We were looking [12:08] at the budget. And did convey [12:16] to them where we stand with the [12:18] discussion of the first [12:19] committee. I want to report [12:20] that we did have the [12:23] resignation of a long standing [12:26] member. And my deepest [12:44] gratitude. She was on several [12:47] commissions. I know she will be [12:54] missed. If you are watching, I [12:59] send lots of love and you will [13:02] be missed. [13:05] I have a request. At san pablo, [13:08] when I go and visit and [13:10] sometimes chat with the [13:13] different merchants, I have [13:14] seen that we need some sort of [13:19] blinking light for pedestrians [13:21] to cross from one end to the [13:25] other. I have seen cars have a [13:31] difficult time making a left [13:35] turn. So I have seen drivers [13:38] make a u-turn. So looking at [13:43] the safety fact of that [13:49] particular intersection of san [13:52] pablo. [13:53] I also want to have a request [13:54] of staff to see if we can look [14:00] at where the $25 million [14:13] that is allocated for community [14:17] resilience designated for [14:18] agreement heat if we can [14:22] capture those for palm desert [14:27] given that we get some extreme [14:34] heat. We contract with [15:40] sports for the management with [15:46] desert willow. The 5-year term [16:00] is up soon and the city put up [16:05] the contract for request for [16:10] proposal. And the city [16:22] conducted interviews earlier [16:24] this week and the process is [16:26] moving forward. [16:27] I have no request for action. [16:31] thank you. If we can [30:07] get that answer. [30:14] and my second question would be [30:16] what is the proper for the [30:20] paper maps because some prefer [30:23] drawing their paper maps. I have been involved [30:56] in districting process and [30:58] without software it can be very [31:02] difficult to submit draft maps. [31:13] so our mapping tool is very [31:17] intuitive. I believe [31:37] it's available both on a [31:41] desktop or laptop as well as [31:46] mobile. I will have to come [31:47] back to confirm that forks. [36:07] so I'm confused about what we [36:11] will or will not have tract [36:18] maps at next council meeting [36:33] >> if I can again ask the [36:39] clerk, I know that -- if our [36:50] process is to review tract maps [36:52] at the second public hearing, [36:55] but I want to make sure I'm in [37:00] line with staff's plan for this [37:02] meeting. I will also ask the [37:04] clerk to chime in there. [37:08] >> the written staff report you [37:09] have is consistent with the [37:13] first timeline that was [37:21] presented at city council. [37:37] is that what we are to assume [37:42] is the accurate timeline? [37:48] >> you know, frankly -- [38:10] >> so we know that the public [38:17] knows what to expect when. So [38:29] what is accomplished and [38:39] clarity. My way of thinking, [38:40] this is for a second [38:48] introductory session. So if we [39:01] do the tract map, but as I [39:02] said, we need to figure out how [39:08] to make sure that our [39:21] communications are clear. [39:23] >> our intent and our practice [39:28] is to have the draft maps [39:35] available for review at the [39:40] second public hearing. [39:41] and that is the plan is to have [39:46] it a draft map at the second [39:53] public hearing. [39:54] the public has the ability to [39:57] submit draft maps all the way [39:59] up to the third public hearing. [40:11] there is a longer window to put [40:16] together their draft maps to [40:18] consider. But you will have a [40:24] draft map that complies with [40:30] all of the requirements, the [40:33] settlement agreements and with [40:36] the input we receive tonight [40:41] and the intent there is to give [40:47] both the council and the public [40:54] enough time to mole over that [40:58] draft map and make any tweaks [41:07] with their own submitted draft [41:10] maps to kind of again have more [41:12] time for that part of the [41:15] process as it really is the [41:17] most important part of this [41:22] process. Richardson, I just wanted [42:01] to say our city of palm desert [42:09] is 50,000 population, and doing [42:18] like a redistricting of a big [42:24] city like los angeles, almost [42:28] seems to be an easier job to [42:42] do. As palm desert, can we [42:46] redraw these maps as some sort [42:48] of priority. Should they be [42:49] looking at the homes that are [42:56] unique in golf courses, that [42:59] are gated. We have 55 plus, we [43:07] have 55 plus in manufactured [43:13] home communities. So we are [43:15] somewhat unique in a lot of [43:16] work that you are doing in [43:23] redistricting. [43:25] so, it just seems so wrong and [43:32] I would hope that we can give [43:36] the public some more fine [43:38] tuning tools to more prioritize [43:40] this as they draw these maps. [43:43] I'm not sure if you are aware [43:45] of this or not, but the city of [43:50] palm desert, north frank [44:10] sinatra drive, is in the desert [44:15] sanders school district. That [44:16] is one that pops in my mind for [44:19] community of interest. Thank [44:24] you. Those of my comments. [44:27] >> if I can respond briefly to [44:29] that. I think you've nailed the [44:32] primary issue on the head when [44:35] it comes to redistricting. [44:36] actually while we certainly [44:42] have worked with bigger [44:44] jurisdictions, most of our [44:50] clients are small to mid-size [44:53] cities just like palm desert. I [44:58] serve the city attorney as well [45:02] and just like palm desert in [45:06] terms of being served by [45:14] multiple school districts, [45:15] having hoa's. Those are pretty [45:20] distinct areas in the city. [45:21] that is exactly what we want to [45:25] look at. [45:26] unfortunately the fair maps act [45:28] which is the law that informs [45:32] what we do isn't that specific [45:40] with the criteria. So we know [45:42] that the districts have to be [45:48] geographically contiguous. It [45:52] can't look like an octopus with [45:57] tentacles. [45:58] we know they have to be [46:02] compact, right. But the bulk of [46:05] our work is going to be exactly [46:10] like you articulated. 55 plus [46:12] communities that are clustered [46:15] together and gated communities [46:19] and hoa's and breaking up those [46:26] types of communities up [46:27] probably isn't consistent with [46:29] the fair maps act. [46:33] so the communities job and the [46:39] council's job is to articulate [46:44] where those boundaries are, [46:45] what those communities are that [46:48] you don't want to break up as [46:51] you redraw the lines between [46:54] these two districts. [46:57] that school district line -- if [47:11] there is specificity what you [47:18] just articulated is exactly the [47:21] rule that we want to be looking [47:27] at. Do you have specific and [47:34] distinct communities that [47:38] shouldn't be separated. [47:41] that's what the fair maps act [47:44] wants us to look at when we are [47:48] separating those into [47:50] boundaries. Sometimes we have [47:52] to separate them, but often you [47:53] can keep them together because [47:56] they should be together. I hope [47:58] that answers the question. [48:02] >> thank you, mr. [1:15:02] >> today we are requesting [1:15:09] additional budget for [1:15:10] engineering to provide [1:15:13] additional construction [1:15:14] management services to complete [1:15:17] the construction for the [1:15:18] president plaza the parking [1:15:25] renovation project. [1:15:26] throughout construction project [1:15:31] has experienced numerous [1:15:32] challenges and resulted in [1:15:35] additional work and overall [1:15:37] expended construction schedule. [1:15:38] for now, I want to start by [1:15:52] summarizing some of the [1:15:53] additional work items that have [1:15:59] been required during [1:16:00] construction. Here is just a [1:16:11] few of the bigger examples that [1:16:16] we have. As you probably all [1:16:26] heard, our construction team [1:16:29] has found to date 18 septic [1:16:36] tanks throughout the project [1:16:46] site. Many of which were [1:16:51] properly abandoned and [1:16:53] connected the affected [1:16:55] businesses to the sewer system. [1:16:57] we also had a lot of issues [1:17:01] while grading with dealing with [1:17:07] wet and dry utilities. [1:17:18] dpw has had a lot of delays. So [1:17:27] our contractor had to wait and [1:17:36] work around the infrastructure [1:17:37] around all the bright water [1:17:40] lines that should have been [1:17:42] vacated and in turn we had the [1:17:47] lower a lot of those and we [1:17:52] also had to replace a lot of [1:17:56] wet and dry utilities because [1:17:57] they were shallow and also a [1:18:03] lot of them were sewer lines [1:18:08] and private lines and aged [1:18:10] and/or damaged during [1:18:19] construction. [1:18:20] as for dry utilities, we had [1:18:36] spectrum and sce come out for [1:18:38] the lower area that was graded. [1:18:41] we also ran into several [1:18:44] unmarked system lines that had [1:18:46] to be lowered and they were in [1:18:53] both in east and west lots. [1:18:58] very expensive amount of work. [1:19:01] in addition, our contractors [1:19:04] refined the ada improvement [1:19:05] design. We got a lot of [1:19:10] comments from businesses that [1:19:20] there weren't enough ada ramps [1:19:22] coming from the parking lot. So [1:19:24] we added some of those. Also we [1:19:28] refined the larger ramps to the [1:19:31] businesses that needed them so [1:19:32] they really match well with the [1:19:37] existing buildings. They were [1:19:39] being applied to. [1:19:44] due to the cwd delays, we also [1:19:47] had some rework for the [1:19:50] contractor. They had to leave [1:19:56] out some segments of the and [1:20:46] make connections so cwd had to [1:20:51] redo some work that resulted in [1:20:54] this -- for this type of work. [1:21:10] we also chose to install [1:21:14] temporary light towers [1:21:21] throughout project site, as a [1:21:31] safety measure until we can get [1:21:34] the new lighting put in. [1:21:39] the additional sidewalk redesign [1:21:47] from the contractor included [1:21:50] curb ramp designs to match the [1:22:00] existing conditions and [1:22:01] additional drainage [1:22:05] improvements that work better [1:22:07] with the lower profile curb [1:22:11] design, and also some redesign [1:22:13] around palm trees and sidewalks [1:22:17] that are going to remain. [1:22:28] this map, we included this. I [1:22:29] know it's hard to see but I'm [1:22:32] not going to spend a lot of [1:22:34] time on it. This just shows all [1:22:40] of those improvements [1:22:45] throughout the project site. So [1:22:46] this is the east lot and you [1:22:49] will see this is a spectrum [1:22:51] line I was talking about here. [1:23:07] and it shows the improvements [1:23:11] are not located in individual [1:23:14] project site. We have run into [1:23:17] issues all over every time we [1:23:19] put a shovel in the ground. [1:23:24] that was the east lot. [1:23:30] this is the west lot and [1:23:36] another large spectrum line [1:23:37] that we found while we were [1:23:42] digging and septic and all the [1:23:51] sidewalks and utilities. [1:23:52] this shows the severity of the [1:23:55] additional work that's been [1:24:03] completed. [1:24:04] so that has ultimately extended [1:24:06] the work schedule for [1:24:08] construction. Right now I want [1:24:09] to give you a quick update, [1:24:19] where we are at. [1:24:22] by the site, you will see the [1:24:25] east lot was paved on the 23rd. [1:24:28] most of the parking lot now [1:24:31] open for parking. We do have [1:24:33] some staging and the contractor [1:24:36] is going to to continue [1:24:39] installing other improvements [1:24:40] in that lot and they plan to be [1:24:45] done with most to the [1:24:57] construction and that lot by [1:25:00] the end of february. That is [1:25:05] club landscaping, lighting, [1:25:12] closures, the works. [1:25:16] cwd is expected to complete [1:25:18] their work next week and should [1:25:21] have the sidewalks finished and [1:25:24] should look really good. And [1:25:29] now the west lot is scheduled [1:25:33] for february 23rd and 24. The [1:25:38] remaining lots will be closed [1:25:40] to vehicle traffic until the [1:25:42] lot is paved. The contractor is [1:25:46] only required to [1:25:53] have 150 spots on the lot and [1:25:58] agreed to have spots open in [1:25:59] the area as feasible as long as [1:26:03] they are safe to provide as [1:26:09] much parking as possible to the [1:26:12] businesses. We still don't have [1:26:20] a solid date to cwd's work [1:26:23] schedule yet but they are [1:26:31] hoping to be at the lot by the [1:26:35] end of this month. That's where [1:26:36] we stand now. I wanted to [1:26:41] highlight the construction [1:26:42] schedule. When we set up the [1:26:46] contract, the contractor was [1:26:47] getting 125 working days to [1:26:49] complete the interim portion of [1:26:55] the project. [1:27:00] it's primarily getting the lots [1:27:01] paid and that was planned for [1:27:05] december 1, 2021. And then the [1:27:10] completion date for the total [1:27:14] project was january 29, 2022. [1:27:26] based on the additional work, [1:27:28] we have granted 40 extra [1:27:31] working days for the [1:27:35] contractor. So now the interim [1:27:39] completion date is february 8, [1:27:43] andth, and the total completion [1:27:56] date is april 11th. [1:27:59] the interim date is where the [1:28:05] lots are primarily open, [1:28:13] drivable, usable and the [1:28:14] completion date in april will [1:28:16] be for all the other [1:28:22] improvements that would require [1:28:29] -- once the lots are paved, we [1:28:37] should see improvement. [1:28:39] with that being said, we need [1:28:48] the management and on-site [1:28:59] during construction and extra [1:29:05] management required for the [1:29:09] construction for april. And we've [1:32:55] discovered these previously [1:32:56] unknown conditions under the [1:33:04] ground that has largely caused [1:33:06] these increases and they keep [1:33:08] rising from the deep. [1:33:10] here is the question. [1:33:16] are we -- do we have a sense [1:33:24] whether there is control and [1:33:28] whether there is more monsters [1:33:29] down there? [1:33:30] >> yes, we are in the last, the [1:33:33] north side of the west lot is [1:33:39] the west quadrant of the site [1:33:40] that has to be graded. The [1:33:45] other three -- that have [1:33:53] previously been closed, we've [1:33:57] already graded them out. They [1:33:59] are a finished grade. So this [1:34:04] week, we have identified [1:34:12] utilities that the contractor [1:34:13] has addressed and we have found [1:34:16] additional cesspool, but as we [1:34:23] get to that final grade, then [1:34:27] we feel much more confident [1:34:31] that we will not hit anymore [1:34:35] surprises.
