1 00:00:01,000 --> 00:00:01,367 Yeah. 2 00:00:01,367 --> 00:00:10,000 Like half a mile. Good evening. Welcome to the City Council meeting for Wednesday, August 26th, 2026. Councillor Ahern, would you want to leave this in the pledge, please? 3 00:00:10,000 --> 00:00:23,767 I pledge allegiance to the flag of the United States of America and to the Republic for which it stands. One nation under God, indivisible, with liberty and justice for all. 4 00:00:23,767 --> 00:00:27,701 Thank you. Miss Massaro, we have a moment. Get a roll call, please. 5 00:00:27,701 --> 00:00:28,601 Councillor O'Hearn. 6 00:00:28,601 --> 00:00:29,200 Present. 7 00:00:29,200 --> 00:00:41,467 Councillor Cogswell here. Councillor green. Yes. Assistant Marie Martel. Councillor Kosky. Present. Councillor Olmos. Councillor Hemingway. Here. Councillor. Irish here. Mayor Gerrard here. 8 00:00:41,467 --> 00:00:52,100 Thank you. Do we have any agenda changes for this evening? Seeing none. I'll move on to the report of the Secretary for the minutes of August 12th, 2026. 9 00:00:52,100 --> 00:00:54,100 Make a motion to accept as presented. 10 00:00:54,100 --> 00:01:05,300 Second. So motion by Councillor Hemingway, seconded by Councillor Green rose any further discussion. 11 00:01:05,300 --> 00:01:06,601 Everybody's looking at me funny, though. 12 00:01:06,601 --> 00:01:07,901 No, we're here in an echo over here. 13 00:01:07,901 --> 00:01:12,067 Okay. Um, I wasn't sure what was going on, so that's why I stopped. 14 00:01:12,067 --> 00:01:14,467 So now I'm hearing it. 15 00:01:14,467 --> 00:01:18,801 We'll be just a moment. 16 00:01:18,801 --> 00:01:20,868 Echo. 17 00:01:20,868 --> 00:01:28,400 Mark. 18 00:01:28,400 --> 00:01:34,901 Okay. 19 00:01:34,901 --> 00:01:35,267 Sorry. 20 00:01:35,267 --> 00:01:35,901 Whoa. 21 00:01:35,901 --> 00:01:37,100 That wasn't going. 22 00:01:37,100 --> 00:01:37,868 That wasn't an echo. 23 00:01:37,868 --> 00:01:41,868 That was just me. Like, not breaking figuring. Yeah. 24 00:01:41,868 --> 00:01:45,267 Yeah. It is. 25 00:01:45,267 --> 00:01:48,601 It's not city property. 26 00:01:48,601 --> 00:01:51,367 That drapes. Goodness, we can try. 27 00:01:51,367 --> 00:01:52,067 Is that better? 28 00:01:52,067 --> 00:01:52,701 Yeah. 29 00:01:52,701 --> 00:02:07,467 Okay. Thank you. Apologize for the short delay, so the motion was by Councillor Hemingway, second by Councillor Green, writes any further discussion on the minutes from the 12th seeing none. All those in favor say aye. 30 00:02:07,467 --> 00:02:08,167 Aye. 31 00:02:08,167 --> 00:03:03,000 Any opposed moving along? I'd like to start off with, um, some sad news. I guess is the best way. I'm going to start off with, uh, I'd like to announce that, uh, former assistant mayor, city councilor, Assistant Fire Chief Vic Bergeron passed away, I believe, a week ago. They'll be having services, uh, later in October. I think it was the 24th, if I remember correctly. I'm sure other things will be posted. I also want to note that Counselor Moses mom passed away this past Monday as well. And for anybody that's been around the community, all Arlene Merrill from passed away, which the mayor has been very involved with a lot of things. I'd like to have a moment of silence for the three of these, please. 32 00:03:03,000 --> 00:03:06,367 Thank you. 33 00:03:06,367 --> 00:03:28,167 Before I get on to my other announcements, I'd like to now move on to a proclamation that I'd like to have the folks from Microsoft join me here, if you don't mind. 34 00:03:28,167 --> 00:03:31,467 Thank you for joining us. 35 00:03:31,467 --> 00:03:34,267 Microsoft, where is Microsoft Technologies was founded in. 36 00:03:34,267 --> 00:05:13,868 1991, is celebrating 35 years of doing business in New Hampshire. Now, therefore, be it resolved, the City of Claremont Plains August 26th, 2026. As my first technology stated in witness whereof, I hereunto set my hand to cause the Great Seal the two new Claremont, New Hampshire to be a fix on this 26th day of August in the year 2026. Thank you very. 37 00:05:13,868 --> 00:05:30,501 Much. Thank you very much. 38 00:05:30,501 --> 00:06:32,767 Folks at home, they didn't speak at this point, but we have a nice presentation coming from them in a few short minutes. So that's why we kind of skipped by at this point. So um, so just wanted to make a few announcements of things that are coming up. Uh, first one, just a as a reminder for folks that are, uh, we have our primary for the state, county and federal elections on September 8th. Uh, the middle school and desert will be used, as it always has been on September 11th. Claremont Parks and Recreation will be hosting the September 11th Remembrance Memorial Stair Climb at 830, behind the visitor center. Anybody interested? Please reach out because I know it's the 25th anniversary as well this year. So. And the last thing is, the Claremont Kiwanis will be hosting their annual Brew Fest behind the Visitor Center on September 19th. Tickets are still available online for anybody who's interested in those. That's all I had for this evening, Mr. Bergeron. 39 00:06:32,767 --> 00:06:43,868 Thank you. Uh, first item I'd like to, uh, touch on is introduce you to the new library director, if I may. Uh. 40 00:06:43,868 --> 00:06:44,667 Yeah. 41 00:06:44,667 --> 00:06:54,567 We can. This is Jim Allen, the new library director. I just wanted to welcome them aboard and wish Council would do the same. 42 00:06:54,567 --> 00:06:57,467 Welcome. Welcome aboard. 43 00:06:57,467 --> 00:07:02,200 This seat. 44 00:07:02,200 --> 00:07:03,267 Thank you. 45 00:07:03,267 --> 00:07:20,467 I just want to stop by and say hi to the council and introduce myself and tell you how excited I am to start as the fifth Free Library Director. I've been living in town since 2003. I've been a library director for the past 19 years, and I'm just really thrilled I can serve in my own community now. 46 00:07:20,467 --> 00:07:21,367 So awesome. 47 00:07:21,367 --> 00:07:22,367 Thank you very much. 48 00:07:22,367 --> 00:07:30,667 Welcome. Thank you. Thank you. 49 00:07:30,667 --> 00:09:10,000 Next, I'd like to pass on some more good news. The staff is tentatively hired. A new finance director. Uh, the only remaining, uh, item of that is a background check and she will start on September 14th. Also, Planning and Zoning have hired a new deputy building inspector slash health officer, and he is also going through the final hiring processes. And he will also start on September 14th. Uh, we're close to bringing a new Parks and Rec director on board. Uh, at number one candidate, we offered the job to him. Uh, he molded over for a couple of days and, uh, declined our offer. Not for any shortcomings in the office offer or any reason having to do other than, uh, he had a, uh, a second job. He's a, uh, those professional, uh, speaking engagements around the country and the demands of the Parks and Rec director in Claremont, he felt he might not be able to meet, so he declined. We're making the offer to the number two candidate and hopefully next meeting I'll be able to advise you that we have a new Parks and Rec director on on board. Um. 50 00:09:10,000 --> 00:10:02,200 Also lastly, I guess is I had, uh, a note passed to me from, uh, came in to the treasurer's office, and it's really directed to the council as a whole. So I'd like to read it. And, uh, on behalf of everyone at the Claremont Soup Kitchen, we gratefully acknowledge your generous gift. We deeply appreciate the faith you have in the work that we do at the soup kitchen. This gift is a tangible investment which will enable us to continue providing meals to the less fortunate of our community. Thank you again for your continued interest and support. So I just wanted to pass that along because I think the message really is directed to the board. And that's all I have. Okay. 51 00:10:02,200 --> 00:10:10,267 Anybody have any questions? The manager before we move on. Excellent. 52 00:10:10,267 --> 00:10:47,501 Next I'd like to open Citizens Forum. At this time I'd like to open Citizens Forum. As a reminder, Citizens Forum is designed to allow you the opportunity to make Council aware of your concerns. Please state your name and ward number when you reach the podium. We ask you to address your concerns directly to the council. The council manager will not be responding to you during this time. You are limited to five minutes on any non-agenda item in the back of the room. Please write down your contact information as well as your concern on the clipboard to allow for any follow up. They'll ask someone from the correct department to respond to your concerns. Thank you. Anybody like to speak this evening during the citizens Forum? 53 00:10:47,501 --> 00:10:53,467 Mr.. 54 00:10:53,467 --> 00:11:39,000 Hello. My name is Eric Dean Ward two, and I am presenting myself here as the vice chair of the Tolls home that you appointed me to the board of trustees. And I have some process questions that I need clarification on. I understand you may not address them here, but I would like them to go on the record because since I was appointed to the board, it's never been clear to me. And there's definitely a fraction of the board members and the general public that attend our meetings. It's not clear who. Who do we answer to? Do we answer to the city council? Are are you are are basically. 55 00:11:39,000 --> 00:12:35,300 The authority above us. If we do something wrong or we need clarification, we have the councilman who's been there and shared a truth of information and guidance. But there seems to be a kind of accountability vacuum at the moment, and I'd like it clearly on the record. So when I go back to talk to other board members or residents or a public, are we an entity that you will just appoint us and approve our bylaws, or do we answer to you for our behavior and actions that we're taking that you've been entrusted us with? That's one question. Um, my next question would be, is there any circumstance that a single board member, or less than a quorum of a vote, is allowed to distribute financial funds that we're entrusted with? 56 00:12:35,300 --> 00:12:57,701 Is there any circumstance at all other than we've got. We've got a bookkeeper and the treasure who has to pay normal bills. But again, there seems to be a vacuum of information, of the boundaries of each role and how we're supposed to work as a team, not as individuals. 57 00:12:57,701 --> 00:13:22,167 Our bylaws point out that we can vote to remove someone from a position, but it doesn't. Clearly, if I read it correctly, it doesn't clearly say that we're able to remove some from the board completely. Do we have that authority? Do you have that authority? Who do we go to for the process, and what are the circumstances that it would be allowable? 58 00:13:22,167 --> 00:14:16,767 And last, I think, but not least, is we have two new members appointed to the board, and I don't have a good outline of how often we should Take a vote for appointing the chair of the vice chair, the treasurer, etc.. I don't really have a standard to go by, and it doesn't appear anyone in leadership has the background any longer. Since we've lost a very long standing member who has been exceptionally helpful through this process. So I have a packet of four kind of stapled together informational packs regarding some emails and some subjects that came up that I'd like to, you know, put into the record so the council can review them. And if anything needs to be followed up, I think it'd be appropriate at this time for the council to look into some of these matters. 59 00:14:16,767 --> 00:14:17,801 Thank you, Mr. Rouleau. 60 00:14:17,801 --> 00:14:26,000 Thank you. Thank you. 61 00:14:26,000 --> 00:14:31,167 Anybody else like to speak this evening during Citizen's Forum? 62 00:14:31,167 --> 00:14:43,367 Seeing nobody, I'd like to close the citizens forum and move on to new business. Miss Gavin, would you like to start off the next section for us, which is Mike Rose technology's presentation? 63 00:14:43,367 --> 00:15:58,667 Yes. I would like to introduce Drew Mattar, the CEO, and I'm going to read his bio. Drew is the CEO and president of Micro Technologies in Claremont, New Hampshire, where he has spent nearly a decade driving innovation in high performance liquid cooling for next generation computing and AI. Since joining the company in 2017, drew has set Micro Micro's technology strategic direction, including leading its acquisition by Jabil, a Florida based global manufacturing company. This milestone has enabled significant expansion of operations in Claremont over the last two years, and under Drew's leadership, the Micro Technologies team continues to grow through increased hiring of high integrity individuals with advanced manufacturing expertise and strategic collaborations with leading technology brands. The company and its employees solve complex problems for the industry by designing and manufacturing highly efficient, scalable thermal management solutions and enhanced data center performance, reliability and sustainability. Drew holds engineering degrees from Dartmouth College and Georgia Tech and leads with a people first mindset fostering a culture that prioritizes professional growth, strong benefits, and a genuine commitment to work life balance. And with that drew matter. 64 00:15:58,667 --> 00:16:03,367 Thank you. 65 00:16:03,367 --> 00:21:01,167 Thank you for having us. We appreciate the recognition. I actually found out too late in the day that it was Micro Technologies Day, so I don't know why I had to work today. Um, but we loved, um, loved the recognition. We did let our employees know. And they, they were delighted, I think more than just the, um, the recognition of the day and the fun that is, I think we have really. We've been in Claremont since the year 2000, so we're in our 26th year in town. And I'll tell you a little bit about our history, but we have, uh, we are increasingly wanting to contribute to the life of the town. And as you heard, we've we've been doing these high technology liquid cooling systems for 35 years, 25 of 26 of those in town. Um, but most recently, we've doubled the size of our company. And so we've been pleased to bring 50 new jobs, and we intend to bring more as we do this work. So I want to say thank you. And we intend to be here to not only provide jobs and new advanced manufacturing opportunities for the coming generation, but also to be a part of the town. And we have had good relationships with, um, Nancy Merrill in, uh, in the town previously and knew Nancy well. She was a welcome. welcome, welcome to us very much in the town. And, and we want to continue to, to build good relationships in the town and be a part of life here and, and provide for the welfare of our citizens. Uh, I want to very quickly introduce, uh, who we are and and why we're here. So, uh, if you want to understand who micros is, micros is we make liquid cooling systems for high powered, uh, let's say high powered hot systems. Things that get too hot for their own good. Uh, we are doing a lot in the computing world. Uh, as my my friend Councilor Cogswell well knows, uh, in his in his silicon days. Um, we back in the day when when micros was founded. You're in 1991. Your 286. You know, Tandy computer did not need liquid cooling. Uh, and but we were founded out of a project to do liquid cooling for the space station. So the founder, Javier Valenzuela, did his PhD at MIT, and he came up to work at Priory, which is in the Hanover, Lebanon area. It's sort of an invention house that does a lot of government work. And he was the principal engineer on a project that designed cooling systems using liquid for the space station and necessity being the mother of invention. There's not a lot of energy coming in to the space station, but you got to do a lot of cooling. And so, as he often does, they kind of develop the best, the best thing out there. And he realized that this technology was going to be needed in the future. So we launched in 1991 and we were in the Lebanon area for about nine years. In 2000, we built the first building, and still the only building that is in the Colonel Ashley Park on on River road. And that building was our only building until about 2014, when we then had to scale with a customer and bought the old Eagle Times building after they had after they had vacated it. So we now have two buildings on that road that are half a mile apart. That Colonel Ashley building is our as our R&D facility and the old Eagle Times building is now our manufacturing facility, and you'll be glad to know that we didn't. We didn't really change. We didn't have a lot of time to change a lot of the walls in the building. So when people say, where do you make your liquid cooling cold plates for these new data centers? We say in the press room, you know, in the journal and a journalist room. But a fun fact about why we're on Colonel Ashley Lane. So part of the technology was that we actually had to make micro nozzles, very, very small nozzles out of steel that would eject a coolant. And there was a proprietary machine that was made and designed to build that. And as he looked to relocate, the founder set up a seismograph around the upper valley because we had to not have very many ground tremors. If there was a ground tremor, we would make a bad set of tiny holes. So it turns out the as Clermont was doing its commercial development on on River road, that that just so you know for for the council would like the record to show that that has, you know, about one tenth the seismic activity of of other areas in the upper valley, in the Granite State. So, so that's actually why we're there. In addition to the economic incentives of the city at the time, we continue to develop as computing developed, we developed these cooling systems for more computers, sort of front end lasers, renewable energy, electric cars. We did a project for the Navy for an advanced destroyer, have always been very kind of cutting edge research technology. In about ten years ago, computing became so powerful that it needed more and more liquid cooling. So we actually. 66 00:21:01,167 --> 00:21:01,567 Uh. 67 00:21:01,567 --> 00:21:23,267 Developed this whole plate and this this cold plate ended up really causing us to scale and really making the company much more substantial. Um, this goes on to a server and cools, cools chips in a, in a server. And this is the reason we bought the old Eagle Times building. We had to make a whole bunch more of these things. We are now in. 68 00:21:23,267 --> 00:21:23,868 In a place. 69 00:21:23,868 --> 00:26:51,200 Of tremendous growth. About two years ago, we realized that the needs of hot things getting cool thermal management needs in the computing space were such that we needed to find a strategic partner. When Javier founded the company, he said, I think we're right now a solution that's looking for a problem someday. And then that problem, the problem has gotten here. So in the Wayne Gretzky analogy, you know, we skate to where the puck is going. Well, when you get to the puck, you've got to be able to hit it in the goal. And so we look for strategic partner, a strategic partner that could help us scale this best in class technology around the world. And that was Jabil. So we were acquired by Jabil. And that's allowed us to to scale now globally and then double our size and more this year and in the coming years. We want to show you our mission statement. It is our mission statement is, is not make the best liquid cooling systems in the world. And I want you to hear this as council members, Micro's technologies mission is to add value to our world, our community, our customers, and our employees through the design and manufacture of innovative products and processes that provide exceptional solutions to difficult and important technological problems. And then secondarily, in pursuit of this mission, we promote a safe, collegial and stable work environment where people can flourish and collaborate enthusiastically. It's purposefully very broad. It doesn't say anything about hot things getting cool because the founder's DNA was we might go build robots. Someday. We may make an electric vehicle, we may invent something new, but this is the kind of company we want to have. Our our core values are about innovation, thinking big, knowing your stuff, making it happen, fostering trust and owning the results. I spent a lot of time talking about fostering trust on our team, and I say trust affects the bottom line. If we have a team that trusts one another, we're going to be shipping better parts faster and more efficiently. And it's very true. I am proud to say, as people come on board and again, have doubled the size of the company in the past year or so, people come on board and they say they would say, I'm still looking for the mean person here. I haven't found them yet. And that's that's good. We are getting a lot of good first impressions of people who are moving to the area and working for us. So very thankful for that. Where liquid cooling makes an impact. So our liquid cooling systems, essentially it's a heat exchanger. It takes heat from a hot thing and puts it into liquid, and it takes it out to a place that you can get it outside. I will sometimes say that we're the we're the, we're the dump. We're the trash guys, you know, who take the waste heat and get it outside to the the thermal dump where which is sort of outside the building or outside the the facility that can be applied to lots of different markets, data centers and artificial intelligence. Obviously catching a lot of news headlines these days, but also laser and optics, electric vehicles, capital equipment, defense and aerospace, 5G, wireless, renewable energy. So our technology is is actually usable across many different markets, which gives us a lot of ability to expand and be, uh, to be a stable company in the area. I'm going to actually probably end with 1 or 2 slides here. There are more, but I'm going to cut it short for the sake of the council here. Just a little view of what we do here when we talk about micro channel liquid cooling. Uh, micro channels make it more efficient. I can explain to you the, the the technology behind that later if you'd like to know. But we can apply this to different kinds of computing chips, different kinds of network switches, semiconductor testing, power electronics, things like that. Just to make sure that you don't forget us. I did bring you all a t shirt. And this is not any sort of political bribe, I promise. Um, but I make our, you know, a much to her chagrin, I make and our marketing director put really nerdy puns on t shirts. So this says it's the little things and it's a nod to micro channels. Okay. And so I have one for each of you. Our solutions really allow on the right side there higher powers of these chips that are needed to do the computing that's powering our cars, empowering our phones. But also one of the biggest things that that I would say I'm proudest of is our technology allows for efficiency. So a lot of headlines, um, are talking about data centers and energy usage. We are being used in data centers, but we're making them more efficient so we can actually reduce the energy usage to that's needed for the same computing in these, these technology environments. Uh, Governor Kelly Ayotte was at Microsoft last week, and she was talking a lot about data centers. And we said, we're not worried about where the data center goes. In fact, we definitely want our energy bills not to go up. That would be a great thing. But where would they do? Go for the for the sake of sustainability of the planet. We want to make them more efficient. And that's what we're really excited to do as a technology company. So I'll leave it with that and say we're very thankful to be a part of Claremont. We're glad to be here. We do intend to grow here. Our goal is we scale around the world, is to continue to be a center of excellence in this town and continue to grow our engineering and advanced manufacturing prototyping capability, and then scale that technology around the world. If you ever have any questions. I have an open door on River road. Would be happy to to entertain any of you and give you a tour and answer any questions you might have. And again, thank you very much from all of us at Micros technologies. 70 00:26:51,200 --> 00:26:53,601 Thank you. Thank you. Thank you. 71 00:26:53,601 --> 00:26:58,667 And thank you, drew. And I just wanted to recognize Micros Technologies. 72 00:26:58,667 --> 00:27:10,367 They have been awarded the 2026 New Hampshire Business of the year, which is why we wanted them to come and share more of what they do. And we're grateful for your investment. Thank you very much. 73 00:27:10,367 --> 00:27:12,267 Thank you. 74 00:27:12,267 --> 00:27:21,000 Thank you, Miss Gavin, for bringing that forward to. 75 00:27:21,000 --> 00:27:33,467 Moving right along. Next up is resolution 2020 717, the AARP grant acceptance, which is scheduled for public hearing. Mr. LeBlanc. 76 00:27:33,467 --> 00:28:08,100 Good evening. Tonight I am asking the council to accept a $15,000 AARP Community Challenge grant for the the construction of a 16 by 24 foot wooden pavilion at Monadnock Park, located between the concession stand and the playground. Since the grant will not cover the full project costs, the Climate Conference Club has agreed to pledge the remaining funds needed to complete the project, resulting in no impact on the tax rate. I respectfully ask the council to approve the acceptance and expenditures for the $15,000 Great. 77 00:28:08,100 --> 00:28:15,167 Thank you. Questions for Mr. LeBlanc. If not, I believe we have a Councilor Irish. 78 00:28:15,167 --> 00:28:16,067 I'll read it if you want. 79 00:28:16,067 --> 00:28:17,467 Absolutely. 80 00:28:17,467 --> 00:29:19,901 I'm a card carrying member, after all. State of New Hampshire second. 81 00:29:19,901 --> 00:29:28,167 Okay, so the resolution was brought in by Councilor Irish, seconded by Councilor Andrew O'Hearne. Do we have any questions for Mr. LeBlanc? Councillor Ahern. 82 00:29:28,167 --> 00:29:28,267 I. 83 00:29:28,267 --> 00:29:32,868 Have a question. I should also disclose that in my AARP card holder. 84 00:29:32,868 --> 00:29:34,000 You guys have to vote on this. 85 00:29:34,000 --> 00:29:36,501 Did you excuse them? 86 00:29:36,501 --> 00:29:38,701 They got to recuse now. 87 00:29:38,701 --> 00:29:39,100 All of. 88 00:29:39,100 --> 00:29:48,167 Us. Okay, I'm I'm not a member. I can ask any question I want. Um. 89 00:29:48,167 --> 00:29:50,467 Now, what was my question? 90 00:29:50,467 --> 00:29:59,167 Are you not in it? Maybe I am, and I forgot, um, is this for the construction of the pavilion? 91 00:29:59,167 --> 00:30:07,501 Is this the sum total of the cost to put it all in, Or is is there going to be additional cost associated with getting it off the ground. 92 00:30:07,501 --> 00:30:25,601 So there will be additional costs, which is why I approach Kiwanis for the remaining funds. They have pledged the remaining funds. We don't know necessarily what the expected cost is. We just have a rough estimate. But they said they would meet that that fund. 93 00:30:25,601 --> 00:30:27,100 Perfect. Thank you. Thank you. 94 00:30:27,100 --> 00:30:49,100 Other questions. If not, I'd like to open up a public hearing for anybody who would like to speak on resolution 2020 717, the AARP grant acceptance. Would anybody like to speak on that this evening? Seeing nobody, I'd like to close the public hearing. Bring it back to council. One last chance for any further questions. Miss Pizarro, when you have a moment, get a roll call, please. 95 00:30:49,100 --> 00:30:50,367 Councilor O'Hearn. 96 00:30:50,367 --> 00:30:51,000 Yes. 97 00:30:51,000 --> 00:30:52,167 Councilor Cogswell. 98 00:30:52,167 --> 00:30:52,667 Yes. 99 00:30:52,667 --> 00:30:53,601 Councilor green rose. 100 00:30:53,601 --> 00:30:55,801 What? Yes. Yes. 101 00:30:55,801 --> 00:31:00,200 Councillor. Yes. Councilor Wayne Hemingway. Yes. Councillor. Irish. Yes. Mayor. Gerrard. 102 00:31:00,200 --> 00:31:01,000 Yes. 103 00:31:01,000 --> 00:31:01,567 Thank you. 104 00:31:01,567 --> 00:31:05,701 Thank you. Thanks. 105 00:31:05,701 --> 00:31:32,100 Our last item under new business. As everybody remembers about a month ago, we brought Mr. Bergeron in to help us out on an interim basis. And at the time, the goal was that he was going to be working approximately 30 hours a week. Um, since that time when we've met with Mr. Bergeron, I think we've been hearing you're averaging about 37 hours a week ish. 106 00:31:32,100 --> 00:31:36,300 At 37 to 40. It's. 107 00:31:36,300 --> 00:31:42,701 That's just how it's working out. I mean, initially I thought that, uh. 108 00:31:42,701 --> 00:32:29,767 You know, my primary goal is I. If you recall, I said I think someone should be in the office five days a week. And that is borne out to be true. And, uh, I thought it was going to be a simple straight 9 a.m. to 3 p.m., Which would equal the 30 hours, and that has been shown to be untrue. So in order to adequately assist department heads meet their schedules and address other issues that they come in from the public or other matters, it's just turns. It has turned into longer workdays than the longer total hours per week. 109 00:32:29,767 --> 00:33:14,868 So the reason why I asked, put this on the agenda this evening is when we first spoke with Mr. Bergeron, we basically asked him to keep track of his hours, and if we were going over that, we needed to also try to compensate him for the hours that he's putting in. So, um, again, I know when last week, when Mr. Bergeron spoke, he talked about the 37. So I'm assuming with this planning board meeting this week, he got to spend a few extra hours here that beyond that as well. So my suggestion is that we either move them up to the 37 hours or 40 hours, whatever the council recommendation is, just to cover his time that he is putting in, to try to make sure that we can continue to move things in a positive. 110 00:33:14,868 --> 00:33:16,467 Councilor agreed. 111 00:33:16,467 --> 00:33:21,868 I think at minimum 37 hours at this point is. 112 00:33:21,868 --> 00:33:23,467 Thank you councillor Ahern. 113 00:33:23,467 --> 00:33:29,367 I would agree. The only question I asked is that is this going to affect anything to do with your retirement? 114 00:33:29,367 --> 00:33:53,000 No, not at this point. That's the our initial discussion though, that uh, total our limitation is per calendar year and we're close to entering September. And this is only my fourth week. So even at 40 hours a week, I would not reach that that limit. 115 00:33:53,000 --> 00:33:54,868 I have no issue with it. 116 00:33:54,868 --> 00:33:56,667 Any other councillor. 117 00:33:56,667 --> 00:33:57,100 Granados. 118 00:33:57,100 --> 00:34:08,801 Thank you. First off, I'm fine with it, but I do have a question for police. How do you feel about it? Are you okay with the additional hours? I mean, it's fine for us. 119 00:34:08,801 --> 00:34:57,601 I mean, and another option would be to just allow me. I'm willing to fill out a time card and pass it to HR and manage it that way because it, you know, maybe 371 week, it could be 33 and whatever the council chooses. But as far as to answer your question, I'm trying to get the job done. I'm trying to keep things moving in most departments and be there in the event of the department. Heads need my assistance and that's what I'm attempting to do. And as I said at the outset, 30 hours is not going to cut it to fill all those needs. 120 00:34:57,601 --> 00:35:01,100 Thank you. Counselor Kowalski. 121 00:35:01,100 --> 00:35:36,868 I am fine with up to 40 hours I've seen in the short time that you're here. Like there's no stale time. Things are moving and progressing. Um, I also, you know, I personally don't feel that having you feel at a time card and turn that in every week is going to solve anything, or I don't have any issue with, you know, us compensating properly up to 40 hours. Uh, we trust you to oversee the city. I don't think you're going to take advantage of a few hours every week, so. 122 00:35:36,868 --> 00:35:37,801 Councillor Ahern. 123 00:35:37,801 --> 00:35:49,100 I agree with councilor McCloskey. I mean, at the end of the day, you know, you may put 40 hours or 28 hours this week and 421 week because of other things, and it balances out. 124 00:35:49,100 --> 00:35:52,167 I, I at this point I'm not seeing a 28. 125 00:35:52,167 --> 00:35:55,200 Hour time soon. 126 00:35:55,200 --> 00:36:03,300 Well, you know, you can do the four days a week like some of the other people are doing. 127 00:36:03,300 --> 00:36:19,467 Yeah, I don't I don't have a problem with it at all. I'm just wondering, do we need to put a hard ceiling on it at all or just I'm trying to figure out how to go with whatever it takes. That's what we got to do. But 40 is a good number. But he's got to go. You know, 45. I don't want him to not be able to. 128 00:36:19,467 --> 00:36:41,000 So I don't think it was us trying to limit the number as much as trying to, because when we gave them compensation, we talked about it being a 30 hour compensation. So I guess from what I'm hearing from everybody sitting here that you're good with going with a 40 hour compensation at the $60 an hour that we had set in his agreement, is everybody? Yeah, I can, counselor. 129 00:36:41,000 --> 00:36:55,567 Yeah, I'm good with I just I don't want to put any strings on it for him that says, okay, you know, I want him to be able to if he wants to do 45 by all means, or 42 I don't want them to get what I've got 40. I can't go because the council said no. It's more of that flexibility of whatever you need. 130 00:36:55,567 --> 00:37:09,267 And I wouldn't do that. And some of the weekly hours that I've stated have had I really being understated. But I'm not going to, you know, stop short if there's a, there's a task that I like to finish. 131 00:37:09,267 --> 00:37:10,868 Yeah. 132 00:37:10,868 --> 00:37:11,868 Councillor Kosky. 133 00:37:11,868 --> 00:37:13,467 Would you like to have an official motion? 134 00:37:13,467 --> 00:37:14,868 Why don't we just go that way? 135 00:37:14,868 --> 00:37:19,467 I would make a motion to compensate the city manager up to 40 hours a week. At $60 an hour. 136 00:37:19,467 --> 00:37:24,467 Are you okay with saying for 40 hours that way? Yes, we know that. What the number is going to be. 137 00:37:24,467 --> 00:37:25,267 Second. 138 00:37:25,267 --> 00:37:29,767 Okay. Councillor Hearn I think was a. 139 00:37:29,767 --> 00:37:30,300 Hundredth of. 140 00:37:30,300 --> 00:37:30,968 A second. 141 00:37:30,968 --> 00:37:38,501 Any further discussion? Seeing none. Miss Pizarro, when you have a moment, can we get a roll call, please? 142 00:37:38,501 --> 00:37:47,100 Councillor O'Hearn. Yes. Councillor Cogswell. Yes. Councillor green rose. Yes. Councillor. Yes. Councillor. Hemmingway. Yes. Councillor. Irish. Yes. Mayor. Gerrard. 143 00:37:47,100 --> 00:37:48,267 Yes. 144 00:37:48,267 --> 00:37:50,901 Thank you. Thank you for all you're doing. 145 00:37:50,901 --> 00:37:52,100 And thank. 146 00:37:52,100 --> 00:37:52,501 You. 147 00:37:52,501 --> 00:37:56,501 Yeah. We've now increased your hours for you so that we can have you. 148 00:37:56,501 --> 00:37:57,567 Thank you. 149 00:37:57,567 --> 00:38:01,000 So you don't have to leave this council meeting early. 150 00:38:01,000 --> 00:38:10,667 Um, moving right along this evening. Committee reports. Councillor Ahern, would you like to start off with the tolls home? 151 00:38:10,667 --> 00:38:11,567 Yes, I think I. 152 00:38:11,567 --> 00:38:12,000 Have his. 153 00:38:12,000 --> 00:38:14,100 Sign. 154 00:38:14,100 --> 00:41:34,601 Yeah. I don't have that here today. Um, so obviously, uh, um, the vice chair brought up some concerns during Citizens Forum prior to me, but so, um, the long story short of it, I'm going to try to. There's been some issues developing at the tolls home. Um, I've tried to address them at the meetings. I had mentioned, like, uh, a few meetings ago, that there were some issues that I thought would have after a discussion with them was resolved. But things are continuing to progress. Um, I have some bullet points basically as to what has happened. Um, so the first thing is that the chair called an emergency meeting. Uh, that did not meet the emergency requirements. Um, they were she was advised that it didn't at the meeting, but, um, chose to continue with the meeting. Um, the second thing was that, um, she had, uh, she violated the chair, violated the nonpublic information by disclosing that non-public in an email to a, um, somebody that was not involved in that, um, meeting. Uh, again, she was advised that it was a violation, I think a misdemeanor. Um, third, um, the chair is, uh, negotiated with a Person outside of the board without the board's approval to employ them at the Toles home, and again was advised that she can't do that because she didn't have the board's approval and authorization to negotiate. Um, those were the three that prior that we had just, I thought had been resolved since then. Um, just recently, the chair has authorized the expense of a $6,066 check to be issued, which was issued to a tenant without the board's approval. Uh, there was no discussion. Um, and it was, I believe, again, she was advised that it was not proper and that she needed the boy's approval to dispense that. Um also has recently taken it upon herself to change the employment status of a The board had approved for a person to be hired as a contract person, and then turned around and told the bookkeeper to hire her as a employee of the Tulsa home, which was not authorized by the board. Um, and then the most recent at the last meeting, uh, again, when these were all brought up, I did have a representation from the city. Uh, I'd asked the city manager, um, and he suggested to have the police chief acting as his representative attend that meeting. Um, which I appreciated. Um, at the end of that meeting, again, the representative had left. But, um, there was another discussion which caused. Um. 155 00:41:34,601 --> 00:43:24,167 The chair was trying to change the, um, um, job description of the site manager, uh, while he was the site manager and changes his qualifications. And I said, well, this is not proper. Um, and of course, that was a tabled. But again, it caused, uh, tension between the site manager and the chair. Um, obviously, I don't know what, uh, the vice chair from the Tulsa summit has presented to the, um, Julia. But I wanted to pass these on to the members that this was given to me. Um, yesterday, uh, after a meeting at the city manager's office with the mayor that I attended. Um, with the presence of the chair and one of the trustees. Um, my concern is, is that I have sat there since a transition from the previous chair to the new trustees. I am not exactly sure that this current chair is getting the understanding that they can't do this. As you'll read in some of this three page letter that I. One of the issues is that I keep saying no. And the reason I say no, you can't do that. Um, and I know that the vice chair had asked some questions which maybe the council can answer, but at the end of the day, um, I believe that there has to be some action because the comment from these, uh, the chair and other members that nothing's going to be done and they're just going to keep doing it. 156 00:43:24,167 --> 00:43:26,100 And I'll I guess I'll end with that. 157 00:43:26,100 --> 00:43:28,868 Mr. Bergeron, would you like to. 158 00:43:28,868 --> 00:43:43,300 Well, I'd like to just address one question. Uh, do you believe that there was any benefit to the meeting that we had yesterday addressing these issues. 159 00:43:43,300 --> 00:43:57,467 My opinion. Again, this is my opinion based on one of the comments was that was said towards the end. I don't believe things are going to change. 160 00:43:57,467 --> 00:44:04,100 Mr. Bergeron no, I mean, does the mayor feel. 161 00:44:04,100 --> 00:44:56,267 So just for clarification, that I was called to come over because the chair and the other board member had asked if I could meet with the manager with him yesterday and Councillor Ahern being the representative, joined into the meeting as well. Um, I'm hopeful that some changes are going to take place. I'm not convinced, but I think at this point, to be honest with you. Um, I'm hearing exactly what Councilor Hearn is saying. I think if we're going to address this, I think we should probably do it at our next regularly scheduled meeting and do it under our where we usually do the appointments to the board. So that way the person can arrive as well. 162 00:44:56,267 --> 00:44:58,667 Um, but, um. 163 00:44:58,667 --> 00:45:22,167 A lot of the questions that Mr. Rouleau did bring up, I think a lot of those we spoke about yesterday as well, because that those concerns were valid and, um, because, again, I don't want to get into each individual question, but I think we really need to address that probably at our next meeting under councilor. Sorry. 164 00:45:22,167 --> 00:45:23,767 No. 165 00:45:23,767 --> 00:46:36,968 I agree that we should be talking about it, but I think there's a for me, there's a bigger context. I think we should have that on the agenda to talk about it in the context of all of our boards and committees, because I think this is and I appreciate counsel for bringing this up. I think it's identifying a bigger issue that I know and have heard about, where many of these in boards and commission don't know how to how to run a meeting, how to do their responsibilities. And there's one line in here that jumped out at me, and I think this is a bigger issue, that we need to talk to anybody that's sitting on any board for us. I submit that the board does not need to know the finer points of parliamentary procedure in order to carry out it. Yes they do. That's the point to this exercise, is every board is supposed to run the same way, whether it's this board or the Parks and Rec. So I think having that on agenda to really go through, because the only part we have in this is appointing and it says in the first line, the management of the fiscal and prudent affairs of Francis, Oklahoma shall be vested in the board of seven trustees, which but we need to make sure. And that's why we have a council member, that they're following the proper procedures and not doing things they shouldn't do. So I think this is a good way not to pick on one board, but to lay it out for everybody that if you're going to get on all these boards, should be at that meeting to know what they're supposed to do. 166 00:46:36,968 --> 00:46:38,067 Thank you, Councillor Ahern. 167 00:46:38,067 --> 00:47:16,868 I would just bring up that and for this information, is that to keep in mind that the there was a transition from a board to the new board and the current chair was there and I have said the same thing with the old chair, and I said the same thing, the new chair. And the issue that I think is that even though I say it, it's now coming to the point. They don't, I don't care, I'll take whatever the consequences. Well, and then if there is no consequences, it's, it's, you know, that's why I'm bringing it to the council's level, that if there's something has to be done. 168 00:47:16,868 --> 00:47:20,367 Councillor Cogswell yeah, I think it. 169 00:47:20,367 --> 00:47:23,267 I think it would be worth. 170 00:47:23,267 --> 00:47:24,167 Understanding. 171 00:47:24,167 --> 00:47:24,968 Though. 172 00:47:24,968 --> 00:49:31,100 For all of the boards that operate. Again, some of the questions that were brought up during the public, um, during public comment are are really good questions, but they're basic questions that anyone on a board should be able to answer. And it's something that should be clearly stated. It doesn't seem to be consistent across all of our boards either, right. So, for example, the Toles Home Board's bylaws don't have anything in there about how you remove a member. But other boards do have something explicit there for how a member is removed. Um, and even that is somewhat different, it seems, between boards. So I think it would be worth. Um, number one, making that available to the public. And I think it's actually part of a larger discussion that I've had with some residents who have brought it up, which is they don't really feel like they know how to effectively navigate city government to get things done or put on the agenda or brought to the council's attention, and it, um. It's just something that's kind of a basic principle. I think that if we're going to be governing the public in any way, they should be able to bring stuff to us. That being said, though, I, I would love I don't know how to do this anonymous or I guess anonymously just through email or whatever, but I would love to hear from the other members of the Tolls Home board. I guess, what their what their thoughts are on the matter. Because at this point in time now, this is sort of a, you know, it's sort of a he said, she said thing. It doesn't seem like things are being done correctly. Um, and I think it's worth us. I mean, I think this is something, though, regardless of the overall discussion about boards and whatever, that we're going to have to figure out something to do here, because it doesn't seem that there's a good working relationship between the current chair and, um, and the council. I just don't. You know. That seems challenging. To then have a board operate in that way. 173 00:49:31,100 --> 00:49:32,367 Thank you. Councillor Hemingway. 174 00:49:32,367 --> 00:49:33,567 Thank you. 175 00:49:33,567 --> 00:49:35,868 Um. 176 00:49:35,868 --> 00:50:43,167 So the history of the tolls room, Holmes. And the reason why we now have a council on theirs. Because they're working autonomous autonomously, uh, on their own, without any supervision. And so then we brought them in, and we had the conversation. We did the bylaws place the councilor on there, too. So that's the reason why they're not used to the system and working with the city. And it is on us to be able to impose upon them the proper boundaries that they need to have regardless. But this is one that has been doing several infractions, and I don't believe all the other, uh, committees or commissions are doing these type of In fractions. Um, so for me, I say we bring them in, and in no way do we request anonymous information from any, uh, board member from there, because that would not be legal. So, uh, that's my opinion. 177 00:50:43,167 --> 00:51:35,567 Again, I'm going to go back to what I stated before. I think if we're going to discuss at least this situation that is being addressed, I think from what we heard from I, I definitely want to bring it up under our boards and commissions or our appointments at the next meeting. Um, just so that way it will be noticed so the person can come in at that point. And the other thing. Uh, I'm just going to go back to what Councilor Hemingway said a moment ago. Um, whether this was a city board or any other board, whether it was one of the nonprofits or anything else in the community. Folks can't work autonomously. They they they have a board for a reason. And so I don't think even if you look at it from that standpoint, they just the board needs to be the ones making decisions, not individuals. 178 00:51:35,567 --> 00:51:36,367 Councillor Irish. 179 00:51:36,367 --> 00:52:29,901 Thanks. I do agree with that. But I will say if we do, I don't have an issue with bringing, I have to say bringing them in. It sounds so formal, but what I don't want to see us do is I want us to address the issues of procedure, because that's where I think the I think Councilor Hemingway is right on it, is that people get on these boards and they're never taught how things run in the city, how to run a meeting, those issues I think we address. I don't think we go anywhere near getting into the personalities of this. There's no benefit to that. And there's no you know, we don't want to get into the public name calling. And he said, she said, and he's wrong. She's wrong. It's this issue because I agree with a lot of what Councilor Andrew O'Hearne had said. It's very clear cut. You can't do this. Check. Can't do that. Check. Can do that. Check. Move on. That's. That's my only concern. I don't have any interest in getting into the personalities of this, just the procedures on how to do it properly. 180 00:52:29,901 --> 00:52:48,601 And I think the reason why I was bringing it up was I think Councillor Ahern was talking about needing to do something with this one individual, which if you're going to do it, you should notice that the person should show up. So if we're going to question which again, we've taken people off board before, so we should be noting it. 181 00:52:48,601 --> 00:52:50,501 Quick follow up to that. 182 00:52:50,501 --> 00:52:55,100 Hold on Councilor Nicholas Koloski first. Now come back across. Councillor. 183 00:52:55,100 --> 00:54:18,267 I just wanted to say at this point I would entrust between the the mayor and the manager to come back with detailed information. Besides what we've been handed this evening. Um, there are a lot of comments being made that reflect someone's character, and there are ways that you deal with that. I don't believe calling somebody in a duly notice public hearing to sit and have us have a back and forth, or explain things where somebody is going to be explaining their side without us having facts in totality. I'm to understand the police chief was there as the manager's representative. It would be nice if, if you gentlemen could get together and see what actually has shaken out of that, so we can have information to take proper action. Because before I sit and accuse somebody of something. Um, I would like actual facts besides a bunch of emails that were sent to us or even to us this evening. My concern, um, in how board operates, even us voting to remove somebody or rescind that, some actions have already happened. Um, those are the Department of the state that handles that with boards. So, um, I think there are some other steps that don't involve Us just having a back and forth in Council chambers. 184 00:54:18,267 --> 00:54:19,100 Councilor Irish? 185 00:54:19,100 --> 00:55:17,667 Yeah. To that point, I don't think we have any reason or right to even consider removing anybody from a board that we've never given direction on how to run that board. That's my point to this. I mean, to me, once we say this is how you run a meeting, this is how you run a board. If it happens again, then we have a conversation. But at this second in time, we've all just said it's it's it's not clear. They may not know what and what's going on. One councillor in fairness saying it's wrong is not wrong. If we'd all had a meeting and talked about it, sure, but we can't bring anybody in front of us now to say you've broken these rules, we're removing you. Well? What rules? We've never had this conversation. You've got to have a conversation and set the. You've got to set the rules first. And then if they get broken, then you have grounds. But at this point, I don't believe for one second we have the grounds to remove anybody until we have a better conversation of what the what the expectation is. You can't you can't remove somebody for not living up to your expectations if you don't tell them what the expectation is. 186 00:55:17,667 --> 00:55:19,501 No thank you. 187 00:55:19,501 --> 00:55:20,501 Councillor green asks. 188 00:55:20,501 --> 00:55:20,968 I don't think. 189 00:55:20,968 --> 00:55:21,100 You. 190 00:55:21,100 --> 00:55:23,667 Have a chance yet. Thank you. 191 00:55:23,667 --> 00:56:36,167 Yeah, just I'm hearing two separate issues here. One is the specifics of this situation right now, and the second is the more general issue of lack of consistency and knowledge and education and training, which maybe for the second point, Council, Irish, Irish might bring it up as a future agenda item. And then we can formally address that one with respect to the specific issue, as I recall. And memory is imperfect. I think one of the reasons we assigned an ex-officio in this case, Councillor Ahern, was to provide guidance to that board because they had run independently for a very long time. I remember a lot of questions about how that even the relationship, the dynamic between the Toles house and the city. Um, and part of that. So I think there was there is there was an intent to provide that guidance. I'm not saying that's sufficient, but I don't think they're operating in a vacuum with with Councilor Hearn there. So I think there needs that situation needs to be brought to us with the correct information as Councilor Nicholas Koloski. 192 00:56:36,167 --> 00:56:37,167 As. 193 00:56:37,167 --> 00:56:48,400 Has proposed. And we'd addressed that specific situation in the committee's session and then address the the larger picture through a future agenda item. 194 00:56:48,400 --> 00:56:50,767 Thank you. Councilor Cogswell. 195 00:56:50,767 --> 00:58:57,267 Um, yeah, that was really the point of what I was trying to say there. Um, you know, obviously I was not, um, saying that we should do something illegal. Um, and I somewhat, uh, take offense to the implication, but, um, Rather that. And I don't believe this is illegal yet. We can gather information, right? I think we're allowed to do that. Um, that was the idea here, right? Was this is a this is, you know, an email like this is is valueless for information, right? It's showing that the relationship is broken down. But that's not what I care about. We're not here to judge people like, uh, you know, we're a click or something, right? We're here to judge whether or not if the action was illegal, um, or improper and what to do about it afterwards. The whole point of having a board is to try to get out of some of this more political kind of shenanigans sort of stuff where I don't like this person, they don't like me. Who cares what's what's legal, what's right. And I think that, um, part of the idea of, of having that information gathering come in would be to allow people to speak freely and openly about their real thoughts on the matter. To get out of some of that stuff. Because again, if, uh, a quorum of voters on the board doesn't vote to remove this person, now you have someone in power who knows they're very unpopular with some of the members. How does the board operate, then? Right. That's why we have to have some of this structure put in place. That being said, it does appear to me that some of this seems fairly, um, fairly clear cut. Um, so I do think it's worth, again, having that training, you know, having a training session and things like that. But I also think this seems to be an issue that has to be resolved because I don't think, um, a member of the board or I don't think counselor O'Hearn would have brought this to us unless it was serious. 196 00:58:57,267 --> 00:58:58,267 Thank you. 197 00:58:58,267 --> 00:59:00,601 Councilor Kozlovsky. 198 00:59:00,601 --> 01:00:24,300 So when the issue first came to light and we made adjustments and put a counselor on the board itself. I had asked at that point if I could have the proper training given to them from legal, and I think because we've had management changes. I'm not certain that occurred. I'm not going to say that even providing that training is going to address the issues or stop them with members, I don't know, but I would like to at least ensure that they have the option of that training. Every boarding committee was supposed to have the training, and I also think that that fell through the cracks. The council had the training when everyone took office again. I've been through it many, many times, but I've never had that at the planning board level. And I am certain that I have caught things with several other committees that when I watch the meetings at home, I'm cringing. So I do believe that they should be yearly, but I certainly want to make sure that the tools home has the training. And I believe New Hampshire Municipal also offers that service. Um, so that would be my request. That needs to be a future agenda item. So be it. But. 199 01:00:24,300 --> 01:00:25,267 Councilor Hemmingway? 200 01:00:25,267 --> 01:00:25,868 Yes. Thank you. 201 01:00:25,868 --> 01:00:26,467 Sorry. 202 01:00:26,467 --> 01:01:01,400 Um, yeah. I'm not I'm not disputing the fact that they need the training, and I. You know, I would probably be forward enough to say that. Let's do the training. And if things don't change, then, then we need to take a look at what needs to go happen. Then I think, um, having a discussion and back and forth who said what? Whatever. I think that's beyond right. Now give them the training and then put them on a probationary period and say, you have this much time to fix your problems, and then we'll have to look at it from there. 203 01:01:01,400 --> 01:01:05,100 Thank you. Thank you, Councillor Ahern. 204 01:01:05,100 --> 01:01:25,000 Hopefully I'll be the last one to speak. Um, I'm just going to say that, uh, I understand everybody's view. Um, everything I've mentioned is documented somewhere. I also want you to understand that there has been a period of time in which the chair has. 205 01:01:25,000 --> 01:01:25,667 Uh. 206 01:01:25,667 --> 01:01:50,300 Not included me in email trends or email correspondence to keep me apprised about things. So I would if we're going to do what the council philosophy suggests, I would hope that I am also involved so that I can help the city manager and the mayor, um, obtaining the proper documentation. 207 01:01:50,300 --> 01:01:52,067 Thank you. 208 01:01:52,067 --> 01:01:52,601 Moving right. 209 01:01:52,601 --> 01:01:53,167 Along. 210 01:01:53,167 --> 01:01:56,667 Councillor green, or do you want to talk about historic and energy? 211 01:01:56,667 --> 01:01:59,501 Historic is tomorrow. Okay. 212 01:01:59,501 --> 01:02:01,467 Energy met today. 213 01:02:01,467 --> 01:02:30,968 Yeah, I will unfortunately miss it because there's a Sullivan County Conservation Commission agroforestry event, but they have a quorum. Um, energy met last week. We had another vendor speak to us about community power. We're in the process. We've completed our due diligence. We are working on our report, and we hope you hopefully bringing that forward to the City council, uh, within the next month or two. 214 01:02:30,968 --> 01:02:42,167 Thank you. Councillor Cogswell, I apologize. Hey. Aren't you. You're good. How about conservation, EPA and CCTV? Uh, EPA tomorrow? Baltimore. Um, EPA. 215 01:02:42,167 --> 01:02:44,367 Uh, we haven't met since the last one. 216 01:02:44,367 --> 01:02:46,067 Um, CCTV and conservation. 217 01:02:46,067 --> 01:02:49,167 Unfortunately, I missed last week because I was at, uh, day job. 218 01:02:49,167 --> 01:02:50,567 So. 219 01:02:50,567 --> 01:02:51,567 Uh, unfortunate. 220 01:02:51,567 --> 01:02:52,067 Job. 221 01:02:52,067 --> 01:02:52,667 I know. 222 01:02:52,667 --> 01:02:53,868 It's a fair day job. 223 01:02:53,868 --> 01:03:00,167 With the, uh. Yeah, so I missed those ones, unfortunately. But, um, the meeting minutes are very well taken so. 224 01:03:00,167 --> 01:03:00,267 It. 225 01:03:00,267 --> 01:03:02,000 Will be available online. 226 01:03:02,000 --> 01:03:05,968 Thank you. Councillor Kozlovsky. 227 01:03:05,968 --> 01:03:07,667 Arts or planning. 228 01:03:07,667 --> 01:03:08,267 Board? 229 01:03:08,267 --> 01:03:21,567 So planning board. I had a conflict of interest with both applicants that evening. I did watch the meeting remotely from home. Um, but the city manager is also a member, so I don't know if he wants to give an update on what occurred at the planning board meeting. 230 01:03:21,567 --> 01:03:24,501 You had two good projects that were brought forward. 231 01:03:24,501 --> 01:03:28,901 Yeah, there were a couple of processes. I don't have my notes with me, so I'll do the best I can. 232 01:03:28,901 --> 01:03:29,767 Director Gavin, did you. 233 01:03:29,767 --> 01:03:37,100 Want to fill in? What a box. Getting passed away from here. No, no, it just so people at. 234 01:03:37,100 --> 01:03:37,868 Home can hear you. 235 01:03:37,868 --> 01:03:41,100 So. 236 01:03:41,100 --> 01:03:42,901 We did have two good projects. 237 01:03:42,901 --> 01:04:05,100 There's a project on Washington Street, a coffee shop, and then we have 21 Water Street, which is an adaptive use, uh, above common man. Uh, Wayne Shaw and research. And so there are going to be the third floor is going to be office space, and then there is going to be 27 units on floors four, five and six. 238 01:04:05,100 --> 01:04:06,167 Thank you. Yes. 239 01:04:06,167 --> 01:04:07,667 Appreciate it. 240 01:04:07,667 --> 01:04:09,100 I'll go back to arts though. 241 01:04:09,100 --> 01:04:54,767 Uh, Arts is actually next Tuesday. I will not be able to attend. I'll be on an airplane at the same exact time. I will tell you that. Uh, just an update. Um, there was communication that was sent out to board members, uh, at or giving an update. The the contractor that would be awarded the job of restoring the Eagle. Uh, will be needing to move up the timeline. So there was going to be the potential ask of the council to front load funds. I don't believe that that would be proper. I will address that, you know, through the, the the board itself in the meeting. But, um, so there may be a potential ask coming forward. Um, but I will follow up after the eighth and ask for detailed notes. 242 01:04:54,767 --> 01:04:56,100 Sounds good. 243 01:04:56,100 --> 01:05:05,567 Um. I know Councilor Moss is not here this evening. The CDA has not met since the last update he had given. So, Councilor Hemingway. 244 01:05:05,567 --> 01:05:09,000 I have nothing new to update since the meet next. 245 01:05:09,000 --> 01:05:10,000 Week. 246 01:05:10,000 --> 01:05:12,000 High the week after counselor Irish. 247 01:05:12,000 --> 01:05:17,801 I don't have anything unless the city manager on the procurement. I don't think any. There's no movement on the software or anything that I've heard of. 248 01:05:17,801 --> 01:05:21,567 I haven't heard any follow up after the last meeting. 249 01:05:21,567 --> 01:05:22,767 Thank you. 250 01:05:22,767 --> 01:05:28,367 And airport. We meet only quarterly, so nothing new there. 251 01:05:28,367 --> 01:05:31,300 Okay, moving right along. 252 01:05:31,300 --> 01:05:36,000 Future agenda items and directives. 253 01:05:36,000 --> 01:05:37,567 Counselor. 254 01:05:37,567 --> 01:05:38,400 Nobody else. 255 01:05:38,400 --> 01:05:38,767 Oh, yeah. 256 01:05:38,767 --> 01:07:37,968 I don't got a couple. Okay, um, I had a couple of questions. Just follow ups. And I had a lot of communication from people in the community this week. Uh, one of them was, um, again, this is a reoccurring issue, but it's the flag light, the flagpole not being illuminated in the park. I have a veteran that calls pretty regularly when it is not. I believe we had traced it out at one point, with parks to be a breaker that keeps being turned off, and I'm not sure if we can just resolve that once and for all, but it's been like six years of the same thing off and on. So. Or maybe there's a better solution of a solar light or something, but I understand the very passionate ask with this individual. And so I again wanted to bring it forward. Um, another question I had was, uh, when you do remote in here or call, it's very difficult to hear still. And my understanding is we do own an Owl device that was supposed to be installed in council chambers. So then when we do remote in, you can actually hear and see what's going on. So I just don't know the status of that or when it might be installed. Um, I had a resident ask the question, and they're resident of the Borden Center. There's a sidewalk that is on, um, headed out Maple Ave, right by Drapers Corners that has been opened up and it is sure park material. And I went by to look today. It's like 8 to 12 traffic cones blocking the sidewalk itself. So there is no travel pass still. And it's it's been over a month. Um, so I was asked when that might be corrected because in order, you'd actually have to double back, go out into the road, use the travel lane to continue to go home. So. 257 01:07:37,968 --> 01:07:39,467 Exactly where is this? 258 01:07:39,467 --> 01:07:42,467 Uh, it is right past where? 259 01:07:42,467 --> 01:07:42,868 Uh. 260 01:07:42,868 --> 01:07:47,567 It's on pleasant, pleasant street. Pleasant street? Yeah, at that corner. 261 01:07:47,567 --> 01:07:48,801 West. Pleasant. 262 01:07:48,801 --> 01:07:49,667 Pleasant. 263 01:07:49,667 --> 01:07:51,100 Uh, no. West Pleasant. You weren't. 264 01:07:51,100 --> 01:07:51,968 Correct. Okay. 265 01:07:51,968 --> 01:07:55,167 Right after the former Aslan's maintenance building. 266 01:07:55,167 --> 01:07:59,968 Right there. Okay. 267 01:07:59,968 --> 01:09:08,501 I had a question as far as if it can be a future agenda item, but a downtown conversation. Um, I wanted to bring up dinner conversation. Yes. Whatever we're going to call it currently. Yes, but just an update. There's been a lot of questions and feedback. I went and visited businesses and had a walk around. Um, but there's a list of items, and I don't know how to address people's concerns in an ongoing manner. Um, because it's the same topics we've talked about for a very long period of time. And, and one of which I would like to discuss when that is an agenda item, if we can get a list of what is available for TIF district funds. Um, because this is an approach I want to look at as far as funding a police position and or a parking enforcement person that just is in the TIF district, to be at a set of eyes that curbs behavior that we're experiencing and just see what that option would look like. 268 01:09:08,501 --> 01:09:21,367 And then, uh, I don't think that we ever got any real answer on as far as where citizens report traffic pole lights. 269 01:09:21,367 --> 01:09:21,567 The. 270 01:09:21,567 --> 01:10:03,667 City pole lights, there are several that are still on. There's one by the old Laval's on the backside of Fitch Manor that are still on. Someone brought that to my attention. Um, and it turns into. It's still confusing and I'm not sure where we left off, but I did want to ask that on the new website. When we do get to that, if there could be a little icon where somebody could click and report either. An outage. Outage of a traffic light because not traffic light. Light pole light because we own those. Um, but there are some that stay on. So the solar cell is gone. So we're just paying the light bill for being on 24 over seven. Uh, that's all I have. Oh, sorry. 271 01:10:03,667 --> 01:10:05,100 One more. 272 01:10:05,100 --> 01:10:52,667 The sculpture. If if you're not aware of the sculpture, um, behind the visitor center was damaged. Uh, I'm not certain at this point. If we have a plan for replacing the lights that were broken. I do know that I was going to reach out because there was an offer prior from a business to to donate lights. Um, so I was still planning on doing that, but, um, I don't know what our status of is of cameras that we're facing, that or how we stop the activity. I do know that a citizen that lives in that area says that routinely people are climbing up on it now, and they're also believed to be the ones that cause the damage and broke the lights. So thank you. 273 01:10:52,667 --> 01:10:54,567 That's it. Okay. 274 01:10:54,567 --> 01:10:55,868 Counselor. 275 01:10:55,868 --> 01:11:31,167 A couple of things that came to mind, but some are pretty easy just on the flags. I don't know if everybody's aware about Dolly Parton passed away and that the flags have been lowered to half mast until September. First, I just want to make sure that the city is gets. I didn't see them down today, but I hope that that happens. Um, I also would like to hear any more feedback, because I saw some people working on in the bullpen area. I think it was the last week or two weeks ago around the lights, where I don't know if they were working on the. 276 01:11:31,167 --> 01:11:31,968 Were they working on the. 277 01:11:31,968 --> 01:11:32,767 Fountain? 278 01:11:32,767 --> 01:12:20,868 No, this was by in front of the, um, coffee shop area that they were actually in front of the lights that we said had been out for a while. And I just want to know if there's any feedback on any update on that, um, that you can come back to us. Um, and then the last one is again Pleasant Street. Um, I don't know if anybody's know this, but I saw there was a, um, what do you call a card counter put up? Yes. Just before the thing where that box is sitting. It looks like either I don't know if this is what happened, but it kind of looked to me that they tried to put it into the granite, and it broke the granite, because now there's are two slabs of granite sitting by the the reader. That used to be. 279 01:12:20,868 --> 01:12:21,767 Exactly where it. 280 01:12:21,767 --> 01:12:52,100 Is. Um, right by the alleyway just before the alleyway. Uh, as you're coming down Pleasant Street. Right. The card reader is there, and you can see it with the silver boxes underneath or to the side of it. It's broken. Um, whatever. The granite. And I also saw today that there was some more granite. Um, back towards this. The, uh, square on the opposite side is buckling. So I don't know if this is an issue that we should address before winter. 281 01:12:52,100 --> 01:12:57,567 Other than the, uh, the force that's growing on Pleasant Street. 282 01:12:57,567 --> 01:12:59,000 Thank you. Councillor Irish. 283 01:12:59,000 --> 01:13:02,100 I just want to make sure council is good. 284 01:13:02,100 --> 01:13:04,167 How many are we? Good. 285 01:13:04,167 --> 01:17:48,701 Um. Well, first, honestly, I think under this agenda item, I. I'm serious about this. I think we do need to rename it. Future agenda items slash directives. Because most of what we do right now is really not going to ever end up an agenda. It's more directives of things, which is fine. I just think it'd be a better name and what I'd really like to see if we could start. And I think I'd be more than willing to help council because he he's probably got a master list somewhere, but I would love to see a master list of all of these things. This was done in previous councils where we we have. Yeah. That's yours from tonight. We have We have. You know, you have a master list of all of these things that is in the council packet. So we don't have to keep reiterating five years ago, because it's happening a lot more than I'm seeing. And there's no way this is for the for the temporary city manager as well as the new city manager. And for us that every packet we get, we could have. Here's the ongoing list of things we've asked for. So we don't have to keep asking. And and we'll have a better clue of what's going on, because I'm pretty sure the list is getting quite lengthy and a lot of it's duplicates. So I'd like to see us talk about maybe just putting that into the packet. I'd be happy to to work with Council to just make the best list we can, because I know he's got something of an honor in a long time. And in fairness, some of them are pretty serious, and I'd say about 80% of the things we talk about right now are everything to do with the first thing people see when they drive into our city, and it's not good. So along those lines, the I want to get back to Pleasant Street as well. Appearance enforcement I want was curious to find out if anybody has reached out to the Garden Club since they sent us that email that I know there's funds available to me if we can just get the appearances cleaned up. Should be pretty easy. Give them some money, plant some flowers, and then we figure out what the long term maintenance is. But the ultimate responsibility of downtown is. That's on the city. We paid for that. So if we if we reached out, that's great. Along those lines and talking to the business owners downtown, I really want to find a way through planning and zoning to start researching some of the landlords that we've allowed in there, because I'm fairly certain, based on what I'm hearing from the tenants and the businesses, they did not live up to their end of the bargain, and they have put apartments in those buildings that they were not supposed to put in those buildings. And there are people in there that are not supposed to be there. And it's part of our issues in downtown. I think we've got to really start looking at the root of some of these problems. And from what I've heard, landlord negligence is if not malfeasance is a big part of the problem, so I would love to see us start really looking into that. Um, because, you know, and same goes with Broad Street Park right now. We've got people coming into town and it looks like we've got homeless shelters everywhere, and it's just not right. And it's not what we're all about, and it's not what we should be seeing. We've got to find ways to to deal with some of this stuff. You know, I'm watching I'm driving down Pleasant Street and seeing people sleeping in the alleys in the middle of the day. That's an enforcement issue. There's no way around it, but it's not as simple solution. But, you know, in contacting other communities like Manchester that have figured out ways to do it would be good to start having those conversations on how do they fix their problems. And I've had people that live down by the Mulberry Street area. There's another entire village going on down there and needles. It's not good and it shouldn't exist. So that's I wish the chief was here, but that to me is we've got to get some enforcement going. Um, along those lines too. I know it's not a Winter Street issue, but it's definitely a big issue. On Winter Street, we have got cars flying up in that winter street, and it's not the speed, it's the mufflers that I know beyond a shadow of a doubt or violating every ordinance on the planet. And I followed one down to the intersection the other day, and you could hear that thing all the way across town, and we've talked about it, but nobody seems to be doing I haven't seen anybody down there yet. And that and they're flying down that road. Somebody is going to get killed. And, um, and then I think Councilor Hemmingway brought this up to the e-bike issue and the e-scooters on the sidewalks and in the roads. It's all good until somebody else gets killed. So I think, I think those are things we need. And then finally, absolutely, this is an agenda item we need to have talk about boards and committees, training and at least training for the chairs. I don't think it's realistic that every person who sits on the board is going to be able to go to training, but I do know every boy that I've gone on since I when I last got off the council. Most people that get on those boards, they don't. They've never done this. We've all done this for a while. We know how the thing works. We know Roberts. We know enough. They've never done this. They're just citizens trying to help. So I think at least getting the board chairs that they have to go through training before they can get going on the board, I think that'll be huge. But that one I'd like to see sooner than later. 286 01:17:48,701 --> 01:17:52,801 Thank you. Councillor Cornwall. Uh. 287 01:17:52,801 --> 01:19:47,868 Yeah. Um, similar. Similar to what Councillor Irish was saying. Um, I would love to see. Besides just that, just like before we get a new city manager come in. I would love us to tighten up a little bit. Some of the clear. A lot of the stuff we're talking about when it comes to, you know, these future agenda items, these are things that we have just kind of kicked down the road historically because we don't, you know, we haven't gone through the process of writing an ordinance or trying to find a rule for this or setting structure in place and the problem without with having no structure like that, especially with a government or any group of people doing anything. That's what leads to problems is what leads to lawsuits, what leads. It's what leads to challenges and issues. And so, um, I'd really like us to take a look at some of that and figure out precisely and with legal help, potentially, how does the charter now operate? Where are some of the places that we are missing rules or regulation or just structure that would be helpful for us, right. Um, you know, for example, like the muffler thing that you were talking about, right. Um, half the people you ask in the city today would tell you, well, we have a noise ordinance, but it's so crazy that it does. It's not applicable anyways. Why do we why do we have one? Right? Just let there not be one. Um, you know, stuff like that, right? So I think it would be very useful for us to have more counsel with our legal team to figure out what are the blind spots that we're maybe missing. Um, Again to protect taxpayers, right? Nobody wants to have more structure in place, necessarily. It's not always fun, but it's protecting taxpayers. Um, that's the idea here. So I would love us to just, I don't know, think about that. What can we tighten up before the new city manager starts so that we don't have problems in the future? 288 01:19:47,868 --> 01:19:54,767 Anybody else? 289 01:19:54,767 --> 01:19:58,467 Being good? I see that. 290 01:19:58,467 --> 01:19:59,167 Okay, so. 291 01:19:59,167 --> 01:19:59,667 We have no. 292 01:19:59,667 --> 01:20:00,901 Consultation with legal counsel. 293 01:20:00,901 --> 01:20:01,367 Motion to. 294 01:20:01,367 --> 01:20:02,567 Adjourn second. 295 01:20:02,567 --> 01:20:03,367 So motion by. 296 01:20:03,367 --> 01:20:11,901 Councillor Hearn and seconded by Councillor Green Rose. All those in favor say aye. Aye, aye. Those opposed? Thank you. 297 01:20:11,901 --> 01:20:17,868 Oh. 298 01:20:17,868 --> 01:20:20,667 I want to go back with with you guys. 299 01:20:20,667 --> 01:20:22,467 Yeah, that'd be great. 300 01:20:22,467 --> 01:20:24,567 Just on the way I go if you want to go. 301 01:20:24,567 --> 01:20:24,567 Yeah? Yeah. Great.
