[19:33] The Jackie Robinson of our fire [19:33] department is still alive today [19:37] and he'll be honored multiple [19:37] times this month. Carter g. [35:33] Woodson to ensure that black [35:33] contributions to this country [35:36] were recognized and remembered. [38:02] I want you to know that being a [38:03] person of color, being a black [38:08] African-American is something [38:08] that so many of us are [38:11] extremely proud of. [38:12] >> Everything that we've done [38:12] in this country should continue [38:13] to be celebrated, to continue [38:14] to be elevated and also [38:14] acknowledged. [38:15] The work that we have done has [38:16] continued to provide [38:17] the overall support for [38:17] diversity, equity, inclusion [38:18] and access. [38:18] Black history is everybody's [38:19] history and as I've always told [38:20] people for as long as I am [38:20] black I am historic. [38:24] I am a part of history. [38:25] So as long as you are black you [38:27] were also historic. [38:32] So I'll remember who you are, [38:33] where you've come from, how you [38:34] have contributed to today's [38:35] society When no one understand [38:35] that you stand on the shoulders [38:39] of so many so many people who [38:43] have come before you and there [38:43] will be others that will stand [38:43] on your shoulders right after [38:43] you. [38:44] So this resolution that is [38:48] coming forth today is something [38:48] that is truly needed especially [38:52] in the trying time when you [38:53] have the administration that's [38:56] doing everything it can to [38:57] continue to acknowledge black [38:58] history, the history that is [39:02] true just and right the history [39:11] of blacks in this country And [39:33] it's a wonderful one. [40:52] I come from a lineage that [40:56] turned chains into language [40:57] that built Saro into song and [40:57] stitched prayers into [41:01] blueprints and called it [41:02] freedom across from Harriet who [41:06] trusted the sky more than [41:07] the law and turned the North [41:10] Star into a roadmap for escape [41:11] from Sojourner who stood in [41:12] the face of denial and made [41:16] truth their worst nightmare [41:16] from Ida who sharpened her pin [41:20] into shake piercing through [41:21] America's lies With everywhere [41:25] written she restored our faith [41:25] . [41:26] I come from the brilliance of [41:30] W.E.B. [42:56] I am the athlete who refused to [43:10] perform quietly who turned [44:11] fields into battlegrounds of [44:12] coaches who bit me, eased race [44:13] fist and reminded the world [44:14] that black bodies are not [44:14] props. [44:15] We are prophecy. [44:16] I am Lee's defiance and [44:17] Serena's dominance. [44:18] I turn arenas into alters [44:18] performance into resistance [44:19] that bars into mountains and I [44:24] will take another black body. [44:24] Excellent. [44:25] And that's the climate I am [44:25] the student who sat down so [44:25] others could stand tall [44:25] The child who marched before [44:25] knowing the cost The young one [44:26] who refuses inheritance steeped [44:26] in injustice and chooses [44:26] instead to rewrite the rules. [44:26] I am the organizer [44:26] the caregiver, the mutual aid [44:27] When systems collapse under [44:27] their own neglect the one [44:27] knocking on doors long after [44:27] hope fails Then because [44:27] the work my people begin still [44:28] has work to do. [44:28] Black history is not behind me [44:28] It is the breath in my lungs, [44:28] the drums in my steps, [44:28] the prayers in my elders mouths [44:28] dreams and my children's hands [44:29] 100 years after it was named [44:29] and I am still naming myself [44:29] still defining freedom still [44:29] daring to believe that some day [44:29] this country will become [44:30] everything it pretends to be. [44:30] And I'm not asking for [44:30] permission. [44:30] I'm reclaiming what was always [44:30] mine. [44:31] I am excellence without apology [44:31] resistance shaped by love I am [44:31] imagination sharpened by [44:33] purpose. [47:26] Uh, I also want to comment on [47:27] National Engineers Week Council [47:27] PRESIDENT Thank you for [47:30] bringing forward this [47:31] proclamation Recognizing [47:32] National Engineers Week [47:32] engineers play a foundational [47:35] role in advancing innovation, [47:36] solving complex challenges and [47:39] applying science and technology [47:40] in ways that improve daily [47:40] life. [47:41] Their work often happens behind [47:45] the scenes but the impact is [47:45] lasting and shapes systems and [47:46] opportunities across [47:46] generations. [47:49] And I would be remiss if I did [47:50] not take a moment to especially [47:51] especially during Black History [47:54] Month to bring recognition to [47:55] acknowledge the National [47:56] Society of Black Engineers. [47:59] Nesbit has been instrumental in [48:00] supporting black engineers and [48:00] scientists, helping create [48:01] pathways, mentorship and [48:05] community in fields where [48:05] representation has been has not [48:09] been equitable during Black [48:10] History Month it's important we [48:10] recognize and uplift [48:14] organizations like Nesby that [48:15] both honor the legacy of black [48:15] engineers in stem but also [48:19] actively invest in the next [48:20] generation. [48:22] Lastly, I'd like to speak on [48:23] item 32 as we recognize [48:24] the year of the Horse. [48:24] I would like to thank Council [48:28] PRESIDENT Joe Carver, Council [48:32] PRESIDENT Pro Tem Ken Lee and [48:32] Council member Shawn Ella [48:32] Rivera for recognizing [48:33] the importance of this [48:33] celebration. [49:31] Thank you to Councilmember [49:32] Foster for sharing [49:34] the background of black History [49:35] Month which has now been [49:36] commemorated for over 100 years [49:40] and through the founding of [49:40] the Association for the Study [49:41] of African-American Life and [49:41] History. [49:45] DR. Woodson and fellow scholars [49:46] worked to correct the exclusion [49:46] and misrepresentation of [49:49] African-American contributions [49:50] and the broader American [49:50] narrative. [49:51] And as Councilmember Foster [49:54] declared, Black history is [49:55] American history. [49:55] Each FEBRUARY Black History [49:59] Month gives us the opportunity [50:00] to uplift and reflect on [50:00] the history, culture, [50:04] sacrifices and immeasurable [50:04] contributions of black [50:05] Americans through art [50:06] throughout our nation's history [50:09] and here in our own communities [50:09] . [50:10] Well, it's been 100 years. [50:11] I think we find ourselves in a [50:14] moment when the foundations of [50:14] our country's history are being [50:15] intentionally erased or hidden, [50:18] vulnerable and marginalized [50:19] communities continue to face [50:20] injustice and the values of [50:24] diversity, equity and inclusion [50:24] are constantly being [50:25] challenged. [50:25] We must acknowledge that [50:29] the work continues and [50:29] therefore our commitment to [50:30] equity, justice and [50:31] the preservation of historical [50:34] truth requires ongoing effort. [50:35] I think as many have shared in [50:38] the audience and we'll share up [50:39] here on this dais Black History [50:40] Month is both a celebration of [50:43] achievement but also a reminder [50:44] of the continuing struggles for [50:45] freedom, dignity and equality. [50:48] And as the city it allows us to [50:49] reaffirm our shared [50:50] responsibility when it comes to [50:53] protecting truth, democracy and [50:54] inclusive storytelling. [51:31] As someone of Chinese American [51:32] descent but whose parents were [51:32] born in Vietnam and in Burma [51:36] this is certainly a holiday [51:36] that has been celebrated by my [51:37] family and many others [51:40] throughout our region. [51:41] And for many of those families [51:42] it's one of the most important [51:45] holidays. [51:46] It's a time to gather, to [51:47] reunite, to celebrate and [51:47] welcome what is hopefully a [51:50] prosperous new year in San [51:51] Diego. [51:51] Lunar New Year has been [51:55] celebrated for over a century [51:55] dating back to the 19th century [51:56] and the formation of [51:56] the region's first Asian [51:59] Asian-American communities. [52:00] If you follow the Chinese [52:00] zodiac, this new year is [52:04] represented by a fire horse [52:04] bringing bold action, growth [52:05] and forward momentum. [52:09] People born in horse years are [52:10] believed to be hardworking, [52:10] warm hearted and independent. [52:14] A shout out to our chief of [52:15] policy in the district office [52:15] Anjali Hoyos, who certainly [52:18] shares these characteristics. [52:19] While 2025 was the year of [52:20] the Wood Snake which [52:23] represented a time to reflect [52:24] to shed what didn't serve us [52:25] and to strategize the year [52:28] the fire horse is associated [52:29] with passion, ambition and [52:33] social shifts encouraging [52:34] decisive action while also [52:34] reminding us to remain grounded [52:35] as impulsiveness can be a [52:38] challenge. [52:39] Although this year is beginning [52:40] with continued unrest and [52:40] instability within our [52:44] communities and abroad, [52:44] the year of the horse reminds [52:45] us that even in turbulent times [52:48] opportunities for evolution, [52:49] progress and positive change [52:49] remain. [52:52] I want to thank all [52:53] the organizations who work year [52:54] round to recognize and uplift [52:57] the Asian-American native [52:58] Hawaiian and Pacific Islander [52:58] community. [52:59] This past Sunday the convoy [53:03] area which I have the honor to [53:03] represent hosted its first ever [53:04] convoy rising Lunar New Year [53:08] celebration And my family and I [53:09] had the opportunity to attend. [53:10] I want to take a moment to [53:12] thank our Arts and Culture [53:13] Commissioner Dennis Dizzy Dawn [53:14] and the Joan Foundation, Lauren [53:16] Garcia of Social artistry She's [53:17] here today and the entire Up to [53:21] you cafe team for their [53:22] collective effort to present a [53:26] beautiful community moment with [53:26] some of the best line dancing [53:27] presentations that we've ever [53:31] seen in the San Diego region. [53:32] We also have a number of [53:33] organizations that are here in [53:33] attendance today. [54:47] This month we honor [54:51] the leadership and cultural [54:51] impact of black communities [54:52] that are often achieved in [54:55] the face of adversity. [54:56] The story of our nation cannot [55:00] be told without acknowledging [55:01] the central role black [55:01] Americans have played in [55:05] shaping our economy, [55:06] strengthening democracy, [55:07] governance and most importantly [55:11] advancing civil rights for all. [55:24] Moving on to item 33 is so [55:25] local, so locally I I'm honored [55:25] to stand before you to [55:29] recognize and celebrate a truly [55:30] special establishment that has [55:30] helped shape the city of San [55:34] Diego's creative culture and [55:34] environmental future. [55:39] And that's so so local. [55:39] >> Founded in 2013 in the heart [55:43] of Barrio Logan Community So [55:44] Loca is a sustainable fashion [55:48] studio that embodies innovation [55:49] ,care and community. [55:49] It's a woman minority owned [55:54] business proudly led by [55:54] co-founder Gloria Rodriguez [55:59] both in ski who's here in [55:59] the in the audience with us and [56:03] Manny Brzezinski whose vision [56:03] and leadership have made a [56:04] lasting impact here in San [56:08] Diego and beyond. [56:09] For the past 13 years so Loca [56:10] has been a force in San Diego [56:12] sustainable fashion movement [56:13] through hands on education in [56:18] sewing mending upcycled and [56:18] conscious consumption. [58:22] Let me start by thanking [58:23] everyone who's here today to [58:27] recognize and be recognized. [58:28] I I'll start with Black History [58:28] Month. [58:32] Thank you, Councilmember Foster [58:33] for including for allowing us [58:37] to join you in proclaiming [58:38] every 2026 to be Black History [58:38] Month. [58:42] It was it's already been so [58:43] well said Why this is so [58:46] important. [58:47] So I did want to just add a [58:51] couple things. [58:52] I always like to look at [58:53] the way that the Association [58:53] for the Study of [58:56] African-American Life and [58:57] History talks about this month [58:57] and what it means in [59:01] the particular moment that [59:01] we're in. [59:02] And I think there were some [59:05] words in on their website that [59:06] I'm really spoke to me and it's [59:10] the final paragraph which says [59:11] to understand the modern world [59:12] especially in nations where [59:12] black people as form a [59:15] significant population, one [59:15] must grapple with the impact [59:16] that the public observances [59:19] have had on the past and [59:19] the present. [59:20] This year when we are [59:21] commemorating the 250th [59:21] anniversary of the United [59:24] States Independence, it is [59:25] important to tell not only an [59:26] inclusive history but an [59:26] accurate one. [59:30] We have never had more need to [59:31] examine the role of Black [59:31] History Month and when than we [59:35] do when forces weary of [59:35] democracy seek to legislate and [59:39] seek to use legislative means [59:40] and book bans to excise black [59:40] history from America's schools [59:44] and public culture. [59:44] Black history value is not its [59:45] contribution to mainstream [59:46] historical narratives but its [59:49] residents in the lives of black [59:49] people. [59:53] Thank you for bringing up who [59:54] you brought up today. [59:55] COUNCILMAN Foster, thank you [59:55] for the role you are playing in [59:58] black history in this city. [59:59] Thank you to all the elected [1:00:03] officials who participated in [1:00:03] it. [1:00:04] I think obvious but also worth [1:00:08] noting that our state [1:00:08] legislators, our county [1:00:09] supervisor and secretary of [1:00:09] state black women who are [1:00:12] demonstrating black excellence [1:00:13] on a daily basis in incredibly [1:00:18] important roles of leadership. [1:00:18] And then Diamond, thank you for [1:00:19] the very powerful words that [1:00:21] were shared. [1:00:22] >> I will just say that in [1:00:27] the moment that we are in it is [1:00:32] incredibly important for me at [1:00:32] least to draw inspiration from [1:00:33] people from people who have [1:00:36] overcome great adversity [1:00:37] adversity. [1:00:37] And there was a line in [1:00:42] Diamond's poem I think she said [1:00:42] of people who survived [1:00:45] the unimaginable unimaginable [1:00:46] and chose to build and to love. [1:00:51] And if that lesson that that is [1:00:52] possible in all moments no [1:00:56] matter how terrible it MAY seem [1:00:57] that that lesson is not [1:00:57] important right now that I [1:01:01] don't know when it would be. [1:01:01] So again, thank you for [1:01:02] allowing me to join you in this [1:01:05] proclamation and I hope this [1:01:10] month is as joyous and [1:01:11] impactful as as it is it should [1:01:11] be. [1:02:17] Um and then last but not least [1:02:18] I just can't help but kind of [1:02:22] reflect on um the power of [1:02:26] Black History Month and [1:02:27] the recognition of Year of [1:02:28] the Horse in this moment in [1:02:32] time again when the history of [1:02:32] this nation's diversity is [1:02:36] attempted to be erased when [1:02:41] the idea itself that we cannot [1:02:42] celebrate one another, we [1:02:42] cannot celebrate our [1:02:46] backgrounds, our histories, our [1:02:51] heritage um when that is being [1:02:52] attempted to be imposed upon us [1:02:55] and that and the ideas that [1:02:55] celebrating those things and [1:02:56] recognizing our history is [1:02:56] un-American. [1:03:01] I very much appreciate that we [1:03:01] are using this space and these [1:03:05] chambers to show the exact [1:03:06] opposite that the exact [1:03:06] opposite is true. [1:05:42] Chief McFarland, I'm very, very [1:05:43] honored to be celebrating your [1:05:44] retirement today although very [1:05:47] sad to see you're leaving [1:05:47] the city today. [1:05:48] It is my honor to recognize [1:05:52] Chief Charles Checkbook Farland [1:05:52] for a remarkable career [1:05:53] dedicated to protecting [1:05:56] the people of San Diego. [1:05:57] For more than four decades he [1:06:00] has served as a helicopter [1:06:01] pilot and the other 40 years in [1:06:01] the fire service Chief [1:06:02] McFarland has demonstrated [1:06:06] extraordinary leadership, [1:06:06] professionalism and commitment [1:06:07] to public safety Since joining [1:06:08] the San Diego Fire Rescue [1:06:11] Department, he has helped lead [1:06:12] one of the nation's premier [1:06:12] municipal fire aviation [1:06:15] programs strengthening our [1:06:16] ability to respond quickly and [1:06:17] effectively to wildfires, [1:06:20] emergency and rescue [1:06:20] operations. [1:06:21] His focus on safety, advanced [1:06:21] training, operational [1:06:25] excellence has not only [1:06:25] protected our residents but has [1:06:28] also supported the firefighters [1:06:29] and first responders who rely [1:06:30] on these critical resources. [1:06:33] Chief McFarlane's expertise is [1:06:34] recognized nationwide and his [1:06:35] work has helped shape [1:06:35] the future of public safety. [1:06:38] Aviation far beyond our city. [1:06:42] As you MAY recall in 2003 we [1:06:43] experienced one of the worst [1:06:43] wildfires in California history [1:06:47] and we lost over 500 homes [1:06:48] because we did not have [1:06:48] the aerial apparatus that we [1:06:49] have today. [1:06:52] And so thank you very much. [1:06:53] Achievement haaland As we saw [1:06:56] last year in JANUARY when we [1:06:56] had five fires and we used [1:06:59] aerial apparatus on every [1:07:00] single one it's a huge game [1:07:00] changer for our city and it's [1:07:04] one of Chief McFarlane's last [1:07:04] services to our city. [1:07:05] He did fly all the way to [1:07:09] Virginia and flew back with our [1:07:10] latest helicopter all the way [1:07:10] across the country. [1:07:14] So we appreciate you very much [1:07:14] ,sir. [1:07:15] I would love to invite you to [1:07:16] come up and invite Deputy Chief [1:07:16] o'Donnell to come up and say a [1:07:28] few words. [1:08:02] So sourcing helicopters and [1:08:06] doing a lot of things to save [1:08:06] the city money. [1:08:07] So it's been a true honor and I [1:08:08] need to say thank you to my [1:08:10] wife Cindy, who I've been [1:08:10] married to since I was 18 years [1:08:11] old. [1:08:11] Without her support I never [1:08:12] could have done this. [1:08:17] So thank you very much. [1:08:22] I'm not going to look at you. [1:08:23] >> So just to add on to the to [1:08:24] the proclamation the great job [1:08:27] that lays out Chuck's career. [1:08:28] I wanted to I'm sorry. [1:08:28] i'm Steve Long, deputy chief of [1:08:29] special operations. [1:08:32] So I'm the chief for Chuck [1:08:32] McFarland. [1:08:33] But I've always said Chuck [1:08:33] doesn't really have chiefs or [1:08:36] bosses. [1:08:37] He has collaborators And so [1:08:38] that's what I've been for [1:08:38] the past couple of years. [1:08:42] Chuck has been the foundation [1:08:43] of our air operations program. [1:08:46] He has innovated this program [1:08:47] and on a selfish point for this [1:08:47] patch and for this city we have [1:08:51] the Premier air operations [1:08:51] firefighting element in [1:08:52] the nation and that's due to [1:08:56] him on a local level. [1:08:56] Chuck has always been the guy [1:08:57] for Cal Fire for us forestry [1:09:02] for local law enforcement. [1:09:02] Chuck is the aviation guy that [1:09:05] everybody calls on a state [1:09:06] level. [1:09:07] He's run committees for fire [1:09:07] scope. [1:09:11] He's part of Cal Chiefs which [1:09:11] has been instrumental [1:09:12] throughout the state on a [1:09:12] national level. [1:09:16] He's worked with the ifc, [1:09:17] the Forest Service to implement [1:09:17] their their air to air [1:09:21] operations programs And on an [1:09:22] international level I've [1:09:22] actually been with Chuck when [1:09:26] he was propositioned by other [1:09:27] companies to come and teach [1:09:27] aerial firefighting in France [1:09:31] and in Greece. [1:09:31] Who gets that? [1:09:32] Who gets that opportunity? [1:09:33] So on that level I just wanted [1:09:36] to say Chuck, thank you for [1:09:37] your service to the city. [1:09:38] Thank you for everything you've [1:09:38] done for us. [1:09:40] We are the premier organization [1:09:41] because of you. [1:09:41] Chuck retires on FEBRUARY. [1:09:44] Friday, FEBRUARY 13th which we [1:09:45] know Chuck was probably bland [1:09:45] but he is amazing. [1:09:49] He will be missed. [1:09:49] But the one thing about Chuck [1:09:50] that we've all seen is when [1:09:54] it's when you need them he's [1:09:54] there. [1:09:55] It's sometimes at some point in [1:09:56] the conversation when something [1:09:58] is trying to be figured out [1:09:59] especially in the fire [1:10:00] department or in special [1:10:00] operations a lot of times it [1:10:03] ends up with as anybody called [1:10:03] Chuck. [1:11:31] Engineers develop systems and [1:11:34] solutions from the roads we [1:11:35] drive on to the invisible [1:11:36] infrastructure that supports [1:11:39] our city Without the dedication [1:11:40] and precision of an engineer [1:11:41] none of it would be possible. [1:44:19] We saw that with the red light [1:44:23] cameras run by a private [1:44:23] business back during [1:44:24] the Sanders administration. [1:44:25] Fortunately that particular [1:44:28] practice was stopped by Mayor [1:44:28] Filner. [1:44:29] But similar examples exist to [1:44:29] this day. [1:44:33] For years now citizens had to [1:44:34] go to the website at Highland [1:44:37] cloud.Com in order to access [1:44:38] the agendas for this meeting. [1:44:39] Since my recent comments on [1:44:41] this I do now see that this [1:44:42] current city council agendas on [1:44:43] the city clerk's website so [1:44:47] thank you to City Clerk Fuentes [1:44:47] for fixing that. [1:51:37] Not only does this represent a [1:51:38] growing financial risk to [1:51:41] the city but also highlights [1:51:42] the need for reform and a [1:51:42] culture change within our San [1:51:48] Diego Police Department today [1:51:52] the City of San Diego since [1:51:56] 2017 has spent roughly $100 [1:51:56] million in San Diego Police [1:51:57] Department litigation and [1:52:01] settlements. [1:52:02] And that's very concerning as a [1:52:06] liability fund is supported by [1:52:10] the general fund And with that [1:52:11] code if I can have a commitment [1:52:15] from the mayor's office, I [1:52:16] would formally request that [1:52:20] risk And Senegal pd docket an [1:52:21] item at the budget and [1:52:25] government or Budget and [1:52:26] Government Efficiency committee [1:52:30] to bring an item to have a [1:52:31] public conversation about these [1:52:34] settlements going back to 2017 [1:52:34] and also would like to know [1:52:35] what steps we are putting in [1:52:39] place to mitigate these types [1:52:43] of litigations and misconducts [1:52:43] . [1:53:19] I'll start with item 100 [1:53:20] Actually I appreciate [1:53:21] Councilmember Von Wilpert [1:53:24] bringing this up a couple of [1:53:25] years ago I believe we had a [1:53:26] contract come to us for [1:53:33] chemicals used for water and [1:53:34] there was a conversation at [1:53:38] that time about the way in [1:53:39] which it seemed as though [1:53:43] the pandemic and the war in [1:53:44] Ukraine were continuously being [1:53:48] used as excuses by companies [1:53:48] that we depend on to in my [1:53:49] opinion gouge the city for for [1:53:53] essential items. [1:53:54] It is not a choice as to [1:53:57] whether or not we treat our [1:53:58] water or our wastewater And it [1:54:02] seemed very much like the city [1:54:03] was being taken advantage of. [1:54:06] I've actually pointed to these [1:54:07] chemicals as examples of some [1:54:12] of the costs that the city has [1:54:12] seen significant increases in [1:54:13] in conversations with committee [1:54:17] members in explaining why [1:54:22] the budget has grown in some of [1:54:22] the ways that it has. [1:54:23] There's other reasons as well [1:54:23] for sure. [1:54:26] But this was an example of a [1:54:27] thing that we needed to pay for [1:54:28] that had significantly increase [1:54:31] in cost And I share [1:54:31] Councilmember Rommel [1:54:35] appreciation that we've dug in [1:54:36] and worked harder to negotiate [1:54:41] a better price for San Diegans [1:54:41] . [1:54:42] So I just want to express my [1:54:42] appreciation for that. [1:54:46] I want to say congratulations [1:54:47] to MR. Cota for your [1:54:48] reappointment, the convention [1:54:51] Center Corporation Board of [1:54:51] Directors. [1:54:55] Obviously you bring a a wealth [1:54:55] of experience. [1:54:56] That's not my way of calling [1:55:00] you old. [1:55:01] That's just my way of [1:55:01] recognizing that you've seen [1:55:05] some things and you've been at [1:55:05] the convention Center for some [1:55:06] very important changes, [1:55:10] especially as it relates to how [1:55:10] the workers at the convention [1:55:13] center are treated and ensuring [1:55:14] that they're treated with [1:55:15] the dignity that they deserve [1:55:18] and receive the pay that they [1:55:19] deserve as well. [1:55:20] So thank you for that work. [1:55:24] I will now pivot to to item 500 [1:55:28] as well. [1:55:29] >> I will start by saying that [1:55:33] I don't think there is a single [1:55:37] thing that I have heard as a [1:55:38] council member that has been [1:55:42] more horrifying and [1:55:42] disappointing to me as a leader [1:55:43] in this as a person who is [1:55:47] charged with a responsibility [1:55:48] of leadership in this city, [1:55:49] then the details of this [1:55:52] lawsuit I believe that our most [1:55:56] sacred duty is to protect our [1:55:57] young ones and the city, [1:55:58] the county, the rock church and [1:56:01] the community as a whole failed [1:56:02] in that duty and we failed. [1:56:02] Arabella McCormick and her [1:56:06] young sisters. [1:56:07] I'm going to read some of [1:56:08] the detailed details of [1:56:08] the reporting because I think [1:56:11] it's extremely important that [1:56:12] we do not run from these [1:56:12] details as horrifying as they [1:56:16] are. [1:56:17] And this is from kpbs aids [1:56:20] reporting Arabella was reported [1:56:21] just 40 pounds when sheriff's [1:56:25] deputies arrived at [1:56:26] the family's Spring Valley home [1:56:26] in AUGUST 2020 to a report of a [1:56:30] child in distress. [1:56:30] McCormick, just 11 years old at [1:56:31] the time, died shortly after [1:56:35] from heart failure. [1:56:35] Her young her sisters both [1:56:36] appeared younger than their [1:56:40] ages due to underdevelopment [1:56:40] they suffered from re re [1:56:44] feeding syndrome a phenomenon [1:56:45] identified following World War [1:56:49] two when prisoners of war were [1:56:49] provided with food after a [1:56:50] prolonged period of starvation [1:56:51] and subsequently died from [1:56:54] cardiac failure they had to be [1:56:59] nourished gradually they were [1:57:00] hospitalized and receive [1:57:00] treatment that saved their [1:57:00] lives. [1:57:03] >> Thank GOD. [1:57:04] >> In addition to her role at [1:57:05] the Rock Church, the girl's [1:57:08] adoptive mother Latisha [1:57:09] McCormick also volunteered as a [1:57:09] crisis intervention specialist [1:57:13] for the San Diego Police [1:57:13] Department. [1:57:14] >> But Couric's parents [1:57:14] the girl's adoptive [1:57:18] grandparents Stanley and Adela [1:57:19] Tom also volunteered with [1:57:23] the Department to add to [1:57:23] the horror. [1:57:24] The legal complaint alleges [1:57:27] that McCormick worked alongside [1:57:28] a San Diego police officer who [1:57:29] visited the family's home and [1:57:32] witnessed the parents [1:57:33] prohibiting the girls from [1:57:33] eating food And when they did [1:57:34] force them to chew their food [1:57:37] very slowly. [1:57:38] That officer was alleged to [1:57:39] have given her friend paddles [1:57:44] to be used on the young girls [1:57:45] and set up apart again. [1:57:46] That officer was alleged to [1:57:47] have given her friend paddles [1:57:52] to be used on the young girls. [1:57:57] >> There are no words or amount [1:57:58] of money that can make amends [1:57:59] for the way Arabella and her [1:57:59] sisters were failed. [1:58:03] I support the settlement [1:58:03] because it is what [1:58:04] the representatives of [1:58:04] the surviving victims believe [1:58:08] because the representatives of [1:58:08] the surviving victims believe [1:58:09] the money paid by the city will [1:58:10] help ensure the girls have [1:58:13] the security they need to heal [1:58:13] from the hardship from [1:58:14] the abuse and loss of their [1:58:17] eldest sister. [1:58:17] My sincere hope is [1:58:18] the settlement and [1:58:21] the settlements of the other [1:58:22] institutions involved will help [1:58:23] provide the surviving victims [1:58:23] the resources necessary to [1:58:26] overcome what has been [1:58:27] inflicted upon them. [1:58:31] And I am so, so sorry that [1:58:32] nobody came to their aid [1:58:36] earlier. [1:58:37] >> It is also important for us [1:58:38] as a city and for all San Diego [1:58:42] to ask what is being done to [1:58:42] prevent anything like this from [1:58:43] ever happening again? [1:58:46] So cota just and this is [1:58:47] rhetorical right now but I do [1:58:51] mean this. [1:58:52] What steps are the mayor and [1:58:52] the chief taking to ensure [1:58:56] the culture and practices of sd [1:58:57] pd prioritize the protection of [1:58:57] children? [1:58:58] Before the unwritten rules of [1:59:01] protecting their own. [1:59:02] And finally in a moment when [1:59:06] the city is roiled in a [1:59:07] conversation of the way [1:59:11] resources are allocated, we [1:59:11] must acknowledge that this $10 [1:59:12] million settlement plus [1:59:13] the settlement with the family [1:59:15] of Keno Wilson puts the city at [1:59:16] over $40 million paid out on [1:59:20] settlements in just the last [1:59:21] couple of months triggered by [1:59:25] the acts and failures to act by [1:59:26] the San Diego Police Department [1:59:30] which resulted in the deaths of [1:59:35] two minors babies. [1:59:35] >> Things must change. [1:59:36] They must change because our [1:59:40] sacred duty to our young ones [1:59:41] demand that they change. [1:59:41] They must change because [1:59:42] the values of justice and [1:59:45] safety demand it and things [1:59:46] must change because we [1:59:47] literally cannot afford for [1:59:49] them not to. [1:59:50] So thank you, Councilmember [1:59:54] Foster for your comments and [1:59:55] making the request that you [1:59:55] did. [1:59:55] I think that's an incredibly [1:59:59] important conversation And when [2:00:00] it comes to the financial [2:00:04] stewardship of the city and [2:00:04] cota, I do very much hope that [2:00:08] the council and the public will [2:00:09] have an opportunity to hear [2:00:13] the ways in which again we can [2:00:18] know that action is being taken [2:00:19] to do everything in our power [2:00:23] to ensure that something like [2:00:24] this never happens again. [2:00:25] And I say that with [2:00:25] the humility of knowing that we [2:00:28] cannot control for the acts of [2:00:29] all people and people do [2:00:33] terrible, terrible things. [2:00:34] But what I also know is it is [2:00:39] completely not okay for people [2:00:43] wearing the badges of this [2:00:44] city, the seal of this city to [2:00:47] fail children in the way that [2:00:48] these children were failed. [2:01:12] But I do want to in this case [2:01:12] talk about the settlement with [2:01:16] our Abella surviving younger [2:01:17] sisters. [2:01:17] The entire city county, Rock [2:01:21] Creek Church even a charter [2:01:22] school failed these little [2:01:22] girls. [2:01:23] There were charter school [2:01:27] teachers in her home twice a [2:01:31] week every week for five years [2:01:32] who didn't report this abuse. [2:01:35] The county investigators from [2:01:36] cps who were charged with [2:01:36] protecting her didn't report [2:01:39] this abuse. [2:01:40] And one of the San Diego police [2:01:41] officers who's named in this [2:01:49] lawsuit contributed to this. [2:01:50] >> As I told my colleagues in [2:01:50] closed session, I have used all [2:01:51] the political pressure I have [2:01:54] to make sure that this officer [2:01:55] no longer has a badge or a gun. [2:01:56] I understand she has due [2:02:00] process rights and they are [2:02:00] going through her. [2:02:01] But every single week I have [2:02:01] called on the police department [2:02:04] to get her off the force every [2:02:05] week with her due process [2:02:05] rights. [2:02:06] I'm not trying to get ahead of [2:02:08] that. [2:02:09] She's no longer being able to [2:02:10] use her badge or her gun is my [2:02:13] understanding And they're going [2:02:14] through the process now to [2:02:15] complete their investigation. [2:02:18] But I do have a request going [2:02:22] forward in cases such as this [2:02:23] which are completely egregious, [2:02:24] which are not life and death [2:02:24] decisions in the middle of [2:02:27] the night when one emergency [2:02:28] this was a long term case of [2:02:28] abuse. [2:02:32] I think it is incumbent upon [2:02:33] the police department to act [2:02:33] quicker. [2:02:36] They do not need to wait for a [2:02:37] civil case or a criminal case [2:02:41] to come down to do their own [2:02:42] internal investigation into [2:02:46] conduct this egregious. [2:02:47] This officer could have had her [2:02:50] badge and gun removed years ago [2:02:50] . [2:02:51] >> So I'm hoping that [2:02:52] the police department going [2:02:55] forward will take actions [2:02:56] sooner when conduct like this [2:02:56] emerges. [2:03:00] Understanding Poobah [2:03:01] understanding everyone's due [2:03:02] process rights that is fine. [2:03:02] But we do need to protect [2:03:05] the public. [2:03:06] The county will also be [2:03:07] settling this lawsuit. [2:03:10] Rock Creek Church will also be [2:03:11] set in a lawsuit. [2:03:11] The charter school will be [2:03:12] settling this lawsuit and these [2:03:18] poor young girls who survived. [2:03:19] The money they're getting is [2:03:19] never going to fix this. [2:03:23] But a holistic society failed [2:03:24] These little girls and I will [2:03:25] continue to use every part of [2:03:28] the pressure I can to make sure [2:03:29] that we do better going [2:03:29] forward. [2:32:49] >> The city had two new Gadsby [2:32:53] standards that were implemented [2:32:53] for fy 25. [2:32:54] The first one our major [2:32:54] implementation for this year [2:32:58] was Gadsby Statement number 121 [2:32:58] for compensated absences. [2:32:59] This was a change in how we [2:33:02] value our compensated absences [2:33:03] balances. [2:33:03] There's no change in [2:33:04] the disclosure just how [2:33:07] the liability balance is [2:33:08] calculated Prior to [2:33:08] implementation our compensated [2:33:12] absences was comprised of [2:33:12] annual leave and compensatory [2:33:13] time off. [2:33:13] Under the new standard we also [2:33:16] pick up annual leave department [2:33:17] discretionary leave, parental [2:33:18] leave and earned sick leave as [2:33:21] well as defined contribution [2:33:21] pensions associated with these [2:33:22] with these amounts. [2:33:26] This helps kind of capture [2:33:26] the total liability to to [2:33:27] the employee and standardize [2:33:31] reporting between entities. [2:33:31] This was a statement that was [2:33:32] implemented retrospectively [2:33:35] which required a restatement at [2:33:36] the beginning of the fiscal [2:33:36] year. [2:33:39] So that restatement was 18.1 [2:33:42] million in governmental funds [2:33:43] and 4.5 million for business [2:33:43] type funds respectively. [2:33:46] And that can be seen in note 22 [2:33:51] of the act for the second [2:33:51] statement implemented this year [2:33:52] was Gadsby statement number 1 [2:33:53] or 2 for certain risk [2:33:56] disclosures a Gadsby number 1 [2:33:57] or 2 requires disclosure of [2:33:57] certain risks that could impair [2:34:01] the city's ability to borrow to [2:34:02] provide services or meet [2:34:02] financial obligations. [2:34:06] These are going concern types [2:34:06] of risks typically where you [2:34:10] have concentration of risk in a [2:34:11] primary employee or something [2:34:12] that would materially impact [2:34:15] the city's ability to receive [2:34:15] resources to provide government [2:34:16] services. [2:34:20] So this is did not have an [2:34:21] impact on financial reporting [2:34:22] this year but is something that [2:34:22] we'll need to continue to [2:34:25] evaluate it through throughout [2:34:26] the course of the year as facts [2:34:27] and circumstances become known [2:34:30] as well as during our expert [2:34:31] prep process. [2:34:35] >> So to give some general [2:34:35] major fund highlights [2:34:39] the consolidated general Fund [2:34:39] ended the year with a balance [2:34:40] of 414.6 million That includes [2:34:44] emergency reserves of 107.6 [2:34:45] million and stability reserves [2:34:45] of 99.5 million. [2:34:49] The water and sewer funds were [2:34:50] were pretty stable. [2:34:50] The water fund ended with a [2:34:54] total net position of 2.3 [2:34:55] billion which represented a [2:34:57] decrease of less than 1% [2:34:58] compared to 2.24. [2:35:01] The sewer fund ended with a net [2:35:02] position of 2.8 billion which [2:35:03] represents an increase of about [2:35:08] 1% over f y 24. [2:35:09] Our external external auditor [2:35:12] Crowe completed their audit on [2:35:13] DECEMBER 17th and found no [2:35:14] significant deficiencies and no [2:35:15] material weaknesses in internal [2:35:17] controls. [2:35:18] It was a clean audit opinion. [2:36:05] >> First I'll cover the audit [2:36:09] objectives to remind [2:36:09] the Council what we were [2:36:10] engaged to perform for [2:36:10] the city. [2:36:11] Second, I'll cover the audit [2:36:14] results and then third I'll [2:36:15] wrap up with the required [2:36:15] communications. [2:36:18] So first up with respect to our [2:36:19] engagement objectives, Crowe [2:36:19] was hired by the city to [2:36:23] express an opinion on whether [2:36:23] or not those financial [2:36:24] statements for the city as a [2:36:25] whole are fairly stated in [2:36:28] accordance with generally [2:36:28] accepted accounting principles. [2:36:29] We conducted our audit as [2:36:32] auditors in accordance with [2:36:33] generally accepted auditing [2:36:34] standards as well as government [2:36:34] auditing standards. [2:36:38] Those are our responsibilities [2:36:38] that also report important to [2:36:39] note managements [2:36:42] responsibilities. [2:36:43] Management is responsible for [2:36:43] the fair presentation of [2:36:44] the financial statements in [2:36:47] accordance with generally [2:36:47] accepted accounting principles. [2:36:48] They're also responsible for [2:36:49] the internal controls over [2:36:51] financial reporting as well. [2:36:52] Moving on to our audit results [2:36:57] I'm pleased to report that we [2:36:57] have issued an unmodified [2:36:58] opinion. [2:36:58] Essentially our opinion states [2:37:01] that the financial statements [2:37:02] are fairly stated in accordance [2:37:03] with generally accepted [2:37:04] accounting principles And so if [2:37:07] that statement is unmodified [2:37:07] it's actually excellent news. [2:37:08] It's the highest level of [2:37:11] assurance. [2:37:12] I'll go ahead and move on to [2:37:13] our required communications. [2:37:16] Our auditing standards required [2:37:16] to cover certain areas with [2:37:17] those charged with governance [2:37:18] And the first one is in [2:37:20] relation to significant [2:37:21] accounting policies. [2:37:21] We have reviewed those policies [2:37:25] and disclosed in footnote one [2:37:26] of the financial statements and [2:37:27] believe them to be neutral, [2:37:27] clear and consistent with prior [2:37:30] year and have no report on that [2:37:31] matter. [2:37:34] Second is management's judgment [2:37:35] and accounting estimates. [2:37:35] Certainly every set of [2:37:36] financial statements include [2:37:37] estimates. [2:37:39] A great example of that would [2:37:40] be your postretirement health [2:37:41] care benefits or your pension [2:37:44] liabilities Management utilizes [2:37:45] actuaries to come up with [2:37:45] estimates which is very common [2:37:49] in this area. [2:37:49] We have reviewed the estimates [2:37:50] and we have no comment in that [2:37:50] area. [2:37:54] On the next slide here and well [2:37:55] had already alluded to this [2:37:59] the city is required to look at [2:38:00] new accounting standards that [2:38:00] are issued by the Governmental [2:38:03] Accounting Standards Board [2:38:04] every year And this year they [2:38:07] issued two standards Gadsby 1a1 [2:38:07] and 1 or 2 related to [2:38:08] compensated absences and [2:38:09] certain risk disclosures. [2:38:12] We've reviewed management's [2:38:13] implementation of those [2:38:16] standards and believed them to [2:38:17] be in accordance with generally [2:38:18] accepted accounting principles. [2:38:21] On the next slide here except [2:38:22] with with respect to [2:38:22] the implementation of the new [2:38:26] accounting standard, we did not [2:38:27] note any material corrected or [2:38:28] uncorrected misstatements to [2:38:31] bring to your attention today. [2:38:32] And then last but not least, we [2:38:33] did not note any of these items [2:38:36] that are listed here on [2:38:36] the slide. [2:38:37] In fact it was quite [2:38:37] the opposite. [2:38:38] Manager was very cooperative [2:38:38] throughout our audit and we [2:38:41] certainly appreciate their [2:38:42] cooperation during that time. [2:38:42] And then last but not least i [2:38:46] did want to confirm that Crow [2:38:47] is independent of the city of [2:38:47] San Diego which is obviously [2:38:48] very important to our role as [2:38:51] your independent auditors. [2:42:06] So much so that they were [2:42:06] willing to take a cut in their [2:42:07] credit rating. [2:42:10] You know And so I've been [2:42:11] asking yourselves what can be [2:42:11] creative answers? [2:42:15] Well can we can we work towards [2:42:16] the more creative answer to [2:42:20] that this time in San Diego [2:42:20] That's what Oakland did And [2:42:21] that's how I mean that's [2:42:25] the kind of tough decisions I [2:42:26] don't hope we have to be that [2:42:29] drastic but it is about [2:42:30] creative solutions. [2:42:34] It does have to be some tough [2:42:34] decisions that have to be made [2:42:35] And then I feel we can put [2:42:39] things off for a few years. [2:42:40] We don't have to say everything [2:42:41] has to be done in a year [2:42:44] deficit wise We can we can pass [2:42:48] it out over time And I think [2:42:49] those are important factors to [2:42:50] consider with this sort of item [2:42:53] losing a credit rating is hard [2:42:54] but maybe can that be a [2:42:58] creative answer to work towards [2:42:58] solutions for very difficult [2:43:03] questions at this time And [2:43:04] learning how to get that is [2:43:08] important and being honest like [2:43:09] that with the parking here you [2:43:09] got to be honest with [2:43:13] the public how your time is [2:43:13] going. [2:53:44] This presentation is for [2:53:44] the state revolving fund loan [2:53:45] to the City of San Diego sewer [2:53:48] system for the Alvarado Trunks [2:53:53] to face for a project package a [2:53:54] for a little bit of background, [2:53:54] the Clean Water State Revolving [2:53:59] Fund or srf as it's commonly [2:54:00] known, offers low cost loans to [2:54:01] help local agencies affordably [2:54:03] construct wastewater projects [2:54:04] throughout the state. [2:54:04] This program is administered by [2:54:08] the State Water Resources [2:54:09] Control Board. [2:54:09] The program offers low interest [2:54:13] rate options for loans and [2:54:14] favorable repayment terms. [2:54:15] The city regularly submits [2:54:17] applications for a standalone [2:54:18] projects that meets eligibility [2:54:18] requirements. [2:54:22] The state has recently limited [2:54:23] loans to $50 million per [2:54:28] project for the Alvarado Trunk [2:54:29] Sewer Phase four package. [2:54:29] The project will increase sewer [2:54:32] capacity by replacing outdated [2:54:33] trunk sewer infrastructure. [2:54:37] The city can receive a srf loan [2:54:37] up to $50 million. [2:54:38] Now full disclosure we have not [2:54:39] gone out to bid yet for this [2:54:42] particular project so we are [2:54:43] asking for the full amount of [2:54:45] the srf loan for $50 million. [2:54:50] The this project has been [2:54:51] included in the intended use [2:54:55] plan and the construction loan [2:54:56] is estimated to start at [2:54:59] the end of fiscal year 2026 or [2:54:59] at the beginning of fiscal year [2:55:00] 2027 and is estimated to be [2:55:03] completed by the end of fiscal [2:55:04] year 2029. [2:55:04] The current interest rate for [2:55:09] these srf loans is 2.2% that [2:55:09] the rate that rate is set by [2:55:13] the state water Board based on [2:55:14] a benchmark of 50% of [2:55:14] the interest rate on [2:55:15] California's average general [2:55:18] obligation rate obtained by [2:55:19] the state Treasurer. [2:55:20] The loan will have a senior [2:55:23] Lean position. [2:55:24] Principal repayment begins [2:55:25] after construction is done and [2:55:27] we will have a 30 year [2:55:28] repayment term. [2:55:31] We estimate the cost for a $50 [2:55:32] million loan to be $2.3 million [2:55:32] annually. [2:55:33] I would like to note though [2:55:36] that interest rate and debt [2:55:37] service is subject to change [2:55:37] based on when the loan is [2:55:40] finalized. [2:55:41] The existing loan and bond [2:55:42] obligations of the sewer system [2:55:44] require the sewer system to [2:55:45] meet certain additional debt [2:55:46] affordability tests when [2:55:46] entering into a new debt [2:55:50] obligation under [2:55:50] the anticipated language in [2:55:51] the loan agreement. [2:55:54] The sewer system will be [2:55:55] required to maintain a senior [2:55:56] debt service coverage ratio of [2:55:59] 1.2 times outstanding maximum [2:56:00] annual debt service an [2:56:01] aggregate debt service coverage [2:56:04] ratio of 1.1 times outstanding [2:56:04] maximum and annual debt [2:56:05] service. [2:56:08] The loan is supported by [2:56:13] currently approved rates. [2:56:13] So for a proposed action we are [2:56:14] asking for the authorization [2:56:18] for the mayor to implement [2:56:18] the srf Loan. [2:56:19] Authorize the city to pledge [2:56:22] net revenues for this from [2:56:23] the Sewer Revenue Fund for this [2:56:24] loan and authorize the cfo to [2:56:27] create a new fund and [2:56:28] appropriate an expense for this [2:56:28] particular project. [3:03:34] When we completed 90% design [3:03:34] the project was split into two [3:03:39] phases due to available free of [3:03:39] funding. [3:03:40] We progressed with phase one [3:03:43] while pursuing funding for [3:03:43] phase two. [3:03:44] We started construction on [3:03:47] phase one and we plan to finish [3:03:47] up this summer. [3:03:48] >> Knock on wood we have since [3:03:51] secured additional funding and [3:03:52] we were given the go ahead for [3:03:52] phase two. [3:03:56] If this action is approved we [3:03:56] will finish up phase two design [3:03:57] and hopefully put it out to bid [3:04:00] late this year so we can start [3:04:01] construction the following [3:04:05] spring. [3:04:06] So here is a summary of [3:04:06] the Design services schedule a [3:04:10] task for this as needed [3:04:11] agreement was issued to submit [3:04:12] design in 2017 for the buyer [3:04:15] Park General Development Plan. [3:05:09] So we need the ongoing support [3:05:09] for that subsequently as we are [3:05:13] wrapping up on work on phase [3:05:14] one we are getting ready to [3:05:18] move forward on phase two. [3:05:18] And so we do need [3:05:19] the consultant to be on board [3:05:22] in order to finalize those [3:05:23] plans for phase to complete [3:05:24] permitting for that and get [3:05:25] them ready to advertise for [3:05:30] construction of phase two. [3:05:31] >> So what has been completed? [3:05:35] We want to highlight some of [3:05:36] the progress that's already [3:05:36] been made on phase one. [3:05:37] You can see the image on [3:05:40] the left shows the undeveloped [3:05:41] site prior to construction. [3:05:41] On the right you can see [3:05:45] the large promenade that [3:05:46] bisects the play areas Two [3:05:50] large playground spur separated [3:05:51] for ages 2 to 5 and 5 to 12. [3:05:55] One of the really great [3:05:56] features on the right side you [3:05:59] can kind of see it peeking out [3:06:00] of the photo is a fairly large [3:06:00] rock climbing wall. [3:06:01] It's going to be a really [3:06:03] interesting, really unique [3:06:03] feature in one of our [3:06:08] playgrounds. [3:06:08] >> There's also two picnic [3:06:09] areas with shade structures You [3:06:10] can see in the background there [3:06:13] of the image. [3:06:14] Those are providing picnic [3:06:17] opportunities for families near [3:06:18] the playground and also in [3:06:19] phase two get constructed. [3:06:28] Also in phase one already [3:06:32] completed our Ampitheater [3:06:32] seating walls that kind of [3:06:33] match the strata of the geology [3:06:36] out there as well as 80% of [3:06:41] the walkways. [3:07:23] So what's remaining planting [3:07:24] completion of the public art [3:07:25] furnishings and energizing [3:07:28] utilities? [3:07:53] >> For the eoc requirements [3:07:54] the original contract again was [3:07:54] $3 million. [3:07:57] We are requesting $300,000 to [3:08:01] finish out the plans for phase [3:08:02] two and complete the services [3:08:02] of phase two. [3:08:06] The contract had a goal of 20% [3:08:10] current slb participation was [3:08:11] at 10% although we should note [3:08:12] that the prime consultant [3:08:16] Schmidt design was an slb when [3:08:16] the contract was signed [3:08:17] originally in 2017. [3:08:20] And with that that brings their [3:08:21] percentages quite a bit higher. [3:08:25] They lost that certification in [3:08:26] 2023 but up until then their [3:08:26] parties participation was much [3:08:29] higher. [3:08:34] >> So to summarize again [3:08:35] the actions we are requesting [3:08:35] is the Second Amendment to [3:08:39] the as needed agreement with [3:08:40] Schmidt Design Group to extend [3:08:41] the contract an additional [3:08:44] three years to get us through [3:08:45] phase two completion of phase [3:08:46] two of by Year Park as well as [3:08:53] authorizing $263,221 to be used [3:08:54] for those services as well as a [3:08:55] little bit extra capacity for [3:09:03] future needs approval of these [3:09:03] actions will allow us to [3:09:04] complete construction support [3:09:05] for phase one as mentioned and [3:09:08] also final design permitting [3:09:08] construction support on phase [3:09:09] two. [3:09:11] Phase one is set to be [3:09:12] completed this summer and phase [3:09:13] two with approval of this [3:09:16] amendment would proceed to [3:09:17] final permitting and [3:09:17] advertisement of [3:09:20] the construction contract [3:09:20] within 2020 six. [3:15:25] We've had now a total of four [3:15:25] parks that have been fully [3:15:29] funded in District eight. [3:15:33] This was an open lot where [3:15:34] residents were promised a park [3:15:36] many moons ago that was never [3:15:41] delivered to them And that's [3:15:42] not even talking about [3:15:42] the parks that we've [3:15:43] refurbished which is a whole [3:15:47] nother positive note on what's [3:15:51] happening in the park system [3:15:52] particularly for District eight [3:15:56] as was mentioned, phase one of [3:16:00] Beier Park is approximately 80% [3:16:00] complete with full construction [3:16:01] scheduled to be completed this [3:16:04] summer. [3:16:05] Community, as I'm sure you guys [3:16:09] know is is very eager and would [3:16:10] love to have a celebration a [3:16:10] community celebration to [3:16:14] commemorate that achievement. [3:16:15] Major amenities such as [3:16:19] the Skate park play areas, [3:16:20] picnic shelters and basketball [3:16:24] courts are already [3:16:25] substantially completed And I [3:16:29] will say that the stronger [3:16:30] lobbying I've ever received was [3:16:30] from the skater kids of San [3:16:35] Ysidro or Cesar Solis Park [3:16:35] which is my local park where I [3:16:39] take my daughter is always just [3:16:40] completely packed and I know of [3:16:44] people that come from other [3:16:45] parts of District eight just to [3:16:45] go skate there. [3:16:49] So this skating facility is [3:16:49] absolutely going to be very [3:16:54] well received. [3:16:54] You didn't show The View but [3:16:58] The View is just spectacular. [3:16:59] I don't think there's another [3:17:00] maybe Keep Sessions is a close [3:17:03] but that view is going to be [3:17:04] amazing And I would be remiss [3:17:07] if I didn't think Casa Familia [3:17:08] are our local nonprofit there [3:17:09] in San Ysidro who has been [3:17:12] steadfast to get this park to [3:17:13] come to fruition And also I [3:17:18] often am very critical of [3:17:18] the mayor's office and of [3:17:23] the mayor and this is one of [3:17:23] the things that I commend him [3:17:27] on him and I very much align [3:17:28] when it comes to parks while in [3:17:29] the mayor's office is doing a [3:17:32] fantastic job I keep on pushing [3:17:33] certain audit showed that we [3:17:37] need to push more and I think [3:17:38] this is an example of of how we [3:17:38] need to continue to push more [3:17:42] in residents need to continue [3:17:42] to ask us for more especially [3:17:46] when it comes to the Prop 68 [3:17:47] funding which this park will [3:17:51] receive. [3:17:51] So this contract amendment is [3:17:52] critical to maintaining [3:17:55] momentum by extending [3:17:56] the contract and increasing [3:17:57] capacity the city's going to be [3:18:00] able to advertise via park face [3:18:01] to this summer with [3:18:04] construction anticipated to be [3:18:05] completed in the summer of [3:18:05] 2028. [3:24:34] San Diego has raised marijuana [3:24:38] taxes yet the city continues to [3:24:39] shortfall in projected revenues [3:24:39] and faces ongoing budget [3:24:43] deficits before asking [3:24:44] residents or other sectors to [3:24:44] pay more. [3:24:47] The public deserves a clear [3:24:48] answer to a basic question Are [3:24:49] we actually collecting [3:24:52] the taxes already owed? [3:24:53] Marijuana remains largely a [3:24:57] cash based industry fee that [3:24:57] relies heavily on [3:24:58] self-reporting. [3:24:58] That creates real challenges [3:25:02] for transparency and [3:25:03] enforcement. [3:25:03] How does the city verify that [3:25:04] all sales are being reported [3:25:07] accurately And if businesses [3:25:08] are not paying what they owe [3:25:09] are penalties and back taxes [3:25:12] being fully collected and [3:25:12] counted towards the budget? [3:25:17] When an industry is cash heavy [3:25:17] and oversaturated it becomes [3:25:18] far too easy to sell out [3:25:21] the front door and the back [3:25:21] door. [3:25:22] The city should also take an [3:25:23] honest look at whether [3:25:25] the marijuana market in San [3:25:26] Diego is over licensed and [3:25:27] oversaturated which strains [3:25:31] enforcement resources and [3:25:31] undermines revenue. [3:26:20] We recognize as the indications [3:26:21] of mental health struggles of [3:26:22] our students and hopefully [3:26:25] the most severe form of mental [3:26:25] health struggles student [3:26:29] suicide ideation, personal [3:26:30] mental health resources have [3:26:34] been written more robustly into [3:26:35] the school district's budget [3:26:38] budgets These days it will take [3:26:39] these dedicated resources and [3:26:40] commitment from everyone at [3:26:43] school and in the community [3:26:44] including the decisions made at [3:26:45] the city council level. [3:26:49] Now more than ever we need [3:26:49] the City Council to make a [3:26:50] commitment to youth. [3:26:54] We need enforcement of our laws [3:26:54] against tobacco stores, vape [3:26:55] shops and marijuana [3:26:55] storefronts. [3:26:59] Who's selling flavored products [3:26:59] which is against your laws and [3:27:04] the state's students need clear [3:27:04] messages from all levels of [3:27:05] city government regarding how [3:27:08] to best handle problems that [3:27:09] are not short term solutions. [3:27:13] An example of such a message? [3:27:17] Drugs are never the answer not [3:27:17] alcohol, not tobacco, not [3:27:22] vaping, not marijuana or abuse [3:27:23] of prescription drugs. [3:27:23] This would show your commitment [3:27:27] to prevention and to our youth. [3:30:15] A major review published just [3:30:16] this month in the journal [3:30:19] Current Addiction Reports [3:30:19] examined the most recent [3:30:20] research on how cannabis [3:30:24] affects driving. [3:30:24] The findings were clear and [3:30:25] consistent cannabis products [3:30:29] containing thc impair driving [3:30:29] performance. [3:30:33] This isn't speculation or [3:30:34] outdated data It's based on [3:30:35] controlled experimental studies [3:30:38] conducted over the last five [3:30:38] years. [3:30:39] The review found that [3:30:43] impairment occurs quickly most [3:30:44] strongly within the first hour [3:30:47] after use and can last 4 to 5 [3:30:48] hours after inhalation During [3:30:51] that time drivers show reduced [3:30:52] reaction time impaired [3:30:57] attention and poorer lane [3:30:57] control skills that are [3:31:01] critical to preventing crashes [3:31:02] Even more concerning [3:31:02] participants in these studies [3:31:06] often felt ready and willing to [3:31:07] drive shortly after using [3:31:07] cannabis despite objective [3:31:11] evidence that their driving [3:31:11] ability was impaired. [3:31:12] In other words, people don't [3:31:16] reliably perceive when they are [3:31:16] unsafe to drive the risks [3:31:20] increase further when cannabis [3:31:21] is combined with alcohol. [3:37:13] They point out that heart [3:37:13] disease remains the leading [3:37:14] cause of death in the United [3:37:18] States and in Mexico and [3:37:18] the second leading cause of [3:37:19] death here in San Diego County. [3:37:23] And the numbers of people [3:37:23] involved here in San Diego [3:37:27] County help with heart disease [3:37:28] has risen over the last year. [3:37:32] They point out that unfortunate [3:37:33] this greatest burden of heart [3:37:37] disease is carried by our black [3:37:38] residents. [3:37:42] And it's important to remember [3:37:43] that one of the very important [3:37:47] conditions of conditions that [3:37:51] causes heart disease is smoking [3:37:52] and vaping. [3:41:07] Joe LaCava Was there a city [3:41:08] council meeting about [3:41:11] the glider part waiver that I [3:41:11] missed and exactly who rejected [3:41:12] that waiver? [3:41:16] Joe LaCava Did this council [3:41:16] hold some kind of a backdoor [3:41:17] meeting or communication in [3:41:21] violation of the Brown Act? [3:41:21] Is there a shadow government [3:41:22] making these decisions behind [3:41:25] our backs? [3:41:26] Let the record show that [3:41:27] the County of Los Angeles has [3:41:30] been using a hang gliding [3:41:31] waiver at Dockweiler State [3:41:31] Beach since 2017. Casco and [3:41:37] myself have flown under those [3:41:40] dockweiler waivers and we've [3:41:41] both written our proposed [3:41:42] Torrey Pines waivers patterned [3:41:45] exactly after that highly [3:41:46] successful dockweiler waiver. [3:41:46] The Dockweiler waiver was [3:41:50] approved by the Los Angeles [3:41:51] County Legal Department back in [3:41:51] 2017 and our proposed Torrey [3:41:55] Pines waivers are almost word [3:41:56] for word identical to it. [3:42:00] But somehow Joe LaCava [3:42:00] announces today that [3:42:01] the proposed Torrey Pines [3:42:05] waivers have been quote unquote [3:42:05] good. [3:42:06] How did that happen? [3:42:09] Joel LaCava Where is the record [3:42:10] of this city council rejecting [3:42:14] a Torrey Pines waiver and which [3:42:14] council members voted for or [3:42:15] against that waiver?
