All we do, we have [1:13:51] a lawn there. I don't know if you're [1:13:52] familiar with the property, but we have [1:13:54] a lawn that we never use. So in the [1:13:56] summer time just to benefit the members. [1:13:59] We have a little cookout and we play [1:14:01] some cornhole. I mean [1:14:04] it's as innocent as it gets. This will [1:15:35] be uh pending a promoter's permit. If [1:15:37] approved, we'll open the public hearing [1:15:39] at 7:54 p.m. I I take it you like being [1:15:43] up there because you ran right up there. [1:15:45] >> I had to take a whole course on this year [laughter] as you just you [1:15:49] just ignore it. [1:15:50] >> Okay. If you would be so kind to [1:15:52] introduce yourself. [1:15:53] >> Uh Rebecca Sukov, owner of Blackstone [1:15:55] River Glass uh center down on the river [1:15:58] at Cadillac Mills uh across from [1:16:00] Cumberland Hall. [1:16:01] >> Very good. and the event that you're [1:16:03] doing this uh [1:16:05] >> we're hoping to start uh one of we're [1:16:08] hoping it'll be an annual thing just [1:16:09] like a nice cultural event to bring [1:16:11] people in. Um we're having like a small [1:16:16] concert and a food truck with a Jamaican [1:16:18] theme to it. And we're also doing glass [1:16:21] activities that go with sort of an [1:16:24] island theme to it. uh making fish, [1:16:27] doing mosaics, um flame working a palm [1:16:31] tree that people are going to get to [1:16:33] make coconuts and stick on the palm [1:16:35] tree. And so anyway, that's we try and [1:16:37] tie everything in together with a theme [1:16:40] and it'll be out on the river. [1:16:42] >> Is this the first time you're having [1:16:44] this type of event or did you have this? [1:16:45] >> No, we had a we had an amazing [1:16:47] fundraiser just a few months ago. Um [1:16:50] that's what I'm thinking. [1:16:51] >> Absolutely incredible. [1:16:52] >> Yeah, I knew you had another event. I [1:16:53] wasn't too sure if it was last year [1:16:55] >> or just recent. Okay. [1:16:57] >> Yeah, that that was early June. [1:16:59] >> Very good. Um, anyone in the audience [1:17:02] would like to speak in favor or against? [1:17:06] >> Anyone from Zoom? [1:17:08] >> No. All right. Then we'll close the [1:17:10] public hearing at 7:55 p.m. Any motions [1:17:13] or discussions from the commission? [1:17:16] >> Question from Commission. [1:17:17] >> You say this is going to be outside. [1:17:19] >> Is this out outside? It's so we're at [1:17:22] the end of the Do you know where [1:17:24] Cadillac Mills is? We're on a dead end [1:17:26] that ends in the river basically. If you [1:17:29] know where the um the boat docks are for [1:17:32] the tourism council, Blackstoneone um [1:17:34] Valley Tourism Council. [1:17:36] >> So, yes, it's outdoor. We have zero [1:17:38] neighbors and we're ending at 10. [1:17:40] >> The the only reason why I asked I didn't [1:17:42] see a rain date. Did you [1:17:44] >> We're going to move it inside because we [1:17:46] couldn't get everybody the the food and [1:17:48] the music. We couldn't get everybody [1:17:49] coordinated. It's not, you know, just do [1:17:53] a little sundance. [1:17:54] >> She's trying to help you. [1:17:54] >> I'd rather not be inside because it's so [1:17:56] beautiful in the river. You know, we've [1:17:58] got the sunsets, but that's that's the [1:17:59] plan. [1:18:00] >> Okay. Thanks. [1:18:01] >> Yep. [1:18:02] >> Anyone else? [1:18:06] » Motion. [1:18:08] to approve by Commissioner McIll. [1:18:10] >> Second. [1:18:10] by Commissioner Kinch. All in [1:18:12] favor? [1:18:13] >> All opposed? The eyes have it. 70. [1:18:16] Congratulations. [1:18:17] >> Thank you all. [1:18:18] >> Thank you. Congratulations. [1:18:20] >> All right. [1:18:22] Next, we have public comment. Anyone [1:18:24] like to speak [1:18:26] on Zoom? [1:18:29] Lastly, we have motion for adjournment. [1:18:31] >> I'll make the motion. [1:18:32] >> Motion by Commissioner Kin, second by [1:18:34] Commissioner McIll. Did you have a [1:18:36] public [1:18:37] >> on liquor? [1:18:40] >> No worries. Um, we have a a motion by [1:18:44] Commissioner McIll, was it? Second by [1:18:46] Commissioner Kinch. Uh, all in favor? [1:18:49] >> I. [1:18:49] >> All opposed. The eyes have it. 70. We [1:18:52] are adjourned at 7:57 p.m. Thank you. [1:18:56] >> Thank you, Mr. Chairman. And I first I [1:18:59] want to welcome everyone to the regular [1:19:01] schedule meeting of the Cumberland Town [1:19:03] Council, and I do apologize for us being [1:19:05] a little ttty in the executive session. [1:19:08] Uh, I'm going to call this meeting uh [1:19:10] together at 7:57 p.m. And for the [1:19:14] record, all council members are indeed [1:19:16] present. [1:19:18] If everybody would join me for the [1:19:20] pledge of allegiance. [1:19:22] >> I pledge allegiance to the flag of the [1:19:25] United States of America and to the [1:19:27] republic for which it stands. One nation [1:19:30] under God, indivisible, liberty and [1:19:32] justice for all. [1:19:35] >> Thank you. [1:19:37] Next item as we moved down our agenda [1:19:39] with three general announcements. [1:19:41] Council, does anyone have any general [1:19:42] announcements they'd like to share? [1:19:47] Seeing none, we're going to move on. The [1:19:49] next item is our consent agenda. If uh [1:19:52] does any council members have any issue [1:19:54] or would like to uh pull out any item [1:19:57] from the consent agenda? [1:20:00] Seeing none, I'll take a motion to [1:20:02] approve the consent agenda. So moved by [1:20:04] councelor Jaw Shaw, second by councel [1:20:07] McIll. All in favor to approve say I. [1:20:10] >> Any opposed? The consent agenda passes [1:20:12] by a vote of seven to zero. Next item is [1:20:16] our first public comment of the evening. [1:20:18] If anybody would like to address the [1:20:20] council on any topic, just please step [1:20:22] to the microphone and state your name [1:20:24] and address for the uh record. Sir, did [1:20:27] you want to uh [1:20:31] you Yeah, you can speak the last anytime [1:20:34] you want. Does anybody want to address [1:20:36] the council [1:20:39] on the first public comment? We got one [1:20:40] more shot at, so don't you worry. [1:20:44] Okay, we're going to move now. Next item [1:20:46] down is uh reports and communications. [1:20:48] We have reports out of executive session [1:20:50] as may be necessary. The council took no [1:20:53] votes in executive session. And next [1:20:55] item, we have item B under that uh uh [1:21:00] line item six is our update from our [1:21:02] school committee. Chairwoman Vogle. [1:21:03] Thank you. [1:21:07] » Good evening. Amy Vogle, 10 Wam Trail [1:21:10] Cumberland. Um, well, it's the start of [1:21:12] a new school year already. I cannot [1:21:14] believe it for the 26 27 class. And on [1:21:18] August 26, grades one through nine [1:21:21] return. And on August 27th 7th, all [1:21:23] grades return. So, normally we started [1:21:26] after Labor Day, but Labor Day being so [1:21:28] late, we're starting before. Um, the [1:21:31] next thing is enrollment com enrollment [1:21:33] this year is 5,171 [1:21:35] students. We are up 88 students from the [1:21:38] same time last year. So we continue to [1:21:40] grow here in Cumberland. And finally, BF [1:21:42] Norton is construction is on time on [1:21:44] budget. So those are two wonderful [1:21:46] things to say. And I was assured at the [1:21:49] last meeting that it would be completely [1:21:50] on time. So any questions? [1:21:55] >> Any comments or or questions for the [1:21:57] chair? [1:21:59] >> Just one council. [1:22:01] >> No. Do you know when the bus schedule [1:22:03] will be published? Because I know that's [1:22:05] often inquired. And are there any [1:22:07] impacts this year to transportation that [1:22:10] you're [1:22:10] >> this year? There's no impacts to [1:22:12] transportation. We are starting a trial [1:22:14] for optin, but they don't need to opt [1:22:16] in. They can start opting in, but it [1:22:18] does not impact bus riders this year. [1:22:20] For the 2728 year, the opt-in model will [1:22:23] be used in order to decide how many um [1:22:26] riders will be on each bus to figure out [1:22:27] the capacity of how many buses we [1:22:29] actually need. So, we're not [1:22:30] overspending money on busing. I I [1:22:33] thought the bus schedule was going to be [1:22:34] out today, but it might be tomorrow. I [1:22:35] think it might be actually in the Valley [1:22:36] Breeze tomorrow, but I could be [1:22:37] completely making that up. That's my [1:22:39] thought. So, [1:22:41] >> thank you. Anything else? [1:22:45] >> Again, thank you, Madam Chair. [1:22:46] >> Thank you. I appreciate it. [1:22:49] >> Okay, we're moving down under our [1:22:51] reports and communications uh section. [1:22:53] We are now at monthly and quarterly [1:22:54] financial reports ending July 2026. Does [1:22:58] anyone have any questions of the mayor [1:23:00] on the financials? [1:23:04] Seeing none, I'm going to move down. We [1:23:06] now have the check register for July [1:23:07] 2026. Any questions of the mayor on [1:23:11] check register? We are now down on item [1:23:13] E. We have a request from the tax [1:23:15] assessor to review and approve July 2026 [1:23:18] abatements and supplemental bills. We do [1:23:20] have a total for 2020 2026 real estate [1:23:24] supplementals for approval in the amount [1:23:26] of $8,827.39. [1:23:30] There's no questions. I will take a [1:23:32] motion to approve. So, so moved by [1:23:34] councelor Shaw, second by councel McIll. [1:23:36] All in favor to approve say I. Any [1:23:39] opposed? The supplementals are approved [1:23:41] by a vote of seven to zero. Moving down, [1:23:45] we are now at [1:23:50] department reports. We have animal [1:23:51] control, building committee, building [1:23:53] official, EMS, library, parks and [1:23:56] recreation, planning and community [1:23:57] development report, uh, police [1:23:59] department, senior services, and the [1:24:02] town clerk's office. Does any council [1:24:04] members have any question on those [1:24:06] reports? [1:24:09] Hearing none, I'm moving on now. We're [1:24:11] going to be at number seven, licenses. [1:24:13] We're at entertainment license. We have [1:24:14] an application for a special event [1:24:17] entertainment license from Blackstone uh [1:24:20] River Glass LLC for the Island Night at [1:24:23] BRGC event on September 11, 2026 from [1:24:27] 6:00 to 10 located at 30 Meeting Street. [1:24:31] We do approve council is pending a [1:24:33] promoter's permit. Uh does anyone have [1:24:36] any discussion on this license or [1:24:38] comments? [1:24:40] Hearing none, I'll take a motion to [1:24:41] approve the license. Motion by councelor [1:24:44] McIll, [1:24:47] second by councelor Shaw. All in favor [1:24:49] to approve say I. I. [1:24:50] >> Any opposed? The license passes by a [1:24:53] vote of seven to zero. We're moving [1:24:55] down. We are now at an application for a [1:24:57] special event entertainment license from [1:25:00] Adam Farms LLC for the weekends at the [1:25:03] farm uh for a farm event on Sep [1:25:05] September 12th and 13th. September 18th [1:25:08] and 19th and 20. September 25th, 26th, [1:25:11] 27. October 2nd, 3rd, and 4th. October [1:25:15] 9th, 10th, and 11th, 12th, 16, 17, and [1:25:19] 18. October's 23rd, 24th, 25th. October [1:25:24] 30, 31st, and November 1st of 2026. They [1:25:28] will be running from 9:00 a.m. to 6:00 [1:25:30] p.m. Located at 158 Burke Swamp. We do [1:25:34] approve. It's pending the promoter's [1:25:36] permit. Does anybody have any questions [1:25:39] on these dates or any other syndrome? [1:25:42] Hearing none, I'll take a motion to [1:25:44] approve all dates. [1:25:45] >> So moved by councel Shaw, second by [1:25:48] council McGill. All in favor to approve [1:25:50] say I. Any opposed. [1:25:52] The uh eyes have it by a vote 7 to zero. [1:25:56] Okay, we are now moving down to our next [1:25:58] license. We have an application for a [1:26:00] special event entertainment license from [1:26:02] Franklin Farms uh for the Cumberland [1:26:05] Fire Department Family Family Day, an [1:26:07] event uh on September 19th, 2026 from [1:26:10] 10:30 a.m. to 6 p.m. located at 142 [1:26:14] Abbott Run uh Road. If we do uh if we do [1:26:19] approve, it's pending the promoter's [1:26:20] permit. Um I see Phantom uh excuse me, [1:26:24] Franklin Farms is here. Does anyone have [1:26:26] any questions for Franklin Farms on this [1:26:28] event? [1:26:30] >> Just one if I may. [1:26:31] >> Of course. Council Bol [1:26:32] >> just curious if there's a rain date [1:26:37] » or Franklin Farm. That's where we are. [1:26:39] Yep. [1:26:39] >> Franklin Farm. [1:26:40] >> Is there a rain date for the September [1:26:42] 19th, 2026? [1:26:47] » Thank you. [1:26:49] >> If there is no uh further discussion on [1:26:52] this, [1:26:52] >> I'll make a motion to approve. I got a [1:26:54] motion by councelor Bolio and a second [1:26:56] by councelor McIll. All in favor to [1:26:59] approve the license say I. Any opposed? [1:27:02] The license passes by a vote of 7 to [1:27:05] zero. Next item, we're moving down now [1:27:08] on licenses number four. We have an [1:27:10] application for a special event [1:27:11] entertainment license for Phantom Farm 2 [1:27:15] uh LLC for a fall fest event on [1:27:18] September 12 and 13, September 19th and [1:27:22] 20. September 26 and 27, October 3rd and [1:27:26] 4th, October 10th and 11th, October 17th [1:27:29] and 18th, October 24 and 25 of 2026 from [1:27:34] 10 a.m. to 2:00 p.m. Uh, this is located [1:27:38] at 2920 Diamond Hill Road or I take a [1:27:42] motion. Does uh any uh council want to [1:27:44] pull one of these dates to treat it [1:27:46] separately? [1:27:48] >> I would. Yes. Thank you. So, um I'm in [1:27:51] support of all days except for September [1:27:53] 19th. And the reason for that is I think [1:27:56] the Franklin Farm event is a full [1:27:59] volunteer event and it's quite in close [1:28:01] in its proximity to the Phantom Farms. [1:28:06] Um I know uh like I said, it's a full [1:28:08] volunteer event and it does help to [1:28:11] promote, you know, the culture within [1:28:13] the farming community in in Cumberland. [1:28:17] And so I think having uh that date [1:28:20] distinguished only for Franklin Farm um [1:28:24] you know again due to the proximity I [1:28:26] think would make the most sense and as [1:28:28] it relates to Adam's farm I supported [1:28:31] all the dates because I think the [1:28:33] proximity is much further apart from [1:28:36] [clears throat] um these two uh [1:28:39] establishments. [1:28:40] >> Okay. So, uh, what what I will do is [1:28:42] I'll take a motion to approve those in a [1:28:44] polling. Well, first I'll take a motion. [1:28:47] Uh, do we want to uh do we want to [1:28:49] remove September 19th [1:28:52] >> 19th September 19th, 2020? [1:28:56] >> Yeah. No, I'll [1:29:01] » Sure. [1:29:04] » Okay. [1:29:09] » I see. Thank you. [1:29:11] >> Does that change? [1:29:12] >> Yes. [1:29:13] >> Yeah, it would be the 26th. My [1:29:16] >> No, thank you. I was gonna get there. I [1:29:17] just didn't know if I had to open a [1:29:18] public hearing before allowed you to [1:29:20] speak, but we're good. [1:29:22] >> On this particular item. [1:29:24] >> Okay. Do I open a public hearing for [1:29:26] this? [1:29:29] >> Oh, okay. Okay. [1:29:36] » I'll bring you. You have to sit tight. [1:29:38] If you want to address the council on [1:29:39] your license, of course. If you want to [1:29:41] come to the podium. [1:29:43] >> Okay. Come on up. [1:29:45] >> Yeah. [1:29:52] Um I guess I just want to know if I have [1:29:54] to reapply for a different license now. [1:29:57] Do I have to reapply if we can't do it [1:29:59] on that date? Well, we haven't made that [1:30:01] decision yet, but if if we pull it um [1:30:05] and and I [1:30:07] agree with the councelor's uh view of [1:30:09] this, is there any way that this one day [1:30:13] could be set aside so that your neighbor [1:30:16] farm can have this solo? [1:30:19] >> Yeah, I'll just talk to the GM and it's [1:30:21] just um an event for the kids. So, we [1:30:24] just wouldn't inflate the balance houses [1:30:26] or do the hay rides um should your [1:30:29] decision that when we have two that are [1:30:31] close by to do that. So, [1:30:33] >> as long as we know ahead just for like [1:30:34] scheduling. [1:30:35] >> Yeah, we'll uh So, what I'll do is I'm still going to go ahead. I'll remove [1:30:40] it, take a vote on them all [1:30:44] and then we'll leave this one to the [1:30:46] side and we'll take a vote separately uh [1:30:48] to deny your Okay. [1:30:51] >> Okay. Mr. President, just to be clear, [1:30:53] if you wanted to substitute another [1:30:55] date, [1:30:57] >> yes, I think you would have to come [1:30:58] back. We just do it every weekend of [1:31:01] September, October for fall. So we [1:31:03] wouldn't push it okay to to another [1:31:05] date. Okay. But thank you. [1:31:07] >> While we have uh we have uh Fan here, do [1:31:11] we have any questions about these [1:31:12] events? [1:31:16] Um [1:31:19] I think uh what is the situation with [1:31:22] parking because um last year we had [1:31:26] parking spilling over into all of the [1:31:28] nearby streets and we are probably going [1:31:31] to reduce parking in all of those [1:31:34] neighborhoods to only one side of the [1:31:35] street because otherwise it's a public [1:31:37] safety issue. The emergency vehicles [1:31:39] can't fit through there. [1:31:40] >> So do you feel that you're going to have [1:31:42] adequate parking with that? because my [1:31:45] concern is we need to make it so [1:31:46] emergency vehicles can fit through those [1:31:48] neighborhoods. We also don't want to see [1:31:50] a trail of people with kids marching up [1:31:52] Diamond Hill Road. Um that seems a [1:31:54] little bit dangerous. So, have you been [1:31:56] able to expand parking? [1:31:57] >> Yeah, absolutely. So, we are working on [1:31:59] an alternate plan for all of our Fall [1:32:01] Fest dates. Um we kind of tested it at [1:32:04] the vendor fair last weekend um where we [1:32:07] opened up down the farm. We um had [1:32:10] people drive all the way down and we [1:32:11] opened up a parking area down there. Um, [1:32:14] so we're contemplating the idea of doing [1:32:16] that partially again, um, and adjusting [1:32:19] our hayride schedule so that it can [1:32:21] alleviate, we were able to fit about 100 [1:32:23] cars down there and we feel as though it [1:32:26] significantly alleviated the side roads [1:32:28] last weekend. We really didn't have any, [1:32:30] to my knowledge, um, neighborly [1:32:31] complaints or anything like that. Um, so [1:32:34] we felt as though that was a good jump [1:32:35] start to be kinder to our neighbors. [1:32:39] Um, I guess one of my other questions [1:32:41] would be when you're Wow, I just forgot [1:32:45] my question when I went to speak. I'm [1:32:47] sorry. [laughter] [1:32:47] >> It's okay. [1:32:48] >> Whoops. [1:32:49] >> Join the club. [1:32:50] >> Yeah. What was that? [1:32:53] One of my other questions would be um [1:32:56] around a police detail because I know [1:32:59] you've had a police detail. At one [1:33:01] point, we requested a police detail. I [1:33:03] noticed on here you only say 100 people [1:33:07] in attendance, but that seems unlikely [1:33:09] for an event that last year full filled [1:33:12] multiple streets on both sides plus your [1:33:14] parking lot plus part of Diamond Hill [1:33:16] Road with cars. So, does that number [1:33:19] need to be updated to something more [1:33:21] realistic? Um, that's what the police go [1:33:24] by for public safety. [1:33:25] >> Yeah, so when we pulled numbers from [1:33:27] last year, we averaged about 98 tickets [1:33:30] sold per day. [1:33:31] >> Okay. Um, but we only charge for the [1:33:35] children. [1:33:36] >> Okay, [1:33:36] >> so that's 98 children tickets average. [1:33:39] There's certainly days where there was [1:33:40] more um per day. So if you have the [1:33:44] grandparents coming and the aunties and [1:33:46] it would lead to to more cars. So I [1:33:49] don't I don't really know how to answer [1:33:51] that properly. There could certainly be [1:33:53] more than that in one day. [1:33:55] >> Okay. Um, [1:34:01] I don't really want to I mean, I think [1:34:04] it's very important that the farm [1:34:06] succeeds, but I also want to make sure [1:34:07] people are safe. So, without us [1:34:10] requiring a police detail or anything [1:34:12] like that, would you take it upon [1:34:14] yourself to reach out to the police [1:34:17] department and see if they think that it [1:34:19] might be and maybe if they're willing [1:34:21] to, I don't know, drive by a few extra [1:34:23] times on the first weekend. If it looks [1:34:25] crowded, have some more because if it's [1:34:26] needed to direct traffic and keep keep [1:34:28] people safe, I want it to be there. But [1:34:31] I don't want to put the onus on you guys [1:34:32] to maybe pay for something or deal with [1:34:34] something that you don't need. But [1:34:35] >> yeah, no, we will certainly pay for [1:34:37] police detail if that's what's [1:34:38] requested. Um, we want everyone to be [1:34:41] safe also. And whatever is requested and [1:34:43] want is wanted by everybody, we will [1:34:45] certainly do that. No problem at all. [1:34:46] >> Can you um maybe do give us an estimate [1:34:50] of how many people you're expecting? If [1:34:52] you're actually counting people, not [1:34:54] just tickets sold, because I that would [1:34:56] be like that would be the number that [1:34:58] public safety needs to determine, you [1:35:00] know, do they need more people for [1:35:02] traffic detail? Do they need you guys to [1:35:04] have a police detail because just the [1:35:06] kids [1:35:07] >> since they usually don't drive, [1:35:09] >> right? Yeah. So, that's why. Yeah. [1:35:11] >> So, I mean, if we could get an updated [1:35:14] number on that, I mean, I would probably [1:35:16] be more um comfortable voting in favor [1:35:18] of it. And it's just trying to get that [1:35:19] balance. And I am a little concerned [1:35:21] because now that we know we have to [1:35:23] limit parking and that's going to be on [1:35:25] an upcoming agenda. I just want to make [1:35:27] sure we're not spilling out onto Diamond [1:35:29] Hill Road with nobody there to help with [1:35:31] traffic because you guys can't really [1:35:32] direct traffic on Diamond Hill Road on [1:35:35] the road. You know, it would be [1:35:36] dangerous and illegal. [1:35:37] >> Um so, [laughter] you know, I just want [1:35:40] to make sure we we have safety and we're [1:35:42] also sort of respecting the neighbors [1:35:43] and everything. [1:35:44] >> Yeah, absolutely. I can get um I wasn't [1:35:46] here [1:35:47] >> for Fall Fest last year, so um I'll just [1:35:49] have to talk to the GM and um and the [1:35:51] owner and just get their better [1:35:53] judgment. [1:35:54] >> Okay. on what they think the actual [1:35:56] attendance was last year versus tickets [1:35:58] sold. Okay. Um and car-wise. Um but I [1:36:00] will also emphasize to them that um [1:36:04] making the back parking is now a [1:36:07] forefront and and rescheduling our [1:36:10] hayide is is of importance so that the [1:36:12] cars can park back there and come out. [1:36:14] >> Yeah. Because I imagine you also have [1:36:15] additional employees and other people [1:36:17] that need to park too, right? It's not [1:36:19] just [1:36:19] >> they're not allowed to park in front [1:36:20] during Fall Fest, but Yeah. [laughter] [1:36:22] >> Okay. [1:36:22] >> Yeah. [1:36:23] >> Okay. So [1:36:24] >> yes, and we h assuming that the um no [1:36:28] parking ordinance passes when it gets in [1:36:30] front of the council in the next few [1:36:32] weeks, it does allow for parking on both [1:36:35] sides of the farm externally. So it'll [1:36:37] be adjacent parking to you and then um [1:36:40] it'll just be one side of those streets [1:36:42] the other way around. So you'll still [1:36:44] have, you know, some areas. [1:36:46] >> Okay. [1:36:47] >> Thank you, Council. Councelor Shaw. [1:36:49] >> Thank you, Mr. President. So, um, unlike [1:36:51] past events where you had vendors, this [1:36:53] one does not have any vendors. So, [1:36:56] therefore, all those parked cars from 40 [1:36:59] vendors being there are going to be [1:37:00] non-existent, right? So, so that's good. That helps [1:37:04] >> at least understand the capacity for [1:37:07] which people that are attending, they're [1:37:08] not going to be finding spots because of [1:37:10] these 40 vendors taking up most of the [1:37:12] parking. [1:37:12] >> Correct. But you did have um and this [1:37:15] could be just my [1:37:18] mind forgetting, but I looked back into [1:37:20] some past meetings. You did say you were [1:37:22] serving liquor [1:37:24] and that that you were applying for an [1:37:26] F1, but I don't see any F1 license being [1:37:30] issued or applied for. And I wanted to [1:37:32] make I went back to like June to make [1:37:34] sure that we didn't do it that [1:37:35] prematurely early and then you're now [1:37:37] you're coming for the regular [1:37:38] entertainment license and like say that [1:37:39] you don't have one. [1:37:40] >> No. Yeah. So, um I'm currently figuring [1:37:44] that out. We're not as of right now. [1:37:47] There will be no Phantom Brewing won't [1:37:49] be there if that that's usually who we [1:37:51] have. [1:37:52] >> Um I'm also So, I'm the new event court [1:37:54] director for Phantom Farms and Phantom [1:37:56] Brewing. [1:37:57] >> So, as of right now, um for Fall Fest, [1:38:00] there will not be Phantom Brewing on [1:38:01] site. There will be no vendors, no [1:38:03] alcohol of any kind. Um [1:38:06] that has been a thing. So, no, [1:38:08] >> but but it could come possibly in the in [1:38:14] like that would affect maybe October if [1:38:16] we had a meeting in September and you [1:38:17] applied for a license for those events [1:38:19] is what is like I want to um [1:38:22] >> maybe confirm with the solicitor. Yeah. [1:38:25] >> So, we've talked about this. So, Phantom [1:38:28] Brewing has a B license and andor a [1:38:33] state license. So, she's conferring with [1:38:37] DBR on what the brewery can do or not do [1:38:42] on other properties. [1:38:44] They cannot get an F license at Phantom [1:38:47] Farm North, I'm calling it. [1:38:49] >> Okay. [1:38:50] >> Because they have they now have the [1:38:52] winery license. [1:38:54] >> So, they are unable to get a uh they are [1:38:58] unable to ask for an F license going [1:39:01] forward. previously they didn't have the [1:39:03] winery license that's why they could ask [1:39:05] for the F license. [1:39:06] >> That was going to be my follow-up one [1:39:07] because I know that was that you and I [1:39:09] have been talking whether or not that [1:39:11] was issued if that was the case. [1:39:14] >> So So okay, I did talk to the state the [1:39:17] other day after our conversation. Um [1:39:21] >> and there are three [1:39:23] conflicting things. So no, the brewery [1:39:25] cannot serve at the farm [1:39:28] ever. You know, right now it it's not a [1:39:30] thing. So, we are seeking after we [1:39:33] spoke, seeking other ways to potentially [1:39:36] have it there. As of right now, it's not going to happen. [1:39:41] >> Okay. [1:39:42] >> Should that change, I don't know how [1:39:44] quick. I don't Yeah, but as of right [1:39:46] now, with their current license at the [1:39:48] brewery, they won't they won't be at the [1:39:51] farm. It might be through one of those [1:39:52] outside vendors, but we haven't even [1:39:55] discussed that. [1:39:56] >> So, the application should read no. [1:39:58] There would be no liquor service. [1:39:59] >> No. Yeah. No, no, sorry. [1:40:02] >> That doesn't say that. That's why I [1:40:03] brought it up. [1:40:03] >> It because um when we did apply for it, [1:40:06] we did apply, but then we figured out it [1:40:09] couldn't. So, yeah. I'm sorry. Yeah. [1:40:11] >> Okay. Well, I appreciate the [1:40:12] clarification. Thank you. [1:40:13] >> Yeah. [1:40:13] >> I I can I just [1:40:16] did you have more employees in that [1:40:18] parking lot of this last festival [1:40:21] because it seemed like there were a lot [1:40:22] of people moving around. [1:40:24] >> I was doing parking detail. Yeah. [1:40:26] >> Good. Good. [laughter] I'm just saying [1:40:27] good. Good for you. Thank you. [1:40:28] >> Yeah. You're welcome. Yeah. [1:40:30] >> Um, now I know there's been some [1:40:31] interest on this. Is anybody else have [1:40:33] any questions of the [1:40:36] >> spokesman for the farm? [1:40:38] >> All right. Thank you. [1:40:39] >> Thank you. [1:40:40] >> Do I have to open a public record if I [1:40:42] want to hear a public meeting? [1:40:43] >> There's somebody that wants [1:40:44] >> Yeah, I want to get me to go up here. [1:40:46] Does you would like to address anything? [1:40:48] Please [1:40:49] >> just state your come to the just state [1:40:51] your name and address for the record. Is [1:40:52] you know the routine. [laughter] [1:41:00] Linda Pillo, one Town Thompson Hill [1:41:02] Drive. I'm just concerned about the [1:41:04] parking because last year was absolutely [1:41:07] horrendous. I know you weren't there, [1:41:10] but there was parking on both sides of [1:41:12] the road. I couldn't even get out of my [1:41:14] street. I had to back down. And so it [1:41:18] was better. I have to say the last event [1:41:21] that you had, the fact that you closed [1:41:24] that gate and people weren't going in [1:41:27] there and then just going up and around [1:41:29] and I did see that people were parking [1:41:31] further down. Um the hundred [1:41:36] for attendance is way off, way off just [1:41:40] because of what was parking in front of [1:41:42] my house last year. There was a minimum [1:41:47] and there was turnover all day. There [1:41:49] was at least 15 cars in front of my [1:41:51] property alone and so and most of those [1:41:56] cars had four people in them. And then [1:41:59] as far as the my understanding with them [1:42:02] applying for a liquor license, I um have [1:42:05] been the license itself hasn't been [1:42:09] issued. So according to DBR and I did [1:42:12] send a letter to Leand desolate until [1:42:14] the license is issued they can apply for [1:42:17] a class F liquor license and that is the [1:42:20] only type of license they can apply for [1:42:23] during that time and then once the [1:42:26] license is license is actually issued [1:42:30] they can then if they want to serve what [1:42:34] is not produced on the farm they then [1:42:38] have to get it through like a caterer [1:42:41] license and someone there [1:42:44] >> and so we don't regulate state licenses. [1:42:47] So a caterer's license is a state [1:42:49] license. So [1:42:51] >> the brewery license is a state license [1:42:53] but they also have a town B class B [1:42:56] license which they can't use to serve on [1:43:00] other properties. Right? So I I am not [1:43:04] uh advising town the town [1:43:07] >> on state licenses, right? [1:43:09] >> But I I think you're right. I think if [1:43:11] they used a caterer, they could, right? [1:43:13] >> I thought that the um winery license did [1:43:16] issue. If it didn't, [1:43:17] >> it has not issued to date yet, but [1:43:19] they're not asking for the F license. [1:43:21] >> But I just wanted you like when you were [1:43:24] saying that since they've gotten the [1:43:26] license, that's what I was told for a [1:43:28] right for a class F. But I emailed her today to ask if the [1:43:34] license had been issued, [1:43:35] >> right? But they're not asking for a [1:43:37] class F, so it doesn't really implicate [1:43:39] this, you know. So once that class F [1:43:43] license issues, even if even if they [1:43:45] were to approve an F license, which [1:43:47] they're not asking for, they couldn't [1:43:49] use it if they had the winery license, [1:43:51] which they don't have yet until it's [1:43:53] issued [1:43:54] >> legally. That's what they told me. So I [1:43:56] just wanted to clarify that. Um and then [1:44:01] if [1:44:03] like there is parking there, what else [1:44:06] can be done [1:44:08] like with the overflow if there is [1:44:11] overflow if parking [1:44:15] isn't limited on the roads [1:44:19] like in the past when the signs went up [1:44:22] like they do for the parade. [1:44:24] >> Yeah. [1:44:25] If when it comes up for z parking and [1:44:31] prevent parking, [1:44:33] what can be done if that doesn't get [1:44:36] issued in time for fall fest? We could [1:44:39] still um do temporary Yeah, we could [1:44:42] still do temporary signs, but um we did [1:44:45] have uh I spoke with all of the chiefs [1:44:48] before putting the ordinance together uh [1:44:50] police, fire, and EMS, and we they [1:44:54] understood and confirmed that there is [1:44:56] not enough room for emergency vehicles [1:44:57] with cars parked on both sides. So, I'm [1:44:59] hoping [1:45:00] >> all these all these wonderful folks up [1:45:02] here, I'm hoping at least four of them [1:45:03] are going to vote with us next time to [1:45:06] get that um parking, you know, in place [1:45:09] and then we'll do our best to get the [1:45:10] signs up before all of this is started [1:45:12] because we still have a little bit of [1:45:13] time left because we meet again in two [1:45:16] weeks. So, the uh my my hope is that [1:45:18] we're going to have ordinance [1:45:19] subcommittee um within that time, [1:45:22] possibly on the same day as our next [1:45:24] town council meeting, pass through the [1:45:26] ordinance thing, assuming everything is [1:45:28] in order um and then have be able to [1:45:32] vote on it and, you know, get the signs [1:45:34] up pretty quickly, but if we need to, we [1:45:36] can do temporary signs again. [1:45:37] >> Okay, great. Thank you. [1:45:38] >> Thank you. [1:45:41] >> Anyone else want to speak on this while [1:45:43] you're [1:45:46] Okay. So, let's get back to the list. [1:45:48] So, I understand [1:45:50] Phantom Farm is willingly going to [1:45:52] remove 926. Is that right? [1:45:59] From your request. [1:46:04] So, um I'll take a motion to amend this [1:46:09] license. [1:46:11] You can vote to approve all the dates [1:46:13] except for September 26th and then take [1:46:16] up September 26th. [1:46:18] >> Makes it simple. So, uh, with that said [1:46:20] and no objection, I'll take a motion [1:46:22] because everything is in order on the on [1:46:24] the farm's end. I'll take a motion to [1:46:26] approve this license for every day [1:46:28] except 92626. [1:46:31] >> So moved by councelor. [1:46:34] >> It is second by [1:46:35] >> council. Councelor Bolio. All in favor [1:46:39] to approve say I. Any opposed. The uh [1:46:42] the license passes by a vote of seven to [1:46:45] zero. And again, I want to thank you for [1:46:46] working with our nonprofit. [1:46:50] Okay, we're move we're moving over to [1:46:54] our next item. We have an application [1:46:56] for a special event license from Ocean [1:46:57] State Brewing Company doing doing [1:47:00] businesses Phantom Farms Brewing for a [1:47:02] parking lot takeover event on September [1:47:04] 5th, uh 2026. All of these will all be [1:47:08] at 26 September 5th, September 20th, [1:47:11] October 3rd, and these are all from [1:47:13] 12:00 p.m. to 6:00 p.m. And it's going [1:47:16] to be located at 30 Mountain Street. [1:47:18] Everything is in order. I'm sorry. Go [1:47:20] ahead. [1:47:22] >> I just want to make sure. So, you took [1:47:25] you voted to approve all of them except [1:47:27] for [1:47:28] >> September 26th. [1:47:30] >> And now, are you going to take up [1:47:31] September 26th? [1:47:32] >> I certainly will if I have to do that. [1:47:34] But if it was removed, [1:47:35] >> Yeah. I think you need a vote on it. [1:47:37] Yeah. [1:47:37] >> Okay. Well, let's go back one. [1:47:39] >> Sorry. [1:47:39] >> So, um we approved uh the previous [1:47:42] dates. Now, I will take a motion uh to [1:47:46] deny the license an application for a [1:47:49] special event entertainment license of [1:47:50] Phantom Farm to LLC uh for Fall Fest for [1:47:54] the date of 92626. [1:47:57] Do I have a motion? So, moved by [1:47:59] councelor Bolio. It is second by [1:48:00] councelor. [1:48:01] >> All in favor to deny say uh say I. [1:48:05] >> I. Any opposed? The the the license is [1:48:08] denied by a vote of six to one. Okay. [1:48:12] Thank you. So, we're moving on to our [1:48:15] next again we special event uh license [1:48:18] for Ocean State Brewing doing business [1:48:19] phantom farms. Uh brewing for parking [1:48:24] lot takeover uh event September 5th, [1:48:27] September 20th, October 3rd, all of 2026 [1:48:30] from 12 uh to 6 pm. This is located at [1:48:34] 30 M Street uh for the council. [1:48:37] Everything is indeed order in order. Um [1:48:41] is anybody here from the farm on this [1:48:43] particular please or you step up tell us [1:48:46] what this is going to entail? [1:48:54] » These are our concert series. [1:48:55] >> Um we do them in the parking lot. They [1:48:57] are really great events. Big turnout for [1:48:59] these. Um we usually anticipate at least [1:49:01] 500 guests to attend. Um the bands go [1:49:06] right on the loading dock um outside. [1:49:08] It's really fun. Um when we serve our [1:49:10] beer, there's usually two food trucks [1:49:12] there. Um I don't know what they will be [1:49:15] yet. Um they're still pending. Um but [1:49:18] just like all the other other ones we've [1:49:20] had. [1:49:21] >> I'll just ask the other ones of not that [1:49:23] I know of of any problem, but uh is [1:49:25] there a law enforcement officer hired [1:49:28] for those? [1:49:30] Um I've only been to one. It was a small [1:49:33] one in March. Um there was no police [1:49:35] detail requested for that one. Um and we [1:49:39] had but we did hire security to man the [1:49:42] gates and check IDs. Um [1:49:45] >> but I don't know for the others. I think [1:49:47] maybe they have police. I would I would [1:49:49] have to double check with with that. [1:49:51] >> Um I can't remember. No, I did call [1:49:54] Lieutenant [1:49:56] um [1:49:57] >> Boris. Boris today and left a message um [1:50:00] because in my portal did say that they [1:50:02] requested police detail. So I'm just [1:50:03] waiting on a call back. [1:50:04] >> Okay. [1:50:05] >> Yeah. [1:50:06] >> Any questions of the uh of phantom? Mr. [1:50:08] Shaw, [1:50:09] >> just just for clarification purposes [1:50:12] because it says 500 in attendance, [1:50:13] right? And that should trigger some sort [1:50:15] of [1:50:16] >> detail. Yeah. [1:50:17] >> And there wasn't any in in the in the [1:50:19] past. You said [1:50:20] >> No, I don't know. [1:50:21] >> That you don't know of. [1:50:22] >> No, I think there was, but I just [1:50:24] >> Okay. So can't confirm it. The [1:50:26] expectation is that there will be a [1:50:27] police detail [1:50:29] >> at these events even though you hired [1:50:30] security. [1:50:33] >> Separate issue that's like a control [1:50:35] thing. But having a police presence [1:50:37] >> and and and [1:50:39] >> EMS or [1:50:41] >> um I think that's a next step in my [1:50:43] portal that it's like not through yet [1:50:46] for the application [1:50:47] >> cuz that's a pretty or or I don't know [1:50:49] if EMS or fire. I don't know what [1:50:51] >> for the big ones. I think they said they [1:50:52] had both EMS and police [1:50:55] >> for the ones that were like over 200 [1:50:56] guests, [1:51:00] » but we're not but last year. Yeah. Yeah. [1:51:02] But you're not there as far as the [1:51:03] portal goes for this event. [1:51:05] >> I did submit this one. [1:51:07] >> Okay. Okay. [1:51:09] >> Mr. President. [1:51:10] >> Yes. I I just want to be clear if it's [1:51:13] not a regulation and I don't know if it [1:51:15] is about the number of attendees [1:51:18] triggering details then if you want them [1:51:22] then you have to make them a condition [1:51:24] of your approval right [1:51:25] >> so I don't know if they're in the [1:51:26] regulation at 200 people or whatever but [1:51:30] if they're not and you want them there [1:51:32] you have to put it in your approval [1:51:36] >> there is a trigger isn't there [1:51:38] >> well that's what I was assumption But I [1:51:40] guess I don't know. [1:51:41] >> She does it. I'm sorry. [1:51:49] » So you'll be [1:51:49] >> So she might be at the point where [1:51:55] » Yeah. I left a message with Lieutenant [1:51:57] Forest today because it said that but [1:51:59] they wanted police details. So I reached [1:52:00] out and just I'm waiting for a call [1:52:02] back. [1:52:03] >> So they they said they wanted one. [1:52:05] >> It's what it said in my in my in the [1:52:07] portal. There's like a message and it [1:52:08] says police detail requested. Please [1:52:10] call Lieutenant um Forest at Yeah. [1:52:13] >> Okay. [1:52:14] >> To coordinate [1:52:15] >> because we don't want to put an undue [1:52:17] burden on the business if it's not going [1:52:19] to deny. But if he's saying that, I [1:52:22] would probably make the motion to add [1:52:26] the police detail. [1:52:29] >> Go ahead. [1:52:31] >> Isn't it It's already part of It's going [1:52:32] to be in that packet. I don't think we [1:52:33] have to say that. We never done that. Do [1:52:35] we? We go. Sure. [1:52:39] » You know, we'll hear from Chief Desert. [1:52:41] Do you want to comment on this? Just [1:52:43] come up here so we can [1:52:47] » leave. [1:52:51] » So, I would like to say that they do [1:52:53] contact us through the portal. [1:52:54] >> Um, there is a trigger number. Um, I [1:52:57] don't know if it's identical across [1:52:59] public safety agencies. Um, but [1:53:01] historically, um, I've always suggested, [1:53:04] well, mandated that an EMS detail be [1:53:07] there. Um, and a few times, um, like a [1:53:11] week before, they they email me to [1:53:13] cancel and say that we don't have the we [1:53:16] haven't had the ticket sales, so we [1:53:18] cancel. This happened to the last one, [1:53:20] okay, on Sunday. I think it was a couple [1:53:22] weeks ago. Um, and there was a medical [1:53:24] event there. So I there's no way for me [1:53:26] to actually [1:53:29] drive by and count the amount of people [1:53:30] there like you know when I'm off duty. [1:53:32] So it it's sort of this [1:53:35] gray area. Um but I can tell you moving [1:53:37] forward I'm not going to allow them just [1:53:39] to cancel because they won't have their [1:53:41] ticket sales because there's no way for [1:53:43] me to verify that and I'm not going to [1:53:44] put this public safety at risk. So um I [1:53:47] just like to say that. [1:53:49] >> Okay. Thank you. [1:53:53] » Mr. McGill. So, is there an event this [1:53:55] weekend on the 22nd? [1:53:58] >> On the 22nd [1:54:00] or the 23rd? [1:54:01] >> Yeah, I think the 22nd cuz there's a [1:54:03] police detail that's [1:54:04] >> one of those dates. Yeah. [1:54:05] >> scheduled for that. [1:54:06] >> Mhm. Yeah. [1:54:07] >> So, if that's similar to what going on [1:54:09] here, I don't know what that event is, [1:54:10] but if it's similar to [1:54:11] >> it's the same it's the same. [1:54:12] >> So, I'm assuming [1:54:13] >> parking lot takeover series. [1:54:14] >> So, I'm assuming that they end up [1:54:15] getting the details. [1:54:17] >> Okay. So, [1:54:17] >> that's my assumption, but you talk to [1:54:19] Lieutenant Forest and [1:54:20] >> Yeah. [1:54:20] >> All right. So if they had one there, can [1:54:23] I just clarify? [1:54:25] Was EMS there as well on the last? [1:54:28] >> Not this last one because they called [1:54:30] they emailed you to cancel it. They said [1:54:31] they had only sold like 100 tickets. So, [1:54:34] you know, I replied, "Okay, [1:54:40] you know, I get people texting big [1:54:43] events, [1:54:45] firearms down here." [1:54:49] » So, [1:54:53] » okay, [1:54:56] >> this is justformational since you're new to the role. I just wanted to [1:55:00] um let you know that we did pass an [1:55:02] ordinance at the last meeting that you [1:55:05] know as you start going forward um we're [1:55:08] asking that everyone apply six weeks in [1:55:10] advance for licenses just for for [1:55:13] situations like this um just to make [1:55:15] sure that public safety and everybody [1:55:17] has a chance to weigh in. So I just want [1:55:18] to make sure you're aware it's new and [1:55:20] you're new and [1:55:20] >> Yes. Yeah. Paige told me. So now I'm [1:55:22] doing the state I have it in my my [1:55:24] agenda is that 8 weeks out I apply for [1:55:26] the state permit that should come in by [1:55:29] time for the six week. So [1:55:30] >> thank you so much. [1:55:31] >> Yep. You're welcome. [1:55:32] >> Any other questions of the applicant? [1:55:36] >> No. [1:55:37] >> Thank you so much. [1:55:38] >> Thank you very much. [1:55:41] >> Any motions or further discussion by the [1:55:43] council on this license? [1:55:44] >> Motion to approve. [1:55:46] >> I got a motion to approve by councel. Do [1:55:49] I have a second? [1:55:51] by council McIll. All in favor of [1:55:53] approve say I. Any opposed? The license [1:55:56] passes by a vote of seven to zero. [1:55:58] >> Thank you. Next item. We're moving down. [1:56:00] We are now at license number six. An [1:56:02] application for a special event license [1:56:04] for Franklin Farm for the harvest [1:56:06] festival event on September 26, 2026 [1:56:09] with a rain date of 20 uh September [1:56:11] 27th, 2026. This is 9 to5 uh p.m. [1:56:15] located at 142 Abbott Run Valley Road. [1:56:18] We do approve this license as pending [1:56:20] the insurance certificate. [1:56:22] Um Mudge, did you want to comment on [1:56:24] that or do do we have do we even need So [1:56:26] we we're quite familiar with that. Did [1:56:28] you someone stick their hand and wanted [1:56:30] to comment on that? Okay. If I don't see [1:56:32] any discussion from the me council [1:56:34] members, I'll take a motion to approve [1:56:36] it. [1:56:36] >> So moved. [1:56:36] by councelor Bolio. It has been [1:56:39] seconded by councelor. Was it sure? All [1:56:41] in favor to approve the license say I. [1:56:44] Any oppose? This license passes by a [1:56:46] vote of 7 to zero. We are now at all [1:56:49] business. [1:56:51] The first item uh we have on uh up for [1:56:55] public hearing is ordinance 26-06. It's [1:56:58] an ordinance amending the code of [1:57:00] ordinance regarding the disposition of [1:57:03] public property. This was tabled from [1:57:05] July 15, 2026 council meeting. And [1:57:08] before we go, um I am going to uh uh [1:57:12] need a motion to accept the A version of [1:57:14] this ordinance. [1:57:15] >> So move. [1:57:15] >> So moved by councelor Bolio second. [1:57:17] >> Second by councelor sweet [1:57:20] >> and sure. [1:57:21] >> All in favor to uh approve say I. [1:57:24] >> Any opposed. [1:57:27] >> Okay. We are now dealing with 260 uh 06A [1:57:30] as amended. I'm going to open the public [1:57:33] hearing at 8:34 PM. [1:57:39] Chairwoman Bole. Thank you, Mr. [1:57:42] President. So, we did hear this uh [1:57:44] ordinance today. It um in our [1:57:47] subcommittee and it received favorable [1:57:49] passage of 3 to zero. Uh what it does [1:57:53] address is the disposition of property [1:57:55] that could include uh equipment as well [1:57:59] as uh real estate property itself. Um [1:58:03] and it was intended to streamline the [1:58:06] processes uh for both of those areas. Uh [1:58:09] and in part as it relates to the um the [1:58:13] vehicle and equipment that they will [1:58:16] leverage the state bid list um or some [1:58:18] other you know public mechanism like [1:58:20] that. Um, and I don't know if you want [1:58:24] to add anything as you've been working [1:58:26] so hard in this councelor. [1:58:28] >> Um, ju just the original in intention of [1:58:33] redoing this ordinance was to give us [1:58:36] more options. Before this, we only had [1:58:38] one um pretty lengthy convoluted way to [1:58:42] sell property that the town had that it [1:58:44] might have an interest in selling. This [1:58:46] gives us a host of options all still [1:58:49] requiring approval from the council and [1:58:52] um it is in keeping with what our [1:58:54] neighbors are doing in the same type of [1:58:57] situation. Um the only major difference [1:59:00] is that I did leave the original system [1:59:03] in place. We just have additional [1:59:05] streamlined options now. [1:59:08] >> Excellent. Um thank you. So, what I'll [1:59:11] do is since the public comment is uh [1:59:14] open, is anybody in the audience would [1:59:17] like to comment on ordinance 26-06A is [1:59:20] amended? [1:59:24] I see no one in the chamber. Madame [1:59:26] clerk, anyone joining us virtually? [1:59:30] Okay. Um, so with that said, I'm going [1:59:33] to close the public hearing at 8:36 p.m. [1:59:38] and leave any motions or comments to the [1:59:40] council. [1:59:42] >> Sure. Question, [1:59:44] >> Mr. Bradley. [1:59:46] >> Is this going to allow us to uh sell [1:59:48] property out on the open market? [1:59:52] >> Yes. [1:59:54] >> Okay. [1:59:56] >> You could we could sell it um through a [1:59:59] real estate agent. We could sell it [2:00:01] through a public auction. Um, we could [2:00:04] sell it to a neighboring property owner [2:00:07] if they weren't trying to develop it. It [2:00:09] gives us a whole host of options and [2:00:11] vehicles and equipment can be se sold [2:00:14] through um, uh, sites that are like [2:00:18] public auction sites like MUN bid. So, [2:00:21] sort of eBay for local government stuff. [2:00:24] Um, so it gives us a whole host of [2:00:26] options for the best way to sell things [2:00:28] and get the best price. And we would of [2:00:30] course be voting on them before anything [2:00:32] was sold. [2:00:34] >> Yeah, the MUN bid for equipment. I [2:00:36] brought that up about five or seven [2:00:38] years ago. [2:00:39] >> Nothing was ever done with it. So, that [2:00:40] I'm good to see. However, I don't think [2:00:42] the town should be in the real estate [2:00:44] business [2:00:46] other than to sell it to an abuing [2:00:47] property owner that's going to add it to [2:00:49] their property. [2:00:51] >> Thank you, councelor. Any other [2:00:52] comments? [2:00:53] >> I I just want to be clear on the surplus [2:00:55] equipment and I want to review this for [2:00:57] a sec here. [2:01:00] the mayor get is the one that would um [2:01:04] sell the surplus goods in consultation [2:01:07] with a town department. So that would [2:01:09] not come to you. I just want to clarify [2:01:11] that real estate always comes to you, [2:01:12] but the surplus equipment would go on [2:01:15] the uh MUN bid or similar site. [2:01:19] >> That's at section F line. find it [2:01:27] » missing where we also have that [2:01:28] >> I think question [2:01:31] >> it it's my reading uh first of all I [2:01:33] appreciate the council taking up uh this [2:01:35] ordinance and I mentioned it for those [2:01:38] who are history buffs this was actually [2:01:39] passed in 1996 I'm not actually well [2:01:43] actually it was probably 1997 [2:01:45] um but um I'm not sure it was ever [2:01:48] actually uh executed in in any in any [2:01:51] manner But it is my reading under um on [2:01:55] section A where the town council shall [2:01:58] determine by resolution the manner in [2:02:00] which the real or tangible property is [2:02:03] to be sold. So, I do believe that I [2:02:05] could be mistaken, but I do think that [2:02:09] whatever the town was looking to uh [2:02:12] sell, there would be a resolution [2:02:15] um informing you as to what was being [2:02:19] sold in the manner in which it was being [2:02:21] sold and you would have an opportunity [2:02:23] to uh weigh in on whether or not you [2:02:25] thought that was appropriate. Um that's [2:02:28] my reading, but I could be mistaken. And [2:02:29] then the other the only other thing is [2:02:31] there needs to be during the committee [2:02:33] there was a spelling error on Y [2:02:35] >> line 101 that needs to be repaired. [2:02:37] Thank you. [2:02:38] >> So if you do want input on the surplus [2:02:40] equipment we should change [2:02:43] uh line [2:02:47] um [2:02:48] line 95 [2:02:53] to sorry line 96. when the mayor in [2:02:56] consultation with the relevant town [2:02:58] department determines [2:03:01] and then yeah [2:03:05] >> okay [2:03:07] >> we will pause [2:03:15] » is the qualified okay [2:03:21] » I'm sorry what line was the typo uh [2:03:25] And that should be qualified, right? [2:03:37] Can we correct those on the fly or I [2:03:39] need a B? [2:03:42] >> Yeah. No, you can correct them. Okay. [2:03:54] Madam solicitor, the second line after [2:03:56] 101 was what? 896. [2:04:00] » 96. [2:04:01] >> But we're not on Zoom again, right? Are [2:04:02] we on Zoom? [2:04:03] >> No, I won't do anything. I'm just I'm [2:04:04] just getting ready. That's all. [2:04:08] >> You're on. [2:04:10] >> Sandra Arts Live. [2:04:17] » Yes. Of course. You want me to take a [2:04:22] >> council doesn't mind? I'm just going to [2:04:24] take a threem minute recess. [2:04:27] >> Give her credit for that. [2:06:16] Yeah. [2:06:59] we can't complain. [2:07:01] Absolutely. You know how tough it is to [2:07:03] sweep in that league. Okay, the town [2:07:06] council is back in session. [2:07:09] Just to give us a quick uh recap, we are [2:07:12] now at ordinance uh 2606 [2:07:16] uh A is amended. Uh we have closed the [2:07:18] public hearing on this uh ordinance at [2:07:21] uh 8:36 [2:07:22] and now we are uh just discussions from [2:07:25] the council. I do have uh two [2:07:28] corrections we're going to make and I'll [2:07:30] take those in a second. I know uh on [2:07:32] line 101 we're going to fix the word uh [2:07:35] correctly spell it to qualified and [2:07:37] there was one more correction you wanted [2:07:39] to make on 96 madam solic [2:07:44] >> no it was um we're going to make a [2:07:47] slight amendment because [2:07:50] >> oh sorry [laughter] [2:07:52] >> because we want to um ensure that [2:07:55] there's no confusion. So, we're going to [2:07:57] um amend 10 line 101 where it says um it [2:08:01] starts above that the mayor or his [2:08:03] design is authorized. We're going to say [2:08:05] the mayor or his designate upon approval [2:08:08] by the council is authorized to enter [2:08:10] into an agreement. And that way it's [2:08:12] just clear that the council has to [2:08:14] approve any sale of property [2:08:19] >> and that's you said 101. So, it's the [2:08:22] same line is qualified. Yes. So, we're [2:08:24] just change making those t changes on [2:08:26] line 101. [2:08:27] >> Yes. [2:08:28] >> Okay. Madam Madam cler, [clears throat] [2:08:30] do you have those changes? Okay. So, um [2:08:35] is there any other um any other [2:08:38] questions? [2:08:40] So, I'm going to take a motion to [2:08:42] approve uh 26 [2:08:46] >> motion to amend. [2:08:47] >> Excuse me. Correct. a motion to amend [2:08:50] 2606A [2:08:52] by making changes to uh lines 101 that [2:08:56] were uh suggested by councelor uh and [2:09:00] you have those madam clerk right okay so [2:09:03] all in favor to approve those changes [2:09:04] say I I any opposed [2:09:07] >> the ch I'm I'm sorry [2:09:10] >> I made the motion [2:09:12] >> okay good [2:09:14] >> second was councelor Shaw [2:09:16] >> all in favor to amend say I I [2:09:18] >> any opposed? Okay, we are now again [2:09:21] dealing with uh uh 2606A [2:09:25] as amended. Um so with that said, is [2:09:29] there any other comments? I will take a [2:09:31] motion on the amended. [2:09:33] >> The the only comment I'll make is just [2:09:35] to sort of counter councelor Bradley. I don't understand how it would make [2:09:40] sense for the town to own property that [2:09:43] we may not need that maybe we acquired [2:09:45] in some way and then [2:09:48] could benefit from selling and not have [2:09:50] the right to sell it unless we sold it [2:09:51] to an abuter which would automatically [2:09:54] privilege any a butter that already [2:09:56] owned property to continue to get more [2:09:58] property. It doesn't really make any [2:10:01] sense to me. So, I'm hoping the rest of [2:10:03] the council is going to vote to approve [2:10:06] this so that the town has more [2:10:07] flexibility to sell things that it has [2:10:10] that it maybe doesn't need or that it [2:10:12] could benefit by selling since more [2:10:14] money for the town is always good. [2:10:17] >> Thank you, council. And I will counter [2:10:19] that with if you sell a piece of [2:10:21] property and you build a house, you sell [2:10:23] that piece of property for one-time [2:10:25] money. You now bring kids into the [2:10:27] school department. We've never adjusted [2:10:29] our impact fees. [2:10:31] So that just goes right on the homeowner [2:10:33] that that's already here. [2:10:35] >> Well, [2:10:35] >> so yeah, I'm not a fan of that. [2:10:37] >> And anytime we're going to adjust those [2:10:40] upwards, I will vote with you on that. [2:10:44] >> All set. No further discussion. Okay. [2:10:47] So, what I'll do now is I will go to the [2:10:50] I got a motion to approve and it was [2:10:52] seconded. So, I'm going to go to the [2:10:53] roll call. Councelor Bradley. [2:10:55] >> No. [2:10:56] >> Council Mativia. Yes. [2:10:58] Councelor Shaw, [2:10:59] >> yes. [2:11:00] >> Council McIll, [2:11:01] >> yes. [2:11:01] >> Councelor, [2:11:02] >> yes. [2:11:03] >> Councelor Bolio, yes. The chair also [2:11:05] votes yes. The ordinance passes by a [2:11:07] vote of 6 to1 with councelor Bradley in [2:11:09] the negative. Okay, we're moving down to [2:11:12] our next uh ordinance for public [2:11:14] hearing. We're at 26-17A. [2:11:16] We have an ordinance amending the zone [2:11:18] and ordinances of town of Cumberland, [2:11:20] Rhode Island. This was tabled from July [2:11:22] 15, 2026 [2:11:24] uh at that council meeting. I do need a [2:11:27] motion to accept 26-17A. [2:11:30] >> So move. [2:11:31] >> So moved by councelor Bolio, second by [2:11:33] councel Shaw. All in favor to amend say [2:11:36] I. Any opposed? [2:11:38] >> Hearing none, the ordinance is amended [2:11:41] uh by a vote of 7 to zero. I will open [2:11:44] the public hearing at 8:49 p.m. [2:11:50] Chairwoman Bolio. [2:11:53] >> Thank you, Mr. President. So this [2:11:55] ordinance um amends uh the storm water [2:11:59] management flood hazards, soil erosions [2:12:02] and sediment control and utilities to [2:12:04] comply with [sighs] department of [2:12:06] environmental management requirements. [2:12:08] And I'm reading from the letter on page [2:12:11] five. So the ordinance um improves the [2:12:14] required language uh that wasn't passed [2:12:16] in the April ordinance which council [2:12:19] approved on April 15th. Um and we are [2:12:24] changing the language from storm water [2:12:26] basins to storm water control measures. [2:12:30] Um additionally the planning department [2:12:32] wanted to provide guidance on [2:12:34] implementation and design of buffers [2:12:36] when commercial or industrial zones [2:12:39] about agriculture open space or [2:12:41] residential zones. Um, and the ordinance [2:12:44] was seen by the planning board at their [2:12:46] June 25th meeting, continued to the July [2:12:49] 30 meeting where they recommendations [2:12:52] received a 90-0 vote, passing [2:12:54] unanimously. Um, and then the state has [2:12:57] requested that the ordinance be updated [2:13:00] by the end of August. So, uh, this was [2:13:03] heard also this evening in ordinance [2:13:05] subcommittee and it received favorable [2:13:07] passage on a three to zero vote. [2:13:11] Thank you very much, councel. Um, [2:13:14] I'm going to go to the members of the [2:13:16] public. Would anybody in the public like [2:13:18] to speak on this ordinance? [2:13:21] Seeing none, I'm going to move [2:13:23] virtually. Is anybody joining us [2:13:25] virtually who wants to speak on this [2:13:26] ordinance? [2:13:28] Okay, no one's got their hand up, so I [2:13:30] will close the public hearing at 8:50 [2:13:33] and leave any comments or motions to the [2:13:36] council. So, just I would commend uh the [2:13:39] director of planning and community [2:13:40] development for the summary because it [2:13:43] was great and made it easy for a complex [2:13:45] ordinance to understand all of the [2:13:47] changes and I would move passage of that [2:13:49] ordinance. [2:13:50] >> I got a motion uh to pass by council [2:13:52] Bolio. Do I have a second? I got a [2:13:55] second by councel Shaw. I'll go to the [2:13:58] role. Uh councelor Bradley. [2:14:00] >> Council Mativia. [2:14:02] >> Yes. [2:14:02] >> Councelor Shaw. [2:14:03] >> Council McGill. [2:14:04] >> Yes. Councelor Swuite. [2:14:06] >> Yes. [2:14:06] >> Councelor Bolio. [2:14:07] >> Yes. [2:14:07] >> The chair also votes yes. This ordinance [2:14:09] passes [2:14:10] >> by a vote of 7 to zero. [2:14:14] >> Moving down on our next item. [2:14:17] We are at [2:14:20] ordinance 26-18. [2:14:22] We have an ordinance amending chapter 38 [2:14:25] article 3 entitled parking, stopping and [2:14:27] standing uh of the town of Cumbland's [2:14:30] code of ordinances presented by the [2:14:31] council president on behalf of the [2:14:33] administration. [2:14:35] I'm going to open the public hearing at [2:14:36] 8:51. [2:14:38] Turn it over to Chairwoman Bolio. [2:14:40] >> Thank you again, Mr. President. So, this [2:14:42] two was heard um in ordinance [2:14:44] subcommittee meeting this evening. It [2:14:46] too received favorable passage on a [2:14:49] three to zero vote. What this ordinance [2:14:51] does is it amends um uh the ordinance to [2:14:56] add uh Hope Street to the list of [2:14:59] locations for accessible parking [2:15:02] signage. Um I know councelor Mativier [2:15:05] did interact with the police department [2:15:08] to ensure you know this was a right best [2:15:10] fit. Um we asked that a letter be [2:15:13] submitted. Uh I think it typically [2:15:15] accompanies this. Uh, so we'll do that [2:15:18] as as a as a pending action. Um, but [2:15:21] again, it received favorable passage. [2:15:25] >> Thank you, Council Bolio. Before I uh go [2:15:28] to the public, uh, Mr. Mativity, do you [2:15:31] want to speak on this? [2:15:32] >> Um, I did speak with the the chief and [2:15:34] he is having them send over a letter. [2:15:37] >> Thank you. [2:15:38] councel. [2:15:41] >> I will go uh to the members of the [2:15:43] public. Anybody want to speak on this [2:15:46] ordinance? Seeing none, anybody joining [2:15:48] us virtually, I'm going to close the [2:15:51] public hearing [2:15:53] at 8:53. Take any comments or motions [2:15:56] from the council. [2:15:57] >> I make a motion to approve. [2:15:58] >> Counceling the receipt of the letter [2:16:00] from the chief. [2:16:02] >> Councel Bolio makes a motion to approve. [2:16:04] Do I have a second? Second by councelor [2:16:06] Shaw. We'll go to the role. Council [2:16:09] Bradley. [2:16:10] >> Councel Mativia. Councel Shaw. Yes. [2:16:13] Council McIll, [2:16:14] >> yes. [2:16:14] >> Council Sweet, [2:16:15] >> yes. [2:16:15] >> Council Bolio, [2:16:16] >> yes. [2:16:17] >> The chair also votes yes. The ordinance [2:16:19] passes [2:16:20] >> by a vote of seven to zero. [2:16:25] » Okay, we're moving down now. We are at [2:16:28] new business. Uh, first we have a claim [2:16:30] by Mr. Mark Costello. We are referring [2:16:33] that to the finance subcommittee. I also [2:16:36] have a claim from Jason Barry. We refer [2:16:38] to the finance subcommittee as well. [2:16:42] No, Jahan Miman. I'm going to refer that [2:16:45] to the finance committee as well. That's [2:16:47] our third uh third claim. Next on our [2:16:51] agenda is appointments. The first [2:16:54] appointment we have is a deputy parks [2:16:55] and recreation director, Miss Susan [2:16:57] Clark. Uh mayor, did you want to uh [2:17:00] comment on this appointment? [2:17:02] >> Yes. Thank you, Mr. President, members [2:17:04] of the council. So, Miss Clark has been [2:17:06] uh in an acting capacity for a little [2:17:09] while uh and has been doing an [2:17:10] outstanding job uh and is replacing uh [2:17:15] the previous deputy parks and director [2:17:17] up at the lodge McKenzie. So, we'd ask [2:17:19] you for favorable passage. Thank you. [2:17:21] Mayor. Does anyone have any [2:17:24] comments on this before I ask for the [2:17:26] cool? [2:17:28] >> Yes. [2:17:31] >> Oh, okay. [2:17:34] Why don't you put her on? [2:17:37] >> Thank you, Susan. Welcome and thank you [2:17:40] for the job you did filling in when we [2:17:41] needed you. [2:17:42] >> Oh, thank thank you very much. [2:17:46] >> Does anybody We won't keep you, I'm [2:17:47] sure. Does anyone have any questions for [2:17:49] the applicant? [2:17:52] >> Miss Clark, we have no questions for the [2:17:54] applicant. Your work spoke for itself. [2:17:56] So, I'm going to take a motion to [2:17:57] approve this uh appointment. [2:17:59] >> So, move. [2:18:00] >> So, moved by councelor Suite. was second [2:18:02] by councelor Shaw. All in favor to [2:18:04] approve say I. Any opposed? The [2:18:06] appointment passes by a vote of seven to [2:18:09] zero. Thank you for joining us, Miss [2:18:11] Clark. [2:18:12] >> Next item on our agenda, we're moving [2:18:13] down to our senior center assistant. Uh [2:18:16] we have Miss Tracy Goyette. Mayor M. [2:18:22] >> Thank you, Mr. President, members of [2:18:24] council. I don't know if Tracy is on the [2:18:26] call or not, and I must admit I was not [2:18:29] part of the uh of the interview process [2:18:32] here, but she uh received uh the uh the necessary approvals from uh Mr. [2:18:38] Cwley and and uh chief of staff, and we [2:18:41] would ask you to favorably act upon the [2:18:43] appointment of Tracy Goyette. [2:18:45] >> Thank you, Mayor. Uh I'm sorry, madam [2:18:47] clerk, you said she was online or no? [2:18:49] Okay, no problem. Um okay, thank you so [2:18:51] much. If there's no further question or [2:18:53] discussion on this appointment, I'll [2:18:54] take a motion to approve. Miss Goyette. [2:18:57] >> Motion by councelor Shaw, second by [2:19:00] councel McIll. All in favor to approve, [2:19:02] say I. Any opposed? Uh the uh [2:19:06] appointment passes by a vote of seven to [2:19:08] zero. Moving down, we have an [2:19:11] appointment uh for accounts payable. We [2:19:14] have Kathy Bido. Uh will uh Mayor, did [2:19:17] you want to handle this one as well? [2:19:19] >> Miss Bido is actually in attendance. uh [2:19:21] oh [2:19:22] >> this evening. So [2:19:23] >> haven't had the pleasure though. [2:19:24] Welcome. [2:19:26] >> Um [2:19:26] >> yes, this position uh if you're if the [2:19:28] council remembers was uh was held [2:19:30] previously by our uh new deputy finance [2:19:34] director and uh so Miss Bol, we're very [2:19:37] uh pleased to have her on staff and [2:19:39] would be uh asking for your approval [2:19:41] tonight. Thank you. [2:19:42] >> Thank you, mayor, and congratulations [2:19:44] and thank you. Uh does anyone have any [2:19:46] questions for the applicant? [2:19:49] Hearing none. I'll take a motion to [2:19:50] approve the appointment. [2:19:52] >> So move. [2:19:52] >> So moved by councelor Bolio, second by [2:19:54] councel McIll. All in favor to approve, [2:19:56] say I. I. [2:19:57] >> Any opposed? The appointment, [2:20:00] congratulations, passes by a vote of 7 [2:20:02] to zero. We're moving down our agenda [2:20:04] now. We are now at resolutions. We're at [2:20:06] resolution 26-35. [2:20:09] We have a resolution authorizing [2:20:11] empowering Mayor Jeffrey D. M to [2:20:12] purchase one 2025 Chevy Silverado, [2:20:15] $1,500 crew cab from Liberty Chevrolet [2:20:18] and a total not to exceed $49,299. [2:20:26] Chief Desert, [2:20:27] >> good evening. Um, so the previous [2:20:30] resolution back in June, um, [2:20:34] the Ford F-150 that was listed on that [2:20:36] resolution, um, was no longer available. [2:20:39] um we were unable to um find any Ford [2:20:44] F-150 that met that from any vendor um [2:20:46] in the New England region. So, uh we [2:20:49] would have had to order one, but the [2:20:51] time constraints on the lease are [2:20:53] required that we had to use that money, [2:20:55] those funds by the end of uh September, [2:20:57] I believe, or early September. Um so, [2:20:59] we're able to locate this 2025 uh Chevy [2:21:03] Silverado uh 1500, which um is is uh [2:21:07] certainly will satisfy our needs. Um, as [2:21:11] far as um, trailering and moving the [2:21:13] special operations trailer. [2:21:17] >> Any questions on this, Chief? I'll just [2:21:19] have one before I go on and look. [2:21:20] >> Sure. [2:21:21] >> Um, how many miles [2:21:23] >> on the new vehicle? It's brand new. [2:21:25] >> 2025. [2:21:26] >> Yeah, it is. It is brand new. Yes. [2:21:27] >> Okay. [2:21:27] >> Yes. [2:21:28] >> Oh, so [2:21:30] >> I asked the same question. Yes, it is [2:21:31] brand new. [2:21:35] » Any questions of the chief on this [2:21:37] purchase? [2:21:40] Okay. [2:21:41] >> Thank you, Chief. [2:21:43] >> The next one's mine, too. So, so [2:21:45] >> you want to stay right up here then? [2:21:46] >> Motion to approve. [2:21:48] >> Second. Do I have a second? Sec. So, I [2:21:50] got a motion to approve. Uh second by [2:21:53] Council Shaw. All in favor to approve [2:21:55] resolution 2635 say I. [2:21:57] >> Any opposed? The uh [2:21:59] >> resolution passes by a vote of 7 to [2:22:01] zero. Moving down with resolution 2636. [2:22:05] We have a resolution authorizing power [2:22:07] empowering mayor Jeffrey J. Mutter to [2:22:09] enter an agreement with Strobes and More [2:22:12] for the purchase and installation of the [2:22:13] emergency warning equipment, vehicle [2:22:16] console, [2:22:18] accessories, and related uplifting for [2:22:20] the for a 2025 [2:22:23] uh Chevy El Dorado [2:22:25] Silverado 1500 and the amount not to [2:22:28] exceed $18,919.98. [2:22:32] Chief Desert. [2:22:33] >> So, this uh this will allow for the uh [2:22:36] upfitting of the the the deputy's [2:22:38] vehicle, uh lights, siren, center [2:22:41] console, um mounting equipment, um etc. [2:22:47] » Also, uh in installation of a radio and [2:22:50] antennas, etc. Thank you. Any questions [2:22:53] of the chief on this purchase? [2:22:56] Hearing none or no discussion, I'll take [2:22:58] a motion to approve. So moved by [2:23:01] councelu, second by councelor Shaw. All [2:23:04] in favor of approve say I. Any opposed [2:23:07] purchase is approved by a vote of 7 to [2:23:10] zero. [2:23:11] >> Thank you. [2:23:11] chief. [2:23:12] >> Thank you. [2:23:12] >> Next item we're moving down to [2:23:14] resolution [2:23:15] uh 2637. We have a resolution [2:23:18] authorizing powering Mayor Jeffrey J. [2:23:20] Mutter to engage in uh Me O'Brien Sons, [2:23:24] Inc. for the purchase and installation [2:23:25] of equipment at Valley Falls Heritage [2:23:28] Park in the amount not to exceed [2:23:31] 86,778.50. [2:23:34] Mayor M. Oh, I'm excuse me, Miss King. [2:23:53] All right. So, good evening counselors. [2:23:56] Thank you as always for your time [2:23:58] tonight. Um, it was almost two years ago [2:24:01] exactly to the day that I stood in front [2:24:03] of you on August 21st to ask for uh the [2:24:07] approval for the EW Burman contract to [2:24:10] begin construction at the Amoral [2:24:12] building. Um, which is interesting [2:24:15] considering now I stand before you [2:24:17] asking for approval for this next phase [2:24:19] of the project. As you all know, the [2:24:22] Amoral building construction is [2:24:24] complete. The building is open. It's [2:24:26] been really successful and and nice to [2:24:28] see all the programming that people of [2:24:30] all ages have been able to enjoy in [2:24:32] there. Um, but as you may recall, and I [2:24:35] do have a few brief slides, we had two [2:24:38] kind of funding buckets that I would [2:24:40] describe for this project. The first was [2:24:42] the million dollars we had received from [2:24:44] the community development block grant [2:24:46] and that million dollars was solely for [2:24:48] the Amaral building that saw us from [2:24:51] design through construction of the [2:24:53] building. Then there was a second grant [2:24:56] which was through the state and is a [2:24:58] multi-purpose community learning center [2:25:00] grant that was $3.1 million. Now, that [2:25:03] grant allowed us to complete the Amaral [2:25:05] building, but the additional funds were [2:25:07] to be used at Valley Falls Heritage Park [2:25:10] with the idea being that they're so [2:25:12] close together that it would be a great [2:25:14] way to invest in the space to try to [2:25:16] connect those two spaces together. Um, [2:25:18] so we are able to use the grant funds [2:25:21] for the park so long as they directly [2:25:24] and jointly enable education, health, [2:25:28] and job training. [2:25:30] Um, so that kind of brings us to where [2:25:33] we're at right now. When we received [2:25:35] those funds, again, as you may recall, [2:25:37] we did a lot of community engagement [2:25:39] around what people wanted to see at the [2:25:41] park. And I appreciate everyone's [2:25:43] support during that process, whether it [2:25:46] was coming to the community dinner or [2:25:48] the design workshops. All of those [2:25:50] things led us to creating a master plan [2:25:53] for Valley Falls Heritage Park, which [2:25:56] was always intended to be a long-term [2:26:00] plan with several phases. The first [2:26:03] phase being funded by this grant to [2:26:06] build an outdoor classroom [2:26:08] um and some connectivity from the [2:26:10] Emerald Building to the park. Um, so [2:26:15] there were kind of a lot of [2:26:16] conversations as you can see from this [2:26:19] graphic that was made during our [2:26:20] community engagement about what people [2:26:22] wanted to see, what was allowed to [2:26:25] happen at the park with our covenant [2:26:27] from DEM, which is really about passive [2:26:31] um, recreation, but a lot of the common [2:26:33] themes were education, gathering spaces, [2:26:37] places for field trips with the tourism [2:26:39] council right there through the [2:26:41] Blackstone River waterhed. Um, so that [2:26:44] really is why we focused on getting an [2:26:46] outdoor classroom space. And as you can [2:26:49] see, this picture kind of shows you the [2:26:52] area of the park where the classroom is [2:26:54] going to be placed. It's going to be [2:26:56] placed on the main island portion of the [2:26:58] park. If you're familiar with Heritage [2:27:00] Park, there had been some discussion [2:27:02] about um doing kind of amphitheater [2:27:05] style in the grading. That was not [2:27:07] feasible. Um, and quite frankly, it [2:27:10] makes the most sense to do it on the [2:27:11] flattest portion where people can gather [2:27:14] and see the water, be close to the [2:27:16] water. So, that's why we focused on that [2:27:19] main island space. So, the proposal that [2:27:21] you see before you from Emmy O'Brien and [2:27:23] Sons will replace the existing [2:27:27] uh picnic tables that you see in this [2:27:30] photograph. will um put a new trash [2:27:33] recepticle and then in the open space [2:27:36] that you see on the island. There will [2:27:38] be a large shade structure. Um there [2:27:42] will be amphitheater style benches [2:27:44] placed underneath that shade structure [2:27:46] and a stage will actually be built and [2:27:49] installed under the shade structure as [2:27:52] well. The installer will do grading in [2:27:55] that area. They will actually be moving [2:27:57] be removing the gr the grass in the [2:28:00] square portion where the shade structure [2:28:02] is to allow for easier maintenance and [2:28:05] we'll be putting in a compacted granite [2:28:07] um so that stone so that we're able to [2:28:10] maintain that space and maintain ADA [2:28:13] accessibility there. Um, this is this [2:28:16] doesn't show the stage, but this shows [2:28:18] you the type of shade structure that [2:28:19] we're going to be installing the [2:28:21] benches, the new picnic tables, and the [2:28:24] trash can. And Emmy O'Brien and Sons was [2:28:28] eager to help us with this project, and [2:28:30] we we had a timeline that they were able [2:28:34] to meet, and they are part of a [2:28:36] cooperative purchasing agreement, which [2:28:38] allowed us to engage with them directly. [2:28:40] The name may sound familiar to you. [2:28:42] We've worked with them several times [2:28:44] before, whether on the monastery [2:28:46] playground, and the school department [2:28:48] has used them for all of the new [2:28:49] elementary school playgrounds, which [2:28:51] have been very successful. So, we're [2:28:54] just looking to kind of really kick off [2:28:56] this next portion of the project and tie [2:28:59] together two really special places in [2:29:01] Valley Falls. So, with all that being [2:29:03] said, I respectfully ask for passage and [2:29:06] I welcome any questions that anyone may [2:29:08] have. [2:29:09] >> Thank you, uh, Mr. King. I I do have a [2:29:11] question if no one else is where's the [2:29:13] timeline for completion on this? [2:29:15] >> So everything soup to nuts will be [2:29:17] installed by the end of October. [2:29:19] >> Okay. Do Yeah. No. Yeah. I'll be one [2:29:23] quick [2:29:25] I'll pass this maybe even on to the [2:29:27] mayor. We build it. It's there. Do we [2:29:30] have or will we'll have a program to [2:29:32] maintain it? I mean, is this something [2:29:33] the classroom space by a whim that the [2:29:37] BF Norton can walk over to or are they [2:29:40] going to be able to call and [2:29:43] um [2:29:44] secure [2:29:46] it and it's clean? [2:29:48] >> Yeah. I mean, they it's a public park. [2:29:51] They wouldn't need to call us to secure [2:29:53] it. I know they do a walking field trip [2:29:55] usually to the park every year anyway. [2:29:57] They usually stop at town hall and have [2:29:58] lunch at the park. Um, we are we [2:30:01] specifically designed materials that [2:30:02] were or picked materials that were going [2:30:04] to be very easy to maintain. That's also [2:30:06] why we're taking out that grass area. [2:30:08] Okay. [2:30:09] >> Um, everything will be installed into [2:30:11] the ground. It's not movable. Um, the [2:30:15] shade structure she has in very large [2:30:18] parks and in cities that haven't been [2:30:21] damaged and things like that. So, will [2:30:24] we have to maintain it? Yes. Is it [2:30:27] something that's specifically designed [2:30:28] to be very easy to maintain? Also, yes. [2:30:31] The stage is going to be like that fake [2:30:34] wood. I can't think of the name. And [2:30:35] there's going to be an anti-slip [2:30:37] material put on it. So, it should be [2:30:38] easy to clean. [2:30:39] >> I just want to know, you know, if [2:30:40] they're going to walk down there, as we [2:30:42] say spontaneously, we're going to hold [2:30:44] the class there. When they get there, [2:30:46] are they going to be surprised that they [2:30:48] can't use it after they move that group [2:30:50] of kids a few blocks down? That's that's [2:30:53] all. [2:30:54] >> Yeah. I mean I we will make every effort [2:30:56] to maintain it as fast as humanly [2:30:58] possible. [2:30:59] >> Mr. Mativia, [2:31:02] >> thank you. The um the entrance that was [2:31:04] originally designed to connect it, is [2:31:06] that not happening at all or just [2:31:07] postponed or [2:31:08] >> So um that is part of a a different [2:31:11] grant that's a streetscape specific [2:31:13] grant. Um the primary focus of that [2:31:16] grant um which we're in the works of of [2:31:19] getting underway is um a crosswalk that [2:31:24] we've gone back and forth with public [2:31:25] safety a little bit on exactly where [2:31:27] that crosswalk should be um and whether [2:31:29] we can elevate it or not um in terms of [2:31:32] snow plowing. [2:31:34] fixing the sidewalks and then having uh [2:31:38] doing some tree plantings, clearing the [2:31:40] overgrown brush and creating a more [2:31:42] visible entryway from that portion of [2:31:44] Mil Street. [2:31:45] >> So, there will be an entrance there. [2:31:47] Okay. And any of the other um So, that [2:31:50] is I thought it was off the table. So, [2:31:52] it's it's still [2:31:53] >> the entry from Mil Street will still be [2:31:55] happening. And our goal is I mean, [2:31:58] ideally, I'd love to see the entire park [2:32:00] redone. Um, we're actively applying for [2:32:02] grants for other phases, but we're [2:32:04] trying to take it in manageable pieces [2:32:06] at a time. [2:32:07] >> So th those two phases are the ones that [2:32:09] are going to go forward. [2:32:10] >> Those are the ones that we have secured [2:32:11] funding for and we'll be executing. [2:32:13] >> Thank you. [2:32:15] councel. Any other questions, [2:32:17] Miss King? [2:32:19] >> May I? Just a comment. [2:32:20] >> Council, [2:32:21] >> just excited to see this coming together [2:32:23] and that there's more outdoor spaces to [2:32:26] welcome the public to. I know how big [2:32:28] the attendance now is at the Diamond [2:32:31] Hill Park and the monastery is always [2:32:33] full of people enjoying the outdoors. [2:32:36] So, really happy to see this. Thank you. [2:32:37] >> Yes, us too. Thank you. [2:32:39] >> Thank you. [2:32:40] >> Anyone else? Thank you, uh, Miss King. [2:32:46] » Okay, with that said, if there's no [2:32:47] further comment, I'll take a motion to [2:32:49] approve resolution 2637. [2:32:52] >> So, moved by councel Mativia. It was [2:32:55] second by councelio. [2:32:57] >> Yes. And uh I will take for all excuse [2:33:01] me all in favor say I. [2:33:03] >> I. [2:33:03] >> Any opposed? [2:33:05] >> The resolution passes by a vote of seven [2:33:08] to zero. [2:33:09] >> Thank you counselors. [2:33:10] >> Thank you. Nice uh nice job sir. Um [2:33:13] we're moving down now to item D. We're [2:33:17] ordinance for presentation and [2:33:18] permission to advertise. First one we [2:33:20] have 20 ordinance 2619. We have an [2:33:23] ordinance authorizing temporary parking [2:33:25] on Tower Hill Road on September 7th on [2:33:29] westbound from 100 ft before pole 60 and [2:33:32] continuing to poll 61 presented by [2:33:35] council president Kinch. Uh it's [2:33:38] referred to the uh ordinance [2:33:40] subcommittee. [2:33:42] Uh next um we have ordinance 2620. We [2:33:46] have an ordinance amendment amendment of [2:33:48] the code of ordinances amending the [2:33:50] zoning map thereof with reference to [2:33:52] Cumberland Assesses Plat 058 lots 81 82 [2:33:56] and 83. We're going to refer this to the [2:33:58] ordinance subcommittee. Um we are now at [2:34:01] ordinance 26-21. We have an ordinance [2:34:04] authorizing the placement of a stop sign [2:34:06] the intersection of Rapid Hill [2:34:09] Rabbit Hill Road and uh England Street [2:34:11] presented by councelor Bolio. We're [2:34:12] going to refer this to the ordinate [2:34:15] subcommittee. Um, ordinance 26-22, we [2:34:18] have an ordinance amending the zoning [2:34:20] ordinance related to data centers [2:34:22] presented by counceloruite, also [2:34:24] referred to the ordinance subcommittee. [2:34:26] Uh, next we have ordinance 26-23. We [2:34:29] have an ordinance amending the zoning [2:34:31] ordinance of the town of Cumberland, [2:34:32] Rhode Island, presented by the council [2:34:34] president on behalf of the [2:34:35] administration. Moving down, we are a [2:34:38] seven. Uh, we have ordinance 26-24. We [2:34:41] have an orders establishing a no parking [2:34:43] zone on Thompson Hill uh Drive, Thomas [2:34:46] Drive, and Westbrook drives presented by [2:34:48] councelor Suite. I'm going to refer that [2:34:51] as well to the ordinance subcommittee. [2:34:53] No discussion. I'm going to move on. The [2:34:55] next item is our public comment section. [2:34:58] If anybody would like to address the [2:35:00] council, please step to the podium, [2:35:02] state your name and address for the [2:35:03] record. [2:35:13] Yeah, we'll see how far. [2:35:14] >> All right, let me just get my clock out [2:35:17] here. [2:35:19] >> Good evening, council members. I'm Janet [2:35:21] Preventure. I live at 3383 Mendon Road [2:35:24] in Cumberland. [2:35:26] I've written something. It's a little [2:35:28] later than I anticipated it to be, so [2:35:30] I'm going to shorten it up a little bit. [2:35:32] Um, [clears throat] [2:35:34] I wanted to talk with you tonight about [2:35:36] flock cameras and flock safety. [2:35:39] uh and the cancellation of our town's [2:35:41] contract with flock safety as well as [2:35:43] the removal of their ALPR cameras. Um I [2:35:46] reached out to the council via email [2:35:48] with several articles as well as some [2:35:49] letters from the ACLU of Rhode Island [2:35:51] and requested this topic be added to [2:35:53] this meeting's agenda. Coincidentally, [2:35:55] just before I sent my email, the ACLU [2:35:57] sent you an email of their own with the [2:35:59] same request. um as a woman of from East [2:36:02] Providence has now filed a federal [2:36:04] lawsuit against the town for the use of [2:36:07] their flock cameras to uh allegedly [2:36:10] misidentify her and lead to her wrongful arrest. So uh I was let I was [2:36:16] informed I could speak in the public [2:36:18] comment section. I pushed back because I [2:36:20] feel like this is a very important [2:36:21] issue. Um, and I was then con contacted [2:36:24] by council president Kinch uh that I was [2:36:27] welcome to speak during the comment that [2:36:28] we will have a complete review as soon [2:36:30] as we discuss the town solicitor due to [2:36:31] the pending lawsuit. Very much heard. [2:36:35] Um, so as we await the complete review, [2:36:37] I'd like to speak briefly about the [2:36:39] dangers of flock safety, what they do [2:36:41] with our information, and what anyone [2:36:42] can do with our information and the urge [2:36:45] the council to do the right thing for [2:36:47] our town and for our neighbors. [2:36:49] Uh, for those who don't know, the [2:36:50] acronym ALPR stands for automated [2:36:53] license plate reader, which is the [2:36:54] designation Flock has given their [2:36:56] cameras installed all around the [2:36:57] country. However, these cameras capture [2:36:59] a whole lot more than just your license [2:37:00] plate. These cameras capture your car, [2:37:03] your roof and back racks, bumper [2:37:04] stickers, and even you. At any point, an [2:37:07] investigator can go into a search system [2:37:09] cameras use and look up your vehicle. [2:37:11] They'll then be granted access to every [2:37:13] photo taken of your car by flot camera [2:37:15] in the past 30 days [2:37:17] by cameras in their jurisdiction. This [2:37:20] means they can piece together your daily [2:37:21] routine. They can see when you pick up [2:37:23] your prescriptions at CVS, when you drop [2:37:25] your kids off at their high school, when [2:37:26] you fill your gas tank at Cumberland [2:37:28] Farms. Did I mention that the cameras I [2:37:30] just listed are all currently active on [2:37:31] Mendon Road in these exact locations? [2:37:34] You might think, "Oh, well, if an [2:37:35] investigator is the only person who can [2:37:37] see what I've been up to, that must not [2:37:38] be too bad. not too unsafe. Though you [2:37:41] may be told that your daily routine is [2:37:43] not only Though you may be told that [2:37:45] your daily routine is only to be viewed [2:37:46] by officers of the law for 30 days after [2:37:48] the photos were taken, they are far from [2:37:50] the only people who can see it and for [2:37:52] only a fraction of the time that Flock [2:37:54] Safety has granted themselves. Their [2:37:56] updated contracts now grant them the [2:37:57] exclusive right to determine and control [2:37:59] the method, timing, format, and medium [2:38:02] of access to your data and grant the [2:38:04] company a perpetual right to it. In [2:38:06] other words, to do with whatever they [2:38:08] want forever. [2:38:11] That information is terrifying in the [2:38:13] hands of anyone, let alone an [2:38:15] investigator who may simply be curious [2:38:16] about you. Curiosity, it turns out, is [2:38:19] all they need as reason to find you in [2:38:21] the system. For many search sessions of [2:38:23] Flock Database, the reason for search [2:38:26] was simply listed as investigation with [2:38:28] no further explanation as to why they [2:38:30] needed to find someone. Days ago, a [2:38:33] Massachusetts police officer was accused [2:38:34] of using a flot camera to stalk her [2:38:35] ex-girlfriend, but inputting her license [2:38:37] plate into the system and tracking her [2:38:39] whereabouts. That is unfortunately far [2:38:41] from the first time and will most likely [2:38:44] not be the last time an officer [2:38:46] willfully abuse the system to stop an [2:38:47] innocent person. These cameras are also [2:38:49] incredibly easy for an outside party to [2:38:51] access and with the right skill set in [2:38:53] network administration and cyber [2:38:54] security can be routed directly to an [2:38:56] individual's system at home. [2:38:59] There are almost no safeguards stopping [2:39:00] someone from watching your neighbors, [2:39:02] your kids, or you from the comfort of [2:39:03] their own home. If you're finding this [2:39:05] overwhelming and hard to believe, don't [2:39:07] worry. So do I. The research deep dive [2:39:10] I've done into flock safety and their [2:39:11] cameras goes much further than what I've [2:39:12] mentioned here. And I brought with me [2:39:14] some printouts of my sources that I have [2:39:16] also emailed to the council. Um, so you [2:39:19] can do the research for yourself. [2:39:21] Uh, if the council is to work in our [2:39:24] town's best interest, oops, I skipped a [2:39:26] line here. [2:39:28] Next year, we are set to renew our [2:39:30] contract with Flock Safety, which means [2:39:32] our contract is almost up. So, there is [2:39:34] still hope. If the council is to work in [2:39:36] our town's best interest, by this time [2:39:38] next year, we could be free of flock [2:39:39] cameras, which, did I forget to mention [2:39:41] continue to record after contract [2:39:43] cancellation unless physically removed. [2:39:46] I digress. I'm here to warn my neighbors [2:39:48] and the council who represent us of the [2:39:50] immeasurable danger of flock safety's [2:39:52] ALPRs and of their chance to ri [2:39:54] Cumberland of such a threat. I do hope [2:39:56] after hearing me today looking in the [2:39:58] eyes of a rightfully frightened citizen [2:40:00] of Cumberland that you will do the right [2:40:03] thing when it comes to the time and [2:40:04] remove block surveillance from our [2:40:05] streets. Thank you. [2:40:07] >> And thank you very much. [2:40:09] >> Anyone else? Clap if you'd like. That's [2:40:12] okay. [laughter] [2:40:14] >> That's not a problem. [2:40:17] We do I I did let uh Janet go a little [2:40:20] bit longer. We try to keep it around [2:40:22] three, but uh you know, we're going to [2:40:24] be a little lenient. and I know this [2:40:25] means a lot to a lot of people. [2:40:28] >> Thanks. Uh my name is Jonah Filibar, [2:40:31] also a resident of 3383 Mendon Road in [2:40:34] Cumberland. Um I wanted to speak just a [2:40:37] little bit more on the technical side of [2:40:39] block safety cameras. Uh I am a [2:40:42] development and operational engineer at [2:40:44] a medtech company. So part of my work [2:40:46] involves vetting software and hardware [2:40:49] components that are used in medical [2:40:51] equipment. um just to lend some [2:40:54] credibility to the things that I was [2:40:56] going to say. Um one of the big tools [2:40:59] that I use in determining the safety of [2:41:02] uh software hardware component is [2:41:04] whether or not it has an entry into the [2:41:06] national security vulnerability [2:41:07] database, which is an open-source um [2:41:10] database filled with uh discovered uh [2:41:13] vulnerabilities in software and [2:41:15] hardware. Um, [2:41:17] for context, if I find even one [2:41:20] pertinent entry into the database that [2:41:22] relates to the device, that is [2:41:23] absolutely off the table. We can't have [2:41:25] that sort of risk in a medical device. [2:41:28] Uh, the last time that I checked, Flock [2:41:30] Camera has 57 entries and 33 confirmed [2:41:34] vulnerabilities. [2:41:37] I have never seen that many [2:41:40] vulnerabilities for a device. [2:41:43] Um I was hoping to explain one of them [2:41:45] in a little more detail uh using words [2:41:48] that might be in terms that people can [2:41:50] understand just so you can see how wide [2:41:52] open they are. Um [2:41:55] this particular exploitation takes [2:41:57] advantage of what is called diagnostic [2:41:59] mode on the camera. Diagnostic mode can [2:42:02] be entered by repeatedly pressing the [2:42:03] power button on the back of the camera. [2:42:05] I want to say ahead of time these things [2:42:07] were all discovered using the right to [2:42:08] repair. Um, I'm not divulging [2:42:12] flock secrets here. Um, they've pretty [2:42:15] much divulged them themselves. You can [2:42:18] press the button repeatedly or if the [2:42:20] camera receives any damage, it will it [2:42:22] will enter diagnostic mode as well. So, [2:42:24] you can remove the cell card. The camera [2:42:26] remain entirely functional, but it will [2:42:27] enter diagnostic mode. From there, the [2:42:30] camera will start broadcasting a Wi-Fi [2:42:32] hotspot. This is intended for [2:42:34] technicians to access the camera's [2:42:35] features. Um, among the features [2:42:38] available from the hotspot are the [2:42:40] domain name server on port 53, which is, [2:42:43] if you're not familiar, kind of like a [2:42:45] road map of the internet. It's how the [2:42:47] device understands where to reach [2:42:48] things, meaning a slight edit to that, [2:42:51] and you can be sending your traffic to [2:42:53] wherever you like instead of the Flux [2:42:54] home servers. It includes the HTTP [2:42:57] server on port 8080, which is a [2:42:59] transport protocol so vulnerable that if [2:43:01] you've attempted to click a HTTP link on [2:43:04] your computer before, your browser will [2:43:05] warn you, don't click this, your data is [2:43:08] vulnerable. You are probably about to [2:43:10] get robbed. If all of that is too [2:43:12] complicated, and it really isn't, these [2:43:15] are sort of entry- level concepts in [2:43:17] network administration. They also just [2:43:20] explo expose the camera feed directly on [2:43:22] port 1 2 3 4. The hotspot is password [2:43:26] protected, but Flock has hardcoded the [2:43:29] exact same password onto every device in [2:43:32] plain text. So, it's no small wonder [2:43:35] that it is common knowledge that the [2:43:37] password on Flock cameras is with a near [2:43:40] lethal dose of irony security. [2:43:43] No capitals, no symbols, the same for [2:43:47] every camera. [2:43:49] These cameras are the sloppiest piece of [2:43:52] hardware I've ever had the misfortune of [2:43:53] looking into. And I can say with [2:43:56] absolute certainty that they have not [2:43:58] passed any sort of third party security [2:44:00] audit. [2:44:02] These devices are used by law [2:44:04] enforcement, a field where a mistake can [2:44:07] destroy a life or cost the town a [2:44:09] lawsuit as you know. And I hope that you [2:44:13] will remove them at the soonest [2:44:14] possibility and put some serious [2:44:16] scrutiny into how it came to be. these [2:44:18] cameras were installed in the first [2:44:19] place. [2:44:20] >> Thank you. [2:44:21] very much. [2:44:24] >> Anyone else? [2:44:29] » Welcome, sir. Just again, state your [2:44:31] name and address for the record. [2:44:32] >> Only gave myself two minutes, so [2:44:37] » Hi. Uh my name is Robert Potter. Uh [2:44:39] resident of 51 Front Street, apartment [2:44:41] 335. Um, I'm addressing the council as a [2:44:45] member of Rhode Island Rhode Islanders [2:44:47] for personal privacy as well as a me uh [2:44:50] Cumberland resident. Um, speaking in [2:44:52] support of ordinance number 26-22. [2:44:56] Um, and I want to thank councelor uh for [2:44:59] proactively addressing this issue and [2:45:01] bringing it to the forefront regarding [2:45:03] data centers in uh potential um zoning [2:45:07] for data centers in Cumberland. From the [2:45:10] perspective of a RIP member, uh we do [2:45:13] oppose data centers across the state. Um [2:45:17] well, you might ask yourself, how does [2:45:19] personal privacy and data centers kind [2:45:21] of mix? Uh it's less on the direct [2:45:24] impacts of data centers in terms of [2:45:26] their physical presence, more in the how [2:45:29] the impact of how data centers are used, [2:45:32] particularly in terms of uh artificial [2:45:35] intelligence and AI models. [2:45:39] um just in terms of like how data is [2:45:42] collected to build those AI models and [2:45:45] to train those AI AI models just [2:45:47] constantly hoovering up uh personal [2:45:50] information through people's uh internet [2:45:52] usage as well as just how some end users [2:45:55] are using those AI models um in terms of [2:45:58] business use from a the perspective of a [2:46:01] Cumberland resident um I oppose it [2:46:03] personally just in terms of the direct [2:46:06] impacts they have on communities not [2:46:08] only in the direct energy um increased [2:46:11] energy costs for user uh other residents [2:46:14] in the town but also in the long-term [2:46:18] impact for maintenance costs for upsized [2:46:21] utilities that are required to m uh to [2:46:24] meet the demands of these uh AI data uh [2:46:27] data centers. [2:46:29] Additionally, there's potential [2:46:31] increased water usage for some of these, [2:46:33] but there are al also uh different [2:46:35] design models that use air cooled um [2:46:39] technology rather than water cooled. [2:46:41] That said, those air cooled models do [2:46:44] tend to have um other impacts, [2:46:47] especially some AI or data centers that [2:46:49] use turbine generators which uh present [2:46:53] uh concerns related to air quality for [2:46:57] uh surrounding residents as well as [2:46:59] health effects due to uh increased noise [2:47:02] um both in the um long-term and [2:47:05] short-term health effects on that. So, [2:47:07] in that case, we do oppose them from [2:47:08] that perspective as well. Thank you. [2:47:11] for coming down, sir. [2:47:15] Anyone else can address the town council [2:47:17] on any topic if they wish. [2:47:22] Welcome. [2:47:29] Good evening. Thank you for your time. [2:47:31] My name is John Downey. I'm from 61 [2:47:33] Pinehurst Avenue, Providence, Rhode [2:47:34] Island. I'm here tonight on behalf of [2:47:37] both Rhode Islanders for personal [2:47:38] privacy and climate action Rhode Island. [2:47:40] And first and foremost, I would like to [2:47:43] also indicate my support for uh [2:47:46] ordinance 2622 as well. I think it's uh [2:47:49] incredibly insightful. Um as was stated [2:47:53] just before, uh the environmental [2:47:55] impacts are [2:47:57] never overstated. um the water usage, [2:48:02] the pollutants that are emitted during [2:48:03] construction and after construction. Um [2:48:06] the noise has been consistently [2:48:08] complained about by just about every [2:48:09] community that's had one built. And [2:48:13] um the use of turbines has also been [2:48:15] proven to pollute as well in the [2:48:17] instances that those are used. Uh as for [2:48:20] the flock cameras, um I agree with [2:48:23] everything that's been said already. Uh [2:48:25] I'm from Providence which is a city that [2:48:27] has many flock cameras as it is. Um I [2:48:31] can safely say that uh very few people [2:48:33] feel safer for having them there. A lot [2:48:35] of people feel more paranoid. Morale is [2:48:37] lower. Uh recently it was discovered [2:48:39] that um similarly to what has been [2:48:42] stated before, uh these cameras can lock [2:48:44] onto the Bluetooth signatures put out by [2:48:47] people's phones. Uh despite the [2:48:49] company's insistence that that's not the [2:48:51] case. Um, many police officers, [2:48:54] including a police officer from Pucket, [2:48:56] uh, have come forward and expressed [2:48:58] their concerns involving the security of [2:49:00] these cameras. And for those reasons, [2:49:03] um, I am against them being really [2:49:06] anywhere. So, thank you for your time. [2:49:09] Have a good night. [2:49:09] >> Thank you very much for your comments, [2:49:12] >> sir. Welcome. [2:49:14] >> Thank you, Mr. President. [2:49:15] >> It's my my pleasure. [2:49:21] My name is Randall Rose. Um, [2:49:23] unfortunately I am also from Providence. [2:49:26] Um, 20 Lewis Street in Providence. Um, [2:49:29] but um, and also a member of Rhode [2:49:31] Islanders for personal privacy like some [2:49:33] of the Cumberland residents and [2:49:34] non-residents who have spoken. Um, I [2:49:38] >> I would came here mainly um to support [2:49:41] the data center ordinance by [2:49:43] Councilwoman Suite um, 2622. Um, but I [2:49:48] feel that as a non-resident for C of [2:49:51] Cumberland, I really should, um, leave [2:49:53] it to Cumberland residents to decide on [2:49:55] this. Um, I think it's great that, um, [2:49:59] PE residents are speaking up more and [2:50:01] more in their communities and wanting to [2:50:03] have a voice. Um, because, you know, um, [2:50:06] a lot of the national leaders or even [2:50:09] some of the state leaders have been [2:50:10] saying, let's just build data centers [2:50:12] all over the place and not really giving [2:50:14] local residents a voice. And I think we [2:50:16] have um more democracy at the local [2:50:18] level. I think it's really important for [2:50:21] local residents to decide do we want to [2:50:23] have these co costs and um repercussions [2:50:27] from data centers. Um town places that [2:50:30] have lots of data centers often find [2:50:33] that the place is physically hotter just [2:50:35] because it's so hard to cool um a place [2:50:38] with a thousand computers in it. And um [2:50:41] each generation of computers takes up [2:50:43] generates more and more heat. has more [2:50:45] and more difficulty cooling. Um, I'm a [2:50:47] former software engineer, so I know [2:50:49] about that. Um, so I I don't want to be [2:50:52] heavy-handed. I um but I'm glad that um [2:50:55] that residents of Cumberland are [2:50:58] starting this discussion and deciding [2:51:00] what kind of policy they they want to [2:51:02] have on data centers because it should [2:51:04] be up to the residents. Um and I think [2:51:07] um and I we are not an anti-tech group [2:51:10] but we believe that the people should [2:51:12] have a voice um on the the main tech [2:51:15] issues of our time which includes um [2:51:17] surveillance cameras, artificial [2:51:19] intelligence and data centers. Those are [2:51:21] the three issues we concentrate on. And [2:51:24] um we um and I didn't have anything [2:51:27] prepared about flock cameras, but [2:51:29] usually when a town's flock camera [2:51:31] contract is up for renewal, I prepare a [2:51:34] legal analysis of the contract. And I [2:51:36] have not specifically looked through [2:51:38] Cumberland's contract yet, but in every [2:51:40] town's contract I've seen, um, just, um, [2:51:44] continuing the point that Robert made [2:51:46] earlier, um, every town's contract I've [2:51:49] seen, um, bans the town from doing its [2:51:53] own independent security audit of flop [2:51:55] cameras. It says you cannot um you [2:51:58] cannot independently um um look into the [2:52:03] um device to see what his security [2:52:06] vulnerabilities are. Um they prohibited [2:52:08] that legally. Um and that's part of how [2:52:11] the flop cameras are so unreliable, so [2:52:14] open to hacking. And of course in modern [2:52:16] warfare, one of the first things that's [2:52:18] targeted in modern warfare is they hack [2:52:20] into these systems. So, um, so it makes [2:52:23] it open to foreign militaries, hackers, [2:52:25] and all sorts of people. Um, but I'm [2:52:28] glad that people are starting this [2:52:29] discussion, and I realize this this is [2:52:31] just about putting the one ordinance out [2:52:34] to advertise, and flock isn't even on [2:52:36] the official agenda yet, but these are [2:52:38] going to be important going forward. So, [2:52:40] thanks for addressing them. [2:52:41] >> Thank you. [2:52:43] Anyone else? [2:52:46] And I will let him I'll just let the [2:52:48] folks that are uh know that we will have [2:52:52] um councelor's ordinance in front of us. [2:52:55] This is as you know this was just to [2:52:57] advertise it. We will have a public [2:52:59] hearing on that and of course uh being a [2:53:02] public meeting you're more than welcome [2:53:03] to attend uh that public hearing. So we [2:53:07] have someone uh can I'll finish. I think [2:53:10] this miss did you want to address the [2:53:11] council please? [2:53:15] Just state your name and address for the [2:53:17] record. [2:53:21] » Hi. So, my name is Natalyia Rosemill. [2:53:23] Um, I'm also with Rhode Islanders for [2:53:26] Personal Privacy and also coincidentally [2:53:28] I'm a community member in Cumberland. [2:53:30] Um, I work at 3383 Mendon Road. Um, hi [2:53:34] guys. Um, I definitely did not intend on [2:53:38] speaking at all, but I just wanted to [2:53:40] publicly support um, everything that was [2:53:43] just said about flock cameras. I was [2:53:45] here um, about Councilwoman Suites [2:53:48] ordinance. I wanted to show up in [2:53:50] support for that. Um, so hopefully I'll [2:53:52] be back when we are having the public [2:53:54] hearing about that. Um but I think my [2:53:57] main point is that just regarding both [2:53:59] of those issues, data centers and block [2:54:02] cameras that is has such a big impact on [2:54:06] the community and community members that [2:54:09] I think it is um just the one of the [2:54:12] most important things is that it is the public and the community is [2:54:17] consulted about these things and that [2:54:19] their voice is considered in the [2:54:21] decision to hopefully you guys will be [2:54:24] considering your decision to renew your contract and [2:54:28] that the public will have a voice in [2:54:30] that. I think since we are so deeply [2:54:33] impacted by [2:54:35] the presence of flock cameras and the [2:54:38] potential presence of a data center in [2:54:40] our community that I think it is just [2:54:42] it's a public issue all around and I [2:54:44] just wanted to state that and state that [2:54:46] I'm I'm glad that it is already being [2:54:48] proposed. So, thank you. [2:54:51] >> Thank you. [2:54:53] >> Anyone else? [2:54:58] M madame clerk, someone wants to join us [2:55:00] virtually. [2:55:15] » Hello, town council. Can you hear me? [2:55:19] >> Hello. Can you hear us? [2:55:20] >> Yep. This is Ron Colstrom, 7 Old Forge [2:55:22] Road. [2:55:24] Thank you for joining us, uh, Ron. [2:55:26] >> Yep. No, so one of the things I just to [2:55:29] add on the flot cameras. So, in 2024, [2:55:32] the chief of police came, uh, in front [2:55:35] of the town council and told you guys [2:55:37] that this was going to be a license [2:55:39] plate reader, right? And I think most of [2:55:41] the people that were on the town council [2:55:42] at the time interpreted that as a um, [2:55:46] license plate reader that's just going [2:55:48] to snap photos of your license plate. [2:55:50] And obviously it's had some pretty good [2:55:53] um pretty good track record, right? So [2:55:56] we had a robbery in Attabro and it it [2:55:59] got to uh identify the person that was [2:56:01] coming and and committing the crime and [2:56:03] we found them, right? But there's [2:56:05] obviously a lot of issues that's going [2:56:07] to be that we've we've seen. So, I think [2:56:10] what the town council needs to do, just [2:56:12] in my opinion, is um bring the chief of [2:56:15] police back in, ask them a little bit [2:56:18] more about what the policies and [2:56:19] procedures are. Obviously, it's not just [2:56:21] a license break reader with what we've [2:56:23] been seeing kind of in the news and and [2:56:26] not knowing what you guys are privy to [2:56:28] on the police side of things, but I [2:56:31] think they need to kind of come to you [2:56:33] guys and say, "Hey, listen, this is what [2:56:35] we're using it for. If it's a license [2:56:37] plate reader, that's great. Um, but if [2:56:40] it's looking at people in the cars, if [2:56:42] it's storing data longer than you guys [2:56:44] think, I think there's some questions to [2:56:46] be asked and uh answers that you guys [2:56:48] need to figure out. Thank you. [2:56:51] >> Thank you so much. [2:56:53] Anyone else? [2:56:55] Okay, there's no more public comment and [2:56:58] I want to thank again everybody for [2:57:00] their uh their input. I'm going to go [2:57:02] down to the next item and is our [2:57:03] adjournment. I will take a motion to [2:57:05] adjurnn at 9:34 by councelor Shaw. Do I [2:57:08] have a second? Second by councel McIll. [2:57:11] All in favor to adjourn say I. Any [2:57:13] oppose? We are adjourned at 9:34 p.m. [2:57:16] Thank you and thank you everyone.
