We've covered most of it [10:29] in our two prior public meetings, but [10:31] I'll run through it pretty quickly here [10:33] tonight. Tonight we have two action [10:35] items before you. The first one is the [10:37] budget public hearing. At the conclusion [10:39] of the budget public hearing, state [10:40] statute requires that you take some sort [10:42] of action at the conclusion of tonight's [10:44] public hearing. So the action needs to [10:46] be that you will set formal action on [10:48] September 22nd at 6 p.m. here at city [10:50] hall. The second item before you tonight [10:53] is a tax rate proposal and again that [10:56] has very specific wording that you must [10:57] make your motion when we get to that [10:59] point. A look back at kind of where we [11:02] are in the budgeting process. We [11:04] presented the initial base budget in [11:05] July. We held our budget workshop on [11:07] August 7th. Took that feedback from the [11:10] council and opened the public hearing on [11:12] August 10th with a revised budget. We'll [11:14] go over what all that includes here [11:16] shortly. Tonight, we're continuing the [11:18] public hearing and proposing the tax [11:20] rate and then we will set everything for [11:22] final adoption on September 22. [11:26] Um, a little bit of note, as you all [11:28] know, we've talked about this year [11:30] significantly different than what we've [11:32] seen in at least recent property tax [11:34] setting years. our certified appraisal [11:37] role was up just.7%. [11:39] Um, typically in years past, we've seen [11:42] that number up around five or six%. Um, [11:45] but the biggest change this year was [11:47] that our net taxable value decreased, [11:50] which means our opportunity for revenue [11:52] to fund city operations also decreased. [11:55] Um, the taxable base did not keep pace [11:58] with community growth, inflation, and [11:59] service demand. The biggest reasoning [12:02] for this reduction was due to changes in [12:04] exemptions for business personal [12:06] property and then a correction of an [12:08] error that was made related to business [12:10] personal property tax and last year's [12:12] tax rate calculation. So while yes, we [12:14] all look around and we see all the [12:16] growth that's happening that's not [12:18] translating into tax revenue growth for [12:20] the city this year. [12:22] >> So that wasn't a city error. [12:24] >> No sir, it was with the appraisal [12:26] district. [12:30] Um, so as I mentioned, we came back to [12:32] you with a revised budget. This is just [12:34] an overview of what changed in the [12:36] general fund where we stand with [12:38] revenues, expenditures, and then a [12:40] forecasted margin of only 57,272, [12:43] which is very thin for a budget of about [12:45] $10 million the year. We feel like this [12:48] is the best most prudent use of funds [12:52] for the upcoming year. So that's kind of [12:54] where we stand there. Um, and then was [12:58] revised in the budget was to allow for [13:00] four additional public safety positions, [13:03] an investigator patrol officer, two [13:05] full-time firefighters, the replacement [13:07] of tasers for our police department, two [13:10] AED replacements. Those are all [13:14] external. [13:17] I don't know what the A I can't remember [13:18] what the A stands for. [13:21] >> Yes, [13:22] >> you do have to press the button. [13:23] >> Critical equipment if your heart stops [13:26] and then an increase to and storm water [13:28] repairs for both Rosebrook street [13:30] repairs of about 50,000 and then a [13:32] citywide roadway commission assessment. [13:35] Um all of those things are added in the [13:36] revised work program. Again, this will [13:39] allow for three officers on every patrol [13:42] shift for our police department and [13:45] provide a second investigator which is [13:46] critically needed as our population has [13:48] continued to grow. Um our public safety [13:51] departments have done a great job of [13:52] keeping up but we're at a critical [13:54] tipping point where we've got to have [13:56] some additional if we want to maintain [13:58] those service levels. Same for the fire [14:00] department. This would allow for three [14:01] full-time and one part-time firefighter [14:04] per shift and would allow us to need [14:08] those staffing models that are needed. [14:12] A quick look at the tax rate reference [14:14] points. The last time you we all spoke, [14:16] we were thinking that the the rate would [14:17] need to be at the divinous rate of 828. [14:20] Um after speaking with Mayor Wansley, [14:24] Miss Le and I did their financial [14:26] advisors and tax attorneys and feel like [14:29] that tonight we would recommend that you [14:31] propose a rate of 792891 [14:34] which is three and a half cents below [14:36] the minimum rate and five and a half [14:38] cents below the voter approval rate. Um [14:41] we understand that this is still a [14:44] significant increase in what the current [14:46] adopted tax rate is but it it is going [14:49] to be used strictly to provide critical [14:51] public safety services and roadway [14:53] repairs. Um [14:56] so this is how we came up with that [14:58] scenario. So the M rate would be 493059 [15:03] the INS rate of 299832. [15:07] One thing to note here we have to do [15:09] statutos on our 2026 tax rate [15:12] calculation sheet. What that rate showed [15:14] what that worksheet showed was that the [15:17] debt rate should be 335717. [15:22] We were looking for any opportunity to [15:24] not go up to the diminish rate of 82 [15:26] cents. And so what we are asking for the [15:29] council to do is to use some fund [15:31] balance both the general fund and the [15:33] INS fund to help lower that rate. [15:37] Um we feel like that's important. We [15:39] think some of it will provide permanent [15:43] rate relief, but a portion of it will [15:44] only be for one year. We're we realized [15:47] we're asking a lot here and so we wanted [15:49] to make sure that we were doing what we [15:51] can to find the right mix, but [15:54] as we move forward. [16:00] So, what this looks like is that the [16:01] general fund would assume scheduled [16:03] payments for the 2007 bond refunding and [16:06] the 2021 fire truck obligations as they [16:09] come due. Both of those two notes are [16:11] scheduled to be paid off by the end of [16:13] next year. The general fund would assume [16:15] those payments out of the debt [16:17] calculation. [16:19] Then we would use additional funds from [16:21] the debt service fund balance to pay [16:24] interest only on the 2022 refunding and [16:27] the 2018 C. That's that one time [16:31] lowering of the rate just slightly so [16:33] that we can keep it 80 cents for the [16:36] upcoming year. We will see that again in [16:39] our tax rate calculation next year. It's [16:41] a one time thing. Jennifer, as I said, [16:43] Jennifer and I did speak to our [16:44] financial advisors. They felt like we [16:46] had healthy fund balances in both the [16:49] INS fund and the general fund to support [16:51] this recommendation. [16:53] So that again we can limit that increase [16:54] as much as possible. So we would take [16:56] that rate from 335717 to 29932. [17:03] » Any questions on that? So, if you're if [17:05] you were budgeting at home and you were [17:07] looking for a way to lower basically [17:10] your monthly payments on things, you [17:12] would look for any savings that you [17:14] might have that's beyond what you would [17:16] need for emergency. And you would say, [17:18] is there any debt that is one or two [17:20] years away from being paid off [17:22] completely? And if we put that excess [17:25] fund balance towards it, then that's [17:28] where the INS that's where the INS [17:29] pennies. So, this change in the compared [17:34] to what you saw last time doesn't [17:35] represent anything falling off the [17:36] budget. Any of those services that we [17:38] saw that were that were there. It's just [17:40] a way to pay off debt a little bit [17:42] early, which we're paying principal only [17:44] on at this point. Like the interest was paid. One of them was widening 346. [17:49] You know, that's how old some of that [17:51] debt is. Uh and just a way that we can [17:53] use fund balance uh not for something [17:56] that would be recurring again next year, [17:58] but for permanent removal of the [18:00] pennies. So, that seemed like a good use [18:02] of fun balance. We're doing a onetime [18:04] payment out of it to get rid of a [18:06] permanent tax burden. [18:10] » And again, we it's not paying it off [18:12] early. It's just paying it as it comes [18:14] to you. We didn't ask about paying it [18:15] off early, but because it's principal [18:16] only, there's no [18:18] >> Oh, right. That's right. Yeah. [18:20] >> So, we wouldn't save any on interest by [18:22] paying it off early. It's just putting [18:24] fund balance towards those payments, [18:26] which is even smarter. I mean that that [18:28] allows that money to stay in fund [18:29] balance uh and be interest bearing while [18:33] we while we make those payments. So even [18:35] better. [18:36] >> So again what this what this strategy [18:39] does it uses our available reserves to [18:41] reduce that INS levy requirement [18:44] and you are allowed to do that. So you [18:46] can go lower than what the tax rate [18:48] calculation worksheet shows to be paid. [18:51] You just cannot go above. So by lowering [18:53] it we're well within state law to do so. [18:56] Again, it does not or it does not [18:58] eliminate our future debt service [19:00] requirements. We have a 30year debt [19:03] schedule that's planned out well in [19:05] advance. One of the things that we run [19:07] into is that we plan 30 years out based [19:10] on the rules and allocations that we [19:13] have today. So, when we issue debt in [19:16] 2025, we made those decisions based on [19:18] our property tax values, how they've [19:21] grown, and what the state legislature [19:23] had those numbers at then. What they've [19:25] done has changed the rules. So every [19:28] time they give one group a greater [19:30] exemption [19:32] another we either have to cut services [19:34] or another group has to make up the [19:36] difference. And so that's one of the [19:37] things that we're running into this [19:38] year. [19:41] I'm going to skip this. We covered where [19:43] we've been and where we're headed again [19:45] tonight. So this first item is to set [19:49] the date for action and adoption for the [19:51] budget for September 22nd at 6 p.m. And [19:54] then on item number We will need to [19:56] determine the tax rate to be formally [19:58] proposed and the required public hearing [20:00] and adoption also September 22. When city approves a plan [25:44] development, people make decisions based [25:46] on that approval. They buy homes, they [25:48] build homes, they invest hundreds of [25:51] thousands of dollars. They choose one [25:53] neighborhood over another because they [25:54] have a reasonable expectation about [25:57] what's going to be built around them. I [25:59] believe the city has an obligation to [26:01] respect that revise. The development [26:03] contemplated here was approved with [26:05] certain characteristics as almost a [26:07] retirement community. It was gated. It [26:09] had an age restriction. It included a [26:12] dog park. These things help define the [26:14] nature of the development that people in [26:16] the surrounding area reasonably expected [26:18] would be built. The entire neighborhood [26:20] was developed after the entire [26:22] neighborhood community has been [26:24] established. Those homeowners have [26:26] already made their investment. Now we're [26:28] asking to materially change uh that [26:31] plan. That troubles me and I believe it [26:33] should trouble every one of you. I've [26:35] spoken about it here before and I [26:37] believe very strongly that this should [26:39] be prevented by ordinance. Homeowners [26:41] should not be forced to stay vigilant to [26:44] protect their investment in our city. [26:45] That's what P&Z is supposed to do and [26:48] frankly that's what you guys are [26:49] supposed to do. So these citizens, these people built and invested in our [26:54] community with the belief that this [26:56] quiet little over 50 neighborhood was [26:59] going to be built in this little nook. [27:01] And then that's not we're planning for. [27:03] I'm not against small homes. I'm not [27:05] against affordable housing. I don't [27:06] think anybody is. But they're against it [27:08] where they built because that's the [27:10] condition that they built under. And I [27:12] believe that's a contract we all have to [27:14] keep. And I [37:29] went back and listened to the recording [37:30] of that of that meeting and we were [37:32] super excited because the the plan [37:34] development was somewhat new for the [37:36] city. Like we wanted we wanted [37:38] developers to have the opportunity to [37:40] take what was then residential low. I [37:42] think all eight people that have bought [37:44] uh that property half of you bought the [37:46] property when it was res bought your [37:48] homes when it was residential low. The [37:49] other half bought your property with [37:52] this this zoning in place where it was [37:55] going to be a retirement community. you [37:56] know, was going to be 50 or older, it [37:58] was going to be a dog park, a picnic [37:59] area, a gate, sidewalks. They talked [38:01] about sidewalks in that meeting. Um, and [38:04] definitely the age restriction. And I'd [38:06] imagine, you know, buying your property [38:08] with the idea that, hey, maybe one day [38:10] mom and dad will live back there, right? [38:11] It's the retirement community. So, it [38:13] was almost a value ad to have it, you [38:15] know, as it was zoned, which is the [38:16] purpose of of a plan development. You [38:18] take property that's residential low and [38:21] it's negotiation between the city and [38:23] the developer to try to make changes to [38:25] it but changes that still retain the [38:27] value that you would get out of a [38:28] residential low development. So that's [38:32] what was that's what was proposed and it [38:34] was it was hard to get it through [38:35] planning and zoning even with those you [38:36] know with those concessions because a [38:39] couple of things people just see that it [38:40] was being reszoned as residential medium [38:42] plan developments were new to the city [38:44] they didn't trust that the city was [38:46] going to hold a developer to the [38:47] requirements that they put in place. Um [38:50] but it got through planning and zoning [38:51] there was about a month of conversation [38:53] before it finally made it to council [38:54] while they were talking to the citizens [38:55] and mitigating those concerns. And then [38:58] it came to council and it was about a [38:59] 20-minute conversation just full of [39:00] excitement, you know, that we had this [39:02] plan development that it was going to be [39:03] built this way. This was brand new to [39:05] White House, you know, for how it's [39:07] being built and the amenities is going [39:08] to bring. So, I think that that was I [39:11] mean that was a that was a hard thing to [39:13] move from residential low to residential [39:15] medium with all of those concessions in [39:17] place. And I would think as I've spoken [39:21] to tonight, we're kind of the stewards [39:23] of of the property here in White House. [39:26] When it's planned that way, when it's [39:28] negotiated that way, it's up to planning [39:30] and zoning and the city to make sure [39:32] that developers uh stick to those [39:34] negotiations that are made during that [39:36] process. [39:37] Now, if we want to start over, we're [39:39] going to go back to residential low and [39:41] then enter into a new contract where we [39:42] try to figure out what residential [39:44] medium plan development would look like. [39:47] That's great. But to me at this point to [39:48] take what was kind of hard to get [39:50] through in the first place and start [39:51] knocking stuff off of it. I feel like it [39:53] knocked some of the value off of what [39:54] was negotiated in the first place. [41:13] This is something that we need to [41:17] with the TCDQ [41:18] and we've been working closely with [41:24] cost as much as we can to [41:27] make it as effective as we can and now [41:30] that we're done with the final design. [41:32] We've already done the bids and bids [41:34] came back ranging from $259,90 [41:39] to $647,950. [41:45] The engineer's opinion of probable [41:48] construction cost was approximately [41:51] $578,000. [41:54] The lowest bidder that came in had to [41:57] withdraw due to lack of electrical [42:00] certification requirements as was put in [42:03] the attachment that I attached to [42:05] report. So the next lowest bid was for [42:10] code in [42:12] it at $38,700 [42:17] which [42:19] bid it was $189,300 [42:23] below the [42:27] That's [42:30] » we're seeing that more and more council [42:32] right now that projects are coming in [42:34] slightly or significantly under OBCC. [42:39] I think with the way the construction [42:41] market has changed since 2020 numbers [42:44] are kind of all over the place and you [42:46] never know which trade is going to be [42:48] where. So we saw that a little bit. Um [42:51] some things on for sale. I think it was [42:53] a little bit under the OPCC as well. We [42:56] told the OPCC a little bit high and that [43:00] are a little bit lower than try and [43:01] figure it out after the fact. So this is [43:04] good news. I will say council Lazarine [43:07] asked me earlier today could we apply [43:09] those savings to another project and the [43:11] short answer is no. We were already [43:13] going to be using some fund balance for [43:15] some projects that were coming out of [43:16] the ACOS. It would just reduce the [43:18] amount of fund balance that we would [43:19] need to use to get these projects across [43:21] the finish line. So that was [46:30] all included in the scope. We did [46:31] receive again 10 subs for that. Staff [46:34] reviewed the subs and is recommending [46:36] that we move forward with Fitzpatrick's [46:38] architects for the project. As you all [46:40] know Fitzpatrick did the preliminary [46:42] planning for that. One of the biggest [46:44] factors that we were looking internally [46:46] was not only qualifications, experience [46:48] and how well they work together as a [46:50] team, but also we wanted someone in the [46:52] local area this time. We felt like that [46:54] would serve us better. [46:57] So again, [47:00] » I worked with them a ton of class [47:04] >> and they're the ones that found a way [47:06] for the fire station to go over there to [47:07] take what was going to be unused space [47:09] out of the middle of the the renovations [47:12] here.
