Yes, I do. [6:34] Thank you, Chair Stern Good evening, commissioners. Tonight the consideration of a [6:42] request for a closed hearing appeal of a agrees it grievance decision is before the [6:48] commission to decide At the commission will one hear the matter to adjudicate the matter [6:56] without a hearing or three refer the matter out to a hearing Officer? [6:59] The Commission's decision is pursuant to civil service rules 12 point 5B4 Little I Number [7:09] three So I or 12.12 before I continue with the brief staff report tonight going forward in [7:18] this item the grievant or the employee will be referred to as Grievant and has requested a [7:25] closed hearing. With that being said, staff is emphasizing that the [7:29] commissioners and all parties present refer to the Grievant by Grievant and not their name [7:36] In order to maintain their privacy we ask that all commissioners and parties use [7:43] the term grievant in place of the employee's name. Thank you. [7:47] Tonight the Commission and its legal counsel Ms. Monica Khalifa will receive the full [7:55] grievance hearing along with the staff providing copies to the parties that are present in [7:59] accordance with civil service rule 12.5 B for Little three Eyes This portion of the [8:10] grievance rule requires that the Commission receives the full grievance record to review [8:14] prior to deciding one Will they hear the matter to will they adjudicate the matter without a [8:22] hearing Or three will they refer the matter out to a hearing officer as part of the [8:28] grievance for record there's a series of short videos for the Commission to review due to the [8:35] limitations of viewing these documents or these videos from the Dyess there is a closed [8:43] session item on the agenda tonight that closed session item will be used to view those [8:48] videos only staff will provide further information and instruction to the Commission [8:54] Once you've completed your review of the written record. Thank you for your time this [8:59] evening and I'll turn the item back over to Chair Stern to continue as mentioned in the [9:06] h.R. Staff report since this item is requesting the commission to [9:12] first review the written administrative record I ask at this time that we recess i [9:17] recommend the commission take up to one hour with a 30 minute check in to complete the review [9:26] of the administrative record individually and without discussion staff Please let me [9:31] know when you're ready to proceed. Okay. [9:34] Give us a few moments. We'll pass out to the record for everyone to review. [9:39] Thank [11:15] . Chair Start If I can just confirm that everybody has a [11:18] copy. Yes. Okay. [11:24] Thank you [11:39] . Did you wish to secure the chambers or no [12:10] ? Chair Stern, you were asking a question if you could repeat [12:15] that. >> Can you turn on your mic so I can hear you? [12:23] I'm apologies. Did you wish to secure the chambers for this component? [12:30] You are in open session still for a one. We're not in closed session [12:34] yet. You're simply at our recess For you all to be able to review [12:39] the record and also go ahead monitor. [13:12] We now starting with the one hour time limit. Yes. [13:16] I've been monitoring that were a couple of minutes and so I will be checking in with you [13:23] all in a close to There was less than 30 minutes but I'll check in. I'm we're about 30 minute We're [39:30] almost 30 minutes in so I can do your approximate 30 minute time check right now if that's [39:40] good for you All if you don't mind, Chair Stern, if I can get some feedback from you and the [39:48] members as to approximately how much more time folks need or if people are ready to commence at [39:56] this point. All right. I would like in there ten more [40:02] minutes. Okay. Anybody need more than ten more [40:05] minutes? Yeah, I would like about 15 more minutes. [40:09] 15 minutes? Anyone else This? Okay, so I'll do another time. [40:16] Check out 15 minutes which will put us at 755. Thank you. [40:20] Thank you. Your most welcome [50:51] Commissioners. Have we all finished? Yes, it's I we're all finished [51:03] on reading. Okay give me just one moment here [51:24] . So the commission has completed its review of the written [51:26] record please. Now Chair Stern, that we will move to the next matter on your [51:38] agenda. So you would ask for a pass on the next item on a one Go ahead [51:46] on item one the next item on the on the commission's agenda is a closed session pursuant to [51:54] government code 54957 Beeves and boy public employee employment discipline Dismissal [52:04] release The Commission will recess in the closed session and we'll return to open [52:08] session to report out any action taken during the closed session. [52:14] Only the Commission relevant staff and the parties may be present during the closed [52:19] session at this time I request that staff confirm once the chambers closed and prepared. [52:30] Okay give us just a few minutes for us to take care of making certain everything is closed [52:37] and make certain that technology she is following that closure of the room and [52:42] then more convenient court session. Thank you. [52:46] Thank you [52:58] this one [53:19] chair Stern e ready to continue when you're ready. [53:26] Thank you. I noticed that other counsel just walked out. [53:34] Well, should we wait a second till she returns and so she's here. [53:41] Okay [53:48] . The Civil Service Commission is returning from from recess for [53:53] agenda item closed session pursuant to government code 54957B is employed Public [54:03] employee discipline dismissal Release The Commission met in closed session regarding the [54:10] item listed on the agenda There is no reportable action We will now return to item A-1 That [54:21] would be a 127 dash 33 Consideration of a request for a closed hearing appeal of a [54:30] grievance decision [54:37] . Let me ask please that we would like to hear from each party [54:42] present if you would You shall everyone come forward at the same time or do we want to call [54:49] individually? You have the ability to call each one independently but you [54:56] can go ahead and give them their instructions for what it is that you would like to hear [55:03] from them in regards to stating their name, how long their cases are expected to last and [55:07] how many witnesses are anticipated. Okay, Please introduce yourself [55:11] including the spelling of your name and do so slowly If you would please provide the total [55:19] number of hours that you anticipate your case to last Provide the total number of [55:26] witnesses you anticipate calling As mentioned by staff the request is for a closed [55:33] grievance hearing Please refrain from mentioning the employee or grievance name or [55:40] title or substance of the grievance. Well all right with the hook [55:54] for the grievance for this please the grievant and and counsel [56:15] Hello everybody Hear me ? Gotcha. [56:19] Thank you. Good evening, commissioners. It's nice to see you again. [56:24] I'll be victorious under different circumstance since for the record, my name is [56:29] Jessica Mauro and it's j e FICA m o r r o w. Before addressing the request I [56:39] just want to state that there's a concern about the record. It is missing the risk [56:50] management report and the sound quality report. And so I just want to go on [56:59] record stating that there are some things missing from the complete record. [57:05] So received [57:12] as far as time goes we don't believe it should take more than a day And we're [57:18] looking at three witnesses potentially for [57:31] in total number of hours. Well, eight hours it's eight [57:37] hours. That's correct [57:45] . Any questions? Thank you, Ms.. [57:52] Norton. Thank you [57:58] . All right. Thank you. [58:04] Good evening, Commissioners. My name is Brittany Del Toro. I'm with the firm Atkins [58:10] Anderson and I'm appearing for the city. Would you spell your last name, [58:17] please? Yes, of course. Villa Toria, that's de space l [58:24] a space t o r r e. And if I may also spell out my first name it's spelled a [58:32] little differently b r i t t a n e y. And the city anticipates [58:45] calling 3 to 4 witnesses and we also do not anticipate that this will last longer than a [58:51] day. And the day being approximately eight hours per night I would [58:58] say no more than eight hours. I would say between 6 to 8. All right. [59:07] Thank you. And I actually do have a question, sir. [59:11] Would your 3 or 4 witnesses be different than the other three witnesses that the appellant [59:15] would be calling? That's a great question. I don't know if they will be [59:20] different but okay. Yeah. Okay. [59:25] Just curious. Thank you. Thank you. [59:33] Okay. Thank you for the information [59:45] . Well, at this point do we begin a discussion? [59:49] Yes. At this point the commission can go ahead and discuss. [59:56] Just remember as a reminder you're not to discuss any of the subject matter of the [1:00:01] actual hearing but your discussion can surround your decision in regards to whether [1:00:08] or not you're going to hear the grievance appeal, whether you're going to adjudicate the [1:00:12] matter without a hearing or if you're going to send the grievance appeal to a hearing [1:00:17] officer. Just keep in mind that a couple of those options either hearing [1:00:23] the appeal or adjudicating the matter without a hearing would be something that we would want [1:00:27] to discuss Potential hearing dates or a deliberation date depending on which choice you [1:00:35] choose of those two of the three. Just so that we can move [1:00:39] forward with the matter but know that staff and Ms. Khalifa are also here to answer [1:00:43] questions the commissioners may have. Thank you. [1:00:46] Are we all clear that we have three options on the table? Yes. [1:00:53] Okay. All right. Mr. Green, you are covered. [1:01:00] Could you please turn on your microphone so we can all hear for the record? [1:01:05] Thank you. I don't have any comments at this point, Chair Michel but I [1:01:11] think this is worth us hearing. I think the record is green. I think we could make a [1:01:20] decision based on this record especially if it were supplemented. [1:01:23] But I feel like there are more questions to be answered by both parties So I think we [1:01:30] would benefit from having a hearing and I think it's something we should do in-house [1:01:34] because this is what we do. All right. Thank you, Chair. [1:01:38] I also agree it would be my preference to adjudicate immediately but I have a whole [1:01:46] series of questions for both sides and I believe that there is much that isn't mentioned in [1:01:49] the record that I would want to touch base on and I do think it's appropriate that we hear [1:01:54] it since we heard the matter previously that led to this. So thank you. [1:02:00] So yeah I am in consideration of adjudicating it. I am not opposed to hearing it [1:02:14] . That's where I'm at And my thought is is adjudication [1:02:18] based on the record would be a viable option. Of course I'd not be opposed to [1:02:26] hearing it either. I just think that the record is he said She said there's like [1:02:34] two versions and I think that the witnesses would fill in a lot of gaps. [1:02:38] I assume to give more context and answer maybe some of the questions that we have. [1:02:45] I mean we could do it but I think it would be much more fair to both parties to have [1:02:52] more evidence before us. Yeah, I agree. I have I guess I would call [1:02:59] reservations. I'm not sure I I'm in favor of adjudicate but I have some [1:03:04] reservations about some of the questions about some of the matter is that either in the [1:03:08] record or items that I feel ought to be in the record that I have questions about. [1:03:17] All right. Well shall we take a vote in which case I move that we hear [1:03:22] the matter? Okay. We have a second and second. [1:03:28] Okay. We have a first and second tier. [1:03:29] Can we get a restatement of the motion on the table, please? Some of you just say you know [1:03:36] some of you are sitting back a little bit further from the mike than others so it can be a [1:03:40] little bit hard for staff to ultimately hear you. I realize you might be able to [1:03:44] hear each other. There was a motion and a second to hear the matter in closed [1:03:54] session with all parties before the commission. Before the commission? [1:03:58] Yes. We have confirmation that Commissioner Gong made the [1:04:05] motion and I'm not certain Mr. Crean made the second. Okay, Commissioner Craig, meet [1:04:10] the second. Thank you [1:05:03] . Thank you for your patience in the matter before you. [1:05:11] You should have a motion or you should have a vote screen. And just so you know them for [1:05:18] the record, the motion is to move forward with hearing the grievance appeal request in [1:05:26] closed session and does everybody have a vote screen? We see the same thing you have [1:05:37] up there. You see that? Okay then we'll do a voice [1:05:41] vote. Okay. Okay. [1:05:45] Commissioner Crieff how do you vote? Commissioner van Gelder And how [1:05:52] do you vote? I rest are gone. How do you vote? [1:05:56] I. Vice chair of the party. How do you vote? [1:05:58] I chair Stern How do you vote? I [1:06:06] . The motion passes to the next matter would be for the [1:06:14] Commission to consider the dates to and commence with the hearing and as a matter of [1:06:29] information for the commission to consider. You do have a hearing that is [1:06:34] set to begin later this month that as I think you're all aware it will take a [1:06:41] significant number of dates. I just want you to make certain that you keep those dates in [1:06:49] mind for your availability as well as staff's availability. I'm not sure why anyone else [1:06:57] and I'm not sure about anyone else on the commission but I'm already looking at dates in [1:07:02] January February. I will agree with me. I feel the same thing in [1:07:11] November or December. I we may need to leave November open if we have to put some of [1:07:21] October into November. You know we still have an open matter that we haven't [1:07:25] initiated yet So I have a question for staff if I may on the on the upcoming hearing or [1:07:36] the October dates back in play, do we know [1:07:47] okay, you just meet with yourself. >> So Commissioner meeting [1:07:55] commission it's still tentative pending trial. So I don't think there's been a [1:07:59] determination yet if those dates will still valid. Okay. [1:08:02] Because now we have well I think the only four dates that so far we've got calendared for [1:08:10] November. Yeah. To try to complete that [1:08:11] particular hearing. So that's why I'm a little worried that we may need [1:08:15] additional dates beyond that to complete that matter. >> That's how I'm looking at [1:08:24] That's how I look at January. How about looking at the calendar here? [1:08:28] Would you consider the end of September Beginning of October We have a week open there And [1:08:36] if I may just from the staff perspective and logistics perspective perhaps it may suit [1:08:48] the commission to potentially consider putting the calendaring of this grievance [1:08:52] request actually on their October agenda. Once you have a clear picture [1:09:00] as to what's happening with your hearing that begins the middle of September so you have [1:09:05] a better idea. It's an option to consider I'm saying one way or the other But [1:09:09] if you want to look at dates tonight that's fine as well. But I just want to know let you [1:09:13] know that that could be an option available. Okay. [1:09:20] Thank you. We do have in the September and well first three weeks in [1:09:27] October available. >> It's potential I mean I'm not sure. [1:09:31] Is staff available for that and and counsel. It depends on the actual date I [1:09:38] know I as well as counsel have a couple of obligations. City council. [1:09:45] Yes. For the next coming months if it gets a little bit too heavy [1:09:49] for staff. So it just depends on the date. Okay. [1:09:54] Well what we're going to need to calendar at least what two maybe three dates for this [1:09:59] matter to continue at least to to the hearing dates on eight hours of testimony. [1:10:07] Yes. There there is not even eight hours of being in session [1:10:10] really. So if it's eight hours of testimony from one party that's [1:10:14] more than one hearing day still to be safe. That's I think at least two, [1:10:20] maybe three. Okay then three. Yeah. [1:10:24] Just you know, for us to deliberate and discuss. So I'm actually determined make [1:10:27] a determination So I mean November may be viable but rather than push it into [1:10:36] January well my pro is I'm going to be away from Thanksgiving through about the [1:10:42] middle of December at least one way to. So that's why I was thinking [1:10:49] January might be looking at that at all. Yeah I'm looking more toward [1:10:53] the end of September here October we have three weeks there of freedom. [1:11:01] Can I ask a question? How long have you been trying to get dates from the for the [1:11:04] other matter for October to help. It's been going on for a really [1:11:06] long time and they haven't really committed to date so maybe we should just they have [1:11:12] a it's due to a trial that they weren't aware previously would start in October and it's based [1:11:17] on whether that would continue. Correct? So I mean it would be my strong [1:11:23] suggestion to wait until the October seventh meeting because we should have more inquiry on [1:11:31] dates during after the other hearing actually begins. The October dates though begin [1:11:39] October to one unless I'm incorrect. Chair You are correct in that [1:11:52] first date that we had calendar for we have calendars for the other matter and which does [1:11:57] then give us beginning September 28th the week of seven September 28th, the week [1:12:05] of November 5th, the week of October I'm sorry Tobar five The week of October 12. [1:12:13] So there's there's a three week span in there that potentially as long as parties are prepared [1:12:24] and I'm not sure about h.r. Staff i due to the scheduling of the other hearing and me [1:12:32] walking out those dates i've had to schedule a ton of other things between you know when we [1:12:37] have definite free time and I'm sure H.R. has been doing the same thing as far as scheduling [1:12:47] So it's a bit tough. Yeah well now that we're speaking about like potentially [1:12:51] three days for this hearing including deliberations, I feel you know, with the uncertainty [1:12:59] of these dates I think pushing it into January would be you know, a viable idea And that [1:13:07] was my original thinking. So I thought just skip past all this and wait till January. [1:13:11] But if it is possible I would rather have it sooner. But if it's not possible I can [1:13:18] see where it could be logistically complex to do it now to to try to try this could [1:13:25] have it somewhat simultaneous with the other hearing even though this is should be you [1:13:30] would think would be rather simple simpler matter but you have the dates are uncertain [1:13:37] and no one is given but we're not interfering with the dates that we're interfering with. [1:13:41] There is staff availability. I'm still with the Jen Yes So I'm sorry newbie question to [1:13:53] the do we have to set the dates at an open meeting as we're doing now or can this be [1:14:01] discussed between meetings. No no can't be discussed too well. [1:14:04] Individual commissioners can provide their general availability to staff just it [1:14:09] can't be discussed with a quorum outside of the meeting. Okay. [1:14:16] And how many commissioners need to attend the meetings? Well, five of us have to be [1:14:21] available for the hearing itself. Yes. [1:14:24] No, we need a minimum of three for a quorum So that's for example we don't have all [1:14:31] commissioners participating in the upcoming hearings as long as we have a quorum we are [1:14:39] fine. Okay. So then at the October meeting [1:14:46] I imagine that staff could come up with a list of dates where all the various people outside [1:14:54] of commissioners would be available because you can discuss it selves, right? [1:14:57] Yes. And Amy, would that be possible to by the October meeting [1:15:02] receive availability from the parties, from commissioners and from staff and make suggest [1:15:09] suggestions on potential dates ? Yes, I think we could. [1:15:14] I think that information I think this has to be discussed with the commission among the [1:15:21] commissioners. It would be discussed I think the idea that Commissioner [1:15:28] Craig is bringing up is to essentially postpone actually calendaring the date until the [1:15:37] October meeting when staff has more information and not only about the hearing but [1:15:41] everybody's availability. Okay. That that then precludes us [1:15:45] from doing having any action prior to that meeting So yes but at least for me I'm [1:15:56] unavailable the first week of October, the last week of September I'm not sure about [1:15:59] each our staff but we do have other options here to to look at two accommodate staff and [1:16:09] commissioners Okay so so another new question would it be allowable for commissioners [1:16:16] to between now and October seventh and just to reach out to each other a list of dates [1:16:25] where we're available so that you have that information so you can make your will [1:16:31] discussion. Yes Nothing in the brown I argued that. [1:16:36] Okay Thank you then I'm I suggest that's what we do is for the last October 7th. [1:16:43] Yes So then they have our schedules right and then they can also gather up the parties [1:16:48] schedules and staff schedules And then when we reconvene next month we'll have a lot of [1:16:51] information we can hopefully just find some dates that everybody I, I know I'm I, I [1:17:01] would entertain the thought of moving this into January. >> We feel that could certainly [1:17:08] be on the on the on the table along with some of the other data you could possibly be [1:17:15] proposed But I think it's prudent to go ahead and wait until the October meeting until [1:17:20] we have more information rather than dinner. It could be an option. [1:17:24] I just think it would be nice to try to do this as soon as reasonably possible because [1:17:30] it's an ongoing situation, you know, and I want to resolve it. I agree that we've eaten into [1:17:38] her time, you know, at that point So do we need to notice at the the meeting, you know, [1:17:50] like a certain amount of time prior to the meeting If if we have the hearing, do we have to [1:17:58] notice that hearing for this any specific time prior? Yes, it did. [1:18:05] You want to go ahead. Okay. So yes, any time a public body [1:18:09] meets there does need to be notification posted in advance If the hearing is held outside [1:18:16] of a regular agenda is meeting and that's considered a special meeting and does require at a [1:18:24] minimum 24 hours notification in advance in order to post an agenda. [1:18:31] How about to council? Um you know where are we at with that To the legal council. [1:18:38] Legal counsel to the outside Legal counsel to the parties here yet we haven't even [1:18:46] discussed their availability yet. Oh no. [1:18:47] So do we have a noticing requirement? No. [1:18:50] No, not to external counsel. Okay, don't. We're just talking about the [1:18:57] public posting of the commission meeting. Okay [1:19:08] . Okay. So October, October 7th is [1:19:17] October 7th our meeting date. Is that correct? Correct. [1:19:21] That's your next regular meeting date. You know all I see really there [1:19:26] is Yes, we have about a week thereafter. Well, we can do that if you [1:19:34] wish. I There's a course of action. Okay. [1:19:40] Very good. I'll agree. Okay, So then do we need to [1:19:48] take a motion on this? No, just table it. Okay, So So you just they [1:19:58] already voted to hear it correct? I I'm blanking on that part. [1:20:02] You can make you don't need a motion now since you're not setting any dates. [1:20:06] What we would do is agenda Is it for the October 7th meeting and hopefully we will have more [1:20:12] clarity on everyone's availability and be able to schedule it at that time. [1:20:20] Very good. Thank you madam. Okay. [1:20:23] And just and follow up from staff and the commissioners can expect communication from us [1:20:30] seeking your availability over the next couple of months so that we can put together a [1:20:36] calendar of dates to where it appears that everyone's available at least to have a [1:20:40] more efficient conversation about calendar and dates. Okay. [1:20:43] Thank you. May we move on with the agenda or not yet? [1:20:57] Yeah. Okay. So are there any public [1:21:02] comments [1:21:08] there? None. None. [1:21:09] We have been received. All right. I have some staff Yes, we do [1:21:16] have a couple One if you can all place your packets up on the top of the Dyess so we can [1:21:24] collect those at the end of the meeting. We'd greatly appreciate that [1:21:28] because you're not permitted to take those with you and we'll take also those items from that [1:21:35] were distributed to the parties as well. You will get them back Don't [1:21:42] worry when you hear the matter But a couple other items from staff along with those things [1:21:47] in your packet staff did send informational communication to the commission today about [1:22:00] questions or requests that were received at the last agenda or the last regular meeting. [1:22:05] If you do have any questions about what was communicated please do reach out to staff [1:22:08] directly And we also want to take the opportunity to remind the Commission that items from [1:22:16] commission members should be brief and informational in nature If there are matters [1:22:20] that do require staff to review or research, please kindly bring those to our to our [1:22:28] attention Prior to the meeting so we can be prepared with a response And then I know it's [1:22:35] come up a couple of times in our prior item is a little reminder about the upcoming [1:22:40] hearing for those members that are participating in the disciplinary appeal hearing [1:22:47] that is scheduled to begin on Monday September 21st. Please be aware the associated [1:22:51] special meeting agenda will be posted within the next two weeks and you'll receive that [1:22:58] communication from us. As a reminder the following dates are currently calendar by [1:23:03] the Commission to continue the hearing based upon those days that were requested we have [1:23:14] asked for the parties to continue to hold these extra dates so that we can be [1:23:21] reviewing those when the hearing begins and also hold extra dates in your calendar [1:23:26] for any deliberations. So we have Monday, September 21st Wednesday, September 23rd, [1:23:34] Thursday, September 24th. Wednesday, October 21st. Thursday, October 22nd. [1:23:41] Friday, October 23rd Monday, October 26th Wednesday, October 28th Thursday, October 29th [1:23:51] Monday, November 2nd Wednesday, November fourth Thursday, November 5th and Friday [1:23:59] November 6th. Okay But it includes items from staff for me unless Monica or [1:24:05] Dana have anything to add I have a question on the dates It turns out I'm not available on [1:24:14] September 21st so should I not attend all of these or should I turn the dates that I'm [1:24:22] available? So for the hearing specifically in order to ensure fairness in [1:24:29] the process to the appellant we would need all participating commissioners to be available [1:24:36] for the full hearing [1:24:43] . Okay Item some Civil Service Commission members anybody know [1:24:54] ? No, not at this time. Thank you. [1:24:58] No, no, not at this time. Well I move to adjourn. I will second give us just a [1:25:12] moment. No, sorry. I'm struggling with the pushing [1:25:20] up here to get it to us. I made the motion so maybe Yes, Chair Stern and a second by [1:25:30] vice chair The Prado and can I just call for does anybody not want to pass a motion to [1:25:45] adjourn? Do I have any nays now? Okay. [1:25:50] All those in agreement say I. All right. Okay.
