Do have [6:55] speakers on this item. [6:59] >> Any comments from council? [6:59] Seeing none. Let's go to [7:03] public speakers. [7:06] >> As a please push the podium [7:07] or raise your hand and zooms. [7:08] I can easily identify you. As [7:10] I stated before, because in [7:11] chambers will be taken first [7:12] and then we will move to dozen [7:16] speakers. Missus battle about [7:17] have you with multiple cards, [7:20] MR. Hazzard, I have you with [7:21] multiple cards. My goal that I [7:23] know. Sorry. I said that [7:24] incorrectly. Kendrick [7:31] Armstrong. Melinda. And that [7:36] is if you heard in a prison. [7:37] If you heard name, please [7:38] approach the podium. Amanda, [7:41] so Lozano, so have you. If you [7:42] heard name who's supposed to [7:44] put him any order, please sign [7:46] up so we can get through this [7:47] because expeditiously, if you [7:48] are able and again, if you're [7:49] on zoom, please raise your [7:49] hand so I can easily identify [8:01] you. Signed up for 2 items my [8:06] name is Armando. So we need [8:07] the shelter. Crisis be can [8:07] give people a place to go. [8:08] That was the big theme last [8:12] week. [8:13] >> And no Councilmember Wang [8:13] Wei shutting down a medical [8:16] respite facility in your [8:18] districts we've gotten and how [8:20] we've gotten. And how's [8:22] mortality crisis more than 200 [8:23] people dying on the street [8:24] each year. Disproportionately [8:27] black you should ask yourself [8:28] those people are going to die [8:28] because you denied them. [8:31] Medical respite. Saying that [8:32] if we bring homeless people in [8:33] the Chinatown is going to be [8:36] manslaughter in the streets. [8:40] That is very charged language. [8:41] And I'm really offended by the [8:43] lies I heard last week saying, [8:45] you know, we're going to [8:46] arrest people for returning to [8:48] an encampment But we're not [8:49] criminalizing homelessness. [8:50] You think we're that stupid [8:51] that you can just lie with no [8:54] accountability. And saying [8:55] we've got people coming from [8:56] Canada in Missouri. You know [8:57] that that's not [8:58] evidence-based. It maybe in a [9:02] few cases. But the ucsf [9:04] statewide study and the [9:05] Point-in-time count, the vast [9:05] majority of our unhoused [9:08] people like 70 80%. Have lived [9:10] here for decades or [9:12] generations and have you read [9:13] the home together? Strategic [9:13] plan that all the policies [9:17] need to be grounded in. You [9:18] know, stop racialized [9:19] displacement. That is your [9:21] mandate. And that is what you [9:22] know, These policies are [9:25] tempting. And why. And it's [9:26] embarrassing that we're [9:29] debating these Kauai Ch [9:30] guidelines. This is the bare [9:30] minimum of constitutional [9:32] protection just to prevent [9:33] lawsuits. We should be not [9:35] racing to the bottom and [9:37] struggling to comply with the [9:38] bare minimum of legal said we [9:38] should be raising our [9:39] standards and adopting best [9:43] practices. The best practices [9:44] guidelines say put the public [9:45] health officials in charge of [9:48] a cannon planning. Okay. We [9:49] need a public health approach [9:51] in the midst of this mortality [9:51] crisis, not punishment of [9:58] criminalization. And it's an [9:59] embarrassment that we're [10:01] aligning with the Trump [10:02] Supreme Court and celebrating [10:03] when they stripped [10:06] constitutional protections. [10:07] You're criminalizing the [10:09] status of homelessness when [10:10] people have no place to go and [10:24] you're punishing him for that. [10:26] >> Hello, my name is Kendrick [10:26] Armstrong. I am the current [10:29] music director for the Oakland [10:30] Symphony. I'm here to speak on [10:33] behalf of the Oakland Symphony [10:34] in renaming 21st Street next [10:37] to the Paramount in honor of [10:39] Michael Morgan. For those of [10:39] you who did not know Michael [10:40] Morgan was the music director [10:43] of Center for 30 years and the [10:44] second to black music director [10:46] of the Oakland Symphony, [10:47] myself being the 3rd black [10:49] music director of the Oakland [10:51] Symphony and his 3 point that [10:51] no other work history in this [10:54] country can say that they've [10:54] had the legacy of having 3 [10:57] black music directors in [10:58] classical music, black [11:02] musicians only make up 2.1% of [11:03] musicians in classical music. [11:04] And so being able to honor [11:06] Michael Morgan and being able [11:08] to honor the musical legacy of [11:09] Oakland in this way to have a [11:13] way that everyone who comes to [11:14] downtown Oakland to see that [11:17] the amazing legacy of a man [11:18] who championed diversity, [11:19] equity, inclusion of classical [11:22] music so that I can now be the [11:23] 3rd black music director is an [11:24] incredible honor. So thank you [11:37] so much for. [11:41] My name says like [11:45] I'm a come resident Berkeley [11:45] resident now retired professor [11:46] at uc Berkeley. I was there [11:50] from us 40 years. [11:51] >> In my research, specialty [11:52] was the history of disability [11:55] poverty in Street, clearing. I [11:57] wrote a book called The Ugly [11:57] Laws, which is about an [12:00] ordinance that banned. [12:02] Unsightly, disabled people [12:04] from exposing themselves to [12:05] public view. It was an anti [12:09] beging ordinance. And I also [12:09] read an article in Harvard Law [12:11] Review that was specifically [12:12] about the use of the Americans [12:15] with Disabilities Act to [12:16] justify cynically the [12:20] clearing. The kicking of [12:20] disabled people to the curb [12:25] in. Out of sight. On the [12:28] grounds of disability axis. So [12:29] many of the people we're [12:31] talking about. Are disabled. [12:35] Our older people. Deserve that [12:39] protection. But I do want to [12:40] talk to about that. I came [12:41] here today for another reason [12:42] after a retired, I started [12:48] working. As a volunteer, [12:50] providing a company men and [12:51] comfort to dying on house [12:52] people in San Francisco in the [12:53] tender line street medicine [12:55] team. [12:57] >> I just want to tell you [12:59] about my first experience my I [13:13] went out for training on it. [13:16] >> Good morning. My name's DR. [13:17] Me Echo Know I'm the ceo of [13:19] the Oakland Symphony. Speaking [13:23] on behalf the initiative to [13:25] rename the space next to where [13:25] the street next to the [13:28] Paramount Theater. Michael [13:30] Morgan, Way, I got extreme [13:31] privilege of working with [13:31] Michael Morgan for 3 years [13:33] before he passed. I'm also [13:35] speaking on behalf of the [13:36] Paramount Theater leadership [13:38] as they are unable to be here [13:40] this morning on short notice. [13:43] But they are extremely in [13:45] favor of this. Their board and [13:47] they're they're director Jason [13:48] Blackwell. Michael Morgan [13:51] spent his last 18 years of his [13:52] life conducting the Oakland [13:53] Symphony at the Paramount [13:56] Theater. He is nationally [13:57] internationally recognized as [13:58] someone who brought diversity [14:01] into classical music in an [14:03] intentional way when he is [14:05] celebrated across the country [14:05] and as my strong Strong said [14:07] that people come here knowing [14:10] who he was and our community [14:11] members know who he was [14:12] because he went to schools and [14:16] had at least 50 school visits [14:16] every single year, which is a [14:30] next. Starting 5.3 declaration [14:32] of local emergency on [14:33] homelessness. [14:36] >> If you pay attention to the [14:36] government's mild ordinance, [14:37] addressing encampments with [14:39] urgency and dignity, it is [14:42] very similar to what Mister [14:43] Houston is proposing. MR. [14:49] Houston. Your audience. It's [14:49] similar to the governor. This [14:50] ordinance on homelessness. [14:55] It's called the model [14:55] ordinance addressing [14:56] encampments with urgency and [15:00] dignity. Look at it. 5.4 It [15:02] says that you're going to have [15:03] all partnership with the [15:08] friends of. Open Animals. But [15:09] it looks like you have not [15:13] completed that. That [15:14] relationship and you still [15:15] working on it. So I don't know [15:16] what you approving when this [15:18] has not been finalized. 5 [15:21] point. 6 Shelton crisis [15:26] augments. You have the reasons [15:29] for obtaining shelters as a [15:32] result of the threat of health [15:34] and safety to persons. That's [15:35] what mistake can Houston was [15:39] proposing. Ken Houston, 5.6 is [15:39] what you were dealing with, [15:45] ok? Statement significant. It [15:48] initiatives are in place all [15:50] to deal with homelessness is [15:51] in this document related to [15:52] 5.6 and that's natural. That's [15:57] natural. All you says you will [15:59] allow the city to establish [16:00] minimum minimum health and [16:01] safety standards you jump in [16:04] on Ken Houston for what he's [16:06] trying to do. Bodies being [16:07] cremona. It's a criminal thing [16:11] to arrest people. But you are [16:13] proven in this 5.6 that you [16:14] allow the city to establish [16:18] minimum health and safety. [16:20] Standards. Okay. Going to the [16:23] next item which is 5.7 You [16:28] need to define affective and [16:29] coordinated services for the [16:30] Department of Violence [16:31] Prevention related to this [16:34] issue. Use a lot of language [16:35] but it got him. You got to [16:39] meet really say what you mean. [16:40] 5.8, you collecting data that [16:43] demonstrates what? 5.9 pro [16:48] housing. You cannot have pro [16:50] housing when you have [16:52] gentrification and a sanctuary [16:55] city when you cannot determine [16:56] how much housing is needed. [16:59] That's why we on the streets. [17:00] Black people because of Jenks [17:01] who sent to gentrification and [17:04] sanctuary city status. That's [17:05] why black people on the street [17:08] and you will not talk about. [17:09] Unity Council. You cannot [17:14] legally. Vote on an item that [17:16] says Unity Council Farm 9.19, [17:18] says that that is the Spanish [17:20] Beacon Unity Council of [17:24] Alameda County. There's no [17:25] such Neagle. All gonna station [17:26] is the Unity Council. Why did [17:28] they do it? Because they want [17:29] you to believe that it also [17:43] port, they own. [17:47] >> Thank you. Is all about [18:03] your time is up. And so team. [18:07] This meeting, this is sold. [18:10] That's no reason why you, [18:10] MISTER PRESIDENT have changed [18:11] this to a special council [18:15] meeting 3.30 Tomorrow. What's [18:18] the reason? Other sparse [18:21] attendance? That's why you did [18:24] it. And you got items on this [18:25] agenda that you want to try to [18:28] push through. You still [18:33] haven't dealt with. That. Now, [18:33] $10, a crisis from the federal [18:35] government to the state [18:35] government, but not in the [18:38] city of Oakland and you pass [18:42] it on the agenda. I gave you [18:55] this document. 2.12, section. [18:56] Adoption Amendment of [19:04] ordinances. Know what this is [19:06] all to after its introduction. [19:09] And that's what happened was [19:10] measured the transaction and [19:15] use tax. It's still not be [19:22] adopted. It. Turn on the back. [19:28] On JANUARY 16. City attorney [19:32] found with Alameda County [19:32] Register's office [19:34] acknowledging. He off to the [19:39] ballot measure. On Page 8 [19:41] Section 10 that this city [19:43] attorney in a chord with the [19:45] city attorneys powers and [19:46] duties is hereby authorized to [19:51] insert. The final ballot [19:52] question into this ordinance. [19:56] That's one 38. 33. After the [19:57] adoption by the council so [19:59] that the ballot question Costa [20:00] to say to an impartial [20:02] synopsis. [20:05] >> know what worth. It. How do [20:09] you? [20:14] >> And you. Councilmember way [20:16] you got mitigated know to talk [20:18] about racism because black [20:21] folks could not a day shelter [20:22] could not go to the court [20:27] yard. How Rice is is that? One [20:28] has races and none of you [20:30] could is to use efforts to [20:35] address rv's, not of you. He [20:37] was wrong. Cassie, then it by [20:40] himself. But one of you [20:45] silent. Pull item number 9, [20:47] they're obligation, bond. You [20:50] all got down below here. With [20:56] my signature on it. Pull item [20:57] 9 cash. You can't do a duet [21:02] obligation, bond. Refinancing. [21:10] And I got contact with that. [21:11] >> Thank you, MR. Has that [21:21] your time is up? [21:22] >> If your name is Kani wish [21:23] to speak, please approach the [21:24] podium or raise your hand and [21:25] zoom at this time. [21:27] >> Names have been called. [21:28] >> Seeing no more speakers. [21:36] One and 10 motion. Moved by [21:37] Councilmember and Sandra and [21:37] second by Councilmember [21:39] Houston. [21:43] >> On a roll for the consent [21:44] calendar move by Councilmember [21:46] Ramachandran saying by [21:47] Councilmember Houston. [21:48] >> Noting that item 6.2 is an [21:48] emergency ordinance. I'm [21:55] sorry. Items that yes. One of [21:57] the items on consent is an [21:59] emergency ordinance and will [22:02] introduced and finalize on the [22:03] same day do the Raw Council [22:06] member Brown. I. Councilmember [22:11] Fife is excuse. I. Biden is [22:15] now present. Councilmember [22:16] Houston. I councilmember [22:17] around the child run [22:19] councilmember anger. I [22:28] councilmember won. And can I [22:32] just make a comment? I want to [22:33] thank council member Phife [22:34] actually for the resolution [22:36] around honoring Michael [22:36] Morgan. [22:40] >> I was actually privilege to [22:41] be a student in the Oakland [22:42] Youth Orchestra where Michael [22:44] Morgan had been a director and [22:45] was privileged to study [22:47] directly under him. And he was [22:50] really a trailblazer in the [22:51] the music community. Thank you [22:52] for the public speakers who [22:55] came to also speak about it. I [22:57] just want to say, too, that he [22:57] was such an innovator. I [22:59] remember once that we actually [23:03] played a piece of music where [23:04] departure from classical music [23:07] were actually playing a piece [23:08] that really represented the [23:12] urban. The sounds of just [23:13] urban America and it was [23:14] anyways. I know it's a little [23:17] out of turn, but I wanted to [23:19] just speak to his legacy a [23:21] night. Really appreciate that. [23:22] He's being honored. He also [23:24] had early death. And so we [23:25] lost him far too early. Thank [23:32] you. Otherwise I. Chair [23:36] Jenkins. Motion passes with a [23:45] vote 8 eyes. Moving to the [23:46] year public hearing side with [23:51] item 6.1 Conduct a public [23:52] hearing upon conclusion [23:53] received the city of Oakland's [23:53] consolidated annual [23:55] performance and evaluation [23:59] report for fiscal year. 24 [24:00] this. 25 Community Development [24:00] Plant excuse me, block Grant [24:03] home investment partnerships, [24:04] housing opportunities for [24:04] persons with aids and [24:08] emergency Solutions. [24:27] But chairs of the [24:29] council members use of the new [24:30] system. You do have to get in [24:32] the queue to make the motion. [24:33] You can't just yelled out so [24:35] the public can hear you on the [24:36] mic. So you do need to click [24:38] the request to speak in the [24:39] chair. Well, it speaks so we [24:41] can get the motions. Orderly [24:45] and I can. I do recognize your [24:46] voice is, but I'll be able to [24:47] actually see. And here who's [24:50] making the most So we have a [24:51] motion by Councilmember Gallo, [24:53] second by Councilmember [24:55] Houston. So to open the public [24:56] hearing Council member Brown. [27:19] Plans also include [27:20] homelessness, solutions and [27:20] small business development [27:21] activities. Next slide, [27:25] please. In fiscal year, 2020 [27:27] for the City Council accepted [27:28] and appropriated the following [27:30] Formula Grants approximately [27:31] 11.5 million dollars in [27:32] community development block [27:35] grant or cdbg, including [27:37] reprogramming prior your funds [27:37] and reinvestment of loan [27:40] repayments from our revolving [27:42] Loan fund and the following [27:42] slide, all breakdown or uses [27:46] by strategic priority. And finally, [28:29] approximately 650,000 [28:30] emergency solutions grants, [28:31] which is also administered by [28:33] chs and is used for a variety [28:33] of homelessness services. Next [28:38] slide. Please. Cdbg uses are [28:40] restricted to primarily [28:40] capital uses, which is why we [28:42] allocate the lion's share to [28:44] production and preservation [28:45] activities, including using it [28:45] as a source in our new [28:46] construction. No fun or notice [28:50] of funding availability and [28:51] are home owner occupied [28:52] rehabilitation loan and grant [28:57] programs. Additionally in. 24 [28:58] 25 we allocated approximately [28:59] 1 million dollars to the [28:59] improvement of city owned [29:02] homelessness facilities. More [29:04] than 600,000 were allocated [29:05] economic and workforce [29:05] development activities. So [30:08] that concludes my presentation [30:09] happy to answer any questions. [30:13] Thank you so much, Amy. [30:13] >> Comes from the council [30:14] members saying we will go to [30:18] the public speakers. [30:19] >> As a kind name, please [30:20] approach the podium in any [30:21] order. Please state your name [30:21] for the record before [30:24] beginning. He please raise [30:24] your hand so I can easily [30:26] identify you. Jon Jones, the [30:30] 3rd. This is about and Derrick [30:42] Barnes. [30:42] >> Good morning. My name of [30:44] John Jones. The 3rd most Apple [30:45] Urban Strategies Council [30:48] services director of programs. [30:49] We know House is important. I [30:51] want to speak to the first 4 [30:51] words mention and the [30:55] recommendation. Conduct [30:56] public, he run. What does that [30:59] mean? [31:00] >> On a study of the word him [31:05] and means to listen. I though [31:06] the increasingly and growing [31:07] frustration I had with the [31:10] city of Oakland collectively [31:11] is the fact that folks don't [31:12] listen to who consider to be [31:16] legacy residents. I hear folks [31:18] like MISTER Hazard and MISS [31:19] The side of coming here that [31:19] the wealth, the wisdom in our [31:20] community, that for whatever [31:22] reason gets ignored. I wanted [31:26] and why that happens. I don't [31:27] understand why there's this [31:29] continual practice of either [31:29] granting money to or harming [31:32] people. That's not from here. [31:35] That is super disrespectful. [31:37] To those of us who are from [31:39] here, who understand what's [31:39] happening here, right? We hear [31:41] a lot about these hearings. [31:43] That's not what we need. The [31:46] wealth of wisdom is here. What [31:47] I would like the city, the do [31:50] everyone, every branch within [31:51] the city in every department, [31:51] meet the focus on hiring [31:54] people from Oakland. Right? [31:55] Because I'm tired of people [31:57] come in and talk about the [31:58] Black Panthers, but totally [31:58] disrespect the haute and point [32:01] platform. And if you're [32:02] confused about what I mean, [32:03] when I say a legacy resident [32:04] MAY have to be born in [32:06] Oakland, that simply means [32:08] that you a flag here in [32:09] Oakland, right? He repeat, no, [32:10] wasn't born in Oakland, but he [32:12] planted his flag here you get [32:14] them sand rather turn hot, [32:17] know yet is a legacy resident. [32:19] He planted his flag. Gives [32:19] back sentence for a reason [32:20] that someone that's racing kid [32:23] here. I'm focused on the [32:27] future of my kid who is 10 and [32:29] the things that we see don't [32:31] always match the work that I [32:31] hear. But everybody's the [32:32] expert who got skin in the [32:36] game and the city. We need to [32:38] stop that practice of [32:38] disrespecting the legacy here. [32:39] Because if we keep doing that, [32:41] he won't be open. It won't be [32:54] open for you on it. There are [32:55] a number of issues in the [32:56] document that questionable in [33:00] terms of. Was an equitable [33:01] practice in place. I'm just [33:06] give you 2 examples. 46 units [33:09] for a new affordable housing. [33:11] Out of 136 for homeless. Was [33:16] that equitable? [33:17] >> Not 97. Affordable senior [33:21] housing. [33:21] >> 4. [33:25] >> The China town. Was that [33:26] equitable in terms of who else [33:28] in districts got affordable [33:32] housing for seniors. Now, when [33:33] you talk about hud, hud is a [33:38] federal agency. And that's the [33:40] part of their requirement is [33:41] that you have a citizens [33:44] participating plane. The [33:46] person in charge of putting [33:46] the citizens participation [33:49] plan in place chose to use a [33:53] resident plan. You often take [33:55] the role of not using citizens [33:58] to make sure you include your [33:58] undocumented community and you [34:00] have to actual self. Is that [34:06] fair practice? Eligibility [34:07] requirements that we follow [34:08] the requirements, thank-you it [34:13] a sanctuary city. Income at [34:14] below Pacific. Am I he asked [34:17] to be identified U.S. [34:20] Citizenship. All eligibility [34:24] non citizens status. No. [34:25] Outstanding delinquent federal [34:29] debt. Certain crimes MAY not [34:32] be up rival with this ways. [34:36] The way is the report that [34:38] identifies and then last thing [34:41] is and on a to obtain [34:43] continuous funding. You must [34:47] disclose any suspected [34:48] violations of federal criminal [34:52] law involving fraud, bribery, [34:54] all grad to 2 h u d. Where is [35:05] that in the report? [35:05] >> Their barns. Are you in the [35:08] chamber or on zoom? [35:09] >> At this time on sees me at [35:10] this names have been caught. [35:22] >> Her 10 motion. So moved. [35:23] >> Well, we need to make a [35:23] motion to close a public [35:30] hearing. Understanding that [35:31] that's what Councilmember [35:35] owner was doing. Yes. [35:36] >> So just for clarity, that [35:40] motion was too received the [35:40] report and close the public [35:41] hearing with the same motion. [35:45] Is that correct? Now? Take [35:51] that as a yes cow. Yes, that's [35:59] correct. Council member Brown. [36:01] Councilmember 5, I. [36:02] Councilmember Gallo. I [36:06] Councilmember Houston. Council [36:10] member Ramachandran. [36:12] Councilmember anger. I [36:19] councilmember Chair Jenkins. [36:20] Motion passes with a vote 8 [36:30] eyes. Going to item 6.2 [36:31] >> I would retain a motion to [36:39] open the public hearing. Okay. [36:41] So what you guys tap on the [36:42] mic? I hit the button and turn [36:47] your mic on. All right. So [36:48] moved by on Councilmember [36:48] Gallo, seconded by [36:52] Councilmember Friday. [36:53] >> And that motion was to open [36:56] the public hearing. I'll go [36:57] ahead and read item is the [37:00] record. I'm sorry. Taking look [37:01] the raw dough for the public [37:03] Hearing Council member Brown. [37:05] I Councilmember 5. I council [37:07] member Dai o I Councilmember [37:13] Houston. I. Councilmember [37:14] Ramachandran I councilmember [37:15] hunger. I councilmember white. [37:19] And Jenkins. I motion passes [37:20] with a vote of 8 eyes. I will [37:23] go ahead and read the item [37:25] record just before I read. Is [37:26] a regular do roll call. You [37:26] don't have to get in the queue [37:28] cause I can automatically open [37:29] you. So just wait tonight and [37:34] huge. You. Because that's a [37:35] public hearing conclusion of [37:37] that, the following pieces of [37:38] legislation, emergency [37:39] ordinance adding Open [37:42] Municipal Code chapter 15.0 6 [37:43] can amendments to the [37:45] California energy and green [37:46] building codes related to [37:48] building decarbonization [37:50] energy efficiency and public [37:51] health to meet the city of [37:52] Oakland's rhesus resource [37:54] conservation and climate [37:56] goals. Repealing the city of [37:57] Oakland's local amendments to [38:00] the 2022. Edition of the [38:02] California Energy Code and the [38:02] 2022 California Green Building [38:06] Code. At Owen's the chapter [38:09] 15.0 4 part 6 and part 11, him [38:11] in a straight of in technical [38:13] amendments and adopting [38:13] appropriate sequel. Findings [38:16] and exemptions. And a [38:17] resolution of finding [38:19] supporting an emergency [38:20] ordinance adding Oakland [38:24] Municipal Code chapter 15.0 6 [38:24] Oakland amendments to the [38:26] California energy in Green [38:28] codes related to the [38:28] decolonization energy [38:31] efficiency and public health. [38:32] To me, the city of opens [38:34] resource conservation and [38:36] climate goals. Repealing the [38:37] city of Oakland's local [38:38] amendments to the 2022 edition [38:40] of the California Energy Code [38:43] and the 2022 California Green [38:44] Building Code. Don't see [38:47] Chapter 15.0 0, 4, part 6 in [38:49] part 11, administrative and [38:50] technical amendments in [38:51] adopting appropriate secret [38:53] findings. And just knowing [38:56] that item 2006.1 season, part [38:58] one is an emergency ordinance. [38:59] If adopted, it will be [39:00] approved, introduced and [39:02] approved on the same day. [39:03] Thank you. Please place. 3 [39:09] minutes on the clock. [39:11] >> Jenkins in MAY, please. The [39:13] council. I'll be very brief [39:16] and turn over the content [39:17] presentation technically to [39:17] interim chief building [39:21] official says then went But [39:22] this is a context for those of [39:24] you who have served on this [39:25] council on through our [39:25] previous cycles of building [39:28] Code Amendment. You know, [39:29] faced with very different [39:31] scenario than we've had. [39:31] Historically, we typically [39:34] have the had the opportunity [39:36] until the following JANUARY [39:37] 1st to review codes that were [39:38] issued in the summer for us to [39:41] review for amendment. And we [39:42] have operated for three-year [39:45] cycle for those renewals. [39:45] >> At the end of JUNE, [39:49] amendment was made at in [39:51] Sacramento that has now placed [39:53] a 6 year window. So instead of [39:53] having every 3 years to [39:54] examine our codes, that's been [39:57] extended to 6 years. We also [39:59] have been given a date of [40:00] SEPTEMBER 30th as opposed to [40:03] DECEMBER 31st of JANUARY. 1st, [40:05] SEPTEMBER, 30th, the end of [40:07] this month to adopt this code [40:09] with any local amendments that [40:10] are specific to Oakland. And [40:11] as many of you know, we have [40:11] some very specific conditions [40:15] here that we use to amend our [40:16] code. I'm going to turn this [40:18] over to them but I just wanted [40:19] to make sure that you are [40:20] aware of the urgency and the [40:23] situation place. The sand [40:24] because we did not receive [40:25] copies of the code until the [40:26] summer. We were not in a [40:27] position even to bring this [40:29] before you as we was in place. [40:31] So we along with other [40:31] municipalities within the [40:32] state are under a very keen [40:34] sense of urgency. If we want [40:37] to get our amendments, I [40:38] submitted to the state by [40:38] SEPTEMBER 30th. We need to [40:40] take action at this meeting. [40:44] So appreciate you for your [40:45] consideration. And again, we [40:46] had more time, but that's the [40:46] situation which we find [40:54] ourselves. Thank you. [40:56] >> Good Honorable Council, [40:56] PRESIDENT Jenkins and members [41:00] of the City Council has [41:00] already stated my name is a [41:02] silly and we align. I'm [41:02] currently the interim building [41:05] official for the Planning and [41:06] building bureau. I'm here [41:08] again today to present to you. [41:13] Our adoption of the 15. 0, 6, [41:14] energy conservation code. It's [42:22] >> Through [42:23] >> adoption of baby one 30 are [42:25] could cycle now has changed as [42:25] already mentioned that we used [42:26] to have sometime before [42:29] DECEMBER 31st to adopt our [42:30] coat. That time has since been [42:33] expedited to meet a cut off of [42:34] SEPTEMBER. 30th. So we are [42:37] here today to present to you. [42:37] Some of these changes affect [42:42] can next slide. Please. [42:43] >> This shows the adoption [42:44] timeline through the 2024 [42:45] trial. Could adoption cycle [42:52] next slide? We're looking to [42:53] adopt a chapter that head of [42:54] title 15 under the buildings [42:57] and constructions Omc. This [42:58] includes amendments to [42:59] California, energy and green [43:01] coats with a goal to establish [43:02] pathway to meet the city of [43:04] Oakland's equitable climate [43:05] action plan is already mention [43:07] and the environmental justice [43:09] element of the general plan [43:09] for new construction to [43:13] introduce new measures, 2 [43:14] existing residential buildings [43:14] and ongoing alterations next [43:19] slide. Some of the highlights [43:21] of the California Energy code [43:22] includes stab wishing high [43:22] performance standards for new [43:24] construction. Using energy [43:26] modeling metrics er and source [43:28] energy to strongly incentivize [43:29] all-electric designs. Any [43:31] lawful trouble manner. It also [43:33] includes residential building [43:34] alterations with a permit [43:35] valuation of over 25,000. That [43:36] would require the [43:40] implementation of practical [43:40] cost-effective, [43:41] electrification and efficiency [43:42] measures of from a flexible [43:50] menu of options. Next slide. [43:51] In addition, essential in [43:52] operations for the permanent [43:54] mission of over 25,000 will [43:55] require implementation of all [43:57] mandatory measures because the [43:58] project ad, but the project [43:59] type adding condition space [44:01] volume or science, and it [44:03] would require new [44:05] constructions new construction [44:06] to utilize copy mix. Isn't [44:09] that do not exceed a specified [44:09] maximum global warming [44:13] potential or twp limit? Any [44:17] questions? [44:28] >> Thank you so much. [44:30] >> So this is separate from [44:31] the fire right when when is [44:31] the fire code adopted? Are [44:34] they connected at all? [44:35] >> They they are connected [44:38] through 15. 0, 4, could option [44:39] process. So when will the fire [44:43] could be up for? That should [44:51] be a part defer to her Fire [44:52] Prevention bureau will be [44:53] front. Will be bringing that [44:55] forward for adoption for their [45:02] code. Thank you. Of course. [45:06] Thanks. Council PRESIDENT. So [45:10] just 2 quick questions. [45:11] >> I noted the importance in [45:12] the report on natural gas. And [45:15] and the way that natural gas [45:17] can create fire risks. Can you [45:18] speak a little bit more about [45:20] how we're approaching? You [45:22] know what facilities have [45:25] natural gas or using them How [45:26] are we going to be approaching [45:30] just? You know, for moving [45:31] those and conversion to [45:35] electric facilities. [45:36] >> Absolutely. I'm going to [45:39] actually bring up that will [45:40] assist us in answering some of [45:48] the stand-up of question [45:50] council PRESIDENT. [45:51] >> When a machine or field [45:53] goal acting state, a new [45:54] director, sigh. Can you hear [45:57] me now? [45:58] >> Good morning. Acting [45:59] sustainability director in the [46:00] city administrator's office [46:04] Hurstville Gold. [46:05] >> And the question was in [46:07] regards to how we are hoping [46:08] shift to a financial accounts. [46:11] Yes, correct. So, of course, [46:12] the city itself does not [46:16] produce our own incentives and [46:17] rebate programs. We partner [46:22] very closely with pg e the Bay [46:23] Area, Regional Energy Network, [46:24] the statewide tech program [46:25] which is funded through this e [46:29] e c. And and many others in [46:31] addition to working closely [46:34] with local nonprofits. [46:35] >> And workforce development [46:37] providers like Rising Centre [46:37] for Auburn to nutty any [46:39] college and others to make [46:44] sure that we do have robust [46:45] energy efficiency first and [46:46] foremost and electrification [46:50] programs available to Oakland [46:51] residents, landlords and [46:55] tenants very importantly. As [46:57] well as small businesses and [46:59] others to make sure that the [47:03] education, the awareness out [47:04] there, that incentives are [47:05] getting first and foremost to [47:06] those who need them most and [47:06] who would benefit from the [47:10] most. The city's equitable [47:11] climate action plan, which [47:15] council adopted in 2020. [47:17] Starts with the word equitable [47:21] because we do recognize that [47:23] avoiding displacement of [47:25] residents and businesses has [47:29] to be first and foremost. [47:29] Alongside the fact that the [47:32] continued use of natural gas [47:34] exacerbates the climate crisis [47:36] and worsens health outcomes. [47:38] Particularly among those who [47:40] can, you know, afford to have [47:44] you know, poor health, the [47:45] least right. So so we kind of [47:48] bring all this together, the [47:48] sustainability and resilience [47:49] division and the cao does [47:53] coordinate across departments. [47:54] As well as with outside [47:56] agencies like pg need to make [47:57] sure that we are bringing all [48:01] of these incentives and [48:03] resources capacity to all of [48:05] our departments. Couple of [48:05] examples. We worked very [48:06] closely with our housing [48:07] Community Development [48:10] Department couple years ago to [48:12] do staff training and to bring [48:12] additional funds into our [48:16] residential lending program to [48:19] better incorporate [48:19] electrification measures into [48:21] our access and safety program. [48:26] For low-income homeowners. My [48:28] our our group work very [48:29] closely Cecilia Huertas and [48:32] her team and, you know, [48:35] putting together these could [48:36] amendments to make sure again [48:38] that there is maximum [48:40] flexibility while we're [48:41] enabling residents and [48:43] businesses and property owners [48:45] to prepare for regional [48:46] requirements that are coming [48:49] soon. Send 2027 for the bear. [48:50] Credit Quality Management [48:55] District gas powered water [48:55] heater that breaks down. We'll [48:58] have to be replaced with the [48:59] heat pump or somewhere you [49:00] will not be able to replace a [49:04] failed gas water heater with a [49:06] gas appliance and 2029. Same [49:08] thing for hvac. So gas furnace [49:09] fails. You can have replace it [49:13] with the heat pump. And the [49:16] requirements go on and time. [49:17] And the last that Oaklanders [49:19] can afford is to be ill [49:21] prepared for those [49:21] requirements. And so these [49:26] code amendments were very much [49:27] constructed with with that [49:28] that flexibility and that part [49:29] ration that awareness and [49:34] mind. Does that It does. And I [49:35] my next thing is just really [49:36] more of a comment. But it says [49:37] under fiscal impact that you [49:38] all have. [49:41] >> The performance standards [49:42] actually ensure that the [49:43] all-electric construction is [49:45] going to be the most [49:47] economically advantageous [49:48] pathway. And so I think that's [49:49] great because we don't want to [49:49] inadvertently drive up the [49:51] cost of housing. So thank you [49:59] for the work. Thank you. Well, [50:01] I just wanted to first just [50:03] gratitude the planning and [50:04] building department for moving [50:05] so quickly with the really [50:07] short turnaround time. [50:08] >> Just wanted to thank you [50:10] for that. I have 2 questions. [50:11] The first one has to do with [50:15] Page 5 of the report. Can you [50:17] all provide some examples of [50:18] what you think would be the [50:22] immediate cost impacts of some [50:26] of alterations in to the re [50:27] requirements around different [50:30] types of property renovations [50:30] just so that we can get an [50:31] understanding of what property [50:37] owners can expect. [50:38] >> That's a great question. So [50:40] when when we were looking [50:41] through the different pathways [50:42] by which somebody would be [50:43] compliant, we took that into [50:44] consideration. So one of those [50:46] things would be, you know, [50:49] what would be the most Abbott, [50:51] but the largest spend it or [50:51] for a property owners, [50:52] specifically one that is the [50:53] homeowner that doesn't [50:54] necessarily have the means to [50:57] be able become compliant. So [50:59] we added the 3 different paths [51:00] where they could choose a way [51:02] of compliance to this. New [51:04] ordinance. Some of those [51:05] things to consider would be [51:07] exactly what Shana said. You [51:08] know, the change out of water [51:11] heaters and furnaces. The cost [51:13] of fact that those MAY have [51:16] and being able to really gage [51:17] what that impact would be. And [51:19] we found it just across the [51:20] border through our research [51:20] with other municipalities that [51:22] that would be the most minor [51:23] change for those specific [51:27] change out. [51:28] >> And then how did Steph [51:30] decide on the energy [51:31] efficiency standard for a new [51:32] residential buildings? And [51:38] then that's on page. 22. [51:40] >> Yes. We looked through our [51:41] our partner municipalities [51:43] that have been going through [51:44] the same process to again, [51:47] find a pathway by which we [51:49] then come in. And Taylor. [51:50] Obviously looking at what they [51:52] MAY have seen already has an [51:54] impact. We were able to get [51:57] herself spy. What was most [51:57] cost-effective being the first [51:59] and foremost and what could be [51:59] reasonably implemented with [52:03] less impact to that property [52:03] owner. [52:05] >> I see. And so with the [52:06] changes that you making, it [52:07] sounds like what I'm hearing [52:09] is that there's a lot of [52:10] comparison to what other kind [52:11] of local jurisdictions are [52:13] doing. That's correct. All [52:21] right. Thank you. I just want [52:22] to state for the record. I [52:24] hate this new system. [52:31] Microphones second, it. [52:31] >> I [52:32] >> One of the questions was [52:33] answered by council member [52:35] wants question about the fit [52:37] financial impacts on [52:38] affordable housing. So I [52:38] appreciate that information. [52:42] But I want to know, do you [52:45] have any why the state changed [52:46] their policies that are [52:49] rushing us to get through our [52:50] amendments faster than the [52:51] they've been done in the past. [52:52] Like, what's the rationale [52:53] behind that? And then what's [52:54] the consequence for the city [52:56] of Oakland? If we don't? [53:01] Actually meet that timeline. [53:04] >> Through the PRESIDENT, [53:05] Councilmember 5. Yes, the [53:08] state wanted to provide more [53:09] robust, quicker way of going [53:12] through the development [53:13] process. So in their mind [53:14] said, being able to go through [53:16] the codes, really look at them [53:17] again or changes in before [53:18] SEPTEMBER, 30th to see what [53:21] was working at 22 code cycle. [53:22] What would work in the 2025 [53:23] code cycle that would give us [53:24] an opportunity to bring forth [53:27] those changes or amendments so [53:28] that we can get him in for the [53:31] next 6 years. So the whole [53:32] idea was trying to streamline [53:32] our development process, make [53:39] it easier. [53:40] >> From MAY also to the chair [53:43] for PRESIDENT. Accounts. We [53:44] also only for city attorney's [53:44] office MAY be able to speak to [53:45] some of that as well. Lot of [53:49] us had to do with the timing [53:52] where it typically to cycle [53:53] through. Later it was put with [53:53] That's the change with this [53:57] JUNE adoptions. So that also [53:59] squeeze things in terms of the [54:00] reasons behind them. The full [54:03] range of motivation. Again, we [54:04] would have to confer [54:05] legislators on that. But I'll [54:06] this over to the turning [54:10] Murray. [54:11] >> Good morning, Brian Murray [54:14] from the city attorney's [54:16] office looking at the [54:17] legislation. It is pretty [54:18] clear it's only applying to [54:19] residential buildings. And [54:20] what they're trying to do is [54:21] create the state legislature [54:22] trying to create certainty for [54:25] residential home builders. [54:26] Because there's, I think, been [54:26] some complaints among the [54:29] residential home builders that [54:30] each locality has different [54:31] requirements and that's making [54:33] it much more difficult to [54:34] build residential, you know, [54:37] to build housing. So what the [54:38] state has done and said, we're [54:38] going to just freeze the [54:39] building code as a residential [54:41] buildings for 6 years. But [54:44] they've given local [54:44] jurisdictions until SEPTEMBER [54:45] 30th to bring any local [54:46] amendments. They want to [54:50] bring. [54:53] >> Yes, again to the council [54:53] to the council, PRESIDENT [54:54] Council defacto what that [54:58] would do tend to normalize the [54:59] code, the building code across [55:00] jurisdictions. So again, [55:01] there's a little bit more [55:02] predictability from one [55:03] jurisdiction to the other. [55:05] >> Give this rate hike time [55:05] frame in which we all have to [55:06] adopt amendments. So that's [55:13] also an outcome. [55:16] >> And if I MAY also going [55:16] through this process also [55:19] allows ability implement reach [55:20] codes that allow us to meet [55:23] our our climate goals for the [55:24] city. [55:25] >> Wonderful my lap. The last [55:26] piece of my question was, [55:26] what's the consequence if we [55:27] wouldn't need if we didn't [55:31] meet that timeline? [55:31] >> We did meet the timeline [55:32] that we wouldn't be able to [55:34] look at the new model code [55:36] cycle, the 2025 coats to [55:37] implement those for over the [55:44] next 6 years. [55:45] >> Councilmember Guy, thank [55:50] you. Can hear me. Okay. When I [55:50] Director Gil, Chris, first of [55:52] all for the information and [55:54] certainly from the federal to [55:55] the state to the county and [55:56] city level. We're seeing many [55:59] changes when it comes to what [56:00] we do at home energy wise and [56:02] just an example, I had a [56:04] couple people come knock on my [56:07] door saying that I'm eligible [56:07] and qualified for the solar [56:11] panels on my roof. Right. And [56:13] I know years ago we establish [56:16] surgeons areas soanes and [56:17] certain locations to do the [56:21] solar energy so for that, I [56:24] guess what I'm asking my [56:25] question is, do are we [56:26] providing this information to [56:30] the public? And are there [56:31] certain areas within East [56:35] district that qualify for the [56:36] funding for the implementation [56:38] of these people knocking on [56:41] our doors saying they're the [56:43] with this company eligible x, [56:43] y z and knew I wasn't even [56:46] aware of it. And so are we [56:47] providing that information [56:54] directly? Our communities. And [56:54] secondly directed Gilchrist. [56:57] Do we have to staffing [56:59] available? So when we do send [57:01] developers and business people [57:03] downtown, there's someone [57:05] there to respond and answer [57:08] their questions provide this [57:08] information. Those are my [57:12] questions to you. Go first and [57:14] take them a little out of [57:16] order. And in terms of the [57:17] staffing you know, that's [57:18] always a challenge that we're [57:21] working to recruit and get [57:22] more people. We will be [57:23] looking at the task level. [57:25] What it is going to take for [57:26] us to meet this goal. Staff [57:26] will know it's their [57:28] responsibility to provide [57:30] information [57:31] >> and specific to the energy [57:32] code Information. I'm gonna [57:33] also defer to Sheena who can [57:34] speak directly about that. But [57:35] we will definitely have. That [57:39] is part of the assignment. And [57:40] on our regular updates around [57:42] budget submittal staff, needed [57:42] cetera. We will certainly make [57:45] you aware of any gap or any [57:45] capacity assistance that we [57:46] need to make sure we're [57:49] hitting a performance. Mark. [57:51] So the council will clearly [57:51] know within their district. [57:53] What areas would locations? [57:55] >> Or what type of housing [57:57] eligible to receive the [57:59] energy. And I will defer to my [58:00] colleague to respond to that. [58:01] Okay. Thank you. That's [58:02] extremely important. Because [58:05] like understood. 2 different [58:06] companies knocked on my door [58:07] eligible and I wasn't even [58:10] aware. Because not no one in [58:13] the neighborhood had when part [58:14] of this whole process. Thank I [58:17] threw the chair. [58:21] >> They're as I said before, [58:22] there are a lot of incentive [58:22] programs out there understand [58:23] that. There's also a lot of [58:26] confusion and particularly for [58:28] >> older folks get and which [58:31] is not you, of course. But for [58:33] example, my who I love with [58:34] has answered the door many [58:35] times and there's somebody [58:36] there saying, hey, I have a [58:38] free product for you and she's [58:38] texting me. One network saying [58:44] is this legit? [58:44] >> So [58:45] >> very much understand the [58:47] concern of needing to make [58:49] sure that, you know, folks in [58:49] your in your district are [58:53] aware of what's available. [58:55] With current staffing [58:56] constraints, we have had to [58:57] make some tough decisions [58:59] about allocating allocating [59:01] our staff time. [59:02] >> You know. [59:05] >> 2. [59:06] >> For example, policy versus [59:07] planning versus public [59:10] outreach and engagement. Our [59:11] team does, however, work very [59:15] closely with the citywide [59:16] communications team, the [59:18] citywide engagement working [59:19] group and through our own [59:20] direct communications. We have [59:24] a monthly newsletter. Where [59:25] we're trying to get the word [59:28] out. We're also connecting [59:31] local organizations, for [59:32] example, organizations like [59:33] Rising Suns Center property, [59:34] which I mentioned great [59:34] alternatives, which MAY have [59:38] been somebody reaching out to [59:41] you as well implement ERs of [59:43] pg Power. My home. Which is an [59:47] incredible program. We are [59:50] working to connect those with [59:52] local nonprofits. They the [59:54] some of the implementer is of [59:55] of those pg e funded programs [59:57] have been showing up at the [1:00:01] town nights programs over the [1:00:03] summer, making sure oaklanders [1:00:03] that family is ineligible [1:00:05] neighborhoods are where of [1:00:06] those programs we could [1:00:10] definitely do a better job and [1:00:12] our our team has been working [1:00:13] on a better schedule and [1:00:15] better format to kind allocate [1:00:19] are scarce time. For the [1:00:20] communication channels that [1:00:21] make the most sense. One of [1:00:21] the things we're trying to do [1:00:25] a better job with is sending [1:00:26] monthly announcements to your [1:00:27] offices so that you can in [1:00:32] turn pass a salon. I will say [1:00:34] that powerful neighborhoods [1:00:35] and empower my home are 2 [1:00:36] really important programs [1:00:39] happening right now. Those are [1:00:40] utility rate payer funded and [1:00:42] they are specifically focused [1:00:44] on energy efficiency and [1:00:47] electrification in [1:00:48] lower-income neighborhoods. [1:00:48] >> Thank you. And make a [1:00:53] motion to approve [1:00:54] >> We have a motion that we [1:00:54] need to hear from the public [1:00:56] speakers. So will. Will hear [1:00:58] your motion. Councilmember [1:01:02] Houston. [1:01:03] >> Yeah, just want to just a [1:01:05] little bit of clarity in [1:01:06] piggybacking on Kesennuma [1:01:07] guidance about that threshold [1:01:11] at 25 k I wanted to find out. [1:01:12] Is it a grace period after [1:01:14] that Code amendment and and [1:01:17] and our seniors, this test? [1:01:17] You know, I get the cost [1:01:19] seniors about this. Can you [1:01:21] guess I'm just a little bit [1:01:24] more clarity and then on the [1:01:25] is there Grace period on that [1:01:31] code amendment that? [1:01:34] >> So as we move forward [1:01:35] through through the Press [1:01:37] Council, Councilmember [1:01:38] Houston, what we will be doing [1:01:41] is shooting out information to [1:01:42] the mast, the community [1:01:42] members so that we make [1:01:43] everybody aware that these [1:01:46] changes are up and coming that [1:01:49] way, there is enough time to [1:01:50] prepare equally. You know, as [1:01:51] we move forward, we're going [1:01:53] to do our best provide that [1:01:54] information. We'll be tapping [1:01:56] into resources chain as well [1:01:57] to see if there's anything out [1:01:58] there that we can assist our [1:01:58] community with this. Well. [1:02:04] Keeping that in mind. [1:02:05] >> From a gun to the [1:02:06] PRESIDENT. Real quickly to [1:02:09] counselor Houston and [1:02:09] Councilmember Gallo, excellent [1:02:10] points on communication and [1:02:13] getting word out there. What I [1:02:14] will say also and I think [1:02:15] that's a good last several [1:02:15] months. We've been working [1:02:16] much more closely with the [1:02:18] public information office. [1:02:21] Also out of the CEOs office. [1:02:22] The group has really been [1:02:23] focusing us on ways to get our [1:02:26] message out better to the [1:02:27] community. So we MAY in [1:02:28] addition to having the kind of [1:02:29] direct outreach to [1:02:29] organizations in the community [1:02:33] is your guiding. We also use [1:02:35] our Web pages and that we also [1:02:36] use public information through [1:02:37] sponsored announcements to the [1:02:39] media to make sure that people [1:02:41] are aware. But we do know [1:02:42] think one of the big [1:02:43] challenges in focus as we have [1:02:46] just, you know, it's a culture [1:02:46] among ourselves. It's a good [1:02:47] word out just because we know [1:02:48] something does not mean [1:02:50] everybody does. And to really [1:02:51] look at all the ways in venues [1:02:52] that people can be made aware [1:02:54] of this. So even if you're [1:02:55] coming in the 4 permit for an [1:02:56] appointment and this MAY not [1:02:58] be your thing. We could have [1:02:58] information up there so you [1:03:08] can learn about it anyway. [1:03:09] >> quick question when when [1:03:13] approximately will you have [1:03:13] information for the public [1:03:14] either on the website or as a [1:03:15] one pager about the changes [1:03:27] people start make to make. [1:03:28] >> Through the council, [1:03:31] PRESIDENT Council member from [1:03:32] Chandra and immediately after [1:03:33] this is approved, that's [1:03:35] typically the way that we try [1:03:35] to get the information out [1:03:38] soon as possible. Well, star [1:03:39] meeting together and getting a [1:03:39] plan in place to get that [1:03:48] information out. [1:03:49] >> When on the Web site so we [1:03:53] can send the word to our [1:03:53] constituents. [1:03:54] >> Yes, absolutely. And just [1:03:54] for awareness, this would go [1:03:55] into effect JANUARY 1st. Thank [1:04:02] We have [1:04:03] >> And I'll second council [1:04:09] member. I think Councilmember [1:04:15] guys motion. Let's go to the [1:04:17] public speakers moving to the [1:04:18] public speakers as I call your [1:04:18] name, please approach the [1:04:19] podium in any order. Please [1:04:21] state your name for the record [1:04:22] before beginning. [1:04:22] >> The rise and raise your [1:04:23] hand so I can easily identify [1:04:34] you. This is And Sam Fishman. [1:04:39] >> I get an all-electric home. [1:04:40] There's a probability I still [1:04:40] have to deal with men in the [1:04:43] water lead in the paint, [1:04:46] asbestos pcb has its soil [1:04:47] contamination and air [1:04:51] pollution. So we fix this. But [1:04:52] look at the magnitude of what [1:04:53] we have to deal with in terms [1:04:57] of some health issues. What [1:05:02] confuses me is that the state? [1:05:03] >> says that that there's a [1:05:06] statement that this adverse [1:05:06] impacts associated with the [1:05:07] heist. And it's I don't know [1:05:08] if y'all addressed what those [1:05:11] are. You dealt with the coast. [1:05:17] Cost impact. It also says that [1:05:19] you not proposing all-electric [1:05:20] requirements for new all [1:05:22] existing buildings within the [1:05:23] city. You are preparing [1:05:29] amendments. 4 buildings in the [1:05:30] future float electrification [1:05:36] changes. You're not really [1:05:36] doing anything right now. So [1:05:38] when is the future identify [1:05:40] the also have 40% of Oakland [1:05:45] buildings. Word start a built. [1:05:50] Before 1940, 40%. So depending [1:05:52] on the age of the building, [1:05:55] will the cost change related [1:05:58] to what is required for this [1:06:00] to have buildings to be [1:06:00] electrify. Didn't the race and [1:06:03] equity statement? What is a [1:06:06] frontline community? Because [1:06:07] you say you address an [1:06:08] affront. You almost like you [1:06:09] had was something the front [1:06:10] line. What does it mean that [1:06:15] you on the I mean, you created [1:06:15] right is you don't want to [1:06:19] say. Certain things like this [1:06:20] is for black people on this is [1:06:23] fall. Asian people get is the [1:06:27] frontline community. And [1:06:28] anybody wants to give me a [1:06:28] clue as to what that means. Be [1:06:42] happy to listen. [1:06:42] >> Morning Council members, [1:06:43] thank you for the opportunity [1:06:46] to speak. My name is Sam [1:06:47] Fishman. I'm a sustainability [1:06:48] and resilience. Policy manager [1:06:51] with the organization Spur. We [1:06:53] have a focus on the carbon [1:06:53] eyes the Bay area's buildings [1:06:57] that have been working with [1:06:57] cities throughout the region [1:07:00] as well as the air district on [1:07:01] policies to help the region to [1:07:03] carbon eyes equitably and [1:07:06] affordably. I think that this [1:07:07] is a really important step [1:07:11] towards that goal in Oakland. [1:07:13] As she mentioned, the Bay Area [1:07:14] Air district will be [1:07:15] implementing rules that will [1:07:16] begin phasing out gas [1:07:18] equipment in the Bay area. And [1:07:20] what these amendments do is [1:07:21] really make sure that that [1:07:23] happens in a planned and [1:07:25] cost-effective way. What we've [1:07:28] seen is that the [1:07:29] electrification or building [1:07:31] retrofits for efficiency and [1:07:32] electrification are more [1:07:35] expensive and more difficult [1:07:36] when they happened at the time [1:07:38] of a burnout of equipment. And [1:07:42] when the home is not already [1:07:43] taken, some measures putting [1:07:44] in wiring making sure their [1:07:46] ducks are more efficient. If [1:07:46] those measures have been [1:07:49] taken, customers end up with [1:07:53] more complicated issues. These [1:07:54] is exactly the kind of [1:07:55] amendment that make sure that [1:07:56] when work is happening on [1:07:57] buildings, when new buildings [1:07:59] are going up, they're ready to [1:08:02] be electrified. They're ready [1:08:06] to ensure that there energy is [1:08:06] being captured and kept [1:08:09] efficient within the building. [1:08:12] So this is I think, a common [1:08:12] sense proposal provides a lot [1:08:13] of flexibility to so that, you [1:08:15] know, different housing types [1:08:17] with different problems can [1:08:18] pick from this menu of option, [1:08:21] which I think city really put [1:08:23] together in a careful and [1:08:25] considered way and that can [1:08:29] ensure that that specific [1:08:31] buildings needs can be met and [1:08:31] that homeowners aren't forced [1:08:32] to do something that's more [1:08:33] expensive or that maybe [1:08:34] doesn't make sense for their [1:08:36] home. So I thank you for your [1:08:37] time and for considering this [1:08:39] very important and impact full [1:08:42] set of amendments. Thank you. [1:08:42] >> Thank Does that conclude [1:08:44] our public speakers? What is [1:08:53] frontline community? [1:08:55] >> I threw council PRESIDENT. The [1:12:52] California building code. [1:12:53] >> take an account, tap a [1:12:55] graphical geological and [1:12:55] climatic. [1:12:58] >> Changes. Next slide. [1:13:02] Please. The California [1:13:03] building codes are updated [1:13:04] every 3 years by the state [1:13:05] State Building Standards [1:13:08] Commission California, [1:13:08] building codes are based on [1:13:09] the Coats issued by the [1:13:10] International Code Council as [1:13:11] they are model through their [1:13:13] model Coats. The International [1:13:15] Association of Plumbing and [1:13:16] Mechanical officials and [1:13:17] National Fire Prevention [1:13:20] Association. Local [1:13:21] jurisdictions in these coats [1:13:24] to be more restrictive due to [1:13:26] specific geological top, a [1:13:27] graphical in climatic [1:13:32] conditions. Next slide. [1:13:33] Through the adoption of baby [1:13:35] one 30 or 2025 codes became [1:13:39] published on JULY. First 2025. [1:13:40] With that. The effective date [1:13:40] of JANUARY. First 2026 because [1:13:45] of this change. Jurisdictions [1:13:46] now have a more expedited [1:13:47] timeframe for adoption. We're [1:13:48] used to be 6 months to be able [1:13:53] to adopt these amendments. How [1:13:54] could is related to [1:13:56] residential buildings will be [1:13:56] subsequently frozen and till [1:13:59] 2031 given a six-year freeze [1:14:03] on code adoption. Maybe one 30 [1:14:04] for much better collaboration [1:14:05] between state agencies and [1:14:06] local jurisdictions to [1:14:09] facilitate development process [1:14:10] as well provide streamline and [1:14:11] improve permitting process for [1:14:11] board affordable housing [1:14:15] projects. Which then allowed [1:14:18] for urgency in being here [1:14:18] before you today to be able to [1:14:19] present these to you next [1:14:24] slide. Once again. This here [1:14:27] is a timeline that the [1:14:28] California building standards [1:14:28] commissions puts together for [1:14:29] cities under the state of [1:14:30] California so that they can [1:14:32] themselves to coat adoption. [1:14:35] Keeping in mind that this year [1:14:36] special in the sense that we [1:14:37] had an urgency based on a b [1:14:39] one 30 in its adoption. Next [1:14:45] slide. Please. Chapter 15. 0, [1:14:49] 4, Represents the following. [1:14:50] Oakland amendments. We're [1:14:52] looking to establish peace and [1:14:53] electronic document submittals [1:14:54] to our administrative [1:14:57] amendment process. And [1:14:58] simplify permit application [1:15:02] procedures and process On the [1:15:03] technical side, we're looking [1:15:05] to establish creating a very [1:15:06] fat high fire severity zone [1:15:09] provisions. We're looking to [1:15:10] adopt California residential [1:15:10] Code sound separation [1:15:14] criteria? As well as adopt the [1:15:15] California Essential Co tiny [1:15:18] homes provisions. Establish [1:15:19] higher standard seismic design [1:15:22] provisions. And adopt an [1:15:26] emergency housing provisions. [1:15:26] For our development here in [1:15:28] Oakland. Next slide. Please. [1:15:45] Thank you for your time. Thank [1:15:46] >> The sides mentions [1:15:46] something about making the [1:15:47] permit process simpler. Could [1:15:51] you explain? Of these Code [1:15:52] Amendment Clements would make [1:15:57] the permit applications. [1:15:58] >> Looking at new could option [1:16:01] every try annual cycle when [1:16:02] the codes are being developed. [1:16:05] We look efficiency of [1:16:05] procedures for could adoption [1:16:07] buildings, code amendments and [1:16:10] such being able to look at the [1:16:11] 2025 coach, we often find [1:16:15] pathways for approval and [1:16:16] >> ways that one could then [1:16:17] bring forth their development [1:16:18] project. That would be much [1:16:20] easier and turn making it [1:16:21] easier for the development [1:16:24] community to submit those to [1:16:26] permitting process. Given [1:16:28] these provisions in the [1:16:28] amendments. It allows us to [1:16:32] look at what I am property [1:16:33] owner or developers proposing [1:16:35] work with them to find a [1:16:35] better pathway for approval of [1:16:42] the project. Thank you. [1:16:42] >> right, seeing no more [1:16:49] comments from the can. Cause. [1:16:56] I'm okay. Do we have to be [1:16:58] able to implement the new [1:17:03] Construction Co. So we have to [1:17:04] staffing available business [1:17:04] developers and so forth. And [1:17:05] that's the requests that I [1:17:08] get. I have to come to your [1:17:09] office. But the developer to [1:17:11] make sure that we get there. [1:17:12] Prop there. [1:17:12] >> Papers process in terms of [1:17:16] development. Do we have the [1:17:17] staffing available? Are they [1:17:19] here Monday through Friday and [1:17:20] sitting at City Hall where [1:17:21] they can come in, get their [1:17:25] permits. [1:17:26] >> Yes, through the PRESIDENT [1:17:28] Of the council Councilmember [1:17:31] Guy. Yes, we have in recent [1:17:31] months made changes to our [1:17:32] staffing and availability had [1:17:35] a front counters. So we do [1:17:36] have staff available 5 days a [1:17:38] week that could assist our [1:17:38] development community on [1:17:39] property owners when they come [1:17:42] into summit for their [1:17:42] projects. [1:17:43] >> Get in for the public's [1:17:46] information. That information [1:17:47] also available online. You can [1:17:48] go online, do the paperwork or [1:17:50] come to city Hall. That's [1:17:51] correct. Yes, thank you. Thank [1:17:59] you. Thank you to the chair. [1:18:00] Your slides that something [1:18:03] about tiny homes is that [1:18:04] basically build things [1:18:05] standard specially with [1:18:06] measure w coming up everything [1:18:08] for community cabin sites or [1:18:08] is that? [1:18:13] >> Like, you know? Those tv [1:18:15] shows that at that you see on [1:18:16] http on like tiny homes. Just [1:18:16] want clarification on what [1:18:21] that is. Exactly. Thank you. [1:18:22] >> I went through the [1:18:23] PRESIDENT Of the council. I [1:18:24] yeah. So it would it would [1:18:25] take into account anything [1:18:26] that would fall under the [1:18:26] provisions of what is [1:18:29] considered a tiny home. So we [1:18:30] have to look at we have to [1:18:31] look at exactly what that [1:18:33] means. Now, the state has [1:18:35] recently adopted in into their [1:18:36] appendix. So we're adopting it [1:18:37] as well so that we're able to [1:18:39] use that should be have this [1:18:40] is situation or an instance [1:18:41] where somebody is proposing [1:18:44] that as far as it being a [1:18:46] captain or temporary cabin? I [1:18:46] don't I don't think that that [1:18:47] seen 10 to the code. It's more [1:18:48] to provide provisions by which [1:18:50] it would be sustainable. [1:18:50] Housing that has built [1:18:53] adequately. All right. We'll [1:18:55] some. That sounds great. Thank [1:19:00] you. [1:19:00] >> Seeing no more comments [1:19:01] from the council members. [1:19:02] Let's go to the public [1:19:03] speaker. [1:19:13] >> Missus, saddle of [1:19:14] >> The document states that [1:19:18] you establishing permitting [1:19:18] requirements to ensure public [1:19:23] safety and accessibility. [1:19:25] >> So I just want to speak on [1:19:26] a level of with public safety [1:19:28] and accessibility is being [1:19:29] challenge. [1:19:30] >> When we are doing [1:19:32] remodeling in the community. [1:19:35] So when people all working on [1:19:37] these buildings. When they [1:19:39] tear down the structures, what [1:19:43] they're doing is taking. [1:19:44] You're eminence of what they [1:19:47] have taken down. And to our [1:19:50] community. Right now in [1:19:53] Keller, the about 25 bakes of [1:19:56] materials torn down [1:19:59] construction site. That's been [1:20:00] sitting there for 3 weeks. [1:20:05] What's Those elements? It [1:20:07] could be asbestos and could be [1:20:08] lead. Pcbs. [1:20:09] >> It could be mercury could [1:20:12] be mole. [1:20:13] >> And so we talking about [1:20:15] safety. You have to have a [1:20:16] permitting process that [1:20:20] requires the contractor once [1:20:22] he is taken down materials to [1:20:23] produce where those materials [1:20:27] have been brought. He's [1:20:28] supposed bring it when he pays [1:20:29] a fee or somebody pays the fee [1:20:32] and you get a receipt. That's [1:20:35] not happening. But all over [1:20:38] the city, we have a lot of. [1:20:39] Blight based on construction [1:20:47] work. Being dumped Oakland. At [1:20:47] and this is somewhat related [1:20:49] to but not exactly public [1:20:51] safety and accessibility. And [1:20:52] this is in front of schools. [1:20:56] It's in front of Holmes is on [1:20:56] private property. That's [1:21:01] that's happening. Do what you [1:21:02] gotta do. But at some point, [1:21:04] this has to be address. People [1:21:05] do have respect and [1:21:07] contractors don't want to pay [1:21:11] full, eliminating that debris. [1:21:13] And we have to make somebody [1:21:13] responsible for them doing it [1:21:19] the right way. [1:21:20] >> Does that conclude our [1:21:27] public speakers? Just had a [1:21:31] comment. I know I'm not [1:21:32] supposed speak to the public. [1:21:34] So speaking to you, PRESIDENT. [1:21:39] That's a wrap. People he's [1:21:40] dumping that trash that best [1:21:42] is that materials make sure [1:21:43] prosecuted to the full extent [1:21:46] of the law because it's a [1:21:47] crime against our community. [1:21:48] And that's what I stood on to [1:21:50] be elected for make sure that [1:21:52] happens. And that's a fact. [1:21:53] And is that a motion close the [1:21:55] public hearing? [1:22:12] Second? [1:22:16] >> And through the chair by [1:22:16] that's a motion or adopting [1:22:17] the item and closing the [1:22:18] public hearing. Yep, that's [1:22:20] what I heard. Thank you for [1:22:22] that clarification. Council [1:22:28] member Brown. Councilmember 5. [1:22:29] I just told you guys not to [1:22:32] get in the queue to let me run [1:22:32] through it because I Not [1:22:38] talking to you. Councilmember [1:22:40] Gallo. I councilmember [1:22:40] Houston. I councilmember [1:22:41] Ramachandran. I councilmember [1:22:45] under. Under Councilmember [1:22:52] won, I. Motion passes with a [1:22:52] vote of 8. I's noting that [1:22:56] item 3006.1 is an emergency [1:22:59] ordinance and will be [1:22:59] introducing adopted on the [1:23:00] same day. We're not ready for [1:23:03] prime time. And that does [1:23:04] conclusion. Public hearings [1:23:05] moving on to the not consent [1:23:08] portion of the agenda. Signed [1:23:12] with item 8. Adopt a [1:23:13] resolution accepting [1:23:14] inappropriate in grant funds [1:23:17] in the amount of 400, $70,000 [1:23:18] from the state of California [1:23:20] Office of Traffic Safety for [1:23:22] the fiscal year. 25 26 [1:23:24] Selective Grant enforcement [1:23:26] program to be administered by [1:23:27] the Oakland Police Department [1:23:27] and authorizing the use of [1:23:31] general purpose services but [1:23:34] to contribute at 2, $76,308. [1:23:37] I'm sorry, $328. So cover the [1:23:38] related central services [1:23:39] overhead costs. You have one [1:23:47] speaker on this item. [1:23:48] >> So we need to get you back [1:23:49] on the street. So we're going [1:23:50] to be 2 minutes. I appreciate [1:23:52] it, sir. That's all I need. [1:23:53] This is the same grant that [1:23:54] we've accepted from Office of [1:23:55] Traffic Safety for the last 20 [1:23:58] years for the city of Oakland. [1:23:58] It's designed for traffic [1:24:00] safety, traffic awareness [1:24:03] education as well. So we [1:24:04] participate in the every 15 [1:24:05] minutes program here in the [1:24:06] city of Oakland. We educate [1:24:10] the youth about drunk driving. [1:24:10] It's also dui checkpoints, [1:24:11] which is focal point of [1:24:14] awareness as well and also [1:24:15] traffic safety. Different [1:24:17] operations or around the city [1:24:19] of Oakland. We base all of our [1:24:20] locations where we do the [1:24:22] operations on the high injury [1:24:24] network. So we look at [1:24:25] collision data and we focus [1:24:26] our attention is there. So [1:24:27] it's spread out citywide or in [1:24:30] the city of Oakland. To the [1:24:36] parliamentarian. [1:24:39] >> Through the chair to the [1:24:40] body and 2 staff, the first [1:24:42] resolve class in this [1:24:45] resolution indicates I think [1:24:47] there's a typo did indicates [1:24:49] $500,000 and also $470,000. So [1:24:51] we can just confirm, I think [1:24:52] the correct amount is 470,000 [1:24:55] and in that case, yes And in [1:25:00] that case, when the body makes [1:25:01] a motion to adopt, if that's [1:25:02] the of the body, if you can, [1:25:03] can just correct that amount [1:25:08] to 470. [1:25:12] >> All right. See no comments [1:25:15] Thank you. I threw the chair. [1:25:20] Thank you so much for the [1:25:20] report. There was also [1:25:21] included around the [1:25:21] collisions, injuries and [1:25:25] fatalities. I. You know, I [1:25:28] think we all recognize that [1:25:30] traffic safety. It is real [1:25:32] issue here in It's definitely [1:25:33] something that I think we need [1:25:34] to to work on. I'm trying to [1:25:36] understand looking at this [1:25:38] report, it's alarming to me [1:25:43] that looking at the 2022 to [1:25:44] 2023 year to 2023 to 2025 [1:25:48] that. If I'm reading this [1:25:51] right, we went from 184 [1:25:52] victims in nighttime [1:25:53] collisions to poor 178, which [1:25:59] is at drastic increase. And I [1:25:59] love understand what happened [1:26:02] there what can we as a council [1:26:06] do to support tackling this [1:26:10] issue? Because as that is an [1:26:11] unacceptable rise. [1:26:12] >> well. As you know, the is [1:26:15] going through some issues now [1:26:16] with staffing. I'm here to say [1:26:17] bad news as well that the [1:26:19] traffic enforcement unit being [1:26:20] disbanded here at the end of [1:26:25] the week. So I don't know what [1:26:26] the future looks like. I can [1:26:26] only predict that maybe [1:26:28] collisions will go up with [1:26:31] losing this enforcement unit. [1:26:32] We're on the trend right now [1:26:33] for traffic fatalities to [1:26:34] probably be around 40 for the [1:26:37] end of this year. Usually [1:26:38] average between 30 32 sore [1:26:41] were up on that as well. So [1:26:44] anything you know, we can get [1:26:45] chp has been very helpful to [1:26:46] with patrol inner cities at [1:26:47] night. And I hope that [1:26:48] continues on for a while as [1:27:02] well. [1:27:18] >> Yes, through the chair. I'm [1:27:19] just curious if there's any [1:27:22] flexibility on. How these [1:27:23] funds are utilized. I know [1:27:28] part of it is for education. [1:27:30] Can any of it be used to [1:27:32] address some of the serious [1:27:35] issues that the city is [1:27:36] experiencing around rv's and [1:27:37] off-road vehicles on the [1:27:37] streets of Oakland by any [1:27:40] chance. [1:27:41] >> Part of the grant does [1:27:42] allow for an operation for [1:27:43] reckless driving. So we do [1:27:44] focus on that as well, too. [1:27:48] What does that look like? It's [1:27:49] camera, the exact dollar [1:27:51] amount that's allocated for [1:27:54] reckless driving. But we focus [1:27:55] on an area of like likes of [1:27:55] atv's around the lake is [1:27:57] probably what you're talking [1:27:58] about. Them so we put out it's [1:28:02] quiet out there to deal with [1:28:03] that for Forsman paid for by [1:28:05] this grant. So one even cause [1:28:06] open any money pay for the [1:28:16] grant. Understood. Thank you. [1:28:17] >> Moving to the public [1:28:25] speakers Mississauga all [1:28:26] >> so according to the [1:28:33] documentation. $450,000 will [1:28:34] cobble 15 different areas of [1:28:37] focus. It would have helped to [1:28:40] see each area the amount of [1:28:44] money dedicated to that area. [1:28:45] The area that I wanted to [1:28:48] probably see more emphasis on [1:28:52] spending, it says to Pacific. [1:28:54] 2 special operations [1:28:55] specifically on street racing [1:28:59] and sideshows. 2 operations. [1:29:02] This is a very serious area. [1:29:04] And I don't know if we could [1:29:06] have moved some spending [1:29:07] allowed to have more [1:29:10] concentrating on this area. So [1:29:11] that's why I thought that was [1:29:16] important. Then dealing with [1:29:20] dea, DUIs you're dealing with [1:29:23] traffic safety, drugs night [1:29:25] time. You have all different [1:29:26] areas. The one thing that I [1:29:30] was concerned about is who is [1:29:32] available for enforcement [1:29:36] because of shortage of staff. [1:29:38] Specifically who is going to [1:29:39] be we don't have I don't think [1:29:40] we even have any traffic [1:29:41] offices anymore. So how will [1:29:45] we? Manipulate this to work [1:29:49] based on shortage of staff [1:29:49] would be one of the questions [1:29:56] that concern to us. Well. [1:29:57] >> Thank you. As all of all of [1:29:58] that was all of the speakers [1:30:06] over 10, a motion. [1:30:09] >> that's an excellent [1:30:11] question. I'm a big was a big [1:30:12] supporter your motor second [1:30:16] squadrons years ago. And what [1:30:17] is our enforcement when it [1:30:20] comes to traffic? [1:30:21] >> Right now the whole [1:30:22] department is on mandatory [1:30:23] overtime for a force on the [1:30:24] weekends. So we have to do a [1:30:26] rotation of Saturday and [1:30:28] Sundays. So we already have [1:30:28] dedicated on the average [1:30:31] about. 30 cops on a Saturday, [1:30:34] 30 caps on Sunday, [1:30:35] specifically for sideshow [1:30:36] enforcement. We need every [1:30:38] Wednesday, 02:00pm. Look at [1:30:39] what the Intel report looks [1:30:40] like for the weekend. We just [1:30:41] start times for that to deal [1:30:45] with over the weekends also, [1:30:47] there's talk of a club detail [1:30:48] downtown after what happened 2 [1:30:50] Fridays ago in the morning. So [1:30:51] I think they're going start [1:30:52] doing extra enforcement of [1:30:55] that in 2. But that's [1:30:55] separate. And what this [1:30:59] Granite Hills we did right in. [1:31:01] We wrote this great. We didn't [1:31:01] have all of the mandatory [1:31:03] overtime for sites like we do [1:31:05] currently. So we did right [1:31:06] inside to operations, reckless [1:31:09] driving operations to cover. [1:31:11] And staffing is an issue. I [1:31:14] wish could say it wasn't when [1:31:14] I first started, I think we [1:31:15] had in our cops and we're [1:31:16] pushing around 6.15, [1:31:20] strikeout. I would like to see [1:31:20] a larger traffic enforcement [1:31:22] in the years to come. But [1:31:25] right now a lot of this [1:31:26] operations that's listed here [1:31:27] are all funded by over time, [1:31:28] which is 3rd party over time [1:31:31] doesn't cost the city money [1:31:32] and we need to have regular [1:31:32] officers work these events [1:31:34] too. [1:31:34] >> Make a motion to approve [1:31:43] the item. [1:31:45] >> On the motion moved by [1:31:46] Councilmember Guy a second by [1:31:49] Councilmember long and MADAM [1:31:49] Clerk. [1:31:50] >> Sorry to interrupt me. Does [1:31:52] that include the amendment [1:31:53] which would be to strike the [1:31:54] words $500,000 and at the [1:32:00] words, $470,000. [1:32:01] >> Just confirming that mover [1:32:01] in the second or a friend that [1:32:07] be. $500,000 beach removed and [1:32:11] it will be $470,000 Council [1:32:11] member Brown. [1:32:42] Adopt an ordinance providing [1:32:43] that barring of funds and the [1:32:44] issuance and sale general [1:32:45] obligation, bonds in an amount [1:32:49] not see. 300 million dollars [1:32:51] authorizing the issuance and [1:32:52] sale not to exceed 55 million [1:32:54] aggregate principal amount. [1:33:06] PRESIDENT Jenkins and council [1:33:09] members, David Jones of the [1:33:10] Treasury Bureau before you [1:33:11] this morning is the second [1:33:14] reading of the ordinance that [1:33:15] staff recommends council adopt [1:33:17] for the borrowing of funds and [1:33:18] issuance of general obligation [1:33:20] of bonds in the mount. [1:33:20] >> Not to exceed 300 million [1:33:25] dollars. And also 55 million [1:33:27] dollars and be funding bonds. [1:33:30] We came before you in JULY [1:33:32] with the first meeting at this [1:33:34] particular ordinance. And this [1:33:38] is basically just a formality [1:33:39] prove this ordinance for the [1:33:44] bombing of funds. We are [1:33:45] anticipating approximately [1:33:46] 78 million dollars to streets [1:33:48] and sidewalks, 15 million for [1:33:50] city facilities. And another [1:33:52] 180 million or so for [1:33:55] affordable housing. We are [1:33:59] anticipated to price this [1:33:59] particular transaction on [1:34:02] Tuesday, OCTOBER, 21st with [1:34:06] the expected close of [1:34:07] NOVEMBER. 4th of a perfect [1:34:16] answer. Any questions. [1:34:19] >> Yes, for the record. [1:34:22] Borrowing money from a bond to [1:34:25] for other activities. I mean, [1:34:26] we have legal support to be [1:34:29] able to do that. [1:34:31] >> Yes, particularly [1:34:32] transparent transaction has [1:34:34] been that it through outside [1:34:37] counsel. So legal experts have [1:34:38] already weighed in on the [1:34:39] legality, the bombing of the [1:34:41] funds as well as the refunding [1:34:44] of the 2015 bonds that were [1:34:48] issued. And we have some [1:34:49] savings that we can capture [1:34:52] that all the legal framework [1:34:53] for this point, particularly [1:34:56] fans, action is all is all his [1:34:58] own. Good go, if you will. So [1:35:01] outside legal counsel gave us [1:35:02] up. [1:35:03] >> Perhaps absolute 5 borrow [1:35:04] the money. That means someone [1:35:06] to replace it. Eventually. [1:35:06] Yes, you will be paying the [1:35:10] debt service for the next 30 [1:35:12] years. And these are general [1:35:13] obligation. Bonds and paid for [1:35:14] by ad valorem taxes. Is there [1:35:14] a timeline for me replace [1:35:17] Cent? Restructuring is for 30 [1:35:21] years. No, you know, the [1:35:23] reason I ask you, Stuart, [1:35:26] going through some serious [1:35:27] budget issues. Great. Want to [1:35:30] come back and be no. This will [1:35:30] not have Now have this is all [1:35:32] voter approved money. [1:35:33] >> That will be paid outside [1:35:35] the general fund. Some doubt. [1:35:35] All right. Thank you. Thank [1:35:41] you. [1:35:42] >> I understand. Thank you. [1:35:43] Thank you. Chair Jenkins [1:35:48] through the chair. Where families [1:40:15] gather for competition, [1:40:16] recreation, where future [1:40:16] champions lace up their [1:40:18] skates. Now, I know some of [1:40:20] you might think. [1:41:14] In short, the Oakland Mason [1:41:16] has been a cornerstone for the [1:41:17] city and with your support, it [1:41:21] can continue to shine not just [1:41:21] as a nation as a gathering [1:41:23] place for entire community. [1:41:25] I'd like to thank you for your [1:41:26] time. And let bring a little [1:41:33] chill to the meeting today. [1:41:34] >> Good Morning Council [1:41:35] members. My name is if are [1:41:35] best the business development [1:41:37] manager at the Knee Council, [1:41:38] we would like to thank council [1:41:39] for moving to release chance [1:41:42] to funding. We have a project [1:41:43] with an existing trends to [1:41:43] commitment that is on track to [1:41:44] close financing and begin [1:41:47] construction early next year. [1:41:48] It is critical that council [1:41:48] releases funds so that city [1:41:49] can make good on its [1:41:51] commitments. These funds will [1:41:52] support desperately needed new [1:41:53] affordable housing units, [1:41:53] including many permanent [1:41:57] supportive housing units. As [1:41:57] well as conversion of existing [1:42:00] housing to affordable [1:42:01] affordable units. We urgently [1:42:02] support this measure. Thank [1:42:07] you. [1:42:08] >> Good Morning Council. My [1:42:13] name is Mary. I'm I'm I'm. [1:42:14] Vice PRESIDENT Of portfolio [1:42:17] finance policy at h housing. [1:42:18] I'd like to thank the Council [1:42:20] for moving to really stretch [1:42:22] to funding these funds will [1:42:23] support new construction of [1:42:25] affordable housing units and [1:42:27] homeless exits into permanent [1:42:29] housing as well as supporting. [1:42:31] We have existing affordable [1:42:32] housing and preservation [1:42:33] conversion of affordable [1:42:37] housing. There are some [1:42:38] projects in the Oakland [1:42:39] Affordable Housing pipeline [1:42:40] that have been awarded funding [1:42:42] from the state of California, [1:42:44] Housing and Community [1:42:46] Development Department. But [1:42:49] those funds are at risk of [1:42:51] being due to delays in [1:42:53] construction. Start many of [1:42:55] these projects in need of [1:42:56] local funds for feasibility [1:42:58] and the funds would also make [1:43:00] projects more competitive to [1:43:01] leverage additional federal [1:43:02] funding through the low-income [1:43:06] housing tax credit. Timing [1:43:06] timing of issuing the bonds is [1:43:10] critical for Oakland. [1:43:11] Oakland's affordable pipeline [1:43:11] to be able to compete and [1:43:14] leverage other state and local [1:43:21] federal funds. Thank you. [1:43:22] >> Good Morning. Council [1:43:24] members. My name is tunnel [1:43:25] Trachtenberg. Honorable [1:46:50] PRESIDENT, Honorable Council [1:46:51] members. I'd like to [1:46:51] acknowledge it's a very tough [1:46:52] act to follow. Thank you. [1:46:53] Thank you, Arthur, for coming [1:46:55] out today. My name is Chris [1:46:56] Shea of senior vice PRESIDENT [1:46:57] Government affairs on behalf [1:46:59] of Shark Sports entertainment [1:47:00] in support of the proposed [1:47:01] general obligation, bonds [1:47:03] passes today. The Oakland I [1:47:04] center is a truly a community [1:47:06] treasure each year it welcomes [1:47:07] an average of 400,000 visitors [1:47:11] into our downtown built by the [1:47:12] redevelopment agency in 1995. [1:47:14] It remains a city-owned [1:47:14] facility. One that continues [1:47:15] to bring people together [1:47:17] nearly 30 years later. But as [1:47:18] you know, equipment ages much [1:47:22] what's inside center today [1:47:23] original from 1995. That means [1:47:24] it's now more than double the [1:47:28] expected useful life. Shark [1:47:28] sports entertainment worked [1:47:29] very hard to stretch the life [1:47:30] as far as possible, far beyond [1:47:31] what anyone could have [1:47:34] anticipated. We take great [1:47:35] pride in managing this [1:47:37] facility, opening the doors, [1:47:38] families, neighbors and kids [1:47:39] who come here to skate, [1:47:40] learning connect. In fact, can [1:47:42] I center provides more than [1:47:44] 5,000 free skate. It's great [1:47:45] experiences every year for [1:47:46] Oakland Unified School. [1:47:47] District's with your help. We [1:47:47] like to double that to 10,000 [1:47:50] free skate every year. That's [1:47:52] thousands of young people each [1:47:53] year who get to try something [1:47:54] new, build confidence and feel [1:47:57] part of the great city. This [1:47:58] bond measure is about more [1:47:59] than replacing old equipment. [1:47:59] It's about investing in a [1:48:00] facility that's been serving [1:48:02] Oakland for decades and we'll [1:48:03] continue to do so for [1:48:06] generations to come on behalf [1:48:06] of Shark Sports entertainment. [1:48:08] We strongly urge your support [1:48:09] so center can remain a [1:48:10] vibrant, welcoming place for [1:48:10] the entire community. Thank [1:48:19] you. [1:48:20] >> good PRESIDENT Jenkins and [1:48:21] council members. My name is [1:48:24] Mikel. These men. [1:48:28] And I just wanted to thank you [1:48:30] all for considering to [1:48:32] released ranch to funding. [1:48:33] This would help one of my [1:48:36] current has a partial ward. [1:48:37] It's a partnership project [1:48:40] with Saint Mary's Center [1:48:43] located at 31 35 San Pablo and [1:48:43] plan and it would be 73 units [1:48:47] of senior housing. And I would [1:48:49] definitely appreciate that. [1:48:53] You all consider. Releasing [1:48:54] the funds because it would [1:48:55] really help our projects start [1:48:57] construction in early 2026. So [1:48:58] thank you so much for your [1:49:07] consideration. Good Morning. [1:49:09] Council members. [1:49:14] >> name is Andrew Wagner. My [1:49:15] daughter is a member of that [1:49:15] 12. You, Oakland, there's [1:49:18] hockey team. That she wears a [1:49:26] pride that she represents [1:49:29] Oakland across California. As [1:49:30] you know, the ice facility is [1:49:32] relying on city funding [1:49:33] through measured the to [1:49:34] continue functioning. It badly [1:49:37] in need of repair. The [1:49:38] facility, isn't it? The [1:49:40] facility is repaired. We'll [1:49:40] lose. Not just a sports [1:49:44] facility. But one represents [1:49:44] the diversity in values of [1:49:48] Oakland. As we travel to other [1:49:49] cities in California to play [1:49:50] our games. And sometimes [1:49:53] beyond. We see how it's all to [1:49:57] unique. That we play on teams [1:49:59] that lift up youth regardless [1:50:00] of gender, race and color, cut [1:50:04] culture in sight. Eggnog. You [1:50:05] have a number of difficult [1:50:06] funding decisions here this [1:50:08] morning. Please do not let [1:50:10] this opens them fall into [1:50:12] darkness without the rink. But I was back [1:50:54] on the ice at 6 weeks. [1:50:55] Postpartum for both times. [1:50:57] Thank you very much. I am not [1:51:01] a good hockey player. But I'm [1:51:01] a passionate player and I'm [1:51:05] passionate about playing [1:51:05] about. I'm passion about [1:51:06] playing and grateful for the [1:51:09] community. So much so that [1:51:10] I've been a volunteer coach [1:51:11] for the Oakland Tech High [1:51:15] School Ice hockey program for [1:51:16] 5 years. And it has further [1:51:16] deepened my appreciation of [1:51:17] the incredible resource at the [1:51:22] o I c each year we introduced [1:51:23] 15 to 20 new teens from [1:51:24] Oakland Tech to a sport at no [1:51:29] cost to them. And let me know [1:51:30] that at least one-third of [1:51:32] those kids each year identify [1:51:34] as queer. It is the only safe [1:51:35] sport that trans athletes can [1:51:38] play in right now. Now I [1:51:41] learned how to skate in 1997 [1:51:42] and started captaining. My [1:51:43] first team at Oakland, ice in [1:51:47] 1998. A few decades later. I'm [1:51:49] still capturing all gender. My youngest child [1:51:59] was born to physical [1:52:01] challenges and required [1:52:02] occupational therapy and [1:52:05] physical therapy. As a toddler [1:52:06] and we dressed him in hockey [1:52:06] closing, got him on the ice [1:52:09] and he was able to use the ice [1:52:10] as his physical therapy and a [1:52:16] normalized way. With his [1:52:17] peers. He is now 18 and an [1:52:17] assist in helping us coached [1:52:20] the Oakland Tech program. [1:52:42] >> I am weekly hockey player [1:52:44] at Oakland, ice and a resident [1:52:45] of Oakland for decades in the [1:52:47] Golden Gate neighborhood. It's [1:52:48] an honor to speak before you [1:52:51] and supported the measure and [1:52:54] also the PRESIDENT Of the a [1:52:55] California non-profit [1:52:56] corporation, the sf [1:52:59] Earthquakes, lgbtq+ Ice Hockey [1:53:02] Club. We provide a safe, [1:53:04] healthy non-discriminatory for [1:53:08] lgbtq+. And also other hockey [1:53:09] players as youth, many of us [1:53:11] chose to leave for never [1:53:13] started playing hockey because [1:53:14] we encountered and welcoming [1:53:17] or even hostile environment. [1:53:18] But we found a partner here in [1:53:22] Oakland, a center. They have [1:53:23] enthusiastically hosted our [1:53:25] hockey with Pride event where [1:53:27] my club welcomed 40 queer [1:53:28] identified players from [1:53:30] Oakland and beyond. As we seek [1:53:31] to grow interest in starting a [1:53:35] second team. Additionally, [1:53:37] when my team hosted our [1:53:38] California Pride Invitational [1:53:41] 2025. With the support of the [1:53:44] Sharks Foundation lgbtq+ [1:53:45] players from Oakland as well [1:53:47] as the teams from Los Angeles [1:53:49] in Coachella chose downtown [1:53:50] Oakland and the uptown [1:53:52] neighborhoods for our host [1:53:55] hotels for our Pre and Post [1:53:57] tournament parties at locally [1:53:57] owned independent restaurants [1:54:02] right here on Telegraph and [1:54:03] also caterer for Pride, Hockey [1:54:05] Bank with that's right here on [1:54:07] San Pablo. This is all because [1:54:08] Oakland, a center and its [1:54:10] diverse staff of workers from [1:54:13] the local community. They [1:54:13] welcomed us. They accommodated [1:54:15] all our needs and they helped [1:54:18] us to promote the tournament. [1:54:20] In fact, several parents of [1:54:22] children who identify as [1:54:23] lgbtq+ asked if their [1:54:26] teenagers could join the team. [1:54:27] That's not possible because we [1:54:28] are an adult league. I'm old [1:54:30] enough to be their [1:54:32] grandfather, but we could say [1:54:34] with complete confidence that [1:54:35] the lessons and the youth [1:54:36] league at Oakland ice provide [1:54:39] a welcoming safe space for [1:54:55] lgbtq and people. At its best [1:54:56] in Oakland. There's no doubt [1:54:56] that we want to support more [1:54:59] housing. [1:54:59] >> But you have a [1:55:02] responsibility. Not to [1:55:03] compromise the fiscal [1:55:07] stability of the city. And you [1:55:10] are currently in a situation [1:55:14] you are negative rating. And [1:55:17] when you proceed to do this, 2 [1:55:18] things are going to be [1:55:20] happening. It's a wrist. [1:55:22] Component. You putting the [1:55:25] city at with us. From going [1:55:28] more deeply into debt. And [1:55:30] you're going to have to deal [1:55:33] with the possibility of higher [1:55:35] interest rates because of your [1:55:40] negative status rating status. [1:55:41] >> You've been told by the I [1:55:43] remember hearing this wait [1:55:47] until DECEMBER. When we could [1:55:47] possibly have rating to [1:55:52] change. And then we could move [1:55:55] more safely into doing this, [1:55:56] MR. Gallo, thank you for [1:55:57] bringing up some points of [1:55:58] concern because these are the [1:56:02] concerns. Out. What are we [1:56:03] going to have to pay? How much [1:56:04] we're going to have to pay all [1:56:07] we at risks. You insist on [1:56:11] doing this. And I insist that [1:56:14] you become more of fiscally [1:56:16] responsible and making [1:56:17] decisions. And this is not a [1:56:20] fiscal responsible decision. [1:56:20] And people who are advocating [1:56:24] for their needs. The continued [1:56:24] advocate. You have a right to [1:56:29] do that. But we all at risk [1:56:30] for the whole picture of what [1:56:32] can happen to everybody if [1:56:35] this becomes a Moore. In debt [1:56:40] problem. And I don't know why [1:56:41] finances recommending news. [1:56:43] They have a responsibility to [1:56:47] make make you a of the risk. [1:56:48] Make you aware of high [1:56:57] interest rates, MR. Gallo. [1:56:58] >> Thank you. Is all about [1:57:01] moving to Speaker Tory half. [1:57:02] You can begin your comments. [1:57:02] You have 2 minutes to address [1:57:06] the council. [1:57:07] >> Good Morning. City Council, [1:57:09] many Mistry half and I work [1:57:10] for Eden, Housing, nonprofit, [1:57:10] affordable housing developer [1:57:13] that works here in Oakland. [1:57:16] Eden. Housing currently an [1:57:16] existing property in city of [1:57:19] Oakland, the on time with 174 [1:57:21] units heimer built over 100 [1:57:23] years ago is in need of [1:57:24] substantial rehabilitation. We [1:57:28] also projects in our pipeline [1:57:30] Liberation Park, Dr Kenneth [1:57:32] Anderson, senior Housing and [1:57:33] 77th and Bancroft representing [1:57:36] a total of 276 additional [1:57:37] units. Thank you to the [1:57:38] council for moving to really [1:57:40] strives to funding of measure [1:57:41] you funds. These funds are [1:57:42] critical source of support for [1:57:46] new construction of of [1:57:46] affordable housing units and [1:57:49] homeless exits to to permit [1:57:51] housing as well as the [1:57:52] rehabilitation of existing [1:57:54] affordable housing and [1:57:55] preservation and cons of [1:57:56] conservation affordable [1:57:59] housing. The timing of [1:58:01] distribution of these funds is [1:58:02] critical. Oakland needs to [1:58:03] make awards in time for the [1:58:04] next round of state funds at 2 [1:58:04] black or we risk leaving [1:58:06] millions of dollars on the [1:58:07] table for projects that have [1:58:10] already received awards [1:58:12] availability of these funds [1:58:12] will be critical to help [1:58:13] bridge. Any remaining gaps as [1:58:15] they begin the construction [1:58:19] closing financing process. [1:58:21] Affordable housing is [1:58:23] fundamental for building [1:58:25] strong, equitable communities. [1:58:26] Thank you from moving release [1:58:27] the trench 2 funds. The [1:58:29] measure you funding that will [1:58:30] make a meaningful impact for [1:58:30] our communities today. And [1:58:37] tomorrow. [1:58:38] >> Thank you for your [1:58:38] comments, MR. PRESIDENT. That [1:58:45] was the last speaker. [1:58:46] >> They're a couple things. [1:58:48] First of all, I want to thank [1:58:49] all the folks who came from [1:58:50] the Oakland I center. You [1:58:53] heard some of the stories that [1:58:56] have benefited Oakland [1:58:56] residents and Glenn, you still [1:58:58] haven't given me my daughter's [1:59:01] tooth. She lost at the Open [1:59:05] Eye Center. But I I think its [1:59:05] important to state that they [1:59:06] provide so many free resources [1:59:09] to Oakland, public school kids [1:59:10] that most people don't know [1:59:13] about. So I encourage people [1:59:14] listening to go in, find out [1:59:14] what what they offer it. It's [1:59:17] an amazing resource. And the [1:59:18] fact that we have an Olympian [1:59:20] that was strange right here in [1:59:21] Oakland says a lot for what we [1:59:24] are able to do in the city. I [1:59:26] did a tour in final and that [1:59:27] they're so many things that [1:59:28] need to be done regarding the [1:59:30] infrastructure. That space [1:59:33] that I'm excited to move this [1:59:34] item forward. And I would like [1:59:36] for the public to be clear [1:59:41] about our credit rating and [1:59:41] what it means in terms of [1:59:43] having expensive debt versus [1:59:46] less expensive debt. And so [1:59:46] through the chair MR. Jones, [1:59:48] if you could speak a little [1:59:53] bit too, why? [1:59:54] >> Our that our credit rating [1:59:57] was downgraded, but it still. [2:00:00] >> Significantly reasonable to [2:00:02] go out for for bonds at this [2:00:02] time. If you could just [2:00:03] clarify that a little bit. [2:00:04] Appreciate it. Threw the [2:00:09] chair. Yes, absolutely. The [2:00:10] city's credit is strong. Can [2:00:14] weaver. Downgrade, ok? Moody's [2:00:15] took us from double a one, a [2:00:17] deadly, too. [2:00:19] >> I just want to make it very [2:00:20] clear that prior to the [2:00:21] downgrades and even right now [2:00:25] the cities. Credit rating is [2:00:28] is is that we have access to [2:00:31] the markets. Okay. We have [2:00:32] that at You know, through the [2:00:36] financing team. Obviously [2:00:38] there's volatility in the [2:00:40] markets. We're not market [2:00:40] timers here or anything along [2:00:42] those lines but I just want to [2:00:44] make it very clear that, you [2:00:45] know, we've spoken to the [2:00:48] experts. Been doing this long [2:00:52] time. And there is an appetite [2:00:56] there for the city's credit. [2:01:00] So, you know, very optimistic [2:01:01] on OCTOBER. 21st is the day [2:01:03] that were slated price. Will [2:01:06] be able into the market. [2:01:06] Cheese and very attractive [2:01:10] rates. [2:01:11] >> And I just want to say this [2:01:13] is so critical for us being [2:01:14] able to deliver the [2:01:15] infrastructure needs in [2:01:15] affordable housing needs the [2:01:19] exits to homelessness. For all [2:01:19] of the back to basics needs [2:01:23] that oaklanders expect. The [2:01:24] bond market and going to the [2:01:25] bond market is critical to [2:01:27] making those things happen. So [2:01:28] thank you for your diligence [2:01:29] on this and thank you for [2:01:30] pointing out that the [2:01:33] legislation isn't the have [2:01:40] sent present. Thank you. [2:01:40] >> Yes, thank you. And thank [2:01:44] you for that information. And [2:01:45] certainly I think I recognize [2:01:48] I value the services that were [2:01:50] trying to address immediately [2:01:51] today. But to the [2:01:55] administrator. [2:01:55] >> Since it is your [2:01:56] responsibility or role to [2:01:59] maintain. A balanced budget [2:02:04] for the city of Oakland. And [2:02:05] and so I I just need to hear [2:02:06] from you. I've been through [2:02:11] this practice before. Where we [2:02:12] do x, y c, the balance, [2:02:14] six-way c and 3 months later. [2:02:18] Guess what? You're back And [2:02:21] this is what Oakland unify [2:02:22] went through that I wind up [2:02:23] having to borrow 100 million [2:02:24] dollars from the state of [2:02:25] California, but they took over [2:02:27] the school district and which [2:02:29] is the 20 years later finally [2:02:33] making the payment. So I'm [2:02:35] asking you directly that is [2:02:37] your role because I've heard [2:02:39] not only the budget deficit [2:02:40] for this year, but for the [2:02:41] coming years going to be [2:02:45] works. That's the members that [2:02:47] I kept seeing as see. That's [2:02:49] why the police department, as [2:02:51] understaffed. That's why other [2:02:52] departments are way onto [2:02:55] service because we don't have [2:02:57] the money and that's when we [2:02:59] deal with our contract [2:02:59] negotiations. Well, we can [2:03:00] meet their knees because we [2:03:03] don't have money. And I just [2:03:05] want to be very clear for the [2:03:08] record from to be able to stay [2:03:10] that borrowing the money. To [2:03:14] provide a service. That we [2:03:15] will be able to replace the [2:03:21] money back. Since I don't have [2:03:22] and I have to go borrow from [2:03:26] one bomb to the unit deliver a [2:03:26] service from now. I heard for [2:03:27] the last 6, 8, months there [2:03:32] wrote. So so anyways, I just [2:03:34] need to hear from a city [2:03:34] administrator directly this [2:03:35] action that we're putting in [2:03:38] place. It's a legal action and [2:03:42] one that you recommend. [2:03:42] >> city administrator, in [2:03:43] addition to that, can you have [2:03:44] a staff member come up and [2:03:45] explain general obligation, [2:03:49] bonds as well? To the chair, [2:03:50] the council Gallo, thank you [2:03:51] for the question. Appreciate [2:03:52] the historical context of what [2:03:53] you experienced during a time [2:03:56] of the school board. So yes, [2:03:58] so through this process, we [2:04:00] have vetted this decision by [2:04:01] both inside and outside [2:04:02] counsel. We have been council [2:04:05] that has been with us from the [2:04:06] very beginning. And so I'm [2:04:07] confident that decision solely [2:04:09] a prudent one. [2:04:10] >> And we have the ability to [2:04:11] pay down the debt service [2:04:12] payments of the appropriate [2:04:14] schedule. Thank you. [2:04:15] >> And I through the [2:04:18] challenges like to add that, [2:04:19] you know, general obligation, [2:04:22] bonds are paid by the property [2:04:25] taxpayers, ok? So this is [2:04:25] insulated from your general [2:04:26] fund. This is money that is [2:04:32] paid. By voter approved debt. [2:04:32] The city of Oakland voters. [2:04:35] You was like almost 80%. [2:04:40] Approved measure you okay. So [2:04:41] this is a strong one of the [2:04:43] strongest credits out there [2:04:44] and he's not relied upon your [2:04:48] general fund. We thing like [2:04:50] that. It is paid by the ad [2:04:51] valorem property tax of the [2:04:55] city of Oakland. [2:05:04] >> Order in the chambers. Just [2:05:05] want I just want reaffirm what [2:05:07] you just said. These are [2:05:08] property taxes that have [2:05:09] already been approved by the [2:05:10] voters. We're just moving to [2:05:11] do with the voters told us to [2:05:14] do to sell them. Yeah, they're [2:05:15] not secured by the general [2:05:15] fund their secured by the [2:05:17] property values of our voters. [2:05:18] That is absolutely correct. [2:05:22] And is that a motion? Is that [2:05:25] a second? So we have a motion [2:05:29] a second. [2:05:31] >> On the motion and second [2:05:32] move by Councilmember 5 second [2:05:33] by councilmember under for [2:05:36] item 9 Council member Brown. I [2:05:38] Councilmember 5. Councilmember [2:05:45] Gallo. Councilmember Houston [2:05:47] is excuse councilmember [2:05:47] Ramachandran. [2:05:50] >> Is also excited. I thank [2:05:51] you. Councilmember [2:05:51] Ramachandran Councilmember [2:05:56] hunger. I councilmember For [2:06:00] the Mike. I and chair Jean [2:06:01] King r Motion passes with a [2:06:02] vote of 7 eyes. One excuse [2:06:06] Houston. [2:06:13] >> going to item 10. Adopt the [2:06:14] following pieces of [2:06:15] legislation adopt a resolution [2:06:16] approved approving the [2:06:16] issuance and sale of one or [2:06:19] more series of city of Oakland [2:06:21] general obligation, bond [2:06:23] measure you in aggregate [2:06:25] principal amount not to exceed [2:06:26] 300 million dollars and city [2:06:28] of Oakland general obligation, [2:06:29] refunding bonds and they [2:06:30] aggregate principal amount not [2:06:33] to exceed 55 million dollars [2:06:34] approving the terms of sale of [2:06:36] said Bonds approve in the form [2:06:38] of of unauthorized and [2:06:39] execution delivery of the [2:06:42] fiscal agent agreement [2:06:43] continuing discloses [2:06:46] disclosure certificate in Van [2:06:47] Purchase agreement approving [2:06:48] the form of an authorizing the [2:06:50] distribution of a preliminary [2:06:52] official statement and [2:06:53] authorizing the execution and [2:06:55] delivery of an official [2:06:55] statement and authorizes the [2:06:58] necessary actions related [2:06:59] there, too. And a resolution [2:07:00] identifying projects [2:07:03] authorized for funding with [2:07:03] proceeds of city of Oakland, [2:07:06] general obligation, Bonds [2:07:09] series, 2, 0, 2, 5 be dash. [2:07:11] One series, 2, 5, 2, 5, to 0 [2:07:15] to 5, be dash. 2. Taxable [2:07:16] social bonds in series 2, 0, [2:07:19] 2, 5, be dash 3 taxable issued [2:07:22] pursuant to the 2022. [2:07:23] Affordable housing and [2:07:24] Infrastructure Bond ordinance [2:07:26] measure you and allocating [2:07:28] bond proceeds identify [2:07:30] projects and a resolution [2:07:31] declaring the City Council's [2:07:33] official intent reimburse [2:07:34] certain expenditures from [2:07:38] proceeds of indebtedness. [2:07:39] >> Sure, everybody read the [2:07:39] package. Can you just explain [2:07:40] the difference between this [2:07:45] and the last item? Excuse me. [2:07:45] Can explain that difference [2:07:47] because unlike [2:07:51] >> The previous item item [2:07:52] number 9, it's just an [2:07:52] ordinance. Okay. So through [2:07:58] the city's charter, we are [2:08:00] obligated approve an ordinance [2:08:01] for the borrowing of the [2:08:02] funds. Okay. So now what you [2:08:04] have before you and item [2:08:06] number 10, 3 different [2:08:07] resolutions. The first [2:08:09] resolution is basically [2:08:12] authorizing the issuance as [2:08:14] well as approving the [2:08:16] documents. So the preliminary [2:08:17] official statement, the [2:08:19] continuing disclosures [2:08:21] certificate, fiscal agent [2:08:23] agreement. All of these [2:08:23] documents are resolution. [2:08:28] Number Okay. Resolution number [2:08:30] 2 is identifying the projects [2:08:33] authorized to funding with [2:08:34] proceeds of the general [2:08:36] obligation. Bonds measure you [2:08:38] tax-exempt and taxable and [2:08:42] then the 3rd resolution as a [2:08:43] proving for the reimbursement [2:08:45] of certain expenditures. So [2:08:46] there's certain expenditures [2:08:47] that are allowed to be [2:08:51] reimbursed before we actually [2:08:52] close the bonds projected at [2:08:53] this time on NOVEMBER 4th and [2:08:57] receive those funds. Okay. The [2:09:01] proposed. Financing live ants, [2:09:03] city priorities such as [2:09:06] housing as we've ivory [2:09:07] infrastructure with the [2:09:09] rehabilitation of city streets [2:09:11] and sidewalks. As I mentioned [2:09:11] earlier, approximately [2:09:15] 78 million will go to streets. [2:09:16] 15 million dollars for [2:09:17] facilities. 10 million dollars [2:09:20] for the eye Center and [2:09:21] approximately 180 million [2:09:23] dollars for affordable housing [2:09:26] and given the complexity of [2:09:27] this particular transaction in [2:09:30] the refunding bonds associated [2:09:31] with this. Issuance is going [2:09:35] to be so through it negotiated [2:09:36] basis with Siebert. Williams [2:09:37] Shank concede Manor senior [2:09:39] manager excuse me, Loop [2:09:41] Capital has become an utter [2:09:42] and Bank of America as the [2:09:45] other competitor. And as I [2:09:46] mentioned before, you know, [2:09:48] we're looking in getting into [2:09:51] the market around OCTOBER. [2:09:52] 21st number, they will answer [2:09:53] your questions that MAY have [2:09:56] and also have representatives [2:09:56] from the departments here [2:10:00] well. Let's go the public [2:10:05] comments. As a kind name. [2:10:06] Please the podium in [2:10:08] any order missile, a violent. [2:10:13] >> Marion Lamin Tory half. [2:10:15] He's the problem related to [2:10:19] measure you. You have been [2:10:22] using measure you. [2:10:23] >> And in an equitable, unfair [2:10:29] way. The money that he's been [2:10:31] allocated for measure you. For [2:10:34] the Lincoln Park rec center [2:10:37] over 32 million dollars. That [2:10:40] project was submitted a new [2:10:42] rec center by the community of [2:10:46] Chinatown. And they initially [2:10:49] said they would fund it. They [2:10:52] started a funding process. [2:10:57] Then through Basque. She got [2:10:59] you to approve that you the [2:10:59] city would fund the process. [2:11:02] The project with 32 Million. [2:11:03] Now the project itself is [2:11:04] going to cause over [2:11:10] 70 Million. So you gave [2:11:11] 32 million people who can [2:11:11] identify with the rest of the [2:11:14] money is gonna come from. And [2:11:15] this is not a high priority. [2:11:18] They said they would do it. [2:11:19] But we got things like the [2:11:22] whole with Durant Library. [2:11:23] It's been sitting on the table [2:11:25] for years in West Oakland and [2:11:28] he's got no Pacific funding. [2:11:30] We still wait fall. The report [2:11:32] to come back on how we can be [2:11:35] done. But we do things like [2:11:41] this. Certain projects get [2:11:42] priority. We got police [2:11:44] administration building. That [2:11:48] should be demolished according [2:11:49] to the recommendation and [2:11:50] rebuilt. You say you don't [2:11:54] have the money but should give [2:11:54] 32 million dollars to the [2:11:58] Lincoln Park Rec center. It's [2:12:00] not that you do what you do [2:12:00] with this. What you do when [2:12:01] you get the money, it's [2:12:05] unfair. And many cases is [2:12:09] unfair. So when are we going [2:12:10] to have the use of funds from [2:12:12] this city done. Well, in terms [2:12:14] of fairness, equity and racial [2:12:29] group. [2:12:31] >> Thank you, MISS All of name [2:12:32] is Kani. Wish to speak. Like [2:19:28] I said, a month or 2, 3, [2:19:33] months later and [2:19:33] >> and have us be in a [2:19:34] position where we're [2:19:36] completely in the hole and it [2:19:37] was thank you for that [2:19:42] information. Thank you. [2:19:43] >> I just wanted to make sure [2:19:43] that the motion included the [2:19:44] amendment that was stated on [2:19:47] the record by our staff. [2:19:48] >> Yes, and we will go to the [2:19:49] public speaker after that and [2:19:50] talk about. [2:19:59] >> This is about love. [2:20:00] >> So the current m o u expire [2:20:03] JUNE 30th of 2025. Is there [2:20:04] any reason why this was not [2:20:08] done in a timely manner? This [2:20:09] should should have been done [2:20:10] before the expiration date of [2:20:12] JUNE. 30th 2025. [2:20:14] >> It says that the bonuses [2:20:16] contingent. It's not [2:20:19] guarantee. Is contingent on [2:20:23] the 25. 26. General purpose. [2:20:25] Fun 3rd quarter if it exceeds [2:20:29] the general purpose funds [2:20:31] unrestricted revenue [2:20:32] available. So you're not [2:20:35] really giving them something [2:20:36] until you actually have the [2:20:38] money in place to do it. So [2:20:41] that needs to be made clear. [2:20:42] The other thing, it states in [2:20:44] the documentation is that the [2:20:45] city administrator can [2:20:49] provide. On represented [2:20:52] employees less compensation, [2:20:55] then represented employees. [2:20:57] And each category. What type [2:21:01] identified. So Ali, Al is [2:21:02] saying if you're not a member [2:21:06] of the Union. You get might [2:21:07] not get human. But if you are [2:21:09] a member. Hugo Guarantee, you [2:21:13] can get your money. Okay. So [2:21:17] this is a onetime book bonus [2:21:19] subject to require tax [2:21:19] deductions. [2:21:22] >> And MAY be paid. [2:21:22] >> off cycle payments with [2:21:25] that When you don't get the [2:21:28] money. And what is the total [2:21:31] costs? That you are [2:21:36] obligating? The city of [2:21:37] Oakland to be responsible for [2:21:41] based on you. Broke it down to [2:21:47] 3,000 to fit 2,51517 $750 [2:21:47] categories. But you never [2:21:50] identified a total amount. [2:21:51] That you possibly will Is this [2:21:56] fiscally responsible behavior? [2:21:56] That's a city administrator [2:22:03] just say, oh, I can guarantee. [2:22:04] >> Thank you. There's a motion [2:22:06] a second chance some cent. [2:22:11] Yes, when clarify what I [2:22:12] understand about the contract, [2:22:13] understand that there are 2 [2:22:14] portions. There's a bonus. [2:22:14] What happens now, which is [2:22:18] guaranteed. [2:22:19] >> And raise which happens at [2:22:23] the end. Only if revenues [2:22:24] exceed. [2:22:24] >> Our our current [2:22:25] projections. So these are [2:22:27] these these are 2 separate [2:22:28] things. So 1, 1, there's a [2:22:29] bonus now. And later that [2:22:31] there won't be a raise if the [2:22:33] money's not there to fund it. [2:22:35] That is correct. Councilmember [2:22:36] And then on the piece about [2:22:39] the unrepresented employees, [2:22:39] my understanding is that this [2:22:43] is not referring to members [2:22:45] who have exempt in the south [2:22:48] to Janice, but members who are [2:22:48] in a job classification that [2:22:51] is never represented. That is [2:22:52] also correct. Councilmember, [2:22:54] thank you. Thank you. We have [2:22:58] a motion a second clerk. [2:22:59] >> Moving the Borough Council [2:23:00] member Brown. I. Councilmember [2:23:05] Fife. Councilmember guy. I? [2:23:08] Councilmember Ramachandran? [2:23:11] Councilmember anger. [2:23:14] Councilmember along eye. [2:23:14] >> Chair Jenkins us as [2:23:20] amended. Motion is approved [2:23:21] Motion's approval as amended [2:23:24] with a vote of 7 eyes. One [2:23:25] excuse Houston moving to item [2:23:29] 12. Adopt a resolution [2:23:30] amending to contracts that [2:23:31] Townsend, Public Affairs to [2:23:34] serve as the city of Oakland, [2:23:35] State lobbyist and provide [2:23:36] grants support by extending [2:23:38] the term through OCTOBER one [2:23:42] 2025. To SEPTEMBER 30 2027. [2:23:43] And adding plans for a total [2:23:47] amount not to exceed $420,000. [2:23:48] And to serve as the city of [2:23:50] Oakland, federal lobbyists and [2:23:51] provide grants support by [2:23:53] extending the term through [2:23:56] OCTOBER one 2025. SEPTEMBER 30 [2:23:57] 2027 and adding funds for an [2:24:01] amount not to exceed $252,000 [2:24:02] and authorizing the city [2:24:03] administrator. With that for [2:24:06] the council action to exercise [2:24:07] an option to renew each [2:24:07] contract for 30 years under [2:24:10] the same terms and conditions [2:24:11] for an amount not to exceed [2:24:13] $210,000. For the 3rd year of [2:24:19] state. Lobbyist contract and [2:24:22] $126,000 for the 30 of the [2:24:23] federal lobbyist contract and [2:24:25] authorizing the city [2:24:26] administrator. The city's [2:24:26] local business, small local [2:24:29] business program participation [2:24:29] requirements. You have one [2:24:31] speaker on this item. Move [2:24:35] approval. [2:24:36] >> We have a motion a second. [2:24:37] Let's go to a public speaker. [2:24:47] >> This is [2:24:48] >> you make some powerful [2:24:51] statements about Chalabi, U.S. [2:24:53] You say that they chief high [2:24:55] levels of success over the [2:24:57] years and how many years were [2:25:00] talking about since 2006. [2:25:01] That's how long we've had [2:25:03] these lobbyists in place. So [2:25:07] over the years, what have we [2:25:08] what have they accomplished? [2:25:11] Specifically? What have they [2:25:17] accomplished? They hit you say [2:25:17] that they in Sacramento and [2:25:21] Washington. They have been [2:25:25] knowledge of Oakland issues in [2:25:26] working on things that are [2:25:27] going to help us. That's [2:25:29] great. I don't see the [2:25:32] evidence of it. [2:25:35] >> So did they support the [2:25:38] homeless services items sb [2:25:42] 1361, and sb. 2835, which is [2:25:45] homeless service sb One s 13. [2:25:46] 61 is homeless service [2:25:52] contracts. Exemptions from [2:25:57] Cipro sb. 2835. Eases the [2:25:58] placement of homelessness, [2:26:01] individuals into hotels and [2:26:02] motels along the stage. I'm [2:26:03] just talking about 2 things [2:26:05] having to do with [2:26:06] homelessness. When did they [2:26:07] how they work on that? What [2:26:08] was your position on that? I [2:26:11] never anything. What you say? [2:26:11] We've taken a position every [2:26:17] now and then okay. I just like [2:26:18] to know at this a long time [2:26:20] have somebody in place since [2:26:22] 2006, I didn't get here until [2:26:27] 2000 7. So I've been the a [2:26:28] long time and I can't say [2:26:28] anything about what I've been [2:26:30] able to accomplish. Very [2:26:33] little. How do you guarantee [2:26:38] you how much we pain? This is [2:26:38] how all do business. You [2:26:39] rubber stamp everything. [2:26:43] Mostly. So these lobbyists [2:26:45] doing doing the work us. We [2:26:47] pay them a lot of money. Yes. [2:26:52] What you say? [2:26:54] >> And go island by 2 back for [2:26:54] a presentation on your where [2:26:55] you usually come for [2:26:59] presentation. Is correct? [2:26:59] >> Absolutely. On a boat [2:27:02] council, PRESIDENT Council [2:27:03] members super grateful for [2:27:04] this great partnership. We've [2:27:05] had very grateful for support [2:27:08] of the mayor. Administrator. I [2:27:09] know we're not supposed to [2:27:10] respond to the public. Proud [2:27:12] of helping you all secure over [2:27:15] 880 million between state and [2:27:17] federal efforts. 38 open [2:27:18] specific sponsored bills [2:27:21] signed into law as it relates [2:27:22] to homelessness. And I'm [2:27:23] sorry, I'm a little exhausted [2:27:24] because we've been running all [2:27:26] week and the session. We are [2:27:27] able to get a trailer bill to [2:27:29] fast-track are hap around 7 [2:27:31] funds. Really great for the [2:27:32] Bears help on that tissues [2:27:34] person making phone calls to [2:27:35] so very grateful for all the [2:27:36] work looking forward to [2:27:37] additional partnership. So [2:27:38] thank you all. Let's keep this [2:27:42] going. [2:27:44] >> I don't know through the [2:27:45] chair to our lobbyist. I don't [2:27:48] know other firms that actually [2:27:50] go into neighborhoods and [2:27:51] communities with elected [2:27:53] officials to talk to [2:27:54] neighbors. But I'm deeply [2:27:55] grateful that you went into [2:27:58] West Oakland with me to [2:27:59] address homelessness and to [2:28:01] listen to my neighbors and to [2:28:02] see what people living on the [2:28:05] streets were experiencing and [2:28:07] we're able to take that [2:28:09] experience and bring that back [2:28:10] in or that are helping us to [2:28:12] address the situation that [2:28:13] we're experiencing that went [2:28:15] directly to the extended stay [2:28:18] hotel. So I've personally [2:28:18] benefited from being in [2:28:21] relationship with this firm [2:28:22] and my community has benefited [2:28:22] and that's what makes the [2:28:25] difference to me. So I'm happy [2:28:28] to second this. This [2:28:30] legislation and look forward [2:28:30] to more opportunities to bring [2:28:32] more resources to the city of [2:28:32] Oakland. Thank you. [2:29:13] >> Councilmember around the [2:29:19] happening, more and more oil. [2:29:25] Councilmember Fife after [2:29:27] >> I don't have an in [2:29:29] memoriam, but I wasn't able to [2:29:29] read a statement that I was [2:29:32] asked by the chair of the [2:29:33] Paramount Theatre's and I [2:29:34] wanted to speak before council [2:29:35] member Brown because hers is [2:29:39] more serious. So I wanted to [2:29:39] just 8 on the record because I [2:29:42] told Ray Leon, that I would at [2:29:43] the Paramount Theater [2:29:44] completely supports the naming [2:29:45] of 21st Street in honor of [2:29:48] Michael Morgan. The maestro, [2:29:49] the paramount was MISTER [2:29:51] Morgan's canvas for his [2:29:52] masterful performances. This is their [2:30:32] first inaugural season. And so [2:30:34] just one in by all of my [2:30:36] colleagues in on the community [2:30:37] out for that because we are so [2:30:39] proud of them. And then in [2:30:41] addition on behalf of [2:30:42] Councilmember Ramachandran, I [2:30:50] did want to and turn in memory [2:30:50] for doctors surely block a [2:30:53] former youth counselor at [2:30:55] youth uprising, a beloved [2:30:58] community leader mentor and [2:31:00] activists whose life left. An [2:31:02] incredible mark on Oakland nb [2:31:05] on. She lost her battle with [2:31:07] count cancer on AUGUST. The [2:31:10] 24th and for decades, doctor [2:31:11] block poured love, guidance in [2:31:14] hope into the lives of youth [2:31:17] at-risk justice involve young [2:31:18] people. Dr [2:31:33] Block was a tireless community [2:31:37] activists who made it her [2:31:38] mission to change the [2:31:39] trajectory for countless young [2:31:43] people and young adult don'ts [2:31:44] while do direct outreach, [2:31:45] advocacy and building of [2:31:48] programs and support. She said [2:31:49] as a powerful voice for [2:31:50] justice, compassion, an [2:31:54] opportunity. [2:31:55] >> All right. We'll go to open [2:32:06] for him. The governor of [2:32:23] California Newsom submitted to [2:32:25] every city. Document that was [2:32:29] called a model ordinance. [2:32:29] Addressing encampments with [2:32:30] urgency in dignity. The [2:32:33] purpose of it was to do some [2:32:36] changing in your cities [2:32:37] related to the challenges of [2:32:41] encampments. Your member [2:32:42] representative, can Houston [2:32:44] attempted to do that? None of [2:32:48] you supported him publicly. [2:32:50] What you have created now [2:32:52] because you took no action of [2:32:55] the cities have taken action. [2:32:59] San Jose and San Francisco. [2:33:01] Have taken action on [2:33:02] encampment changes. Those [2:33:05] changes have resulted in [2:33:06] homeless communities, leaving [2:33:07] those cities and guess where [2:33:10] they have come. To Oakland. We [2:33:13] have now had an increase [2:33:13] amount of homeless [2:33:28] individuals. [2:33:30] Thank you for [2:33:45] your comments with us either. Just wanted to first to [2:34:12] say thank you for passing the [2:34:13] resolution to make Michael [2:34:14] Morgan away. A reality on the [2:34:17] board member will open a [2:34:18] symphony. Why one? Michael [2:34:19] Morgan came in Oakland in [2:34:20] 1990. I was a sophomore [2:34:21] Skyline. High school me spoke [2:34:23] to be in common, inspire me to [2:34:25] continue on my path as a [2:34:26] musician. So just thank you [2:34:26] for that. Look forward [2:34:29] celebrating at what happens. [2:34:29] Secondly, just to raise a [2:34:30] couple of quick things on on. [2:34:33] We have a little bit of time [2:34:34] permitting around events in [2:34:36] Oakland. I was supporting the [2:34:36] high that we know moved to San [2:34:39] Francisco this year. I want [2:34:40] have continue conversations [2:34:41] around how we can support [2:34:43] events around permitting. It [2:34:45] also does the amount of [2:34:46] staffing that was unavailable [2:34:48] from opd to kind of had [2:34:49] prevented them from having a [2:34:51] festival here in Oakland. [2:34:52] Lastly, openly love life. That [2:34:55] is our motto. While I was [2:34:56] cultural strategist, we had [2:34:57] open love life. They open a [2:35:00] love life week. We had events. [2:35:01] We have a city departments go [2:35:01] out, feed the homeless, make [2:35:12] so you can. [2:35:14] >> Big issue regarding [2:35:16] refinancing the joint [2:35:17] obligation, bond is increase [2:35:19] in debt service. Why don't ask [2:35:21] Finance Department that? [2:35:27] Member tell you? The Oakland [2:35:27] City Council MAY call a [2:35:30] special meeting to address [2:35:32] pressing issues that require [2:35:33] action before the next regular [2:35:35] scheduled meeting.
