[17:59] We do not have any organized [17:59] presentations for the closed [18:00] session agenda. [18:01] Sorry for reading no worries [18:03] with that please proceed with [18:04] public comment. [18:04] >> Thank you. [18:05] We do have one person here and [18:10] public comment Jesse Connor for [18:10] c. [18:11] S two If you can please come up [18:11] to the microphone You will have [18:12] one minute. [18:12] Please proceed. [18:17] Good morning MR. Chair. [18:18] Honorable Council Jesse Carter [18:18] Vice PRESIDENT Firefighters [18:19] Local 145 speaking on item c [18:21] has to in 2016 firefighters [18:22] negotiate for an option to [18:23] establish a medical veba for [18:23] its membership a tax exempt [18:28] trust to provide health care a [18:28] benefit enjoyed by many groups [18:29] across the state. [18:30] We spent thousands of dollars [18:33] on recognized experts as [18:34] required by city attorney and [18:34] risk management to demonstrate [18:35] both the legality and [18:36] the viability of such a plan. [18:39] The city reaffirmed that option [18:40] by approving it multiple mou [18:40] cents. [18:41] Now when firefighters here are [18:46] ranked 23rd of 23 departments [18:47] surveyed when firefighters [18:47] would be going to work for [18:48] the last 55 days without a [18:51] contract, the city's [18:52] negotiating team appears to be [18:52] holding a new contract hostage [18:53] on the premise that [18:54] firefighters must agree to have [18:58] this benefit stripped. [18:58] This cost the city nothing. [18:59] It already exists in our mou. [19:00] We're no more important than [19:03] other city employees but [19:04] sometimes our needs are [19:04] different. [19:05] We should be allowed to pursue [19:06] our needs just as other groups. [19:06] We're not here to ask for [19:09] anything more than what you've [19:10] already approved. [19:10] We respectfully request you [19:11] preserve the status quo with [19:12] regard to firefighter medical [19:15] plan options Do not strike this [19:16] language from our contract. [19:16] >> Thank you very much. [19:17] Thank you. [19:17] That does include public [19:21] comment here in council [19:22] chambers have started the five [19:22] minute timer going to those [19:23] participating remotely. [19:26] We currently have five people [19:27] in the queue. [19:27] When I unmute you please be [19:28] sure to let me know which item [19:34] or items you wish to speak to. [19:34] >> Blair Beckman if you can [19:35] please on you. [19:38] All right, we're going to [19:39] please you. [19:39] >> Please proceed. [19:40] You'll have one minute. [19:40] Thank you. [19:44] We're really nice public [19:45] comment previously Thank you. [19:50] I think it's worth debating, [19:50] you know the future of benefits [19:51] for San Diego employees. [19:56] I've been learning really [19:56] important lessons. [19:57] We don't cut benefits. [19:57] I think that's really [19:58] important. [20:02] Oakland is trying to do [20:03] the same thing because you know [20:04] there are serious budget issues [20:04] they have They're doing [20:08] the same thing the same thing [20:08] to their city workers. [20:09] I think it's a really wrong way [20:09] to go. [20:14] I really ask yourselves again [20:15] to consider the idea of our [20:19] city workers taking a 25 to $50 [20:20] pay cut a month That's like [20:24] $600 a year And that actually [20:25] brings a budget savings of [20:25] close to 1 or $2 million. [20:26] Can you please consider that [20:31] option and keep our benefits? [20:31] I think benefits are vitally [20:32] important. [20:33] Good luck to consider such an [20:37] option for a future. [20:37] >> Thank you. [20:38] Thank you Million Mile Man If [20:39] you can please unmute and let [20:42] me know which item or items you [20:43] wish to speak to. [20:43] >> Are you on public? [20:48] No we're on closed session [20:48] agenda. [20:49] >> Okay well then I would like [20:54] to weigh in on what I just [20:55] heard from You'll have one [20:56] minute to speak on the agenda [21:01] on the firefighter. [21:02] Look, you know, it doesn't take [21:06] a lot of intelligence to [21:07] understand that you give [21:07] the firefighters what they [21:07] want. [21:12] I mean, look at not only have [21:13] they paid their dues and [21:17] society, not only have they [21:18] paid their dues too to humanity [21:24] but they are deserving of of [21:24] what they want, period. [21:25] And it doesn't take much to [21:26] understand it. [21:30] This is all about common sense [21:30] and that's all I have to say. [21:36] But GOD bless all of those [21:37] fellows that work in the San [21:42] Diego rescue and lifeguarding [21:43] and police and public safety. [21:44] My GOD they can you imagine [21:48] doing their job? [21:49] i mean I can't imagine and I'll [21:50] probably need them one day. [21:54] So I hope not. [21:55] But anyway, if you can hear me, [22:00] MR. Connor man keep up the good [22:00] work. [22:01] >> I've got your back. [22:01] Thank you. [22:02] Thank you. [22:02] Next to the original if you can [22:07] please on mute and let me know [22:08] which item or items you wish to [22:08] speak to. [22:09] I'm going to tap on all of it. [22:12] You'll have three minutes. [22:12] >> Please proceed. [22:13] I really appreciate when people [22:14] come in and give you their [22:17] insight on what's really going [22:18] on with these contracts and [22:18] the fact that there's many of [22:19] these employees that have been [22:23] working uncontracted waiting [22:23] to, you know, get things back [22:29] over center. [22:30] It's a little bit sad to think [22:30] that, you know, that could be [22:31] abused in such a way to have [22:35] their benefits taken kind of [22:36] force them to sign a contract [22:41] which in that that would be [22:42] null and void because you can't [22:43] be forced to sign something. [22:43] But you know, as we're talking [22:47] about labor negotiations, it's [22:47] a little bit interesting to see [22:48] what's happening with [22:49] the litigation with that and [22:49] where you're going to be [22:53] bringing in you know, [22:54] discussing labor negotiations [22:58] And when we have issues like [22:59] this going on and for such a [23:00] significant importance position [23:05] because these guys do work that [23:05] you know most people won't do [23:06] but we need them And I feel [23:11] like they get treated kind of [23:11] you know, like they get [23:12] the leftovers Whatever's left [23:17] over after you know, you give [23:18] all your employees in the city [23:18] that are working with you guys [23:22] all of their money, all of [23:23] their benefits And then we have [23:24] people that are on the job that [23:28] are physically exerting a lot [23:29] of energy and potentially, you [23:30] know, getting injuries that [23:34] nobody else that worked in [23:35] the city are going to get And [23:35] then we're cutting their [23:36] benefits like they should [23:36] actually have more. [23:40] And if you do have to take from [23:41] some of those employees that [23:42] have been getting, you know, [23:46] these significant pay raises [23:47] that potentially, you know, [23:48] work for the mayor or your [23:48] guys's staff, I mean I think [23:52] that these people deserve [23:53] benefits over that pay raise [23:54] that those people are getting. [23:54] So if we have to make some hard [23:58] choices, that's what needs to [23:58] be done. [23:59] And so I hope you guys do [23:59] the right thing because you [24:00] know, when they when you need [24:05] them you're not going to want [24:05] to, you know, have made a [24:06] mistake for over a minute on [24:06] that topic. [24:10] On to another item There's two [24:10] labor negotiation or one about [24:15] fire and lifeguards and one [24:15] about labor negotiations. [24:16] So there's two of them in [24:16] there. [24:17] So thank you. [24:20] But I'm going to keep going And [24:21] for the other two with the trip [24:26] and fall in the bike accident [24:26] you guys need to you're with [24:27] the way that you were telling [24:32] us on the regular agenda how [24:32] much the settlements are. [24:33] It's no longer visible in just [24:34] the itemized items. [24:37] i think you guys need to bring [24:38] that back so it can be [24:39] transparent just right off [24:39] the bat without having to go in [24:43] search for the amount of money [24:44] . [24:45] And I think you guys need to do [24:45] some kind of tally where you're [24:49] saying this this year or this [24:50] And all time we have spent on [24:51] litigation for trip and falls [24:55] for bike accidents for whatever [24:56] and then show that you have [24:56] gone into those areas where [24:57] those accidents occurred and [25:01] that has been mitigated and how [25:02] much it cost to do that and [25:07] what the cost benefit ratio is [25:08] of you know the litigation and [25:08] we're just fixing the roads and [25:09] making sure that this kind of [25:13] stuff doesn't happen on a [25:14] continual revolving door basis. [25:19] >> Our next week is 8700 if you [25:20] can please I'm you and let me [25:20] know which item or items you [25:22] wish to speak to. [25:23] The five minute timer also [25:24] concluded we have one [25:24] additional speaker after [25:25] the speaker and no other [25:26] speakers will be taken. [25:27] >> Please let me know which [25:27] items and proceed. [25:32] Yes. [25:33] >> One, two and three You'll [25:34] have three minutes. [25:39] Please proceed. [25:40] Thank you, Julius And to [25:41] welcome back everybody on c. [25:44] S one which is another trip and [25:45] fall I came up with this [25:50] thinking on the agenda and [25:51] feeling involved to then you [25:56] Who is the one suing the city [25:57] is a metaphor as all these [26:02] people are that they have these [26:03] suits against the city [26:03] entrepreneurs. [26:08] You're really a metaphor for [26:08] this city is tripping and [26:09] falling and tripping and [26:13] falling on a public system for [26:14] sidewalk maintenance and of [26:19] course many, many other things [26:19] . [26:20] So I think it's a powerful way [26:21] to look at this and to know [26:25] that we're doing our best, that [26:26] we are improving Regarding [26:27] the sidewalks, that's for sure. [26:33] I like this metaphor and it's [26:34] just continuing and we need to [26:34] just keep on top of [26:38] the discussion We can see as to [26:39] I'm not quite clear on [26:40] the details of this item's [26:43] purpose here and the speakers [26:44] speak some very powerful words. [26:49] I really respect and honor our [26:50] and we'll use the memorandums [26:51] of understanding. [26:55] I think they're very powerful [26:56] For some reason I really put my [26:56] arms around the animal use and [27:01] embrace them as a very positive [27:02] support system for all of our [27:02] beloved employees. [27:07] And I do notice as I go out and [27:07] about in the world that I can [27:12] feel the tension in [27:13] the employees as we go through [27:14] these uncertain times and how [27:18] we're having to meet them. [27:19] So I love that there are so [27:25] many names on that code section [27:26] but there's just so many people [27:27] that have the back of our [27:27] employees and all the labor [27:31] association. [27:32] So if we're going to do it and [27:32] just go with your employees, we [27:33] love you firefighters, [27:36] lifeguards please everybody we [27:37] love you. [27:42] Keep at it On Fire Street. [27:42] Okay. [27:43] Lifeguard service provision [27:47] policy 2.9 Night crew I look [27:51] like I read you the policy 2.9 [27:52] It does involve an animal you [27:57] and excuse me I'm sitting on a [27:58] sidewalk here. [27:59] It's a long story but to me my [28:04] crew work is still very [28:04] crucial. [28:05] It is a very strong policy and [28:10] an mou which I think it has. [28:10] Maybe it needs improvement. [28:11] I also see us doing much better [28:15] in honoring the needs of our [28:16] excuse me of our valued and [28:21] appreciated the lifeguards. [28:22] We're really making progress [28:23] with our lifeguards. [28:28] I really feel good about it So [28:29] if I keep at it it's going to [28:29] be a great week. [28:29] You're back. [28:33] I hope you had a wonderful [28:34] summer and I look forward to [28:34] participating and hearing what [28:39] you're sharing and sort of to [28:39] all Thank you. [28:40] Krypto Bradley if you can [28:41] please unmute and let me know [28:47] which item or items you wish to [28:47] speak to. [28:48] >> Thanks one and two please. [28:51] This is Hector a I'd say on a [28:52] good note the slip and fall [28:57] that go into the airport Now [28:57] what's great I dropped off my [28:58] girlfriend at Southwest It's [29:03] amazing how it works Really [29:03] good. [29:04] And then the slip and fall down [29:04] at the island. [29:09] The crosswalk that goes in [29:09] there. [29:10] I didn't get it done. [29:11] That's like a dangerous [29:15] situation And there's there's [29:15] only one line left to [29:16] the crosswalk and I've been [29:16] going down there a lot [29:21] different and it's gave me 543 [29:22] days that they're going to [29:27] paint the crosswalk. [29:28] So if we get it done that takes [29:33] 531 days out of you. [29:34] Just give us some paint at [29:35] ourselves, you know, to speed [29:35] it up. [29:39] So because that could be a big [29:40] time loss you could get a lot [29:41] of traffic and people walking [29:45] around on bikes and cars and [29:45] the fire department you got to [29:50] give them what they want. [29:51] The attorneys are making all [29:51] the money, maybe only have one [29:57] city attorney on the job [29:57] because that's what lawsuits [29:58] are like. [29:58] The attorneys, all those guys [29:59] in the back, the attorneys or [30:03] the fire, they could be getting [30:03] paid by somebody anyway. [30:09] That's just like any lawsuit. [30:09] The attorneys are raking in [30:10] the money to pay them and they [30:11] put up warning signs that you [30:14] want to river during the flood. [30:14] It's going to be a massive [30:21] health care disaster when [30:21] the floods come and hit [30:22] the water. [30:22] Don't order any firemen or [30:27] firefighter in the water. [30:28] Don't even have them in there. [30:29] Put up signs with your dumb in [30:33] the water. [30:34] You're on your all. [30:34] Don't MISS Their last rescue [30:35] When some idiot gets down there [30:38] in the water during the storm [30:39] that's common. [30:40] It's not worth these guys lives [30:43] to rescue something down there. [30:44] So that's my thing with [30:49] the lawsuits and the firemen. [30:50] >> You got to give them [30:50] the money. [30:51] Thank you. [30:51] Thank you. [30:55] Let us conclude closed session [30:56] public comment. [30:56] >> All right. [30:57] Thank you, City clerk We will [30:57] now recess and the close [31:00] session and reconvene council [31:01] today at 2 P.M. Or shortly [36:42] thereafter [38:42] and [39:37] from the company we have like [39:37] to make sure thank you for [39:38] their official testimony. [39:40] Yes I can thank you so much. [39:40] Thank you. [39:41] And Capital One welcome. [39:41] Hello and thank you so much. [40:11] >> Thank you. [42:02] >> And I think [44:02] really [47:12] we're ready. [47:18] >> All right. [47:19] Good afternoon. [47:19] Yeah. [47:19] First day back from our [47:20] legislative recess. [47:24] I will now reconvene the city [47:25] council meeting on Monday, [47:25] AUGUST 24th, 2026. [49:33] Thank you, Council PRESIDENT [49:33] All right. [49:34] Thank you. [49:54] >> And with that clerk please [49:55] introduce item 200. [49:59] Item 200 is the proposed fiscal [50:00] year 2027 Statement of [50:05] Budgetary Principles. [50:06] If you'd like to speak on this [50:06] item now's the time to raise [50:07] your hand by pressing Star nine [50:08] or if you are here in person [50:10] please be sure to bring your [50:11] speakers up to the front of [50:12] the room so that we can have it [50:12] ready. [50:12] Thank you. [50:16] Council PRESIDENT All right. [50:17] Thank you. [50:17] All right. [50:18] This item is being brought [50:18] forward by the Office of [50:19] the Independent Budget and also [50:21] kick it over to MR. Monica to [50:22] start the presentation. [50:22] Great. [50:22] Thank you. [50:23] Council PRESIDENT Council [50:26] members So this item is [50:27] the city's 20th Annual [50:28] Statement of Budgetary [50:28] Principles. [50:32] The documents that staff will [50:32] be going over are essentially [50:33] an agreed upon set of reporting [50:34] and communication [50:38] responsibilities for both this [50:38] Council and administration as [50:42] it actually implement the fy [50:42] 2027 budget. [50:43] So the best practice to ensure [50:43] that both the administration [50:48] and the Council agree on [50:49] the communication and roles and [50:49] responsibilities associated [50:50] with the budget that are before [50:53] each of those bodies. [50:54] Sergio I'll call the on my [50:54] staff will walk you through [50:57] the actual statement itself. [50:58] I would just note at the outset [50:59] that this statement of [50:59] principles essentially covers [51:03] everything that you saw in [51:04] the prior statement for fy 2026 [51:05] with one addition and that is a [51:08] requirement of [51:09] the administration to provide [51:09] an annual update to the Council [51:10] on Settlements and Judgment [51:13] payments that the city makes [51:14] each year. [51:14] With that I'll kick it over to [51:17] Sergio and his presentation [51:18] will take about six minutes. [51:18] >> Thanks, Charles. [51:19] I'm sorry I'll call the office [51:22] of the aba On JUNE 30th 2026 [51:26] Our office released Iberia [51:26] Report 26 Dash 18 which [51:27] includes the proposed fiscal [51:30] year 2027 Statement of [51:31] Budgetary Principles Since [51:32] the Statement of Budgetary [51:32] Principles is an annual [51:35] agreement between Council and [51:36] the Mayor our office obtain [51:37] review and input from [51:37] the Department of Finance as [51:40] well as the City Attorney's [51:40] Office. [51:41] We appreciate their [51:41] collaboration. [51:42] We're asking the Council to [51:46] review and adopt the principles [51:46] with any desired modifications. [51:50] By way of background, [51:51] the Statement of Budgetary [51:51] Principles represents an [51:52] agreement between Council and [51:56] the Mayor for administration of [51:56] the budget. [51:57] It clarifies budgetary [51:57] authority and facilitates [52:01] communication regarding [52:01] the budget. [52:02] The need for the principles [52:02] came with the transition to [52:05] the strong mayor strong council [52:06] form of government. [52:07] At the time there was a lack of [52:10] clarity between the executive [52:11] and legislative branches about [52:12] budget administration and [52:12] handling of related fiscal [52:15] matters. [52:16] The statement of budgetary [52:20] principles was put into place [52:20] in fiscal year 2008 as an [52:24] accompanying resolution to [52:24] the fiscal year 2000. [52:25] The appropriation ordinance [52:26] since then has been adopted [52:29] each year and we recommend it [52:29] to continue for fiscal year [52:29] 2027. [52:33] The proposed principles were [52:34] heard on the JULY 8th Budgeting [52:38] Government official commit [52:39] Government Efficiency Committee [52:39] which forwarded it to council [52:40] without any additional [52:43] adjustments. [52:47] The principles can be broken [52:48] down into three sections. [52:49] First the communication on [52:52] budget programs services. [52:53] The second is the Appropriation [52:56] ordinance. [52:57] And third is the principles for [52:58] an effective, collaborative and [53:01] transparent city budget [53:01] process. [53:02] I will provide highlights for [53:03] these functions for these [53:06] sections later in this [53:07] presentation. [53:07] The proposed fiscal year 2027 [53:11] principles largely mirrored [53:12] those of fiscal year 2026 with [53:13] most revisions consisting of [53:16] updated dates and technical [53:16] adjustments. [53:17] I do want to note that there is [53:18] one proposed substantive [53:21] judgment which is a requirement [53:21] for an annual update on [53:22] the city's settlement and [53:22] judgment payments including [53:26] related expenses and claim [53:26] information for the police [53:27] department. [53:30] This adjustment stems from a [53:31] request that came out of [53:31] the JUNE 17th Budget and [53:32] Government Efficiency Committee [53:35] meeting. [53:39] >> Moving on to the three [53:40] sections of the proposed [53:40] principles the first outlines [53:44] how communications should occur [53:45] regarding budget to programs [53:45] and services. [53:49] The principles require [53:50] the mayor to provide quarterly [53:51] reports to the council which [53:51] are done through the quarterly [53:54] budget monitoring reports. [53:55] The mid-year budget process is [53:56] also included in this [54:00] requirement under which [54:00] the Mayor MAY recommend to [54:01] council how to budget any [54:02] projected surplus or how to [54:04] adjust any projected deficit. [54:05] For the third bullet the mayor [54:09] must provide written notice to [54:09] council before implementing any [54:13] significant reduction or delay [54:14] to a funded program. [54:15] This written notice must [54:18] include justification and a [54:19] description of service level [54:20] impacts including potential [54:23] unintended consequences that [54:24] create disproportionate [54:25] inequity for communities of [54:25] concern. [54:28] We emphasize the importance of [54:29] both clear communication and [54:30] making any reductions [54:33] thoughtfully. [54:38] >> The next section sets out a [54:39] sets of principles for [54:40] the Appropriation Ordinance or [54:43] aoe The principles preserve [54:44] the intent that the aoe is a [54:45] document to implement adopted [54:47] budget and does not provide [54:48] policy direction. [54:48] The principles also state that [54:53] neither the mayor nor Council [54:53] have unilateral authority to [54:54] make changes to the spending [54:57] authority in the budget. [54:58] Accordingly, Council cannot [55:01] change the budget without first [55:02] receiving a funding [55:03] recommendation from the mayor. [55:07] And finally the mayor must in [55:07] good faith fulfill [55:08] the legislative intent [55:12] reflected in the budget. [55:12] The principles further include [55:13] Council's intent that services [55:14] be implemented equally and [55:19] equitably. [55:20] >> The final section in [55:20] the principles applies to an [55:23] effective city budget process. [55:24] This line lists some of [55:25] the principles for a fiscally [55:26] responsible budget process [55:28] including eliminating [55:29] the structural budget deficit [55:30] for pursuing service delivery [55:34] efficiencies, maintaining [55:34] reserves and planning for [55:35] deferred capital infrastructure [55:43] and its maintenance. [55:44] >> Other principles for an [55:44] effective city budget process [55:45] include limiting programmatic [55:48] supplemental positions. [55:49] The principles note that [55:49] programmatic supplemental [55:53] positions should only be [55:54] requested after the fiscal [55:55] year's first quarter unless [55:58] the need for these positions [55:59] could not have been anticipated [55:59] during the budget adoption [56:03] process and waiting until [56:03] the end of the first quarter [56:04] would restrict the city's [56:05] ability to provide critical [56:08] services. [56:08] Other principles include having [56:09] council committees review key [56:13] performance indicators or KPIs [56:13] and ensuring collaboration and [56:18] carrying out council's policy [56:18] directives including [56:19] the Programs Council has [56:22] included in the adopted budget [56:23] and the city's labor [56:23] negotiation policies. [56:28] The principals also encourage [56:28] council members to discuss any [56:29] proposed adjustments with our [56:32] office before Council's final [56:33] budget adoption meeting so that [56:33] we MAY provide feedback. [56:38] As we noted earlier, there is [56:38] one proposed substantive change [56:39] to the principals. [56:42] This new change would require [56:42] the risk management department [56:43] to give City Council an annual [56:44] presentation on the city's [56:47] settlement and judgment [56:48] payments including related [56:48] expenses and claim details for [56:52] the city's police department. [56:53] Again, this proposal reflects a [56:58] request a request made at [56:58] the JUNE 17th dng Committee [56:59] meeting following a similar [56:59] presentation from risk [57:02] management. [57:03] >> What that our office is [57:06] requesting the Council to [57:07] review and approve the proposed [57:08] fiscal Year 2027 Statement of [57:09] Budgetary Principles along with [57:11] any desired changes. [57:12] Note that since this is an [57:13] agreement between the City [57:16] Council and the mayor, any [57:17] proposed revisions to [57:18] the principles will be subject [57:18] to mayoral approval. [57:21] That concludes my presentation. [57:22] Council PRESIDENT And we're [57:23] happy to answer any questions. [57:23] All right. [57:26] With that thank you very much [57:26] with for the presentation of [57:27] the work to bring this item [57:31] forward and the work with [57:31] the Budget Committee. [57:32] With that city Clerk please [57:35] proceed with public comment And [57:36] again we'll be looking for your [57:37] comments on item 200. [57:40] Thank you. [57:41] Council PRESIDENT We do have [57:41] several speakers here in [57:42] council chambers. [57:42] We did not received any [57:45] organized presentation requests [57:46] for this item so we'll be [57:49] starting with Joyce Senora And [57:50] as noted on the agenda it is [57:51] two minutes per person. [57:54] So Joy, if you can please come [57:55] forward if I can have [57:55] the following individuals [57:56] please come up to the reserved [57:59] seats at the front. [57:59] Paul Krueger, Laurie Saldana [58:00] and allegedly Audra please [58:03] proceed. [58:04] >> Thank you. [58:08] Okay. [58:09] The slip that I gave to our [58:13] dear city clerk is one that has [58:17] red letters on it and it says [58:18] opposed. [58:22] And I want you to know that I [58:23] am a strong no on this item. [58:31] I am a strong no. [58:36] >> Sergio, thank you for [58:36] presenting it. [58:36] Very good. [58:40] And thank you to everybody who [58:41] worked on it and for these [58:42] many, many years. [58:45] Thank you so much. [58:46] So it's a great document. [58:47] There's no doubt about it And [58:50] it's needed And I love [58:51] the authority part of it [58:54] clearing that up on [58:55] the executive and legislative [58:55] branches. [58:56] I love the communication and [59:00] the collaboration portion of [59:00] it. [59:01] I love that it's you know, [59:05] helps with the budget changes. [59:05] I like that the framework is [59:09] there for administering [59:10] the administration of [59:13] the budget each fiscal year. [59:18] Here's what I don't like. [59:19] >> Support a physically [59:21] responsible budget process. [59:26] >> It does not. [59:27] How long have we had a [59:30] structural budget deficit? [59:31] We're not addressing it and you [59:36] don't address it clearly in [59:36] this document? [59:40] We don't we're not supporting a [59:41] fiscally responsible budget [59:41] process. [59:45] Period. [59:46] And I don't know when we're [59:46] going to start. [59:51] We nibble at it and all we do [59:51] is nibble. [59:55] And I ask you for several years [59:56] to remove the word any as it [59:56] relates to the structural [1:00:00] budget deficit. [1:00:00] Any to me is a question any [1:00:05] structural budget deficit? [1:00:05] >> No, we have one. [1:00:06] Anyway, thanks for listening. [1:00:17] Love to all No on this item. [1:00:18] >> Uh, good afternoon, council [1:00:18] members. [1:00:22] I wanted to thank you first of [1:00:23] all especially Councilmember [1:00:26] Foster for the increased [1:00:27] scrutiny that you're going to [1:00:28] have on police settlements. [1:00:32] I think it's important that you [1:00:33] thoroughly review and try to [1:00:36] take affirmative early action [1:00:42] to understand why we're making [1:00:42] these settlements and ways that [1:00:43] we can avoid them And that goes [1:00:47] much further to all forms of [1:00:48] public liability. [1:00:48] Look at the number of [1:00:49] settlements you have on this [1:00:55] Tomorrow's budget for trip and [1:00:56] falls and flooding that are [1:00:57] totaling tens hundreds of [1:00:59] millions of dollars a year. [1:01:00] But I wanted to speak most to [1:01:04] this issue on that aspect of [1:01:04] effective collaborative and [1:01:08] transparent communication in a [1:01:09] mayor council form of [1:01:13] government as Apple clickable [1:01:14] to the city's budget process. [1:01:19] My concern or my example I [1:01:19] would give about the really [1:01:24] significant importance of this [1:01:24] is this complete breakdown that [1:01:25] we had on the restrooms in [1:01:29] mission Bay. [1:01:29] I wasn't the only one to [1:01:33] express concerns about [1:01:33] the closure of those restrooms [1:01:37] in JULY before you went on your [1:01:38] hiatus. [1:01:39] The fact that it got past [1:01:42] the budget approval process [1:01:43] when at least one of you [1:01:48] opposed the closure of those [1:01:49] restrooms and that they [1:01:49] continued closed for another [1:01:53] month in the face of [1:01:57] significant public outcry for [1:01:58] want of a better word is really [1:02:02] unacceptable. [1:02:03] That should not have happened [1:02:04] And I don't think as members of [1:02:07] the public we care what [1:02:08] the reason why they were closed [1:02:12] and more importantly why it [1:02:13] took more than a month to open. [1:02:14] But nobody and I think [1:02:17] yourselves included wants to [1:02:18] see that happen again. [1:02:18] >> Thank you. [1:02:22] Thank you. [1:02:22] Hold on. [1:02:23] You and I understand you have a [1:02:25] presentation materials to share [1:02:30] for the. [1:02:30] But did you want to start with [1:02:35] the video or start speaking [1:02:36] videos for this is just images. [1:02:36] >> Oh I don't know what that [1:02:37] music came from. [1:02:39] My apologies either but I [1:02:40] wanted to start by saying that [1:02:44] in order to have these [1:02:44] budgetary principles work you [1:02:48] need to have good faith [1:02:48] negotiations with the mayor. [1:02:53] And if the mayor is in [1:02:53] Sacramento negotiating on [1:02:54] issues such as exemptions for a [1:02:59] project to take place at [1:02:59] the council then has no control [1:03:00] over. [1:03:03] You are being encumbered [1:03:03] legislatively in ways that I [1:03:04] don't think are good faith [1:03:08] principles If your ability and [1:03:09] specifically I'm talking about [1:03:17] efforts by the mayor and body [1:03:18] to have exemptions to secure [1:03:22] for a major development project [1:03:22] in an area that lacks [1:03:23] the infrastructure to support [1:03:23] it. [1:03:26] Go ahead to the next slide [1:03:27] please. [1:03:27] So while the mayor is supposed [1:03:31] to be communicating in good [1:03:32] faith with you, he is making it [1:03:33] impossible for you to safeguard [1:03:37] people in an area. [1:03:37] If I could have the next image. [1:03:38] Thank you. [1:03:41] That is rapidly this is an [1:03:42] image from Rotterdam is rapidly [1:03:42] sinking much like other cities [1:03:46] around the world because of sea [1:03:46] level rise. [1:03:50] And PRESIDENT Lacob, you're an [1:03:51] engineer. [1:03:51] I don't think we need to tell [1:03:52] you that saltwater intrusion [1:03:55] into structures is not a good [1:03:55] combination and the city's [1:03:56] ability to deal with it. [1:04:00] Your council ability. [1:04:01] >> I'm going to I'm also [1:04:02] the council PRESIDENT And we [1:04:04] ask people to speak to [1:04:05] the budgetary principles [1:04:05] whether the language is good or [1:04:06] whether you like the addition [1:04:10] rather than veer off into other [1:04:11] conversations that might be [1:04:11] more appropriate for the next [1:04:13] item or certainly for non [1:04:18] agenda No. [1:04:19] >> Well we'll put it back If I [1:04:22] did say it for you and one [1:04:23] reason you have the budgetary [1:04:23] principles was because you were [1:04:27] not having good communication. [1:04:28] There was a pension crisis that [1:04:29] was underfunded that wasn't [1:04:32] communicated And I would say [1:04:32] that the same thing is [1:04:33] happening now where you are [1:04:36] being obligated for some [1:04:37] expenses that you were not [1:04:37] privy to and that you would [1:04:41] have no control over and that [1:04:42] has to do with some development [1:04:42] projects specifically But [1:04:46] there's other things as well. [1:04:47] So if you're against [1:04:47] the administration, the mayor [1:04:52] is going to lobby on behalf of [1:04:52] the city for a specific piece [1:04:56] of legislation or to that is an [1:04:57] encumbrance of future fiscal [1:05:01] responsibilities And it is not [1:05:01] in good faith And I don't [1:05:02] believe you're going to meet [1:05:07] the goal of of this. [1:05:07] >> Thank you. [1:05:07] Thank you. [1:05:08] I did pause of your time during [1:05:09] that So allegedly Andre, if you [1:05:09] can please come forward. [1:05:10] >> You'll have two minutes as [1:05:14] well. [1:05:19] >> I love here Enjoy Come out [1:05:19] here and really start holding [1:05:20] you guys accountable because it [1:05:24] is very clear what's going on [1:05:24] And you guys's actions speak [1:05:25] louder than your empty words [1:05:28] because even if you brought [1:05:29] forward this ordinance to stop [1:05:33] the things that you talk about, [1:05:34] these things are still taking [1:05:35] place and so you can't be [1:05:39] trusted that you know, even if [1:05:40] you continue to pass this that [1:05:40] it's going to stop it. [1:05:43] I mean because I think there's [1:05:44] a lack of communication between [1:05:48] you guys and the mayor And I [1:05:48] don't believe there is an [1:05:49] effective collaborative process [1:05:52] that is taking place which is [1:05:53] really unfortunate because you [1:05:54] guys need to be good stewards [1:05:54] of our money. [1:05:57] But if there's this constant [1:05:58] battle and one side's doing [1:05:59] something that the other side [1:06:02] isn't stopping, then you know [1:06:03] how how strong is that for [1:06:07] the city And what happens if [1:06:08] you guys don't pass this? [1:06:09] I feel like that's something [1:06:09] that you guys should put in [1:06:12] here, you know, like do you [1:06:13] have to because you guys get [1:06:16] into these situations where you [1:06:17] pretty much have to pass [1:06:17] the item and so you go ahead [1:06:21] and do it just because you have [1:06:22] to instead of going is this [1:06:25] really what's best If we [1:06:26] brought it forward to stop [1:06:27] the things that we're talking [1:06:27] about, it hasn't done that [1:06:30] because then you're just [1:06:31] gaslighting the people acting [1:06:32] like you're you're you know, [1:06:35] doing what's best because even [1:06:36] still like the fulfilling [1:06:36] the intent of the budget does [1:06:40] that ever happen I mean [1:06:40] potentially because your guys [1:06:41] is in the mayor's intent is [1:06:44] different than what you present [1:06:45] to the people so you're filling [1:06:46] your own pockets and things [1:06:49] like that But what you present [1:06:50] to the people isn't what's [1:06:50] happening and the impacts. [1:06:51] It's like who knows what [1:06:54] the impacts are like even [1:06:54] closing the bathrooms. [1:06:55] Is that something that [1:06:56] the mayor let you guys know [1:06:59] what those impacts were going [1:07:00] to be and how would he know [1:07:00] that? [1:07:03] How could you trust that he [1:07:04] would provide you enough [1:07:05] information that would really [1:07:05] show what the people are going [1:07:09] to be, you know, suffering? [1:07:09] I mean because he's not going [1:07:10] there and having to suffer [1:07:10] that. [1:07:14] So I just think you guys need [1:07:15] to be more mindful about [1:07:15] the way you do this And we need [1:07:16] to be hearing about what [1:07:17] the impacts are if you don't [1:07:19] pass it. [1:07:25] Anthony Ralphs Okay then we'll [1:07:25] go to those that are [1:07:30] participate voting online [1:07:31] starting with calling user one [1:07:31] If you can please unmute you'll [1:07:37] have two minutes. [1:07:37] Say hello. [1:07:43] Hello. [1:07:44] >> Yes we can name it Gore on [1:07:48] my name is Gore Button and I [1:07:48] live in Tule Lake. [1:07:49] I just want to say on [1:07:50] the budget they are going to [1:07:53] both we should not be giving [1:07:54] money to Breaking Bad. [1:07:58] Sure that we need to we are [1:07:59] women or we are women in [1:08:04] bathrooms and basically get [1:08:04] what are you thinking and will [1:08:05] there be an increase? [1:08:08] I hate you pretty much if you [1:08:09] are too weak and by you are a [1:08:12] man and you do not belong in [1:08:17] men's race men women, [1:08:18] restrooms, women's locker rooms [1:08:22] and women's jails I'm sick [1:08:22] Entire training taking over San [1:08:27] Diego GOD bless America GOD MAY [1:08:28] appease Really GOD bless Donald [1:08:31] Trump are eternal I think GOD [1:08:35] bless our governor takes barely [1:08:40] That concludes your comments. [1:08:40] Okay Starting with next going [1:08:44] to Kathleen Lippert. [1:08:45] >> Thank you. [1:08:50] Good afternoon. [1:08:50] Council My name is Kathleen [1:08:54] Lippert at over the past two [1:08:55] decades the city of San Diego's [1:08:59] workforce has expanded from [1:09:03] 11,000 employees in 2005 to [1:09:07] 13,000 in 2025 a 20% increase. [1:09:07] Notably during that period [1:09:08] management level positions [1:09:12] surged by 461% this year. [1:09:17] Meantime, along a 10% rise in [1:09:22] the city's population, I want [1:09:22] to point out that there is an [1:09:26] example that the city could [1:09:27] follow and perhaps collaborate [1:09:27] with the city of Temecula. [1:09:35] It became debt free after [1:09:35] $76.86 million was paid off. [1:09:36] The officially declared itself [1:09:39] debt free. [1:09:40] The city including the city [1:09:44] manager announced [1:09:45] the achievement in JULY 2026 [1:09:49] Temecula City Council Under [1:09:50] the city's definition debt [1:09:54] included mortgages facility [1:09:54] loans, unfunded pension [1:09:55] obligations and long term [1:09:59] liability. [1:10:00] If the payoff was the result of [1:10:04] a multi-year financial strategy [1:10:05] that addressed facility loans, [1:10:09] mortgages unfunded pension [1:10:10] obligations and other long term [1:10:11] liabilities By resolving these [1:10:15] obligations the city not only [1:10:16] removed debt from its balance [1:10:20] sheet but also reduced future [1:10:21] interest costs significantly. [1:10:25] However, this can only be done [1:10:29] if there is a market solution [1:10:30] and and dedication to being [1:10:34] into integrity and and [1:10:35] the public good. [1:10:39] So thank you for letting me [1:10:39] speak. [1:10:40] >> Thank you. [1:10:41] Next is John If you can please [1:10:43] unmute. [1:10:48] Good afternoon City Council [1:10:49] members I'm sorry your and we [1:10:50] can I can hear you very very [1:10:54] faintly. [1:10:54] Sorry about that. [1:10:55] Is this better? [1:10:55] Yes that's better. [1:10:56] Please proceed. [1:10:58] Excellent. [1:10:59] >> John Brady with Lived [1:10:59] Experience advisors. [1:11:00] Good afternoon City Council. [1:11:03] I am concerned about how [1:11:03] the budget process played out [1:11:07] this year. [1:11:08] It seemed that we were going to [1:11:09] protect everything related to [1:11:12] our services for the homeless [1:11:13] community. [1:11:14] And at the very end it appeared [1:11:14] that we were going to [1:11:18] discontinue funding for the Neo [1:11:19] good day center and now it [1:11:19] appears that the denial good [1:11:22] day center is going to be [1:11:23] permanently closed and licensed [1:11:24] from operation. [1:11:27] That is a very different [1:11:28] outcome from what we expected [1:11:29] at the beginning and I can [1:11:32] assure you the community [1:11:33] response would have been much [1:11:33] more aggressive had we known [1:11:37] that a as a decrease in funding [1:11:38] was going to be an absolute [1:11:39] shutdown of the neo good day [1:11:43] center To put that in [1:11:43] perspective. [1:11:44] The name of the Day Center has [1:11:46] either 6 or 8 men's and women's [1:11:47] stalls four bathrooms. [1:11:50] That is over 50% of [1:11:51] the available public bathrooms [1:11:51] in the city of San Diego for [1:11:55] people experiencing [1:11:55] homelessness. [1:11:56] >> That is an outrageous [1:11:56] outcome. [1:12:00] John I'm going to interrupt [1:12:01] because I have to be fair to [1:12:01] everyone. [1:12:02] We're talking about [1:12:04] the budgetary principles not [1:12:05] about any facility or any [1:12:06] budget allocation So understood [1:12:09] and understood And what I'm [1:12:10] seeking is more clarity when a [1:12:14] shift like that is going to [1:12:14] occur. [1:12:15] So I and I apologize for [1:12:19] getting into in depth into that [1:12:20] I understand. [1:12:20] Council PRESIDENT. [1:12:24] So I really hope that in [1:12:25] the future we are able to [1:12:25] provide a lot more clarity [1:12:29] about the impact of decisions [1:12:30] like this as well as cutting [1:12:35] cutting public bathrooms across [1:12:36] the board. [1:12:36] >> Thank you. [1:12:37] Blair Beckman if you can please [1:12:39] unmute. [1:12:39] All right. [1:12:45] Thank you. [1:12:45] Beakman I really second [1:12:46] the words of the previous [1:12:46] caller. [1:12:50] I'm very, very much so. [1:12:50] >> We can continue to talk [1:12:51] about these issues. [1:12:54] Thank you. [1:12:55] To me for me to speak on [1:12:56] principles of budgetary [1:13:00] concerns at this time it's my [1:13:01] sincere hope that we're [1:13:04] understanding that we can't [1:13:05] just simply offer, you know, [1:13:10] the best practices of budget [1:13:10] austerity to immediately solve [1:13:11] our budget issues a budget [1:13:16] deficit issues. [1:13:17] >> It was a fine that was a [1:13:18] program that was created kind [1:13:20] of in the 80s and 90s and it [1:13:20] was the accepted standard way [1:13:21] to work. [1:13:25] But we're trying to understand [1:13:26] the concepts that human beings [1:13:30] come first before ledger books [1:13:30] . [1:13:31] And that is been a bit of a [1:13:32] difficult journey for [1:13:32] ourselves. [1:13:35] We're learning how to navigate [1:13:35] it. [1:13:36] I hope we can continue that [1:13:37] important journey into next [1:13:40] year into 2027. [1:13:41] So you know budget time in MAY [1:13:47] of next year for 2028 we will [1:13:47] be much more ready to talk [1:13:51] about equity and talk about [1:13:52] best practices so people don't. [1:13:52] Services don't get cut. [1:13:57] And then how we learn those [1:13:57] principles. [1:13:58] I want to be better prepared [1:13:59] about how we learn [1:14:02] the principles that we feel [1:14:03] that continuing health care [1:14:08] benefits and retirement [1:14:08] services for our city [1:14:09] government workers in times of [1:14:13] stress is I think an important [1:14:14] principle and that a pay cut [1:14:15] MAY actually possibly be a [1:14:19] little easier than cutting. [1:14:19] You know, our concerns and our [1:14:24] and our retirement concern for [1:14:25] city workers it's learning a [1:14:26] principle system that we're [1:14:30] trying to navigate and better [1:14:30] understand for all of us [1:14:31] because look how we can do that [1:14:32] And I think it can make our [1:14:35] future better decisions better. [1:14:36] And it has to be based on [1:14:37] the choices of humanity and not [1:14:41] serving economic forecasts and [1:14:41] and ledger books. [1:14:42] So good luck in the efforts. [1:14:47] Thank you. [1:14:48] Thank you. [1:14:48] The five minute timer To [1:14:49] conclude during Blair's [1:14:49] comments there were three [1:14:50] people in the queue. [1:14:53] Additional speakers will be [1:14:53] taken. [1:14:54] Catherine Rose If you can [1:14:54] please unmute. [1:14:56] After that is Natalie Raskin [1:14:57] 7499. [1:14:57] >> Hello this is Catherine [1:14:57] Rhodes. [1:15:02] I wanted to talk about [1:15:03] the structural budget deficit. [1:15:03] You know maybe have and I put [1:15:08] forward about proposed ballot [1:15:09] measures that would have gone [1:15:09] on the NOVEMBER ballot to [1:15:13] eliminate the structural budget [1:15:14] deficit. [1:15:14] But instead of the debate [1:15:19] giving a written report on why [1:15:19] they think our numbers were [1:15:24] incorrect, all we got was a [1:15:25] verbal thing saying that it [1:15:30] wouldn't make that much money [1:15:31] wouldn't solve the structural [1:15:31] budget deficit. [1:15:35] But instead of using our [1:15:36] numbers of about $140 million [1:15:37] that would have came here that [1:15:37] would have solved all your [1:15:38] problems. [1:15:42] And I just want to I would like [1:15:43] the idea to actually put [1:15:48] something in writing instead of [1:15:49] just have it being verbal. [1:15:50] You know, this was a plan to [1:15:54] eliminate the structural budget [1:15:54] deficit by identifying new [1:15:55] revenue sources. [1:16:00] One good thing is that the city [1:16:00] of Los Angeles in JUNE did [1:16:01] the same thing where they had [1:16:06] know this was part of changing [1:16:07] the municipal code to say [1:16:11] online travel agencies are [1:16:12] considered hotel operators and [1:16:13] that they would have to pay [1:16:15] the full transit occupancy tax [1:16:22] instead of only a portion of it [1:16:22] . [1:16:23] Pretty soon we'll be getting [1:16:23] information from Los Angeles [1:16:24] that will probably show that [1:16:28] they're going to be making so [1:16:28] much more money. [1:16:29] They think that they're only [1:16:33] going to be making an [1:16:33] additional $3 million for [1:16:34] the whole year. [1:16:38] I bet you they will make $3 [1:16:38] million in a couple of weeks [1:16:39] and they're going to be making [1:16:43] so much more money and using [1:16:44] that information you'll see how [1:16:45] much you guys totally lost [1:16:45] the ball on this. [1:16:50] The other thing about this is [1:16:51] the idea and I believe also [1:16:51] the city attorney tried to say [1:16:56] that we needed a two thirds [1:16:57] voter approval because of [1:17:03] the measure c because it's a [1:17:03] special tax. [1:17:04] >> How about you're talking [1:17:04] about concluded that only if [1:17:11] you complete them you not only [1:17:16] rushfield experience advisors [1:17:17] When we talk about principals [1:17:18] it is it is confusing I'm [1:17:22] confused on all the principals [1:17:22] . [1:17:23] I would have changed my what I [1:17:28] was going to say when I had my [1:17:29] two minutes to speak on [1:17:29] the budget If I would have [1:17:30] understood what these proposals [1:17:35] are, what we're going to be on [1:17:36] there, what we're going to be [1:17:36] on there, what was already [1:17:37] decided. [1:17:40] It's very frustrating because [1:17:41] I'm passionate about what I do. [1:17:41] I'm passionate about my family [1:17:42] and what happens to them and [1:17:46] what these decisions that are [1:17:47] made that affect me personally [1:17:47] and the rest of the community [1:17:53] and those principles Are we [1:17:53] going off the air, [1:17:59] the bathrooms being shut down? [1:18:00] Are they mayors, principals? [1:18:04] Are we not having shelter? [1:18:05] We are having shelters. [1:18:05] Are they planning on putting us [1:18:10] on on Break Ranch? [1:18:11] I think there should be [1:18:11] clarity. [1:18:12] There should be What's the word [1:18:16] transparency because it affects [1:18:17] me personally my children [1:18:23] personally and the principles [1:18:24] that I stand by or live by [1:18:28] don't seem to be the same as [1:18:29] anybody else's which is fine. [1:18:35] But the principles that we're [1:18:36] who are beating us in this [1:18:40] administration I don't I don't [1:18:41] think we should be doing [1:18:42] anything that goes along with [1:18:42] those principles. [1:18:47] Thank you. [1:18:48] So I have to say thank you. [1:18:49] And our final speaker lowered [1:18:50] their hand so that does [1:18:51] conclude public comment on this [1:18:57] item. [1:18:58] >> I think it took a second for [1:18:59] that to sink in. [1:19:02] All right. [1:19:03] Thank you, city clerk. [1:19:04] And with that we'll turn it [1:19:04] over to council members for [1:19:09] questions and comments and [1:19:10] entertain a motion And we'll [1:19:10] start with the chair of [1:19:11] the Budget Committee. [1:19:15] >> Councilmember Foster Yes. [1:19:16] Thank you, Council PRESIDENT [1:19:20] And thank you to the aba's [1:19:21] office for the work that goes [1:19:26] into this document. [1:19:27] Thank you for putting in [1:19:28] the information regarding risk [1:19:32] management and having them [1:19:33] included in the conversation. [1:19:33] I think that's an important [1:19:39] department and important fund [1:19:40] as it is you know the backstop [1:19:44] it is the general fund. [1:19:45] And so I think that's something [1:19:46] that is of value as we go [1:19:46] through our budget [1:19:51] deliberations. [1:19:52] Also for transparency just so [1:19:53] that the public can understand [1:19:56] where our dollars are are [1:19:57] going. [1:20:03] Just quickly just listening to [1:20:03] public comment. [1:20:09] Quite frankly, I do have [1:20:09] concerns about this document, [1:20:16] this effort as it is a [1:20:16] resolution. [1:20:17] It is I say an agreement [1:20:20] between the council and mayor [1:20:21] in regards to the simply [1:20:21] communication. [1:20:26] It does not have any true teeth [1:20:27] in regards to when that [1:20:32] agreement is not adhered to, [1:20:33] whether it's the mayor or [1:20:33] the council in regards to that. [1:20:34] But I think the overall [1:20:39] frustration quite honestly [1:20:39] relates to our current system. [1:20:44] And that's the stronger form of [1:20:45] government. [1:20:45] I think you are seeing just [1:20:46] what was put in place, what [1:20:50] those impacts are and what it [1:20:51] means to be in a stronger [1:20:51] system in that authority that [1:20:56] the mayor has now. [1:20:57] And so as we continue to move [1:20:58] forward, that is one thing that [1:21:01] will be on my mind as we [1:21:02] continue to move forward and [1:21:03] that is a discussion of strong [1:21:08] mayor versus city manager form [1:21:08] of government. [1:21:09] So with that I'll begin. [1:21:10] Thank you for the efforts on [1:21:15] this item and I will move [1:21:15] staff's recommendation. [1:21:16] All right. [1:21:16] Thank you sir. [1:21:20] So we have a motion by Council [1:21:20] member Foster to move the staff [1:21:21] recommendation and we go next [1:21:22] to Council PRESIDENT Pro Tem [1:21:26] Lee then council PRESIDENT And [1:21:27] I will start by seconding [1:21:32] the motion and maybe to thank [1:21:32] Council Member Foster for [1:21:33] the additions that he made to [1:21:34] this year's budget principles [1:21:34] In terms of some of [1:21:37] the additional transparency but [1:21:38] also to echo some of his [1:21:39] comments I think these [1:21:39] principles exist and only work [1:21:44] as well as they do based on how [1:21:45] both sides choose to adhere to [1:21:50] it and how we work with each [1:21:50] other. [1:21:51] And I think we have seen in [1:21:51] the last couple of years [1:21:55] the limitations of that as well [1:21:55] . [1:21:56] And so I don't come in [1:21:57] pretending like that's not [1:21:57] the case but look forward to [1:22:02] continuing to try to see how we [1:22:03] can improve our communications [1:22:03] and efforts across the board as [1:22:10] we work towards another what I [1:22:10] think is going to be expected [1:22:11] to be a challenging budget [1:22:11] year. [1:22:12] So thank you Council present. [1:22:14] All right. [1:22:14] Thank you, sir. [1:22:15] So we have a motion by Council [1:22:16] member Foster in a second by [1:22:19] Council PRESIDENT Pro Tem Lee [1:22:20] to move the staff [1:22:20] recommendation. [1:22:21] I don't see anyone else on [1:22:26] the lights or any hands up. [1:22:27] I'll just add my thank you to [1:22:28] Charles and the sergeant on [1:22:31] the team for working on this [1:22:32] year after year. [1:22:32] You know perhaps we're getting [1:22:37] more clarification that this is [1:22:38] a statement of communication [1:22:38] between the mayor and [1:22:43] the council and unnecessary [1:22:44] only translate to what [1:22:45] the public MAY or MAY not need [1:22:49] in understanding the budget [1:22:49] process. [1:22:50] And while some of us think [1:22:51] the budget process is long and [1:22:51] tedious drawn out, it actually [1:22:57] moves pretty fast and it's hard [1:22:57] to wrap your head around a [1:23:00] thousand pages a budget and two [1:23:01] plus 2 billion plus and all [1:23:01] the different components of [1:23:07] what we are as I have I want I [1:23:08] want to really respond to some [1:23:08] of the public comments but that [1:23:13] really is not the item in front [1:23:13] of us. [1:23:14] I see the work continuing KPIs. [1:23:15] I've never been a big fan but [1:23:19] I'll respect those who do see [1:23:24] those as valuable and continue [1:23:25] to make to my commitment with [1:23:26] my amazing staff to make sure [1:23:30] that we'll do everything we can [1:23:30] to dig into the budget, [1:23:31] understand what [1:23:31] the implications are. [1:23:32] But as the budgetary principal [1:23:36] say that when the Council [1:23:37] adopts the budget that it is [1:23:37] the mayor on the operation [1:23:42] sides to carry it out and [1:23:42] sometimes we find out things [1:23:43] that we didn't appreciate or [1:23:48] did not figure out what [1:23:49] the implications were going [1:23:49] forward as we saw happen in [1:23:54] dramatic fashion this month. [1:23:55] I'm glad we were able to even [1:23:55] if it took us six weeks to get [1:23:56] that taken care of. [1:24:00] I think. [1:24:01] Thank you Council member [1:24:02] Campbell for that partnership [1:24:02] so that we can always do [1:24:03] better. [1:24:05] We need to do better and have [1:24:06] Council PRESIDENT Pro Tem Lee [1:24:07] said that we will have another [1:24:12] challenging budget ahead and [1:24:13] I'll throw in a little final [1:24:17] out Temecula sales tax is a [1:24:18] full 1% higher than the city of [1:24:21] San Diego's which would mean [1:24:22] $400 Million if we have [1:24:23] the same sales tax as the city [1:24:29] of Temecula. [1:24:29] Anyway, with that we have a [1:24:30] motion by Councilmember Foster [1:24:31] and a second by Council [1:24:34] PRESIDENT Pro Tem Lee to move [1:24:35] this off Recommendation City [1:24:36] Clerk Please call them I'm [1:24:36] sorry the voters and please [1:24:42] cast your vote. [1:24:43] Council Member Bond Wilford if [1:24:43] I can get your vote for [1:24:44] the record I vote yes And [1:24:51] Council Member Campo Yes and [1:24:52] that passes unanimously 9 to 0. [1:24:52] Thank you Council PRESIDENT All [1:24:53] right. [1:24:53] Thank you. [1:24:57] City Clerk Committee And thank [1:24:58] you to the Office of the aba [1:24:59] for the good work on that item [1:24:59] With that clerk please [1:25:03] introduce item to or what item [1:25:04] to a one is the repeal of [1:25:05] Measure c amending the People's [1:25:05] Ordinance and associated [1:25:08] amendments to the Standing on [1:25:08] this bill code and Local [1:25:09] coastal program. [1:25:10] If you'd like to speak to this [1:25:15] item please be sure to submit a [1:25:15] Speaker's up to the front of [1:25:16] the room or raise your hand by [1:25:17] pressing Star nine the raise [1:25:17] your hand icon I will Now that [1:25:20] the public comment time for [1:25:21] this will be two minutes so [1:25:22] that you can be prepared and [1:25:23] that no organized presentations [1:25:23] were submitted Thank you [1:25:26] Council PRESIDENT All right [1:25:26] thank you. [1:25:27] Realizing this is primarily a [1:25:28] bookkeeping effort but [1:25:31] nevertheless it's an important [1:25:32] work in front of us staff [1:25:33] Introduce yourselves for [1:25:33] the record and let us know how [1:25:37] much time you need for your [1:25:38] presentation Just good [1:25:38] afternoon. [1:25:38] >> Thank you. [1:25:43] Council PRESIDENT My name is [1:25:44] Corey Funk and I am here with [1:25:45] the with that I'm senior [1:25:46] planner with the City Planning [1:25:49] Department. [1:25:49] We request five minutes for [1:25:50] the presentation when you're [1:25:55] ready. [1:25:56] Okay. [1:25:56] Thank you. [1:25:56] Good afternoon. [1:26:01] Members of the city council [1:26:02] again, my name is Corey Funk, [1:26:02] senior planner with City [1:26:03] Planning Department Joining me [1:26:07] today our planning director [1:26:08] Heidi Van Bloom and deputy [1:26:12] director Seth Whitney. [1:26:13] The item before you today is [1:26:14] for the repeal of Measure c [1:26:18] amending a people's ordinance [1:26:18] and associated amendments to [1:26:19] San Diego Municipal Code and [1:26:24] Local Coastal Program on [1:26:31] NOVEMBER seventh, 1972, voters [1:26:31] approved a citizens initiative [1:26:32] that established the coastal [1:26:36] height limit overlay zone. [1:26:37] This initiative is also known [1:26:38] as the People's Ordinance [1:26:42] Number Oh Dash 10960. [1:26:43] The coastal height limit [1:26:43] overlay zone limits the height [1:26:48] of buildings to 30ft for [1:26:49] the area located generally [1:26:53] within city limits And west of [1:26:53] Interstate five on NOVEMBER [1:26:58] 8th, 2022, Measure c was passed [1:26:59] by a majority of the city of [1:27:03] San Diego voters. [1:27:04] The ballot measure amended [1:27:05] the People's Ordinance and [1:27:05] the coastal height limit [1:27:06] overlay zone. [1:27:10] The purpose of the measure was [1:27:11] to exclude the Midway Pacific [1:27:14] Highway Community Plan area [1:27:15] from the 30 foot high limit [1:27:20] Measure c was subsequently [1:27:24] challenged through a lawsuit on [1:27:25] OCTOBER 17th of 2025 [1:27:26] the California Court of Appeals [1:27:31] ruled that the city needed to [1:27:32] complete additional [1:27:32] environmental review to study [1:27:35] the impacts of buildings [1:27:36] exceeding the 30 foot high [1:27:37] limit On MARCH 12th of 2026, [1:27:42] the San Diego Superior Court [1:27:43] issued a writ of mandate [1:27:43] directing the city to set aside [1:27:48] the approvals for Measure c. [1:27:49] This action is intended to [1:27:54] comply with the court's writ of [1:27:54] mandate. [1:27:55] The action requested and would [1:27:56] repeal the ordinance which [1:28:00] submitted Measure c to the city [1:28:01] voters and the associated [1:28:01] amendments to the San Diego [1:28:02] Municipal Code. [1:28:06] There The repeal of Measure c [1:28:07] means that the 30 foot high [1:28:07] limit on buildings in [1:28:08] the coastal high limit overlay [1:28:11] zone remains in effect for [1:28:12] the Midway Pacific Highway [1:28:16] Community Plan Area. [1:28:17] The request of staff is that [1:28:18] City Council adopted ordinance [1:28:23] to repeal ordinance number [1:28:24] o-21508 which submitted Measure [1:28:30] c to city voters and associate [1:28:30] amendments related to [1:28:31] the Coastal Highway overlay [1:28:32] zone in the Midway Pacific [1:28:38] Highway Community Plan Area. [1:28:39] This concludes staff's [1:28:39] presentation. [1:28:40] We are available for questions. [1:28:40] Thank you. [1:28:44] All right. [1:28:45] Thank you for the work on this [1:28:45] bringing it forward and [1:28:46] the presentation with that [1:28:46] clerk. [1:28:50] Please proceed with public [1:28:51] comment on item 201 Thank you [1:28:52] Council PRESIDENT Starting with [1:28:56] Leslie Morgan if you can please [1:28:56] come forward to the microphone [1:28:57] and if I can have the following [1:28:58] individuals in the front row. [1:29:01] Angela better Joyce Senator [1:29:07] Paul Krueger, Lori Saldana and [1:29:08] allegedly Audra those are [1:29:08] speakers here. [1:29:09] Please proceed. [1:29:09] Good afternoon. [1:29:12] I'm Leslie Martin, executive [1:29:13] director of San Diego Fair [1:29:14] Housing Loud, an independent [1:29:18] fair housing research and [1:29:18] advocacy group working to [1:29:19] expand fair housing access and [1:29:20] homeownership opportunity [1:29:23] across San Diego as high as [1:29:24] three source neighborhoods. [1:29:25] i know the council has no [1:29:26] discretion on this item so my [1:29:29] comments are purely for [1:29:29] the record. [1:29:30] In a JULY 15th, 2022 memo your [1:29:35] own planning department wrote [1:29:35] that the coastal height limit [1:29:36] remains as a barrier to [1:29:37] maximizing construction of [1:29:40] homes and residential [1:29:40] developments with restricted [1:29:41] units. [1:29:44] The memo sampled 13 [1:29:44] developments both inside [1:29:48] the overlay zone since 2001 is [1:29:49] only three stories. [1:29:49] Just one has been restricted [1:29:54] homes The Department recorded [1:29:55] that barrier, never asked where [1:29:55] the barrier falls or on whom So [1:29:59] we did in our first report [1:29:59] Coastal Opportunity and Housing [1:30:04] Access in San Diego which [1:30:05] publishes tomorrow. [1:30:06] The city has had it since [1:30:06] Friday If you doubt I you [1:30:10] personally inside the coastal [1:30:10] height limit 80% of census [1:30:11] tracts are higher highest [1:30:15] resource areas versus 54% [1:30:16] citywide In the current housing [1:30:20] cycle the overlay has only [1:30:20] permitted 32.5 homes per [1:30:21] thousand existing versus [1:30:26] citywide 62% homes affordable [1:30:29] below the original median two [1:30:30] per thousand against 11 for [1:30:30] the city. [1:30:35] So that's half the citywide [1:30:36] rate on housing of every kind [1:30:36] and a fifth the citywide rate [1:30:40] on affordable. [1:30:40] Today a staff report concedes [1:30:41] that this means less [1:30:45] development It contains no [1:30:46] federal housing analysis. [1:30:47] A cap on building is not in [1:30:50] neutral as static rule on [1:30:51] the most valuable land in [1:30:51] the city decides who gets to [1:30:52] live there. [1:30:54] Thank you very much. [1:30:59] Thank you Angela Better. [1:31:00] Hello When you repealed Measure [1:31:04] c today as the court has [1:31:05] ordered don't turn around and [1:31:10] use the state density bonus law [1:31:11] as a backdoor to accomplish [1:31:15] the same thing Allowing midway [1:31:15] rising to exceed 30 foot height [1:31:16] limit. [1:31:19] Now we have sb 958 and sb 344 [1:31:20] coming out of Sacramento [1:31:24] creating yet another backdoor [1:31:24] around the environmental [1:31:25] review. [1:31:29] This massive project is I'm [1:31:30] really going to ask you to [1:31:30] speak on Measure c There's [1:31:33] plenty of opportunity to speak [1:31:34] on that item but I know what [1:31:39] you're saying. [1:31:40] I understand it. [1:31:41] I fully respect it and I would [1:31:41] hope that it knowledge in a [1:31:43] public comment you come and [1:31:44] make that powerful statement [1:31:45] but talk about whether or not [1:31:48] we should repeal Measure c [1:31:51] Thank you for that choice And [1:32:00] yet if I'll try this one you [1:32:04] notice I have no comments in my [1:32:05] hand so I'm going to wing it on [1:32:05] this one. [1:32:09] I'll start with this is this [1:32:14] little illegal voice or is this [1:32:18] the voice of the people winning [1:32:23] on this one And council member [1:32:24] DR. Campbell I really support [1:32:29] your position on this totally [1:32:29] and I'm looking forward to [1:32:33] hearing you speak. [1:32:38] I think that we can go [1:32:39] overboard on the environmental [1:32:43] concerns and if you get me [1:32:47] started on density you probably [1:32:48] won't like me a lot of you [1:32:52] because I love density Joy I [1:32:53] have to be fair to everyone and [1:32:58] we all do love you But speak to [1:32:58] the whether we should rescind [1:32:59] Measure c or not. [1:33:02] You start talking about density [1:33:03] and you love density. [1:33:04] This is just a question of [1:33:07] whether we should repeal [1:33:08] the measure c which is a court [1:33:12] order back on and I'll try [1:33:12] again. [1:33:16] Okay So I did look at you know [1:33:21] glance at this very quickly So [1:33:22] all I can say is that it seems [1:33:26] like a legal thing that we're [1:33:26] following that all we're doing [1:33:31] is following the legal decision [1:33:31] that was made in the court that [1:33:36] we can't implement in Measure c [1:33:41] as it was chosen by correct [1:33:41] majority of the people. [1:33:45] And that sort of shocks me and [1:33:46] I don't really understand how [1:33:51] these things can end up this [1:33:51] way. [1:33:56] So I appreciate sorry about [1:33:56] that PRESIDENT LaCava And I [1:33:57] really do appreciate when you [1:34:01] take that stance on it not just [1:34:02] for me but for everyone that I [1:34:06] think that's the right way to [1:34:06] go. [1:34:07] Thank you. [1:34:10] So I'll just say that I'm going [1:34:11] to look forward to listening to [1:34:16] council member DR. Campbell [1:34:16] This is her Council District [1:34:20] two item and I'll I'll go from [1:34:21] there. [1:34:25] So thank you and love to all [1:34:26] Thank you Paul Krueger And I [1:34:26] understand you have a [1:34:31] presentation or images to share [1:34:32] so staff will get those up for [1:34:39] you. [1:34:40] >> So I don't know where [1:34:40] the music is coming because [1:34:42] it's your walk up songs. [1:34:43] >> I do appreciate that you [1:34:44] bring a little levity in [1:34:47] the chamber. [1:34:47] There's another video coming in [1:34:48] every time we share for some [1:34:49] reason the audio sharing or [1:34:53] that other video that's prepped [1:34:53] but it's a nice walk up song. [1:34:54] Please proceed. [1:34:57] Can you zoom in on that a [1:35:01] little bit to the circled area [1:35:02] if possible? [1:35:02] If not all I'll just explain. [1:35:03] If not we'll print and share [1:35:09] with the council as well. [1:35:10] Back when you decided to appeal [1:35:12] this measure is to the Supreme [1:35:12] Court. [1:35:13] Two of you voted against it. [1:35:14] Raul Campo explained that he [1:35:17] didn't think that your appeal [1:35:18] would be successful and [1:35:22] COUNCILWOMAN Moreno declined to [1:35:22] offer to explain why she voted [1:35:23] against it. [1:35:26] But there's the bill from [1:35:30] Everett Delano $446,000 he was [1:35:31] awarded by he hasn't been [1:35:32] awarded by the court. [1:35:35] He submitted his fees and costs [1:35:39] recently for his work on [1:35:45] overturning Measure c. [1:35:49] I'd like to say that I don't [1:35:50] keep chipping away at [1:35:54] Proposition d with issues like [1:35:55] Measure c If you and your [1:35:56] colleagues in the building [1:35:59] industry and the labor unions [1:36:04] don't like Proposition d, put [1:36:04] it on the ballot, give [1:36:08] the voters a chance to agree or [1:36:13] disagree with your position [1:36:14] that many of you have That [1:36:15] measure d should be voided and [1:36:18] that we should be approving [1:36:23] items like Measure c do not [1:36:23] take a piecemeal approach to [1:36:25] this issue as you did with [1:36:30] Measure c Most importantly what [1:36:36] you did with Measure c was you [1:36:36] put before voters an incomplete [1:36:40] analysis by any means by a [1:36:41] unanimous Supreme Court [1:36:45] decision that by any means of [1:36:46] interpretation deprived voters [1:36:50] of the information that they [1:36:50] needed to know to make a [1:36:54] decision on measure c And you [1:36:55] did it twice not you the city [1:36:59] It wasn't I don't know [1:37:00] the extent to which the council [1:37:00] approved a supplemental each [1:37:04] year but you did have a chance [1:37:05] to take a position as Raul and [1:37:08] Vivian did when it came before [1:37:09] you to take it to the Supreme [1:37:10] Court and you decided to do it [1:37:10] anyway. [1:37:12] Thank you for that Concluding [1:37:12] comment. [1:37:22] >> Lori Saldana So to continue [1:37:23] on what was just said I agree [1:37:23] that this was and I probably [1:37:28] submitted the wrong slip I [1:37:29] should have supported repealing [1:37:32] c but not for simply reasons of [1:37:33] height but also because frankly [1:37:36] local coastal program will [1:37:37] needs to recognize that rising [1:37:41] sea level is causing inundation [1:37:42] in this area. [1:37:43] So if you were going to be [1:37:46] honest with a consideration [1:37:47] with an environmental impact [1:37:49] report about building in [1:37:54] the Midway area, I don't think [1:37:59] you hit the mark on this And [1:38:00] the hazards are many. [1:38:00] This this area is not just a [1:38:04] matter of building too high. [1:38:05] It's a matter of having [1:38:08] liquefaction underneath it and [1:38:13] having an unsteady ground to [1:38:13] build anything upon. [1:38:14] So I'm sorry you repealing this [1:38:17] at a time when there are bills [1:38:18] going through the legislature [1:38:19] and I know I'll be interrupted [1:38:22] about that once again but it [1:38:23] you're an engineer you know [1:38:23] things are connected. [1:38:24] You can't have one without [1:38:27] the other And we can't have a [1:38:28] repeal at the local level if [1:38:31] there's push to approve and [1:38:32] remove the height [1:38:32] considerations at the state [1:38:33] level. [1:38:36] So when this comes before MR. [1:38:37] Lee's committee in just a few [1:38:41] weeks there's going to be a [1:38:42] major contradiction. [1:38:42] The council is repealed on [1:38:43] the height but now the state is [1:38:46] working on saying the height [1:38:47] shouldn't be considered. [1:38:51] So you're you're setting [1:38:51] yourself into quite a quandary [1:38:52] here And I don't know how [1:38:56] you're going to figure this out [1:38:56] . [1:38:57] But what I do know if you go on [1:38:58] to another image I've lost [1:39:01] track of which images I've [1:39:02] submitted here This is already [1:39:02] happening in our coastal areas [1:39:06] The sea level does not respond [1:39:06] to legislation. [1:39:07] So MR. Lee, when you look at [1:39:11] this housing and land use, [1:39:12] consider water use also because [1:39:16] that is really what is at stake [1:39:16] if you're going to build [1:39:21] anything in these coastal areas [1:39:21] . [1:39:21] >> Thank you. [1:39:22] Allegedly order you were doing [1:39:26] so well you really nailed [1:39:26] the testimony for repealing [1:39:27] Measure c until right at [1:39:32] the end. [1:39:33] Obviously this is circumventing [1:39:34] the will of the people because [1:39:38] the people voted to have this [1:39:39] be in place And it doesn't [1:39:39] matter if a judge rules a [1:39:43] certain way, it can still be [1:39:43] illegal and it can still be [1:39:44] something that you guys push [1:39:47] back against because moving [1:39:48] forward with this would be [1:39:48] extremely negligent. [1:39:52] There is a lot of issues that [1:39:56] are not being addressed and no [1:39:57] offense to other speakers but [1:40:01] it's not that sea level is [1:40:01] rising. [1:40:02] It's going back to where it was [1:40:06] at one time because California [1:40:06] used to be an island [1:40:07] technically and the water has [1:40:11] been, you know, dammed up in [1:40:12] different things And so it's [1:40:13] just coming up to where it had [1:40:16] been prior to all of that. [1:40:17] And so to build on those types [1:40:17] of things and have the height [1:40:21] levels that are going to be [1:40:22] extremely high and potentially [1:40:26] I mean these things are going [1:40:26] to be blocking even just [1:40:27] the beach for some people but [1:40:31] it's dangerous to build on [1:40:32] marshlands like that when [1:40:32] people claim that they are [1:40:36] going to be able to, you know, [1:40:37] deal with the weight of it so [1:40:37] it wouldn't sink in. [1:40:38] But I don't think that that's [1:40:38] really true. [1:40:40] I believe that these unions [1:40:41] want the jobs and so they want [1:40:45] to go in and build but and [1:40:46] they're doing what their part [1:40:46] is. [1:40:47] But these engineers even though [1:40:50] they're saying they're going to [1:40:50] be putting posts down, it is [1:40:51] still putting the potential [1:40:55] danger of it being in like [1:40:55] with quicksand. [1:40:56] And so it's more of a public [1:41:00] safety issue as opposed to [1:41:01] anything else When you guys are [1:41:04] doing stuff like this And I [1:41:05] understand people want jobs and [1:41:06] you guys want housing but you [1:41:09] shouldn't be putting people in [1:41:10] danger just to do it and [1:41:10] repealing things that [1:41:14] the people voted for. [1:41:15] You say you represent [1:41:15] the people so if you're going [1:41:19] to repeal this then obviously [1:41:20] you don't because you're going [1:41:20] against what the will of [1:41:24] the people was So I mean you [1:41:25] guys need to really think about [1:41:26] that If you if you claim to [1:41:28] represent us then put your [1:41:29] money where your mouth is and [1:41:30] not just doing something [1:41:34] because it's going to benefit [1:41:34] construction. [1:41:35] >> Thank you. [1:41:35] That concludes your time. [1:41:36] I'm sorry The five minute timer [1:41:38] going to those participated [1:41:39] remotely. [1:41:39] Katherine Rhodes if you can [1:41:42] please unmute you'll have two [1:41:43] minutes. [1:41:43] >> Wonderful. [1:41:47] This is Katherine Rhodes and as [1:41:48] most of you know I'm a civil [1:41:48] engineer. [1:41:51] I have problems regarding [1:41:56] Midway Rising and the midway [1:41:57] area due to my concerns [1:42:01] regarding liquefaction, [1:42:02] regarding groundwater [1:42:03] intrusion, regarding the king [1:42:07] tides for waters actually and [1:42:08] sea level rise often we've [1:42:09] already talked about that this [1:42:12] is just a measure of c and [1:42:13] whether we should repeal it or [1:42:14] not write my agenda will give [1:42:17] you an opportunity to speak on [1:42:17] it. [1:42:18] I gave people a little bit of [1:42:21] leeway but let's just focus on [1:42:26] Measure c and not on [1:42:27] liquefaction or the ground [1:42:27] conditions. [1:42:28] Should we should we repeal [1:42:31] measure c or not? [1:42:32] >> Oh I'm talking about [1:42:35] the reason why you have to [1:42:36] repeal Measure c is regarding [1:42:40] decision by the judge that told [1:42:41] you that you guys did not [1:42:45] analyze a whole bunch of [1:42:46] things. [1:42:50] >> One of the things that you [1:42:51] you know the only thing that [1:42:52] San Diego has regarding sea [1:42:55] level rise is porous pavement [1:42:56] That is your mitigation force [1:43:00] for sea level rise that that is [1:43:03] incomplete. [1:43:09] Yes, of course you should This [1:43:09] should go forward. [1:43:10] It has to go forward. [1:43:13] It's a law. [1:43:14] It shouldn't have gone forward [1:43:18] in the first place because one [1:43:18] of the great things that [1:43:19] the Port of San Diego used to [1:43:23] have in their master plan is [1:43:24] that there had to be two levels [1:43:27] of underground parking or [1:43:28] basement under every project in [1:43:32] areas of let's look with viable [1:43:33] soils and a great example of [1:43:37] what to do in this area is [1:43:38] the Navy Broadway complex or [1:43:42] Manchester's Pacific Gateway. [1:43:43] Another great example that that [1:43:46] is used in San Diego is [1:43:47] the County Administration [1:43:52] Center building that has two [1:43:52] levels of underground also [1:43:53] where what you do is you [1:43:56] actually get rid of [1:43:56] the liquefaction. [1:43:57] You guys don't even have any [1:44:01] type of engineering standards. [1:44:02] So yes, this is good to get rid [1:44:03] of but you also have to have [1:44:06] basic engineering Standard and [1:44:07] Poor's pavement is not you know [1:44:11] does not cut it. [1:44:12] So you guys have a lot of work [1:44:12] to do. [1:44:16] Your time has concluded Just [1:44:17] did anybody think it odd that I [1:44:17] looked at the screen when I was [1:44:18] talking to MISS Rhodes She's [1:44:21] not up there. [1:44:22] Jeff Tutor if you can please [1:44:30] unmute Yeah, Thank you Counsel [1:44:30] You know obviously we just want [1:44:35] to be clear that the reason [1:44:36] we're repealing probably a [1:44:40] major c and restoring the high [1:44:41] limit is so we can exceed it by [1:44:44] other means which is either [1:44:45] going to happen to [1:44:49] the legislature or you know by [1:44:50] state law I just you know we [1:44:55] just need to be up front. [1:44:55] The goal here isn't really to [1:44:58] protect the height limit. [1:44:59] >> It's really to protect this [1:45:00] Midway Rising project. [1:45:03] Thank you. [1:45:03] >> Next is Blaire Beekman if [1:45:04] you can please. [1:45:08] And you. [1:45:08] All right. [1:45:09] Thank you. [1:45:09] We're Beekman to weigh in on [1:45:13] the measure c issue and its [1:45:13] judgment I'm assuming from [1:45:18] Katherine's words words that [1:45:19] the judge he had many items [1:45:22] that he was addressing and why [1:45:23] he he made the decision that he [1:45:26] did possibly very much included [1:45:27] in that is the idea of sea [1:45:28] level rise issues that I think [1:45:32] has to be a part of the future [1:45:33] of this conversation and that [1:45:33] you guys are working on it on [1:45:37] the state level you have a [1:45:37] vested interest to not talk [1:45:38] about sea level rise issue and [1:45:42] I hope that and when this item [1:45:42] comes up at council person [1:45:46] leave meeting in the future [1:45:47] that we can be allowed to have [1:45:47] a more open conversation. [1:45:50] I feel our current PRESIDENT Is [1:45:51] is being a little too narrow in [1:45:52] his definitions how we can talk [1:45:55] about this issue. [1:45:56] There is sea level rise that we [1:45:56] have to be able to talk about [1:46:00] more openly and clearly for [1:46:01] the future of this area. [1:46:01] It's an important conversation. [1:46:05] It needs to be open and not [1:46:06] just for this item but for our [1:46:07] environmental future of San [1:46:09] Diego how we address our issue [1:46:10] as well. [1:46:11] So good luck how we work on [1:46:11] this issue together. [1:46:11] Thank you. [1:46:14] An open Thank you John If you [1:46:24] can please unmute and and John [1:46:25] Brady lives experience advisors [1:46:28] I am calling in because I think [1:46:29] that the intent of this measure [1:46:29] was to remove the height limit [1:46:33] in areas that were not [1:46:33] necessarily beach adjacent and [1:46:38] and completely made sense as to [1:46:39] the legal I can't address but I [1:46:43] think the intent was you know [1:46:47] this is clearly not a near [1:46:48] beach area even though it's [1:46:48] near marshland. [1:46:52] I really struggle with the fact [1:46:53] that we would not be able to [1:46:54] build in what is clearly semi [1:46:57] industrial area. [1:46:58] So I would vote against [1:47:05] repealing Measure c thank you [1:47:06] next 27499 if you can please [1:47:11] unmute. [1:47:16] Bob Kozinski here. [1:47:17] I just want to express my [1:47:17] disgust of Joe LaCava [1:47:20] demonstrating his disregard for [1:47:21] the public by repeatedly [1:47:21] cutting people off. [1:47:22] >> Thank you. [1:47:25] Coming No Vega If you can [1:47:29] please unmute regarding [1:47:30] the Vega district eight I [1:47:34] didn't do as much research [1:47:34] necessarily on this but I did [1:47:38] want to just point out that [1:47:38] something that someone said in [1:47:39] person that just because [1:47:40] something is legal doesn't mean [1:47:43] it's right but definitely [1:47:48] trying to consider who is going [1:47:48] to be most affected by this [1:47:53] based on the areas where Well [1:47:58] will this will affect Thank [1:47:58] you. [1:47:59] >> Thank you Then Amanda, if [1:48:02] you can please unmute. [1:48:07] >> Hi, Good afternoon City [1:48:07] Council. [1:48:08] >> Welcome back. [1:48:12] And so I take a few minutes [1:48:13] this morning to look through [1:48:17] ruling from the Superior Court [1:48:17] because I really wasn't [1:48:18] familiar with the whole court [1:48:22] process about Measure c And so [1:48:26] from what I understand is that [1:48:27] you guys put a dangerous [1:48:32] measure on for up for a vote [1:48:36] without considering [1:48:37] the important environmental [1:48:37] impacts. [1:48:38] I'm going to read from [1:48:41] the court ruling We will [1:48:41] reverse an agency's [1:48:42] determination regarding school [1:48:46] compliance only where there was [1:48:46] a prejudicial abuse of [1:48:50] discretion applying [1:48:51] the environmental impact [1:48:51] reports at ground water levels [1:48:55] which are expected to be near [1:48:56] sea level throughout most of [1:48:57] the Midway Pacific Highway area [1:49:00] can result in response to [1:49:01] changes in precipitation and [1:49:01] runoff. [1:49:05] As a result, the environment [1:49:06] Impact report recognized most [1:49:07] of the Midway Pacific Highway [1:49:10] area has a high potential for [1:49:11] liquefaction because the area [1:49:16] has shallow groundwater or [1:49:16] major drain drainages and [1:49:20] hydraulic spills. [1:49:21] I'm really disappointed that [1:49:22] and again I know we need more [1:49:25] housing. [1:49:26] We need more affordable [1:49:26] housing. [1:49:27] We don't need any more luxury [1:49:27] housing. [1:49:30] We have quite enough of that. [1:49:31] But I just wanted to say that [1:49:31] I'm really disappointed that [1:49:34] this ever got put up for a vote [1:49:35] and that you guys were [1:49:36] practicing prejudicial [1:49:40] prejudicial abuse of discretion [1:49:40] and lying to the voters. [1:49:41] That's all. [1:49:44] Thanks. [1:49:44] Thank you. [1:49:45] That does conclude public [1:49:46] comment on this item. [1:49:49] All right. [1:49:49] >> Thank you city Clerk And [1:49:54] thank you to the comments. [1:49:54] If anyone is curious about my [1:49:56] feelings about the course I'll [1:50:01] limit and Sacramento's [1:50:05] intrusion on local land use [1:50:05] authority. [1:50:06] I think I've been pretty [1:50:10] eloquent on that But there's [1:50:11] also going to be an opportunity [1:50:11] to speak on some of the issues [1:50:15] that I think is pent up in this [1:50:16] chambers on non agenda public [1:50:17] comment and of course on [1:50:20] project specific opportunities [1:50:20] . [1:50:21] So I look forward to hearing [1:50:25] from you And with that we'll [1:50:25] turn over to the Council for [1:50:26] questions comments entertain a [1:50:30] motion and we'll start out with [1:50:30] the council member representing [1:50:31] District two which is where [1:50:31] Midway is located. [1:50:34] Council member Kim Thank you. [1:50:39] >> Council PRESIDENT Thank you [1:50:39] guys for the presentation. [1:50:40] I think we're all a little bit [1:50:44] sad those of us who are [1:50:44] interested in making [1:50:47] the biggest housing development [1:50:48] in one place that the state has [1:50:52] seen including half the living [1:50:53] arrangements being affordable. [1:50:56] However, the court has ruled [1:50:57] and we have exhausted all legal [1:51:02] appeals Our case was not taken [1:51:02] by the Supreme Court and so [1:51:03] we're stuck with what [1:51:07] the superior Court ruled and we [1:51:07] must abide by the court's writ [1:51:12] of mandate because we believe [1:51:12] in following the law and [1:51:16] because of the writ of mandate [1:51:17] which says we must remove this [1:51:17] language from the municipal [1:51:22] code by amending Measure c with [1:51:22] this amendment the only effect [1:51:26] our Midwood District we must do [1:51:27] it and if we don't we will be [1:51:31] in contempt of court. [1:51:32] And when we're in contempt of [1:51:33] court we open the city to [1:51:36] tremendous numbers of fines [1:51:37] which we can ill afford and [1:51:41] besides which is good citizens [1:51:42] who even disagree with [1:51:42] the court. [1:51:47] We still think that we must [1:51:47] follow the court's orders [1:51:48] because that is the law And so [1:51:51] therefore I move the staff [1:51:52] recommendation to do so as [1:51:56] ordered by the court and I so [1:51:57] move. [1:51:57] >> Thank you. [1:51:58] Council PRESIDENT All right. [1:51:58] Thank you Council members. [1:52:01] So we have a motion by Council [1:52:02] member Campbell to move [1:52:02] the staff recommendation [1:52:05] Nothing He went on the lights. [1:52:06] I'm happy to second that motion [1:52:08] again not see anybody else in [1:52:13] the lights call a vote. [1:52:14] We have a motion by council [1:52:15] member Campbell and the second [1:52:18] by myself I started the voting [1:52:19] system Council member Von [1:52:23] Wilber Please register your [1:52:24] vote orally I vote yes. [1:52:27] >> Council member can you [1:52:28] please register your vote [1:52:28] early? [1:52:32] Yes. [1:52:33] And that passes unanimously. [1:52:42] All right. [1:52:43] >> Yeah. [1:52:44] Thank you for out for this [1:52:47] bookkeeping item. [1:52:48] I appreciate the work. [1:52:48] So with that we will now take [1:52:53] up non agenda public comment. [1:52:53] This is the opportunity to go [1:52:54] big on whatever you want within [1:52:57] the city's purview. [1:52:58] Council members respect and [1:52:58] appreciate the public input and [1:52:59] are fully committed to [1:53:02] protecting every participant's [1:53:03] free speech rights at council [1:53:04] and committee meetings. [1:53:07] Clerk Please proceed with non [1:53:08] agenda Public Comment Thank you [1:53:13] Council PRESIDENT Pearl 2.7 Non [1:53:13] Agenda Public comment is an [1:53:14] opportunity for members of [1:53:15] the public to comment items [1:53:17] that are not on the agenda but [1:53:18] within the subject matter [1:53:18] jurisdiction of the City [1:53:19] Council As the Council [1:53:22] PRESIDENT Just noted each each [1:53:23] public member will have two [1:53:26] minutes to speak. [1:53:27] If there are eight or more [1:53:28] speakers on a single topic [1:53:28] the maximum time for the topic [1:53:30] will be 16 minutes. [1:53:31] If you are in chambers please [1:53:31] submit your speaker slip. [1:53:32] If you're joining us virtually [1:53:35] please raise your hand to speak [1:53:36] by tapping the raise your hand [1:53:37] icon or if you're a call [1:53:39] participant The Star nine We're [1:53:40] starting with those here in [1:53:44] chambers starting with Jeff [1:53:45] Bartlett. [1:53:45] Please come up to [1:53:46] the microphone. [1:53:51] After that we'll have Charlene [1:53:52] Antonio, Antonino Alto, Lino, [1:53:55] Lori Saldana, Joyce Kenyatta [1:53:56] and Irene Ramirez. [1:54:00] Please proceed. [1:54:01] >> All righty. [1:54:01] All right. [1:54:02] My name is Jeff Bartlett. [1:54:05] i reside down in Tijuana. [1:54:06] I do commute across the border [1:54:07] to work security out here in [1:54:11] downtown San Diego. [1:54:12] I'm in a leadership supervisor [1:54:12] position out here and I'm going [1:54:17] to address some concerns I have [1:54:17] about how sd pd responds. [1:54:22] I mean we have the lack of [1:54:23] community policing out here [1:54:27] long sd pd response times I can [1:54:28] go an entire shift without them [1:54:29] showing up and dispatchers can [1:54:33] get kind of unprofessional at [1:54:33] times. [1:54:34] I don't like how the city [1:54:38] police will send the entire [1:54:39] squad out to arrest like one [1:54:39] unarmed person but then they [1:54:40] don't show up when I call them [1:54:44] in for something in other [1:54:45] states sometimes you might only [1:54:45] need 1 or 2 officers to arrest [1:54:49] someone. [1:54:50] Also I think we need a better [1:54:51] system to report crimes instead [1:54:56] of your online system to report [1:54:56] crimes because that's limited. [1:55:01] So if you don't know the person [1:55:02] I think San Diego clean and [1:55:02] safe has a system where you [1:55:03] know you can take a picture and [1:55:07] report things maybe the city [1:55:08] police should adopt something [1:55:08] like that. [1:55:13] But I running low on time here [1:55:14] But I do want to point a few [1:55:14] things. [1:55:15] I think we need some dui [1:55:18] checkpoints on Fourth Avenue [1:55:19] where Gaslamp Quarter is [1:55:20] especially near large parking [1:55:25] garages. [1:55:26] I think we need to crack down [1:55:26] on the drugs in the city. [1:55:31] I mean trolley stops like Fifth [1:55:32] Avenue and 12 in Imperial even [1:55:37] here at Civic Center you have [1:55:37] people hanging out using drugs [1:55:38] near the trolleys. [1:55:42] i think the city needs to crack [1:55:43] down on the drugs in this city [1:55:44] and we need to also find [1:55:49] resources to assist and help [1:55:50] our homeless people so they're [1:55:51] not getting arrested and then [1:55:54] coming back out on the streets [1:55:55] ,find ways to rehabilitate [1:55:56] them And I am running low on [1:55:56] time So thank you for [1:55:59] the opportunity to speak. [1:56:00] Thank you. [1:56:06] Next is Charlie. [1:56:07] Good afternoon. [1:56:12] My name is Charlene El and I am [1:56:13] here on behalf of the San Diego [1:56:14] Committee on Employment of [1:56:14] People with Disabilities. [1:56:18] I am the chair and ceo. [1:56:19] Each OCTOBER our committee [1:56:19] hosted OCTOBER 1st one of [1:56:20] the largest disability focused [1:56:25] job bears in California serving [1:56:29] up to 1500 job seekers annually [1:56:30] For the past 27 years this [1:56:31] event has connected individuals [1:56:31] with disabilities to employment [1:56:36] opportunities and economic [1:56:36] independence which remains [1:56:37] especially important giving [1:56:41] the disproportionate high [1:56:42] unemployment rate with [1:56:42] the disability community. [1:56:43] For the last 20 years we have [1:56:48] been honored to hold you [1:56:49] OCTOBER 1st at the Balboa Park [1:56:50] Club and we are deeply grateful [1:56:54] to the City of San Diego for [1:56:54] its longstanding partnership [1:56:55] and generosity in providing [1:56:55] this venue. [1:56:56] While we sincerely appreciate [1:56:59] the city support, we [1:57:00] respectfully ask the Council to [1:57:01] consider the intended impact [1:57:06] that recently implemented [1:57:06] parking fees in Balboa Park MAY [1:57:07] have on attendance this event [1:57:11] this year Many city residents [1:57:12] with disabilities MAY not have [1:57:16] had an opportunity or ability [1:57:17] to register in advance for [1:57:18] the resident parking waiver [1:57:18] program. [1:57:19] I can also share that we have [1:57:23] received reports from community [1:57:24] members that the parking waiver [1:57:24] registration process can be [1:57:29] difficult to navigate even with [1:57:29] eligible city residents [1:57:30] Challenges with obtaining [1:57:30] information completing [1:57:35] the process and sharing [1:57:36] the waiver registration process [1:57:37] can be difficult to navigate. [1:57:37] So I see I'm running out of [1:57:42] time and we have contacted city [1:57:42] council members. [1:57:43] We have contacted the mayor's [1:57:49] office and this is going to be [1:57:49] a challenge in OCTOBER on [1:57:50] the seventh for people with [1:57:50] disabilities. [1:57:54] So we have typically 75 [1:57:58] employers, 60 volunteers and [1:57:59] upwards of 1500 job seekers And [1:58:00] again most of our job seekers [1:58:00] don't have physical [1:58:05] disabilities but mental and [1:58:05] intellectual disabilities which [1:58:06] will affect them with [1:58:10] the parking. [1:58:11] Larry Saldana If you can please [1:58:12] come forward I understand you [1:58:17] have some materials to share. [1:58:17] Thank you. [1:58:18] So now I think we can [1:58:22] unencumbered discuss [1:58:22] the challenge of sea level rise [1:58:23] in our coastal areas and in [1:58:29] particular one that is being [1:58:29] scheduled or being discussed as [1:58:35] dense high housing. [1:58:36] If that does come before a [1:58:37] council committee I hope that [1:58:37] you can go to the next slide [1:58:40] please. [1:58:41] You will take into account what [1:58:42] other cities are doing to [1:58:47] combat the tide That is [1:58:47] overwhelming our infrastructure [1:58:48] as we speak. [1:58:48] This is not a future [1:58:52] consideration and this is only [1:58:53] the words that we see on [1:58:54] the surface What is happening [1:58:54] below ground is even more [1:58:58] troubling and more challenging [1:58:59] when it comes to adding housing [1:58:59] to the coastal areas. [1:59:00] The Storm Stormwater Department [1:59:05] is aware of this. [1:59:05] They have gone out and welded [1:59:06] the storm water covered sheet [1:59:07] and the pressure of [1:59:10] the incoming tide is still [1:59:11] getting out because the sea [1:59:11] level rise is exceeding [1:59:17] the height of the storm water [1:59:17] system. [1:59:18] And I know you're getting a [1:59:19] report on that very soon as we [1:59:22] go on to the next images. [1:59:22] Saltwater is extremely [1:59:23] corrosive. [1:59:29] It is destroying you can see [1:59:29] the really rough surface of [1:59:30] the streets. [1:59:30] This is the end of Mission [1:59:34] Boulevard And again, this is [1:59:35] only what you see on [1:59:35] the surface. [1:59:36] What's going on below surface [1:59:40] is in the case of Mission Beach [1:59:40] their sewage and wastewater [1:59:41] system is at serious repair or [1:59:46] needs serious repairs. [1:59:46] Next slide please. [1:59:47] And just for standing water it [1:59:47] gets quite deep. [1:59:52] Next slide. [1:59:53] And I guess I. [1:59:54] I submitted several things I [1:59:58] don't recall exactly which ones [1:59:58] but I am repeating this because [1:59:59] I don't think that it is being [2:00:00] taken seriously enough. [2:00:04] I realize you were preparing [2:00:05] for El Nino. [2:00:05] You were talking about storm [2:00:06] water. [2:00:06] This is not storm water. [2:00:10] This is simply high water in [2:00:11] the ground that is going to [2:00:12] continue to rise with the sea [2:00:12] level. [2:00:17] We need to learn from Rotterdam [2:00:17] and other coastal cities and I [2:00:18] will continue to come back and [2:00:21] introduce that in the future. [2:00:21] >> Thank you. [2:00:22] Thank you, Joyce. [2:00:27] Again, it first of all I [2:00:34] support San Diego Police [2:00:34] Department's work to keep our [2:00:35] people safe and the results are [2:00:39] in. [2:00:40] Crime continues to decrease and [2:00:46] keep our beautiful city at [2:00:47] the top of the list as one of [2:00:47] the safest cities. [2:00:52] Dear Public I'm sure some of [2:00:53] you have read this past [2:00:58] Monday's usa Today front page [2:01:04] article on flock safety. [2:01:05] After reading it I spent about [2:01:05] two hours Googling information [2:01:09] on Flock safety With the large [2:01:10] outpouring of public concern [2:01:16] about the use of this [2:01:17] technology like safety has made [2:01:22] the necessary changes to help [2:01:22] people feel more comfortable [2:01:23] and safe as as the people move [2:01:28] around living their lives. [2:01:29] Our whole nation is affected by [2:01:34] these changes and the federal [2:01:35] government has stated it will [2:01:35] come forward soon with its [2:01:40] position on the use of this [2:01:41] surveillance technology. [2:01:42] A big thank you to Keith Wall [2:01:46] and all others for the JULY [2:01:47] 27th excuse me JULY 22nd public [2:01:52] meeting on this matter and for [2:01:53] public input Also online until [2:01:58] JANUARY till JULY 29th. [2:01:59] Again I support sd pd and their [2:02:04] use of this technology. [2:02:05] Our trust ordinance is working [2:02:06] and with a robust conversation [2:02:11] on this important matter. [2:02:12] Dear Public Trust Trust will [2:02:18] win. [2:02:18] One people One family one San [2:02:19] Diego. [2:02:20] Love to all this Been a great [2:02:24] day. [2:02:24] >> Welcome back, everybody. [2:02:25] Thank you. [2:02:31] Irene Ramirez is a second [2:02:31] assistant here on location and [2:02:38] that is Cortez. [2:02:39] We're impressed about [2:02:39] the timing of those those [2:02:41] comments. [2:02:49] We know and what they will [2:02:50] because they are key. [2:02:50] They can be read into your [2:02:52] table. [2:02:53] The reason that I'm here is a [2:02:54] little bit different than what [2:03:01] I thought. [2:03:01] Meramec have portion this year [2:03:02] an opportunity though they have [2:03:04] a lot of they looking for [2:03:05] things. [2:03:05] But I stayed because I was told [2:03:06] I have the opportunity to speak [2:03:13] about what is before what I [2:03:14] want to speak about. [2:03:14] If any the problem of up [2:03:18] tomorrow I will lay low. [2:03:19] I've been having several [2:03:19] problems with my invoices for [2:03:23] my water bill. [2:03:23] They are what I'm doing. [2:03:30] And with the doubling of water [2:03:30] as well. [2:03:31] Okay. [2:03:36] And I will not let them go. [2:03:36] They'll be 23. [2:03:37] The other thing we want to do [2:03:40] the meals budget. [2:03:41] The first one is with [2:03:42] the property that I have that's [2:03:45] a duplex that I received in [2:03:46] 2023 an invoice for $1,068 or [2:03:52] lengthy phase that will help [2:03:56] them for their metering take [2:03:57] courtroom. [2:03:57] And then last month I received [2:04:03] another invoice for the same [2:04:04] property for 1034 and can [2:04:07] always ask for us and can send [2:04:13] me that. [2:04:13] I don't see the reason of why [2:04:14] these two different invoices [2:04:15] give us losses on them Looking [2:04:19] at those dollars Million that [2:04:23] both of them are coming out to [2:04:24] 1500 the two different invoices [2:04:25] are half a year Tambi\n Antonio [2:04:31] Campbell's fha the De la [2:04:31] Factotum yacht any of the as [2:04:32] you know having a color [2:04:42] populated in our to the upper [2:04:42] middle and then the invoice [2:04:43] dates are changing as well they [2:04:45] used to be the 18th and 19th of [2:04:45] each month and now they're [2:04:46] the 30th and first of each [2:04:46] month. [2:04:50] I'm not sure when they change [2:04:51] your why you're not away I [2:05:01] would guess your well you know [2:05:05] they get on us a lot of them on [2:05:06] end of the year if we could get [2:05:11] them really so much on me this [2:05:12] the like Brazil and then I [2:05:13] don't it seems to me that [2:05:14] the water billing is a bit [2:05:14] dysfunctional because of so [2:05:15] many changes from bill to Bill [2:05:19] and in the property where I [2:05:19] live in the change in water [2:05:20] bill changes quite frequently [2:05:21] and they are looking at it [2:05:25] because I have a lot of issues [2:05:26] where I sometimes have high [2:05:26] water pressure and sometimes I [2:05:34] have little to no water [2:05:34] pressure on my property your [2:05:35] property angle problem and that [2:05:36] in order to have it be [2:05:37] amplified or you know and then [2:05:38] go back and put pressure on [2:05:43] them which I me to be the last [2:05:44] people And then I've had a lot [2:05:45] of problems with my water [2:05:45] meters and that with the water [2:05:49] pressure that comes in and even [2:05:50] explode some of my pipes are [2:05:57] stuck and nobody intended to [2:06:03] correct me in our you think a [2:06:07] little on our solar panel [2:06:08] services telling us they tell [2:06:08] me that they finally found [2:06:09] the problem but they still [2:06:12] haven't been able to come out [2:06:13] and fix it And now they're [2:06:13] still having issues with [2:06:14] the water pressure and that is [2:06:18] changing the bill cycles and [2:06:19] the amount of the bill that's [2:06:28] being paid are charged. [2:06:28] So yeah. [2:06:31] MR. Cochran Bill, our now these [2:06:32] last two they are finally [2:06:33] starting to charge me water for [2:06:40] the use cabana I started out on [2:06:41] the house because I maybe [2:06:42] because they said that they [2:06:43] weren't going to start charging [2:06:43] me until they started making [2:06:44] the adjustments necessary to my [2:06:48] house because if if I don't do [2:06:49] I want to show you. [2:06:50] But that's not true because I [2:06:53] have been paying water the last [2:06:53] two months. [2:06:53] Okay. [2:07:04] And so people see that we now [2:07:05] see what that is going to be [2:07:06] And my comment is that but it [2:07:07] that it must be a plan [2:07:10] approximate using a manyama or [2:07:11] it's criminal what is a little [2:07:16] better and multiple Yeah he got [2:07:16] his but also he said he also [2:07:22] can put that away in the bills [2:07:22] he's like a little thing but [2:07:24] almost enables me not this this [2:07:25] and I'm again going to the next [2:07:27] speaker Anthony Ross after [2:07:27] Anthony Ralph says Angela [2:07:31] better and after Angela better [2:07:32] is Paul Kruger If you can all [2:07:33] please come up to the front [2:07:44] room I think we know who [2:07:50] the bad guy is now but I think [2:07:51] what the whole world wants to [2:07:51] know is who wants to be [2:07:56] the good guy? [2:07:57] My phone has been blowing up [2:07:57] off the hook. [2:07:58] I'm being interviewed this [2:07:58] morning. [2:08:01] I was interviewed twice by four [2:08:01] more media and by The Daily [2:08:02] Wire. [2:08:07] I have a request to be [2:08:07] interviewed this entire week [2:08:08] And what I would like to ask is [2:08:09] of the five council members [2:08:12] that voted for Flock, when will [2:08:13] this end? [2:08:13] When will you listen to [2:08:14] the vast majority of your [2:08:14] constituents? [2:08:15] When will you respect [2:08:19] the Constitution that you swore [2:08:19] an oath to defend? [2:08:20] When will you respect our [2:08:23] privacy rights that are [2:08:24] enshrined in the Fourth [2:08:24] Amendment? [2:08:25] These are non-negotiables. [2:08:25] It should not have had to come [2:08:26] to this. [2:08:29] I came respectfully. [2:08:30] I presented my position [2:08:30] respectfully with hundreds of [2:08:31] other organizations that [2:08:35] expressed the exact same [2:08:36] sentiment that I'm expressing [2:08:37] before you now I should not [2:08:37] have had to wear this Darth [2:08:41] Vader outfit in order to get [2:08:42] your attention in order to [2:08:42] raise global awareness about [2:08:43] this issue. [2:08:47] But now that I have I'm glad [2:08:48] I'm glad that this is going [2:08:48] viral. [2:08:49] I'm glad that this is now a [2:08:52] viral conversation that [2:08:53] the whole world is happening [2:08:53] because now this is an [2:08:54] opportunity for you to see This [2:08:57] is an opportunity for you to [2:08:58] continue your political careers [2:08:58] if you still want them. [2:08:59] There is nothing that is [2:09:03] uniting the right and the left [2:09:04] faster than our disdain for [2:09:05] this Orwellian surveillance [2:09:09] technology. [2:09:09] That's abundantly clear by [2:09:10] the fact that I could wear this [2:09:11] costume once and it could go [2:09:15] globally viral be picked up by [2:09:16] cnn Washington Post I've seen [2:09:16] this I've seen my video [2:09:17] translated in Arabic. [2:09:20] I've seen it translated in [2:09:21] Spanish that showcases that [2:09:21] should demonstrate to all of [2:09:22] you who couldn't read the room [2:09:26] when the vast majority of your [2:09:27] constituents were opposed to [2:09:27] flock that the world is against [2:09:31] flock, that the world is [2:09:32] against being surveilled, that [2:09:32] we understand that poverty is a [2:09:37] symptom of rampant inequality [2:09:38] that billionaires not paying [2:09:38] their taxes are the ones that [2:09:43] approve this technology [2:09:43] Billionaires, boomers, cops and [2:09:44] fascists and those that don't [2:09:48] respect the Constitution are [2:09:49] the only ones that want Angela [2:09:53] better. [2:09:59] Hi I want to say I'm really sad [2:09:59] that I was cut off earlier [2:10:00] because when I was talking [2:10:04] about and if you would have let [2:10:05] me finish it would have gotten [2:10:06] to the point where, you know, [2:10:10] Measure c was about the 30 foot [2:10:10] height limit and repealing [2:10:11] that. [2:10:14] >> But anyway I'll start here [2:10:20] sb 344 Okay. [2:10:24] Sb 344 is a bill that is going [2:10:32] through Sacramento that that [2:10:37] Senator Weber Pearson has [2:10:42] decided to get and change it to [2:10:43] Midway Rising and sequel And [2:10:46] you know it was about human [2:10:47] remains dispose of human [2:10:48] remains so to me that just [2:10:52] that's like taking a shirt that [2:10:53] you see at a store and saying I [2:10:58] don't like the price so I am [2:10:58] going to remove that price tag [2:11:02] and switch it for something [2:11:02] that's on sale. [2:11:03] >> The other thing is that you [2:11:07] know, as a physician she should [2:11:08] understand why, you know, just [2:11:13] like all of you that you don't [2:11:13] decide a patient's outcome [2:11:17] first and then eliminate tests [2:11:17] that might reveal something [2:11:22] that you don't want to hear And [2:11:22] just because there's [2:11:23] legislature that allows that to [2:11:26] happen doesn't mean it's right [2:11:26] . [2:11:27] >> So I just want to say, you [2:11:28] know, traffic emergency [2:11:31] response infrastructure, air [2:11:32] quality, you know, other [2:11:37] impacts, you know, they just [2:11:38] don't disappear because [2:11:42] Sacramento Bill says that needs [2:11:42] to. [2:11:43] >> So I hope you don't find [2:11:44] another way to eliminate the 30 [2:11:47] foot height limit and you know [2:11:52] respect the San Diego residents [2:11:52] because ultimately the voters [2:11:55] are the ones that put all of [2:11:55] you out there. [2:11:59] Thank you. [2:12:00] >> Paul Kruger, if you can [2:12:08] please come up. [2:12:09] Thank you. [2:12:13] First I like to say speaking on [2:12:14] behalf of the non billionaire [2:12:23] non fascists but boomers I did [2:12:23] support Floc I do support Floc [2:12:27] It's a tough call but you all [2:12:28] know there's another side out [2:12:32] there Also Council PRESIDENT I. [2:12:37] I will always remember the very [2:12:37] powerful comments you and Raul [2:12:41] Campo gave about [2:12:42] the construction of the eight [2:12:46] storey project on Coronet near [2:12:47] Mission MAY Drive That's going [2:12:51] up now that again the issue is [2:12:52] not whether or not we need [2:12:52] the housing. [2:12:56] The issue is whether or not [2:12:56] we're going to respect voters [2:12:57] on Proposition d and properly [2:13:01] put the measure before them for [2:13:01] appeal. [2:13:05] That's the issue I just wanted [2:13:06] to do on the record thank [2:13:07] people who I believe made it [2:13:08] possible to reopen [2:13:14] the restrooms and with [2:13:14] favoritism towards none and [2:13:15] thank you towards all I just [2:13:18] put it in alphabetical order [2:13:19] Again just to put on the record [2:13:24] those who who reversed that [2:13:27] really unfortunate policy. [2:13:28] First of all council member [2:13:29] Campo who acknowledged his vote [2:13:32] for the budget but was [2:13:33] the first to forcefully come [2:13:37] out and argue for there be in [2:13:38] statement of the funds to open [2:13:39] it to spite been ignored by [2:13:41] the mayor The letter writer [2:13:42] through the Union-Tribune who [2:13:46] week after week refused to let [2:13:46] the issue die. [2:13:47] Audrey Pham, the pediatrician [2:13:51] at Children's who on Tuesday [2:13:52] before the mayor announced [2:13:52] the openings pointed out [2:13:56] the problem of communicable [2:13:56] diseases caused by closed [2:13:57] restrooms. [2:14:01] Chris Read at the Union-Tribune [2:14:01] who endlessly, tirelessly and [2:14:05] sometimes a little too [2:14:06] vociferously urged the opening [2:14:07] of the restrooms. [2:14:11] Bradshaw fell from the mission [2:14:12] Bay Conservatory Thank you all. [2:14:15] >> Thank you. [2:14:16] I'm sorry The five minute time [2:14:17] we're going to those [2:14:17] participating remotely We [2:14:18] currently have 11 people in [2:14:19] the queue. [2:14:19] >> The original if you can [2:14:23] please unmute Yes with all this [2:14:24] focus on flock it's interesting [2:14:28] because it's the surveillance [2:14:29] technology that we need to be [2:14:29] focusing on. [2:14:33] You guys like to concentrate on [2:14:33] these billionaires and what [2:14:37] they're doing to encroach on [2:14:38] everybody's lives and [2:14:38] the billionaires that you speak [2:14:39] of and want to you know, hold [2:14:42] back are the very ones that are [2:14:43] owning these technologies And [2:14:47] it's not about flock but it was [2:14:48] a great bait and switch for [2:14:52] them to bring in flock and do a [2:14:52] corporate cannibalism of it by [2:14:57] bringing in some a partner who [2:14:57] supported Flock in [2:14:58] the beginning in fact gave [2:15:02] funding to it which is Axon. [2:15:03] And so Axon is going to be [2:15:04] coming in and taking the place [2:15:07] of flock. [2:15:08] Axon already got the contracts [2:15:12] on the body worn cameras on [2:15:13] the 911 dispatch on Alpers [2:15:17] within the law enforcement [2:15:17] vehicles. [2:15:18] And so as we sit here and we [2:15:22] concentrate on one entity and [2:15:23] not the entire system as a [2:15:24] whole and understand that Peter [2:15:28] Teal who is very well connected [2:15:32] with Epstein and Larry Fink [2:15:33] with BlackRock it's you know [2:15:33] all of these JPMorgan's [2:15:34] the people that you guys even [2:15:38] contract out but instead you [2:15:38] want to focus on Trump. [2:15:39] You need to be focusing on [2:15:42] these entities that are [2:15:43] collecting our data on a [2:15:44] massive scale bringing in these [2:15:47] A.I. Data centers and are [2:15:48] surveilling our children [2:15:51] wherever they go And this is an [2:15:52] Epstein operation. [2:15:53] Jeffrey Epstein is not dead. [2:15:57] His operation is in full flux [2:15:57] And the concern is not only [2:16:01] that it's a satanic Lucifer [2:16:02] Korean ritual abuse that [2:16:02] happens on children but it's [2:16:06] also a blackmail system because [2:16:07] you know, Jeffrey Epstein is a [2:16:11] cia and Mossad agent And so as [2:16:12] we see these things [2:16:13] encroaching, we need to really [2:16:16] be concerned about where our [2:16:16] data is going. [2:16:17] And so you guys need to be [2:16:18] standing against surveillance [2:16:22] as a whole not flock, not Axion [2:16:22] but surveillance as a whole and [2:16:26] understand that your children [2:16:27] are being watched by the very [2:16:27] people that you think shouldn't [2:16:28] be in jail. [2:16:31] >> Time has concluded. [2:16:32] Becky Wrap if you can please [2:16:33] unmute after that is Barbara [2:16:37] Gordon and Katherine Rhodes. [2:16:37] Thank you Rob. [2:16:38] I can hear me. [2:16:40] There you go. [2:16:41] >> Good afternoon. [2:16:42] My name is Becky Rapp and I'm a [2:16:45] parent in a public health [2:16:45] educator And today I come to [2:16:46] ask the Council for [2:16:51] Transparency when it comes to [2:16:51] the city's cannabis tax [2:16:51] revenue. [2:16:55] A neighboring city, Los Angeles [2:16:56] has significantly more [2:16:56] marijuana businesses than San [2:16:59] Diego. [2:17:00] And in MARCH of this year they [2:17:01] were able to report that its [2:17:04] marijuana businesses owe [2:17:05] approximately 400 million in [2:17:05] back taxes and fees. [2:17:09] The city is now considering an [2:17:10] amnesty program because so much [2:17:14] money remains uncollected. [2:17:15] If a city of this size with [2:17:15] hundreds of pot shops can [2:17:19] provide this detailed [2:17:19] information, why can't San [2:17:20] Diego residents are still [2:17:24] asking how much marijuana tax [2:17:25] is actually owed? [2:17:25] How much was supposed to be [2:17:29] collected and how much was [2:17:30] actually collected including [2:17:30] interest charges and late [2:17:34] penalty fees. [2:17:35] The city tells us that [2:17:35] marijuana businesses are free [2:17:38] to read to be audited and [2:17:43] the city's own tax materials [2:17:43] state that audits can identify [2:17:44] underreported taxes and that [2:17:48] penalties and interest can be [2:17:48] assessed. [2:17:49] So where's the public [2:17:50] accounting of those results? [2:17:53] The city treasurer has a [2:17:54] delinquent accounts program [2:17:57] that collects past receivables [2:17:58] including audit deficiencies [2:17:58] But the public deserves to know [2:18:02] specifically what is happening [2:18:03] with cannabis tax [2:18:03] delinquencies. [2:18:07] So I'd like to ask the Council [2:18:08] to once again direct the City [2:18:12] Treasurer and City Auditor to [2:18:12] provide an update publicly [2:18:13] available cannabis revenue and [2:18:17] tax compliance report. [2:18:17] Appreciate your time. [2:18:18] Thank you. [2:18:18] Thank you. [2:18:20] Next is Barbara Gordon. [2:18:25] If you can please unmute. [2:18:30] >> Good afternoon. [2:18:31] In San Diego it's hard to MISS [2:18:31] The many cannabis businesses [2:18:34] and billboards promoting [2:18:35] cannabis as a treatment for [2:18:39] virtually every condition. [2:18:40] Medical izing commercializing [2:18:44] of high potency thc has [2:18:45] produced rising rates in [2:18:45] addiction emergency room [2:18:49] visits, traffic fatalities, [2:18:50] serious psychiatric harm [2:18:51] especially among youth. [2:18:55] Recently a dea scientist [2:18:59] testified about the widespread [2:19:00] abuse and the lack of [2:19:01] standardized cannabis products [2:19:05] and the absence of rigorous [2:19:05] scientific evidence necessary [2:19:10] to establish acceptable cold [2:19:11] medical use for cannabis under [2:19:14] the Controlled Substance Act. [2:19:14] Congress established [2:19:15] the scientific standard for [2:19:19] drug scheduling to help ensure [2:19:19] that these decisions are based [2:19:24] on evidence rather than [2:19:24] political pressure. [2:19:25] If those standards can be [2:19:29] reinterpreted whenever they [2:19:29] become politically inconvenient [2:19:34] scientists scientific integrity [2:19:34] gives away to political [2:19:35] expedience. [2:19:39] We know lowering [2:19:39] the restrictions will increase [2:19:40] availability, reduce public [2:19:43] perception of risk, encourage [2:19:44] greater use and ultimately [2:19:48] increase addiction especially [2:19:49] among vulnerable young people. [2:19:49] Our young people deserve [2:19:53] protection when they repeatedly [2:19:54] hear that marijuana is harmless [2:19:58] or it is simply medicine. [2:19:58] They MAY underestimate [2:19:59] the risks. [2:20:02] The profit driven marijuana [2:20:03] industry big weed mirrors [2:20:07] the tactics of big tobacco big [2:20:07] alcohol. [2:20:08] These developments are not [2:20:08] accidental. [2:20:12] I urge the city to take [2:20:12] stronger actions by limiting [2:20:17] marijuana businesses and [2:20:17] advertising and marketing of [2:20:18] this drug. [2:20:22] Thank you for letting me speak [2:20:22] . [2:20:23] >> Thank you. [2:20:24] Next is Katherine Rhodes than [2:20:25] Kathleen Lippert in 7499 after [2:20:28] the five minute timer has also [2:20:29] concluded there were 13 people [2:20:30] with their hands raised. [2:20:30] No additional speakers will be [2:20:31] taken. [2:20:34] Kathleen, please proceed. [2:20:35] >> Hello, this is Katherine [2:20:39] Rhodes and I'm calling again [2:20:39] regarding our ballot measure [2:20:43] That was not allowed to be [2:20:44] heard for a second reading at [2:20:44] the Rules Committee and was [2:20:49] taken out by PRESIDENT Joe La [2:20:49] Cava based on I believe false [2:20:54] information from both the Ebert [2:20:54] which said that which only gave [2:20:59] a verbal response saying that [2:20:59] there's only going to be a [2:21:03] minimal amount of money, not [2:21:04] 140 million that would have [2:21:05] solved our city structural [2:21:08] budget deficit but also a [2:21:13] verbal legal opinion by [2:21:14] the city attorney that tried to [2:21:18] say that if we just wanted to [2:21:19] have the words online travel [2:21:19] agency as part of a hotel [2:21:23] operator in the municipal code, [2:21:27] it would require a [2:21:27] supermajority or two thirds [2:21:28] public voter approval because [2:21:31] this was a special tax. [2:21:32] What I'm trying to say is [2:21:32] that's not true. [2:21:36] That again is false [2:21:36] information. [2:21:37] I would like for both the ipa [2:21:41] to write a written response [2:21:42] regarding exactly how much [2:21:46] money should should be created [2:21:51] by changing the municipal code [2:21:51] plus a legal opinion a written [2:21:52] legal opinion by the city [2:21:56] attorney because they said you [2:21:57] know what you guys did is a [2:22:01] validation lawsuit for Measure [2:22:05] c and what you guys said there [2:22:05] is that because it was a [2:22:09] special tax proposed by a [2:22:10] citizens initiative even though [2:22:11] it's a special tax, it only [2:22:15] needs 50% or a majority voter [2:22:18] approval not the two thirds [2:22:19] supermajority. [2:22:19] And so you guys won that [2:22:23] lawsuit And so of course it's [2:22:27] only 50% for that And it was [2:22:28] it's always been 50% And I just [2:22:32] think you guys just totally [2:22:33] ruined all the work, all [2:22:38] the hundreds of hours of work I [2:22:42] put into this for no reason. [2:22:43] My apologies. [2:22:43] Thank you. [2:22:46] Next is Kathleen Lippert. [2:22:50] >> If you can please unmute. [2:22:51] Thank you. [2:22:55] Good afternoon again. [2:22:56] >> I'd like to share some [2:22:57] information from Paul Light. [2:23:00] He writes that the first step [2:23:01] in preventing future failures [2:23:01] is to look at past policy [2:23:05] failures to prevent worsening a [2:23:06] growing behavioral health [2:23:06] problem. [2:23:10] >> There is plenty of [2:23:11] historical evidence for drug [2:23:12] policies that have failed in [2:23:15] the past. [2:23:15] The fda has asked and opposed [2:23:20] cooperation with county public [2:23:20] health departments questions [2:23:24] that can determine whether [2:23:25] the policy was necessary in [2:23:26] the first place or whether it [2:23:29] would resolve the problem at [2:23:29] hand. [2:23:30] They don't. [2:23:30] The city's marijuana [2:23:34] legalization expansion policy [2:23:35] is a perfect example. [2:23:36] It should have been clear from [2:23:38] the beginning that attempting [2:23:39] to partner with an addictive [2:23:40] drug industry was destined to [2:23:44] fail at regulating itself. [2:23:44] The ordinance and the industry [2:23:49] became undeterred undermined by [2:23:49] corruption and unethical [2:23:50] conduct. [2:23:53] Well beyond monitoring. [2:23:54] Ironically, The New York Times [2:23:55] once an advocate on marijuana [2:23:58] commercialization, has [2:23:59] acknowledged that marijuana [2:23:59] became too potent. [2:24:02] What did they expect? [2:24:03] Of course industry addiction [2:24:04] industries like alcohol, [2:24:08] tobacco now marijuana strive to [2:24:08] increase their potency of [2:24:09] products. [2:24:12] Then year ago city and County [2:24:13] both collaborated with [2:24:14] the industry to increase [2:24:17] availability and allow rapid [2:24:18] changes in marijuana products [2:24:22] Selling Bud along with highly [2:24:22] concentrated vape cartridges, [2:24:23] gummies, edibles, waxes and [2:24:27] beverages infused with [2:24:28] the psychoactive compound thc. [2:24:32] These newer products evolve to [2:24:37] max to engineer maximum thc to [2:24:37] be used conveniently and [2:24:38] discreetly. [2:24:41] Of course concern is for our [2:24:42] adolescents whose brains are [2:24:43] still developing and are more [2:24:46] vulnerable to the effects of [2:24:47] repeated exposures to high [2:24:47] levels of thc. [2:24:52] Regulation are are supposed to [2:24:53] allow for public education and [2:24:59] teaching but concluded next to [2:24:59] sound for nine nine. [2:25:00] If you can please unmute. [2:25:08] After that is Blair Beekman. [2:25:09] >> Apology 7499 If you can [2:25:14] please unmute. [2:25:15] Bob does this get here? [2:25:16] I'm going to read from several [2:25:16] letters written to Joe LaCava [2:25:17] regarding the Torrey Pines [2:25:19] Light report. [2:25:19] i'll start with this 2021 [2:25:20] letter written from the Horry [2:25:21] Town Council. [2:25:22] Quote On APRIL 8th, 2021 [2:25:23] the committee reported its [2:25:23] findings to lgc which [2:25:27] unanimously supported that [2:25:27] the City of San Diego [2:25:28] reconvened the Torrey Pines [2:25:28] Advisory Board. [2:25:29] We are requesting that the City [2:25:33] of San Diego consider whether [2:25:33] the solo pilot suppliers should [2:25:34] have to pay annual membership [2:25:38] fees or cost of insurance to [2:25:39] fly the glider for end quote. [2:25:39] Next is a letter from [2:25:40] the Higher Shores Association [2:25:42] on NOVEMBER 13th, 2025. [2:25:43] Quote The Lahaina Shores [2:25:43] Association respectfully submit [2:25:46] this letter in support of [2:25:47] establishing the Torrey Pines [2:25:48] City Park Advisory Board and [2:25:48] its role in overseeing [2:25:52] operations at the Torrey Pines [2:25:52] y Airport. [2:25:53] Our association believes this [2:25:54] matter is vital to the safety [2:25:56] of park users, visitors and [2:25:57] the surrounding community. [2:25:58] We encourage the city of San [2:25:58] Diego to carefully evaluate [2:26:01] where the solo flier pilots [2:26:02] should be required to pay [2:26:02] annual membership fees and or [2:26:03] maintain insurance coverage to [2:26:06] fly at the glider airport end [2:26:06] quote. [2:26:07] Next letter is from [2:26:07] the University Community [2:26:10] Planning Group Quote On MARCH [2:26:10] 10th, 2026, the U.S. Passed [2:26:14] the following resolution quote [2:26:15] where whereas Torrey Pines City [2:26:16] Park has unique and [2:26:16] irreplaceable natural resources [2:26:19] and. [2:26:19] Whereas, citizen input over [2:26:20] these resources is both [2:26:21] appropriate and timely, [2:26:21] the University Community [2:26:24] planning Group recommends that [2:26:24] the city establish a Torrey [2:26:27] Pines City Park Advisory Board [2:26:28] under Charter Section 43 to [2:26:29] advise the city on planning [2:26:29] maintenance and operation of [2:26:33] Torrey Pines City Park end [2:26:33] quote. [2:26:34] Finally this is a second letter [2:26:36] from your town council on [2:26:37] AUGUST 13th 2026 while you were [2:26:37] on vacation. [2:26:38] Quote the law your town council [2:26:41] respectfully submit this letter [2:26:42] in support of reactivating [2:26:43] the Torrey Pines City Park [2:26:45] Advisory Board under City [2:26:46] Charter Section 43 and its [2:26:47] essential role in providing [2:26:47] oversight of operations at [2:26:50] Torrey Pines Flight Report. [2:26:51] Torrey Pines City Park Advisory [2:26:52] Board should be tasked with [2:26:53] advising the city on matters of [2:26:55] safety and fair access to [2:26:55] the Torrey Pines City Park. [2:26:56] Matters of fair access should [2:26:59] include a review of whether [2:27:00] solo flier pilots should be [2:27:00] required to maintain annual [2:27:01] membership fees and or [2:27:04] individual insurance coverage [2:27:05] as a condition of flying [2:27:06] the glider for end quote. [2:27:06] Joe LaCava. [2:27:09] Why are you ignoring all of [2:27:10] these important local [2:27:14] organizations? [2:27:15] >> Why your time did conclude [2:27:18] Blair Beckman If you can please [2:27:23] unmute. [2:27:23] >> Hi, Thank you. [2:27:24] Blair Beekman. [2:27:24] Thank you for that beginning of [2:27:27] our meetings today. [2:27:28] I wanted to thank Anthony for [2:27:28] his work. [2:27:32] He's bringing light to hpr and [2:27:36] surveillance technology issues [2:27:37] overall in San Diego the same [2:27:42] time he was a council in [2:27:42] the past few weeks with his [2:27:43] showing what he can do well. [2:27:51] There was also on on npr Radio [2:27:52] in San Diego ktvu kpbs It was [2:27:56] it was National you know [2:27:57] consider pr week Do we do we [2:28:01] leave hpr Weekly? [2:28:02] How can we live our. [2:28:05] It was a week to do that and [2:28:06] npr and and kpbs picked up on [2:28:07] that. [2:28:11] They were covering stories. [2:28:12] Should we be leaving? [2:28:12] Aoki argues. [2:28:13] That's an amazing concept. [2:28:15] I think. [2:28:16] And for all the years I've been [2:28:17] talking to you guys trying to [2:28:19] be accountable more [2:28:20] responsible, good policy [2:28:21] practices, open policies, [2:28:25] working with community more. [2:28:26] There's a part I'm not offering [2:28:29] enough and that technology [2:28:30] overall is really uncomfortable [2:28:31] to a lot of people. [2:28:34] And when you sit here and say [2:28:35] how wonderful and magical [2:28:39] billboards are each each year, [2:28:40] each time it makes people [2:28:41] really uncomfortable. [2:28:44] For the most part our [2:28:45] technology future is not that [2:28:46] much of a price. [2:28:49] And I think there's more of a [2:28:50] price at this time in how to [2:28:51] talk about the open accountable [2:28:54] democratic process. [2:28:55] And you guys I really hope want [2:28:55] to make these efforts this fall [2:28:58] towards such efforts. [2:28:59] You know, with all the election [2:29:03] issues I hope is real talk [2:29:04] about accountability and [2:29:04] working with the community on [2:29:05] the future of our cec. [2:29:08] How do we talk about the future [2:29:09] of Waymo? [2:29:09] I think we're all uncomfortable [2:29:10] with that subject. [2:29:13] I think there's ways to better [2:29:14] talk about how we can have a [2:29:17] trial period for them and then [2:29:18] a real serious public process [2:29:19] if they should be here in [2:29:19] the future or not. [2:29:23] We can do that. [2:29:23] >> We have the ability to say [2:29:24] no to technology. [2:29:25] Let's do things well. [2:29:27] Guys, thank you. [2:29:28] Concluded John if you can [2:29:28] please unmute. [2:29:29] After that is not only asking [2:29:32] John. [2:29:33] >> Good afternoon. [2:29:40] Oh MAY not be able to hear me. [2:29:40] You hear me now? [2:29:41] Yes. [2:29:41] Please proceed. [2:29:42] There we go. [2:29:42] Thank you. [2:29:44] John Brady lived experience [2:29:45] advisors. [2:29:46] I wanted to talk about the safe [2:29:46] sleeping site. [2:29:50] We're concerned about where [2:29:50] we're headed with the safe [2:29:54] sleeping site in terms of [2:29:55] quality of life. [2:29:55] When we supported the initial [2:29:59] operation it was our [2:30:00] understanding that it was going [2:30:01] to be, you know, one maybe, you [2:30:04] know, 200 individuals or tents [2:30:09] that were going to be on that [2:30:09] site And now we are approaching [2:30:12] just shy of 600. [2:30:13] In the meantime, we've not [2:30:13] provided any shade cover. [2:30:17] We've not provided any ground [2:30:17] cover. [2:30:18] I know the city has tons of [2:30:22] trees and tree limbs that it [2:30:23] shreds on a regular basis. [2:30:24] Why can't we just dump some of [2:30:27] that onto the ground so people [2:30:27] are not tracking dirt or even [2:30:31] worse mud into the places that [2:30:32] they're living in. [2:30:32] And we see continuous issues [2:30:36] with people's ability to shower [2:30:37] with that number of people. [2:30:38] It appears that our trailers [2:30:41] have not been expanded for [2:30:42] showers as well as access to [2:30:46] and from the facility via [2:30:47] the provided electric [2:30:47] transport. [2:30:51] I really am concerned [2:30:52] the direction that we're [2:30:52] headed. [2:30:56] We've decided not to build any [2:30:57] formal shelter since the mega [2:31:01] shelter proposal. [2:31:02] And with this administration [2:31:06] we've laid a pretty pretty bare [2:31:06] bones example of what an [2:31:11] internment camp could be as an [2:31:12] operating function if if that's [2:31:12] the direction it truly decides [2:31:15] to head which seems to be all [2:31:16] indicators forcing homeless [2:31:16] people into some sort of [2:31:20] containment facility ice. [2:31:25] >> So I really think that we [2:31:26] need to look at you know, when [2:31:26] we saw the budget lines [2:31:29] presented, you know, there was [2:31:30] ,you know, less than $50 a [2:31:30] day. [2:31:31] The question needs to be is [2:31:34] that really adequate? [2:31:35] Are we treating people [2:31:36] humanely, cramming them into [2:31:39] these facilities when [2:31:40] originally we talked about [2:31:40] small encampments around [2:31:44] the city, not one large sided [2:31:44] location. [2:31:45] >> But now over 600. [2:31:48] Natalie Raskin If you can [2:31:52] please unmute your immediate we [2:32:03] do not hear you. [2:32:09] Hello. [2:32:09] Sorry. [2:32:10] Your mike does not seem to be [2:32:13] working. [2:32:14] You will have to move on to [2:32:17] the next caller and we'll try [2:32:17] one more time. [2:32:22] I see that you're in a meeting [2:32:23] but the device that you're [2:32:24] speaking into MAY be muted as [2:32:26] well. [2:32:27] We will have to move on to [2:32:31] the next caller. [2:32:42] I am concerned about collection [2:32:43] of city council members [2:32:48] physically just stupid whopping [2:32:48] old giddy gleeful Perry Como [2:32:53] What mother Julia Colbert [2:32:54] the eccentric moneybags and I'm [2:32:55] now crippled but the fear as [2:33:01] you feel would sleep on them [2:33:02] laying low Hola Just not happy [2:33:03] to pay for a car but probably [2:33:04] why one of his political [2:33:05] opponents Well tell me what [2:33:06] feels in California If you go [2:33:07] back to New Jersey, New York [2:33:11] you go up a big floppy county. [2:33:14] >> got it all next says [2:33:15] Madison. [2:33:19] If you can please unmute it. [2:33:19] Hi, good afternoon. [2:33:24] City Council I want to remind [2:33:25] the Council that when we talk [2:33:25] about cannabis policy we cannot [2:33:29] lose sight of the kids that are [2:33:30] growing up in this environment. [2:33:34] We are creating a teenager's [2:33:35] brain is still developing into [2:33:35] their mid-twenties. [2:33:36] Cannabis can affect memory [2:33:40] attention learning, decision [2:33:40] making and coordination and [2:33:45] teens who use cannabis are more [2:33:45] likely to experience problems [2:33:46] such as cannabis use disorder [2:33:50] and difficulties Completing [2:33:50] school. [2:33:51] But the consequences are more [2:33:55] than just statistics because [2:33:56] for a young person losing [2:33:56] motivation can mean falling [2:34:00] behind in school and poor [2:34:00] judgment can mean getting [2:34:01] behind the wheel impaired [2:34:06] Regular use can turn into more [2:34:06] and become a dependance issue [2:34:07] And for some young people [2:34:11] cannabis use is associated with [2:34:11] serious mental health [2:34:12] consequences including [2:34:12] psychosis. [2:34:16] As adults we have a [2:34:17] responsibility to make sure our [2:34:18] children understand that [2:34:21] marijuana is not harmless [2:34:21] simply because it is available [2:34:22] to adults. [2:34:23] San Diego can be a leader in [2:34:27] prevention by investing in [2:34:27] evidence based youth education, [2:34:32] supporting parents and schools [2:34:32] ,enforcing protections around [2:34:33] cannabis businesses and making [2:34:34] sure prevention doesn't get [2:34:37] treated as an afterthought. [2:34:38] We spend enormous resources [2:34:39] helping people recover after [2:34:43] substance use has caused [2:34:43] damage. [2:34:44] I hope we will remember that [2:34:44] preventing that damage in [2:34:48] the first place especially for [2:34:49] children and teenagers is one [2:34:49] of the best investments [2:34:50] the city can. [2:34:54] Thank you. [2:34:54] >> Thank you. [2:34:59] Remember back and please unmute [2:34:59] . [2:35:00] >> Hi, good afternoon again I'm [2:35:04] in the district seven. [2:35:05] I'm so first I wanted to bring [2:35:09] up I just found out about [2:35:10] recently like a couple of [2:35:11] months ago about this program [2:35:15] the keep Homeland Security [2:35:15] grant program that's [2:35:16] administered through fema. [2:35:20] Apparently it's a $1 billion [2:35:24] program and we as a big city [2:35:25] receive funds from this program [2:35:26] through the u. [2:35:31] A I urban area security [2:35:31] initiative. [2:35:35] I actually when I first learned [2:35:36] about it in early JULY, I put [2:35:37] in a public records request and [2:35:41] it's been delayed now three [2:35:41] different times. [2:35:42] So from JULY 9th they've now [2:35:46] delayed until SEPTEMBER 1st. [2:35:47] I don't know if that's normal. [2:35:48] I haven't done a ton of public [2:35:51] record requests yet. [2:35:52] I've done a few and I've never [2:35:53] taken this long. [2:35:54] And I just wanted to bring that [2:35:57] up. [2:35:58] Secondly, I'll just read and I [2:35:59] read this to you guys before [2:35:59] but I'm just going to keep [2:36:03] coming back and reading it. [2:36:04] I'm in a city full of sailors, [2:36:09] soldiers and veterans. [2:36:10] It absolutely disgusting that [2:36:10] our city council so easily [2:36:15] decimates the Fourth Amendment [2:36:16] protections that our military [2:36:19] families sacrifice for bled for [2:36:27] and died to protect. [2:36:28] >> That concludes your [2:36:28] comments. [2:36:29] No, sorry. [2:36:29] I'm okay. [2:36:33] I I'm going to help them with [2:36:33] practice. [2:36:34] They're taking the economy on [2:36:34] purpose. [2:36:35] So small farms, small [2:36:38] businesses fail and big [2:36:38] corporations can buy scraps and [2:36:39] monopolize exports even more. [2:36:40] They're running up our national [2:36:44] debt while they still can so [2:36:45] they can go through defense [2:36:45] contracts and corporate tax [2:36:46] cuts even removing required [2:36:50] social support and removing [2:36:51] social support and services so [2:36:51] they have more money to [2:36:52] embezzle and defense contracts [2:36:52] and tax cuts. [2:36:56] They're creating a surveillance [2:36:56] system and desensitizing [2:36:57] massive paramilitary on [2:36:58] the streets of the rebellion [2:37:02] When the air bubble pops. [2:37:03] Our fallen kids evaporate in [2:37:04] places devastated. [2:37:04] The people have nothing to lose [2:37:08] by rebelling because nothing [2:37:08] like history. [2:37:09] >> Smash and grab robbery. [2:37:09] I'm sorry your time has [2:37:10] concluded. [2:37:10] Great. [2:37:13] Thank you. [2:37:13] Catherine Douglas and then [2:37:14] Fannie after that. [2:37:19] Hello. [2:37:19] >> Hello. [2:37:20] Yes, I can hear you. [2:37:20] Okay. [2:37:21] Patricia Filet. [2:37:24] Previously District three now [2:37:25] District two Old town. [2:37:26] The supplemental air for San [2:37:26] Diego is Measure c was found [2:37:29] legally deficient for failing [2:37:30] to properly analyze impacts on [2:37:30] cultural resources and [2:37:35] neighborhood character in areas [2:37:36] adjacent to the Midway District [2:37:36] such as Ultium. [2:37:37] The review downplayed [2:37:41] the effects of increased [2:37:41] density and traffic on historic [2:37:42] sites leading to a court ruling [2:37:47] that the city violated Sequoyah [2:37:48] the city's failure to conduct a [2:37:48] proper analysis regarding [2:37:53] Measure c and its resulting [2:37:53] coastal height limit in [2:37:54] the Midway District directly [2:37:59] impacts Presidio Park [2:37:59] assignments specifically [2:38:00] recognized as a national [2:38:05] historic landmark by [2:38:06] challenging but weakly [2:38:06] deficient air successfully [2:38:11] argued that the that [2:38:12] the environmental review [2:38:12] treated areas like Presidio [2:38:17] Park and Old Town as isolated [2:38:18] islands completely ignoring how [2:38:22] a wall of high rises in [2:38:23] neighboring Midway would [2:38:24] visually and culturally degrade [2:38:29] a national historic landmark. [2:38:30] In short, while Measure c [2:38:30] attempts to adjust municipal [2:38:35] height boundaries locally. [2:38:36] Section 106 ensures that [2:38:36] federal planning standards [2:38:37] treat Presidio Park as a [2:38:41] protected asset whose visual [2:38:41] horizon early California [2:38:42] landscape and ancestral [2:38:47] archeology cannot be legally [2:38:48] disregarded by a full vote. [2:38:53] Our surrounding neighborhoods [2:38:53] matter as much as our native [2:38:54] and descendent voices too For [2:38:58] any major developments to [2:38:59] further attempt to erase our [2:39:05] historic and cultural heritage. [2:39:05] >> Thank you. [2:39:05] Thank you. [2:39:06] Katherine Douglas, if you can [2:39:06] please. [2:39:10] I'm you. [2:39:10] >> I hadn't planned to speak [2:39:11] this afternoon but I am [2:39:16] appalled at some of [2:39:17] the comments regarding Alpers. [2:39:22] The police department has great [2:39:23] oversight from multiple [2:39:23] committees. [2:39:28] The police department put on a [2:39:28] technology informational [2:39:34] technology meeting on I believe [2:39:35] it was JULY 22nd. [2:39:38] I happened to go to the one in [2:39:39] my area. [2:39:40] There were four officers there. [2:39:40] There were three people from [2:39:41] the public. [2:39:46] There were a few more at Anchor [2:39:46] Church. [2:39:47] Most of the as we went through [2:39:51] the meeting and they explained [2:39:51] technologies which are super [2:39:58] important to our public safety [2:39:58] they're force multipliers where [2:40:04] 230 officers short as of last [2:40:04] Wednesday maybe even shorter [2:40:05] today. [2:40:10] But did any of those people go [2:40:10] to those meetings? [2:40:11] Did any of those people learn [2:40:12] about the technology? [2:40:16] Do any of those people Basham [2:40:17] and Alpers realize that [2:40:22] everybody has on everybody has [2:40:22] a smartphone. [2:40:23] A lot of people have Apple [2:40:23] watches. [2:40:27] People have ring cameras and [2:40:28] public safety surveillance [2:40:34] cameras on their homes and [2:40:34] businesses. [2:40:35] You're being surveilled all [2:40:35] the time. [2:40:40] The technology this particular [2:40:41] technology just caught someone [2:40:41] who shot into a crowded [2:40:46] restaurant and injured someone [2:40:47] with a gun Last week that [2:40:52] happened to be in Vista But it [2:40:52] happens in San Diego And they [2:40:53] because of Alpers they were [2:40:58] able to catch the suspect. [2:40:58] He's been charged with [2:40:59] attempted murder and he's [2:41:04] probably going to jail. [2:41:04] So I caution people to learn [2:41:11] about the technology before [2:41:11] they speak without [2:41:12] understanding it. [2:41:12] Thank you. [2:41:13] Thank you. [2:41:17] That is funny. [2:41:18] Esquivel The next speaker is [2:41:19] Fannie Esquivel who has [2:41:19] requested translation fantasy [2:41:23] before that idea is allowed in [2:41:28] France's courts before [2:41:28] Parliament. [2:41:34] >> When a service member goes [2:41:35] it's funny as we communion in a [2:41:40] way that Good afternoon members [2:41:40] of the San Diego City Council. [2:41:41] >> My name is and I am here [2:41:42] today as a member of [2:41:44] the community a concerned [2:41:52] member of the community of Soda [2:41:53] is a product of the tobacco tax [2:41:57] and using dairy. [2:41:58] >> I'm concerned because of [2:41:58] the tobacco product litter that [2:41:59] is scattered throughout my [2:42:01] neighborhood. [2:42:12] >> We see what this is. [2:42:12] My children and grandchildren [2:42:13] are curious about the cigaret [2:42:14] butts and pick them up to play [2:42:14] with them. [2:42:19] So you have political opponents [2:42:27] in cities meeting looking to [2:42:29] put in their little hands and [2:42:30] clothes become contaminated [2:42:30] with these toxic substances [2:42:35] even though they're not smoking [2:42:35] them By touching these products [2:42:36] the chemicals can come into [2:42:37] contact with their bodies and [2:42:42] consume it. [2:42:43] >> Yes. [2:42:44] In the study on tobacco use and [2:42:48] throwing these products on [2:42:49] the ground has become [2:42:49] normalized and that is not [2:42:50] okay. [2:42:57] >> And where they put it that [2:42:57] is because then what are you [2:43:00] standing against in a context [2:43:01] of combustion popsicle Instead [2:43:02] of being able to relax while my [2:43:03] children and grandchildren play [2:43:03] outside? [2:43:08] >> I'm constantly worried that [2:43:08] they will come into contact [2:43:09] with this toxic litter. [2:43:13] But I know that it's important [2:43:13] that in especially in what is [2:43:17] seen a little bit most of our [2:43:17] children deserve to be able to [2:43:18] play in a clean and safe space [2:43:19] without the risk of becoming [2:43:21] sick or being exposed of [2:43:22] tobacco related substances that [2:43:28] is toxic that can duplicate [2:43:29] tobacco. [2:43:29] But I know so many fundamental [2:43:34] issues that only that I see [2:43:39] programs but I'm exactly sick. [2:43:40] >> The amount of tobacco [2:43:41] product waste is harmful to our [2:43:41] environment and our community [2:43:45] just as there are programs to [2:43:46] collect and recycle recycle [2:43:53] hazardous products. [2:43:54] >> What's the point? [2:43:58] What is the picture that that [2:44:03] hazardous product such as [2:44:03] batteries and motor oil We [2:44:04] should also implement programs [2:44:05] to collect and recycle tobacco [2:44:05] waste. [2:44:11] For me that is a ticket to [2:44:12] the polls. [2:44:16] Some people say But what about [2:44:16] media? [2:44:17] >> Our is asking you prioritize [2:44:20] our community and the health of [2:44:21] everyone. [2:44:21] San Diego represents itself as [2:44:22] a clean, safe and family [2:44:29] friendly city and in particular [2:44:29] political. [2:44:33] >> And as it stands city must [2:44:33] get to win. [2:44:34] >> However, our current [2:44:34] policies do not reflect that [2:44:35] standard. [2:44:39] We ask that you take action. [2:44:40] >> Did I say positive things? [2:44:40] Thank you for your time and [2:44:41] attention. [2:44:45] I'm grateful for our witnesses [2:44:45] . [2:44:46] >> Next is Korina Vega. [2:44:49] If you can please unmute [2:44:50] District eight. [2:44:50] I continue to be baffled that [2:44:51] many necessary programs are [2:44:56] partially or fully cut off and [2:44:57] we're constantly told there's [2:44:57] no money when the department [2:44:58] year after year increases their [2:45:02] budget at the expense of every [2:45:03] citizen safety health [2:45:03] especially the safety of our [2:45:04] brown and black brothers and [2:45:08] sisters who if I remind you are [2:45:09] seven times more likely to [2:45:09] experience unnecessary force [2:45:12] four police officers and nine [2:45:13] times more to be charged with [2:45:14] resisting an officer all while [2:45:18] crime has been down. [2:45:19] I was at the church meeting [2:45:20] with 15 other comrades for that [2:45:23] technology presentation and I [2:45:24] can not support the police [2:45:25] department or them getting more [2:45:25] surveillance technology. [2:45:26] They do not keep all members of [2:45:30] the community safe. [2:45:31] The city of San Diego is a [2:45:32] large community. [2:45:32] When you aren't true community [2:45:35] if you see one member [2:45:36] struggling you balance their [2:45:36] need by looking at who has an [2:45:37] excess to share To alleviate [2:45:42] that need. [2:45:43] At dpd has enough excess to fix [2:45:43] our city's budget and then some [2:45:47] We do not need to invest 2 [2:45:47] million a year with a lpr for [2:45:48] surveillance like Darth Vader [2:45:53] supports nor an underwater [2:45:54] rovers or smart glasses. [2:45:55] There is no tough call in [2:45:55] saying that truth. [2:45:59] The truth that all hail pr [2:46:00] surveillance is a threat to our [2:46:00] constitutional rights. [2:46:05] The whole nation agrees. [2:46:06] Tony's video has gone viral [2:46:06] internationally the left, [2:46:07] the center and the right here [2:46:11] in this country are in [2:46:12] agreement that our rights [2:46:12] matter, our environment matters [2:46:13] And this technology is not [2:46:17] about safety but rather 24/7 [2:46:18] surveillance to keep the rebel [2:46:18] scum in check. [2:46:23] Like in any dictatorship there [2:46:23] are enough billions in [2:46:24] the world to take a moral [2:46:25] stance and please be a hero. [2:46:30] >> Thank you. [2:46:31] Our next speaker is Roseanne [2:46:37] Barr started by opening [2:46:38] Parabolas which will crossover [2:46:42] across the translation. [2:46:49] >> Like what? [2:46:49] I'm. [2:46:50] What about cutting open it? [2:46:50] Why not? [2:46:54] Like I said when you know. [2:47:00] Good afternoon to City council [2:47:01] My name is Roseanne. [2:47:02] Can also be the funny bone and [2:47:03] people it's not that typically [2:47:10] member of the community. [2:47:10] I'm here as a constituent a [2:47:12] concerned mother about tobacco [2:47:13] product waste on the streets of [2:47:19] San Diego. [2:47:29] The folks that call my mother [2:47:33] generally in uniform people [2:47:38] from discarded tobacco products [2:47:39] are not just litter they're [2:47:43] most commonly littered consumer [2:47:43] waste product in the world and [2:47:44] preventable source of plastic [2:47:48] pollution That's going to [2:47:56] become apparent. [2:47:57] Also pretty interesting that [2:47:59] people will the exposure to [2:47:59] toxic chemicals and increase in [2:48:00] cleanup costs to cities like [2:48:12] San Diego With that in on our [2:48:18] fans and what it can throw [2:48:22] people making or farming one [2:48:26] way that we know what I bet [2:48:27] people do not realize that [2:48:27] tobacco litter contaminates our [2:48:28] water our land and environment. [2:48:33] For example, in my building my [2:48:34] upstairs neighbors smoke When [2:48:34] they finish they throw their [2:48:35] cigaret their cigaret waste [2:48:36] outside their home. [2:48:44] >> I think I'll be honest i [2:48:50] pick them to be the nails in my [2:48:55] as I get on to something before [2:48:56] it becomes as much attention as [2:49:00] I get it and it ends up inside [2:49:01] the homes below They do not [2:49:02] recognize how their actions [2:49:02] affect the lives of the people [2:49:09] around them And a baby was just [2:49:09] born with a heart defect. [2:49:13] They know somebody I tell them [2:49:18] to be. [2:49:28] I don't think they can And then [2:49:29] and science has shown us [2:49:30] the consequences of tobacco use [2:49:30] including exposure to [2:49:33] secondhand smoke. [2:49:34] >> We have to protect children [2:49:34] from the harm caused by [2:49:42] tobacco, nicotine influence [2:49:43] things in anything we politic. [2:49:47] I think that lacking in some [2:49:48] evil form very thankful for [2:49:57] that think this is what we can [2:49:58] do We ask that you take action [2:49:58] and implement a policy that [2:49:59] helps protect the people of San [2:50:00] Diego from the harm caused by [2:50:00] tobacco. [2:50:01] Thank you for your time and [2:50:03] attention and I just want that [2:50:03] does conclude on agenda public [2:50:04] comment for today's meeting. [2:50:04] >> All right. [2:50:05] Thank you. [2:50:09] City clerk With that will turn [2:50:09] it over to the office of [2:50:10] the city attorney Is there [2:50:10] anything to report out in [2:50:11] closed session? [2:50:14] There's nothing to report [2:50:14] today. [2:50:15] All right. [2:50:15] Thank you for that. [2:50:16] And with that we will now [2:50:16] adjourn council to [2:50:19] the regularly scheduled council [2:50:23] meeting on Tuesday AUGUST 25th,
