can fish on the back [15:09] side of it and get all of it cleaned up around down through there. [15:13] But, they have been working on it. It looks it's starting to take shape. It's [15:17] looking really good. So, probably what, another [15:22] couple days, a week. They'll have it pretty much all done and [15:25] then hopefully with that done, um then we can kind of get the first phase [15:32] or the first part of this contract done. Yeah. Um and close Cuz when's the [15:37] deadline? May 1st. May 1st or something. May something. I think It's the 1st. [15:44] So, that's kind of the goal and Good. hats off to y'all cuz they really been [15:49] hitting it hard. It looks good. So, we're getting there. [15:52] Good. [15:55] Other than that, that's my report. Okay, that's my [15:59] report. You had a question. I was going to ask. [16:02] No, it's okay. Okay. Moving on. [16:08] Uh next up, we have business from the audience. [16:11] It's limited 3 minutes per speaker. Any person, resident, or non-resident [16:16] wishing to address the council may approach the microphone at this time, [16:20] state their name, and their comments. It's 3 minutes. [16:25] Oops. [16:35] Yes, my name is Richard Rodden. My [16:39] uh complaint is about the police department. [16:44] I have here recently, I've had problems with noise [16:49] complaints in my neighborhood. I'd call [16:55] an officer would show up. >> [sighs and gasps] [16:59] » I think the first one was badge 130. He told me that this was at 3:00 [17:08] in the morning. [17:11] He told me, "No, I'm not going to go over across the road and go to that [17:18] I'm not going to do my job. It's basically what he told me. [17:25] So, I had to sit there the rest of the night after he left. Now, 10 minutes [17:31] after he left, a car pulled up in front of that house, [17:37] and a person come out of that house, got a car, and left. [17:44] He didn't want to wake nobody up. He didn't want to investigate. [17:49] » [snorts] >> The officer before that, badge 142. [17:54] This was back when there was snow on the ground. It was cold outside. [18:01] He didn't want to do his job, either. He told me, "No, I'm not going to go over [18:06] there. I'm not going to do that. I don't cuz [18:10] when he pulled up, they turned the music off. He says, "I don't hear no music. [18:16] Until I hear music, I'm not going to do nothing." [18:25] So, you know, what's the point in calling the police [18:30] if the police aren't going to do their job? [18:36] Is my point. What is a citizen supposed to do? A [18:41] taxpayer? [18:47] Is what I'd like to know. [18:53] Just yesterday, I got a ticket for driving my tractor, lawn tractor. [19:00] Mind you, there was a couple protest signs on it. I had come back from mowing [19:05] a buddy's yard. [19:09] On my way home, I decided I'm going to circle the police department a few times [19:16] and then I'm going to sit in front of the police department for a short period [19:20] of time, then I'm going to go home. [19:23] I sit there, out comes an officer, badge 114, [19:29] and writes me a ticket for driving my lawn tractor. He's classifying it on the [19:36] ticket as a motor vehicle. [19:43] If you look underneath the Missouri law statutes, it is listed underneath farm [19:49] machinery. >> Mr. Rodden, that's your 3 minutes. Mr. [19:53] Hudson, would you Thank you. We'll talk about this. [19:58] Anyone else like to approach the mic at this time? [20:09] I'm Randy Duett. I'd like to see about getting some 30-minute parking signs on [20:14] the south side of the post office. There's seven spots there. One's [20:18] handicap and the other six are being tied up 8:00 to 5:00 every day, [20:23] Monday through Friday, by I'm not sure who, [20:27] but that that's so nobody of the 575 personal mailboxes in there, people have [20:33] got to park on the far side of the street, [20:35] cross over, get their mail, cross back across the street, and a lot of those [20:39] are senior citizens. And that's kind of an unsafe situation, [20:42] I would think. I think if we had the 30-minute signs [20:46] there, there were some 10-minute signs and 1-hour sign, but they've been [20:51] removed. So, [20:54] anybody can park there all day, I guess. But I would think being the post office [20:58] that they would want to let their customers come in and get [21:01] their mail on time without worrying about trying to, you [21:04] know, get hit across the street back and forth. [21:08] That's uh that's basically what I'd have. I just think it'd be a safety [21:12] issue there to go ahead and have that done. 30-minute signs, I think, would uh [21:16] would be sufficient for sure a person to get in there and get out. [21:20] Okay. Thank you. Thank you, Mr. DeWitt. Thank [21:23] you. [21:26] Would that fall under [21:35] Mr. Gibson. Yeah. Can you kind of do a little bit of research on that? Yeah, [21:40] absolutely. We'll look into that. Thank you. [21:44] Anyone else like to speak at this time? [21:54] My name is Keith Zinn. And I agree with Randy there. That is uh [22:01] bad signs. You get elderly people trying to get into the post office. [22:06] And they just took the signs down. That that just a free-for-all for them trying [22:12] to get in. Elderly people is what I was referring to. [22:16] And uh [22:18] our former mayor, is that lawsuit settled? [22:24] I don't There's not a lawsuit with the former [22:27] mayor. It wasn't with them? No. Well, I thought there was. No, sir. [22:33] Huh. Okay. So, yes, it's settled. Never was one. Never was one. Hm. Okay. [22:41] Uh how much does RTS pay the city for [22:46] tearing up the streets? [22:50] We don't collect anything from RTS for their street or for their pick their [22:53] truck usage. Hm. Well, I [22:58] got some pretty good information that's $250,000. [23:04] Uh well, if it is, I don't remember it being in the contract. So. [23:09] I said, "Well, I'd like somebody to look at that because what I got is pretty [23:14] reliable." And [23:18] he uh I said, "My God, $250,000. [23:22] Wow." But, I could've misunderstood him, but I [23:25] don't think so. Thank you. We'll find out. Let's examine [23:30] it and get back with you. Drew, [23:33] Dan, can y'all check into that, JD, please? [23:38] We'll get you an answer. Yes, sir. [23:42] » [clears throat] [23:46] » Anyone else like to speak at this time? >> [clears throat] [23:53] » Moving on. Randy, [23:58] moving up, the next one we have is uh the mowing services. [24:03] And what I have here is uh [24:06] it says on March 25th, 2026, bids were opened for lawn mowing services at city [24:12] office building, Martin Martin Community Center, and Municipal Court in Marshall. [24:18] Um there was only one bid that was received. [24:22] And that was with Quality Lawn Care. That is $200 per mowing. [24:28] Anybody got any questions about that? Is that for mowing all three locations or [24:33] $200 per location? It's for all three locations. [24:37] » Is this in line with the last year's? Last year was $195 per mowing, so it's [24:42] $5 increase per mowing. Gas prices. [24:46] » [laughter] >> Amen. That's generally followed a $5 [24:50] increase annually. [24:54] If everybody's okay with that, um I'd ask for a motion in a second to [24:59] approve quality lawn. I make a motion to approve. Second. [25:04] » Second, Alan. Ooh, he was You got to speak up, Harold. You got to [25:08] speak up. All All in favor? Aye. Aye. [25:13] Any opposed? [25:19] Next up, we have the lawn [25:23] um, fertilization services. This one here was on March 25th, 2026. [25:29] Bids were opened for lawn fertilization services at City Office Building, Martin [25:34] Community Center. Um, one bid was received as follows, and [25:39] that was with Easy Green Professional Turf Management. [25:44] And that is an amount um, well, it's recommended that we go with that one, [25:48] but it's an amount of 1,440 bucks. Is that for a year or for the [25:54] year? >> That is for the year. Last year was [25:56] 1,350. [26:01] If everybody's okay with that, I'd like to ask for a motion and a second to [26:04] approve that. Move to approve. [26:08] Second, Patrick. All in favor? Aye. Aye. Any opposed? [26:18] Next up, we have um, oops. [26:25] 2026, that's a micro-surfacing program. [26:30] Brandy, do you want to talk about that one real fast? Can you ex- or Dan? [26:35] Yeah, we this is um, this is the slurry and [26:40] crack seal and and slurry, and this was you know, we we had the we got the [26:44] ballot issue today, and and as we said before, if that passes, [26:49] that we will be increasing this program. But, at this time, this is all we're [26:55] we're approving is this crack seal and slurry. [26:59] Uh we want to get it in the mail, basically, and uh we have [27:04] two bids that were turned in, I believe. Yeah, one with um [27:09] Vance Brothers and the other was [27:15] was it Pavement Management? Yeah. [27:19] And um we've used both of these in the in the past. I you know, we're we're [27:23] been very happy with Vance Brothers and they came in with the low bid. Also came [27:28] in um under the [27:32] estimated engineers' estimated bid, also. [27:35] So. Uh would be the recommendation from [27:40] Municipal Services to accept that bid and from [27:44] our uh director. Okay. You What streets are these, do you [27:48] know? Mhm. What streets are we doing? [27:52] Uh I [27:53] we don't have it right here, but we've got it we've got a program showing what [27:57] we're going to do. Um it may be [28:02] Uh Amory, it may be on that one that's on the website, isn't it? Or it would be [28:07] real close. I don't know. I think it is up there. Yeah. [28:11] Yeah, we had the mill and overlay and then we had the slurry [28:15] uh crack seal and slurry coat. So, this would be the crack seal and [28:19] slurry coat, but there's no there's no mill and overlay here. Good.
