[6:11] regular meeting today. Today is Monday, [6:14] September the 27th, 2026. The time is [6:17] now 4:30 p.m. So, I officially want to [6:20] call our meeting to order. I had been [6:22] waiting for our [6:24] guest of honor, but he sort of snuck in [6:26] on the back row and took a seat. So, uh, [6:29] now that he's here she works, we shall [6:30] get started. Uh, first thing on our agenda today is that we're [6:34] going to be, uh, do a prayer normally, [6:37] but today we're going to have a moment [6:39] of silence. Uh, there's been a Kentucky [6:42] state trooper down in Warren County, B, [6:46] Bowling Green, Kentucky, [6:48] who was shot today in the line of duty. [6:51] We think he's still alive, but want to [6:53] do a moment of silence in his behalf. [6:57] So, if you'll bow with me, please. [7:14] Thank you all. And if you would please [7:17] stand as we are going to be led this [7:20] evening. A pledge of allegiance by [7:22] Langston Zim Zeba who is the nephew of [7:28] the honore this afternoon. Come forward [7:31] young man Langston. Love that first [7:33] name. [7:49] To the flag of the United States of [7:52] America and to the republic for which it [7:55] stands, one nation under God, [7:59] indivisible, with liberty and justice [8:02] for all. [8:05] Now, now Langston is a third grader [8:09] >> and by the time he gets to be in the [8:10] fifth grade, he's going to be taller [8:11] than the chief. [8:21] » Oh, he is also the [8:24] son of Ashley Gray, [8:27] who is a Denver High School 1939 [8:30] graduate. [8:34] Oh, Ashley, that's my urine. I'm sorry. [8:36] [laughter] [8:38] And where' your dad go? His dad's al Oh, [8:40] there he's dead back there, too. [8:43] Oh, he looking around. Put that hand up. [8:45] There you go. [laughter] [8:47] We want to welcome all of you all back [8:49] to them on behalf of the chief. [8:53] Next on our agenda is uh the chair would [8:56] like to entertain a motion to approve [8:58] the agenda as prepared today. [9:01] So move. [9:02] >> Thank you ma'am. Is there a second? [9:04] >> Second. [9:05] >> Thank you sir. [9:07] Hearing no additions or deletions. Uh [9:10] chair would call for the question. All [9:11] those in favor of approving our agenda [9:13] as presented say I. [9:15] >> I. [9:16] >> Oh well they got shot today. Those [9:17] opposed. Motion carries. Next on our [9:20] agenda as we hear the public and uh [9:22] those who are present who want to speak [9:24] to us about things on our agenda uh [9:27] today may speak at this time. There's [9:29] another opportunity to speak to the [9:31] commission about things that are not on [9:34] our agenda today. [9:40] All right. So, hearing none, the next [9:42] order of business is uh approval of the [9:44] minutes of the previous meeting. Chair [9:46] would like to entertain a motion to [9:48] approve our minutes. [9:50] >> I'll make a motion to approve the [9:52] minutes of 914 2022 as presented. [9:56] >> Thank you, ma'am. Is there a second? [9:58] >> Second. Thank you, ma'am. Any [10:00] corrections, additions, or deletions? [10:04] Hearing none. All those in favor of [10:05] approving our minutes say I. [10:08] >> I. [10:09] >> Those opposed? Mot motion carries. [10:12] Yeah, I I guess I should say the next [10:14] item on the agenda is uh maybe the most [10:18] important thing that we will attempt to [10:20] do this afternoon. It's one that uh I'm [10:24] going to vote no [10:27] for this afternoon. and he already knows [10:29] that. But uh we want to recognize uh [10:34] our retiring [10:36] well I should say your retiring police [10:39] chief our retiring police chief. Uh, [10:43] and it's a it's a tough time for us [10:46] to have a young man who started off as a [10:49] snotty-nosed police officer with the [10:51] Denver Police Department and has spent [10:54] his entire professional career [10:57] in the Davville Police Department. [11:01] That's kind of tough, but he's done just [11:03] that. And so, we are very proud and [11:05] respectful of him for that. Uh and in [11:08] spite of the news that we got from [11:09] Bowling Green today, uh our chief has [11:12] been uh through it all with our own [11:15] police department, but with lots and [11:17] lots of police departments [11:19] throughout the state. That's another [11:23] reminder about the thing in Bowling [11:24] Green. So you all silence your phones. [11:27] Mine [11:28] just keeps shocking me, but it's on [11:30] silence. So, uh [11:34] Chief Gray, I guess we should entertain [11:35] a motion. uh [11:39] to first of all accept your resignation. [11:44] I'm sorry. [11:46] >> Retirement. Retirement. I'm sorry. [11:48] Retirement. [11:50] >> I'm I'm I'm all shook up, but that's [11:53] okay. [11:53] >> I'm going to make a motion that we [11:55] adjourn. [11:59] » Whoa. [12:01] So that means we would will not have to [12:03] address his retirement today. Our [12:05] resignation, right? [12:06] >> Okay. [12:08] Is there a motion [12:12] >> to accept the retirement of [12:15] Mr. Chief Tony Gray? [12:20] >> I will regretfully make that motion. [12:24] >> Okay. Is there a second? [12:27] >> I'll second. And I'd like to amend the [12:29] motion to say official retirement date [12:33] September 30th, 2030. [12:40] » No worries. [12:41] >> I got to keep on trying, guys. [12:43] >> Yeah, [12:45] [clears throat] [12:45] >> now before we approve this motion, I'm [12:46] going to let Assistant Chief dome come [12:50] forward and uh [12:52] have a few words of [12:55] few comments. [12:56] The key word in that was few. So, [13:04] » Chief Grey leave again. Oh, there he is. [13:08] >> All right. Mayor, commissioners. [13:12] When I first looked at the agenda that [13:15] uh for his retirement, it said Mr. [13:17] Coffee was going to speak, but that's [13:19] okay. We've been around each other long [13:20] enough that I can talk about him and if [13:23] uh I don't do a good job, we can let him [13:25] talk about himself. He won't have any [13:26] issues with that. No, I'm just kidding. [13:29] All right. 31 years. I keep saying 30, [13:32] but it's really been 31. Chief Gray [13:34] started here in 1995. [13:37] So, rose up through the ranks, patrol [13:40] officer, [13:42] detective, which I'm sure there was many [13:45] occasions he wish he would have stayed [13:46] as a detective in that bureau. [13:49] But uh better things await and he became [13:54] the administrative sergeant. He was [13:56] intram chief, [13:59] assistant chief, intram chief and then [14:01] became chief of police. [14:03] 31 years is a long time to work [14:07] anywhere. 31 years in policing [14:11] >> is forever. and for somebody to serve [14:17] with the integrity that he served with. [14:21] He is a constant professional. And when [14:24] I think about Chief Gray, that is really [14:26] what I think about is professionalism [14:31] embodied. [14:34] He promoted me to his assistant chief. I [14:38] think together we were a pretty good [14:39] pair. He was professional and calm. [14:43] Sometimes I was a little uh [14:46] quick to act on things. So one of the [14:49] things that he has taught me is to be [14:51] patient. Look at things from 360 [14:56] degrees. Look from things from a higher [15:00] vantage point. Plan for the future. [15:04] I think the Danville Police Department [15:07] has soared under his leadership. As you [15:09] can see, [15:11] the people here tonight to support him. [15:14] He won't be replaced, that's for sure. [15:18] But he has left this department a lot [15:20] better than he found it. [15:24] And what good cops want at the end of [15:26] the day when they call it a career is [15:29] for just the people that were served [15:31] alongside of them and served either [15:36] beside them or under them. is to just be [15:38] able to say that guy was a good cop. [15:42] >> Tony Gray was a damn good cop. [15:44] >> Well, thank you. [applause] [15:54] » Uh uh Chief Chief Ray, before you uh [16:00] have your your moment of your words to [16:02] share with us, I feel a need to [16:05] move this motion forward. [16:08] I said, "I want you to go up and sell [16:09] them good things and then the vote goes [16:10] the wrong way." So, [laughter] [16:14] when I decided to run for the mayor's [16:17] job, I was made some promises by lots of [16:20] folks who were part of the city uh city [16:23] staff. And one was that if I uh [16:27] was successful and served uh four years [16:30] or eight years or 12 years, whatever the [16:32] time might be, that they would uh always [16:34] be right there by my side. Got my back, [16:37] you know. And uh I pray on early in [16:39] November I'll get to serve four more [16:42] years. But Chief Grace says he'll still [16:45] be there and still got my back, but he's [16:46] not going to be in uniform. So in case [16:49] you're wondering why I got this jacket [16:50] on today, I got my uh holster on. He's [16:52] promised to give me a something to put [16:54] into my hoster here. So, we'll see what [16:56] happens later on. Okay. [16:58] >> Please do. [16:59] >> So, we have we have a motion on the [17:00] floor and a second to accept uh Chief [17:04] Grey's official return effective uh 09 [17:09] 30 2030. [17:14] [snorts] [17:16] >> Is that okay with you, Chief? [17:17] >> We can do that, but he'll be here. [17:19] >> He'll be here. Right. it it's uh [17:22] September the 30th, 2026. [17:25] So, we're going to do a roll call vote [17:27] for the record. So, all those in favor [17:29] of accepting his retirement. [17:33] Commissioner Codle [17:36] >> again regretfully. [17:38] Yes. [17:38] >> Commissioner Peak. [17:40] >> Thank you for your service, Tony. Yes. [17:42] >> Mayor Atkins, [17:44] >> again, regretfully, [17:47] but yes. Commissioner Holland. [17:51] >> Yes. [17:51] >> Commissioner Sris. [17:55] » Oh, okay. [17:58] >> Congratulations, Chief. [18:01] [applause] [18:19] Now, I guess you uh [18:21] you know the standard protocol is you [18:23] get three minutes, but since this might [18:26] be this might be your last chance, [18:27] you'll [18:30] >> we'll just we'll just ignore that one [18:31] tonight. Yes, sir. [18:33] >> Uh I have just a few comments because [18:36] most of the family here is three hours [18:38] away [18:39] >> and [clears throat] work will come early [18:41] for them in the morning. [18:42] >> Yes. [18:43] >> But not for me. Oh, [18:47] [laughter] [18:50] » mayor, you pinned me 15 years ago. [18:52] >> 15 years ago. Wow. [18:54] >> And uh you let me hang around this long. [18:56] So, I guess I didn't mess things up too [18:58] badly since you finally let me pick my [19:01] retirement date. [19:02] >> Oh, man. [19:04] >> First, I'd just like to say God's been [19:06] so good to me. [19:07] >> Amen. Amen. [19:12] » It's all right. [19:20] Can I thank everyone I need to thank by [19:22] name. [19:24] There are way too many people that have [19:26] contributed to this incredible chapter [19:29] of my life. [19:32] Mayor, commissioners, city managers, [19:34] fellow city co-workers, [19:36] county officials, emergency responders, [19:39] [clears throat] community members, [19:41] friends, classmates, [19:43] dispatchers, and most of all the members [19:45] of the Danville Police Department. [19:48] I am eternally grateful to each and [19:50] everyone. [19:52] Many are not here, but I recognize I [19:55] would not be here without yours and [19:56] their support and their grace. [20:00] In two more days, my retirement will be [20:02] official and this 31-year chapter of [20:05] life will end. [20:07] It truly has been an honor to serve and [20:09] represent a great city and a privilege [20:12] to lead a great police department. [20:17] We have outstanding professional men and [20:19] women that we work with daily. [20:23] I am confident that they are capable [20:25] individuals who will carry on the [20:27] values, the rich history and traditions [20:29] of the Danville Police Department. [20:33] I wish for them a hedge of protection [20:35] around them, calm seas, and much success [20:38] in their future endeavors. [20:42] Lastly, but not least, [20:45] I give great thanks to my immediate [20:47] family. [20:50] [clears throat] [20:50] In 28 of my 31 years, especially the [20:53] last 15 years as chief, this job has had [20:57] immense [20:59] repercussions on their lives as well. [21:04] Behind the scenes, they have provided a [21:06] safe space for confidentiality, [21:09] no judgment, and much needed rest. [21:13] They've held me up, pushed me forward [21:16] with unwavering support in uncertain [21:19] times and challenging times. [21:22] They have sacrificed on my behalf, and [21:25] those sacrifices cannot be numbered, nor [21:28] can they be measured. [21:31] I appreciate everybody that's in this [21:33] room today. [21:34] those inside the room and those outside. [21:38] I want to thank you all for your [21:39] comments and support. [21:41] >> Thank you. [21:42] Chief. [applause] [21:53] » Um, [21:55] Chief Gray, [21:57] >> uh, you're not getting off that easily. [21:59] Come on back down front. [22:04] This is a roast. [22:06] [laughter] [22:08] » I guess technically you do have me for [22:10] two and a half minutes. [laughter] [22:14] [snorts] [22:19] » I want you to know I got a jacket on [22:20] tonight. [laughter] [22:23] [snorts] [22:24] That's not me. [22:25] >> Yeah, [22:26] >> but I [22:30] appreciate [22:33] a few. [22:42] Oh, it says Anthony. [22:47] [laughter] [23:02] those things. [23:19] [laughter] [23:30] What's that used for? [23:31] >> It's not a get out of jail. [23:37] » I don't even pass those out. [23:49] » Keep the city. [23:52] >> Guess I will need one after this. [23:54] Another [24:06] » Yes, sir. [24:10] [laughter] [24:12] >> Oh, I'm sorry. [24:15] You don't know this. [24:24] My son turned 16 and he told his friends [24:27] to go out and buy a matchbox [24:30] car's [24:46] car. [24:55] That's what it takes. [24:58] for [25:11] real. [25:14] [cough] [25:16] We thought it would be [25:23] professional [25:25] longing career, whatever you want to [25:27] call it, has been with us. [25:32] I think you serve 15 years as [25:36] our chief. That's [25:39] a monumental achievement as well. And [25:42] the fact [25:48] that serve in a position [26:07] 15 years ago [26:17] with you. Then we want to get all your [26:20] family. [26:24] We're not going to miss you. [26:27] won't be coming. We'll see you [26:29] around. [26:31] >> And every time we have a special event, [26:34] we'll make sure the chief All [26:44] right. [26:52] Thank you. [26:54] >> All right. [27:06] Brother, sister, [27:42] Perfect. [27:45] >> Let's get C3. [27:47] [applause] [27:54] » [applause] [27:58] » some of his fellow officers who were [28:00] present [28:08] also used to be a part of [snorts] [28:12] Mr. [28:21] There you go. Pull him out of there. [28:40] » You want one by yourself? [28:44] Get you one by yourself, man. [28:46] >> You taught him everything that he knows, [28:47] right? [29:03] » [laughter] [29:20] [clears throat] [29:26] » Hey Tony, before you get gone, [29:30] I want to Uh, [29:36] » you don't need to hear from me. I [29:38] acknowledge that, [29:39] >> right? But, but you've been a part of my [29:43] personal life since I was in high [29:45] school. We talked about that there a [29:47] minute ago. Uh, [29:48] >> oh, [29:48] >> when when you started repping, John [29:49] Drake was too back there, just by the [29:51] way. So, I'll give him I'll age him a [29:52] little bit. But man, listen, you you are [29:56] a tremendous person and you have done [30:00] more for the community than [30:03] the average citizen understands. [30:06] You're you are a an extremely long [30:09] tenure chief. that is so hard to be and um you have weathered a storm for [30:19] this community for a number of years and when other communities have [30:25] struggled, you know, you you've looked [30:27] around and you can see it different [30:30] places, you know, different thing. We [30:32] never experienced that here. And the [30:34] police chief role and your leadership as [30:38] chief has a lot to do with that. And [30:41] don't don't walk out of here and not [30:44] know that that we as your peers, [30:48] employees, as peers, we acknowledge [30:51] that. Okay. [30:53] >> I appreciate. [30:54] >> Commissioner Codle wanted to make [30:57] >> Can I make a just quick? [31:02] Oh, time to get in. [31:07] Chief, um, I've known you a long time [31:09] and not many people really know that [31:12] when you applied for the job, you [31:13] actually had on parachute pants and a [31:16] you had a fade, but you had to that's a [31:19] little known fact. [31:21] But if you I don't know if you look at [31:23] the crowd that kind of sums you up um [31:26] pretty quickly the number of people and [31:29] all the the diversity of all the people [31:32] that that you have had an influence over [31:34] and and treated fairly all these years [31:36] and you know you got the good, the bad, [31:38] and the Anthony Wright out there. It's [31:40] just it's it's amazing. But your, you [31:44] know, your leadership, the law [31:46] enforcement part, the and the public [31:48] relations is going to be the thing [31:50] that's really hard to replace because [31:52] you knew how to walk that fine line, [31:54] which is not always easy to do. And and [31:57] I appreciate it and the city appreciates [31:59] it. [32:02] » And um another FYI for those who are in [32:05] attendance tonight and those who are [32:07] viewing us, u there's going to be [32:10] another special recognition for Chief [32:12] Gray. uh given by his family on [32:16] Saturday, October the 17th [32:18] from 11:00 to 2:00 p.m. [32:22] >> 2 to 4 [32:23] >> 2:00 p.m. to 4:00 p.m. All right. I was [32:25] going to get there early. Okay. But uh [32:28] so please feel free to uh because there [32:29] are a lot of people want to say [32:30] something to our chief, outgoing chief, [32:32] and uh we didn't want to get into that [32:34] tonight. Uh but we want to give you the [32:36] family wants to give you an opportunity [32:38] to come by and say some other things to [32:40] him. [32:42] What's that now? Or sign a book. [32:44] >> Yeah, we'll have a thing where you can [32:45] write. [32:46] >> He's so sweet. [32:48] >> It'll be October the 17th from 2 to 4 at [32:51] the showroom. [32:52] >> I changed my calendar. I had four. [32:54] >> Is that right? 17. [32:56] >> 2. [32:57] >> I guess you told me 11 o'clock so I [32:58] could come help set up then, right? [33:00] >> Yes. I'm I'm good with that. [33:03] >> Earn my piece of cake, right? [33:06] >> All right. That's good. Mayor, I just, [33:08] you know, the me and Stephen were [33:10] talking last week and uh [33:15] it's all about the village. The village [33:17] has been good to me. [33:18] >> So, I've tried to be good to the [33:20] village. [33:20] >> Wow. [33:21] >> That's the best way for me to sum it up. [33:23] >> Wow. [33:24] >> And chief, if I can, mayor, take one [33:27] liberty. It feels like a a notable [33:29] moment in our history as a fair city. [33:31] >> Yes. [33:33] Tony, many men want to be remembered for [33:35] things they accomplished, of which you [33:36] have numerous things that we could list [33:38] here tonight. But your impact is who you [33:41] have impacted here, not what you have [33:44] accomplished. And that's evident not [33:46] only by this room, but the body of your [33:49] work. And I'm so glad that while you're [33:51] retiring as chief, you're not retiring [33:52] from your impact that you've left in [33:54] this community. I know that'll continue. [33:56] you, the measure of you as a leader and [33:59] a chief uh in this community is your [34:02] demeanor and your integrity. Um, which [34:05] has been a stabilizing factor for a [34:08] long, long time. And we're lucky to have [34:11] had your leadership and your impact and [34:13] I'm grateful it'll continue because I [34:15] know it will. Thank you. [34:20] » Thank [clears throat] you, Mr. Dixster. [34:23] Okay, let's let's go on then. Let's go [34:25] to our next item on the agenda cuz I [34:28] know some people are real antsy to get [34:29] him outside. So [laughter] [34:31] chief for the next 48 hours now you're [34:33] still an employee of the city of DO, [34:35] right? So [34:35] >> yes, [34:36] >> don't do anything out there I would I [34:38] wouldn't approve of. [laughter] [34:41] >> Wow. [34:42] >> That's amazing, isn't it? Hard to [34:43] believe. [34:46] >> Next item on our agenda is a [34:47] presentation recognition of Kentucky [34:50] Veterans Hall of Fame, Mr. Jack [34:52] Hendricks. [34:55] Where' Jack go? Kind of hard to follow [34:57] that Jack, but [35:11] [snorts] [35:15] » don't take Don't take it personally. [35:30] When you're ready. [35:32] >> Are we ready? [35:33] >> We ready to clutch. You had 30 seconds. [35:35] >> Well, I was going to say something. [35:37] Thank Tony for all the work work he's [35:39] done. Congratulate him on his uh [35:43] retirement. [35:45] I worked with him as a volunteer, as you [35:47] guys all know, for 16 years. I'm telling [35:49] you, he's one of the best police chiefs [35:50] in this state, if not one of the best in [35:53] the country. So hopefully you'll get one [35:56] just as good. [35:58] At any rate, uh I'm Jack Hendrickx. Good [36:01] afternoon, mayor, city commissioners, [36:02] and others. Uh thank you for inviting me [36:05] up and General Hunt, uh here to join you [36:08] in honoring one of our local veterans. [36:11] I'd also like to thank our city manager, [36:13] Earl Coffee, for attending the induction [36:16] ceremonies in Lexington for the last two [36:19] or three years. [36:21] Earl and this body has always shown deep [36:24] dedication to all of our veterans. [36:28] And that's pretty obvious with all the [36:30] banners up and down Main Street and all [36:32] the other streets in town. So this body [36:36] as well as every other commission that's [36:38] set up there for me for the last 25 [36:40] years has always been there for our [36:43] veterans and I've never asked for [36:45] anything for the vets that you didn't [36:47] agree to. So thank you very much for [36:49] that. [36:51] For those who may not be familiar with [36:53] the Kentucky Veterans Hall of Fame, let [36:55] me give you a little info about this [36:58] great organization. [37:00] Uh the Kentucky Veterans Hall of Fame [37:02] was foundation was formed in 2010 [37:06] by executive director HB Deathridge. [37:10] He's a Vietnam vet, businessman, and [37:13] formed for the p purpose of recognizing [37:17] great Kentucky veterans, past, present, [37:21] and future, who honorably served in our [37:24] uniformed services of the United States [37:26] military and who upon returning to [37:29] civilian life continue to exemplify the [37:32] finest virtues of citizenship by leading [37:35] a life of honor, service to our [37:38] communities, [37:40] and and whose achievements and [37:42] accomplishments go above and beyond [37:44] others in his or her chosen calling. [37:49] That's what the Veterans Hall of Fame is [37:50] all about. There's some brochures back [37:53] at the back if anybody'd like to have [37:54] one. Tells you a little bit about it. [37:58] The Kentucky Hall of Fame does just that [38:01] what our founder [38:03] set out to do. Each year, nominees from [38:07] across the state are reviewed, and each [38:09] year they select a number of worthy [38:12] veterans to be inducted into this great [38:14] organization. [38:16] This year, there were 22 chosen. With [38:19] these new inductees, it will bring the [38:21] alumni to 317 for state of Kentucky. [38:26] Now, that's out of the hundreds of [38:28] thousands of veterans that have served. [38:30] So [38:31] needless to say, it's a great honor for [38:34] each of the inductees. Damble and B [38:36] County has now has three of these [38:39] honores. [38:41] With that, I'll turn it over to General [38:43] Hunt who is a member of the board of [38:45] directors of the Kentucky Veterans Hall [38:47] of Fame and he will introduce this [38:51] year's inductee from Danville, General [38:53] Hunt. [38:58] » Thank you. Thank you for allowing me [38:59] this opportunity to speak briefly. Uh [39:03] the Kentucky Veterans Hall of Fame is an [39:05] organization that takes the as the [39:08] foundation a person's military career [39:11] where they have served honorably in in [39:13] the in the military of the United States [39:16] and each inductee has done that. But the [39:19] difference maker for the Kentucky [39:21] Veterans Hall of Fame is that the [39:23] inductees have been uh vetted with their [39:29] service beyond uniform service. What [39:32] they've done to improve the quality of [39:35] life in their sphere of influence where [39:37] they live across the state. And this [39:40] year we inducted 22 new veterans into [39:44] the Hall of Fame. One of them being a [39:46] 100red years old from Richmond and [39:48] Madison County. [39:50] 100 years old. And he is as clear as [39:54] clear can be. But in Bole County, [39:58] Army Specialist Donnie Canater Jr. [40:03] has distinguished himself greatly to [40:06] have passed a rigorous vetting of the [40:09] qual of the of the performances he has [40:12] done to make Boil County and Danville a [40:16] better place to live through his service [40:18] and giving back to the community that [40:21] has provided so much for him. and he is [40:24] uh employed with the uh national I'm [40:27] going to say this wrong Mike the [40:28] National Cemetery Administration [40:31] and his supervisor and boss are here [40:34] today is here today to show support for [40:37] Donnie Caner and I want to thank the [40:39] Daml city commission and mayor for this [40:42] recognition of him it's about specialist [40:46] army specialist retired Donnie Caner [40:50] » [applause] [40:57] » They kind of put me on the spot. Melanie [40:59] texts me on Friday. He's like, "Hey, can [41:01] you be at the commissioner's meeting on [41:02] Monday?" Like, "Sure." But then, of [41:04] course, Jack says, "Hey, it's for [41:06] recognition of your induction." So, I'm [41:08] a little underdressed and not speak. [41:10] >> That's okay. [41:11] >> Um, I want to thank the mayor, the [41:13] commissioners, city staff. You all are [41:17] what made my work possible. [41:20] The county officials, county employees, [41:23] we couldn't do what we do at the VFW. We [41:25] couldn't do what we do without your [41:26] support. And that that makes a world of [41:29] difference because all of my efforts [41:31] have been through you all. You know, you [41:33] all been on our side. You've taken, you [41:35] know, you've taken time out of your day [41:37] to come support us. [41:39] And [41:40] it's an honor to be recognized in front [41:42] of everybody. [41:44] And like I said, I'm sorry. I was not [41:46] prepared for this. [41:49] >> Um, but about a year ago when Jack first [41:52] uh first approached me with the about [41:54] the nomination, I didn't want to do it [41:57] because I didn't think I'd earned a I [41:59] hadn't earned it yet. You know, some of [42:02] these guys been doing this for 40, 50, [42:03] 60 years. You know, it's been I've been [42:07] active in a community for about 10 to 12 [42:08] years now. and to be held in regard with [42:13] those same people means a lot to me. [42:16] And then uh Melanie or yeah, Melanie [42:19] said she couldn't make it. So uh I had [42:23] talked to her on Friday. I also talked [42:25] to Earl. So while I've got the [42:27] microphone, I've got something I need to [42:29] do on behalf of the BFW. So I'm gonna [42:30] steal the floor for just a minute. So [42:31] that's all right, sir. [42:32] >> Yes, sir. [42:34] >> Um so back in December, we hosted the uh [42:37] the city county dinner annually. [42:40] One of our awardees was unable to attend [42:42] because of an accident on go at the end [42:45] of Gogggin Lane and 52. It took up about [42:47] half the county staff that day. Um after [42:51] that everything kind of got pushed. [42:55] Things got lost in the mix. We never [42:56] could make schedules mesh up. So I've [42:59] got the final awardee for the 2025 26 [43:03] year for the public servant awards that [43:06] the VFW puts out every year. U if I [43:09] could have Crystal Blackburn. [43:12] I received her write up. [applause] [43:20] Her supervisor nominated her and it was [43:22] a very impressive write up. I don't [43:24] unfortunately I don't have it with me. [43:26] It's buried in a stack of emails [43:27] somewhere. [43:29] But uh she was also the runner up for [43:32] the state awardee. [43:34] So that came down to about 45 [43:38] dispatchers across the state and she was [43:40] narrowly narrowly beat out on the the [43:42] winner of the state award. Crystal, I'm [43:45] sorry it's taken almost a year to get [43:46] this to you. Um on behalf of the BFW, I [43:51] want to say thank you for your service. [43:54] [applause] [44:08] Yes, sir. [44:12] » Thank you. I appreciate it. Thank you. [44:14] >> Thank you again for your service. [44:19] [laughter] [44:20] >> All right. Thank you, sir. [44:26] » [laughter] [44:31] » Everybody [44:38] [laughter] [44:52] » [laughter] [44:53] >> That's for sure. [45:07] two [45:11] perfect [45:16] [applause] [45:38] I don't want to break a camera. [45:52] » Commissioner Peak just reminded me. I [45:54] didn't say, but there's three inductees [45:57] now. Donnie makes the third in Ball [45:59] County. For a county our size, there's [46:02] not very many that's got three inductees [46:05] into the Veterans Hall of Fame. And [46:07] that's Howard, myself, and Donnie. So, [46:11] >> thank you, Donna. [46:20] » Thank you, everybody. [46:21] >> Thank you. Appreciate you. [46:31] Okay, we got a lot of items left on our [46:33] agenda and we only have 20 minutes of [46:34] time left. So, I guess we had to really [46:36] roll her, right? Okay. Um, that was good [46:40] though. [46:41] >> Got two more items and we'll have it [46:42] clean down. [46:45] >> Next on our agenda is to hear from [46:48] Dav County Development Corp update our [46:51] new president, Grayson Evans. Welcome, [46:54] Grayson. [46:56] Thank you, mayor, members of the [46:57] commission. A couple of very difficult [46:59] acts to follow tonight, but we certainly [47:01] have a lot to be thankful for here. Um, [47:04] I won't give a spoiler or anything like [47:06] that, but you do have an agenda item on [47:08] your agendas for later in your meeting [47:10] this evening and wanted to come and just [47:13] thank you all in advance for your [47:14] consideration and also um just give you [47:17] a quick update on some of the things [47:19] that we're doing around here as your [47:21] economic development organization. Um, [47:24] so whenever our entity, the the [47:28] development corporation passed a fiscal [47:29] year 26 budget, it was at a time when my [47:32] position was vacant and the board had [47:35] communicated with key officials, as I [47:37] understand it here at the city about the [47:39] possibility of a budget amendment being [47:41] needed. Um, at our September 16th [47:44] meeting, uh, the development court [47:45] passed a budget amendment. Um but wanted [47:48] to let you know that fiscal stewardship [47:50] is is obviously at the forefront of my [47:52] mind as I move into this role. Um we [47:55] have started working on um garnering [47:59] support for additional members for our [48:01] chairman circle and leveraging private [48:03] partners in the community and trying to [48:05] find other groups to come alongside you [48:07] all the county and other important [48:09] partners to invest in what we're trying [48:11] to do to bring more jobs to the [48:12] community and more growth to Danville. [48:14] Um, so just wanted to wanted to make [48:18] that disclaimer here in front of you all [48:19] this evening and then um give you a [48:21] quick update on just a few of the things [48:23] we've done in the last month or so. Um, [48:25] we're working pretty aggressively to [48:27] advance the development of all three [48:29] distinct properties owned by the EDA and [48:32] the industrial foundation. Uh, if you [48:34] drive around town, you'll see a couple [48:36] of different road projects taking shape. [48:38] one in our existing industrial park, [48:41] another off of Steuart's Lane on the [48:43] EDA's Norfolk Southern property, and [48:46] we'll certainly be moving forward with [48:48] the help of city engineer and manager [48:50] and other staff members on access to the [48:54] reading site for a couple of the [48:55] commercial businesses who will be making [48:56] it their new home here soon. Um, we're [48:59] engaged with multiple prospects who've [49:01] expressed an interest in the vacant RR [49:03] Donnelly building and we've established [49:05] a new marketing committee and have [49:06] created a new content plan for our [49:08] website, publications, and social media. [49:11] Um, last week facilitated the regional [49:13] job fair for the community and the other [49:16] cities and counties that surround. We [49:18] don't have a hard and fast count yet, [49:19] but estimate that we had about 500 job [49:21] seekers attend the event and have heard [49:23] from several of our employers that they [49:26] have made hires already. and we're [49:28] already almost full again with [49:30] pre-registrations for the spring should [49:32] we choose to move that event forward [49:33] again. Um we have a small business and [49:36] entrepreneurship course going on right [49:38] now in partnership with the chamber and [49:39] ENKU and BCTC. Uh folks trying to launch [49:43] businesses here in Danville and Boil [49:44] County from gunsmithing to AI video [49:48] development to baked goods to barbecue [49:50] sauce to psychiatry. So, um, you know, [49:54] kind of a diverse and broad, uh, kind of [49:56] series of different business interests, [49:58] but we're trying to help provide [49:59] resources for them. Um, just again [50:02] wanted to give you all a quick update on [50:04] what these first few weeks on the job [50:05] have looked like and thank you for [50:07] continuing to support our entity and the [50:10] economic development efforts of the [50:11] community. So, thank you. [50:13] >> Thank you, sir. [50:16] >> Any questions? [50:17] >> I just appreciate you coming to the [50:19] meeting. I learned a lot and took notes. [50:21] So, um, I hope to see you regularly. [50:25] >> We'll be back. We'll make it happen. [50:26] >> Thank you. [50:29] sir. Next item on our agenda [50:32] is a banner request from the Kauian [50:35] Club, their annual chili cookover. The [50:38] chair would entertain a motion to [50:40] approve the banner request as presented. [50:43] >> [laughter] [50:45] >> Kellen codle. I will also say that let's [50:48] go ahead and just put that on the agenda [50:50] that October the 17th come to the chili [50:52] cook off get your get plenty of food and [50:55] then go to honor Tony on the two [50:58] o'clock. There you go. [51:00] >> I think that's pretty sweet. [51:01] >> I think that's a great idea. [laughter] [51:04] >> Is there a motion to approve the banner? [51:08] >> Second. [clears throat] [51:08] >> Thank you all. [51:10] >> Thank you very much. [51:11] >> When is the cook off? [51:12] >> What time? It is 11 11:30 is when we [51:15] start the tasting. It's over with at 2. [51:18] We announce the winners at 2:30. So, you [51:20] can come get tons of food and tons of [51:22] chili and then go see Tony and and honor [51:25] him. [51:25] >> Okay. [51:25] >> It's a good deal. [51:26] >> See, I I had chilly at 11 o'clock. [51:28] That's what it was. All right. [51:29] [laughter] [51:30] >> See chili. [51:39] for proclamations for fire safety week [51:41] 2026. [51:44] >> Madam clerk, would you read that for us? [51:47] >> Sorry, I was not prepared to read that. [51:49] I will do it though. Just give me [51:51] >> Cool. [51:52] >> Just give me a second. [51:53] >> Well, I can read. Want me to read it? [51:54] >> I can get it. [51:55] >> You sure? [51:56] >> Yeah. [51:56] >> I was going to charge. [51:58] >> Fire prevention week 2026. Whereas the [52:01] city of Danville, Kentucky is committed [52:03] to ensuring the safety and security of [52:05] all those living in and visiting [52:07] Danville. And whereas fire is a serious [52:09] public safety concern both locally and [52:11] nationally and homes are the location [52:13] where people are at greatest risk from fire. And whereas the [52:18] majority of US fire deaths, four out of [52:21] five occur at home each year, Danville [52:23] citizens should identify places in their [52:25] home where fires can start and eliminate [52:27] those hazards. And whereas lithium ion [52:30] batteries are increasingly found in [52:32] devices and systems that are used daily. [52:35] And whereas these batteries can overheat [52:36] and catch fire if not used, charged, or [52:39] stored properly. And whereas the 2026 [52:42] fire prevention week theme is charging [52:44] to fire safety, safe charging is a [52:46] superpower. And whereas this year's [52:49] theme focuses on educating everyone [52:51] about the importance of buying, [52:52] charging, and recycling lithium ion [52:55] batteries safely. And whereas Danville's [52:58] citizens are responsive to public [52:59] education measures and are able to take [53:01] action to increase their safety from [53:03] fire, especially in their homes. Now [53:06] therefore, be it resolved that Mayor [53:07] James JH Atkins and the city [53:09] commissioners of the city of Danville on [53:11] this 28th day of September, 2026 do [53:14] hereby proclaim the week of October 4th [53:17] through the 10th, 2026 as fire [53:19] prevention week and urge all citizens of [53:21] Damble to educate everyone on the [53:23] importance of having working smoke [53:25] alarms in their home and to support the [53:27] many public safety activities and [53:29] efforts of the Damble Fire Department [53:31] during Fire Safety Prevention Week. [53:34] Thank you, ma'am. [53:36] >> I move that we uh accept the [53:38] proclamation into the record. [53:41] >> Thank you, sir. Is there a second? [53:44] >> Second. [54:02] This is the second reading of ordinance [54:04] number 2077, an ordinance changing the [54:07] zone from highway business HB and [54:09] general business GB to single family [54:11] residential R1C and multif family [54:13] residential RM4 for approximately 41.482 [54:17] acres more or less of real property [54:19] located at 755 Stanford Road in the city [54:23] of Danville, Kentucky. [54:24] >> Is it a first read or second reading? [54:27] >> It's the first reading. [54:29] >> She said second. Chair would entertain a [54:32] motion to accept the first reading of [54:35] ordinance 277. [54:37] >> I'll move to approve the first reading [54:39] of ordinance 2077. [54:42] >> Thank you, ma'am. Is there a second? [54:45] >> Thank you, ma'am. Any questions or [54:47] comments? [54:48] Hearing none. All those in Oh, roll call [54:50] vote. [54:52] >> Commissioner Codle, [54:53] >> yes. [55:51] We feel like that is a good be in the [55:52] staff recommending requesting approval [55:55] of that RFP from F electrical for the [55:58] new sound system. [56:01] >> Thank you, sir. Is there a motion? [56:04] >> I'll move to approve resolution [56:06] 2026092801. [56:10] » Thank you, ma'am. [56:11] >> Second. [56:11] >> Thank you, sir. Um, [57:17] through [57:19] several discussions the with with the [57:22] county judge and the mayor, we um [57:26] arrived at the the the [57:28] uh point where we felt like the [57:30] resolution should be recommended to the [57:32] full commission and and considered. the [57:34] fiscal court picked it up and and have [57:37] already done done that consideration and [57:39] actually approved it as you can see in the uh with a signature on the [57:44] document. The Bull County uh court [57:46] resolution 260922 and the city of [57:49] Damville resolution 20260 2802 joint [57:53] resolution of the city of Danville and [57:55] the Bull County fiscal court [57:57] establishing an ad hoc committee to [57:59] evaluate planning and zoning and make [58:01] recommendations for improvement. Um it [58:04] establishes uh just in the same way [58:06] we've done with other joint jointly [58:09] created operations of the the two [58:11] governments. Uh recently we can think of [58:14] not from 911 to parks and wreck to the [58:17] even our our EDA process with the EDC [58:22] a jointly uh created uh committee of [58:25] sorts is is uh the best way to to have [58:29] that dialogue and then come back with [58:31] the recommendations. And so what the the [58:34] purpose is not necessarily to we we just [58:38] want to acknowledge I guess not [58:39] necessarily to to say there's something [58:42] ne to to recreate but what we'd like to [58:45] do is figure out u the the operations [58:49] and reaffirm that we're doing uh a good [58:53] job reaffirm our our I guess our [58:56] protocols and and our understandings of [58:59] all the things that are related to the [59:01] operation of planning and zoning which [59:04] is u not necessarily a Danville only [59:08] problem or a bull county only problem. [59:10] It it is a consistent divergent over [59:12] time where you have a board and you have [59:15] the law and and then you have u various [59:18] decisions. You have turnover on the [59:20] board over a period of time. So it [59:22] really what we want to do is recenter [59:24] our effort and to make sure uh we're [59:27] doing a good job and serving the [59:28] community with the expectation that that [59:31] was originally created when KRS 100 was [59:34] passed. Um other communities across the [59:37] state are having similar issues. The [59:39] reason the which is really shown with [59:42] the legislature uh taking so much u if [59:46] you look at the bills being produced at [59:48] the legislature you see so many of them [59:50] in reaction in response to local [59:53] planning and zoning decisions which [59:54] isn't necessarily a healthy thing. And [59:57] so what we've got to do is try to figure [59:58] out to make sure we're compliant, make [1:00:00] sure we're doing a good job. And and uh [1:00:04] um we don't know where that goes [1:00:06] honestly. We we just we know that that [1:00:09] planning zoning is creation of the city [1:00:11] and the county. And so through through [1:00:14] as I said through discussions with the [1:00:15] county judge and and the mayor, it seems [1:00:18] like a good time to do that. U the the [1:00:20] indicators are that we've had three [1:00:22] turnovers of the positions in recent [1:00:25] years and among all the other [1:00:26] trepidation and discussions that we've [1:00:29] had u of late especially couple times. [1:00:32] And so it just seems like the right [1:00:34] thing to do and and to get everybody [1:00:35] back centered on the same page. And uh [1:00:38] so that's what we are providing you with [1:00:40] the opportunity and the recommendation [1:00:42] that you proceed with the the ad hoc [1:00:45] committee evaluation. It does not [1:00:46] include uh uh me for example. It [1:00:49] includes the judge, a magistrate, the mayor, a commissioner. Then it [1:00:55] includes the city attorney, the county [1:00:57] attorney, the city engineer, and the [1:01:00] county elected surveyor. [1:01:06] » Thank you, sir. [1:01:08] >> Any comments from the commission? [1:01:12] >> Go ahead. [1:01:13] >> We'll make the motion first. [1:01:22] » Where' it go? [1:01:24] Sorry. [1:01:32] » Yes. I move for approval of resolution [1:01:35] 20269282. [1:01:42] » Second [1:01:47] questions or comments? [1:01:49] >> Go ahead, Don. [1:01:50] >> Yeah, you go ahead first. Everybody [1:01:52] wants to go. Okay. I'm just going to say [1:01:54] for me I just like if you would for the [1:01:57] community I mean I think overall what [1:02:00] the we have a P&Z director that's [1:02:02] leaving and I think as custom in a lot [1:02:06] of jobs in the city when things change [1:02:10] drastically or the same thing happens [1:02:12] over and over the city and the county I [1:02:14] look at things as a whole to see what [1:02:17] works if it's fine it may be perfectly [1:02:20] fine as it is but you need to just [1:02:23] review it. I think for the best of the [1:02:25] community that's I I just want to get [1:02:28] that out there because that's sort of in [1:02:29] your summary here. I think that's [1:02:31] important for people to know that P&Z [1:02:33] isn't stopping that she's leaving and [1:02:36] that things will go on as [1:02:38] >> correct. [1:02:39] >> Right. As like [1:02:41] >> Yeah. So the resolution only asks for a [1:02:43] pause in the hiring until an evaluation [1:02:46] pause of six months I believe [1:02:48] >> from the date of execution. It's and it [1:02:51] really it gives an opportunity. So So [1:02:54] expand on that. Not just the PNZ [1:02:56] director position is is being replaced. [1:02:59] You have uh the county building [1:03:01] inspector is going to indicated a [1:03:03] retirement this year possibly. You're [1:03:06] you've we have Sergeant Rainwater and [1:03:09] our code enforcement that's retiring. So [1:03:11] there's a lot of vacancies in the space [1:03:13] of application of the zoning ordinance, [1:03:15] the subregs, the the uh compliance of [1:03:20] all of our building building codes, [1:03:22] right? Uh so it the time is correct to do that evaluation now spec es [1:03:29] especially now that you have the [1:03:30] director position turned over. So it [1:03:33] just makes sense in the same way we had [1:03:35] other events historically that that [1:03:38] required such as changes in state law or [1:03:40] something that required 911 to be [1:03:42] revisited with a funding application. if [1:03:44] you'll remember the driver of that the [1:03:47] EDC the turnover in the director [1:03:49] position meant a lot when when we did [1:03:52] the um visits to other agencies and it [1:03:55] brought that back to okay what do we do [1:03:57] with the board now that we're creating [1:03:59] an EDA so that the structure then was [1:04:01] properly evaluated by [1:04:04] and and it was healthy I mean at the end [1:04:06] of the day um the city and county had [1:04:10] these are create creations of the the [1:04:12] local governments and And so having [1:04:15] those local governments re reweigh and [1:04:18] revisit those foundations makes a lot of [1:04:20] sense and provides some of the [1:04:22] leadership that you're quite frankly [1:04:24] elected to provide. And so this is the [1:04:27] methodology through which your elected [1:04:29] voices can jointly be uh considered [1:04:32] towards an idea. [1:04:37] Yeah, I was going to touch on, you know, [1:04:40] you mentioned we had three directors in [1:04:43] the past however many years. [1:04:45] >> Yeah, six years, five years. [1:04:46] >> And two of them, the last two we've had [1:04:48] have been young people that would have [1:04:49] been great to keep on long term. And um [1:04:54] so it occurs to me we may be the problem [1:04:57] and if we are we need to address that. [1:04:59] it could be a a board issue. And so I, [1:05:04] you know, I think it's like you say, [1:05:07] it's a good good time to re-evaluate and [1:05:10] uh fix what needs fixing if anything [1:05:13] does. [1:05:14] >> Yeah. [1:05:16] So there's not there's there's not [1:05:18] one single way to administer planning [1:05:20] and zoning. So, if you go across the [1:05:23] state, depending on the population of [1:05:24] your community, you could have [1:05:26] everything from joint boards, you could [1:05:29] have the city of Danville could have its [1:05:30] own planning and zoning board. [1:05:32] >> Now, that's that's not something that [1:05:34] you've ever talked about and I'm not [1:05:36] advocating for anything. I'm saying too, [1:05:38] you can have so some of the discussion [1:05:41] historically happened in here where we [1:05:42] had we had uh Mr. Hunter was from [1:05:45] Bowling Green. Well, his employment at [1:05:47] Bowling Green was different than our [1:05:48] employment structure here. So some of [1:05:50] the resources he he had at accessible at [1:05:55] that previous position, he qu I don't [1:05:59] have access to those here. Well, it's [1:06:00] because you're not structured inside of [1:06:02] the the system in the same way as you [1:06:04] were there. It's it's a different So you have the flexibility to really [1:06:09] change how you're structured. I'm not [1:06:11] advocating that you do that, [1:06:12] >> right? But but it's a proof check to [1:06:14] make sure that the existing structure is [1:06:16] correct and serving the community with [1:06:18] the existing load that we have on it, [1:06:20] the existing demand for services that we [1:06:22] have on on the system. It's everything [1:06:25] that we do for economic vitality. When [1:06:28] we have any any enterprise coming into [1:06:31] the community is dealing with your [1:06:32] building inspector, planning and zoning [1:06:34] for zoning compliance, your code [1:06:36] enforcement folks, you want that to [1:06:39] operate as efficiently as possible. [1:06:42] And so it's not being efficient whenever [1:06:44] we debate [1:06:46] how you apply clear text that is in the [1:06:51] zoning uh subdivision rags when because [1:06:55] you've just simply had a different [1:06:56] director that that isn't experienced [1:06:59] with that application yet. Right? So you [1:07:01] don't want to you want to create a [1:07:03] simple efficient system. And I know I'm getting deep in the weeds in ways [1:07:08] but I apologize for that. But at the end [1:07:11] of the day, that's that's the debate you [1:07:12] want to have. And and truthfully, it [1:07:15] doesn't start at with planning and [1:07:17] zoning commission on its on at that [1:07:20] level. It starts with the elected [1:07:22] bodies. It starts with the county judge [1:07:24] and the mayor and the ad hoc committee [1:07:27] guiding what their expectations are and [1:07:29] then delivering that as a product. [1:07:36] Looking at the framework of the [1:07:38] committee, um there's really no one on [1:07:40] the committee right now that's currently [1:07:42] serving on the the planning and zoning [1:07:44] board. Um so would it be uh my privilege [1:07:47] to suggest that we consider the planning [1:07:50] and zoning attorney as a ninth member of [1:07:53] this uh ad hoc committee? So I can [1:07:57] >> mayor we made a full conscious kind of [1:07:59] effort in our review of that matter to [1:08:01] not include anyone that is currently on [1:08:03] the planning commission or its council [1:08:05] for the matter of fact that the planning [1:08:08] zoning board itself is vested with [1:08:10] authority that is given by the city and [1:08:12] the county and that it's critical um in [1:08:16] our estimation that that determination [1:08:18] be made by the parent organizations of [1:08:21] the planning commission which are the [1:08:23] city and the county. And we've done this [1:08:25] in in previous aspects as well um when [1:08:30] we've reviewed city county joint [1:08:32] operations to not include members of the [1:08:35] created entity that serve at the the [1:08:39] pleasure of the forming entities. So [1:08:42] from an efficiency standpoint the [1:08:44] commission itself needs to operate as [1:08:46] directed by the city and county and not [1:08:49] be part of the direction itself. So that [1:08:52] was the philosophical um manner for [1:08:55] which the the uh ad hoc committee was [1:08:58] devised. [1:09:00] >> That's interesting. [1:09:01] >> And furthermore, what we look at at um [1:09:04] in these situations like Commissioner [1:09:06] Codle said about kind of the the [1:09:07] turnover that's transpired and some of [1:09:09] the other um I I'll say elements of [1:09:12] friction um that have been present um by [1:09:15] virtue of just kind of common [1:09:17] circumstances through the planning [1:09:18] commission. It's akin to like having the check engine light on your car come [1:09:23] on. It it needs it it means that it [1:09:25] needs to be evaluated for service. It [1:09:28] could just be um a simple fuse that [1:09:31] needs replaced, but it could also show [1:09:34] some mechanical issues that need to be [1:09:36] addressed further. It would be unwise to [1:09:40] merely continue to drive the vehicle [1:09:42] knowing that the check engine lights on [1:09:45] without making proper evaluation. What [1:09:47] this is is merely a pause. [1:09:49] an evaluation and a confirmation of the [1:09:52] systems that we have in place are [1:09:54] appropriate, well functioning and [1:09:58] welloiled. [1:10:00] And then those recommendations will be [1:10:02] brought back respectively to the city [1:10:04] and county for further um action. And [1:10:07] then the planning commission will then [1:10:09] be directed at the um behest of the city [1:10:13] and county jointly for its mission going [1:10:16] forward. [1:10:18] So the same response would be to my next [1:10:20] thought and that was to suggest uh one [1:10:23] of the planning and zoning board [1:10:26] planning and zoning commission members [1:10:27] be appointed to this ad hoc committee. [1:10:29] We we do not feel that would be [1:10:31] appropriate or an efficiency of of [1:10:34] process that would be necessary at this [1:10:35] point in time. [1:10:36] >> And from this proclamation, the county [1:10:40] should probably ask well the county sort [1:10:42] of adheres to that philosophy as well [1:10:44] since they've approved the [1:10:46] >> that that's correct. That that had been [1:10:47] fully discussed um in previous [1:10:50] encounters with the judge executive. [1:10:54] If PNZ isn't included, have they been [1:10:56] communicated with thoroughly [1:10:59] since I I never knew anything about this [1:11:01] till I read it Sunday, [1:11:04] >> but um was staff communicated with with [1:11:07] the county at least by the 22nd or [1:11:10] earlier? [1:11:11] >> Well, [1:11:13] staff [1:11:15] there's only one subordinate staff [1:11:16] person. The director position is vacant. [1:11:19] the planning zoning commission. We we [1:11:22] intentionally had a conversation with [1:11:24] the county judge and the mayor uh as a [1:11:27] group first because the the planning [1:11:30] zoning commission follows their [1:11:32] direction. So I don't want to [1:11:33] artificially create a situation where a [1:11:36] volunteer appointed board member assumes [1:11:40] the elected [1:11:44] people's um peer responsibility. I'm [1:11:49] trying to think of a way to say that [1:11:50] correctly. I just wanted to make sure [1:11:51] it's not [1:11:53] >> well and and so the communication what [1:11:55] we would do is take the time to speak [1:11:57] after you all consider the resolution. [1:11:59] We'll communicate that effectively to [1:12:01] >> to them. [1:12:03] >> Um more specifically, the uh deputy [1:12:06] judge executive did reach out to staff [1:12:09] >> and we did communicate to staff and I [1:12:12] know the mayor did uh comment to the [1:12:14] chairman. I know the county uh folks [1:12:17] have emailed. I know that happened um [1:12:21] different times both before last Tuesday [1:12:25] um last Tuesday and since last Tuesday, [1:12:28] but but we haven't been overt in in [1:12:31] having a like a formal meeting. I know [1:12:33] that we've had indep independent [1:12:35] communication with different folks along [1:12:37] the way. Um, but like I said, I I think [1:12:40] it's it's important [1:12:43] that the the planning and zoning is not [1:12:46] the elected body for the community. And [1:12:49] I think I think for me part of the [1:12:51] confusion and and I think that's [1:12:53] demonstrated throughout Kentucky over [1:12:55] time as as the legislature is continuing [1:12:58] to necessarily weigh in on local issues [1:13:03] through through in response to planning [1:13:06] and zoning decisions that's being passed [1:13:08] up to them. You can see it in the House [1:13:10] bills being presented. And so I think [1:13:12] it's an when when you have a something [1:13:15] so significant as your application of [1:13:17] your zoning ordinance, I think the [1:13:19] elected officials have to take the [1:13:20] leadership role that they're responsible [1:13:23] uh or that you've been elected to. And [1:13:25] so what I'm trying to do through this [1:13:27] resolution and through this [1:13:28] recommendation [1:13:30] um is to make sure you all have the [1:13:32] proper floor to exercise your elected uh [1:13:34] authorities. I mean, I think it's good [1:13:36] to evaluate because Danville has changed [1:13:39] and sometimes structures need to change. [1:13:41] >> Well, and we planning zoning still has [1:13:44] in in essence the same foundation it's [1:13:46] had since we've create since it was [1:13:49] created in this community, right? Um I I [1:13:52] don't know um if that that may be fine, [1:13:56] you know, I I I don't know. I think it's [1:13:59] but I I do think it's important that like I said the jointly elected [1:14:04] officials need to make that that [1:14:05] recommendation to the city commission [1:14:07] and to the fiscal court. Um [1:14:10] and not necessarily me or or you know I [1:14:14] think I think this process enables the [1:14:17] elected officials to lead. [1:14:20] >> That sounds good. I I think six months [1:14:22] is a lot. Um, [1:14:24] planning and zoning, as you know, had [1:14:27] three positions, a director, an [1:14:30] administrative assistant, and a code [1:14:32] enforcement. [1:14:33] >> Mhm. [1:14:34] >> Full-time. [1:14:36] >> And now there's one person. Um, [1:14:41] so six months would be a lot. [1:14:44] >> Yeah. I think for one person to not have [1:14:46] a breakdown and for the citizens, [1:14:50] you know, uh to be worked with and was [1:14:54] it right to lose that code code [1:14:56] enforcement officer position? I don't [1:14:59] know. That was a position that checked [1:15:02] if everything was right afterwards. [1:15:05] whether it's signage, [1:15:07] whether it's [1:15:09] uh landscaping, [1:15:13] you you need to check things and not [1:15:16] trust that it happens. [1:15:18] >> Um and then with Rusty retiring, um [1:15:21] please don't take six months. [1:15:23] >> And commissioner to address I think the temperature of the county judge and [1:15:27] I don't think she would mind saying was [1:15:29] there's no expectation that it would [1:15:31] last that long. The the hope is that it [1:15:33] would be [1:15:34] >> it would be a swift eval comprehensive [1:15:38] process that begins immediately after [1:15:40] the passage of this resolution. [1:15:42] >> That's good. [1:15:42] >> And then conclusions are reached uh [1:15:45] promptly for implementation [1:15:48] uh swiftly [1:15:49] >> that can be done before Christmas. I [1:15:51] mean meeting weekly. [1:15:52] >> There there is certainly a desire of the [1:15:54] parties to accomplish that task quickly. [1:15:57] And I I just want to also just for the [1:15:59] notation of of the public record that [1:16:02] there's an expectation that's reiterated [1:16:04] in the joint resolution saying that all [1:16:07] administrative services shall continue [1:16:10] and that there's nothing prohibiting the [1:16:13] planning commission from appointing an [1:16:14] interim director and and we would [1:16:17] encourage them publicly to do so um [1:16:20] swiftly so that they can continue to [1:16:23] operate as nor enable them citizens to [1:16:26] receive the services that are expected [1:16:28] to be received. This is a pause on the [1:16:31] permanent hire of a full-time director [1:16:34] so that these further evaluations can be [1:16:36] met. You can never change structure post [1:16:38] hire. It's most efficient to look at [1:16:41] structural u mechanisms prehire so then [1:16:44] the right person is hired with a right [1:16:46] understanding of what they the structure [1:16:48] they're being employed by is. [1:16:51] >> Oh, I think it's a great thing to look [1:16:53] at. So, it's it's a good time. Thank you [1:16:55] for uh it not being six months. [1:16:59] >> So [1:16:59] >> he couldn't guarantee that. But okay. Uh [1:17:02] any other comments? [1:17:03] >> This is just a comment. This is out [1:17:04] there. Have Have the city and county [1:17:07] ever been pleased with planning and [1:17:09] zoning? [1:17:10] >> Yeah. When I sued about [1:17:12] >> So So I I would absolutely say yes. Um [1:17:17] it had it was it functioned at a very [1:17:20] high level until we started having just [1:17:22] the [1:17:23] >> the turnover when when the the historic [1:17:26] director that had been here a long time [1:17:27] retired. I don't think we we h I think [1:17:30] we had some turnover on the board itself [1:17:32] at the time. I think we had some [1:17:33] resignations of long-erving folks and I [1:17:37] just don't think that the board itself [1:17:39] really has found its footing again. And [1:17:42] I I think so you you had a planning [1:17:44] design. We first of all the the city [1:17:47] engineers back there and he can talk but [1:17:49] um we we we valued the the inspection [1:17:54] that came from zoning compliance is [1:17:56] critical [1:17:57] >> but the city didn't necessarily endorse [1:18:00] that that decision that was made by [1:18:02] planning and zoning as a body. So [1:18:05] planning and zoning made the decision to [1:18:07] remove the code enforcement and to [1:18:09] consolidate the enforcement and [1:18:11] observation of their zoning into the [1:18:13] director position. We didn't support [1:18:15] that and we we went on the record with [1:18:18] not supporting that. We don't support [1:18:19] that now. The the average complaint we [1:18:22] get. So that's part of the recent [1:18:25] confusion. We've had uh structures built [1:18:28] on property lines that were not movable. [1:18:30] Um, we we've had things that are just [1:18:33] issues that doesn't involve that that [1:18:37] are purely administration and and [1:18:39] application of of the documents that [1:18:42] planning and zoning is responsible for [1:18:43] enforcing. So, it's not necessarily um [1:18:48] slander at any one individual. It's it [1:18:51] truly is is an education, it's a [1:18:53] training, it's a reiteration. It's all [1:18:55] the aspects of administering a body like [1:18:57] that. But the most important thing is is [1:19:00] that the the elected officials [1:19:02] um establish the level of service that [1:19:05] it wants or the level of service that it [1:19:08] needs because plan zoning is the arm of [1:19:10] the city and county as it relates to [1:19:12] development, [1:19:13] >> right? And then we'll get together and [1:19:14] know that we want to, you know, pay for [1:19:17] good services. So that's that's good. [1:19:20] Okay. [1:19:22] >> Other comments? [1:19:25] Call for the question. [1:19:28] All those in favor of resolution 2026 [1:19:33] 0928 [1:19:35] 02 say I. [1:19:38] >> I. [1:19:39] >> Those opposed. Motion carries. [1:19:42] >> Okay. Next on our agenda, [1:19:45] the city manager report. [1:19:51] » Thank you, mayor, commissioners. Um, [1:19:53] we'll go over some quick dates. The fall [1:19:56] break for the schools are October 5th [1:19:58] through the 9th. We would like to just [1:20:01] make everybody aware that uh people will [1:20:04] be all over town. Usually kids are out. [1:20:07] Um October 12th is the next commission [1:20:09] meeting. Um moving down the October 2nd [1:20:13] is the Bourbon Chase. Uh the epicenter [1:20:15] will be fourth in Maine. Again, you'll [1:20:18] have u a significant number of people [1:20:21] that that pass through town during that [1:20:23] event. Each bus has six people on it. [1:20:25] You'll have three or 4 hundred buses. [1:20:27] So, you're going to have you could have [1:20:29] 5,000 people that will will kind of move [1:20:31] like a herd through downtown over a [1:20:33] period of a few hours there. And um it's [1:20:36] a it's a sight to see if you would like [1:20:38] to come out and definitely would [1:20:40] encourage you to do that. Center [1:20:41] college's homecoming is the 15th through [1:20:43] the 17th. The um audit process is is [1:20:48] ongoing. If you have any questions, we'd [1:20:50] be happy to talk to you that the their [1:20:52] staff was in the building last week. The [1:20:55] um skate park grand opening was [1:20:56] terrific. Uh we had a a big day in the [1:20:58] park that Saturday. You had touch a [1:21:00] truck was going on. You had I think [1:21:03] Commissioner Holland was watching soccer [1:21:05] that morning, too. And it was a it was a [1:21:08] big day definitely for Millennium Park. [1:21:09] But it was a it was a milestone day. [1:21:10] There were some kids out there that [1:21:12] helped. They were they were adults now, [1:21:15] but they were kids when the original [1:21:16] skate park was assembled. [1:21:18] >> And uh it's it's just an interesting [1:21:20] thing to see how things uh like uh [1:21:23] features in a park progress over time. [1:21:26] >> And so you can see those kids that was [1:21:27] learning to skate in 2005 [1:21:30] that are really impressive now as adults [1:21:33] that are encouraging others to skate and [1:21:35] taking care of the young folks. So it is [1:21:36] interesting. Um the um October 15th is [1:21:41] third Thursday witches night downtown 5 [1:21:43] to9 17 Saturday again is the chili [1:21:46] cookoff which you know and then I want [1:21:48] to talk about the uh police chief hiring [1:21:50] process. We since the uh packet was [1:21:54] Friday we we took a minute and would like to draw your attention to the [1:21:58] digital uh uh file. We've added inside [1:22:02] of your packet a a flowchart when you [1:22:05] get to the folder of the the hiring [1:22:08] process. We were able to do that today [1:22:09] for you to look at. This is the what the [1:22:12] process that we will follow and I'll go [1:22:14] over that. We we are updating the job [1:22:16] description. [1:22:18] The it is below my memo. Kevin, uh [1:22:21] commissioner call. Thank you. [1:22:23] >> Yeah. Um the job description [1:22:26] >> I knew where it was. Donna was I need a [1:22:28] copy cuz I'm papering, you know. [1:22:30] >> Yeah, we I did not print it. I [1:22:32] apologize. [1:22:33] >> Um the um current job description that we're looking at is in there. It's [1:22:40] including your packet. You're welcome to [1:22:42] review it and give us any feedback that [1:22:44] you want. So, it's update the job [1:22:46] description which is done and the [1:22:48] marketing materials which is ongoing. We [1:22:50] want to advertise the position. Um we [1:22:52] are advertising nationally a as uh been [1:22:56] suggested to me. We we are going through [1:22:59] our national um um sources that we were [1:23:04] able to um use during the fire chief [1:23:07] hire that resulted in um a wide variety [1:23:11] of applicants from across the the region [1:23:14] and also some from out of state. Um, so [1:23:17] we were able to what we consider a a [1:23:20] wide spectrum of candidates. [1:23:23] We would like to uh then take those with a small committee. What I'm going [1:23:28] to use right now, unless you all give me [1:23:31] different direction, is the HR director. [1:23:33] I want to use the utility director and [1:23:35] the city attorney to start to whittle [1:23:37] down the applications once the deadline [1:23:39] passes. Um we'll go through uh screen [1:23:44] those applicants down to a a small [1:23:46] number and begin to do uh interviews on [1:23:49] with some top applicants. Um and we'll [1:23:53] do uh with that panel we'll we'll do [1:23:55] that interview and then we'll ultimately [1:23:58] um come back with a recommendation to [1:24:00] you guys at the end of that process. So [1:24:02] that slide, the very last page, page [1:24:05] seven of that packet indicates the [1:24:07] process that we would expect to to [1:24:09] follow, which is very similar to to the [1:24:12] fire chief hire that we uh had to [1:24:14] experience what uh well we've done twice [1:24:17] now. [1:24:21] » Any questions or comments to the city [1:24:23] manager? [1:24:26] » You can do that and and certainly um the [1:24:29] first step will be advertising. So when [1:24:32] we come back in two weeks, if you all [1:24:34] have a question on the process, you're [1:24:36] welcome to bring that up then and and [1:24:39] because it will be at once advertised, [1:24:41] it will be out there for a while. Um so [1:24:44] just know that. Um so you will have time [1:24:47] to to come back and talk about the [1:24:49] process that we've we've given you. [1:24:52] >> So it's advertising for how long? [1:24:54] >> We will be advertising and I think what [1:24:56] do we do on the the fire chief Randy? 30 [1:24:58] days. Um actually I think it ended up [1:25:01] being more like 60. We really didn't put [1:25:03] a time stamp on it because we wanted to [1:25:05] make sure that we got vid cabinets but I [1:25:08] think practically I think it was open [1:25:09] for about 60-day window. [1:25:15] » Other questions for the city manager [1:25:20] » hearing none then uh the next item on [1:25:22] the agenda is the our second hear the [1:25:25] public where folks can be recognized and [1:25:28] speak to us for 3 minutes or less and [1:25:30] we'll listen to you talk about your [1:25:32] topic and move right along. Is there [1:25:34] anyone deser to speak to them? Yes, sir. [1:25:36] You want to take the mic and identify [1:25:38] yourself? [1:25:42] Mayor, Mr. Mayor, commissioners, [1:25:46] my name is Michael Thrasher and I reside [1:25:49] at 75 Gwyn Island Circle in Boil County. [1:25:54] Roughly eight years ago, a sewage [1:25:56] pumping station was built in the [1:25:58] vicinity of the intersection of [1:26:00] Southbuster Pike and Highway 33 along [1:26:03] Mox Creek. The city of Danville has been [1:26:06] and is responsible for this pumping [1:26:09] station and the one located near Spears [1:26:11] Creek just off the Highway 2168 bypass. [1:26:15] >> [clears throat] [1:26:16] >> Ever since a sewage pumping station was [1:26:18] put into operation, there has been a [1:26:20] continued problem of air pollution from [1:26:23] the pumping station, primarily during [1:26:25] the hours of 7:00 p.m. to 7:00 a.m. [1:26:29] Though there has been some minor [1:26:30] technical attention to the problem in [1:26:32] the past, it still exists. The odor from [1:26:36] this problem radiates about one quarter [1:26:39] to [clears throat] one half of a mile. [1:26:41] This distance encompasses not only [1:26:44] houses near the intersection of Gwyn [1:26:47] Island Road and Highway 33, but also [1:26:50] nearby houses in the Hunt Farm [1:26:52] subdivision and the Mox Creek [1:26:54] subdivision. [1:26:55] Somewhere in the neighborhood of 30 [1:26:58] houses are directly affected, plus [1:27:00] traffic passing through that area on [1:27:02] Highway 33 and onto Gwyn Island Road. As [1:27:06] a side note, the pumping station near [1:27:09] Spears Creek does not seem to have this [1:27:11] air pollution problem to my knowledge. [1:27:15] My sole purpose being here today and [1:27:17] speaking to this group is to ensure that [1:27:19] you as the governing body of the city of [1:27:22] Danville have been ma made aware of the [1:27:25] problem of the air pollution caused by [1:27:27] the sewage pumping station and that it [1:27:30] is a matter of public record. Thank you [1:27:32] very much. [1:27:33] >> Thank you, sir. [1:27:34] >> What was your name again? I'm sorry. [1:27:38] >> C. [1:27:38] >> Thank you. [1:27:40] >> How you spell that? [1:27:41] >> T H R S H E R. [1:27:44] >> All right. Good. All right. Thank you, [1:27:46] sir. [1:27:48] Anyone else? [1:27:52] Thank you guys for being patient [1:27:53] tonight. [1:27:54] >> Yes, sir. Young man. [1:27:57] All right. [clears throat] First off, [1:27:59] congratulations to Tony. Been a neighbor [1:28:02] and a friend for a long time. All [1:28:05] right. Next. [1:28:09] Anybody seen any raccoons in the [1:28:12] neighborhoods? [1:28:14] >> I'm not seeing them anymore. [1:28:17] Um, [1:28:18] >> you caught them all. [1:28:20] >> You're not seeing them. [1:28:21] >> They disappeared. [1:28:22] >> Oh, okay. [1:28:22] >> Yeah. Um, [1:28:26] speak about the cat that was in the [1:28:28] window. Since we don't have planning and [1:28:30] zoning enforcement, we can't seem to get [1:28:33] a a phone call from any enforcement. [1:28:37] Dead cat laid in the window in that [1:28:39] house next to me or my daughter for five [1:28:42] days. Dogs broke the windows out. They [1:28:45] attacked and came after my daughter. [1:28:49] Trapped one woman in the car. [1:28:52] There's six of them in there. They've [1:28:54] been gone. They left them there for over [1:28:56] five days. [1:28:58] >> [clears throat] [1:28:59] >> couldn't get a hold of anybody to come [1:29:01] over there and look, do anything. [1:29:03] >> What's that address again? [1:29:06] >> My address for my do my house is 418. [1:29:10] It's the one next to me. [1:29:11] >> Yeah, it was 416 [1:29:13] 420. [1:29:14] >> It should be 416, I think. But I'm not [1:29:18] positive that that's the number. It [1:29:20] should be, but mine is 418. I'm next to [1:29:23] it. It laid in the window right beside [1:29:26] our driveway and the smell and the [1:29:29] stench from the house is rank comes out [1:29:32] of it all day. [1:29:35] Now [1:29:38] the dogs [1:29:40] I I mean they have barked but they [1:29:44] actually came after my daughter and run [1:29:47] her in the house. Pin one in the car. [1:29:52] I'm not going to put up with that. [1:29:55] I don't want to. I'm gonna have my [1:29:58] granddaughter get bit or my grandson. I [1:30:01] don't know if any of y'all have ever [1:30:02] been dog bit, but it it hurts. I have [1:30:06] twice about two bad dogs. [1:30:10] Shots and all that you have to go [1:30:11] through. Now, [1:30:17] I got to address this. I didn't get to a [1:30:21] while back because I've been busy with [1:30:23] my grandkids. But I wanted to say this [1:30:26] to Mr. Coffee here. Average average [1:30:30] citizen [1:30:32] uh few meetings back it was said it [1:30:35] spoke they don't quite understand the [1:30:38] workings of the public [1:30:41] agendas and the uh government. I [1:30:45] understand it pretty good. I brought [1:30:47] this up with Mr. Uh Jason at the county [1:30:51] because he said it too there. We [1:30:53] understand a lot more than you all think [1:30:55] we do. I've been watching a lot more. [1:31:02] I guess that was my 30 minutes. [1:31:05] >> Did you self-govern yourself there? [1:31:07] >> I figured I better. [1:31:10] >> That's not all I had to say. Was that [1:31:11] your last item? [1:31:13] >> Was that your last item? [1:31:15] >> No. [1:31:15] You got another I I wanted to ask [1:31:17] about well is that the reason that you [1:31:20] can't get because of the turnover with [1:31:22] the planning and zoning and the [1:31:23] enforcement code enforcement is that why [1:31:25] you can't I couldn't get somebody to [1:31:27] come come out there. Animal control [1:31:29] didn't answer. They didn't come. I mean [1:31:32] >> did you go to the courthouse for animal [1:31:34] control? [1:31:36] I mean in fiscal court over animal [1:31:38] control. I'm [1:31:40] >> they just turned them into under the [1:31:42] sheriff's office, [1:31:43] >> right? [1:31:43] >> Yeah. [1:31:44] >> Did you? Well, I went out to I caught [1:31:46] out to the where you go is out to [1:31:48] >> humane societies. [1:31:49] >> Yeah. Out on the bypass. That's where I [1:31:51] had to go when I had [1:31:53] >> when I had to talk to them. [1:31:55] >> I went out there and [1:32:00] >> thank you. [1:32:01] >> Thank you'all. [1:32:02] >> But please continue to come back. Keep [1:32:03] us updated on the stuff. [1:32:05] >> I just been busy with my grand [1:32:09] you been spoiling them. [1:32:10] >> Oh. [1:32:16] Well, thank you, sir. That's great. [1:32:19] >> Anyone else? [1:32:26] » Uh, commissioner comments. And, uh, [1:32:31] >> I've got one. [1:32:32] Um, pertains to our [1:32:36] city attorney. [1:32:38] Uh, congratulations on being named [1:32:41] Graham Pub Center. Um, [laughter] [1:32:45] you won the Joe McDaniel, what was the [1:32:48] full title of the [1:32:50] >> Excellence Award. [1:32:52] >> Thank you. [1:32:53] >> That's pretty cool. [1:32:54] >> I appreciate that. It was a special day [1:32:56] >> for sure. [1:32:56] >> Well, you you surprised us. [laughter] [1:33:00] >> Thank you. I think it surprised a lot of [1:33:01] people. [1:33:03] >> I'm kidding. Congratulations. [1:33:04] >> Thank you very much. [1:33:05] >> He He compliments and he takes it right [1:33:07] back. [1:33:08] man. [1:33:09] >> I'll take it, [1:33:09] >> Steve. [laughter] [1:33:11] >> Okay, [1:33:12] >> other comments. [1:33:14] >> I just wanted to say I mean there's a [1:33:16] lot going on in Dan. Well, obviously the [1:33:18] things that were good, but the KC the [1:33:19] training was good that we went to last [1:33:21] year, last year. Last week feels like [1:33:24] last. And then the award that uh was [1:33:27] given on Friday for the city. Hopefully [1:33:29] you'll announce that again um for the [1:33:32] mural on Main Street, [1:33:34] >> which was awesome. And then [snorts] um [1:33:37] maybe at the next meetings we could do [1:33:40] per you know the cancer awareness for [1:33:41] October [1:33:44] add that to the agenda maybe but since [1:33:47] October will be this week just to [1:33:49] acknowledge that. [1:33:52] >> Okay. Someone else [1:33:55] >> I had I had several people I have a Josh [1:33:58] request. I'm just putting it out there. [1:34:00] Um you know you're out there on the [1:34:03] campaigning and stuff. um across from [1:34:06] Jenny Rogers between Jenny Rogers and [1:34:08] Monasuri and there's the walkway um not [1:34:12] only the people that help the kids walk [1:34:14] but um where Alta and East Maine is [1:34:16] people don't stop [1:34:19] and I've had um several people wonder if [1:34:22] there can be a speed hump before or [1:34:25] after the crosswalk or something um [1:34:29] because there's been some scary [1:34:30] incidents um with kids and all going to [1:34:34] Jenny Rogers. [1:34:35] >> So, I wanted to make sure you were aware [1:34:38] of that. [1:34:38] >> Yeah, we'll put it on our list. I've [1:34:40] always had kind kind of had my eye on [1:34:42] that intersection for a mini roundabout. [1:34:43] I'm not sure if the the dimensions would [1:34:46] work, but it would definitely do the [1:34:47] job, but we'll we'll take a look at it [1:34:48] and see. [1:34:49] >> Okay. Thank you, Josh. [1:34:53] >> Other comments? [1:34:58] » All right, let's go on then. Next item [1:35:00] is pay of the bills. [1:35:02] Oh. [1:35:10] We'll take a break. [1:35:11] >> Well, there's been a Are you motioning [1:35:13] for a five minute? [1:35:16] >> Two minutes. Two. [1:35:18] >> Wow. [1:35:21] >> Is there a second comment consensus? [1:35:23] We'll take a five minute break. I'm not [1:35:25] leaving my seat. I can't do anything in [1:35:27] five minutes anymore. [1:39:10] Next item is payment of the bills. Uh [1:39:12] chair entertain a motion to pay the [1:39:14] bills as presented. [1:39:15] >> So moved. [1:39:17] >> Is there a second? [1:39:18] >> Second. [1:39:19] >> Thank you all. Any questions about the [1:39:21] bills? [1:39:23] >> Hearing none. All those in favor say I. [1:39:25] >> I. [1:39:26] >> Those opposed. Motion carries. Budget [1:39:28] book presentation. [1:39:30] comfort. [1:39:32] >> So within your packet, you as of about [1:39:35] 4:25 have our FY27 [1:39:39] budget book [1:39:41] >> uh which is different than your approved [1:39:42] budget which has been available online [1:39:45] um on our website available to the [1:39:47] public since um July 1st. But your [1:39:50] budget book is a much more comprehensive [1:39:53] document that includes [1:39:55] um charts and and abstracts and and [1:39:59] graphs and data. Um and it gets compiled [1:40:03] into 191 page document which is also why [1:40:07] you all don't get a copy yet. Um [1:40:11] >> thank you. [1:40:11] >> I'm working with Melanie. We're going to [1:40:13] have some professionally printed copies [1:40:15] made um for you all and then copies [1:40:18] available that for people here at the [1:40:20] public if they would like one. [snorts] [1:40:21] Um we'll also post our um budget book to [1:40:25] the website as well so the public can [1:40:27] get the full document as well. Um we'll [1:40:30] be submitting it to the National [1:40:33] Government Finance Officers Association [1:40:35] to attempt [1:40:37] um a budget award. Um this will be our [1:40:40] second attempt. We have not yet got the [1:40:41] award, but we got some good feedback [1:40:43] last time. So, um hopefully we'll get [1:40:46] some more feedback this year as well. Um [1:40:49] and see if we get to get a nice gold [1:40:52] star for um uh gold standard in [1:40:56] budgeting as a as a city. So, uh we just [1:41:00] wanted to present this to you all as an [1:41:02] official document. It it just takes a [1:41:03] while. Takes time to do it. It takes um [1:41:06] time to review it. You know, Melanie [1:41:08] helped out. I've got a staff member, [1:41:11] Mariah, who put her poor heart and soul [1:41:14] into it this year. Last year, we had our [1:41:16] intern um working on it. And um it just [1:41:20] it's a team effort that a lot of tears [1:41:24] back there and paper cuts [1:41:29] >> close to 200 pages. [1:41:31] >> 200 pages. [1:41:31] >> Oh man, that's [1:41:33] >> And you guys need to read every single [1:41:34] one of them, [1:41:34] >> right? I say don't print too many [1:41:36] copies, man. If you catch a typo, tell [1:41:38] me before [snorts] Wednesday when [1:41:40] therefore Wednesday. [1:41:41] >> I'm sorry. [1:41:42] >> Are there numbers in it? [1:41:43] >> There are numbers all over it. [1:41:47] >> It's in the packet, but just going [1:41:49] through the It's pretty impressive [1:41:50] though. [1:41:51] >> It is in the packet. the the actual line [1:41:53] item budget is also included in the [1:41:55] document itself, but it's really um the [1:41:58] intent of the budget book is is to be [1:42:00] almost an analysis of your budget plus [1:42:03] to include um uh like your policies like [1:42:06] I throw Ry's um authorized positions [1:42:10] policy in there and the comp plan and we [1:42:13] include debt and um [1:42:16] >> lots of lots of things. Um [1:42:20] it's a we try to make it a little bit [1:42:22] visual but it's um [1:42:26] it's available to the public. I will say [1:42:28] this type of budget book is not as [1:42:30] easily understood by the public which is um on my list of next things after this is to start producing what's [1:42:39] called a popular annual financial report [1:42:42] which is a short [1:42:44] >> public update kind of a little different [1:42:46] than what we do at our monthly and [1:42:48] quarterly updates that you all get but [1:42:50] is really truly geared toward the [1:42:52] public. Um whereas my reports to you all [1:42:54] are geared so that you all know the [1:42:56] position of of the city financially. Um [1:43:00] so this is we're happy for the public to [1:43:02] look at it, ask questions. Like I said, [1:43:04] we'll have some printed copies for them, [1:43:06] but a lot of times they don't know what [1:43:08] a consolidated financial statement is or [1:43:12] um necessarily what our funds are and what they're for. And so this could [1:43:17] be a little bit overwhelming to a true [1:43:19] non-financial person, but it's in there. [1:43:23] Um, if you have any questions about it, [1:43:25] let me know. [1:43:26] >> Thank you, ma'am. No extraction needed [1:43:27] on that one. [1:43:28] >> I just want to say thank you because [1:43:30] that's not been done in a long time. [1:43:32] >> Yeah. [1:43:32] >> And it and I think once we get a good [1:43:34] process in invol place, it'll be a [1:43:37] little quicker. [1:43:38] >> Um, but it takes it takes a lot of work. [1:43:41] We've been working on it since since [1:43:43] April. It's just a and the system we [1:43:45] use, we use Canva a lot for it. It's [1:43:47] finicky and [1:43:49] >> um so we've been working on it. It just [1:43:52] takes a while. [1:43:54] [clears throat] [1:43:54] >> All right. The next item which does [1:43:56] require some action is the Denver Board [1:43:58] County Development Core budget [1:43:59] allocation request. M Compton, you going [1:44:02] to take the lead on that one? [1:44:03] >> Yeah. So in um budget um this year we [1:44:06] allocated $50,000 to the Danville Boil [1:44:10] County Economic Development Corporation. [1:44:12] We are recommending that that allocation [1:44:14] be increased to 100,000. That is [1:44:17] commensurate with where it was a couple [1:44:19] years ago. Um we had reduced it um for a [1:44:22] couple years running. Um there were a [1:44:24] few reasons um for that partially [1:44:27] budgetary, partially I think um some [1:44:32] communication issues. Um we, you know, I [1:44:36] feel comfortable requesting that you all [1:44:38] increase it. I do sit on the board's um [1:44:40] finance committee for the Danville Bo [1:44:42] County Development Courts Fina finance [1:44:44] committee. Um they're they're taking a [1:44:48] very strong and and um financially [1:44:52] responsible position in their upcoming [1:44:56] um year. Um and I think in the best [1:45:00] interest of the city and the [1:45:02] corporation, we should increase their [1:45:05] current year [clears throat] funding. [1:45:07] >> Thank you, ma'am. Is there a motion? [1:45:11] » I move to approve the request as [1:45:14] presented. [1:45:16] >> Thank you, ma'am. [1:45:18] >> I'll second. [1:45:21] >> Thank you, ma'am. Any questions to Miss [1:45:24] Compton? [1:45:29] Hearing? None. All those in favor say I. [1:45:32] I. Those opposed. Motion carries. [1:45:35] Thank you all. [clears throat] [1:45:38] smiling back there. Look, [1:45:41] next item is uh resolution 20 26 092803, [1:45:46] the KPBI dispersement number six. Mr. [1:45:50] Hun, welcome. [1:45:52] >> Good to see you back there, man. [1:45:58] Uh this is dispersement request number [1:46:01] six for the second round of KPDI funds [1:46:05] that have been awarded to the EDA. Um [1:46:08] this is related to the project that the [1:46:11] local match is being funded by the [1:46:13] industrial foundation. Um it's the [1:46:16] project that is um [1:46:21] uh there's too many KPIs [1:46:24] >> Stagal Road. Stagal road. Uh within the [1:46:27] packet is the dispersement request and [1:46:29] an update on the project. Um but we just [1:46:32] need this signed for the dispersement by [1:46:35] the cabinet. [1:46:37] >> And the request is for how much? [1:46:39] >> Oh [1:46:41] 165 35719. [1:46:44] Yeah, [1:46:44] >> they have four thou 4 400,000 or so left [1:46:48] on the grant. Um, and total is a [1:46:50] million. Um, but this is a direct pass [1:46:52] through to the EDA from the city. [1:46:55] >> Thank you, ma'am. Chair would like to [1:46:58] entertain a motion to the KPDI [1:47:01] dispersement. [1:47:02] >> I'll move to approve resolution [1:47:04] 2026092803. [1:47:09] » Thank both of you ladies. Any questions [1:47:11] or comments? Hearing none. All those in [1:47:13] favor say I. [1:47:14] >> I. [1:47:15] >> Those opposed. Motion carries. Next item [1:47:19] is the second reading of ordinance 2076 [1:47:23] fiscal year 27th property tax rates. Uh [1:47:26] madam clerk, you want to read to [1:47:28] ordinance for us, please? [1:47:29] >> Yes. This is the second reading of [1:47:31] ordinance number 2076 and ordinance [1:47:33] establishing adorum tax rates for fiscal [1:47:35] year 2026 through 2027 and payments for [1:47:39] penalties for non-payment. [1:47:41] Thank you, ma'am. [1:47:43] Is there a motion? [1:47:46] >> I'll make a motion to approve the a [1:47:48] second reading of ordinance 2076. [1:47:51] >> Thank you, ma'am. Is there a second? [1:47:55] >> Second. [1:47:56] >> Thank both of you. Any questions or [1:47:59] comments? [1:48:01] Hearing none. Roll call vote. [1:48:03] >> Commissioner Peak. [1:48:05] >> Yes. [1:48:05] >> Mayor Atkins. [1:48:06] >> Yes, ma'am. [1:48:06] >> Commissioner Holland, [1:48:07] >> yes. Commissioner Sris, [1:48:09] >> Commissioner Codle. [1:48:10] >> Yes. M. Compton, you want to make a [1:48:12] comment now? [1:48:13] >> Uh, just just to read uh to remind the [1:48:16] public from the last meeting, rates for [1:48:18] 2026 will be set at for real property at [1:48:22] um 11.7 cents per 100 for real property. [1:48:26] 17.95 [1:48:27] cents per $100 of personal property and [1:48:31] 20 cents per $100 for motor vehicles. um [1:48:34] for real property which is your home [1:48:36] property. This is a decrease in your [1:48:38] rate for 2026. [1:48:41] >> Thank you ma'am. The word decrease is [1:48:44] very important right. [1:48:45] >> All right. Next item. Resolution 2026 [1:48:49] 092804 [1:48:51] the KIA grant assistance agreement. [1:48:54] >> Mr. Courier. [1:48:57] >> Thank you. Mayor [1:48:57] >> have to vote on that. [1:48:59] >> Uh oh. [1:49:00] >> This is Wait. Sorry. [1:49:02] >> We did. We did roll call vote, didn't [1:49:03] we? Yeah, we did real quick. [1:49:04] >> Oh, we did. Okay. [1:49:06] >> Yeah, [1:49:06] >> you scared me. [laughter] [1:49:10] » That's all right. I have them all the [1:49:12] time. All right, Marshall. I'm sorry. Go [1:49:14] ahead. [1:49:15] >> Thank you, Mayor. Um, this is a request [1:49:17] for approval of proceeding for with the [1:49:20] Kentucky Infrastructure Authority grant [1:49:22] agreement for wastewater treatment plant [1:49:25] improvements phase 2 project. This grant [1:49:28] agreement uh totals $12 million. [1:49:31] Um, and this goes along with the [1:49:35] previously approved um, KIA [1:49:39] uh, lowinterest loan agreement that we approved a couple months ago for [1:49:45] an additional $10 million. So that [1:49:47] brings us to $22 million to fund the [1:49:50] project. [1:49:51] [clears throat] [1:49:52] >> Is there a motion to accept [1:49:55] the grant assistance agreement? [1:49:59] I'll make a motion to approve resolution [1:50:01] 202692804. [1:50:04] >> Yeah, I was concerned about that [1:50:05] hesitation. Is there a second? [1:50:07] >> No hesitation. [1:50:09] >> Second. [1:50:10] >> Thank you, ladies. [1:50:12] Any questions or comments on this, [1:50:14] Grant? [1:50:16] >> The match was what? Uh [1:50:19] >> what was the match? [1:50:21] >> There's no match on this. [1:50:22] >> Oh, wow. [1:50:23] >> Yeah. [1:50:23] >> No hesitation. [1:50:26] >> Wow. the TW me. [1:50:30] All those in favor say I. [1:50:32] >> I. [1:50:33] >> Those opposed? Motion carries. [1:50:37] Next item is solid waste ordinance. [1:50:42] Orderous discussion. [1:50:43] >> Excuse you. [laughter] [1:50:46] >> Well, it was Josh. I guess Josh, you're [1:50:48] up, right? [1:50:50] >> Yes. Thank you all. Um this and you know [1:50:53] it's been a this meeting's been a little [1:50:54] bit of a longer one so we don't have to [1:50:56] spend a lot of time on this because this [1:50:57] isn't timesensitive. We during the [1:51:00] process of all the solid waste changes [1:51:01] we've made this year. We've gone through [1:51:02] the solid waste ordinance and it needed [1:51:04] to be updated uh in a big way. So [1:51:07] >> if you look through it's in your packet [1:51:09] the update that we've done. There's a [1:51:10] lot of red. We it shows all the changes [1:51:13] and it's almost all red. We've had to [1:51:14] change almost the entire thing. This is [1:51:16] something my our staff we worked with [1:51:18] codes enforcement on because there was a [1:51:19] lot of codes enforcement portions to [1:51:21] this. Um it really just modernizing it [1:51:23] and also providing us with some [1:51:25] enforcement mechanisms that we [1:51:26] previously didn't have such as [1:51:28] previously we there was no ordinance [1:51:30] that says you couldn't put your garbage [1:51:32] in a recycling container. [1:51:33] >> So we didn't have any enforcement [1:51:34] measures for that if we caught somebody [1:51:36] doing that. So that's in there. I'm [1:51:38] going to run through real quick some [1:51:39] highlighted stuff. Like I said this is [1:51:40] not time sensitive. We don't have to [1:51:42] approve anything tonight. I wanted to [1:51:44] get you this in your hands, show you [1:51:45] some of the big changes, and then let [1:51:46] you all stew on it for a little bit, and [1:51:48] we can we can talk about this later. Um, [1:51:51] very first page, there's a and we can [1:51:53] get in more into this later. We define [1:51:55] apartment complexes, townhouse [1:51:56] complexes, conomian complexes as a [1:51:59] property that has six or more units on [1:52:00] it. We're going to use that later to [1:52:02] tell people where they have to have [1:52:04] dumpsters at moving forward. Um, because [1:52:07] th those are our big trouble areas with [1:52:08] containers right now. and from [1:52:10] enforcement standpoint is when we have [1:52:12] a, you know, sixlex with a very small [1:52:15] road frontage area and they're all [1:52:17] putting all these containers there all [1:52:19] at the same time and it's it makes that [1:52:20] difficult. So, we're going to try to get [1:52:22] more dumpsters in those locations. So, [1:52:24] that that that definition will apply [1:52:26] later. You know, we define recyclable [1:52:28] materials. We kind of leave that a [1:52:29] little bit open so it can change because [1:52:31] that's not something I also we tried to [1:52:33] make this as evergreen as we could. uh [1:52:35] that you know as things change in the [1:52:37] future that we don't have to go back and [1:52:38] be revisiting this ordinance all the [1:52:40] time. Um put in here about solid waste [1:52:42] collector uh that we contract that that [1:52:45] out. So how that's going to work. Um [1:52:50] on page 27-2.1 [1:52:52] we go more into we we created a section [1:52:55] about downtown collection. Um this is [1:52:58] probably the area that we had the most [1:53:00] discussion about of of how to do [1:53:02] downtown solid waste collection. Um, [1:53:05] this could be one I could see us coming [1:53:06] back to in the future after we do a [1:53:09] little trial and error with with this [1:53:11] with when you read through this. It's a [1:53:13] lot about, you know, where do we what [1:53:14] enforcement do we have for when people [1:53:16] use roll carts, when do we force them to [1:53:18] use dumpsters, when does the city put [1:53:19] out dumpsters, and you have kind of [1:53:20] common areas as long as they're paying [1:53:22] in to the overall collection on their on [1:53:24] their water bill. Um, and then we talk [1:53:28] about grease and oil that they need to [1:53:30] address. If there's a restaurant, they [1:53:31] need to address their grease and oil. [1:53:32] And they do that through the health [1:53:33] department and through uh wastewater [1:53:35] with with Marshall and those folks. So, [1:53:37] um, we we added an area in there for [1:53:42] they have to have their contain if [1:53:43] they're using containers. If they're if [1:53:44] they're a business that there's no way [1:53:45] we can get a dumpster, they have to use [1:53:47] containers. In this area that we [1:53:49] describe as downtown, they have to have [1:53:50] them off the sidewalk really quickly [1:53:52] after it's picked up. They can't leave [1:53:53] their containers out. Even, you know, [1:53:56] residents, okay, you know, you you get [1:53:58] home from work late, you're gonna have [1:54:00] time to get that off the off the curb, [1:54:01] but downtown businesses need to get [1:54:03] those containers off the curb pretty [1:54:04] quickly. Um, [1:54:06] and then it just on through 7-3 is about [1:54:09] the container requirements. [1:54:11] Um, like I said, it it talks about where [1:54:14] feasibility and that that a lot of that [1:54:15] falls back on me to determine when [1:54:17] dumpsters are feasible and when row cart [1:54:19] row carts the city engineer has [1:54:20] described in here. Um [1:54:24] 7-3F goes into a little bit more into [1:54:26] dumpster containers. Um and when those [1:54:28] are utilized and when they're not. Um [1:54:32] especially when it comes to with like I [1:54:34] said those multif family businesses when [1:54:36] they're going to be required to use a [1:54:37] dumpster, when they're eligible to use [1:54:39] roll- cart pickup. Um 7-4 was a big one. [1:54:43] That was placement of containers. This [1:54:44] code enforcement had a big role in this [1:54:46] the updates to it which was when can [1:54:48] people set their containers out? When do [1:54:49] they have to have them picked up? who's [1:54:50] responsible for that. Um, one thing that this is a little bit of an aside [1:54:56] I'll make quick. Anything that any [1:54:59] issues we have with codes enforcement [1:55:00] with roll carts with gu with anything in [1:55:02] this area, it all goes back to the [1:55:04] property owner because that's the only [1:55:06] thing we can tie it to. So, that's a a big a bit of u you know, it [1:55:12] causes a bit of an issue because the the [1:55:14] especially landlords, they don't they [1:55:16] don't want to be dealing with who set [1:55:17] their roll cars out, when they set them [1:55:19] out, did they pull them back in time, [1:55:20] are they are they broken, those kind of [1:55:21] things. Um, but there really is nothing [1:55:23] for else for us to tie that codes of [1:55:25] enforcement to. We have to tie it to the [1:55:27] property owner. Um, so I think as much [1:55:30] of that as we can get cleaned up and and also make sure that the landlords [1:55:34] and the property owners are aware that [1:55:36] they are the ones responsible for [1:55:37] ultimately for that. They can pass that [1:55:39] some of that responsibility on to their [1:55:41] renters. Um, [1:55:45] that's what down at the bottom of [1:55:48] the page that starts 7-4 at the bottom [1:55:50] there is that this sentence about if [1:55:52] it's a recyclable, if it's designated as [1:55:54] recyclable roll card, it can only have [1:55:55] recyclables in it. So that gives us a [1:55:57] little bit of enforcement teeth with [1:55:58] that. Um and then you get to 7-4.1 that [1:56:02] talks about this the collection fee [1:56:04] charges. In the past we actually had the [1:56:06] dollar amount in this ordinance. So [1:56:07] we've taken we replace that with it [1:56:10] depends on the contract with the solid [1:56:12] waste collector and it'll be determined [1:56:13] annually by the city commission. Uh so [1:56:15] they can it can change annually with as [1:56:17] is due with the contract. Um, yeah, and [1:56:21] it kind of it describes kind of how we [1:56:23] do things now with the base service of [1:56:24] one cart. Extra services go through the [1:56:26] solid waste collector. Um, but yeah, [1:56:29] that's that's really the highlights. Uh, [1:56:31] like I said, we can spend some time [1:56:33] looking at this. If you all have any [1:56:34] questions, reach out. Um, but yeah, this [1:56:37] is just something that we just needed to [1:56:38] do just from it really needed to be [1:56:40] updated. Uh, we got I got a couple other [1:56:42] ordinances on my list that we'll [1:56:44] hopefully get to in the near future um [1:56:46] that need to be updated as well. So, uh, [1:56:48] that's all I had for tonight unless [1:56:49] there's any any particular questions. [1:56:52] >> They're not allowed. They're not allowed [1:56:54] to ask any. Let's go. Uh, next item is [1:56:58] resolution uh 2026 092805 [1:57:02] Station number two for bid award. Josh, [1:57:07] >> wait, wait, wait. How about this? [1:57:09] >> I'd like to entertain a motion to [1:57:11] approve this resolution [1:57:14] for station number two. So moved. [1:57:17] >> Thank you, ma'am. Is there a second? [1:57:18] >> Second. [1:57:20] >> All right. Any questions about this bid? [1:57:24] >> You all had a chance to study, right? [1:57:27] >> Josh, you want to make a real short [1:57:29] comment? [1:57:29] >> Yep. We uh opened bids on September 8th. [1:57:31] We got four bids for the renovation of [1:57:33] the flat roof at fire station number [1:57:35] two. Um the low bid was from Top Roofing [1:57:38] in the amount of $42,866. [1:57:41] I reviewed it. Chief McCertie and I uh [1:57:44] we've looked at it together. staff at [1:57:46] the fire station met with these folks [1:57:47] when they came to review it before their [1:57:49] bid. They and we all we have a good [1:57:51] feeling about them. We've looked at [1:57:52] references and we recommend awarding the [1:57:54] bid to top roofing for that amount and [1:57:57] it's under budget by by a significant [1:58:00] amount. [1:58:00] >> Thank you, sir. [1:58:00] >> So, all those in favor say I. [1:58:03] >> I. Those opposed? Motion carries. [1:58:08] We like to entertain a motion for the [1:58:11] skate park skate park change order [1:58:14] number one. Is there a motion? [1:58:17] Resolution 202692606. [1:58:20] >> And I'll make that motion. [1:58:21] >> Thank you, sir. Is there a second? [1:58:22] >> Second. [1:58:23] >> Thank you, ma'am. [1:58:25] Any brief comments on this one? [1:58:27] >> This is actually a deduct of $1,500. [1:58:29] There was meant to be painted on that [1:58:31] low wall Millennium Skate Park. [1:58:34] >> There was no version of that that we all [1:58:35] thought looked good. So, we just said, [1:58:38] "Let's just scratch it. We'll figure out [1:58:40] some signage later." Because we just [1:58:41] couldn't, nobody was comfortable with [1:58:43] how anything looked that they drew up [1:58:44] for us. So, that's what we're getting [1:58:46] this deduct for. [1:58:48] >> Thank you, sir. [1:58:49] >> I was wondering what it was. So, [1:58:51] >> okay. [1:58:54] >> All those in favor of resolution 092806 [1:58:57] say I. [1:58:58] >> I. [1:58:59] >> Those opposed? Motion carries. Thank you [1:59:02] all. Resolution 2692807 [1:59:07] local assistance road program grant [1:59:10] application. Chair will entertain a [1:59:12] motion to accept this resolution. [1:59:14] >> So move. [1:59:17] >> Is there a second? [1:59:18] >> Second. [1:59:19] >> Thank you, ma'am. [1:59:21] Josh, brief comment. Yes, this is uh we applied for a similar grant last year [1:59:26] that had different name, but uh this is [1:59:28] a state program that pays for mostly [1:59:30] resurfacing of existing streets. We are [1:59:33] applying for $200,000 and then with that [1:59:36] has a $50,000 match to repave corporate [1:59:38] drive. Um so that's the project that we [1:59:41] would like to apply for. Applications I [1:59:42] think are due on Thursday. So we'll get [1:59:45] that we'll get that sent in tomorrow. [1:59:48] >> Thank you, sir. [1:59:51] >> All those in favor? [1:59:54] plan for this grant. Say [1:59:56] >> I. [1:59:58] >> Those opposed. Motion carries. Okay. Uh, [2:00:02] thank you. Well, Josh, resolution [2:00:03] 092808, [2:00:05] Meadow Brook design fee increase. Is [2:00:09] there a motion to approve this fee [2:00:11] increase for Meadow [2:00:14] Brook Drive? I [2:00:15] >> move for approval of resolution [2:00:17] 202692808. [2:00:19] >> Thank you, sir. Is there a second? [2:00:24] Thank you, ma'am. Josh, brief comments. [2:00:27] >> Uh, yes. This is that project that's the [2:00:30] swell that runs between Metobrook and [2:00:31] Brook Haven. We have a lot of flooding [2:00:33] and erosion issues out there. This is [2:00:35] they've done a preliminary design uh [2:00:37] that we're we're on board with and now [2:00:38] this will just they'll prepare the final [2:00:40] bid documents uh for this fee and then [2:00:42] we'll get it out the bid. I think this [2:00:43] will be something we'll ask for in the [2:00:45] budget next year. Uh probably start [2:00:46] hopefully start next summer would be the [2:00:48] goal for it. Uh but yeah, it's $22,500 [2:00:51] for them to to complete the bid [2:00:53] documents with it's Strand Associates is [2:00:56] the engineering firm doing the work. [2:00:58] >> So it just went up during or I mean [2:01:00] >> well they just they the scope of work [2:01:02] they they've not gotten a fee for that [2:01:03] yet. They just they we approved their [2:01:05] fee to do preliminary design. Now we're [2:01:07] approving their fee to do the the final [2:01:09] design. [2:01:09] >> Okay. [2:01:10] >> Yeah. [2:01:10] >> Just make a difference there. [2:01:15] » Thank you. So all all those in favor of [2:01:17] passing 2092808 [2:01:19] say [2:01:20] >> I. [2:01:21] oppose. [2:01:23] Motion carries. Thank you. [2:01:26] All right. Resolution 202692809 [2:01:33] Stanford. Oh, this is the agreement [2:01:35] between the Danville Fire Department and [2:01:36] the Stanford Fire Department. Okay. Um, [2:01:39] is there a motion to approve this [2:01:40] resolution? [2:01:42] >> I'll move to approve. [2:01:44] Is there a second? [2:01:45] >> Second. [2:01:46] >> Thank you all. All right, Chief, give [2:01:47] them a brief explanation of this. What [2:01:49] do you mean? [2:01:50] >> Thank you, mayor, commissioners. Uh, [2:01:51] yes, very similar to the last agreement [2:01:53] that you uh approved between B County [2:01:56] and and Naval. Um, we we're just trying [2:01:58] to go through systematically with all [2:02:00] our neighboring departments and get an [2:02:02] updated agreement before them so that we [2:02:05] can agree on them and get on the same [2:02:06] page. Stanford is a little bit different [2:02:08] of a um of an agreement because they [2:02:11] also offer ladder operations and they [2:02:14] can support us in latter operations as [2:02:16] well as we can do for them. So this is [2:02:18] just another general guideline and [2:02:21] reciprocal reciprocal agreement um [2:02:23] between Stanford and Damble and I [2:02:25] appreciate you considering it for [2:02:27] adoption of this agreement. [2:02:29] >> It really sounded good to me. Okay. All [2:02:32] those in favor? [2:02:34] >> Those opposed? Motion carries. Thanks [2:02:36] staff for a lot of good work tonight. [2:02:38] >> Yeah, [2:02:39] >> there is a motion to adjourn. [2:02:42] >> There is do need an executive session [2:02:44] for the [2:02:46] for personnel. [2:02:47] >> All right, chairman entertain a motion [2:02:50] to go into a very brief executive [2:02:52] session dealing with personnel. [2:02:55] >> I'll make a motion to go into executive [2:02:57] session to discuss personnel pursuant to [2:02:59] KRS618101. [2:03:02] >> Can you say very brief? [2:03:04] >> Is there a second? [2:03:06] Thank you, ma'am. Thank you. [2:03:07] >> I want to say thanks, Josh, for I mean, [2:03:09] we learned about the grant at the KC [2:03:11] training last week and I texted and it's [2:03:14] like, oh, I'm already doing that. So, [2:03:15] thank you. [2:03:16] >> Yeah, [2:03:17] >> he's always [2:03:18] >> Yeah, seems always, oh, it's fine. Josh [2:03:20] knows about this. [2:03:21] >> Hey, John. [2:03:22] >> Okay. Did I motion? All in favor of [2:03:24] going to executive session say I. [2:03:27] Those opposed. All right. Motion [2:03:29] carries. [2:41:24] So moved. [2:41:26] >> Second. [2:41:27] >> All right. All those in favor coming up [2:41:28] say I. [2:41:29] >> I. [2:41:30] >> All right. Um, Mr. City Manager, you [2:41:33] have a couple of things for us. [2:41:34] >> Yes, sir. Um staff is recommending the [2:41:37] hiring of Dakota Williams to the [2:41:39] position of program coordinator within [2:41:41] parks and recck department. [2:41:43] >> Thank you sir. Is there a motion? [2:41:45] >> So moved. Second. [2:41:47] >> Thank you all. All those in favor say I. [2:41:49] >> I. [2:41:50] >> Those opposed. Congratulations. [2:41:54] >> Staff is recommending the [2:41:55] reclassification of Jacob Jacob Borman [2:41:58] to the position of police sergeant. [2:42:02] >> Thank you, sir. Thank you, sir. [2:42:05] Thank you, ma'am. All those in favor? [2:42:08] >> I. [2:42:09] >> Those opposed? Thank you. [2:42:10] >> Uh, Commissioner Pete, you have a [2:42:14] >> motion you'd like to make? [2:42:15] >> I'd like to make a motion that the city [2:42:18] of Dame will appoint Glen Don to the [2:42:21] position of interim police chief [2:42:23] effective October 1st. [2:42:25] >> Second. [2:42:26] >> Thank you all. Any comments or [2:42:29] questions? [2:42:32] >> Who is he? [2:42:33] >> [laughter] [2:42:35] >> All those in favor say I. [2:42:37] >> I. [2:42:38] >> Those opposed. [2:42:40] >> Motion carries. Congratulations. [2:42:45] » Okay. Now we need to have a discussion [2:42:46] about the U [2:42:50] ad hoc planning and zoning committee. As [2:42:53] the mayor, I've been deemed a member of [2:42:56] that committee and there's a vacancy on [2:42:58] that committee for a city commissioner. [2:43:01] So, the chair will entertain motions [2:43:03] from the floor to who's going to [2:43:05] represent us on the uh planning zone and [2:43:08] ad hoc committee. [2:43:10] It we would be my suggestion that um [2:43:14] Commissioner Holland be on the committee [2:43:16] due to her experience in that particular [2:43:18] area. [2:43:21] >> Second [2:43:23] proply moved and second. Any other [2:43:24] nominations from the floor? [2:43:27] >> Hearing none. So, uh although Oh, are [2:43:30] you willing to serve? Oh, Barry. Yes, [2:43:33] I'd be glad to. [2:43:35] >> All those in favor of a [2:43:38] the motion to have Mrs. Commissioner [2:43:40] Holland represent the city on the [2:43:43] planning and zoning ad hoc review [2:43:45] committee. Say I. Uh Jason [2:44:18] >> Jason, you have the you have the [2:44:19] authority to edit out what you want to [2:44:21] about my comments, sir.
