Tax map number is 25A-1-4 [4:09] in district 1. The subject parcel was [4:12] originally created by a division plat of [4:14] Belmont acres which was recorded in 1947 [4:17] and therefore predates the zoning [4:19] ordinance and the Chesapeake Bay [4:21] preservation ordinance. The majority of [4:23] the lots in the subdivision are roughly [4:25] an acre or less. The access road Belmont [4:28] Creek Road is a private 20 foot wide [4:30] gravel drive. [4:32] The [clears throat] [4:33] applicant's property is approximately [4:35] 1.1 acres in fronts on the westerly side [4:38] of Belmont Creek Road and on the [4:39] easterly bank of the Rapahhanic River. [4:42] Subdivision subdivision lots on the [4:44] easterly side of Belmont Creek Road have [4:46] not been developed and are currently [4:47] being farmed. The applicant desires to [4:50] build a residential pickleball court [4:52] using a 30 foot by 60 foot slab, which [4:55] is 1,800 square ft placed in the front [4:58] yard of the property outside of the [5:00] utility easement. The pickleball court [5:02] will be unlit and unfenced with the [5:06] surface being built at grade. The [5:09] requested location puts the edge of the [5:11] pickleball court 10 ft from the property [5:14] line along Belmont Creek Road. The [5:16] applicant believes the setback distance [5:18] requirement of 75 ft from the center [5:20] line of the road unreasonably restricts [5:22] the property and a variant should be [5:24] considered for the following reasons. [5:27] The existing location of the septic [5:28] system and drainfield on the northerly [5:31] side of the property prevents use of the [5:33] area. A large magnolia tree in the front [5:36] yard prevents the pickle ball court from [5:37] meeting the required road setback. [5:40] Removing the tree is undesirable and [5:42] potentially cost prohibitive. The 100 [5:45] foot RPA buffer from the Rapahhanic [5:47] River on the westerly side of the [5:48] property further restricts the property [5:50] and the applicant does not believe that [5:52] the proposed location of the pickle ball [5:54] court would impede traffic visibility or [5:57] raise any other safety concerns. [6:00] Um, [6:03] as part of the memo, there were certain [6:05] exhibits that were um added to that. So, [6:07] you have a copy of the subdivision plat, [6:10] the specific survey for the subject [6:12] property. I put in there the septic [6:15] permit that shows where that septic [6:17] system is. Um, the pickle ball pickle [6:20] ball court sketch that was provided by [6:22] the applicant, some site pictures, and [6:25] just a comparison of the sizes. If [6:27] you're unfamiliar with pickle ball and [6:29] what the size of that kind of court is, [6:31] there's kind of a a a simple comparison [6:34] of sizes um in that. Um, [6:38] as uh if depending on how you all uh [6:43] vote on this, we would uh the staff [6:46] would recommend that any approval [6:48] clearly state that the variance applies [6:50] solely to the use of the area as a [6:53] pickup court or some sort of [6:54] recreational [6:56] uh court. The slab shall not [6:59] subsequently be used in whole or in part [7:02] as a foundation for any rod or enclosed [7:06] structure without obtaining a [7:08] modification to the variance and all [7:10] other required county approvals. So the [7:13] idea is that we don't want it to set a [7:15] precedent to be used to create something [7:18] that would be more non-conforming or [7:22] than than it already would be basically.
