Who told you to put my blanket there? 56 00:03:17,000 --> 00:03:18,000 Who told you to switch my food bowl? 57 00:03:18,000 --> 00:03:23,000 So I have her tantrums where she picks up the food bowl and just tosses it wherever she wants. 58 00:03:23,000 --> 00:03:28,000 She's like, you need to come back, get this right, or apologize. 59 00:03:28,000 --> 00:03:30,000 But that's Annie for you. 60 00:03:30,000 --> 00:03:34,000 Hopefully you guys can figure out once you adopt there, what she likes and dislikes. 61 00:03:34,000 --> 00:03:37,000 The adoption fee covers the Spaniard Surgery. 62 00:03:37,000 --> 00:03:39,000 Our adoption fees are only $40. 63 00:03:39,000 --> 00:03:41,000 The Spaniard Surgery is for bunnies. 64 00:03:41,000 --> 00:03:43,000 It's actually really expensive. 65 00:03:43,000 --> 00:03:45,000 It is an invasive surgery for them. 66 00:03:46,000 --> 00:03:49,000 It takes a lot of time, more than a dog or a cat. 67 00:03:49,000 --> 00:03:55,000 So when adopters come and meet some of our rabbits, they know a lot more than us. 68 00:03:55,000 --> 00:04:00,000 So we just kind of humble ourselves and listen and try to take any knowledge we can from the adopters. 69 00:04:00,000 --> 00:04:04,000 But they're always making really good comments as far as a, that their microchip, 70 00:04:04,000 --> 00:04:07,000 be their vaccinated and see that they're spated and neutered. 71 00:04:07,000 --> 00:04:10,000 So we're trying to set up the adopters for success. 72 00:04:11,000 --> 00:04:22,000 Thank you so much for writing in the start to our meeting and wish Annie Luck 73 00:04:22,000 --> 00:04:25,000 in finding her forever home. 74 00:04:25,000 --> 00:04:27,000 Moving forward to proclamations. 75 00:04:27,000 --> 00:04:29,000 National Public Works Week. 76 00:04:29,000 --> 00:04:32,000 Council, you have the clear proclamations. 77 00:04:32,000 --> 00:04:34,000 City of Napa proclamation. 78 00:04:34,000 --> 00:04:36,000 National Public Works Week. 79 00:04:36,000 --> 00:04:39,000 May 17, 2023, 2023, 2006. 80 00:04:39,000 --> 00:04:43,000 Whereas this year marks the 66 annual National Public Works Week. 81 00:04:43,000 --> 00:04:46,000 Sponsored by the American Public Works Association. 82 00:04:46,000 --> 00:04:50,000 In this year's theme rooted in service powered by community. 83 00:04:50,000 --> 00:04:54,000 Illustrating how public works professionals provide valuable contributions to in 84 00:04:54,000 --> 00:04:58,000 enhance our communities quality of life and all and. 85 00:04:58,000 --> 00:05:03,000 Whereas the quality and effectiveness of the city of Napa's public works infrastructure, 86 00:05:03,000 --> 00:05:07,000 programs and services are an integral part of our residents everyday lives and our 87 00:05:07,000 --> 00:05:11,000 vital importance to the health safety and well-being of the community. 88 00:05:11,000 --> 00:05:16,000 And we're as such infrastructure programs and services could not be provided 89 00:05:16,000 --> 00:05:20,000 without the dedicated efforts of public works employees who are responsible for and 90 00:05:20,000 --> 00:05:24,000 who plan, design, build and maintain the roadways, sidewalks, streetlights, 91 00:05:24,000 --> 00:05:29,000 traffic signals, drainage systems, pavement, striping, signage, city buildings and 92 00:05:29,000 --> 00:05:34,000 who provide fleet services, stormwater quality programs, engineering, 93 00:05:34,000 --> 00:05:39,000 administrative, real property management, development services, and 94 00:05:39,000 --> 00:05:41,000 construction oversight. 95 00:05:41,000 --> 00:05:42,000 And. 96 00:05:42,000 --> 00:05:46,000 Whereas with an ever increasing demand and infrastructure, the continued dedication, 97 00:05:46,000 --> 00:05:50,000 ingenuity and innovation, public works employees will help 98 00:05:50,000 --> 00:05:54,000 ensure a strong and sustainable city for generations to come. 99 00:05:54,000 --> 00:05:58,000 Now, therefore, be it resolved that I, Kristina Talley, 100 00:05:58,000 --> 00:06:02,000 Vice Mayor on behalf of Scott Sedgley, mayor of the city of Napa, along with 101 00:06:02,000 --> 00:06:07,000 the Napa City Council, do hereby proclaim the week of May 17th through 102 00:06:07,000 --> 00:06:12,000 23rd, 2026 as National Public Works Week, and call upon all residents and 103 00:06:12,000 --> 00:06:16,000 civic organizations to acquaint themselves with the issues involved in providing our 104 00:06:16,000 --> 00:06:20,000 public works and to recognize the contributions which public works employees 105 00:06:20,000 --> 00:06:25,000 make every day to our health, safety, comfort, and quality of life. 106 00:06:25,000 --> 00:06:38,000 We have just below in the public work staff to accept. 107 00:06:38,000 --> 00:06:42,000 On behalf of our outstanding public work staff, thank you, Vice Mayor and Council for the 108 00:06:42,000 --> 00:06:43,000 recognition. 109 00:06:43,000 --> 00:06:47,000 This year's theme rooted in service powered by community, really captures what public 110 00:06:47,000 --> 00:06:49,000 works Napa is all about. 111 00:06:49,000 --> 00:06:53,000 The work that we do every day matters because of the community that we serve and it's 112 00:06:53,000 --> 00:06:56,000 not because of the community's trust input and engagement. 113 00:06:56,000 --> 00:07:00,000 Our work is often behind the scenes, but it does touch nearly every part of daily life, 114 00:07:00,000 --> 00:07:02,000 like you mentioned in the proclamation. 115 00:07:02,000 --> 00:07:06,000 None of this work happens without an incredibly dedicated team, staff who plan, 116 00:07:06,000 --> 00:07:10,000 design, build, maintain, and respond, sometimes at all hours. 117 00:07:10,000 --> 00:07:13,000 What makes Napa special is that it isn't one-sided. 118 00:07:13,000 --> 00:07:14,000 It's a partnership. 119 00:07:14,000 --> 00:07:18,000 Our community helps shape priorities, supports investment, and infrastructure, 120 00:07:18,000 --> 00:07:21,000 and ultimately benefits from the results. 121 00:07:21,000 --> 00:07:25,000 I want to thank our public work staff for their professionalism, commitment, and 122 00:07:25,000 --> 00:07:29,000 pride in their work, and the community for being an active part of what we do. 123 00:07:29,000 --> 00:07:33,000 We're proud to serve our community that truly powers the work in public works. 124 00:07:33,000 --> 00:07:36,000 Thank you for the recognition and have you public works week. 125 00:07:36,000 --> 00:07:41,000 Thank you. 126 00:08:06,000 --> 00:08:16,000 Thank you. 127 00:08:16,000 --> 00:08:21,000 Perfect, I'll have to give my zippy stuff. 128 00:08:21,000 --> 00:08:26,000 Ryan the Meadow. 129 00:08:26,000 --> 00:08:33,000 All right. 130 00:08:33,000 --> 00:08:36,000 You must have a good work, guys. 131 00:08:36,000 --> 00:08:58,000 Next, we have Jewish American Heritage Month. 132 00:08:58,000 --> 00:09:03,000 Okay, I'll begin this as the city of Napa Proclamation for Jewish American Heritage Month. 133 00:09:03,000 --> 00:09:10,000 May 2026, whereas from our nation's earliest days, 134 00:09:10,000 --> 00:09:14,000 Jewish Americans have been an essential part of the American story. 135 00:09:14,000 --> 00:09:19,000 Greatly contributing to the religious, cultural, political, economic, and intellectual 136 00:09:19,000 --> 00:09:24,000 advancement of all people, even while in the face of discrimination and adversity, 137 00:09:24,000 --> 00:09:29,000 and have enriched our country, stirred our conscience, and challenged us to extend the 138 00:09:29,000 --> 00:09:31,000 miracles of freedom and security. 139 00:09:31,000 --> 00:09:37,000 We're asked that federal government proclaimed May as Jewish American Heritage Month 140 00:09:37,000 --> 00:09:44,000 in 2006, and recognition of the over 350-year history of Jewish contributions to American culture. 141 00:09:44,000 --> 00:09:45,000 And? 142 00:09:45,000 --> 00:09:50,000 Whereas, as we celebrate the rich heritage of the Jewish American community in the city of Napa and the nation, 143 00:09:50,000 --> 00:09:55,000 we recognize that American Jews have worked tirelessly to strengthen the promise of religious freedom 144 00:09:56,000 --> 00:10:01,000 and civil rights by joining together with all faiths to reject ignorance and intolerance. 145 00:10:01,000 --> 00:10:07,000 Teach empathy and compassion and root out hatred wherever it exists and are compelled to never forget. 146 00:10:07,000 --> 00:10:08,000 And? 147 00:10:08,000 --> 00:10:13,000 Whereas anti-Semitism has risen in recent years and Jewish communities continue to confront hostility 148 00:10:13,000 --> 00:10:14,000 and bigotry. 149 00:10:14,000 --> 00:10:21,000 The city of Napa shares the obligation to condemn and combat anti-Semitism and hatred wherever they exist. 150 00:10:21,000 --> 00:10:26,000 Whereas, during Jewish American Heritage Month, to see if Napa celebrates the hard-fought progress 151 00:10:26,000 --> 00:10:32,000 one through the struggle and sacrifice of Jewish Americans, and where you redaticate ourselves to building a world 152 00:10:32,000 --> 00:10:36,000 where diversity is cherished and faith is protected. 153 00:10:36,000 --> 00:10:41,000 Now, therefore, be it resolved that I, Christina Talley, Vice Mayor on behalf of Scott Sedgeley, 154 00:10:41,000 --> 00:10:45,000 Mayor of the city of Napa, along with the Napa City Council due hereby, 155 00:10:45,000 --> 00:10:49,000 in the program, May 2026 as Jewish American Heritage Month. 156 00:10:49,000 --> 00:10:53,000 In call upon all residents to celebrate and thank Jewish Americans past and present, 157 00:10:53,000 --> 00:11:00,000 we've contributed, measured to the fabric of American history, culture, science, education and social justice, 158 00:11:00,000 --> 00:11:06,000 and to many aspects of our local Napa community, dated May 19th, 2026. 159 00:11:06,000 --> 00:11:11,000 And we have Niles Goldstein, Senior Rabbi of Congregation, Beth Shalom, to accept. 160 00:11:15,000 --> 00:11:20,000 Thank you very much. 161 00:11:20,000 --> 00:11:26,000 We are honored to receive this proclamation as we have in past years. 162 00:11:26,000 --> 00:11:31,000 And on behalf of Congregation, Beth Shalom and the Jewish community of Napa Valley, 163 00:11:31,000 --> 00:11:35,000 we are very grateful as the proclamation notes. 164 00:11:35,000 --> 00:11:40,000 This is not an easy time to be Jewish in this country or around the world. 165 00:11:40,000 --> 00:11:45,000 The Scourge of Antisemitism is still with us to a very troubling degree. 166 00:11:45,000 --> 00:11:53,000 So, we always, always appreciate the friendship and the allyship of all of our non-Jewish neighbors 167 00:11:53,000 --> 00:11:56,000 were stronger with diversity. 168 00:11:56,000 --> 00:12:01,000 And as we saw yesterday at the mosque shooting in San Diego, 169 00:12:01,000 --> 00:12:07,000 whether you're Jewish or Muslim or part of any faith minority community, 170 00:12:07,000 --> 00:12:09,000 we need to be vigilant. 171 00:12:09,000 --> 00:12:12,000 We need to all look out for one another. 172 00:12:12,000 --> 00:12:17,000 And so I send my thoughts and prayers to the Muslim community of San Diego. 173 00:12:17,000 --> 00:12:22,000 I thank you all again very much for this proclamation. 174 00:12:22,000 --> 00:12:32,000 And we will share it with our congregation and with the Jewish community here in Napa and in the county with great pride. 175 00:12:32,000 --> 00:12:34,000 Thank you very much. 176 00:12:35,000 --> 00:12:36,000 Thank you. 177 00:12:36,000 --> 00:12:37,000 Thank you. 178 00:12:37,000 --> 00:12:38,000 Thank you. 179 00:12:38,000 --> 00:12:39,000 Thank you. 180 00:13:04,000 --> 00:13:19,000 All right, public comment on non agenda items. 181 00:13:19,000 --> 00:13:21,000 During the public comment portion of the meeting, 182 00:13:21,000 --> 00:13:27,000 the public is invited to address the council on any item within the subject matter jurisdiction of the council. 183 00:13:27,000 --> 00:13:33,000 Please focus your comments on either past actions taken by the council or proposed future actions to be taken by the council. 184 00:13:34,000 --> 00:13:37,000 However, if the subject of public comment is not on the agenda, 185 00:13:37,000 --> 00:13:41,000 state law strictly limits the council's ability to respond to at this meeting. 186 00:13:41,000 --> 00:13:43,000 Have a received card? 187 00:13:43,000 --> 00:13:45,000 I have vice mayor. 188 00:13:45,000 --> 00:13:46,000 Harrow ligands. 189 00:13:46,000 --> 00:13:48,000 Cindy Walters. 190 00:13:48,000 --> 00:13:49,000 And or water? 191 00:13:49,000 --> 00:13:50,000 I think. 192 00:13:50,000 --> 00:13:51,000 And Dalton Percy. 193 00:13:55,000 --> 00:13:56,000 No water. 194 00:14:03,000 --> 00:14:08,000 Good afternoon. 195 00:14:08,000 --> 00:14:09,000 Council. 196 00:14:09,000 --> 00:14:12,000 Harrow ligand 1923 Adrian Street. 197 00:14:12,000 --> 00:14:13,000 Two quick comments. 198 00:14:13,000 --> 00:14:15,000 One is definitely not on the consent calendar. 199 00:14:15,000 --> 00:14:18,000 I just wanted to update you a while back. 200 00:14:18,000 --> 00:14:21,000 I brought up the the subject matter of consideration. 201 00:14:21,000 --> 00:14:26,000 If the I asked a question if the city council had brought up any conversations. 202 00:14:26,000 --> 00:14:28,000 We're guarding property tax. 203 00:15:00,000 --> 00:15:29,000 And I did reach out to John Tudor's office and being the gentleman that he is he gently reminded me that that's primarily a state issue. So I'm in the process of contacting Cecilia Aguilar's office to bring something up to to help facilitate the development of more ADUs as I've mentioned. I'm doing this for our friend in mind. 204 00:15:29,000 --> 00:15:51,000 It's born and raised here in town and is on disability. And so I would I would think that would the promotion that the state would the grant and the county loan that I'm partaking in, it would be nice to see something from a property tax aspect to help lessen the burden on the development of such things. 205 00:15:51,000 --> 00:16:11,000 Last comment which is on the agenda is on regarding street sweepers. I have to chuckle whenever I see the street sweeper go by and my neighborhood in all the cars on the street and street sweepers basically just taking the metal blades and chewing up the the the asphalt. 206 00:16:11,000 --> 00:16:30,000 The concept of a street sweeper is to sweep the curb area to keep items from going down into the storm drain system. So I'm wondering if there's any aspect in the future to address like they do in the cities and so on so forth for a certain days of the week. 207 00:16:30,000 --> 00:16:46,000 You cars have to be removed from one side of the street or the other it might help with the actual cleaning of the curbs and the gutters so anyway that's pretty much all I have to say there. Thank you for listening. Thank you. 208 00:16:46,000 --> 00:17:06,000 Next speaker. Hi Cindy water for 27 even street right over there. It's nice to be here and I just wanted to show up and be a little ray of sunshine and tell you that I really appreciate. 209 00:17:06,000 --> 00:17:24,000 Well first of all I want to say that nap is a wonderful town I've lived here for 36 years when disaster strikes people pitch in and help when I I had cancer twice my my kitchen door was full food offers to take care of my children. 210 00:17:24,000 --> 00:17:34,000 If someone's house burned down if someone's if someone's child is in an accident there are fundraiser school or so it really is a great place to live. 211 00:17:34,000 --> 00:17:45,000 And now I don't know what it is that makes really nice people get all feral when they go on next or an ampa but after I went to the fuller park. 212 00:17:45,000 --> 00:18:00,000 The fuller park playground opening high saw you know all of you and had nice chat I went and looked at this my social media and there were people complaining about it perhaps you saw it and I didn't see any of them there. 213 00:18:00,000 --> 00:18:13,000 And I just wanted you to know that my grandson loves it he's been there four times since it opened it's fun of course the best time for toddlers is early in the morning when it's cool. 214 00:18:13,000 --> 00:18:34,000 I'm worried about trees no trees that well you can't have trees over a playground a lima fall down and heard someone and they're surrounded with trees that is the best tree place in napa so if you get hot you go sit under a tree and guess what you've got a shade structure and picnic tables too you thought of everything so thank you and one more plug. 215 00:18:34,000 --> 00:18:52,000 Thank you to Molly gradigan my husband is very concerned about parking during bottle rock in our neighborhood and he wrote to her and she got back to him fourth with and I really appreciate that sort of service in our wonderful town thank you. 216 00:18:52,000 --> 00:18:59,000 Thank you. Next speaker. 217 00:19:04,000 --> 00:19:21,000 I'm Dalton J. Percy and I don't represent musicians I represent local music culture which is all the musicians combined and I'd like to talk about this. 218 00:19:21,000 --> 00:19:48,000 I'll talk about the second income which I think is really important to discuss you know I see a lot of the complaining you know online about an happens not adjusting to the change the second income with music events is highly important because when you see the amount of service you see the amount of products and produce coming in to the community. 219 00:19:48,000 --> 00:20:04,000 You see them hiring more people to work within the community as music events are going on that is an excellent point of how the second income works. 220 00:20:04,000 --> 00:20:33,000 So I think it's really important that our community keep in mind that when we have bottle rock yes we have a lot of noise we have a lot of people doing things and coming to an app but they don't know now but you know it's still they're bringing that income into this community and then that income is going into our city and then that income is is making a big change for what's happening in the city of Napa. 221 00:20:33,000 --> 00:21:02,000 One of the other things to realize to is music culture we were not above the ground you know you're talking to Dalton I did the first four years of music in part that was my event I created it I did over 86 concerts I brought musicians as from as far southern California on my invitation they came because I invited them. 222 00:21:03,000 --> 00:21:26,000 You know and I think that the music in the park is an important event and I'd like to see the amount of what it cost reduced so that we can have more than just 30 days for concerts in the park that we could have a little bit more during my time like I said I did 86 concerts. 223 00:21:26,000 --> 00:21:38,000 Sometimes with three to four bands at a time that's a lot of work and all the young people came in a volunteer and all members from the community came in a volunteer. 224 00:21:38,000 --> 00:21:48,000 You know and I did carry insurance form but the other thing I wanted to say too you know local music is someone shut out of bottle rock. 225 00:21:48,000 --> 00:22:07,000 Everybody complains about bottle rock but you know what we don't get in the bottle rock and guess what they give free tickets to east nap I'd go to the bottle rock you know what musicians get we get to stand outside in the street. 226 00:22:07,000 --> 00:22:12,000 Thank you. 227 00:22:12,000 --> 00:22:15,000 Any additional speakers. 228 00:22:15,000 --> 00:22:23,000 Thank you moving on to the consent calendar consent calendar items are considered routine and may be approved by a single vote of the council. 229 00:22:23,000 --> 00:22:35,000 However members of the public or city council may request that a consent item be pulled for discussion there are 16 consent items identified on the agenda for the consent calendar items six a through six p. 230 00:22:35,000 --> 00:22:38,000 Is there a request to pull a consent item. 231 00:22:38,000 --> 00:22:55,000 Vice Mayor I have no request to pull I think how gave his comment for street sweeping under public comment but I did want to make one comment for members of the public item six six o the community development block grant program annual action plan amendment was inadvertently. 232 00:22:55,000 --> 00:23:11,000 Notice is a public hearing not a public meeting so I just want to be sure that we do ask if anyone in the audience wishes to speak to item six o the community development block grant program annual action plan amendment that they do so now I want to make sure that they're given an opportunity. 233 00:23:11,000 --> 00:23:14,000 I don't have any cards but wanted to do one last call for the record. 234 00:23:14,000 --> 00:23:17,000 Is there anybody in the audience with like to speak on that item. 235 00:23:17,000 --> 00:23:20,000 Okay, I don't see any so I can figure out. 236 00:23:20,000 --> 00:23:23,000 Seeing none is there a motion to approve. 237 00:23:23,000 --> 00:23:26,000 Move approval of the consent calendar. 238 00:23:26,000 --> 00:23:28,000 All in favor. 239 00:23:28,000 --> 00:23:31,000 I any opposed. 240 00:23:35,000 --> 00:23:38,000 Moving on to administrative reports. 241 00:23:38,000 --> 00:23:53,000 Which we first will hear a staff presentation then we'll open to public comment and then bring it back to the council for any questions and a decision. 242 00:23:53,000 --> 00:23:57,000 I will turn it over to. 243 00:23:57,000 --> 00:24:04,000 Our city attorney Christopher Diaz. 244 00:24:05,000 --> 00:24:07,000 Well, Vice Mayor De Natali honorable council. 245 00:24:07,000 --> 00:24:12,000 Christopher Diaz or interim city attorney here today to present an overview of Senate bill 707. 246 00:24:12,000 --> 00:24:15,000 It does change the brown act and how we do public meetings. 247 00:24:15,000 --> 00:24:21,000 We will also talk about the requirement to adopt a disruption policy and so I want the council as we go through the poll. 248 00:24:21,000 --> 00:24:24,000 The presentation to think about disruption in two ways. 249 00:24:24,000 --> 00:24:31,000 One is obviously the technology disruption because we will have to allow the public to connect in a in comment via zoom. 250 00:24:31,000 --> 00:24:42,000 For future public meetings after July 1st and then also think about disruption of any virtual attendees or even in person attendees disrupting the flow of the meeting or ability to conduct business. 251 00:24:42,000 --> 00:24:50,000 Because the policy also addresses that and also talk about what the brown act includes for in person people who are commenting. 252 00:24:50,000 --> 00:24:52,000 So just in the agenda of what we'll cover today. 253 00:24:52,000 --> 00:24:55,000 What is the general purpose behind Senate bill 707. 254 00:24:55,000 --> 00:24:59,000 Why did the state legislature think in all their wisdom that this was a law that they should pass? 255 00:24:59,000 --> 00:25:05,000 We'll also talk about the updates for what's defined now and in the brown act as eligible legislative bodies. 256 00:25:05,000 --> 00:25:10,000 As you know, the brown act already defines legislative bodies, but we'll talk about that new definition and who it includes. 257 00:25:10,000 --> 00:25:14,000 And then we'll also talk about the disruption policy requirement itself. 258 00:25:14,000 --> 00:25:16,000 I will lightly touch on teleconferencing. 259 00:25:16,000 --> 00:25:19,000 This was another big update with Senate bill 707. 260 00:25:19,000 --> 00:25:21,000 Historically looking at council. 261 00:25:21,000 --> 00:25:26,000 It doesn't seem as if you are are opting to zoom in very often into meetings. 262 00:25:26,000 --> 00:25:32,000 And so we'll lightly touch on this, but if council wants more information on teleconferencing or more than happy to do an additional presentation. 263 00:25:32,000 --> 00:25:36,000 Or provide something and writing that will provide guidance to the council. 264 00:25:36,000 --> 00:25:40,000 And then lastly, we'll talk about miscellaneous updates with Senate bill 707. 265 00:25:40,000 --> 00:25:46,000 Just a hodgepodge of minor updates that were included within the bill. 266 00:25:46,000 --> 00:25:50,000 So what is the big or what is the bill itself? 267 00:25:50,000 --> 00:25:56,000 If you're not aware, Senator DeRazo was the author of this bill and looking at it many, many moons ago. 268 00:25:56,000 --> 00:26:04,000 It was actually a bill that was amending the brown act, but to be a little bit more favorable to bargaining groups at respective cities. 269 00:26:04,000 --> 00:26:12,000 And so it was tying the hands a little bit of public agencies in what we couldn't could not do with regard to bargaining groups and other employment issues. 270 00:26:12,000 --> 00:26:17,000 DeRazo's former labor organizer, so it wasn't surprising she was going that direction. 271 00:26:17,000 --> 00:26:21,000 Ultimately, like most things in Sacramento, the bill got quite gut and amended. 272 00:26:21,000 --> 00:26:25,000 And so I think DeRazo had seen what happened during the pandemic. 273 00:26:25,000 --> 00:26:30,000 How cities had basically allowed technology in the public to attend via zoom. 274 00:26:30,000 --> 00:26:40,000 And so her bill kind of modified and morphed into basically including technology changes that will be imposed on local agencies to basically provide that greater public access. 275 00:26:40,000 --> 00:26:46,000 So people can attend public meetings in a variety of ways. 276 00:26:46,000 --> 00:26:57,000 Now, what is the definition of eligible legislative body? Well, as I indicated, as you know, the brown act includes a definition of legislative body and that includes your city council obviously here at this level. 277 00:26:57,000 --> 00:27:03,000 It also includes all the subsidiary bodies that the council has created and appoints individuals to. 278 00:27:03,000 --> 00:27:10,000 And so those are legislative bodies, but now with SB 707, there's a new definition called eligible legislative bodies. 279 00:27:10,000 --> 00:27:14,000 That includes only the senior body at these respective entities. 280 00:27:14,000 --> 00:27:17,000 And so a city with the population over 30,000. 281 00:27:17,000 --> 00:27:21,000 And that would really be the basis as to why it's subject to SB 707. 282 00:27:21,000 --> 00:27:25,000 Also county board of supervisors with a population over 30,000. 283 00:27:25,000 --> 00:27:29,000 Also any city in a county with a population over 600,000. 284 00:27:29,000 --> 00:27:34,000 And so any any smaller city in a larger county would also be subject to SB 707. 285 00:27:34,000 --> 00:27:42,000 And then finally special districts if you have a website and a special district is quite large either covering all of a county over 600,000 population. 286 00:27:42,000 --> 00:27:46,000 Plus having 200 employees, they would be subject to this new requirement. 287 00:27:46,000 --> 00:27:51,000 A special district with a website plus with a thousand plus employees also subject to this requirement. 288 00:27:51,000 --> 00:27:57,000 And then also special districts with a website and 400 million in annual revenue plus 200 employees. 289 00:27:57,000 --> 00:28:02,000 So just think when you're thinking about eligible legislative bodies, just think of those larger entities. 290 00:28:02,000 --> 00:28:08,000 And again, it's that top-level governing body, not the subsidiary bodies within those organizations. 291 00:28:08,000 --> 00:28:12,000 Now, what is the big requirement that kicks in under Senate Bill 707? 292 00:28:12,000 --> 00:28:14,000 What's the requirement that we connect the public? 293 00:28:14,000 --> 00:28:22,000 We allow them the opportunity to do both attend the meeting and comment either through a two-way telephonic service or two-way audiovisual platform. 294 00:28:22,000 --> 00:28:29,000 Most of the requirements in Senate Bill 707 kicked in July 1, but the heavier lift is really kicking in July 1, 295 00:28:29,000 --> 00:28:30,000 2022. 296 00:28:30,000 --> 00:28:37,000 My best guess is to why the State Legislature Legislature had a delayed implementation as to this heavier lift. 297 00:28:37,000 --> 00:28:40,000 Is some cities went away from Zoom, obviously, as Napa did. 298 00:28:40,000 --> 00:28:48,000 Some cities kept Zoom, but if you did not install Zoom or allow the access once you went back to in person, it's a heavy technology left. 299 00:28:48,000 --> 00:28:54,000 And so I think the State Legislature was smart about this and they said, let's give cities more time to comply with this requirement. 300 00:28:54,000 --> 00:29:01,000 Now, keep in mind that we do not need to connect the public via Zoom and allow them to comment if Zoom is not operational at the meeting location. 301 00:29:01,000 --> 00:29:08,000 There's a big question mark as to what this necessarily means because the brand act doesn't define what it means to not be operational at the meeting location, 302 00:29:08,000 --> 00:29:14,000 but as all things with the law, there will likely be challenges in case law will clarify what that means in the future, 303 00:29:14,000 --> 00:29:21,000 but our best guess is if there's no internet or phone access at that meeting location, then you do not have to connect the public via Zoom. 304 00:29:21,000 --> 00:29:31,000 Keep in mind that for the Zoom option, we do have to post and provide the call in option or the link on our meeting agenda to allow the public to get access via Zoom. 305 00:29:31,000 --> 00:29:40,000 And then also this is a new requirement and most cities have not been doing this who are still using Zoom, but we have to turn on captioning on Zoom to allow the public to see words on the screen. 306 00:29:40,000 --> 00:29:48,000 Now, as I indicated, there are certain meetings where we do not have to connect the public again, where the meeting location doesn't accommodate the Zoom technology. 307 00:29:48,000 --> 00:30:00,000 But then also these laundry list of exceptions, which exist within the brand act for other purposes, but if you were to all want to attend a court hearing of some sort or administrative hearing, you would not need to connect the public via Zoom if you're in spec. 308 00:30:00,000 --> 00:30:24,000 Reading, rule, personal property where the topic of the meeting is limited to that property. Again, don't need to connect the public via Zoom. If you're meeting with your Federal or state legislatures to lobby them, don't need to connect the public via Zoom. And then meeting in or nearer facility owned by the local agency. Again, where it's limited to that facility, the topic of the meeting. Don't need to connect the public via Zoom, and then finally under the emergency meeting provisions of the brown act. 309 00:30:24,000 --> 00:30:28,400 Now, the big reason why we're here tonight is because SB 707 does include a requirement that 310 00:30:28,400 --> 00:30:32,480 not only we connect the public via zoom and allow them to comment, but that we actually have 311 00:30:32,480 --> 00:30:37,840 a disruption policy adopted by the council in open session, not on consent, where we talk about 312 00:30:37,840 --> 00:30:43,200 how we deal with the technology disruption, but then also because SB 707 includes new language 313 00:30:43,200 --> 00:30:49,280 to deal with virtual attendees disruption. We also include that within the policy. So again, 314 00:30:49,280 --> 00:30:52,800 thinking about disruption in two ways, but first I wanted to walk you through the technology 315 00:30:52,800 --> 00:30:58,960 disruption piece. So if we were to have a technology disruption, we need to basically try to 316 00:30:58,960 --> 00:31:03,840 make good faith attempts to restore the service for at least one hour. Now, hopefully we connect 317 00:31:03,840 --> 00:31:08,960 the service sooner than that so we can continue with business, but once we get that disruption, 318 00:31:08,960 --> 00:31:12,720 we'd want our clerk or the mayor to announce the service disruption to the public so they 319 00:31:12,720 --> 00:31:18,320 understand what's going on and why we're taking a break. The council is required to resist the meeting 320 00:31:18,320 --> 00:31:23,440 if we have a closed session on our agenda and it's been agendized for that meeting and let's say 321 00:31:23,440 --> 00:31:28,080 we didn't either get to the closed session in time or we have unfinished business, we can 322 00:31:28,080 --> 00:31:33,200 adjourn to close session to basically take care of that business and so the state legislature was 323 00:31:33,200 --> 00:31:37,680 wise to think, okay, during this recess, what can we realistically do and we can go into closed 324 00:31:37,680 --> 00:31:42,960 session if it is agendized on our agenda. And then again, during that recess, we need to make a 325 00:31:42,960 --> 00:31:51,280 good faith attempt to restore the service. Now, what happens if we can't fix the issue within an hour? 326 00:31:51,280 --> 00:31:56,640 Well, we are required to do one of the following options. Either adjourn the meeting, further extend 327 00:31:56,640 --> 00:32:02,080 the recess to restore the service or we make reconvene an open session but we must adopt the 328 00:32:02,080 --> 00:32:07,840 finding by a roll call vote that one good faith efforts were taken to restore the service and to the 329 00:32:07,840 --> 00:32:12,480 public interest in continuing the meeting outweighs the public interest in remote public access. 330 00:32:13,280 --> 00:32:19,280 Now, again, this is a finding that we would need to make and what we see future challenges will 331 00:32:19,280 --> 00:32:24,400 understand exactly what should be included for cities and making this finding that my best guess is 332 00:32:24,400 --> 00:32:28,720 let's say you had a scenario where you had something on your agenda staff was indicating to you as 333 00:32:28,720 --> 00:32:33,360 council. We need to take action on this agreement by the end of the week and so we really need you to 334 00:32:33,360 --> 00:32:37,680 take action tonight on this item because it needs to be approved by the end of the week and let's say 335 00:32:37,680 --> 00:32:44,080 at the city level we had no interest from the public, nobody sending in emails. It just didn't 336 00:32:44,080 --> 00:32:48,880 seem like anybody really cared about the item. Well, in that scenario, you can easily make this finding. 337 00:32:48,880 --> 00:32:53,280 Obviously, we have a need to continue with business. The public hasn't showed a heavy interest in 338 00:32:53,280 --> 00:32:56,880 this item and therefore we're going to go ahead and proceed with the meeting even though we've lost 339 00:32:56,880 --> 00:33:03,520 the public via Zoom. It will be very fact-dependent in making this finding and so we'll want to look at 340 00:33:03,520 --> 00:33:11,520 the facts before us in making that decision. Now, turning more so to virtual attendees disrupting 341 00:33:11,520 --> 00:33:16,640 the meeting and I will tell you that this similar language to this is already included in the Brown Act. 342 00:33:16,640 --> 00:33:21,680 It's included within the policy that's before you tonight but it's also included for in-person attendees 343 00:33:21,680 --> 00:33:26,480 in the Brown Act and so similar process where you give a warning but I'll walk you through what's 344 00:33:26,480 --> 00:33:31,520 included within the policy for virtual attendees if we did have somebody who was disrupting the meeting 345 00:33:31,520 --> 00:33:38,000 and I want to clarify that disruption under the law is quite a heavy, heavy burden to me. 346 00:33:38,800 --> 00:33:44,000 Basically, you would need to show that the public is basically stopping us from proceeding with the meeting, 347 00:33:44,000 --> 00:33:49,440 stopping us from conducting business. There's a recent court decision if I recall correctly where somebody 348 00:33:49,440 --> 00:33:55,120 was complaining about a trash franchise agreement under public comment that came in with a trash bag and 349 00:33:55,120 --> 00:33:59,920 just dumped it next to the podium as they were giving their comments. And the court, that issue was 350 00:34:00,000 --> 00:34:04,960 litigated and the court ultimately said that was disruption because ultimately the local agency 351 00:34:04,960 --> 00:34:10,160 had a clean up the trash, the public that wanted to speak after that speaker didn't want to stand next 352 00:34:10,160 --> 00:34:14,960 to that podium because of the smell. And so yes, that was disruption it caused us to stop the meeting 353 00:34:14,960 --> 00:34:19,200 and have to clean that up and deal with it. And so that's an example of what's disruption under the law. 354 00:34:19,200 --> 00:34:23,280 But if we did have somebody on Zoom who was disrupting the meeting, stopping us from flowing with business, 355 00:34:24,400 --> 00:34:28,080 the options are for the mayor of City Clerk to provide a warning consistent with the Brown Act 356 00:34:28,080 --> 00:34:33,120 which is just a verbal warning. Normally I'd recommend pausing the timer if we have a timer on the 357 00:34:33,120 --> 00:34:39,520 speaker, not taking away their minutes. Obviously giving them that fair warning, indicating to them that 358 00:34:39,520 --> 00:34:44,080 they are disrupting the meeting under the law. And if they fail to cease their behavior, it will result in removal. 359 00:34:45,200 --> 00:34:50,720 For virtual attendees, if that person persists and we give them the warning, we give them their minutes back and they 360 00:34:50,720 --> 00:34:56,320 keep going with the disruption. Our options are to either mute the speaker if that takes care of the issue. 361 00:34:56,480 --> 00:35:02,480 And if it does not, then we can remove them from the Zoom platform. As I indicated, for in-person attendees, 362 00:35:02,480 --> 00:35:06,800 there is a similar requirement in the Brown Act that was enacted within the past, I'd say, three years. 363 00:35:07,600 --> 00:35:12,240 Requires the same thing. Basically, if someone is standing up at the podium, disrupting the meeting, 364 00:35:12,240 --> 00:35:17,200 keeping us from proceeding with business, we give them that warning, stop the timer, given the warning, 365 00:35:17,200 --> 00:35:21,600 see if they can comport their comments consistent with what we're asking for. And if they cannot, 366 00:35:22,320 --> 00:35:26,400 you can't remove them from the meeting. I would say, in that situation with an in-person attendee, 367 00:35:27,360 --> 00:35:31,360 I don't normally like to give the direction to remove someone from the meeting. And so if they are 368 00:35:31,360 --> 00:35:36,560 disrupting the meeting, I normally recommend that the chair or the mayor call a recess, kind of diffuse the 369 00:35:36,560 --> 00:35:44,400 situation, and then come back, and hopefully that doesn't continue. Now, I should note that Tiffany Karanza 370 00:35:44,400 --> 00:35:49,840 and the City Clerk's office is taking a very heavy lift with Senate Bill 707. And so I wanted to turn it over to 371 00:35:49,840 --> 00:35:54,480 Tiffany to walk through the next two slides as to what she's dealing with in the City Clerk world. 372 00:35:54,480 --> 00:36:00,080 So Tiffany? Thanks, Chris. So under under the bill, the City also needs to take action to encourage 373 00:36:00,080 --> 00:36:04,080 residents, including those in underrepresented communities and on English-speaking communities, 374 00:36:04,080 --> 00:36:09,440 participate in the public meetings. This includes a system for electronically accepting and fulfilling 375 00:36:09,440 --> 00:36:15,360 requests for meeting agendas and meeting documents through email or an integrated agenda management platform 376 00:36:15,440 --> 00:36:21,200 and provide information on how to make requests. We will be utilizing a new system 377 00:36:21,200 --> 00:36:26,320 feature from our webpage called Civic Send that will allow for a simple straightforward way to sign up 378 00:36:26,320 --> 00:36:33,120 and subscribe to our agenda notifications. Currently, anyone can request notifications just simply by emailing 379 00:36:33,120 --> 00:36:37,920 but this may be a more straightforward method by just filling out a quick form online. And then we're also 380 00:36:37,920 --> 00:36:44,240 able to send the agenda's out that way as well. We'll also need to make some changes to our webpage 381 00:36:44,240 --> 00:36:49,200 to ensure we're maintaining an accessible webpage dedicated to public meetings that includes 382 00:36:49,760 --> 00:36:54,560 a general explanation of the public meeting process and explanation of the procedures for a member of 383 00:36:54,560 --> 00:36:59,760 the public to provide in-person, remote or written public comment. A calendar of public meeting dates 384 00:36:59,760 --> 00:37:05,600 including time and location of each meeting and the current posted agendas agenda or agendas of the body. 385 00:37:05,600 --> 00:37:11,280 And the page show also be able to be translated into Spanish. So a lot of this was already on our radar. 386 00:37:11,360 --> 00:37:17,840 This was just giving us a hard deadline. We also, this is something new. We also have to provide 387 00:37:17,840 --> 00:37:23,840 physical space near our posted agendas where public can post agendas translations. This is a new 388 00:37:23,840 --> 00:37:29,440 requirement in which a member of the public is allowed to post additional translations in which ever 389 00:37:29,440 --> 00:37:35,440 whichever language they choose. And we have a note as it will say that we're not responsible necessarily 390 00:37:35,440 --> 00:37:40,480 for the content that is being translated but they have the ability to post. We'll be providing an unlocked 391 00:37:41,440 --> 00:37:45,120 like Dropbox next to the current Baltimore in front of City Hall for that purpose. 392 00:37:46,480 --> 00:37:52,320 In addition, we have to make efforts to invite groups that do not usually participate under SB 393 00:37:52,320 --> 00:37:58,080 while SB 707 introduces several new public engagement requirements. I'm happy to report that 394 00:37:58,080 --> 00:38:02,240 consistent with Council's focus areas. The city has already taken a proactive approach toward 395 00:38:02,240 --> 00:38:07,280 implementing many of these measures and we plan on continuing to build on those efforts. Our community 396 00:38:07,280 --> 00:38:12,640 relations team has significantly expanded outreach related to Council meetings through a variety 397 00:38:12,640 --> 00:38:18,960 of communication channels including meeting previews in the city of Napa News, Napa's weekly. E Newsletter 398 00:38:19,760 --> 00:38:26,320 increased social media posts featuring meeting previews, reminders. We've done pre pre radio 399 00:38:26,320 --> 00:38:32,400 promotion and as you are likely aware, our social media communications are provided in both English 400 00:38:32,400 --> 00:38:38,080 and Spanish. In addition, staff is developing a proposed multi-channel outreach strategy 401 00:38:38,080 --> 00:38:43,040 that would further enhance social media engagement and expand direct outreach to community partners 402 00:38:43,040 --> 00:38:48,400 via email. So the goals to create a more formalized community organization contact network using 403 00:38:48,400 --> 00:38:53,840 existing relationships and outreach efforts which would allow the city to more effectively connect 404 00:38:53,840 --> 00:38:59,040 with neighborhood associations, chambers of commerce, service clubs, faith-based organizations, 405 00:38:59,040 --> 00:39:04,640 cultural groups and other community stakeholders. So I will be working closely with our 406 00:39:04,640 --> 00:39:11,280 community relations team, Jane and Katie on that as well. In Napa approach, this approach is focused 407 00:39:11,280 --> 00:39:15,600 on meeting residents where they already receive information and leveraging trusted community partners 408 00:39:15,600 --> 00:39:21,040 and messengers, not solely city communication channels, which will help us broaden awareness and 409 00:39:21,040 --> 00:39:27,360 participation. If you do have any ideas, please feel free to let us know on that. And then next 410 00:39:27,360 --> 00:39:33,040 slide, please, Chris. And then additionally, we are required to accommodate translation interpretation 411 00:39:33,040 --> 00:39:38,160 requests. So this assistance in compliance with the requirement may include, for example, 412 00:39:38,160 --> 00:39:43,440 arranging space for interpreters at the meeting location, allowing extra time during the meeting for 413 00:39:43,440 --> 00:39:49,920 interpretation or ensuring participants may use their own personal equipment. It does not require 414 00:39:49,920 --> 00:39:55,040 the city is not required to provide the interpretation, but make a combination for those who are here and 415 00:39:55,200 --> 00:40:01,680 would like it. We will are required to translate and post the agenda, including remote attendance 416 00:40:01,680 --> 00:40:07,280 info into any language spoken by more than 20% of the jurisdiction utilizing the most recent American 417 00:40:07,280 --> 00:40:12,720 community survey, which is published by the U.S. Census Bureau, which Napa is Spanish. So our 418 00:40:12,720 --> 00:40:18,800 genders are currently translatable via our web page, but will also be posting a translated agenda 419 00:40:19,760 --> 00:40:26,320 online and also posting one outside to meet the requirements. And that requirement, just a note 420 00:40:26,320 --> 00:40:31,120 that the requirement does not apply to the full packet of information that the agenda itself. 421 00:40:32,160 --> 00:40:38,400 Okay, thank you. Thank you, Tiffany. So I will lightly touch on teleconferencing for the council's 422 00:40:38,400 --> 00:40:43,520 benefit, but if you've ever teleconferencing into a meeting in the past, the traditional teleconferencing 423 00:40:43,520 --> 00:40:48,560 rules where you have your location wherever you're calling in from. On the agenda, those rules 424 00:40:48,560 --> 00:40:53,840 still exist. They've been in the Brown Act almost since its inception, but those are not going away 425 00:40:53,840 --> 00:40:59,840 with Senate Bill 707. A new requirement did kick in with Senate Bill 707, and this was actually 426 00:40:59,840 --> 00:41:06,400 generated by attorney general opinions. The first was issued in 2001, if I recall correctly, where the 427 00:41:06,400 --> 00:41:11,200 question before the attorney general's office was, should the Brown Act, which is state law, 428 00:41:11,200 --> 00:41:15,040 essentially, been to federal law, American with Disabilities Act? In other words, should the 429 00:41:15,040 --> 00:41:20,080 Brown Act, even if it doesn't include language as to how council member can come into a meeting remotely, 430 00:41:20,080 --> 00:41:25,600 if they have a disability, should we accommodate, in other words? And in 2001, the attorney general's office 431 00:41:25,600 --> 00:41:30,000 said, the answer is no, the Brown Act doesn't include any language. We don't think it has to 432 00:41:30,000 --> 00:41:34,320 bend to federal law. Therefore, agencies, you don't have to accommodate a council member if they have a 433 00:41:34,320 --> 00:41:41,040 disability. To 2024, the same question was posed before the attorney general's office, and they 434 00:41:41,040 --> 00:41:46,800 came to a very different conclusion. They said, yes, it should bend, and they basically looked at 435 00:41:46,800 --> 00:41:51,040 what occurred during the pandemic, and all the council members essentially teleconferencing in from 436 00:41:51,040 --> 00:41:56,720 their individual homes. And they said, cities have the tools that they can essentially accommodate 437 00:41:56,720 --> 00:42:01,520 a council member if they have a disability, allow them to zoom into a meeting. And so what you're really 438 00:42:01,520 --> 00:42:07,680 seeing here is the state legislature codifying that attorney general opinion from 2024, and basically 439 00:42:07,680 --> 00:42:12,480 saying that, yes, if you have a disability under American with Disabilities Act, we have to accommodate 440 00:42:12,480 --> 00:42:16,960 you. There's specific requirements now included within the Brown Act as to how, as to how we do that. 441 00:42:17,840 --> 00:42:21,600 And so those are all the requirements there on the screen if you're interested in that as an option. 442 00:42:22,640 --> 00:42:28,080 And then lastly, the alternative teleconferencing rules. These are all the other types of teleconferencing 443 00:42:28,080 --> 00:42:34,960 options besides disability, besides the traditional rules. If you recall during the pandemic, 444 00:42:34,960 --> 00:42:38,960 obviously, you were able to go completely remote. And so that still exists within the Brown Act. 445 00:42:39,520 --> 00:42:44,560 Just cause which came out post pandemic where the state legislature built some flexibility into the 446 00:42:44,560 --> 00:42:49,120 Brown Act. If you were sick with COVID, if you were taking care of somebody who had COVID, those rules 447 00:42:49,120 --> 00:42:55,200 continue to exist, but they've been simplified to some extent. Also, eligible subsidiary bodies, 448 00:42:55,200 --> 00:43:00,320 this is an option where as a council, you could decide that we want to allow some of our subsidiary 449 00:43:00,320 --> 00:43:06,640 bodies to go completely remote without in-person attendance or in-person meetings. You can do that, 450 00:43:06,640 --> 00:43:10,320 but you'd have to make findings. You'd have to re-up those findings and then the subsidiary 451 00:43:10,320 --> 00:43:15,920 body itself would have to say yes or no. So it is an option though, if council did want to explore that 452 00:43:15,920 --> 00:43:21,840 in the future. And then also eligible multi-jouristictional bodies. These are your larger bodies where you 453 00:43:22,720 --> 00:43:27,200 are being forced to travel large distances to get to those meetings. There is a mileage of requirement 454 00:43:27,200 --> 00:43:32,400 within this provision. And I want to say it's 250 plus miles. If you're traveling that kind of distance, 455 00:43:33,120 --> 00:43:37,680 this gives you an option to essentially teleconference into a meeting. So keep that in mind. And if you are 456 00:43:37,680 --> 00:43:42,160 on one of those bodies, speak with your agency council. They can help you or I can help as well. 457 00:43:43,920 --> 00:43:48,720 Now, just the miscellaneous updates. If you're not aware, there is an existing law within the Brown Act 458 00:43:48,720 --> 00:43:54,400 that contains social media restrictions. And so you don't want to like comment on or interact 459 00:43:54,400 --> 00:43:59,040 with a post by your fellow council member on social media. The risk there really is that if you were to 460 00:43:59,040 --> 00:44:05,520 like something, let's say one council member post something about city business. You like it. A third 461 00:44:05,520 --> 00:44:10,320 council member sees that and assumes you're all in favor of that. It could lead to a collective concurrence 462 00:44:10,320 --> 00:44:15,760 of the council occurring outside of a public meeting. This used to have an actual a sunset provision, 463 00:44:15,760 --> 00:44:21,840 which I think basically those restrictions were to go away this year. And Senate Senate Bill 707 464 00:44:21,840 --> 00:44:27,200 essentially made those permanent. So they are now in the Brown Act. Also, we must provide you a copy of 465 00:44:27,200 --> 00:44:31,600 the Brown Act. And so I think our clerk has satisfied that requirement. But that has kicked in with Senate 466 00:44:31,600 --> 00:44:38,880 Bill 707. As you are aware into the Brown Act, we cannot discuss local agency compensation at a 467 00:44:38,880 --> 00:44:43,600 special meeting. That includes your city manager, your department heads, your city attorney. And now, 468 00:44:43,600 --> 00:44:49,040 Senate Bill 707 extends that to the legislative body. So if you were to ever discuss salary, 469 00:44:49,040 --> 00:44:53,920 changing the salary for council member compensation or to discuss benefits that would need to occur 470 00:44:53,920 --> 00:44:58,560 at a regular meeting. And then the last one is there was a new provision as I indicated, which is 471 00:44:58,560 --> 00:45:08,560 included within your policy. 472 00:45:00,000 --> 00:45:04,000 As to how to deal with a removal of disruptive virtual attendees. 473 00:45:04,000 --> 00:45:10,000 And with that, that staff's recommendation to receive a report from staff regarding Senate Bill 707, which you've done, 474 00:45:10,000 --> 00:45:15,000 and then second to adopt a resolution adopting a disruption of telephonic or internet service during meeting 475 00:45:15,000 --> 00:45:21,000 policy and accordance with Senate Bill 707. Both Tiffany and I are available to answer any questions the council may have. 476 00:45:21,000 --> 00:45:22,000 Thank you. 477 00:45:22,000 --> 00:45:26,000 Thank you. Any clarifying questions from the council? 478 00:45:27,000 --> 00:45:30,000 I'd see none. I will open up public comment and any comment cards for this item. 479 00:45:30,000 --> 00:45:32,000 I have none. 480 00:45:33,000 --> 00:45:35,000 But I see someone. 481 00:45:38,000 --> 00:45:44,000 You know, I graduate at Sanoma State with the first bachelor's degree in digital media. 482 00:45:44,000 --> 00:45:48,000 I've been chasing ones in zero since 1991. 483 00:45:48,000 --> 00:45:55,000 When you had to wait three days to load up 50 megabytes on a computer. 484 00:45:55,000 --> 00:46:05,000 I could tell you this, one thing that my department chair of computer science told me before I left the school after I graduate. 485 00:46:05,000 --> 00:46:10,000 He said, Dalton, God made the computer. 486 00:46:10,000 --> 00:46:17,000 I said, yes. Okay. He said, Dalton, the devil made technology. 487 00:46:18,000 --> 00:46:23,000 And believe me, I'm I'm pretty free wheeling guy. 488 00:46:23,000 --> 00:46:32,000 The first time I brought up the Brown Act back in 1986 at the planning department they asked me to leave. 489 00:46:32,000 --> 00:46:37,000 Last time I brought it up was two years ago and they called security on me. 490 00:46:37,000 --> 00:46:46,000 So I think it's important that we have the Brown Act, but also I think the overuse of technology is bringing us into 491 00:46:46,000 --> 00:46:50,000 an area where we're going to have a lot more problems. 492 00:46:50,000 --> 00:46:55,000 You know, I mean, I could essentially say to you, I'm not Dalton today. 493 00:46:55,000 --> 00:46:57,000 I'm AI. 494 00:46:57,000 --> 00:47:01,000 So I think I see those problems with this. 495 00:47:01,000 --> 00:47:13,000 And if there is a possible way that this meeting that the council meeting in the city government can avoid using technology to 496 00:47:13,000 --> 00:47:21,000 to to our meetings, I think that's really important because I think if somebody is really interested in their government, they should show up. 497 00:47:21,000 --> 00:47:31,000 They should stand here and they should talk intelligently about what it is that they want our need or they see for the future. 498 00:47:31,000 --> 00:47:33,000 Thank you. 499 00:47:33,000 --> 00:47:34,000 Thank you. 500 00:47:34,000 --> 00:47:36,000 You additional public comment. 501 00:47:36,000 --> 00:47:40,000 All right, I'll close public comment and bring it back to the council. 502 00:47:40,000 --> 00:47:43,000 Councilmember Narveyes. 503 00:47:43,000 --> 00:47:45,000 Thank you. 504 00:47:45,000 --> 00:47:46,000 Okay. 505 00:47:46,000 --> 00:47:51,000 A couple questions and I understand SB 707 something to comply with. 506 00:47:51,000 --> 00:47:59,000 I think that technology can be used for an advantage, but there's also some things that we have to take a look at that kid. 507 00:47:59,000 --> 00:48:02,000 You know, cause some issues. 508 00:48:02,000 --> 00:48:06,000 First question is, I know as soon as mentioned quite a bit, there's other platforms. 509 00:48:06,000 --> 00:48:15,000 Is that are we using zoom generally or is that the platform that we're going to be using or there are others that we consider. 510 00:48:15,000 --> 00:48:17,000 I'll take this, Chris. 511 00:48:17,000 --> 00:48:20,000 Yes, we are we are currently in the process of testing out zoom. 512 00:48:20,000 --> 00:48:31,000 We've secured the webinar license based on our research in with IT's also recommendation more moving forward with that. 513 00:48:31,000 --> 00:48:35,000 A little bit more secure to do the webinar function in the allow for additional. 514 00:48:35,000 --> 00:48:41,000 Security measures across the board, but we will be implementing zoom for the remote participation. 515 00:48:41,000 --> 00:48:42,000 Thank you. 516 00:48:42,000 --> 00:48:45,000 And this SB 707. 517 00:48:45,000 --> 00:48:54,000 I guess this requires to stream in anywhere else or is it just within that platform that we're choosing to have the online meeting. 518 00:48:54,000 --> 00:48:55,000 Yeah, it's a great question. 519 00:48:55,000 --> 00:48:59,000 The requirement is really just to connect the public via the telephonic. 520 00:48:59,000 --> 00:49:03,000 It can call in or two way out of visual platform, which soon would be one of those. 521 00:49:03,000 --> 00:49:06,000 I know that the city does also. 522 00:49:06,000 --> 00:49:09,000 Tiffany, you know the word better than I do it in terms of. 523 00:49:09,000 --> 00:49:16,000 We do have a stream through the local through our agenda management software provider grant a case, which is on our public page. 524 00:49:16,000 --> 00:49:21,000 And then I am in the process of looking at the ability to stream on YouTube. 525 00:49:21,000 --> 00:49:25,000 As well, there's a available connector, but there are some. 526 00:49:25,000 --> 00:49:31,000 There are a lot of applications with that is released to other board and commissions, so it's likely going to happen in the future. 527 00:49:31,000 --> 00:49:37,000 I'm just hoping to get secured and comfortable with the use of our zoom before expanding on on that. 528 00:49:37,000 --> 00:49:45,000 And as well as actually expanding the use of closed captioning on our meeting, the meeting videos that are. 529 00:49:45,000 --> 00:49:48,000 Save on our insight page or what page. 530 00:49:48,000 --> 00:49:50,000 Great. Thank you. 531 00:49:50,000 --> 00:49:58,000 Making comments, typing in the, you know, zoom has the ability for comments and making, you know, typing in. 532 00:49:58,000 --> 00:49:59,000 We want to public. 533 00:49:59,000 --> 00:50:02,000 We will not be enabling chat. 534 00:50:02,000 --> 00:50:03,000 Yeah. 535 00:50:03,000 --> 00:50:04,000 Okay. Thank you. 536 00:50:04,000 --> 00:50:06,000 Now, I do see. 537 00:50:06,000 --> 00:50:14,000 I do remember during COVID how it how the online, you know, assistance specifically zoom was it was the big one. 538 00:50:14,000 --> 00:50:18,000 It did a lot for a lot of, you know, participation, you know, we have a video. 539 00:50:18,000 --> 00:50:25,000 But the notion of being able to say a comment, you know, from home, you know, there's. 540 00:50:25,000 --> 00:50:32,000 There's times there's other means that I like to to watch and I was able to, you know, if I'm making dinner with make it, I can listen and maybe make a comment. 541 00:50:32,000 --> 00:50:41,000 I can't. So there are some advantages to reaching part of our community, but there also also opens the door for, you know, as we spoke some disruption. 542 00:50:41,000 --> 00:50:45,000 So to that note, what I like to know, do they couple things. 543 00:50:45,000 --> 00:50:50,000 Do they have to have the camera on do we collect data on that person. 544 00:50:50,000 --> 00:50:57,000 And the reason I'm asking if there is a disruption and potentially legal issue, how do we follow up with the individual. 545 00:50:57,000 --> 00:50:59,000 That's a great question. 546 00:50:59,000 --> 00:51:03,000 I will say that the brand isn't clear as to whether we need to allow camera on. 547 00:51:03,000 --> 00:51:08,000 I think there's a suggestion and I'm happy to kind of walk the council through that with guidance. 548 00:51:09,000 --> 00:51:18,000 And so yes, I think it's an open question, but yes, and I think when you're dealing with cameras on obviously there is a more ability to show more, which could be problematic. 549 00:51:18,000 --> 00:51:22,000 I think if that was to occur and something was being displayed, that's problematic. 550 00:51:22,000 --> 00:51:26,000 We'd want to look at what that is first to see if it's protected by the first amendment. 551 00:51:26,000 --> 00:51:36,000 It's an absurdity, you know, stuff that is not artistic is not protected by the first amendment, so if it was pornography, if some sort, we could probably shut that down easily. 552 00:51:36,000 --> 00:51:40,000 If it was something that was protected by the first amendment, but we're still disrupting the meeting. 553 00:51:40,000 --> 00:51:49,000 I'd want to invoke the procedures out in the policy, basically giving a fair warning stopping the timer and seeing if that person can change our behavior. 554 00:51:49,000 --> 00:51:57,000 Okay, thank you. And when I do log into zoom, do they, so like, do you have to register with some meetings. 555 00:51:57,000 --> 00:52:03,000 Is there a name and email that has to be, can you just click on it, I'm likely log in or what's the process for that. 556 00:52:03,000 --> 00:52:06,000 We're still working on the exact process there. 557 00:52:06,000 --> 00:52:10,000 I don't want to make it overly burdensome where it's complicated to log. 558 00:52:10,000 --> 00:52:16,000 I want to be able to have somebody jump on jump off without getting confused on how to register. 559 00:52:16,000 --> 00:52:23,000 I believe there are safeguards in place where we can, for example, not allow somebody to change their name. 560 00:52:23,000 --> 00:52:32,000 During a meeting, for example, I've heard from my, my clerk colleagues were, you know, I'll be Tiffany Carranza, then I'll get off, re-raise my hand under Tiffany Reed. 561 00:52:32,000 --> 00:52:35,000 And then so there's, there's a safeguard, I believe, in place for that. 562 00:52:35,000 --> 00:52:42,000 We're, we've got the technology at our fingertips, we were still in the testing phases. 563 00:52:42,000 --> 00:52:48,000 And in our web page and our agenda, we'll very clearly state how someone will, we'll sign up. 564 00:52:48,000 --> 00:52:54,000 And I think we'll be able to use the same link meeting after meetings, so that will also be more convenient. 565 00:52:54,000 --> 00:52:57,000 But there will, we'll use as many safeguards as possible. 566 00:52:57,000 --> 00:53:01,000 And one, one discussion point has been video on video off. 567 00:53:01,000 --> 00:53:09,000 What is the, so it's, it's, there's benefits to not having their faces on and there's, I don't know that we could make somebody. 568 00:53:09,000 --> 00:53:16,000 But I guess we may have to, well, I was, we were kind of aiming to not allow video, but we don't have to. 569 00:53:16,000 --> 00:53:17,000 And I'm not mean one or the other. 570 00:53:17,000 --> 00:53:20,000 Yeah, no, yeah, but just a full disclosure. 571 00:53:20,000 --> 00:53:28,000 Great. Well, you know, intention of this is to make these meetings a lot more accessible, but I am concerned that, you know, some people, 572 00:53:28,000 --> 00:53:33,000 I mean, I take these means the series as we do, even on the light issue, right? 573 00:53:33,000 --> 00:53:43,000 So my, my message to public is, you know, join us in the seriousness of this meeting and, and, you know, you know, you know, so we can continue to do good work for a community. 574 00:53:43,000 --> 00:53:49,000 But, you know, good luck with implementing this and, you know, I'm sure you and your team will do a great job as always. 575 00:53:49,000 --> 00:53:50,000 Thank you. 576 00:53:50,000 --> 00:53:52,000 But it is a very valid concern council member. 577 00:53:52,000 --> 00:53:58,000 I would say that this bill was opposed largely by local agencies, just because of the technology cost, 578 00:53:58,000 --> 00:54:03,000 the zoom bombing that we a lot of agency saw during the pandemic, which was just not fun to deal with. 579 00:54:03,000 --> 00:54:06,000 And create issues for local agencies. 580 00:54:06,000 --> 00:54:09,000 Thank you. 581 00:54:09,000 --> 00:54:10,000 Thank you. 582 00:54:10,000 --> 00:54:11,000 This is a lot. 583 00:54:11,000 --> 00:54:15,000 I mean, you guys been working on this for a long time, and I'm sure the state's paying for us to do this, right? 584 00:54:15,000 --> 00:54:16,000 Yeah. 585 00:54:16,000 --> 00:54:22,000 I'm grateful that we've invested in our staff and our technologies so that we can do this. 586 00:54:22,000 --> 00:54:26,000 But I'm really concerned about smaller cities and how they're going to try and figure this out. 587 00:54:26,000 --> 00:54:32,000 I do have some questions also kind of around the same thing about this issue of total failure versus partial failure. 588 00:54:32,000 --> 00:54:36,000 I think it's easy to describe a total failure of zoom goes down. 589 00:54:36,000 --> 00:54:38,000 Then, okay, it's it's, you know, it's done. 590 00:54:38,000 --> 00:54:44,000 But there are situations of kind of partial failure where I'm not sure if we would still say. 591 00:54:44,000 --> 00:54:49,000 Partition, participation has been meaningfully impacted to the point that we would stop the meeting. 592 00:54:49,000 --> 00:54:52,000 And I think we'll probably figure a lot of this out as we go. 593 00:54:52,000 --> 00:55:00,000 But can you kind of clarify when you say call in, you mean call in through the zoom feature correct, not like a separate phone line. 594 00:55:00,000 --> 00:55:01,000 Okay. 595 00:55:01,000 --> 00:55:05,000 Correct. The two way communication will all be through zoom. 596 00:55:05,000 --> 00:55:12,000 So zoom offers the the link to participate virtually with your with your camera, you know, from yourself on your computer. 597 00:55:12,000 --> 00:55:19,000 And then there is also a dial in phone number that will be published and that members can utilize to for just the audio portion. 598 00:55:19,000 --> 00:55:24,000 But they could also call in if they pushed star six or something. 599 00:55:24,000 --> 00:55:25,000 Okay, but it's all through zoom. 600 00:55:25,000 --> 00:55:26,000 Correct. 601 00:55:26,000 --> 00:55:27,000 Okay. 602 00:55:27,000 --> 00:55:35,000 And then if one person says they can't connect, but there are other people who have been able to, you know, however many other people who've been able to participate. 603 00:55:35,000 --> 00:55:40,000 Is that we consider that a personal technology issue or is that an agency failure? 604 00:55:40,000 --> 00:55:41,000 Is that on us? 605 00:55:41,000 --> 00:55:44,000 Do we have to pause the meeting because one person says they can get on? 606 00:55:44,000 --> 00:55:45,000 No, it's a great question. 607 00:55:45,000 --> 00:55:50,000 And I would say that's a personal technology issue and we would not send somebody their house to help them connect. 608 00:55:50,000 --> 00:55:57,000 And we would not stop the meeting and that's a circumstance because if everyone else is connected, we're conducting business and our technology and the chambers is working. 609 00:55:57,000 --> 00:55:58,000 Okay. 610 00:55:58,000 --> 00:55:59,000 Great. 611 00:55:59,000 --> 00:56:05,000 And then what what if the audio quality is just kind of not great and we can't hear the comments that well is that a situation where we would pause? 612 00:56:05,000 --> 00:56:11,000 I probably would recommend to be safe just because we're not actually hearing the comments and that's a requirement is that we allow them to comment. 613 00:56:11,000 --> 00:56:14,000 We're allowing them to comment, but if you're not hearing them, is that really meaningful? 614 00:56:14,000 --> 00:56:21,000 So I would recommend pausing as best we can and seeing if we can fix that issue and hopefully it's just the speaker issue or some audio issue on our end. 615 00:56:21,000 --> 00:56:22,000 Okay. 616 00:56:22,000 --> 00:56:23,000 Thank you. 617 00:56:23,000 --> 00:56:26,000 And then just some concerns that I would share. 618 00:56:26,000 --> 00:56:29,000 You know, I think we're going to figure out how to fly the plane as we go. 619 00:56:29,000 --> 00:56:38,000 But I'm actually concerned about stricter enforcement against people that are appearing on Zoom because it's really easy to hit the mute button and stop someone from talking. 620 00:56:38,000 --> 00:56:44,000 It's not as easy to stop someone who's yelling at us from the back of the room as they walk out, which has happened. 621 00:56:44,000 --> 00:56:49,000 So just treating people differently is always a concern of lawsuits. 622 00:56:49,000 --> 00:56:56,000 And then of course, trolls and we've talked about this before, but you know, there was a lot of anti-Semitic, for example, 623 00:56:56,000 --> 00:57:03,000 Zoom's earlier during COVID and, you know, can the mayor cut them off just because of that, probably not. 624 00:57:03,000 --> 00:57:04,000 I don't think so. 625 00:57:04,000 --> 00:57:08,000 But if it's outside of subject matter jurisdiction, it gets a little wishy washing. 626 00:57:08,000 --> 00:57:16,000 So, and then also, you know, the good faith effort to fix the technology issue is inherently subjective. 627 00:57:16,000 --> 00:57:19,000 Do we have to keep our IT department here all the time? 628 00:57:19,000 --> 00:57:24,000 Do we have to have somebody here all the time ready to jump in if something happens if a meeting goes until midnight? 629 00:57:24,000 --> 00:57:26,000 Do we have to keep them here? 630 00:57:26,000 --> 00:57:30,000 And then also just finally the kind of political aspect of it. 631 00:57:30,000 --> 00:57:37,000 If Zoom goes out and we do everything we can to fix it and hour goes by, we have a role call vote and we decide we're going to keep going with the meeting. 632 00:57:37,000 --> 00:57:47,000 Anything we vote on after that point is going to become more controversial because it's going to look like we're trying to, you know, hide comments or trying to have less participation. 633 00:57:47,000 --> 00:57:49,000 So that's just something I'd be concerned about. 634 00:57:49,000 --> 00:57:53,000 But thank you for all your work on this unfunded state mandate. 635 00:57:54,000 --> 00:57:55,000 Council member pay. 636 00:57:55,000 --> 00:57:57,000 Yeah. Thank you. Yeah. 637 00:57:57,000 --> 00:58:02,000 You know, I have somewhat similar comments, but I think they're really important. 638 00:58:02,000 --> 00:58:06,000 And I want to sort of touch a little bit on my question about. 639 00:58:06,000 --> 00:58:15,000 Zoom callers coming in when potentially, you know, if someone's from well outside the area, we can't say they're not allowed to call in. 640 00:58:15,000 --> 00:58:20,000 But that certainly has happened, but the notion of a troll or a bot or the way AI is going, 641 00:58:20,000 --> 00:58:25,000 there could be circumstances where we don't know if the caller is even a human being is there. 642 00:58:25,000 --> 00:58:34,000 And I don't know the technology, and I'm not an expert, but that's the kind of thing that I think is potentially a problem. 643 00:58:34,000 --> 00:58:36,000 So you're kind of nodding your head, yes, I don't. 644 00:58:36,000 --> 00:58:37,000 Yeah. 645 00:58:37,000 --> 00:58:42,000 I would say yes, clear acknowledgement that I think those issues are going to be issues. 646 00:58:42,000 --> 00:58:49,000 And I think in the state legislature and acting this law, I'm hoping that in future years they do provide some greater clarity and greater tools to deal with those issues. 647 00:58:49,000 --> 00:58:52,000 Because I do think they will be issues. 648 00:58:52,000 --> 00:58:54,000 I think they're going to be big issues. 649 00:58:54,000 --> 00:58:56,000 And I don't want to take up too much time with that. 650 00:58:56,000 --> 00:58:59,000 I think we've all kind of voiced that concern. 651 00:58:59,000 --> 00:59:05,000 You know, thank you to Tiffany and Chris to everybody who's put time into this unfunded state mandate. 652 00:59:05,000 --> 00:59:11,000 One other question before I leave this, can we limit callers to two minutes rather than three minutes? 653 00:59:11,000 --> 00:59:21,000 You can, if I, excuse me, if I recall correctly, city council policy resolution 19 does include some language where the mayor their chair has discretion to basically reduce that public comment time down. 654 00:59:21,000 --> 00:59:26,000 Based on the volume of business you need to conduct and how many speakers that want to speak on particular issues. 655 00:59:26,000 --> 00:59:30,000 So that's not in the resolution that we're looking at tonight. 656 00:59:30,000 --> 00:59:35,000 So what we did is we looked also obviously this is dealing more so with the virtual platform. 657 00:59:35,000 --> 00:59:40,000 We also looked at city council policy resolution 19 as part of this exercise to make sure you had the tools. 658 00:59:40,000 --> 00:59:43,000 That resolution does include obviously what you indicated. 659 00:59:43,000 --> 00:59:51,000 Beth just the option to reduce that minute time down if we need to do so for the volume of speakers and the amount of business we need to conduct. 660 00:59:51,000 --> 00:59:58,000 It also includes the option for the mayor to essentially do a total amount of time for public testimony on a particular issue. 661 00:59:58,000 --> 01:00:00,000 And so if it wasn't something that would. 662 01:00:00,000 --> 01:00:13,000 We come back to you multiple times. Maybe you limit public comment to an hour. If there's 300 people that want to speak, there will be some people that won't get to speak. But again, if it's one of those issues that keeps coming back to you, maybe it's a study session, you could do that. 663 01:00:13,000 --> 01:00:14,000 And so those options are in. 664 01:00:14,000 --> 01:00:25,000 Well that's something I want to leave on the table and we can all think about whether or not I'm also a fan of just trying to get people to come here and show up so we can have a dialogue and be in person. 665 01:00:25,000 --> 01:00:29,000 And these are members of our community who are talking to us about our community. 666 01:00:29,000 --> 01:00:38,000 Now people from the outside. So I would be in favor of least exploring the notion of a flat reduced time for online callers. 667 01:00:38,000 --> 01:00:43,000 Just to clarify, and Chris can correct me, it would be for, it has to be the same time for each. 668 01:00:43,000 --> 01:00:50,000 You can't provide a different set of time or instructions for teleconferencing members. 669 01:00:50,000 --> 01:00:52,000 Yes, different sort. Okay, I just want to. 670 01:00:52,000 --> 01:00:53,000 Okay. 671 01:00:53,000 --> 01:00:56,000 I put a blue applied. Okay. Thank you for. 672 01:00:56,000 --> 01:00:59,000 Not the direction I was hoping, but I understand. 673 01:00:59,000 --> 01:01:03,000 And then the last thing I'll just say is, you know, we're not in this alone. 674 01:01:03,000 --> 01:01:08,000 Every single community that the way described, obviously very small, maybe not so much. 675 01:01:08,000 --> 01:01:15,000 So we really need to get our comments back to our state representatives as we try to navigate our way through this. 676 01:01:15,000 --> 01:01:19,000 I think we're, you know, reasonably good position to give it a shot. 677 01:01:19,000 --> 01:01:23,000 But I think it's going to be a challenge across the state. 678 01:01:23,000 --> 01:01:27,000 And if we can do our best to provide comments, I think we ought to do that. Thank you. 679 01:01:27,000 --> 01:01:34,000 And my hope is that with all most agencies going this direction, the larger agencies that you see zoom bombing, 680 01:01:34,000 --> 01:01:36,000 they're equitably distributed across the border. 681 01:01:36,000 --> 01:01:39,000 It just doesn't occur because there's so many agencies have gone this direction. 682 01:01:39,000 --> 01:01:42,000 But we shall see. Okay. Thank you. 683 01:01:42,000 --> 01:01:44,000 Thank you so much for the presentation. 684 01:01:44,000 --> 01:01:47,000 Thank you to Tiffany in your office for all your hard work on this. 685 01:01:47,000 --> 01:01:51,000 I did have one additional clarification on a partial disruption. 686 01:01:51,000 --> 01:01:55,000 So we talked about it if it was one, but what if we get 30 calls that are unable to get on. 687 01:01:55,000 --> 01:01:57,000 But we see people are able to get on as their threshold. 688 01:01:57,000 --> 01:01:59,000 We should look at it as we're. 689 01:01:59,000 --> 01:02:02,000 There's nothing within the Brown Act that defines like a threshold of any sort. 690 01:02:02,000 --> 01:02:07,000 And so I would say if we are connected, people can connect in there's 30 that just can't connect. 691 01:02:07,000 --> 01:02:11,000 Maybe it's the internet and that location in the city or something is going awry. 692 01:02:11,000 --> 01:02:16,000 But I would say that circumstance as long as we have other people connected with the technology issue is not here. 693 01:02:16,000 --> 01:02:18,000 In the chambers, it's somewhere else. 694 01:02:18,000 --> 01:02:20,000 And so I would not recommend taking every system that circumstance. 695 01:02:20,000 --> 01:02:22,000 But we do want to look at it and just make sure. 696 01:02:22,000 --> 01:02:24,000 Thank you for that. 697 01:02:24,000 --> 01:02:28,000 With that, do I have a motion to adopt the resolution? 698 01:02:28,000 --> 01:02:32,000 I make a motion to adopt the recommendation. 699 01:02:32,000 --> 01:02:36,000 Number one, receive a report from staff regarding Senate Bill and to adopt the resolution 700 01:02:36,000 --> 01:02:40,000 to adopt the resolution, adopt the disruption of Tephonic or Internet service during meetings, 701 01:02:40,000 --> 01:02:44,000 policy and accordance to SB 707. 702 01:02:44,000 --> 01:02:46,000 I have a second from our bias. 703 01:02:46,000 --> 01:02:50,000 And I have a motion from our bias, a second from Leros, all in favor. 704 01:02:50,000 --> 01:02:52,000 I, in the opposed. 705 01:02:52,000 --> 01:02:54,000 That passes unanimously. 706 01:02:54,000 --> 01:02:58,000 Thank you. 707 01:02:58,000 --> 01:03:04,000 Moving on to public hearings for annual update to speed limits on city streets. 708 01:03:04,000 --> 01:03:10,000 First, we will hear a report from city staff, which may include responses to clarifying questions from members of council. 709 01:03:10,000 --> 01:03:16,000 Next, members of council will ask to disclose any information learned outside of the hearing. 710 01:03:16,000 --> 01:03:20,000 Then members of the public will be provided an opportunity to present testimony regarding the hearing. 711 01:03:20,000 --> 01:03:22,000 Finally, we will close the public testimony. 712 01:03:22,000 --> 01:03:26,000 We will now hear a report from staff. 713 01:03:34,000 --> 01:03:44,000 Vice Mayor. 714 01:03:44,000 --> 01:03:47,000 Vice Mayor, members of city council. 715 01:03:47,000 --> 01:03:52,000 My name is Lauren Clark, and I'm the senior transportation planner for the city of Napa's Public Works Department. 716 01:03:52,000 --> 01:03:55,000 I'm joined today by Jimmy Jessup from Parametrics. 717 01:03:55,000 --> 01:04:01,000 Parametrics is serving as the city's transportation engineer while we're recruiting for our next senior traffic engineer. 718 01:04:01,000 --> 01:04:15,000 Today, we'll be providing a presentation on the annual update to speed limits on city streets and the municipal code section 10.2040 amendment. 719 01:04:15,000 --> 01:04:19,000 The presentation will include background on the setting of speed limits. 720 01:04:19,000 --> 01:04:21,000 Some recent state legislative changes. 721 01:04:21,000 --> 01:04:23,000 The annual speed limit update. 722 01:04:23,000 --> 01:04:25,000 The recommended action. 723 01:04:25,000 --> 01:04:29,000 And then both myself and Jimmy will be available to answer questions at the end of the presentation. 724 01:04:29,000 --> 01:04:37,000 I'll now pass it over to Jimmy to continue with the presentation. 725 01:04:37,000 --> 01:04:39,000 Good afternoon council members. 726 01:04:39,000 --> 01:04:43,000 Jimmy Jessup, transportation engineer with parametrics. 727 01:04:43,000 --> 01:04:55,000 Parametrics is a firm that provides very traffic engineering services to jurisdictions and we consider speed limit establishment one of our core services. 728 01:04:55,000 --> 01:05:03,000 And I would also like to note that we have been following the speed limit reductions of late in Napa. 729 01:05:03,000 --> 01:05:14,000 I presented using Napa as an example for other jurisdictions to follow and others have in adopting similar 20 mile in our zone downtown and the light. 730 01:05:14,000 --> 01:05:21,000 And so we've seen Napa as kind of a guiding light in this area is a pleasure to be here presenting to you for the first time. 731 01:05:21,000 --> 01:05:27,000 I'd like to talk a little bit about speed limits where they come from what their purpose is. 732 01:05:27,000 --> 01:05:35,000 The California vehicle code spells out a lot of the requirements for both motorists and for jurisdictions regarding speed limits. 733 01:05:35,000 --> 01:05:45,000 On the left you'll see motorists are required as per the vehicle code to conduct themselves and operate vehicles at speeds that are considered reasonable and prudent. 734 01:05:45,000 --> 01:05:59,000 Conversely or cooperatively speed limits themselves which are the responsibility of local jurisdictions are meant to advise those motorists of maximum and reasonable safe driving speeds. 735 01:05:59,000 --> 01:06:09,000 Hopefully speed limits also provide a basis for legal adjudication on contests to citations. 736 01:06:09,000 --> 01:06:14,000 So let's talk a little bit about speed limits where they come from what they mean. 737 01:06:14,000 --> 01:06:28,000 There are two general types of speed limits on the left you'll see a description of prima facia speed limits prima facia is a Latin term that means at first glance or in speed limit parlance. 738 01:06:28,000 --> 01:06:36,000 The speed limit parlance prima facia means a presumed speed limit so you'll see a picture of a typical residential street here in Napa. 739 01:06:36,000 --> 01:06:47,000 Many times these streets might not have a posted speed limit but it is presumed that the speed limit on residential or business district streets is 25 miles an hour. 740 01:06:47,000 --> 01:06:53,000 For all other roadways for instance on the right you'll see a picture of a four lane arterial roadway. 741 01:06:53,000 --> 01:07:04,000 This is neither a residential or a business district street and speed limits are established by an engineering study that we have called a engineering and traffic survey. 742 01:07:04,000 --> 01:07:19,000 The California vehicle code is very specific on what constitutes an engineering and traffic survey in NTS and it involves a survey of roadway conditions land use characteristics and namely traffic speed. 743 01:07:19,000 --> 01:07:35,000 So part of the survey is to conduct speed surveys of at least a hundred vehicles a travel on the roadway and the eighty-fifth percentile is a value that largely dictates the resulting established speed limit. 744 01:07:35,000 --> 01:07:42,000 The process of landing at that speed limit looks as such displayed on the screen. 745 01:07:42,000 --> 01:07:56,000 The data collection as mentioned is a survey measured speeds typically with radar that's conducted under various specific conditions to measure the unimpeded or three-flow speed of vehicle traffic. 746 01:07:56,000 --> 01:08:09,000 And from those distribution of collected vehicle speeds we calculate the eighty-fifth percentile which is the speed at which eighty-five percent of the vehicles are traveling at or below. 747 01:08:09,000 --> 01:08:16,000 Now the other way to think of eighty-fifth percentile is the speed at which fifteen percent of vehicles travel above. 748 01:08:16,000 --> 01:08:22,000 And as per the vehicle code that eighty-fifth percentile is a speed which is considered reasonable and prudent. 749 01:08:22,000 --> 01:08:29,000 On the right you'll see that's what dictates the recommendation for an established speed limit. 750 01:08:29,000 --> 01:08:41,000 This is an example, a real world example of collected speeds and you'll see the distribution of speeds on the left from as low as fifteen miles an hour to thirty-four miles an hour. 751 01:08:41,000 --> 01:08:45,000 Collected from a local street so you can imagine your local residential street. 752 01:08:45,000 --> 01:08:48,000 You'll have some vehicles traveling only at fifteen miles an hour. 753 01:08:48,000 --> 01:08:52,000 Some that are going maybe a little over the speed limit. 754 01:08:52,000 --> 01:09:01,000 And from the graph on the left you'll see the bulk of collected speeds distributed between that nineteen and twenty-four mile an hour range. 755 01:09:01,000 --> 01:09:04,000 There's a few outliers. 756 01:09:04,000 --> 01:09:10,000 But in actuality of these one hundred collected vehicle speeds the average speed is twenty-three miles an hour. 757 01:09:10,000 --> 01:09:13,000 But here's where understanding the eighty-fifth percentile is important. 758 01:09:13,000 --> 01:09:17,000 You'll see the eighty-fifth percentile line there at twenty-eight miles an hour. 759 01:09:17,000 --> 01:09:22,000 Again, fifteen percent of vehicles travel above twenty-eight miles an hour. 760 01:09:22,000 --> 01:09:31,000 As per the procedure established in the vehicle code we would round that eighty-fifth percentile to the nearest five mile an hour. 761 01:09:31,000 --> 01:09:38,000 In this case the resulting rounded speed limit would be thirty miles an hour. 762 01:09:38,000 --> 01:09:51,000 So the way that we establish speed limits on our streets as per the vehicle code tends to, especially in the way that we understand speed limits in our modern society, 763 01:09:51,000 --> 01:09:58,000 tends to lead to increased establishment of speed limits higher than what we would typically expect or want. 764 01:09:58,000 --> 01:10:10,000 And this is a trend that over the years has been recognized by cities, by the profession, and further informed with our understanding of crash outcomes. 765 01:10:10,000 --> 01:10:26,000 This is a graph that we have seen displayed in many different ways in our profession, but it relates the potential for pedestrians to survive being hit or struck by a vehicle, 766 01:10:26,000 --> 01:10:34,000 traveling at various speeds. So if a vehicle is traveling at twenty miles an hour, a pedestrian has a 90 percent chance of surviving that collision, 767 01:10:34,000 --> 01:10:44,000 but statistically speaking if a vehicle is traveling as high as forty miles an hour, then a pedestrian succumbs to those injuries eighty percent of the time. 768 01:10:44,000 --> 01:10:55,000 And so it's because of this large inflection point on pedestrians survivability of crash incidents that we take great care in thinking about speed limits. 769 01:10:55,000 --> 01:11:00,000 That are established between twenty and forty miles an hour. 770 01:11:00,000 --> 01:11:14,000 As mentioned, the eighty-fifth percentile approach, the typical traffic engineering approach has led to questioning the methodology that we have used to establish speed limits over the years in California. 771 01:11:14,000 --> 01:11:27,000 And so that's why recently we now have additional ability within the local jurisdiction to adjust speed limits in a couple of different ways. 772 01:11:27,000 --> 01:11:36,000 On this screen on the left, I'll talk about normal established speed limits on the right, recent legislation changes how schools on speed limits are established. 773 01:11:36,000 --> 01:11:47,000 Assembly Bill 43 on the left went fully into effect just a couple of years ago, but now recognizing some of the adverse crash outcomes. 774 01:11:47,000 --> 01:11:56,000 For the first time, the vehicle code requires an engineering and traffic survey to take into account more than just the motorist ability to navigate the roadway. 775 01:11:56,000 --> 01:12:05,000 It requires taking into account the presence of vulnerable roadway users, those that are children, seniors, persons, disabilities in the unhoused. 776 01:12:05,000 --> 01:12:15,000 And then it also allows local jurisdictions to further reduce speed limits by five miles an hour, given certain contexts. 777 01:12:15,000 --> 01:12:24,000 If there is a high preponderance of crashes along the roadway or if roadways are adjacent to land uses that generate high volumes of pedestrians or bicyclists. 778 01:12:24,000 --> 01:12:40,000 And so really, it's hard to understand how revolutionary this is in the state of California for the first time local jurisdictions had this additional ability to reduce the speed limits if the jurisdiction feels that that is most in line with the intended use. 779 01:12:40,000 --> 01:12:58,000 So that's what we'll be talking about tonight. There's also new legislation affected this year that California AB 3482 on the right that can reduce schools on speed limits, you might see those on your drive speed limit 25 when children are present. 780 01:12:58,000 --> 01:13:08,000 That speed limit will be reduced to 20 miles an hour in 2030 in the year 2031. 781 01:13:08,000 --> 01:13:23,000 AB 3802 also permits local jurisdictions to accelerate adoption of reduced speed limit school zones. That's not the basis of tonight's presentation, but it is something that the city is looking to undertake. 782 01:13:24,000 --> 01:13:38,000 And also a note about speed limits because I'm sure it seems that you may have heard about the update of the speed limits before we already have speed limits on our street. Why do we continue talking about it. 783 01:13:38,000 --> 01:13:53,000 The vehicle code does require a regular update of an engineering and traffic survey in order to retain enforcement of speed limits that update cycle is every seven years. 784 01:13:53,000 --> 01:14:11,000 The procedure for this update within the city limits is specified within the municipal code as Lorian mentioned in chapter 10 not 20 and because there are so many roadways within the city limits the way that the city updates of speed limits is on a rolling basis. 785 01:14:11,000 --> 01:14:27,000 This cycle, Napa is looking to updates speed limits on 52 of its roadway segments there's many more, but the way we do this is on a cadence of a few a batch of roadways every year. 786 01:14:27,000 --> 01:14:44,000 So the big reveal this year's 52 roadway segments after conducting an engineering and traffic survey and evaluating the results in the context of new provisions within the vehicle code under Assembly Bill 43. 787 01:14:44,000 --> 01:15:00,000 We've determined that a recommended speed limit to be enacted on 33 other roadways would be equivalent to a reduction of five mile an hour from the current speed limits for 19 roadways we recommend. 788 01:15:00,000 --> 01:15:13,000 And retaining the same speed limit that currently exists. And then on none of the evaluative 52 roadways do we recommend increasing the speed limit. 789 01:15:13,000 --> 01:15:25,000 Similarly, that looks like this on a map of the city. The way that we've depicted this is from cool to warm, slower to faster speed limits. 790 01:15:25,000 --> 01:15:40,000 And again, we take great care and looking at established speed limits between this range of 20 to 40 miles an hour, recognizing its potential effect positively in terms of resulting safety outcomes. 791 01:15:40,000 --> 01:15:47,000 Of the orange existing 40 mile an hour speed limits, you'll see transitioned to a recommended 35 mile an hour. 792 01:15:47,000 --> 01:16:00,000 And again, this is a map that shows the 33 segments that we recommend for a reduction in speed limit. 793 01:16:00,000 --> 01:16:10,000 So that concludes the outcome of our engineering and traffic survey. I'll pass it back to Lorraine. 794 01:16:10,000 --> 01:16:14,000 So for tonight, staff recommends that City Council take the following action. 795 01:16:14,000 --> 01:16:22,000 One, approve the first reading and introduction of an ordinance, a Mending Navim municipal code section 10.20.040, 796 01:16:22,000 --> 01:16:41,000 related to the establishment and enforcement of speed limits. And two, adopt a resolution determining that a declared speed limit is justified based on an engineering and traffic survey for identified street city streets and roadway segments and determining that the actions authorized by this resolution are exempt from sequela. 797 01:16:41,000 --> 01:16:47,000 And that concludes our presentation. Both myself and Jimi are available to answer any questions that the council may have. 798 01:16:47,000 --> 01:16:51,000 Thank you so much for the presentation. Any clarifying questions from the council? 799 01:16:53,000 --> 01:17:02,000 Seeing none, I will move on to disclosures. If a council member has received information prior to this hearing, that is important to the decision making process for the hearing. 800 01:17:02,000 --> 01:17:11,000 And if the information is not included in the written materials for this item, please disclose the information at the time. So participants in this hearing have an opportunity to consider that information. 801 01:17:11,000 --> 01:17:13,000 No disclosures. 802 01:17:13,000 --> 01:17:14,000 No disclosures. 803 01:17:14,000 --> 01:17:16,000 No disclosures. 804 01:17:17,000 --> 01:17:19,000 We'll now open public testimony. 805 01:17:19,000 --> 01:17:22,000 Submit speaker cards to this city clerk. 806 01:17:22,000 --> 01:17:28,000 Time is limited to three minutes. The speaker will sound at 30 seconds to allow speakers to summarize comments. 807 01:17:28,000 --> 01:17:29,000 Any speaker cards? 808 01:17:29,000 --> 01:17:31,000 I have none. 809 01:17:31,000 --> 01:17:34,000 Sorry, we do have one or two. 810 01:17:34,000 --> 01:17:46,000 Hi, everybody. 811 01:17:46,000 --> 01:17:49,000 I live at 4.38. 812 01:17:49,000 --> 01:17:54,000 And I take a bigger interest in lowering speed limits than most people do. 813 01:17:54,000 --> 01:17:58,000 Since the slow down nap, I campaign began in 2020. 814 01:17:58,000 --> 01:18:01,000 We've seen significant reductions in the city. 815 01:18:01,000 --> 01:18:07,000 But there's a disconnect between city procedures and the lived experiences of residents. 816 01:18:07,000 --> 01:18:11,000 So I understand about the street segments being evaluated every seven years. 817 01:18:11,000 --> 01:18:20,000 And that makes sense for staff because it's through the lens of project schedules and being able to present a completed task to council. 818 01:18:20,000 --> 01:18:22,000 But it can be confusing to residents. 819 01:18:22,000 --> 01:18:29,000 We lowered 12 segments in 2021 and then another 28 in 2023. 820 01:18:29,000 --> 01:18:32,000 And now we're doing 33 more. 821 01:18:32,000 --> 01:18:35,000 But the segments don't always connect. 822 01:18:35,000 --> 01:18:42,000 We had had discussions early on about creating a holistic approach to curbing speeding in the city. 823 01:18:42,000 --> 01:18:48,000 And visual aids greatly assist residents in understanding the impact of the changes. 824 01:18:48,000 --> 01:18:55,000 If we can build a narrative around how these 60 reductions contribute to enhancing safety, 825 01:18:55,000 --> 01:18:59,000 we can better illustrate their significance. 826 01:18:59,000 --> 01:19:02,000 A comprehensive map could provide multiple benefits. 827 01:19:02,000 --> 01:19:05,000 So this is an excellent start and I thank you very much. 828 01:19:05,000 --> 01:19:10,000 I think it's helpful for residents to be able to navigate their daily routes. 829 01:19:10,000 --> 01:19:13,000 School drop-offs and neighborhood walks. 830 01:19:13,000 --> 01:19:21,000 A map could also include locations of the enhanced crosswalks and pedestrian beacons. 831 01:19:21,000 --> 01:19:25,000 I think there are 60 of these pedestrian beacons around the city. 832 01:19:25,000 --> 01:19:30,000 And the city can take I mean is the great thing to be able to take credit for its excellent work. 833 01:19:30,000 --> 01:19:42,000 Also outlining the downtown Napa 20 mile an hour zone and those approach streets that are 25 miles an hour is a great thing to be able to point out why we are doing this. 834 01:19:42,000 --> 01:19:48,000 The connecting segments as well now that we have third street from the roundabout California to third. 835 01:19:48,000 --> 01:19:59,000 It was a connection that was missing a year ago and even Coold Street where I live now it's 25 from Amola so the entire complete street is now the same. 836 01:19:59,000 --> 01:20:06,000 A map could also highlight segments that have benefited from Measure G funding. 837 01:20:06,000 --> 01:20:11,000 Capital improvement at paving projects that may include traffic measures could be highlighted. 838 01:20:11,000 --> 01:20:18,000 And a map could show an overlap between neighborhood traffic calming applications and lowered speed limits. 839 01:20:18,000 --> 01:20:23,000 I think we've received 25 of the application somewhere already in process. 840 01:20:23,000 --> 01:20:33,000 But it would be great for neighbors to feel heard and validated that the city is lowering speed limits that align with their application. 841 01:20:33,000 --> 01:20:37,000 A map is also a great way to visualize what's missing. 842 01:20:37,000 --> 01:20:40,000 And a glaring example is oxbow. 843 01:20:40,000 --> 01:20:44,000 We need an explanation for why oxbow isn't a 20 mile an hour zone. 844 01:20:44,000 --> 01:20:47,000 The way downtown is. 845 01:20:47,000 --> 01:20:53,000 I'm going to continue on if that's okay may I. 846 01:20:53,000 --> 01:20:59,000 The chemistry is being lowered to 25 miles an hour from 30 and that's always been a puzzle for me. 847 01:20:59,000 --> 01:21:05,000 How can a speed limit be 25 miles an hour in front of model bakery. 848 01:21:05,000 --> 01:21:09,000 I've mentioned opportunities for speed reduction in schools on several times. 849 01:21:09,000 --> 01:21:11,000 Thank you very much for those comments. 850 01:21:11,000 --> 01:21:18,000 A cohesive strategy could significantly improve public understanding of how the city is working to enhance safety and reduced speeding. 851 01:21:18,000 --> 01:21:20,000 So thanks for considering these points. 852 01:21:20,000 --> 01:21:21,000 Thank you. 853 01:21:21,000 --> 01:21:22,000 Thank you. 854 01:21:22,000 --> 01:21:33,000 Good afternoon, Vice Mayor Dana Talley and Council members. 855 01:21:33,000 --> 01:21:36,000 I'm care of her with an app economy bicycle coalition. 856 01:21:36,000 --> 01:21:42,000 And I want to first thank public work for the public works for these proposed speed limit reductions. 857 01:21:42,000 --> 01:21:49,000 And ask that you approve them lower speed limits are needed because on two speeds are the leading factor in injury collisions throughout. 858 01:21:49,000 --> 01:21:53,000 In the morning, according to NVTA's vision zero report. 859 01:21:53,000 --> 01:21:57,000 However, lowering speed limits is just one piece of the vision zero puzzle. 860 01:21:57,000 --> 01:22:01,000 It needs to be paired with traffic calming enforcement education and other strategies. 861 01:22:01,000 --> 01:22:07,000 The University of Berkeley safe trek center found that lowering a speed limit by five miles an hour. 862 01:22:07,000 --> 01:22:12,000 Actually lower speeds by only one to two miles an hour. 863 01:22:12,000 --> 01:22:18,000 The great news though is that the change had a stronger effect on the fast distributors who stand to do the most. 864 01:22:18,000 --> 01:22:34,000 So as a result, the impact of a five mile an hour speed limit reduction is that injuries dropped by eight to 15% and fatalities dropped by 10 to 30% for all road users. 865 01:22:34,000 --> 01:22:42,000 For bicyclists specifically, a drop from 35 miles an hour to 30 miles an hour, which is being proposed in many of these segments. 866 01:22:42,000 --> 01:22:48,000 It needs by 17 to 32% and fatalities by 21 to 45%. 867 01:22:48,000 --> 01:22:55,000 When speeds are actually fully reduced, not just speed limits, but speeds are fully reduced by five miles an hour. 868 01:22:55,000 --> 01:22:58,000 Pedestrian C incredible gains. 869 01:22:58,000 --> 01:23:04,000 Serious injuries dropped 56 to 88% and fatalities dropped 80% to 96%. 870 01:23:04,000 --> 01:23:12,000 So lowering speed limits along with implementing other strategies to fully reduce speeds to by five miles an hour. 871 01:23:12,000 --> 01:23:22,000 Sansa make a huge difference in our road safety and with nap is traffic calming program advances and enforcement and other efforts is absolutely on the right track. 872 01:23:22,000 --> 01:23:34,000 One segment we are hoping will be re-evaluated sooner rather than later is the triangle off freeway drive that includes the block of Laurel Avon and Kilburn. 873 01:23:34,000 --> 01:23:38,000 These blocks are dense with apartments and businesses. 874 01:23:38,000 --> 01:23:43,000 They see a lot of pedestrian activity and a high number of active transportation users. 875 01:23:43,000 --> 01:23:49,000 We would guess like downtown that a 20 mile speed limit would be most appropriate here. 876 01:23:49,000 --> 01:23:55,000 And so we request that the city reconsider this triangle once the road changes are done. 877 01:23:55,000 --> 01:24:01,000 No one's speeding their now because they would destroy their car if they spit on the street right now. 878 01:24:01,000 --> 01:24:03,000 It's the water main project. 879 01:24:03,000 --> 01:24:07,000 We were also a little curious about first street in the Oxford district. 880 01:24:07,000 --> 01:24:12,000 Keeping that at 25 was surprising as tests as well. 881 01:24:12,000 --> 01:24:23,000 Finally I just want to say that in the future those who are in collisions on these street segments and survive will not likely know what to think the city. 882 01:24:23,000 --> 01:24:28,000 Preventing prevention in the first place can go and notice. 883 01:24:28,000 --> 01:24:34,000 Please know that we see the city's leadership on behalf of our 2000 members and supporters. 884 01:24:34,000 --> 01:24:40,000 And we thank you for greatly increasing the likelihood that we will all return home to our loved ones in harm. 885 01:24:40,000 --> 01:24:42,000 Thank you. 886 01:24:42,000 --> 01:24:44,000 Thank you so much. 887 01:24:44,000 --> 01:24:46,000 Any additional public comment? 888 01:24:46,000 --> 01:24:47,000 All right. 889 01:24:47,000 --> 01:24:48,000 Seeing none. 890 01:24:48,000 --> 01:24:51,000 Is there a motion to close public testimony? 891 01:24:51,000 --> 01:24:52,000 So moved. 892 01:24:52,000 --> 01:24:54,000 Second motion. 893 01:24:54,000 --> 01:24:55,000 Second. 894 01:24:55,000 --> 01:24:56,000 Second. 895 01:24:56,000 --> 01:24:57,000 Second. 896 01:24:57,000 --> 01:24:58,000 Second. 897 01:24:58,000 --> 01:24:59,000 Second. 898 01:24:59,000 --> 01:25:00,000 Second. 899 01:25:00,000 --> 01:25:01,000 Second. 900 01:25:01,000 --> 01:25:02,000 Second. 901 01:25:02,000 --> 01:25:03,000 Second. 902 01:25:03,000 --> 01:25:04,000 Second. 903 01:25:04,000 --> 01:25:05,000 Second. 904 01:25:05,000 --> 01:25:06,000 Second. 905 01:25:06,000 --> 01:25:07,000 Second. 906 01:25:07,000 --> 01:25:08,000 Second. 907 01:25:08,000 --> 01:25:09,000 Second. 908 01:25:10,000 --> 01:25:12,000 I'm early in the presentation. 909 01:25:12,000 --> 01:25:18,000 I just want to clear something up that I thought was really interesting and the speed limit to background. 910 01:25:18,000 --> 01:25:33,000 When it says reasonable and prudent and I just have to ask, is there any ever reason that is reasonable and prudent to go above this speed limit as posted? 911 01:25:33,000 --> 01:25:34,000 Thanks for the question. 912 01:25:34,000 --> 01:25:36,000 It's a good one. 913 01:25:37,000 --> 01:25:49,000 The basis for the California vehicle code stems from code that was accepted in the 1930s when traffic engineering was a burgeoning new profession and cars themselves are relatively new. 914 01:25:49,000 --> 01:26:01,000 The thought at the time was that individuals by and large are reasonable and prudent and so the expectation was that the speed at which traffic flows will be safe and reasonable speed. 915 01:26:01,000 --> 01:26:11,000 And because it has not necessarily played out to be the case over time, that has spurred some of the rethinking of how we established speed limits. 916 01:26:11,000 --> 01:26:12,000 Okay. 917 01:26:12,000 --> 01:26:13,000 Thank you. 918 01:26:13,000 --> 01:26:18,000 And then the speed limit says advises drivers and maximum reasonable and safe driving speed. 919 01:26:18,000 --> 01:26:22,000 Is it an advice or is it the law to follow that speed limit? 920 01:26:22,000 --> 01:26:28,000 I just want to be clear on that because the warning here is a little different way expected. 921 01:26:28,000 --> 01:26:33,000 As per the vehicle code, it's not lawful to travel faster than the post speed limit. 922 01:26:33,000 --> 01:26:34,000 Okay. 923 01:26:34,000 --> 01:26:35,000 All right. 924 01:26:35,000 --> 01:26:36,000 Thank you. 925 01:26:36,000 --> 01:26:40,000 Just want to make sure clear by that. 926 01:26:40,000 --> 01:26:47,000 There was a question about the oxbow speed limit at 25 versus 20 to match the rest of downtown. 927 01:26:47,000 --> 01:26:49,000 Can we can submit address that please? 928 01:26:49,000 --> 01:26:50,000 Yes. 929 01:26:50,000 --> 01:26:57,000 In the last update where we did look at lowering the central business district to 20, we were looking at the core downtown area and did not extend it. 930 01:26:57,000 --> 01:27:00,000 The C-O-B-O-B-O-B-on. 931 01:27:00,000 --> 01:27:05,000 So at this E-N-T-F-D-A-R-We did a full E-N-T-Ware looking to lower it five typically. 932 01:27:05,000 --> 01:27:13,000 You want to lower and five mile increments to not cause that additional jar, but in the future looking at potential if there is. 933 01:27:13,000 --> 01:27:20,000 If there is an allowable area beyond the core downtown to lower to 20 that could be something we would maybe look at on the future. 934 01:27:20,000 --> 01:27:22,000 I would say please look at that. 935 01:27:22,000 --> 01:27:24,000 I mean, I've gone there in the weekends. 936 01:27:24,000 --> 01:27:26,000 There's an incredible amount of food traffic. 937 01:27:26,000 --> 01:27:34,000 A food traffic going crossing that street between copia and the markets and the garden out there. 938 01:27:34,000 --> 01:27:43,000 So because of the parking so complicated, people tend to park across the street and cross a lot and there's just so much traffic there. 939 01:27:43,000 --> 01:27:49,000 I appreciate the report and I support the reduction of the speed limits. 940 01:27:49,000 --> 01:27:53,000 It's quite a bit of a road, so I do agree that communication is key. 941 01:27:53,000 --> 01:28:00,000 But at the same time, what I've learned is throughout my years in council is very difficult to ask people to slow down. 942 01:28:00,000 --> 01:28:05,000 And it's actually very uncomfortable for people to slow down when they're used to driving us from a speed limit. 943 01:28:05,000 --> 01:28:08,000 I have to remind myself to slow down, right? 944 01:28:08,000 --> 01:28:11,000 And it's just something you actually have to do. 945 01:28:11,000 --> 01:28:18,000 And what I've seen is when I've traveled and driven in other communities beyond the speed limit, 946 01:28:18,000 --> 01:28:25,000 there's other things, there's objects, there's physical changes on a roadway that really forces you to slow down. 947 01:28:25,000 --> 01:28:32,000 For example, some communities have when you're going downhill, though have a speed bump at the stop sign. 948 01:28:32,000 --> 01:28:33,000 At the end of the stop sign. 949 01:28:33,000 --> 01:28:39,000 So if you accelerate, it's really difficult to accelerate very quickly because there's a speed limit. 950 01:28:39,000 --> 01:28:44,000 There's also other things that you can do to reduce traffic. 951 01:28:44,000 --> 01:28:49,000 So just to staff and public work that would say in addition to reducing the speed limit, 952 01:28:49,000 --> 01:29:00,000 I would really like to see some physical changes on the roadway to really look at areas where we can add. 953 01:29:00,000 --> 01:29:07,000 I'm not sure what the terminology is for the different kinds of objects, but there's another number of them. 954 01:29:07,000 --> 01:29:10,000 But there are areas where I think we can reasonably put them on there. 955 01:29:10,000 --> 01:29:15,000 I know floor traffic is very important for people to get to work for school drop off, 956 01:29:15,000 --> 01:29:20,000 but there are areas where I think we really need to help people slow down. 957 01:29:20,000 --> 01:29:28,000 Specifically, an intersection when people go beyond the stop sign and you're looking at trying to increase the vision. 958 01:29:28,000 --> 01:29:32,000 Try and go, but they're getting really close to that cross traffic. 959 01:29:32,000 --> 01:29:36,000 And I'll be talking about speeds, but speed and safety, it's all together. 960 01:29:36,000 --> 01:29:42,000 So as you look at this, let's also look at other areas where we can some physical objects to slow down traffic. 961 01:29:42,000 --> 01:29:45,000 Thank you. 962 01:29:45,000 --> 01:29:46,000 Councilmember Paine. 963 01:29:46,000 --> 01:29:48,000 Okay, thank you. 964 01:29:48,000 --> 01:29:50,000 Thank you for the presentation. 965 01:29:50,000 --> 01:29:56,000 I was actually really happy to see your summary of the state legislative changes. 966 01:29:56,000 --> 01:30:00,000 Those are really important tools because in past meetings we've talked about. 967 01:30:00,000 --> 01:30:21,000 I'm just really happy that we have those tools and you're beginning to use them as we look at all this, also really impressed that you're using NAPA as a model. You know, we often hear as council members, why don't we do things like other communities, but you're out there saying why don't you do things like NAPA? 968 01:30:21,000 --> 01:30:33,000 You know, we're working at it. It's not something that changes overnight, but it just is really heartwarming to hear that we are a model out there. 969 01:30:33,000 --> 01:30:41,000 I want to piggyback first on the comment from our speaker, more in-trip about the idea of the map and the visuals. 970 01:30:41,000 --> 01:31:02,000 That, to me, really fits in with our focus area of communication, so not that we do it today, but as you build these maps, whatever we can do to deliver that message of not just bead limits, but all the other things that she described, including, you know, what's been repaved, where new bike lanes, where we improve sidewalks. 971 01:31:02,000 --> 01:31:11,000 The flashing beacons are really, really popular, and maybe we kind of call it our vision zero progress map or something to that effect. 972 01:31:11,000 --> 01:31:29,000 We could also put other speed reducing, you know, engineering ideas on that map, but it gives us that way to sort of build on hey look what we've done over all these years, and it's very visual, so I like that. I really like that suggestion. 973 01:31:29,000 --> 01:31:52,000 I also would agree with Councilmember Narayas, looking at the oxbow again, I think particularly in light of what we can do under AB 43, and say this is an important commercial district business district with a lot of people, you know, it's something that I would not take off the list in terms of trying to slow traffic down. 974 01:31:52,000 --> 01:32:10,000 It is difficult. Listen, I live, as many of you know, out in Brown's Valley, so I've seen how drivers have responded to not just the change in speed limit, but also the change, the physical change in what's happened to the road, which really is intended to slow people down. 975 01:32:10,000 --> 01:32:26,000 It was really difficult at first, and if you drove the speed limit when it was reduced to 30 miles an hour, it was very common to have somebody right on your tail because, you know, you must be that old lady driving 30 miles an hour, which I probably am. 976 01:32:26,000 --> 01:32:43,000 But it's changed, and it's normalized, it's becoming more normalized, so I would say even though it's difficult, it's something that becomes the norm in a community, so I'm very much in favor of what you've done tonight. 977 01:32:43,000 --> 01:32:59,000 I want to support that. I want you to know that you know, you have that support and keep up the good work. It's science based, but it's also community based. So those are my comments. Thank you. 978 01:32:59,000 --> 01:33:06,000 Thank you so much for the report. I will agree with my colleagues that digging in deeper to Oxford. I think it's very important. 979 01:33:06,000 --> 01:33:17,000 Also that outreach changes very hard, so the more we can put it out there and the more we can tell people. I think that's important and also continuing to focus on other traffic calming measures that add to it. 980 01:33:17,000 --> 01:33:30,000 Lastly, I would like to encourage this body to look at lowering the school speed limits earlier than 2031. I think that would make a big difference in our neighborhood. 981 01:33:30,000 --> 01:33:55,000 Back to Councilmember Narveyes for what we're talking about. I forgot to ask about big ranch road, because I know part of that. I just don't know that the length of how much it's part of seeing that but I know that was pretty we get love speeding complaints there and I believe it's one of the higher speed limits in the city. Have you looked at that yet. 982 01:33:55,000 --> 01:34:00,000 I want to clarify a question. Did you want to know which section was the cities or when it was. 983 01:34:00,000 --> 01:34:05,000 Well, I believe part of it's the city. So correct. Okay. And then I do. 984 01:34:05,000 --> 01:34:13,000 In that might be a partnership with the county, but if we looked at that road on where we on it and if we've looked at lowering the speed limit there. 985 01:34:13,000 --> 01:34:18,000 I'll have to double check when it's coming up on the list, but it's happy to get back to you on that. 986 01:34:18,000 --> 01:34:21,000 Thank you very much and thank you for the work. 987 01:34:21,000 --> 01:34:27,000 All right. Well, thank you with that. I will look for a motion. 988 01:34:27,000 --> 01:34:35,000 I'll go ahead and move the staff recommendations. That includes two items approving the first reading and introduction of the ordinance. 989 01:34:35,000 --> 01:34:53,000 I'm sending the municipal code 102040 related to the establishment and enforcement of speed limits and secondly adopting a resolution determining that it declared speed limit is justified based on an engineering and traffic survey for the identified city streets and roadway segments. 990 01:34:53,000 --> 01:34:58,000 And determining that the actions authorized by this resolution are exempt from sequela second. 991 01:34:58,000 --> 01:35:06,000 The resolution from painter second from Leros all in favor. Hi. Any opposed passes unanimously. Thank you. 992 01:35:06,000 --> 01:35:11,000 All right. Moving forward to update of citywide user fees. 993 01:35:11,000 --> 01:35:21,000 First we'll hear report from city staff, which may include responses to clarifying questions from member of council next members of council will be asked to disclose any information learned outside of the hearing. 994 01:35:21,000 --> 01:35:30,000 Then members of the public will be provided an opportunity to do percent testimony regarding the hearing. Finally, we will close the public testimony. We will now hear a report from staff. 995 01:35:30,000 --> 01:35:59,000 All right. Good afternoon, vice mayor. Council members. My name is Frank Arreda. I'm the county supervisor on the revenue division. And I'm joined by Don Lee or finance director. 996 01:35:59,000 --> 01:36:01,000 Okay. So. 997 01:36:01,000 --> 01:36:11,000 I'm actually going to be discussing the update of the citywide user fees. So as you may recall, council adopted and amended master fee schedule in February. 998 01:36:11,000 --> 01:36:20,000 With an effective date tied to the required 60 day noticing period under state law or the implementation of the city's new permitting system, whichever occurred later. 999 01:36:20,000 --> 01:36:26,000 Since the 60 day period has now passed staff is recommending removing the connection to the permitting system. 1000 01:36:26,000 --> 01:36:33,000 Implementation and establishing July 1st, 2026 as the effective date for the previously adopted fees. 1001 01:36:33,000 --> 01:36:43,000 Any additional fee revisions considered tonight would become effective August 1st, 2026 consistent with the minimum 60 day noticing requirement under state law. 1002 01:36:43,000 --> 01:36:50,000 Before moving further into the presentation, I also want to clarify that tonight's discussion is focused solely on user fees. 1003 01:36:50,000 --> 01:37:03,000 User fees support on going services provide directly at customers while development impact fees are intended to ensure that new growth contributes towards the cost of infrastructure needed to accommodate future demand. 1004 01:37:03,000 --> 01:37:12,000 Development impact fees are reviewed and adopted through a separate legal and policy process. 1005 01:37:12,000 --> 01:37:24,000 So at the February meeting, council also directed staff to conduct a more comprehensive review of several fee categories to ensure they align with the council's focus areas and broader policy priorities. 1006 01:37:24,000 --> 01:37:36,000 Staff evaluated the purpose structure and cost recovery basis of the identified fees and assess whether adjustments were warranted to better support the city's strategic objectives. 1007 01:37:36,000 --> 01:37:48,000 Overall, the review confirmed that many of the evaluated fees are appropriately structured consistent with current policy direction and do not create barriers to advancing the council's identified priorities. 1008 01:37:48,000 --> 01:37:59,000 Staff found that fees are generally comparable to those charged by similar agencies and reflect reasonable cost recovery practices for the services provided. 1009 01:37:59,000 --> 01:38:07,000 As a reminder, the city may only recover the actual cost of providing a service and cannot overcharge one fee to subsidize another. 1010 01:38:07,000 --> 01:38:14,000 In many cases, user fees do not fully recover costs and the city already subsidizes certain services. 1011 01:38:14,000 --> 01:38:26,000 Based on the review, staff is recommending targeted adjustments to a limited number of fees to improve clarity, better align with neighboring agencies and further support the city's policy objectives. 1012 01:38:26,000 --> 01:38:38,000 With that overview in mind, the next few slides highlight the specific fee adjustments staff is recommending and the rationale behind those recommendations. 1013 01:38:38,000 --> 01:38:46,000 So first one here, back in February, council adopted a new EV charging fee of 35 cents per kilowatt hour. 1014 01:38:46,000 --> 01:39:01,000 That rate was intended to achieve near full cost recovery by covering electricity, maintenance, and vendor-related costs with only a minimal city subsidy of approximately one cent per kilowatt hour. 1015 01:39:01,000 --> 01:39:07,000 The following additional review, staff is not recommending reducing the rate to 25 cents per kilowatt hour. 1016 01:39:07,000 --> 01:39:13,000 This proposed rate aligns with the rate currently charged by the NAPAVALY transportation authority. 1017 01:39:13,000 --> 01:39:23,000 At its 46 public charging ports, helping provide greater consistency for residents using public charging infrastructure throughout the area. 1018 01:39:23,000 --> 01:39:29,000 Now, at the 25% rate, the city would no longer fully recover all service-related costs. 1019 01:39:29,000 --> 01:39:36,000 While the fee would continue to largely offset electricity costs, the city would absorb maintenance and vendor expenses. 1020 01:39:36,000 --> 01:39:47,000 Staff believes this is an appropriate policy choice that supports the council's broader sustainability and community access priorities. 1021 01:39:47,000 --> 01:39:54,000 The next item relates to appeal fees for the planning commission and cultural heritage commission. 1022 01:39:54,000 --> 01:40:04,000 As part of the February fee schedule adoption, those appeal fees were established at full cost recovery in the amount of $4,558. 1023 01:40:04,000 --> 01:40:15,000 After further review, staff is recommending reducing the fee to $911, which would align it with the existing council appeal fee already included in the fee schedule. 1024 01:40:15,000 --> 01:40:25,000 While this represents a significant reduction from the previously adopted amount, it creates consistency in the cost of filing an appeal regardless of the hearing body involved. 1025 01:40:25,000 --> 01:40:37,000 Under the proposed approach, the fee would then continue to increase annually in the same manner as other appeal-related fees within the schedule. 1026 01:40:37,000 --> 01:40:43,000 For card room dealer permits, the recommended change is administrative in nature. 1027 01:40:43,000 --> 01:40:48,000 We are proposing to move the renewals cycle from every six months to an annual renewal. 1028 01:40:48,000 --> 01:41:03,000 This adjustment aligns the city with how neighboring jurisdictions administer similar, administer similar permits and reduce administrative workload for both staff and permit holders without changing the overall regulatory intent. 1029 01:41:04,000 --> 01:41:17,000 For dealer response costs recovery, staff is recommending adding clarifying language to the fee schedule to reflect the recoverable costs for these incidents may not exceed $12,000 per occurrence. 1030 01:41:17,000 --> 01:41:21,000 This consistent with government code section 53555. 1031 01:41:21,000 --> 01:41:32,000 This cap has always governed the program. The update simply insurance the limitations clearly stated in the fee schedule for transparency and consistency. 1032 01:41:33,000 --> 01:41:37,000 So tonight, we ask the adoptor resolution. 1033 01:41:37,000 --> 01:41:49,000 Mending resolution are at 2026-014, which is adopting the city's master fee schedule to revise select fees and charges and to clarify updated effective dates for implementation. 1034 01:41:49,000 --> 01:41:54,000 And with that, we conclude the presentation and we've opened for questions. 1035 01:41:54,000 --> 01:41:59,000 Thank you for the presentation. Any clarifying questions from the council? 1036 01:42:00,000 --> 01:42:03,000 Right. Seeing none, we will go to disclosures. 1037 01:42:03,000 --> 01:42:08,000 If a council member has received an information prior to the Syrian that is important to the decision making process for this hearing. 1038 01:42:08,000 --> 01:42:13,000 And if the information is not included in the written materials for this item, please disclose the information at this time. 1039 01:42:13,000 --> 01:42:18,000 So participants in the Syrian have an opportunity to consider that information. 1040 01:42:18,000 --> 01:42:21,000 No disclosures. 1041 01:42:21,000 --> 01:42:22,000 No disclosures. 1042 01:42:22,000 --> 01:42:24,000 No disclosures. 1043 01:42:24,000 --> 01:42:28,000 That I will open public testimony any speaker cards for this item. 1044 01:42:28,000 --> 01:42:32,000 I have done anybody in the audience would like to speak. 1045 01:42:32,000 --> 01:42:33,000 All right. 1046 01:42:33,000 --> 01:42:37,000 Seeing none, I will look for a motion to close public testimony. 1047 01:42:37,000 --> 01:42:39,000 So moved. 1048 01:42:39,000 --> 01:42:42,000 Motion from Leros, second from Narveyes. 1049 01:42:42,000 --> 01:42:43,000 All in favor? 1050 01:42:43,000 --> 01:42:44,000 Aye. 1051 01:42:44,000 --> 01:42:45,000 Any post? 1052 01:42:45,000 --> 01:42:46,000 All right. 1053 01:42:46,000 --> 01:42:48,000 We'll bring it back to council for deliberation. 1054 01:42:48,000 --> 01:42:51,000 We'll start with council member Leros. 1055 01:42:51,000 --> 01:42:53,000 Thank you for the presentation and the updates. 1056 01:42:53,000 --> 01:42:55,000 Appreciate you guys bringing it back to us. 1057 01:42:55,000 --> 01:42:59,000 I appreciate that we were able to come down on the EV charging fee. 1058 01:42:59,000 --> 01:43:01,000 Although now it seems silly with the price of gas. 1059 01:43:01,000 --> 01:43:04,000 It's just so not comparable. 1060 01:43:04,000 --> 01:43:07,000 Hopefully that will help move people over to electric cars. 1061 01:43:07,000 --> 01:43:08,000 And just wanted to add. 1062 01:43:08,000 --> 01:43:12,000 I also appreciate that we were able to move the appeal fees down quite a bit. 1063 01:43:12,000 --> 01:43:15,000 Thank you. 1064 01:43:15,000 --> 01:43:16,000 Council member. 1065 01:43:16,000 --> 01:43:17,000 Patre. 1066 01:43:17,000 --> 01:43:18,000 Yeah. 1067 01:43:18,000 --> 01:43:23,000 I am also really happy to see the EV charging fees. 1068 01:43:23,000 --> 01:43:33,000 I want to just dig in a little bit as to, you know, our thought process. 1069 01:43:33,000 --> 01:43:38,000 And moving to full recourse recovery back in February on the appeal fees. 1070 01:43:38,000 --> 01:43:40,000 And now dropping back. 1071 01:43:40,000 --> 01:43:47,000 I don't think we have what I would call, you know, sort of an abuse of the appeal process. 1072 01:43:47,000 --> 01:43:50,000 But it has happened in other locations. 1073 01:43:50,000 --> 01:43:53,000 And so. 1074 01:43:53,000 --> 01:44:00,000 I just want to maybe maybe you can explain, you know, what I thought process wasn't February and moving to a full recovery cost. 1075 01:44:00,000 --> 01:44:08,000 And now backing and now moving back. 1076 01:44:08,000 --> 01:44:09,000 Sorry. 1077 01:44:09,000 --> 01:44:11,000 Donna Lee finance director. 1078 01:44:11,000 --> 01:44:18,000 Back in February, I actually think it was probably it was likely an oversight that it was put on there at full cost recovery. 1079 01:44:18,000 --> 01:44:22,000 I don't think the intent was ever to achieve full cost recovery. 1080 01:44:22,000 --> 01:44:30,000 And then when it was noticed, we moved it back to be in alignment with the other appeal for to the commission. 1081 01:44:30,000 --> 01:44:32,000 And so that they're aligned. 1082 01:44:32,000 --> 01:44:33,000 Okay. 1083 01:44:33,000 --> 01:44:34,000 Okay. 1084 01:44:34,000 --> 01:44:35,000 Yeah. 1085 01:44:35,000 --> 01:44:45,000 I'm okay with it at this time, but I'm just sensitive to it because I have seen in some other places where the appeal process can get. 1086 01:44:45,000 --> 01:44:55,000 Some of it overused in ways that, you know, we may want to rethink this at some point, but we always have that option. 1087 01:44:55,000 --> 01:44:56,000 All right. 1088 01:44:56,000 --> 01:44:58,000 Well, thank you so much for doing a deep dive. 1089 01:44:58,000 --> 01:45:01,000 I appreciate what you came back to with it. 1090 01:45:00,000 --> 01:45:08,000 I think it really addressed our questions last time. So thank you for that. And with that, I will look for a motion. 1091 01:45:08,000 --> 01:45:12,000 I move staff, I'm a recommended action on this item. 1092 01:45:12,000 --> 01:45:16,000 On motion from Leros, second from Narvaya, it's all in favor. 1093 01:45:16,000 --> 01:45:22,000 Any opposed? Passage unanimously. Thank you. 1094 01:45:22,000 --> 01:45:28,000 Moving on, we now are at comments by council or city manager. I'll start with the city manager. 1095 01:45:28,000 --> 01:45:32,000 Any comments from council? 1096 01:45:32,000 --> 01:45:38,000 All right. Seeing none, we will then move to a close session. We are now at agenda item 10, close session. 1097 01:45:38,000 --> 01:45:42,000 I asked the city attorney to provide the required announcements for closed session. 1098 01:45:42,000 --> 01:45:46,000 Thank you, Vice Mayor De Natali. So council will convene a close session and consider one item. 1099 01:45:46,000 --> 01:45:53,000 Conference with Labor Negotiators, pursuant to government code section 5495726, with city designated representatives in the room. 1100 01:45:53,000 --> 01:45:57,000 Steve Potter, Liz Hapkirk, MJ Turos, Donna Lee, Zach Kern and Jesse Ladd. 1101 01:45:57,000 --> 01:46:04,000 And finally, the Employee Organizations for Discussion or the NAPACITY Employees Association and the NAPACITY Firefighters Association. 1102 01:46:04,000 --> 01:46:05,000 Thank you. 1103 01:46:05,000 --> 01:46:07,000 Thank you. We will now recess to close session. 1104 01:46:07,000 --> 01:46:10,000 We'll return for evening public session at 630 p.m. 1105 01:46:23,000 --> 01:46:25,000 Thank you. 1106 01:46:53,000 --> 01:46:55,000 Thank you. 1107 01:47:23,000 --> 01:47:49,000 Thank you. 1108 01:47:49,000 --> 01:47:50,000 Thank you. 1109 01:47:50,000 --> 01:47:51,000 Thank you. 1110 01:48:20,000 --> 01:48:34,000 For items 158 and 15, I'm sorry, for items 14A and 15A PowerPoint presentations from staff. 1111 01:48:34,000 --> 01:48:35,000 Thank you. 1112 01:48:35,000 --> 01:48:39,000 I'll now move to public comment on non agenda items. 1113 01:48:39,000 --> 01:48:46,000 During the public comment portion of the meeting, the public is invited to address the council on any item within the subject matter jurisdiction of the council. 1114 01:48:46,000 --> 01:48:52,000 Please focus your comments on either past actions taken by the council or proposed future actions to be taken by the council. 1115 01:48:52,000 --> 01:49:00,000 However, the subject of the public comment is not on the agenda state law strictly limits the council's ability to respond at this meeting. 1116 01:49:00,000 --> 01:49:03,000 Have we received any speaker cards? 1117 01:49:03,000 --> 01:49:19,000 I have Vice Mayor Azander and Aldo Solano. 1118 01:49:19,000 --> 01:49:26,000 I'm here pushing for a sanctuary city ordinance as we've come before. 1119 01:49:26,000 --> 01:49:35,000 With each week the passes, we reminded that immigration enforcement entities continue to terrorize NAPA and surrounding communities. 1120 01:49:35,000 --> 01:49:38,000 The people we spoke to are most recent bodywalk. 1121 01:49:38,000 --> 01:49:42,000 Don't want to hear that it's only criminals are being detained. 1122 01:49:42,000 --> 01:49:47,000 They just hear of their neighbors being literally chased through the garden apartments and West Napa. 1123 01:49:47,000 --> 01:49:51,000 Or I see using city parking garages to stage their terror. 1124 01:49:51,000 --> 01:49:59,000 They're hearing a surveillance cameras flock that stores everyone's data. 1125 01:49:59,000 --> 01:50:06,000 And with no civilian oversight or audit, there's no trust the way of knowing where that data is going. 1126 01:50:06,000 --> 01:50:09,000 The state state security city ordinance is symbolic. 1127 01:50:09,000 --> 01:50:13,000 Well, symbolism is strong and sends a message. 1128 01:50:13,000 --> 01:50:17,000 But clearly there are real material actions we can take here. 1129 01:50:17,000 --> 01:50:21,000 No use of city property by immigration enforcement. 1130 01:50:21,000 --> 01:50:24,000 Council of the flood contracts. 1131 01:50:24,000 --> 01:50:32,000 With that very leechly civilian oversight of the flood contract, the systems that they restored. 1132 01:50:33,000 --> 01:50:35,000 And local operation at all. 1133 01:50:35,000 --> 01:50:36,000 Thank you. 1134 01:50:36,000 --> 01:50:38,000 Thank you so much. 1135 01:50:50,000 --> 01:50:51,000 Hello council members. 1136 01:50:51,000 --> 01:50:52,000 City clerk. 1137 01:50:52,000 --> 01:50:53,000 Thank you for hearing us today. 1138 01:50:53,000 --> 01:50:54,000 My name is Zander. 1139 01:50:54,000 --> 01:50:56,000 I'm a resident of district three. 1140 01:50:56,000 --> 01:50:59,000 A member of North Bay Community Service Organizing. 1141 01:50:59,000 --> 01:51:03,000 CSO and a legal observer with the North Bay Rapid Response Network. 1142 01:51:03,000 --> 01:51:10,000 I want to ask you to pass real sanctuary city ordinance, banning the use of city property for immigration 1143 01:51:10,000 --> 01:51:17,000 enforcement, prohibiting the cooperation between local law enforcement and ice and ending the handovers at the jail 1144 01:51:17,000 --> 01:51:21,000 for people who have only been charged but not convicted of a crime. 1145 01:51:21,000 --> 01:51:23,000 Now I want to talk about flock. 1146 01:51:23,000 --> 01:51:26,000 The other day I was running an errand in the neighborhood. 1147 01:51:26,000 --> 01:51:31,000 I'm very familiar with and noticed a new flock camera had been installed. 1148 01:51:31,000 --> 01:51:32,000 I was surprised. 1149 01:51:32,000 --> 01:51:40,000 And so I tried to access the Napa flock transparency portal to see if the city revealed how many new cameras were in place. 1150 01:51:40,000 --> 01:51:44,000 Or if this was just the old camera that had been moved. 1151 01:51:44,000 --> 01:51:51,000 Only to find though that they had the transparency portal had been completely taken down without a trace. 1152 01:51:51,000 --> 01:51:54,000 It was active just a few weeks ago and now it's gone. 1153 01:51:54,000 --> 01:52:03,000 I find it concerning that at a time when a civilian grand jury says that Napa needs to be more communicative and more transparent. 1154 01:52:03,000 --> 01:52:09,000 This simple feature has been removed, hiding from the public how many cameras we are paying for. 1155 01:52:09,000 --> 01:52:15,000 So I'd like to ask that the transparency portal be re-reactivated at the bare minimum. 1156 01:52:15,000 --> 01:52:19,000 I also want to ask to cancel the contract with flock. 1157 01:52:19,000 --> 01:52:23,000 This kind of drag net surveillance does more harm than good. 1158 01:52:23,000 --> 01:52:29,000 Recording everyone that crosses the path of their cameras not just people who break the law like running a red light. 1159 01:52:29,000 --> 01:52:38,000 Multiple cities in the Bay Area have canceled their flock contracts after third party audits revealed that they had illegally been sharing their data with ice. 1160 01:52:38,000 --> 01:52:47,000 That's why I want Napa to allow a third party public audits so we can see who is being recorded and who we are sharing our data with. 1161 01:52:47,000 --> 01:52:53,000 When the transparency portal was up, it showed that we were sharing data with cities that shared their data with ice. 1162 01:52:53,000 --> 01:52:57,000 And I am very concerned that our cameras are part of that security breach. 1163 01:52:57,000 --> 01:53:10,000 For any of you or anyone in the audience who wants to know more about how these cameras work, where they are and how weak their security is, how easy they are to be accessed by bad actors. 1164 01:53:10,000 --> 01:53:12,000 Please visit deflock.org. 1165 01:53:12,000 --> 01:53:14,000 Thank you very much. 1166 01:53:14,000 --> 01:53:15,000 Thank you. 1167 01:53:16,000 --> 01:53:18,000 Any additional speaker cards? 1168 01:53:18,000 --> 01:53:21,000 Any additional speakers in the audience? 1169 01:53:21,000 --> 01:53:22,000 All right. Thank you. 1170 01:53:22,000 --> 01:53:26,000 I will close public comment and move to administrative reports 14A. 1171 01:53:30,000 --> 01:53:32,000 We will now hear a report from staff. 1172 01:53:35,000 --> 01:53:37,000 Good evening mayor and council. 1173 01:53:37,000 --> 01:53:43,000 I'm Donna Lee, the finance director and tonight I'll be providing a brief overview of the city's retiree benefit obligations. 1174 01:53:43,000 --> 01:53:46,000 With a focus on CalPERS and OPEB and funded liabilities. 1175 01:53:46,000 --> 01:53:54,000 As you may recall, council previously directed staff to evaluate options to accelerate funding of these liabilities to reduce long-term costs. 1176 01:53:54,000 --> 01:53:58,000 And tonight we're here to walk you through those options. 1177 01:54:01,000 --> 01:54:06,000 So I'll start with a quick refresher on a few key terms. 1178 01:54:06,000 --> 01:54:12,000 CalPERS is the city's defined benefit retirement plan and other post employment benefits are OPEB. 1179 01:54:12,000 --> 01:54:15,000 Refers to our retiree health plan. 1180 01:54:15,000 --> 01:54:21,000 Tonight we'll be discussing the unfended actuarial liabilities or UAL for both of these plans. 1181 01:54:21,000 --> 01:54:30,000 The UAL represents the gap between the value of benefits already earned by employees and retirees and the assets currently set aside to pay for those benefits. 1182 01:54:30,000 --> 01:54:39,000 In addition to the UAL, our annual contributions also include the normal cost, which is the cost of benefits employees earn each year while they're actively working. 1183 01:54:39,000 --> 01:54:45,000 However, tonight's discussion is focused specifically on the unfended liability. 1184 01:54:45,000 --> 01:54:54,000 Historically, both CalPERS and OPEB have not been fully funded, which is why these unfended liabilities exist. 1185 01:54:54,000 --> 01:55:03,000 However, due to council's continued focus on fiscal sustainability, the city's OPEB is now fully funded. 1186 01:55:03,000 --> 01:55:14,000 So looking ahead, contributions will be limited to the minimum needed to maintain that fully funded status also known as the actuariali-determined contribution or ADC. 1187 01:55:14,000 --> 01:55:24,000 As a result, we can reduce our annual general fund contributions by approximately $650,000 beginning next fiscal year. 1188 01:55:24,000 --> 01:55:34,000 And those savings are already incorporated into this mid-cycle budget update to help balance next year's budget, as you'll hear more from Seth in a little bit. 1189 01:55:34,000 --> 01:55:49,000 As we develop the next biennial budget, staff recommends gradually redirecting those savings to our section 115 trust to support long-term pension cost stability, and I'll have more on that in just a moment. 1190 01:55:50,000 --> 01:55:59,000 So while the city has made strong progress on OPEB, pension obligations through CalPERS remain a significant long-term financial challenge. 1191 01:55:59,000 --> 01:56:09,000 The city is currently just under 70% funded for both the miscellaneous and safety plans, which is somewhat below the broader CalPERS average. 1192 01:56:09,000 --> 01:56:22,000 The city's combined UAL is approximately $215 million with this year's required UAL payment totaling nearly $20 million. 1193 01:56:22,000 --> 01:56:27,000 As I previously mentioned, the city does have a section 115 trust. 1194 01:56:27,000 --> 01:56:34,000 These funds are set aside to help manage future pension cost increases and reduce volatility and CalPERS contribution rates. 1195 01:56:34,000 --> 01:56:42,000 The trust currently totals approximately $13.5 million, including the mid-year contribution of $3.5 million. 1196 01:56:42,000 --> 01:56:51,000 This trust serves as an important tool to help the city manage long-term pension obligations and maintain greater budget stability. 1197 01:56:51,000 --> 01:57:02,000 At Council's direction, staff evaluated a range of potential approaches to accelerate funding the city's pension liabilities, and these are the primary options available. 1198 01:57:02,000 --> 01:57:10,000 The city has the option to make additional contributions either to the section 115 trust as we did at mid-year or directly two CalPERS. 1199 01:57:10,000 --> 01:57:24,000 These contributions can be built into the annual budget as ongoing funding or made on a one-time basis using your and budget residual or other unanticipated savings. 1200 01:57:24,000 --> 01:57:36,000 Currently, the projected payoff of the UAL is 2042, paying the UAL down sooner reduces long-term interest costs in ongoing budget pressure. 1201 01:57:36,000 --> 01:57:47,000 To illustrate this, we modeled three contributions scenarios, an additional $2 million per year contribution for 12 years, which shortened the payoff by two years, 1202 01:57:47,000 --> 01:57:59,000 and generate approximately $27 million in savings, and additional $6 million a year for 10 years would shorten the payoff by five years, and generate approximately $42 million in savings, 1203 01:57:59,000 --> 01:58:09,000 and an additional $10 million per year for eight years would shorten the payoff by eight years and generate approximately $55 million in savings. 1204 01:58:09,000 --> 01:58:20,000 As these scenarios show meaningfully accelerating the payoff of the city's $215 million UAL would require substantial additional annual contributions. 1205 01:58:20,000 --> 01:58:31,000 While those accelerated contributions would generate long-term savings, they would also require the city to dedicate significant ongoing resources that could otherwise support operations, 1206 01:58:31,000 --> 01:58:39,000 capital needs service levels, or provide flexibility during periods of economic uncertainty. 1207 01:58:39,000 --> 01:58:51,000 Although fully accelerating the payoff may not be financially feasible in the near term, continuing to build a section 115 trust allows the city to proactively set aside funds, 1208 01:58:51,000 --> 01:59:00,000 improve long-term cost management and help offset future rate volatility. This approach provides a more measured and sustainable path forward. 1209 01:59:00,000 --> 01:59:15,000 Based on this, staff recommends continuing to build the section 115 trust using one-time funds when available, such as budget residual or savings like the OPEB reductions that I discussed earlier, to help manage future pension cost increases. 1210 01:59:15,000 --> 01:59:25,000 As opportunities arise, staff would return to Council with recommendations for additional contributions consistent with the approach taken in prior years. 1211 01:59:25,000 --> 01:59:30,000 That concludes my presentation, and I'm happy to answer any questions. 1212 01:59:30,000 --> 01:59:33,000 Thank you for the presentation. I will open up public comment. 1213 01:59:33,000 --> 01:59:35,000 City Clerk, do we have any speaker cards on your side? 1214 01:59:35,000 --> 01:59:36,000 We do not. 1215 01:59:36,000 --> 01:59:39,000 Do we have anybody in the audience who would like to speak? 1216 01:59:39,000 --> 01:59:42,000 Seeing none, I will close it and bring it back to Council. 1217 01:59:42,000 --> 01:59:46,000 For discussion, we have no action on this, but discussion questions. 1218 01:59:46,000 --> 01:59:48,000 Council Member Leros. 1219 01:59:48,000 --> 01:59:53,000 Thank you for the presentation. I think what we're doing now is fine. 1220 01:59:53,000 --> 01:59:58,000 That is adding contributions when we can, using the one-time funding sources. 1221 01:59:58,000 --> 02:00:01,000 I think that the total liability amount is... 1222 02:00:00,000 --> 02:00:08,000 Maybe not the biggest issue. I think the real danger is what if we have a recession? What if payroll grows significantly? What if the cost of public safety goes up? 1223 02:00:08,000 --> 02:00:28,000 There are all these other factors that play into it. I think at some point you're right, we're going to need a more solid plan. Be it a budgeted amount or, you know, some percentage of the surplus if we have one. I think some other cities do that. The 115 trust has been a good decision. We just haven't been able to grow it as much as we need to. 1224 02:00:28,000 --> 02:00:35,000 I appreciate it seeing kind of the breakdown of what it could look like. I don't think it's $10 million a year because we need to do other things. 1225 02:00:35,000 --> 02:00:41,000 But it's helpful to see, you know, even making a little payment how much more that can help. 1226 02:00:41,000 --> 02:00:43,000 So thank you for the presentation. 1227 02:00:43,000 --> 02:00:59,000 All right. No comments. So thank you very much for the presentation. I really appreciate you bringing this back to us. 1228 02:00:59,000 --> 02:01:08,000 Now, we'll move on to 15A public hearings. First, we will hear a report from city staff, which may include responses to clarifying questions from members of council. 1229 02:01:08,000 --> 02:01:13,000 Next, members of council will ask to disclose any information learned outside of the hearing. 1230 02:01:13,000 --> 02:01:20,000 Then members of the public will be provided an opportunity to present testimony regarding the hearing. Finally, we will close the public testimony. 1231 02:01:20,000 --> 02:01:23,000 We will now hear a report from staff. 1232 02:01:24,000 --> 02:01:30,000 Okay. Good evening. Vice Mayor Dina Tele and council members. I'm Seth Anderson, the city's budget officer. 1233 02:01:30,000 --> 02:01:41,000 I'm pleased to present to you today the city of Napa's FY2627 mid cycle budget adopted on June 17th, 2025. 1234 02:01:42,000 --> 02:02:01,000 Though under a year ago, the biennial budget established our foundation, the purpose of the mid cycle budget is to provide an update to council regarding revenue and expenditure trends and to propose appropriate revisions to the fiscal year 2627 budget prior to the start of the second year of our two year cycle. 1235 02:02:01,000 --> 02:02:09,000 We look forward to the feedback you'll provide today in the direction as we prepare to adopt on June 2nd, 2026. 1236 02:02:11,000 --> 02:02:17,000 The agenda for today covers proposed adjustments for fiscal year 2627. 1237 02:02:17,000 --> 02:02:30,000 We will begin with the general fund which does include measure G and then we'll look at the non-recurring general fund, other funds, CIP changes proposed staffing plan adjustments and end with our recommended action. 1238 02:02:30,000 --> 02:02:37,000 All of today's topics are within the proposed mid cycle budget report that's attached to the council item today. 1239 02:02:37,000 --> 02:02:43,000 That's where you'll find all the proposed adjustments in greater detail. 1240 02:02:43,000 --> 02:02:55,000 First we'll look at the general fund with measure G transaction and use tax included as a reminder of the general fund accounts for the general revenue we receive that is not related to special purpose funds. 1241 02:02:55,000 --> 02:03:04,000 It also accounts for general service expenditures for the city, including city administration, public safety and operating departments. 1242 02:03:04,000 --> 02:03:12,000 The general fund is equivalent to 41% of all city expenditures. 1243 02:03:12,000 --> 02:03:28,000 So first we begin with the current fiscal year and projecting that out, the fiscal year 2526 adjusted budget shows general fund revenues at 165.91 million and expenditures at 182.77 million. 1244 02:03:28,000 --> 02:03:46,000 11.86 million of the previous years on assigned available fund balance will be brought in to balance the budget and additional 5 million in measure G fund balance was also brought forward to cover its commitments to measure G capital project contributions. 1245 02:03:46,000 --> 02:04:08,000 And then due to the adjustments from the mid year so adjusting the current year revenues are projected to come in right on target expenditure projections provided by departments project a $400,000 budget residual and that does include all reserve contributions required by fiscal policy. 1246 02:04:08,000 --> 02:04:29,000 So zeroing in on measure G specifically within the general fund revenues are projected to come in at 22.57 million with expenditures at 27.25 million which again includes caring forward that $5 million for the commitments to capital projects. 1247 02:04:30,000 --> 02:04:54,000 Now we look ahead the fiscal year 2627 budget as originally adopted estimated general fund revenues of 168.43 million and expenditures of 168.21 million for resulting in a balanced general fund budget this also included funding our reserves per fiscal policy. 1248 02:04:54,000 --> 02:05:10,000 Within the adopted budget the general fund budget for 2627 is 23.05 million and measure G revenue with 23.13 million and planned expenditures. 1249 02:05:10,000 --> 02:05:29,000 Next we will review the proposed adjustments to the fiscal year 2627 adopted general fund budget including measure G these revisions reflect updated revenue trends in evolving operating needs that have emerged since budget adoption. 1250 02:05:29,000 --> 02:05:48,000 General fund and measure G revenue adjustments are recommended based on the current year's projections economic indicators in historical growth rates and in collaboration with city staff and professionals overall proposed adjustments would increase city revenue by $1.1 million. 1251 02:05:48,000 --> 02:06:03,000 We'll start with property tax which is relatively in line with our adopted budget just some updated projections from our consultants yields a $330,000 increase. 1252 02:06:03,000 --> 02:06:22,000 For a normal 1% Bradley burn sales tax revised projections provided to us from our consultants are projecting a lower growth rate in 2627 then originally provided prior to budget adoption this results in a $1.01 million recommended reduction. 1253 02:06:22,000 --> 02:06:33,000 The current fiscal year was adjusted down by $640,000 during mid years so this adjustment reflects two years of lower growth. 1254 02:06:34,000 --> 02:06:43,000 Measure G sales tax or transaction and use tax however is projected to receive $1.44 million more than originally projected. 1255 02:06:44,000 --> 02:06:58,000 This adjustment also reflects how measure G is bringing in more revenue than our normal 1% sales tax which was initially predicted to be equivalent to about 95% of our base sales tax. 1256 02:06:59,000 --> 02:07:08,000 Transy at occupancy tax or TOT for 27 it was originally projected to have minimal growth in the adopted buying old budget. 1257 02:07:09,000 --> 02:07:30,000 The projections at that time were based on gross receipts received through April of 2025 which indicated that FY25 would remain flat to the previous fiscal year FY24 however a strong fourth quarter in fiscal year 25 yielded actual $1.5 million higher than the projected budget. 1258 02:07:30,000 --> 02:07:40,000 Our current year's projection was adjusted at mid year by $1.8 million which equated to 2% growth over fiscal year 25 actual receipts. 1259 02:07:41,000 --> 02:07:49,000 Our current analysis of fiscal year 26 so the current fiscal year is still very much in line with those projections. 1260 02:07:50,000 --> 02:07:57,000 This puts FY27's adopted projection behind fiscal year 25 and 26 actuals. 1261 02:07:58,000 --> 02:08:09,000 So though this number appears large $1.15 million it really equates to 1% growth over the current fiscal year's projection or $315,000. 1262 02:08:12,000 --> 02:08:18,000 We have a significant reduction of $1.16 million to business license tax. 1263 02:08:19,000 --> 02:08:34,000 This mostly accounts for reversing two years of projected growth when we adopted the budget on discovery and collection revenue so one time revenue that was included in our base amount that should have been seen as one time revenues. 1264 02:08:35,000 --> 02:08:46,000 We have been working with our consultants ACL on better identifying this discovery and collection revenue so that we can protect better going forward on ongoing revenues only. 1265 02:08:48,000 --> 02:08:58,000 License and permits and charges for services are both tracking ahead of current year projections and these increases here have recommended to bring our budget in line with the trends. 1266 02:09:01,000 --> 02:09:16,000 Another decreases recommended for investment earnings so at the time of budget development investment earnings were higher than ever before fiscal year 25 yielded nearly $4 million in actual earnings in the general fund. 1267 02:09:17,000 --> 02:09:24,000 fiscal year 27 is adopted at 3.2 million so still we're pretty conservative when we adopted the budget. 1268 02:09:25,000 --> 02:09:42,000 The city investments do remain strong however we recently utilized some of our cash reserves for the acquisition of harvest recreational site which reduces the investable cash base used to generate returns so that's really where the lower than budget of returns are stemming from. 1269 02:09:46,000 --> 02:09:52,000 Moving to transfers in so this is a revenue source transfers in from other funds. 1270 02:09:52,000 --> 02:10:07,000 So given the new measure g revenue projections creating capacity for additional core service support staff is proposing directing additional measure g dollars towards supporting and enhancing our 911 and dispatch services. 1271 02:10:08,000 --> 02:10:18,000 These services are essential for providing pre arrival medical instruction maintaining emergency response times and coordinating police and fire responses. 1272 02:10:19,000 --> 02:10:24,000 Measure g support ensures that these critical services have stable funding. 1273 02:10:25,000 --> 02:10:28,000 While maximizing community benefits. 1274 02:10:28,000 --> 02:10:38,000 Another transfer in from measure g into the general fund is proposed it's $560,000. 1275 02:10:39,000 --> 02:10:48,000 This indicates the amount of measure g program expenditures that are over the projected revenue for next year so this really is a budgeting mechanism. 1276 02:10:49,000 --> 02:10:55,000 Measure g revenue in fiscal year 2425 so that first quarter of receiving measure g. 1277 02:10:55,000 --> 02:11:04,000 Broad in 600,000 dollars over our projected revenue so this FY 2627 budget would utilize this additional revenue. 1278 02:11:07,000 --> 02:11:13,000 Earlier this year the city completed an update to the city's cost allocation plan. 1279 02:11:14,000 --> 02:11:24,000 Cost allocation plans are the mechanism for distributing the cost of our centralized support services such as finance, HR, IT and legal. 1280 02:11:25,000 --> 02:11:28,000 Fundments who benefit from the services. 1281 02:11:29,000 --> 02:11:40,000 So this updated model the cost recovery process showed us that a larger amount of the general fund departments were utilizing the city services. 1282 02:11:40,000 --> 02:11:55,000 So since we do not charge general fund to general fund departments for the cost allocation this resulted in a 2.73 million dollar rejection and transfers in from other funds. 1283 02:12:01,000 --> 02:12:04,000 Okay so now we'll move to the expenditure side. 1284 02:12:04,000 --> 02:12:06,000 Oops excuse me. 1285 02:12:08,000 --> 02:12:15,000 Post expenditure adjustments to the general fund and measure g would increase the budget by 1.07 million dollars. 1286 02:12:16,000 --> 02:12:28,000 First our salary and benefits budget was recalculated to better reflect our current census and include post adoption council approved reclassifications and cost increase assumptions. 1287 02:12:29,000 --> 02:12:33,000 This resulted in a 1.24 million dollar increase. 1288 02:12:34,000 --> 02:12:42,000 This cost was then offset by a $650,000 reduction in the general fund for other post employment benefits. 1289 02:12:43,000 --> 02:12:48,000 And that's the result of the city's obligation being fully funded. 1290 02:12:49,000 --> 02:12:57,000 We have a $1 million rejection to general government, which is just a correction to a budget administration air at the time of adoption. 1291 02:12:58,000 --> 02:13:05,000 We have a $212,000 increase for the city share of the animal shelter obligation. 1292 02:13:06,000 --> 02:13:09,000 This is the amount over what we adopted in the budget. 1293 02:13:10,000 --> 02:13:20,000 There are two budget package requests for the general fund totaling $266,000 dollars, which I'll show you those on the next slide. 1294 02:13:21,000 --> 02:13:29,000 Next we have a reduction in general liability insurance costs so after a thorough analysis of our lost history. 1295 02:13:30,000 --> 02:13:38,000 The city identified cost savings by switching to a higher single incident report threshold with a lower premium amount. 1296 02:13:39,000 --> 02:13:49,000 Our general liability cost recovery calculation was then able to be recalculated resulting in a 1.13 million dollar savings to the general fund. 1297 02:13:54,000 --> 02:14:04,000 Then we have the 2.11 million dollar transfer out of measure G into the general fund that corresponds to measure G support of the 911 and dispatch services. 1298 02:14:05,000 --> 02:14:14,000 And then finally given the recommended expenditure adjustments and due to the contributions budgeted in the current fiscal year after mid year. 1299 02:14:15,000 --> 02:14:22,000 Our required general fund reserve contribution for FY2627 will decrease by $700,000. 1300 02:14:23,000 --> 02:14:33,000 Given this staff proposes utilizing this budget savings to increase the budgeted contribution to our capital improvement funds general reserve. 1301 02:14:34,000 --> 02:14:50,000 Increasing it from 0.5% to 1% the policy has a range of 0.5% to 3% and this will allow us to make sure that the five year CIP budget as adopted can be fully executed. 1302 02:14:50,000 --> 02:15:00,000 The budget packages are submitted by departments for review by the. 1303 02:15:00,000 --> 02:15:12,000 The city management department for any new programs or activities and things that go beyond minor operating adjustments. 1304 02:15:12,000 --> 02:15:27,000 In the general fund, we have two proposed budget packages, the first is for the city clerk's office. So just as they spoke about earlier today, this is SB 707 compliance, public meeting compliance, zoom and captioning services. 1305 02:15:27,000 --> 02:15:42,000 It's an ongoing $10,000 request. In the human resources department training and organizational development staffing and ongoing costs of $256,000. 1306 02:15:42,000 --> 02:15:53,000 This request has a revision to the budget package from the adopted budget that requested a limited term human resources manager dedicated to organizational development. 1307 02:15:53,000 --> 02:16:11,000 It was budgeted in the non-recurring general fund. Staff is proposing amending the staffing plan to make this position ongoing, which also includes budgeting the position in the general fund rather than the non-recurring. 1308 02:16:12,000 --> 02:16:30,000 Proposed revenue adjustments would bring the FY2627 revenue budget to 169.53 million proposed expenditure adjustments and the budget packages would bring FY2627 expenditures to 169.28. 1309 02:16:30,000 --> 02:16:36,000 This would yield a general fund budget residual of $257,000. 1310 02:16:36,000 --> 02:16:57,000 Again, zeroing in on measure G. Measure G revenues would be revised to $25.24 million, which includes the transferring in of the $560,000 and unassigned fund balance and proposed expenditures in measure G would be $25.24. 1311 02:16:57,000 --> 02:17:03,000 So utilizing every dollar there. 1312 02:17:04,000 --> 02:17:16,000 To recap, the general fund as originally adopted had a budget residual of $220,000 with proposed revenue and expenditure adjustments to the adopted budget being nearly equal. 1313 02:17:16,000 --> 02:17:32,000 Projected year-end residual of $250,000 is projected. The slide also shows that $4.25 million in one time non-operating revenue excess e-raft has been used to balance the general fund budget. 1314 02:17:32,000 --> 02:17:41,000 No additional usage of one time revenue is proposed. 1315 02:17:41,000 --> 02:17:46,000 Okay, to the non-recurring. 1316 02:17:46,000 --> 02:18:03,000 For fiscal year 2526, the non-recurring general fund, which is used for reimbursements, one time expenditures, and non-capital projects, and all funded by one time general fund revenues, or transfers in from other funds. 1317 02:18:03,000 --> 02:18:20,000 We have $34.3 million in adjusted revenues, and this comes primarily from $29.58 million in transfers in from other funds for the harvest recreational site acquisition, demolition and project planning. 1318 02:18:20,000 --> 02:18:29,000 Other revenues include grants and donations, one time revenues, and reimbursable charges for services. 1319 02:18:29,000 --> 02:18:45,000 The $40.3 million adjusted expenditure budget also contains the same $29.58 million for the harvest recreational site, along with grant funded projects, reimbursable services, and other projects funded by this one time revenue. 1320 02:18:45,000 --> 02:19:01,000 So many projects within the non-recurring general fund span multiple fiscal years. At the end of each fiscal year, all revenues and expenditures are analyzed, validated, and then re-budgeted, re-budgeted when appropriate through the annual carry forward process. 1321 02:19:01,000 --> 02:19:15,000 Fiscal year 2526 projections showed the non-recurring general fund with a $4.9 million available fund balance at the end of the fiscal year. 1322 02:19:15,000 --> 02:19:35,000 The fiscal year 2627 adopted budget for the non-recurring general fund brings in another $6.3 million of revenue with $7.7 million in related and one time expenditures, requiring the use of $1.4 million in fund balance. 1323 02:19:35,000 --> 02:19:56,000 We have three budget packages requested from the non-recurring general fund. The first is for the community resources department, and this request is $150,000 in funding towards the downtown specific plan update, ensuring downtown stays aligned with current conditions and future opportunities. 1324 02:19:56,000 --> 02:20:02,000 This adds to the $100,000 appropriated in fiscal year 24. 1325 02:20:02,000 --> 02:20:16,000 For Parks and Rec, I request for $200,000 for open space and conservation park planning in order to develop a long-term strategy for conserving the city's natural open spaces open space parks. 1326 02:20:16,000 --> 02:20:28,000 This is also an addition to the $85,000 that's budgeted in fiscal year 2627 from a budget package for south Jefferson feasibility study. 1327 02:20:28,000 --> 02:20:38,000 For the police department, we have a request for $42,200 for part-time staffing that would facilitate the migrating of digital evidence. 1328 02:20:38,000 --> 02:20:56,000 And then also shown in the non-recurring general fund is the reduction to the non-recurring for moving the HR manager from the limited term to a full-time equivalent and into the general fund. 1329 02:20:56,000 --> 02:21:11,000 The proposed revenue and expenditure adjustments, inclusive of the previously mentioned budget package request, would require the usage of $752,000 in available fund balance. 1330 02:21:11,000 --> 02:21:28,000 The non-recurring general fund would end fiscal year 2627 with an estimated $4.18 million in projected fund balance. 1331 02:21:28,000 --> 02:21:31,000 Moving on to other funds. 1332 02:21:31,000 --> 02:21:35,000 We'll take a look at solid waste and recycling. 1333 02:21:35,000 --> 02:21:44,000 $12.3 million in revenue adjustments and $6.7 million in expenditures, adjustments are proposed. 1334 02:21:44,000 --> 02:21:57,000 Operating revenue adjustments include 8.72 million of refuse collection charges that reflect council adopted rating creases that took effect January 1st, 2026. 1335 02:21:57,000 --> 02:22:12,000 Additionally, we have a proposed increase for projected material sales revenue $3.4 million, which is the result of higher global commodity pricing improved optical sorting and an expanded customer base. 1336 02:22:13,000 --> 02:22:30,000 Expenditure adjustments include $3.85 million in contract services and $1.2 million in payments for materials, which are offset by reductions related to the city's cost allocation plan update and other minor adjustments. 1337 02:22:30,000 --> 02:22:43,000 Additionally, solid waste and recycling has proposed $3 million in capital project expenditures related to critical facility needs. 1338 02:22:43,000 --> 02:22:45,000 Next, we'll look at water. 1339 02:22:45,000 --> 02:23:09,000 Proposed revenue adjustments total $3.47 million within water's capital project fund proposed expenditure adjustments total $7.91 million, which includes an operating expenditure adjustment of $1.12 million for chemical purchases and electricity cost for treatment operations and pump stations. 1340 02:23:09,000 --> 02:23:17,000 Water has also proposed two budget packages related to staffing that total $186,000. 1341 02:23:17,000 --> 02:23:30,000 These increases are offset by salary and benefit adjustments, general liability costs and a $1.26 million reduction from the city's cost allocation plan update. 1342 02:23:30,000 --> 02:23:44,000 For water's capital project fund, $8.15 million in adjustments are proposed for new projects and adjustments to existing projects. 1343 02:23:44,000 --> 02:24:08,000 Looking at the two budget packages for water utilities, the first is water control systems analyst, so one FTE physician estimated at $178,000 would add the needed in-house resources to move forward several critical treatment plan projects as well as control and cyber security plan implementations. 1344 02:24:08,000 --> 02:24:34,000 Second, we have a proposed position reallocation which would create an advanced water treatment operator position that would possess instrumental skills that could document equipment conditions and perform analytical studies that support of coming improvements at the HANAC treatment plan and this estimated ongoing cost is $8,000 annually. 1345 02:24:34,000 --> 02:24:46,000 Looking at our special revenue funds, we have a handful of them with significant changes, again the details for all special revenue funds are within the report attached to the council item. 1346 02:24:46,000 --> 02:24:56,000 Most notably is the red light camera fund which is the result of operations taking longer to come online than originally projected. 1347 02:24:56,000 --> 02:25:09,000 This leads to a $1 million proposed reduction on the revenue side as well as a $330,000 adjustment on the expenditure side since only the contract expenditures are expected. 1348 02:25:09,000 --> 02:25:17,000 For measure you, this is the county-wide tax that replace measure T for local streets and roads. 1349 02:25:17,000 --> 02:25:27,000 It's projected to receive $370,000 less than the adopted budget. There's also a million-dollar decrease in capital project funding. 1350 02:25:27,000 --> 02:25:31,000 I'll show you that on the capital improvements slides. 1351 02:25:31,000 --> 02:25:51,000 Also stemming from capital projects, $540,000 in expenditure adjustments to the public art fund, this includes $555,000 in proposed usage of public art funding for seven newly proposed capital projects. 1352 02:25:51,000 --> 02:25:57,000 Our capital project funds, so a few changes to our capital project funds. 1353 02:25:57,000 --> 02:26:08,000 Here you see a revenue adjustment of $690,000, which is the proposed increase contribution to the CIP's general reserve from the general fund. 1354 02:26:08,000 --> 02:26:18,000 We also see both on the revenue and expenditure side, the net effect of the proposed capital improvement project additions and adjustments. 1355 02:26:22,000 --> 02:26:38,000 Looking at our internal service funds, minor revenue changes to our fleet fund, proposed expenditure adjustments here are the result of salary and benefit updates along with a $300,000 reduction to fleet upfit expenditures. 1356 02:26:38,000 --> 02:26:54,000 In fiscal year 2627, the risk fund has a decrease to service charges revenue, which is the result of the revised premium structure for general liability insurance. 1357 02:26:54,000 --> 02:27:12,000 Revenue here is the cost recovery mechanism that has charged the departments to fund the program, and with the program decreasing in expenditures due to the revised premium structure, this lessons the amounts charged to departments. 1358 02:27:12,000 --> 02:27:29,000 So on the expenditure side, a $320,000 reduction stems from the insurance premiums, again reflecting the revised premium structure along with some minor updates to salary and benefit cost. 1359 02:27:30,000 --> 02:27:41,000 Proposed reductions to our post employment benefits funds show both on the revenue and expenditure side, so $820,000 in payroll charges. 1360 02:27:41,000 --> 02:27:59,000 That show up in this fund as a revenue, which is then passed through as a contribution on the expenditure side, this will no longer be required due to the city being fully funded, so $820 also shows up in the departments as savings, $615 in the general fund. 1361 02:27:59,000 --> 02:28:22,000 All right, for the CIP changes. So we have several proposed CIP changes within the proposed midcycle budget report, we have tables that show these changes reports and individual project sheets for all the all that's changed in fiscal year 2627. 1362 02:28:22,000 --> 02:28:27,000 Here we show them broken out by funding source and I'll touch on them briefly. 1363 02:28:28,000 --> 02:28:39,000 For measure you, $1 million reduction to the FY2627 street preventative maintenance project is proposed, which would reduce that project's budget to a million dollars. 1364 02:28:39,000 --> 02:28:55,000 In public art, we have the seven newly proposed projects, which includes sculpture relocation city hall commissions arts and parks, pavement art and a master plan update. 1365 02:28:55,000 --> 02:29:13,000 For solid waste and recycling, we have the addition of two new projects, the MDF's southern parcel site improvement project, along with organics receiving building partial floor replacement. 1366 02:29:13,000 --> 02:29:23,000 For water utilities, three new projects are proposed along with several adjustments to existing projects within the five year capital plan. 1367 02:29:23,000 --> 02:29:46,000 Newly proposed projects include Atlas Peak Water Main Replacement project from Monticello to Hillcrest, the Pueblo Avenue Water Main Replacement Project from California Boulevard to Railroad and the South School Water Main Replacement Project from Lincoln to La Homa. 1368 02:29:46,000 --> 02:30:00,000 Okay moving into proposed staffing plan changes city staff and coordination with our human resource department proposes three staffing plan adjustments for fiscal year 2627 as I mentioned earlier. 1369 02:30:00,000 --> 02:30:06,000 Earlier, budget packages were submit for these changes, or they are within the mid-cycle report. 1370 02:30:06,000 --> 02:30:12,000 These proposed adjustments were increased, budgeted full-time equivalent positions by one. 1371 02:30:12,000 --> 02:30:18,000 Water utilities has proposed adding one water control system's analyst, and the reallocation 1372 02:30:18,000 --> 02:30:24,000 of the water treatment operator position for an advanced water treatment operator. 1373 02:30:24,000 --> 02:30:36,000 Human resource department has also proposed making their limited term human resources manager into a full-time. 1374 02:30:36,000 --> 02:30:43,000 Flat takes us to the recommended action for tonight. 1375 02:30:43,000 --> 02:30:51,000 So the recommended action for tonight is to provide direction to staff to amend and finalize the proposed fiscal year 2627, 1376 02:30:51,000 --> 02:31:01,000 mid-cycle budget, and the city-wide position staffing plan, and to present those documents for final review in approval at the 1377 02:31:01,000 --> 02:31:07,000 regularly scheduled meeting on June 2, 2026. 1378 02:31:07,000 --> 02:31:10,000 Thank you so much for the presentation. 1379 02:31:10,000 --> 02:31:11,000 Move to disclosures. 1380 02:31:11,000 --> 02:31:17,000 If a council member has received information prior to this hearing that is important to the decision-making process for this hearing, 1381 02:31:17,000 --> 02:31:23,000 and if the information is not included in the written materials for this item, please disclose the information at this time. 1382 02:31:23,000 --> 02:31:27,000 So participants in this hearing have an opportunity to consider that information. 1383 02:31:27,000 --> 02:31:29,000 No disclosures. 1384 02:31:29,000 --> 02:31:30,000 No disclosures. 1385 02:31:30,000 --> 02:31:31,000 No disclosures. 1386 02:31:31,000 --> 02:31:32,000 No disclosures. 1387 02:31:32,000 --> 02:31:33,000 Thank you. 1388 02:31:33,000 --> 02:31:35,000 And now I will open public testimony. 1389 02:31:35,000 --> 02:31:38,000 Please submit speaker cards for the city clerk. 1390 02:31:38,000 --> 02:31:39,000 Time is limited to three minutes. 1391 02:31:39,000 --> 02:31:44,000 The speaker will sound at 30 seconds to allow the speaker to summarize comments. 1392 02:31:45,000 --> 02:31:47,000 Any speaker cards for this item? comments. 1450 02:33:55,000 --> 02:34:01,000 I'm not feeling super optimistic about the future economy, so you know for me it's hard. 1451 02:34:01,000 --> 02:34:06,000 It's hard to really know if it's prudent for us to rely on the economy. 1452 02:34:06,000 --> 02:34:12,000 Being favorable for much longer, but I know that we have levers we can pull if and when that day comes. 1453 02:34:12,000 see, you know, a lot of good in what the work that we've done in the last several years to really be in and get position. 1459 02:34:37,000 --> 02:34:43,000 I do agree that outside of here the economy doesn't look good for a lot of industries. 1460 02:34:43,000 --> 02:34:46,000 But we're seeing the TOT. 1461 02:34:46,000 --> 02:34:49,000 Higher the measures use higher even though sales taxes low low. 1462 02:34:49,000 --> 02:34:55,000 So that's one that we really have to to watch and help our economic development team. 1463 02:34:55,000 --> 02:35:00,000 Really reach out to business community 02:35:21,000 So supporting that that area for growth is really important as well as the open space and park planning. 1468 02:35:21,000 --> 02:35:27,000 You know we have a lot of parks and continue to plan and improve the quality of our residents is really important. 1469 02:35:27,000 --> 02:35:32,000 And when they see you know that way back to the community the the continued to support what we're doing. 1470 02:35:32,000 --> 02:35:37,000 So great work and you know have anything else to say thank you. 1471 02:35:37,000 --> 02:35:39,000 I just want to thank you. 1472 02:35:39,000 -->
