like Jonah [0:38] don't know [0:42] if you could all join me in a moment of [0:44] silence [1:01] thank you [1:02] I like to call this meeting order this [1:04] is Monday August 21st of uh 2023 at 6 [1:09] 30. we have four of the five council [1:11] members of President we are missing uh [1:14] councilwoman Tucker tonight [1:16] our first order of business is we have a [1:18] recognition of our comfort canine [1:21] exander and officer Ashley Pierce [1:41] [Music] [2:11] would you be able to share just a few [2:14] words about the the contest that that [2:16] these guys won sure after Mass services [2:18] holds a canine Grant every year this [2:21] year we had over 700 entries Nationwide [2:24] and her entry with Xander got first our [2:29] second place in the tier so um they were [2:32] rewarded a thousand dollars for the [2:34] canine program [2:36] [Applause] [2:38] uh so we are so grateful for this [2:41] additional funding and so grateful for [2:43] officer Pierce and Xander and all that [2:45] they do for our community did everybody [2:47] get a chance to pet Xander hopefully out [2:49] there good [3:21] night [3:35] area [3:42] thank you [4:29] all right [4:31] okay [4:33] that was very nice that was up always [4:36] great to do one of those things all [4:37] right next up I have approval of the [4:39] minutes for May 24 23 special session [4:41] and June 5th regular session Mr chair [4:44] I'll make a motion to approve the May [4:46] 24th and June 5th meetings second all [4:50] right I have a motion in a second any [4:52] discussion [4:53] all right I'll call the boat all those [4:54] in favor say aye aye [4:56] opposed name okay [5:01] [Music] [5:03] what's with people outside are watching [5:06] the talk to the people I want to make [5:07] sure they hear us I like them when I can [5:09] hear you gotta talk right into them okay [5:11] on the public comment I do have some uh [5:16] Quest public comment [5:19] I see two of them are for [5:23] the two ordinances did you all want to [5:26] speak when we do the ordinances you want [5:27] to speak now [5:29] we can go ahead and do it now [5:32] so first up will be uh Mr Shank [5:37] [Music] [5:43] hello everybody uh Stephen shank 112 [5:46] Boardwalk Avenue Oviedo I'm just here [5:49] about the uh I know it's only first [5:51] reading uh or a setting scheduled first [5:54] reading but to get some ideas and stuff [5:55] thoughts in the head about golf carts [5:58] and the upcoming uh ordinance uh first [6:01] uh you know it's mentioned in there the [6:04] extensive research that's done but [6:06] there's absolutely nothing attached to [6:08] that packet that shows any research has [6:10] done whatsoever [6:11] to give you any idea of why what where [6:14] when how [6:15] and what went into putting this together [6:17] so you know if I can get that tomorrow [6:19] that'd be great but uh you know that [6:21] that's what I'd like to see first and [6:22] foremost is the research that was done [6:25] um why who's looking for this uh what [6:28] brought this forward what groups groups [6:30] Etc have brought this forward to make [6:32] this uh put motion [6:35] uh what areas are going to be most [6:37] affected as part of that research what [6:38] areas are going to be most affected uh [6:41] that you again that the research points [6:42] out that will be getting [6:44] the most traffic from golf carts uh [6:47] things like that [6:48] uh how did you determine that golf carts [6:51] May safely be operational on city [6:52] streets there that stated in there as [6:54] part of thing that it was determined [6:56] that they could be safely on city [6:57] streets what was that determination how [6:59] is that done [7:01] reports mechanisms Etc uh why was [7:04] Chapman and them all specifically left [7:07] out those seem two interesting thoughts [7:09] especially Chapman to me since the back [7:12] end is almost rural it's an interesting [7:15] thought that that was designated to not [7:17] have any golf cart traffic on it [7:20] as far as cost there's it says costs who [7:23] knows you know some estimate of the cost [7:26] that's going to be involved in not only [7:27] registration that should theoretically [7:30] take care of itself never does but [7:31] should theoretically take care of the [7:33] cost of administration [7:36] but of taking care of the officers and [7:40] everybody enforcing those uh things we [7:42] already have golf carts that are in [7:44] multiple neighborhoods and are I'm going [7:47] to say the word problematic but they're [7:48] problematic they ride on the sidewalk [7:49] they're out on the street they have kids [7:50] riding etc etc how will that solve this [7:54] problem because that's illegal currently [7:56] so how does this help change that which [7:59] is already happening [8:01] um [8:02] and have you gone around to any [8:04] neighbors the neighborhoods that will be [8:05] affected uh and said you know this is [8:08] what we're thinking this is what we're [8:09] looking at what do you propose I live on [8:12] Oviedo in a park I figure that's one of [8:14] the areas that's it's already has golf [8:15] carts come through [8:17] some of them street legal which is [8:19] currently legal if you have a Street [8:20] Legal golf cart [8:22] you can drive that currently [8:24] so you're adding in what looks like [8:26] almost Street Legal golf carts if you [8:28] look at the definition of what you need [8:30] to have it and then a license from the [8:32] city [8:34] um if you want to designate certain [8:35] areas that are allowed and those areas [8:37] want it I'm all for it but that would be [8:41] the step to me not [8:43] broaden compassing and then trying to [8:45] come back and say well these areas don't [8:47] like it thank you for your time thank [8:49] you sir [8:54] okay next up I have a Donald Terry [9:03] hi uh thank you for allowing me to speak [9:06] Donald Terry 1911 silverweed way [9:10] I live across the street from the mall [9:12] and the townhouses I was here previously [9:16] at the zoning board talking about the [9:18] units that are being developed in front [9:21] of the mall and that strip on the [9:23] boulevard I would like to address this [9:26] 557 unit multi-family residents [9:29] developed next door to the dwell [9:33] so we got the dwell which is 300 units [9:37] let's say so that's 600 cars so now you [9:41] want to add a [9:43] 557 unit I mean that's a big amount of [9:47] people so that's 1100 cards [9:51] and the only way in and out is Sugar [9:53] Mill or is there going to be another way [9:56] in or out that little that other little [10:00] street that goes to West Broadway I mean [10:03] Maggie new had told me that that would [10:05] be one of the exits for the dwell [10:08] but I don't see another way out for this [10:11] 557 unit [10:14] monstrosity that you're putting up in [10:17] another Woods I mean [10:19] I understand this is Florida you need to [10:22] develop there's rules about development [10:25] but does it have to be so massive [10:27] I mean I understand it has to be so big [10:30] it covers the expenses for the developer [10:33] covers a lot of things for the developer [10:35] it'll be very profitable with that many [10:37] units but I mean [10:40] it reaches a point here in Oviedo where [10:43] there's not going to be any woods [10:45] anywhere it's just going to be [10:47] wall-to-wall Apartments retail Banks [10:51] dentist office [10:53] the traffic [10:55] so you put up a light where there's [10:57] Sugar Mill [10:59] off of a Rita of of you know Mall [11:03] Boulevard but if you're driving east [11:06] from the mall over 417 and you want to [11:09] turn in a Sugar Mill there's no turning [11:11] lane [11:12] what are you going to do with 1100 [11:14] people who want to get into [11:16] those the dwell and the other new unit [11:19] it says here there's no uh expense for [11:24] improvements to the developer [11:27] uh can't they pay for something [11:31] um so I I'm very much against this [11:36] of course I don't have very much support [11:38] I have one other guy here who who agrees [11:42] with me [11:43] um and I presume then there's another [11:45] public meeting after this September one [11:47] or something like that do I need to [11:49] bring more people to get a voice [11:51] um I don't know it's you read in on [11:54] Facebook all the time oh there's too [11:56] much development too much development [11:57] Oviedo but [11:59] no one shows up no one cares I don't [12:03] know [12:04] it's when I moved here 12 years ago was [12:07] a little teeny town no traffic now you [12:10] could barely make a turn you can't pull [12:12] a lot of Culver's those little retail [12:15] shops in West Broadway that have the [12:17] drill behind it you can't pull a lot of [12:19] those it's very hard to pull into those [12:21] so I don't know [12:25] it reaches a point where it's absurd I [12:28] think and 550 units just sounds like a [12:31] monstrosity that's all I have to say [12:33] thank you great thank you [12:39] I have two for the resolution do you all [12:41] want to speak at the resolution [12:48] okay next up is the consent agenda what [12:51] is the pleasure of council I move we [12:53] approve the consent agenda but take [12:55] number nine separately please [12:58] so uh approved consent agenda items [13:01] number four through eight please [13:04] which one which one you want to remove [13:06] uh item nine nine [13:09] second [13:10] all right I have a motion in a second [13:12] any discussion [13:15] [Music] [13:17] okay [13:18] so the motion is to approve agenda [13:21] except removing number nine [13:23] number nine would go into [13:26] discussion item [13:29] that would be number uh [13:31] attendee or 9A no Stephanie mayor just [13:35] make it 9A and we'll consider it [13:38] separately okay [13:41] okay so we had the motion and a second [13:43] all those in favor say aye aye [13:47] okay now let's do 9A [14:00] and not for no need on my end to do a [14:03] big formal presentation I read the [14:05] packet so I've just hoping we can [14:07] consider it separately oh thank you [14:12] okay so we get resolution number [14:15] 4366-23 FY 2022 23 Florida recreational [14:19] development assistance program Grant [14:21] application for Riverside Park [14:24] Mr Cobb how shall we proceed uh thank [14:27] you Deputy Mayor this is request for [14:29] Council to approve the submittal of a [14:32] Grant application for the Ferd app the [14:35] Florida Recreation development uh [14:39] I'm not sure on the AP but it's it's a [14:42] recreation Grant to the State of Florida [14:44] and to authorize a work order with rmpk [14:47] funding who is our grant writer for uh [14:50] four thousand dollars for the [14:51] preparation in the submittal of the [14:53] Grant application the Grant application [14:55] is for Riverside Park and still new [14:58] improvements to the uh multi-purpose [15:01] field down below where The Pavilions are [15:04] also to bring in picnic areas as well as [15:07] create an official dog park which we [15:09] know from past history that a lot of [15:12] folks use that area as a unofficial doc [15:15] Park and so the staff is looking at the [15:17] idea of actually creating a smaller [15:19] version of the BART card which is up at [15:21] Shane Kelly Park uh and then also to do [15:24] some resurfacing of the uh of the [15:27] parking lot uh Mr Mr Belden is here uh [15:30] to answer any questions the city's [15:33] policy requires Council approval for us [15:35] to be able to submit the application so [15:37] that's why we have this on the agenda [15:39] tonight we're seeking your approval to [15:41] submit the application it is a four [15:43] hundred thousand dollar Grant uh the [15:45] first grant program requires the city [15:48] fund to fund the full 400 000 up front [15:52] and then after the Project's done we [15:54] would seek reimbursement for two hundred [15:56] thousand dollars it's sort of a [15:57] one-to-one funding ratio [16:00] um Mr Bill is there any other items that [16:02] we need have I covered everything [16:04] okay so uh it's recommended that city [16:06] council adopt resolution number 4366-23 [16:11] okay [16:14] well it's a pleasure of council [16:16] [Music] [16:19] Mr chairman I'll move to approve [16:21] resolution number 4366-2-3 [16:26] oh second it [16:27] all right Motion in a second any [16:29] discussion oh Brian did you say is this [16:32] a one-to-one match it is it's uh so the [16:36] state Grant is for 200 000 the city's [16:38] match would be 200 000 okay yes all [16:41] right [16:42] I think that's all I had to be cleared [16:45] up I've [16:48] is the four thousand dollars for the [16:50] preparation is that a standard fee for [16:53] for a new Grant uh yes for our for our [16:56] grant writer to produce that he what he [16:58] will do is if you prepare the grant [17:00] itself submit it but then he'll also dog [17:02] it through the process of addressing any [17:05] type of questions that the state may [17:06] have and then he also assists us on the [17:09] back end once if we are if we get funded [17:11] then he also assists us with the reports [17:14] medals uh our annual report submittals [17:17] after we get the grant okay [17:19] that sounds like money well spent is are [17:22] we going to need to uh notify our [17:24] lobbyists [17:25] for any help with this we usually do uh [17:28] anytime that we submit a grant we also [17:29] let Mr commodity know so that there's [17:31] anything that he can assist with okay [17:33] thank you okay [17:36] Mr Belden I've got a question for you uh [17:39] so I mean we're we're taking 200 000 [17:44] basically out of out of our our city [17:47] funds to to take to [17:50] work on these projects this was an area [17:53] that was completely underwater when the [17:56] the hurricane came through well these [17:58] improvements if something like that were [18:00] to happen again with these improvements [18:02] be [18:03] destroyed [18:05] with the improvements to the [18:07] multi-purpose field we're not looking to [18:09] put Bermuda in there we're trying to [18:10] make it a re-leveled surface regrading [18:13] new Turf just providing that safe and [18:17] more usage of a field for like the [18:19] soccer groups our flight football [18:21] program lacrosse teams and possibly you [18:24] know bring that up a little bit but make [18:25] it more level we'll provide that space [18:27] since Shane Kelly and osc are a [18:29] primarily a shutdown facility for our [18:31] contractual youth organizations so then [18:33] the dog park we're trying to put [18:35] elements within it that aren't going to [18:37] be washed away or destroyed through [18:38] future flooding you know knock on wood [18:40] we're not going to get the storm again [18:41] so we're being very cautious with what [18:44] we're you're not going to raise the [18:45] elevation of the surface okay I thought [18:48] I heard that and then with the park [18:49] amenities the park amenities within the [18:51] or around The Pavilions and around the [18:54] facilities they're deteriorated we've [18:56] requested it through our CIP program [18:57] they're rusted out we feel that this [19:00] gives us an opportunity to refurbish [19:01] those amenities picnic tables trash [19:03] receptacles and park benches with a [19:06] multi-purpose field but also Around The [19:08] Pavilions surrounding that Park okay so [19:10] so for the most part I mean the These [19:13] funds are going to something that even [19:15] if it was underwater it when the water [19:17] water receded that it would still be I [19:20] feel that this is uh improving our Parks [19:22] infrastructure perfect in addition to [19:24] improving the facility okay okay all [19:26] right thank you thank you okay if you [19:29] asked pre-asked a lot of a lot of my [19:31] questions uh so that's one of my [19:33] concerns and the other is I like that [19:35] that field is just a free-for-all and [19:38] that it's not formal and that people can [19:40] go and their dogs can use it or anybody [19:42] can use it so I'm a little bit hesitant [19:44] to create something that may be rentable [19:46] because there's very little space that's [19:49] just free play space and and I I like [19:52] the idea of keeping that free play space [19:55] and if we have to redo our our all the [19:58] stuff that's under The Pavilions anyway [20:00] this does seem like a sensible thing so [20:03] a question though if we do get the 200 [20:05] thousand dollars and it comes back and [20:07] it turns out that getting the parking [20:09] lots fixed and the other things besides [20:12] formalizing the field and maybe [20:14] formalizing a dog area if it comes in [20:17] lower are we are we allowed to do the [20:20] less than because half off coupon we [20:22] still have to pay the half so I'm [20:24] hesitant to pay more than what what the [20:27] community collectively traditionally if [20:29] we do not expend what we sought after [20:31] then we would just get a less [20:33] reimbursement back from the state okay [20:35] okay perfect [20:37] all right thank you all right [20:39] with a motion on a second all those in [20:41] favor say aye aye [20:44] okay so that passes [20:47] okay we have no public hearings [20:50] we have the first reading of the [20:52] ordinances first one up is [20:56] 1736 [20:59] this Cobb we provide a brief [21:02] introduction we need the attorney first [21:05] resolution audio ordinance all right [21:10] Mr Deputy Mayor if we could I [21:14] resolution 43 58 23 I mentioned it prior [21:18] to the meeting that we may need to move [21:20] that up to public hearings the item does [21:23] require a public hearing so I was [21:25] wondering if we could move that item and [21:27] do that now under public hearings rather [21:29] than waiting until resolutions to do [21:31] that item there was a all right and we [21:35] don't need to schedule that [21:37] yeah go ahead and do it now the public [21:38] hearing has already been advertised and [21:40] noticed all the notice requirements have [21:42] been fulfilled it it was just something [21:44] that happened when when it was being [21:46] input into the system uh there is a [21:48] there is a check box for public hearing [21:51] I have a feeling what happened was [21:52] public comment got got checked under [21:54] resolutions you get two choices public [21:56] hearing or public comment I think you [21:58] get the public comment got checked and [22:00] so it went down into the resolution [22:01] section of the agenda but if we could do [22:04] that now as a public hearing and I would [22:06] need you to actually open and close the [22:07] public hearing as part of this [22:10] okay so we will open a public hearing [22:12] here for resolution number 43 58-22 [22:16] street light assessment rate [22:19] which is item number 14. so if anybody [22:21] in the audience is looking at an agenda [22:23] sheet item 14 just moved to sort of like [22:26] it's in between 10 and 11. so it's 10A [22:28] Mrs Ross can you read my title only [22:43] a resolution of the city of Oviedo [22:46] Florida relating to the delivery and [22:48] funding of Street lighting services [22:50] within the city amending ratifying and [22:52] confirming the final rate resolution for [22:55] fiscal year [22:56] 2023-2024 determining that that certain [22:59] real property is specially benefited by [23:02] Street lighting Services approving the [23:04] assessment role providing the method of [23:07] collection and providing for [23:09] implementing administrative actions [23:10] scrivener's errors conflict separability [23:12] and effective date [23:15] this cop can give us a brief [23:16] introduction yes thank you Deputy Mayor [23:18] I ever since we instituted the street [23:20] Life program one of the requirements of [23:22] the state statute is that every year we [23:24] need to recertify the tax roll and the [23:26] reason we need to do that is because [23:28] every year we have new people moving [23:30] into the City and so it is what the [23:32] statute says is that you have to provide [23:34] notice to anyone who is receiving this [23:36] for the first time so any new residents [23:38] have to be have to receive a notice and [23:41] so what what we have to do is part of [23:43] that process is that we have to [23:45] recertify the tax roll that's what this [23:47] resolution does it re-certifies the tax [23:49] roll for the coming year and then it [23:51] also maintains the uh [23:54] the fee at the 78 dollars and uh [23:58] 13 cents yeah 78 and 13 cents it [24:01] re-adops the the fee as well so there's [24:04] no change in the fee this year and uh [24:06] but that's what this pretty much is is a [24:09] recertification of the tax roll for the [24:11] impact for the street light district and [24:13] so it's recommended that you conduct a [24:15] public hearing and adopt resolution [24:17] number 4358-23 [24:20] okay [24:22] yes sir I'll make a motion to uh adopt [24:25] resolution [24:26] 4358-23 oh we've got to do public [24:28] hearing questions yeah [24:30] okay so no it's okay [24:33] I have no written requests obviously for [24:35] this is there anybody in the audience [24:37] that wish to speak on the subject [24:42] and by not trying to do a fake head Bob [24:46] okay I will close the public record or [24:48] public comment [24:51] what is the pleasure at councils [24:53] Mr chair I'll make a motion to approve [24:55] adopt resolution number 4358-23 [24:59] second all right I have a motion in a [25:02] any discussion [25:04] yeah I just Brian as far as the street [25:08] light uh [25:10] count we set that up to pay the electric [25:13] bill and then to do improvements are we [25:15] are we on schedule for all the [25:17] improvements that we've planned I [25:19] believe we are I mean the fee pays for [25:21] what the fee does it pays for the [25:23] maintenance Leasing and the electricity [25:26] for all of our street lights and it also [25:30] has some money set aside for Capital [25:32] and the city has been very aggressive [25:34] over the past few years in getting [25:36] retrofitted into the different [25:38] neighborhoods uh the most recent one was [25:40] where we were operating in Alafaya woods [25:42] and Twin Rivers was the big retrofit [25:44] there and we also did the we couldn't [25:47] install the lighting up on the North [25:49] side of Lockwood Boulevard [25:50] as far as I know as we mentioned in our [25:53] staff report [25:54] we still need to do Lockwood South [25:58] and that's that's another retrofit on [26:01] the Lockwood South and then looking at [26:03] doing some [26:05] conversions in the Oviedo on the Park [26:08] area to go to uh to get every all of the [26:11] lights to the [26:13] um LED because some of the lights in the [26:15] video on the park aren't LEDs we need to [26:17] get them get them all to LEDs so those [26:19] are two of the projects that we need to [26:20] do we're still going to be looking at [26:21] areas where we don't have lighting so [26:24] that we can fill in and but we're doing [26:28] it as the um as we have you know Capital [26:31] funds available for us to do it uh [26:33] thankfully uh [26:35] FPL was great right out of the box they [26:38] did the East Side they retrofitted the [26:39] east side of town everything went to LED [26:42] um and Duke took a little bit longer but [26:44] now Duke actually has a program similar [26:46] to [26:48] um [26:48] uh Florida FPL they have a similar [26:52] program now and so even though the Duke [26:55] retrofits crossed a little bit more they [26:57] don't cost as much as with initially was [26:59] quoted to us so it's easier for us to do [27:01] retrofits in the Duke neighborhoods now [27:03] as well so yeah I think we are I think [27:06] we're right on schedule in getting [27:07] getting the different uh upgrades as [27:09] well as doing new new capital items okay [27:12] are we [27:13] solvent as far as you know I look at my [27:16] electric bill every month and it's way [27:18] higher than it was last year do we have [27:19] enough funds to pay the electric bill oh [27:21] yes I mean that that is for that is [27:23] first the you know like I said [27:24] maintenance Leasing and electricity [27:27] those are the very first that's the top [27:28] priorities with this fund it's [27:30] whatever's left over is how much we have [27:32] for capital okay thanks [27:34] okay [27:37] I'm good you would but I do have I want [27:39] to make sure everybody in the room knows [27:41] what's going on because we've got a lot [27:42] of young people who it's probably their [27:43] their first time hearing about this so [27:45] what we're talking about is who pays for [27:46] the street lights are y'all following [27:48] this [27:49] so there is a line on the tax bill [27:53] for paying 78 dollars or something like [27:56] that we pay for electricity we actually [27:59] rent a lot of the the power poles uh and [28:02] then you know we can put new ones in [28:04] different ways and sometimes we own them [28:07] so the new ones we're putting in we're [28:08] trying to own so we don't have to pay [28:10] rent on power poles every single month [28:12] so that's what we're voting on today is [28:15] not the 78 dollar fee but whether we [28:18] agree that the tax roll is correct and [28:22] what the tax roll is is the list of each [28:26] property in Oviedo and who owns it [28:29] so we're saying we agree that this is [28:31] who owns each property and we're going [28:33] to send them a bill for the right amount [28:35] based on the formula that was approved [28:38] previously like five years ago or so [28:40] so it's kind of a complicated thing and [28:42] we could talk more later about it but I [28:44] just want to make sure you know we're [28:45] talking about lights [28:47] okay [28:51] well we're technically we're not allowed [28:54] to do questions in public comments but [28:55] after the meeting if you can stick [28:56] around or email one of us yep [28:59] okay so I have a motion in a second what [29:01] is the favor of council [29:03] oh I'm sorry oh those in favor say aye [29:07] aye aye opposed [29:08] okay [29:10] stumbling along here [29:12] thank you deputy mayor for accommodating [29:14] us on that we appreciate it [29:18] okay next up we have [29:21] ordinances [29:22] [Music] [29:28] and the ordinance we have up here we're [29:31] in 1736 Mr Ross we read the orange by [29:34] title only [29:38] [Music] [29:39] map of approximately 13.81 acres of land [29:43] generally located approximately 476 feet [29:47] south of Winter Springs Boulevard and [29:49] approximately 150 feet west of West [29:52] Broadway street from Office commercial [29:54] OC to residential R3 providing for [29:57] conflict separability codification as [30:00] well as the correction and scrivener's [30:01] errors and an effective date [30:04] thank you [30:05] this cobby gave us a brief introduction [30:06] yes thank you Deputy Mayor all right [30:09] this is a zoning map Amendment and so [30:11] we're City councils asked to change the [30:13] zoning of the property from Office [30:16] commercial to R3 residential uh the [30:19] applicant is proposing to construct [30:21] multi-family residential on the property [30:25] multi-family residential is not a [30:27] permissible use within the current [30:29] zoning classification and Madeline can [30:31] you pull up the maps for us and so we [30:34] can see this is basic the the location [30:36] if you only you'll need there we go this [30:38] is the location of the property it's [30:40] obviously it's located south of Winter [30:41] Springs Boulevard West of State Route [30:43] 426 and north of ovina ball Boulevard [30:46] its primary access is the new Sugar Mill [30:49] Road that's being currently developed by [30:51] by the dwell I don't think we could go [30:53] on to the next one there we go thank you [30:55] all right the properties feature land [30:57] use designation is the newly created [31:00] West Gate [31:01] designation and the thing about it is [31:04] that when you have a zoning [31:05] classification zoning classification the [31:07] very first thing you ask is is it [31:09] consistent with the future land use [31:10] designation the OC zoning designation is [31:13] not and so uh one of the requests one of [31:17] the reasons that the applicant is [31:18] requesting the change to R3 is so the R3 [31:21] is a zoning classification that is [31:24] consistent with the properties future [31:26] land use designation [31:28] manual because the next one all right [31:30] one of the other things that you look at [31:32] as well is uh is the zoning [31:34] classification compatible with [31:35] surrounding area well you can see to the [31:37] South you've got PUD you've also got [31:39] some OC and you've got commercial C2 are [31:41] surrounding uh this property and so one [31:45] of the things about the arts for the [31:46] examine district is that it can be used [31:48] as a buffer area for between residential [31:51] and Commercial areas so the the R3 [31:54] zoning district is compatible Madeleine [31:56] if you'll go to the next next map you'll [31:58] see the R3 zoning District actually is [32:00] compatible with the surrounding area [32:03] with the surrounding zoning Districts [32:04] The third question you ask is is the [32:06] permissible use is compatible with the [32:09] surrounding zoning districts and if you [32:10] think about the the applicant is [32:13] proposing to construct multi-family on [32:15] the property there's multi-family to the [32:18] South already that's being constructed [32:20] in it's also compatible with the [32:22] commercial that is to the East and to [32:24] the north and so yes the staff in their [32:27] analysis did find that the the proposed [32:30] uses within the R3 zoning District are [32:33] compatible with the surrounding area [32:36] and so those those are the basic when [32:38] you're looking at a zoning map Amendment [32:40] those are the basic tenets that you look [32:42] at are whether or not to recommend [32:45] approval obviously the staff they their [32:47] findings are presented in the supporting [32:49] data inventory and Analysis uh they [32:52] recommend approval of ordinance not 1736 [32:54] uh based on the findings in their report [32:56] the local planning agency conducted a [32:59] public hearing on Tuesday August 1st and [33:02] recommended approval recommended [33:04] adoption of the ordinance there was [33:06] concern expressed during their public [33:08] hearing about the connection to oviedo's [33:11] to Winter Springs Boulevard which we are [33:13] currently going through addressing with [33:15] our Mobility plan [33:17] tonight it's recommended that the city [33:19] council [33:21] schedule of public hearing for September [33:23] the 7th 2023. [33:26] great thank you [33:28] is the applicant present [33:30] would you like to say a few words [33:35] my name is David axle axle real estate [33:37] 1757 West Broadway Street Oviedo and as [33:42] this is just first reading I won't make [33:45] any comments I am here to ask answer any [33:47] questions and if there's any public [33:49] comment to address that so I ask that [33:51] you proceed and schedule the public [33:52] hearing for the next meeting thank you [33:57] we did have one written request which we [33:59] already did is there anybody else that [34:01] did not send a written request at one to [34:03] speak on the subject [34:06] CNN [34:08] move on [34:10] what is the pleasure of council [34:13] Mr chair yes I'll make a motion to [34:15] schedule a public hearing for September [34:17] 7th 2023. [34:19] second all right I have a motion and a [34:22] second any discussion [34:24] um Mr axel [34:30] the 557 dwelling units is that is that [34:33] what's being proposed [34:34] So today we're just doing zoning and as [34:37] part of that process you have to project [34:40] a certain amount and compare it to the [34:44] prior use [34:45] so we attempted to use maximum but it [34:48] came out slightly lower because as we [34:51] were working through the application we [34:53] got new Wetland surveys so I would [34:56] venture to say there's there's some [34:58] slight difference in the I think the [35:01] third set of numbers from the second set [35:03] of numbers what's likely to occur but [35:05] it's part of the site approval is less [35:08] than half this amount but today we're [35:11] just here about the zoning and we also [35:14] had to apply for school capacity so the [35:17] analysis had to be done on a number and [35:19] we tried to use the 50 units per acre [35:21] that the land use allows and there was a [35:23] little snafu in the math that's all [35:25] right does that answer the question yes [35:27] thank you [35:28] okay [35:30] any further discussion [35:32] well there there's a couple of things [35:33] that bug me about this and none of them [35:36] can we do anything about [35:38] we do not control [35:41] where students are zoned to go to school [35:44] that is exclusively the jurisdiction of [35:47] the school board [35:49] so it really bugs me that there's no [35:51] capacity for these students to go [35:54] without a bus to Lawton Elementary and [35:56] that they would probably have to be [35:57] buzzed pretty far but we can't say no on [36:00] account of that and we're not saying yes [36:01] or no at all today so just as a matter [36:04] of procedure for all the people in the [36:06] room you're hearing stuff about like hey [36:09] should we build allow somebody to build [36:12] 550-something Apartments well why aren't [36:14] we voting on that what we're doing is [36:15] voting to have a second hearing to vote [36:18] about it at another later time [36:20] and we had one person come and speak out [36:22] against it so there will be one more [36:24] chance only one more chance for the [36:25] public to come and and express concern [36:28] and we've got some pretty high bars to [36:31] overcome because there's this thing it's [36:33] like the constitution of land use called [36:35] the comprehensive plan and the current [36:37] zoning has to be compatible with that so [36:41] the constitution of land use says it has [36:44] to be something other than what it is [36:47] so the landowner came and said hey we [36:50] want to make it something that matches [36:52] what's allowed so we're we're going to [36:56] have a quasi-judicial hearing where we [36:58] kind of act like a court next month so [37:01] come back for the stunning conclusion to [37:03] all of this because all we're voting on [37:05] today is whether to have a hearing a [37:08] second hearing on this next month so all [37:12] these vote like you're hearing all these [37:13] votes and we're voting on these really [37:14] obscure technical things so hopefully [37:17] you're kind of catching on to some of [37:19] that but I want to make sure [37:21] everybody knows that [37:23] very good so we have a motion in a [37:25] second all those in favor say aye aye [37:27] opposed all right so that was not a vote [37:31] to allow the apartments that was a vote [37:33] to have a second hearing [37:46] okay next up we have ordinance number [37:48] 1737 [37:51] Ross can you read that by title only [37:55] an ordinance of the city of Oviedo [37:58] Florida pertaining to the use of golf [38:00] carts upon designated roads within the [38:03] city of Oviedo subject to specified [38:05] restrictions and the provisions of state [38:07] law providing for legislative purposes [38:09] findings and intent providing for [38:12] definitions providing for the [38:13] designation and prohibition of roads and [38:16] the potential addition of Roads [38:17] providing for authorized means of [38:20] Youth and prohibited and unlawful means [38:23] of use providing for signage only as may [38:26] be required by state law providing for [38:28] enforcement penalties and collections [38:31] providing for implementing [38:32] administrative action [38:34] providing for a savings provision [38:36] providing for conflicts providing for [38:38] severability providing for codification [38:41] as well as the correction of scrivener's [38:43] errors in providing for an effective [38:44] date [38:45] thank you Mr kyleby give us a brief uh [38:48] introduction all right thank you Deputy [38:50] American yes the council has asked to [38:51] adopt what we call the golf cart [38:52] ordinance and what this will do this [38:55] ordinance establishes that golf carts [38:57] will be permissible forms of [39:00] Transportation on on city streets that [39:04] um [39:04] have a posted speed limit of less than [39:07] 30 miles per hour or less [39:10] I it also establishes that the golf [39:15] carts can only be operated on the [39:17] roadways that are designated and but [39:20] they cannot be performed operated on [39:22] state or County roadways unless they are [39:25] crossing at a signalized intersection [39:28] there are some streets that we did say [39:30] yes they can't be used on they're mainly [39:32] our primary roadways uh I know it was [39:36] mentioned about Chapman Road Chapman [39:37] Road East which is a local Street and [39:40] has a speed limit of 25 it's eligible [39:43] it's Chapman Road West that goes from [39:45] 434 to 426 which is four lanes and has a [39:48] speed limit of 40 that we said no don't [39:51] operate on that one so [39:54] um [39:55] I remember that was mentioned as well [39:57] and so we also have requirements that [40:00] you need to have a driver's license or a [40:03] learner's permit [40:04] and that the if you do have a learner's [40:07] permit then you have to have somebody [40:08] who is 21 or older and has a driver's [40:11] license sitting next to you while [40:13] operating the um [40:15] operating the golf cart golf carts also [40:17] if you to be operated on private [40:19] property they have to have the owner's [40:21] permission to be operated on the private [40:22] property and that they are not operate [40:24] authorized to be operating on the [40:26] sidewalks or the bicycle pass or the [40:29] trails our Trails have regulations that [40:32] you can't put a motorized vehicle on [40:33] them unless it's like the county doing [40:35] maintenance on it so tonight is the [40:38] first reading of the ordinance and it is [40:41] recommended that the city council [40:43] schedule public hearing for September [40:45] the 7th 2023. [40:47] okay [40:49] we had the one written request already [40:51] speak uh is there anyone who did not [40:54] turn a request that would like to speak [40:58] okay seeing none we will move on [41:01] what is the pleasure our Council Mr [41:03] chair yes I'll make a motion to schedule [41:06] a public hearing for ordinance number [41:07] 1737 on September 7th 2023 [41:12] second okay Motion in a second any [41:14] discussion [41:15] now we can save it for September 7th [41:19] I think we should not save it for [41:21] September 7th I had a lot of the same [41:23] concerns as Mr shank has already brought [41:25] up and I I don't fully understand how [41:28] what we are doing is any different from [41:31] the state level law other than the state [41:34] level law did mention that we have to [41:36] designate certain roads as safe like it [41:38] seems like we can designate additional [41:40] roads and safe Beyond [41:42] what the state law says and I'm [41:45] scrolling through because I asked a [41:47] couple of yes no questions related to [41:49] this item and I'm scrolling through just [41:50] to make sure that I understood some of [41:52] the the questions how they were answered [41:55] and so Madam mayor I was the one that [41:58] that brought this this subject up [42:00] initially and the the reason I brought [42:02] this up was because it's very difficult [42:05] to register a golf cart you have to get [42:08] a VIN number [42:10] um you you know basically what this [42:12] ordinance is doing is [42:15] putting all the same state level [42:18] standards correct me if I'm wrong Chief [42:20] but it's basically putting all the same [42:22] state level standards on the golf cart [42:24] with the exception of actually having to [42:26] get that VIN number and you know to to [42:29] get a license tag number so instead of [42:31] getting a tag for it you get a you you [42:34] get the the city you know permit for it [42:38] but it's basically the same thing [42:41] without having to spend all the money on [42:43] getting the VIN number and everything [42:45] we are taking on the city would be taken [42:48] on all of the safety checks all of the [42:49] everything else it seems like it we're [42:52] biting off an awful lot and the state [42:54] already [42:55] kind of volunteers to do that for us [42:58] yeah [43:04] um [43:04] uh councilmember you're pretty close on [43:07] that we followed the state statute on [43:09] what a low-speed vehicle would be we [43:11] added a few things one of them statute [43:14] was just changed to require a driver's [43:16] license uh for somebody over the age of [43:20] our learner's permit we incorporate that [43:23] early on because basically we want [43:25] somebody to have some Driving Experience [43:27] preferably a driver it also prevents [43:29] somebody who may have a DUI and not have [43:32] a driver's license they they cannot [43:34] drive one of these on the city streets [43:35] as well [43:36] uh uh we incorporated a few more [43:39] safety features I would call it uh like [43:42] if you have small children we require or [43:44] improved child carrier per child animals [43:48] should be securely fastened we'll leave [43:50] that up to the owner but if we do [43:52] require them to be [43:53] restrained securely it doesn't require [43:57] registration if you're going to drive it [43:59] at night you got to have lights [44:00] headlamps and things of that nature so [44:03] it is very similar to the low speed [44:05] vehicle but as you said it does not [44:07] require [44:09] somebody to have to take it to the DMV [44:11] to get it registered and inspect it [44:14] we're going to require them to do their [44:16] own Inspections just like you do your [44:17] own motor vehicle uh you know used to we [44:21] did inspections in Florida if you've [44:22] been here long enough but we don't do [44:23] that anymore you basically ascertain [44:25] your vehicle is roadworthy and if it's [44:28] not we stop you we could you can be [44:30] cited for it as well the same thing here [44:33] if you're either there'll be a check off [44:35] list that you you'll attest to that you [44:38] have this equipment and uh and we'll [44:42] we'll go in good faith that that's what [44:43] you have and if you're seeing driving [44:45] without it you could be cited well [44:48] um get prohibited on sidewalks same same [44:50] rules apply as the lbv or low speed [44:53] Vehicles no sidewalks has to be on the [44:55] streets it has to be under 30 miles an [44:56] hour [44:57] so [44:59] do we have a a number in mind for what [45:02] we would charge people to get this [45:04] thing that lets them not have to get [45:05] event that's not my uh area I don't know [45:09] I don't have a number no but uh I [45:11] figured that would be figured on after [45:14] everyone once the ordinance or at a [45:17] later time Chief I I see golf carts all [45:20] over my neighborhood how are you [45:22] enforcing the rules on those [45:25] uh we're not we're not going to be we're [45:27] not heavy-handed on them because [45:28] basically uh you're right most [45:31] neighborhoods they're in them I don't [45:33] know of a neighborhood that you're not [45:34] uh and people a lot of people just [45:36] assume they are legal and this makes it [45:39] legitimate otherwise right now it's [45:41] state statutes and it's actually [45:42] criminal in some cases where if you're [45:44] letting a 14 year old driver unlicensed [45:46] motorized vehicle on a roadway that is a [45:48] criminal offense and I don't think any [45:51] parent needs to have that you know [45:53] allegation to charge to them so we do a [45:55] lot of warning a lot of warning but like [45:57] most times parents don't always listen [45:59] to uh to the direction [46:01] this makes it an easier path to get that [46:03] done so they don't have the argument [46:05] that council member Pollock said where I [46:08] don't I don't have time I don't have the [46:09] effort to go get it registered at the [46:11] DMV I don't know you know get a VIN [46:13] number for it so this makes it a much [46:16] easier process it's coming through [46:17] getting getting the registration and [46:20] playing it on but applying it to the [46:23] golf cart [46:26] and the city gets fees for this as [46:30] opposed to if DMV the DMV soon [46:35] keep this one last thing in the uh in [46:38] the staff report talked about uh the [46:39] traffic surveys that were done um we're [46:41] here to one resident that was asking [46:43] about that is that coming from the [46:44] Planning Group in the traffic studies do [46:47] you know about the traffic studies [46:49] uh the [46:51] we don't have a defined traffic study we [46:53] looked at traffic studies there's [46:55] traffic places that have done the same [46:58] thing we've reached out to them in [46:59] several of the Cities Stanford's a good [47:01] example uh how well is their program [47:03] working what do they have problems with [47:05] and and several other jurisdictions I [47:08] think DeBerry was either looking at it [47:09] or now has it and looking at what would [47:11] what do they recommend and every one of [47:14] them said you know keep them in [47:16] basically the neighborhoods are off off [47:18] busy thrower Affairs even if you can and [47:21] you know nobody's had any major issues [47:25] like any other motorized vehicle if you [47:27] got the wrong person driving it bad [47:28] things can happen but they're generally [47:30] a little bit more cognizant of the [47:32] vehicles around them because one they're [47:34] open air you know and they're not [47:36] they're not they're able to hear [47:37] everything but they're also know that [47:39] they're the smaller it's kind of like [47:40] being a bicyclist on the road I think [47:42] you could relate to that you pay a lot [47:44] more attention to what's going around [47:45] you than you do if you're the the the [47:47] truck on the road like a Dodge truck or [47:50] something you know on the roads [47:51] uh and and so they not really had [47:55] anywhere we found of any major there's [47:57] always going to be the crash there's [47:59] always going to be somebody that did [48:00] something but as a general rule they [48:02] provided a pretty safe Avenue to [48:05] transport around town [48:07] I guess one last question on on the [48:10] and it's a great point about having [48:11] underage kids that drive drive the [48:13] vehicles I do see it you know in similar [48:16] neighborhoods that I go through I guess [48:17] my question would be obviously we'll do [48:19] whatever you can you know once we get [48:21] past a hearing if it does pass us to [48:23] communicate it but not everybody sees [48:25] the communications those individuals [48:27] that are pulled over the first time is [48:29] it a warning is it a citation right away [48:31] I mean how do you handle the underage [48:33] kids that are driving them the underages [48:36] have a a conversation with the parents [48:38] and say look this is the warning it's [48:41] going to get very expensive if you [48:42] continue this on we're trying to keep [48:44] your kids safe in the neighborhood safe [48:47] they're not allowed because most of the [48:49] time they're with their friends and [48:50] they're driving generally on the [48:53] sidewalk right you know what I would [48:54] consider recklessly but not maybe you're [48:56] a hazard to health but a hazard to [48:58] everybody else we're not going to be [49:00] tolerant of it I can tell you that we'll [49:01] try to get compliance first but if it [49:04] shows that we've we've been out with [49:05] them before they'll probably get cited [49:08] and um and see where it goes from there [49:10] okay [49:11] thank you and you have one more question [49:13] back in 2017 we adopted a golf cart [49:16] ordinance and my understanding is not a [49:18] single person registered so it sends it [49:20] automatically what [49:23] is different now that we think people [49:27] will register I mean unless we're really [49:29] going to push the registering people [49:31] will continue just to drive the golf [49:32] carts as they have since 2017. we will [49:35] probably start an education process [49:37] where if we see golf carts on the road [49:38] that aren't registered we'll stop them [49:40] and inform them they need to be [49:41] registered it would be a citable offense [49:43] again much a very expensive citation [49:46] because that's a state citation [49:49] um and to gain the compliance the other [49:52] thing is then it was only on the east [49:55] side of Lockwood so effectively if you [49:57] weren't [49:58] uh you didn't live in the golf course [50:00] half of Twin Rivers it was not useful to [50:02] you but you couldn't you couldn't go go [50:05] anywhere but there but if you're in Mead [50:08] Manor you can go all of mead Manor you [50:10] know your sub like Live Oak as an [50:12] example they could go up to Publix are [50:15] you saying with a new proposal correct [50:16] okay because my understanding is they [50:18] can go beyond that you can go as far as [50:20] your battery will take you or your I [50:22] guess you could get a gas powered golf [50:23] cart as far as there's a 30 mile an hour [50:25] correct exactly you're like you can't go [50:27] down Lockwood so anybody Twin Rivers [50:29] going could not drive down the window [50:30] but you can Crossroads correct you had a [50:33] signalized intersection [50:35] so that that's that's okay and the [50:38] reason is that's the safest way to cross [50:39] the street so there are boundaries so [50:41] you can go only within your neighborhood [50:43] and then once you hit 419 you're out of [50:45] luck correct you can't just go alongside [50:47] it unless and until we are able to build [50:50] a golf cart so there's a pathway to get [50:53] there legally okay we looked at every [50:56] subdivision and see how far they could [50:58] go [51:00] um legally even if they had to go way [51:03] around you know you know a big circle to [51:06] go down and make it legally some [51:08] neighborhoods they can go quite far some [51:11] neighborhoods they can't go that far at [51:12] all uh it just depends on the [51:16] on on what road to borders on okay so as [51:19] long as soon as you hit a 45 or 30 or [51:21] higher you're kind of capped out [51:24] so it's you know if there's a signalized [51:26] light they can cross over to another [51:29] Street that's under 30 they can keep [51:31] going so and the goal was kind of look [51:33] at Oviedo in the park and see how how [51:35] many people could get to there they had [51:37] a golf cart like for instance a meat [51:39] Manor is a good example they can get [51:40] there you can come down Division Street [51:43] to Oviedo Boulevard uh you know through [51:45] the roundabout crossover 419 at the [51:47] light and make it all the way to Oviedo [51:49] Boulevard I mean all the way to Oviedo [51:50] in the park without [51:52] legally if you're in Alafaya Woods you [51:55] can get to uh Oviedo on the park because [51:57] you can come down Alexandria to clearly [52:00] to uh to again crossover and you're in [52:03] Oviedo in the park and that's kind of [52:04] what the focus point was when we were [52:06] looking at it because that's where our [52:07] events are and things so they could make [52:10] it to there not every subdivision is [52:12] going to I mean the majority of [52:14] subdivisions can't make it there but as [52:15] many as we could make it there is how we [52:17] were looking at it [52:19] thank you okay [52:20] great thank you sir [52:22] all right we had a motion in a second to [52:25] schedule a public hearing on September [52:27] 7th [52:28] all those in favor say aye aye [52:35] moving on to resolutions we are on [52:38] resolution [52:40] 4364-23 there's a Cobb we provide a [52:43] brief introduction uh yes thank you [52:45] Deputy Mayor actually Dr Correa is going [52:49] to provide the staff presentation for [52:51] this item [53:01] good evening mayor Deputy Mayor City [53:04] Council Members this is a request for [53:07] the city council to approve an end stud [53:09] story development agreement in a master [53:11] land use plan for the Lockwood Village [53:14] shopping center [53:15] all the sea sections 2.5 is 7 and 11 [53:19] state that the city council shall have [53:22] final [53:23] authority over development agreements in [53:26] muscle induce plan [53:29] um [53:29] if we can move to the next step thank [53:32] you so [53:34] um this the subject project property is [53:37] approximately 7.7 Acres along this side [53:42] of Lockwood next to the intersection [53:45] with Mitchell hammock [53:47] it is uh [53:50] part of the Twin Rivers PUD [53:53] so the future land use is beauty the [53:55] zoning is also PUD and the proposed used [54:00] users are in accordance with the C2 [54:03] zoning District [54:05] the idea is to create so this is the [54:09] parcel the big part of the shopping [54:11] center where where you have the [54:13] Winn-Dixie supermarket and the idea is [54:16] to create two Lots now [54:19] so you have lot one which is the [54:21] remaining shopping center at around [54:23] seven acres [54:25] in log 2 is going to be carved out of [54:28] the Big Lot for a proposed restaurant [54:30] for the Longhorn Restaurant if you can [54:33] move to the next one [54:35] so this is the site [54:38] if we can click it should show the new [54:44] can you [54:45] yeah so this is the the Longhorn [54:48] Restaurant being proposed so it's [54:51] carving out from the big parcel [54:54] the access points remain the same [54:57] and it's just [55:00] um a reorganization of the site [55:03] internally if you can move forward [55:06] so this is the site this is the [55:09] um [55:11] we can move forward this is the site [55:13] plan so you have the longhorn now with [55:16] some parking around it so there was just [55:20] the rearrangement of the parking area [55:23] moving forward the development agreement [55:27] um the entitlements are not being [55:29] changed so they are within the Pud [55:32] parameters that were approved as I said [55:35] the permissible uses are going to be the [55:37] ones according to the C2 it's just a [55:39] single phase project and the development [55:42] agreement allows for modifications for [55:44] standards to be negotiated while we're [55:47] on this slide can you let us know the [55:48] year in which the original development [55:50] agreement was approved [55:53] I do know by 19 like 1990 something yeah [55:58] 1987. okay thank you I think it's [56:00] rounding there [56:02] thank you Mr Kaaba I would not know I [56:04] know it's it's been a while but I would [56:06] not know exactly the date the [56:09] modifications so for the buffer it's we [56:12] are just so we're keeping the 20 feet [56:15] um buffer around but internally between [56:18] the two lots we are excluding the buffer [56:21] requirements because that doesn't would [56:22] not make sense the open space is not [56:25] being reduced so it's still 30 percent [56:27] overall in the Pud and actually in this [56:30] particular site they are increasing the [56:32] open space because they are turning [56:34] parking spaces into there is now some [56:37] landscape areas so they are increasing [56:38] the open space [56:40] um there are some deviations for [56:44] landscape islands and [56:47] these are just really minor deviations [56:50] from the code if you can move forward [56:54] um [56:55] the parking size space for the for the [56:59] the whole development is being kept the [57:02] same and the parking [57:06] counts has been reduced right because [57:09] now we are creating this restaurant in [57:11] the in the parking lot so what they are [57:14] providing now is 272 parking spaces and [57:17] there is a slide showing you know this [57:19] the the breakdown [57:21] the loading the parking space size is [57:25] still the same but the parking space [57:27] number is less yeah the size is the the [57:31] is the footprint the footprint so they [57:34] have a weird number which is I think [57:37] it's um [57:38] um [57:40] 10 by 18. so our our regular 10 by 20 [57:45] per code [57:47] in their development agreement they [57:49] already had a different in a difference [57:51] from our code and we are moving because [57:54] we are rewriting the code we are moving [57:56] to the compact which today what is [57:58] considered compact [58:00] which actually is the standard in other [58:02] jurisdictions which is nine it's nine by [58:04] 18. so we are keeping the same you know [58:07] the the number for the for lot one lot [58:11] two is proposing I think a different one [58:13] but the packing space is the number of [58:16] spaces have been reduced and do they [58:19] still meet the space requirement the [58:22] parking requirements I will show the [58:24] next led the slide will have a a [58:26] breakdown of those [58:29] um the loading area it's being used for [58:32] the parking space so the loading is [58:35] going to be off hours we are also [58:38] removing the requirement because there [58:39] is no spillover from lighting and when [58:44] you have Parcels but because they are [58:46] internal and they have you know Common [58:48] parking spaces and parking lots we a lot [58:51] we are removing those and they have the [58:55] lot too which is longhorn requested an [58:58] allowance of 2.5 square feet of building [59:00] signage for each building Frontage [59:05] with a maximum of six signs [59:08] the lot one which is the remaining [59:12] shopping center is going to also have a [59:15] tree restoration to kind of restore a [59:18] little bit the side because with the [59:19] years some trees are are you know bad [59:24] and been replaced Etc so they are going [59:26] to restore [59:28] next slide please [59:32] um well the next steps they have a [59:35] non-state story [59:37] um subdivision and they're reviewing a [59:39] site development order uh already under [59:42] the under review and the architecture [59:45] has already been approved [59:46] there should be a slide for can you move [59:49] forward to see if [59:51] well this is the land LPA [59:53] recommendations we should have one for [59:55] the parking count [59:57] no so I can explain the parking count we [1:00:01] have two numbers we have the number that [1:00:04] was originally approved which is 300 [1:00:07] parking spaces and then with the new so [1:00:10] what we're doing is that you're removing [1:00:12] parking spaces and putting a restaurant [1:00:14] a restaurant demands for more parking [1:00:16] right so the new parking account would [1:00:19] be [1:00:19] 350 something uh parking spaces that [1:00:23] would be the new one [1:00:24] required for the code today [1:00:27] we are again we are reviewing the code [1:00:29] in the LDC and we are going to be [1:00:33] reducing those numbers because [1:00:36] usually we over Park you know the the [1:00:41] the standard to provide for peak days [1:00:44] right for Christmas for days that you [1:00:47] know there is a lot of demand for [1:00:49] shopping centers so we are kind of now [1:00:52] bringing more to reality because you [1:00:55] know we did not want to have a lot of [1:00:57] parkings a lot of area designated to [1:01:00] parking spaces [1:01:01] so this what they are providing today [1:01:05] which is 273 is a 24 deviation for what [1:01:09] the code would require [1:01:11] and that is I had a slide there for this [1:01:14] breakdown [1:01:15] and but it's basically a 24 deviation [1:01:20] so that is that is the major you know uh [1:01:24] you know in a way deviation that they [1:01:25] are requesting from the codes [1:01:27] so with this being two separate lots are [1:01:35] we going to get into a situation like we [1:01:36] have over here at Oviedo on the park [1:01:38] where this is their parking and this is [1:01:41] their part no it's a shared parking [1:01:42] agreement so they have cross access [1:01:44] easements in a shared parking agreement [1:01:46] that's part of the development agreement [1:01:48] so everybody can park anywhere [1:01:51] there isn't a longhorn [1:01:53] you know specific parking and there [1:01:56] isn't the rest you know [1:02:03] you're welcome [1:02:05] I do have uh two written requests to [1:02:07] speak the first one is Mr de Matteo [1:02:15] please state your name and your address [1:02:19] yes I'm loud thank you Council Connor [1:02:23] demateo 1009 Pearson Drive Oviedo [1:02:26] Florida [1:02:28] council members I am speaking and Mike [1:02:30] sassy as a citizen now unrelated to Cafe [1:02:33] panuzos I often talk about the need for [1:02:35] prioritizing infrastructure over [1:02:37] development to allow for the smart and [1:02:40] sustainable growth of Obito it is not a [1:02:42] question but a fact that oviedo's [1:02:44] roadways are stressed we see over 20 000 [1:02:47] cars pass through the city every day by [1:02:49] fdot reports Lockwood alone has an [1:02:51] annual average daily traffic count of [1:02:53] over 17 000. [1:02:55] we can see all the traffic backups at [1:02:57] the Lockwood and Mitchell hammock [1:02:58] intersection just as well as the [1:02:59] Lockwood and Broadway intersections [1:03:01] whether that's a car stopped in the [1:03:03] middle of the intersection waiting to [1:03:04] turn Northbound onto Lockwood or if it [1:03:06] is the inability of a car to turn across [1:03:09] the southbound Lanes into the Northbound [1:03:10] Lanes the traffic on Lockwood is rough [1:03:13] putting some numbers on this claim at [1:03:16] the intersection of Lockwood and [1:03:17] Mitchell hammock there have been 24 [1:03:18] traffic crashes in the last 12 months [1:03:21] the most recent being less than a month [1:03:23] ago [1:03:24] even worse the intersection of East [1:03:26] Broadway and Lockwood has seen 66 [1:03:28] traffic crashes in the same time period [1:03:31] the most recent being today [1:03:34] our roadways are ill-equipped for [1:03:36] increased traffic flow is an [1:03:38] understatement [1:03:39] our roadways can barely withstand our [1:03:41] current volume and the addition of a [1:03:42] LongHorn Steakhouse on Lockwood [1:03:43] Boulevard will undoubtedly exacerbate [1:03:46] the issues we are already facing on our [1:03:48] streets even if this council is [1:03:50] incapable of voting down this Longhorn [1:03:52] development it should not go without [1:03:54] saying that it is not in the best [1:03:56] interest of the community to continue [1:03:57] the pace of development in the city I [1:04:00] implore you all to stop and reflect on [1:04:02] the impact development has beyond the [1:04:04] monetary [1:04:06] it can damage our community identity our [1:04:08] way of life and our safety I further ask [1:04:11] that this Council and the city officials [1:04:13] gathered here tonight [1:04:15] strongly consider hosting public forums [1:04:17] and appropriate actionable civil [1:04:19] discourse with our local business owners [1:04:21] local residents and local groups Beyond [1:04:23] those during a city council meeting many [1:04:26] individuals are simply unaware or [1:04:28] unprepared to voice their concerns in a [1:04:30] manner that will be able to Spur change [1:04:31] in the community and I truly believe [1:04:34] that is unfair in my heart of hearts our [1:04:37] role as public servants [1:04:39] in the words of the Constitution is to [1:04:41] establish justice provide for the common [1:04:42] defense and promote the general welfare [1:04:44] this comes in many forms and at its core [1:04:46] it is ensuring the public is informed [1:04:48] enough to be able to make informed [1:04:50] decisions and offer direction to its [1:04:52] public officials to enact change it [1:04:54] deems appropriate I fully recognize the [1:04:57] burden you all Face In Your Capacity as [1:04:59] council members and I respect you all [1:05:00] for putting yourselves in that position [1:05:01] to make tough decisions but as we look [1:05:04] forward looking towards tomorrow and [1:05:07] next week and next year we have to [1:05:09] accept that each of the actions and [1:05:10] inactions [1:05:12] we take will all affect us in one way or [1:05:14] another I do not envy you for the [1:05:16] decisions you have to make nor do I hold [1:05:17] any ill will against any of you for what [1:05:19] is at the end of the day just business I [1:05:21] do however ask that you listen to the [1:05:23] concerns of the citizens to ensure that [1:05:25] this kind of commercialization of our [1:05:26] great city does not continue beyond [1:05:29] recognition thank you all very much for [1:05:31] your consideration and I of course look [1:05:32] forward to your continued work thank you [1:05:34] great thank you [1:05:37] next up I have Miss Delgado [1:05:47] I am Kalina Delgado at 1004 wheeler [1:05:51] Place Oviedo [1:05:53] good evening council members I'm here [1:05:55] speaking to you on behalf of my family's [1:05:57] restaurant Cafe panuzos we have been [1:06:00] lucky enough to serve our Oviedo [1:06:01] community and have proudly done so for [1:06:03] the last 15 years we are most definitely [1:06:06] a family business my dad is the chef my [1:06:08] sister and cousin are servers my baby [1:06:10] brother is a host and we think of the [1:06:12] rest of our staff as family too [1:06:14] as I'm sure you can imagine we are [1:06:16] deeply concerned about the proposed [1:06:18] Longhorn development while we recognize [1:06:20] we cannot stop the development due to [1:06:22] the land zoning in the plaza I wanted to [1:06:24] present my concerns to you for remedy [1:06:26] unfortunately we were not notified of [1:06:28] this impending construction with any [1:06:29] advance notice so we were incapable of [1:06:31] raising our concerns throughout their [1:06:33] application and planning process if you [1:06:36] refer to tonight's packet under the [1:06:37] exhibits for resolution [1:06:39] 436423 you will notice that the longhorn [1:06:42] faces away from panuzos therefore [1:06:44] panuzos will be in full view of [1:06:46] LongHorn's back facade although we [1:06:49] recognize that they will provide some [1:06:50] fencing and hedging around the dumpsters [1:06:52] and back door this does not mean that it [1:06:54] will not affect our own business under [1:06:55] its current orientation [1:06:58] having been in the restaurant industry [1:06:59] for well over a decade we know that no [1:07:02] amount of fencing will stop the smell [1:07:03] from radiating outward this in [1:07:06] conjunction with flies employees on [1:07:07] break behind the restaurant and the [1:07:09] inevitable influx of Scavenging birds [1:07:11] all have the potential to affect our [1:07:13] patio business which is very prominent [1:07:15] for most of the year in addition to our [1:07:17] general foot traffic we know our food [1:07:19] simply won't be as appetizing to patrons [1:07:21] with the smell of a dumpster at our [1:07:23] doorstep to be clear we want to be [1:07:25] supportive of a growing Oviedo but we [1:07:27] want to ensure that the growth and [1:07:29] development is Equitable for all the [1:07:30] affected parties that said we would like [1:07:33] to please ask for your help and [1:07:34] consideration regarding the orientation [1:07:36] of the restaurant we are asking that the [1:07:38] freestanding development be rotated 90 [1:07:40] degrees clockwise or counterclockwise to [1:07:43] reduce the potential impact on our [1:07:44] family business if rotating the business [1:07:47] is not an option we would at the very [1:07:49] least request the dumpsters be relocated [1:07:51] to another part of the proposed lot [1:07:54] we know just as well as LongHorn [1:07:55] Steakhouse that when it comes to the [1:07:57] service industry Impressions matter this [1:08:00] includes the quality of the food the [1:08:01] quality of the staff and the overall [1:08:03] appearance of the restaurant inside and [1:08:05] out we feel as though if the tables were [1:08:08] turned and we were proposing a [1:08:09] restaurant to be constructed in front of [1:08:11] a longhorn they wouldn't be happy if our [1:08:13] dumpsters fenced or not were at their [1:08:15] front entrance likewise we don't believe [1:08:17] it's fair that our visibility to and [1:08:19] from Lockwood will now be separated by a [1:08:21] building with a view of fenced-in [1:08:22] dumpsters and hedges [1:08:24] we fully recognize that this is a big [1:08:26] ask of you but we do truly feel like [1:08:28] this is about a big enough issue for our [1:08:30] business that it should be considered [1:08:31] for resolution my family has loved [1:08:34] contributing to Oviedo and we are [1:08:36] forever grateful for the opportunities [1:08:37] this city has presented us we want to be [1:08:40] able to continue that tradition of love [1:08:41] and Community for many years to come and [1:08:43] we hope that you council members will [1:08:45] help maximize our chance to do that [1:08:47] alongside our new neighbors thank you [1:08:49] all so much for your time and [1:08:50] consideration great thank you [1:08:53] I have no more written requests or to [1:08:55] anybody that would wish to speak on the [1:08:57] subject that did not turn in a written [1:08:58] request [1:09:01] okay saying none we will close out for [1:09:03] the record [1:09:04] what is the pleasure our Council [1:09:11] Leanne for purposes of discussion move [1:09:13] we approve resolution 4363-23 [1:09:18] do I have a second I'll second for [1:09:21] discussion my uh [1:09:23] iPad's going anywhere around me here so [1:09:25] I don't have it in front of me okay [1:09:27] we have a motion of discussion uh Motion [1:09:29] in a second what [1:09:31] discussion [1:09:32] that's a very reasonable request to not [1:09:35] have the dumpster be in your face thank [1:09:37] you for bringing that up [1:09:39] and for proposing a solution is the [1:09:43] applicant present tonight [1:09:45] I I think it's a reasonable request can [1:09:48] you accommodate it [1:09:50] um unfortunately in that case we do have [1:09:52] the building owner's approval to put the [1:09:54] dumpster [1:09:54] um and the plaza where it's at [1:09:57] um they are also signing the nsda in [1:09:59] this case as they are the property owner [1:10:01] so we've worked with with the building [1:10:03] owner in this case I get that you've [1:10:05] worked with the building owner but can [1:10:07] you of your own free will ask the [1:10:09] building owner to think about it I'm [1:10:12] saying the plaza owner again the plaza [1:10:15] owner yes or are they open to I don't [1:10:17] think they care where it is I mean [1:10:20] Longhorn cares where it is in this case [1:10:21] I would recommend that they speak with [1:10:23] their tenant on their concerns but we [1:10:26] have [1:10:27] that owner of the Plaza's concern so [1:10:30] what's your role in this [1:10:32] um we're with Longhorn the development [1:10:34] yes and then the person who is signing [1:10:37] this nsda is the owner of the plaza in [1:10:39] the rear okay [1:10:41] um [1:10:42] so are any of those people in the room [1:10:46] we don't have the [1:10:48] um the property owner at this time we do [1:10:50] have a gentleman here that used to be [1:10:52] the property owner um and they're the [1:10:54] developer for this as well [1:10:56] um but I mean Harris can speak to it as [1:10:58] well they are signing this nsda they [1:11:00] have reviewed our site plans they are in [1:11:02] full consent of this okay [1:11:05] thank you so that puts us in a really [1:11:09] bizarre situation uh it does look like [1:11:12] so I guess we need Dr Korea back up here [1:11:14] to address the extent to which we are [1:11:19] required to agree to deviations [1:11:22] uh so back in 1987 or so [1:11:26] the ability to put something of the [1:11:29] shape and footprint of Longhorn already [1:11:31] existed that is not a dispute at this [1:11:34] time it sounds like there is some leeway [1:11:38] being suggested from staff [1:11:41] with regards to the parking spaces so we [1:11:43] don't have to agree to that the [1:11:45] developers agreement [1:11:46] shifting within that module [1:11:50] then this is a question for our attorney [1:11:52] we have we do not have discretion to [1:11:54] shift within the limits of the [1:11:57] developers agreement is that correct [1:11:58] because it's a sort of a quasi-judicial [1:12:00] thing [1:12:03] a question I'd have to do a little [1:12:04] research to get you the best answer on [1:12:06] that okay so where'd this is going to my [1:12:09] brain is we may need to table this until [1:12:11] we have more of these answers [1:12:14] because I think we've got deviations [1:12:16] that we don't have to Grant [1:12:19] possibly and if we don't have to grant [1:12:21] them and an existing person has made a [1:12:26] kind of a reasonable request even if the [1:12:28] property owners all agree [1:12:31] maybe we could have a discussion about [1:12:33] it anyway mayor I'll be honest it's [1:12:35] unfortunate that this was not brought to [1:12:37] the attention of Staff either like a [1:12:40] long time ago because last time you [1:12:42] could have just we could have because I [1:12:44] think relocating a dumpster it's much [1:12:47] easier than [1:12:49] um you know shifting Shifting the [1:12:51] building right that can happen yeah that [1:12:53] would be completely different it would [1:12:55] be a different lot it would be a [1:12:56] different you know configuration it [1:12:58] changed the whole thing changing a [1:13:01] dumpster is an easier right I know the [1:13:04] architecture was already approved so we [1:13:06] already had that being discussed in the [1:13:08] previous meeting that was in June but [1:13:11] it's an easier you know configuration or [1:13:14] change in a plan especially in so in the [1:13:17] property owner so this was not [1:13:20] advertised to the tenants because we [1:13:22] have the property owner authorization he [1:13:24] was the one applying right so um and [1:13:27] that is the reason why we we would not [1:13:30] you know the city is not obligated to to [1:13:33] but everything we do is it's on the on [1:13:35] public records but um [1:13:38] [Music] [1:13:40] so I mean staff would be willing to to [1:13:43] look at the site and see if there is any [1:13:45] other proposal for a dumpster location [1:13:48] but [1:13:50] um we are not the property owners so we [1:13:52] we cannot [1:13:53] um [1:13:55] have the final [1:13:58] and I guess I've got another question [1:13:59] for the property owner with this trigger [1:14:03] re-engineering your site or is this like [1:14:05] not a big deal [1:14:07] so how Longhorn works on their dumpsters [1:14:09] in a specific location which is behind [1:14:11] the kitchen to prevent those people [1:14:13] sitting on crates in a parking area and [1:14:15] so it's all shielded with a wall and [1:14:17] then with large gates in front of the [1:14:19] dumpster but that building is configured [1:14:21] in a certain way where the dumpster has [1:14:22] to be attached to the building [1:14:24] additionally if you look at the site [1:14:26] plan we do have a limited lot space and [1:14:28] we don't have the ability to go to that [1:14:30] property owner in the rear because we [1:14:32] are selling out this prop parcel and [1:14:34] having a dumpster shared onto their lot [1:14:36] that's something that they wouldn't [1:14:38] agree to because then you would have [1:14:40] tenants you know walking through to the [1:14:42] rear of the other building for the [1:14:45] dumpster situation um so we are [1:14:46] providing dumpster enclosure meeting [1:14:49] oral architectural and legac [1:14:51] requirements all of our Landscaping [1:14:54] except for two islands which is due to [1:14:56] existing lighting fixtures is also [1:14:58] meeting Land Development code and then [1:15:01] the only deviations is in regards to [1:15:03] parking in those small items that she [1:15:05] brought up before we did do full parking [1:15:07] study as well as a traffic study and we [1:15:09] are within ite trip generation and [1:15:12] parking generation for this project at [1:15:13] maximum hours can you point on this or [1:15:16] somebody point on this where are the [1:15:18] dumpsters proposed to be yes [1:15:24] and you can see the gates in front of it [1:15:26] and then the wall on all sides and then [1:15:29] the rear doors Okay so [1:15:35] trees all in that Island [1:15:38] so roughly how many feet is between the [1:15:41] the dumpster area and the facade of the [1:15:45] building to the east [1:15:54] 100 feet [1:15:57] and so this is include these have lids [1:16:01] they're going to be done how often are [1:16:03] you going to empty the dumpsters [1:16:07] like twice a week three every day [1:16:10] twice a week okay if needed they usually [1:16:13] the the concern I have with with the [1:16:16] dumpsters is we just had a code [1:16:17] enforcement action across the street at [1:16:20] the Tijuana Flats shopping center and I [1:16:23] mean and that was horrible if that [1:16:24] occurred here [1:16:26] that that would that would really be [1:16:29] detrimental to to the neighbors so in [1:16:32] this [1:16:33] imagine this is on the is on the side of [1:16:35] their kitchen [1:16:37] concerns in regards to [1:16:39] um that how they care for the dumpster [1:16:41] can also become a Florida department of [1:16:43] health issue because their kitchen is [1:16:45] right out the back door of that so [1:16:46] that's obviously something Longhorn is [1:16:48] really [1:16:49] adamant about their kitchen safety as [1:16:52] well as the dumpster being kept in a [1:16:54] certain way just because of the [1:16:55] proximity to the kitchen [1:17:00] Deputy Mayor can we get her name and [1:17:02] address please oh yes Malaya storm 5404 [1:17:05] Cypress Center Drive thank you or Tampa [1:17:08] Florida [1:17:09] thank you [1:17:12] that's all I've got for now [1:17:16] okay any further discussion well is [1:17:18] there was there a suggestion to table [1:17:20] this because I have the same pretty much [1:17:22] the same concerns the mayor brought up [1:17:26] the only viable thing I can see is to [1:17:29] shift everything to the left and put [1:17:31] more parking in the rear of the building [1:17:32] unless in in front of it and I guess [1:17:35] that means moving things to the [1:17:38] I guess that would be to the West [1:17:41] and put some more space between the [1:17:44] building and the and the existing [1:17:46] restaurants because it's not just [1:17:48] panuzos out there there's a couple other [1:17:49] restaurants on that row too that if I [1:17:52] understand [1:17:56] so we had a motion in a second there are [1:17:58] you saying you want to and I I I would [1:18:01] like to take back my motion and move [1:18:03] that we table resolution [1:18:05] 4364-23 until September 7th so we can [1:18:09] get the information about [1:18:12] you know what we are required to allow [1:18:15] in the form of deviations relative to [1:18:18] the original developers agreement [1:18:23] I don't think we're we're not allowed to [1:18:25] accept anything [1:18:30] okay I think we can allow I don't know [1:18:32] what the process is go ahead go ahead [1:18:35] thanks for everyone's time uh I'm Blake [1:18:38] McRae uh 2215 Emory Drive Tifton Georgia [1:18:43] I'm with Stafford development the parent [1:18:45] company of the developer that is in a [1:18:48] lease agreement with Longhorn the parent [1:18:51] company of Longhorn is Dart in [1:18:53] restaurants [1:18:54] some of y'all may know Darden is this is [1:18:57] pretty much their Hometown [1:18:59] um so I'm sure they take all this in [1:19:01] consideration just as much as I do I [1:19:03] know developers come in here and they [1:19:04] propose things but with a particular [1:19:06] relationship that we have with Darden at [1:19:08] this time they're very cognizant of the [1:19:10] situation and the magnitude of this [1:19:12] development I just ask that maybe with [1:19:16] the I know they're still you know [1:19:18] building permits to be reviewed maybe [1:19:19] the dumpster enclosure can be noted at [1:19:22] that time maybe something be worked out [1:19:23] at that time as well and I'm sure Darden [1:19:26] they would be okay with you know working [1:19:27] something out with the city too I know [1:19:29] we're not just going to just let it ride [1:19:31] and sweep underneath the rug I'm sure [1:19:33] they want to address it just as much as [1:19:34] we want to so we're very concerned about [1:19:36] that but at the same time we are here [1:19:39] tonight to uh just thank everyone for [1:19:41] your time and consideration this has [1:19:43] been a long process just thanks again [1:19:45] for your time and just listening to us [1:19:46] this evening [1:19:49] Mr Cobb are you going to say something [1:19:52] uh yes mayor you withdrew your motion [1:19:56] yes okay [1:19:58] definitely you don't have a motion on [1:20:00] the table right now so there's nothing [1:20:02] to table [1:20:03] however you can that's true you can [1:20:06] continue your consideration to a date [1:20:10] certain and you will need to specify the [1:20:12] day the mayor recommended September 7th [1:20:14] but I will tell you those deadlines for [1:20:17] submittal are coming up in the next few [1:20:19] days [1:20:20] um what is it next Monday [1:20:24] or next Thursday [1:20:26] September 1st we have to publish [1:20:29] well it seems like we ought to be able [1:20:31] to very quickly [1:20:32] find the answer about you know with the [1:20:36] deviations and all that good stuff and I [1:20:38] don't want to hold up the project that's [1:20:40] that's not the intent here it's let's [1:20:41] get the information that we're lacking [1:20:43] as quickly as we can okay one thing [1:20:45] about it is [1:20:47] yes there was a what they call it there [1:20:49] was a development agreement done back in [1:20:51] 1987 that was for the Twin Rivers PUD [1:20:54] this is a commercial track within the [1:20:56] Twin Rivers PUD subsequently there was [1:20:59] probably at that time because it was [1:21:01] before I got your a conditional use [1:21:03] permit which is today's site development [1:21:05] order that was done for the shopping [1:21:06] center [1:21:07] and so those were done the the [1:21:10] the development agreement for Twin [1:21:12] Rivers basically says it's C2 it follows [1:21:14] C2 and that's really all it says doesn't [1:21:16] get into the detail that we get into [1:21:18] nowadays with our non-statutorial [1:21:20] development agreements when you're doing [1:21:21] a non-state 40 development you're [1:21:23] establishing minimum standards you're [1:21:25] not really doing deviations yes they [1:21:27] look like deviations because it's [1:21:29] something different from what's in our [1:21:30] code but for this property you're [1:21:32] actually setting minimum standards for [1:21:34] that this applicant did us like with the [1:21:37] parking this applicant did a study they [1:21:40] said that there was there was capacity [1:21:42] to accommodate the lesser of the Lesser [1:21:45] thing across the entire property this [1:21:47] does encompass the entire the shopping [1:21:49] center as well as the long part it [1:21:50] encompasses everything they did as [1:21:52] parking study the parking study said [1:21:54] that there was adequate parking to [1:21:56] accommodate the restaurant as well as [1:21:58] the shopping center they did a traffic [1:21:59] study as well they really didn't have to [1:22:01] do a traffic study because that was all [1:22:02] taken care of during the approved back [1:22:05] in 1987 with the approval of Twin Rivers [1:22:08] uh so but you can continue it if you [1:22:11] have questions yes that's within your [1:22:13] your authority to say we would like to [1:22:15] continue this then make sure it's to a [1:22:17] date certain so that then we can get we [1:22:19] can get the answers to your questions [1:22:21] for you and get that put back in we have [1:22:24] two meetings in September September 7th [1:22:26] which is a Thursday and we also have [1:22:28] September the 18th so [1:22:30] so you're saying this is not a 24 [1:22:33] deviation then no not in this case [1:22:35] you're setting the minimum standard in [1:22:37] other words you're going to set the [1:22:38] minimum standard for this development [1:22:40] that's what you're doing that's what [1:22:41] that's the difference with the between [1:22:42] the development agreement and a site [1:22:44] development order a site development or [1:22:46] if it was coming for you it would be [1:22:48] listed as a deviation a 24 deviation to [1:22:51] the parking regulations but in this case [1:22:53] you're actually saying that this [1:22:55] property will have how much 200 257 so [1:22:58] we're we're making rules right out of [1:23:02] thin air and that is my concern is that [1:23:04] we're making rules out of thin air it's [1:23:06] not out of thin air well no it's based [1:23:07] on stuff I agree based on studies but we [1:23:11] don't have to have these be the rules we [1:23:14] can have different rules because we are [1:23:17] making them up not making them base [1:23:19] basing them on but issues not parking [1:23:21] right the issue is is the dumpster is [1:23:24] the location so two considerations that [1:23:26] I wanted to bring one is that this is [1:23:28] not a a unique situation right in [1:23:32] Suburban development when you have the [1:23:34] development sat way back there are [1:23:36] sometimes out Parcels right so we have [1:23:39] several examples of that Central Square [1:23:41] is building the last out parcel right [1:23:43] the publics have several out Parcels so [1:23:46] this is not an uncommon situation now we [1:23:49] can try so for the dumpster if we cannot [1:23:52] move the dumpster there are landscape [1:23:54] you know solutions that we can you know [1:23:57] enhance to to [1:23:59] trying to to disguise right or to try to [1:24:02] buffer or like get some fans that have [1:24:05] to blow towards Longhorns or something I [1:24:07] don't know we we can work on that so I [1:24:10] don't know if um because if it's a [1:24:13] completely rearrangement of the site [1:24:16] then it's going to be very hard to come [1:24:18] in September 7th right it feels like [1:24:21] it's going to be beautiful can Longhorn [1:24:23] agree to put fans blowing any potential [1:24:27] smells well [1:24:28] that's not it I mean we're not Engineers [1:24:31] here but that's something all we're [1:24:34] trying to do is we we know that there's [1:24:36] a there could be a new sense caused by [1:24:39] the dumpsters and we need to find a way [1:24:40] a solution to resolve that nuisance but [1:24:44] we're allowed to put that in this type [1:24:46] of document that's what I'm saying this [1:24:48] is such a flexible malleable document we [1:24:51] can put these things in it and it could [1:24:54] directly address the one concern [1:24:57] that I I think we can probably address [1:25:00] this late in the game which is the smell [1:25:04] is that something you can just on that [1:25:06] spot [1:25:07] say you're cool with [1:25:11] I feel like that would move over into a [1:25:14] building permitting type of document [1:25:15] while the mlup does kind of leave [1:25:18] availability [1:25:19] um for us to make deviations from code [1:25:21] I'm not sure that it sets the [1:25:23] availability to implement stuff above [1:25:25] code requirements um so with that being [1:25:27] said you know we did provide everybody [1:25:30] as well as staff the parking studies [1:25:32] support it the parking counts we do meet [1:25:34] Seminole County code on the parking [1:25:36] study as well and then we would just ask [1:25:39] potentially that we could make a [1:25:41] condition of this approval that we add [1:25:43] additional landscaping or buffer between [1:25:47] the trash enclosure and the rear uses as [1:25:53] a condition of this document [1:25:55] so how what would that look like from a [1:25:57] legal perspective we would not [1:25:59] necessarily approve this document per se [1:26:01] tonight we would approve a document [1:26:03] that's slightly modified and we'd still [1:26:05] have to revisit it on the 7th [1:26:08] I think that it's a messy mayor um [1:26:11] procedurally I would like a chance to [1:26:13] look at it just [1:26:14] the options are in this specific context [1:26:17] okay so it sounds like at this point the [1:26:20] cleanest method is to continue this [1:26:22] until September 7th I would continue it [1:26:24] till September 18th that far I don't [1:26:27] want to that gives them time to research [1:26:28] it [1:26:31] can you guys live with the 17th 18th or [1:26:35] 18th whatever yeah [1:26:36] I know you don't want to live beyond [1:26:39] today but yeah no I understand I mean uh [1:26:42] unfortunately we would not be able to to [1:26:44] live with it because per our lease [1:26:46] agreement we have to have government [1:26:48] approval by a certain date [1:26:50] and what's your drop dead date like this [1:26:52] Friday so Friday and your staff has been [1:26:55] awesome with getting us here and I [1:26:58] appreciate every one of you guys but it [1:27:00] is really is it's like it's at that [1:27:02] point and so as far as certain [1:27:04] conditions that we can discuss I mean I [1:27:06] know there's [1:27:07] um as far as dumpster enclosure you know [1:27:09] as far as if there's regular maintenance [1:27:11] associated with that with pressure [1:27:12] washing and cleaning of the dumpsters uh [1:27:15] you know disposing getting them [1:27:17] maintained more often you know we'd have [1:27:19] to talk to the owner about that but yeah [1:27:22] we're kind of at that at that critical [1:27:23] moment that [1:27:26] 2021 and if we don't get approved this [1:27:28] week then [1:27:30] all bets are off it's all done like and [1:27:32] we're out I mean yes I guess the only [1:27:34] question I would have in this back to [1:27:36] staff how did we get to this point we're [1:27:37] we're at a deadline [1:27:39] tonight for the for Friday for this [1:27:42] applicant it seems like this should have [1:27:43] come to us sooner [1:27:47] we can only bring when it's ready right [1:27:49] so yeah but it's ready he has a deadline [1:27:52] by this Friday I mean so how does that [1:27:55] happen [1:27:56] to me everything we do is on the clock [1:27:58] we did not control the applicants [1:28:01] right so everything if every time we [1:28:05] review plans it's on the clock [1:28:07] today's efficiency 21 8 Days first [1:28:10] compliance 21 to a second compliance [1:28:14] 14th when did the applicant turn in the [1:28:18] proposed like who crafted this I'm [1:28:20] guessing the applicant crafted the [1:28:22] non-statutory development agreement when [1:28:24] did it come in [1:28:26] so I don't have debates here okay we got [1:28:29] dates back here somebody's going to jump [1:28:30] in and tell us [1:28:32] I don't understand how we have four days [1:28:35] development review manager the [1:28:37] application came in in November of 2021. [1:28:40] so [1:28:41] this non-statutory development agreement [1:28:44] has been in our hands for two almost two [1:28:46] years and it's never been shown to us [1:28:48] until four days before they have a [1:28:51] triggered deadline am I understanding [1:28:54] this correctly [1:28:56] we've gone through the process where [1:28:58] they go through review and then they go [1:29:00] to land planning agency into City [1:29:02] Council [1:29:03] I'm talking about this document [1:29:05] specifically the non-statutory [1:29:06] development agreement [1:29:08] when that that not the site plan not the [1:29:11] architectural I know they've been going [1:29:12] through different parts of review but [1:29:14] this the nsda [1:29:16] uh when did this hit our end [1:29:21] it was November of 2021 that came in [1:29:24] there was a period of time where this [1:29:26] application laid dormant for almost a [1:29:28] year [1:29:28] and then they revved it up okay so this [1:29:32] has been an on our in our court since [1:29:34] 2021. the application came over here [1:29:37] just the application not the nsda [1:29:43] yes so the application comes it's an [1:29:45] nsga in a conceptual development plan [1:29:47] right this document the 21 Pages not the [1:29:50] final one but in the final one not but [1:29:54] the proposal the application to start [1:29:56] the process yes the thought to create a [1:29:58] 21-page or so document that began in [1:30:01] 2021. at what point did was there a [1:30:04] draft of what we're looking at now the [1:30:06] 21 pages [1:30:09] the the current draft that we have [1:30:11] or some something kind of close to it [1:30:14] that would have [1:30:15] said what the buffers were and all these [1:30:18] things [1:30:19] the documents changed over time so the [1:30:23] most recent where it was close to this [1:30:26] version is probably back in May or June [1:30:28] of this year okay so three four months [1:30:30] maybe yeah and and since then there's [1:30:33] been some tweaks in language and back [1:30:35] and forth to make sure that the [1:30:37] development agreement reported to the [1:30:39] Twin Rivers ped and some other issues [1:30:41] that we need to go ahead and iron out as [1:30:43] far as you know having the proper owner [1:30:45] and you know little items that we have [1:30:48] to iron out to make sure that it's ready [1:30:49] to go to the land planning agency and [1:30:51] city council okay [1:30:55] mayor if I may that there is no site [1:30:58] plan at the moment that's submitted so [1:31:01] you it is possible if the council once [1:31:04] wishes to put [1:31:06] um conditions on the approval of what's [1:31:09] before you tonight that's that is an [1:31:11] option if you would like to do that and [1:31:13] then you can address the further [1:31:15] concerns in the site plan approval but [1:31:17] would this site plan necessarily come [1:31:19] before us they don't have to correct as [1:31:22] long as there's no deviations [1:31:24] this is back to the thing we already had [1:31:26] an issue with so I don't want us to get [1:31:28] stuck in a spot where this is our last [1:31:30] bite at the Apple and we don't address [1:31:33] what would I think is a reasonable [1:31:34] concern [1:31:36] yeah unless you have specific requests [1:31:38] so if you it's to enhance the landscape [1:31:41] so that it buffers you know any nuisance [1:31:44] you're laughing at me but I'm serious [1:31:46] fans that's that gets the smell going [1:31:50] the right way for sure if you guys can [1:31:52] agree to fans [1:31:54] I'm all in tonight [1:31:58] so why not enclose it with a roof and [1:32:01] put exhaust fans on it and then if it [1:32:04] smells under the roof you guys will have [1:32:05] to do something about it [1:32:10] you know I don't know this this really [1:32:12] is impacting existing [1:32:15] restaurants out there I know you've [1:32:16] probably worked in good faith but these [1:32:19] these folks have been here for a long [1:32:21] time and [1:32:23] I can't see where it wouldn't impact [1:32:24] them so we need to do something to try [1:32:27] to mitigate that [1:32:30] um [1:32:31] I mean as of right now she's making a [1:32:33] phone call to the director of real [1:32:34] estate for Darden she's the key decision [1:32:37] maker [1:32:38] um she can see what asked if they can [1:32:40] meet with with staff or or the I mean [1:32:43] tenants the fans I'm I'm very [1:32:45] open-minded to anything [1:32:47] um but as we know with anything that's [1:32:49] mounted outside such as a fan or [1:32:51] anything like that how long is that [1:32:52] going to last is it going to break down [1:32:54] I mean I I totally get it that's the [1:32:56] same thing with the gates yeah how long [1:32:58] does it get I mean the gate's going to [1:32:59] stay closed and they just leave them [1:33:01] wide open that's right and you get the [1:33:03] rodents and everything else in there in [1:33:04] front of the restaurant right no I [1:33:07] totally get it I totally understand what [1:33:08] you guys are saying [1:33:10] um I just feel like maybe during site [1:33:11] plan review or building permit reviews [1:33:13] some of that stuff can be addressed we [1:33:15] can still sit down and have those [1:33:16] discussions at that time I'm just asking [1:33:18] for approval with conditions so we can [1:33:20] move this still forward provide a nice [1:33:22] sit-down restaurant for the citizens of [1:33:24] Oviedo so [1:33:26] is there even a mechanism in our code [1:33:28] for us to approve condition upon us [1:33:31] getting to deal with the dumpsters later [1:33:33] I don't think we have we do okay please [1:33:36] tell us about this method you could do [1:33:38] it you could do a motion to adopt with [1:33:40] the condition that [1:33:42] the dumpster the dumpster enclosure [1:33:45] we'll just call it I'll call it [1:33:46] enclosure the enclosure of the dumpsters [1:33:48] will have to be addressed at site at [1:33:51] site development order to [1:33:54] and it has to come back to council I [1:33:55] think that staff can't do it on their [1:33:57] own with increased Landscaping ever how [1:34:00] you know even like Mr Britton explore [1:34:02] that option you didn't answer your [1:34:04] question you know and we wanted to come [1:34:06] back to us I think do we all want it to [1:34:08] come back [1:34:09] versus staff just said oh that's as good [1:34:12] as it gets I want to be sure that [1:34:13] whatever solution we come up with [1:34:14] actually works and that it's done [1:34:18] I will say this coordination of the [1:34:20] tenants you can insert language into the [1:34:23] development agreement that the site [1:34:25] development order must be approved by [1:34:26] Council okay but you can't impose it on [1:34:29] them they have to agree to it the [1:34:31] agreement isn't it is an agreement they [1:34:34] have to agree to the conditional [1:34:35] language being added to the added to the [1:34:37] nsda okay that their side plan will be [1:34:40] approved by Council if they don't agree [1:34:42] to it then we'll write back to I would [1:34:43] say continuous okay but can I can I ask [1:34:48] the applicant question real quick yes so [1:34:50] you said that it has to be approved by [1:34:52] the governing body by Friday right [1:34:56] but it's not getting approved because [1:34:58] the site development order or the the [1:35:02] um final engineering does this allow a [1:35:04] closing to occur is that that the bench [1:35:06] Mark year ma'am I'm sorry does this [1:35:09] allow a closing to occur like you get [1:35:10] the nsda then everything is set so you [1:35:12] can begin your real estate moving okay [1:35:15] so you're you're working towards a [1:35:16] closing correct right okay and this is [1:35:19] your deadline on Friday so if we approve [1:35:21] it uh subject to uh adding language that [1:35:25] the site plan will come before this body [1:35:27] to make sure that we're cool with the [1:35:29] dumpster resolution at a later date will [1:35:31] that get you where you need to go [1:35:34] I can't really answer that I don't know [1:35:36] if uh she's she's probably on the phone [1:35:38] with somebody trying to figure out what [1:35:39] she's probably talking to a person that [1:35:40] probably needs to be here to tell us yes [1:35:42] or no uh unfortunately Madam I'm I'm [1:35:44] unable to answer that part so [1:35:47] um so I'm sorry okay well well can we [1:35:52] can we do this and give them some time [1:35:54] and let's you want to talk about the [1:35:58] discussion item and then we can come [1:36:00] back to this while you guys uh actually [1:36:03] she's coming back now yep [1:36:10] you're on the hot seat [1:36:12] sorry so where we are right now is uh [1:36:16] proposing language to approve this [1:36:19] roughly as it is but added a provision [1:36:21] if you guys will agree to it that the [1:36:24] site plan uh the site development order [1:36:27] will return to council so we can make [1:36:30] sure we're comfortable with the the way [1:36:31] the dumpsters are addressed [1:36:36] so it's so the question that was then [1:36:39] it's site plan not the site development [1:36:41] oh that okay [1:36:49] happy to me if I could re request that [1:36:53] this is bumped to the last item and we [1:36:55] can have a meeting even with the [1:36:57] panusa's representative to see if we can [1:37:00] have any kind of agreement you know that [1:37:02] would be good okay all right okay I [1:37:04] think we're in agreement there all right [1:37:06] okay thank you so what are we going to [1:37:08] the uh we're going to the concessions [1:37:10] the discussion item [1:37:13] you guys are hardcore all the scouts [1:37:15] thank you for sticking this out I am so [1:37:18] impressed [1:37:19] got a real lesson today they're helping [1:37:21] us with a pledge of allegiance yeah [1:37:25] you're good [1:37:33] they're all revved up for you [1:37:39] I got time to go to the restaurant this [1:37:41] usually doesn't yeah we'll take a five [1:37:43] minute bile break [1:43:48] we're ready to go ahead and move on to [1:43:50] discussion item [1:43:52] [Music] [1:43:56] so we're on item 15 here [1:43:59] discussion item veto sports complex and [1:44:02] Shane Kelly concession operations Mr [1:44:04] Kyle be by the brief introduction are [1:44:06] you going to let this Belden go ahead [1:44:08] and jump right into it all right let Mr [1:44:10] Belden go at it [1:44:14] good evening honorable mayor Deputy [1:44:16] married council members tonight City [1:44:17] staff is requesting [1:44:19] direction from city council with regards [1:44:21] to Outsourcing [1:44:23] concessions operations at Oviedo Sports [1:44:25] Complex and Shane Kelly Park tonight [1:44:28] staff is recommending that we amend the [1:44:30] existing agreements with Oviedo Babe [1:44:32] Ruth and the Florida crazed Crush youth [1:44:36] organizations to allow them to operate [1:44:39] their own concessions utilizing City [1:44:40] facilities with the respective [1:44:42] facilities that they use Oviedo Babe [1:44:44] Ruth uses a comp Sports Complex creates [1:44:47] crushes at Shane Kelly Park [1:44:49] secondly staff is recommending that we [1:44:51] utilize the net savings from these [1:44:53] changes to unfreeze to maintenance [1:44:56] worker one positions that would then be [1:44:59] utilized within the Park's maintenance [1:45:00] division in your packet we had [1:45:02] attachment number one that provided [1:45:04] those net savings to you [1:45:06] to break that down for you from savings [1:45:09] and temporary staffing and concession [1:45:12] supplies there was approximately overall [1:45:14] Savings of 137 thousand dollars [1:45:17] on the flip side with us giving up the [1:45:18] concession stands to the youth leagues [1:45:20] there is obviously a reduction of [1:45:22] Revenue so the net revenue loss [1:45:25] incorporating the concession stand lease [1:45:27] that the leagues would pay the city [1:45:29] equates to a little bit over forty six [1:45:32] thousand dollar deduction at the end of [1:45:34] the day net savings is just shy of [1:45:37] ninety one thousand dollars which we [1:45:39] staff is requesting to be [1:45:41] um [1:45:42] recommended to unfreeze those two [1:45:43] positions this evening it is recommended [1:45:47] that city council provide discussion and [1:45:49] direction to staff with regarding the [1:45:51] libido concession stand operations and [1:45:53] this evening I have joining me is our [1:45:55] the president of your Babe Ruth Jason [1:45:57] McCluskey he'd be more than happy to [1:45:59] answer any questions regarding them [1:46:00] taking on on their role best idea ever [1:46:04] I've been hoping we do this for seven [1:46:05] years it's about time [1:46:08] so is uh [1:46:10] is there going to be a cost sharing or [1:46:12] is it going to be at least to the the [1:46:14] leagues or what so [1:46:16] presently if this is a uh if we get the [1:46:18] proper direction this evening we would [1:46:19] do an amendment to their agreement [1:46:21] incorporating a concession lease as part [1:46:23] of their normal agreement okay with [1:46:25] regards to Oviedo Babe Ruth it would [1:46:27] basically be twelve thousand dollars how [1:46:29] much twelve thousand dollars Revenue a [1:46:31] thousand dollars per per month okay uh [1:46:33] Florida crazy crust would be a four [1:46:36] thousand dollars per year uh broken down [1:46:38] you know by monthly [1:46:39] so where does the [1:46:41] the revenue for the maintenance workers [1:46:43] come from [1:46:44] there's no revenue for the maintenance [1:46:46] workers we're not paying people to sell [1:46:48] constructions anymore yeah so so we [1:46:50] pulled so we're pulling off City staff [1:46:52] that were running the thing and [1:46:53] transferring that over to them so labor [1:46:55] running these concession stands is one [1:46:57] of our key components it took it took up [1:47:00] a lot of our uh you know budget uh we're [1:47:03] not capturing the full-time hours that [1:47:05] are associated with this so full-time [1:47:07] staff are just being reallocated we are [1:47:08] shifting our model of concessions over [1:47:11] to the gymnasium and Aquatics facility [1:47:13] the Cantina in Oviedo in the park and [1:47:16] Riverside Park which soon will have our [1:47:18] new Senior Center as well as a skate [1:47:20] park so you weren't making money on [1:47:21] these concessions we were they were they [1:47:24] were making money [1:47:26] um this is the chance that we just did a [1:47:28] full review of the operations and we [1:47:30] feel that by making these changes we can [1:47:33] shift our resources elsewhere without [1:47:35] losing the service level to the [1:47:38] customers [1:47:39] partnering with Oviedo Babe Ruth and [1:47:41] crazed Crush will serve as a fundraiser [1:47:43] for those programs they can now generate [1:47:46] some fundraising activity to now be [1:47:48] pumped into their program and [1:47:49] potentially be offset and return to the [1:47:51] city for maintenance so let me put [1:47:53] another way your recommendation is a is [1:47:55] a net [1:47:57] cost to the city's Net Zero cost of the [1:47:59] city [1:48:02] there's true savings we are trying to [1:48:04] reallocate those savings into the [1:48:06] maintenance workers that are truly [1:48:07] needed in the Parks division [1:48:09] one of them would be stationed at Oviedo [1:48:11] Sports Complex there's four individuals [1:48:13] that maintain that facility so it's a [1:48:15] net zero [1:48:17] essentially I mean better cost recovery [1:48:19] in our and our efficiency increases by [1:48:22] making this transition [1:48:24] okay okay [1:48:25] do you want to say something [1:48:30] I can't so uh my name is Jason McCluskey [1:48:33] I'm the president of Vito Babe Ruth uh [1:48:36] so like Paul pointed out that this is [1:48:38] going to help us with fundraising in the [1:48:40] park uh all of our families and stuff [1:48:43] like that where we can donate stuff back [1:48:45] to the park to do some upgrades that [1:48:47] they're asking for [1:48:49] um and basically just allow us to be [1:48:51] open during all of our times because [1:48:53] there has been some times that well the [1:48:55] city can't host everything that we have [1:48:58] going on so the concessions are closed [1:48:59] and [1:49:00] we have people asking us where they can [1:49:02] get waters and stuff and we have [1:49:04] injuries and nobody can get ice and [1:49:06] stuff like that so this allows us to [1:49:08] help out everybody that's there at the [1:49:10] park to play with us so you guys are in [1:49:12] agreement correct yeah we went through [1:49:13] our board we've been talking now I think [1:49:16] for like six months back and forth [1:49:19] um and then we went to our our board and [1:49:21] our board approved it I have not [1:49:23] mentioned it to all of our players yet [1:49:25] until tonight until it was approved or [1:49:27] whatever uh then I was gonna go to the [1:49:30] all the families to let them know but [1:49:31] right now it's just our board members [1:49:32] that know okay okay all right some [1:49:35] crazies the same way they're [1:49:38] was receptive we are still working on [1:49:40] some of the the the details on how to [1:49:43] take that over uh which I'm confident we [1:49:45] would work those details out the uh [1:49:47] Oviedo literally they don't use our [1:49:49] facilities do they they're just out did [1:49:50] they use um the sports complex but they [1:49:52] have their own concessions stands at [1:49:54] their facility now you're running that [1:49:55] themselves okay we're one of the few [1:49:59] municipalities that actually run our own [1:50:00] concessions in the state little in the [1:50:02] nation a lot of Youth groups operate [1:50:04] their own concession stands and we feel [1:50:07] um you know there's been discussions in [1:50:08] the past about concessions and even the [1:50:10] facility for that matter and after [1:50:12] further thought and review of Staff I'm [1:50:15] open to this opportunity um it's I think [1:50:17] it's going to be a benefit for the city [1:50:18] but I think it's gonna be a benefit for [1:50:19] the community [1:50:20] on top of that so so I have a I have a [1:50:23] couple questions so the current [1:50:24] concession supplies that are in there [1:50:26] that were paid for by the city what's [1:50:28] going to happen to those supplies are [1:50:31] they going to be reallocated together so [1:50:34] the the the reduction of supplies is [1:50:36] sixty thousand five hundred dollars [1:50:37] that's the savings so what's the Forty [1:50:40] thousand for [1:50:42] are we still putting supplies in the [1:50:44] concession stand so yeah the remaining [1:50:46] forty thousand is for the three is for [1:50:48] the stands that are still open the [1:50:49] gymnasium and Aquatics facility okay yes [1:50:51] yeah we're still operating those things [1:50:52] so but the the ones that are in the [1:50:54] concession stand at at the at Shane [1:50:59] Kelly and at [1:51:00] um of the Sports Center Sports Complex [1:51:03] those ones are those those con those [1:51:06] supplies are going to be reallocated to [1:51:08] the existence we reduce those completely [1:51:10] from the budget from those four stands [1:51:11] yes okay that's what he's asking is if [1:51:13] there's stuff left over when they take [1:51:15] over we're giving them shells of [1:51:17] buildings not supplies that they're [1:51:18] selling and keeping the profit that's [1:51:20] one thing I didn't share with you as [1:51:21] we're currently working on [1:51:24] um as part of their Amendment any of the [1:51:26] equipment that's left in the stands the [1:51:28] league is um willing to purchase that [1:51:31] back from the city as part of their [1:51:33] Amendment [1:51:34] but what if we have a city event at [1:51:37] those facilities now we're not going to [1:51:40] have access to the to the concession [1:51:42] stands at the at the complex or Shane [1:51:45] Kelly yes that's something we would [1:51:47] still work in with them uh they would [1:51:49] provide the opportunity to open [1:51:51] concessions for those events we don't [1:51:53] have any City events at those two [1:51:55] locations right now other than the the [1:51:57] crazed Crush Youth League games [1:51:59] or the sports complex tournaments or [1:52:03] their own you know [1:52:10] we did the project pressure way back [1:52:13] um [1:52:15] my issue is is we're giving we're giving [1:52:19] you know something that you know piece [1:52:22] of our property you know over to them I [1:52:25] mean there's a there's a lease agreement [1:52:27] but then we're not entitled to use it [1:52:29] anymore for anything that we may want to [1:52:32] do right as part of the the agreement [1:52:33] we're also going to require that if [1:52:36] there's any usage in the in the complex [1:52:37] that they're going to be responsible for [1:52:39] opening the stands for those groups so [1:52:40] if if a beetle B Ruth is not as complex [1:52:43] but literally just using the you know [1:52:44] two fields for instance they would have [1:52:46] to open up the stand for that practice [1:52:48] same for a softball tournament same [1:52:50] thing just like for our adult softball [1:52:52] teams that are City sponsored if we have [1:52:54] a games going on on Monday night out [1:52:56] there but there's no other activity in [1:52:58] the complex Oviedo Babe Ruth will be [1:53:00] required to open up the stand for our [1:53:01] city-sponsored program okay okay and [1:53:04] that's that's a revenue generator for [1:53:06] for you guys I assuming you're going to [1:53:08] be using volunteers right correct yeah [1:53:09] so the volunteers uh basically of our [1:53:13] members of The League uh we are so we're [1:53:15] going to reach out to high schools and [1:53:17] stuff like that uh and try to do the [1:53:19] community service hours and stuff like [1:53:21] that [1:53:22] okay be careful with that I haven't used [1:53:24] to do that [1:53:25] we ate more popcorn than we sold yeah [1:53:27] and there's also be a transition period [1:53:29] with this [1:53:30] um If This Were to if we got the [1:53:32] direction from Council this evening we [1:53:33] would use the month of September as a [1:53:35] slow transition period we would you know [1:53:37] the leagues only take on one stand [1:53:40] the other two stands would be monitored [1:53:41] by City staff so there could be a [1:53:42] transition we're going to train their [1:53:43] staff we're also going to work them [1:53:45] through the tanks and [1:53:46] um as far as the equipment and show them [1:53:48] how to use it properly also make sure [1:53:50] that their staff or volunteers are [1:53:51] certified through the Safe Surf program [1:53:54] so no it sounds like a good plan [1:53:56] sale I'm not sold on that okay well [1:54:01] greatest thing ever but it sounds like [1:54:03] you got consensus so we have consensus [1:54:06] right we have consensus okay all right [1:54:07] all right sorry Bob all right thank you [1:54:09] thank you thank you Mr McCloskey [1:54:13] no appreciate it [1:54:15] all right all right we're back to [1:54:17] resolution [1:54:18] 4364-23 Master land we use plan and [1:54:22] non-statutory development agreement plan [1:54:24] for Lockwood Village shopping center [1:54:29] thank you Deputy Mayor so we reached an [1:54:31] agreement uh we what we're going to do [1:54:34] so he is we're going to flip the the [1:54:38] dumpsters the enclosure they are facing [1:54:41] now East [1:54:44] now they're gonna face Southeast [1:54:47] so they are not gonna face [1:54:49] um if we can pull the the I got it [1:54:52] pictured [1:54:58] yeah that okay with you guys [1:55:00] all right [1:55:02] okay [1:55:05] so it's not gonna face the restaurant [1:55:06] anymore and uh what we agreed also is to [1:55:10] increase the the enclosure the walls and [1:55:14] then to enhance with landscape okay so [1:55:17] they are not going to look at the [1:55:19] dumpsters it's going to be now facing [1:55:21] the drive aisle so where you see over [1:55:24] there the South you know east corner [1:55:28] where you have the huge island that's [1:55:30] where we're gonna put the dumpsters and [1:55:34] now they're gonna be facing 90 degrees [1:55:36] to the [1:55:38] um driving aisle that it's going you [1:55:42] know to the east so that area is going [1:55:45] where you have the dumpsters it's going [1:55:48] to be moved and over there you're gonna [1:55:50] have dumpsters to move higher walls more [1:55:54] Landscaping more landscape enough [1:55:56] so that little curved area [1:55:59] Corner that's where the dumpsters are [1:56:00] going to go yes there's some Landscaping [1:56:02] in there and then you'll move the [1:56:03] Landscaping over a little bit yeah okay [1:56:06] all right okay everyone's agreeing and [1:56:09] we are going to I'm going to um we're [1:56:11] gonna communicate now with the [1:56:14] um tenants and we are going to send to [1:56:16] them just so that we need to make any of [1:56:19] that in our in the motion or are we good [1:56:23] we need words we can trust you and I can [1:56:26] sign this on Friday so we're so we're [1:56:29] not signing something tonight I want to [1:56:30] make sure that the words that we come up [1:56:32] with in this agreement is reflected I [1:56:34] think you approved with the condition [1:56:36] that the conceptual development plan is [1:56:38] is is amended and the side plan reflects [1:56:42] you know the amendment to show the [1:56:44] dumpsters at that location where you [1:56:48] have the island [1:56:49] um not facing the restaurant so not [1:56:51] facing the shopping center facing the [1:56:53] South you know East portion with higher [1:56:57] enclosures and enhanced landscape around [1:57:00] it [1:57:01] okay I move we do what she just said [1:57:04] can we also add a second can we add one [1:57:08] other thing [1:57:09] that we don't have to amend the [1:57:11] architectural design order to do this [1:57:15] you've already approved it back in June [1:57:17] and I would appreciate that we can do [1:57:20] these these adjustments without having [1:57:22] to think that they're going to change [1:57:23] right yeah it doesn't change the [1:57:26] materials no so that's what we approved [1:57:29] yeah I just want to make sure because of [1:57:31] the Mr developer can you do this as a [1:57:33] field change [1:57:35] okay uh [1:57:38] we got Pastor bedtime [1:57:41] at least we're not Winter Springs yet [1:57:44] so [1:57:45] Okay so [1:57:49] all right so basically what I would [1:57:51] recommend is this make it make a motion [1:57:52] to adopt the resolution [1:57:56] uh with the [1:57:59] changes that were addressed by Dr Correa [1:58:04] in that the dumpster area will be [1:58:06] relocated facing the southeast and that [1:58:10] there will be taller Walls and More [1:58:12] landscaping and did I cover everything [1:58:16] and that that has to be all done as part [1:58:20] of the stock development [1:58:21] I move we have adopt resolution 4364-23 [1:58:27] on the condition that we add in language [1:58:30] that the angle of the dumpsters will be [1:58:33] shifted to the southeast the walls will [1:58:35] be higher by an amount of [1:58:38] two feet [1:58:39] and additional Landscaping in the form [1:58:43] of [1:58:45] bushes trees and other it that it will [1:58:49] not pay a buffer an opaque okay A little [1:58:52] pig buffer I like that something that we [1:58:54] cannot tell is a wall so much vegetation [1:58:58] we can't tell it's a wall [1:59:01] I think that's the motion no that is the [1:59:03] motion is that the motion I don't know [1:59:05] if I said a complete sentence is the [1:59:07] last thing but second you get the idea [1:59:09] we have a motion in a second [1:59:11] a discussion [1:59:14] all right I'm glad we were able to [1:59:16] resolve this tonight so everybody can [1:59:19] move forward [1:59:20] okay and thank you for coming and [1:59:22] speaking [1:59:24] oh yes we can [1:59:26] all those in favor say aye aye [1:59:30] thank you so much thank you [1:59:31] [Music] [1:59:36] okay city managers report I have no [1:59:39] report deputy mayor all right City [1:59:41] attorney's report [1:59:43] Mr Deputy Mayor good evening mayor [1:59:46] council [1:59:47] I just wanted to report that at the last [1:59:49] meeting you requested that I send a [1:59:51] request for an advisory opinion to the [1:59:53] division of Elections [1:59:55] um pertaining to [1:59:58] um whether the city's authorized to post [2:00:01] factual information about the bond [2:00:03] referendum on its social media as well [2:00:06] as website and just wanted to let you [2:00:08] know that that request was sent on [2:00:11] August 14th the division of Elections [2:00:14] confirmed receipt on August 16th and in [2:00:17] the request I did include a statement of [2:00:19] necessity for an expedited response so [2:00:22] hoping to hear back soon [2:00:24] thank you okay thank you [2:00:28] council member Britton [2:00:30] uh real quick just want to [2:00:33] kind of update on the league of cities [2:00:35] conference that we went to last week it [2:00:37] was [2:00:39] you don't always go to every every [2:00:41] session they have but they had some good [2:00:42] sessions on [2:00:44] the effects of artificial intelligence [2:00:47] they had a couple CNN anchors on there [2:00:52] that gave a pretty pretty cool [2:00:53] presentation on on the state of things [2:00:56] that we have in our country and maybe [2:00:59] the need to tone it down a little bit [2:01:01] and I'll wait to see that from them [2:01:05] one conversation I had was with a group [2:01:07] that's [2:01:09] vendor for this program called red speed [2:01:12] and chief I've I've talked to you about [2:01:14] it uh it's a program that the state [2:01:18] legislatures have passed into the law [2:01:19] where they would put speed cameras up in [2:01:23] school zones [2:01:24] and it'll [2:01:26] have a sign they're saying you're on [2:01:27] camera any car going over uh 10 miles an [2:01:31] hour over the limit in the school zone [2:01:33] gets a hundred dollar ticket [2:01:34] automatically [2:01:36] I think that's a good idea that there [2:01:39] was a report on the news the other night [2:01:41] that I think Winter Garden has already [2:01:43] implemented it and it's it's pretty easy [2:01:46] to see there's a sign that said you're [2:01:47] on camera and here's your speed and if [2:01:49] you don't slow down you're going to get [2:01:50] a hundred dollar ticket so Chief I know [2:01:52] you wanted to to work with the county on [2:01:54] this but I I'd hate to wait to let that [2:01:57] bureaucracy take effect is there any way [2:01:59] we can [2:02:00] take some steps and get out in front of [2:02:02] this and maybe be the leaders on this [2:02:07] okay I'm not advocating the fellow I [2:02:11] talked to was very very impressive uh [2:02:14] so but I'm not advocating a particular [2:02:16] vendor just just want to see if we can [2:02:18] go find someone that can do this and [2:02:20] take the lead and do what we normally do [2:02:23] lead lead stuff shouldn't we vet it a [2:02:26] little bit more just to make sure that [2:02:27] there's no there's always going to look [2:02:29] at it may make sure it doesn't because I [2:02:31] think there's some legislation that had [2:02:33] to do with red light ticketing uh red [2:02:35] light cameras this last season I know [2:02:37] comes up over and over again and and it [2:02:39] there's this red light cameras this was [2:02:41] school zone I get it the red light in a [2:02:43] school zone may be kind of different [2:02:45] things but I think there will be some [2:02:47] pushback [2:02:48] well I hope there is because I go [2:02:50] through school zones all the time and I [2:02:51] get past like crazy especially on 419. [2:02:55] uh I've been hit [2:02:57] by a bunch of emails from different [2:02:59] vendors on the same thing once once the [2:03:01] bill was passed it only specifically [2:03:03] governs school zones during school times [2:03:05] is effectively a red light camera [2:03:07] instead of a camera a red light is for [2:03:09] Speed yeah and uh it's a flat rate [2:03:12] already already decided to pass by the [2:03:15] state legislator for all uh all of [2:03:18] Florida [2:03:19] I've we had a Chiefs meeting the other [2:03:21] day and it doesn't appear to anybody in [2:03:23] the county is ready to move forward on [2:03:25] it uh any any municipalities or the [2:03:28] county itself but we'll start looking [2:03:30] into it and see where we go with this [2:03:33] for what vendor and what it'll take and [2:03:35] what the costs are and all of that so [2:03:38] okay I don't [2:03:41] try to keep in my mind what what school [2:03:43] zones we have in the city and I think [2:03:45] there's only uh on 419 maybe on Alafaya [2:03:49] Woods Boulevard [2:03:51] depending on depending on where they [2:03:53] what roads they allow them on and I [2:03:56] can't I don't I don't I can't give you [2:03:57] that answer Mitchell hammock and uh [2:03:59] Alfie Woods Boulevard yeah it's a [2:04:02] signalized intersection but still yeah I [2:04:04] don't yeah I don't see the sign hanging [2:04:06] over the road saying you know 20 miles [2:04:08] an hour when the lights flashing like [2:04:09] they have correct uh in front of [2:04:11] stenstrom uh in front of by just by [2:04:15] every Elementary School somewhere [2:04:16] there's probably one parking's got one [2:04:18] on our street on Twin Rivers Boulevard [2:04:21] Alfie Woods Boulevard [2:04:25] off the top of my head that's the two [2:04:26] Live Oak has one yeah that would [2:04:31] probably be yeah I just uh I think it's [2:04:34] attractive to me because I I see us [2:04:37] every day people driving like [2:04:39] Knuckleheads and if anything can keep [2:04:42] them aware of their surroundings I think [2:04:45] it's a good thing okay we'll take a look [2:04:47] into it okay all right that's all I have [2:04:50] all right [2:04:52] council member Tucker is not here [2:04:53] tonight Madame mayor [2:04:56] on League of cities this [2:04:58] I got a little note that I have [2:05:00] officially been appointed to the [2:05:01] taxation committee and I'm very excited [2:05:03] about that because [2:05:04] um part of their wrap up at the league [2:05:07] and I was not on that committee I was on [2:05:08] land use this last year but the taxation [2:05:10] committee uh was they listed as the hot [2:05:13] bills to watch the pair bills that were [2:05:16] inspired by Oviedo and the once at sales [2:05:19] tax and expanding its use to be allowed [2:05:21] for maintenance in addition to Capital [2:05:24] expenditures so I'm looking forward to [2:05:26] digging into that on I think it's [2:05:28] September 8th as the first policy [2:05:30] meeting [2:05:31] and also the original bills that were [2:05:33] filed last year are coming back both of [2:05:36] those sponsors are open to if we can [2:05:39] address some of the concerns that kept [2:05:41] them from moving last season they're [2:05:43] they're both open to to file them again [2:05:45] so I'm really hopeful that we can get [2:05:47] this done [2:05:48] and are you on a committee yes [2:05:50] taxation okay which I have done before [2:05:53] and it was not exciting but I'm really [2:05:55] excited about this pair of bills so I'm [2:05:57] going to power through it because we [2:05:58] need all the whole state get excited [2:06:00] about it okay I'm on the transportation [2:06:03] and uh yeah you're like Transportation [2:06:06] guy how many years have you been on that [2:06:07] one [2:06:09] I'm glad you do it maybe yeah that I [2:06:12] poked my head in there and it's not as [2:06:14] exciting as land use oh we have fun [2:06:17] uh and one other thing I wanted to let [2:06:19] you guys know about is there is a guy [2:06:21] named Mr Young who noticed a problem a [2:06:24] while ago and in one of our [2:06:25] neighborhoods and that is that there was [2:06:27] no place for the kids who were coming to [2:06:29] the bus stop to hang out so he went and [2:06:31] he had stalled a bench at his own [2:06:33] expense in his house uh you know it's [2:06:35] kind of by the sidewalk and then he [2:06:37] planted trees [2:06:38] and they've been there for a while and I [2:06:40] think the city recognized him at the [2:06:42] time but this post has gone viral guys [2:06:44] everybody uh in the whole country now [2:06:46] knows about Mr Young and the really cool [2:06:49] thing he did seeing a problem he just [2:06:51] saw this so I wanted to give him a shout [2:06:52] out because [2:06:54] it was just really cool seeing that he's [2:06:56] like oh no big deal I know how to do [2:06:58] this I'll fix it and and he did so [2:06:59] that's an inspiration to all of us too [2:07:01] we see a problem just fix it man [2:07:05] that's all I got great council member [2:07:07] Pollock [2:07:08] I've got another report [2:07:10] [Music] [2:07:12] while you're out this time too [2:07:13] [Music] [2:07:15] um just a couple of things uh obviously [2:07:17] there was a great Optical peers coming [2:07:20] in and xanier that's uh always good to [2:07:23] see them so that was great do you know [2:07:24] what they're going to use that money for [2:07:27] not yet not yet they'll come back and [2:07:29] let us know dog food dog food yeah and [2:07:34] officer Bongo I just we found he's going [2:07:36] to be our second motorcycle officer all [2:07:38] right congratulations to you sir that is [2:07:40] great stuff [2:07:42] cheap one more thing I had a few things [2:07:44] for you tonight but one more thing was [2:07:45] uh I would sit down in South Florida [2:07:48] this week and I went by and I was [2:07:50] telling Mr Cobb I went by the Fort [2:07:52] Lauderdale Police Department and it is [2:07:53] being torn down being rebuilt and that [2:07:55] was curious if we could find out how [2:07:58] they're doing that what is her plan to [2:08:00] do it and how it's being funded Mr Cobbs [2:08:03] suggested maybe you could reach out to [2:08:04] your counterpart and see if maybe you [2:08:06] could find out anything or know somebody [2:08:07] down there that could find anything out [2:08:10] yeah it looks like they're completely [2:08:12] tearing down the building and rebuilding [2:08:15] it but they had to fund it somehow I was [2:08:17] curious how they were funding it and [2:08:18] what was their plan [2:08:20] property taxes property taxes the [2:08:23] highest in the country [2:08:25] donut but I thought was interesting [2:08:27] especially since it's a hot topic for us [2:08:30] so [2:08:32] um [2:08:34] and obviously uh [2:08:36] the research I know that Mr shank had [2:08:38] asked about research I know you kind of [2:08:40] addressed a little bit Yeah if there's [2:08:42] anything [2:08:43] great I'm glad we were able to work out [2:08:45] the situation with the longhorn and Cafe [2:08:48] penuzo I'm glad we could come to our [2:08:49] agreement on that appreciate everybody's [2:08:51] work on that scat troop 787 they're [2:08:54] already
