[6:40] What are you doing? >> Hey [7:03] Hey, look. It works. [7:42] [Music] [8:19] [Music] [8:40] You sound like the other [8:47] [Music] [9:24] That's right. [10:38] I didn't think about that. [11:00] Good evening. It is 6:30 and we are going to uh call this city council [11:06] meeting to order. Tuesday, September 23rd, 2025. [11:10] And with that, we will go into our invocation. And uh I'm actually going to [11:17] do the invocation tonight. So, if you'll please stand. [11:26] Lord, we come to you for guidance, wisdom, and grace in the oath we take to [11:31] serve the citizens of this city. We ask that you give us that understanding to [11:35] listen better and speak with our hearts that look to serve. [11:40] We come wanting understanding, Lord, as we have all seen the tragedy that took [11:43] place and touched our nation. The loss of Charlie Kirk should be the reminder [11:47] that we should live Christlike. While the battle cry may say live like Charlie [11:52] or I am Charlie, it is simply a way of the reminder that we can all love like [11:56] Jesus. We can find forgiveness in those that [11:59] trespass against us because that is what our savior did for us when he laid down [12:03] his life. So if you will all join me. Our father who art in heaven, hallowed [12:10] be thy name, thy kingdom come, thy will be done on earth as it is in heaven. [12:17] Give us this day our daily bread. And forgive us our trespasses as we forgive [12:22] those who trespass against us. and lead us not into temptation, but deliver us [12:28] from evil. For thine is the kingdom, and the power, and the glory forever and [12:32] ever. Amen. >> Mr. Good, will you lead us in our [12:37] pledges? [12:41] To the flag of the United States of America and to the [12:47] stands nationy [12:52] and justice for all. [12:57] flag. [13:01] One state under God, one and indivisible. God bless Texas. [13:17] » Pretty sure I threw everybody because I don't normally do the prayer. [13:21] Um, so our rules of decorum, I always uh just pull a name from this jar up here [13:28] and we honor somebody uh whether they were law enforcement or military and we [13:32] dedicate the meetings to them. And this one is John McDonald. And so we will [13:38] honor him tonight in our meeting. And with that, we will uh treat each other [13:43] with kindness. So that's going to bring us up to our [13:48] proclamation. Yay. [13:52] » So, I'm gonna start this off real quick. What does one say about a person who has [13:58] shown courage to stand up and serve? Who has shown compassion when working with [14:02] people? Who has shown understanding when listening to the people whom she comes [14:06] into contact with? How do you say thank you, honor, and make sure they know they [14:10] are valued and appreciated for all they do and have done? And I have no doubt [14:14] will continue to do even after she steps away from this seat. Maybe the best way [14:19] to do it is serve as Bev has, but just make sure to hold a better poker face [14:23] when the topics are not so fun. Here's the thing. I firmly feel and [14:29] believe that this city is better because of Bev. It is said, it was said by Teddy [14:33] Roosevelt, "Walk softly and carry a big stick." And honestly, if you go with the [14:37] meaning behind it, it means to approach situations with a gentle demeanor and be [14:41] prepared to use strong measures when necessary. A lesson we should all [14:45] remember not only in saying but doing. Bev has taught me a lot and in many [14:49] cases how to have a better tamed tongue and sit back and take deep breaths and [14:54] focus on moving forward and doing good things. It isn't about getting in the [14:58] mud and rolling around and getting dirty. It's about the windshield. It is [15:02] much larger than the rearview mirror. Unfortunately, it took me a bit of time [15:07] to concede this as I am a stubborn Taurus and I do not [15:13] like to sit quiet sometimes. Bev will be missed and I will continue to lean on [15:17] her for her mentorship even though she will be absent from the office of city [15:21] manager going forward. Bev, you are truly a good person. You [15:25] took things on the chin even in our disagreements on many matters. You [15:28] always remain professional, kind, and more so my friend. I love you. You are a [15:33] rock and you will always be the first city manager of Mlennon Chisum and we [15:36] thank you for your service. [Applause] [15:50] [Applause] [15:59] sit downclamation. If I could sit down, I would. But then [16:05] got to do this proclamation cuz she loves all this kind of stuff. [16:10] It's >> the third time today we've won this. [16:13] » It is the third time today we've done this. Uh Be was recognized this morning [16:18] at the county commissioners uh court um where they relished in embarrassing her. [16:24] Uh today at lunch we uh were able to do that again with the state rep uh state [16:30] rep's office, state senator's office, and uh Congressman Found's office as [16:35] well. And uh we get to be the ones to do this. So I apologize if y'all notice [16:40] this proclamation and then staff will present her her road sign and a couple [16:46] other little things and then we'll get into business. I apologize. So [16:50] proclamation whereas Bev Stevens a 1973 graduate of Pana noise married her [16:57] husband Neil who she met on a blind date in 1976 [17:02] and married in 1977 and moved with him to Mlendon Chisum in 1980. [17:08] Whereas before acting as our intern city administrator, Bev has been part of our [17:13] part of several nonprofit organizations such as American Heart Association, [17:17] Dallas Area Habitat for Humanity, and Volunteer Center of North America. [17:22] Whereas Bev has many talents, including being a trained florist with a true [17:27] green thumb, she also enjoys travel, traveling with the world with her [17:32] husband and loves cruising. Whereas between cruises, Bev has had a [17:38] firm belief in serving and being a part of her community. Over the years, she is [17:42] involved in all parts of her community, including helping hands, Rockwell open [17:46] space alliance, women in need, and the chocolate indulgence committee. [17:52] Whereas in 2003, she was citizen of the year of Mlennon Chisum and Rockwell I [17:58] will mess this word up. >> Seropimist. [18:00] » Sopimist nominee for woman of distinction. [18:05] Whereas [18:11] recent being that of the first to hold the title of city manager under our new [18:16] home charter, whereas Bev has served countless years in service of the city [18:20] and county, being on the city council for 22 years, a mayor prom for eight [18:25] years, chairwoman of the budget committee for nine years, commissioner [18:29] of planning and zoning, member of the concept committee, and commissioner of [18:32] the city charter 2024. war. Therefore, as Bev Stevens is the definition of a [18:38] servant leader, and it is with great pleasure and a humbled honor to be able [18:41] to recognize her for her outstanding service to the city of Mlennon, Chisum, [18:45] Rockwalk County, and the impact she has made. Signed, Ryan McNil, Mayor [18:52] [Music] [19:00] [Applause] [19:07] Yeah, >> because I made a huge mistake at lunch [19:12] for there. I left one very important person out and that is our city [19:18] attorney. He has stood by me through a lot of [19:23] different roles here and tried to keep me legal. I won't always [19:30] say he did, but a huge thank you to him. A huge thank you to this council, the [19:37] past council, the staff. You guys are great. Citizens couldn't [19:42] have better neighbors. So, Fabric, I wish you well. [19:48] You got a big problem on your hands. [20:01] Okay. [20:10] [Applause] [20:21] That's perfect. [20:41] Thank y'all for uh allowing us that time to honor Bev. So, I appreciate that. [20:47] I'd hope to embarrass her city business to do. So, let's get to it. [20:54] This will bring up citizens comments. Do we have any citizens comments turned in? [20:59] Does anyone want to speak before I close citizens comments? [21:03] Okay, we will close citizens comments. And that's going to bring us to consent [21:07] agenda. I will entertain a motion to accept a consent agenda unless anyone [21:12] sees something they would like to pull. >> I'd like to discuss 6.2. [21:20] » Okay. Is there any other items that need to be pulled? If not, I'll entertain a [21:24] motion to um approve the rest through consent. [21:29] » So moved. >> Is there a second? [21:31] » Second. >> All in favor say I. Please. [21:34] » I >> I [21:35] » I >> I. [21:38] » Okay. So we will pull 6.2. Um, discuss and consider approval of a [21:44] final plat that provides for the development of 406 residential lots and [21:48] seven open space lots on 105.099 acres of land located generally at the [21:55] intersection of FM 548 Nan Road. The Rockwell CAD property identification [22:00] number is 10985. [22:04] And I'll entertain a motion on this one to discuss and approve. [22:09] » So move. >> Is there a second? Second. Okay, it's [22:12] open for discussion. I'm going to turn this over to uh city manager, [22:18] city planner. >> Good evening, council. Um the applicant [22:23] is requesting approval of a final plat that provides for 406 residential lots [22:28] and seven open space lots. Um, in summary, uh, this project is tied with [22:33] several previous preliminary plat approvals and, uh, as a city in the ETJ, [22:39] we only have platting authority, um, for this case. So, the that being said, the [22:44] applicant is here if you do have development questions, um, questions [22:49] about his development as a whole, but as far as the city is concerned, I only [22:53] have, um, subdivision ordinance authority, platting authority. [22:58] » Mr. Paula, um, can you clarify something with me on the final plat? And the [23:04] reason it's on consent agenda is because when it's a final plat, [23:08] unless there is some crazy legal reason, if the eyes are dotted, te's across, [23:12] stables are in the right place, we've got to approve this or the shot clock [23:15] approves it anyway. Is that correct? >> You would be correct, Mayor. Under [23:18] 212009 of the LGC. If it's uh administratively [23:22] complete, which literally means is it stapled in the right spot? Is the fee [23:27] paid? all that kind of thing, right? Copies and is it in technical compliance [23:31] with our subdivision ordinance? If both of those answers are yes to each of [23:36] those questions, the council doesn't have a choice and we have to approve uh [23:40] the plats. They're they're the most unique land used animal that we have. [23:45] » Which is why if we do know that it's already in compliance and it's complete [23:49] and everything's good to go, putting it on consent just allows us to move things [23:53] through a little bit faster. >> Absolutely. I I appreciate council [23:56] member Goodman pulling this because many people don't understand u on the citizen [24:03] side. They just see something that we're just trying to slide through and that's [24:06] not the case. If there was something that needed to be discussed, it wouldn't [24:09] be on their consent. It would have been in the regular agenda. That's the city [24:12] manager's place to put that there for us. So, uh [24:16] » no, that's correct. As per usual, when cities have difficulty with land use, [24:21] it's the state legislator's fault and that's the case here. So, [24:24] » okay. So, does that reach you what you needed or do you need you have anything? [24:28] » No, I got a few things I want to clarify. [24:29] » No doubt. >> Just just so kind of the public is [24:33] aware. We didn't This is so far outside of what our community wants here in [24:38] Mlennon Chisum. This is an ETJ. It's on the border. It actually is half Kaufman, [24:43] half Rockall County. Correct. Or >> no, I believe it's almost entirely [24:48] Kaufman County. >> Okay. [24:50] Um this was no plan development or anything that we did here. This was [24:56] » there is no executed development agreement or plan development district [25:00] agreement. >> Okay. [25:02] Chief Stow. >> Yes. Does this affect fire district 22 [25:08] at all? >> No sir. This is uh part of the MAM [25:12] project and they have a emergency services contract with uh ESD in coffin [25:17] county. >> Okay. So no impact to the fire district. [25:21] There's really not much we can do but approve. [25:26] » As far as the plat is concerned, that is correct. [25:30] » Thank you. Does anyone have any further questions [25:34] on this one? Okay. So all those in favor say I. I. I. [25:41] I. I. I. All right. I I >> believe that's unanimous. [26:00] Okay. So, this brings us up to uh item 8.1. [26:08] Discuss and consider approval for the donation of a 1995 Pierce Fire Engine to [26:13] the North Texas Fire Academy for training. I'll entertain a motion. [26:19] » So moved. >> Second. [26:21] » Second. >> Open for discussion. Um, city manager. [26:26] Good evening, mayor, council members. Uh this item before you this evening is [26:30] regarding uh donating a 1995 Pierce Fire Engine to the North Texas Fire Academy [26:37] for uh purposes of training in exchange for $10,000 equivalent in uh training uh [26:46] credit. And as I understand it, that would be in addition to the already [26:50] granted uh $10,000 worth of training credits. Yes. Uh, with that said, staff [26:58] does recommend approval of this item. We have in the audience with us, Mr. [27:03] Michael Simmons that is here available for any questions if you should you have [27:08] it at this time. [27:13] » Yeah, I got you. >> Mr. London, do you have any questions on [27:17] this? >> No questions. [27:18] » Mr. Towry, >> Mr. Brew, [27:22] » if I understand this right, this truck has been there for quite some time. [27:26] » Yes, sir. >> And the only thing that actually [27:28] operates on it is the pump part. Everything else is pretty shot. [27:33] » So, you're correct. So, in 2018, it had been stored there for storage offsite. [27:38] The department still had used it on and off for different types of training and [27:42] all that. It was no longer a primary apparatus. One of the main reasons it [27:45] was stored is because it failed a pump test. So in order to get the pump back [27:49] to original working condition, we would have to invest a little bit. But for [27:54] what we do and function properly, putting it back on the street and using [27:58] as a first out or second out or third out. [28:00] » No sir, you are correct. >> Mr. Dean, [28:06] » I'm good. Thank you. >> Mr. Goodwin, [28:10] » I'm good. >> Mr. Powers, good. And I have no [28:14] questions. So, uh, >> and excuse me, just to make notes, we [28:17] are getting the C logo removed from the truck, correct? [28:20] » Absolutely. [28:24] » Anything else from staff, chief? All right. I'll since we've had the [28:29] motion in a second, all those approved say I. [28:32] » I. >> I. I. [28:36] I. >> I believe that's unanimous as well. [28:39] » Mr. Simmons, our finance director, has the title. He is signing it over to you [28:43] right now. >> He's got the title. Sign it over to you [28:46] right now. >> Oh, good deal. Thank you, mayor, council [28:50] members. Appreciate it. Thank you very much. [28:52] » Thank you, Chief. >> That brings up item 8.2, [29:00] discuss and determine whether the proposed site plan conforms to the [29:04] Crossroad Plan Development District. [29:08] Before I call Mr. very up on this. Let me ask you a question. Being that this [29:14] is where this debate, does that mean we can take action? I [29:18] mean, I don't So, discuss and determine whether the proposed site plan, it [29:21] doesn't say discuss and approve. [29:28] » So, are we good? >> I mean, I'm still going to have him come [29:31] up and speak. I just >> So, so I can take Do I need But I guess [29:35] what I should ask it this way. I need to still take a motion in a second, right? [29:41] » I don't think so because the way that this the way it looked like it was taken [29:45] from is from 5-1, I think it's D of our uh zoning ordinance, the plan [29:51] development district, what that talks about when they talk about uh [29:55] conformance to the plan development and all that other information. That's when [30:00] when establishing a plan development district. this was established. [30:04] » Well, I'm talking about on this the way it's worded. It's so discuss and [30:08] determine whether the proposed site plan conforms to the crossroads. It should I [30:12] mean >> I don't think so because I don't think [30:14] there's a motion that the council can take. [30:16] » So then I can let him still speak. Correct. Say yes. Okay. [30:19] » Mr. Barry. [30:28] Good evening, mayor, uh, council, members of the staff. [30:33] U, I think you may go into executive [30:37] session. I'm not sure it's shows to be here. I'm sorry that um, we're kind of [30:43] going out of order here. I'm not 100% sure why uh we are having to come here [30:49] with the exception of the fact that we have a site plan um that was submitted [30:55] for approval on uh a 7 acre track that we have on the east side of uh State [31:04] Highway 205 at the intersection of 205 and 550. [31:09] Um there's a couple of things that I think point out um that kind of tie and [31:15] coincide together here tonight that I think that um ultimately we need to look [31:21] at ultimately in your packet what you have in front of you and the request of [31:27] sames suggests that the council is to interpret whether or not our plan [31:31] development is in conformance. Um there's certainly developers that [31:36] have done this a lot longer than I have, but this is a first for me. And so, um, [31:41] it seems as though we're going a little bit out of order, but, um, your city [31:46] planner has suggested that the site plan application that we had by 7-Eleven, um, [31:52] as the enduser through a developer by the name of Verd, [31:57] um, who is a buyer from one of our holdings, uh, submitted a site plan [32:02] approval that was ultimately rejected by the city planner. Uh, when [32:10] here tonight. Uh, and I do apologize that you have 80 plus pages in your [32:15] packet tonight. There's two things if you were to go break out and I'm happy [32:19] to talk at length in whatever capacity you'd like to. There's two things that I [32:23] think that we need to look at tonight. One is ultimately the rejection which [32:28] suggests that we are not in conformance. And I trust that you uh received in your [32:33] packet and saw in exhibit I on page 209 and 210 a two-page letter that I [32:41] concluded by providing five or six reasons very specifically stating as to [32:46] why I believe this is more in conformance than than not. [32:51] And the second thing that we have to talk about tonight is an already [32:55] approved plat that uh took place at the December 10th [33:01] uh conclude who our ultimate enduser was going to be and that the mayor and the [33:06] city manager had the authority to make interior lot line changes. [33:11] And so as part of our site plan approval, we sent the uh plat reflecting [33:20] a uh 2025 date in the signature blocks in [33:25] lie of the 2024. and we adjusted the interior lot lines [33:30] in two different places and uh would just point out for the record that none [33:35] of the exterior perimeters have changed. So, um you received in your packet um [33:44] 80 plus pages and um beginning on page 132 [33:51] through 134 in your packet, there was ultimately five different sections of [33:57] reasoning as to why that this was rejected [34:01] uh by nonconformance. And so if now is the time, I would be [34:06] happy to go through those, but I want to respect the process and um go through [34:12] that. I would ask when it comes to the plat that you get the official word from [34:18] your city attorney from a vested rights perspective. It's my firm belief that we [34:23] established that back on December 10th of 2024 [34:28] and uh feel with certainty that he will agree with the same. But I would ask [34:33] that you not ask me my opinion because I'm clearly trying to move forward with [34:36] a development and a disposition of an asset and would like for you to get that [34:41] blessing from him. But I can't move forward with the development of 711 [34:48] without going through a site plan approval of which I feel that we're in [34:51] full conformance with from what I now understand that we have to add a layer [34:56] of government to the process by getting your blessing of conformity. So, I guess [35:02] my first question, Mr. Mayor, is is do we want to go through this in in [35:08] great detail now? Would you like an opportunity to meet with the council? [35:11] How would you like for me to proceed with my my questions? I would actually [35:16] be okay with hearing your input. Um, and I and I would think the council would [35:22] agree to hear it all now, if you're okay with it. And and [35:27] time. I'm okay with the time because one thing that I want to make very clear is [35:32] as a city, whether it's an elected or a staff, we have to be better and we have [35:37] to make sure that we're here to serve you. Whether you're a developer or a [35:41] citizen, you're coming to our city and that's that's our role is to serve. So, [35:47] I respect your time. If you're willing to share your input, I'm taking notes [35:51] because I think it's prudent to do so if everyone's in agreement. [35:58] Okay, fair enough. And I appreciate that. Um, unfortunately [36:02] um I'm dealing with a city planner that's stated no less than four times [36:07] that they don't support our use nor our user. And um [36:12] he's told me that uh he's told that to my partners. He's told that to myself. [36:18] And I would respectfully tell you that you're out of bounds and you don't have [36:21] that authority. We're inside a plan development district and we're in [36:25] conformance. And with that, I would proceed forward. The first thing that we [36:30] want to talk about is uh conformity. If I could get you to direct your [36:35] attention to page 185 inside your packet, um you will find my letter and [36:42] on the I apologize. Uh, page 132 of your packet. [36:53] » I'm going to interrupt real quick. So, the way that [36:56] » the information that we have is not structured the same way. So, whenever he [37:00] calls out a page number like that, >> okay, [37:02] » it's it's broken up differently for us. >> Fair enough. Thank you, Chief. Um, [37:07] inside your packet, it I believe it's listed as exhibit I and I I can't [37:12] confirm what page number it is. Um, in my packet it's I'll get a couple [37:19] of different versions. This one is 209. Let's see if that works. [37:22] » Is it the supporting documentation letter? [37:26] » Is it your letter? >> 209 and 210. And you see a letter that [37:30] was presented. Okay, great. If I could direct your attention to page 210 of [37:35] that in the last paragraph, I stated that we are grateful for the opportunity [37:40] to be heard by the city council where I look forward to further discussing this [37:44] matter. Please note the following in advance. One, the concept plan shows two [37:49] ingress and egress entrances on State Highway 205. So does our site plan. The [37:55] concept plan shows one ingress and egress entrance on FM 550. and so does [38:01] our site plan. The concept plan shows a fire lane generally from each of the [38:06] respective entrances. So does our site plan. Generally, the [38:10] concept plan shows two buildings north of the proposed entrance on state [38:14] highway 205. So does our site plan. [38:18] Ordinance number 2022-11 PD permitted uses states, and I quote, [38:25] "The uses allowed or prohibited in this plan development district are as [38:29] follows. Those uses allowed in the city of Mlin and Chisum GB general business [38:35] district namely convenience store with or without fuel sales is a permitted use [38:41] that does not require an SUP. We have a plan development district that [38:47] was approved back in 2022 [38:52] and we are not asking for any variances and our initial site plan approval [38:58] request is for a use that's permitted by right that doesn't even require an SUP. [39:05] Second thing that I want to point out tonight that I would respectfully ask [39:09] that you consult with your city attorney on is an already approved [39:16] final plaque that was blessed by unanimously by the council on at the [39:21] December 10th, 2024 meeting. And I would ask that you ask your city [39:27] attorney about our vested rights. And specifically, I would ask that you ask [39:33] for clarity in the direction that I was given by your city staff at that time to [39:38] hold off on your signature, Mr. Mayor, as well as the city manager or the city [39:42] administrator, I believe, at that time because we were working with two [39:47] different applicants at the time as who was going to be purchasing purchasing [39:52] the hard corner. and we were told that it was proper [39:58] for us to wait until that was identified, which is what we've done. [40:03] And so alongside our site plan application here, we submitted [40:10] the revised and current site plan that showed those modifications and addressed [40:15] the respective comments with Mr. Sherman in person to where [40:21] at the time we had a full understanding and what I understood to be complete [40:28] support same. Those are the two matters um on pages um [40:37] 132 through 135 in your 134 in your packet. You have five items noted by [40:45] staff, namely Mr. Sherman. One being the comprehensive plan. [40:52] And I would respectfully tell you that this is not about a comprehensive plan. [40:56] This is an already approved plan development district. I have utmost [41:01] respect for your comprehensive plan, but it's not applicable to this application. [41:06] Two, A through F. I can go through each of these if you [41:11] would like. 2 A, we have that included. 2B, we have a detention pond and a [41:18] letter from an engineer stating same that it's been removed and relocated. [41:23] 2C, if you would see page 212 of your packet, you'll see that that is actually [41:29] included. 2D is an absolutely ridiculous statement [41:34] that suggests that we're talking about limiting the amount of headlight [41:38] intrusion where I would remind you that it wasn't two city council meetings ago [41:44] where you had unanimous support of a plan development district by that was [41:48] approved unanimously by a good partner of mine and a good friend at the Chisum [41:53] Square that had 68 parking spaces alongside State Highway 205, 34 of which [41:59] are facing direct directly onto state 205. We have zero. [42:05] That wasn't even mentioned through any of that report. [42:10] 2E, we will meet the general business requirements for landscaping. [42:16] 2F is not true. See page 140 of your packet. There's another lot behind [42:23] 7-Eleven, not just the one shown in the site plan [42:27] where it suggests that we only have an entrance off of 550 going into the [42:33] northeastern corner of our project. Section three suggest proposed site [42:37] plan. 3A, not true. See page 140. 3B, we will adhere to the landscape [42:46] requirements in general business. 3 C we've provided an engineering letter to [42:52] address same 3D not true see page 212 3E we've already addressed 3F we've [43:03] already addressed we will meet the general business requirements for [43:06] landscaping 3G it's not true but respectfully that's not of city [43:12] authority it's a text dot requirement we will work directly with text dot as we [43:17] have Section 4 4A [43:23] respectfully you're not an engineer but we have provided a letter addressing [43:28] same and it will be further addressed whenever we're putting our civil package [43:34] together for approval. 4B we've already addressed. 4 C is a text issue. 4 D [43:42] we've already addressed. 4 E is absolutely not true. We have a fire lane [43:48] going through the middle of our property as indicated in the plans. 4F. [43:55] Not true. It's not in a fire lane. Five. I would ask that you just talk [44:01] with Mr. Hollow. council, [44:09] we have not been treated the way your precedents been set on recently [44:14] previously submitted and approved development packages. I don't want to go [44:19] there. We're simply trying to stay in the confines of what we bought. It was [44:24] an already approved, already [44:28] um entitled piece of property. We are strictly in the confines of conformity. [44:36] I've identified no less than a half a dozen examples for same and certainly [44:42] welcome further discussion. I would note for the record that no less than four [44:47] requests were made by my applicant to this gentleman right here to get [44:51] specific confirmations of what needed to be addressed andor to confirm that [44:56] everything was addressed inclusive of two additional requests made by me. to [45:01] receive zero remarks outside of a rejection stating nonconformity after I [45:07] commanded a reason for why. That's not the way we do business here. And I don't [45:11] think that you would agree with me. It's the way y'all want to do business. I'm [45:15] not trying to raise havoc. I'm strictly trying to do what we committed to you [45:19] back on December 10th when we brought in front of you [45:25] the final plat that we did where alongside same I provided for you an [45:31] amended a draft rather concept plan that showed almost to the tea of exactly what [45:37] we're doing. I'm here for any questions. I will happily see and I'll happily come [45:42] up and entertain anymore. I don't have anything else to address at this time. [45:46] One one second. So, Mr. Hollage, help me clear something up [45:50] here. Uh, Mr. Barry brought up the fact that it was not signed in December, that [45:56] would not have any weight whether it was signed or not signed since it was a [46:00] legislative action by the council. Correct. [46:03] » Correct. Once that uh uh once that ordinance was passed, the PL or the plat [46:08] was approved by the council, then it's approved as of that date. It's a [46:12] ministerial duty um by the mayor at the time to sign ordinances or plats or [46:18] whatever it is that the council has passed um unless there's a reason under [46:23] like for example resolution ordinances under 5203b the mayor's got it a he can [46:28] reconsider ask council to reconsider that but that doesn't change the fact [46:32] that once legislative body has made a decision boom that decision is made and [46:37] not signing it is not going to stop that >> so not an expiration date of [46:44] » whether it took 90 days or 365 days that legislative action was passed. It is [46:50] approved and it is done. >> Correct. [46:52] » Uh my other concern back to you, Mr. just so I can make sure I understand uh [46:57] cuz we will go into executive session because we have some other legal [47:00] questions to ask on this. But I want to be clear, you submitted six times asking [47:07] for to be told explicitly for what was [47:12] » I would not want to misrepresent on the record anything different than what I [47:16] stated in my letter. Um what I'm attempting to state for you is is after [47:20] we made uh the application I personally sat down with Mr. Sherman we sat down [47:26] and went through a number of pages of checklist provided receipts uh of [47:31] payment for same asked if we were good. Um I I certainly didn't ask him if it [47:37] was uh uh approved at that time and and never would have. Um um and following [47:43] that meeting um the applicant who is here um on the behalf of Verdad uh sent [47:50] four different messages to not receive any responses to of which I added two [47:54] additionals with a request confirming that we would be on the next PNZ meeting [47:58] which I believe at the time was the September 9th meeting [48:02] um and received no correspondence outside of a rejection stating that we [48:08] were not in conformance. Sir, >> gentlemen, before we go back into [48:12] executive session, Mr. Lone, do you have anything you want to get cleared before [48:15] we go back there that you're confused on? [48:18] » Just making sure there's no variances being requested. You're just going off [48:21] of what's already been submitted. >> To the very best of my knowledge, I'm [48:24] not requesting any variance, Mr. London. >> Thank you, sir. [48:27] » Mr. Towry, Mr. Brewer, [48:34] » Mr. Dean, Mr. Goodwin, Mr. Okay. So, with that being said, kind of [48:42] flip back [48:46] all the verbage. [48:51] City council for the city of Mlennon, Chisum, Texas, reserves the right to [48:54] convene into executive session at any time during the course of this meeting [48:57] to discuss any of the matters listed as authorized by Texas Government Code [49:04] Real Property 551073. It is 7:08 and we will be in executive [49:09] session. [50:16] I mean, [50:31] that's [50:50] Facebook. [50:57] [Music] [51:26] Sounds good. [51:33] Georgia [51:47] [Music] [52:00] as Well, [52:04] excuse me. [52:56] supposed. [53:16] Exactly. [54:19] Don't [54:47] smoke. [55:05] What's up? [55:30] I'm not talking [55:33] about [56:10] No problem. [56:24] Rio [56:41] Excuse [56:50] me. [57:20] Thank you. [57:30] [Music] [57:44] Yeah, we're getting ready, too. So, there was a little bar in that [57:49] worked out. [58:21] Well, Let's [59:10] Watch. [59:32] You know, [59:44] » we had a lot of time [59:50] I like [1:00:15] So I [1:00:21] Christmas. [1:00:54] Try it out. See what you know. [1:01:07] » Once she's done, let me know. I'll pick them up, run through the machine. [1:01:11] network. I mean, [1:01:35] this [1:01:43] I only three times. Would you take [1:02:05] on top of [1:02:48] Brother [1:03:18] All you got to do [1:03:33] it to years. [1:03:55] employee. [1:04:09] That's it. Do you [1:04:23] see [1:05:08] Oh yeah. [1:05:36] is not [1:06:27] doesn't [1:06:33] feel [1:06:51] What we do [1:06:55] yesterday [1:07:13] is here is [1:07:39] Appreciate. [1:07:53] That was a tennis [1:08:21] Yes. [1:08:44] So [1:08:58] guys, [1:09:02] Okay, I should say [1:09:34] So [1:09:48] anymore. [1:10:17] So [1:10:25] Anybody else [1:10:30] want [1:10:58] We were already [1:11:23] [Music] So the guy who's [1:11:38] daughter. [1:11:54] What happened? [1:12:14] 36 [1:12:23] to get his foot out. [1:12:53] Hope that's a good idea. [1:13:08] There you go. [1:13:22] I'm thinking [1:13:47] First [1:14:08] [Music] [1:14:11] thing you know, [1:14:17] What's that? [1:14:25] [Music] [1:15:21] [Music] [1:16:35] Welcome to [1:17:07] Good. [1:17:22] » Sorry. [1:17:51] You won't be exactly [1:18:15] Are you saying [1:18:53] You got [1:19:09] I guess whatever. [1:20:06] So [1:20:09] the name [1:20:18] Easy. [1:20:57] So we got [1:21:09] So we [1:21:34] What I So [1:21:40] what do we need? [1:22:15] What? [1:22:25] » Yeah. It's already [1:22:33] done. [1:24:17] All [1:24:35] right. [1:24:54] [Music] [1:25:16] I know. [1:25:20] » Always did. Always did. [1:25:35] You got [1:25:51] speech. [1:26:18] Okay, it is 7:45 and we are back for executive session. [1:26:22] Um, no action was taken in executive session. Um, however, we did have a few [1:26:29] questions that we were able to get answers to from our legal counsel. Um, [1:26:36] and with that, I'm going to turn it over to the city attorney because of the [1:26:42] concerns that are out there on the legalities and allow him to explain uh [1:26:47] the process and moving forward. [1:26:54] So, let me start off by saying the council is really excited [1:26:58] about the particular uh developer and what they brought to the city. Um, they [1:27:04] actually wanted to do a lot of things tonight. So, it is my fault that they [1:27:10] are hopefully not going to do anything uh tonight. And and I'll explain the [1:27:15] reason why about that. Uh because like I said, council is they want to make sure [1:27:20] that they're treating everybody fairly, that everybody gets what the due process [1:27:26] allows them to get under the ordinances uh under a code of ordinances. They're [1:27:30] very adamant about that. They're very appreciative of you actually [1:27:34] specifically uh Mr. Barry. The mayor didn't want me to say that, but I [1:27:37] thought I would, you know, let you know they specifically appreciate it. um the [1:27:42] where it looks like there was maybe a mislication of our ordinances because if [1:27:47] you look at five this language is taken almost directly from 5-1 I think it's [1:27:51] subsection uh D of our code of ordinances zoning ordinance and in [1:27:57] five-1 it starts off with in the establishment of a plan development [1:28:02] district and then it's got ABC and D well that is that whole procedure is [1:28:08] when you're actually in the process of establish establishing a plan [1:28:11] development. That's not what's going on out here. One of the council members you [1:28:16] So, you're basically saying that the horse is out of the barn, it's gone, [1:28:19] it's had ponies, and now it's in the glue factory. I said, exactly. This was [1:28:23] done. I thought it was pretty clever myself. That was three years ago. It's [1:28:27] over. It's done. So, there there there is no authority for the council to take [1:28:32] action at this point. So um what now different things can happen at at this [1:28:39] point you know where we are we can you can leave it where it is um you know you [1:28:44] can you can continue to try to work with staff see what we can work out there's [1:28:48] also an option if you want to amend uh see to amend the PD to conform with [1:28:53] whatever the the consent plan you had and I understand there may be some [1:28:56] disagreement between staff and developer but here's the thing if the developer [1:29:00] says look I'm willing to do I don't know say A B and [1:29:04] But the staff wants me to also do deenf. I don't think I need to or I don't want [1:29:09] to or both. That doesn't mean council's going to make the the or even P&Z is [1:29:15] going to recommend that the developer do def. That is totally within the purview [1:29:20] of the council. So it can go through P&Z and they can come to council and council [1:29:24] can say hey you know what uh developer I agree with you. I think only AB and C [1:29:29] are necessary. So we're going to approve the amendment to the PD with just ABC [1:29:34] and not DEF. So council that is perfectly within their perview, [1:29:37] perfectly within their authority to do that. So those are just a couple of [1:29:41] options. Uh you know that they are. But as far as tonight, as much as council [1:29:46] would gen genuinely like to do something because what I've appreciated about this [1:29:51] council is they're willing to not not concede to developers, but they [1:29:55] understand that that the best option is to work with developers because that's [1:29:58] going to benefit the community and everybody as a whole. at this point, the [1:30:03] way the ordinance is and and we kind of apologize and and maybe I should have [1:30:07] caught it too that the way it's worded and taking from the section of our [1:30:11] ordinance that it was in, it should have really been on the agenda even for [1:30:14] tonight. So, and I don't want them to to ask questions. So, please blame me. It [1:30:21] is not their fault. They are genuinely excited about y'all, but I have asked [1:30:26] them not to have their questions answered because in the future, for an [1:30:31] example, if there is an attempted minute in the PD, I don't want them to have all [1:30:35] their questions answered and they made a decision tonight when it's not even in [1:30:38] front of them. So, that's kind of just generally where they are. [1:30:41] » Yeah. Thank you, Mr. Holla. Um, and thank you, council. Um just as it [1:30:46] relates to next steps. Um next steps is is um we were shut down on the process [1:30:55] of what I would call the traditional [1:30:58] process the the the the city of Mlennon Chisum's process of submitting a site [1:31:04] plan application on an already approved plan development district. We all know [1:31:09] that this is not a zoning case. uh we were here or required to be here [1:31:14] tonight at the request of myself to get here tonight to determine your [1:31:19] conformity so that we can move forward with the site plan approval process. And [1:31:26] so the only action that I would interpret, as much as I would love to [1:31:30] ask for you to uh to to take this under advisement for a site plan approval, I [1:31:36] I'm not asking that. It's not on the agenda tonight and I acknowledge that. [1:31:40] Um what is on the agenda tonight is the clarification that's being required or [1:31:45] requested for the city administrator or for the city planner to hear your [1:31:50] direction to allow us to determine that this is in fact in conformance so that [1:31:57] we can move to the site plan approval process. [1:32:00] » That and that's what I was obviously didn't do a good enough job conveying. [1:32:04] They can't do that tonight. >> Okay. What this comes from, that's what [1:32:08] I was trying to explain. What this comes from is section 5-1 of our ordinance. [1:32:14] The asking for council to determine conformance that can only happen during [1:32:20] the establishment of a plan development district. That is not what we have here. [1:32:25] This plan development district has already been established. So the section [1:32:30] that would normally allow this is not applicable. So at this point, we've [1:32:36] already got an established plan development district and so we have to [1:32:39] go from there. That's what I was trying to convey. [1:32:42] » Fair enough. And I respect that. You also appreciate the fact that my site [1:32:46] plan submitt was rejected due to nonconformity and it was stated here and [1:32:50] we've missed another 30 or 45 days in the process because I had to go receive [1:32:55] council's direction to agree that we're in conformity so that he will then take [1:33:00] it through the next process. So, I respect the fact that they don't have [1:33:04] the authority to do something that's already been done, [1:33:07] » right? >> But but understanding that I can't do [1:33:10] that process according to the city planner because his interpretation [1:33:16] as written is that we're not in conformance and without the council [1:33:21] stating that we are in fact in conformance, he's not going to take it [1:33:25] to the next steps. And there creates a pretty significant problem that I'm [1:33:30] trying to avoid here for all parties involved. So, what what am I supposed to [1:33:35] do if if in writing all 81 pages tells me that the reason why we weren't [1:33:41] successful getting on the planning and zoning commission docket was because his [1:33:46] interpretation was is that our site plan uh suggested a use and or what have you [1:33:53] that's not in conformance with my plan development district. And you're telling [1:33:57] me in section 5-1D to the best of your memory, we're not writing that down. uh [1:34:02] to the best of your knowledge that 51D states that that's only applicable at [1:34:07] the time we're establishing a plan development district that's already been [1:34:11] created and established, >> right? [1:34:13] » What is my next steps? Because right now I'm being told that we're in a we're [1:34:18] we're in we're stuck and that's not acceptable obviously. [1:34:22] » Okay. Yeah. Well, I'm not trying to say that you're stuck. What I'm gonna say is [1:34:27] uh first off um it actually is absolutely is 5-1. I do know the number. [1:34:33] So first off we got that um I got a reputation uphold. Second um I only know [1:34:38] a little bit about what's going on. I don't know all the details. Sure. So [1:34:43] maybe the next option would be is have a meeting not just with the parties that [1:34:48] were involved but the parties that were involved and some others if you need you [1:34:53] know like myself and also Bree he's new he he just started um uh you know two [1:34:59] days ago uh and he's been drinking water from a hose like he says so that's uh [1:35:04] that we need to get him caught up too. So I think that would be one thing is to [1:35:08] start there and see where we are. Now, here's the thing, and I I think I've [1:35:12] said this before, but the PD that was adopted August the or October the 11th, [1:35:19] 2022 did have a concept plan attached to the ordinance. So, that is the law on [1:35:26] that. I don't think anybody would disagree with that. So, the question is, [1:35:30] does the new concept plan conform with that concept plan then? And if not, what [1:35:37] has changed? Because there are avenues and you know this as well as I do. There [1:35:41] are avenues where there and and there there may be a difference of opinion on [1:35:45] what a minor deviation from the concept plan is. I don't really have a problem [1:35:50] if there's uh minor deviations saying yeah this concept plan we're not going [1:35:55] to have an issue with that. If they're major then maybe we need to do an [1:35:59] amendment to the PD. So and I think that's something that the city can fast [1:36:04] track. I think we can get that done inside of a month. uh depending on if [1:36:09] that's the the route that we want to go. That's what I think. [1:36:11] » Okay, let's pause for station identification. I was stopped [1:36:17] via a rejection for nonconformance [1:36:23] and beg and pleaded to get this opportunity which I'm grateful to have [1:36:27] had tonight to present as directed the determination by this body as to whether [1:36:34] or not our use was in conformance. And I stated at the request of Mr. Sanchez and [1:36:41] Mr. chairman to provide a narrative stating my reasons as to why we were in [1:36:47] conformance. Was then told that the agenda was being [1:36:52] printed as stated that the request was for the city council to interpret plan [1:36:57] development conformance. Not trying to beat a dead horse. [1:37:02] I'm here asking for them to confirm or deny [1:37:08] as to whether or not we're in conformance as required because I can't [1:37:14] go to the next step. I've provided everything. I've provided all our [1:37:19] checklist. I'm in conformance. I am at the discretion of this gentleman right [1:37:25] here who can't take me to the planning and zoning commission to discuss site [1:37:30] plan approval items [1:37:35] outside of the purview of deliberating to whether or not we're even in [1:37:39] conformance to get to a site plan approval. [1:37:42] So that's I I I totally respect and understand and certainly not barking at [1:37:46] you as it relates to the fact of what was written on the [1:37:51] agenda is in fact not even allowed or applicable, which is a whole another [1:37:57] problem. We're creating more damages on myself [1:38:01] here. What am I supposed to do next? I I I don't know what else to sit down with [1:38:06] this gentleman who's extremely unreasonable with what we've already [1:38:09] provided for him. And we've given all kinds of information stating our [1:38:14] perspective and our inside of our own purview which seems to be rather limited [1:38:20] stating how we are in fact in conformance [1:38:24] and he states that we have to go get their blessing before we can go to the [1:38:29] next step. I would love Mr. Mayor to ask for freaking sight plan approval tonight [1:38:33] but it's obviously not there. >> Mr. Holla, I apologize Mr. Barry. He [1:38:38] he's bringing up some new points. Um, and I've been asked, [1:38:42] » can we go back into executive session? We have some more questions now. He's [1:38:45] brought up some new points and I think we [1:38:48] » I think we owe Mr. Barry the correct answers as we stated in there. And I [1:38:52] want to make sure that's delivered tonight. I do not I was told a good [1:38:55] story that uh, you know, if you're off by one inch as a carpenter, once it's [1:39:01] built, you can't go back and redo it. And I I don't want to put us in that [1:39:04] situation. Uh, so I would like to take us back into executive session. Do I [1:39:07] have to read the paragraph again? >> Yes, sir. [1:39:10] » Okay. Uh, when we go back into executive session, Payton, I'm going to need you [1:39:13] to come in on this one. Uh, city council for the city of Minton Chisum, Texas [1:39:17] reserves the right to convene into executive session at any time during the [1:39:20] course of this meeting to discuss any of the matters listed as authorized by [1:39:25] Texas government code chapter 551073 real property. I'm going to do a fivem [1:39:31] minute recess so that anyone can use the restroom and then we will be in [1:39:35] executive session at 8:05. [1:41:58] Don't worry. [1:42:18] So [1:42:51] That was nice. [1:44:37] ladies. [1:45:19] Where's [1:45:30] Excuse [1:45:40] me. [1:46:16] system. [1:46:26] So, we're just going [1:47:25] Speech. Speech. Speech. [1:48:43] It's all around [1:48:56] It's not [1:49:22] [Applause] [1:50:06] to be able to address anything. [1:50:19] Those [1:50:29] are also [1:51:10] That's [1:52:01] at the same [1:52:35] That was an extraordinary [1:52:59] Oh yeah. [1:53:20] What's this? [1:53:35] Happy birthday. [1:53:57] to discover [1:54:12] Awesome. [1:56:04] Wonderful. [1:56:33] This is Yes, [1:57:12] I know [1:58:50] That's the [1:59:19] This morning [1:59:46] Serious. [2:00:24] We're just waiting on Mr. Holla. Just waiting on Mr. Holla. [2:02:40] It is 8:22. I appreciate your patience. We are back from executive session. [2:02:45] Um I'm going to end up turning this back over to Mr. Holla. Um but I I do want to [2:02:51] stress um to Mr. Barry that I'm going to ask staff [2:02:59] Fabric and Mr. Holla to uh and again Mr. is going to speak in a minute, but I [2:03:04] have asked them to both reach out to you tomorrow, figure out a time they can set [2:03:10] up a conference call uh so that all three of you can be on the phone. Um I [2:03:15] apologize. Um I I accept responsibility as a mayor [2:03:21] that this should have been done better, handled better. Um, at the end of the [2:03:27] day, I can't regulate how developers do things, but I can take responsibility [2:03:31] when the city fails to do what I would think would be for any developer [2:03:35] standing in front of us, whether it's you, Mr. Palani, Mr. Whittle, whomever [2:03:39] it is, I feel we're here to serve and that's what we should do. And so, please [2:03:45] accept my apologies. And with that being said, Mr. Hollow. [2:03:49] » Thanks, Mayor. Appreciate it. So, I think uh and I appreciate you doing [2:03:53] that, Mayor. And even though you didn't have to, I think it was just a [2:03:56] misunderstanding of the way our ordinance was written and so it never [2:04:00] should have been on the agenda. And so yeah, I'm happy to to get with Breeze [2:04:04] and and we'll sit down just to see where we are. You definitely have the option. [2:04:09] You can say, "Hey, look, I appreciate it, but no, thank you." Uh, and we can [2:04:12] get it on the the site plan approval on the next P&Z agenda if that's an option [2:04:17] that you want to take. And we can talk through all that about exactly how you [2:04:20] might want to do that. uh because there's a couple different avenues to [2:04:24] getting that done. So, um I would expect uh in fact, even if you have enough time [2:04:29] tomorrow afternoon, we're going to have a meeting here at 6:30 tomorrow night. [2:04:33] So, I don't have anything uh planned in the afternoon because I made [2:04:36] arrangements to uh uh to be here. I don't mind getting early being here [2:04:41] early for precess time. Um if y'all want to come, you know, say 3:00, 3:30, [2:04:46] something like that. >> Would that work for you, Mr. Barry? [2:04:49] » I'll make whatever work. I just want assurance that we're going to be on the [2:04:52] next planning and zoning commission for a site plan approval. [2:04:55] » Let's let's do that for sure. But if you can be with Mr. Holla and Mr. Fris [2:05:00] Kabona tomorrow at 3:30 here at city hall and then that way y'all can have [2:05:05] face to face time versus phone call, would that work for you Mr. Reiano as [2:05:08] well? >> Okay. [2:05:12] Um, and >> to answer your question, one of the [2:05:15] things that was discussed and they will go into it tomorrow was is October 21st [2:05:21] is the earliest we can get you on a PNZ due to notices having to be mailed out. [2:05:26] Is that correct? And then that would put you on the 28th council meeting, but [2:05:31] they have I want them to be able to talk to you about other options as well. Uh, [2:05:35] and they can do that tomorrow in y'all's meeting at 3:30. [2:05:39] » That's all I can ask for. I appreciate everybody's patience. Thank you. Thank [2:05:42] you, Mr. Barry and Mr. Riano. Thank you so much. [2:05:54] Okay, so no action taken on 8.2 and again I appreciate everyone's [2:05:59] patience. Um [2:06:04] 8 8.3 discuss and consider a resolution restricting the use of proceeds of bonds [2:06:10] issued to finance public improvements in the Sonoma Public Improvement District. [2:06:17] » I'll entertain a motion. >> So move. [2:06:20] » Second. >> Second. [2:06:23] » Is this one back to you or the city? >> This is going to be me and then Mayor [2:06:27] Pro Tim Brewer. Um, council and mayor, you may remember several months ago, [2:06:32] Mayor Prom Brewer and I were assigned the project of exploring the sale of the [2:06:37] water pipes in Soma Verde to RCH. We met with our pit administrator P3 Works who [2:06:45] uh totally understands that there was developer money also went into the [2:06:50] infrastructure of Sonoma Verde 1 through5 but they wanted us to have a [2:06:55] document in place that stated PID money did not pay for water infrastructure. [2:07:01] This is the resolution in front of you tonight and then we can move forward [2:07:06] with next steps. I appreciate you doing that, Bev. And Mayor Pro Tim, I'll turn [2:07:10] it back over to you. >> I'll just add one of the reasons we're [2:07:14] having to do this as well as we don't want to lose the tax exempt status of [2:07:19] the bonds. If we resell the pipes and the bond [2:07:23] money was used, we'd lose the tax exempt status of that. [2:07:27] » Ah, that's a very good key point and that [2:07:31] might have answered Mr. Dean's question. Um, Mr. Mr. London, I'll start with you [2:07:36] if you have any questions for Mr. Brewer or M. [2:07:38] » I'm good. Actually, it was the the tax question. [2:07:41] » Mr. Towry, I know Mr. Brewer is good. Mr. Dean [2:07:45] » answers my question. Thank you. >> I figured it did I. [2:07:48] » Mr. Goodly, you can do it. >> Hit Mr. Powers. Well, with that, I think [2:07:52] we'll take a vote. All those in favor say I. [2:07:55] » I. I. >> I. [2:07:59] » Well done. >> I [2:08:06] Very well done. And on 8.4, um this is to discuss and approve a bid for the [2:08:13] remodel of the old fire station. I will be [2:08:16] uh removing this. However, I'm going to um direct staff to do an RFP on this uh [2:08:24] and bring it back to council with those if you can please for brief. [2:08:30] 8.5 Discuss and consider approving an [2:08:34] ordinance amending the 2024 2025 fiscal year budget finding municipal purposes [2:08:39] authorizing expenditures providing for a severability clause and providing for an [2:08:43] effective date. Uh I'll entertain a motion on this. [2:08:47] » So move second. >> Second. [2:08:49] » And this one looks like it's going to Jeff. [2:08:53] Thank you, Mayor and Council. This is just wrapping up the uh current fiscal [2:08:59] year's budget. Um the amendments are based on additional revenues that came [2:09:04] in, expenses, some of which were approved at by council for expenditures [2:09:09] throughout the year. Um some uh are just line items that we either didn't spend [2:09:16] as much as budgeted or we spent more. Um so this is just basically tidying up the [2:09:21] budget for the for the year. [2:09:26] Mr. Love, Mr. Cowry, Mr. Brewer, Mr. Deing, Mr. Sidley. [2:09:33] » Good. >> And Mr. Powers. [2:09:37] » All right. All those in favor say I. >> I. [2:09:40] » I. >> I. [2:09:42] » I. >> I. [2:09:49] » 8.6. discuss and consider approval of the appointment of five members to the [2:09:54] comprehensive plan advisory committee. Uh with this being an approval, uh I'll [2:10:00] entertain a motion. So moved. >> Second. [2:10:04] » Second. >> M Stevens. [2:10:07] Mayor and council member. This item is regarding appointing uh five members to [2:10:12] the comprehensive plan advisory committee. U staff is in front of you. [2:10:17] You should have a file with all the applications that have been received. Uh [2:10:22] staff is recommending appointing Mr. Mark Russo, uh Mr. Garrett Nickel, Mr. [2:10:28] Justin Rugiano, Mr. Becca Freeze, Mr. David Black, [2:10:34] and Mr. David Black. Uh and that would be we have uh and that would be [2:10:40] obviously to begin working with Sanchez and associates on a comprehensive plan [2:10:45] update. Uh we have with us this evening Mr. Martin Sanchez. Uh should you have [2:10:51] any questions at this time? [2:10:56] » How many people is that? >> It's five. [2:10:59] » Five. >> Five. [2:11:04] » You want me to list the names? >> No, it's I was thrown off. [2:11:08] » Yes. >> Understood. Got it. I'm [2:11:12] » I like that. Um so if everyone accepts those names um um [2:11:20] since we did a motion to second if all approve those names say I [2:11:24] » I [2:11:29] » I >> I [2:11:31] » I'm an I. >> Mr. Black will be watching you. [2:11:37] Just kidding. Thank you Mr. black for uh volunteering. [2:11:42] Um, discuss and consider Rockball Wall County appraisal district board of [2:11:45] directors nominee. Um, [2:11:50] this one doesn't need an action. It looks like it says discuss and consider. [2:11:54] » There's a resolution. >> Oh, there's a resolution. All right. [2:11:57] I'll entertain a motion. >> So moved. [2:11:59] » Second. >> Second. [2:12:02] » Back to y'all and council members. This item is about uh submitting a nomination [2:12:06] for the ARCAD board of directors. Uh staff is recommending [2:12:11] nominating Mr. Tony Crawford who has submitted his application for the Arcade [2:12:17] board. Um you should have included in your packet a copy of his biography [2:12:23] uh attached with his along with his qualifications. Uh with that staff [2:12:28] recommends approval of this item and Mr. Crawford is in the audience this evening [2:12:32] in case you have any questions for him. >> I can assure you that I'm an I'm going [2:12:38] to be a yay and I will not put Mr. Crawford through what he went through [2:12:41] last time. So I'm a yay. If everyone else is a yay, I'll take that now so we [2:12:45] can move on. [2:12:49] » Yay. >> Yay. Yay. [2:12:52] » Yay. >> Abstain. No, I'm kidding. Yay. [2:12:57] » Mr. Crawford, you set yourself up for the punishment, so we appreciate you. [2:13:01] Uh, [2:13:04] it's too late now, sir. It's too late now. [2:13:09] » Yep. [2:13:12] 8.8. Discuss and consider directing staff to advertise for finance and audit [2:13:17] committee members. [2:13:22] This is just an item directing to consider directing staff uh to advertise [2:13:28] for the finance and audit committee members. [2:13:32] So directives. Anybody have any questions on that one? [2:13:38] » All right. 8.9. Discuss and consider approving the [2:13:42] creation of an economic No. Because we're director. [2:13:47] uh discuss and consider approving the creation of an economic development [2:13:51] committee. >> This is also an item to consider [2:13:55] directing staff to create the creation of an economic development committee. [2:14:02] » Um does anybody have any questions on this one? [2:14:04] » And advertise for volunteers. >> Anybody have any questions? [2:14:09] » Uh yeah. So I discovered I was on the economic I was the economic liaison. [2:14:15] » Yeah. You can blame uh there's an outgoing city manager that you can blame [2:14:19] for that one. >> I wasn't invited to Croatia and Italy on [2:14:23] the trip, so sorry. >> There you go. [2:14:27] » All right. Uh yeah, no, that's fine. I think this would be great. I I haven't [2:14:31] quite thought in my head how we want this. I actually would want whoever [2:14:36] volunteers, the group that volunteers to kind of give the direction. But I think [2:14:41] uh when we talk about trying to recruit businesses here, it would be very [2:14:45] helpful for them to maybe give us some ideas on what is a very uh enticing way [2:14:52] to to recruit people. >> So I had one of my many meetings with [2:14:57] Free today. Uh and I know he's going to be meeting with all of you on council. [2:15:01] He actually had a really awesome idea when we spoke. So, I'll let him share [2:15:05] that when y'all meet. Um, but u make sure that you have the input on the uh [2:15:12] process since you're going to be the one heading it and next time invite Bev to [2:15:15] Croatia, you won't be on a committee. >> Mr. Towry, do you have anything on this [2:15:20] one? I was just going to say uh once it is um um once the committee is put [2:15:26] together, it would be nice to do some kind of like workshop or something maybe [2:15:29] with with council just to kind of get their feedback and kind of everybody's [2:15:33] on the same page of the vision going forward and what we want to bring in. I [2:15:37] think that may be helpful as well. >> Yeah, absolutely. [2:15:43] » Absolutely. All right. So, you got direction on that? Are you good to go? [2:15:47] » Okay, next one. will discuss and consider action to approve the requests [2:15:51] for qualification notice and packets to be sent to engineering firms [2:15:56] specializing in road maintenance. I'll entertain a motion. [2:16:01] » So moved. >> Is there a second? [2:16:05] » Second. >> All right. And that one will go to [2:16:09] » This one actually goes to Councilman Powers. [2:16:11] » Councilman Powers. >> Uh yes. This was the request that we [2:16:16] made a few a couple of city council meetings ago. Excuse me. Excuse me. I [2:16:20] apologize. 8.9 says, "Discuss and consider approving the creation. That's [2:16:25] not direction." So, I apologize. Um, let me entertain a motion on 8.9 to [2:16:30] » move. >> Second. [2:16:32] » Second. >> All in favor say I. [2:16:34] » I. >> I. [2:16:35] » I. Thank you, council, for catching that. [2:16:38] » There you are, Angela. Apologize. Now, 8.10. We've already read We've [2:16:44] already taken the motion and second, and I apologize for cutting you off, Mr. [2:16:47] hours, but we had to get that part done. Back to you, sir. [2:16:49] » Quite. All right. Yeah, I'll be very brief. This was from a couple city [2:16:53] council meetings ago where we were um sub submitted wanted to do this so that [2:17:00] we could have a professional organization [2:17:04] uh do a study on the uh streets both public and private in our city and [2:17:10] ascertain their you know all the stats about them and their their uh [2:17:16] construction type and the condition that they're in. so that we would have an [2:17:20] idea of what would be needed in today's dollars to bring all of those [2:17:27] streets and roads up to standard if that's what we choose to do. At least [2:17:31] we'll know what the size of the issue is facing us. Um and then with that [2:17:38] um we the apparently staff has gone out and [2:17:43] look and located two or three companies that we can contact. [2:17:48] You have not done that yet. >> When you issue an RFQ in the newspaper, [2:17:52] it's up to them to reach back out to us. >> Okay. So, have So, we have not done that [2:17:56] part yet. >> We have not issued the RFQ. That's what [2:17:59] we're voting on tonight. >> Correct. Okay. Want to make sure I had [2:18:02] that right. So, we're going to direct you to to take care of that. [2:18:09] Is that okay with everybody? >> So, so directed. [2:18:14] » All right. So, all those in favor say I. >> I. I [2:18:18] » I >> I [2:18:23] » Next up, before I read it, Fabric, normally Angela reads the agenda items. [2:18:28] I just did it tonight just to expedite us because of the length of 8.2. [2:18:33] 8.11 discuss and consider approval of a final [2:18:37] plat of one lot necessary for development. The property is a 3acre lot [2:18:41] track of land located on the north side of state highway 205 between League Road [2:18:46] and FM 548 within the city limits of Mlin and Chisum. The track is fully [2:18:51] zoned in the single family residential SF 2.5 district. I'll entertain a [2:18:57] motion. So move second. [2:19:02] » Second. >> And that opens it up for discussion. [2:19:07] Who is on this one? city please. [2:19:11] » Good evening. Uh the applicant is requesting approval of of a final plat [2:19:16] of one lot necessary for development. Uh this applicant specifically obtained a [2:19:21] board of adjustment approval on August 13th of this year um for this to be [2:19:26] correctly platted. Um that was for the access easement to exceed 600 ft um as [2:19:32] outlined in our subdivision ordinance. So now that that BOA approval has been [2:19:35] obtained, this plot is in complete conformance with the subdivision [2:19:39] ordinance. Happy to answer any questions. Mr. [2:19:42] London, do you have any questions? >> When I was reading through it, I was [2:19:47] just going through it again. I saw that this is actually a 40 acre tract. [2:19:53] » Uh it's 28 acres roughly and the land was conveyed without pladding. So this [2:19:59] was more so a retroactive effort uh more than anything. So, [2:20:03] » okay. So, they're just bringing into conformity with what they want to do [2:20:06] with an >> Yes, sir. That's correct. They went [2:20:08] through Burgess through our residential review entity and they got a permit hold [2:20:12] with them that triggered the platting process with me and then that and then [2:20:16] after initial review found out a variance was needed. So, they had to go [2:20:20] BOA1 and then platting two. >> Okay. So, they're repl [2:20:25] they're only final platting the threeacre track that's listed in the [2:20:29] staff report. >> Great. Councilman London, if I can help [2:20:33] with this a little bit. This is a large family track that pieces were just given [2:20:38] off by grandparents. And so to get their building permit, it [2:20:42] had to be legally plant platted. >> And that's that's why I was asking [2:20:46] because I I originally read in there somewhere and I can't remember exact [2:20:49] where I think it's on page 262 where it was talking about there was a 40 acre [2:20:54] and then the the divisions and so Okay. Thank you, [2:20:58] » Mr. Towering. Mr. Brewer. Mr. Dean, [2:21:03] » I think it's important to note PNZ approved it seven to nothing. Um, so [2:21:08] I don't know if that means we're super majority or what. [2:21:12] » It's pretty strong. >> Okay, [2:21:15] good. Good powers. [2:21:19] » All right, we've had the motion and the second. All those in favor say I. I [2:21:26] » I >> I [2:21:28] » I [2:21:33] » All righty. That takes us to our council member reports and announcements. [2:21:39] Jeff, >> I do not have anything this evening. [2:21:44] » Hey, Chief Mr. London. Um, I'm just going to say, mayor, thank [2:21:51] you for putting together and uh allowing me to participate in that operation to [2:21:57] get that sign and flag out for the Charlie Kirk Memorial. I really [2:22:02] appreciate that. And we got a lot of positive feedback from that. So, thank [2:22:05] you. >> Operation Lone Ranger. Uh, for the [2:22:10] record, I was uh Kimosabi and he was Tanto. [2:22:16] Mr. Brewer. Uh, I just wanted to say, um, thank you [2:22:22] to Bev. Um, [2:22:26] she's been a a great den mother to us, >> particularly to one person in [2:22:33] particular, but um, but I but I I really do appreciate the [2:22:39] work you've been doing. um the transition from a general law to a home [2:22:45] rule city. It it's one thing to get the document done. It's another thing to get [2:22:51] the vote uh get approval. But the third and most important thing is the [2:22:56] implementation and you jumped right into it and got it done. So thank you for [2:23:01] that. I enjoyed working with you. >> Mr. London, I'm going to give you an [2:23:05] opportunity to say something to Bev. [2:23:10] Absolutely. Thank you for all of your um I'll say guidance and sometimes using [2:23:16] the foot against my backside to gently guide me. Um I I do need that. So, you [2:23:21] know, you you've been a a vital part of this city for a very long time and we [2:23:27] definitely want you to stick around and continue providing your input. I know [2:23:32] you're not going anywhere. So, I do have a bottle of bourbon with their name on [2:23:35] it. So, we'll take care of that. Thank you, Ben. [2:23:39] Alrighty, Mr. Tower. >> Yeah, I do appreciate it. I think it [2:23:43] could have been better timing having you come in with all us new rascals up here [2:23:48] trying to figure this out and I felt like you that Denmother is probably the [2:23:52] perfect we were just, you know, so I I do appreciate all the guidance and um [2:23:58] and I couldn't ask for a better uh person by our side to help us through [2:24:02] this. >> Even though I wouldn't let you wear a [2:24:04] hat. >> Now I got to cut my hair more often. [2:24:08] Okay. [2:24:14] » All right. Mr. H. Uh, Mr. Dean, sentiments. Uh, exactly. I I'm pretty [2:24:20] sure when you took the job, you didn't know you'd be kneede in in sewage. [2:24:27] Uh, and yeah, >> Mr. If you only knew that that that [2:24:32] wastewater are my least two favorite words through this whole eight months [2:24:38] cuz it started on week one where I sat down and they started talking to me [2:24:43] about sewer lines and expansions and lift stations and I'm like I had no [2:24:49] idea. >> She did look a little comfortable with [2:24:51] the so thanks for that. I I I also would want to call out Mayor McNeel. I don't [2:24:58] know if that Charlie Kirk Memorial could have happened without what he did. Uh he [2:25:02] is the go-to guy in Rock Wall County to make a production like that. And so, um [2:25:08] I I was happy we had a chance to uh to honor the memory of of Charlie Kirk and [2:25:14] uh Mayor McNeel helped helped that to happen. So, appreciate it. [2:25:20] » Thank you. Um you did surprise me and then didn't realize your wife got a [2:25:24] candid shot of us. So, that was We now have to keep an eye on Helen. [2:25:29] » Yes, I did not know she was taking pictures. That was not Mr. Good. [2:25:35] » Uh, I just wanted to let everyone know norm normally I'm doing my second [2:25:40] Wednesdays at Rosa's meeting with council do breakfast. Uh, this month [2:25:44] I've got to change it to the first Wednesday to the first. Um, so October [2:25:50] 1st meet with council 7:30 at Roses near the near the uh the 30. um open to hear [2:25:56] any questions or or answer any questions. Um so just being available to [2:26:01] the community. I'd like to shift now. Um thank you. Thank you for helping us all [2:26:09] come on and and really for somebody that has to have the dots connected but maybe [2:26:14] their brain doesn't go fast enough. You always slowed it down for me, connected [2:26:19] the dots. Um, I really appreciate it because you probably had to overexlain [2:26:24] things. Um, and I just I can't tell you how much I appreciate you and um, just [2:26:29] how much you've done for this community over all the years. So, thank you. [2:26:33] » There will be lots of jokes, Mr. Goodwin. Lots of jokes, Mr. Powers. [2:26:41] Uh, you've already heard me say many times that you're a treasure for this [2:26:46] city and, uh, you've been here since 1980. you've had your finger in the [2:26:51] pies, fingers in the pie ever since then, wearing so many different hats. [2:26:56] And uh so somebody that has that kind of of time in the city 45 years uh and been [2:27:03] active the whole time, it's truly a treasure. And I know you're tired of [2:27:06] hearing all these compliments, but I'll give you one more. Um and I've already [2:27:11] said it earlier. I'm looking forward to seeing you up there stating your un [2:27:18] unfiltered opinion on various topics that may come up. [2:27:23] » You are probably the only one sitting up there that is looking [2:27:26] » say do you really want that? >> 100%. [2:27:30] » Be know how to give a filter. >> Mr. Holla, do you have anything? [2:27:36] » I do. I appreciate it. there. I I mean, Bev, I always knew I've known you for [2:27:42] close to 20 years now. I always knew you were smart. I mean, you showed that with [2:27:46] with phone calls that we had, you know, during the day, at night, on the [2:27:50] weekends, and how you totally took advantage of the fact I love you would [2:27:54] never build a city for that and the thousands of dollars you saved them. So, [2:27:57] you showed me you were smart. You know, even when you would call just to [2:28:00] complain about how you to talk slowly, connect the dots for Council Member [2:28:03] Goodwin. He wasn't. I I never I never mind it. And actually, as soon as you [2:28:09] said that, I whispered, "But Bev, I got I said, I got one." But in all [2:28:13] seriousness, I I worked with you early on. We kept in touch during the times [2:28:18] that I wasn't a part of the city, so I always knew what was going on in the [2:28:22] city. And I remember thinking, "Oh, okay. You know, Bev's got a lot a lot of [2:28:27] that she can offer as a city administrator." I said, I I there's a [2:28:30] lot there that she can do. My only concern is she hasn't actually done the [2:28:34] job. So, it was there were times that I literally forgot that you hadn't been a [2:28:39] city administrator her whole life. And I I've told you more than once and and I [2:28:42] mean it that it you missed your call. I think you are you you just jumped into [2:28:50] the job. You had natural instincts a ppeaciousness about the the job and how [2:28:55] to do the job and and what how to react and what to say and what to do that you [2:29:00] you can't always teach somebody. Sure, people can learn it, but you didn't [2:29:05] necessarily need, you know, to learn that. You just the actual, you know, [2:29:09] training, seminars, whatever, whatever. Um, you you didn't have that, but you [2:29:15] just had a natural ability to do it. And it just really over time it really [2:29:20] amazed me and I appreciated that about you and I appreciated the fact that you [2:29:24] know all seriousness is you don't really give filtered opinions. I mean, you you [2:29:28] I I think that is good for us in cities to know there's so much to what we do [2:29:34] that is in black and white and I've just always [2:29:40] appreciated knowing you and you know me meant a lot to me personally and how [2:29:44] you've been there for me when I've needed things and how our friendship, [2:29:48] you know, has grown over this and I know you're going to be around but it's going [2:29:51] to be, you know, it's going to be, you know, different. I mean, you're you call [2:29:56] and and you know, honestly, half the time that I never put anything on the [2:29:59] bill was was, you know, there may be 15 minutes, 20 minutes of city business and [2:30:03] then 15 or 20 minutes of us just, you know, talking and so I I know you're [2:30:08] going to still be around. I am excited about Breeze. I mean, I genuinely am. [2:30:11] I've known him for a while and I'm being dead serious. I am very excited about [2:30:15] Freeze. He was the guy who was hoping it was all I could do. I had to sit on my [2:30:18] hands and sit on my lips to not say anything, you know, about Freeze. I'm [2:30:22] excited, but I'm I'm generally in and with all my heart going to miss having [2:30:27] you around and and you'll always be my friend. And if you ever need anything, [2:30:31] you can always just let me know that. >> City Manager Cabona, when you've been [2:30:36] here 45 years, we'll say nice things about you, too. [2:30:41] » Fabric, I'm going to allow you to say some comments as well. [2:30:44] » Yes, sir. Thank you. Thank you. So, for one, I do want to thank uh MV. Uh it [2:30:51] really doesn't take too much to recognize just the wealth of [2:30:56] information, the wealth of knowledge that she carries with her, the [2:30:59] commitment and dedication that she has for the city of Mland and Chisum. Uh [2:31:03] I've been extremely lucky. Not most new city managers don't have somebody to [2:31:08] hold their hands during the transition process and she's been that for me. [2:31:12] She's graciously been willing to do that for me and I really appreciate it. Um [2:31:17] and and that's part of the reason why we've decided to keep her on an as [2:31:22] needed basis. It's because she has such a she's such a [2:31:26] resource. Uh so thank you. Thank you on a personal level. I really appreciate [2:31:30] it. Uh it's a pleasure. I'm I'm excited to be able to join the city and I'm [2:31:35] looking forward to everything that we'll be able to accomplish. I'm looking [2:31:37] forward to working with the team and with you serving under your leadership, [2:31:41] mayor and council members. Um, and secondly, I do want to remind you that [2:31:46] we have a joint training session tomorrow evening at 6:30 p.m. that will [2:31:51] be provided by Mr. Holla and that would be between uh with city council and PNZ. [2:31:57] Thank you. >> And I do want to point out, mayor, that [2:31:59] another amazing thing about Bev, no one probably in my 26 years of doing this [2:32:03] has ever asked for my advice more and taken it less than Bev. [2:32:08] » I understand. Angela, I want you if you want to say anything to Bev and then [2:32:13] I'll close this out. >> Just want to say thank you for helping [2:32:18] in that transition because when one person leaves, you never know what [2:32:22] you're going to get. So, you are now helping us through two. We're very glad [2:32:27] that Fuse is here. I think it's going to be a great addition to the city. But, [2:32:31] thank you very much for all that you've done for the staff. We love you. [2:32:38] and I will close us out. Um, Bev, thank you. Uh, probably one of the hats I will [2:32:45] miss the least is the uh, mayor and city manager hat. Um, many of you not know [2:32:51] this, but Bev and I have many hats in our discussions throughout the day. Uh, [2:32:56] we have mom son hat, we have Brian and Bev hat, we have city manager and mayor [2:33:02] hat, and probably a few others. And I jokingly say that because I don't know [2:33:07] if I would be the mayor I am today if it wouldn't have been for your guidance. [2:33:11] And I know we joke a lot that I didn't take your advice. Uh I know that so I'm [2:33:16] basically blaming her for all the videos. I'm basically blaming her for [2:33:20] all the posts. Basically every speech written uh is Beth Dibbons. Uh I will be [2:33:27] happy to give her personal email out. On a serious note, you have been a solid [2:33:34] person in my corner and I appreciate that very much. Um, also with that said, [2:33:40] Fabric, welcome to the city of Mlennon Chisum. I [2:33:44] look forward to working with you. I've already had a few sit downs and talks [2:33:48] with you. Uh I know you have time set to meet with the council members and I can [2:33:53] only assure them that they are about to be super impressed uh with the visions [2:33:58] and the things that you're going to bring to the city and I am looking very [2:34:01] forward to working with you. And lastly, my next ask is our next council meeting [2:34:07] is October 14th. Okay. Um that's Charlie Kirk's birthday and I would ask us to [2:34:13] all be in red. So, if we can all wear red on October [2:34:19] 14th, I would appreciate that, council. Uh, I'll leave that up to you. If you [2:34:23] want to wear a red freedom shirt or however you want to do that, uh, staff, [2:34:28] I would ask y'all to do the same in that. [2:34:31] And also, there is a meeting scheduled for council on in November that is going [2:34:37] to be November 11th. That is Veterans Day. I will be cancelling that and I [2:34:41] will be calling a special meeting for November 18th. Uh I will not hold a [2:34:46] council meeting on Veterans Day um because we will be honoring veterans [2:34:50] that evening uh with a sunset um event and I will not dishonor uh veterans by [2:34:58] holding a council meeting when we need to be honoring them. So please know that [2:35:01] I will cancel November 11th and I will move us to November 18th. So council, if [2:35:08] y'all can make yourselves aware, staff Angela, you need to know that for [2:35:11] posting purposes with the new law changes. And with that, it is 8:5. Oh, [2:35:16] go ahead. >> I do want to let our audience know that [2:35:19] uh we have the extreme green event this Saturday from 8 to noon. [2:35:24] So, there's an opportunity for you. >> Extreme. There's a social media post [2:35:30] today that lists the items that they're accepting. So, please take a look at [2:35:34] that so that you don't bring something that they can't accept. And they are [2:35:37] doing shredding as well. Document shredding. [2:35:41] It is it is 8:55 and we are adjourned. [2:36:15] [Music] [2:37:00] tomorrow. [2:37:41] That's the Only thing [2:37:53] [Music] [2:38:04] background
