[10:46] this is an application for an amendment to subdistrict [10:50] 30 within plan development district number 1 93 oak lawn [10:54] special purpose district. This is located on the north corner of [10:58] reagan street and brown street. [11:15] okay, this is, um, the location. This is [11:19] located in council district number 14. This [11:23] is the area of request on reagan brown. [11:29] again, this is currently zoned subdistrict 30 within pd 1 93, [11:33] and it's currently developed with the community service center building [11:37] and office. And, um, it was the resource [11:41] center of dallas incorporated, uh, p ds 30 [11:46] functions similar to the multifamily two subdistrict, but it has modified [11:50] yard lot and space standards primarily to facilitate [11:55] an existing community service center building. Subject property has [11:59] been developed with that office building since 1964, and [12:03] the community service center has been there since 1985. [12:07] um, but the tenant has, [12:12] or owner has since vacated the existing building. So they're requesting [12:16] an amendment to this pd to allow a new indoor game [12:20] court center, um, for indoor game courts. Nothing [12:25] will be outdoor at all. Uh, it's approximately 2000, um, [12:29] with an approximately 2000 square foot restaurant without drive through. [12:36] the applicant is proposing to modify, um, the front yard [12:40] setback along reagan street to 10 feet in lieu of the, [12:45] the mf two district requirement of a 15 foot front, [12:49] front setback and also double frontage for the longest street. [12:54] um, they also are asking for a 65% lot [12:59] coverage for the new game court center in lieu of the required 50% [13:03] lot coverage. Um, the applicant also [13:07] is proposing, um, a lot of different standards to, for [13:11] the subdistrict, pretty much compatible with what you see in other, [13:15] um, pd 1 93 locations. Um, that includes [13:19] habitat, gardens, some other sustainability features such as solar for the roof, [13:24] pedestrians, sidewalks and paths and sidewalk amenities. [13:30] um, again, this is the aerial and land use map. It's pretty much surrounded by [13:34] multifamily. Uh, for the most part, there is an institutional use, [13:38] a church use just, um, just next to it adjacent to the north, [13:43] but otherwise it's, um, multifamily and then the variety of other [13:47] types of housing. And then a little bit of a variation [15:45] on reagan street to make sure that we get the [15:49] five foot sidewalk and the buffer. Um, the buffer will vary a [15:54] little between four and five feet. Um, [15:58] this is just a closeup view. Um, pd, [16:02] pd conditions, um, habitat garden. [16:06] again, that's, um, we have a definition for that. They also have the micro [16:11] mobility charging. Um, so we have a definition for that. We had to add, [16:16] um, this is to allow the game court center use. [16:22] um, this is specifying a game court center, uh, must [16:26] be located indoors. I would like to also point out, um, you should have [16:30] a handout and there was also an email sent out with, um, a [16:34] few updated, a few updates, um, within the pd [16:39] conditions. Um, they are in, in the presentation [16:43] as well, though. Um, this is for [16:47] the setbacks. Um, 15 along brown, 10 along [16:51] reagan [16:57] design standards. Again, the sidewalks and pedestrian paths are [17:01] in here. The micro mobility. [17:06] um, the photovoltaic for the roofs, [17:10] pedestrian amenities, excuse me. Uh, [17:15] landscaping, um, again, so that everything can be accommodated. [17:20] um, we do have some language in here, uh, specifying that [17:24] the minimum general or special planting areas which are required [17:28] in pd 1 93 in this subdistrict may be reduced, [17:33] uh, for the purposes of allowing up to one foot of the minimum five foot [17:37] unobstructed sidewalk to be constructed. So again, we're just trying to [17:41] make sure everything fits in. Um, [17:46] habitat garden signage, um, this is what I [17:50] have in blue here and lavender in your handout is, um, this [17:54] was added hours after the, um, docket went out. [17:58] hours of operation are being added for the game court center. They may only operate [18:03] within 7:00 am uh, to 10:00 pm [18:09] okay, so, um, again, this is just a comparison chart. It's, [18:14] um, pretty compatible with pd pd 30. Now [18:18] again, we're just, um, varying slightly one of the, some of the setbacks, [18:23] um, lot coverage and then adding in all of the special [18:27] standards that we just discussed. Um, [18:31] this is consistent with forward dallas 2.0. It's in the city residential [18:36] place type, um, which does allow for civic, [18:40] um, institutional uses, commercial office, a variety. [18:44] basically a mix of uses in a, in an urban area. [18:50] staff recommendation is approval subject to development plan and [18:54] amended conditions as briefed. [22:31] uh, the proposal for his application is this new specific use permit for the sales of alcohol [22:36] beverages in conjunction with the german merchandise store. Uh, 3,500 square feet [22:40] or less on property zone sub area two within plan development district [22:44] number 360 6 butner boulevard special purpose district with [22:48] the d one liquor control overlay. [22:52] here's a few background information. Um, currently the site is developed, uh, with the drum [22:57] merchandise store 35,000 square feet or less. Uh, this will be a new [23:01] sup for the property. Um, which that in that case would be no changes to [23:05] svp or site plan since it's a new one. [23:09] uh, here's the subject property. Uh, it is going to be the, the window, [23:13] um, three, three doors down to the right [23:18] here's looking, uh, west along late june road [23:23] to the north and then to the east. [23:30] uh, here's the proposed site plan with the application, [23:36] uh, the proposed sup conditions. [23:42] according to forward dallas, this property is identified as neighborhood mixed use [23:49] and, uh, recommendation approval of subject to site planning conditions. [23:56] thank you mr. Lee. [24:26] I, I think it was unit one 20 is what you were looking at. So the [24:31] sup would cover actually both units on that corner and it actually extends into the street, [24:35] which was strange to me. I had never seen that before. Um, so I was just wondering like [24:40] if someone else is gonna own the other unit on the right side of [24:44] that, 'cause that that appears to also be covered by that blue square and then why it [24:48] extends into the street the way it does. Yeah. Uh, yeah, so the reason [24:52] it extends into the street, um, that would be a question for our gis team, which, um, the person who [24:56] does that, she's out okay. In the office. I couldn't get an answer for that. Mm-hmm . Um, [25:00] regards to the different units, I believe when I went to the property they were doing [25:05] interior renovations. Um, so I think it would be the two, the two doors. The one [25:09] 20 and one 30 unit? Yes. Okay. And do you, do you have any insight as to why it [25:13] extends into the street? I can speak to that actually. Uh, so there's kind of two [25:17] things going on. Any, any zoning can be done through a meets [25:21] and bounds, which is an individualized survey of a small base of land. That's what [25:25] they did in this circumstance. So it does not actually, yeah, as, as you said, apply to the whole, [25:29] uh, parcel, which is much larger. Um, that's fairly common with these, uh, kind [25:34] of suite based or, or, or strip mall type businesses. [25:38] uh, on the other hand, going to the street, that's actually, that's actually pretty common for a [25:42] lot of zoning because zoning actually, uh, extends to the center of the street. So [25:46] if you go to the property line, which I believe they surveyed it to the property line mm-hmm . Zoning, [25:51] any zoning actually goes to the center line of the street. So in the situation where, [25:55] uh, street was abandoned, then the zoning, uh, then goes out there. So [25:59] that's kind of a, a quirk, but I think it's because they surveyed this from the [26:04] property line into their suite and then up, but I, and, and, and [26:08] harder to say exactly where it falls in those suite lines, but they, they did their [26:12] best to survey. I, I appreciate it. Still learning about some of this stuff, so I appreciate [26:16] you. Um, good question, uh, ask, answering that for me also, do you, do [26:21] we know anything about the owner? I was trying to look up like what type [26:25] of convenience store, this is gonna be the ownership. I'm janna weell, I'm the transportation [29:23] planning administrator with the transportation public works department. [29:27] um, so the thoroughfare plan is really simply how the city plans our [29:32] long way, our long range roadway capacity and, um, any [29:37] right of way that we need to preserve to ensure that we can maintain mobility and connectivity [29:41] across the city. So it looks at some basic things like the amount of [29:45] right of way number of lanes, is it divided or undivided, [29:49] what its function is within the city. Um, it does not take into [29:54] consideration things like aesthetics, uh, safety [29:59] sidewalks, things like that. It really focuses on how much right away needs to be [30:03] preserved so that dallas can remain connected, have access [30:07] to different parts of the city, um, make sure we have enough capacity. So, um, the city of dallas has multiple standards [30:32] and street design manuals, um, different policies and things like that. [30:36] and so a thoroughfare plan is really just looking at the basics of the roadway [30:41] and you would apply those street design standards during plan review during public [30:45] meetings through different like, um, processes outside of the [30:49] thoroughfare plan. Could you kind of run through the sort of hierarchy [30:58] of the different types of, you know, the arterials and, and the [31:02] fact that not all streets are on the thoroughfare plan? Yes, that is a great question. [31:06] so, um, the thoroughfare plan has different functional classifications of streets. [31:11] so you have your major and minor arterials, um, which [31:15] provide connectivity over larger distances, collectors [31:19] that feed into those arterials. Um, and then local streets are [31:23] not included on the thoroughfare plan, so you're more residential streets. There [31:27] are still requirements for how those are designed and built, but they're just not part [31:32] of the larger thoroughfare plan. [31:37] any other questions? One, just one follow up. [51:56] so we have a somewhat unique idea with constraints in place in order that [52:01] we can be good neighbors to the existing community, community and honor the legacy of [52:05] the site we are proposing. And an [52:09] amendment to the pd to allow for the game court center use for the operation [52:13] of a padel facility on the site. Padel is a quickly growing [52:18] sport that is a hybrid between tennis and racketball. So lot five and lot four were, [1:46:17] um, basically, um, separate lots, uh, [1:46:21] but lot five was a bigger building site [1:46:25] back before, uh, current times. Uh, [1:46:30] the city of dallas has let you build over lot lines and so what the [1:46:34] previous property owner did was annex part of lot four into their, their [1:46:39] build site and they built the house on that property. The purpose of this [1:46:43] request is to actually move the original lot line [1:46:48] east or southeast to match the building track line. And you'll hear from the neighbors for [1:49:18] sort of some egregious not getting drainage and paving and 8.503, [1:49:24] I, I don't disagree with mr. Boro guard about it meets the math, [1:49:28] but if you read after that, the pattern already established [1:49:32] in the adjacent area is having due regard to the character of the a area. [1:49:37] its particular, particular suitability for development and in taking [1:49:41] into consideration the natural topography of the ground, drainage, [1:49:46] et cetera. So the first part of this, they probably meet the math [1:49:51] part that there's a variety of shapes and a lot of lots, but what they're [1:49:55] doing here is, you know, changing the nature. I think most people know [1:49:59] this was a dairy farm, which is kind of cool and you know, [1:50:03] most of the lots are one acre and, and it, and you [1:50:07] know, like one history that says lot character trees setback, privacy [1:50:11] are what define this area. That's what makes bluff view, [1:50:15] bluff view and the bluff. They have really removed the bluff [1:50:20] by their, you know, going out and, and just scraping [1:50:24] the site, uh, without, at the time all the right permits, [1:50:28] um, to the point that they have created something that wouldn't otherwise [1:50:33] be there. I mean my, I think what defines bluff view and that neighbor, [1:50:37] that neighborhood is the natural space is what defines it and makes [1:50:41] its character, not the structures. This would be fine. Like in vent tree, [1:50:46] you know, big house and a big lot they're creating as mr. Burgart, he got this, [1:50:50] that part, right? For sure they are creating a larger building site and [1:50:54] they've done it by digging into the bluff and the slope to create a much larger [1:50:58] site. To have a much larger house. And they've also, we'll [1:51:02] show you, I mean this is kind of the nature of, you know, you go out to bluff view, you can't [1:51:06] see the houses until you're on the lot. In many cases we're gonna have a big [1:51:11] suburban style, you know, development. So here, you, you know, here [1:51:16] I think this exhibit shows what they're doing and then they've created in that [1:51:20] blue area a lot more buildable space. So [1:51:24] they're changing the nature of the site and making it much larger than [1:51:28] what otherwise would be there. So this isn't like, oh, we got an older home [1:51:32] and we're just gonna replace it with a similar newer home. It's different site. Um, [1:51:36] I mean, and here I'll show you some pictures. I think the neighbors will show you more. There [1:51:41] were, I, I I mean hundreds of dump trucks taking this [1:51:45] site down, creating this very large pla so that's when I said [1:51:49] at the beginning, they're asking for permission now after [1:51:53] that's your time, you know, uh, my colleague will finish for us, but I'm [1:51:57] happy to stay and answer questions too. Cothran was talking about, they're taking the bluff out of [1:52:22] bluff view. I think there was a lot of due diligence that wasn't done beforehand, especially [1:52:26] for this major remodel. Uh, the proposed pla conflicts [1:52:30] with the intent and the purpose of the dallas development code by failing to respect the [1:52:35] established neighborhood. Its natural topography, the pattern, its character, [1:52:40] um, its inconsistency to preserve its natural character, the terrains, [1:52:44] the trees, the landscape, and has already made significant [1:52:49] alterations that have already occurred [1:52:53] here. We can see the before and after of the [1:52:57] existing subject site where the single car driveway that is off of [1:53:02] tu waga road and now it has been widened [1:53:06] for construction access. And this is the blue area that was highlighted [1:53:10] in the terrain. Now long [1:53:14] canyon drive the slope as well. Um, you could see the slope, [1:53:19] the drainage that goes, falls into waga road, but those mature trees have [1:53:23] also been removed. And the elevation [1:53:27] change of the fire hydrant, the grading, that was completely done beforehand. [1:53:32] I think there is a lot of, um, this is one of the stages having [1:53:36] the plat development done, is there are several other development [1:53:40] stages that are in the future. So this is something that due [1:53:45] diligence is gonna have to be really respectful and have to be [1:53:49] considered. Again, we have the drainage, the slope that is going [1:53:53] down into waga road and site [1:53:57] grading. I think these are a couple of videos [1:54:15] and you can see the drastic gray change that is happening on site. [1:54:28] and for the next video, not only are they making altering [1:54:32] their site, they're also altering the neighbor across the street [1:54:37] where the subject property sits at a higher elevation. [1:54:54] and I think it's more, the more than simply drawing new lot lines of phases of [1:54:58] construction that will take place. It's increasing the building footprint on a corner lot [1:55:02] and corner laws are more visible and contribute to the street [1:55:06] scape, especially with two frontages for the subject property. I run by the house every day. I walk my dog by this house [1:55:33] and this property every day. I know it very well. I I wanna thank all the [1:55:37] people that are here for trying to help dallas be a better place. I know your time [1:55:42] is valuable and I'll try and be succinct. Um, I represent over [1:55:46] 20 neighbors who found out about this hearing, but were unable to make it and knew I [1:55:50] was gonna be here and says, please speak for us. And I can tell you within the neighborhood, [1:55:54] we are united and all of the people in bluff view are opposed to this project. [1:55:59] we all assume a degree of responsibility when we do a construction [1:56:03] project in a neighborhood. It can disrupt a neighborhood, it can disrupt privacy [1:56:08] of neighbors, it can do a lot of things that are negative. There's a positive outcome many [1:56:12] times, but only when you work with your fellow neighbors, only when you communicate, [1:56:16] you work with them. This did not happen in this case. [1:56:21] I think it's appropriate that the owners of this property are not here today. They're never [1:56:25] available. They were never available to us. They never, they hid behind [1:56:30] the project. You couldn't get through the dump trucks that were going to destroy this [1:56:34] prop, this property. You couldn't find a way to contact them. [1:56:38] you still can't. There were never postings to find out who was doing this. [1:56:43] just suddenly I couldn't, I couldn't go by the property. There were so [1:56:47] many dump trucks taking this property down 20 feet or more of hard [1:56:51] rock, removing mature trees. The destruction is [1:56:55] a moral crime. If you've ever been to bluff view, you know how [1:56:59] bluff view is unique. It has changing topography unique to dallas, [1:57:04] lots of mature trees. We live in a house that's over a hundred years old. [1:57:08] our house is only remarkable because barney, the purple dinosaurs cra live [1:57:13] there. Originally this property was unique because it's had anybody from [1:57:17] paul mccartney's family spent a summer there to a lot of other folks like the cast of dallas [1:57:21] and other folks. It was a unique property that's been destroyed. We [1:57:25] don't trust this owner to go further because of what they've done [1:57:29] so far. How can we trust them to maintain the neighborhood [1:57:33] of bluff view and how special it really is to the city of dallas [1:57:38] if they continue to go forward? They have not earned that trust for [1:57:42] us. Hopefully they haven't earned it with you guys. Um, [1:57:46] I really hope that the commission and I know you are here to try and protect [1:57:50] dallas and look after its best interests. Here is an opportunity [1:57:54] to do exactly that and save the neighborhood of bluff u and its [1:57:59] special characteristics. Thank you. [1:58:05] next speaker. [1:58:14] hi, I am haley ow at 48 0 7 west lovers lane. [1:58:19] good afternoon. Bluff view is one of dallas's most unique natural landscapes [1:58:23] for generations. It has been defined by its dramatic topography, matri, mature [1:58:28] trees, wildlife in historical significance. It has been [1:58:32] home to great horned dows, red-tailed hawks, and many other protected [1:58:36] species while serving as a natural buffer for our neighborhood [1:58:40] today. All of that has been destroyed. Beginning in november, mature [1:58:44] trees were not marked and were ripped out with excavation [1:58:48] in march and only left a few standing to this day, [1:58:53] many of them have exposed roots, dying trees and nearly 50 foot trees [1:58:57] leaning toward homes in power lines, creating safety [1:59:01] concerns. A landscape that took generations to form has [1:59:05] been altered in just months. In early march, excavation [1:59:10] happened in more than a thousand rock trucks lined the roads to remove [1:59:14] material from a neighborhood where large trucks are restricted to 2000 [1:59:18] pounds, 2000 tons except for deliveries [1:59:23] hard, fast, and do not get caught. Approach to my understanding, [1:59:28] required permits were not obtained before this work began. City rules [1:59:32] require permitting for excavation of four feet or more. Yet [1:59:36] there was between anywhere from 10 to 15 feet minimum [1:59:41] of, of earth removed off of the top layer on [1:59:45] the property as a whole, which I am sure is different than what was [1:59:49] presented in the original paperwork. Since the excavation began, [1:59:53] we have seen changes that have never be occurred before. [1:59:57] the trees, the vegetation that once absorbed, the rainfall [2:00:02] has been removed, leaving exposed clay and increased runoff. [2:00:06] the results are already visible. The erosion failing streets, [2:00:11] broken asphalt and increased flooding risk for nearby [2:00:15] homes. One home has already experienced water entering [2:00:19] its attached garage and bluff. You did not have these issues [2:00:23] before. Bluff you's beauty and privacy comes from [2:00:27] its natural terrain. Replacing that with a bare concrete house [2:00:32] will increase the heat, threaten remaining vegetation and permanently [2:00:36] change this neighborhood. I ask that you not rely on reports [2:00:41] and drawings. Please come walk the property, see the damage, the erosion, [2:00:45] and talk to more of the residents experiencing these impacts firsthand. [2:00:50] the reality on the ground tells a different story than what the paperwork will [2:00:54] show. I ask for a full transparent, independent review [2:00:58] of what has occurred and the long-term impact of, of bluff view [2:01:03] in all of its residents. Bluff view is more than a development site. It [2:01:07] is an irreplaceable part of dallas's natural heritage. [2:01:11] once it is gone, it cannot be restored. Please do not approve [2:01:15] this project until the full impact that's has been properly evaluated. [2:01:19] the landscape architect is no longer on's your time, project your time. I'm a native dallasite [2:01:38] and I live directly across from this property. I respectfully oppose [2:01:43] the proposed property line adjustment because I believe it's inconsistent with the [2:01:47] character of bluff view and the, and the protection of the [2:01:51] natural environment. For these reasons, I respectfully as the commission to deny this request. [2:01:56] I have provided a handout with photographs comparing the property's [2:02:00] condition when it was marketed for sale to its current state. Along with the [2:02:05] prior and current surveys. These materials show significant changes that [2:02:09] have occurred. The survey maps applied by the owner, which is labeled [2:02:13] current, reflects topography conditions created [2:02:17] after sub substantial grading and excavation has already [2:02:21] occurred. This work was done without a city permit and does not [2:02:26] represent the property's natural state at the time of the purchase. The hill on canyon [2:02:31] reflects the original elevation, yet the hill has been lowered approximately [2:02:36] 10 to 14 feet. These altered conditions should [2:02:40] not be treated and accepted simply because they appear on the applicant's [2:02:44] survey. In recent months, the neighborhood has experienced extensive excavation. [2:02:49] approximately a thousand trips from 18 wheeler, rock trucks [2:02:53] remove dirt and stone from the site along with dust, noise [2:02:57] and removal. About a hundred trees causing major terrain [2:03:01] changes. These activities have already created viable erosion [2:03:06] and damage along canyon drive and have placed significant stress on [2:03:10] nearby trees, wildlife, and the surrounding natural environment. [2:03:15] bluff view is defined by its natural bluffs, creeks, mature trees, [2:03:20] wildlife, and rolling terrain. Expanding the property to create [2:03:24] a flatter, larger building site is inconsistent with the character [2:03:28] of bluff view in risks, further damage in the natural terrain, [2:03:32] mature trees, disturbing wildlife habitat, and reducing the [2:03:36] environmental protections that make this neighborhood unique. These lots [2:03:41] are bordered by a natural ravine on the backside that serves [2:03:45] as a drainage corridor and provides important habitat for [2:03:49] wildlife. Altering this terrain in this area has the potential to [2:03:53] affect natural water flow disturb wildlife habitat, [2:03:57] increase erosion and diminish environmental features that define [2:04:02] bluff view itself. Plans appear to include a larger [2:04:06] residence, guest house and tennis court, which will require further grading [2:04:10] to increase a level in level pad in court. Increasing [2:04:15] these negative impacts. Such changes are [2:04:19] inconsistent with bluff use, natural character and rolling terrain. [2:04:24] for these reasons are, uh, respectfully ask the commission to deny the [2:04:28] request for the property aligned adjustment if this commission [2:04:33] nevertheless approves the request. I live at 87 32 canyon drive, [2:05:00] uh, directly north of the property. 20 years ago, we bought a little [2:05:04] 1940s house in bluff view because of its natural beauty and the [2:05:09] wonderful neighbors. This is not about the neighborhood [2:05:13] telling the owners what and how they should build. It's about following [2:05:18] the proper permit process and filing the correct permits. [2:05:22] the owners knew from the beginning if they properly presented what they had planned [2:05:26] to do, the city would have denied the permits. The [2:05:30] owners also tried to impose a gag order in an nda when [2:05:35] a neighbor tried to get them to pay for the damage to her property. If [2:05:39] she had signed this nda, she would not be able to talk or [2:05:43] speak today about the repl. Why did the owners try to impose this [2:05:47] gag order? What are they trying to hide when filing the [2:05:51] initial permit? The owners completely misrepresented [2:05:55] what was actually going to be done to the property. Would the city have [2:06:00] actually approved the removal of 25,000 cubic yards of [2:06:05] soil and destruction of the bluff? In bluff view? I don't think [2:06:09] so. Would the city have allowed the owner to cut down numerous large [2:06:14] old growth trees without an inventory of the existing tree [2:06:18] types and sizes? I doubt it. [2:06:22] what is the true intent of the owners wanting to replant [2:06:26] this? Why are the owners trying to change the property lines [2:06:30] by increasing the size of one lot and decreasing the size of the other lot? [2:06:35] why are the owners not combining the two lots into a single parcel, [2:06:39] which is how they've treated this from the very beginning, given [2:06:43] the owner's lack of transparency in the permitting process, [2:06:48] I strongly urge you the city planning commission to reject and oppose [2:06:53] the pro repl. Um, our [2:13:27] authority when it comes to plats is really looking at some very [2:13:31] narrow items, whether it's met state law requirements [2:13:35] for platting as well as whether it's met the city [2:13:39] code requirements for plating. Um, there are things that were brought [2:13:43] up today that sound like they could be very valid concerns in the part [2:13:47] of the neighbors, but we're not here to, um, [2:13:51] ultimately under our limited platting authority to look at, um, [2:13:56] those issues. For example, whether proper permits were pulled or not. [2:14:00] um, that does not give us a basis to approve [2:14:04] or deny a plat that is for, um, code [2:14:08] compliance and the, the building official to look at. [2:14:13] and additionally, some of the [2:14:17] engineering and other things like that, which are again, very important aren't [2:14:21] for our consideration at this preliminary plat stage. [2:14:26] um, I, I understand I, you know, sometimes wish we could take into [2:14:30] account the entirety of a development, everything that's come before or after, but we [2:14:34] really, we are very limited in what we look at here in terms of platting [2:14:38] as to the state law and the 8.503 standard. And I'll add on 8.503, [2:14:43] which is our standard for lot size. The primary, primary [2:14:47] consideration there is the pattern already established in adjacent areas [2:14:52] and the remaining things about character suitability for development [2:14:56] topography, those are subordinate considerations to [2:15:00] the pattern. The pattern based on the way that it's directed is our primary consideration. [2:15:05] and this does fit it within the pattern and questions [2:15:09] about character and, and other issues, unfortunately, or, [2:15:13] you know, don't we, we don't have free wide ranging discretion under 8.503. [2:15:18] it is hemmed then pretty narrowly. So again, I, I [2:15:22] don't want to, I, I can't, you know, [2:15:26] ultimately determine that the truth of some of the things that the neighbors have said [2:15:30] today about the lack of permits or other issues there. [2:15:34] um, they sound like very important concerns, but they're ultimately ones that, uh, do need [2:15:39] to be addressed in a different forum other than the plan commission.
