Um today the Kansas Corporation Commission [12:45] approved the transfer of the three parts questions approved the transfer of those [12:50] part city service territory beverages uh territory. So beyond now on the [12:58] application that the developers submitted to Bevered [13:05] everything is approved by commission. Uh the other item that we've been [13:10] talking about is this franchise agreement part of franchise agreement [13:13] never achieved well the 20-year agreement 4% rate. Uh this is a 20% year [13:20] but a 20 year agreement 5% rate and it would go into effect as soon as [13:26] published if there are questions. [13:35] I know [13:51] it's just power and that's what the economy is [13:58] that's what they so with the case [14:05] overall since they have [14:15] whatever [14:18] that is not technically a power sale. They're paying for 80% of the power but [14:24] they're not receiving delivery. So they would be home [14:32] and then their sales tax [14:41] it will take it'll probably take four or five years uh for us to realize the full [14:48] estimated $20 million franchise fees that we would that we're supposed to [14:52] realize. um it'll take four or five years for them to get filled out. [14:59] » And if the data center doesn't go in, you know, we voted out um [15:07] the the franchise fee stands for whatever we have connected. Now [15:12] » there's there's uh I got a virtually earlier this week I want to [15:19] say there was like 15 other properties almost all [15:24] or south or where our house distribution system [15:29] does not extend that's all but I guess [15:35] if that center is notable something else [15:42] Right. We had an agreement on each server. [15:52] Once we transfer the service territory that you get out, that's the average. So [15:57] regardless of how much power locates those three parcels, it's going to [16:03] they're going to collect branches. [16:14] uh they could be approaching us for a week. [16:22] It's actually beneficial for them to for us to renew it when we don't have an [16:28] active franchise because the section of state statute that controls what the [16:33] cost is if we want to acquire um service territory on purchase. Um, [16:41] absent the franchise agreement, the statutes control dictate that we pay the [16:47] existing provider the depreciated cost of any infrastructure over which is how [16:53] we bring the state hospital on the city system for less than $10,000. Uh if [16:58] there was an active franchise agreement, then we're looking at paying them four [17:03] years of revenue that they could be off of that if u [17:34] approving. The the [25:23] development contractor got into 510 and start doing a lot more investigating as [25:28] to what it was going to take to make that building structurally sound and [25:32] they came to the determination that costwise going to cost way money to [25:38] rehab 510 going to just tear it down and build new. Um since that time um and [25:46] just came in this morning I visited with the developer uh they did their [25:51] crunching of numbers on a new building and that building itself also still be a [25:56] losing proposition right now with the amount of land that's available it's [26:00] only a 25 so go so I um so what they have done is they they have notified us [26:09] that they plan to back away and I That's probably uh [26:16] I I I hate to see it happen because I was hopeful that the building would be [26:21] salvaged. Uh but the project itself is not viable that there aren't two [26:26] buildings there and 510 is really kind of the [26:32] the we link in the project that if it wasn't going to require so much money to [26:38] store uh then yeah we would not be having this conversation tonight. Well, [26:42] they estimated it's going to be particular district. [26:46] And even then, there's still an old building that's been retro bitted and um [26:52] doesn't exactly have the space that they could could like or would like. Uh so [26:58] with that, I put this resolution together. think it's in the best [27:01] interest of the cities to move forward with returning the eel grant and then [27:08] issuing for the demolition of 10 and it's going to have to be very delicate. [27:12] I don't expect that to be cheap to tear that building down, but I would rather [27:18] take it down in a controlled way than [27:22] that. Yes. Uh, so we've worked through the title process. [31:19] Um, the title company did not like the way the agreement is structured. They [31:24] said it still requires a tax law to transfer the land. Um and now they take [31:30] more towards the pool. Um because it didn't actually it was a structure like [31:35] a mortgage where it just became theirs. Um I went council resolution authorized [31:40] actually transfer the land from the city to the trust. So that's resolution 139. [31:48] just any questions. [34:00] Um the only thing I have is um we did receive our um an initial guaranteed [34:09] maximum price on our water treatment plant. Um the cost of construction is uh [34:14] it's between 34 and 35. And the reason I'm not saying the exact number is [34:18] because we're still working through some of the line items and getting what is [34:23] all included in those line items understood. So we make sure we're not [34:27] including too much that we don't want or adding in not including things that we [34:31] do need. Um in that 34 million there's roughly 2.6 million in contingency. Um [34:39] about half of that 2.6 six is in below grade contingency. the uh the Seymar has [34:44] a certain amount of rock excavation that they've included in their bid and the [34:51] 1.3 million in contingency is in the event they run into more rock excavation [34:56] than what they estimate and they would have to justify that to not only the [35:00] engineer but the city in the form of I don't want to necessarily call it a [35:04] change order but the council would have to release authorized release of that [35:09] contingency. Um the other uh unknown is the amount of [35:14] work that's going to be required at the intake. So that number is also 1.3 [35:19] million. Um we had a diver go in from gardener. Um and they do these types of [35:24] dives regularly. That's their business. Um is to do diving into clear wells and [35:30] other water tanks. um those types of situations, intakes, uh to see what the [35:36] condition of those intakes are um to try to remove some of the unknown around [35:41] that work and work some of that 1.3 million out of out of their contingency [35:46] or their allowance. Um the Semar fee itself is about is [35:51] between 3 and 4 million and that's going to be contingent on where we sign the [35:55] final GMP. So, at the end of the day, it best case scenario, if we are able to [36:01] eliminate all of the uh contingencies that are in the bid, our water treatment [36:06] plant is currently anticipated to cost 31 million, but we can't really put that [36:12] out there because we don't know what type of subsurface risk there is. And [36:17] then also the risk uh around the uh intake work. So, um with that, that's [36:23] all I have as city manager. Um, do you have anything yet? [36:27] » Um, this week we released an invitation for bid for all of the work that needs [36:32] to be done. Uh, that's going to be insurance covered from the hail event [36:36] back in April. It took quite a while for us to get back all of the estimates uh [36:41] from the adjuster uh and also just to know everything widespread that was [36:47] damaged. Uh, but now we have that out for uh any contractor who would like to [36:52] bid on that. We do have that structured uh to be you can bid by building, you [36:57] can bid by trade, you could build a bid a single building. Um basically whatever [37:02] someone feels comfortable being able to bid on um and complete the work on, they [37:08] are welcome to bid that. They do not have to bid the whole package. There are [37:11] 20 buildings listed um or 20 pieces of property. Uh I do want to make a note [37:16] 500 Main is one of those. Um there is roof repair already in that. We'll see [37:20] what all that covers and then we can have more conversations about that roof. [37:24] But I'm really hoping that we can get that roof solidified in a way that we [37:28] don't have to revisit it um after this bid process. Uh the other thing I want [37:34] to mention is Brett and I did um have a conversation with BG consultants uh to [37:40] ask them to do a feasibility study on using our remaining right ofway at Carr [37:46] Avenue as a potential solution for a pedestrian overpass bridge. Um as [37:52] council is aware, there are two problems with the overpass. Um pedestrian access, [37:57] but then also just the size of the overpass and its ability to serve our [38:01] community. um take on larger vehicles and have the correct weight for the type [38:06] of vehicles that actually need to use it when Main Street, Pacific, and Brown are [38:10] all blocked. Uh so, one thing that they're going to examine is whether or [38:13] not building a new overpass structure on that car ride ofway is something um that [38:19] would work for the community and be feasible. Uh the reason we're having to [38:23] look at that right of way uh is because the railroad has told us in no uncertain [38:28] terms are we going to be allowed to put any kind of structure even a pier in any [38:34] of their right of way. Um and the right of way that the railroad owns in town [38:38] basically runs from uh where buildings start [38:44] uh to 7th Street uh through that whole corridor. Um, so the current overpass [38:50] does have peers in Railroad Rideway. Uh, if we were to re try and rebuild that, [38:54] they would not allow us to maintain those peers or put those peers back. Um, [38:58] so a rebuild or a adjustment to the existing overpass is likely not in the [39:03] question. Um, and then the other thing that they have given us an option for is [39:10] um, potentially if we wanted to build something over the railroad tracks, we'd [39:16] have to have it completely outside of their rideway on either side. Um, which [39:21] obviously the ride ofway that we own is streets that are currently open. So [39:25] that's Main Street, Brown, Pacific, and we don't want to be putting a structure [39:29] in the middle of those used streets. So, Carr Avenue is one of the remaining [39:34] swaths of rightway that we have that we're hoping there may be something [39:38] feasible to do there. Um, so we're going to start working on that and start [39:42] chasing some grants and some funding hopefully from there. Um, and just keep [39:47] trying to figure out how to solve this problem. Um, and I think that's all I [39:51] have. There wasn't something else.
