I wanted to make a public comment because I'm just becoming aware of the number of vacation rentals that are being applied for and pebble beach.

And two of the issues that I wanted to address were the concentration.

I'm going to ask her of homes that are going to be on our block of Riyada Road and the block behind us on facing Oliada. There are three homes to them border each other.

The other one is one house over. So we're concerned about the impact of having three vacation rentals all in basically one area one block of pebble beach.

And it's the safety issues and all the parking and everything else that goes on for each specific home.

Car week provides a clear example in the risks presented by the current short term interactivity.

The many hotel down the street currently has eight vehicles on site with additional vehicles parked in the rear and overflow on the adjacent property.

So, today's hearings are related to commercial vacation models.
[20:54]
I think all of you are aware.
[20:57]
As some of you may know, the Board of Supervisors who adopted vacation model regulations over the last couple years.
[21:03]
And the county is processing numerous applications.
[21:06]
The county's process of adopting the regulations occurred over many years
[21:10]
with extensive public participation.
[21:13]
The Board of Supervisors in intent was to strike a balance that allows
[21:17]
Monterey County to benefit from the tourism economy.
[21:19]
We'll also minimizing loss of long-term housing and ensuring that residential
[21:24]
neighborhoods are protected from potential social and
[21:27]
behavioral impacts of vacation models.
[21:30]
Part of the Board of State termination was that the community is better served by having
[21:35]
limited while regulated vacation model uses rather than
[21:38]
ongoing illegal rentals.
[21:40]
To achieve this balance, the Board placed a maximum limit of 4% of homes for
[21:45]
uses commercial vacation models in the county planning areas.
[21:49]
The regulations ensure that each side is managed and responsible to respond
[21:54]
to any issues.
[21:55]
In addition to the zoning regulations, the county coding includes regulations
[21:59]
in Chapter 7.120, which includes among other requirements,
[22:04]
prohibitions on outdoor amplified map sound and requires a sign

So these applications are considered here by the zoning administrator

The proposed location for the commercial vacation rental is one for four one Rihada Road in Pebble Beach.

It is subject to the County of Monterrey County Code as well as the Del Mon� Forest land use plan.

The planning area is the Del Mon� Forest land use plan and it is owned LTR 1.5.
[25:26]
So low density residential was a gross density of 1.5 acres per unit and a design control overlay in the coastal cell.

The property has a maximum nighttime occupancy of nine people and a maximum daytime occupancy of 13 people.

These occupancies exclude infants between 0 to 12 months and are set for pursuant to chapter 7.1 to 0, which establishes the requirement for the vacation rental operation license.

The applicant submitted a certified home inspection, which was completed by a certified home inspection.
[45:30]
The property has a local property manager who will be available 24 hours a day, seven days a week to respond to complaints or concerns that arise at the property.
[45:39]
The property manager will be available to arrive on site within 30 minutes of receiving a complaint for a concern.
[45:45]
The operations plan provides addresses and contact phone numbers for the police station, fire station and hospitality.
[45:52]
This information is also included in an informational notice, the individuals saying that the property along with quiet hours and notification of emergency routes.
[46:01]
Condition number three prohibits the property from hosting corporate or private events unless the property has a separate entitlement for such use.
[46:11]
The regulations for commercial vacation rentals allow to 57 vacation rentals to be approved in a DelMani forest land use plan for civil and CC section 2064 to 90 if approved this would be the fifth approved commercial vacation rental DelMani forest land use plan.
[46:29]
The property is accessed through conveyor road private road therefore subject private road regulations the original deed contains deed restriction language.
[46:38]
They can be interpreted as the private road agreement and the private road maintenance agreement therefore the project is classified as the tier forward.
[46:46]
Company the governing structure was notified of the project.
[46:49]
And if you have to to the use of a private road based on the entire language contained within the agreement although the property owner has the right to access their subsequent language regarding the prohibition of trades and businesses on residential property.

Therefore staff considers the objection from level of each company a substitute as a substitute of dispute.

Staff recommends condition number six the states.
[47:12]
The resident shall resolve the dispute prior commencing or continuing the use within 60 days.

Staff would like to clarify the language in the access evidence within the resolution in finding one.

The county prepared an FER for the vacation rental ordinance project and the FER did not identify any significant impacts for CVRs up to the cap specific for each planning area.

The FER identifies the regulations that were developed to ensure compatibility within the existing residential uses.

The objective of the regulations is to preserve the residential character of the name.
[47:49]
The FER identified potential negative effects including new sense issues such as noise, traffic and parking.
[47:55]
These areas are addressed by enforced regulations outlined within our code.

Compliance with the emergency emergency response time is another measure to ensure safety and security is addressed.

And I know these staff, as a matter of course, is imposing that, but I think that's erroneous in contrary to law.

So Title 16 references private road and with that incorporation staff and the zoning administrators requiring that they show they have access to a private road.

And the applicants have submitted their deeds, which was referenced in the staff report.
[53:05]
And the, the deed allows for use to the grantee, their family, their deaths, their attendance.
[53:15]
And it's not subject to any other conditions.
[53:18]
And I would point out that in the staff report, this is referred to as a restriction, that's incorrect.
[53:24]
It's a license. It is a license to use and by recording it, the Pebble Beach Company is granting an easement for the use of the private roads.
[53:34]
It is a right to use, it is not a restriction, at least not for the applicant.
[53:39]
And in looking at that language, staff says the plain language of this deed restriction, which is a license, gives the property owner access to their property as long as they pay $25 each January 1st.
[53:54]
That's it. There is no requirement in that language that you obtain additional consent. That is the consent.
[54:01]
By recording it in the county recorders office, they are granting an easement for the use of the private road.
[54:07]
And the applicant has demonstrated to the staff that the plain language gives them access.
[54:14]
That's all the required to do under Title 16 is show that they have a right to access.
[54:21]
Now, the objection is based on a different part of the deed, which is a use restriction.
[54:28]
That use is independent of the road.
[54:32]
Because that use restriction doesn't say, if you violate this, we can withhold consent to use the road.
[54:38]
That's not what it says.
[54:41]
If Title Beach Company thinks that it can prevent the applicant from using the property based on the deed restriction,
[54:48]
it should be incumbent on the Title Beach Company to go into court and get an order that says it can interfere with the use.
[54:56]
When the staff has said the plain language gives the applicant the right to use the road.
[55:03]
Not the other way around. And the county previously had a provision in the ordinance and a draft that would allow homeowners associations to object,
[55:14]
if they felt that there was a restriction in their CCNRs that prevented short-term rentals.
[55:20]
They didn't enact that. They removed it from the ordinance.
[55:24]
But by allowing Pebble Beach Company to object, the zoning administrator is in effect imposing that requirement which the county never adopted in the new ordinance.
[55:37]
It has given Pebble Beach Company cart blocks to interpret and apply its own restrictions, even though that interpretation is contrary to the express language,
[55:48]
and the county is accepting it, saying, fine, homeowner, we're going to put the burden on you to go to court to show that Pebble Beach Company's interpretation,
[55:59]
which is contrary to the express language of the deed, is not valid.
[56:04]
And the last point I want to make is the county has rightly said, we're not going to wade into disputes between private parties, but that's exactly what it's doing.
[56:14]
It is taking the side of the Pebble Beach Company that it's interpretation of its deed restriction gives it a right to object to the use of the road, even though the agreement expressly says they can use the road.
[56:30]
And by getting on that right, you are taking their position, if not intentionally, at least implicitly, when what the county should say is Pebble Beach, this license says they have right to use the road.
[56:42]
If you think you can stop them, you go into court and you get a judge and then we'll see what the judge says, but otherwise they have demonstrated that they have a right to use the road by virtue of the license that you granted in the recorded deed.

Also, the applicant will be required to supply an informational notice tickets, as well as the neighbors for with contact information for the emergency response.

Since the property is within a vehicle, it has required emergency advocacy response time of 5 to 8 minutes.

If I will be to fire station 22, it is approximately 5 minutes away, and charm is approximately 5 minutes away as well.

Therefore, it complies with the advocacy for the response times. Additionally, the property manager's information will be supplied for sanctuary vacation rental so that they can respond with it 30 minutes.

Also, condition of my previous manager, we did to the permit, which will allow no special events for private parties.

There are several conditions such as condition three, which is previously mentioned prohibits the property from being used for special events or private parties,

to address noise and trash and of potential congestion with parking and traffic safety.
[1:18:16]
As well as condition number five, which requires that all the regulations in chapter 7.120 are met,
[1:18:23]
but you can also prohibit the use of outdoor fire pits, recreational things for that nature.
[1:18:30]
Also, the applicant is proposing again five spaces, which is as an exceedance of the two minimum required parking.
[1:18:43]
It is not a recommendation that's owning a ministry of no vote, and then the project qualifies for class-slime,
[1:18:47]
practical and public assumption.
[1:18:49]
Zico-wildized section 15301, and none of the exceptions from section 15300.2 applied to the project.

I think it's safe to say that the condition of the property is actually better now than when we were residing there for full time.

And we take really seriously what our neighbors think and what they feel about the way that the property is managed.

Although we did note that there was a comment from one of the next our neighbors about the fact that the.

The fact that the property management was not made aware to them that they felt that it was managed well and that's that's in one of the records.

I also want to just state that we were unaware of the issue of our application not diligently moving forward.

And this is the first time that we've heard about that.

It was certainly never told us and we would have done everything possible to rectify that situation if we had been made aware of it.

I purchased the house on Thomas and next door to the subject property.

And we have been there since May 4th I believe.

We were aware of it as a mental.

We were told by and I'm a real estate agent and and told by the agent.

We were working with her lovely work from Sonoma County that the company that was managing it was one of the best.
[1:24:24]
And I have no stranger to vacation rentals having managed a guest house in this in the sea ranch Sonoma County.
[1:24:33]
So I'm familiar with a lot more of the details in regards to the vacation rentals than probably most people.
[1:24:43]
The issue that I have is that we moved in there and we were never welcomed by the rental management company.
[1:24:51]
We didn't of course I can access tax records and and come across addresses and mail things because I'm still connected to the MLS.
[1:25:01]
But we were never introduced to the company.
[1:25:03]
I never had a number to call and there are some issues from our perspective.
[1:25:08]
It is a well-managed.
[1:25:10]
That guests are mostly by it.
[1:25:13]
I'll accept for one karaoke party that occurred recently.
[1:25:16]
That was very late at night and I'm not about to get up and call because I don't have a number.
[1:25:21]
And in Sonoma County we can access the permits and there are numbers associated with the manager.
[1:25:28]
They're required in Sonoma County to have a manager that's on site or close to that site and a phone number and a contact.
[1:25:37]
And if they don't respond to your concerns and make some corrections they will lose their license.
[1:25:42]
And there is active involvement in following and managing those licenses.
[1:25:49]
I think there's more than two people there in that county that are working on that.
[1:25:54]
The issues we have with the house as I have to be honest and say that we bought in Temple Beach for the privacy.
[1:26:00]
The fact that we have gated community and we also are retiring we sold two properties in Sonoma County to be here.
[1:26:12]
We got into a bidding war on this property there were five offers on it and it's a little disappointing that we do have the rental next door for the following reasons.
[1:26:24]
The rental is rented we had a three night minimum on my rentals this house rents for one night we've had several that come in one night and two nights and three nights not too many that are much longer.
[1:26:36]
But the problem is there's a bunch of cars that come in it's a circular driveway so when they say five car five parking spaces.
[1:26:45]
I have a real issue with that because most of them like last night we had the vehicles lights on in our bedroom for most of.
[1:26:55]
I don't know an hour while they were unpacking their vehicle comes right into our house.
[1:27:00]
And so the parking and then when the renters leave then the cleaning crew comes in and there's usually what two three vehicles.
[1:27:09]
And it's nonstop and it is a small street and that's one of the reasons we bought on that small street because it was small.
[1:27:16]
And private that there's a lot of traffic there just from this house alone we have full time neighbors across from us and on the other side.
[1:27:27]
Another issue for for us is that the property although it does look in pretty good pretty good shape.
[1:27:37]
I know some neighbors are friends with the owner.
[1:27:41]
And I asked for a phone number but apparently that's not you know we're trying to make it we're wanting to retire and live there and be peaceful we don't want to come to meetings and create issues for people and I understand.
[1:27:56]
Why they would need to make money if they're not there but that's not what we bought we bought somewhere for private not a lot of cars coming through and all that extra lighting.
[1:28:10]
In the house this left on all night by the renters and by cleaning crew that also comes into our house.
[1:28:18]
We have a nitrogen to house should have a single pane windows and we have no blinds and we are updating all of that because we have a necessity now whereas we weren't really really not a position to be able to afford all of that but at this point.
[1:28:36]
We are happy to do it because we are concerned about our privacy.
[1:28:40]
And the lighting I did talk to one housekeeper and I asked her if I didn't want to complain I didn't want to create any problems for anybody but the lighting was really bothering us.
[1:28:52]
And she's told me she says well they're only supposed to have the front porch light on and the light on the inside directly inside the door and this light is coming from another part of the house and there's an exterior as well as interior that are left on very often.
[1:29:08]
And we have nobody to call no one to tell anything about that and we don't have blind yet because we're trying to update the windows first so we would appreciate any kind of.
[1:29:19]
The final thing I want to say is that we just had three trees removed from our property that we had our burst out went through Monterey to get the permits and they had various illnesses they were sick trees and they've been removed.
[1:29:37]
The table beach also responded to request and they came out and there were two trees that they removed that were.
[1:29:45]
Close to our property there are some trees on this subject property that I'm very concerned about.
[1:29:52]
So one in the front the root system is just overtaking the street as well as their driveway and again.
[1:30:00]
Although the owners of the property wouldn't make as much money probably. Their property is going to be taken better. It's going to make their neighbors have here. And I don't know if you handle long-term rentals, but that is a better option. Not only for the property, but for the neighbors. Because, quite frankly, I have heard Michael's a wonderful guy. I've never met him, but I don't like him because of what he's doing to us.

This project is for a coastal development permit to allow a commercial vacation rental operation on 4168 sunset length in Pebble Beach, subject to the Del Monte forest land use plan.
[1:43:28]
This property is known to be in density residential with a maximum gross density of 4 units per acre in the with a design control overlay and a coastal zone.
[1:43:38]
If approved, this would be the 7th commercial vacation rental out of 57 that's allowed.
[1:43:44]
The subject property is identified in red here, there are five other applications that are currently in process to for limited in one for commercial.
[1:43:56]
Staffel likes to know that this one here was previously, this is a Guamja project that previously came before the zoning administrator that's currently a peel before the board.
[1:44:06]
The subject property has an existing single-family dwelling that's about 1,900 and eight square feet.
[1:44:12]
It has three bedrooms and two and a half bathrooms which provide a maximum occupancy of 7 overnight guests and 10 during the day.
[1:44:20]
The property does have an attached car port of approximately 623 square feet with the car port and driveway.
[1:44:27]
The parking has three total on site which is adequate for our regulations.
[1:44:33]
The subject property did receive a certified home inspection checklist done by certified contractor.
[1:44:40]
Emergency response times for this area according to our regulations with the 5 to 8 minutes as it will be just considered a community service area.

The properties of 6 minutes away from the nearest fire station and for from the community hospital of Monterey Peninsula.
[1:45:00]
Emergency response times for this area, according to our regulations, would be five to eight minutes, as it will be just considered a community service area, the properties about six minutes away from the nearest fire station and for from the community hospital of Monterey Peninsula.

The property is accessed through sunset lane, which is a private road and therefore subject to the private road regulations outlined in chapter 16, 80 of our code.

There is language within the due restrictions that constitute a private road agreement that allows the right to access for the property owner, but there's subsequent language that identifies no trader business to be conducted on a residential property.

The right to access, classifies this as it's your three application, the regulation state that should a substitute be submitted to the county that the county can condition the project as appropriate to clear that dispute prior to commencement abuse.

An objection has been received by the couple leads company that's the governing structure for this area and they have submitted an objection regarding the language outline in the private road agreements and therefore staff has conditioned the project appropriately.

Parking on the site is currently legal and non-conforming as to current parking centers.
[1:56:43]
The home was built in 1980 and therefore required only one parking at the time.

Current regulations identified two parking spaces per single family dwelling as current regulations.

This is the site plan of the property and a street view of the house of to the left.

This would be the one space, there is space in front of the house for additional parking.

And as staff check with our public works, engineering services division,

There has been public comments that we're received for this application, both in support of

an objecting to. The objections were raised regarding the noise parking concerns due to the

to ensure that these new senses were lessened. The FERR that was done for the commercial vacation
[1:58:01]
rental regulations and identified new cumulates in the impacts, but based on the implemented regulations
[1:58:08]
identified that these new senses should be lessened through the implementation of our regulations.

Staff is recommending changes to condition number two and six or two and five it should be in my apologies.

Condition number two should be prior to the issuance of the vacation rental operation license

and condition number five should say prior to the commencement abuse.

Carmel is a very special place to ask. Jerry's father went to NPS. So Jerry has been some of his childhood time here.

Over the years, we always find ourselves coming back here with friends and family. So over COVID, we took opportunity to purchase our home first home together as a couple.

We're working remotely.
[2:00:47]
The later on, we tend to office-mending happen. We have to move back to the Bay Area.
[2:00:53]
But our goal is always to be moving back here and raise our family here. And we now have an 18-month-old.
[2:01:00]
And we will very much like him to experience the same childhood here as Jerry did.
[2:01:05]
But before that happened, we're sharing our homes with our family and friends and renting it out to help to cover the costs, which is extensive in California.
[2:01:15]
So we don't have to sell and lose our home.

That's a little bit about us and I did, we threw all the public comments and we really appreciate both the support and the feedback from the neighbors and the community.

And so I'd like to take that opportunity to address three concerns that I'm hearing.

They won his parking and I completely agree that the parking on lower and upper trail can be difficult.

I want to ensure our neighbors that we will never ask our guests, family and friends to park around the corners where it is dangerous.

Moving forward, I will ask everyone in my house not to park anywhere on the street on upper and lower trail.

And I also think that it will be helpful to have a no parking sign to help to enforce it.

So I have submitted a ticket to the county requesting an official no parking sign where it's dangerous to park.

And I will continue to work with the county to find a resolution.

The second one is noise and I acknowledge and we all love how quiet and peaceful this place is, and so we plan to keep it that way.

So the quiet hour at our house is from 9 p.m. to 9 p.m. and we will be adding a outdoor noise detector to continuously monitor the sound levels so that if there's any issue, we can address them immediately.

And I also heard that there's some issues on my Jacuzzi and our shand when people see that Jacuzzi outside they, you know, they come first.

So we're looking into ways to maybe move our Jacuzzi to the backyard, which is away from lower and upper trail side and looking into ways to add perhaps like enclosure to reduce conversation to travel.

And the third one is the amount of applications in the in the neighborhood.

And I understand why this can be concerning to our neighbors.

So I have already reached out to several other shelter mental owners in the neighborhood.
