[0:09] the meeting to order we have uh it's [0:12] February 13th 4 [0:15] pm agaw committee for the [0:19] bza um members present is commissioner [0:22] Dennis hunt commissioner Joseph Hodge [0:25] and myself commissioner Laura [0:27] Nettles um [0:30] have y'all uh had a chance to look make [0:32] a motion to approve the agenda okay now [0:38] second first and second all those in [0:40] favor I I I um any public [0:45] comments no public comments at this [0:49] time okay um to approve and modify [0:54] previous minutes the previous minutes [0:55] have y'all had a chance to look at [0:58] that [1:01] so these are what you submitted right [1:04] okay [1:06] yes okay on January 26th I submitted [1:24] these okay I'll make a motion that we [1:27] accept those second to approve the [1:30] minuts all those in favor I [1:35] approved now on to business um in our [1:39] last meeting uh we all agreed to um [1:44] request the last 15 years from the [1:47] January [1:49] bza [1:51] meetings and we have those here current [1:54] correction we ask [1:56] for full legislative body there you go [2:00] that's not the bza not the bza meeting [2:02] the full legislative body meeting for J each January right correct for the [2:07] last 15 years and uh commissioner hunt [2:11] put in that request and we have those [2:13] here and we're going to be taking a look [2:15] at those this evening [2:18] to [2:28] review all right the these are the [2:31] minutes provided by the [2:34] clerk is that right yes that's right [2:39] okay and [2:42] my intent for requesting these the [2:46] motion that I made to request is is [2:49] committee assignments nominations and uh [2:53] approvals for committees are [2:56] made in January uh right especially the [3:03] subject committee the board of zoning [3:06] appeals so I felt like if we go back [3:10] through the last at least last 15 years [3:14] we may find we have to dig deeper to be [3:17] honest with you but right now maybe [3:19] we'll find what happened that uh [3:23] precipitated [3:24] this [3:26] uh [3:27] erroneous member [3:30] term exploration that we're faced with [3:32] right now because we got three [3:35] members [3:37] who own by record say that their term [3:40] expired this year so okay anyway I think [3:45] if we take these one month at a [3:48] time uh looks like the oldest one we [3:53] ought to start with the newest one and [3:55] go backwards is my [3:57] opinion so you think we are not start [4:00] 2009 or go back to the very we need to [4:03] start with the newest okay and go [4:06] backwards is my opinion I think we'll [4:10] find the [4:13] discrepancy a long way hopefully [4:23] okay [4:25] and when we when we are reviewing these [4:30] mhm if you notice uh I think I'm looking [4:35] in my foldo to see if I have that [4:38] committee list yeah I've got mine [4:41] committee list I got it right here too [4:44] uh we don't have the January 24 minutes [4:47] those probably weren't necessary not [4:50] necessary because the bza was not dealt [4:52] with in Jan January [4:55] 24th I got [4:58] you all right [5:00] I want I want to take a second okay to [5:04] the the board of zoning [5:07] appeals right now the members are [5:11] myself commissioner Dennis hunt Tim [5:15] Morris commissioner as well L [5:19] Duke Kevin sop Sammy Morton [5:23] JR are all full bza board the board [5:28] members have [5:30] debellis is the an associate member and [5:34] as our as our zoning [5:39] resolution [5:41] requires Dennis [5:44] hunt represents the Planning [5:48] Commission on the board of zoning [5:50] appeals Tim Morris [5:53] represents the full legislative [5:57] body Samy Morton Jr [6:00] represents the full-time farmer those [6:03] are the only three positions that must [6:06] be that you must have one member from [6:09] the Planning Commission you must have [6:11] one member from the full legislative [6:13] body a commissioner and you must have [6:15] one full-time farmer the other two can [6:18] be normal people the way I like to put [6:21] it right right and we and we do have an [6:24] associate member and Helen debellis [6:27] fills that position in in the event that [6:30] any one of those five members do not uh [6:34] show up for a meeting the associate [6:36] member can uh participate and vote as a [6:41] full member does uh and as an example of [6:45] the importance of associate member our [6:47] very last Board of zoning appeals [6:50] meeting only two full members showed up [6:54] plus Miss de Bellis the associate member [6:57] so those three individual did make up a [7:00] quorum where we could go ahead and uh [7:04] and conduct business okay all right now [7:07] having said that TCA [7:12] requires any any commission board or [7:17] committee by TCA requirements says a [7:21] member must be a commissioner a member [7:26] of the full legislative body or if our [7:28] if we have a resolution that [7:32] requires a member of a committee must be [7:36] a full legislative body or [7:41] commissioner if you if those if that is [7:44] a requirement for any board commission [7:47] or [7:48] committee during an election cycle if a [7:52] member of the board commissioner [7:54] committee does not run or is not [7:58] successful when being reelected any of [8:02] the committees or boards or commissions [8:05] that they serve on that requires that [8:08] membership to be a commissioner that [8:11] seat is automatically vacant at that [8:14] point in time so but these members here [8:18] according to what this says are the bza [8:20] is appointed by the Planning [8:23] Commission or does that mean the [8:25] commission the the clb the clb so who [8:29] appoints them the full legislative body okay so by [8:33] nomination from the floor okay that is [8:37] that that one is not by the mayor [8:41] Planning Commission members is an [8:43] appointment by the mayor of the County [8:46] uh conf confirmed by the full [8:48] legislative okay the board of zoning [8:51] appeals is uh they're trying to take [8:54] politics out of this is the most this is [8:56] the most uh well I've explained it so [9:00] many times the board of zoning appeals [9:02] makes binding decisions right only a [9:05] court canot return their R only a court [9:08] can the uh decisions can be overturned [9:11] okay so well I was just trying to [9:12] clarify the commission here appointed by [9:14] the commission that means the clb yes [9:17] the entire legislative body the full [9:19] legisl commiss all right okay now I'm getting somewhere with all of this [9:25] uh I'm leading up to Tim [9:28] Morris [9:29] when commissioner Bobby Bryan uh failed [9:33] to be reelected in this last election [9:37] cycle he was a member of the board of [9:40] zoning appeals so his seat automatically [9:44] became vacant and we nominated Tim [9:48] Morris as commissioner because Bobby [9:51] Bryan represented the member uh [9:54] requirement of the full legislative body [9:58] so commissioner Tim [10:00] Morris was nominated and [10:03] approved uh should be January 23 minutes [10:07] I think you'll find that that's when [10:09] that took place all right so having said [10:13] that this is one of these things we have [10:16] to determine when did commissioner [10:20] Brian get nominated and approved for the [10:24] board of zoning appeals when would his [10:27] term have normally his fiveyear term [10:30] normally expired right commissioner [10:32] Morris is only going to uh finish the uh [10:37] term Bobby had started so see those are some of the things that we got [10:43] to look at that's how I think a lot of [10:46] this got messed up and if you note it [10:49] says Tim Moore's term expires in the [10:51] year 2030 yeah he serves to Long uh [10:54] that's that's I don't know how that [10:57] happened I have no idea how that [11:00] happened but uh we've got to figure all [11:02] this out so okay I think we need to [11:06] start if [11:07] everybody's uh looking at January 23 I'm [11:12] hoping we can see [11:17] the has anybody seen the bza yes on the [11:20] second page bottom uh second page at the [11:23] bot yeah hunt nominated Tim Morris yeah [11:26] as commissioner appointment and hen Bell [11:29] associate as the associate all right I [11:32] I'm starting notes I'm hoping y'all are [11:35] too yeah January of [11:39] 23 Tim Morris was appointed [11:42] to uh fulfill the term of former [11:47] commissioner Bobby [11:49] Bryan so we need to make that [11:57] note hey he's to feel the remainder of [12:01] Bobby Bryan's [12:16] term so to figure that out we'd have to [12:18] find out when Bobby Bryant was a we'll [12:20] run across it as we go backwards that's [12:23] what I'm [12:24] hoping that is definitely what I'm [12:26] hoping and I sort of think that's how we [12:29] uh like you know you would think logic [12:35] might have somebody automatically put [12:37] five years on Tim mors right then yeah [12:40] 2028 is what it should have been if you [12:44] were using that logic but that would not [12:47] be correct right he just we all agree on [12:50] that right all right so [12:53] now okay so that appointment would be to [12:56] fulfill and it wouldn't just be starting [13:00] new that's correct it would just be [13:02] that's correct finishing out to fill the [13:07] remainder [13:14] sure it [13:16] would to fulfill the remainder of the [13:21] seat vacated by commissioner [13:27] Brian well that get real confusing if it would seem like at the election I [13:32] mean I I don't know all of the [13:34] guidelines for appointing those but it [13:35] would seem like if the commissioner was [13:38] not reelected and you appointed a new [13:40] commissioner they would assume a [13:42] five-year [13:44] St no okay that's not the statute reachs [13:49] you would uh it's to fulfill the [13:53] remaining term of the vacated seat if [13:57] you didn't that's that's what gets you [13:59] in a mess we have to we must have one [14:06] member term expiring each calendar year [14:11] one yeah can't have two can't have three [14:14] that's TCA and our own zoning resolution [14:18] so that's why okay you can't have [14:21] somebody starting a fiveyear term when [14:23] they're actually finishing up somebody [14:25] else's fiveyear term had only got one [14:28] year left after two or something that's [14:31] what I think we're going to find is [14:32] created this problem well another [14:35] problem is if you've got Commissioners [14:37] that are going four years and they this [14:39] is a five-year term you're going to [14:41] always have this problem that's not [14:44] always well you're going to most of the [14:46] time you're going to have the same [14:47] problem not always because then you're [14:49] going to have to elect someone to [14:51] fulfill a one-year stand here's the key [14:53] word [14:54] reappointment so many people get [14:57] reappointed and that's why I think [15:02] that the the commissioner [15:06] term like let's say I've got three years [15:10] left as a commissioner I'm on the [15:14] bza I'm not a commissioner after the [15:17] next election [15:18] cycle I can be moved to uh if if I'm the [15:24] commissioner representing the Comm I'm [15:26] not I'm representing the Planning [15:28] Commission I don't have to [15:31] be a commissioner to be on the Planning [15:33] Commission okay [15:37] so when I'm no longer a [15:40] commissioner the full legislative body [15:43] may say well let's appoint Dennis in the [15:47] position from the Planning Commission if [15:49] I was the one doing the commission it [15:51] gets complicated well that's what I'm [15:53] trying to say I don't think I don't [15:54] think you're going to have this problem [15:57] every single election CLE well but it's [16:00] set up to be problems I mean the the [16:02] pattern is going to be a problem and [16:04] what I'd like to see where's the where's [16:07] the TCA for this uh tennessy code [16:10] annotated where is that for this or does [16:12] this I gave you a copy was that the last [16:14] time meeting okay all right I have a [16:16] copy of those if you need it well that [16:19] would be something that we need to look [16:20] at uh I know we need to find certain [16:22] people and but this whole thing of [16:24] fiveyear term when you especially when [16:27] you've got commit commers CU that's [16:29] going to that's just going to be a [16:30] problem because you got Commissioners [16:32] just four years at best you're going to [16:34] have them serving only four of the [16:35] fiveyear term then you're going to have [16:37] to apply another guy for onee term and [16:39] then another guy after that I mean it's going to be a mess it just looks [16:44] like the pattern is a [16:45] [Laughter] [16:50] mess I'm just in prevent of [16:56] Maintenance I think that's TCA okay this [16:59] is the okay this is the TCA okay we [17:02] should be back uh I'm on 2022 minut [17:07] right now trying to figure out all right [17:09] let's see 2022 Let's see we can go back [17:13] and find all this then come back and [17:14] look at this other later but I I was [17:16] just really interested in going back and [17:17] yeah comparing that yeah right now we [17:20] need to figure out how we're going to [17:22] fix this with the rules as they are [17:25] we're not here to change the rules we [17:28] here to comply with the rules okay yeah [17:38] absolutely so go back to [17:42] 22 here's I found Planning Commission [17:46] okay what page the about the third page no it's more than that I'm in [17:54] 22 okay one two three four the fifth [17:59] page second paragraph down right is [18:05] uh that's [18:07] AG wait a [18:09] minute I might be on the fourth page [18:13] I've done lost [18:21] it [18:23] there's I was just looking at Planning [18:27] Commission [18:33] lot of minut on now it is m i see the [18:38] strategic planning that's what made that [18:40] might have caught my eye no here it is [18:43] I've got it right here motion made by or [18:46] executed by def4 to reappoint Steve [18:49] Cunningham to the Coffee County Planning [18:51] Commission the motion was approve 18 [18:56] yes one two [19:00] three four five six the six page which [19:04] is one page from the last I think no [19:08] actually this thirdd page from the [19:11] back that's the Planning Commission [19:14] right generally speaking we would deal [19:17] with the [19:18] bza right around the time we're dealing [19:21] with the Planning Commission [19:23] appointments but I don't see bza at [19:27] all [19:30] see it would be a very small paragraph [19:32] just like that [19:57] one [20:21] probably should have asked her to give [20:23] us a copy of the [20:25] agenda because the agenda would say [20:29] uh what order it came in uh what members [20:33] what committee appointments were to be [20:35] made I don't see just [20:39] purchasing beer [20:42] board railroads and bridges capital [20:49] outlay r solid [20:54] w c solid was planning regional [21:00] board investment [21:03] committee who's till stubberfield who's [21:07] till in stubberfield is that Tim that's [21:09] Tim's daddy that's Tim's Dad okay yeah [21:12] okay good EMA [21:18] board [21:24] ethics [21:27] AED veterans representative County [21:32] Corner industrial [21:42] board Planning [21:46] Commission strategic [21:55] planning yeah uh I'm I've done went [21:59] through all the committee appointments [22:02] MH yeah I didn't see it personally I did [22:05] not see [22:06] it22 would y'all agree that in 2022 [22:10] there was no appointments to the bza [22:14] made yes there's no record of [22:25] that see there there's one hiccup right [22:29] there right there should have been there [22:31] should have been [22:35] one or just where it came for approval [22:38] of the full commission do what now or [22:40] just where it came to approval for the [22:42] full commission it should have been [22:43] there for approval by the full [22:45] commission somebody should have come [22:49] off and either reappoint or replace one [22:53] or the [22:54] other so [22:56] uh [23:02] okay and I wish these were numbered so [23:06] we make sure we didn't miss a page [23:09] anywhere because these Pages aren't [23:11] numbered so we don't know if we missed a [23:13] page but that's [23:15] okay okay now [23:26] 21 [23:56] that was me I'm sorry I'm glad you're [23:58] did that because I haven't muted [24:07] mine all right in [24:09] 21 appr this is a short [24:13] meeting I's see right here on second [24:16] page I see motion B by Cunningham and [24:18] second and by or to appoint Randy Harold [24:20] to the [24:21] planning replacing Chris [24:24] Anderson who [24:26] term third P second page second page [24:30] Dear Boy Road second 911 plan commission [24:36] I remember when that happened [24:44] EMA see that's Planning Commission yeah [24:47] Planning Commission um V so his Chris [24:50] Anderson's term expir so I would thought [24:54] it would have been right around there [24:56] well it appears [24:59] there was no [25:03] bza in 21 if you looked at the following [25:08] February of each of those years and [25:10] maybe it was overlooked or couldn't be [25:11] done or wasn't brought and would have [25:13] been approved in a in a later one could [25:15] that have happened I just don't think [25:17] that's going to be found but we're [25:20] sitting in a year where this is like [25:24] this we didn't make a Planning [25:27] Commission [25:28] appointment or confirmation nor did we [25:31] make a bza appointment or confirmation [25:34] in January of [25:37] 24 but it's always been done in January [25:41] prior to [25:43] that so there's [25:46] two consecutive years and see if y'all [25:49] remember in [25:51] 20 [25:54] three when I nominated Tim Morris [25:58] Claud Morris nominated Helen [26:01] debellis and I made my little [26:05] speech saying guys this feels just a [26:09] little bit different because the board [26:11] of zoning appeals is totally controlled [26:15] by the legislative body doesn't come [26:18] from [26:20] the the mayor's office right [26:24] and that in itself is probably what has [26:28] created this issue is because [26:32] we we have not done due diligence as a [26:37] legislative body to address the bza [26:40] every year we just wait for somebody to [26:42] throw a packet in front of us and we [26:44] deal with what's laid in front of us [26:46] when it's our [26:47] responsibility as a full legislative [26:50] body to appoint and approve the board of [26:53] zoning appeal [26:55] membership and I think we've done found [26:58] two problems already yeah two years in a [27:01] row it wasn't addressed at least not in [27:03] January [27:06] yeah [27:09] so if you go to the second page on [27:14] 2020 I think number go down to the about [27:17] the six or six yeah there was a motion [27:21] made by Miller and second by ort to [27:23] reappoint Dennis hunt and Bobby Bryan to [27:26] the bza [27:28] okay that whose terms expire in 2020 so [27:32] they're just going to reappoint y'all [27:35] because y'all both of y'all's terms it [27:36] says was going to expire in 2020 how was [27:40] how would both of y'all's expired in [27:43] 2020 like I said but that fits with but [27:47] that fits with the latest list where [27:49] you're [27:50] 2025 if you're going to go for a 5year [27:52] period And if they're appointing you in [27:54] 2020 that makes sense yeah somebody [27:56] wrote that down right right didn't [28:00] M so is that on the second page it's on [28:03] the second page uhuh about let's see one [28:04] two three four five six will paragraph [28:07] down small paragraph yeah okay I'm going [28:11] try start by that Mark [28:14] that all right so January of [28:20] 2020 you were reappointed that's why [28:22] yours is correct [28:26] 2025 [28:28] so if Bobby was reappointed in 2020 then [28:32] that means Tim Morris would have to go [28:35] by the [28:37] 2020 until we figure out why there was [28:41] two expiring in 20 20 20 that's right but yeah but you see that's when [28:47] Bobby was reappointed too 2020 so you [28:50] are Tim's feeling that you're correct [28:53] but this ain't [28:55] yeah yeah [29:05] but each everyone except the associate [29:09] member is supposed well even the [29:10] associate member is supposed to roll off [29:12] one is supposed to roll off every year [29:14] once a year mm so yeah but even even [29:17] with there's six on there the Associates [29:19] on there so if everyone if one rolls off [29:22] every five years then see that's messed [29:24] up too because you've got six on the [29:25] board yeah the the associate member is [29:30] the way I felt like everybody has [29:34] approached it is just a floating [29:38] member that's the only time I can [29:41] remember when uh when um Miss dellis [29:45] actually got to vote on business that's [29:47] the only time I remember an associate [29:50] member doing that but I'm sure it's [29:54] happened I was associate member when I [29:56] first got a [30:01] appointed it would be nice if we could [30:04] find the [30:05] local [30:07] uh when this was established the [30:10] bza because the information here is like [30:13] it was initially established and how to [30:15] start the initial board right so you got [30:19] to remember that uh what we have to go [30:23] by is our current zoning resolution [30:27] which was revised in [30:30] 2006 but we were dealing with zoning [30:33] prior to that I wasn't in government I [30:35] can't attest to what was done or how [30:37] they did it and I don't know that we'd [30:40] be able to go back that far but I'm [30:42] assuming that little sentence right [30:44] there happened prior to 2006 yeah that [30:48] was like I said that was a sentence [30:50] termin with those terminology of that [30:52] description there would fit an initial [30:55] beginning of the board [30:58] probably I can't I can't argue with that [31:01] I'd say you're right it says but here's [31:04] our zoning resolution it [31:07] says the board of zoning appeal shall [31:10] consist of five members appointed by the [31:13] Coffee County Commission the board [31:16] members shall be appointed to fiveyear [31:20] terms however the initial appointments [31:23] shall be arranged so that one member [31:26] will expire [31:27] each year okay that's if we would start [31:31] from scratch with this language you'd [31:33] have okay number one you're going to [31:35] have a one-year term number two you're [31:37] going to have a two-year term number [31:38] three you're going to have a three-year [31:39] ter number four you're going to have [31:40] four number five you're going to have [31:41] five that's how it would have been [31:44] handled initially by this language I'm [31:47] going to say that language that we're [31:49] looking at on that uh committee [31:52] membership list is probably language [31:56] that was done in 2004 2001 who knows [32:01] right what I do know is this is current [32:04] and the TCA rules uh that would it not [32:08] have been applied at that designation [32:12] there when that was accepted that they [32:14] have not reassigned all the people to [32:17] this board you would [32:18] think you and I weren't there okay we [32:21] don't know okay I just I was just asking [32:24] if anybody knew so yeah okay [32:27] but we did find out in 2020 that you and [32:31] Bobby Bryant were reappointed for [32:33] fiveyear terms in 20120 yeah you know [32:37] after we figured this [32:38] out uh [32:41] TCA says we have to have have to have [32:46] three or five can't have four can't have [32:50] two can't have six it must be three or [32:55] five now if you're [32:57] I'm reading this handout this the the [33:00] county legislative body shall be the [33:03] appointing power of the members [33:07] okay of such board appeals and may fix [33:10] their [33:11] compensation and their terms which terms [33:15] shall be of such length and so arranged [33:18] that the term of one member will expire [33:21] each year we have the latitude if you [33:25] will to change the this 5year [33:28] term uh that's in our zoning resolution [33:33] that's our language [33:36] uh TCA says we can fix the term we can [33:40] make it 10year ter we could make it any [33:43] but we got to fix it where one member [33:45] expires each year all right you got to [33:47] have a roll off yeah so okay well we can [33:50] get to that point yeah we have to [33:52] understand where we got to where we are [33:54] now we got to make it fair we can't just [33:56] I don't think we can just go wipe out [33:58] all the memberships and start from [34:00] scratch I mean uh these guys we've never [34:03] our Planning Commission has a good track [34:06] record our uh who only makes [34:08] recommendations by the way they don't [34:10] make binding decisions this board makes [34:12] binding decisions we've never been [34:15] challenged uh it's it's really a tough [34:19] job and we've done a pretty good I mean [34:21] well you wouldn't want to start from [34:22] scratch anyway because you lose your [34:23] brain trust and everybody that kind of [34:25] sees what goes through it [34:27] you're correct all right so I think we [34:31] need to move to [34:33] 2019 okay go to the second page and [34:35] about six down I [34:38] see y want to read that section [34:42] okay to reappoint Kevin [34:48] Cy L Duke there's all three of them the [34:52] three that expire this year there they [34:54] are three that's that's what happened is [34:56] that year they were all three appointed [34:58] mhm mhm so they were done and if they [35:00] were trying to fill three expiring [35:02] positions at that point they should have [35:03] said okay you're going to do one you're [35:05] going to do two and you're going to do [35:06] three right but they were theyo they [35:09] just put five years on every one of [35:11] those okay so if they're being [35:12] reappointed then that means they were [35:14] already on there five years prior [35:17] correct uh reappointed that's what that [35:20] means I don't know about Sammy Morton JR [35:23] but I'm think Lyal Duke had been on [35:26] there prior to this [35:28] date and I'm pretty sure Kevin sap had [35:33] been on there prior to this [35:37] date uh I I don't [35:40] know if Sammy Morton was or not I just [35:43] don't remember I think I was already [35:46] there but I think I was I may have still [35:48] been an associate member for all I know [35:52] all right so well the way it's written [35:54] it would say that they're all were [35:56] already there because they it says they [35:58] all were reappointed that's a good point [36:01] so [36:04] reappoint because it list all three of [36:06] them yeah and and you and Bobby were [36:08] reappointed so that means y'all had been [36:09] on there probably since 2015 2015 [36:13] so okay so all right reappointed [36:20] K S [36:24] Morton and El Duke and that works then [36:28] those four the 24 dates work yeah [36:31] because they were all reappointed in [36:33] 2019 that's five years so [36:36] that's the math is right just not [36:40] the just not how they all went on just [36:43] not the process right we've got to [36:46] Anchor the [36:49] process okay well we're find [36:51] clarification [36:53] there let's keep going all right digs a [36:57] little [36:58] deeper [37:00] 2018 you done found no not [37:03] yet been quicker than me well I was [37:06] scanning while y'all were talking a [37:08] little bit and I was like [37:12] okay British Beer board I wouldn't be [37:18] purchasing I wouldn't be surprised if we [37:20] don't see one coming off on [37:25] 18 [37:29] there's appointment to the Planning [37:30] Commission but I don't see the [37:47] bza I don't see [37:49] it not not an 18 at [37:52] all yeah which that don't surprise me if [37:55] they were just reappointed in 19 all [37:58] three of them and they even talked about [38:00] a resolution to reone some things but I [38:02] don't see the bz egg bu it [38:07] on I think it looks as though it got [38:16] skipped I'm going to be willing to bet [38:18] we're going to find back in 2015 [38:22] probably let's [38:25] see [38:30] we're going to [38:33] find [38:35] that the problem goes beyond 15 [38:48] years all right so we're back to 2017 is what I'm looking [38:55] at [39:01] judicial [39:03] planed [39:06] communication [39:17] Industrials have appointment to the [39:19] Planning [39:25] Commission [39:35] we just haven't [39:36] been doing it have we don't look [39:41] like I just don't see [39:55] it [40:06] well y'all didn't say one 2017 [40:12] no I did not [40:19] see 2016 we're moving on [40:25] here [40:35] Capital outlay beer [40:38] board [40:41] purchasing County [40:44] Corner ra roads and [40:48] bridges [40:53] 911 a [40:55] ComEd [40:58] Service [40:59] Officer planning Carol Willis and Paul [41:02] Elum to Planning [41:10] Commission yeah and see those are [41:12] fouryear terms those are but nobody can [41:17] find that in print I mean we're not [41:20] dealing with the Planning Commission I [41:21] just find that unusual but our Planning [41:24] Commission and I [41:27] uh well there's a there's an active [41:29] search underway for definition and [41:31] responsibility of committees standing [41:33] committees so that did I give you the [41:35] one for Capital outlay did I give you [41:37] that copy yes okay thought you brought [41:40] that back into me [41:43] yeah the uh one discussion that somebody [41:48] suggested that the fiveyear terms were [41:51] set up by by we made that decision prior [41:56] to us when I say we the cof county uh [41:58] commission to the bza needed politics [42:03] should not have any [42:05] political U overtones so that's why the [42:10] mayor does not appoint and fiveyear [42:15] terms uh goes beyond a four-year term [42:19] of some legislative body members and the [42:22] mayor you know when you get right down [42:24] to it that the fiveyear term means that [42:26] goes beyond election cycles and that's [42:29] what somebody said I I would have not [42:31] thought of that but it sort of made [42:33] sense when they said [42:35] it all right [42:38] 2016 have y'all seen a bza appointment [42:41] not yet I have [42:48] not well that was dealt with a lot in [42:51] that [42:54] meeting but nothing busy [43:25] y yeah I don't see [43:27] it what's the [43:29] PBA PBA public building authority that [43:34] took care of [43:36] our conference center a zoning [43:38] resolution but there weren [43:41] any what anything there so nothing in [43:44] the [43:50] 2016 all right [43:55] 2015 [44:05] there's [44:08] notaries [44:09] purchasing beer [44:25] board [44:54] for [44:56] rural roads and bridges agricultural [45:02] committee County Corner [45:07] Communications the adult orientation [45:09] board Remains the [45:13] Same I've even heard of that one [45:24] lately appointments to the Planning [45:26] Commission but not [45:32] BCA this says [45:35] this it's interesting because we're [45:37] looking at all these committees and [45:39] we're here to deal with one I know I [45:41] hate this that I have to keep bringing [45:43] but right here it says a motion made by [45:47] Brian seconded by Kelly to approve Chris [45:50] Anderson Lee Ducket and Allan Howard to [45:53] the Planning Commission and I thought we just saw where Chris Anderson [45:58] was appointed just a few ones back we [46:01] did so he was going appointed to [46:03] something well it was the Planning [46:04] Commission was it then that was it yeah [46:06] and uh we're not dealing with the [46:09] Planning Commission but that and and [46:11] that might end that might mean he was [46:14] appointed to fill uh the remaining days [46:17] of the term true [46:22] yeah I know seeing Allen Howard's name I [46:25] know [46:26] he uh resigned from the Planning [46:28] Commission at one point and I was [46:32] appointed to take his place [46:35] so there a interesting side [46:40] note I still don't see anything here I [46:44] don't see anything on bza you I do [46:53] not and these minutes were approv [46:55] approved in the following you know [46:58] commission meeting so yeah if something [47:00] was wrong someone would have caught it I [47:03] mean like it instead of the Planning [47:04] Commission it was the bza or something [47:06] you know some mistake like that it would [47:08] have been caught in a later should and [47:10] updated yeah yeah it should the then [47:13] these would have been revised correct [47:16] I'm pretty sure she goes back oh [47:20] yeah and amends when required because [47:24] they're not official until they V voted [47:26] on the next meeting and and looking [47:28] through several of those today that they [47:30] say revised so when they're yeah they've [47:33] gone back and them they've revised them [47:43] so we're back for my time now says mayor [47:47] Pennington amended the agenda yall look [47:50] at [47:51] 2014 okay [47:53] yeah so this was before four years [47:59] yeah my first that was the election year [48:03] I think I started in [48:11] 15 that's that's not good man look at [48:14] how many how many years there now since [48:15] no one several years in in a row before [48:20] anything was [48:23] appointed beer board county corn [48:40] roads here's another known the planning [48:43] motion made to approve Allan Howard [48:45] replacing Austin Anderson and Steve [48:49] Cunningham replacing Forest frame to the [48:52] Planning [48:54] Commission [49:00] Budget Finance oh here we [49:03] go Motion made by Brian and seconded by [49:07] Ducket for the following members to [49:10] remain the same on the board of zoning [49:14] appeals [49:16] Connie Larry Gary cordale LEL Duke Kevin [49:22] sou Sam Morton and Bobby [49:33] bran that's one two three four five six [49:37] so it does not say who was the associate [49:41] and who which five was the full members [49:45] but I would like to point out Sam [49:50] Morton the late Sam Morton that's be I [49:54] think he passed away during his term and [50:00] Samy Morton JR was uh confirmed to [50:05] replace his father and I bet you that [50:09] will not be found in a January meeting [50:12] it would be found right uh during the the fiscal year sometime or the [50:18] calendar [50:19] year when Mr Morton passed [50:24] away [50:28] sometime in that 2014 maybe [50:31] year between that and 2015 maybe he did [50:35] had to be [50:36] yeah so we [50:39] know Lal Duke and Kevin thy who are [50:42] current members were there in [50:46] 2014 we know they were there prior to [50:49] 2014 because there it says the following [50:53] members to remain the same [51:02] right [51:12] so now and and you want see we don't [51:16] really know why what they mean the [51:18] same so are they reappointed all at the [51:22] same time and now they all have fiveyear [51:24] terms that's good question question so [51:26] we don't know what they mean by that re [51:29] to remain the same well we don't know [51:30] how long they've been there we all know [51:33] they were there at that point I guess we [51:36] need to see the standing committee list [51:40] at that time [51:42] yeah that's not a standing [51:46] committee the board is zoning appeals is [51:48] not a standing committee okay it's still [51:51] on your list you're going to have [51:53] committee list okay right but a standing [51:55] committee is made up of full legislative [51:57] body members only okay see in the [52:01] bza uh it only requires one it can have [52:06] it let's see I get planning and the bza [52:09] mixed up like the Planning Commission [52:12] can have as many full legislative bodies [52:15] members as we approve as long as they [52:18] don't make up the [52:21] majority so of uh seven members there [52:24] can't be four four legislative body [52:26] members there can be [52:28] three all right the board of zoning [52:31] appeals says [52:34] one one must be must one and then [52:38] another must be from the Planning [52:40] Commission so forth so forth well I [52:43] noticed that in 2014 these were all made [52:48] you know members to remain the same yep [52:50] but three of [52:52] those were re reappointed in 2019 and I [52:57] know it says it doesn't say junior on [52:58] Sammy Morton but it does say reappoint [53:02] Sammy Morton Jun and that's five years [53:04] from from 14 to 19 so those three were [53:08] in five years were reappointed those [53:10] three were and then Bobby was [53:13] reappointed the next year in 15 H and [53:17] then you were added in [53:24] 15 [53:31] bab [53:54] burn [54:07] it doesn't look like they've got [54:09] somebody coming off every year do I it [54:13] just doesn't look like they've got [54:14] somebody coming off every year it look [54:16] like I don't know we haven't run ACR we [54:19] have not run across one meeting in [54:22] January where they appointed one member [54:25] have we no no we've it's been multiple [54:29] members when they have been [54:31] reappointed so someone hasn't been [54:33] reading and exactly and remember we're supposed to be complying with our [54:40] own zoning resolution which was [54:45] uh what's that read 06 06 8 years prior [54:50] to this right [54:54] here all right on 13 on page two it's [54:57] one two three [54:59] four five six [55:05] down Connie Larry Gary Cordell and Bobby [55:16] Bryan Ain that something you [55:21] have three members approved that year [55:25] yep those same three members were [55:28] approved the next year [55:54] yep [56:03] this is co this is so convoluted at this [56:07] point we're just going to have who's the [56:09] oldest folks on the [56:12] commission and I mean suggest a you know [56:15] here's where we need to start and start [56:17] with that [56:19] description and then start this and make [56:22] sure we do it every year from now on I [56:24] mean this is this is so convoluted how [56:26] are you going to figure all this check [56:27] it all [56:28] out because it hasn't been done right [56:32] yet in in uh let's see we're 2014 yeah [56:37] 11 years it hasn't been done right in 11 [56:44] years this is embarrassing [56:49] folks well we can't dis we cannot take [56:53] responsibility for the [56:55] mistakes that we can take responsibility [56:59] for correcting if we do it right if we [57:01] do it right and and it's like I said and [57:04] be fair yeah well it's like I said we [57:06] might I mean we could do a lottery put [57:08] all their names in a hat and draw them [57:10] out and do it that way but I don't have [57:12] any idea who has the most experience [57:15] we'd have to depend on you two for who [57:17] has the most experience and and try to [57:18] line it up and make sure we F fulfill [57:20] the other guidelines on [57:23] here all right here 2012 I've already [57:28] found on approved L Duke and Kevin [57:32] S and it says Bobby Bryan as an [57:34] associate member and also Bobby Bryan is [57:36] an associate man it's the first time [57:38] we've seen that it is except for H and [57:41] deil so all [57:44] right now this is on the second page it [57:47] is about the [57:48] seventh third paragraph [57:51] up okay it gotcha okay Kevin [57:55] [Music] [57:57] S L [58:09] Duke and B associate and and you wonder if they [58:15] say oh we haven't done this so we need [58:17] to get this done and if they did approve [58:19] it and they did set it up staggered but [58:21] they didn't record it that it was set up [58:23] staggered mhm we have to go back and [58:25] maybe look at like this sheet of the [58:29] committee and see if they staggered them [58:31] at the time they were elected because [58:32] it's not indicated [58:34] here we're gonna have to have Miss [58:37] Teresa to give us some more reports [58:39] aren't [58:41] we yeah I think it just how deep do we [58:44] want to dig they don't look like they've [58:47] been doing it so it's just I thank you I [58:50] we might have to I don't see anybody [58:52] following the guidelines of our own so [58:53] we may have to we we might just have to [58:56] suggest something to the commission and [58:59] let them vote on that or change it as [59:01] that will we can [59:05] take take the members that are [59:09] there and [59:13] uh somebody's going to need to expire this [59:19] year basically and another name for next [59:22] year another name for the following year [59:25] and we should make a uh the the our [59:29] zoning resolution does not speak to the [59:34] associate [59:38] member [59:42] so uh regarding the [59:46] term [59:47] um unless we want to make that [59:52] clarification well there again that [59:55] that'd be hard to do be hard to have six [59:58] one coming off every year when they [1:00:00] 5year [1:00:01] return [1:00:06] yeah all right we're in [1:00:08] 2011 well we're at least one thing we're [1:00:11] going to figure out we're going to [1:00:12] figure out who's been there the longest [1:00:14] right right yes at least at least [1:00:20] that and if the commission approves this [1:00:23] then we're going to have have to send [1:00:25] letters to those people asking them to [1:00:28] this is what we found and asking them [1:00:31] would they agree to the new [1:00:34] setup because some of them you know like [1:00:37] I [1:00:39] said well I think everybody on that [1:00:43] board agrees that it's it's uh we have [1:00:48] oversight the full legislative body has [1:00:51] oversight on this and if if if the full [1:00:55] legislative body votes and agrees on it [1:00:59] um I don't I know all of them pretty [1:01:02] good I don't think anybody on the border [1:01:04] zoning Fields would have a problem with [1:01:06] fixing a problem [1:01:12] no yeah let's let's do it by the book [1:01:15] folks let's set it up and do [1:01:19] it do you all see anything in [1:01:23] 11 [1:01:25] yeah hindes requested to include Board [1:01:27] of zoning appeals next [1:01:30] January and the jail inspection [1:01:33] committee should be [1:01:34] presented by the law enforcement [1:01:36] committee that was it's like yes on the [1:01:40] fourth H requested to include board it's [1:01:44] like they [1:01:47] never talked about board is owning [1:01:49] appeals or they didn't no it's just they [1:01:51] requested to include the board in Pony [1:01:53] zil next January next January and the J [1:01:56] we're not going to deal with it this J [1:01:58] let's see if they dealt with it uh well [1:02:00] they didn't do it in 212 because there [1:02:02] wasn't any report right well there was a [1:02:05] 12 yeah there was Kevin sou L Duke and [1:02:08] Bobby Bryan associate [1:02:11] member that's right all right so let [1:02:15] this going to be interesting let's see [1:02:17] what happened in [1:02:20] 2010 if [1:02:23] anything [1:02:31] can Corner bear [1:02:34] board R [1:02:36] roads [1:02:39] a service officers Planning [1:02:49] Commission I'll read this motion made by [1:02:52] offered and seconded by Hogan for the [1:02:55] Planning Commission to remain the [1:02:58] same they are Lee Ducket Austin Anderson [1:03:02] Virgil alord Carol Willis Charles Harris [1:03:05] Gary Cordell and Forest Frank see Carol [1:03:09] Willis that puts her is the oldest [1:03:11] member of our Planning Commission uh see [1:03:17] that's how that's how it would get [1:03:19] messed up right there when you just [1:03:21] approve all of them to remain the same [1:03:25] yeah [1:03:27] well that in itself says and if they're [1:03:30] fiveyear terms or something then [1:03:32] whoever's in the uh the mayor's office [1:03:35] trying to compile committee list and [1:03:37] term expiration dates they see this well [1:03:40] there's five years on every one of them [1:03:42] you know it's [1:03:47] uh but I don't see the board zoning [1:03:50] appeal do you guys no not on here [1:03:55] n here on 2010 all right so in 2010 [1:04:01] no [1:04:08] bza we're on our last one anyway [1:04:12] mhm for the 15 years yeah purchasing [1:04:17] beer [1:04:18] board they always dealt with the beard [1:04:20] board I seem like every time C Corner [1:04:26] Communications service [1:04:28] officers Planning Commission they always [1:04:31] vote on that Carol Willis was there then [1:04:34] industrial [1:04:36] board [1:04:41] Consolidated [1:04:47] Equalization [1:04:49] ad [1:04:51] EMA Duck River agent [1:04:56] see County Road list nothing no [1:05:00] bza it appears as though as [1:05:04] important and as powerful as the [1:05:07] bza [1:05:09] is it's sad that it received as little [1:05:13] attention as it has yeah in years [1:05:23] past [1:05:40] um I'm sort of you know I wanted to [1:05:43] bring all the details [1:05:47] and the printed [1:05:50] material to establish what we supposed [1:05:53] to be doing and and what we do do and [1:05:59] because I am a board of zoning appeals [1:06:02] member I'm going to be reluctant in [1:06:05] trying to [1:06:06] steer the solution in any direction or [1:06:09] another so I'm I'm not going to uh I [1:06:15] will support any reasonable solution I [1:06:18] think you you two uh guys come up with [1:06:22] but um [1:06:28] I like I said before I do feel like [1:06:32] everybody that that I serve with on the [1:06:35] board of zoning appeals will be [1:06:39] perfectly okay with whatever the leg [1:06:42] body they would probably like to be a [1:06:43] part of the solution [1:06:53] yeah [1:07:08] so it is it [1:07:10] is totally foar at this point we are not [1:07:15] well the oldest the oldest serving [1:07:18] members by the records we have before us [1:07:22] are Kevin S and L [1:07:26] Duke those yeah we have uh corroborated [1:07:31] their appointments [1:07:33] 2014 12 years ago right well they were [1:07:37] yeah L Duke and Kevin Saturn 2012 [1:07:40] reappointed in 14 and in [1:07:44] 19 and uh Sammy Morton come on in 2014 [1:07:49] and [1:07:51] 2019 and then 2015 junior or senior you [1:07:55] got to differentiate Junior was was on [1:07:58] in 219 that's what they well they have [1:08:00] Junior there I'd like to know is it [1:08:02] junior or is it senior because in [1:08:05] 19 uh no in 14 I'm pretty sure that [1:08:08] would be senior yeah okay I'm pretty [1:08:11] sure of [1:08:12] that well and the only reason I say that [1:08:15] is because it says reappoint in [1:08:20] 19 uhuh uh Sam senior Sam senior passed [1:08:26] away September 16th 2014 okay okay so [1:08:30] they may have put Junior on in his what [1:08:33] date was that and 14 what date of month [1:08:36] what month September September so he had [1:08:38] served he did four months Sam Morton [1:08:42] senior passed away September September [1:08:45] of [1:08:46] 2014 okay so that would be Samy Morton [1:08:49] Jr in 219 2019 thank you for that John [1:08:53] call so it would be junior in 2019 yes [1:08:56] yeah so this is going to be senior here [1:08:59] in [1:09:00] 2014 I'm wondering if they didn't put [1:09:03] Junior in that spot uh after he [1:09:10] passed and we can get in trouble for [1:09:12] assuming but I would assume like I said [1:09:13] when people read the minutes that they would correct things like that in [1:09:19] the following yeah right and then we [1:09:21] would see revised minutes I've been [1:09:23] looking do a lot of this today the [1:09:25] records and when they're revised it's mentioned in sh the revisions they [1:09:30] do a good job in the clerk's [1:09:34] office yeah Teresa goes over it pretty [1:09:41] good Dennis it says reappoint Dennis [1:09:44] hunt and Bobby Bryan [1:09:47] in I think I think you went on to 2015 [1:09:50] didn't you 20 2020 okay I would have [1:09:54] thought I mean I yeah reappointed in 20 [1:09:59] so if he was REO I was there before 2020 [1:10:02] so that's what I mean you might have [1:10:03] went on in 15 if it was a five year you [1:10:06] know what I [1:10:08] mean but didn't say that here did it [1:10:11] nope nothing in 2015 I I know good and [1:10:16] well well you were reappointed in 2020 [1:10:20] right and that fits with the what the [1:10:22] date is here on the presid list 25 to [1:10:24] roll off so that fits and so you would [1:10:26] have been originally maybe appointed [1:10:28] into 2015 that's what I was thinking [1:10:30] maybe you back that [1:10:32] up so that that works out there but in [1:10:36] the 2015 minutes there's no bza [1:10:39] appointment whatsoever correct that we [1:10:51] found yeah we only see in 23 and 20 and [1:10:56] 19 and 14 and 13 and 12 and 11 anything [1:11:02] appointed to bza those are the only [1:11:05] years so and most of those the last 15 [1:11:09] yeah and they said keep it the same and [1:11:11] all that type of stuff so we don't know [1:11:14] exactly what keep it the same meant [1:11:16] maybe keep the same people but what did [1:11:18] we do with their expiration [1:11:22] term [1:11:35] and commissioner hin it appeared as [1:11:39] though she picked up on it and said hey [1:11:43] we need to put the board zoning appeals [1:11:45] on next January that was what was in the [1:11:48] minutes right right [1:11:51] mhm they saw that they had missed it [1:11:54] there [1:11:56] too I think we need to get this [1:12:00] addressed so our longest members are L [1:12:04] duuk and Kevin [1:12:05] sap [1:12:09] correct that's what I'm and Tim and Tim [1:12:12] Morris just went on in 2023 to replace [1:12:15] Bobby bran [1:12:17] yes and Brian was reappointed in [1:12:20] 2020 right so he would been rolling off [1:12:23] in [1:12:24] 2025 so I would think that Tim Morris [1:12:27] needs to roll off in [1:12:28] 2025 correct and that maybe that's a [1:12:31] typo right yeah I'm I'm following you [1:12:33] there [1:12:37] yeah I think but Dennis would also come [1:12:41] off in 2025 yeah so we've got to we got [1:12:43] to fix that [1:12:47] uh after I said I wasn't going to get [1:12:50] involved I was thinking but I'll let [1:12:52] y'all keep [1:12:54] talk well [1:12:57] um so which 2025 is just so this year [1:13:02] somebody needs to come off this this [1:13:03] year I mean they can get reappointed but [1:13:05] somebody does need to and that would I [1:13:06] would think that would need to be L [1:13:12] Kevin or even Sammy Junior if you got [1:13:16] all six names yeah I have them in my [1:13:18] head but okay I was thinking arrange all [1:13:21] six names in what we know is the [1:13:25] longevity of their membership of that [1:13:28] bza which uh Helen was brought on in [1:13:32] [Music] [1:13:33] 20123 [1:13:35] so little du K the other definition by [1:13:39] who has to be on [1:13:41] that correct because we just you just [1:13:44] need one commission member one must be [1:13:48] from the full legislative body right [1:13:51] another is the word another shall be [1:13:55] from the Planning Commission okay so [1:13:57] that's a must shall be is a must and one [1:14:00] should be a full-time farmer okay [1:14:06] yeah so actually the two oldest [1:14:11] members [1:14:14] are not of those three [1:14:22] categories [1:14:24] and then we need a a [1:14:26] farmer now what is your definition of [1:14:29] farmer we had a long discussion about [1:14:33] that okay because I felt like a [1:14:37] full-time farmer means that's all his [1:14:41] entire livelihood is made from [1:14:45] Agriculture and [1:14:47] uh I didn't think we had anybody on [1:14:50] there that fit that description [1:14:54] and there was a lot of push back on it [1:14:57] so I dropped the subject what uh what [1:15:01] does our state recognized as a we [1:15:04] couldn't find it they Define agriculture [1:15:07] and they Define farming and all that but [1:15:10] a farmer we couldn't really find it [1:15:15] okay there somebody that is working some [1:15:19] percentage of the [1:15:21] ground whether they work another job at [1:15:24] midnight and I tell you I know lots of [1:15:27] individuals that that's all they do [1:15:30] that's all they've ever done they get up [1:15:32] every morning put on them overalls and [1:15:34] they're plowing or feeding cows or doing [1:15:37] something you know what I'm [1:15:38] saying yes sir well it looks like um you [1:15:43] and Tim are scheduled to come off in [1:15:45] 2025 and [1:15:47] LOL Kevin and Sammy they they got [1:15:50] reappointed in 2019 their schedule time [1:15:52] is 24 which one of them needs and then [1:15:56] Helen was put on in 23 so hers is [1:16:00] 2028 [1:16:05] but we're gonna have [1:16:11] to and I tell you what we can we can uh [1:16:16] we can [1:16:19] suggest [1:16:21] a an amendment to our zoning [1:16:25] resolution uh we the full the okay and [1:16:30] this how this process works if we amend [1:16:33] the zoning resolution and when I say [1:16:36] that I'm I'm thinking uh [1:16:40] this six members we actually have six [1:16:43] people on the [1:16:46] bza and if we have fiveyear terms and [1:16:51] one comes off every year that don't work [1:16:54] we could uh suggest [1:16:59] a one uh six-year term you could do that [1:17:03] got six members one has to come off one [1:17:06] term has to expire every year we could [1:17:11] suggest to the uh we this ad hoc [1:17:16] committee would have to first suggest an [1:17:19] amendment to the zoning resolution to [1:17:22] the planning committee [1:17:24] the Planning Commission has to make a [1:17:27] recommendation to the full legislative [1:17:29] body for any text whatsoever to be [1:17:34] changed in our zoning [1:17:37] resolution so approve a legislative [1:17:39] committee then the full legislative body [1:17:42] takes the recommendation of the Planning [1:17:45] Commission and either approves or [1:17:48] rejects and if we approve it then the [1:17:51] language in zoning resolution would wind [1:17:53] up being what this ad hoc committee [1:17:55] decided fixes the problem if you guys [1:18:00] think we need to do that my I like that [1:18:03] but what I'm thinking if we're trying to [1:18:07] keep it neutral and objective and not [1:18:10] any political uh overtones to it why [1:18:14] don't you make it every three [1:18:16] years then you're rotating uh [1:18:19] Commissioners and things like that uh [1:18:21] well then but it it keeps from that it [1:18:23] keeps from having five or six members [1:18:25] and and having to carry over and make up [1:18:27] and if you had them every three years [1:18:30] that rollover would take care of that [1:18:32] problem it would be a solution in itself [1:18:34] but you have six members and terms [1:18:37] expire in three years because you you've [1:18:40] got two people at least two people [1:18:42] rolling off every time we saw this you [1:18:44] had two people rolling off or being [1:18:45] reapproved oh so you're saying two [1:18:47] should come off every year every three [1:18:50] years yeah you you you put everybody on [1:18:52] there for three years years and every and every year two would roll [1:18:56] off oh every year two that's not going [1:18:58] to work okay TCA see that goes contrary [1:19:02] to TCA TCA plainly says one member's [1:19:07] term shall expire each year okay so we [1:19:11] would have to keep it at five address [1:19:14] the floating associate member address it [1:19:18] separately or go to six-year terms and [1:19:22] count the associate just like we would a [1:19:24] full member that's what I cuz we set the [1:19:27] terms TCA says one member comes off or [1:19:32] expires right everybody we [1:19:36] atast every year yeah one Member One [1:19:41] member's term shall expire each year and [1:19:44] six years would would take care of the [1:19:46] associate also if we wanted to do that [1:19:51] yeah [1:19:54] I wish this ad hoc committee had had [1:19:57] been assigned to to figure out [1:20:02] the terms of our Planning Commission [1:20:05] members but we were not so I'm not going [1:20:07] to say we need to address that this is problem at this point now that [1:20:11] we have delved into this and have all [1:20:13] this information in front of us because [1:20:17] uh I don't see it in print [1:20:20] anywhere in our zoning res solution I [1:20:23] could not find it and others have not [1:20:25] either what the term length and TCA [1:20:28] doesn't full legislative body controls [1:20:31] term [1:20:33] length if we keep the present members [1:20:36] that are on there and just reassign the [1:20:39] term ending would seem to be the most [1:20:42] simple thing to do that's kind of what I [1:20:45] had wrote down right here if we could [1:20:46] keep the current members and then [1:20:48] reassign years that they need to come [1:20:51] off correct and then from there [1:20:54] forward well then next January we would [1:20:56] reappoint the person rolling off right [1:20:59] so 2024 even though I know January has [1:21:02] passed but somebody needs to come off [1:21:04] this year and be reappointed this year I [1:21:06] think correct it has to 24 so and I had [1:21:10] put LOL just as a name because he was [1:21:12] been the longest running uh but so his [1:21:15] site so I put him as 25 and Sammy is 26 [1:21:17] you is 27 more is 20 you know just as an [1:21:20] example but give everybody a roll off [1:21:23] year one person comes off a [1:21:26] year that that is my opinion is the most [1:21:30] logical Choice arrange them in uh [1:21:35] chronological order who's been there the [1:21:37] longest and they get the first ending [1:21:41] term right which is 2024 somebody's term [1:21:44] should be assigned to 2024 okay and that [1:21:48] keeps your that keeps your brain trust [1:21:50] people that have the experience right [1:21:51] correct yeah now do we do we fulfill the [1:21:54] other descriptions we got one [1:21:56] commissioner one planning committee [1:21:58] member and planning committee member and [1:22:00] one [1:22:01] farmer do we still have that on yeah we [1:22:04] do because everybody's going to be the [1:22:06] same and if LOL is okay with staying on [1:22:09] I don't care that you know I'm to re [1:22:11] reappoint if that's what he wants to do [1:22:14] you know well that's going to be the the [1:22:18] like I said the full legislative body [1:22:19] points somebody has to nominate from the [1:22:23] okay and so to help people in the future [1:22:26] we can indicate by their name what [1:22:28] position they fulfill commissioner or a [1:22:30] farmer or Planning Commission we can do [1:22:33] that by their name should be [1:22:35] commissioner yeah I've always made it so [1:22:37] that's very public that uh who is what [1:22:42] well it wasn't indicated here no it was [1:22:45] our farmer who is our farmer Sammy [1:22:48] Morton JR is who [1:22:51] consider [1:22:53] and uh Tim he works for the city [1:22:56] Manchester City Fire Department uh not [1:22:59] anymore he left there that's why I know [1:23:02] that I know that I was getting to that [1:23:04] okay sorry I was getting to that that's [1:23:06] what I sort of had a problem with the [1:23:08] designation of full-time farmer when [1:23:10] you're pulling down a pretty good chat [1:23:12] cross the city I see you know but Sammy [1:23:15] does Farm uh and he he did tell me a few [1:23:20] months ago he said I'm going to be [1:23:21] retired so I will be a full-time farmer [1:23:24] so but we're just trying to get this [1:23:25] reestablished and then the commiss if we [1:23:27] indicate that on that list then the [1:23:29] Commissioners whoever's rep okay we need [1:23:31] a farmer this year or we need a see the [1:23:34] commissioner is Morris and what was the [1:23:36] other one we had to have the what now a [1:23:38] planning a plan Planning Commission one [1:23:42] member which is you Dennis wait a minute [1:23:44] let me read this out loud let's read [1:23:46] that back [1:23:48] yeah from our zoning resolution there's [1:23:53] my glasses I'm [1:23:54] [Laughter] [1:23:57] looking [1:24:01] okay powers of the [1:24:04] board the Coffee County Board this is [1:24:08] section [1:24:11] 10.70 Coffee County Board of zoning [1:24:14] appeals this is the paragraph from our [1:24:18] zoning resolution not TCA the Coffee [1:24:21] County Board is owning appeals is hereby [1:24:23] established in accordance with [1:24:26] 13-7 d106 through 13-7 [1:24:30] 109 of the Tennessee code annotated the [1:24:33] board of zoning appeal shall consist of [1:24:36] five members appointed by the Coffee [1:24:40] County Commission period the board [1:24:43] members shall be appointed to fiveyear [1:24:46] terms however the initial appointment [1:24:49] shall be arranged so that the term of [1:24:51] one member will expire each year period [1:24:55] And I will say what we had just [1:24:57] discussed and suggested does exactly [1:25:00] that okay okay now the last the next [1:25:04] sentence in that paragraph one member of [1:25:07] this board shall be a CO County [1:25:11] Commissioner another a member of the [1:25:14] Planning Commission period one member of [1:25:18] the board should be a full-time farmer [1:25:21] should sort of is like a wiggle word but [1:25:24] it is derived from sh so we do your best [1:25:28] to do that but if you can't then yeah I [1:25:30] think I think I think that signifies [1:25:35] shall so and we have we have that [1:25:38] established we have uh kept it that way [1:25:42] and [1:25:45] so that way when I'm at the Planning [1:25:48] Commission like when I go to a board of [1:25:50] zoning appeals uh [1:25:53] meeting sometimes we're asked to change [1:25:57] a uh a decision that are uh direct let [1:26:03] me let me just powers of the [1:26:06] board three there's three powers pretty [1:26:11] explicit doesn't give us a lot of [1:26:13] latitude that's why I've seen some [1:26:15] people walk out of this room crying you [1:26:18] know U because we can't do what they [1:26:21] want us to do do the board of zoning [1:26:24] appeal shall have the following powers [1:26:27] administrative review to hear and decide [1:26:31] appeals where it is alleged by the [1:26:33] appellant that there is error in any [1:26:37] order requirement permit decision [1:26:40] determination or refusal made by the [1:26:44] zoning administrator or other [1:26:46] administrative official in the carrying [1:26:49] out of enforcement of any provision of [1:26:53] this resolution that means if somebody [1:26:55] just doesn't agree with what Curt or [1:26:59] zoning administrator his decision if [1:27:03] they don't like it they think he's made [1:27:05] a mistake they have uh evidence that [1:27:09] he's messed up we can overturn his [1:27:12] decision all right that's the first [1:27:14] Power special exception to hear and [1:27:17] decide applications for special [1:27:19] exceptions as specified in this resol [1:27:22] olution which there's a lot of special [1:27:24] exceptions listed in the text of the [1:27:28] zoning resolution and for decisions on [1:27:31] any special questions upon which the [1:27:33] board of zoning appeals is authorized to [1:27:35] pass you know that's pretty widespread [1:27:38] but in matters of direct [1:27:41] airs the board shall refer to Tennessee [1:27:45] code annotated section 13-3 d48 to [1:27:48] determine the proper division of [1:27:50] property and that that's somebody's [1:27:53] handing down a farm people get to [1:27:55] arguing about it I guess we can help [1:27:57] them decide who gets what I guess then [1:28:01] the variance to that's number three the [1:28:04] third power to hear and decide [1:28:06] applications for variances from the [1:28:09] terms of this resolution and we do that [1:28:12] quite often just the other day in uh out [1:28:15] at Lakewood Park a guy wanted to build [1:28:17] his house we have a 25 foot sidey yard [1:28:21] setback we gave him a variance of I [1:28:26] think it was 5T so he had room to build [1:28:30] the house he wanted to build with a 20 [1:28:32] foot sidey yard so that's that's one of [1:28:36] the things we do and if his neighbor [1:28:38] course and every time something like a [1:28:40] variance or rezoning or something like [1:28:42] that comes up the [1:28:45] U get a letter they have to send a [1:28:47] letter to the neighbors neighbors yeah [1:28:50] and like if we decided that guy deserve [1:28:52] this five foot and neighbor argued well [1:28:54] the neighbor has to go to court to [1:28:57] reverse our our the grant the granting [1:29:00] of that variance so it's it's pretty [1:29:04] powerful uh board and uh that's why I [1:29:08] think it needs to be populated with [1:29:12] people that understand what's going on [1:29:14] and need to have a little compassion [1:29:16] when you're dealing with people yeah [1:29:20] so using that pattern that [1:29:25] solves the problem it it establishes I [1:29:28] gave you my um my list of [1:29:30] members and it establishes it [1:29:33] reestablishes the proper order right and [1:29:36] then it puts us back on track right that [1:29:39] next January whichever one's rolling off [1:29:42] we understand what their position is [1:29:44] whether they're commission Planning [1:29:46] Commission meeting a member farmer or a [1:29:48] farmer or whatever and that helps us to [1:29:50] decide then right from the full [1:29:52] commission during that meeting it can [1:29:54] the nominations can come from the [1:29:57] floor so we've accomplished that so do [1:30:00] we add our so do we so our [1:30:03] recommendation does that still have to [1:30:05] go our recommendation to go to the [1:30:08] planning uh well I haven't heard a [1:30:10] motion putting all this together yet but [1:30:13] are you leaning towards making the bza [1:30:17] members sixe [1:30:20] terms [1:30:24] if we left it at five one of two things [1:30:27] you can one of two things I think would [1:30:29] be a appropriate either way if you make [1:30:33] it a six-year term for that [1:30:37] membership that has to be uh an [1:30:40] amendment to the zoning resolution and [1:30:44] or you could say that leave it five year [1:30:47] for the full membership and the [1:30:50] associate member is floating and could [1:30:54] change annually or every five or you [1:30:58] could you could word it to where the the [1:31:01] five-year term does not apply to the [1:31:04] associate member you could do you could [1:31:06] do many things but that would also [1:31:08] require amending the zoning resolution [1:31:11] to state that can the can the associate [1:31:15] member if she come off in 2028 at her [1:31:18] regular time she would just come off [1:31:19] with one regular member is that a [1:31:21] problem having an associate come off [1:31:23] with one regular [1:31:25] member it it says that just as long as [1:31:27] one I think we would be complying with [1:31:31] TCA [1:31:33] because it TCA says member right the [1:31:39] associate member uh is not a member [1:31:45] right just kind of like a a sub or feel [1:31:47] in for an [1:31:49] absent U member [1:31:57] vacancies shall be filled I'm reading [1:31:59] TCA now not our zoning resolution [1:32:03] vacancies shall be filled for unexpired [1:32:06] terms in the same manner is in the case [1:32:08] of original ones meaning it would be uh [1:32:12] nominations and approval by the full [1:32:14] legislative body that's the way I take [1:32:16] that sentence the county legislative [1:32:20] body May appoint [1:32:22] associate members of the board and in [1:32:26] the event I want to back up may doesn't [1:32:29] say shall we have because we've got [1:32:32] associate members but it's the TCA says [1:32:35] may appoint associate members of the [1:32:38] board and in the event that any regular [1:32:41] member see so they they differentiate [1:32:44] they use the word regular [1:32:47] member and in the event that any regular [1:32:50] member be temp temporarily unable to act [1:32:54] owing to absence from the county [1:32:58] illness interest in a case before the [1:33:01] board or other cause such associate [1:33:05] members Place may be taken during such [1:33:08] temporary disability by an associate [1:33:11] member designated for the purpose by the [1:33:15] county legislative [1:33:17] body so it still doesn't address the ter [1:33:22] well but it it gives us the [1:33:25] opportunity to let like you said Float [1:33:28] let the associate [1:33:29] float and we [1:33:31] could regular members are coming off [1:33:35] term expires year yeah and then we could [1:33:39] look at the associate every year I yeah [1:33:41] to to approve or to roll off or whatever [1:33:44] the commission whatever the commission [1:33:47] Wills well I mean we have it sounds like [1:33:49] we have that flexibility yeah and I [1:33:52] think I think the the associate member [1:33:55] can come off with a regular member and when there's a reappointment as long [1:33:58] as it's put into the minutes when you [1:34:01] reappoint a regular member that it put [1:34:03] if you have to reappoint associate that [1:34:05] it says associate that way it's not you [1:34:08] know it says it in there it's not [1:34:09] confusing to us I mean you know what I'm [1:34:10] talking about yes I see what you're [1:34:12] saying so as long as it says associate [1:34:14] will know that one regular member got [1:34:17] reappointed or appointed along with the [1:34:20] associate [1:34:22] but if that be the case she would come [1:34:23] off in [1:34:24] 2020 okay we're not changing anything [1:34:27] we're just updating the [1:34:30] dates so can this go directly to the [1:34:33] commission without going through the [1:34:34] legislative committee if we're not [1:34:36] changing [1:34:37] anything all we're doing is updating the [1:34:39] dates yeah just to approve the current [1:34:41] board and move [1:34:44] forward at this time with one member [1:34:46] coming off each year starting with the [1:34:48] oldest member we're not changing the [1:34:50] process no we're just change we're [1:34:52] updating and bringing in line the [1:34:56] dates of the [1:34:58] terms so we're actually not changing [1:35:01] anything of the [1:35:04] process if I understand what you've been [1:35:07] reading I'm I'm just reading I don't [1:35:10] want [1:35:10] to I'm looking at our remember TCA [1:35:16] says that the legislative body May up [1:35:21] Point associate members of the board [1:35:24] may I don't see anything in here where [1:35:27] it says associate member in our zoning [1:35:31] resolution well we must have at least [1:35:34] the minimum to apply to the TCA we've [1:35:37] got to agree with that whatever we do we [1:35:39] can add to that oh yeah but we've got to [1:35:41] do the minimal of what TCA does correct okay so are we [1:35:46] in with what I just said are we are we [1:35:50] making it with TCA and our [1:35:52] local yeah I mean nothing's been said [1:35:54] about what y'all what I'm saying is [1:35:58] where where's the language that says the [1:36:01] county legislative [1:36:04] body has associate member it's not in [1:36:07] her zoning [1:36:10] resolution correct no it's not I don't [1:36:13] see it I may have to go out to the [1:36:16] vehicle and get the full only the the [1:36:20] County Board is owning a it doesn't say [1:36:22] that we will have it does not say we [1:36:24] will have an associate [1:36:29] member the first one I seen But the TCA [1:36:32] does TCA says we can may may I got [1:36:38] you but the be the but the zoning [1:36:41] resolution doesn't say we shall elect a [1:36:47] associate [1:36:49] member but we would be fulfilling the [1:36:52] minimal requirements with TCA with May [1:36:55] that means yeah we we've got the we [1:36:56] we've got the okay to do [1:36:58] that we would be fulfilling TCA [1:37:01] requirements if we disregard an [1:37:04] associate member allog [1:37:06] together because they say we can say we [1:37:08] don't have one right now we could almost [1:37:10] say that because I don't see it in uh in [1:37:13] the membership makeup of the board of [1:37:16] zoning [1:37:18] appeals so therefore there having said that let's just not deal with it [1:37:24] the the fiveyear terms for the five [1:37:27] regular members is y'all laid out [1:37:31] works it [1:37:33] works the associate member we may need [1:37:36] to uh we this this would not have to go [1:37:41] to the Planning Commission right if [1:37:43] we're leaving every the we're not Chang [1:37:45] we're not amending our Zone resolution [1:37:47] right [1:37:48] um and this has been done [1:37:52] for the 15 years that we've looked [1:37:55] through the they've had the associate in [1:37:57] there already for that 15 years right [1:37:59] yeah in 2012 somewhere some one in 2012 [1:38:04] Bobby bran was I guess and I don't know [1:38:08] that since TCA says we may appoint one [1:38:11] well we did appoint one right that's way [1:38:15] it looks that's how we have to but our [1:38:17] owna resolution don't even mention [1:38:19] associate member that I [1:38:21] and I could be mistaken I might need the [1:38:23] whole book but this is where it says the [1:38:26] makeup of the membership so having said [1:38:30] that uh I [1:38:33] think that we're good with what y'all [1:38:37] have discussed I think I think that's proper way handling [1:38:43] it I I would welcome any other solution [1:38:45] but I think we've got Simplicity we've [1:38:48] got application uh we we were [1:38:52] accountable to uh TCA guidelines and and [1:38:55] the best that we know from Planning [1:38:57] Commission [1:39:00] so I mean from from my opinion my pers [1:39:05] perspective and you've got them written [1:39:07] out there I do and and that's what I [1:39:10] mean that's what do we so we need to [1:39:12] make a motion uh yeah to approve the [1:39:15] current board uh with one member coming [1:39:19] off this year [1:39:22] um would you like to make a motion [1:39:24] starting with the oldest I I make a [1:39:26] motion that we take the list as we've [1:39:28] come up with there uh keeping the uh [1:39:32] published names of the bza at this point [1:39:37] and just [1:39:38] adjusting their their uh dates of [1:39:40] service rolling [1:39:50] off [1:39:54] and then do we just make the associate a [1:39:56] an annual uh [1:40:02] approval yeah we can just make the the [1:40:05] associate an annual approval of the [1:40:08] right now that's what we need I don't [1:40:10] think we need to address it well that [1:40:13] keeps us again from we we're still in [1:40:15] compliance with everything oh yeah and [1:40:17] we're not violating anything uh and [1:40:20] that's been done we have that that [1:40:23] record and simply because it's been done [1:40:25] before that mean it's now but we're not [1:40:27] in our observation of [1:40:30] TCA U we're in [1:40:36] compliance where I had the names there [1:40:38] we're going to all right this is what [1:40:41] you got [1:40:49] okay [1:40:55] you've made a motion I'm going to read [1:40:56] your motion even though you didn't say [1:41:01] all the mo cuz I'm secretary and I have [1:41:04] to get this recorded but the motion to [1:41:08] uh to to fix this uh conundrum we are in [1:41:13] with the uh term expiration motion by [1:41:17] commissioner Joe mik [1:41:19] Hodge is that where are taking the five [1:41:23] regular [1:41:24] members arranging them so their [1:41:28] terms would expire as such we're just [1:41:32] adjusting their terms in order to repair [1:41:37] or to reestablish and corre we've taken [1:41:40] these as the we've we've wrote reviewed [1:41:43] 15 years of records and these are the in [1:41:46] chronological order as We Know It uh ly [1:41:49] Duke's term will EXP expire [1:41:52] 2024 Kevin Sap's term will expire [1:41:57] 2025 Sammy Morton Jr's term will expire [1:42:03] 2026 he is the required full-time farmer [1:42:09] designation Dennis Hunt's term will [1:42:12] expire [1:42:14] 2027 he is the [1:42:18] representative Planning Commission m Tim Morris will expire [1:42:27] 2028 he is the [1:42:30] representative commissioner full [1:42:32] legislative body [1:42:34] member Helen [1:42:36] debellis [1:42:38] is the associate member and [1:42:43] we your motion for associate members [1:42:48] would be to address associate member [1:42:51] annually correct okay that way the the [1:42:53] full body will be and that will help us [1:42:56] to remember to do that [1:43:01] maybe [1:43:04] um okay that'll get second that motion [1:43:08] okay okay all those in favor I I okay did you vote I did [1:43:16] okay I did I well [1:43:21] uh another thing I want to make uh clear the TCA [1:43:34] regarding [1:43:39] membership that I wanted to read [1:43:41] legislative body vad zoning Authority P [1:43:44] part the shall be appointing power of [1:43:46] the members shall [1:43:49] be we need to copy that sent so we can [1:43:52] do that see it in the legislative [1:43:54] committee yes so we get that next week [1:43:56] and we can get that approved and then [1:43:59] ship it on to the yes my secretary is [1:44:02] going I I don't have that printed off [1:44:04] because I didn't really there was some [1:44:07] we have to remember the board of zoning [1:44:11] appeals and the Planning Commission only [1:44:14] deals with business and issues in rural [1:44:20] coffee County they have no oversight [1:44:23] whatsoever within the municipal [1:44:25] boundaries of t or Manchester I would [1:44:27] expect them to okay right yeah okay now [1:44:31] uh there was a question about the [1:44:35] membership does the members of the board [1:44:39] of zoning [1:44:42] appeals and the Planning Commission have [1:44:44] to [1:44:45] be rural [1:44:48] residents what I found in TCA and I [1:44:52] didn't print that because we wasn't [1:44:54] really dealing with it uh because [1:44:56] actually miss debellis lives within the [1:44:58] city limits of Manchester what TCA uh [1:45:02] States is that a majority of the body [1:45:07] must reside in the territory in which [1:45:10] they oversight or oversee so the county [1:45:14] they have to most of them the majority [1:45:15] have to be from the county so five three [1:45:18] of them have to be rural residents but [1:45:20] we're in good shape there all five are [1:45:23] rural residents and Helen is an [1:45:25] associate member we're nowhere near [1:45:28] getting in uh okay we're we're compliant [1:45:31] with that when we print [1:45:34] this in the future it need those [1:45:38] guidelines need to just like these [1:45:39] guidelines are stipulated here those [1:45:41] guidelines need to be stipulated and [1:45:43] those indications of what position they [1:45:46] feel needs to be there too just like [1:45:47] Helen's the associate uh then we go back [1:45:50] now and and and you'd be Planning [1:45:53] Commission and Tim Morris would be [1:45:55] commissioner they need to be signified [1:45:57] by their name somehow so that we know [1:45:59] when they're rolling off who we need to [1:46:00] replace there just to help the people in [1:46:02] the future right [1:46:04] okay does that make sense [1:46:07] yes and we need to stay stay on top of [1:46:10] it that that we are compliant with those [1:46:14] three designated positions [1:46:18] yes yeah and it's just to give everybody [1:46:20] a fair shake you know the me coming from [1:46:24] the Planning Commission if I sit in on [1:46:26] the bza I can I can uh relate all of the [1:46:30] issues see the the the Planning [1:46:34] Commission as has been stated does not [1:46:38] make binding decisions but they [1:46:41] confirm binding language that's in our [1:46:45] zoning resolution they don't really make [1:46:47] a decision on it they're just saying [1:46:49] yeah this is what it's says and yes um [1:46:52] ma'am sir you will have to do it this [1:46:55] way you must do that you know we vote on [1:46:57] it that's the way they do it and if it's [1:47:00] uh amending the zoning [1:47:03] resolution which if you have a piece [1:47:06] property that fronts Highway 55 out [1:47:09] there and it's R1 for housing but you [1:47:11] want to put a little car lot it needs to [1:47:13] be [1:47:14] C1 that you come to the Planning [1:47:16] Commission and asks for your property to [1:47:18] be rezoned well that is amending the [1:47:21] zoning resolution because the map our [1:47:24] zoning map is is part of our zoning [1:47:29] resolution and then we would vote on [1:47:32] resoning your property and if it if we [1:47:36] get a positive vote out of the Planning [1:47:39] Commission that's not binding you go to [1:47:41] the full legislative body then we vote [1:47:44] as the Commissioners to change your [1:47:47] zoning [1:47:48] designation and [1:47:51] I don't know that I've ever seen it fail [1:47:54] generally I mean if the Planning [1:47:55] Commission gives it a positive [1:47:57] recommendation that means it's pretty [1:47:59] much been run through the meal but uh [1:48:02] anyway it's intriguing but the effort of [1:48:05] this Administration this election cycle [1:48:08] has been to clarify and to [1:48:11] reestablish what should have been going [1:48:13] on in order and I think that's what [1:48:15] we're doing here I think that's another [1:48:17] step in what we're doing is trying to [1:48:19] make things clear [1:48:20] uh make it objective uh and and that [1:48:23] type of thing so I I think we've [1:48:24] accomplished that maybe today unless [1:48:26] somebody there's something that I [1:48:28] compliance is the catch word compliance [1:48:31] yeah I'm all for that so this will uh [1:48:35] just need to be brought up at our next [1:48:37] full commission meeting then yeah we [1:48:39] will um just get a copy of this and send [1:48:42] it to the legislative committee because [1:48:45] we're supposedly the Clearing House so [1:48:47] just get this and get it to me so I can [1:48:49] get it on our agenda so we're ready to [1:48:51] go to the full commission with it I [1:48:53] don't think that's necessary but if [1:48:56] y'all want to look at it you can because [1:48:59] it's the the full legislative body is [1:49:02] the one that uh we're responsible for [1:49:06] the bza like I said I was just looking [1:49:08] at those U things today because we're [1:49:12] again trying to decide on that and it [1:49:14] said the legislative Committee of Coffee [1:49:17] County Tennessee commission is the [1:49:18] Clearing House for either new County [1:49:20] resolutions or proposed amendments to [1:49:22] existing resolutions M and we're not [1:49:25] amending all all legislation proposed by [1:49:27] the county mayor's office or the County [1:49:29] Commission normally makes a stop in the [1:49:31] legislative committee before proceeding [1:49:33] to a full vote of the County Commission [1:49:35] so it's just an extra set of eyes yeah I [1:49:38] was [1:49:39] uh I agree with the resolution I'm not [1:49:42] sure this has to be a [1:49:46] resolution uh it's we're just making a [1:49:49] clarification and a reestablishment [1:49:51] Comedia assignments you know if you [1:49:53] notice have no resolution number you all [1:49:56] these minutes we looked at there's no [1:49:58] resolution number associated with [1:50:00] membership but uh you know I [1:50:04] don't when is the next legislative body [1:50:07] the legislative committee meeting it's like next week or week after next [1:50:11] okay it's it's a week before the [1:50:13] commission okay [1:50:15] meeting [1:50:17] y [1:50:19] and [1:50:20] I don't know I think I think we've [1:50:23] covered it I think it's a I think it's a [1:50:26] good motion I think it's a good uh [1:50:30] solution and uh what I don't know if [1:50:34] this needs to be policy and procedures [1:50:36] or legislative but these [1:50:41] appointments to all committees and [1:50:45] Boards I feel like any name that is [1:50:51] uh [1:50:52] placed uh in nomination to be approved [1:50:56] that individual should be there yeah and [1:51:01] that rarely happens I mean all of our [1:51:05] standing committees and committees that [1:51:08] have legislative body members on it [1:51:10] we're already sitting there and we can [1:51:12] speak to it if we wish to but these uh [1:51:16] like the Planning Commission there's [1:51:18] only I'm only if they're appointed and [1:51:20] not elected I mean publicly elected [1:51:23] through election process that's what [1:51:24] you're talking about IED I think when we [1:51:27] are appointing when we're populating [1:51:29] boards commissions and committees the [1:51:32] individuals that we are approving should [1:51:34] be there should be in [1:51:36] attendance but there's nothing that I [1:51:39] see right now in our policy and [1:51:42] procedures that requires that I just [1:51:45] think they should be something we need [1:51:47] to consider yeah all right [1:51:51] very [1:51:52] good trying to pull up the calendar I [1:51:55] can see so it's going to take me a [1:51:57] little while to ride up the minutes on [1:51:59] this but I'll get them out pretty quick [1:52:08] okay have you got anything else Madam [1:52:11] chair woman I was looking on the [1:52:12] calendar um do you have [1:52:16] a a bza meeting on the 15th we do do [1:52:20] okay and [1:52:22] then [1:52:24] um I was looking to see when the when's [1:52:27] our next full commission meeting um is [1:52:30] that the [1:52:33] 12th like March 12th March I think [1:52:37] so [1:52:40] March um yes um March the [1:52:48] 12th [1:52:50] legislative committee I thought it said [1:52:52] February 26 okay February [1:52:55] 26 and then the full commission is March [1:52:58] the 12th March the 12th okay so
