So, they they [2:31] gave away $15,000 [2:33] in prizes on Saturday at the at the [2:36] event, including free fishing rods to [2:38] all of the kids that came. So, it was a [2:41] um very successful event. But two of [7:43] us are here to give a report on that. [7:46] Um, since we last spoke, there have been [7:49] uh not just uh pickup trucks coming in [7:51] with debris, mostly metal. They're now [7:54] dump trucks. There have been four of [7:56] them that I've seen, and another one [7:58] came at 8:30 at night and unloaded for 2 [8:01] hours. The debris of metal was piled so [8:04] high that you could see it over the edge [8:06] of the dump truck um bringing in metal. [8:09] Um they now have so there's new material [8:12] coming in all the time. Since they got a [8:15] report saying that it was substantially [8:17] clean, they thought, "Oh, Ali Ali income [8:19] free. We're good to go now. Let's bring [8:20] in more stuff." Um they built they're [8:23] building a shed 30 ft by 15 ft uh with [8:26] no permit. Uh PNZ has been out to see [8:30] this and now has acknowledged there's [8:31] new material that wasn't there from [8:33] their last report. In conclusion, we've [8:36] all come to the conclusion, all the [8:38] neighbors, and I believe P&Z, that this [8:40] is an ongoing business. It's a [8:41] scrapyard. It's a junkyard. Scrapyard [8:44] has been in business for years. It is [8:47] their source of income. Um, scrap comes [8:50] in, scrap goes out, scrap comes in, [8:52] scraps out. We have to assume it's being [8:54] sold. Uh, they have worked hard to get [8:57] the flammable material out, but the [8:59] business will remain. And we hope that [9:01] by the end of this, whatever the [9:03] conclusion, however this is resolved, we [9:06] hoped very very much that there will be [9:09] something in writing in the clean and [9:11] lean that says that you all have the [9:14] right to come and inspect every four to [9:16] 6 months to ensure that this business [9:18] has been ongoing for over 30 to 40 years [9:22] does not continue to go once they feel [9:24] they have met the requirements of the [9:26] clean and lean because this is their [9:28] source of income which is fine. It's a [9:30] residential neighborhood and maybe in [9:32] the old days when it wasn't so urban, it [9:35] was fine. But now they need to take the [9:37] money that they've made from other land, [9:39] sell it, and go somewhere else to run [9:42] their business and live peacefully as [9:43] our neighbor. And one thing we can agree on [16:20] is uh an entrance further to the north [16:24] on on Corales Road because you know [16:27] there was uh a statement made by the PNZ [16:31] uh administrator when we had our first [16:34] um appeal back in 2023 and we were told [16:37] that uh the New Mexico Department of [16:40] Transportation would never grant uh [16:42] variance. [16:44] Time out. Not true. The New Mexico [16:46] Department of Transportation is located [16:48] at 1120 Cerillios Road in New Mexico in [16:52] Santa Fe, which is another name for [16:54] Highway 14. In fact, the entire basic uh [17:00] commercial district of the city of Santa [17:02] Fe is on a variance. Whether you want to [17:04] go to the Elcourt Motel or you want to [17:06] go to Whole Foods Market, get some art [17:08] supplies at Artisans or buy some good [17:10] food in Marisos, those businesses have [17:13] all been granted a variance. That is [17:16] highway 14 from all the way from uh [17:20] Department of Transportation [17:22] through uh Rodeo Road all the way up to [17:24] where it ends in in uh in Gali Stable [17:27] Road. So I think that uh we should uh [17:30] take a look at the parallel that we have [17:32] our same situation here that this is a a [17:35] state highway and we're being told well [17:37] there can be no variances granted. Well [17:39] variances have been granted to the point [17:41] that that's how uh economy of Santa Fe [17:44] is still sustained. [18:53] Mayor Hashimoto and councel, we have [18:56] been recently made aware due to the [18:58] inclusion on the agenda that the [19:00] property owner Robert Hobbs of 3605 [19:02] Corales Road has withdrawn his site [19:04] development plan 2603 amendment as [19:08] following public site development plan [19:10] hearings. The matter was appealed to the [19:12] village council which determined that [19:14] the proposed increase in intensity [19:17] required further review and remanded the [19:19] application to the planning and zoning [19:21] commission. The applicant then withdrew [19:23] the request and elected to proceed under [19:26] the previously approved original site [19:29] development plan. The owner cannot [19:31] obtain by withdrawal what could not be [19:34] obtained through approval. By [19:37] withdrawing the amendment to modify, the [19:38] applicant remains subject to the [19:40] original site development plan and all [19:43] conditions associated with that [19:44] approval. The withdrawal of the [19:46] application cannot serve as [19:48] authorization for site improvements, [19:50] operations, or uses that differ from the [19:53] approved plan. It has become apparent [19:55] that the site as currently constructed [19:57] and operated may not fully conform to [20:00] the approved SDP plan [20:03] and its conditions. Accordingly, I [20:06] request the village conduct a [20:07] comprehensive compliance review and [20:10] require conformance with all elements of [20:13] the approved plan, including but not [20:15] limited to restoration and construction [20:18] of all site improvements not shown on [20:20] the original approved STP. Remove the [20:23] shipping container, shed, storage, [20:25] fencing, concrete slabs, outdoor gazebo, [20:27] all were added without proper [20:29] permitting. replacement of the [20:31] screening, the walls, the fencing, the [20:33] landscaping and buffering elements that [20:35] were existing on that original plan, but [20:38] subsequently removed, altered or never [20:41] installed. Replacement of a 6' high [20:44] solid wood fencing at the north portion [20:46] of the property. Tree replacement as [20:48] shown on the landscape plan. Restore a [20:51] six-ft high wire fence on Corales Road [20:53] from the wood fence south. Then extend [20:56] east on Metoark. Remove the access drive [20:59] around the pond. Restore the required [21:01] runup capacity and maintenance of all [21:03] drainage, grading, and storm water [21:05] management improvements required by the [21:08] original approved STP. Compliance of all [21:11] approved hours of restaurant operation, [21:14] 8:00 a.m. to 5:00 p.m. Monday through [21:16] Friday, as shown on Mr. Hob's original [21:19] application. His original application, [21:22] hence the approval from from PNZ [21:25] originally was specifically that states [21:28] for one small delicatessan. Hours of [21:31] business are 8:00 a.m. to 5:00 p.m. [21:34] There will be no open cooking in the [21:35] delicatessan and the idea for Belle's [21:38] deli liquor license was dropped during [21:41] the original discussion and was never [21:43] approved. [22:14] As a resident of Palis for over 40 years [22:17] and as an appealing party in a quasi [22:19] judicial proceeding recently heard by [22:21] the council in the special meeting on [22:22] June 2nd, I want to express my concerns [22:25] of bea on behalf of myself and the other [22:28] appalants regarding the process followed [22:30] particularly with regard to notice and [22:33] adequate documentation of the proceeding [22:35] and of subsequent events. In the hearing [22:37] on June 2nd, we were led to believe that [22:39] there would be insufficient time for the [22:40] BNZ to review the conditions set forth [22:43] in the council's decision and it would [22:45] most likely be heard at the council's [22:47] regular meeting on June 23rd. With that [22:50] in mind, the opponents were surprised to [22:51] learn that the findings of fact and [22:53] conclusions of law would be on the [22:55] agenda for re review at tonight's [22:57] meeting and that the amended STP which [23:00] was the subject of the appeal had been [23:02] withdrawn by the apply Mr. Hobbs. that [23:05] information was included in [23:06] administrator's report in the agenda [23:08] packet. Another issue of concern is that [23:10] the minutes of that appeal hearing do [23:12] not adequately reflect the testimony and [23:15] evidence presented for appropriate [23:16] documentation of the proceeding and in [23:19] fact refer to an incorrect STP in the [23:21] motion presented. Further, the [23:23] withdrawal of STP 2603 should be [23:25] presented to the counselors as part of [23:27] the appeal proceeding itself and does [23:30] not in and in and of itself relieve the [23:33] Appal League from his responsibilities [23:35] under the original SDP. I present these [23:38] concerns for your consideration in [23:40] addressing items number one and three on [23:42] the agenda for tonight's meeting. So, [25:04] um, so anyway, I hope that we all could [25:06] always be good neighbors to each other. [25:08] Um, I would like to add my, uh, support [25:12] my neighbors that just came up here and [25:13] spoke. I'm also on East Bedark and I [25:16] share their concerns about the property, [25:19] um, at the corner there of the corner of [25:21] Corales Road. Um, but one thing I also [25:23] wanted to mention, recently I've been to [25:25] meetings regarding a liquor license, [25:27] regarding an appeal, um, all kinds of [25:29] things. And it's a great learning [25:31] process, but sometimes it's frustrating [25:33] because it seems that there's [25:35] inconsistencies or there are rules that [25:38] are hard to understand, especially with [25:40] regards to quasi judicial or quasi [25:42] legal. I forgot what the official term [25:44] is. Um recently um at an appeal um [25:49] attendees were told that only the [25:52] appalants would be allowed to speak but [25:54] then afterwards someone said to me where [25:56] did they get that rule from? That's not [25:58] true. You were part of the initial [25:59] hearing you were also allowed to speak. [26:02] So sometimes there's frustrating things [26:04] like that that happen. Sometimes it [26:06] appears that um sorry like the [26:08] administrator sometimes you put your [26:10] finger on the scale in the way things [26:11] are presented and you should be [26:13] impartial like that shouldn't happen. So [26:15] that's frustrating. Um and also recently [26:19] at the liquor license hearing God it's [26:21] hard to say this in front of everyone. [26:23] Okay. Um there one of the council [26:25] members um accused people that were [26:27] opposing the liquor license. Um there [26:30] was talk about people intentionally [26:32] being misleading and lying and [26:35] particularly under oath because you have [26:37] to swear an oath when you speak at a [26:39] quasi judicial process. In the end after [26:42] the meeting it was all cleared up. It [26:44] was a misunderstanding but in the [26:46] meantime that accusation stuck. It [26:50] stayed there that people that were [26:52] exercising their right and speaking out [26:54] against something were kind of accused [26:57] of of being misleading and lying. [28:20] On a frequent basis, [28:22] I have a close encounter with a vehicle [28:24] coming around that blind curve as I exit [28:27] onto Coral's road or cross to pick up my [28:31] mail. [28:33] On a frequent basis, I get harassed for [28:35] slowing down to turn into Mountain [28:37] Delay. [28:39] On a frequent basis, I think to myself, [28:42] one of these days, [28:45] this has been going on for over 45 years [28:48] that I've lived on Mountain View Lane, [28:51] except that it's happening more [28:52] frequently. [28:54] I have witnessed several dozen [28:56] accidents. [28:58] Two utility poles taken out, a gas [29:02] meter, leaking gas with a wrecked car on [29:04] top of it, fences and walls knocked [29:08] down, and even dead people. [29:12] I am here to request that the Corellus [29:14] Police Department effectively [29:18] effectively [29:20] increase their presence and enforcement [29:23] of the speed limit on our portion of [29:26] Corales Road. Somebody ran over it [30:48] and uh you know, we'd really like to [30:50] have some police presence down there. Uh [30:53] we do see it occasionally at the tree [30:56] farm. Uh the other day I went down [30:59] Lomalara and I seen three police cars at [31:01] different areas. But I'm sure uh you [31:05] know Lomalara doesn't have uh probably [31:09] 10% of the traffic we have in Coralis [31:11] Road on that side. So it'd really be [31:16] nice to have some police presence down [31:18] there and uh slow down that traffic. Uh, [31:23] we also had an event down there. I guess [31:27] it's been a month and a half ago where [31:29] we'd had trucks. I don't know what the [31:33] the regulations for truck traffic is on [31:36] Corales Road, but we had non-stop truck [31:39] traffic for a month and a half down [31:42] there. The big the big trucks moving [31:44] back and forth. Probably 80,000 pounds [31:48] of load on on those trucks. I know the [31:50] highway wasn't made for that. Either was [31:53] Lalara. They were coming from the 528 [31:56] project in Rio Rancho coming down road [32:01] and they were going somewhere over by [32:02] the old church and back and forth all [32:06] day and it it's pretty annoying. Uh and [32:10] uh it's just one of those things. And [32:12] another thing that we need some [32:14] enforcement on is these new uh the trash [32:18] trailers. I mean, just today I was [32:21] working out in my field. I counted in [32:24] two hours. I counted five of these trash [32:27] trailers. I don't know if you know what [32:28] I mean. They're uh they seem like [32:31] they're everywhere. Every every [32:33] contractor has one now, but they're all [32:35] going to the county dump and it's [32:38] nonstop. Some days it's non-stop. [32:41] Some guys have their loads tied down, [32:44] but I have picked up a lot of trash off [32:47] the highway in front of my house from [32:48] stuff just bouncing off those trailers. So any land [33:54] owners interested in placing their [33:56] property in a conservation easement, [33:58] please reach out to the village um about [34:01] that process. So you can find the [34:03] application on the village website. It's [34:05] also you can go to the admin office and [34:07] get it. You can return it in person or [34:09] email it back. Um and then the the [34:12] process will begin from there. Um, this is one of the only [34:25] programs that the village offers to [34:28] support farming in Corales. So, please [34:30] take advantage of it. We are [35:51] dead center on the infamous blind curve. [35:54] There has been much property damage over [35:56] these years, including fence damage, gas [35:59] meters having to be relocated, [36:02] mailboxes being run over, power poles [36:04] being knocked over, and also some [36:07] fatalities. [36:10] The yellow arrow signs put on the curb [36:12] by the highway department in front of [36:14] our property have even been mowed down. [36:17] The work done by the village government [36:19] so far is is much appreciated. And I can just I [38:07] can see that and say, "Okay, as long as [38:09] it's clear, I got enough time to get up, [38:11] get my mail, and get out of there." Uh we [53:22] actually had a uh two uh firefighters [53:26] come out and do a fire inspection uh to [53:28] back up the uh uh business license [53:31] application for uh animal rescue group [53:34] for harvest festival today. And they [53:36] were terrific. And uh it's just [53:38] emblematic of what this what this [53:40] village has. And perhaps uh Melanie, you [53:43] could talk about the history of where [53:45] you said it's it's taken many many years [53:46] to get to to this level. Yeah. [53:48] » And what it really means for [53:51] for our employees. [53:52] » Yeah. So so what this means is now uh [53:54] the police and fire department are at [53:56] the highest level. When when they [53:58] retire, they will get the maximum amount [54:00] available to them. Um, so if somebody [54:02] were to start now and they worked the [54:04] the right number of years, they [54:07] theoretically could retire on 100% of [54:09] their their highest salary when when [54:12] they do retire. So our our current [54:14] employees who have been with us a long [54:15] time, they they they get different [54:17] buckets. So they get the the buckets [54:19] that they earned when we were under, you [54:21] know, plan one and plan two and then [54:22] plan three. We're skipping plan four and [54:25] now we're going to plan five. So, this [54:27] this really um will take care of our our [54:29] firefighters after they've they've [54:31] completed their careers here with us and [54:33] and our police department. Sorry, Chief. [54:36] Didn't didn't mean to forget you guys. [54:38] Um so, police and fire. Um and also this [54:41] this process for these five resolutions. [54:46] We started this exa almost exactly a [54:48] year ago. So the I was looking back at [54:51] my emails last night and this kicked off [54:53] I believe July 7th of last year with [54:55] with um Deputy Chief Latin had sent an [54:58] email to our PAR representative and said [55:01] how do we start this process and we have [55:03] multiple emails back and forth of you [55:05] know this is what you need to do and [55:06] then we would wait for them and this is [55:08] what you need to do. So we would send [55:09] them you know our um our drafts and then [55:12] we'd have to wait a couple of weeks and [55:14] then we'd get those back. So yeah, just [55:16] just this portion has been a year in the [55:19] making. [55:20] » But this also affects uh the village [55:23] employees. [55:24] » Yes. Right. [55:25] » Yep. [55:32] » So yeah, they um so the the the [55:34] remainder of the village employees that [55:36] are under municipal plan two um [55:39] unfortunately plan two is the highest we [55:41] can go for our municipal staff. They [55:42] they do offer up to plan four, but they [55:44] locked out plans three and and four a [55:46] long time ago before the village um had [55:48] the opportunity to um take advantage of [55:50] that for our municipal employees. So, uh [55:53] what what we're doing for our municipal [55:55] staff is the village is picking up a [55:57] portion of their um their contributions. [56:00] So that this will will pick up the [56:03] contributions for police and fire so [56:05] that they they don't pay any more into [56:08] or they they aren't having deducted from [56:10] their paycheck anymore than they [56:11] currently are under plan three. So the [56:13] village is picking up the remainder of [56:15] that. And then for municipal staff, [56:18] they're dropping from the 12 point I [56:21] think it's 12.65% [56:23] down to about 9%. And you know, and I [56:26] know when you look at the resolutions, [56:27] it looks weird because it says, you [56:29] know, we're picking up 48%, but it's a [56:31] percentage over a percentage. And I had [56:32] to break out my math brain and go back [56:34] to, you know, high school algebra and be [56:36] like, okay, I'm doing a percentage of a [56:38] percentage. And, um, we had some [56:40] discussions back and forth about what [56:41] was the proper way to do that. So, um, [56:43] but yeah, no, this has been a very long [56:45] process. And this was the the dream back [56:49] when they very first, um, voted for PRA [56:52] 19 years ago. So, for and as part of [56:56] many other reasons. [56:56] » You hear their presence right now. And as I wrote in the mayor's [57:04] report, New Mexico is number one and and [57:07] u uh property crimes number two in [57:10] violent crimes. And fortunately, Corales [57:12] is number one probably in the state and [57:16] having a good crime record and and a big [57:18] part of that is probably our public [57:20] safety, our police, and our fire [57:22] departments. Uh, and so I think they um [57:25] they they really make us a a place to [57:28] live. Um, and I think doing giving them [57:32] an increase in their parah helps [57:34] retention. I mean, that's a big thing. [57:36] You know, we're competing with [57:37] municipalities who have more bucks than [57:40] we do. [57:41] » And to to keep our [57:44] roles of public safety employees, you [57:48] know, we have to compete somehow and [57:49] sometimes we can't compete salary wise. I believe it [1:08:56] belongs somewhere either in 1492, which [1:08:58] is the I think the uh current legal or [1:09:02] where things are cited, but it needs a [1:09:05] little bit of work. Uh, I'm not totally [1:09:08] agree. I mean, I don't totally disagree [1:09:10] with all the language, but I think it [1:09:11] just needs to be reorganized and put [1:09:13] into 1492 rather than under 1839. [1:09:17] Also, uh there are concerns I have about [1:09:20] the uh changing the seating ordinance [1:09:24] because there are some issues there that [1:09:26] uh we haven't addressed. That is that [1:09:29] one, you're asking to amend the seating [1:09:32] ordinance and not repeal the previous [1:09:34] one. So either we need to repeal the old [1:09:37] ordinance and insert this one as new [1:09:40] language because if we don't we're going [1:09:41] to have confliction because you've got [1:09:43] an old ordinance and a new ordinance and [1:09:45] there's conflicting uh components of [1:09:48] both if you have both of them at the [1:09:50] same time. So I think we need to repeal [1:09:53] the original 1839 C2 and then insert the [1:09:56] new language at that point. You also [1:09:58] need to grandfather in the existing STPs [1:10:02] because if you don't, then if somebody [1:10:04] asks an amended STP, they're going to [1:10:07] have to come in under the new language. [1:10:09] And is that fair for our businesses that [1:10:11] if they have to want to amend their SDP [1:10:14] that now they have to comply with the [1:10:16] new seating ordinance and the parking [1:10:19] versus the old one that they originally [1:10:21] got their uh site development plan [1:10:23] under? So, there are some things there I [1:10:26] think need to be addressed. I I know [1:10:29] this. I worked on this about all [1:10:30] afternoon trying to figure out how to [1:10:32] reorganize this and it's and councelor [1:10:35] Bquerette will kill me because I got 14 [1:10:38] different amendments that I need. That does bring up the [1:11:06] question about we were putting one uh we [1:11:09] were creating a paragraph 15 that was to [1:11:12] go in under 1492 [1:11:14] and I think we just need to create a new [1:11:16] subsection that deals with enforcement [1:11:19] and that way it doesn't there was an [1:11:21] issue where you might have an officer [1:11:23] who might site somebody and then he [1:11:26] could have his vehicle towed at the same [1:11:27] time. Now is that correct? I don't know, [1:11:30] but I think we need to take a look at [1:11:32] that and just uh I think there are [1:11:33] things there that we just need to [1:11:35] resolve before we put this into an [1:11:36] ordinance. One is on [1:11:45] this what you're talking about as far as [1:11:47] the [1:11:48] um parking per two chairs. Um I don't [1:11:52] think it I don't think it's a reasonable [1:11:54] number. Um, I went to two of our [1:11:56] probably most reputable establishments [1:11:58] in town. From a parking standpoint, I've [1:12:00] never heard a single complaint about [1:12:02] overflow parking. Um, one of them has a [1:12:04] 100 seats and 25 parking spots. Um, the [1:12:08] other one has 70 parking spots and they [1:12:10] have I didn't go inside this place, but [1:12:13] they have in my mind probably close to [1:12:14] 200 seats. Um [1:12:18] there is no way that if they were to try [1:12:20] to come into the village and again these [1:12:22] are model citizens, model businesses, [1:12:25] there is no way they could come into the [1:12:27] village and meet these criteria. Um so I [1:12:30] just don't think it's a reasonable [1:12:32] number. um on a grander scale um and I [1:12:36] actually think this is a very [1:12:36] well-ritten policy and I think it's [1:12:38] something we may have to go to but I [1:12:40] would love to see I mean I think there's [1:12:42] these spectrums that we have to look at [1:12:44] when we're looking at all of our [1:12:45] policies friendly unfriendly using [1:12:48] resources that we have now versus going [1:12:50] to get new resources uh unintended [1:12:52] consequences versus limited unintended [1:12:55] consequences and I think we have to have [1:12:56] the desire to do the stuff on the left [1:12:58] left side of the spectrum whenever [1:13:00] possible uh and probably an obligation [1:13:02] to do that. And we have empty lots in [1:13:04] the village that we're doing site [1:13:06] development plans on that I would like [1:13:08] to see those site development plans [1:13:10] happen prior to us enacting anything uh [1:13:13] new on parking with parking on those and [1:13:17] with signs that say village parking so [1:13:19] we can see if that relieves the parking [1:13:21] pressure because even if it relieves it [1:13:23] 75% then maybe we need a different [1:13:25] version of this. But if we have empty [1:13:27] lots sitting next to businesses and I [1:13:30] feel like we owe the citizens, we owe [1:13:31] the businesses um a solution and it's [1:13:34] sitting right there with really limited [1:13:36] stuff and we're working on these site [1:13:37] developments already that um we're not [1:13:40] doing our job if we're not putting [1:13:41] parking on some of those and giving [1:13:43] people a friendly an option without [1:13:46] unintended consequences um to solve this [1:13:49] problem before we put up signs all over [1:13:50] the village. So, I would move that if we [1:13:52] do move this thing forward, I'm going to [1:13:54] want to amend it to where we don't do so [1:13:57] until we have those site development [1:13:58] plans with parking in place and we see [1:14:00] if that solves the problem. [1:14:04] I'd like to bring up an issue too of um [1:14:08] uh [1:14:10] couple things that weren't addressed in [1:14:12] in this version uh had that have been [1:14:15] brought up before is where do you have [1:14:17] the signs? What do the signs mean? Um, [1:14:20] and also if council bur wants to hold a [1:14:24] barbecue party at his home, uh, where [1:14:27] can those people park? Uh, this [1:14:29] ordinance doesn't allow that. Um, [1:14:33] I'll just throw something out just just [1:14:35] for, you know, discussion. um that maybe [1:14:40] um talking about the neighbor commercial [1:14:42] zone uh you have a sign no park [1:14:46] residents parking only coming into the [1:14:49] street from Corales and 300 ft back you [1:14:52] have another sign that addresses the [1:14:55] traffic coming into so you have incoming [1:14:58] traffic on that residential road you [1:15:01] have no parking signs between those [1:15:03] signs coming in from Carales Road and [1:15:05] coming in from interior drains. Say [1:15:08] there'll be a new no parking uh sign 350 [1:15:11] ft deep uh along that road. Uh another [1:15:16] another issue is is um you know uh [1:15:20] having [1:15:22] uh council burst barbecue party or [1:15:24] anybody else's um you know I wonder [1:15:28] whether there should be an allowance for [1:15:30] guests of of a resident and um I think [1:15:35] it's really simple and actually this [1:15:37] afternoon I I mocked up a [1:15:40] a little sign here [1:15:42] and something like This can be put on [1:15:46] the dashboard of the car and basically [1:15:49] it says guest. You're a guest of a [1:15:54] resident who lives there. The resident's [1:15:56] address is here right below guest. So if [1:15:59] anybody has a question who is the host [1:16:01] of the guest, the address is right [1:16:03] there. There's a permit number. Um maybe [1:16:42] through the website that we currently [1:16:44] have or using a separate vendor links to [1:16:47] the website and or you know a very [1:16:50] simple thing is uh a resident can just [1:16:53] write this out. I mean it's just the [1:16:55] number of data is very small. It's a [1:16:58] guest. It's got my address there. If [1:17:00] anybody has a question there's my [1:17:03] address. I'm home. The the license plate [1:17:06] number, the descriptor of the car, and [1:17:08] the date. I mean, that it's just I I [1:17:12] think it it's an easy way to accommodate [1:17:14] having guests. So, I think just to throw [1:17:16] that in the mix of as we discussed a no [1:17:19] parking ordinance, uh there a lot of [1:17:21] different components of this where there [1:17:23] you know go to seating um number of [1:17:26] parking places per seats, tables, that [1:17:29] sort of stuff. um uh no parking on [1:17:32] residential streets. Uh I think one or [1:17:37] two things that have been brought up is [1:17:38] you know where the science place and [1:17:40] what about gas and and I think I just [1:17:42] like to throw this out to add to the [1:17:45] discussion of you know how we how we [1:17:48] design uh a no parking in uh residential [1:17:52] areas uh ordinance. Yes, councelor [1:17:54] Murray. Well, so to add to that, my son [1:17:56] lives up around the wheel Wilshire in [1:17:58] Jefferson and during Bloomfest, they [1:18:00] close off Jefferson, but they have a [1:18:03] placard that gets issued by the Bloom [1:18:05] Festa. Basically just says gives them [1:18:07] permission as long as you got that [1:18:08] placard in your windshield, you're [1:18:11] allowed into the area. It it doesn't [1:18:13] require any [1:18:15] addresses, doesn't require any uh [1:18:18] information about the car, but as long [1:18:19] as you got that placard, you're allowed [1:18:21] into that area. That's that's all we [1:18:23] have to do. We could even include just [1:18:24] say dates, you know, three days or [1:18:28] whatever it is, date one, you know, it [1:18:30] could be June 1st through June 3rd. I [1:18:32] think that would probably cover it, but [1:18:33] that'd be myology. [1:18:35] » Um, if if I may, mayor and council, um, [1:18:37] I I have been looking into different [1:18:39] solutions for this. Um, we we did ask [1:18:41] our attorneys to weigh in on, you know, [1:18:44] the the legality of residential parking [1:18:47] only. and their recommendation is that, [1:18:50] you know, from a a legal perspective, we [1:18:53] should have some sort of permitting [1:18:55] process. And so I've I've have had two [1:18:58] meetings so far. Um, one with a company [1:19:01] called um Shau, and they they do um [1:19:06] sort of a uh build from scratch parking [1:19:10] solution. And so they they would be able [1:19:12] to create a a website, a app, whatever [1:19:16] we want that would be able to do these [1:19:18] parking permits where people could to do [1:19:20] could register for them online. However, [1:19:23] it would take up to 6 months and $60,000 [1:19:27] to do that. Yesterday, I had a meeting [1:19:29] with a company called Honk, um which you [1:19:32] know, it's just it's kind of fun to say. [1:19:34] um their recommendation when I explained [1:19:36] what the situation was is the guy's [1:19:38] first question was do you have public [1:19:41] parking available somewhere in the [1:19:43] village. So that was his first [1:19:44] recommendation. Um second recommendation [1:19:46] is they can do something for us but um [1:19:50] the way their app works is you have to [1:19:52] have paid parking and that's how the the [1:19:54] app gets paid for. So, we would we would [1:19:56] then have to we we could do a solution [1:19:58] where if a resident could prove that [1:20:01] they live in the village, they would [1:20:02] have to pro provide their car [1:20:04] registration, which I don't know that [1:20:05] anybody would want to do, but they would [1:20:07] have to prove somehow that they're a [1:20:09] resident of the village and then they [1:20:10] could have free parking. Um but then I [1:20:13] have another um another meeting [1:20:16] scheduled for tomorrow. So, that's just [1:20:17] sort of what I'm learning so far. So, [1:20:19] there are options to be able to do this [1:20:22] this sort of thing. Um, but it just [1:20:25] depends on how much we want to pay for [1:20:26] it. [1:20:27] » That's so nice. That that section already [1:21:56] exists and people who have commercial [1:21:59] site development plan applications are [1:22:02] referred to that section. And so what it [1:22:04] would now say commercial parking on [1:22:07] residential streets upon notice by code [1:22:10] enforcement or when warranted by ongoing [1:22:13] public safety concerns. So, we're [1:22:15] talking about ongoing chronic issues [1:22:19] really having to do with commercial [1:22:20] parking um and residential streets. In [1:22:24] those instances, the village [1:22:25] administrator may direct that any part [1:22:27] of a residential street be posted with [1:22:29] signs reading no parking. [1:22:32] This will be used judiciously and in a [1:22:35] limited fast fashion. Um, Carllis PD [1:22:38] will have their full discretion as to [1:22:41] how to handle a situation. Um, [1:22:45] I I just want to assure you that it's [1:22:46] it's really a limited scope. We're we're [1:22:49] not talking about the neighborhood [1:22:51] barbecue or oneoffs. We're talking about [1:22:54] chronic ongoing issues. If there was a [1:22:56] neighborhood that had some sort of [1:22:58] chronic ongoing issue with a say a home [1:23:01] occupation, it might be suitable in that [1:23:03] case. But again, it would have to be [1:23:05] upon notice by the code enforcement [1:23:07] officer or EMS that there's there's this [1:23:10] issue and it won't it won't quit and we [1:23:12] need to look at it there and then the [1:23:14] administrator would have to agree. So, I [1:23:17] just want to assure you it's not going [1:23:18] to be blanketing the village with signs. Um, and we seem to [1:24:46] forget that the rural feeling we are all [1:24:48] trying to sustain doesn't have [1:24:50] sidewalks, which none of us, including [1:24:52] me, do not want to see, but walking long [1:24:55] distance is not always practical. That [1:24:57] our rural field can be sustained and [1:25:00] still include those that are not [1:25:01] residents. [1:25:03] And since we don't have a plan yet [1:25:05] except for bathrooms for the Gonzalez [1:25:07] Field, um if we even could put temporary [1:25:10] parking there and see how that works [1:25:12] because that was kind of what was [1:25:13] mentioned by a lot of you. [1:32:36] Restricting parking without adequate [1:32:38] alternatives could reduce customers [1:32:40] access and create unnecessary challenges [1:32:42] for businesses. It will contribute to [1:32:45] the character and economic vitality of [1:32:46] Coralis. If the village believes parking [1:32:50] changes are necessary, I encourage the [1:32:52] council to work collaboratively with [1:32:54] business owners to identify particular [1:32:57] solutions before implementing [1:32:58] restrictions. Um, in addition to the email [1:33:46] and the photos that I sent you recently, [1:33:49] uh, I would like to add to the list of [1:33:51] safety concerns already mentioned that [1:33:54] residents and business owners are not [1:33:57] trained to deal with the general public. [1:34:00] And that is what we're seeing an [1:34:02] increased influx of the public coming [1:34:05] into our village into our neighborhoods. [1:34:09] Uh it is dangerous in this day and age [1:34:11] to approach anyone and ask them to maybe [1:34:14] move their car because they're blocking [1:34:16] our driveway, blocking our trash pickup, [1:34:19] blocking our access to our trailer when [1:34:22] we're taking our green waste. Those [1:34:24] kinds of things are now dangerous [1:34:26] because we don't know always. they're [1:34:29] not maybe our neighbors. Uh so there's a [1:34:33] there's a real need for prof we need [1:34:35] professional help [laughter] in more [1:34:37] ways than one. But uh we do need our law [1:34:41] enforcement to help us on these times [1:34:45] when we feel very vulnerable and [1:34:47] exposed. We should not be asked to do [1:34:50] this on our own. We don't have the [1:34:52] skills. Um, no parking signs are the key [1:34:57] to the law enforcement. They are [1:35:00] universally understood. So, people [1:35:02] coming from other communities, they get [1:35:05] it and we all understand it. And if [1:35:08] we're talking about guests parking in [1:35:10] front of my house, well, if even if I [1:35:13] wanted to have a few friends over, if [1:35:15] the business overflow parking is is all [1:35:18] in front of my house, there's no room [1:35:20] for my guests to park either. So, what [1:35:23] we do is we always stack people in our [1:35:25] driveway and sometimes we move our cars [1:35:29] down the road. We'll ask a neighbor, [1:35:30] "Can we use one of your parking spots or [1:35:33] two for our cars so we can fit more on [1:35:35] our property?" There are ways of dealing [1:35:38] with this as residents. Is it a [1:35:40] sacrifice? Sure. Is it an adjustment? [1:35:43] Sure. Do we accept it because we support [1:35:46] local business? You bet. It's worth it [1:35:49] and it's a unique situation, but it's [1:35:52] the most important thing is that the [1:35:54] children on my street are safe. They can [1:35:57] get to the mailbox. They can walk across [1:36:00] to the pool, to the soccer fields. And [1:36:02] that is the most important issue here. [1:36:06] Consequences are is of not doing [1:36:09] anything is that something tragic will [1:36:12] happen eventually. Let's not wait for [1:36:14] that. Our community does not need that [1:36:17] black eye. We do need to make an [1:36:19] adjustment. It's it's responsible growth [1:36:23] and we can do it. And there are [1:36:25] sacrifices that need to be made for [1:36:28] public safety. And our our law [1:36:31] enforcement needs the clear distinct [1:36:34] signage to enforce the law. Now if it has to be I don't [1:37:41] know what the depth is beyond uh Corales [1:37:44] road that the village can access [1:37:47] lighting and not interfere with this [1:37:50] next do but there's got to be some way [1:37:52] that we can we can handle that people [1:37:54] are people are safe. that's separate and [1:37:56] apart from the really critical issue of [1:37:58] crossing Carellis Road. But [1:54:41] » And an issue I think is that PNM charges [1:54:46] a fairly high amount to run the line [1:54:49] underground whereas to run it overland [1:54:53] is a lot less expensive. And so, you [1:54:55] know, we're probably probably going to [1:54:57] be seeing more overhead line requests [1:55:01] come in um uh because people feel they [1:55:05] can't afford to go underground. [1:58:24] Uh two weeks ago, we had a cottonwood [1:58:26] tree come off um on a private property, [1:58:29] fall down, pulled the overhead power [1:58:31] line to the service head off the house, [1:58:34] shorted out. um kind of smoldering in [1:58:37] the box and luckily the the house didn't [1:58:40] burn down. Um so [1:58:44] hearing that they're doing everything [1:58:46] they possibly can to make it safer in a [1:58:48] customer-owned pole. Counselor, thank [1:58:50] you for suggesting that the tree be [1:58:51] removed. Ultimately, this is your [1:58:53] decision. This is their right to appeal. [1:58:55] Uh but I think we could do better by [1:58:57] making sure that even if it is a [1:58:58] customer-owned pole and the utility is [1:59:01] going to be overhead that the owner of [1:59:04] the property or if the property sells [1:59:08] that it's you know that they have to [1:59:09] maintain a clear area around that [1:59:12] service and not plant trees underneath [1:59:13] the power lines because they're just [1:59:15] continuous you know it's a continual [1:59:17] problem in the village. So thank you. [1:59:20] And the problem there is, you know, how [1:59:22] do you maintain that? You know, that's [1:59:24] not a village easement and they're not [1:59:25] going to give us that land. And if the [1:59:28] owner decides to plant a cottonwood tree [1:59:32] under it, uh what recourse do we have? [1:59:35] Correct, mayor. Uh you're absolutely [1:59:37] right. Right. I mean, I I don't know how [1:59:39] we can enforce it other than uh doing [1:59:42] our due diligence, PSAs, advising [1:59:45] homeowners to if they have trees on [1:59:47] their private property that enforce, you [1:59:49] know, reminding them it's their [1:59:50] responsibility. My understanding, I [1:59:53] could be wrong, but when PNM [1:59:56] takes that their triplex or whatever [1:59:58] service line from their pole to a [2:00:01] customerowned pole or to the house of [2:00:04] residence, that is the responsibility of [2:00:07] that homeowner. And a lot of homeowners [2:00:09] don't understand that. And um I I I just [2:00:13] think, you know, we could do a better [2:00:14] part in trying to educate them that if [2:00:17] they do have trees that they're trimmed [2:00:19] regularly. and uh maintained. [2:01:41] » And mayor and members of council, it [2:01:42] reminds me of something that you had [2:01:43] said prior to this meeting, which is [2:01:45] that the enforcement portion of the code [2:01:47] is kind of an area that I think really [2:01:49] bears looking at. Um and I think sort of [2:01:51] in tandem I'm looking at um 1830 that [2:01:54] subsection Q that talks about these [2:01:56] communication and electrical [2:01:57] distribution lines. Um, and it really [2:01:59] doesn't address in a meaningful way [2:02:02] anything to do with vegetation and [2:02:04] obstruction of the lines. Um, you know, [2:02:06] there are a lot of things that are sort [2:02:08] of notably absent from this in terms of [2:02:11] if we wanted to be able to, you know, [2:02:13] look out over somebody's property and [2:02:14] see that there's a tree back there. Um, [2:02:17] you know, there's really no mechanism at [2:02:18] this stage other than saying, "Hey, we [2:02:19] see that that tree is awfully close to [2:02:21] your power line. You might want to [2:02:22] reconsider that." Um, and that's kind of [2:02:24] where we're limited. Um so it may be [2:02:26] worth taking a look at that code in in [2:02:28] tandem with taking a look at enforcement [2:02:29] provisions and seeing you know is this [2:02:31] something I mean obviously one of the [2:02:33] reasons that this is here is that um the [2:02:36] biggest concern is public safety uh and [2:02:38] if there is a meaningful way to get [2:02:40] underground access u because it would be [2:02:42] a better benefit to public safety. I [2:02:44] mean I think we just heard Chief tell us [2:02:45] that. Um, [2:02:47] so I I mean it may not be strictly [2:02:49] necessary except for those lots where [2:02:50] they already have overhead lines sort of [2:02:53] running through them, running near them, [2:02:54] adjacent to those lot lines, you know, [2:02:55] where you might be considering [2:02:58] granting this sort of with conditions, [2:03:00] right? Uh, I'd like to work, you know, [2:03:48] with our code enforcement, planning and [2:03:51] zoning, and also, you know, maybe we can [2:03:54] parallel [2:03:55] um the P&M's, you know, vegetation [2:03:57] management so we can help each other. [2:04:00] So, when they're coming through and [2:04:01] cleaning up their power lines or [2:04:03] distribution lines, we're also doing our [2:04:06] enforcement at, you know, on the ground, [2:04:09] educating the public and trying to come [2:04:10] up with some of the rules to help us [2:04:13] make our community safer. you know, some [2:04:14] of the major fires in New Mexico have [2:04:16] been power lines going through national [2:04:18] forest and that that the cleared area [2:04:21] wasn't wide enough so that was when [2:04:24] there was a problem sparking whatever it [2:04:25] was, it touched off these major [2:04:27] wildfires. [2:04:28] » So using that as somewhat of a model and [2:04:31] some of the California experiences.
