[16:55] Good evening, honorable mayor, [16:57] vice mayor, commissioners. [17:00] My name is pavel, I'm the chair [17:01] of the mobility and safety [17:01] committee. [17:04] For the benefit of the public [17:05] here, I'd like to state that the [17:08] committee was formed through a [17:09] formal application process and [17:11] our purpose and mission is to [17:12] promote traffic safety in our [17:14] beautiful city, as well as [17:16] pedestrian safety, and to [17:18] generate and discuss ideas for [17:18] improving traffic flow in the [17:20] city of sunny isles beach. [17:23] And we are volunteers, [17:24] contributing our time, [17:26] contributing our efforts, and [17:26] minds, to this very important [17:32] initiative. [17:36] The mapsecond committee over [17:41] past two meetings discussed the [17:42] intersections concerning the [17:44] protection of pedestrians [17:46] crossing from turning vehicles. [17:47] And we would like to highlight [17:48] the points of automated [17:50] enforcement using cameras and/or [17:51] other equipment possible in [17:51] addition to establishing this [17:56] protection. [17:57] There's significant evidence to [17:59] support the idea that automated [18:02] enforcement using traffic [18:03] cameras that capture turn [18:05] violations lead to safer [18:06] crossings for pedestrians. [18:07] In the memo that we provided, [18:09] there's several studies. [18:11] I'm just going to highlight a [18:11] few numbers. [18:12] The american journal of public [18:14] health found that the presence [18:18] of red light cameras lead to a [18:21] reduction, 21% reduction, in [18:21] pedestrian fatalities, and 14% [18:24] reduction in pedestrian [18:25] injuries. [18:27] And this was from the data [18:30] collected from 14 cities across [18:32] the united states. [18:33] General transport and health do [18:36] a study of over 200 sections in [18:37] the city in chicago found that [18:39] these kind of automated [18:41] enforcement cameras lead to 25% [18:41] reduction in the number of [18:46] crashes involving a pedestrian. [18:47] And lastly the american journal [18:49] of public health did a study on [18:52] red light violations, found that [18:54] red light violations decreased [18:56] by up to 90%, and the number of [18:57] crashes at intersections [18:58] decreased by up to 30% in the [19:01] presence of these automated [19:08] enforcement cameras. [19:08] So, there's significant evidence [19:12] from formal studies, but also [19:16] there's support in this kind of [19:17] experience, by the residents of [19:20] our neighboring city, the city [19:21] of aventura, they've been very [19:22] supportive in the red light [19:23] cameras installed in their city, [19:25] and if you drive through the [19:26] city of aventura you'll notice [19:28] that everyone there is kind of a [19:29] model driver. [19:31] You know, very careful in [19:32] approaching intersections. [19:33] Doing their proper red light [19:33] stops, and proceeding [19:38] thereafter. [19:40] And so, I am here presenting [19:41] this memo. [19:43] If you have any questions, [19:45] please let us know. [19:48] But, before I conclude I'd like [19:50] to thank you for establishing [19:51] the mapsac committee. [22:49] This is application pz 2022-09. [22:50] It was approved for two [22:52] apartment towers, a new [22:53] apartment garage and remodeling [22:55] of the existing apartment tower. [22:56] The applicant is proposing four [22:58] separate minor modifications [22:59] which I will walk through now. [23:00] And the applicant will also [23:02] provide a presentation with [23:05] further explanation and will [23:07] also be available for questions. [23:08] First the applicant is [23:10] requesting to eliminate a cable [23:12] railing system along the water [23:16] front of the property. [23:17] The property has two water [23:22] frontages at the north and [23:22] south. [23:25] And it's providing -- they were [23:27] highlighted on the screen. [23:30] So the property has two water [23:31] frontages and is providing [23:32] public walk that's highlighted [23:33] along the water frontages. [23:35] In the original site plan [23:38] approval there was a four foot [23:39] cable railing proposed between [23:40] the bay walk and the seawall, [23:41] the detail of which is also [23:42] shown on the screen. [23:44] And the railing is not required [23:45] by the zoning code or the [23:47] building code. [23:48] So the applicant is requesting [23:49] to eliminate the cable railing [23:52] from the plan. [23:54] Staff does not object to this [23:54] modification, as it is [23:56] consistent with the city's [23:57] comprehensive plan, and the land [24:02] development regulations. [24:06] Second the applicant is [24:08] requesting to modify the [24:09] entryway signage for the [24:10] property. [24:11] It's at the intersection of [24:13] kings point drive and collins [24:13] avenue. [24:15] The approved site plan showed [24:17] two blue city monument signs on [24:19] the north and south side of [24:20] kings point drive. [24:22] The proposed modification is to [24:23] install one city monument sign [24:26] on the south side of kings point [24:28] drive, and a development sign on [24:29] the north side of kings point [24:31] drive. [24:33] Staff does not object to this [24:34] modification as it's consistent [24:35] with the comprehensive plan, and [24:35] the city's land development [24:41] regulations. [24:43] The third request is to modify a [24:44] condition of approval from 2017, [24:44] with regards to the project [24:47] workforce housing. [24:51] The project is required to [24:52] provide 35 dedicated workforce [24:55] housing units in the existing [24:57] remodeled apartment building. [25:02] Condition 22 of resolution [25:04] 17-v-161 require the development [25:05] to record a restrictive covenant [25:07] with the number of units to be [25:08] dedicated to the workforce [25:10] housing program and their [25:10] location. [25:13] so, the resulting restrictive [25:15] covenant would give 35 specific [25:15] unit numbers. [25:16] The management company would [25:17] like a little bit more [25:18] flexibility with regard to [25:22] leasing the units. [25:23] And would like to amend the [25:26] covenant to remove the 35 [25:27] specific unit numbers, while [25:30] maintaining the unit mix, and [25:33] maintaining that the units will [25:35] be located on multiple floors. [25:37] Staff does not object to this [25:37] modification. [25:39] Subject to the condition that [25:41] the applicant must record an [25:41] amended covenant in a form [25:47] accessible to the city attorney. [25:49] The final and fourth [25:50] modification, the applicant is [25:51] requesting to construct a [25:53] residential marina with 18 [25:55] slips. [25:59] The property is zoned rms-2 or [26:00] medium high density residential, [26:02] and marinas are permitted [26:05] accessory use in this zoning [26:05] district to residential [26:06] development. [26:08] Staff has no objection to the [26:09] marina if the condition of [26:10] approval applies operational [26:10] limitations such as the [26:14] following. [26:15] Vessel movement is to be [26:17] restricted to the hours between [26:19] 6:00 A.M. And 12:00 A.M. But can [26:21] be extended in cases of [26:22] emergency or weather events. [26:24] No fuelling or pump-out services [26:28] are to be provided. [26:31] There are no live aboards [26:32] allowed. [26:33] Proof of living in the [26:34] development is required for [26:35] leasing a slip. [26:37] Vessels cannot be rented to any [26:38] individual for any amount of [26:39] time or used for any commercial [26:41] activity including jet ski [26:42] rentals. [26:43] That the marina must be managed [26:47] by a dock moster. [26:48] In working with the applicant [26:50] and speaking with our legal [26:51] department it was determined [26:55] that the condition that's listed [26:56] in the staff report providing [26:58] for a restrictive covenant [26:59] concerning the operational [27:01] limitations I just described is [27:02] not necessary. [27:03] As the city can enforce the [27:04] limitations that I just [27:06] described in conditions through [27:08] the site plan approval and [27:09] city's code. [28:03] The four changes are to [28:04] eliminate the cable railing [28:06] along the seawalls, to improve [28:09] the entryway signage, to modify [28:11] the workforce housing covenant [28:13] to allow greater flexibility to [28:14] evenly distribute the units [28:15] throughout the building, without [28:17] any change to the number, [28:20] quality or type of units [28:20] provided. [28:22] And to construct a previously [28:25] existing 18-slip residential [28:27] marina restricted to use by [28:29] upland owners only, and subject [28:32] to the other voluntarily [28:34] proffered conditions, as stated [28:35] by the planning director this [28:35] evening. [28:38] Before I proceed with the rest [28:41] of the presentation, I think [28:44] it's important to note that the [28:46] brunetti family has owned this [28:47] property for nearly 40 years. [28:49] And this is a long-term hold. [28:51] They have redeveloped the [28:53] property, as you know, the [28:55] existing building, building two [28:57] new residential rental [28:57] buildings. [28:58] And so they are owners. [29:00] They are not going to be [29:01] building it, selling it, and [29:01] leaving town. [29:05] They're going to be operating [29:05] it. [29:07] And so, they are more concerned [29:09] than anyone that they have a [29:10] quality property that attracts [29:11] good tenants. [29:11] We can go to the next slide, [29:15] please. [29:17] You see number one is [29:18] eliminating the cable railings [29:20] that were in the original [29:21] approved plan. [29:25] This shows the site behind the [29:25] building today. [30:55] So the proposed marina is [30:56] consistent with the definition [30:58] and will serve as permitted [31:00] by-right accessory use to the [31:00] upland residential property. [31:41] The city manager has elected to [31:44] seek your input on this. [31:47] And finally, next slide. [31:49] Just to repeat some of the [31:52] history on this, the proposed [31:53] marina replaces what was a [31:55] longtime existing marina that [31:56] was destroyed by hurricane wilma [31:59] in 2005. [32:01] This marina fulfills the [32:05] complete vision of the wider [32:09] recently reinvigorated marina [32:09] del mar project. [32:09] And, in fact, enhances the [32:10] quality of the project and the [32:13] quality of the residential [32:13] environment at the marina. [32:15] The marina was in continuous [32:17] operation for nearly 40 years [32:18] before it was destroyed by the [32:21] hurricane. [32:22] Even after the hurricane, the [32:25] applicant has paid taxes on the [32:27] marina, since it was destroyed. [32:31] The applicant has prioritized [32:32] upland redevelopment and the [32:33] fortified seawall and now seek [32:35] to reinvest in the marina, as [32:36] well. [32:39] And finally, miami-dade county [32:40] environmental resources [32:41] management has performed a [32:43] preliminary review of the [32:46] proposed marina, and confirmed [32:46] its consistency with key [32:47] regulatory provisions. Joseph, so, in the course of [35:01] developing the project in the [35:05] early submissions, the landscape [35:07] architect proposed the railings [35:08] as part of the overall design. [35:10] By the time we developed both [35:11] the towers, and all of the [35:13] platforms for the tower, all of [35:15] the safety issues that would be [35:17] related to the higher level [35:18] buildings were built into the [35:20] building, so we have glass [35:21] railings around all the [35:22] buildings, and what we've seen [35:25] in the other areas in town is [35:31] that there's a lot of use along [35:33] the fortified seawalls where [35:36] people are enjoying firing and [35:38] doing other things, so we saw [35:39] that as an amenity to the [35:41] community now that we have the [35:42] easement for the bay walk around [35:43] all our properties. [35:45] And we see a lot of dog walking, [35:46] fishing, and things like that [35:48] already going on. [35:50] So our thought was, it's not [35:53] being required to enhance the [35:54] amenity of the new seawalls, [35:56] which are elevated higher than [35:57] the other seawalls, and quite [35:59] safe in terms of flooding and [36:01] everything else, it's just a [36:01] better look and feel for the [36:04] overall community, we thought. [36:07] And that was our reason for not [36:10] building that railing. [36:12] >> so the original idea of the [36:14] railing, it was for fancy rather [36:15] than safety? [36:21] >> no, I think ultimately, and I [36:23] can't speak for our landscape [36:24] architect, but I think in [36:25] general he felt that it was [36:28] required. [36:30] And we learned long after that [36:31] that it wasn't. [36:34] And then when we saw the use of [36:36] the bay walk, we felt it would [36:38] be better to allow it for [36:40] people -- and I will be honest, [36:44] fishing is a big thing around [36:46] saul of those areas so we see a [36:47] lot of people coming to our [36:48] property to do those things. [36:49] So that's, I think, how it [36:53] evolved. [36:55] >> okay. [36:57] So, how do you plan on keeping [36:59] small children away from the [37:00] edge of the seawall? [37:02] >> well, we have about anywhere [37:06] from six to ten inches of rise [37:09] there, along the bay walk. [37:11] And it seems like all the other [37:12] bay walks, even right adjacent [37:14] to us, where we have the [37:16] children's park, there's a good [37:18] 10 feet of space, which is used [37:20] by families walking dogs and [37:24] things, between poinciana and [37:27] ours, that have very similar [37:27] situation. [37:29] So I think it's -- I think it's [37:32] a fairly safe environment. [37:33] >> so this railing wouldn't in [37:35] any way keep children away from [37:37] the seawall? [37:40] >> it might. [37:42] But I think the curb itself [37:44] keeps them on the walkway. [37:48] The bulkhead itself is too deep. [37:50] So, it just seems similar to [37:54] what we've seen elsewhere in the [37:55] city on sunny isles beach. [37:56] And we think it's kind of [37:59] compatible with the way people [38:01] use the edge, the water edge in [38:01] the community. [1:30:01] 20 vendors registered as a plan [1:30:03] holder to receive automatic [1:30:04] updates regarding this rfp. [1:30:06] For those of you who are not [1:30:07] familiar with demand star, [1:30:10] demand star is a recognized [1:30:11] procurement database platform [1:30:12] with thousands of registered [1:30:13] vendors according to their [1:30:17] commodity code. [1:30:19] In addition to demand star, the [1:30:24] rfp was e-mailed to over 400 [1:30:25] restaurants, listed on the [1:30:29] florida restaurant and lodging [1:30:29] association, and the greater [1:30:30] miami convention and visitors [1:30:33] database. [1:31:16] On OCTOBER 20th, the city [1:31:18] clerk's office received two [1:31:19] proposals by the said deadline [1:31:23] in response to the rfp. [1:31:28] The two proposals was one [1:31:29] pantheon gastrobarn and prime 29 [1:31:29] inc. [1:31:31] The evaluation committee [1:31:33] appointed by the city manager [1:31:37] was composed of three city [1:31:38] employees, which was the [1:31:40] assistant city manager, the [1:31:42] planning and zoning director, [1:31:45] and our senior accountant. [1:31:47] The evaluation committee met to [1:31:50] review and rank the two [1:31:52] proposals on NOVEMBER 3rd, 2022 [1:31:53] on the fourth floor conference [1:31:54] room. [1:31:56] The meeting was posted on the [1:31:56] city's website as a sunshine [1:32:00] public meeting. [1:32:02] Based off the criteria on page [1:32:04] 31 of the rfp solicitation, the [1:32:07] committee evaluated and ranked [1:32:08] pantheon gastrobar as the [1:32:11] highest ranked firm. [1:32:12] After consideration and [1:32:13] reviewing the committee's [1:32:15] recommendation the city manager [1:32:16] finds that it is in the best [1:32:19] interest of the city to reject [1:32:20] all proposals. [1:32:21] Therefore, if you have any [1:32:22] questions regarding the [1:32:23] procurement process, I'll be [1:32:25] more than happy to address them. [2:01:06] I'm probably one of the few [2:01:08] people here that was present [2:01:11] when the original charter was [2:01:21] put together and dan lenhieser [2:01:23] was appointed and when the mayor [2:01:24] got sworn in or the [2:01:27] commissioners got sworn in [2:01:29] within 24 hours from an [2:01:29] election. [2:01:33] By the time 2001 came along, [2:01:36] there were elections and we [2:01:38] noticed that there probably [2:01:40] needed to be a change in the [2:01:46] charter as to the timing [2:01:47] primarily because of civility [2:01:49] and courtesy we didn't want to [2:01:51] be kicking people out of office [2:01:56] the day after an election and we [2:01:58] timeline for a smooth [2:01:59] transition. [2:02:03] So in 2003 when the last -- the [2:02:06] first charter revision took [2:02:07] place, there was a provision [2:02:10] made in the charter which is [2:02:22] applying today that anyone [2:02:22] elected would wait 30 days [2:02:22] before coming in, realizing that [2:02:22] there could be a situation where [2:02:24] there would be a former mayor or [2:02:25] former commissioner still in [2:02:27] office for 30 days. [2:02:32] But we felt the courtesy [2:02:34] outweighed the negativity of the [2:02:37] situation and that major issues [2:02:40] really weren't going to be done [2:02:42] during let's call it a lame duck [2:02:43] period. [2:02:46] And that certainly, a new mayor [2:02:47] would be given the opportunity [2:02:48] or a new commissioner would be [2:02:50] given an opportunity to pick [2:02:52] people that would be serving on [2:02:55] committees during their time in [2:02:56] office. [2:02:58] So basically, I have two [2:03:00] recommendations. [2:03:03] One is change today's meeting to [2:03:04] include that the four [2:03:06] commissioners can make their [2:03:07] appointments today because they [2:03:09] will be on the new commission. [2:03:11] But reserve the right for the [2:03:14] incoming mayor to pick the fifth [2:03:18] person at the next JANUARY [2:03:20] meeting, or today just pass the [2:03:22] resolution that you will have a [2:03:24] charter committee and in JANUARY [2:03:27] all of you can fill in the five [2:03:28] people that you wish to be on [2:03:31] the committee. [2:05:56] And now somebody just wants to [2:05:58] take advantage of that, perhaps [2:06:00] we will have to go and change [2:06:02] the charter again at this next [2:06:04] commission to correct what we [2:06:06] thought was the right thing to [2:06:10] do, but it did have unintended [2:06:10] consequences. [2:07:10] And so that charter [2:07:12] commission -- the revision [2:07:14] commission changed it for 30 [2:07:26] days, at which, of course, I [2:07:26] drafted per their request. [2:07:26] But it didn't contemplate this [2:07:27] situation, obviously. [2:07:27] and that MAY be something you [2:07:27] want to take up with the new [2:07:27] revision commission. [2:07:30] But I'd like to remind you, the [2:07:32] city was formed -- and the [2:07:33] reason the charter was drafted [2:07:35] in the first place was because [2:07:38] this area was part of the [2:07:39] county. [2:07:42] And this -- the residents of [2:07:44] this city to become wanted [2:07:45] autonomy and wanted to be able [2:07:49] to be part of the decision [2:07:49] making. [2:07:52] And they wanted the government [2:07:53] close to themselves. [2:07:55] So they formed a city and we [2:07:56] drafted the charter with every [2:07:58] provision with that question in [2:07:59] mind. [2:08:03] Did it reflect the choice of the [2:08:03] people? [2:08:04] And that's part of the reason [2:08:07] that we had the installation and [2:08:10] commencement of office the day [2:08:13] after the election. [2:08:18] So it is, in fairness, that [2:08:21] mayor edelcup is asking to defer [2:08:23] the mayor's selection. [2:08:24] Constitute the charter revision [2:08:27] per the charter as I'm sure your [2:08:28] city attorney has told you to [2:08:31] do, but give consideration to [2:08:35] the unique circumstances in the [2:08:36] first instance. [2:33:20] And at the end of the day what [2:33:22] happens is that the supervisors [2:33:25] of elections staff do what they [2:33:27] call an audit, a precinct audit. [2:33:30] What they do is take all four [2:33:31] precincts here and put them on [2:33:33] little stickers -- [2:33:33] >> five. [2:33:34] >> five precincts. [2:33:35] They put them in a bowl. [2:33:37] Somebody picks out a number and [2:33:38] that's the number of the [2:33:38] precinct. [2:33:40] They bring out all of the [2:33:45] ballots, both the vote ballots [2:33:47] and previously received ballots [2:33:49] and they do a manual recount. [2:33:49] - [2:33:50] and when they did that, the [2:33:52] numbers were exactly matching [2:33:53] what the results were. [2:33:54] >> yes. [3:21:36] And you can make the right [3:21:37] decisions and moving forward [3:21:39] with some of the things we were [3:21:44] able to accomplish, so it's [3:21:44] great. [3:21:46] A lot of things.
