[50:28] Race inequity to conduct a
[50:29] racial equity impact analysis.
[50:32] But prior to passage and that
[50:32] was in the staff report and
[50:35] that's attached here
[50:39] attachment b. And the reason
[50:40] that we're here today is
[50:42] because the ordinance required
[50:43] the city attorney to collect
[50:45] data on lawsuits filed under
[50:46] the ordinance and to present a
[50:47] report to council within 3
[50:50] years of passage. And the
[50:50] reportedly publicly available
[50:52] on our website. So we have
[50:55] this report that we we put
[50:58] forward to the committee and
[50:59] as the report says, the city
[51:00] attorney filed 5 lawsuits
[51:01] under the ordinance over the
[51:04] last 3 years, including
[51:06] lawsuits to protect the rights
[51:07] of Oakland, tenants, workers
[51:09] and residents to the lawsuits
[51:11] are still pending. One was
[51:12] dismissed. One was settled and
[51:14] one is mostly resolved. And
[51:15] the details of those lawsuits
[51:18] is in the report. The city
[51:21] attorney also included this
[51:22] ordinance in demand letters.
[51:23] We are often able to resolve
[51:23] issues short of filing a
[51:28] lawsuit. And and overall c one
[51:31] point has been. Useful for
[51:34] office, we continue. We plan
[51:37] to continue using this tool
[51:41] and we have some next steps
[51:42] that are included in the
[51:44] report, too. Make our use of
[51:48] this tool more meaningful in
[51:48] robust, for example, we will
[51:51] be creating a plan to collect
[51:51] enforcement data more
[51:53] thoroughly inconsistently
[51:54] across the teams that are
[51:57] using ordinance in the office.
[51:58] We will follow the current
[51:59] cases through collect
[52:00] demographic data on the
[52:02] outcomes and impacts of
[52:04] litigation. We will develop
[52:05] additional training for
[52:07] attorneys in our office about
[52:08] conducting an equity analysis
[52:12] when c 1.1 Now and we will be
[52:13] consulting with Dre, the
[52:15] Department of Race inequity in
[52:15] this process. We have
[52:16] consulted with them and they
[52:18] continue to be a partner for
[52:19] us. I'm happy to answer any
[52:23] questions about the report.

[52:32] quick questions. I very much
[52:33] remember this being brought
[52:36] forward back in 2023 glad to
[52:39] hear that office had success
[52:41] in utilizing it in a few
[52:45] cases. My first question is
[52:47] mentioned that it's also been
[52:48] invoked in demand letters.
[52:50] What type of cases are those?
[52:53] This is primarily used by the
[52:54] affirmative litigation
[52:55] division and our office and
[52:56] the types of cases that we
[53:00] bring. There are a lot of
[53:01] housing cases. So cases where,
[53:03] you know, tenants complained
[53:03] to the city about their rights
[53:08] being violated by landlords.
[53:10] We also have used it worker
[53:13] protection cases cases where,
[53:14] you know, I've wage and paid
[53:16] sick leave. Another worker
[53:16] protection laws are being
[53:18] violated and their complaints
[53:20] the city or to our office
[53:21] about that. We also have a
[53:25] fair number of public nuisance
[53:30] matters where. There there's
[53:32] you know, a business that is
[53:32] engaging in conduct that's
[53:34] creating a public nuisance.
[53:36] And Oakland and residents are
[53:40] being harmed. And so we make
[53:42] include this in. This is
[53:42] actually a great tool to
[53:44] address public nuisances
[53:47] locally. So we have used this
[53:49] tool and some of our public
[53:50] nuisance matters. Those are
[53:51] some examples of the types of
[53:52] cases that our our team has
[53:55] worked on. We work on a range
[54:00] of issues, but those are some
[54:03] of That's great. And I
[54:04] understand having written a
[54:04] lot of demand letters in my
[54:05] previous legal career that
[54:07] these can be very impactful.
[54:09] And on that note. How can
[54:13] members of the public have a
[54:14] complaint? Obviously, your
[54:16] office cannot take all of
[54:18] them. How does, for example,
[54:19] if there is a serious is that
[54:20] of tenants that have a major
[54:24] issue in want to seek the city
[54:25] attorneys use this see how to
[54:27] engage with their office
[54:29] based, you know, it's a great
[54:29] question. So we do get lots of
[54:34] complaints from the public and
[54:35] we have 3 units within the
[54:36] affirmative litigation
[54:38] division. That, you know, we
[54:39] work together, but we also
[54:43] have have different focus
[54:45] areas. We have a housing
[54:46] justice initiative. That's one
[54:49] of the units that focuses on
[54:52] tenant protection cases and so
[54:56] the members of the public can.
[54:57] So that there's also the
[55:00] neighborhood La La Core, which
[55:04] as a team 4 to 5 attorneys
[55:05] that we'll address complaints
[55:08] that come in. I think that the
[55:08] contact information that we
[55:09] probably have on the website
[55:10] is for the neighborhood lock
[55:11] or because they're a little
[55:13] bit closer to the ground they
[55:14] can also so they can contact
[55:17] the neighborhood lock or if
[55:20] you look at the Oakland City
[55:22] attorney's website and you
[55:22] find the neighborhood block
[55:23] where the firm Litigation
[55:26] Division you should find there
[55:28] at least email if not also a
[55:30] phone number. So that's one
[55:30] way to contact our team. And
[55:35] that's where a lot of direct
[55:36] complaints and inquiries come
[55:36] through is the neighborhood
[55:41] lock or and sometimes look at
[55:42] rooted then to the Housing
[55:44] Justice Initiative. For
[55:45] example, if it's a tenant,
[55:47] like a large tenant protection
[55:50] case, I also we you know, we
[55:51] hear from council members
[55:51] about complaints that have
[55:55] come to the city. We hear from
[55:55] nonprofits, legal aid
[56:02] organizations. And also filing
[56:02] complaints with diversity
[56:06] departments. So for example,
[56:07] the Department of Workplace
[56:08] unemployment standards is sort
[56:13] of the first stop. For worker.
[56:14] Rights violations. If you
[56:16] think you're not being paid
[56:17] minimum wage or that your your
[56:18] rights are being violated in
[56:21] the workplace, you can file a
[56:22] complaint with the Department
[56:22] of Workplace unemployment
[56:23] standards and that information
[56:25] is on their website and we
[56:26] have worker protection
[56:27] attorneys on our team who work
[56:29] with that department and you
[56:32] know, help them with resolving
[56:35] cases, filing lawsuits cetera.
[56:37] And you can file complaints.
[56:38] Tenants filed complaints with
[56:39] our building Code Department
[56:43] all the time. And we also work
[56:45] with code to address some of
[56:46] those issues, especially when
[56:48] seeing pattern and practice.

[56:54] 2 and a half. 3 years ago
[56:55] asking this question. But he
[56:59] and a fresh and ready. How is
[57:01] 1.1 0 different from the
[57:02] powers that the affirmative
[57:06] litigation team already So the
[57:07] city attorney already had the
[57:09] authority to enforce a number
[57:10] of Oakland laws, but not every
[57:12] single Oakland law. And so
[57:16] when this ordinance passed, it
[57:17] became gave the city attorney
[57:18] clear authority to enforce all
[57:20] of the Oakland Municipal Code.
[57:24] And it also. Gave the city
[57:27] attorney and meaningful
[57:29] remedies that were not
[57:29] available under every single
[57:30] Oakland. Last of some laws
[57:33] say. When the city attorney
[57:34] brings a lawsuit under this
[57:36] the city attorney can seek,
[57:38] you know, penalties that we'll
[57:41] go to the city. Some of the
[57:42] ordinances had said the city
[57:47] attorney can seek money for
[57:48] residents or workers are
[57:49] tenants who are harmed. Some
[57:51] ordinances didn't say that. So
[57:56] this c 1.1 0 provides clear
[57:59] authority to seek a range of
[58:01] remedies that make our work
[58:05] meaningful. That can be a
[58:06] deterrent. 2 actors that are
[58:10] repeatedly violating the law.
[58:17] And that allow the city to to
[58:19] recoup money for the city as
[58:21] well. As for people who are
[58:22] armed and who might be owed
[58:23] back rent or who might be
[58:26] owed. You know, back wages and
[58:30] things like that. We can move
