[0:05] All right, we're officially going to call our meeting to order. [0:08] » This is our uh this is a notice of our May 18th, 2026 Memphis City Council [0:13] special call meeting. We're officially gathering here at 6:03 p.m. City Council [0:19] Room 721 Robertson Street, Memphis, Texas, America. We're calling this [0:24] meeting to order. We're starting out with our invocation and our pledge of [0:27] allegiance. And at this time, I'll ask Zach Alman to lead us in a prayer and if [0:33] Micah Copus will lead us in the pledge to follow [0:42] Lord to come to you tonight just asking you to be with the council as we try to [0:47] make the best decisions for the interest of the city, [0:51] best decisions for the future of Memphis. Lord, I ask that you just be [0:55] with each and every one of us in here today as we took time out of our day to [0:58] be here at this meeting. Care about the community so much that we're here to [1:04] fight for what we believe in. We thank you for all your many blessings [1:08] you give us, the opportunities you present to us every day. We're so [1:11] grateful to stand stand on this earth that you [1:15] provided. We dare you name [1:24] I aliance to the flag of the United States of America and to the republic [1:30] for which it stands. One nation under God, indivisible, with liberty and [1:36] justice for all. >> All right. Well, glad to see a great [1:41] turnout here tonight for our our non-counsel meeting. Again, this is our [1:45] call meeting tonight and we're going to start out here with uh our public [1:49] comment. Citizens are limited to three minutes to address the city council. [1:53] regarding any issues of concern or items on the agenda. So again, this is opening [1:59] the floor if anybody would like to speak up before we get going here tonight. [2:06] » All right. Well, one, two. You want to say something? Wait, [2:09] » I would like to >> go right ahead. [2:11] » Okay. Hi, I prepared a couple notes. My name is Joanna Buckner. I'm at 1321 West [2:16] Bradford. Thank you for allowing me to address the council tonight. My husband [2:20] and I have made a concerted effort to be present here at city council and among [2:25] town and really make ourselves a part of the community as we've been here. [2:28] [snorts] And we are really happy with Memphis and Memphis has a lot going for [2:33] it and we see a good future for Memphis and one of the things I want to point [2:38] out is this country was founded by risk takers and those who are willing to take [2:44] a risk to make things better. So, in saying that, we're really happy that the [2:49] city is looking at fire safety ordinances and ordinances to make things [2:54] safer within our town. Uh, in saying that, looking at what is on the agenda [2:59] tonight, we do want to say if we're going to look at things for RV parks [3:03] specifically, we also need to look at things within the city like houses that [3:08] are a blight or maybe need to be torn down or just need remediation. things [3:14] that are fire safety hazards within the midtown. Looking at things like uh [3:18] proper address labels for houses so that ENT fire police are able to identify [3:25] said locations so that they're not looking around town like Rex mentioned [3:29] at the last meeting trying to find out who called where. [3:34] Those things are super important. I know I'm limited on my time. So, uh, we are [3:38] very proud of the people who are the risktakers in this town who are trying [3:41] to build businesses such as the RV parks and we don't want to see them penalized [3:45] in the sense of making it so difficult to grow a business that they're unable [3:50] to continue for it because it is not a small business venture in order to set [3:55] one of these places up. It's hundreds of thousands of dollars to get an RV park [3:59] really set up. So, in saying that, while we're looking at those things, let's [4:04] take into consideration the local area as well and look at things like the [4:09] rental houses, the current existing structures. What do we need to fix? How [4:13] can we help blacks and everybody else send out the letters, get things cleaned [4:18] up so that everybody can pro be proud of the city that they're in, not just the [4:21] people who are coming in to see these RV parks. And uh in keeping with all of [4:26] that um you know I I know that you guys are have a lot on your plate. [4:31] It's hard to catch up with city ordinances if there's not already [4:34] ordinances in place. There are things on the state level that have already been [4:38] put into place and we can kind of pull some of those just to find them. And if [4:42] you want help, I'm happy to help. I will donate my time. Um but I think you guys [4:46] are doing a great job. Keep up the good work. Let's look at the [4:51] whole picture, not just the art. >> All right. Thank you. Thank you. [4:56] » I'd like to speak. Go ahead. [snorts] >> I know you think I sound like a program. [5:01] My biggest concern is is that this is once in a lifetime oper opportunity, [5:06] generational opportunities. And we as a city of Memphis ought to do [5:12] what we can to allow our locals to profit from this instead of hurt our [5:18] locals. And that's my biggest concern because this is the only time we're [5:22] going to be able to help our local people do anything. And you know that we [5:26] are one of the if no way the number two lowest economic, socially, economically [5:31] uh county in the state of Texas. So we do have an opportunity for some of our [5:37] people to make money out of this. Let's don't hurt them uh by kicking them in [5:42] the shin. I mean that's all I want to say. [5:44] » Sure. That's fine. >> Anybody else? But there is opportunity [5:47] you said and there is things that do need to be worked on there. It's going [5:50] to be rough like the Sure sanitation. Understand that. [5:55] » I have one fact that was brought to my attention earlier. The infrastructure [6:00] was built for a much higher population than we have at this time. So the people [6:06] that are concerned about it handling more people especially at the level that [6:11] we are growing right now should not even be [6:15] » right. It's just another rock to throw. [6:20] » Um good evening. My name is Amy Trible and I'm speaking tonight regarding the [6:25] proposed RV park ordinance. Um I'm speaking tonight as a nearby resident by [6:30] the RV park and I want to share concerns that I believe are important for the [6:34] ordinance to address. I urge the council to include fencing requirements and [6:38] enforceable quiet hours in the ordinance. I live near the RV park on [6:44] 18th in my family and I have had repeated instances of people coming onto [6:48] my property at all hours of the day and night. In one instance, the property [6:53] owner was present when it occurred. This is a serious safety concern. A properly [6:59] maintained fence is not about appearance. It establishes clear [7:03] property boundaries, helps prevent trespassing, and protects neighboring [7:07] residents. I was told over a month ago by the property owner that a fence would [7:12] be installed, and no progress has been made. This is exactly why the [7:16] requirement should be written into the ordinance rather than relying on verbal [7:21] promises or individual agreements. I also know that residents near other RV [7:27] parks have voiced similar concerns regarding property lines, fencing, and [7:31] the impact on surrounding properties. I also ask that quiet hours be included in [7:36] the ordinance to help protect nearby residents from late night noise, music, [7:40] and disturbances. I support growth in development of Memphis, but it should [7:44] not come at the expense of nearby residents safety and quality of life. [7:48] Including fencing requirements in the ordinance and enforcing quiet hours [7:53] would set clear expectations and ensure these issues are addressed consistently [7:59] rather than le left to informal promises. Including these requirements [8:04] in the ordinance ensures accountability and prevents these issues from being [8:08] handled on a case-byase basis. Thank you for your time. [8:11] » Thank you. >> All right. Anybody else? Okay, we'll get [8:16] rolling there. Go ahead. >> I just want to speak on the [8:20] infrastructure that everybody's worried about. Yes, I did. I had limited time, [8:25] but I did. We are our uh permit uh allows us $365,000 [8:32] I mean >> gallons a day, [8:35] » which if you calculate that, that's uh >> you're talking about [8:40] into the into the system. >> And on the average in uh [8:48] 2000 we had which we had it wasn't the biggest population but it [8:54] was like 500 people more. Uh we were having 50 million that that roughly uh [9:00] goes to about 117 million that we do for the year. And that year we did 50 [9:06] million which we're not by any means close to. [9:10] » Okay. >> So you're basically addressing that that [9:13] we're for improvement, >> right? Just to [9:15] » our infrastructure can. >> Yes. And as of uh 23 we had 22 million [9:21] that come in. That's uh when you're capable of 17 million you get 22 million [9:27] or less. It is not [clears throat] [9:30] a concern that not water or uh sewer. >> How are water wells? I was told [9:42] by very very reliable person that we are in need of a new water well. [9:47] » We are but it's not a we've tried it. Uh the last time I was [9:53] two years ago, but it's uh over half a million dollar. Obviously, we don't have [9:58] that that money. Uh we've got five good whales. We've got two gas, two electric [10:06] or three electric. That way we run out of gas, we have electric. We run out of [10:11] electric, we have the gas. >> Will they keep up with more water coming [10:16] through? Well, our biggest deal is we've always been the top the the the [10:20] forefathers have always thought about this [10:24] » and right now I mean people ask us why do we have so much I have a,820,000 [10:30] gallons uh on standby >> is that with green belt? [10:35] » No sir we don't use green belt that is strictly out of our [10:38] » the green belt line has been used in 18 years [10:43] long >> it does not mix. They went to tomies. We [10:47] were using toine and they do not mix without us adding ammonia and it does [10:53] not but we have in at a cost of uh I would [10:59] say no less than a,700,000. [11:05] We're it it should be there at the 820 which is when our tanks were off and of [11:11] course that's within us just like the other night we had that loop we had that [11:16] line that both come in it was uh it was putting out 500 gallons [11:21] » for that loop not to mention what the firefighters were having [11:28] » all right >> granted that's not you know wasn't just [11:31] for days and days and days we're We're very well set for water and waste water. [11:41] » All right. Thank you, Junior. Uh, you know, I can also speak for three [11:46] minutes. Also, I want to I want to bring up the city of Memphis is not the it's [11:51] been, you know, we're talking about addressing what's going to happen around [11:54] here with the city council. Are we ready? And all that. So, all that's come [11:58] to be and and and then of course the RV deals are going up uh maybe quicker than [12:03] we thought, but that's fine and dandy. One great thing about our our you know, [12:07] we have our water system outside of town. That water only goes to Texas. [12:12] We're just so blessed to have drinkable water. I think we've got best water [12:18] ever. I mean, I drink it all the time, but we're so lucky there. The only the [12:22] thing that was brought up about any kind of a regulation as far as city council [12:26] and ordinance goes is we don't really have any other than we have to go with [12:31] what the state and they just they have some new ordinances about RV parks and [12:35] stuff like that. So we we would have to basically the people that have one or [12:39] whatever would have to adopt those standards and I guess it would be up to [12:43] city council to follow through on that. So we don't have any standards. Amy [12:47] brings up some great points that uh that we need to be aware of. Fire safety. [12:53] That's one thing that we talked about our last council meeting the other night [12:56] where we were as far as putting all that together, making sure that um you know, [13:00] we can pass on to the to the citizens of Memphis that are going to do this that [13:04] that um you know that we have to follow the state law. So, we don't really have [13:08] any anything on our own on our books. Uh talking about uh fencing, I had a [13:15] gentleman bring up that uh there was a place going up and he lives next door, [13:20] has three uh girls and was was interested about having a privacy fence, [13:24] you know, to keep that going. So that was brought up. So I don't I don't you [13:28] know that may be something we look at. I think quiet hours is another very [13:32] important thing. And so that would be the same thing that you would do if [13:35] somebody's living in a house next door to you or whatever other than if you're [13:39] going to have a number of people maybe the the fencing. So, uh, the city [13:43] council and I'm speaking on behalf of city council, we don't have any [13:48] anything. It's all been brought up on what what we can do in order to provide [13:53] the best u uh oversight and not get in the way like Ronnie was saying about [13:58] people doing that. that we can't uh uh I don't think we're going to go out and I [14:04] don't council up to them tonight to bring some things up, but uh our packet [14:08] was put together. We have a bunch of ordinance from other cities, things that [14:12] we've looked over and consider and same thing on our little golf cart deal and [14:16] all that. So, I just wanted to bring all that up and if anybody on the council [14:20] like to say anything as far as our open session here goes and you [14:25] » Yeah, I'd like to add one thing that has [clears throat] always been on my mind [14:29] and I would like to state that uh as a council as as a town that we never [14:36] considered a pipe water out here, >> right? because that's I know there's [14:41] money that the state come along and say you're going to you know right now we're [14:47] so >> in my 35 years here that is not [14:50] » yeah I mean >> what you want to do look at look at [14:53] climate >> absolutely [14:54] » I would ask that you never even consider >> not to you could pipe it 30 miles and I [15:00] know >> we have the storage we have the water [15:05] but please do not ever consider that >> no I think We're very very lucky on that [15:11] behalf. >> All right. Uh so let's go ahead and move [15:14] on. Any anybody else want to speak up on any anything before we move on? All [15:19] right. Now we go ahead and uh bring up old business. Uh look for a motion to [15:23] remove the table items off the table. We've got a few there. [15:32] » I got a motion two second. All in favor. >> All right. Second. Oh. [15:39] U second it [15:43] unanimous. Okay. Discuss and consider amendments to the golf c golf cart [15:47] ordinance. I don't remember it being that thick when we did it a while back. [15:53] But I think we need to uh shorten this thing down a little bit. put on their [15:57] golf cart or side by side with are uh are legal to be driven on the streets of [16:04] Memphis, Texas with a permit except on 16th Street and uh and uh null highway [16:11] 254 [snorts] because the Texas state law speed limit on public streets in our [16:15] ordinance here says 30 miles an hour. That's fine. Uh I think all vehicles [16:20] wishing to operate in town need to be permitted, which was brought up for [16:23] safety reasons. uh permitted. That would be people going back to the golf course [16:28] or riding around town. And they have to have their uh slow sign on the rear. [16:33] Have to also provide insurance, which is part of our permitting process through [16:38] the city of Memphis. And uh would be also have their insurance and the the [16:44] sticker and the sign always posted on the vehicle at all times. And to operate [16:49] at night, I think it'd be easy enough to kind of scale that down that they would [16:52] have to have front and rear lights And that would be about it. Underage [16:58] drivers, I think it'd be 16 or under. And uh but this there there's so much [17:03] stuff in here. It's rather thick. So I think we ought to just make it if [17:07] there's anybody operating the vehicle in town, uh we're going to require them to [17:11] be permitted for our liability reasons. [17:16] Council have anything else to say on that? Or how would we go about skimming [17:20] that down a little bit? I think the biggest thing is because this says in [17:25] this ordinance that they're not allowed >> in the second paragraph. [17:29] » So that needs to be that's what >> I remove that and then I was trying to [17:36] get for those that have the golf carts that don't have lights, let y'all permit [17:42] those and use them for daylight hours only and with hand signals. That way [17:46] everybody can use their golf carts. Fair is fair. Really? [17:53] » So during the day, they don't have to have any lights [17:56] » during the day, I would say. Yeah. No lights as long as they're using hand [18:00] signal. There are a lot of golf carts that I see [18:03] driving up down the road that don't have lights. [18:05] » And what about uh it says the person has to have a valid [18:10] driver's license. >> Correct. That's state law. [18:14] » It's operated on the road. It has to be a drive valid driver license. So, what [18:18] about electronic bicycles? >> What are the [18:22] » Now, you want to get into that. This falls into the same thing. [18:26] » Well, the they're still writing some stuff on the bicycles because certain [18:31] certain electric bicycles start getting into [18:36] actually being motor vehicles at that point. And once they're over a certain [18:41] cc or speed, >> then they're going to need licenses and [18:44] insurance and helmets. And the thing about the golf cart too is [18:49] if there's a tournament that's late and you can't get to your house [18:54] and you have no headlines. I mean, you have to make some type of [18:59] » Well, you can say unless you know, unless [clears throat] [19:01] tournaments, [19:08] » you drive. >> Easy. [19:12] » Oh, I know you do it all the time. I know they do all [19:17] » they can call you and you guess all my [19:22] » So what's the council have to say about just at this point [19:27] holding that uh uh paragraph B. [snorts] So that kind of contradicts [19:34] what the ordinance was about the original. But there are sure a lot of [19:38] papers uh here with it. We want to add some more to it for [19:43] emphasize golf carts and off-road vehicles [19:46] » right side by side >> 4x4s are not [19:49] » four that's not >> dirt bikes are not [19:51] » no you're talking about something where you're sitting in it with a wheel about [19:55] kids that are uh not of a legal age but they're uh going back and forth to the [20:01] golf course during the day >> law says they can't do it [20:04] » I know some kids going over there to play golf but [20:07] » what about the high school kids they play golf we have golf with high school [20:10] so they are they not allowed to wear their golf carts either Well, that's [20:14] what >> state [20:17] driver [20:41] » I don't think has a [20:46] So if they school they should be shown to [20:50] » by the school [20:55] board. >> All right. So [20:58] » I'll put this in as presented [21:05] » presented. [21:08] remove that. >> So, at this time, you want to go ahead [21:12] and make a motion to remove B. >> Paragraph B. [21:15] » Paragraph B. >> And we have a second over here. [21:18] » Are we going to add the other golfers? >> Are we [21:22] Are we going to add the other golf cart? Right now, you're required to have [21:27] front, rear lights, insurance, all that stuff. Allow the [21:31] ones without lights to be operated on the street. We got plenty of them on [21:34] there. We may as well register them and get them insured. [21:41] whether it's daytime or night time. >> Well, the one thing about getting a [21:47] permit is that that clears us for a legal liability that they actually don't [21:50] know what the rules are, you know, and it's not us, but somebody could come [21:54] back. So, we're not enforcing it and so on, get run over. That's what happens. [21:58] Ruins it for everybody. But want to make an amendment on your [22:04] » Yeah. >> Mortgage there [22:06] » with the time addendum [22:11] front and side reflectors all the add to the city code 11046. [22:19] » So all >> you want to make a motion that all golf [22:23] carts and side by sides need to be permitted if operated in the city of [22:26] Memphis and then and then I pull this paragraph [22:30] B. >> That sound about right? We put an [22:35] exclusion on their tournaments. [22:43] Go ahead. >> Can I question what you're asking? You [22:46] want to remove [22:59] » with the exception of I guess tournament. [23:04] I don't I don't know how you >> how do you enforce [23:10] what? >> Well, you just kind of let it go on with [23:13] tournament weekend and the rest of time. [23:20] » You're going to have a lot of town people riding around, [23:26] » you know, that weekend. There's, you know, they're getting ready to have this [23:29] coming weekend. So you have a lot of people there stay at the hotel or [23:33] wherever they're staying they golf >> no take weekend off [laughter] [23:44] » you know it's like county picnic weekend where kids are riding their stuff all [23:48] over town >> on Saturday. [23:52] » So during Hall County Picnic the kids can't ride their golf carts in the [23:55] parade either if they don't have a license. Well, they they do it. So, that [23:58] would be that would be an exception, would they? [24:02] » By law, no. >> And they ride [24:05] because they ride around town. It's kind of like a free free day. [24:08] » Will I enforce it? No. But by law, yes, they're required. [24:13] » But just on a regular basis is what we're talking about here [24:17] other than special circumstances. [24:35] Well, what why don't we just do this? We'll move uh paragraph B tonight and [24:39] then we'll bring it back up and look at the whatifs and all that. [24:46] You know, go to other towns. [24:50] » They're driving them around after tournament. So, I I don't see how you're [24:54] going to enforce that. I [snorts] don't. But if they hit [24:57] somebody, >> well, we've had them thrown out of [25:01] cards, too. >> Hit cars. [25:04] » So, you want to make it easy with that? >> I'm going to move the motion. [25:08] » Just remove paragraph. >> All right. So, you want to second that? [25:14] » I'll second that. >> All right. Got second. All in favor? [25:17] » I can raise your hands for record keeper back there. [25:22] All right. We'll work on that one later. All right. Uh, next up, uh, under new [25:27] business, uh, discussing to consider the loan for from the revolving loan fund to [25:32] Cliff and Cindy Banner during business as Gabby's [25:39] in the packet. [25:47] Everything still good to receive. [25:51] » Huh? We have to go home. [25:55] » Yeah. So, so the revolving loan fund the revolving loan met on the 6th of May [26:03] earlier and they discussed with Mr. Mrs. $7,000 for a machine and the volume fund [26:14] managers wanted to give them they recommend to give them $7,000. [26:20] So, It's up to council's approval whether or not we proceed. [26:28] » All right. Got a motion by Mark, second by by Zack. All in favor? All [26:33] » in favor? >> All right. [26:38] » Got that Malia? >> Yes. [26:41] » All right. Uh, we got a table B here. New business. [26:48] I don't I don't think he has anything for us. [26:53] » What? >> You have a budget for the budget. [26:55] » The budget presentation you wanted. >> I've got some stuff, but uh let's go. [27:00] Can we take it to the next meeting like we always do? [27:04] » Well, don't say that. We got a crap here today. [27:08] » Always do. Wait a minute. >> Yeah, I'm still doing some I I still got [27:13] some research to do, but I think You need to have them. [27:19] » All right, we got a motion to table. Second by [27:22] me, Lisa. All in favor? >> I [27:25] » You get that? >> Second by. [27:28] [clears throat] >> All right, next up, discuss and consider [27:31] the National Fire Prevention Association code enforcement for RB parks. [27:37] And along with that uh there's also what is the one that just [27:45] came down from the state? What what else is the other? What's the heading of name [27:49] of that bill or whatever >> other than the fire? What's it? [27:53] » Yep. >> So Rex handed out in this packet. So [27:57] this has to do governor Abbott back September of 25 of last year. Uh the [28:01] heavens 27 camp safety act. Uh this had to do with the uh the camp Mystic [28:06] flooding and any anyhow Governor Greg Abbott signed NFPA 1194 [28:13] the law. So I just I just got 1194 here, but it's there's a lot of there's a lot [28:19] of stipulations in there and codes that all existing RV parks and new [28:25] constructed RV parks you don't have to follow. So, I just got this I got this [28:30] here press time, but uh I've got the bill that Governor Ab signed into law [28:35] and uh the U says right here now withstanding chapter 764 health and [28:41] safety code is added by this act, the recreational vehicle park or campground [28:45] to which that chapter applies operating on the effective date of this act is not [28:49] required to comply with that chapter before September 1st, 2026. So [28:54] everything that's in NFPA 1194, all existing RV parks and all new [29:00] constructed RV parks to that standard >> by [29:04] » state law by this is state law. It's supposed to be [29:10] » that's that's coming from Governor Abbott. [29:13] » All right. >> So with that, who is the one that [29:18] enforces that? >> That will be your fire marshal. And is [29:22] Nickif? [29:26] » No. So, >> so let's see. So, the discussion I had [29:29] with [29:33] so according according to our city ordinance what was passed excuse me. [29:40] So in uh let's see in March of 23 the uh office of the fire marshall was created [29:49] and it says that the fire marshall shall be properly qualified for the duties of [29:53] his office which include the power to make arrest and shall shall be shall be [29:58] removed only for cost. He shall serve on a voluntary basis without compensation. [30:04] The other thing that goes into our city ordinance as well, it says uh the fire [30:09] prevention code shall be enforced by the fire marshal. The fire marshal shall be [30:14] exeicio chief of the fire prevention bureau. The fire marshall may detail [30:18] such members of the fire department as inspectors and shall from time to time [30:22] be necessary. So chief plant is the fire marshal um [30:29] according to according to our according to statute or according to our ordinance [30:35] but you know yes as far as the credentiing Nick has the credential. So [30:40] Nick does the inspections and if there's anything out [30:43] » that's that's according to how far >> that's how we [30:48] point it out and then if you needed a ticket break that out [30:52] » so the people that have already picked up building permit to do uh the RV [30:56] business here in Memphis will contact them make sure they have a copy of that [31:00] or just enforce them >> well they should get a copy of the house [31:04] » well I mean a permit should other ones that I'm that already in progress. [31:12] » Yeah. I mean, whenever you come in, you get a copy of it. [31:17] » Oh, so we have a copy? >> Yes. [31:19] » Okay. No, we didn't before. [31:24] » They didn't give you a copy that you [31:29] have it signed in place. [31:35] » Well, so we I think we just got it. Did we? [31:37] » I got it Friday. Right. So, I mean, we'll follow up on that to make sure [31:41] everything's, you know, we're not it's not anything that we're the city of [31:44] Memphis is doing. >> So, can we have copies here? So, if they [31:47] didn't get it, they can come get one. >> Yes. [31:49] » How are we supposed to know what we're going to have to [31:53] » I'll put together a packet >> online? [32:02] » Well, it's it's nothing. It's it's all new to us, too. I mean, this is just [32:06] kind of a whirlwind deal. I mean, we We don't, like I said, we don't have any [32:09] ordinances on the the books as far as that goes other than just following what [32:13] the state's directive is. >> We're just talking. [32:18] » Yeah. But I'm just as far as all the [32:23] » It's just you. [32:29] So right now, if I'm understanding it, Rex is leaving at the end of se No, end [32:37] of August. September, maybe next week. I don't know. [32:39] » Okay. So when the county does take over after he retires, then it'll be the [32:47] their county will do that. >> We'll appoint somebody probably out of [32:50] here because it's city. >> Oh, okay. [32:53] » Yeah. [32:56] » Okay. And then and then Mr. At that time, you know, it says in our ordinance [33:01] that, you know, it has to be an arresting officer. But that that's just [33:04] that is as far a lost to make that call with it's the Texas [33:09] Fire Prevention, the Texas Commission on Fire Prevention that a fire marshal does [33:14] not have to be [clears throat] officer. It's up to our local jurisdiction. So [33:18] basically you can repeal the ordinance depending on how one week when you get [33:23] down to the end of September that that ordinance can be repealed and then you [33:28] can you can change change orders to require the fire marshall not to be [33:33] arresting officer that it can be it can be somebody. [33:38] So over here back under discuss and consider the national fire prevention [33:41] association code enforcement parts. Uh I think the easiest thing to do is have [33:46] that available and we'll uh contact the the people that have already had a [33:50] permit that we have that for them and we'll go with that and that would [33:53] basically take care of seeing then wouldn't it [33:57] » so we need to >> adopt this? [34:02] » No, I mean that's >> national fire. [34:04] » It's state law. >> I'm just saying that we to discuss and [34:08] consider. Basically what we want what I'm saying is we we just have have that [34:12] packet available to make sure that everything's good but it's not what [34:15] we're doing. >> Yes. So so when we drafted the agenda we [34:19] put it out in Tuesday of last week. I was not aware of the 1194 NPA [34:24] requirement. So and that's that's part of everything that got put together in [34:28] pack that was put out Friday that this was signed into state law last September [34:33] by Governor Ab. So, it's it's not it's not as far as us adopting the NFPA code [34:39] that was adopted back we adopted the code back in 23 [34:43] » and uh and under it's 693 but we we follow the NFPA code but this is this is [34:51] just Governor Abbott's signing state law and we we have to [34:57] abide by that. So, we're we're already we're already uh we're already with it [35:03] as far as as far as what what NFP regulations are out there and I've got [35:09] it here and I'll make copies for everyone and be found on the internet [35:13] too, but I'll make copies for everyone and everybody. [35:17] » So, somebody want to make a motion have that available to pass out to our permit [35:23] recipients. I will make the motion that we have [35:31] available. >> Yeah. [35:35] » All right. That all right with everybody got a motion to do that. You want to [35:39] second that. Win. >> All right. All in favor? [35:43] » All right. You vote? >> I [35:47] » unanimous. Okay. All right. Next up here, discuss and consider creation of [35:51] city ordinances on RV parks. And as far as [35:57] I think the city council goes, we don't have any. [36:03] Is that right? >> Yeah. So, [36:05] » and other than I think that the idea about uh this maybe discussing the idea [36:10] of maybe the fencing issue possibly depends on you know something to look at [36:16] and uh quiet hours and I think uh was also brought up about house numbers [36:22] that's been brought up in the past and we may just have to put the numbers down [36:26] for somebody's house on make sure that that's uh visible at those locations too [36:33] because we have you people doing deliveries. We have uh uh [36:37] ambulances going out and can't find it. So, we tried to do a deal. The the [36:42] school was going to sell them one time. We sold a few. But, I think it's [36:45] something the city council was going to have to go around and put up and charge [36:50] people $10 or whatever it cost to get that little reflective plate on there. [36:54] Make sure every house has it uh where they can see it. I've seen ambulances [36:59] going up and down streets looking for a house with all their lights on. [37:04] Yeah, I just so so as far as the what was in your packet is you know the [37:09] ordinances that have been placed for you know surrounding communities and what [37:13] they put in there. So with that being said in NFPA 1194 I think it it would be [37:19] a suggestion that maybe the mayor appoint an ad hoc committee that we can [37:23] go through and we can cross reference 1194 with what what other ordinances [37:27] that you see in the packet that you may want to far as fencing restrictions. You [37:32] know, there's there's several things in there. I I haven't gone through 1194 to [37:35] to see what the the correspondence is between the the other ordinances passed, [37:40] but that's something I think that we that the mayor needs to put together an [37:44] ad hoc committee with people with the council members and we go through line [37:47] by line and cross reference with the line 1194 and then we can present it uh [37:53] present it and have a hearing for people for review and then make any necessary [37:57] amendments that go from there. [38:04] All right. Well, uh I guess as far as that goes, would you be interested in [38:09] serving on that in that? Anybody else like to volunteer [38:13] to be part of that? That could be got one more person [38:17] like serve. >> I'll do it. [38:19] » You'll put those three on there and then by time we get ready for our next [38:24] council meeting coming up in uh June, then we can look at that. I don't we [38:29] don't need to another call meeting right away. Do we? [38:32] » I don't think so. >> Okay. [38:36] » All right. Uh we move on that good. [38:42] You got all that, Molly? >> Yes. [38:44] » Okay. Discuss and consider amendment to the city building permit. [38:54] » Yes. [38:58] I table this to the next city council meeting. [39:03] » I'll second. >> We got a motion to table that. Second [39:06] over here. All in favor? [39:10] » All right. Motion carries. >> Uh that it [39:21] » all right. Uh I'll see if this council wants to say anything. We'll wrap this [39:25] meeting up here. >> We still have the That's a city building [39:28] permit. >> Huh? [39:29] » We still have E. >> Oh, I thought you saying table that. [39:34] » No, but together committee on D. Okay. Discuss and consider amendment for the [39:38] city building for [39:54] » that question. Was the is the issue or a question of NPA 1194 and the ordinance [40:01] being limited to the discussion for RV parks? [40:06] I think it's uh I don't >> I guess one thing is were the board not [40:12] also looking to all residential structures as an example uh NFPA1 talks [40:18] of uninhabited dwellings residential the requirement [40:23] that all combustibles be removed exterior interior property it's a major [40:29] fire hazard concern as we're experiencing right now wildfires um this [40:34] is about the health protection and safety of city of Memphis. We need [40:38] to exped [40:52] uh we had our open session at the beginning that young lady was making [40:56] making a comment about uh buyer safety housing buildings as well. So I think [41:01] lady back here. So that we need to consider that as a whole too. Not just [41:04] that, but that's what seems to be the hot topic right now. But yeah, you're [41:08] right. We need to be aware of all that. [41:20] We're we're we're uh don't have a code on that, a building code, but we follow [41:25] with the state uh requires. [41:30] So, you don't you don't have we don't have a building inspector for the city [41:34] of Memphis. Yeah, some cities do, but we don't have that. And that's [41:37] » we have it in code. >> What? [41:41] » In the code that electric will be inspected by the [41:45] electrical inspector is in >> I don't think so. [41:50] Jack [42:01] was >> Did we see something in the code that [42:04] says electric needs to be inspected? >> Yes, there's a in the building [42:08] [clears throat] in the building regulations. [42:12] In the building regulations, we do have uh [42:16] you know that's under our electrical code, plumbing code, um building [42:21] inspections official. That's all that's all in there [42:25] as far as Yes, we're supposed to have those. [42:28] » Have an inspector? >> Yes. [42:30] » Yeah. So, like an electrical city never had one. [42:34] » Yeah. >> When he was here was an inspector when [42:38] he was here, I believe he did it right. on the building. [42:58] » So, so with with a plumbing with a plumbing inspection, that's a that's a [43:02] TCQ requirement for it's a CSI customer service inspection. So that's Texas [43:08] commission quality makes us do that and that's where we have licensed plumbers [43:12] go through and before everything's >> somebody tank than the person that's [43:17] putting it in has to be licensed in order to put [snorts] [43:22] » the only thing we've ever done on the electrical require a and that's just [43:27] talking to him that a certified electrician does. [43:33] We really have no [43:39] We always require certified electrician to do the jobs which all these that have [43:45] been putting in right now are the [43:50] but if there were there's no really nothing we can mention the plumbing [43:55] basically plumbing part would be our city hooking it up to a city outlet. So [44:00] you have you have yours there and long as that you know they're okay with that [44:04] then that takes care of that. >> So so going back going back to your [44:08] electrical inspection it was it was adopted in 2005. It says uh it's a [44:14] 402093 office of electrical inspector [44:18] established says hereby created the office of electrical inspector who shall [44:22] be appointed by the mayor subject to confirmation by the city council. He [44:26] shall have at least two years experience as an electrician, shall be good of good [44:29] moral character, shall be versed in the approved methods of electrical [44:33] construction for safety of life and property in the national electric code [44:37] and shall receive such compensation as the city council may decide. [44:42] » And who was that person? [44:54] » That's interesting. I went here at that time. [44:57] » That's interesting. >> Okay, sounds good. [45:01] » So, just just one thing I believe, correct me if I'm wrong, chief plant, [45:06] you you've had discussion with some local electric contractors about [45:09] providing some of this service. But the main thing is if we're requiring [45:15] them to be licensed, then my next step was I was going to approach [45:21] somebody approach electric see if they had somebody [45:25] interested doing it as a per site basis. However much like the plumbing thing I [45:30] think what are we charging 75 >> so you see what they want for the [45:38] property have to pay for it. [45:42] wouldn't be able to [45:52] » We're not doing this for me. We're just This stuff's been on the books. [45:57] » So, [clears throat] would all the electrical inspections, the plumbing [46:00] inspections, would they be also for the Airbnbs in town and the hotels and the [46:04] rent houses and all that, too? >> Well, it would be any new construction, [46:08] I would guess, or any addition anytime they touch what's already there when [46:12] » there's new construction not old construction [46:17] they're working on if they're coming in to do something the whole idea [46:20] » is new and existing >> yes so if they're touching what they're [46:25] already doing you know if they're adding on or whatever what do you have there [46:29] » section 42 096 um specifically states completion of wiring installation or [46:35] alteration of any building or structure for light heat power appliance or [46:38] apparatus uh must be >> that was to go back and check things [46:43] out. Anything >> new any addition? [46:52] » Well, so where are we on having to discuss consider the city building [46:56] permit? We have to find get somebody do that then. [47:00] » I think the reason I don't think they ever adopted it is they could never get [47:03] anybody and u electrician [47:10] » [clears throat] >> probably [47:18] electrician. [47:23] » Yeah. >> Since there may not be one specific [47:26] master electrician in Memphis that would be necessarily obtained by the city of [47:30] Memphis, could we put together a list of approved master electricians that could [47:35] do the jobs? >> Yeah. So that it wouldn't be a, you [47:39] know, >> you don't have to have a person. Yeah. [47:41] » Yes. [47:47] » Most people do electrical work around here. They do it because they know how [47:50] to hook the wires up. [48:01] here. Somebody want to make a motion to go ahead and follow follow what the [48:05] ordinance is in ' 05 and [48:09] work on getting that done. It looks like we should have done it in [48:19] order. I got a question. So the people that's [48:22] in construction, how long it's going to take y'all to [48:26] find somebody? They got to stop construction [48:30] electrician to uh I mean because up come in after [48:38] you wait like me myself. Do I need to wait until she get inspector in to [48:45] inspect before I can rent it out? >> I I would say no. And I don't think I [48:49] don't want to have to take the heat for all that. [48:52] » I would say I would say that you know proceed like you've been doing. [48:56] » Proceed like you've been doing. >> There's code on the book for that as [48:59] well. >> Huh? [49:00] » There's already code for that as well. It says a reasonable amount of time. [49:05] » It says reasonable amount of time. >> The failure to comply statute that's [49:10] already on the books. It it only specifies a reasonable amount of time. [49:14] So if you wanted to change that ordinance, you would have to vote on [49:17] what is reasonable. >> I just think right now priority should [49:21] be finding somebody getting a list together of approved master electricians [49:25] and getting it as soon as possible so people that want to do it and are doing [49:29] it can get up and running and it doesn't nothing comes back later on. It goes [49:34] ahead and we get this figured out sooner rather [49:38] than later. >> We should have had this much activity [49:40] around here since I've been here a few decades. So [49:44] That's interesting. Great. >> If you're going to build something, [49:46] you're going to have to have it in electrical inspector. [49:50] » Electrical and plumbing says once you get it [49:55] run, >> then they have to come in and inspect it [49:58] and then they have to over [50:05] » I think the inspector will >> report back here. [50:08] » Reports back to us and says it's a go or no go. [50:11] » You want to say something, Bob? is a majority of the time that your insurance [50:16] is going to require that your electrical systems are certified [50:22] and that your uh before you can the electric company will h will hook up [50:29] anything anymore require that it be >> add on to what your your existing [50:35] » if you're going to add on they're going to require it be inspected before that [50:39] before they will put the meter back in And I know your insurance is a big deal [50:46] on that. [51:09] Somebody else [51:20] know how to do it. But again, it goes back to licensing. [51:29] Somebody want to make a motion we follow up on this at D here. Discuss consider [51:35] building permit. >> So the second page, [51:40] » huh? >> Well, I'm talking about E here [51:44] discussing the city building per this bill. Yes. [51:50] » Well, that would go back to what's been brought up as far as electrical. make [51:53] sure they hold that. [51:58] I >> mean, I guess we better must must make a [52:00] motion on it. Sound like it's should have been done to add if we have the [52:05] plumbing right here and saying there will be an additional $75 inspection [52:09] fee. I think we need to have electrical too. [52:13] » We need we need to find out for sure if it's only $75, [52:16] » but I mean we also need to look more into our city ordinances. We need to [52:20] fact check before we just go to amending and approving stuff. We need to go in [52:24] and check and make sure we're not contradicting what we already have [52:28] » because there is some stuff that Leslie just showed me that uh you are allowed [52:32] to do your own renovation on your own property. [52:35] » You are in Texas. >> Yeah. Without requiring without getting [52:39] a permit, >> right? [52:44] » Well, you can you can make a motion. We can we're going to [52:49] go over there in that seen [52:56] » electrical inspector. Can we get our own electrical inspector and then come and [53:00] show you or submit it to y'all? >> I'm saying I think so. I don't I don't [53:04] » That's when we're talking about getting a master list of all master electricians [53:07] in the area that you can go from and call them in and they will uh they can [53:13] come do the inspection. I know they are saying we need to have our inspection [53:16] right now. So >> well I mean not right now it'll happen [53:19] but as soon as it says in a timely manner but you know in children for [53:23] instance they have a building code inspector. So if anybody does anything [53:27] in town they have to go by there and sign off on it. So you're at there kind [53:31] of they're rehearsing but in never had one. [53:34] » So that's where [53:37] » Liberty down there. >> Liberty done yours and buddy Billy Buddy [53:41] Billy Beloon did yours and he's a plumber. You don't have any problems. [53:45] » All you need is a statement. >> You just have to have it signed off on [53:49] basically. >> My part's already up and running. I have [53:52] people there already. >> Yeah. [53:54] » It's been open for a month now. Well, like I said, this is all this is coming [53:58] in here pretty quick for city council and and we don't want to make any any [54:04] dumb decisions or any dumb statements. [54:08] » That's a first [laughter] [54:12] and you're already up and running and you know the electrician and the plumber [54:18] already put it in. Why didn't they sign off on it and submit that to the city? [54:24] » I would like that. Okay, I think that'd be right by now. [54:29] » I mean, if they're licensed, that'd be fine, but other than that, if if [54:32] somebody just wired it up and all that, we may have to go back and get it signed [54:35] off by somebody that's certified and say, "Yeah, that looks good." Because, [54:38] you know, you're going to have so you can only hook up so much so much power [54:42] to so many breakers and so on. And >> so, uh, you know, we want I guess we [54:47] want to follow what the state regulation is. So, [54:49] » they can't sign off on their own word. [55:09] I'm going to make a motion that we table this to the next council meeting [55:13] » and we need to be looking until then >> on until our next meeting we need to [55:17] look at making a list of master plumbers and master electricians in the area they [55:21] can be put on the list Okay. >> So, the people that currently have one [55:25] running or are currently building one has a list to go by. [55:30] » All right. Got a motion to go ahead proceed with that. Second by [55:34] » I'm sorry. A motion to table it. You're seconding that. All in favor? [55:38] » I. >> All right. That'll wrap us up on that [55:41] end of it. Council have anything else to say tonight or [55:44] » on our call meeting? I want to say thanks very much for everybody coming [55:47] out tonight. Any final comments from the crowd [55:52] » about anything? I mean, go ahead. >> You know, [55:57] Memphis is based on agriculture. It has been for my last five decades. Been here [56:02] before that. And this this this opportunity to have to grow our [56:09] population, whether it is RV parks or putting a new hotel. So, I'm looking [56:15] into that, you know. I think we should embrace it, [56:19] but we do have to go by the state laws, you know, but I don't think we need to [56:24] treat it. I think what we do for RV parks, what we're going to do to them, [56:27] we need to do to rent houses that nobody's lived in. I think I think we [56:32] need to take a while to look at that. I think that's already been versed a [56:34] little bit. I just wanted to throw that in there as extra. You know, RV parks [56:39] need to be looked at. I get it. need to go by these new fire codes and stuff, [56:42] but I think there's a lot of other fires fire potential [56:47] around that that that's all I wanted to add. [56:51] » What about you homes in town that burn out, people are [56:56] living in them, they have no water, electricity. I can point out two or [57:00] three RVs that are parked, no electricity or water, people living in [57:04] it, no cure. >> I can drive you around all over town, [57:08] show you all stuff. And that's what we're looking into. We want to make sure [57:12] that we are code >> and following state law. [57:15] » So that that's also going to go back to the ordinance about light clean up and [57:20] if it's open to the outside get in there, animals, whatever. [57:26] » If it's a wreck and it's sealed up, then we that they will continue to operate. [57:31] You want to say something? So with the fencing, does it necessarily have to be [57:35] a privacy fence or can we just put any fence up that they know not to go on [57:39] other people's property? >> At the current moment, we have no city. [57:43] » We don't have to put a fence up if we don't want to. [57:45] » At the current moment, there's no city. >> But does it necessarily [57:50] have to be private? I would think >> be something where they go on this side [57:55] of their property. >> That's that's going to be a ordinance. [57:57] But I I would think that um uh since there's going to be a number of people [58:02] over there, it's probably going to want to be a privacy fence, tell the truth. [58:05] You know, we to hide that people's property and and yours from multipleies. [58:12] » Why would we have to put one up? I mean, why can't they put their fence up? [58:17] » Well, we'll just the council have to address that. [58:20] » Yeah. [58:23] So >> I can't answer that [58:25] » on that note. So even state law says you don't have to fence your animals in, [58:32] you have to fence your animals out. So by saying that, you're exactly right. I [58:39] don't have to build a fence to hide my property. You have to build a fence so [58:43] that you don't see it. Does that make sense? It's like the cattle law [58:47] » open range. So, >> don't and and I'm not saying any of [58:52] that, right? Like that's what the law says. [58:54] » Don't we have an ordinance against u abandoned vehicles and they have to be [58:59] behind a privacy fence? >> So, [59:02] that does. Yes. Yes. So, I I think the biggest thing is everybody's excited, [59:06] everybody's nervous. A lot of people do this when they really don't know the [59:12] facts and we don't know all the facts. All this stuff is due [59:17] that's coming in and it's overtaking everywhere. So all the council is trying [59:23] to do is put us in position to make all of y'all successful [59:29] but do it correctly, right? We don't want to put [59:33] 20 RVs in a you know what I mean? stacking everything on top. Yes, there [59:38] are multitude of other issues that need to be addressed by the council. It has [59:43] been forever. There's abandoned houses. There's [59:47] » old tires, >> old tires. [59:50] » I mean, there there's a lot of things that need [59:54] to be addressed, right? And has been a continuum that's um maybe got pushed [59:59] aside, you know, like most saying gets pushed off to the back burner. [1:00:05] But what the council is trying to do is do, we want everybody to be law abiding [1:00:12] in the construction of stuff. So if the state does come in here, they're going [1:00:16] to say, "Hey, let me see your stuff." Hey, right here. Not a problem. So [1:00:21] you're not penalized for doing something wrong. You're following the state law. [1:00:25] And just because you didn't know about it, I'm sorry. This thing is ain't [1:00:28] tough. It was published. You should have done your research. Your contractor [1:00:32] should have done your research. There's no excuse for not knowing. That is truly [1:00:36] not. You have to be diligent in yourself in knowing the laws and your contractor [1:00:42] has to be diligent. If you were the general contractor, [1:00:46] you're liable 100% for everything that was done. If you had someone else as a [1:00:51] general contractor, they have to do that. That's why they charge their money [1:00:55] to research and do what's correct so that you're according and they all any [1:01:00] general contractor does have to follow national code. installation of any [1:01:05] » I feel if we don't follow follow this that we're not going to be able to give [1:01:08] out a bid for that >> and that's all we're trying to do [1:01:11] » we don't want anybody we want people to prosper right I mean this is this is [1:01:16] about a fiveyear swarm right doors >> well okay yeah so [1:01:21] » 7 to 10 >> 7 to 10 so anyway I think it's great but [1:01:24] and we're not absolutely the council is here to make everybody prosperous in [1:01:30] this I mean all the business are starting up and it's like it's great to [1:01:34] provide, you know, is to ride and keep keep it done like spoke to so [1:01:38] everybody's uh protected and their investment. [1:01:43] » Yeah. You want your you want your investment if I go spend, you know, [1:01:47] $200,000 on put or whatever it is on putting an army lock. I want to know [1:01:52] that it's done correctly so somebody can't come in there and shut me down and [1:01:56] say, "Hey, you didn't do this correctly." And guess what? You're shut [1:02:01] down. And now then what do I do now? I got to spend another however much money [1:02:07] to repair, replenish, down that much behind. So that's all we're trying to do [1:02:11] and this is all. >> Um I know there was a question regarding [1:02:14] the decibel or noise ordinance and I looked it up. Um, there is a state [1:02:19] ordinance and Rex can correct me if I'm wrong, but it says that um, if there is [1:02:24] a noise complaint and the police officer has already gone out, if they go back [1:02:28] out again and the noise exceeds 85 dB, there is a state statute for that. And I [1:02:32] I you'll have to ask for what the exact number is, but there is a state statute [1:02:36] for >> that's not an RV. That is across the [1:02:40] board noise. [1:02:52] » All right, we're going to wrap. We're going to wrap our meeting up. Does [1:02:55] anybody else have anything to say? Because [1:02:58] » can I commend the >> speaker? Always hold your peace. Yeah, [1:03:01] » I would like to commend the city and the city administrator for cleaning up some [1:03:04] of the blight that was already in town when you guys took down some of those [1:03:08] buildings and cleaned them up and then auctioned them off. You guys did a great [1:03:11] job in that and that was amazing because you didn't just sell a dilapidated [1:03:15] property for somebody else to figure out. You guys took care of the problem [1:03:19] and you made it an effective solution and you were able to cover your cost [1:03:22] with it. I think you guys should be commended for that. So, thank you very [1:03:25] much. >> You're doing a good job. [1:03:26] » You guys are doing a good job. This all this is this RV deal is just [1:03:31] all of a sudden you tell that we we already [1:03:36] look at old fire. >> Yeah. Well, that guy brought the dump [1:03:40] over there for his fence. >> All right, we're going to wrap it up. [1:03:43] So, >> hold on. I'm going to have something to [1:03:44] say. >> I would just say um yeah, I commend the [1:03:48] council on the work that you guys have in front of you. It is going to be a [1:03:51] very arduous task. Uh you're going to make a lot of people upset. You're going [1:03:55] to make a lot of people happy. But I I would just ask you to you know remember [1:04:00] that the the job of the council is not even so much growth in this state of [1:04:04] population to people go to Alba that it is technically the 198 [1:04:11] but but growth is prosperity for the people that are here the investors that [1:04:15] are here um and you have a really unique opportunity I have to be very aware of [1:04:18] what's about to happen uh here not just south you know children's burn area but [1:04:24] it's also coming Memphis. Um, so there is a unique opportunity that Memphis can [1:04:29] see a resurgence and growth and uh become a very desirable place in the [1:04:34] panhandle. But you guys are going to make some people upset in the process. [1:04:37] Uh, but but for the greater good of what you've been elected to do [1:04:42] power. >> Well, our main job and mind and council [1:04:47] is we're going to be fair all the way across the board. We don't have we're [1:04:50] not going to nitpick anything. We're going to that's the way it is. Be here [1:04:54] and that's I think that's the easiest way to go. Okay. Somebody want to make a [1:04:58] motion to adjurnn? Got a motion to adjurnn. [1:05:03] » Second by Melissa. All right. All in favor. [1:05:07] » Again, thank you very much for coming out for our call meeting tonight. We [1:05:10] appreciate it. >> Yeah. I'm glad everybody showed up. [1:05:13] Always everybody showed up every time. Our next count.
