[1:18]

[1:23]
All right, public comment. Public comment provides an opportunity for members of the public to directly address the planning commission on items of interest
[1:31]

[1:39]

[2:14]
So moved.
[2:16]
Do we have can I second?
[2:19]
All right, all those in favor?
[2:21]
I abstain.
[2:23]
So with two, is that enough to go forward?
[2:26]
Okay, great. Thank you.
[2:28]

[2:52]
Tonight we have the following item.
[2:54]
Item 7A Morimoto Asia Entertainment use permit at 790 Main Street.
[3:00]
We will start with commissioner disclosures.
[3:06]
I spoke with staff.
[3:08]
And I'm familiar with the space I have visited many times.
[3:11]
I am a frequent fire as well.
[3:14]
And we will now hear a report from staff.
[3:17]
Good evening, everybody. I'll be presenting on the proposed use permit request for Morimoto Asia.
[3:22]
I'm Vince Lee is also here from the applicant team. He serves as the general manager.
[3:28]
This is a request for a use permit for a joint entertainment use and extended hours of operation for Morimoto Asia.
[3:35]
As stated, the properties look at at 790 Main Street.
[3:40]
This is the southeast corner of third street in Main Street within the riverfront complex adjacent to the Napa River.
[3:49]
The site is an existing approximately 6,000 square foot square foot full service restaurant and originally opened in 2022.
[3:58]
This request has two parts.
[4:00]
The request for extended hours of operation allowing the space to remain open to 1 a.m. on Fridays and Saturdays and certain holidays including the Sunday before Memorial Day, the Sunday before Labor Day, Halloween, same Patrick's Day, Independence Day, New Year's Eve.
[4:16]
The second part of the request is for a joint entertainment use which would allow the operator to host live music, DJs and other entertainment at the site.
[4:28]
A joint entertainment use is a category within the city's downtown specific plan and it provides for entertainment as an accessory use less than 50% of the floor plan would be utilized for entertainment purposes.
[4:40]
The primary use of this space would remain as a restaurant.
[4:45]
The city's entertainment overlay district really centers around Main Street. The site is within the overlay district.
[4:55]
This is the proposed activated floor plan for entertainment.
[4:59]
As you can see, there's proposed dance floor that would occupy around 21% of the space.
[5:06]
Potential DJ or band would be located in the corner.
[5:11]
The dance floor adjacent to the main entrance and there's several entry and exit points to inform the dance floor.
[5:19]
There wouldn't be any crowding concerns.
[5:24]
Just to give some context to the site.
[5:28]
As mentioned earlier, the site is within the riverfront complex.
[5:32]
This is a large mixed use development with ground floor retail and offices and residential units above.
[5:38]
It's worth noting that residential units are only located in the southern portion of the riverfront complex.
[5:44]
The portion south of the breezeway dividing the structure.
[5:50]
The applicant has provided a safety and security plan.
[5:53]
They would provide two security guards each night from 9.30 pm to closing.
[5:58]
Security would be responsible for managing occupancy levels preventing overcrowding and de-escalating any conflict.
[6:05]
The site also hosts full video surveillance.
[6:10]
The applicant would have to comply with the noise-decephal level limits contained in the downtown specific plan.
[6:17]
This is 67 decibels from the property line on the site and then 65 decibels from any property line of any property that's designated for residential use.
[6:29]
This includes the riverfront's residential condominiums and the southern portion of the structure.
[6:35]
For context, 65 decibels is about the noise level of a regular conversation.
[6:42]
The staff review the project against the city's review criteria for cocktail lounges, bars and commercial recreation.
[6:50]
The application was read to the police department for review.
[6:54]
They didn't have any concerns on their asked that the closing time be 1 a.m. in the applicant agreed.
[7:01]
As a result, staff determined that this would be an appropriate hours of operation for the site.
[7:07]
The police presence along Main Street is pretty significant.
[7:11]
It's being within the entertainment overlay.
[7:15]
There's routine police presence so there wouldn't be any potential for lowering, especially considering the onsite security that would be provided.
[7:24]
There's adequate site lighting.
[7:26]
The properties at least half a mile from any school.
[7:31]
The property is located near residential uses.
[7:36]
But as they have to comply with the noise decibels levels, this didn't create any concerns.
[7:42]
The site does serve alcoholic beverages, but they have complied with all ABC requirements.
[7:51]
To approve the project, the commission would have to make the findings for a use permit that the proposed use is in accordance with the general plan.
[7:59]
The second thing, the acts of facilities near applicant?
[8:02]
Half a goal of specific plans tomar and square planning.
[8:05]
The objectives of the zoning ordinance and the purposes of the zoning district and回來 district, which the site is located.
[8:11]
That the project will not impact public health saved your welfare, or be Director properties or improvements in the vicinity.
[8:19]
That the project will comply with each ethical provision of the zoning ordinance.
[8:25]
for the proposed use, but there's no additional findings required.
[8:30]
And with that staff recommends that the Planning Commission adopted a resolution
[8:34]
approving a use permit for a joint entertainment use,
[8:37]
allowing an existing restaurant at 790 Main Street to host live
[8:41]
and amplify music performances with extended hours until 1 a.m.
[8:44]
and determining that the project would be exempt from CEQA.
[8:48]
Thank you.
[8:49]
Thank you, Paul.
[8:51]
Commissioners, does anybody have any questions for staff?
[8:55]
No.
[8:56]
Would the applicant like to make a presentation?
[8:59]
Yes.
[9:01]
And before that, the Commissioner Myers just set up two closures.
[9:07]
I do not have any disclosures.
[9:11]
Thank you.
[9:13]
Hello.
[9:14]
Good evening, everyone.
[9:15]
My name is Vince Light.
[9:16]
I am the Regional GM for the Moor Motor Brand.
[9:19]
First and foremost, I just want to say thank you for your support for those who are familiar
[9:23]
with our location as 790 Main Street.
[9:26]
The goal for us is to really be able to provide
[9:30]
entertainment and something different for the public,
[9:35]
whether they're visiting or locals here in the downtown
[9:39]
Napa area.
[9:40]
In doing so, we would like to be able to provide a late night scene,
[9:45]
but at the same time, ensure that it is completely safe,
[9:49]
that it wouldn't affect the city in any negative way.
[9:54]
On top of the information that was provided up there on the screen,
[9:59]
I've actually included additional information or procedures
[10:03]
in creating a safe environment for staff and for our guests.
[10:07]
So, whether it's providing context for taxi service,
[10:12]
the Yellow Cab locally executive service, depending on the clientele,
[10:16]
all the way down to non-emergency contacts to Napa police department,
[10:20]
whether it's an emergency or non-emergency.
[10:24]
Our contact information is readily available,
[10:27]
and our plan in our SLP is available to the staff in multiple areas
[10:31]
for the late night program.
[10:33]
One being in the back of the house area,
[10:35]
and one being in the front of the house area.
[10:37]
So, it's accessible, it is informational,
[10:41]
and it's going to really determine safe environment for the community.
[10:46]
Thank you.
[10:48]
Thank you.
[10:51]
Any questions for the applicant?
[10:53]
I have one question.
[10:55]
Do any of you the other Mori Moto Asia or Mori Moto facilities have live entertainment with dancing?
[11:05]
No, not at the ones, not at the ones in California,
[11:09]
but in Hawaii we do.
[11:11]
Oh great.
[11:13]
Thank you.
[11:15]
All right. Thank you.
[11:17]
Thank you so much.
[11:19]
I'm going to open public comment.
[11:21]
Maya, do we have any public comment cards?
[11:23]
No, I received that. Thank you.
[11:25]
All right.
[11:27]
Are there any requests?
[11:29]
Okay, nope.
[11:30]
Bring it back to the commission, then, for deliberation.
[11:33]
Do we have to close public comment?
[11:36]
If there's no comments?
[11:37]
No.
[11:38]
Okay.
[11:41]
Okay.
[11:44]
Could I get a motion to close public comment?
[11:48]
I'll make a motion to close public comment.
[11:51]
Second, all those in favor?
[11:53]
All right.
[11:54]
Public comment is now closed.
[11:57]
All right.
[12:00]
I guess we'll be right back here.
[12:02]
Does anybody have any comments?
[12:03]
Additional comments for this?
[12:05]
No.
[12:06]
The only comment that I have is that I think that we do need more opportunities for people to dance.
[12:16]
And I think this is going to be a really great fit.
[12:21]
You guys have, I know you're proud because I'm around that area at times very late.
[12:29]
In the evening, I happened to work at a fellow, like one of your peers,
[12:35]
right down the street.
[12:36]
I managed special events and book bands for that venue.
[12:40]
And I know that we desperately need danceable places.
[12:45]
So, this is, I believe, of step in the right direction.
[12:49]
A two step in the right direction.
[12:54]
I only had one comment that I spoke to staff about, but I will mention it here,
[12:59]
because I appreciate the fact that you are planning for people
[13:06]
to be outside the front of the business with your security staff.
[13:10]
One of the things that always concerns me about late night,
[13:13]
because I've traveled other places where I've stayed too close to a late night place,
[13:18]
is that people spill out at the odd hours and then they end up making a lot of noise,
[13:23]
which is louder than a 65 decibel light conversation.
[13:28]
So, what I appreciate is the fact that you're doing that in this instance,
[13:32]
because in the front of your restaurant, it has a nice seating area.
[13:35]
You know, that area makes it easy for people to come out and get a breath of fresh air.
[13:39]
So, appreciate it.
[13:41]
I hope that everything goes really well.
[13:46]
I like the project.
[13:48]
Yeah.
[13:49]
Commissioner Myers, do you have anything to have?
[13:51]
Well, I agree.
[13:52]
I think it's a great project.
[13:53]
Thank you.
[13:55]
I agree as well.
[13:56]
The location is perfect for extending these hours.
[13:59]
I'm excited to have it here now, but into eat more of your carriage chicken.
[14:03]
All right.
[14:04]
Can I get a recommendation?
[14:06]
Okay.
[14:08]
I recommend that Planning Commission adopt a resolution of proving a use permit,
[14:15]
authorizing a joint entertainment, use allowing an existing restaurant at
[14:20]
790 Main Street to host live and amplified music performances with extended hours
[14:26]
until 1 o'clock a.m.
[14:28]
And determining that the actions authorized by this resolution are exempt from the California Environmental Quality Act.
[14:36]
Second.
[14:37]
All those in favor?
[14:38]
I would have I done.
[14:41]
Oh.
[14:44]
Oh, this is my motion.
[14:46]
Yes, I'm not.
[14:47]
I'm I don't know if I've ever made a motion.
[14:50]
And we had a second.
[14:55]
Yes.
[14:56]
And all those in favor?
[14:57]
Aye.
[14:58]
Congratulations.
[14:59]
Thank you.
[15:00]
Thank you. Do we have any administrative reports? Additional? No. Any additional comments by staff for commissioners?
[15:11]
Well, I apologize for being tardy.
[15:14]
That drive from Santa Rosa.
[15:17]
I will say I'm so excited that the zoning to draft zoning ordinance came out today.
[15:24]
And if you're out there and you signed up to get notification, the city's email worked because I got it as a citizen before I got it as a planning commissioner.
[15:35]
So it's great.
[15:37]
Fantastic.
[15:38]
Yes, it is on the city's web page.
[15:41]
So if you go to the government tab and to the planning division and then on to the sub tabs and the projects, if you click that and it opens up,
[15:51]
the zoning ordinance update, where the zoning ordinance update has been positioned since kind of the start of this undertaking.
[16:01]
The documents of the public draft, there will be three documents available to you.
[16:07]
An executive memo, which is intended, although it's seven pages of an executive memo, in comparison, it's supposed to break down this document at a high level and kind of outline some of the changes that are occurring in the individual sections.
[16:20]
He is the draft itself is 474 pages long.
[16:25]
Both are up on the Cs website as well as the draft zoning map.
[16:30]
Do want to clarify there will be opportunities for public outreach.
[16:35]
City staff will do independent outreach to organizations within the community.
[16:39]
We have created a separate email address as a central location to receive public comments to fill the increase.
[16:46]
I'm going to take a look at the link in the description.
[16:52]
The main public workshop will be two-day July 14th at 530 in the community room.
[16:59]
In my recommendation, both there and the planning commission study session on Thursday July 16th, 530 in the council chambers will be because our consultant will be there.
[17:10]
There will be an agenda where they have opportunity to go more in depth on these changes that are occurring.
[17:15]
While staff's outreach is to pretty much be both specific to topics in areas of interest as well as giving opportunity and clarifying details within the draft.
[17:28]
But our recommendation will be to attend those public workshops as well.
[17:34]
But yeah, we're definitely excited. It's been quite the undertaking that's tiering from quite the undertaking that was the housing element and quite the undertaking and receptive feedback that was the general plan update.
[17:47]
So hopefully this is one portion of implementing that general plan that will have a substantial amount of change within the community that will be seen.
[17:59]
Because it is a conference as our importance update.
[18:03]
A lot of what's implemented within this effort will be enforceable for decades to come.
[18:11]
Definitely excited about it.
[18:14]
Thank you. Any other comments?
[18:17]
No.
[18:18]
It says here the next regularly scheduled.
[18:21]
We have one before that.
[18:24]
Yeah, so there's a special meeting on the 30th of June.
[18:28]
The pre-substantial project. So continue to track that forecast and the genders as those get published.
[18:33]
There's some legal answer that have gone out for that.
[18:36]
And then on July 2nd regularly scheduled meeting.
[18:41]
We'll have a agenda tracking to have at least two items on that.
[18:45]
And then for the 16th of July we'll be tracking to have both the study session and at least one item at this point in time.
[18:53]
All right. Thank you. This meeting is adjourned.
