[0:33] >> Carey ready, Jason, you [0:39] good. Good evening, everyone. [0:41] I would like to read called a [0:44] special meeting to order on [0:47] JULY 8th 2025. And before we [0:50] begin the roll call, I would [0:53] like to note for record that [0:54] commissioner has school is [0:57] appearing by zoom today under [0:59] exceptional circumstances. [1:00] This meeting was called an [1:00] emergency basis in response to [1:04] the letter received from the [1:05] Attorney general on JULY [1:08] second, 2025. And therefore [1:09] her remote attendance is [1:11] permitted. Do I have it? Any [1:16] objections? Hearing? No [1:17] objections. Her remote [1:19] participation is here by [1:21] approved and she will be [1:22] considered fully present for [1:23] the purposes of this meeting. [1:25] Kerry, can you call the roll? [1:26] Please? Commissioner Carey [1:27] here, commissioner Castillo [1:31] present Commissioner Haskell. [1:32] Commissioner Hoover here. [1:35] Commissioner Kaufman. [1:35] Commissioner Lee here. Mayor [1:37] Henry gets here. Please stand [1:42] for the Pledge of Allegiance. [1:44] I pledge to the flat United [1:47] States of America and to the [1:49] Republic for which it stands. [1:52] One nation. Got indivisible [1:53] with liberty and justice for [2:06] all. Approval of agenda. [2:07] >> Are there any changes to [2:13] the agenda? Do I have a [2:14] motion? So moved motion by [2:16] Commissioner Carey to have a [2:17] second second second by [2:18] Commissioner Lee all in favor [2:20] say Aye. All right. Any motion [2:24] carries. Resolutions item [2:25] number one authorizing and [2:26] directing the city manager to [2:29] enter into the 28 hour. [2:31] >> 2.87 g voluntary memorandum [2:32] of agreement with United [2:33] States Immigration and Customs [2:37] Enforcement. [2:39] >> Okay. So I am sponsoring [2:40] this resolution to direct our [2:44] city manager enter into the [2:46] 2.87 g voluntary memorandum of [2:47] agreement with United States [2:49] Immigration and Customs [2:52] Enforcement. The 2.87 g [2:54] Program has 3 models. The jail [2:56] enforcement model, the task [2:57] force model and the warrant [3:01] service officer model. And as [3:03] our police chief indicated at [3:04] our last meeting, the option [3:05] that had been signed was the [3:09] task force model which focuses [3:11] on immigration enforcement [3:14] during routine policy duties. [3:15] My vote at that time was not [3:20] intended as a rejection of [3:21] cooperation with United States [3:23] immigration and collect [3:23] Customs enforcement, nor was [3:26] in an attempt to violate [3:26] Florida law. Rather. My [3:28] decision was based on guidance [3:31] from our interim city attorney [3:31] who determined that the [3:33] existing agreement was not [3:34] valid because it had been [3:37] signed by the chief of police [3:39] rather and the city manager [3:41] has required under our city [3:43] charter. I supported the vote [3:45] to terminate the existing [3:46] agreement so that a new valid [3:49] to 87 agreement could be [3:50] properly considered. And if [3:51] approved, probably executed by [3:53] the city manager in accordance [3:56] to our charter requirements. [3:57] While there are different [3:58] views about the substance of [4:01] the agreement itself, position [4:02] remains focused on ensuring [4:06] that the city of Key West [4:07] complies with both state law [4:09] in our own governance [4:09] standards. So with that, too, [4:13] we have public comments we do [4:15] prior to Commissioner Kaufman [4:17] has sent a statement that he'd [4:17] like me to read. He's unable [4:20] to based on his location. [4:24] >> So I will his statement. [4:25] First. Would like to say that [4:26] I'm extremely disappointed [4:28] that can't be there tonight. [4:28] I'm out of the country on a [4:30] long planned family trip. But [4:32] this meeting, one of the most [4:32] important we faced was [4:33] scheduled without checking of [4:35] all commissioners could [4:35] attend. That's not just [4:37] disrespectful. It's [4:39] unacceptable. 2 of us are gone [4:42] and the still moved forward. [4:43] Why? How is the state chosen [4:45] where there any discussion [4:45] where there was there any [4:47] discussion any transparency or [4:50] is it another behind the [4:50] closed door move like our [4:52] former city manager was [4:54] ousted? Nevertheless, let me [4:55] be clear. I support our [4:57] police. I fully support our [4:59] chief and I absolutely stand [5:00] with our immigrant community, [5:01] our neighbors, our workforce, [5:03] our friends. I think everyone [5:03] showing up tonight in defense [5:05] of human dignity and public [5:06] safety. Unfortunately, we [5:08] landed in this legal mess [5:11] because we didn't get proper [5:12] guidance before the JUNE 30th [5:12] vote. We should have had [5:13] expert legal counsel from the [5:18] start. Why didn't Now instead [5:19] of slowing down and [5:20] considering all our options, [5:21] including joining South South [5:23] Miami's legal challenge, the [5:26] mayor rushed to reverse course [5:27] the city's expert legal [5:28] counsel has confirmed we are [5:30] in a strong position by doing [5:30] nothing. We haven't entered or [5:33] rescinded in agreement. [5:33] There's no legal liabilities. [5:37] So why panic? The mayor [5:37] scheduled this meeting prior [5:38] to discussion the legal [5:40] options with the attorneys. [5:42] Why not wait for the courts to [5:43] decide whether the 2.87 g [5:45] Agreement is mandatory or [5:47] voluntary. Florida law does [5:48] not require cities to sign [5:51] 2.87 g it only applies to [5:53] sheriffs. Our police chief [5:53] signed that agreement without [5:54] public input or commission [5:56] approval. That's a problem. [5:57] And we were right to recognize [6:01] it is void. If the mayor's [6:02] resolution is approved, which [6:04] I do not support to enter into [6:05] the 2.87 agreement, that at [6:05] least let's fight in court [6:07] alongside South Miami. But [6:09] make no mistake that entering [6:11] into the 2.87 g Agreement is [6:12] the worst option for our [6:14] community. He depends on [6:16] tourism. We depend on trust. [6:17] Turning our police into ice. [6:19] Agents erodes both. This isn't [6:20] about politics. It's about [6:22] public safety and economic [6:23] survival. There are no [6:24] sanctuary cities in Florida. [6:27] We comply with the law. But we [6:28] don't need to go further than [6:30] the law requires, especially [6:30] not when doing so makes us [6:33] less safe and more vulnerable [6:35] to lawsuits. We took a stand [6:36] for our values on JUNE. 30th [6:38] South Miami stands with us and [6:38] we should stand with our [6:39] Haitian neighbors now tp tps [6:43] is at risk and this is a [6:44] moment for more clarity. [6:45] Please do not let fear win. Do [6:48] not rush. We do not abandon [6:49] the people we swore to [6:50] protect. I respectfully urge [6:50] my fellow commissioners to [6:53] postpone this vote until the [6:54] courts have determined whether [6:55] the city is legally obligated [6:57] to enter this agreement. [6:58] Additionally, such an [6:58] important decision should be [7:00] made when the full commission [7:02] is present approving the [7:03] mayor's resolution at this [7:03] time is premature and [7:04] unnecessary and could place [7:06] both the city and our [7:09] residents in a disadvantage [7:10] position. I think Kerry before [7:12] before you get started. [7:15] >> I like clarify 2 things [7:16] before you get started. [7:20] >> Number one, for the record, [7:21] I did not know that there was [7:22] 2 commissioners that we're out [7:23] of time when this meeting was [7:24] called. I learned I learned [7:27] this the win Facebook. There [7:30] was a Facebook post that there [7:32] was a story to write because [7:34] of 2 commissioners being out [7:35] of town on Saturday. I called [7:39] you to say, are there to [7:39] commissioners that not going [7:41] to be present at this meeting. [7:42] And you told me at that time [7:45] that is correct that they're [7:47] going so join by Zoom. And I [7:48] asked you, who are those 2 [7:49] commissioners and then you, [7:50] Tony, so want to correct that [7:51] record. And then the other one [7:53] is how did you send that [7:53] statement? Was that by the [7:55] Internet? It was an e-mail, [7:59] ok? Thank you. All right. Can [8:00] you call for public comment, [8:01] please? Yes. So prior to [8:03] public public comment, I do [8:04] want to read one other section [8:06] of done this in the past from [8:07] our resolutions. This is [8:08] pursuant to resolution 25 [8:09] dash, 1, 4, 3, [8:13] >> Section 4 b members of the [8:14] public address in the City [8:16] Commission shall observe order [8:17] and decorum, including the [8:18] combining confining of remarks [8:21] to the item at hand. All [8:21] speakers must address their [8:23] comments to the presiding [8:23] officer rather than individual [8:27] commission members or staff a [8:27] person engaged in disorderly [8:28] conduct in the commission [8:29] chambers pursuant to Section 2 [8:31] dash, one of the code of [8:33] ordinances maybe removed upon [8:34] a complaint of the presiding [8:36] officer to the police. I'm [8:38] going to call 3 people at a [8:39] time. Everyone will have 3 [8:40] minutes. I'm doing 3 in case [8:44] some of the people are out. If [8:45] somebody could go get them, if [8:46] call them and they're not in [8:47] chambers, that would be great. [8:50] So we're going to start with. [8:54] Lucy Hawk, Chris McNulty and [8:55] give that So if you're the [8:57] subsequent speakers, please be [9:00] ready. And we are going to let [9:01] the clock the buzzer has. [9:02] Sometimes you don't hear it. [9:03] So we are going to have to [9:03] keep everything to 3 minutes. [9:04] We have many people signed up. [9:11] Ok, thank you. I think the [9:11] mike needs to get turned Sorry [9:17] perfect. [9:18] >> Good evening, mayor and [9:19] commissioners. My name is Lucy [9:21] Hawking. I'm speaking on [9:22] behalf of 133 members of the [9:24] community who could not be [9:26] here tonight. You see all [9:27] these forms. These are the [9:29] people who speaking majority [9:30] of the people who filled out [9:30] these forms live in the [9:33] Bahamas Village community [9:34] members of that community [9:35] spent hours over the weekend [9:38] canvassing the neighborhood to [9:39] spread awareness about what's [9:41] going on and to get their [9:42] input. We asked 3 simple yes [9:45] or no questions based on [9:46] tonight's agenda. There's a [9:46] lot of those people are not [9:48] able to be here. The questions [9:52] that we asked where item one [9:53] should cue spd enter into a [9:57] 2.87 g agreement. Item 2. [9:59] Should the city see clarity [10:00] from a court through a lawsuit [10:00] against Governor DeSantis or [10:02] join the city of South Miami [10:03] said to determine the legality [10:05] of the requirement to enter [10:08] into 2.87 g item 3. So the [10:12] city expressed support 4 [10:13] extend extending tps for [10:16] Haitian community. Of the 133 [10:19] papers that I'm holding 130 [10:21] people think we should uphold [10:24] the decision that was made [10:26] last Monday. 127 people also [10:28] think we should seek clarity [10:30] through lawsuit and 130 people [10:31] also support our Haitian [10:34] community members. These [10:37] numbers are not just numbers. [10:38] These are people that live on [10:40] this island who are not here [10:41] to speak for a variety of [10:45] reasons, work fear, inability [10:47] to be public. That kind of [10:49] thing. But most of these [10:50] people are from the Bahamas, [10:51] alleged community and live in [10:53] Commissioner Castillo's [10:55] district based on those [10:56] opinions. We strongly urge you [10:56] to uphold the decision that [10:59] you made last Monday. These [11:00] people are very proud of what [11:01] you did last week. We hope you [11:11] can honor that. Thank you. So [11:12] if Chris Bentley and then Lisa [11:16] Chronis. [11:17] >> How America's City [11:18] Commissioners, my name is [11:19] Chris McNulty. I'm a resident [11:21] of district one. I'm also the [11:21] executive director of the [11:24] Queer Keys Community Center. [11:26] I'm also gay. Also queer. I'm [11:28] also non binary and also [11:31] Gemini. And I do understand [11:32] that my big beautiful earrings [11:32] might be very loud. Some will [11:36] try to speak over them. And I [11:38] just want to express my [11:39] frustration as well for the [11:41] emergency nature of this [11:42] meeting. I do not feel that [11:44] there is an emergency on this [11:46] island. The only emergency [11:47] that I'm aware of is the [11:49] paranoid delusion of our [11:49] PRESIDENT Who thinks there's [11:50] something happening in this [11:55] country. I also understand [11:56] that based on the state [11:57] attorney general's letter that [12:01] you are all worried about your [12:01] jobs and your positions here [12:05] and I understand being worried [12:08] about that. I but however, I [12:09] also think that that is a moot [12:10] point because if we do sign [12:13] and that's to 87 g Agreement, [12:16] I do think you your jobs are [12:22] up for for release. Anyway. [12:24] And I also would like to [12:25] express on behalf of my friend [12:27] who I mentioned last time I [12:28] was here. She is an immigrant. [12:31] She is here on a work permit [12:32] and I would like to speak on [12:33] her behalf because he's afraid [12:38] to be here. So she says. As an [12:39] immigrant to this country, I [12:41] was drawn here by the promise [12:42] of happiness, peace and [12:42] justice that I lacked in my [12:46] homeland. Unfortunately, after [12:48] a decade of living here, I [12:49] have witnessed a disturbing [12:51] trend of racism in America get [12:52] i remain hopeful that we can [12:55] rise above this challenge. We [12:56] are all immigrants to this [12:57] country with our ancestors [13:00] hailing from Foreign shores by [13:01] acknowledging our shared [13:01] heritage, we can tap into a [13:03] deeper sense of empathy and [13:04] understanding. I'm deeply [13:05] concerned about my friends [13:06] were currently incarcerated [13:08] without just cause simply [13:10] because of their immigration [13:12] status. It is crucial to [13:13] recognize that they are [13:15] hard-working, kind and decent [13:15] individuals who contribute [13:18] positively to society. Well, I [13:20] I agree that criminals and [13:20] individuals who pose a threat [13:22] to society should be held [13:24] accountable. I firmly believe [13:25] that the current system is [13:25] unfair and disproportionately [13:28] targets innocent people who [13:30] among us has not inadvertently [13:31] committed a minor infractions [13:33] such as running a red light. I [13:34] urge you to reflect on your [13:36] own actions and be honest with [13:37] yourselves. By doing so we can [13:38] cultivate a more compassionate [13:40] and inclusive society [13:41] together, we can create a [13:41] brighter future where everyone [13:44] has the opportunity to thrive. [13:46] If we unite and advocate for [13:47] justice, we can bring about [13:47] transformative change and [13:49] there is strength in unity and [13:50] together we can overcome even [13:54] the most daunting challenges. [13:54] And also like to say that I [13:56] also support our police force [13:58] and I am wondering how they [14:01] feel about using our taxpayer [14:04] dollars on their regular pay [14:05] to support ice was getting [14:05] bonuses through our tax [14:08] dollars from that big focus [14:12] with that, I will just I urge [14:13] you to deliver us from evil. [14:21] Thank you so much. Have to vet [14:24] Lisa and then Madeline bomb. [14:27] Good afternoon, MADAM Mayor [14:27] and commissioners. [14:28] >> My name is the baddest one, [14:29] although Lee and I'm a 61 [14:33] year-old native of Key West. [14:33] I'm a 4th generation Kong [14:34] whose ancestors migrated from [14:38] Spain, Cuba and the Bahamas. I [14:38] attended the city commission [14:39] special meeting 2 weeks ago in [14:41] left feeling hopeful and so [14:44] proud to have such courageous [14:45] open minded individuals to [14:46] represent this city that I [14:48] love and call home. I'm [14:49] fortunate enough to have [14:50] worked with children from all [14:52] over the world, including many [14:56] Latin countries, Haiti, China, [14:56] Russia, the Czech Republic. [14:59] And is that the stand to name [15:00] a few? I have had the [15:01] opportunity to retool and with [15:02] them about many things, [15:04] including the civil rights [15:06] movement and activists heroes [15:07] like Martin Luther King [15:09] Junior, Rosa Parks, Ruby [15:11] Bridges, protest, boycott [15:12] Siddons and how those who [15:13] participated were simply [15:16] asking for equal equitable [15:16] treatment and the right to [15:20] live a good life. Many [15:20] students said I would have [15:21] fought them or I would have [15:22] said this or that. [15:23] >> But one student looked at [15:24] me and asked what would you [15:28] have done? I thought for a [15:30] moment and said I honestly [15:31] don't know because I was not [15:32] there, but I hope that I would [15:32] have been brave enough to do [15:35] the right thing. I'll never [15:38] forget that. I never thought [15:38] i'd have the opportunity to [15:39] find out what I would have [15:42] done. But here we are and I [15:43] owe it all to to all of my [15:44] children to stand up and speak [15:45] out on their behalf because [15:47] they can't do it for [15:49] themselves to have to do the [15:51] right thing. And yes, I said [15:52] my children because they are [15:56] they're all our children. I've [15:56] had students whose parents [15:58] were deported during the last [15:58] Trump administration. And [16:00] though this was traumatic for [16:01] them, they had one parent who [16:04] was allowed to stay behind the [16:05] saving grace, then was that [16:06] these family members were sent [16:09] back to their country of [16:11] origin and as problematic and [16:12] dangerous as that MAY have [16:14] been, at least it was familiar [16:15] territory. Now people who have [16:16] committed no crime safer, [16:19] wanting and hoping to ensure [16:20] safety an opportunity for [16:21] themselves and their loved [16:25] ones are being terrorized, [16:26] kidnapped, shackled and [16:27] shipped off to concentration [16:27] camps and who loves with no [16:29] hope of release. These people [16:31] are not criminals. They're [16:33] hardworking members of our [16:34] community. Their parents, [16:35] sons, daughters, Brothers, [16:37] sisters, friends and [16:39] neighbors. We cannot stand for [16:41] this. We cannot ask our law [16:43] enforcement officers to comply [16:44] if the risk of becoming [16:46] dehumanized and radicalized as [16:48] weapons inflicting harm on our [16:50] most vulnerable population. So [16:52] I ask you to leave with your [16:56] heart. The brave. Continue to [16:58] stand with our community, our [16:58] beloved community be on the [17:02] right side street. Empathy is [17:03] all that prevents us from [17:06] becoming immune to suffering. [17:07] Once we sacrifice our humanity [17:10] cannot get it back together. [17:13] We are one human family. We [17:14] are all the same. Same for the [17:16] circumstances and luck of our [17:16] birth. Thank you for [17:27] listening. [17:27] >> Lisa Matalin and then Sarah [17:28] did not. [17:32] >> Good evening. Name is Lisa [17:35] Curtis. I moved here in 1989 [17:35] at work. Is a paralegal. And [17:38] so 2000. Then it became a [17:39] registered nurse and took care [17:40] of this community. Everybody [17:42] and this community got the [17:44] same care for me. What I'm [17:48] watching is horrific. It's [17:49] it's a terrific and we have [17:52] the power because when I [17:53] looked at the 2.87, g is a [17:56] voluntary. It's voluntary [17:59] cracked. So if it's voluntary [18:01] and work us were one human [18:04] family. Why are we voluntarily [18:06] assisting? Why don't we join [18:07] with MR. Huffman had said if I [18:11] heard him correctly. Wait for [18:15] the lawsuits filed lawsuit. [18:16] This is a small community. I [18:18] am begging you. These are [18:18] people we know that we've [18:21] worked with for 20 years. Some [18:24] of them they're hard workers. [18:25] It's not okay. I'm not put the [18:26] police officers are awesome [18:30] too. They're awesome. We love [18:31] our police officers put their [18:33] community police officers to [18:34] help us. That means every one [18:37] of us. We can't cherry pick. [18:39] This reminds me of 1930's. I'm [18:40] not exaggerating. Thank. They [18:44] didn't start for the end, but [18:45] we have the ability to make a [18:45] little bit change right here [18:48] in the city of Key West. We [18:50] can show the world that we [18:51] care. We're going to protect [18:52] every human being no matter [18:56] what. The criminals are in [19:00] prison, they can send them. [19:00] Why are they going after [19:01] people that are taking care of [19:03] patients? That are working in [19:06] a nursing home? Make that make [19:10] sense to me. But before it [19:10] doesn't make sense to me, [19:11] please do not sign up to [19:11] j [19:12] '6*;^/pd3gJmlhoxk!Q7,oaey y\l%n&u [19:12] 0[[ [19:12] Yy [19:12] I~h$^s [19:13] t&@+@/@,@0l)L(@@ [19:13] @ [19:13] 5@+&$ [19:13] I [19:13] p1b_ep [19:13] 9b6 [19:19] Hl> Up in the Everglades. [19:36] >> And in it. [19:38] >> Hence in a swamp with this [19:40] key knows that have illnesses [19:44] and water on the floor. We [19:45] have to actually, I think put [19:46] a barrier around the [19:49] immigrants and protect them. [19:49] For all immigrants to at the [19:53] end of the day, I'm not an [19:54] American Indian. I'm not going [19:56] to tell my family came here [19:56] from Italy to escape whatever [19:59] they were trying to escape. [20:00] And I'm asking for compassion [20:01] from city. I know. Has it. You [20:04] have it. Do the right thing. [20:16] Please. But the law work. [20:17] >> Madeleine Sarah and then [20:22] Kirby Myers. I am Reverend [20:24] Matalin, pastor of Qs, United [20:26] Methodist Church just over a [20:28] week ago, I left this place [20:29] feeling great joy and pride in [20:31] all of you for having the [20:33] courage to take the stand for [20:34] those in our community who are [20:36] living in fear. Now, it seems [20:41] for some of you, your fear is [20:42] causing you to second guess [20:44] the brave and morally [20:47] admirable decision you made [20:48] last week. Now I have to say [20:51] that I understand fear. I do. [20:51] I have lived a great majority [20:53] of my life, fearful that [20:57] people would not like me. So I [20:58] did with the bullies and the [20:59] people in power told me to do [21:02] even when I knew was wrong. [21:03] Fear is cause me to do things. [21:07] I am not proud of one of those [21:08] things is that I remain silent [21:11] for many years as our [21:12] denomination debated the [21:16] ordination of lgbtq clergy and [21:16] performing same sex weddings [21:19] because I was afraid I would [21:22] not be ordained. In other [21:23] words, I was afraid I would [21:25] lose my job. Fear is real. And [21:28] I understand it. But here's my [21:31] question for you. Has the [21:32] entire country watches on [21:34] which side of history. Would [21:36] you like to be found? Do you [21:37] want to be the people who [21:40] allowed fear to dictate their [21:41] actions or do you want to be [21:43] the people who found the [21:44] courage to do what is right, [21:47] no matter how scary that MAY [21:49] be last week. You are brave. [21:50] In other words, in the words [21:52] of the prophet Micah, you [21:52] sought justice. You loved [21:54] mercy and walk humbly with [21:56] GOD. And now you are allowing [21:57] the bullies to cause you to [22:00] second. Guess that. I want you [22:01] to hear this. I still often [22:04] fear when I enter the pulpit [22:06] to preach and even standing [22:08] before you. But I know 2 [22:10] things being liked in staying [22:12] in my comfort zone is far less [22:13] important than standing up for [22:15] those who cannot stand up for [22:16] themselves and being silent is [22:19] not an option. My personal [22:23] journey I realized on JUNE 12, [22:24] 2016 when 49 people died in [22:27] the polls. The Pulse nightclub [22:28] massacre that I could no [22:28] longer remain silent and [22:32] silence is not an option. Now, [22:32] as are our neighbors are in [22:38] fear. I often use quotes in [22:39] movies, firms from movies and [22:39] my sermons. So let me leave [22:42] you with this. This quote from [22:46] we bought a zoo. Sometimes all [22:49] you need is 20 seconds of [22:52] insane courage just literally [22:52] 20 seconds of embarrassing [22:54] bravery and I promise you [22:55] that's something great will [22:58] come of it. This is your 20 [23:09] seconds. Thank you. And So [23:14] curvy and then Daniel Mothers. [23:15] >> Hi, Good evening. My name [23:16] is Kirby Myers. And I've been [23:18] a key West residents since [23:20] 2012. I stand here tonight [23:21] because like you, I'm scared [23:25] and I'm angry. I know each of [23:26] you have been threatened by or [23:27] government for taking a stand [23:29] to do the right thing. I know [23:31] you've been told if you stand [23:31] your ground here tonight, [23:34] retribution will be served a [23:35] fear tactic. Our government [23:36] has embraced to control those [23:38] who speak out against [23:40] censorship, women's rights, [23:41] minorities and others without [23:44] a voice. So tonight with the [23:46] understanding of the threats [23:47] against you and at the risk of [23:48] being a legally removed from [23:51] this platform by our [23:51] governor's office. I asked you [23:55] a greater calling. And while [23:56] it's much easier path to bend [23:57] and to those in Washington who [23:59] hide behind the masks and [24:00] violence, they continue to [24:02] unleash a their own citizens [24:04] and neighbors. I asked you to [24:05] be the public servants who [24:08] were elected to be for us for [24:09] our children. And for those [24:12] who come after us. The world [24:14] is watching Key West. And [24:16] while this measure is a [24:18] symbolic vote and perhaps a [24:18] vote in your minds that is not [24:20] worth losing your position [24:23] over. I challenge that belief. [24:24] I believe your stance against [24:27] this evil spreading across our [24:28] nation is exactly what you are [24:31] called to do. Because 30 years [24:33] from now, most of us will not [24:33] be here. Put our children [24:37] well. And our grandchildren. [24:39] Well, and when they look back [24:39] at this night, it could be a [24:41] defining moment in our [24:43] history. They will either look [24:44] back at our local leaders here [24:47] tonight who had an opportunity [24:48] to spread a light across this [24:49] nation and create a model for [24:53] others to follow and fight and [24:55] stand and look at the bullies [24:56] in the eye with unity and [25:00] unwavering conviction. They'll [25:01] look back and recall the [25:05] moment that faded as we cower [25:07] fear and allowed those who [25:09] rule by intimidation and [25:09] violence to once again walk [25:11] for those without a voice. I [25:14] know you are scared, scared to [25:15] lose your positions. Scared of [25:18] the retribution, scared of the [25:19] rhetoric hate being spread on [25:19] social media and the violent [25:21] acts against our communities. [25:22] But if you don't take the [25:24] stand tonight, Bill, I'm [25:26] asking you to stay strong. I'm [25:29] asking you to be brave. I'm [25:30] asking this night to become [25:31] something more than a symbolic [25:33] state from a little island of [25:34] Key West, I'm asking you to [25:38] create a spark, a spark that [25:38] will ignite a flame across the [25:41] state and across this nation. [25:42] One that calls for more [25:43] leaders in towns like us here [25:44] to fight back for those who [25:46] cannot and to stand together [25:47] because if you fight for us, [25:51] we fight for you. As and Frank [25:52] hid in the attic. Fearing the [25:53] inevitable that she would be [25:55] likely abducted by armed [25:56] government forces attempting [25:57] to cleanse communities of [25:58] immigrants in minority. She [25:59] still believed in a world. The [26:00] pope and love and empathy. And [26:03] during that time she wrote. [26:04] How wonderful it is that [26:06] nobody wait a single moment [26:08] before starting to improve the [26:09] world respected commissioners, [26:13] please don't wait. Stay the [26:14] course. Fight for your [26:15] children, your grandchildren, [26:15] fight for the truth and [26:26] nothing. Let's let know. [26:26] >> And you call the next [26:32] Please. [26:33] >> Can you call the next one? [26:34] Please carry Can you call the [26:36] next one? Please? Are you [26:42] Sarah? [26:43] >> So we have Sarah Daniel [26:44] Mothers and then Aaron Stover. [26:46] My name is Sarah Tunnel. It [26:49] I'm a full-time resident. [26:50] Something I think about often [26:56] is time. Time wasted. Time [26:57] calling my representatives who [26:58] rarely pick up the phone. And [26:59] if they do. Don't have any [27:04] answers. Time we stood reading [27:07] a report hoping that the [27:08] public servants listed in the [27:10] report but have the decency to [27:13] do the right thing. [27:15] Acknowledge their wrongdoings [27:18] and pass the baton along to [27:22] people with backbones. The [27:27] time we stood by people only [27:28] live here have time [27:29] complaining about people who [27:31] actually live here full time. [27:32] The people who keep this [27:34] island to life. Time well [27:39] spent. Showing up. But this [27:40] communities to support [27:43] neighbors and insight 13, the [27:46] reputation of a community that [27:46] has always stood up against [27:50] tyranny. Time lost. My friend [27:54] at the corner store, hiding in [27:57] the bathroom until he heard me [27:58] announce myself and then [27:58] walking out shaking and in [28:02] shambles. The time my friend [28:05] spent trying see his dying [28:05] father in another country [28:07] before time ran out. It ran [28:13] out. Like to spend the rest of [28:15] my time and our time quiet [28:16] contemplation and to make it [28:20] count. Whenever anyone in this [28:22] room is ready, please raise [28:25] your hand if you agree that [28:26] keyword should remain a [28:27] sanctuary, a place where a [28:29] person. [28:32] >> But their time is free, [28:35] precious and protected. Except [28:37] in the most serious of [28:39] circumstances. And please keep [28:40] your hands down if you think [28:42] that key West should no longer [28:43] be sanctuary by any definition [29:00] of the word. [29:53] Thank you. Daniel [30:00] Aaron and then Abby Weiss. [30:00] >> I imagine the job of key [30:02] West City commissioner is a [30:05] relatively thankless task. [30:06] Most days are mundane filled [30:07] with small choices about which [30:10] the public will largely never [30:11] be concerned. I imagine the [30:11] moments when your duties are [30:13] thrust into the spotlight can [30:14] be stressful and emotionally [30:18] draining. So I'd like to thank [30:19] you for the courage and [30:21] humanity you showed last week. [30:22] I am deeply appreciative of [30:23] your willingness to hear pleas [30:25] from your constituents. Andrew [30:27] in accordance both with their [30:29] desires and with the of [30:30] inclusivity that has long been [30:30] the heart of the key West [30:34] community. Unfortunately, days [30:35] later, we find ourselves [30:37] asking that same question, a [30:38] question that has become a [30:39] flash point in the battle for [30:43] our cultural identity as we [30:44] approach a crossroads that [30:45] will shape the future of this [30:46] island and be remembered by [30:48] those who come after you. I [30:48] want to place this moment in [30:51] the greater context of the [30:55] nation and of history. We MAY [30:57] be a town of just 20,000. The [30:58] key West is a name that's [31:01] larger than life. Actions on [31:03] this island. Reverberate [31:04] across the nation in a way few [31:07] small towns can replicate. Eu [31:08] ruling last week made [31:09] headlines in New York and [31:12] California, Texas and Ohio. [31:13] Social media accounts with [31:14] millions of followers praised [31:19] bravery. Your choices will be [31:20] mourned or celebrated by far [31:21] more than those who fill this [31:23] room, your voices might be [31:25] heard around the world as [31:26] Florida boycotts explode [31:30] across Europe and Canada. If [31:31] the consensus you reach is in [31:33] line with the image we strive [31:34] to project a culture that [31:37] embraces all regardless of [31:37] gender, sexuality, skin color [31:39] or place birth. Key West could [31:42] become beacon of hope [31:43] separated from the mainland by [31:46] more than our bridges. This [31:48] can be achieved by simply [31:49] delaying a decision on the [31:50] 2.87 agreement until we're [31:53] certain of our legal standing. [31:55] History rarely looks kindly on [31:57] those who see power to [31:57] politicians seeking the [32:01] consolidation of that power. [32:01] We're not talking about the [32:03] glorious actions of those who [32:04] vowed to the wills and [32:06] dictators or governors as they [32:07] stripped their subordinates, [32:08] the capacity to be more [32:11] loving, more kind and more [32:12] compassionate. There is a word [32:14] for describing we're facing [32:17] when leaders enforce their [32:18] agendas, threats, remove duly [32:19] elected officials for [32:20] representing the will of their [32:21] constituents and power in the [32:23] hands of their chosen [32:23] enforcers. We call it [32:27] authoritarianism. America was [32:29] supposed to oppose that [32:31] ideology. We are supposed to [32:33] fight for more freedoms, more [32:34] equality, more distribution of [32:36] power to municipalities, [32:39] cities and individual voters. [32:39] The stories we tell ourselves [32:41] about the greatness of this [32:43] country are filled with pave [32:44] individuals who fought back [32:46] against government overreach. [32:49] Today we're asking you to find [32:49] the courage to be the heroes [32:53] of this particular story and [32:53] make a choice that future [32:55] generations can celebrate. [32:56] Thank you for your time and [33:10] your compassion. Aaron. And [33:11] actually, Richard, what [33:11] comment called Abby [33:12] incorrectly, Richard. And then [33:14] John [33:17] >> MADAM Mayor commissioners [33:17] Stover. I'm a full-time [33:20] resident since 2012. I'm [33:21] reading a letter tonight on [33:22] behalf of Natalia Duke, [33:25] founder of the Keys, [33:26] Immigration Coalition is that [33:26] a country wanted me to share [33:29] her words. She writes, I've [33:30] never been more proud of our [33:32] city that I was last Monday [33:34] when you write leave, what are [33:35] the agreement that force local [33:36] law enforcement erratically [33:38] profile and detain community [33:39] members. I thank you for your [33:41] courage for doing the right [33:42] thing. And yet we must [33:44] continue the course you have [33:46] the privilege and duty the [33:47] vote on what not only will [33:48] make us safer, but what is [33:52] right. The numerous problems [33:53] that come with signing a 2.87 [33:54] g Agreement were clearly [33:57] stated last week in addition [33:58] taking valuable time and [33:58] resources from officers doing [34:00] their actual job. It also [34:03] leads to racial profiling and [34:04] lack of due process, both of [34:05] which have been costly for [34:08] Monroe County in the past in [34:10] 2018 mcso wrongfully detained [34:12] and handed over U.S. Citizen [34:16] Peter Brown to ice. The [34:17] lawsuit brought by splc, an [34:20] aclu in 2018 cost the county [34:21] the taxpayers hundreds of [34:22] thousands of dollars. Do we [34:26] want to be next? I ask you to [34:27] stay strong and not [34:29] voluntarily signed the [34:31] agreement. Let's wait to let [34:31] the courts decide the legality [34:34] of entering the agreement. [34:35] Furthermore, I encourage you [34:36] to join South Miami's lawsuit [34:39] against the state. Multiple [34:40] organizations around the state [34:41] have offered their pro bono [34:44] services to help us understand [34:45] and fight against this [34:47] massive, unconstitutional [34:49] overreach. Moreover, I urge [34:50] you to express your support [34:52] for extending tps for [34:54] Haitians. When I taught in [34:57] adult education in 2011, the [34:58] majority of my students were [34:58] from Haiti escaping damage [35:00] from the earthquake and again, [35:03] from the cholera epidemic. I [35:05] run into them weekly as they [35:05] are embedded in our diverse [35:09] community. Currently, I teach [35:11] yes, well, 2 key West High [35:12] school students and have many [35:13] Haitians students that have [35:15] escaped gang violence. They [35:17] long to feel safe and [35:19] included. Unfortunately, after [35:19] all, they've been doing there [35:21] now scared to even attend [35:22] summer school. We have a duty [35:26] to support and protect them by [35:27] staying strong. We have an [35:28] opportunity to truly show the [35:30] state of Florida and the [35:32] country. What it means to [35:34] actually be one human family [35:39] signed that all you do. Those [35:40] are not my words. I do [35:42] absolutely. Echo them agree [35:43] with them. And I just wanted [35:45] to quickly add that this feels [35:49] like a small boat by a small [35:49] group of people on a small [35:52] island. But you have so much [35:53] power to set precedent. So [35:53] please don't squander that. [36:09] Thank you. So we Richard would [36:15] come John and then fill er. [36:16] >> Hello, my name is Richard [36:19] would come. Iqs. Business [36:20] owner and I live in Old town. [36:21] Thank you for the opportunity [36:26] to speak. I'm opposed to the [36:28] city of Key West entering into [36:30] a 2.87 g agreement with ice. [36:32] I'm very emotional about this, [36:33] but I'll be speaking [36:38] factually. Point number one. [36:39] Key West law enforcement [36:40] acting with ice is bad for the [36:42] key West economy. As a [36:43] business owner, the labor for [36:45] the available labor force is [36:47] very tight. Many members of [36:48] the qs community are afraid to [36:49] go outside or go to church or [36:54] go to work. Point. Number 2, [36:55] agreement will damage [36:57] relations between U.S. Law [36:59] enforcement in the qs [37:00] community. It makes what [37:03] should be a co-operative. [37:03] Relationship. Much more [37:07] adversarial. We already have [37:08] Monroe County law enforcement [37:10] acting as isolations. Point. [37:14] Number 3. This agreement will [37:17] divert U.S. Law enforcement [37:18] resources in addition to [37:20] costly and time-consuming [37:22] training, it takes valuable [37:22] time away from city law [37:25] enforcement functions. The key [37:28] West City Commission should [37:29] protect the community and the [37:31] businesses of Key West by not [37:33] entering into an agreement. [37:43] With ice. Thank you. After [37:44] John, we have still are. And [37:51] then Hannah Edwards. I'm John [37:51] a lifelong resident of Key [37:53] West. [37:54] >> Thank you for this [37:57] opportunity to speak. It's [37:58] important that we keep our eye [38:02] on the issues here. Agreement [38:04] 2.87 g it's not necessary for [38:06] ice to do its work here, you [38:09] for the local police to assist [38:10] them but ending Estes until [38:11] they can be transported [38:15] elsewhere. As I understand it, [38:16] the fact that participation is [38:18] not required already in the [38:20] title. We're at states [38:25] voluntary, not mandatory. So [38:26] as Tallahassee wanting so [38:27] badly to impose this sentence. [38:30] Not a surprise, actually, it's [38:31] consistent with its actions [38:33] across the years to squelch [38:34] every part of local autonomy. [38:37] It possibly can often in [38:38] violation of the powers [38:41] granted to local [38:41] municipalities by our state [38:45] constitution and laws. By and [38:46] large. Our community has a [38:47] favorable impression of our [38:48] local police department and [38:52] justifiably so. We are [38:53] fortunate the chief Brandon [38:54] brings a fair and reasonable [38:56] man. It was wrong to [38:58] disrespect him when he spoke [38:59] last week. He's on our side [39:00] and has the best interest of [39:04] our community at heart. Our [39:05] police, our trains to defuse [39:06] tense situations rather than [39:09] fanning the flames and [39:10] escalating them into more [39:13] newsworthy crisis. Do you have [39:15] the same impression of ice? If [39:19] anything, quite the opposite. [39:20] They have been reports and [39:22] allegations that police in key [39:24] west of acted as de facto ice [39:26] agents during routine traffic [39:27] stops, particularly targeting [39:31] immigrants. By making our [39:33] police officers act as hit men [39:35] for ice. The excellent [39:36] community report we have had [39:38] with our police vanishes in an [39:42] instant. Once our police [39:43] officers become identified [39:45] with ice agents, they will no [39:46] longer be regarded with the [39:47] same sense of trust. We have [39:51] had. Is that what we want? Is [39:52] that even with our police [39:56] themselves want. And therefore [39:59] propose reinstating are 2.87 g [39:59] agreement. It is not necessary [40:02] for ice's work. Additionally [40:03] agreeing to it since the [40:05] message to Tallahassee that we [40:07] are further acquiescing as [40:11] they attempt to strip us more [40:12] and more of local control over [40:14] our own affairs. If you give [40:17] in to a bully, you just get [40:20] more being bullied. Listen, [40:34] open your eyes and see. [40:35] >> Phil and then Hannah [40:39] Edwards and many Hartman after [40:39] >> Good afternoon, [40:42] commissioners Mayor, I'm Phil [40:42] Air resident of Miami-Dade [40:43] County and the retired Navy [40:44] must thing here with my words [40:48] to serve in courage. What [40:51] happened last week was. [40:52] >> Administrative correction. [40:55] You corrected an error. [40:56] >> And the world came down [40:57] upon. You recognize that what [41:00] is coming down upon you is [41:02] political pressure, political [41:02] pressure in the form of a [41:05] letter from the state attorney [41:05] general who could who writing [41:09] with political politicized [41:09] rhetoric within his letter. [41:10] It's clear to see no need to [41:13] be a lawyer to see it. So it [41:14] is the political pressure that [41:15] you're responding to in my [41:19] assessment. It is the [41:23] political pressure also of [41:24] your boss. Is your residence [41:24] here in the chamber that you [41:25] responded to last week and you [41:27] should respond to this week [41:31] today. So with that. I want to [41:33] just encourage you to think [41:36] about. Whom do you work for? [41:39] Who do you work for? And what [41:43] are your core values and your [41:44] core values are meant to be [41:48] with the people. So I'd [41:49] encourage you stand with the [41:51] people. Recognize what is [41:53] legally required. And I think [41:54] the previous commissioner was [41:55] on commissioner coffin. Lay [41:57] that out very well. And what [42:03] is politically? Charged and go [42:04] with your go with your with [42:07] your gut and don't be bullied [42:08] by the the political messaging [42:18] from Tallahassee. Thank you. [42:19] >> After Hannah, we have Manny [42:23] and then Laura Byrne, Italy. [42:23] Good evening. Mayor [42:26] commissioners and staff. My [42:27] name is Hannah Edwards. And [42:27] I'm speaking as a private [42:30] citizen. I want to thank you [42:30] for the courage you showed in [42:32] the last meeting. And I want [42:34] to share something with you. [42:35] When I left that meeting, I [42:39] ran into a friend of mine. [42:40] She's from Nicaragua. And [42:41] though she and her family are [42:41] naturalized, many of her [42:43] friends and relatives are here [42:45] on visas. My friend gave me a [42:46] big hug. She'd watching the [42:47] meeting online while she [42:50] worked her second job. Thank [42:50] you. She said for standing up [42:53] for my community were all too [42:54] scared to be there to be at [42:57] the meetings. GOD bless you [42:58] and GOD bless the city of Key [43:02] West. I thought you should [43:04] hear that people who work the [43:04] people who are quietly behind [43:05] the scenes making this city [43:07] run. Appreciate you. You might [43:10] not know them all by name, but [43:11] they're really grateful for [43:13] what you did last week. Now [43:15] regarding the situation at [43:17] hand, I read the a g's letter [43:19] and I believe the intent is to [43:21] scare you. And this whole [43:22] situation is scary. Many, many [43:23] people in this town are [43:25] scared. I'm scared right now. [43:27] I remember that fear can be [43:29] used as a very effective tool [43:30] to get people to do what you [43:31] want, especially when your [43:35] argument is lacking. In his [43:35] letter, the ag mentions the [43:36] arrest of sex offenders, [43:39] murderers and animal abusers. [43:39] He makes it sound like or [43:42] community is unsafe. But I [43:44] disagree. We have excellent [43:46] law enforcement, including the [43:46] chief the Key West Police and [43:48] the Monroe County sheriff. [43:50] They do their jobs extremely [43:52] well. They're great stewards [43:52] of our tax dollars are crime. [43:55] Rates are very low and they [43:57] cooperate with all other law [43:59] enforcement organizations and [43:59] the people I says now [44:01] snatching from their bikes are [44:02] not criminals. According to [44:04] the transactional Records, [44:06] Access Clearinghouse as of [44:07] JUNE 15th. So it's probably [44:10] even more so than now or than [44:13] then. 71.7% of those held in [44:14] ice detention have no criminal [44:18] record. My parents were active [44:19] in the civil rights movement [44:21] in the 1960's and the kkk [44:23] burned across in their yard to [44:24] scare them. That was extremely [44:27] scary for them. But it didn't [44:27] stop them from standing up for [44:30] equal rights. Don't let fear [44:32] stop you from doing what's [44:33] right. We believe in you and [44:34] we will continue to support [44:38] you. My daughter's preschool [44:39] teacher once told me a story [44:41] she was in a store with their [44:41] own little girl who had a [44:43] meltdown in the middle of the [44:44] aisle she wanted to Dish Usher [44:46] in leave the store. But she [44:48] had a cart full of groceries [44:49] and she remembered how we, as [44:50] parents always say, I'd [44:50] stepped in front of a train [44:52] for my child and she thought [44:55] this is the train, these [44:57] tantrums these hard moments. [45:00] This is what we step in front [45:01] of. So she sat down on the [45:02] floor next to her daughter in [45:03] tow. She calmed down. [45:04] Commissioners. This is the [45:07] train. This is the hard moment [45:08] where you get to choose [45:09] whether to do it, you know, is [45:10] right and stand beside the [45:13] people of your city or to walk [45:16] away because this is hard. We [45:17] can let the courts do their [45:19] job. We can wait for legal [45:20] clarity. We can stand by our [45:22] values and protect trust [45:22] between our immigrant [45:25] neighbors and our police. Cbs [45:26] News is predicting that you [45:28] okay because you're afraid, [45:29] please show them what we all [45:31] know that they are on the [45:32] year. Strong leader has [45:33] nothing. Her original. What? [45:42] Thank you. Thank you. Laura. [45:44] And then just Wagner. Good [45:47] afternoon, everyone. [45:50] >> Commissioners, MADAM Mayor. [45:50] Thank you for allowing me to [45:52] come and speak. I'm a resident [45:54] of Miami-Dade County drove all [46:00] the way down from Homestead. [46:01] Thankless job. Every single [46:04] one of that. You do the right [46:05] thing. It's expected. Okay. [46:09] You do the wrong thing. You [46:13] get hurt. What you did 2 weeks [46:14] ago take took a lot of [46:18] courage. You're being asked to [46:22] do it again. It's a new. You [46:23] already did it once you do it [46:25] again. It takes a lot of [46:27] courage. It's easy to take the [46:33] easy way out. The path of [46:34] least resistance is always [46:38] there. Doing the right thing. [46:40] Really does take lot of [46:47] courage. I came here. Because [46:48] there's a lot of people that [46:52] are no longer with us. [46:53] Including my family that I [46:55] know would be wanting to come [46:55] and talk. So I'm here to speak [46:57] for the folks that cannot [47:01] speak that are not here. So [47:03] channeling their voices. And [47:04] channeling what they wanted to [47:10] say. I want to say. For voting [47:12] that way. Thank you. Did 2 [47:14] weeks ago and continue to vote [47:15] that way for those that cannot [47:18] speak. For those that don't [47:21] have the ability and that are [47:22] not here and possibly in [47:26] another country. As a former [47:26] union steward, I know for a [47:32] fact. Having a thankless job [47:38] is. Appreciate you. Thank you. [47:40] And for allowing a Miami-Dade [47:41] County resident, the city [47:42] homestead to come and speak [47:52] your city of Key West. [47:58] >> Laura is there Laura? And [47:58] then just the Wagner and [48:03] Amanda Velazquez. [48:04] Commissioners, thank you for [48:07] letting me speak tonight. My [48:09] name is Laura Perez. I am a 3 [48:10] year resident of Key West. I'm [48:11] in Monroe County employee the [48:15] public facing position which [48:16] as you might guess that means [48:17] get to interact with an [48:18] incredible cross section of [48:21] people on this island and [48:22] every day I am still amazed [48:23] not only by the mix of [48:24] cultures, but the absolute [48:25] acceptance and openness and [48:26] sons of unity displayed by [48:29] people here. Your decision [48:31] last week regarding the 2.87 g [48:34] Agreement had impact on a [48:35] national scale. People other [48:36] cities he was acceptance, [48:40] openness and sense of unity. [48:41] We show that it's possible to [48:43] push back against power to [48:45] what's right. We provide [48:48] example of a community can be [48:48] demonstrate at quality and [48:54] politics We know to continue [48:54] to lead and to do what's [48:57] right. And we ask you to stand [49:01] behind decision your decision. [49:03] But man paying out of city [49:04] budget, the federal government [49:07] hurt our community put our [49:07] neighbors and our friends, our [49:11] co-workers. Into a rapid [49:12] expanding, completely [49:14] unaccountable and for profit [49:15] detention system. And there's [49:18] no reason for this. Our police [49:20] officers are already required [49:21] to cooperate fully with ice [49:21] and expressed their intention [49:25] to do so. To a little rest [49:25] between kw pd and the people [49:29] of Key West citizens both [49:30] documented and undocumented [49:31] would the same racial [49:35] profiling and paranoia and [49:35] isolation has to reach out to [49:39] key wpd for help. Other [49:40] countries will be spent by the [49:41] threat of indiscriminate and [49:45] in death attention. We have to [49:46] and made safer by this [49:48] decision. Well, as you look [49:50] good and thoughtful people, I [49:51] know you don't want to being [49:55] part of someone sending [49:56] someone to a cage in the [49:57] Everglades. I'm comfortable [49:58] with the knowledge. You MAY [49:59] put a person who showed up for [50:03] immigration court. The into a [50:04] detention facility with more [50:06] familiar contact. No legal [50:07] counsel and will chance of [50:09] dying use political act. And [50:12] should mention there been 13 [50:14] deaths in ice custody this [50:14] year alone and 5 of them in [50:20] Florida. Not fixed having a [50:23] lot is not completely [50:27] circumscribed, but as what is [50:28] helpful to building a decent [50:29] society, we to be says right [50:30] now, but it possible in just [50:32] to detain people indefinitely [50:35] without proper medical care [50:36] legal representation. You know [50:38] that to be false. That isn't [50:43] just matter. But says. Thank [50:44] you for your courage and the [50:45] to display courage wants more. [50:47] The people in this room, the [50:49] city of South Miami and many [50:50] other organizations and [50:52] individuals across the nation [50:55] have a more expansive man and [50:57] inclusive vision. This country [50:58] can be. Us in creating that [50:59] new reality. Thank you for [51:09] your time. Jesse. We have [51:10] Amanda and then for t s to [51:19] month. We're just the Wagner [51:20] and Jillian titan of 11 [51:23] Kentucky. [51:24] >> We're going to sing you a [51:25] song written by Woody Guthrie [51:40] in 1948. [51:48] >> Thompson Sodium, [51:52] >> back up next, Campbell. [51:52] >> Them money. [51:54] >> back [52:00] >> Leads. [52:08] >> It tells you This [52:12] >> when you're on the big [52:19] >> 0.2 [52:21] >> a father. He landed 2. All [52:30] the [52:33] >> insist is down [53:02] this Be. I'm saying it was on [53:37] track rights like the will no [53:44] longer Process. Then you, MAY [53:47] be involved [54:03] sneeze and it was a [54:12] >> Gore [54:16] >> We love you. Thank you to [54:16] the officers and the fire [54:30] department [54:31] >> After a man do we have for [54:33] tea? And then Jennifer Kutch. [54:34] That's a hard act to Not going [54:39] to Thank you, Mayor Henry [54:40] Cause and commissioner, thank [54:40] you for the opportunity share [54:42] my comments regarding the [54:44] proposed 2.87 g Resolution. My [54:46] name is Amanda An immigration [54:47] attorney been practicing [54:49] immigration law for 25 years. [54:49] >> And I've had my practice in [54:53] Key West since 2018. I see the [54:54] human impact everyday. What my [54:55] clients are experiencing as a [54:56] result of immigration [54:57] enforcement efforts happening [55:00] in and around Key West [55:01] receiving nonstop phone calls [55:02] from detention centers and [55:03] worried family members around [55:04] the clock. The vast majority [55:06] of these individuals do not [55:07] have criminal records. This is [55:10] not speculation. I know them. [55:11] I would be happy to share more [55:13] about their experiences at [55:14] another time. But I believe [55:15] that for today's meeting, it's [55:16] valid for you to understand [55:17] the legal options you have [55:19] with regard to the 2.87 g [55:21] Agreement. Allow me to share [55:22] my colleague Ashley sub as Lot [55:23] Sound legal advice that you [55:24] cannot be here in person [55:26] today. I write today to [55:29] respectfully urge you not to [55:30] move forward with the [55:32] resolution at this time. [55:33] Instead, I encourage the [55:34] commission to table the matter [55:35] into the city can obtain legal [55:36] clarity on its obligations [55:38] under chapter 908, of the [55:40] Florida statute on JUNE 30th, [55:41] this commission voted to void [55:43] a 2.87 g agreement that had [55:44] been improperly executed [55:44] without the legal authority [55:47] required under city charter. [55:49] Was not a rejection of federal [55:50] immigration enforcement. It [55:52] was a vote to correct a [55:53] procedural defect until now [55:54] the city has maintained a [55:55] strong legal position. It was [55:58] addressing an internal process [55:59] issue and preparing to seek [56:01] judicial guidance on whether [56:01] Florida actually requires [56:04] entry into such an agreement. [56:05] However, if the resolution [56:08] before you is either past or [56:09] voted down tonight, it [56:10] significantly increases the [56:11] risk that the governor and [56:12] attorney general will argue [56:14] that the city is prohibiting [56:16] participation and the 2.87 g [56:17] program precisely the conduct [56:18] prohibited by section 908, of [56:21] the Florida statute. Moreover, [56:22] the language of this [56:24] resolution appears to concede [56:26] without legal challenge. The [56:27] attorney generals assertion [56:28] the Key West is now a [56:29] sanctuary city in violation of [56:31] state law. That framing [56:33] matters it will surface in [56:34] pleadings press releases in [56:36] future legislative debates. [56:37] Once it's part of the public [56:38] record, it cannot easily be [56:41] undone. We do not have to make [56:43] that mistake. I respectfully [56:45] request that the commission [56:46] tabled the resolution and [56:47] direct the city attorney or [56:48] outside counsel to seek a [56:49] declaratory judgment as a city [56:52] of South Miami is doing let a [56:53] court decide whether entering [56:54] into this agreement is legally [56:56] required. That approach is not [56:57] only responsible and strategic [56:59] that it is lawful. If you [57:01] believe you must take some [57:02] action tonight at most, that [57:03] would encourage you to [57:04] consider, sir amending the [57:05] resolution from last Monday to [57:06] void the agreement without [57:09] prejudice. And agreement [57:10] requires negotiation and [57:13] consideration by all parties. [57:14] It's not an agreement. If [57:16] we're being told by the [57:16] governor and the legislature [57:17] that we have to enter into it [57:19] without negotiating the terms, [57:20] let's not rush into this [57:21] decision. Thank you for your [57:21] time and thoughtful [57:31] consideration. After for tea [57:32] is Jennifer and Robert [57:36] Milwaukee. The irony of [57:38] standing here before you today [57:39] and ask you to be brave. I am [57:41] actively practicing being [57:42] brave. [57:43] >> And publicly speaking [57:45] today, so [57:52] name is for on. I've been a [57:52] resident of to us for the past [57:57] 15 years. Today. I come before [57:59] you as a community member and [58:00] as the child of Haitian [58:04] immigrant parents. My parents [58:06] came to this country with very [58:07] little. But Terry tweens, as [58:10] big as this island. Like many [58:11] immigrants, stay in the work [58:13] hard pay taxes and raise a [58:14] family rooted in resilience [58:17] and hope. And he did it all [58:19] while navigating a world that [58:21] often them with suspicion [58:24] instead of gratitude. I'm [58:25] standing here today because [58:27] they believe in the promise of [58:28] America, they believe that if [58:31] you just work hard and kept [58:32] heads down. They could build [58:35] something better. But how can [58:36] that promise exist if we allow [58:37] fear to take hold of our [58:41] community? Last you, MADAM [58:43] Mayor majority of our city [58:44] commissioners made the right [58:46] choice to reject in agreement [58:47] that would allow Qaida bpd to [58:52] collaborate with ice under the [58:53] 2.87 g program. That decision [58:56] reflected the heart of West. A [58:57] city that has long prided [59:00] itself on being a place of [59:01] refuge, a place of compassion, [59:02] a place that understands that [59:03] community safety does not come [59:05] from intimidation. It comes [59:10] from trust. Let's be honest. [59:10] Programs like 2.87 g don't [59:12] make communities safer. They [59:14] make immigrants afraid to [59:16] report crimes, afraid to seek [59:19] help free to exist. And the [59:20] truth is when one group in our [59:21] community is living in fear, [59:27] all of us feel less safe. [59:31] Immigrants are not threat. The [59:31] threat is allowing fear and [59:32] misinformation to shape [59:38] policy. I am asking, know, I [59:40] urging all of you are city [59:43] leaders. Do not walk is back. [59:45] Do not trade, courage for [59:47] comfort. We must not allow our [59:48] local police force to become [59:50] an extension of federal [59:50] immigration enforcement. That [59:54] is not who we are. I love us [59:55] because we celebrate [59:58] differences here. We one human [59:59] family, but that motto might [1:00:01] mean more than a slogan on a [1:00:02] bumper sticker. It must show [1:00:03] up in our decisions and our [1:00:05] policies how we treat the most [1:00:08] vulnerable among us. Mayor and [1:00:08] weekends and city [1:00:11] commissioners. You are brave [1:00:14] ones be brave again. Do not [1:00:17] listen to vote. Stand with [1:00:19] immigrants who make this [1:00:20] island beautiful. Stand with [1:00:22] the families like mine. Stand [1:00:23] up those who still believe in [1:00:24] the dream that brought so many [1:00:26] of the year. History is [1:00:29] watching. And so we. Thank [1:00:42] you. After Jennifer's Robert [1:00:43] know Wiki and then clean [1:00:49] Lopez. [1:00:50] >> My name is Jennifer Coach. [1:00:51] And I make us PRESIDENT And I [1:00:53] fully support the decision. [1:00:56] Made last week to avoid the [1:00:57] 2.87 g Agreement. I would like [1:00:58] to encourage the city [1:00:59] commissioners to stick with [1:01:02] their original decision. It [1:01:03] was one of the first mayor [1:01:04] tumors of hope. I think many [1:01:07] of us felt many months. The [1:01:08] courage that was shown [1:01:08] standing up for what you know [1:01:09] is right and humane was [1:01:13] heartening. Now is the time to [1:01:14] continue to be brave and stay [1:01:17] on the right side of history. [1:01:17] Understand the difficult [1:01:18] position this puts you its the [1:01:22] job you signed up for. Human [1:01:23] people are being racially [1:01:27] profiled and kidnapped. Then [1:01:27] being unlawfully and [1:01:29] inhumanely detained in [1:01:30] concentration camps. Trigger [1:01:33] words matter? We've heard [1:01:36] countless stories in that of [1:01:38] the terrible conditions and [1:01:39] unconstitutional detainments [1:01:40] where families and even [1:01:41] lawyers are not able to get in [1:01:42] contact with their level. [1:01:45] Clients? I heard on the news [1:01:47] this morning regarding the [1:01:48] Texas floods that people don't [1:01:49] know where their loved ones [1:01:50] are or whether their letter [1:01:54] that alive or dead. I wish the [1:01:54] government show the same [1:01:55] compassion for immigrant [1:01:58] families who are feeling [1:01:59] similarly after no contact [1:02:00] from their loved one's as [1:02:00] they're being ripped off the [1:02:02] streets out of their homes [1:02:03] away from their jobs. And so [1:02:07] on. This is the beginning. [1:02:09] This is only the beginning. [1:02:09] And while I'm not sitting here [1:02:10] because I'm worried about my [1:02:12] safety or citizenship yet [1:02:13] because I am very afraid of [1:02:16] what the future holds. You [1:02:17] must be able to see the [1:02:17] writing on the wall fully. Let [1:02:20] them get away with this. Now, [1:02:21] where next? Any one of us can [1:02:24] and will be a target and that [1:02:25] you hope someone will stand up [1:02:26] for you when your rights are [1:02:29] being violated. Please stay [1:02:30] strong and do the right thing. [1:02:32] The country is watching and [1:02:32] I'm tired of being ashamed of [1:02:33] being Florida resident, my [1:02:39] husband and I. My husband, [1:02:40] sorry, my husband and I are [1:02:42] originally from Baltimore, [1:02:44] Maryland and the governor of [1:02:45] Maryland Westmore and many [1:02:45] others in similar positions as [1:02:54] yours and as his. Have spot [1:02:56] And many others in similar [1:02:58] positions as un does him have [1:02:58] been very vocal against the [1:02:59] administration and they're [1:03:03] terrible policies. I'd like to [1:03:03] be proud of where I live in [1:03:05] the politicians that represent [1:03:06] my community. So please know [1:03:06] you are not alone in standing [1:03:08] for the right thing. Many [1:03:09] members of our community [1:03:10] support you and other [1:03:13] politicians as well. There is [1:03:16] power and standing with the [1:03:17] people. I'd also like to [1:03:17] comment says about where I'm [1:03:19] from. I come from a community [1:03:20] that is afraid to call police [1:03:21] when things are happening. And [1:03:24] I can assure you when people [1:03:25] are afraid to call the police [1:03:26] is a much more dangerous and [1:03:27] unsafe place for everyone in [1:03:36] my community. [1:03:39] >> Rob is Robert. So Robert, [1:03:42] here, Robert Clayton. And then [1:03:54] Wayne Dempster. CHAIRMAN, [1:03:55] thank you. [1:03:56] >> My name is DR. Rob Nokia [1:03:57] was here last week. Thank you [1:03:59] all again for taking the time [1:04:00] to have this meeting and to [1:04:03] listen to the public. I had a [1:04:06] whole list of talking points [1:04:07] that I wasn't trying candidate [1:04:07] 3 minutes and most of them I [1:04:09] don't have to talk about [1:04:10] because they've already been [1:04:10] really eloquently said by [1:04:13] people before me. But really [1:04:14] tonight is not about these [1:04:15] facts. Anyway. We went over [1:04:19] the last week. We went over [1:04:20] the legal situation, went over [1:04:20] the moral situation, win over [1:04:23] the economic situation. Today [1:04:24] is much bigger question, which [1:04:25] is, you know, do we let [1:04:28] ourselves get bullied around? [1:04:29] And I don't know how many [1:04:30] people in this room have been [1:04:33] bullied as a child. I was it [1:04:33] s# [1:04:33] # [1:04:34] # [1:04:34] # [1:04:34] . And the thing is, as [1:04:35] other people have said, if you [1:04:38] let a bully bully, you not [1:04:39] only are they going to [1:04:40] continue to do it, they'll be [1:04:40] bold and they're gonna believe [1:04:43] other people. And sometimes [1:04:43] the other people they bully [1:04:44] are less able to defend [1:04:47] themselves. Then you are. And [1:04:48] when that happens, you have a [1:04:49] duty to do something about it. [1:04:50] And I think we're in that [1:04:55] situation tonight. Because of [1:04:56] the things that we discussed [1:05:00] last week. You know. If one of [1:05:01] the reasons why we're all here [1:05:04] tonight is to show solidarity [1:05:07] and our support for you. But [1:05:08] you just have to look at this [1:05:10] and for anybody who's looking [1:05:12] online, this room is full. The [1:05:14] upstairs room is totally full. [1:05:17] The lobby is full. They are [1:05:18] regulating who can come into [1:05:21] the city hall because it's [1:05:22] full because so many people [1:05:24] are here to support you. And [1:05:27] if you continue to stand firm, [1:05:29] we're going to need a bigger [1:05:31] city hall because [1:05:35] >> the city is weak. Your [1:05:39] constituents are with you. We [1:05:39] support you. And if you want [1:05:40] to hold another meeting next [1:05:41] week will be here next week [1:05:44] and will probably have people [1:05:45] from Collier County. You want [1:05:46] to host the 2 weeks from now. [1:05:48] We'll be reaching up to [1:05:50] Orlando. Okay. The reason [1:05:50] people are driving hundreds of [1:05:51] miles to be here tonight is [1:05:52] because they support you and [1:05:56] probably to some degree [1:05:57] because they're elected. [1:05:57] Officials aren't doing what [1:05:59] you were doing. You are [1:06:02] pulling people from elsewhere [1:06:02] because their own people are [1:06:04] not chanting them. You are do [1:06:06] not forget that we are very [1:06:20] proud of you. After after [1:06:21] Clayton is Wayne and then [1:06:25] Erica Jewel. [1:06:26] >> Good Evening. MADAM And [1:06:32] Commission is, you know me. [1:06:33] There's a claim that the [1:06:34] attorney general's letter to [1:06:36] eu states that but you didn't [1:06:37] let your last special meeting [1:06:39] on the subject was a violation [1:06:42] and make us a sanctuary city. [1:06:44] I take issue with the spin [1:06:45] that the ag is put on this [1:06:47] issue in order to pursue his [1:06:49] own violation of that higher [1:06:50] legal authority. The United [1:06:57] States Constitution. Catch a [1:06:59] last meeting. Much was raised [1:07:01] about the 14th Amendment which [1:07:03] guaranteed citizenship the by [1:07:05] birth or by naturalization. [1:07:09] There is a process due process [1:07:10] for both. That's not what's [1:07:13] happening. The people who work [1:07:18] for the city moved in next [1:07:19] door attended school with and [1:07:21] play ball with our children [1:07:21] and grandchildren. Married [1:07:24] into our families and on value [1:07:25] but contributors to our [1:07:28] society are free because they [1:07:30] have become victims. The [1:07:31] governmental overreach and [1:07:37] bullying. The very government [1:07:38] that boasts on its most [1:07:40] visible monument to freedom to [1:07:41] give me your tired, your poor, [1:07:44] your huddled masses, you're [1:07:44] running to breathe free has [1:07:48] betrayed them. I beseech you [1:07:49] to avoid succumbing to that [1:07:50] bullying by postponing the [1:07:53] vote. On your agenda. Item [1:07:55] number one, until you can [1:07:56] receive input from the city [1:07:57] attorney contracted attorney [1:07:59] or at least give yourself time [1:08:02] to find out the outcome. The [1:08:05] South Miami case are enjoying. [1:08:08] That's the fear of the people. [1:08:10] All it takes for evil to exist [1:08:10] is for good people to do [1:08:14] nothing. I understand the [1:08:17] issues of not wanting [1:08:19] criminals, then seek out the [1:08:20] criminals as had been done in [1:08:21] the past and stop seeking [1:08:22] quotas for the sake of the [1:08:31] numbers. One final thought [1:08:35] each of you on the Dias was I [1:08:36] the ball on came here seeking [1:08:38] something to Key West offer [1:08:40] too. Some your grandparents [1:08:41] and great grandparents came [1:08:42] from islands from all over the [1:08:44] Caribbean. Do you see the [1:08:49] correlation? It's no different [1:08:49] than those people who risked [1:08:50] their lives. Many of them [1:08:53] seeking a better life, not for [1:08:54] themselves, but for their [1:08:58] children. Many of those people [1:08:59] are your current business [1:09:01] owners, employers and labor [1:09:02] U.S. Today. Again, please [1:09:06] postpone is item. You've had [1:09:07] other success. The suggestions [1:09:10] presented to you. I also ask [1:09:10] that you draft a letter [1:09:12] demonstrating support for the [1:09:14] extension, the temporary [1:09:15] status, not just for patients, [1:09:18] but for all its intended. When [1:09:19] this is all over with our [1:09:20] model still be one human [1:09:35] family. [1:09:35] After Wayne is Erica. [1:09:42] And then Zach Forward. [1:09:43] >> My name is Wayne dab, [1:09:49] resident of Key West. I am a [1:09:49] U.S. Navy officer with 28 [1:09:51] years of commission service [1:09:54] currently retired. I'm a [1:09:54] practicing attorney for the [1:09:57] past 40 years. The last 25 in [1:10:01] Key West. I represent [1:10:01] individuals and families [1:10:04] before the immigration courts, [1:10:06] the immigration Service, [1:10:07] deportation offices and U.S. [1:10:08] Department of State and [1:10:12] consulates. I estimate I [1:10:13] represented between 5 7,000 [1:10:17] persons here in Key West. I'm [1:10:17] considered to be one of the [1:10:19] experts immigration law in [1:10:25] South Florida. As a lawyer, I [1:10:26] represent individuals are [1:10:27] pulling their rights under the [1:10:30] Constitution and U.S. Laws. [1:10:32] The 2.87 agreement he's being [1:10:37] asked Key West to sign but key [1:10:38] wpd under the direction and [1:10:41] supervision of ice in the [1:10:41] performance of immigration [1:10:45] duties. The interpretation [1:10:47] actions by ice of the laws of [1:10:50] Florida. And of the Aqsa laws [1:10:52] of the U.S. In mortar [1:10:56] situations. Are in direct [1:10:59] contradiction to those laws. [1:11:00] And the night the actual [1:11:04] facts. Florida Law says that [1:11:06] police must have reasonable [1:11:09] suspicion of a crime in order [1:11:09] to ask immigration-related [1:11:13] questions. I says they do not [1:11:18] need to follow that law. When [1:11:18] a person arrives the southern [1:11:21] border there legally outside [1:11:24] the U.S. Until interviewed and [1:11:25] approved and then issued a [1:11:28] parole to enter. Is illegal [1:11:36] entry. Yet ice claims without [1:11:37] That is a crime to act to [1:11:40] enter that way. And thus they [1:11:44] can arrest someone any time. [1:11:45] Despite having a pending [1:11:49] asylum case. Court hearing [1:11:50] scheduled pending benefit [1:11:51] applications. Our legal status [1:11:55] to be here. No criminal [1:12:00] record. These allegations [1:12:02] about act, ice's actions and [1:12:04] interpretations should be [1:12:05] examined and documented before [1:12:07] any decision is made. On the [1:12:09] cooperation with ice in [1:12:15] enforcement operations. [1:12:16] Currently in cooperation with [1:12:20] the fhp. Is continuing to stop [1:12:22] and take into custody citizens [1:12:25] of Key West as recently as [1:12:29] this morning. Despite the [1:12:31] citizens having lawful status. [1:12:34] This forces the the clients to [1:12:36] expend significant resources [1:12:39] in time and money. To obtain [1:12:41] their release from lawfully [1:12:43] tension. I pose a significant [1:12:54] bonds of ice to the court. [1:12:55] After Erica. We have Zach [1:12:57] Forward and then Bird that [1:13:04] foster. [1:13:04] >> My name is Erika Jewel and [1:13:08] I live in District 5. I was [1:13:09] born and raised in Key West [1:13:10] and I love the cosmopolitan [1:13:11] and open-minded nature of our [1:13:15] small town. Not only do we [1:13:15] play host to tourists from all [1:13:18] over the world, our community [1:13:18] is composed of a diverse group [1:13:22] of outsiders who we welcome I [1:13:24] know a bit about what being an [1:13:25] outsider and immigrant feels [1:13:26] like to the 13 years I lived [1:13:28] outside of the states, [1:13:29] although other countries treat [1:13:30] Americans much better than we [1:13:31] treat anyone edition, [1:13:35] different nationality. I'm [1:13:35] ashamed of the PRESIDENT Of [1:13:38] the Mast ice agents I see on [1:13:39] our streets and I'm ashamed [1:13:40] that my immigrant friends are [1:13:43] afraid to be out in public. [1:13:44] But last week's decision made [1:13:47] me so proud to be key West. [1:13:48] Our city is making [1:13:49] international news by standing [1:13:50] for what is right. My friends [1:13:51] across the world have reached [1:13:54] out to tell me that they've [1:13:54] had about last week's decision [1:13:58] in their media. Although I [1:13:59] find it shameful that in [1:14:00] America we make decisions [1:14:01] based on the economic rather [1:14:04] than human costs of our laws. [1:14:05] The economic cost of this [1:14:06] agreement have already been [1:14:09] made clear. Certainly we're [1:14:10] not even discussing opposing [1:14:12] the presence of ice in our [1:14:12] community and this needing [1:14:13] simply whether we want local [1:14:16] police to act as ice. Let use [1:14:16] its own massive budget to [1:14:20] train its own officers. Please [1:14:20] don't cave to the attorney [1:14:21] generals attempts to [1:14:25] intimidate you. We support you [1:14:26] and I hope they'll continue to [1:14:28] make us proud by voting no to [1:14:31] entering into it to 87 g [1:14:32] Agreement. Joining South [1:14:33] Manny's lawsuit and yes to [1:14:34] extending tps for Haitian [1:14:43] community. Thank you. And sack [1:14:47] here safc Forward. [1:14:47] >> And about Foster and then [1:14:51] Elizabeth through us. Forgive [1:14:52] me for speaking extemporaneous [1:14:53] Lee. I thought it was signing [1:14:58] up just to be here. [1:14:59] >> It's true. I'm sure you can [1:15:00] feel proud everyone is for how [1:15:02] you voted last week you can [1:15:02] feel it in your hearts. But I [1:15:05] have to say the fact that we [1:15:09] are all here today p# [1:15:09] # [1:15:09] # [1:15:09] # [1:15:09] # [1:15:10] # [1:15:10] you [1:15:11] not to go full, not see is a [1:15:12] little bit I hope everyone [1:15:15] knows what that word means. It [1:15:16] means reprehensible. And I [1:15:19] know how much your jobs s# [1:15:19] # [1:15:20] # [1:15:21] because I was also a political [1:15:23] candidate. A few years ago, I [1:15:23] ran for mayor of my hometown [1:15:26] and skin Alice, New York. The [1:15:26] lake was getting polluted. I [1:15:30] stood up against homophobia [1:15:31] and racism and they tried to [1:15:35] run me out of town. I lost the [1:15:36] vote. The police were [1:15:39] weaponized against me. The ecl [1:15:41] you gave me a lawyer's pro [1:15:43] bono, the editorial board at [1:15:46] the Syracuse Post champion Me. [1:15:47] I think the first rate white [1:15:48] guy that the aclu or give [1:15:49] lawyers to that's have bad [1:15:52] things are getting in the [1:15:54] United States. But I just [1:15:56] wanted to say if I rebound [1:15:59] handwriting, you guys are [1:16:00] doing the right thing. But if [1:16:00] you're worried about losing [1:16:02] your jobs and un is coming [1:16:04] here, we will simply out vote. [1:16:06] You and you will not be [1:16:06] renewing longer anyway. You [1:16:10] can feel how galvanize we are. [1:16:11] And I will personally run for [1:16:12] mayor and my parents might [1:16:15] hear a [1:16:18] >> I think playing pretty [1:16:19] already. [1:16:22] >> My parents I here in the [1:16:24] 1970's. I was conceived here. [1:16:27] That makes my skin my [1:16:29] spiritual home Didi. You know [1:16:31] me. I'm the one who [1:16:31] interviewed you about and one [1:16:32] is for the Oxford American [1:16:38] icon to you, humorously as [1:16:39] slippery in basin because [1:16:39] you're not immune opinion and [1:16:42] whether you hated or loved one [1:16:43] is please keep that tongue in [1:16:48] cheek. Journalist equip, [1:16:49] humorous prove wrong that you [1:16:53] will do the right thing in [1:16:54] white. I know how much it [1:16:54] s# [1:16:54] # [1:16:54] # [1:16:55] # [1:16:57] to fight, but you. Do. [1:17:00] And I just moved back to [1:17:00] Florida. Like woman said, I do [1:17:06] not want to be to the from [1:17:07] Florida. I don't even tell [1:17:08] people I want to go to New [1:17:08] York and Ali that I live [1:17:09] Florida on the dating apps. [1:17:12] They keep off the dating apps. [1:17:13] But please do the right Thank [1:17:22] you. After her best is [1:17:26] Elizabeth. And most a leak. [1:17:28] >> Good evening, mayor and [1:17:29] commissioners. My name is [1:17:30] private Foster and I'm [1:17:33] attorney with the community [1:17:33] Justice Project. We are at [1:17:36] with firm in Miami and we have [1:17:38] come to talk to you tonight in [1:17:41] support your constituents. We [1:17:42] have litigated on the very [1:17:48] issues of sanctuary bands and [1:17:50] best effort provisions in the [1:17:54] past. We've also over the last [1:17:55] decade represented local [1:17:56] governments to vindicate their [1:17:57] rights to make sure that the [1:17:59] state is not engaging in [1:18:02] overreach. And so in 2019, [1:18:02] specifically, we represent the [1:18:05] city South Miami in a federal [1:18:06] case challenging the very [1:18:07] provisions that are at issue [1:18:10] today. Office has been [1:18:12] tracking the enactment of 2 87 [1:18:15] g in the legislature. We've [1:18:16] also been tracking its [1:18:16] implementation across the [1:18:18] state. It's important to make [1:18:22] clear in hopefully this [1:18:22] echoing of legal analysis will [1:18:26] ring true with you all. 2.87 g [1:18:27] agreements are not mandatory [1:18:30] in the state. It's clear based [1:18:31] on the plain language of the [1:18:35] statute. Legal key west as [1:18:37] well as any city in the state [1:18:39] of Florida does not have an [1:18:41] obligation to enter into this [1:18:43] agreement. So instead, what [1:18:45] we're seeing is the governor [1:18:46] and the attorney general using [1:18:47] fear and intimidation to 4 [1:18:51] cities across the state to [1:18:52] engage in conduct that far [1:18:53] exceeds Florida state law [1:18:56] requirements. Nonetheless, to [1:18:58] let you know, you are not [1:19:01] alone. Less than half of all [1:19:02] Florida law enforcement [1:19:03] agencies have signed on to [1:19:08] 2.86 to 87 g Agreement. And in [1:19:09] fact, nationally we're seeing [1:19:11] a vanishing number of cities [1:19:12] fewer than 35 across the [1:19:15] country outside the state that [1:19:17] have taken steps to deputize [1:19:18] their law enforcement [1:19:21] agencies. You are not alone. [1:19:23] Qs. We applaud this [1:19:24] commission's clear and [1:19:25] measured approach to the [1:19:27] issues before you. You all [1:19:31] have entered and resolved a [1:19:33] thoughtful and legally sound [1:19:36] resolution that you passed on [1:19:37] JUNE 30th. There's nothing [1:19:41] there that probably key West [1:19:42] Police Department, any [1:19:42] prohibition with federal [1:19:45] immigration authorities there [1:19:48] is no sanctuary policy here [1:19:49] and there's no violation of [1:19:53] the best efforts clause which [1:19:54] is mischaracterized by the [1:19:56] attorney general in his [1:19:59] letter, what you all did is [1:20:01] clear. It was simply a [1:20:02] correction of the void [1:20:03] contracts signed by the chief [1:20:07] of police. That's all. It is [1:20:08] our analysis, actually, that [1:20:12] key West at this time [1:20:13] currently sits in the [1:20:14] strongest legal standing of [1:20:17] any city in the state to [1:20:18] vindicate the rights of [1:20:20] municipalities to govern [1:20:21] themselves as they see fit and [1:20:25] as their constituents desire. [1:20:26] Key West has the opportunity [1:20:27] here to ensure that all [1:20:37] cities. Kerry, can you call [1:20:38] the next one. Please. Thank [1:20:50] you. After Elizabeth is Emma [1:20:51] and then Heather Swift Co [1:20:53] Bathurst. [1:20:54] >> Good evening, MADAM Mayor [1:20:56] and the Commission. My name is [1:20:57] Elizabeth Threes. [1:20:59] >> I am currently a law [1:20:59] student working over the [1:21:01] summer on the rights of cities [1:21:02] and participating with the [1:21:03] 2.87 g Agreement and the [1:21:04] impact of its implementation [1:21:06] in our communities. I am in [1:21:08] Miami-Dade County resident. I [1:21:10] had the ability to drive for [1:21:12] hours to speak. Before I [1:21:15] speak, what I prepared, I want [1:21:16] to take a moment to tell you [1:21:19] what I hope you already know. [1:21:21] You have an incredible [1:21:23] community here. Words spoken [1:21:25] from your constituents are so [1:21:27] moving, you can feel the [1:21:29] kindness, integrity and [1:21:32] empathy of these key West [1:21:33] residents. There's something [1:21:34] beautiful that you all have [1:21:34] here that I have never seen [1:21:36] before. That should mean [1:21:40] something to you. Service [1:21:42] community in an era of [1:21:43] loneliness where you have here [1:21:43] is worth being brave and [1:21:52] courageous for. Many of us [1:21:53] here are deeply concerned with [1:21:54] how far the state's executive [1:21:55] body is willing to go in [1:21:57] taking the rights of local [1:21:59] authority. This executive [1:21:59] overreach would like to [1:22:00] determine what is in the best [1:22:05] interest of your community. [1:22:05] Has duly elected officials. [1:22:07] You took an oath to faithfully [1:22:10] perform the duties of this [1:22:10] office with this. It is your [1:22:13] responsibility to represent [1:22:15] your constituents in a matter [1:22:16] that protects and defends the [1:22:20] autonomy of the city. With [1:22:22] cities are not required to [1:22:23] enter into the 2.87 g [1:22:26] Agreement. It is a choice and [1:22:26] one that would be in Key [1:22:27] West's best interest to not [1:22:30] support. There's immense power [1:22:34] and local government. The [1:22:34] governor and attorney general [1:22:38] are utilizing fear tactics to [1:22:38] force the beautiful city of [1:22:39] Key West to enter into this [1:22:41] agreement under duress. There [1:22:44] are other routes available. We [1:22:47] the people implore you to [1:22:50] utilize any and all resources, [1:22:50] especially the voice of your [1:22:58] constituents. This commission [1:22:59] is in a unique position to [1:23:02] retain its power support the [1:23:05] needs of the community. If you [1:23:07] stand for nothing. What will [1:23:09] you fall for? Thank you for [1:23:19] our time. After Emma is [1:23:23] Heather and then Tessa Pettit. [1:23:25] Good evening Commissioners. [1:23:26] Hello. My name is Emma failing [1:23:27] and I'm a proud member of they [1:23:30] key West Immigrant support [1:23:30] network. [1:23:32] >> I'm expert excerpts from a [1:23:34] letter from the aclu of [1:23:35] Florida. This letter was sent [1:23:37] to all of you via e-mail [1:23:40] yesterday, the American Civil [1:23:42] Liberties Union, Florida is a [1:23:43] non-partisan organization [1:23:45] whose mission is to protect, [1:23:46] defend, strengthen and promote [1:23:48] the constitutional rights and [1:23:50] liberties of all people in [1:23:52] Florida. We write to you [1:23:53] regarding the attorney [1:23:55] General. James Uthmeier is [1:23:55] correspondence to the city [1:23:59] Commission dated JULY 2nd. The [1:24:00] attorney general claims that [1:24:01] the commission's JUNE 30th [1:24:02] vote to avoid the city's [1:24:05] existing 2.87 g Agreement with [1:24:06] ice violates Florida statute [1:24:08] and refers to the possibility [1:24:10] of suspension from office as [1:24:12] consequence. But the attorney [1:24:13] general's arguments and threat [1:24:16] rely on false premises. First, [1:24:18] the attorney general claims [1:24:19] that when a city terminates [1:24:21] the 2 nd 87 g Agreement, the [1:24:22] city of violates Florida's [1:24:23] prohibition on sanctuary [1:24:25] policies. But the plain text [1:24:26] of the statute makes it makes [1:24:29] no such a leap. The relevant [1:24:30] statutes are Florida statute [1:24:33] sections. 908, 0.1, 0, 3, and [1:24:36] 908, 0.1, 0, 2, neither of [1:24:37] which are violated when the [1:24:40] city avoid the 2.87 g [1:24:41] Agreement. Second, the [1:24:43] attorney general asserts that [1:24:43] Key West avoiding its 2.87 g [1:24:44] agreement violates Florida's [1:24:47] best efforts clause. The [1:24:48] statute does not require [1:24:50] cities to undertake 2.87 g [1:24:51] agreements, nor does it [1:24:53] prohibit them from voiding [1:24:55] such agreements. There are [1:24:56] numerous ways that local law [1:24:57] enforcement agencies could [1:24:57] comply with this obligation [1:25:02] without. Implementing 2.87 g [1:25:04] agreements. Additionally, [1:25:05] Governor Ron DeSantis has no [1:25:05] constitutional authority to [1:25:07] suspend municipal off airs [1:25:10] under these circumstances that [1:25:11] that's the governor and [1:25:12] attorney general are willfully [1:25:15] misreading Florida law at [1:25:16] worst, their delivery [1:25:16] deliberately distorting it in [1:25:17] order to bully locally [1:25:20] elected. Officials using the [1:25:23] threat of retaliation to be [1:25:24] clear under Florida law. The [1:25:25] city of Key West is not [1:25:27] required to enter or maintain [1:25:31] 2.87 g agreement with ice. No [1:25:34] state or federal law requires [1:25:35] any law enforcement agency to [1:25:37] transform its employees into [1:25:38] another agency's officers just [1:25:41] to participate in an operation [1:25:43] yet to the attorney General's [1:25:44] Strange logic, any local [1:25:45] government entity in Florida [1:25:46] could be required to turn over [1:25:48] the entirety of its law [1:25:49] enforcement resources to [1:25:51] federal immigration efforts. [1:25:52] This makes no sense and it is [1:25:55] not the law. A free state [1:25:56] respects local officials to [1:25:57] make choices that make sense [1:26:00] for their communities. It does [1:26:01] not weaponized the law to [1:26:01] punish those who disagree [1:26:03] with. But the political agenda [1:26:06] of state officials, we urge [1:26:08] you to resist authoritarian [1:26:09] threats and to listen to the [1:26:12] constituents who you serve. [1:26:13] 2.87 g programs, transform [1:26:15] local law enforcement into [1:26:16] immigration agents and sit at [1:26:18] the significant local cost. [1:26:19] They also lead to illegal [1:26:21] racial profiling. Other civil [1:26:23] rights abuses, local officials [1:26:24] fulfill their responsibility [1:26:37] by thinking. After Heather's [1:26:40] Tessa and then Erica Rose. [1:26:42] >> How there's the about [1:26:43] there's 14, 17 e street, 15 [1:26:46] years. Fresh water conch [1:26:47] mother of a 2 and a half year [1:26:49] old salt water. Calm point [1:26:52] here in Key West Hospital. I'm [1:26:52] meeting today op-ed written by [1:26:56] Javier Fernandez, former state [1:26:57] representative and current [1:26:58] mayor of South Miami in [1:26:59] support of the city of Key [1:27:02] West. This week, this Key West [1:27:04] City Commission voted 6 to one [1:27:05] to avoid its 2.87 g Agreement [1:27:08] with U.S. Immigration. [1:27:10] >> And Customs Enforcement has [1:27:12] an attorney and the mayor of [1:27:13] South Miami who recently took [1:27:14] the state of Florida to court [1:27:14] over this very issue. I [1:27:17] applaud their decision. Other [1:27:20] local governments should take [1:27:21] note Florida law requires [1:27:24] local jailers to enter into [1:27:25] 2.87 g agreements to [1:27:25] facilitate and honor [1:27:29] immigration detainer requests. [1:27:29] It does not compel cities to [1:27:31] deputize local police as [1:27:32] immigration agents. That [1:27:34] distinction is at the heart of [1:27:35] the lawsuit. South Miami filed [1:27:39] in circuit earlier this year. [1:27:39] Key West's commission [1:27:43] understood that distinction. [1:27:44] The agreement, its chief of [1:27:46] police signed in MARCH also [1:27:46] never received community input [1:27:49] or legislative approval by [1:27:50] rescinding it. The city [1:27:53] reaffirmed 2 principles, [1:27:55] procedural transparency and [1:27:57] community trust tourism is the [1:28:00] lifeblood of the key pushing [1:28:01] immigrant workers and visitors [1:28:02] into the shadows makes [1:28:02] everyone less safe and hurts [1:28:06] the local economy. As mayors, [1:28:07] we are sworn to protect all [1:28:08] who reside and work in and [1:28:10] visit our cities affected [1:28:14] policing depends on trust. [1:28:14] Victims reporting crimes. [1:28:15] Witnesses coming forward. [1:28:16] Parents trusting officers [1:28:18] stationed outside schools [1:28:19] turning local police into [1:28:20] proxy ice agents chills that [1:28:21] trust and undermines public [1:28:25] safety. Key West's decision [1:28:26] also exposes the hollowness of [1:28:27] the do it or else threats [1:28:29] coming from Tallahassee. If [1:28:31] the state really wanted to a [1:28:32] 70 to be mandatory for [1:28:33] municipalities, it would have [1:28:36] made it law during this year's [1:28:37] special session. Instead, [1:28:39] lawmakers rejected that very [1:28:42] proposal. Q s commissioner [1:28:42] showed courage and fidelity to [1:28:44] the rule of law and to their [1:28:46] constituents. South Miami [1:28:47] stands with us in our legal [1:28:49] challenge will continue [1:28:50] because the rule of law and [1:28:51] our oath office constituents [1:28:53] should carry more weight. The [1:28:54] political intimidation from [1:28:56] Tallahassee. This is my [1:28:58] personal note. Commissioners. [1:28:59] Are up urge you to uphold the [1:29:00] decision you made last week [1:29:01] and postpone the resolution in [1:29:05] front of you today. Let the [1:29:07] courts decide in South Miami v [1:29:09] DeSantis, we are in an [1:29:11] incredibly fragile legal [1:29:12] situation currently. But right [1:29:14] now the law is on our side. [1:29:16] Remember, we never entered [1:29:17] into a 2.87 g agreement. [1:29:18] Something you yourselves [1:29:21] confirmed last week and that's [1:29:23] have not effectively exited [1:29:25] one either. It is an [1:29:26] incredibly subtle this [1:29:27] distinction, but it is also an [1:29:30] incredibly clever one. The [1:29:31] threats and it was Meyers [1:29:32] letter are that's incredible. [1:29:35] As of now that being said, [1:29:36] voting on this agreement [1:29:38] tonight, regardless of the way [1:29:39] that the vote goes, moves [1:29:41] those threats from empty to [1:29:41] ballot. I urge you please [1:29:42] postpone the resolution. Thank [1:29:51] you. So test to Erica and then [1:29:53] share the Patton. Good [1:29:57] afternoon. And this [1:29:58] opportunity speaking on behalf [1:30:01] of the Florida immigrant [1:30:02] coalition. [1:30:04] >> And a resident of mandate [1:30:04] and advocate for immigrants [1:30:08] rights. Mayor and [1:30:09] commissioners that the city of [1:30:11] Key West first and foremost, [1:30:11] thank you for bravery in [1:30:16] voting. Against having a city [1:30:16] of Key West enter into a 2.87 [1:30:19] g agreement last week. You [1:30:20] gave hope 2 immigrants in [1:30:22] these dark times reminding us [1:30:23] that for some people we do [1:30:27] matter. Know that we are [1:30:28] grateful for you setting the [1:30:31] example for other CDs in the [1:30:33] state. It made a difference to [1:30:33] me because I am to an [1:30:37] immigrant. We're here to [1:30:38] confirm that you are not [1:30:41] required to sign into a 2.87 [1:30:43] g. The Florida legislature [1:30:44] introduced making 2.87 g [1:30:46] mandatory for local [1:30:47] municipalities in the 2025 [1:30:48] special Legislative session. [1:30:51] And again, during regular [1:30:52] session. And in both times it [1:30:54] did not pass all the efforts [1:30:57] of the attorney general to [1:30:58] strong arm you to go against [1:31:02] the will of the people. Our [1:31:02] state overreach and the use of [1:31:05] fear and intimidation against [1:31:06] people that the community and [1:31:07] elected to be their voice on [1:31:15] the dice. Back in 2012. The [1:31:15] Department of Homeland [1:31:16] Security cancel the task force [1:31:20] model because it encourage [1:31:20] racial profiling and civil [1:31:24] rights concerns. 2.87 g do [1:31:26] nothing more than divide [1:31:27] communities. Create a state of [1:31:31] fear in our communities. We [1:31:31] immediately see a reduction in [1:31:34] crimes being reported and [1:31:36] increase in domestic violence [1:31:38] increase in health issues, [1:31:42] reduce access to health care. [1:31:42] It destroys businesses and [1:31:45] therefore the economy and [1:31:46] gives the past the people to [1:31:47] openly and shame of the [1:31:52] exercise their racism. The [1:31:52] immigrants in your community [1:31:58] are not criminals. Patients. [1:31:58] And added yesterday, [1:32:00] Nicaraguans Hondurans and [1:32:03] Venezuelans on tps will soon [1:32:06] be added to the long list of [1:32:07] targets that you will be [1:32:08] giving to a police officers [1:32:10] and soon enough, the [1:32:13] naturalized citizens. [1:32:17] Suffering from being targeted, [1:32:18] feeling unwanted constantly, [1:32:21] unsure about how day will end. [1:32:23] Every police will become a [1:32:24] hunter after them and their [1:32:28] children. You have the people [1:32:29] support and the Vigo right to [1:32:32] not enter into a 2.87 g [1:32:35] agreement in 24 hours over 420 [1:32:38] people set to your inbox [1:32:39] letters confirming support to [1:32:42] you? You have heard from [1:32:46] lawyers and committee members [1:32:46] since there are doubts on your [1:32:47] rights and to make sure you do [1:32:48] not pay into the state's [1:32:51] efforts to set precedents that [1:32:53] would allow them to every [1:32:53] municipalities power and [1:32:55] eventually the people's rights [1:33:02] do not vote on this. Thank [1:33:15] you. [1:33:15] >> After Erica, it's Sheila [1:33:19] Patton and then Daria would. [1:33:23] Good morning. [1:33:24] >> I've been living and [1:33:25] working Key West for about 7 [1:33:26] years now and at the [1:33:27] philosophy of one human [1:33:29] family. 2 years ago, I stood [1:33:33] in this spot when the city was [1:33:34] going to pass a resolution [1:33:36] defending our cities tracked [1:33:38] cleans trans neighbors and [1:33:42] clear citizens. I asked the [1:33:42] question, what is the city [1:33:44] going to do? What action are [1:33:45] they going to take? Because [1:33:50] words are cheap. Vice mayor [1:33:51] cough and listen to me and [1:33:53] address those concerns. One of [1:33:56] our commissioners blamed their [1:33:57] constituents to just lay down [1:34:00] and let DeSantis walk over us. [1:34:02] Some know me as Michael but [1:34:05] globally on known as Erica [1:34:06] Rose, the Drag Queen who ran [1:34:08] for your state representative [1:34:10] last year under the platform [1:34:11] of human rights and homer, [1:34:17] all. And here we are facing a [1:34:19] situation that endangers both. [1:34:21] I was unable to attend last [1:34:23] week's meeting because living [1:34:24] in Key West, you have to work [1:34:28] 3 full time But there are few [1:34:29] things I wanted to say. Some [1:34:30] of them you MAY have already [1:34:34] heard deserve to hear again. [1:34:35] There's a difference between [1:34:36] standing aside and letting the [1:34:38] federal law enforcement do [1:34:38] their job and actively [1:34:41] standing in their way. We are [1:34:43] not a sanctuary city. A [1:34:46] resident is caught allegedly [1:34:48] committing a crime, they go [1:34:50] through the court system. If [1:34:53] they are found guilty and then [1:34:56] it has discovered they are [1:34:57] undocumented. We hand them [1:34:57] over to the appropriate [1:34:58] authorities to let them be [1:35:01] deported. However, entering [1:35:03] the country on documented as [1:35:07] not a crime. It is that of a [1:35:07] civil offense. Very much [1:35:10] similar to a parking ticket [1:35:11] and you generally don't get a [1:35:14] rested for a parking ticket. [1:35:16] However, racial profiling is [1:35:19] illegal and unethical. The [1:35:20] kidnapping and trafficking of [1:35:24] our citizens. Regardless of [1:35:25] their immigration status [1:35:27] without being proven guilty of [1:35:28] a crime, it's also illegal and [1:35:30] against City resolution. 17 [1:35:34] Dash one, 50. Florida Senate [1:35:35] bill 4 see passed earlier this [1:35:38] year. Would make entering our [1:35:41] state undocumented a crime. [1:35:42] However, that is currently [1:35:46] being blocked by federal. [1:35:47] Judges and attorney general. [1:35:48] Meyer has been found in [1:35:48] contempt for filing this [1:35:52] ruling. The defense of the [1:35:54] Nuremberg defense or I was [1:35:55] just following orders is shaky [1:35:57] at best and dangerous at [1:35:59] worst. Trump will not stay in [1:36:01] office for ever and neither [1:36:03] will DeSantis when they're [1:36:04] asked writing the history [1:36:05] books I ask, How do you want [1:36:08] to be remembered? So [1:36:08] personally, I tell you, please [1:36:10] reject this resolution [1:36:12] professionally. I say postpone [1:36:13] it and see what the courts [1:36:17] have to say. As a community. [1:36:19] And as a culture, it doesn't [1:36:19] belong in our streets belongs [1:36:33] in our cocktails. [1:36:34] >> Shana Daria and Mark [1:36:37] Watson. MADAM Mayor and [1:36:40] commissioners, thank you so [1:36:41] much. My name is Sheila and I [1:36:41] have luckily called que home [1:36:44] for most of my life. I sat in [1:36:46] this meeting last week [1:36:47] completely in all and inspired [1:36:48] by everyone who spoke. And [1:36:49] although this kind of thing [1:36:50] really terrifies me, what [1:36:51] scares me more is the blind [1:36:52] eye that people are willing to [1:36:54] turn about this very real [1:36:56] issue. More than that actually [1:36:56] have watched as people [1:36:58] gleefully cheered the [1:37:00] kidnapping of people by masked [1:37:01] men, many of whom refused to [1:37:02] identify themselves. People's [1:37:03] rights being stripped away as [1:37:04] if that could mean any of us [1:37:06] are next. I've read all of [1:37:08] these violent and hateful [1:37:09] comments on our local Facebook [1:37:10] page is people literally [1:37:11] talking about running folks [1:37:12] over in their trucks and [1:37:13] assaulting women and some of [1:37:15] the worst things that I have [1:37:16] ever seen and holla can think [1:37:17] of is that that is not the [1:37:19] spirit of Key West. And while [1:37:20] they hide behind keyboards to [1:37:22] spew their vitriol, those of [1:37:23] us with love and hope and [1:37:24] bravery in our hearts are here [1:37:24] in this room right now [1:37:28] fighting for its right. And [1:37:29] this is the spirit of to us. [1:37:30] This is one human family. How [1:37:32] many of us are in Qs because [1:37:34] we are lucky enough to have [1:37:36] family members who were [1:37:36] immigrants themselves, [1:37:38] including myself. I was not [1:37:41] born here. I was brought here [1:37:42] as a kid. I was raised by my [1:37:43] uncle who was a Cuban [1:37:45] immigrant. His family fled [1:37:46] Cuba in the 50's to build a [1:37:47] life here in South Florida. [1:37:49] And luckily for me here in [1:37:52] West, I remember sitting in [1:37:54] classic U.S. High school [1:37:55] learning of all the atrocities [1:37:55] of World War, 2 asking myself [1:37:57] how people could possibly [1:37:58] stand by and do nothing while [1:38:00] their neighbors and loved ones [1:38:01] and their friends were taken. [1:38:02] And I see it happening in real [1:38:03] time and I refuse to be [1:38:05] silent. Our key West High [1:38:06] school mascot, cheesy as this [1:38:07] might sound is the fighting [1:38:08] Kong. Right now I feel like [1:38:10] all of us need to channel that [1:38:11] fighting and fight for what we [1:38:12] know in our hearts to be [1:38:14] right. I've also spent the [1:38:15] last 3 years working for a [1:38:17] local tour company taking [1:38:18] immense pride in the culture [1:38:19] of this island. And really [1:38:20] deeply into the entire history [1:38:23] of que estan discovering how [1:38:23] crucial the immigrant [1:38:24] immigrant community has been [1:38:26] in shaping island, the [1:38:27] resilience and vibrancy of [1:38:29] this island would not exist [1:38:31] without immigrants. There is a [1:38:32] minority group here in Key [1:38:33] West that is possibly making [1:38:35] the island a little bit worse [1:38:36] for wear because none of us [1:38:38] can afford to live here. But [1:38:40] those entirely different [1:38:41] discussion. I know that it's [1:38:42] scary to stand up to this [1:38:43] increasingly fascist [1:38:44] administration, but we all [1:38:45] know that they are on the [1:38:47] wrong side of history already. [1:38:48] It's often these little [1:38:49] pockets of resistance that [1:38:50] gives strength to the hole and [1:38:52] we cannot back down now. So [1:38:52] urge you not to be coward [1:38:55] cowed by these heartless [1:38:56] police. We can't passions. And [1:38:57] when we have a chance to [1:38:58] inspire even more cities to [1:38:59] stand up and do what's right [1:39:10] Thank you very much. After [1:39:11] Daria is Mark and then Jeffrey [1:39:17] Segal. [1:39:19] >> MADAM Mayor Commissioners, [1:39:21] neighbors, friends as a [1:39:21] privilege to stand here today [1:39:22] as we work together to make [1:39:23] our city a better place. You [1:39:24] know, given me hope that we [1:39:25] really can make a difference. [1:39:26] And for now, at least we still [1:39:29] have a voice. What concerns me [1:39:31] is that our leaders and [1:39:31] Tallahassee are trying to take [1:39:32] up a ways away and yet somehow [1:39:35] plan that we are free. And [1:39:37] agreement by definition, some [1:39:37] very site is a negotiation [1:39:38] between 2 parties to come [1:39:39] together in a harmonious [1:39:43] arrangement, decided by both [1:39:44] sides cheaper was told and [1:39:45] sincerely believe that this [1:39:46] was mandatory and that he [1:39:47] could lose his job he didn't [1:39:48] sign it. What we were entered [1:39:51] into was a coercion thinly [1:39:51] veiled as an agreement and [1:39:54] built upon fear and threats [1:39:55] choosing to not only tolerate [1:39:56] but enable those who abuse [1:39:56] their elected power to [1:39:58] threaten us, threaten your [1:40:00] jobs, threaten to withhold [1:40:01] funding. That's a corruption [1:40:02] and abuse of power for That's [1:40:03] how we turned a blind eye to [1:40:06] bullies. That's how fear grows [1:40:07] the privilege of living in [1:40:08] this great city because of my [1:40:08] dad who served in the Navy [1:40:12] here during Vietnam. My dad [1:40:13] loved his country and his [1:40:13] neighbors. He was a man of [1:40:14] faith who was kind to [1:40:15] everyone. And one thing he [1:40:16] always told my brothers and me [1:40:20] fear is the opposite of love. [1:40:20] When we make decisions out of [1:40:21] fear, we leave ourselves a [1:40:23] stray from our higher calling [1:40:25] this world a calling to be [1:40:25] brave and just and honorable [1:40:26] to be the best versions of [1:40:30] ourselves. I understand that [1:40:31] you're under immense pressure [1:40:31] and that people are trying to [1:40:32] politicize this issue so they [1:40:34] can manipulate it to serve [1:40:36] their agendas. Do not going to [1:40:37] did this is not about [1:40:38] politics. And we saw last week [1:40:39] has business owner set up and [1:40:41] explained how is affecting all [1:40:43] of a simple financial [1:40:45] logistics alone. This is about [1:40:46] taking our hard working police [1:40:46] force and turning them into [1:40:47] puppets for department that [1:40:48] already has their own funding [1:40:49] and manpower. It's putting [1:40:50] them in an unfair position [1:40:52] with their community, taking [1:40:53] them away from valuable time [1:40:54] protecting and serving and [1:40:55] forcing us to put a foot. The [1:40:59] if I'm not mistaken, the House [1:41:00] just passed a big beautiful [1:41:01] bill to triple funding for [1:41:02] immigration and custom. [1:41:03] Important for cement. If I'm [1:41:04] not mistaken, that funding [1:41:06] totals around 100 billion [1:41:10] dollars. All said so why do we [1:41:12] need to do their jobs for [1:41:13] them? Exactly. Why are we [1:41:13] being threatened? I'll tell [1:41:16] you why. Peak Hawking power [1:41:17] wielding bullying, trying to [1:41:20] take away your rights as a [1:41:21] governing body and send us the [1:41:22] message. You don't have a [1:41:22] choice in matters of defense [1:41:25] in your own city. A mandatory [1:41:25] agreement that's literally an [1:41:29] oxymoron. Silencing overriding [1:41:31] and coercion. That's not [1:41:32] democracy. Commissioners, [1:41:34] that's not democracy. That's [1:41:35] dictatorship. Ice is going to [1:41:36] continue about their mask [1:41:37] mission without [1:41:38] accountability. Transparency, [1:41:39] Art Harris, to due process, [1:41:40] you might be tempted to go to [1:41:42] the attorney general's threats [1:41:43] because they do. They want to [1:41:45] financially penalize us. But [1:41:46] are we already being [1:41:47] financially penalize if we pay [1:41:49] for their work? They want to [1:41:50] fire you, but they didn't hire [1:41:53] you. We did. We are standing [1:41:55] behind you. I chose last week [1:41:56] when Commissioner Leon's [1:41:56] moment of bravery is former [1:41:58] chief and current [1:41:59] commissioner. His decision to [1:42:00] fall for what he felt his [1:42:01] heart was right. Even though [1:42:02] it was hard inspired all of [1:42:04] us. So then at threats, I will [1:42:06] happily pay more taxes. If [1:42:07] that means I can go to sleep [1:42:07] at night with a clear [1:42:08] conscience. Knowing that I [1:42:10] made my decisions logic and [1:42:13] fairness and honor and love, [1:42:14] not fear. Thank you for [1:42:15] continuing to defend us and [1:42:16] our police and for making your [1:42:27] decisions today. After Mark is [1:42:31] Jeff and then Angela Hankins. [1:42:34] >> Now mayor commissioners. We [1:42:34] have to stop meeting like [1:42:38] this. Come to my bar. I'd [1:42:39] rather see you there of [1:42:43] waiting on some of the before [1:42:45] the world's in chaos right [1:42:46] now. Every day I wake up and I [1:42:46] try to find some shred of good [1:42:51] in my fellow humans. Being a [1:42:52] bartender in a tourist town, [1:42:52] you can imagine just how [1:42:55] daunting a task that is when [1:42:56] you deal with trunks all day [1:42:58] long. But last week you did [1:43:02] something good. You did [1:43:03] something brace. You gave us [1:43:04] hope a light at the end of the [1:43:09] tunnel. If you can go back on [1:43:10] that, you're going to destroy [1:43:12] the island's economy. It's [1:43:12] Morales, humanity. We went [1:43:14] over this last week and that's [1:43:17] what this is. It's humanity. [1:43:19] Get rid of the political. This [1:43:20] is not about being a Democrat. [1:43:22] This is not about being [1:43:23] Republican. This is good [1:43:24] versus bad. This is right [1:43:26] versus wrong. It's the golden [1:43:28] roles. It's being human. It's [1:43:31] having compassion. And [1:43:32] speaking of compassion, [1:43:33] something I didn't get to last [1:43:34] week have a lot of compassion [1:43:35] for the key West Police [1:43:36] Department. I have a lot of [1:43:47] compassion. Compassion. I have [1:43:48] for them. I don't want them [1:43:51] brought into this. They [1:43:51] deserve better. We deserve [1:43:53] better. It's a hollow report. [1:43:54] Stealing not recognizing your [1:43:57] country down right now. Don't [1:43:59] make it a hard feeling. Not [1:44:00] recognizing the town you call [1:44:02] home and the town that you [1:44:03] live. Good people ready stand [1:44:15] up to bullies. After Jeff is [1:44:19] Angela and then Ricky Arnold. [1:44:20] Jeffs Eagleson 27 Washington [1:44:22] street. I'm representing [1:44:24] myself tonight last week at [1:44:26] the meeting I rewatched [1:44:27] witness something that I think [1:44:28] was one of the best things [1:44:29] I've ever seen in local [1:44:31] government. And I don't mean [1:44:31] to make feel uncomfortable [1:44:34] that a bit. Commissioner Lee [1:44:35] came in to that meeting and [1:44:37] said you know, I felt I was [1:44:39] going to vote a certain way. [1:44:41] But and he mentioned heart [1:44:44] multiple times that his heart [1:44:47] was swayed by this community. [1:44:50] That is the basis of democracy [1:44:51] that works. And then he [1:44:52] switched his vote because of [1:44:54] that. We found a commissioner [1:44:56] who who found his heart and in [1:44:57] all sincerity, I think was the [1:45:01] best thing I've ever seen. [1:45:01] Similarly. And the mayor and I [1:45:03] disagree on variety of issues. [1:45:05] But she demonstrated the [1:45:06] ability to demonstrate courage [1:45:09] last week and I and and I [1:45:10] would get on the highest [1:45:11] mountain proclaim that. So we [1:45:17] had a commissioner, the foun. [1:45:17] Found his heart be found at a [1:45:18] member of the found their [1:45:22] courage in this Wizard of Oz [1:45:24] Moment. What we need to find [1:45:26] this week is wisdom and the [1:45:28] wisdom that we need to realize [1:45:31] is that you did not void the [1:45:32] agreement last week as was [1:45:33] reported by the press in so [1:45:34] many places as worries [1:45:36] reported by the attorney [1:45:38] general. You did not avoid it [1:45:41] as You found it voided you [1:45:43] founded void as an adjective, [1:45:45] which means that it never [1:45:47] existed. We are in the exact [1:45:51] same spot as South Miami. And [1:45:51] we really can't vote you if [1:45:54] you vote up to if you vote to [1:45:57] approve first agenda item, [1:45:57] you're going to create a lot [1:46:01] of hate here because no one [1:46:02] wants this. If you vote no on [1:46:03] it because of the way it's [1:46:04] worded. You're putting your [1:46:07] your own seats in jeopardy. We [1:46:08] don't want you to do that [1:46:11] either. What we want you to do [1:46:12] is postponed this Let's wait [1:46:14] and use some wisdom. Find out [1:46:16] what happens with South Miami. [1:46:19] So again, the thing to do is [1:46:21] right before you vote, please. [1:46:23] 3 times. Click your heels [1:46:25] together say there's no place [1:46:26] like home and vote to postpone [1:46:36] Thank you. After Angela is [1:46:41] Ricky and then Lori Kelly. [1:46:42] Joining all the other folks [1:46:45] who did this scared. So. [1:46:45] >> Good evening. Mayor [1:46:48] commissioners and staff. My [1:46:50] name is Angela Hankins Service [1:46:50] community as an educator for [1:46:54] over 20 years in the [1:46:54] classroom. I teach students to [1:46:56] think critically to listen. [1:46:58] Respectfully and to engage in [1:47:01] dialogue even when it's hard. [1:47:01] Because that's how democracy [1:47:05] works. That's how we solve [1:47:06] problems. That's how we grow [1:47:10] stronger as a community. What [1:47:11] we're witnessing now in [1:47:13] response to your decision to [1:47:15] avoid participation void, [1:47:16] adjective physician [1:47:18] participation and 2.87 g is [1:47:22] not democracy. Its bullying. [1:47:22] And as an educator, I know [1:47:24] bullying when I see it, the [1:47:25] threats and intimidation [1:47:26] coming from the governor and [1:47:28] the attorney general are [1:47:29] designed not to foster [1:47:34] dialogue but to silence it. [1:47:35] They're attempting to punish [1:47:35] this body for engaging in a [1:47:37] very kind of public discourse [1:47:40] that democracy demands. I want [1:47:41] to thank you for your original [1:47:44] decision. By avoiding that [1:47:45] agreement to participate in [1:47:48] the 2.87 g program was a [1:47:50] lawful valujet and choice that [1:47:52] reflected a commitment to [1:47:52] local control and public [1:47:54] safety. I believe our [1:47:57] neighbors and local business [1:47:58] owners, the people who spoke [1:48:02] last week. They highlighted [1:48:02] how this program has [1:48:04] contributed to racial [1:48:07] profiling, unjust detentions [1:48:08] and a breakdown of the trust [1:48:08] between immigrant communities [1:48:12] and law enforcement. You stood [1:48:13] up to the people who live and [1:48:15] work here and you did so [1:48:16] within the full scope of your [1:48:18] legal authority. But police [1:48:20] don't care about law or [1:48:23] nuance. They care about [1:48:24] control. And right now the [1:48:27] pressure you're facing is not [1:48:30] just about immigration policy. [1:48:31] It is also about whether [1:48:32] locally elected officials will [1:48:33] be allowed to make decisions [1:48:35] for their own communities [1:48:36] without being threatened or [1:48:41] silenced. If that precedent is [1:48:42] set the damage to democracy [1:48:47] won't stop here. This [1:48:48] commission has the support of [1:48:49] the people. If Key West and a [1:48:50] dedicated team of pro bono, [1:48:51] legal advocates ready to [1:48:54] defend your First Amendment [1:48:54] rights and your authority [1:48:56] under the law. You do not [1:48:58] stand alone. Your constituents [1:49:01] are asking you, please do not [1:49:04] see your authority as locally [1:49:08] elected officials. And finally [1:49:10] and my work. We tell our [1:49:11] students that healthy [1:49:12] democracy relies on reasoned [1:49:15] debate, not coercion. On [1:49:18] courage, not fear. So I urge [1:49:19] you to hold the line to show [1:49:22] our young people and the [1:49:24] entire state that in Key West, [1:49:26] we believe and to mock the [1:49:28] Democratic process. And we do [1:49:28] not allow police to govern [1:49:32] with fear. Please post on this [1:49:34] item and allow the courts. [1:49:36] Thank you for your time. Your [1:49:46] leadership and your integrity [1:49:48] so after Ricky, we have Lori [1:49:51] and then Lola Cook. Was a [1:49:52] timer. It's on the lectern to [1:49:53] see the order to get that. [1:49:58] Good. Rookie Arnold. 4 Bay [1:50:02] Drive q a I'm here to. Tell [1:50:06] ya, I come. From here. I'm 5 [1:50:07] generations. I married to [1:50:08] wife. [1:50:09] >> There has come from [1:50:13] communism. I want to go [1:50:15] through the citizenship [1:50:16] process becoming U.S. Citizen. [1:50:16] I've watched her family come [1:50:18] over and vote been with her [1:50:19] watched you. Her family come [1:50:21] over the border. I've watched [1:50:23] the one from both have to a [1:50:24] setback. Not sure where sister [1:50:27] is gone. The problem, I think [1:50:28] the key West is facing as a [1:50:31] whole. Is we have a lot of [1:50:34] rare e very good aggressive. [1:50:37] Come here even to America as a [1:50:37] whole. There's a lot of [1:50:40] hardworking people. And I take [1:50:44] nothing from. To get up to [1:50:45] work hard every day to take [1:50:45] because it's cooler to do [1:50:47] everything supposed to do. My [1:50:50] problem comes in. Is when I [1:50:52] see New York and California [1:50:53] and I see these other blue [1:50:55] states. That if we listen and [1:51:00] I'm not going to try not to [1:51:01] There's a lot of people in [1:51:03] this room that have come from [1:51:03] other states. The reason [1:51:06] they're coming here. It's [1:51:06] because we have control of our [1:51:11] island. The moment this island [1:51:15] becomes a sanctuary state. We [1:51:16] won't be having to be have [1:51:17] safe. Think we are going to [1:51:18] have to try and figure out how [1:51:19] to protect the very people [1:51:21] that are in here defending [1:51:21] people that are here when the [1:51:26] bad ones come. I'm saying. [1:51:28] Sign it back of the federal [1:51:28] government. And let's figure [1:51:30] out a way to fight and have [1:51:31] the immigration corrected. But [1:51:33] as for now, we need to protect [1:51:36] home. First. And then help [1:51:38] with immigration law. Second. [1:51:48] We come first. After Lori is [1:51:59] Lola and then Julie Hill. [1:51:59] >> I'm Lauren Kelly and I'm [1:52:02] here as a member of the Key [1:52:03] West Immigrant coalition and [1:52:05] the Immigrant Support Network. [1:52:09] And just because I love this [1:52:10] island. [1:52:11] >> And I gotta say I am [1:52:13] surprisingly in agreement with [1:52:14] MR. Arnold. [1:52:15] >> I think he's right. We need [1:52:17] to protect our island first [1:52:17] and deal with immigration. [1:52:22] Second. So I would like you [1:52:25] listen my beginning statement, [1:52:27] which is a quote from an [1:52:31] auspicious age who once said [1:52:34] slow down this ain't the [1:52:37] >> Last week you took a stand [1:52:40] to support our police chief by [1:52:43] agreeing to submit the 2.87 [1:52:45] agreement to your thorough [1:52:47] review to ensure that the [1:52:49] police officers can continue [1:52:53] to keep our community safe. [1:52:54] Without exposing him to extra [1:52:59] costs or liability. When faced [1:52:59] with an immediate threat from [1:53:01] the state officials. [1:53:02] Understand why the mayor [1:53:05] called this meeting and she [1:53:05] acted quickly to bring this [1:53:08] item to the commission. And we [1:53:10] appreciate that. You're [1:53:11] allowing us to deliberate this [1:53:12] together. We want you to [1:53:15] protect us. But thankfully [1:53:18] your decision last week allows [1:53:22] us to work at our island pace [1:53:24] and avoid rushing this [1:53:25] decision. You've given a [1:53:28] strong legal back up for [1:53:33] postponing item. One. Wow. [1:53:35] Approving items too, which [1:53:38] give us the backup of kind of [1:53:41] hiding behind South Miami to [1:53:44] wait and see what the [1:53:47] legislation and the judiciary [1:53:50] decide. And then we can also [1:53:55] agree on item 3. Which is just [1:53:57] simply to support the [1:53:57] extension that is already on [1:53:58] the books going through the [1:54:03] courts for Haitian tps. I [1:54:04] would encourage you to just [1:54:07] slow this down a bit for 2 [1:54:09] reasons. We can avoid [1:54:12] significant litigation costs. [1:54:13] Administration has made the [1:54:14] claim that ice agents do not [1:54:17] need to follow due process. [1:54:18] But this claim not been [1:54:22] settled in court and directing [1:54:23] our Key West pd officers to [1:54:25] participate in actions like [1:54:27] that leaves us open to [1:54:30] judgments like the 2018 Peter [1:54:32] Brown case when Monroe County [1:54:35] paid out hundreds of thousands [1:54:36] of dollars in fines for [1:54:37] improperly detaining one [1:54:41] person. So the people who [1:54:44] litigated that case, Natalia [1:54:46] Duke, the PRESIDENT Took [1:54:48] immigration. The aclu, both of [1:54:52] them have given new statements [1:54:53] that gives you a clear path to [1:54:57] avoid this in the future. The [1:54:57] second is that when you took [1:54:59] the time to move it, Island [1:55:12] pace, you allow us. [1:55:13] >> So after Lolo, we have [1:55:14] Julie Hill and then Maggie [1:55:18] would Good evening. [1:55:20] >> My name is Lola Cook. And [1:55:21] today I'm speaking for myself [1:55:22] as well as on behalf of my [1:55:23] mother, Sarah Compton, a local [1:55:25] business owner who couldn't be [1:55:27] here tonight. We reside in our [1:55:28] register to vote in 19, 0, 1, [1:55:30] South Roosevelt Boulevard. I'm [1:55:32] speaking today with urgency [1:55:33] and heartbreak because I know [1:55:35] why we're here. And I know [1:55:38] what you think you have to do. [1:55:39] A few days ago, this [1:55:40] commission made a brave and [1:55:42] morally sound decision. You [1:55:44] voted to end a voluntary [1:55:45] agreement that made our police [1:55:45] department part of the fear [1:55:48] driven machinery of ice. You [1:55:48] did that knowing the attorney [1:55:50] general would come after you. [1:55:54] And now here we are. I want to [1:55:54] remind everyone in this room [1:55:56] that what you did was not [1:55:58] illegal. You are not violating [1:56:00] the law. You are not declaring [1:56:02] a sanctuary city. You simply [1:56:05] chose not to voluntarily [1:56:06] participate in a program that [1:56:06] has led to people being taken [1:56:09] from their jobs off our [1:56:11] streets and disappearing. [1:56:13] People who have done nothing [1:56:15] wrong. Many of whom are [1:56:17] working through legal [1:56:18] immigration channels. You did. [1:56:18] What Key West has always [1:56:20] claimed to do you protected [1:56:23] your people? And because of [1:56:25] that, you're being threatened [1:56:28] with removal with punishment, [1:56:29] with political violence [1:56:30] disguised as legal [1:56:31] consequence. Let's call it [1:56:35] what it is. Intimidation. And [1:56:36] if it works, if you back down [1:56:37] now than the message that you [1:56:39] send to your community is this [1:56:40] when the state comes for you? [1:56:45] We'll let them. And I got it. [1:56:46] You're tired. You've been [1:56:47] through h# [1:56:47] # [1:56:47] # [1:56:49] with internal [1:56:50] investigations. Indictments, [1:56:51] power, struggles. Maybe you're [1:56:52] wondering if you have anything [1:56:54] left to fight with, but I'm [1:56:55] here to tell you this is the [1:56:58] fight worth having. If you're [1:57:00] going to spend political [1:57:01] capital spending on protecting [1:57:01] the people who live and work [1:57:03] in this community, if you're [1:57:04] going to stand for something, [1:57:07] let it be for dignity. Not [1:57:08] compliance. Let it be for [1:57:09] humanity, not political [1:57:12] safety. You gave this [1:57:13] community something we haven't [1:57:17] had a long time. And if you [1:57:18] undo that boat now you don't [1:57:19] just a policy you undo that [1:57:23] hope. You proved to the state [1:57:23] that a little pressure is all [1:57:25] it takes to crack key west. [1:57:27] But if you stand firm, you [1:57:29] send a different message that [1:57:31] we are not afraid of. Police, [1:57:34] that we are not pawns and that [1:57:35] this commission will not be [1:57:36] used to prop up an [1:57:37] authoritarian governor's [1:57:39] agenda, fear and division. [1:57:40] Stand up, only want to see z [1:57:41] and it's not a stand at all. [1:57:44] It's just survival. What you [1:57:46] did last week was bold. It was [1:57:48] rare and it was good. Please [1:57:51] don't undo it. Now, don't [1:57:53] trade courage for comfort. The [1:57:55] leaders we hope to wear key [1:57:57] West. The state needs to see [1:58:11] and be the line that doesn't [1:58:12] After Julie is Maggie and then [1:58:16] hurts us. [1:58:17] >> Hi, my name is Julie. Houma [1:58:17] resident, a key I want to [1:58:20] sincerely thank you. [1:58:21] >> For the decision you made [1:58:24] on JUNE 30 s we recognize the [1:58:26] immense pressure you face and [1:58:26] the serious threats directed [1:58:30] at you. Your courage in that [1:58:31] moment did not go unnoticed. [1:58:31] And we are here to support [1:58:36] you. We are urging you once [1:58:37] again not to allow our police [1:58:38] department to enter any [1:58:40] partnership with ice. We do [1:58:42] not want or local law [1:58:43] enforcement aligned with [1:58:43] federal immigration [1:58:46] enforcement. The choice you [1:58:46] make now will define your [1:58:51] leadership. If you give in to [1:58:52] the governor's pressure, you [1:58:53] turn away from the very people [1:58:54] who elected you are pleading [1:58:55] with you not to take this [1:58:59] pass. The nation is watching. [1:59:00] This is a crucial moment for [1:59:03] both principal leadership. We [1:59:07] want you to be brave. I urge [1:59:07] you to stand up and meet this [1:59:09] moment with decisive legal [1:59:12] action. We have the right to [1:59:12] self-govern without fear of [1:59:16] intimidation. And while the [1:59:17] governor MAY be applying [1:59:19] pressure, I ask you to remain [1:59:21] steadfast. This is not just a [1:59:23] local issue. It's part of a [1:59:24] much larger pattern of [1:59:26] overreach. Communities across [1:59:30] the country are facing. You [1:59:31] have the opportunity to lead [1:59:31] with strength, integrity and [1:59:35] courage. The decision you make [1:59:38] today will have real economic [1:59:39] consequences. People across [1:59:42] the country in the world are [1:59:43] already reconsidering travel [1:59:46] to Florida due to harmful and [1:59:47] dangerous policies. But you [1:59:48] have the power to show them [1:59:50] that we don't bow to unlawful [1:59:53] threats that we stand up for. [1:59:54] What's right. That's the key [1:59:54] West. We want the world to [2:00:00] see. I police support first [2:00:02] extending tps for a Haitian [2:00:03] community. It pains me deeply [2:00:07] that we have to have to frame [2:00:08] this conversation in terms of [2:00:08] numbers to justify the [2:00:12] protection of human lives. [2:00:13] Still, if you must talk in [2:00:14] terms impact, the data is [2:00:17] clear in 2022 Haitian tps [2:00:19] holders and those eligible [2:00:20] from the program contributed [2:00:22] estimated 222, but I'm sorry. [2:00:25] 22 billion in wages to the [2:00:28] U.S. Economy. They filled over [2:00:30] 600,000 jobs. Many of them in [2:00:31] industries are already [2:00:32] struggling with labor [2:00:34] shortages in key West. We [2:00:35] simply cannot afford to lose [2:00:37] this hardworking and the vital [2:00:39] work force. But beyond the [2:00:40] economic argument, it's [2:00:43] something far more important. [2:00:45] Human reality, he still [2:00:47] remains under us travel [2:00:49] advisory due to extreme an [2:00:51] ongoing instability. Those [2:00:51] returned to Haiti face not [2:00:54] only economic collapse and a [2:00:55] humanitarian crisis, but also [2:00:57] widespread gang violence, [2:00:58] including the terrifying [2:01:00] threat of rape and [2:01:02] persecution. Protecting [2:01:03] Haitian tps holders isn't just [2:01:05] the right thing to do [2:01:06] economically. It's the moral [2:01:14] thing to do. Thank you. [2:01:16] Banking is Maggie here. It [2:01:21] will go. Yeah. Okay. That's [2:01:26] fun. And then Stacy Stall. I'm [2:01:26] so proud of everybody in this [2:01:30] room tonight. Good evening. [2:01:33] Commissioners and city staff. [2:01:37] I want to thank you for [2:01:38] providing the documents on the [2:01:40] city's website regarding the [2:01:40] 2.87 g agreements. I've been [2:01:43] doing some reading. [2:01:44] >> I also want to thank you [2:01:46] for listening to your [2:01:47] constituents and boarding the [2:01:51] agreement at our last meeting. [2:01:52] However, I think you're wrong [2:01:53] to consider to reconsider. And [2:01:57] here is why. What kind of [2:01:59] state to we live in where a [2:02:00] governor and his attorney [2:02:01] general who's in contempt of [2:02:02] court, by the way, think they [2:02:06] have the right to threaten us. [2:02:07] With facts that are not really [2:02:13] that impressive. If even true, [2:02:14] anyone who checks out the [2:02:15] sheriff's office arrest log [2:02:16] everyday knows that we have [2:02:16] citizens of our own that are [2:02:22] doing the same thing. We still [2:02:22] live in one of the safest [2:02:26] counties in the state. On top [2:02:27] of that, they expect us to [2:02:31] trust a man who continues to [2:02:32] pass laws that strip people of [2:02:32] their rights and the courts [2:02:35] have to remind him they are [2:02:36] unconstitutional and shut them [2:02:41] down. And he's a lawyer. We [2:02:42] should have known what to [2:02:43] expect from a former jag [2:02:46] officer at who was somewhat [2:02:47] Lucy Goose see with the Geneva [2:02:51] Convention. Is immigration [2:02:55] policy broken? Yes, but that [2:02:57] blame rests on the federal [2:02:58] government who refuses to fix [2:02:58] it. And the donors who own [2:03:02] them. Let's get real. So now [2:03:06] we're being asked or coerced [2:03:08] to help with a policy that is [2:03:08] cruel on American racist and [2:03:10] wrong-headed. At some point, [2:03:13] the governed. Need to stand up [2:03:16] and say no. They don't really [2:03:20] need our help. They're [2:03:21] building a massive ice force [2:03:23] or police state from the [2:03:24] funding they got in their new [2:03:26] budget. The h# [2:03:26] # [2:03:26] # [2:03:27] with poor [2:03:29] folks, veterans the sick and [2:03:29] disabled much less the [2:03:33] undocumented. They are bullies [2:03:35] and cowards. Does it really [2:03:38] take 8 armed masked men and 3 [2:03:39] police dogs to grab one woman [2:03:41] off the street and separate [2:03:44] her from her child. They don't [2:03:47] really want our help. They [2:03:51] want to subjugate Make us. He [2:03:55] used to living in fear. Are we [2:04:00] brave enough to draw the line? [2:04:01] I urge you to join the lawsuit [2:04:02] with South Miami. We are not [2:04:04] the only city in Florida who [2:04:06] has said no. We must continue [2:04:10] to say no. This might just [2:04:11] give others the balls to do [2:04:14] the same thing. We the people [2:04:28] say no. So after Maggie, we [2:04:29] have Stacy and then Tyler that [2:04:34] are sure. Good afternoon, [2:04:35] MADAM. MADAM, Mayor, City [2:04:36] commissioners and staff. My [2:04:39] name is Maggie come. [2:04:40] >> I live and own a business [2:04:45] and district one. 3 weeks ago. [2:04:46] Through a simple Internet [2:04:48] search that anyone could have [2:04:50] done. I discovered agreements, [2:04:54] but Sheriff Ramsey and chief [2:04:55] Brandenburg signed to partner [2:05:01] with ice. It was me. I [2:05:01] probably couldn't those [2:05:02] documents be hard share that [2:05:06] with Commissioner Kaufman. [2:05:08] Shockingly neither nor the was [2:05:12] aware of these agreements. [2:05:13] Simultaneously. Community [2:05:16] advocates had already begun to [2:05:18] organize good people with [2:05:19] limited time and resources [2:05:22] sprang into action. We started [2:05:25] sharing information or that [2:05:26] became clear, but at least [2:05:28] eyes activity on the island. [2:05:32] Listen to violation of the [2:05:33] civil rights standards to [2:05:39] Britain 37 itself. They were [2:05:43] violating policies. By taking [2:05:51] have legal. I-30 to be here. [2:05:52] Reports of serious misconduct [2:05:52] and violations were coming out [2:05:57] and they still come out. Week [2:05:57] ago yesterday I walked into [2:06:01] this room. Thankful to be [2:06:02] sitting on this side of the [2:06:04] diocese and not yours. But at [2:06:07] the end of that meeting, I was [2:06:09] envious of you what you need [2:06:12] place in time. A pivotal [2:06:14] moment our history. We find [2:06:18] ourselves. Opportunities of [2:06:21] this importance are rare. And [2:06:22] the people take them make [2:06:27] history. Like most of last [2:06:30] week. I listened intently to [2:06:30] every speaker like you doing [2:06:34] tonight. I was particularly [2:06:36] impressed by the genuine [2:06:37] compassion on most of your [2:06:39] faces. About the speakers and [2:06:44] their concerns. I was equally [2:06:45] impressed with not just what [2:06:45] our community members said, [2:06:49] but how they spoken. Sensibly. [2:06:53] Calmly and respectively. You [2:06:55] have been given than enough [2:06:56] justification to opt out of a [2:06:58] partnership. I that this time. [2:07:05] Legal all ethical. Actions on [2:07:07] JUNE. 30th reinforced my in [2:07:12] this extraordinary island. [2:07:13] Without 2 passes and the [2:07:17] defense of basic human rights. [2:07:20] Simpkins are safer in West. [2:07:21] Human beings born outside [2:07:26] country. There's no crisis of [2:07:29] conscience here. Crisis of [2:07:32] identity, mask. Rest areas. [2:07:46] This is a crisis of courage. [2:07:47] After Stacy is Tyler and then [2:07:50] Theresa, She's I might [2:07:50] mispronounce that excuse make [2:07:59] of that. New Michael police [2:08:00] think killed there. It is [2:08:00] sorry about that. That was [2:08:03] stolen. Good evening, mayor [2:08:05] and commissioners. I am Stacy [2:08:06] Stall and I am a full-time [2:08:09] resident in District 4. [2:08:10] >> I'm speaking tonight as a [2:08:12] citizen of Key West whose [2:08:13] proud to live in a place that [2:08:16] values fairness process and [2:08:18] standing up to pressure even [2:08:21] if it's uncomfortable. Let's [2:08:22] not lose sight of what [2:08:25] happened here on JUNE. 30th. [2:08:26] This commission did the right [2:08:29] thing by avoiding the 2.87 g [2:08:29] agreement that was signed [2:08:30] without the authority [2:08:33] required. That vote was a [2:08:34] correction of a process that [2:08:37] was ignored. It was about [2:08:38] upholding the law and [2:08:39] protecting the city from legal [2:08:42] exposure. But now under [2:08:43] political pressure from [2:08:44] Tallahassee, we're being [2:08:46] pushed to reverse that [2:08:47] decision. And I'm here to say, [2:08:52] don't do it. You the attorney [2:08:54] general or the governor blind [2:08:56] obedience. You this committee [2:08:57] sound judgment and legal [2:09:01] clarity? If you vote to either [2:09:03] approve or reject this [2:09:04] resolution. Tonight, you risk [2:09:06] giving them exactly what they [2:09:08] want. Ammunition to claim that [2:09:09] Key West is violating Florida [2:09:13] statutes. Even if that's not [2:09:14] your intent, they will twist [2:09:16] your vote and say it is. And [2:09:19] as you've already heard, if [2:09:20] this resolution goes on the [2:09:22] record with the language [2:09:23] that's currently in it [2:09:24] conceding their claim that [2:09:26] were so-called sanctuary city. [2:09:30] That language will haunt us in [2:09:30] court filings in media [2:09:32] coverage political arenas. We [2:09:35] shouldn't fall into that trap. [2:09:36] We don't need to hand our city [2:09:38] over to Tallahassee spin [2:09:40] machines. What we need is to [2:09:43] do what South Miami is doing. [2:09:46] C could judgment from the [2:09:47] courts. Let them decide what [2:09:50] chapter 9 actually requires. [2:09:51] That's not defiance. It's due [2:09:54] process. I've also watched [2:09:56] this spin into a partisan [2:09:58] issue. That kind of politics [2:09:58] MAY play in state capitals are [2:10:02] on the news, but it doesn't [2:10:03] serve the people of Key West. [2:10:03] And right now this commission [2:10:06] needs to focus what's right [2:10:08] for all our consists [2:10:09] constituents and not on [2:10:11] scoring any more political [2:10:14] points. The city never been a [2:10:16] sanctuary city. Please follow [2:10:17] the law. They cooperate with [2:10:19] federal agencies would legally [2:10:21] required and that hasn't [2:10:23] changed. What has changed is [2:10:26] that we're being bullied. And [2:10:27] this commission has the power [2:10:31] and the responsibility to say [2:10:32] not here, not in Key West, not [2:10:35] when the stakes are this high. [2:10:37] I urge you to table this [2:10:39] resolution don't play into [2:10:40] their narrative. Don't hand [2:10:43] them the headline. Let the [2:10:45] courts decide what the law [2:10:46] actually says, not the [2:10:49] Tallahassee, politicians with [2:10:50] an agenda and your [2:10:52] constituents will stand with [2:10:52] you. Thank you so much for [2:11:04] your time and consideration. [2:11:05] So after Tyler is Theresa and [2:11:08] then Golden Isles. Good [2:11:09] evening. My name is Tyler. [2:11:12] You're a share. I live in [2:11:13] district 4 and the criminal [2:11:14] defense attorney and I'm [2:11:16] speaking as a private citizen. [2:11:18] Asking the city to postpone [2:11:20] resolution. One and [2:11:21] declaratory judgment regarding [2:11:22] our city's obligation to enter [2:11:26] into a 2.87 g agreement. [2:11:27] >> In 18, 0, 3, The Supreme [2:11:27] Court declared that it is, in [2:11:31] leave the province and the [2:11:31] duty of the judicial [2:11:34] Department to say what the law [2:11:37] is on the anniversary of our [2:11:38] independence. Our Attorney [2:11:38] General James Uthmeier seeks [2:11:41] to usurp the role from our [2:11:44] courts and Ben reality to his [2:11:46] political convenience. His [2:11:46] royal proclamation does not [2:11:50] override the text of the law. [2:11:50] Both Meyer writes that the [2:11:52] city of Key West as a [2:11:55] sanctuary city because we [2:11:55] recognized our 2.87 g [2:11:58] agreement as void. This has no [2:12:01] basis in law. The city [2:12:03] commission is responsible for [2:12:05] making policy, not the chief [2:12:07] of police. The previous 2.87 g [2:12:09] Agreement was never in [2:12:11] forcible. The alternative is [2:12:13] to allow the chief of police [2:12:13] to enter agreements that he [2:12:15] has no authority to make [2:12:16] because we are afraid of being [2:12:20] labeled a sanctuary city. [2:12:21] Sanctuary policies to find a [2:12:24] 908, 0.1 0, 3, as a policy [2:12:25] that prohibits or impedes [2:12:26] immigration law enforcement or [2:12:29] prohibits cooperation. Take [2:12:31] Key West Police Department has [2:12:34] supported ice and Border [2:12:35] Patrol before 2.87 g and will [2:12:38] continue to do so. This is not [2:12:41] the same as affirmatively [2:12:43] deputizing officers to enforce [2:12:45] immigration law. In fact, the [2:12:47] Florida Legislature has [2:12:51] expressly rejected sb and hb [2:12:52] which would have required [2:12:54] municipalities to adopt 2.87 g [2:12:55] further evidence that this is [2:12:57] a voluntary agreement, not a [2:13:01] sanctuary city policy. The [2:13:02] courts have the duty to say [2:13:05] what the law Declaratory [2:13:06] judgment clarifies the legal [2:13:07] rights and obligations of the [2:13:10] parties in dispute. Let a [2:13:14] judge decide who is right? The [2:13:14] Trump administration has [2:13:16] declared war against tps [2:13:18] holders vawa petitioners, [2:13:21] asylum seekers and [2:13:23] undocumented immigrants [2:13:23] affirmatively joining their [2:13:24] efforts will not remove the [2:13:27] target that's been placed on [2:13:28] Key West. The PRESIDENT Of the [2:13:29] United States has made his [2:13:31] racism and hatred against [2:13:34] Haitian people abundantly [2:13:35] clear deputizing law, local [2:13:36] law enforcement will only [2:13:37] bring more chaos and [2:13:39] heartbreak to our community. [2:13:41] There is no reward for [2:13:43] cowardice. Appeasement will [2:13:45] not save our community [2:13:46] solidarity will please be [2:13:47] brave again and stand up for [2:13:59] what is right. Thank you. So [2:14:00] after Theresa and Buildable [2:14:04] have Monica ca Cereus. Hi, I'm [2:14:05] Theresa Khaki and I've had the [2:14:07] privilege to call myself a key [2:14:08] West local for 6 years. And [2:14:10] there are many aspects of Qs [2:14:11] culture that make me proud to [2:14:14] be a part of this community. [2:14:15] >> From our inclusivity, the [2:14:17] way we stand up for [2:14:18] marginalized communities and [2:14:18] taking care of each other in [2:14:22] times of hardships and nothing [2:14:22] may be prouder to be a part of [2:14:23] this one human family. And [2:14:26] then on JUNE, 30th with the [2:14:28] decision made to avoid the [2:14:30] 2.87 g Agreement. To me, this [2:14:31] was a prime example of what it [2:14:33] means to be a key West are [2:14:34] going against the grain to [2:14:37] stand up for what is right. A [2:14:39] lot of people my age feel [2:14:41] abandoned by our government. [2:14:42] Many of my peers don't vote [2:14:43] because they feel their voices [2:14:44] don't matter. But JUNE 30th [2:14:46] was a testament to the fact [2:14:49] that our voices do hold power. [2:14:50] My community came out voiced [2:14:52] our concerns and you listened. [2:14:56] I thank you for that. I thank [2:14:59] you for the tremendous, [2:15:00] tremendous bravery [2:15:01] demonstrated by the city to [2:15:02] stand up for and represent the [2:15:06] voices of their constituents. [2:15:06] I beg you to show that same [2:15:08] bravery again because our [2:15:11] resistance against falling in [2:15:12] line with fascism and [2:15:13] xenophobia will only grow more [2:15:16] and more crucial. All eyes are [2:15:16] in Key West. Now. History is [2:15:21] watching. No one is saying to [2:15:23] let violent criminals lives in [2:15:23] Key West. What I'm saying is [2:15:25] that it is ridiculous to [2:15:27] target an entire population of [2:15:30] people labeling them all as [2:15:32] potential criminals. The vast [2:15:33] majority of those detained [2:15:35] this year are not violent [2:15:36] criminals and more than half [2:15:36] of them have no criminal [2:15:40] record at all. If government [2:15:42] is really targeting those who [2:15:43] are a drain on our resources, [2:15:44] not contributing to society, [2:15:45] then why are we going after [2:15:47] them at their places of work? [2:15:49] If we are after people not [2:15:50] following the law, why are we [2:15:51] detaining those in the legal [2:15:52] process of seeking asylum? [2:15:55] We're becoming a citizen if [2:15:56] we're truly targeting the [2:15:57] worst of the worst, why are we [2:16:00] going after children? I'm not [2:16:02] asking you to enable [2:16:03] criminals. I'm not asking you [2:16:05] to break the law, but I am [2:16:07] asking you to continue to [2:16:09] represent our voices and to [2:16:10] protect those in our community [2:16:21] most indeed. Thank you. Bill [2:16:23] to Monica and then Marlene. [2:16:26] >> somebody let me wonder your [2:16:29] brain shirts [2:16:31] >> commissioners. [2:16:32] >> MADAM Mayor. [2:16:38] >> Members of audience. I came [2:16:40] from Cuba in 1967. As a Cuban [2:16:47] refugee. So the subject of [2:16:47] immigration and immigrants is [2:16:48] very close to me. And I've [2:16:53] been involved. Every 10 years [2:16:53] and one, form of immigration [2:16:58] or another. I actually very [2:16:58] impressed by all the people [2:17:02] talking Very appreciative of [2:17:08] so much compassion. However. [2:17:10] Really strongly feel that this [2:17:12] whole issue here today, the [2:17:14] size immigration. Is [2:17:18] political. It's obvious by [2:17:21] everybody speak in. They hate [2:17:23] precedent, drum and then they [2:17:27] hate Ron DeSantis. That is [2:17:30] issue. Bill Clinton departed [2:17:31] people. George Bush deported [2:17:34] people. Barack Obama was [2:17:38] called the deporter in chief. [2:17:42] And I never ever heard Such [2:17:48] gatherings against it. So. [2:17:50] Appreciate it. But I don't [2:17:51] think they understand they [2:17:52] don't. They don't go to [2:17:54] Hialeah. They don't go to [2:17:57] Winn-Dixie. These are really [2:17:58] good. The bull was really good [2:18:00] intentions, but I don't think [2:18:03] any of them have lived. [2:18:03] immigrant and the immigration [2:18:09] issue. I don't I don't I don't [2:18:12] know what to say except. You [2:18:14] guys know what's right. You [2:18:17] guys know the law. I'm just a [2:18:20] citizen. I'm an immigrant. [2:18:22] Today. I'm an American citizen [2:18:23] for years that have followed [2:18:27] every law. That's what I was [2:18:28] taught when I came from q a [2:18:29] that was for things that had [2:18:34] to do. I had to learn English. [2:18:36] I had to get my immigration. I [2:18:39] had to vote and I had to pay [2:18:40] taxes and that's how you [2:18:44] become a good American a good [2:18:45] American and to as an American [2:18:48] here to protect my children [2:18:51] and my grandchildren. And [2:18:53] unfortunately, for the past 4 [2:18:55] years, there's been lot of [2:18:56] people coming to America that [2:18:58] we didn't know who they were. [2:19:00] And today, yes, there's a lot [2:19:01] of good people paying the [2:19:04] consequences. But they made [2:19:05] that decision and their home [2:19:06] country when they decided to [2:19:08] come here illegally. And [2:19:12] PRESIDENT Trump. Ran on on [2:19:13] that issue and he won on that [2:19:17] issue. And you can debate that [2:19:18] you MAY not like it. I'm [2:19:22] sorry. Don't like it. As [2:19:24] immigrant and a sick American [2:19:27] citizen. I am here to stand [2:19:30] with the police and with ice. [2:19:31] And I hope you vote the right [2:19:40] way. Thank you. After Monica [2:19:43] is Marlene and then Nick. Doll [2:19:48] that looks like. Sorry, short [2:19:49] short people problems over [2:19:51] here. Good evening, all and [2:19:53] thank you for having me. [2:19:55] >> My name is Monica and I [2:19:59] think since I was a year old. [2:20:00] Actually attended Glenn Archer [2:20:01] Elementary School within these [2:20:03] very walls. I receive school [2:20:04] awards right on the very [2:20:06] stage. You are sitting on. I [2:20:10] am a mother of 2, 2 boys. One [2:20:12] who is a type one diabetic. [2:20:13] I'm a daughter of immigrants [2:20:16] of Mexico. First off, I want [2:20:17] to thank you for your courage [2:20:18] on JUNE 30th. We put we [2:20:20] support and have your back [2:20:22] tonight. I come to give you [2:20:24] grace. You're standing at [2:20:25] threshold. The nation is [2:20:27] watching. Fear is thick in the [2:20:29] air. People have spoken with [2:20:30] fire with reason with urgency [2:20:34] and all of it matters. But [2:20:34] from my time, I want to offer [2:20:35] something that might matter [2:20:39] even more. Still a mess right [2:20:40] now before you vote. I want to [2:20:41] give you a moment to sit in [2:20:42] your own thought to not just [2:20:43] think like commissioner, but [2:20:46] feel like a human. I bring GOD [2:20:50] into this not to judge, but [2:20:50] her mind is that these [2:20:51] decisions echo. And to remind [2:20:52] you that GOD also has your [2:20:57] back and supports you. This [2:20:57] folk carries real wait for [2:20:58] children, for our neighbors, [2:20:59] for the feature of the island, [2:21:01] we call home and yes for your [2:21:05] own soul. So pause to sit with [2:21:08] GOD to ask what is right. As [2:21:08] for me, I've been through h# [2:21:08] # [2:21:08] # [2:21:10] and back and I'm still [2:21:14] standing because of my So I [2:21:15] say in the words of the [2:21:17] singer, songwriter, Rod Wave, [2:21:18] I'm not scared aware where [2:21:23] Wolves vampires, but man, I'd [2:21:23] always lose sleep when I can [2:21:27] set my people free and neither [2:21:29] should you be scared. So be [2:21:30] brave again tonight. Be brave [2:21:30] and choose love when power [2:21:34] would be easier if this is the [2:21:35] only moment I'm ever given in [2:21:37] a room like this, let it be [2:21:40] known. I used it to him by GOD [2:21:41] And also if you happened to [2:21:43] attend Saint Mary star of the [2:21:45] Sea, here is some fun facts [2:21:47] for you when you're sitting in [2:21:48] that church, you're sitting in [2:21:49] a skate, sacred space that [2:21:51] doesn't pray for protection [2:21:53] from hurricanes but also pays [2:21:54] for protection over migrate [2:21:57] migrants crossing oceans, [2:21:58] children, fleeing violence and [2:22:00] families searching for safety. [2:22:02] So with all of that being [2:22:05] said, GOD bless Key West, GOD [2:22:06] bless America. The greatest [2:22:08] country of all time. Be a part [2:22:10] of this next chapter and love [2:22:14] and justice encourage to one [2:22:16] human future. The grace of the [2:22:17] Lord be with GOD's people. A [2:22:18] man police said in silence [2:22:34] with me for 30 2 seconds. [2:22:52] Thank you all. Have a great [2:23:02] night. So we have Marlene Neck [2:23:07] and then Joanna Andra sec. And [2:23:07] Dr Marling College I am a [2:23:10] full-time resident of district [2:23:11] 4. [2:23:11] >> nice thing about going so [2:23:12] late in the evening as I can [2:23:15] cut off half of my my speech [2:23:18] here. It won't be too long. [2:23:21] You know, as we had 70 Elkann [2:23:23] speakers tonight telling us [2:23:24] why we should postpone the [2:23:26] 2.87 g Agreement. Let the [2:23:28] courts decide our next steps [2:23:29] that not entering into this [2:23:33] agreement. Absolves all of us, [2:23:35] the potential liability in the [2:23:36] fiscal responsibility should [2:23:37] an issue occur while engage [2:23:38] our police department is [2:23:40] engaged in supporting ice [2:23:41] activities. So we all know on [2:23:42] JUNE 30th Commissioner Carey [2:23:44] was a lone dissenting vote. [2:23:46] When all of you supported to [2:23:48] void the 2.87 g agreement. And [2:23:51] I want to remind all of us [2:23:52] that our district consists of [2:23:53] members from all walks of life [2:23:57] and that voting to appease the [2:23:58] Tallahassee conservatives is a [2:24:01] disservice to everyone in our [2:24:03] districts because we are all [2:24:06] all sides of the spectrum [2:24:07] here. Ronald Reagan is [2:24:08] conservative and he addressed [2:24:10] immigration extensively during [2:24:12] his presidency and through the [2:24:13] Immigration and Reform Control [2:24:15] Act worked to create a balance [2:24:16] by welcoming immigrants all [2:24:18] while maintaining control over [2:24:20] our borders and the importance [2:24:21] and I quote of a reasonable, [2:24:22] fair, orderly and secure [2:24:23] system of immigration. Rca [2:24:27] also granted amnesty and legal [2:24:28] status to millions of [2:24:29] immigrants who entered the [2:24:30] U.S. Prior to JANUARY. First [2:24:33] of 1982, in his city on the [2:24:35] Hill. Farewell speech from [2:24:35] JANUARY of 89. He said that [2:24:38] America was a beacon, still a [2:24:39] magnet for all who must have [2:24:42] freedom. He believed in that [2:24:46] immigration was noble. That [2:24:47] America was a nation of [2:24:48] immigrants transformative and [2:24:50] a shining light for all [2:24:52] nations. All that being said, [2:24:53] there's been a massive shift [2:24:54] in the arrest made between [2:24:56] Customs and Border Patrol and [2:25:00] ice prior to JANUARY of 25, [2:25:01] most immigrant arrests ribeye [2:25:03] cpb at the borders. But now [2:25:05] most arrests by ice inside the [2:25:09] U.S. In our own house. In [2:25:13] JANUARY. 25 62% of immigrant [2:25:14] arrests were criminals [2:25:14] criminals. But last month, [2:25:15] only 30's put 6% of immigrant [2:25:17] arrests were classified as [2:25:18] criminals. Ice also assigns [2:25:19] levels to their arrest with [2:25:21] level one being the most [2:25:23] severe. And according to data [2:25:25] published by ice themselves as [2:25:27] of last month, only 7% of [2:25:31] arrests for level one. The [2:25:32] remaining 83% of all arrests [2:25:33] were classified by ice [2:25:36] themselves as no threat level. [2:25:37] None of this is a conservative [2:25:39] or liberal issue. It's a human [2:25:42] issue. The bulk of the ice or [2:25:43] for non criminals. These non [2:25:44] criminal arrests continue to [2:25:45] harm the good people of our [2:25:46] community and the immigrants [2:25:48] in which our country was [2:25:50] founded, most of whom believe [2:25:52] that the U.S. Remains as [2:25:53] Reagan begin still a magnet [2:25:56] for all who must have freedom. [2:25:57] You are volunteering our [2:25:58] police department to coast [2:26:00] side. All that's wrong with [2:26:00] how isis treating are law [2:26:03] abiding immigrant community [2:26:05] and placing our city in [2:26:06] physical danger. The brain do [2:26:07] not support signing the [2:26:08] voluntary to 87 agreement. [2:26:19] Thank Is here. That will move [2:26:25] to Joanna. Joanna and then [2:26:25] Michael Berman. [2:26:26] >> Followed by Roberts and [2:26:30] John. [2:26:33] >> My name is Joanna under And [2:26:34] I've lived here full-time for [2:26:35] the past 5 years. But my [2:26:39] family is called a the Keys [2:26:42] home since I was 14. Last [2:26:43] week. Those communities cries [2:26:46] did not fall on deaf ears. [2:26:47] Commissioners, you brought a [2:26:49] smile to all our faces. Are [2:26:51] nearly unanimous vote to avoid [2:26:55] 2.87 g. Speaking with those [2:26:57] who attended the meeting that [2:26:58] day. I can see that this [2:27:00] decision brought hope to [2:27:02] people who have been feeling [2:27:02] that democracy in America, [2:27:06] frankly. Was dying. If you go [2:27:08] back on last week's decision, [2:27:09] you will be crushing that [2:27:13] hope. Every day. We wake up to [2:27:17] news of mask, ice troops [2:27:18] rolling up to neighborhood [2:27:19] parks and Ali and armored [2:27:20] vehicles in full tactical [2:27:22] gear. Spreading fear in the [2:27:27] hearts of this nation. 2 new [2:27:28] merchandise promoting the [2:27:30] conversion of our conservation [2:27:31] lands in the Everglades into [2:27:34] Alligator Alcatraz to our [2:27:36] friends still trapped in [2:27:37] detention centers where they [2:27:38] are starved and mistreated [2:27:43] with no end in sight. How can [2:27:44] ask our local police? Many of [2:27:45] whom grew up here to be a part [2:27:49] of this. We cannot let them be [2:27:51] used as a weapon of an [2:27:52] authoritarian regime. [2:27:55] Hell-bent on imposing their [2:27:56] twisted vision of a white [2:28:00] washed America. I urge you to [2:28:03] continue to hold your ground [2:28:05] on recognizing 2.87 g as void [2:28:07] and to join the city of South [2:28:09] Miami and its case against the [2:28:11] state's position on what is [2:28:15] voluntary agreement? Please [2:28:16] stand with the people who make [2:28:18] this community a vibrant and [2:28:20] resilient help continue the [2:28:23] great tradition of Key West as [2:28:23] this seat of the southernmost [2:28:28] resistance. As it was during [2:28:30] the Civil war. For the 1982 [2:28:31] roadblock, they gave this [2:28:32] place its name as the Conch [2:28:36] Republic. I want to leave you [2:28:38] all of the It's an oldie but a [2:28:41] goodie by the German Lutheran [2:28:42] Pastor Martin, you know, [2:28:43] Mueller written in 1946, after [2:28:47] World War, 2. First, they came [2:28:48] for the communists and I did [2:28:49] not speak out because I was [2:28:53] not a communist. Then they [2:28:55] came for the Socialists and I [2:28:56] did not speak out because I [2:28:59] was not a socialist. Then they [2:29:01] came for the trade union. Us [2:29:02] and I did not speak out [2:29:02] because I was not a trade [2:29:06] unionist. Then they came for [2:29:07] the Jews and I did not speak [2:29:09] out because I was not a ju. [2:29:12] Then they came for me. And [2:29:13] there was no one left to speak [2:29:18] out for me. Please let us not [2:29:21] repeat that mistake. Speak out [2:29:33] for your community. Thank you. [2:29:35] So after Michael is Robert and [2:29:38] then Brailey Prescott, Aruba. [2:29:39] >> Good evening. I'm Adam Air [2:29:41] and the commission. I'm [2:29:44] Michael Berman are Member of [2:29:46] this community for over 40 [2:29:51] years. I'm gonna keep my [2:29:52] remarks brief because most of [2:29:54] what I wanted to say has been [2:29:55] said more eloquently than I [2:29:59] could possibly put it. 2.87 g [2:30:06] is a voluntary. Commitment. We [2:30:08] are not under constitutional [2:30:09] imperatives to do the job of [2:30:12] the federal government. We [2:30:14] have just had the opinions [2:30:16] tonight. Several attorneys, [2:30:18] including experts in [2:30:20] immigration law and the aclu [2:30:22] of Florida, the entering into [2:30:27] 2.87 g Agreement is not only [2:30:27] voluntary, but it is in fact, [2:30:28] in contradiction to the laws [2:30:31] of the state of Florida. There [2:30:33] is an active ongoing lawsuit, [2:30:36] but the city of South Miami [2:30:37] joined by multiple legal and [2:30:38] other organizations against [2:30:40] the governor and attorney [2:30:42] general of Florida. Why not [2:30:44] join this lawsuit in order to [2:30:49] stand up? For the role of law. [2:30:49] Not for the politicians in [2:30:53] Tallahassee. Along with [2:30:55] Commissioner Kalfin. I ask the [2:30:57] commission to postpone any [2:31:00] decision tonight on 2.87 g and [2:31:04] to legal advice. I support the [2:31:08] Key West Police and their [2:31:09] mission to maintain peace and [2:31:11] safety in our city. Not to do [2:31:15] the dirty work of ice agents [2:31:17] who work in disguise because [2:31:18] they know they are committing [2:31:22] evil. I only ask that you, [2:31:24] MADAM Mayor and you [2:31:26] commissioners fulfill the [2:31:27] expressed will the [2:31:28] overwhelming majority of your [2:31:39] constituents. Thank you. Can [2:31:40] use that after Robert and [2:31:43] bravely to be Caitlin Fuller. [2:31:43] Thank you very much, Robert. [2:31:50] Centrum. I'm here in a [2:31:51] different role tonight. In [2:31:53] last time I was here. [2:31:54] >> And that's to speak on [2:31:55] behalf of our 2 ministers at [2:31:59] the church that I attend [2:32:00] Covenant Presbyterian. They [2:32:01] couldn't be here because of [2:32:04] medical issues that they're [2:32:05] dealing with. The good is they [2:32:07] had 2 pages. They want me to [2:32:08] read. I'm only going to read [2:32:10] one paragraph because I think [2:32:14] it's most appropriate. And I'm [2:32:16] going to read it verbatim. As [2:32:18] the Co Pastors of Peace [2:32:19] Covenant Presbyterian Church [2:32:24] in Key West. Rest assured that [2:32:25] the good people of fees, [2:32:26] Covenant Presbyterian Church [2:32:32] are praying for you. To remain [2:32:32] steadfast and not sway from [2:32:36] what is just and right. We are [2:32:39] so very proud of your. Vote on [2:32:42] JUNE 30 s and we stand with [2:32:47] you in that position. We [2:32:47] covenant not to abandon you [2:32:50] and your position to stand the [2:32:52] test. Indeed. We believe GOD [2:32:54] will give you the endurance [2:32:57] and courage to stand the test. [2:32:58] The same endurance and courage [2:33:00] that Jesus used to stand the [2:33:06] test for us. So that [2:33:07] summarizes the position of our [2:33:08] 2 pastors are newly here in [2:33:13] Key West from from Colorado. [2:33:15] And they are so impressed with [2:33:16] what the city commission did [2:33:18] just a few weeks ago that they [2:33:20] felt the need to speak out. [2:33:23] And in closing, I made a [2:33:24] comment after meeting last [2:33:30] week. And the comment was the [2:33:34] little mouse that roared. And [2:33:36] that's what with this [2:33:37] commission did this little [2:33:40] town To the bullies in [2:33:44] Tallahassee. And did what was [2:33:45] right in your minds. And I [2:33:48] just to see chew to stand the [2:33:50] test and do what you know is [2:33:53] right. And I want to thank all [2:33:53] of the people that are [2:33:54] speaking is I've never in my [2:33:59] life. Seeing such eloquence [2:34:00] and civility in the meeting [2:34:01] such as this. And I thank all [2:34:03] of you all for taking the [2:34:04] patients to listen to us. Have [2:34:17] a good evening. [2:34:17] >> After bravely to Caitlin [2:34:19] and then Max Pezzetti. [2:34:23] >> Hey, how are ya? MADAM [2:34:24] Henry cause want visit for a [2:34:27] formal here? My name is [2:34:28] Bradley Press got a rude. I've [2:34:28] been a resident of Key West [2:34:30] for 10 years now. Time has [2:34:34] flown by. I am originally from [2:34:36] Massachusetts, which means I [2:34:37] was raised with one of the [2:34:38] best education say you can get [2:34:41] in the United States. That [2:34:42] didn't mean that I wasn't a [2:34:43] part of systems that made it [2:34:47] hard to come up. I never [2:34:48] thought that I would be able [2:34:48] to go to college. I never [2:34:50] thought I'd be a person that [2:34:55] owned expensive car or Holden [2:34:56] American Express or even leave [2:34:58] the United States and travel [2:34:59] out. It's never something that [2:34:59] I thought would be afforded to [2:35:03] me. But here I am. I have [2:35:04] graduated college. I hold an [2:35:07] American Express. I drive a [2:35:09] car that old. Dude's ask me. [2:35:12] Did Eddie Buy that for you? [2:35:18] I'm mommy. I bought it for [2:35:19] >> I have traveled over 40 [2:35:20] countries. Now I jump out of [2:35:21] planes. I write a kite and I [2:35:26] have. Written across countries [2:35:26] by myself on a motorcycle. I [2:35:30] couldn't even pick up. I'm [2:35:32] here and my heart is racing as [2:35:35] I'm sure yours is too. This [2:35:39] country is one that I am [2:35:40] really proud of. Reading [2:35:42] textbooks growing up. I was [2:35:45] always like I would be her in [2:35:46] that situation. Didi, I voted [2:35:48] for you because I wanted to be [2:35:50] you in this situation. Have [2:35:53] the ability to make the right [2:35:55] choice. Last week I was at [2:35:56] work. I had to make money [2:35:57] because I got to make rent [2:35:57] because just take care, man. [2:36:02] Take care of my mom, too. I'm [2:36:03] here. This week. I signed a [2:36:08] couple days ago. Dined at my [2:36:08] honestly, I hope that you do [2:36:09] the right thing here tonight. [2:36:13] It scares me that this is the [2:36:15] person sitting to your right [2:36:16] because I know that that does [2:36:16] Sheehan's stand for what I [2:36:18] stand for. But I have we hope [2:36:22] that you do. We traveled to [2:36:23] Cuba together on a unesco [2:36:25] World Conference together. I [2:36:28] know you know what is right? I [2:36:29] know that you were put into [2:36:30] office because there are [2:36:34] people here just like you that [2:36:35] have families for generations [2:36:35] after generations that work [2:36:37] there passes off to get where [2:36:40] we are today to have something [2:36:41] that our grandparents and [2:36:43] their parents before them. [2:36:45] Think they would never have. [2:36:46] And now we have that [2:36:49] opportunity. And as for our [2:36:51] police, we love you guys. I [2:36:53] serve you breakfast too. [2:36:54] >> I love the cause the [2:36:59] horses. Forces. We love them [2:37:00] that we don't want to look at [2:37:02] you guys differently. We want [2:37:03] to be on your side. We want [2:37:05] you to be on our side. 2.87 g [2:37:08] does not reflect that and it [2:37:13] reflects. It reflects fascism, [2:37:15] unfortunately. And you don't [2:37:16] have to succumb to that. You [2:37:19] have power. Spiegel. So do it. [2:37:31] Speak for us. [2:37:32] >> So we have Caitlin Max and [2:37:38] then rob Plumber. Hello and [2:37:39] thank you for being here [2:37:44] today. My name is Kate. When I [2:37:44] first moved to q when I first [2:37:48] came us 19 years ago, I was a [2:37:49] teenager and I came from a [2:37:51] small town with one red light. [2:37:51] 35 kids in my graduating class [2:37:53] and little to no diversity. [2:37:54] The only people in my [2:37:56] community back did not look [2:37:59] like me migrant workers. Who [2:37:59] kept our farms and our [2:38:02] extremely rural area running. [2:38:03] And as I grew older, I realize [2:38:05] how important they were to our [2:38:07] community. Not only on a [2:38:08] personal level because over [2:38:09] the years they became close [2:38:13] friends and even like family. [2:38:14] But on a level of the highest [2:38:15] importance without them, we [2:38:16] didn't have the manpower or [2:38:16] the man willing to do the work [2:38:18] that they were doing day in [2:38:20] and day out. Happily and more [2:38:23] importantly, they were safe, [2:38:25] welcomed and loved by our [2:38:26] community and respected as [2:38:29] human beings. I remember [2:38:30] coming us for the first time [2:38:31] in meeting so many different [2:38:33] people from all over the [2:38:34] world. And I don't know how to [2:38:35] describe it because if you [2:38:37] know, you know, but I knew [2:38:38] that I was if I was lucky [2:38:39] enough, one day I could call [2:38:43] this place my home. The one [2:38:44] human family motto wasn't even [2:38:45] something I had known about [2:38:46] back then. But it is something [2:38:48] that I truly felt on a deep [2:38:49] level. Now, I have been a [2:38:50] permanent resident here for 4 [2:38:53] years. And though short but [2:38:53] beautiful for years that I [2:38:57] have spent here, everything [2:38:57] that I fell and experience [2:39:00] back then all started to make [2:39:01] complete sense. The community [2:39:02] that welcomed me, the friends [2:39:04] that became family, the [2:39:04] coworkers, it became a part of [2:39:07] my everyday life from all [2:39:08] walks of life from all over [2:39:09] the world. It embody that [2:39:11] feeling that I had as a young [2:39:13] woman experiencing the [2:39:15] diversity and magic of this [2:39:16] island when our political [2:39:18] climate started to change, I [2:39:19] remember flying back to the [2:39:20] mainland here and there and [2:39:21] every single time I did that, [2:39:22] I remember feeling like I [2:39:24] could not wait to come back [2:39:25] home here to Key West because [2:39:27] no matter what was going on up [2:39:29] there, I knew that Qs was [2:39:31] organically protected because [2:39:31] of the one human family model [2:39:35] that we truly look by. And now [2:39:37] here we making national news, [2:39:38] which by the way means it's [2:39:42] working. Fighting a fight, [2:39:43] begging for human rights for [2:39:46] our neighbors, friends and [2:39:49] families. When the 2.87 g [2:39:51] Agreement was signed up on by [2:39:52] our police department, it was [2:39:52] done. So without clear [2:39:53] knowledge of what was legal or [2:39:57] not. And to be frank, what [2:39:59] even is legal versus not [2:40:00] anymore when our own federal [2:40:01] government isn't even abiding [2:40:03] by the laws by not allowing [2:40:05] due process and changing laws [2:40:05] to better fit their agenda so [2:40:08] that they can legally enforce [2:40:09] their narrative. How are we [2:40:09] supposed to even know what is [2:40:12] real and what isn't, which is [2:40:13] why I don't condemn our law [2:40:13] enforcement agencies for [2:40:16] agreeing to that. Clearly we [2:40:19] all love and support and more [2:40:20] importantly trust our police [2:40:21] department. And I would love [2:40:23] to keep it that way. But that [2:40:24] is why our government is [2:40:25] equipped with a system of [2:40:26] checks and balances to ensure [2:40:27] that even opposing political [2:40:29] parties or not overreaching to [2:40:30] ensure that all of our voices [2:40:33] are heard. And that is what we [2:40:36] saw last Monday when you as [2:40:37] our commissioners voted to end [2:40:38] this agreement, that is a [2:40:39] democracy. And that is working [2:40:40] for your constituents. Thank [2:40:56] you. Max. Is there. Max, The [2:40:58] move to rob Plumber, Keenan [2:40:58] Morrison and then Aaron Street [2:41:04] back. Parents not hear Keenan. [2:41:07] You're gonna pass rob Plumber. [2:41:14] Carter Nasser. Joey Phillips. [2:41:26] Saw him there. He is okay. [2:41:28] >> My name is Sherry Phillips. [2:41:29] I'm here representing myself [2:41:30] today. Good evening that a [2:41:33] mayor commissioners, staff [2:41:34] people with Key West. Good to [2:41:38] Well, holy cow. I'm filled [2:41:40] with a little regret. They [2:41:41] asked called up for work [2:41:41] early. Sorry, co-workers, [2:41:42] thanks for covering. I totally [2:41:44] couldn't waited because of how [2:41:48] many people came to speak. I [2:41:49] haven't lived on the island [2:41:51] for very long, but I fell in [2:41:52] love with Key West really [2:41:55] fast. And I think will I know [2:41:55] the reasons I fell in love [2:41:56] with that so quickly is [2:41:58] because of its community. It's [2:41:59] what the community does for [2:42:03] Key West that I think what [2:42:03] makes it really special worth [2:42:05] living. So I play a small role [2:42:05] in trying to preserve and play [2:42:08] my part in doing that. And I [2:42:09] can say in the short time that [2:42:10] I've been here, I've never [2:42:12] felt more proud to be a key [2:42:15] West citizen. Then on JUNE [2:42:16] 30th, when we set up to [2:42:18] fascism, I mean, that's how I [2:42:19] see it. You know, people [2:42:19] smarter than me can label it [2:42:20] what they will. But one key [2:42:24] West. I feel like truly stood [2:42:25] up for the motto that it totes [2:42:28] defending one human family was [2:42:29] the first time I felt like I [2:42:32] lived in a city that put its [2:42:33] money where its mouth was. And [2:42:34] it was really awesome. And now [2:42:36] less than a week later. Here [2:42:38] we are. I feel jumping the [2:42:42] gun. You know. I don't know [2:42:43] for what reason. I think a lot [2:42:44] of people smarter than me have [2:42:47] shown us avenues has to how we [2:42:48] can, you know, postpone it or [2:42:51] not. Enter to agreement. They [2:42:52] do want to take a second to [2:42:53] try to do away with this false [2:42:54] narrative that the urgency [2:42:58] that ice is, you know, needs [2:42:59] to be in our community. Why [2:43:00] they need why we need to [2:43:01] corroborate them is cooperate [2:43:05] with them. So thoroughly. Is [2:43:05] because there's a threat, you [2:43:06] know, to people's public [2:43:08] safety, their violent illegal [2:43:10] immigrants here that is [2:43:11] utterly false. The only [2:43:13] immigrants that I know are MAY [2:43:15] are my neighbors are my [2:43:17] coworkers are our mothers, our [2:43:17] daughters, our fathers, our [2:43:19] sisters, our brothers. [2:43:19] >> And they're kidnapping [2:43:23] those people. Who are here [2:43:27] legally. And Sort of a little [2:43:28] move that you think it's [2:43:31] crazy. I feel like the key [2:43:31] West community is truly under [2:43:35] attack. And I feel really [2:43:37] proud that the city stood up [2:43:38] for its community and it's [2:43:38] done its part to try to [2:43:42] protect. You know, it's it's [2:43:43] community its people, the [2:43:43] people, you know, it's life. [2:43:45] Everyone who lives here. So [2:43:46] thank you for letting us [2:43:49] today. Thank you for. Being [2:43:50] brave on JUNE 30th. And I hope [2:43:54] that you will do what I think [2:43:56] is not a radical action is all [2:43:58] at all. We're simply asking [2:44:01] for you to postpone the item [2:44:01] and to let us see how it will [2:44:04] play out in the courts. It's [2:44:05] not a radical action. It's not [2:44:07] crazy. It's not a declaration [2:44:08] of war. Just playing it safe. [2:44:12] Your listening to your to the [2:44:12] community. You're listening to [2:44:14] Key West by doing this and [2:44:24] yeah, thank you for your time. [2:44:28] >> Daniela Valdez. Daniela [2:44:39] Valdez and then Genovese Sapa. [2:44:40] Good evening, Mayor. Good [2:44:44] evening Commission. I did not [2:44:45] right anything for this [2:44:46] because I didn't think I was [2:44:48] going to speak today. But as [2:44:50] somebody that was born and [2:44:50] raised in Qs, I felt like I [2:44:56] needed to. There is a lot of [2:44:57] unjust things going on in our [2:45:00] country right now. Like Mister [2:45:02] Arnold did state earlier. We [2:45:06] do have to keep. Key West [2:45:07] first and I agree [2:45:10] wholeheartedly on that. I was [2:45:10] born and raised here. I've [2:45:12] been here. 22 years of my [2:45:13] life. I love this town. I love [2:45:16] these people. My co-workers, [2:45:18] my classmates, everybody. Just [2:45:23] coming here for a better life. [2:45:25] And people are being [2:45:27] kidnapped. We don't know where [2:45:29] they are. They're not here. We [2:45:30] don't know anything that's [2:45:34] happening. Certain people that [2:45:34] have been out there for [2:45:40] months. And that's not ok. And [2:45:41] you guys did a very, very [2:45:42] brave thing last week. I [2:45:42] couldn't be here. I was [2:45:46] working. But you did very, [2:45:47] very brave thing and they are [2:45:48] listening. Everybody's [2:45:51] listening right now. And we [2:45:55] need to continue being brave. [2:45:57] It's point blank period. [2:46:00] That's it. We have to for our [2:46:01] community, for our economy [2:46:02] because that's very important [2:46:06] to us. We have just be brave. [2:46:16] Thank you. Genevieve still [2:46:28] here? Okay. Carter Nassar. [2:46:33] >> I have never then front of [2:46:34] anybody to publicly speak or [2:46:37] anything like that. Sorry from [2:46:41] little bit nervous for shaky. [2:46:44] But to start off my name is [2:46:45] Carter Nassar and where the [2:46:46] cameras hello world. I got 3 [2:46:47] minutes to say something [2:46:52] that's really important. Key [2:46:53] West is unfortunately not a [2:46:57] sanctuary more. We used to [2:46:58] take care of the people who [2:47:02] came here. Go. On a [2:47:02] life-threatening mission. [2:47:07] Cross the ocean. And this was [2:47:11] a place of opportunity for [2:47:12] >> There's co-worker's family [2:47:15] members. There's people who [2:47:16] are trying to support a [2:47:21] family. Try not to come at [2:47:21] this with an emotional [2:47:22] standpoint. And instead I want [2:47:23] to try comes factual [2:47:28] standpoint. About 93% of all [2:47:29] people who have been picked up [2:47:30] by ice so far they have not [2:47:33] been convicted of a felony. [2:47:35] The people who put out a post [2:47:37] publicly to the key West [2:47:38] public, they decided net pick [2:47:39] in that early find the needle [2:47:40] in the haystack. [2:47:42] >> Of people who committed. [2:47:47] Crimes that are not worth [2:47:47] saying publicly because [2:47:48] unfortunately depict the [2:47:49] sharpest tool and this battle, [2:47:51] it's not fair because what the [2:47:54] vast amount of them being safe [2:47:54] supporting each other, trying [2:47:56] to help each other being. A [2:47:59] safe citizen Key West. I think [2:48:01] it's our job to protect those [2:48:02] people. Fortunately for you [2:48:05] guys. You have the power to do [2:48:07] that. You have the voice. I [2:48:09] have 3 minutes and I [2:48:10] appreciate the effort us [2:48:14] taken. It is bravery as cliche [2:48:16] as it sounds stand up for [2:48:17] yourself. That's the hardest [2:48:20] thing to do. And stand up for [2:48:21] the people who stand behind [2:48:23] you. That's even harder [2:48:24] because to find the courage to [2:48:27] defend people. That takes a [2:48:31] lot of work and you guys have [2:48:31] done the work and got to the [2:48:33] position where you guys are. [2:48:34] All right. Thank you for all [2:48:36] that you've done. I thank you [2:48:37] for giving me these these [2:48:43] minutes. Ands. I want to try. [2:48:44] I know that sounds way too far [2:48:47] fetched, but it's already too [2:48:48] late. This is already [2:48:48] happened. People have been [2:48:49] picked up. People have been [2:48:50] getting deported. And I think [2:48:53] and that to find a solution [2:48:54] that's that's that's where it [2:48:55] is to find a solution find an [2:48:56] in-between to say, hey, we can [2:48:59] figure out. What to do from [2:49:00] here. If we take care of [2:49:02] what's already happened, [2:49:04] addressing what's happened in [2:49:06] the past and coming to an [2:49:08] agreement can help shape the [2:49:09] future of fair future. [2:49:10] Something where everybody can [2:49:11] live in and where everybody [2:49:15] can just. Saying live in [2:49:16] pieces as way too far. But [2:49:17] we're all humans. And I think [2:49:20] that to be. Treated this way [2:49:21] because of where you came [2:49:24] from. I don't think that's [2:49:26] fair. I think we should be [2:49:26] protecting the people risk [2:49:27] their lives to get to this [2:49:36] point. Thank you. [2:49:37] >> a first floor just like to [2:49:40] say everyone here for Kamin [2:49:43] and participating and having a [2:49:44] voice. So would you like to [2:49:45] read the resolution one more [2:49:47] time and then lost for [2:49:51] emotion? Just the title? [2:49:52] Authorizing yes, authorizing [2:49:53] and directing the city manager [2:49:57] to enter into into the 2.87 g [2:49:59] voluntary memorandum of [2:49:59] agreement United States [2:50:00] Immigration and Customs [2:50:01] Enforcement. [2:50:14] >> For over 25 years, I serve [2:50:15] this community as a police [2:50:16] officer, 10 of them as the [2:50:19] chief of police. During that [2:50:21] time, there were laws that [2:50:21] weren't clear or needed [2:50:25] interpretation. We often saw [2:50:27] attorney general opinions to [2:50:28] help us guide us on [2:50:31] enforcement actions. Well, not [2:50:32] binding on the courts. They're [2:50:33] highly persuasive. And often [2:50:37] followed. The current attorney [2:50:41] general has opined that [2:50:42] Florida statute 908, requires [2:50:45] municipal police departments [2:50:45] to enter in 2 to 8 ec. 2.87 g [2:50:48] agreements. Or they're deemed [2:50:51] sanctuary cities. Further. The [2:50:52] governor and most recently, [2:50:54] the speaker of the House have [2:50:55] stated that the intent of [2:50:58] Florida statute 908. Was that [2:50:59] municipal police departments [2:51:00] are mandated to enter into the [2:51:03] agreements. During my tenure [2:51:05] as a police officer. There [2:51:06] were times that I didn't agree [2:51:07] with the law but had to [2:51:10] enforce it. This appears to be [2:51:15] one of them today. That the [2:51:17] pending did declaratory relief [2:51:21] action filed by the city of [2:51:21] Miami soon provides answers to [2:51:23] missus to municipalities, [2:51:24] legal requirements on this [2:51:27] issue. Until that time. I [2:51:29] believe we must follow the law [2:51:31] and require the Key West [2:51:32] Police Department to enter [2:51:34] into the 2.87 g agreement. So [2:51:38] tonight. I will vote with my [2:51:42] head and not my heart. So [2:51:45] MADAM Mayor, I move to approve [2:51:45] the resolution with the [2:51:51] following friendly amendments. [2:51:56] In the header. I would ask to [2:52:02] strike the word voluntary. The [2:52:06] 3rd, whereas section. After [2:52:09] whereas on JUNE 30th 2025, he [2:52:11] city commission, voted to [2:52:12] avoid. Is this sting 2.87 g [2:52:15] agreement. I would suggest [2:52:22] striking the rest. Including. [2:52:26] That had. Been improperly [2:52:29] executed without the legal [2:52:29] authority required under the [2:52:33] city charter. The last whereas [2:52:38] section. I would suggest [2:52:41] striking reinstating. And [2:52:45] entering into. Because of my [2:52:54] minutes. Do I have a second? [2:52:55] Second by commissioner to see [2:52:57] any discussion. [2:52:58] >> I believe commissioner has [2:53:01] school. Would like to speak. [2:53:02] Thank you so much, MADAM [2:53:05] Mayor. [2:53:08] >> I [2:53:10] >> to postpone the building on [2:53:15] this resolution. And I motion [2:53:15] postpone takes precedence over [2:53:19] a regular motion. [2:53:20] >> so we have a motion to [2:53:25] postpone. Do I have a second? [2:53:27] Commissioner Gruber? I just [2:53:30] that. It might come please. [2:53:31] >> I would suggest that we [2:53:35] move to table. [2:53:37] >> Under Robert's rules. So I [2:53:38] have a motion to postpone [2:53:41] heard. We actually want to [2:53:41] use. Commissioner Hoover [2:53:42] postponed table would be for [2:53:43] the same session. So we want [2:53:43] to [2:53:46] >> use You want to clarify and [2:53:47] say postpone to another [2:53:53] meeting. It's me talking [2:53:55] carrier the correct word if [2:53:56] we're going postpone it to [2:53:56] another meeting is postponed [2:54:00] table would be too table it to [2:54:04] later in the session. Mayor [2:54:05] MAY I clarify? [2:54:09] >> Yes, ma'am. So as a maker, [2:54:10] the motion, I would like to [2:54:11] clarify that. I would like [2:54:12] postpone it. [2:54:15] >> Living on this resolution [2:54:17] until we obtain some legal [2:54:18] clarity based on the outcome [2:54:21] of the South Miami case. [2:54:22] >> Okay. So we have a motion [2:54:30] have a second. [2:54:30] >> MADAM Mayor, I would like [2:54:35] to comment on that. What I [2:54:35] learned over the course of the [2:54:39] week that we've had aside from [2:54:41] that this really emotional [2:54:42] subject, is that right now? We [2:54:45] don't know what we don't know. [2:54:47] We have not learned all of the [2:54:48] aspects of the law that that [2:54:51] pertain to this because we [2:54:52] haven't really had any access [2:54:56] to someone who is an expert [2:54:56] immigration law. And that's [2:54:59] something I think as the [2:55:01] commission we owe ourselves [2:55:02] order to make this kind [2:55:08] decision. So is that a second? [2:55:13] Motion to commissioner school? [2:55:14] I think I said that well. You [2:55:15] just wanted to clarify. Okay. [2:55:16] So it's we have a first in a [2:55:20] second. Any discussion. Can [2:55:21] you call the Roll, Please? [2:55:22] Commissioner Carey Bill [2:55:23] Commissioner Casteel know [2:55:26] Commissioner Haskell. Yes, [2:55:28] commissioner Hoover. Yes. [2:55:30] Commissioner now mayor in [2:55:36] Vegas now. Motion fails. Okay. [2:55:38] So now we have a motion is [2:55:39] second on the floor motion by [2:55:43] Commissioner Lee second by. [2:55:44] >> Commissioner Castillo. But [2:55:46] we have amendments which you [2:55:49] can incorporate all if it's 7. [2:55:53] 2, we have. MADAME Mayor, if I [2:55:55] yes, go ahead. I would just [2:55:58] like to make the comment that. [2:56:01] It appears in this room that [2:56:02] we are one human family unless [2:56:02] we have a difference of [2:56:08] opinions. And that doesn't [2:56:09] seem that doesn't seem quite [2:56:12] We we have a motion. We have [2:56:13] we have a motion in the second [2:56:17] on the floor. Is there any [2:56:18] other discussion? Can [2:56:23] amendment cities? Let America, [2:56:23] can you give us Clarity? [2:56:25] Commissioner Lee played right? [2:56:26] Thank you. Okay. So in the [2:56:30] header. The word voluntary [2:56:36] strike. It. In the 3rd, [2:56:42] whereas. It says, whereas on [2:56:44] JUNE 30th 2025, to Key West [2:56:45] City Commission voted to [2:56:46] avoid. [2:56:47] >> The existing to 80's 7 g [2:56:51] agreement, comma. Strike [2:56:56] everything there. And then [2:56:57] that the end to the and and [2:56:57] then [2:57:01] >> insert. That had been [2:57:02] improperly executed without [2:57:04] the legal authority required [2:57:13] under the city charter. That [2:57:16] had been improperly executed [2:57:17] without the legal authority [2:57:18] required under the city [2:57:26] charter. And the last whereas [2:57:30] section. Striking the word [2:57:33] reinstating. And adding [2:57:44] entering into. [2:57:45] >> Okay. Is there any other [2:57:51] discussion? Commissioner. [2:57:53] Commissioner tearing up I just [2:57:55] need some clarity. I have some [2:58:01] questions Missus, Harden. [2:58:01] Since we have these amendments [2:58:06] that were discussing. Also was [2:58:09] this resolution, in fact, I [2:58:10] know it. Commissioner Lee is [2:58:11] proposing that had been [2:58:13] improperly executed. Without [2:58:18] the legal authority. That is [2:58:21] in that city charter. But I [2:58:23] need some clarity as to. First [2:58:27] of all, we have said that. The [2:58:29] chief enters into Emily Hughes [2:58:31] often. Is that correct? So [2:58:35] that's different in others, [2:58:36] other agreements and what the [2:58:37] statutes, there's specific [2:58:38] statutes for certain w's in [2:58:39] different agreements for law [2:58:44] enforcement and duties. But [2:58:45] again, specifically, I don't [2:58:47] know statute the time had it [2:58:48] does say to be signed by the [2:58:52] executive of enforcement [2:58:53] agency. I read that as being [2:58:53] the city manager, though, as [2:58:57] well. Okay. So so that i [2:59:01] understand. The chief of [2:59:02] police does enter into and [2:59:04] we'll use. Maybe not [2:59:05] regularly. But that has [2:59:09] occurred. Yes, does sign. Use. [2:59:14] I can't speak to previously. [2:59:14] One has not come in front of [2:59:15] me since I've been in this [2:59:16] position. If it were, I would [2:59:19] it suggests with the [2:59:20] authority. [2:59:22] >> In our charter and in the [2:59:23] think resolutions there hasn't [2:59:24] been delegated authority due [2:59:26] specifically for that. [2:59:27] >> We asked the chief of [2:59:29] police That's put on the spot. [2:59:33] Chief. MADAM Mayor. [2:59:37] Commissioner see finished. No, [2:59:38] no. I'd like to get an answer [2:59:40] on that first. If that's ok [2:59:42] with you, MR. City manager. [2:59:45] MADAM Mayor. Yes, [2:59:46] commissioner, it's absolutely [2:59:47] ok that you get the answers [2:59:59] you as Commissioner Lee stated [3:00:02] our last meeting. And I also [3:00:04] stated in our last meeting [3:00:06] with the city manager [3:00:07] approval, there are Mo using a [3:00:10] moist that I do sign some of [3:00:11] them. We add a line for the [3:00:12] city manager and I both to [3:00:14] sign. But most of the month, [3:00:14] the chief law enforcement [3:00:17] officer. The top police [3:00:18] officer to sign them. That's [3:00:26] me, Anderson. It. And so. If [3:00:27] that is a common practice in [3:00:29] does take place here at the [3:00:30] city in has happened in the [3:00:38] past. Why was that agreement? [3:00:44] Not proper? I want I don't [3:00:44] want to speak to other [3:00:46] agreements, but I would [3:00:46] ultimately say without seeing [3:00:48] them that could be they could [3:00:51] be unenforceable as well. [3:00:51] Ultimately, that would again [3:00:54] depend on the nature of it. [3:00:55] But if he's here to sign [3:00:57] individually without the [3:00:57] delegated authority or the [3:00:58] authority under our charter. [3:01:00] And those the invalid [3:01:06] contracts as well. Does the [3:01:06] city manager have the [3:01:08] authority and Mahe delegate [3:01:09] that authority to the chief of [3:01:13] police to sign a document. I [3:01:14] think the delegation we need [3:01:15] to come for the commission and [3:01:16] in a resolution that says they [3:01:18] have that specific authority [3:01:20] to sign the charter specific, [3:01:21] too. The city manager doesn't [3:01:22] state in there that his power [3:01:25] is to delegate. That [3:01:25] specifically there are [3:01:27] delegations as to the chief of [3:01:29] police and to the chief of the [3:01:30] fire department. But that [3:01:31] specifically to this sign [3:01:33] minutes of the duties of their [3:01:35] officers. So it's not specific [3:01:36] as to what they have the [3:01:40] authority to side. Is it [3:01:42] specific to the city manager? [3:01:45] I'm Thank you, MADAM Mayor, is [3:01:47] it specific to the city [3:01:48] manager not being able to [3:01:49] delegate to the chief of [3:01:50] police, the authority to sign [3:01:53] an agreement such as this one. [3:01:54] It's it doesn't have any [3:01:54] authority and silent [3:02:08] ultimately. And then I think [3:02:11] my final question was. Maybe [3:02:11] not the final question. But [3:02:19] for this round would have. We [3:02:22] have would we have been able [3:02:23] retroactively approved that at [3:02:24] the last meeting? Yes, you [3:02:28] could have ratified ratified [3:02:29] the agreement that the last [3:02:30] meeting stated. Just for [3:02:35] clarity. That. So ultimately [3:02:38] you ratifying if you were to [3:02:40] ratify that contracts, you've [3:02:40] been saying that he had the [3:02:41] authority to sign that you [3:02:42] would be giving him the [3:02:43] authority once you're out of 5 [3:02:47] that time. All right, [3:02:54] Commissioner Christina. I [3:03:01] don't I mainly. Supported [3:03:02] because not only talking to [3:03:05] the sheriff. [3:03:06] >> They haven't made any ice [3:03:10] raids. Anything that I know of [3:03:14] that. I 2 to the fact that [3:03:18] it's going to change the [3:03:18] character of our police [3:03:19] department. We know chief, we [3:03:22] know his guys. We know I'll [3:03:24] share of and we know pretty [3:03:27] much the offices, however. I [3:03:34] was. So moved. We will be in [3:03:35] racially profiled. And that's [3:03:42] not so. I spoke the chief. I [3:03:47] spoke to sheriff and again. I [3:03:48] think we come from a tight [3:03:49] knit community and we needed [3:03:52] to put this to bed. I mean, [3:03:53] just keep going over and over. [3:03:54] We have to comply with the [3:03:57] law. Anyway, am I correct? [3:04:03] Assistant? Ow. Ice, [3:04:03] immigration, Customs, Border [3:04:06] Patrol. [3:04:09] >> Yes, ultimately chapter [3:04:09] 908. [3:04:10] >> And I believe they would do [3:04:10] that. You know, in a in a case [3:04:12] that is needed. But if we kept [3:04:16] this going. This is going to [3:04:24] be okay. Never end. And I feel [3:04:25] really and truly it's it's [3:04:27] gotten really out of hand. To [3:04:31] the point where Chief Bratton, [3:04:32] the bird, like he lost about [3:04:42] 10 pounds. Excuse me, well, [3:04:43] anyway, I'm sorry, chief. It [3:04:44] took this long to get this [3:04:47] preshow few. But [3:04:48] >> all right. Commissioner [3:04:56] Hoover, had a comment. When we [3:04:56] talking about the memorandum [3:05:00] of understanding. [3:05:00] >> I don't think that this [3:05:02] commission can afford to not [3:05:08] have some say so over sight of [3:05:10] something that is a philosophy [3:05:12] like this. It's one thing to [3:05:13] talk about buying a truck [3:05:15] because we have some [3:05:19] arrangement with one of other. [3:05:19] She entities, whether it's a [3:05:22] state or county or whatever. [3:05:22] But this is way too important [3:05:27] to just say that's we always [3:05:28] do it that way. It's [3:05:29] memorandum understanding. It's [3:05:32] not. This is something that [3:05:34] was obviously at the heart our [3:05:38] city and people and to say so. [3:05:39] And we had to listen to that [3:05:42] before. We can't what somebody [3:05:43] make a decision like this [3:05:44] without us knowing about this. [3:05:46] When I was trying to say. [3:05:48] Commissioner school. Thank [3:05:51] you, MADAM Mayor. [3:05:53] >> We did not believe that we [3:05:55] were breaking the law on JUNE [3:05:57] 30th when we passed that [3:06:00] resolution and we are not. We [3:06:02] are not breaking the law now. [3:06:03] If we let that resolution [3:06:09] stand many well informed [3:06:11] citizens. An excellent lawyers [3:06:14] agree that U.S. Has obligation [3:06:18] to enter into a 2.87 g [3:06:19] agreement. I'm like a sheriff [3:06:21] who has entered into it [3:06:23] municipal police chief. That's [3:06:25] not what you're into it. There [3:06:27] is requirement in federal law [3:06:30] to sign such an agreement. [3:06:32] There's no requirement in [3:06:34] state law for a municipality [3:06:38] to sign such an agreement. [3:06:38] Congress, the U.S. Congress [3:06:41] and the state legislature have [3:06:44] both declined to create such a [3:06:45] requirement. They have the [3:06:46] opportunity to create such a [3:06:47] requirement and they have [3:06:49] declined to do so. Neither the [3:06:50] governor nor the state [3:06:54] attorney can override [3:06:55] legislature and enact such a [3:07:03] requirement on own. We're the [3:07:04] ideal opinion that the [3:07:05] attorney general offered in [3:07:08] his letter. Commissioner Lee, [3:07:11] that was not a formal legal [3:07:11] opinion, as you might request [3:07:12] from the attorney general. [3:07:16] That was a statement he made [3:07:16] you know, in a letter which [3:07:17] is, you know, his [3:07:19] interpretation at the time. [3:07:21] But it does not follow state [3:07:25] law or or federal law. So if [3:07:25] unconvincing, anyone who voted [3:07:30] on the winning side of the [3:07:33] previous motion and and to to [3:07:35] not postpone, you would have [3:07:36] the opportunity right now to [3:07:38] ask that that motion be [3:07:42] reconsidered because of if we [3:07:45] follow the lead of the city of [3:07:45] South Miami and we have that [3:07:47] this is no harm done. We're [3:07:50] not doing anything extra [3:07:52] anything different. As I said, [3:07:53] we did not believe we breaking [3:07:57] the law. Then if we passes [3:08:00] this current resolution had a [3:08:01] rolling over and playing dead [3:08:01] and said, yeah, we I guess we [3:08:03] didn't break the law, but we [3:08:06] did not. And we should stand [3:08:07] for what is true and what is [3:08:13] just postpone this. Motion get [3:08:17] some more legal clarity. [3:08:18] >> MADAM Mayor Commissioner [3:08:19] Commission asked if you if you [3:08:21] listen carefully to what I [3:08:22] said, I said that the attorney [3:08:23] general's opinion is not [3:08:26] binding. It's highly [3:08:27] persuasive. Excuse me. And [3:08:33] it's what. Often. Use to take [3:08:33] enforcement actions. That's [3:08:37] what I said. Any other [3:08:41] discussion. Commissioner Jerry [3:08:45] Clerk if I would like to make [3:08:47] a motion to pass a resolution, [3:08:47] as is we would have to take [3:08:49] the vote on this first. Is [3:08:51] that correct? What we can [3:08:55] break out the amendments. I [3:08:56] mean, he's he's made a motion [3:08:57] with 3 amendments. So you can [3:08:59] either break them out. [3:09:00] >> Or you can vote on this. [3:09:03] And then. [3:09:06] >> I would prefer because of [3:09:07] that. [3:09:07] >> The motion to amend higher [3:09:09] than the main motion. So he's [3:09:12] essentially amended. So we [3:09:14] would take each of the [3:09:15] amendment separately and then [3:09:17] vote on the resolution as [3:09:18] whatever amendment had passed [3:09:19] with the attached to the [3:09:22] resolution wrecked. [3:09:22] >> I would like to that way, [3:09:26] if that's okay. I would like [3:09:26] to take the amendment [3:09:32] separately. Okay. Okay. So the [3:09:32] first one would be we don't [3:09:33] need to first and second for [3:09:35] this because we're we've [3:09:36] already established to strike [3:09:40] voluntary from the MADAM. [3:09:44] We're going to the amendment [3:09:44] now. Yes, because I need to [3:09:47] axe to chief. One final [3:09:49] question. Discussion and the [3:09:53] city attorney. Based on the [3:09:58] amendments. It's based on. The [3:10:05] whole. 2.87 Staff recommend [3:10:08] this. I guess is what I'm You [3:10:16] as the attorney. Could give [3:10:18] advice on, I guess the [3:10:19] legality of what you're [3:10:19] looking to do. Can be more [3:10:20] specific and want get your [3:10:20] question is. [3:10:22] >> Well, [3:10:24] >> I'm reading the attorney [3:10:28] general's so. Do you follow [3:10:32] the attorney general's letter? [3:10:35] To entirety? [3:10:35] >> So the attorney General [3:10:38] states that. If they are of [3:10:43] the position that by not or [3:10:44] disagreeing in are prohibiting [3:10:45] not entry into this of law [3:10:46] enforcement wants to be [3:10:49] entered by us voided by you [3:10:51] avoiding the JUNE 30th meeting [3:10:52] that creates a sanctuary [3:10:52] policy and they're claiming [3:10:53] that that is a violation of [3:10:57] chapter 908, there is no [3:10:59] precedent. That's established. [3:11:00] So I don't disagree that it [3:11:02] could be argued either way, [3:11:04] but that is the attorney [3:11:06] general's position. And if you [3:11:07] know, there's there is an [3:11:09] enforcement provision in [3:11:11] there. So with the [3:11:11] determination on how to [3:11:12] proceed would be up to, you [3:11:13] know, it's kind of a judgment [3:11:15] call on that one on what is. [3:11:19] It is that? An actual, you [3:11:20] know, is it Lauren And I think [3:11:21] as Commissioner Lee stated, [3:11:25] you know, they make opinions. [3:11:27] It's not binding until a court [3:11:28] decides. So as of right now, [3:11:29] the court hasn't decided. And [3:11:30] that's what the city of South [3:11:30] Miami is looking for them to [3:11:46] do. Then opinion as a of the [3:11:49] 2.87 with the amendments. As [3:11:52] Commissioner Lee said, we [3:11:53] frequently reach out to the [3:11:56] attorney general for his [3:11:57] opinion, they're not binding, [3:12:00] but we generally follow those. [3:12:00] >> For enforcement, you have [3:12:03] the attorney general's letter. [3:12:04] It's on its for you determine [3:12:08] what that letter means. Okay. [3:12:08] >> And the same as what the [3:12:12] sheriff say it. I mean, they [3:12:17] have enter into the 2.87 g. [3:12:20] It's voluntary. What ow. But [3:12:21] how do you feel about it is [3:12:22] going to change out department [3:12:24] into ice agents? I guess is [3:12:26] what I'm trying to. [3:12:27] >> We are not conducting any [3:12:28] raids of any kind. Okay. Thank [3:12:35] you. All right. So where so [3:12:37] we're now voting on just [3:12:38] striking voluntary from the [3:12:39] title, correct? Can you call [3:12:41] the roll? Please, Commissioner [3:12:42] Carey? Yes. Commissioner [3:12:46] Castillo. Commissioner [3:12:51] Haskell. Commissioner Hoover's [3:12:53] now commissioner Yes, Mayor [3:12:56] Henry guess? Yes, motion [3:12:59] passes. Now voting on strike [3:13:04] taking 3rd, whereas. Leaving [3:13:05] first part of first sentence [3:13:07] up to agreement striking the [3:13:11] rest and inserting that had [3:13:11] been improperly executed [3:13:12] without the legal authority [3:13:17] under the city charter. Okay. [3:13:18] Can you call the Roll? Police [3:13:19] Commissioner Carey know [3:13:21] Commissioner Castillo. [3:13:25] Commissioner Haskell. [3:13:27] Commissioner Hoover. Yes, [3:13:30] commissioner Lee. Yes, mayor [3:13:32] Henry guess yes. Motion [3:13:36] passes. And then finally in [3:13:38] the last, whereas section [3:13:41] striking reinstating an a [3:13:45] inserting entering into. [3:13:47] Commissioner Carey know [3:13:48] Commissioner Castillo know [3:13:52] Commissioner Haskell. [3:13:55] >> Could you repeat that? [3:13:55] Please? [3:13:56] >> Yeah. The very last. [3:13:57] Whereas before we get to now, [3:14:01] therefore. Near the end of the [3:14:02] sentence, he wants to strike [3:14:06] reinstating. Change that to [3:14:08] entering into the 87 g [3:14:13] agreement. Note. [3:14:17] >> Commissioner Hoover Snow, [3:14:19] Commissioner Lee. Yes, mayor [3:14:20] guess yes. Okay. So that did [3:14:24] not pass. The only changes [3:14:27] that that's moving actually to [3:14:27] changes are moving forward. [3:14:32] Striking voluntary. And And [3:14:33] were inserting the language [3:14:34] that had been improperly [3:14:34] executed without the legal [3:14:35] authority under the city [3:14:38] charter. So now we're going to [3:14:41] take a vote. [3:14:42] >> a proven I offered [3:14:47] amendment. Open amendment just [3:14:51] like an a. Amendment to the [3:14:55] existing motion yet I would [3:14:56] like to add the whereas [3:14:58] clauses that would say that [3:14:58] whereas the commission acted [3:15:01] in good faith. As you MAY [3:15:05] either. Only 5 hits either the [3:15:09] plain text Florida statute [3:15:12] 908, nor standing judicial [3:15:13] agreements state excuse me [3:15:15] standing judicial rulings [3:15:16] require participating in any [3:15:17] program or the Mont authorized [3:15:20] under section 2.87 of the [3:15:22] immigration and Nationality [3:15:28] Act. 8 usc as 1, 3, 5, 7, you [3:15:31] could find that language on. [3:15:35] Page 2 of. The resolution that [3:15:37] we previously passed [3:15:43] resolution number, 25 1.61 [3:15:43] With that. The verbatim? [3:15:44] Because I'm gonna probably [3:15:46] need that. Yeah. Okay. [3:15:47] >> Did everybody understand [3:15:49] the spirit of what she would [3:15:52] you repeating that [3:15:53] commissioner? Sure. [3:15:54] >> like on Yeah, let's states [3:15:59] let's look. Point is [3:16:06] >> We we acted in good faith [3:16:07] that last weekend to suggested [3:16:08] amendment is whereas the [3:16:11] commission acted in good faith [3:16:12] has neither the plane tax of [3:16:15] Florida statute 908, nor [3:16:18] standing judicial rulings [3:16:19] require participating in any [3:16:22] program or agreement [3:16:24] authorized under section 2.87, [3:16:25] the Immigration and [3:16:26] Nationality Act and then the [3:16:37] citation follows. [3:16:38] >> Yes, I'm good. I'm actually [3:16:38] going to pull up the [3:16:43] resolution. From last time. [3:16:44] Can you tell me what page that [3:16:46] was on commissioner? Yeah is [3:16:51] on page 2 the resolution with [3:16:54] the underlines and straight [3:16:56] through what was added at that [3:17:00] meeting. What was added I [3:17:01] think that's what the [3:17:03] resolution as it was finally [3:17:04] adopted. Okay. It was [3:17:05] different than the resolution [3:17:06] let me pull Several [3:17:21] amendments. Yeah. [3:17:24] >> and [3:17:25] >> my point is that there is [3:17:29] and a legal support that not [3:17:31] entering into a 2.87 g [3:17:33] Agreement is permissible for a [3:17:34] municipality. So I don't want [3:17:39] to. You know, put the city on [3:17:40] the record, even though I [3:17:40] don't agree with approving [3:17:42] this resolution at all, if [3:17:45] you're going to approve it, I [3:17:47] don't want to put us on the [3:17:50] record saying that saying [3:17:51] something that's that's that's [3:17:57] not true. [3:17:57] >> Terribly. Sorry, [3:18:01] commissioner, I can't find the [3:18:01] language you're talking about. [3:18:02] This is in the amended [3:18:03] resolution. We passed on the [3:18:05] 30th. Resolution number. 25 [3:18:11] 1.61 a second page. Kerry, I [3:18:15] believe, 3 whereas on a second [3:18:16] date yet, whereas neither the [3:18:19] plain text of Florida statute [3:18:21] 908, nor standing judicial [3:18:22] rulings require participating [3:18:24] in any program or agreement [3:18:25] authorized under section 2.87 [3:18:25] of the Immigration and [3:18:29] Nationality Act. [3:18:32] >> So it's what she just read. [3:18:33] But [3:18:33] >> with a little bit before [3:18:34] that, that says the commission [3:18:36] acted in good faith. [3:18:37] >> Yeah. Oh, yeah. I added [3:18:42] those words. You. Because I [3:18:43] want to say we did something [3:18:46] that was or illegal because [3:18:47] that could be used against us [3:18:49] in the future. So I'm saying [3:18:51] we acted in good faith on JUNE [3:18:54] 30th, which we did. So that's [3:18:56] the amendment. That's a [3:18:58] motion. Need a second. You [3:18:59] have any problem with that [3:19:04] done. So I haven't. [3:19:04] >> Kamau shouldn't have a [3:19:05] motion by Commissioner [3:19:15] Haskell. Do have a second. And [3:19:20] motion fans. So now we're back [3:19:23] to the main motion approving [3:19:24] this resolution as amended [3:19:25] with the 2 changes. You a [3:19:29] great too. Do we still have an [3:19:30] opportunity for discussion, [3:19:34] MADAM, you? Yes. Can't I would [3:19:38] just like make a couple of [3:19:39] statements here. So bear with [3:19:43] me. Number one, just so that [3:19:46] the residents of the city of [3:19:49] Key West understand I am the [3:19:51] daughter of a legal immigrant [3:19:52] and mother came here from Cuba [3:19:54] at the age of 7 with her [3:19:56] mother and father and her 2 [3:20:01] siblings. And so I do support [3:20:01] immigration. Legal immigration [3:20:02] is what I support. Also [3:20:04] support the laws of our state [3:20:09] and federal government. And I [3:20:10] think it's very important for [3:20:10] me to have the opportunity to [3:20:13] say that. Also the statement [3:20:17] of be brief I I applaud you [3:20:21] guys for being breeze. I asked [3:20:23] Yuletide others for also being [3:20:23] breathed, even when their [3:20:25] opinion MAY not match yours. [3:20:29] That is what's fair and just. [3:20:29] On the comment of one human [3:20:33] family. MAY we all consider [3:20:35] each other one human family [3:20:36] again, we don't have to agree. [3:20:37] Let's be respectful of each [3:20:41] other. You know how [3:20:42] hypocritical to say one human [3:20:43] family only if you agree with [3:20:46] opinion. So I just wanted to [3:20:47] make those statements and, you [3:20:51] know, as far I rode on a lot [3:20:52] of notes when when people were [3:20:55] speaking here today and saying [3:20:56] things like, you know, don't [3:20:59] be bullied you know, speaking [3:21:02] against hatred, a lot of those [3:21:03] names that signed up and we're [3:21:04] speaking today, not very [3:21:07] hateful statements on social [3:21:08] media. So let us all consider [3:21:11] each other with respect. You [3:21:15] know, I Commissioner Lopez [3:21:16] when he came into the chambers [3:21:19] even know he and I have very [3:21:19] opposing views. And I just [3:21:23] think it's important for us [3:21:24] let's support one human [3:21:25] family. And let's be brief. [3:21:26] Let's allow everybody to to [3:21:27] stand up and speak for what [3:21:31] they believe. Are there any [3:21:36] other comments or discussion? [3:21:38] Kerry, can you call the Roll? [3:21:39] Please, Commissioner Carey. [3:21:39] Yes, commissioner Castillo. [3:21:41] Yes. Commissioner Haskell. [3:21:44] Know Commissioner Hoover [3:21:46] Commissioner Lee. Rodriguez, [3:21:51] yes, motion passes. Item [3:21:52] number 2, authorizing the city [3:21:55] attorney to file a [3:21:56] declaration. [3:21:57] >> Declan Tory judgment, [3:21:58] action against the governor, [3:21:59] Ron DeSantis and all necessary [3:22:01] parties are joining the [3:22:03] action. The city of South [3:22:03] Miami to determine the [3:22:05] legality of the requirement to [3:22:08] enter into 2.87 g agreement [3:22:09] authorizing the city attorney [3:22:11] to take all necessary actions [3:22:11] to effectuate the intent of [3:22:14] this resolution. I have a [3:22:19] motion? Oh, gosh, no, I'm [3:22:20] sorry. We have we do have [3:22:21] speakers accounts. Apologies [3:22:25] for pick. Yes. The first is [3:22:26] Lucy Hawk and then Chris [3:22:39] McNulty. [3:22:40] >> Thank you for letting me [3:22:45] speaking I understand that you [3:22:46] guys feel the to sign the 2.87 [3:22:48] g, although I do not agree [3:22:48] that this was the best thing [3:22:52] for the city. You are the ones [3:22:52] who are supposed to speak. [3:22:53] Resident respect your position [3:22:56] as leaders, although we very [3:22:58] much do not see eye to eye on [3:22:59] this. But now I'm gonna ask [3:23:01] you to also fight. We just [3:23:04] particularly just protected [3:23:07] ourselves from the state, from [3:23:09] their threats from them [3:23:10] telling you that you need to [3:23:11] do this. You guys decided you [3:23:13] want to do that. But that [3:23:15] doesn't mean we can't also [3:23:17] joined the lawsuit. The South [3:23:19] Miami, we can do both. It's [3:23:22] not a one or the other. And a [3:23:23] lot of attorneys were in this [3:23:25] room that are way smarter than [3:23:26] me. That said, you guys have a [3:23:30] really strong case. I'm not an [3:23:33] attorney. I don't know, is [3:23:35] passing a resolution just past [3:23:36] makes your case weaker. But I [3:23:37] think you deserve it to all of [3:23:38] the people that were in this [3:23:41] room to find out. And that is [3:23:43] not something that's going to [3:23:43] happen overnight. And urge you [3:23:47] to really consider the [3:23:50] obligation to hear all of your [3:23:51] constituents. [3:23:52] >> Because there were 2 people [3:23:54] who spoke tonight favor of [3:23:54] 2.87 g. [3:23:57] >> And a lot more that did it. [3:23:59] I don't know where your moral [3:24:01] bounds are on what you need to [3:24:02] follow in percentages of who [3:24:05] supports showing who doesn't. [3:24:06] But that seems a little off [3:24:07] balance. So maybe as a way let [3:24:10] you know, redeem everybody who [3:24:14] spoke and could fight. [3:24:14] >> And I really encourage you [3:24:16] to do that. And I mean that [3:24:17] respectfully and all of the [3:24:19] people who spoke tonight. [3:24:20] >> We'll have your back. [3:24:23] Still. I will have your backs. [3:24:25] So if you decide to join the [3:24:25] fight and if you decide and I [3:24:27] don't even know that it's a [3:24:29] fight really, if you're asking [3:24:30] for clarity, clearly to me is [3:24:34] not a Clarity is clarity. We [3:24:36] just want to know for doing [3:24:37] something illegal. I don't [3:24:38] want you to do anything [3:24:41] illegal. I don't support. You [3:24:42] doing anything illegal? And I [3:24:43] don't know that a lot of [3:24:44] people in this room do, but we [3:24:47] do need to take the time to [3:24:49] find out if this is wrong or [3:24:50] right. And I think you have [3:24:53] the chance now to do both. I [3:24:54] hope you'll really consider [3:24:58] that option. Thank you. [3:25:00] >> Is Chris. Is Chris still [3:25:04] here? Is Chris. [3:25:08] >> Okay. Madalyn bomb. And [3:25:13] then fill are here. That will [3:25:14] go to many Hartman if he's [3:25:25] here. MAY just a second chair. [3:25:27] >> I am not an expert in the [3:25:31] law. However, I am a pretty [3:25:35] pretty good with the Bible. [3:25:36] And anyone who tells you that [3:25:39] there is only way one way to [3:25:39] interpret scripture is pretty [3:25:44] sadly mistaken. In seminary. [3:25:45] We learned that because GOD [3:25:50] speaks to every person through [3:25:50] scripture interpretations MAY [3:25:54] definitely very there are [3:25:55] thousands of biblical scholars [3:25:57] and theologians. Who are much [3:26:01] smarter than me who debate the [3:26:01] meaning of scripture for their [3:26:05] whole lives. Scriptures, a [3:26:05] living word of GOD. So we [3:26:07] cannot ever just read a [3:26:08] sentence and take it at face [3:26:13] value. There is context, [3:26:14] historical meaning intent. [3:26:15] Translation issues and many [3:26:18] other things to consider. When [3:26:19] looking for the true meaning [3:26:20] of scripture. And this is why [3:26:23] I get frustrated with people [3:26:25] who and isolate one line of [3:26:27] scripture and use it as a [3:26:29] weapon to attack others are [3:26:30] hammer home their own warped [3:26:34] agendas. I believe. That the [3:26:37] law is very much the same. [3:26:38] Laws are meant to be [3:26:40] interpreted by the courts. And [3:26:41] that is how we do things here [3:26:44] in the U.S. Law is written, [3:26:45] but then there can be various [3:26:48] interpretations of that law. [3:26:50] So the courts are charged with [3:26:51] interpreting laws. So why [3:26:53] would we not want to challenge [3:26:56] the attorney general and the [3:26:58] governor's interpretation of [3:27:00] the law instead of simply [3:27:01] taking their interpretation at [3:27:04] face value especially when [3:27:05] many other smart people [3:27:09] interpret it differently. I'm [3:27:10] really tired of the ugly [3:27:12] rhetoric on social media. From [3:27:16] many people. Because they have [3:27:18] read one sentence in a letter [3:27:19] from Attorney general are one [3:27:22] sentence of scripture and they [3:27:23] decide to verbally attack [3:27:26] other people who have [3:27:27] different interpretations. [3:27:29] It's really not acceptable any [3:27:31] longer. So I ask you to [3:27:33] consider on item number 2, [3:27:34] which is what I hope are still [3:27:35] on because I was outside [3:27:38] praying with some people. And [3:27:40] I ask you to see an answer [3:27:41] from the courts and the [3:27:44] questions around 2.87 g, [3:27:45] whether we do it in our own or [3:27:47] in conjunction with the city [3:27:58] of South Miami. Thank you. [3:28:02] Hello again. [3:28:03] >> money is because we [3:28:04] resident district one. I'm the [3:28:07] executive director of the [3:28:09] Community Center. I didn't [3:28:11] actually prepare statement for [3:28:13] and my heart is racing. So I'm [3:28:14] just going to speak from my [3:28:15] heart because when it's [3:28:15] racing, it's speaking the [3:28:18] truth. I don't even know if [3:28:20] this resolution is even [3:28:21] something that makes sense [3:28:23] anymore. Now that we've signed [3:28:27] with the 2.87 g Agreement, I [3:28:28] do want to say that I do [3:28:30] believe that you've now forced [3:28:31] a lot of people on this island [3:28:32] to do illegal things because [3:28:33] we are going to protect our [3:28:36] neighbors and our friends. So [3:28:40] that's rough. And I'm [3:28:41] incredibly disappointed in the [3:28:46] city that I call home. I [3:28:49] really hope that you take a [3:28:50] lot of time in 9 to think [3:28:54] through the decision that you [3:28:55] make yourselves right with And [3:29:01] that's all I have to say. [3:29:01] >> So is there Manning [3:29:06] apartment? How Joanna entre [3:29:11] Zach? Brailey, Prescott, [3:29:15] Aruba. Wayne Dumpster. Erik, a [3:29:20] jewel. Genevieve, don't think [3:29:31] Julie Brown. [3:29:35] >> Hello Commissioners, I did [3:29:36] not also plan to speak on [3:29:37] this. I signed up become the [3:29:38] first one and I was skipped. I [3:29:40] understand was a mistake. Had [3:29:43] a good one for you. I'm very [3:29:45] disheartened and disappointed [3:29:48] that you just voted to ignore [3:29:49] legal advice and not seek [3:29:51] additional legal information [3:29:54] that is what year role is [3:29:58] here. You should be getting [3:29:59] legal information to make a [3:30:03] factual and legal decision. So [3:30:04] I do ask that you join this [3:30:05] lawsuit to see can get that [3:30:10] clarity. I'm afraid of what [3:30:11] this community has ahead of [3:30:12] them based on the decision to [3:30:16] enter the 2.87 g I'm afraid of [3:30:16] what is going to do to our [3:30:19] community members who are in [3:30:23] fear now, people who are [3:30:24] friends and support the local [3:30:25] police source as we most of us [3:30:29] do not just conservatives. And [3:30:29] it's at their members of our [3:30:33] community to so this is going [3:30:36] to put everybody in a really [3:30:37] difficult position. The best [3:30:38] thing you can do now is to [3:30:39] join this lawsuit and get [3:30:41] clarity and to fight for [3:30:47] humanity. My mom sent me. The [3:30:49] text tonight and said [3:30:50] >> Praying for humanity to [3:31:00] prevail. Sorry, mom. [3:31:01] >> For this foster. Still [3:31:07] here. Or Julie Hill. Or Bert [3:31:07] Weiss much the that Stacy [3:31:16] Stall. Killed in Niles. [3:31:17] >> I think that's it. Anyone [3:31:18] else want to speak on number [3:31:26] 2. All right. Thank you. So do [3:31:29] we have a motion? Can I 0.1 [3:31:32] thing out? Yeah. [3:31:34] >> Actually a colleague of [3:31:35] mine e-mailed me and I asked [3:31:36] Commissioner Coffin for [3:31:37] clarity. But I think in the [3:31:37] lot very last, whereas [3:31:41] section. It says it's in the [3:31:42] best interest of the city of [3:31:44] South Miami. And I think that [3:31:44] needs to be changed to key [3:31:56] West. Just to make that. I [3:31:57] think it's just a script [3:32:05] scrivener's error. So. [3:32:06] >> with that Correction [3:32:08] Commissioner Haskell. [3:32:12] >> Thank you, MADAM Mayor, in [3:32:13] the interest of compromise, [3:32:16] like to move to approve this [3:32:18] resolution with a an important [3:32:20] change that would be to delete [3:32:23] in the heading to delete the [3:32:25] part that authorizes the city [3:32:27] attorney to file a declaratory [3:32:29] judgment action against the [3:32:30] governor, Ron DeSantis and all [3:32:34] necessary parties soaps. Get [3:32:35] that far because it's kind [3:32:37] either or situation. So skip [3:32:38] that part, no declaratory [3:32:42] judgment. But agreed to join [3:32:43] in the action of the city of [3:32:45] South Miami to determine the [3:32:46] legality of requirement to [3:32:48] enter into this 2.87 [3:32:51] agreement. So that's I'm [3:32:52] suggesting that support the [3:32:55] efforts of the city of Miami. [3:33:00] And we do not request attorney [3:33:00] to file the declaratory [3:33:07] judgment. [3:33:08] >> With that, we have a second [3:33:12] on her emotion. Show second by [3:33:13] Commissioner Gruber. Any other [3:33:17] discussion questions? Let's go [3:33:24] back the studio. That's going [3:33:26] to costs us money in city of [3:33:29] Key West. Joining this little [3:33:34] so. It would depend if we [3:33:35] joined in how that would work [3:33:36] if it was just too. [3:33:40] >> Take that out. Have to look [3:33:40] to see what the language of [3:33:41] the actual section say [3:33:44] regarding that. If we joined [3:33:46] into their lawsuit to it, more [3:33:47] cost-effective than filing our [3:33:54] own. Just going to have an [3:34:08] opinion from you. I know. But [3:34:08] >> the motion I mean, [3:34:11] agreement that we teach this [3:34:12] have any bear on the agreement [3:34:15] that we just pass. I would I [3:34:19] would defer can attorney I. I [3:34:20] don't have an opinion on this. [3:34:24] What was the question? The [3:34:29] 2.87 g agreement and us. [3:34:33] Joining know though, [3:34:34] Miami-Dade in the lawsuit [3:34:35] against DeSantis and Gov. The [3:34:39] governor. [3:34:40] >> Would it have any effect? [3:34:40] Yes, it wouldn't have any [3:34:42] effect until a decision was [3:34:43] made and then it would come [3:34:43] back to the commission to [3:34:44] decide if you want to [3:34:46] terminate it based on what the [3:34:47] decision is, if it is a [3:34:49] requirement is it's a law and [3:34:51] that would be something that [3:34:52] we would term. And at that [3:34:53] point, once the decisions made [3:34:55] by the court commission them [3:34:59] in. [3:34:59] >> I'm not necessarily opposed [3:35:07] to. Joining. The dec action. [3:35:11] With South Miami. But I'm not [3:35:16] sure. I'm not sure doing it. [3:35:20] Spending money to do it. The [3:35:23] end result is. My aunt South. [3:35:24] Miami is going to get an [3:35:29] answer. One way or another. [3:35:33] The judge is going either so [3:35:34] way I see it and correct me [3:35:34] over the judge is either going [3:35:37] to say. I'm not giving you an [3:35:38] answer because you don't have [3:35:42] standing. Or the judge is [3:35:43] going to answer the questions [3:35:43] that Miami South Miami's [3:35:47] already asked. [3:35:48] >> Correct. So, yes, they did. [3:35:48] They'd have to get past the [3:35:50] motion to dismiss on the [3:35:51] standing portion and then [3:35:52] before they could get to those [3:35:55] on specific dec actions that [3:35:56] they're asking for the court [3:35:58] to decide on. So therefore. [3:35:59] >> We we would only be joining [3:36:03] this dec action. As moral [3:36:09] support. To get the same [3:36:12] answers and well into complete [3:36:14] honesty are facts would be a [3:36:14] little different, I think [3:36:15] because I think the argument [3:36:18] in the motion to dismiss is [3:36:20] that they don't have standing [3:36:22] because there was no threat [3:36:22] for moving or suspension of [3:36:26] the mayor and that nature. As [3:36:27] the city, it could be argued [3:36:29] that we might have a better [3:36:29] chance at standing on that [3:36:30] because there has been a [3:36:34] threat as a threat in acted [3:36:35] upon. Not at this time. So [3:36:37] again, that would be something [3:36:38] to argue have been vetted. [3:36:40] Those arguments fully. But as [3:36:41] to standing, I mean, it could [3:36:42] be argued again, either way. [3:36:46] But I woods date that we would [3:36:48] have we potentially have that [3:36:48] are standing just based on the [3:36:51] letter we did receive in our [3:36:52] resolution. We passed on the [3:36:57] 25th. And the resolution we. [3:36:59] In that resolution. We we gave [3:37:04] our support. We voted to [3:37:05] support South Miami in their [3:37:09] efforts. I'm just not sure [3:37:13] whether it's not sure doing [3:37:14] this in spending the money. I [3:37:16] mean, if if my if if, indeed, [3:37:21] South Miami. If the judge says [3:37:22] you don't have standing, then [3:37:24] night. [3:37:26] >> I could see supporting us [3:37:28] saying, ok, they didn't have [3:37:29] standing. We should go in now [3:37:30] and give it a shot and 6. See [3:37:31] if we have standing and get [3:37:33] the answers. But I'm not sure. [3:37:35] Joining them right now. Kind [3:37:39] of makes sense. This point. [3:37:40] >> And I would suggest a [3:37:43] potential would be you do. As [3:37:43] you stated, there is a [3:37:44] resolution that states that [3:37:45] you have support for South [3:37:47] Miami and what they're doing [3:37:51] potentially maybe if you it [3:37:52] could be postponed to say [3:37:52] until maybe the motion to [3:37:54] dismiss is determined. That's [3:37:55] something you want to consider [3:37:57] based on that. [3:38:05] >> you know, bring it back. [3:38:06] >> All right. So right now we [3:38:07] have motion and second, any [3:38:08] other discussion on her [3:38:10] amendment. Commissioner [3:38:14] Haskell's amendment. You want [3:38:15] to say the amendment one more [3:38:15] time? I think this would be [3:38:17] the whole thing because it is [3:38:18] either or so. This would be [3:38:20] the motion is to prove this [3:38:21] resolution. [3:38:23] >> But with choosing join in [3:38:23] the action of the city of [3:38:26] South Miami to determine the [3:38:27] legality, the requirement to [3:38:28] enter into the 2.87 g instead [3:38:32] the first part. Authorizing [3:38:34] the city attorney to Tafolla [3:38:36] attack critics Any other [3:38:42] discussion. Kerry, can you [3:38:42] call the Roll, Please? [3:38:44] Commissioner Carey know [3:38:47] Commissioner Castillo, [3:38:48] Commissioner Haskell. Yes, [3:38:49] commissioner Hoover, yes. [3:38:52] Commissioner Lee. Mayor Henry [3:38:59] get Snow. Okay. Motion fails. [3:38:59] They could be another motion [3:39:06] or we can move on. We can move [3:39:18] could be another. Go ahead. [3:39:19] Item number 3, expressing [3:39:20] support for extending [3:39:21] temporary protected status. [3:39:23] Tps for Haitians. And again, [3:39:23] we do have a public comment. [3:39:30] Okay. Seahawk. Chris McNulty. [3:39:41] And Madeline Ball. Good [3:39:48] evening I have a really nice. [3:39:49] City reaffirming thing to say. [3:39:52] But really, why don't you [3:39:53] >> do want to just throw it [3:39:54] all in. Do want to support [3:39:57] anyone in this community. [3:39:58] That's really like kind of [3:40:02] where we're at now. In 2022. [3:40:04] Mayor Johnson and the [3:40:05] commission proclaimed MAY as [3:40:07] Haitian Heritage Month. [3:40:08] >> But it doesn't seem like [3:40:10] any information we get the [3:40:12] matters. So I'm really not [3:40:12] going to even waste my time [3:40:14] reading this because obviously [3:40:15] you guys don't actually care [3:40:26] about your constituents. [3:40:33] >> I second Lucy Hawk. And [3:40:34] then Abby Weiss. She's still [3:40:41] here. [3:40:43] >> Love the Lord. Your GOD, [3:40:44] with all your heart with all [3:40:45] your soul. And with all your [3:40:48] strength. And the second is [3:40:50] like it, love your neighbor as [3:40:54] yourself. I just want to end [3:40:55] with words of scripture. The [3:40:57] words of Jesus, because that's [3:41:00] how I live my life. And I know [3:41:01] I know that. That's how all of [3:41:03] you want to live your lives. [3:41:05] And I don't have any idea why [3:41:07] we would not support the [3:41:09] extension of tps for Haitian [3:41:16] neighbors. Thank you. [3:41:21] >> And the Julie Hill to [3:41:25] determine if she is here. My [3:41:27] name is Abby Weiss regarding [3:41:29] items 3, I'd like to share a [3:41:30] firsthand experience with the [3:41:31] Haitian member of our [3:41:33] community. [3:41:34] >> I'm a volunteer with keys [3:41:36] to be the change and read with [3:41:36] several Haitian students at [3:41:39] Point Sienna Elementary. A few [3:41:40] months ago. One of the [3:41:43] students and I discussed the [3:41:45] words. Optum, este and [3:41:46] pessimist. How to spell [3:41:49] pronounce and a fine. Every [3:41:50] time we met, I started our [3:41:52] conversation with our u n [3:41:55] Optimist or a pessimist today. [3:41:56] All refer to this child has [3:42:01] optimist. Optimists will begin [3:42:01] be in the fall and in an [3:42:02] effort to ensure they are as [3:42:05] prepared as possible. We [3:42:06] agreed we would like to [3:42:06] continue reading together over [3:42:11] the summer. I work with kids [3:42:11] to be the change and the [3:42:13] Pointe Sienna parent educator [3:42:16] to schedule reaching kids over [3:42:18] the summer is difficult. So I [3:42:20] was excited JUNE 24th. When I [3:42:20] heard when I learned we had a [3:42:21] meeting scheduled for JUNE [3:42:25] 30th. Optimist wants to be a [3:42:26] cardiologist and I was ready [3:42:27] with materials to learn about [3:42:30] how the heart works. New [3:42:33] vocabulary and and and help [3:42:34] bring that dream a tiny step [3:42:38] closer to reality. I want to [3:42:39] help optimist see that. A [3:42:41] career as a cardiologist is a [3:42:42] possibility and there are [3:42:43] invested partners to help make [3:42:47] that happen. On JUNE. 27th the [3:42:49] secretary of Homeland Security [3:42:51] announced hemp very protected [3:42:53] status designated for Haitians [3:42:53] would be terminated as of [3:42:58] SEPTEMBER seconds. On JUNE [3:42:59] 30th, I sat in the Pointe [3:43:00] Sienna office waiting for up [3:43:03] to mess to arrive. The parent [3:43:05] educator called both parents [3:43:06] several times. The phones [3:43:07] rang. Then calls were sent to [3:43:11] voicemail. Optimist lives, [3:43:12] walking distance from the [3:43:15] school. I waited patiently but [3:43:19] optimists never showed. Was it [3:43:20] possible they were too scared [3:43:23] to come to their own school? [3:43:24] Could their parents have [3:43:26] deemed it too unsafe to let up [3:43:27] to Mets walk a few blocks from [3:43:31] home. Do they feel that this [3:43:32] community and the only [3:43:33] elementary school this child [3:43:35] has ever known are now a [3:43:39] threat to their family. These [3:43:39] questions raced through my [3:43:40] mind, then gave way to the [3:43:41] most frightening question of [3:43:44] all. If they rescinded [3:43:47] designation remains in effect, [3:43:48] has optimists public school [3:43:51] education ceased altogether. [3:43:55] Is a 5th grade education. All [3:43:58] this child so full of [3:43:58] potential interest and empathy [3:44:02] will receive from Key West. [3:44:04] Commissioners. I encourage you [3:44:05] to support Optum Este and the [3:44:08] other 5,000 Haitian Members of [3:44:08] our community by voting in [3:44:12] support of this resolution to [3:44:14] extend temporary protected [3:44:16] status. Let's ensure safety, [3:44:17] security and access to a [3:44:18] public school education for [3:44:25] all children in Key West. Want [3:44:30] to go So I don't think other [3:44:31] people are here to say is [3:44:32] there anyone else that would [3:44:33] like to speak on this item? [3:44:46] Please come up. Thank you take [3:44:48] the time again. I have some [3:44:49] questions about this. A [3:44:51] meeting last week. We talked [3:44:51] about him. [3:44:52] >> The number of members of [3:44:55] our community who are Haitian. [3:44:56] This is not just here in [3:44:58] Monroe County are Qs a South, [3:44:59] Florida. I mean, this is a lot [3:45:02] of the state of Florida you [3:45:02] know, we heard a lot of [3:45:05] arguments about what we lose [3:45:06] by not extending this. What do [3:45:08] we lose by extending it? But [3:45:10] what is the harm voting to [3:45:13] extend this? Are we might [3:45:14] aggravate some politicians. Is [3:45:15] that the risk that we're on [3:45:18] our we putting the city on the [3:45:21] line by doing this? I [3:45:21] struggling to understand where [3:45:23] the hesitancy is here. I can [3:45:28] tell you, you know. It's not [3:45:31] just the things that we have [3:45:32] here in the city that rely on [3:45:35] these these folks, its county [3:45:35] services, its regional [3:45:38] services. I mean, go look at [3:45:38] where recycling gaps and his [3:45:42] process. It. A lot of the [3:45:44] functions of the city either [3:45:45] direct or indirect rely on on [3:45:49] these folks. Hawaii, is this [3:45:52] such a conundrum? And we've [3:45:53] already talked about the moral [3:45:54] stuff and everything else. And [3:45:55] that's really important. But [3:45:58] I'm not gonna late bloomer [3:45:58] again. I just don't [3:46:02] understand. What the risk is [3:46:04] to extending I'd love some [3:46:10] clarity on that. Thank you. [3:46:15] Yes, go ahead. [3:46:16] >> Jaime, again, Heather's [3:46:17] look about there's 14, 17, 18 [3:46:21] street district, 4. I just [3:46:22] want to say, I've got a couple [3:46:26] phone calls this week from [3:46:26] city employees. [3:46:28] >> Who are the directors? [3:46:31] >> Or at or [3:46:34] >> directly in charge with [3:46:34] various members of the Haitian [3:46:38] community that fall under tps [3:46:39] asking my organization that [3:46:41] literally I created a month [3:46:41] ago with several other people [3:46:45] in this. [3:46:48] >> Hall to actively try to [3:46:49] help our immigrant community [3:46:50] members. Literally. I've been [3:46:52] doing this activism work. [3:46:55] >> This round for one month. [3:46:57] >> And your people are calling [3:46:59] me and my people asking for [3:47:02] help and guidance and asking [3:47:03] them asking us for pro bono [3:47:05] lawyers because they're about [3:47:07] to lose no less than 8 [3:47:09] employees. Regardless of how [3:47:10] you vote today, tps is ending. [3:47:10] We're kicking all the Haitians [3:47:11] out of the country. It's a big [3:47:11] f# [3:47:12] # [3:47:12] # [3:47:12] # [3:47:12] # [3:47:12] # [3:47:12] mad. [3:47:16] >> Excuse my language. Your [3:47:17] people are calling my people [3:47:18] asking for help because they [3:47:19] don't know what to Clean your [3:47:27] house. [3:47:30] >> That's it. That's it. All [3:47:32] right. Do we have a motion [3:47:33] motion to approve motion to [3:47:35] approve to have a second [3:47:36] check. It. I have a second by [3:47:39] Commissioner casino. Any [3:47:41] discussion Commissioner Carey [3:47:42] just for clarity. We don't [3:47:44] have the authority. [3:47:46] >> The city does not have the [3:47:47] authority to extend this. But [3:47:50] we are urging and asking for [3:47:51] to think it's quite [3:47:55] appropriate that we do so it [3:47:56] is truly have a large Haitian [3:48:00] community here and the thought [3:48:01] original date was in FEBRUARY [3:48:03] of 2026. And backing it up so [3:48:07] quickly. Now to AUGUST 3rd [3:48:07] with the termination date of [3:48:11] SEPTEMBER second seems. Very, [3:48:12] very quickly that these [3:48:13] families would have to make [3:48:17] arrangements. So it does seem [3:48:18] quite appropriate that we that [3:48:19] we just ask for this [3:48:19] consideration that just for [3:48:22] clarity one gentleman was [3:48:24] asking the city has absolutely [3:48:26] no authority to to make this [3:48:27] decision only to urge the [3:48:29] government to do The [3:48:32] supporting Any other [3:48:33] discussion. Commissioner Yeah, [3:48:37] MADAM Mayor. Think some other [3:48:40] language should be added to [3:48:40] this here. [3:48:41] >> Be in not only Haitians [3:48:45] should extend till. The people [3:48:49] that will be sent back and in [3:48:53] the situation. I mean, it [3:48:57] singles out just Haitian. [3:48:58] >> I believe that's what it's [3:48:59] reference to for the. But [3:49:11] here's other. Hundreds is one. [3:49:12] And don't get me wrong. I'm [3:49:13] I'm I'm in full support of it. [3:49:17] So. It's not like I'm I just [3:49:19] don't want to leave anybody [3:49:19] out that some of the same [3:49:28] sanctions is. My fellow Okay. [3:49:29] We don't know what they are, [3:49:30] but we'll have to bring him [3:49:34] back. Well, I guess the [3:49:36] question this is specific [3:49:37] program, temporary protected [3:49:38] status under. [3:49:39] >> The former administration. [3:49:41] I don't know if are there [3:49:42] other groups under their own I [3:49:48] don't know. Commissioner has [3:49:50] school. [3:49:53] >> I believe this humanitarian [3:49:56] parole program primarily [3:49:57] effects nationals from 4 [3:50:00] countries like Commissioner [3:50:01] Casteel said Cuba, Haiti, [3:50:08] Nicaragua and Venezuela. [3:50:09] Commissioner Lee. [3:50:09] >> We're talking about tps [3:50:10] with a parole program month. [3:50:15] This is just temporary [3:50:16] protection. [3:50:19] >> Jennifer Haitian sea well [3:50:20] could be. [3:50:20] >> I don't know. We might want [3:50:23] to postpone this Commissioner [3:50:24] Kaufman be back and [3:50:27] participate. We can bring him [3:50:27] back. [3:50:28] >> so we can go ahead and go [3:50:29] with the resolution we have [3:50:32] now, since we we got a [3:50:34] commission are you sense of [3:50:34] putting it on hold? You're [3:50:35] making a motion for as is [3:50:41] right Ok? Yeah, we have I [3:50:42] second the motion. Oh, I'm [3:50:42] sorry. We have make has [3:50:45] discussions and it's not okay. [3:50:46] Okay. So in speaking with our [3:50:49] hr director today, we do have [3:50:52] to follow the federal law. The [3:50:55] city could be exposed to [3:50:56] hundreds of thousands of [3:50:57] dollars in civil fines per [3:50:59] worker as well as criminal [3:51:02] penalties, including fines and [3:51:04] imprisonment. And then as your [3:51:04] mayor, I cannot support [3:51:09] putting City Hall and this [3:51:09] position. So and we do have [3:51:11] some employees that it could [3:51:13] affect. But we have to follow [3:51:17] the federal law. Not a mission [3:51:18] or Kerry. Just for clarity. [3:51:20] We're just urging the [3:51:21] government right? It's just [3:51:23] asking them to support. [3:51:28] Changing the tea. Correct? [3:51:29] It's ultimately I I don't want [3:51:31] to speak for Commissioner [3:51:31] Hough and but my impression of [3:51:35] it is just expressing support [3:51:37] that we earns right to [3:51:38] continuing it as it's not that [3:51:40] we're implementing anything [3:51:40] that we support extension of [3:51:42] that. Ok, thank you. All [3:51:43] right. We have a motion is [3:51:47] second, any other discussion? [3:51:48] Can you call the Roll, Please? [3:51:49] Commissioner Kerry [3:51:51] commissioner Castillo. Yes, [3:51:54] Commissioner Haskell. Yes. [3:51:55] Commissioner Hoover. Yes. [3:51:55] Commissioner Lee. Yes. Mayor [3:52:00] Enrique Snow. Motion passes. [3:52:00] Okay. Item number 4 [3:52:02] ordinances. First reading. An [3:52:04] ordinance of the city of Key [3:52:07] west of the city commission of [3:52:07] Key West, Florida, pursuant to [3:52:10] Section 8.0 1 of the Key West [3:52:12] Charter and that Nick [3:52:14] ordinance, number 25, Dash 11 [3:52:15] changing the election date for [3:52:16] the proposed amendments to [3:52:18] section 3.0 1, a. [3:52:18] >> And b of the city charter [3:52:21] to be placed up for referendum [3:52:23] on the NOVEMBER. 3rd, 2026 [3:52:23] general election ballot [3:52:25] clarifying the proposed [3:52:28] amended amending language in [3:52:30] Section 3.0 changing the term [3:52:30] of future mayors from 2 years [3:52:34] to 4 years clarifying the [3:52:35] proposed amending language in [3:52:37] Section 3.0 1 b changing the [3:52:39] term limits for future mayors [3:52:42] from 8 12 years providing for [3:52:43] severability, providing for [3:52:43] fielding consistent provisions [3:52:45] providing for an effective [3:52:46] date. [3:52:46] >> And I do have Chris nasa [3:52:54] Coats signed up. Hello, Mayor [3:52:55] and commissioners Chris [3:52:58] mascot, 16, 15 Laird Street. I [3:52:59] had requested that election be [3:53:04] postponed to save $72,000 in [3:53:05] city funds. So I really [3:53:05] appreciate you guys putting [3:53:09] this on the ballot. I [3:53:11] encourage you to put this on [3:53:12] AUGUST election because that [3:53:13] is when municipal elections [3:53:16] here in Key West happen. And I [3:53:18] think it's healthy for us to [3:53:19] have that debate during the [3:53:20] municipal elections. That will [3:53:25] happen in AUGUST. But I do [3:53:26] support this this movement to [3:53:27] make so that we can save some [3:53:28] money. But I do want to point [3:53:33] out one more thing is that we [3:53:34] redesigned City government. [3:53:35] The idea for the mayor to only [3:53:38] have 2 terms was so that every [3:53:39] 2 years we could throw out the [3:53:41] entire the majority of the [3:53:42] commission, if the city, if [3:53:46] the city voters wanted to. I [3:53:47] think that a lot voters might [3:53:53] want to do that. Thank you. [3:53:55] >> Thank you. I did sponsor [3:53:56] this ordinance and I [3:53:57] previously requested that I [3:53:58] would like to see the mayor's [3:54:01] term change from 2 years to 4 [3:54:02] years. However, I have since [3:54:03] asked that it be postponed [3:54:08] until the 2026 election. This [3:54:09] is the right and responsible [3:54:11] thing to do. So I'm asking for [3:54:13] the commission's support in [3:54:14] moving this forward. Do I have [3:54:16] a motion approve? Have a [3:54:17] motion by Commissioner Lee a [3:54:18] second by Commissioner Any [3:54:20] other discussion. Commissioner [3:54:25] Haskell. [3:54:27] >> When a similar ordinance [3:54:28] came before us earlier, that [3:54:29] was putting the election date [3:54:32] in 2025. For first reading and [3:54:35] never came up for second [3:54:36] reading. That also, I do [3:54:39] remember did that also change [3:54:40] the term limits for future [3:54:42] mayors from 8 years to 12 [3:54:43] years or is that on this [3:54:47] version? [3:54:48] >> know that America MAY [3:54:49] commissioner Haskell, that was [3:54:50] a change that was already done [3:54:52] and approved previously. So [3:54:52] the only change that we're [3:54:53] making to this one is [3:54:57] specifically the election date [3:54:59] changing from special election [3:54:59] to the election and a general [3:55:02] election in Thank you. Any [3:55:05] other discussion. Can you call [3:55:08] the roll? Please, commissioner [3:55:09] Carey s commissioner Castillo. [3:55:12] Yes, commissioner Haskell. [3:55:13] Yes, commissioner Hoover. Yes. [3:55:14] Commissioner Lee. Yes. Mayor [3:55:18] Henry gets yes. Motion passes. [3:55:18] >> And at this time our
