Um I think I believe it was through Cobb County um [22:10] somewhere in East Cobb that we had to go to and was really I'd say [22:17] insight on how I guess city by city all licenses varies [22:26] on how strict they are. So that was eye opener for sure. [22:32] Can you what are the processes that you that you'll have in place at Smyrna Gas [22:36] Enterprises in order to uh check IDs and verify age? [22:40] » So as of right now we do uh implement scanning all IDs. Um doesn't matter if [22:47] you 50 or if you're 10 18 you're getting IDed. And also we have a date right [22:56] behind the I guess employee employee customers that show today's date with [23:03] 2020 20 with 21 being the age verification. [23:08] And then we also do um random checks with um employees. [23:15] We'll send a mystery shopper, have them come pick one thing up, and if they get [23:22] IDed, they passed. If not, you get uh I guess written up, and we take like a [23:30] penalty out their pay for not following uh orders. [23:35] » Is that check integrated into your POS system or is that a manual check [23:39] integrated POS system? Okay. Mhm. >> Now, what type of training do you [23:43] provide to your employees to ensure that they understand that POS system and that [23:47] they are doing the checks correctly? So what we do is we also show them YouTube [23:52] videos that I guess our sicko representative has showed us on how to [24:01] um make sure that every single alcohol items that we do have or tobacco, they [24:08] all have to be scanning and before they're able to bypass it or press [24:15] enter, they have to enter the date. So it tell them automatically if that [24:19] person is 21 or not. And there is no way to bypass it but just by saying okay you [24:25] have to enter a date. That's one way. And then um how I said was just mystery [24:32] shoppers will do it once a month. They might come two times in one day. They [24:36] might come um one week. They might come four times. [24:41] It just depends on um what the company does. [24:45] » Okay. How many hours do you spend in the store now? So, this property is um right [27:54] located on the south side of Hayes Drive um which is off of King Springs Road and [28:00] is currently occupied by an existing two-story home that was recently [28:04] completed um back in 2022 as well as a pergola that is in the rear yard. The [28:09] applicant is proposing to add a pool in addition to this pergola and retain both [28:14] on the property. Our ordinance does require only one accessory structure per [28:18] lot. uh the pergola and pool both count and thus the variance is required. [28:25] However, both of these uses are are different. Uh the pergola and the pool [28:29] will be used simultaneously but again offer different uses for the property. [28:33] So the variance is not self-created due to the size of the lot and the [28:39] location of the pool. No other variances are needed. No setback uh reductions, no [28:44] imperous surface area increases. So this is the minimum variance needed to allow [28:49] for both of these to remain on the property. At the time of this report, [28:53] community development has not received any calls or emails in opposition to [28:57] this request. Um and after reviewing the variance application, we do support the [29:01] request and do recommend your approval with just the standard condition. Uh so this lot is located on the western [31:06] side of Call Your Gate Court which is in the Collier Yourgate subdivision. Uh the [31:11] property is currently own um excuse me currently occupied by an existing [31:15] two-story house as well as a 20ft private drainage easement at the far uh [31:20] back of the property. The applicant is proposing to just extend an existing um [31:26] patio area in the back with a new roof and that'll have a more of an enclosure [31:31] in the back um for a little spa that will be installed. Uh the existing [31:36] property is already over the maximum imperous surface area by 2%. This [31:42] occurred when the house was built um and the proper variance was not obtained at [31:47] that time. However, with this additional 118 square feet, this further brings the [31:54] property over the imperous surface area to 46.7%. [31:59] However, even though the property was already over, our uh section 1102 does [32:05] say that no non-conforming building can be extended without having to bring it [32:09] to proper codes. Thus, the variance here today. Um however since this was an [32:14] existing condition on the property this variance is not self-created. [32:19] So after this deck extension the property again will be over the [32:23] allowable imperous surface area by only 1.7%. [32:28] Um in fact the applicant had already installed a French drain and [32:32] infiltration system back in 2017 that's already acting as a water quality for [32:37] the property. Um the engineering plans reviewer has already looked at this and [32:41] has supported this variance without the need for any additional mitigation. [32:46] Uh we believe that this is the minimum variance needed to create any extension [32:50] on this property. Um and at the time of this report, we have received no emails [32:54] or phone calls in opposition to this request. After reviewing the variance [32:59] application, staff does support the request and does recommend your approval [33:03] with again just the standard stipulation that approval of the requested variance [33:07] shall be conditioned upon substantial compliance with the site plan submitted [33:11] with the variance application.
