[37:01] And basically that's it, you know, we just don't know who these people are, they're going [37:08] to be running the place and you're developing it. [38:09] Our houses are not large, and they're proposed three-story, 122-unit complex at numbers [38:16] to 50 or so houses that make up the entire school of Indian neighborhood. [38:22] I have seen many changes to the lane in the last 62 years. [38:26] Many houses were built on vacant lots, but they all remained in character of the neighborhood. [38:33] In contradiction to traffic studies, this will certainly increase the number of vehicles [38:37] to passing by my house as I live with an 300 feet of the property line. [38:43] The noise of instruction over a period of two plus years will profoundly have an impact [38:48] on my daily life. [38:50] I would like to ask each and every one of you, if you lived in my house or on the houses [38:57] directly bordering these massive buildings, would you be happy and comfortable with this [39:04] zoning change? [39:05] I am asking you, please, not go through what does it only change, as it will directly and [39:11] greatly impact the quality of life for all the residents on this quiet dead end street. If you change the zoning in this [40:05] massive senior housing project is built, numbering more than twice the units of [40:09] our homes, the character of this neighborhood will be changed forever. Most of us [40:14] have lived on the lane a very long time and some of us grew up here. We already [40:19] reside here. And it is for that very reason of the peace and serenity that we do. Is it fair [40:24] to take this away from long-term residents and taxpayers? We're often asked in situations [40:30] if the benefit outweighs the drawbacks. No one in sororities is guaranteed to benefit from this. [40:36] Taxes will not reflect the full value of the development and a lottery system does not limit [40:41] the residents to the locals. This project is solely for the benefit of the Dominican sisters [40:47] leaders of Swarp Hill and the developers, not resolute and certainly not resolute [40:52] lanes. [40:53] As elected representatives of the people of the town of Swarp, you will learn a responsible [40:59] for making the decision that our family and their lives. [41:03] We put our trust in. I'm afraid that with this large increase in traffic, [43:14] so our narrow dead-end street, that this may be taken away from them. [46:40] Even on this quiet day, two of three of the fire trucks could not get down [46:44] to a manner of this side lane. One truck went down and the other stayed at the entrance directly outside of the villas that we're speaking about. [46:56] This will be exactly like we'll be dealing with the fire at the villas, a small group of local firefighters swiving there quickly with an outer ladder truck to reach a third story. [47:06] Can you imagine a serious fire in the first story and trying to evacuate [47:10] an elderly population, a 15-minute delay in getting ladders to the scene? [47:15] This means a loss of lives. [47:18] That could be numerous. [47:21] With a guarantee, there's going to be a massive increase of senior residents walking [47:26] driving along with public trucks, parking, GPS service, vans, delivery vans from [47:33] the masterhouse has a van's going. Now we're going to have 150 plus rents walking along [47:39] spawning lane. Why? Because falling waters is too dangerous to walk on on those trebles. [47:45] So they'll be walking just as the sisters did. I believe spawning lane because it's safer [47:50] than they are elderly. So you have elderly drivers, you have elderly walkers, you have already the children, [47:56] The dogs, you know, the local people every single day walking quietly on this lane. [48:03] No sidewalks. [48:04] If you increase the width of this road, statistically, you're going to increase more desk. [48:09] People drive faster once in a while. [48:11] So there's no widening it and making it better. [48:13] There's no sidewalks either. [48:15] So you have a recipe for disaster. [48:17] That's just a lot of them. [48:23] This also does not include the opening of the right-of-way that runs right through this complicated [48:28] entrance. [50:34] Now, the sudden trees don't matter to them, because the word of the day is senior housing and affordable housing, which is fine. [50:44] But I think you have to keep things in respect. [50:48] I know the word they're getting their number of units. [50:52] 122 doesn't drive the billable acreage on the product. I was talking to someone earlier and she mentioned something that came [1:03:24] up at the meeting in September, that, you know, she had a loan in her house and would love to have [1:03:31] senior citizen apartments to go to and let her house be born by a family who could fill it up [1:03:38] again as her family was at one point and now she's by herself. So I think when we look at moving [1:03:44] forward, where are senior citizens going to go? It's a beautiful piece of land and we're willing [1:03:52] to build it and manage it in the same way we've done previously with other housing. Thank you. So for us, this is not about profit. [1:16:40] First, I would like to preface our remarks by saying that we seen the cuts and has had a lot of dealings with the Dominican sisters over several years. [1:16:50] and we find them to be of the highest integrity, and we would have no question about their [1:16:57] motives for trying to develop this property. They're good stewards of the land there, [1:17:03] and the scene that cuts and appreciates all the interactions we've had over the years. [1:17:08] We submitted comments back in December 6, 2022, and we appreciate that the applicant has taken [1:17:15] in several steps intended to address those concerns. [1:17:19] They've moved the southernmost buildings, [1:17:21] three and four about 30 feet to the north [1:17:24] so that they're a little bit farther away [1:17:25] from the falling waters preserve, which we own. [1:17:29] Also, they moved the dumpsters 20 feet from the property line [1:17:32] and provided some screening with an eight foot fence [1:17:34] and plantings. [1:17:35] They're committing to dark sky lighting or equivalent [1:17:38] to keep the site looking as dark as possible [1:17:43] when viewed from offsite in the evening and they've agreed to produce a sign with the hours [1:17:48] of our preserve and park rules and post it where their trail enters our preserve so that the [1:17:55] residents of this site will understand how to responsibly use the preserve. We want to also [1:18:02] go to paraphrase what I've submitted formally in writing. We're very much interested in protection [1:18:08] of scenic resources, particularly views from into scenic areas of statewide significance [1:18:16] and national historic landmarks, and this project is within the Ulster North scenic area [1:18:21] of statewide significance on the slopes of the Hudson River, and it's predominantly visible [1:18:27] from the Hudson River National Historic landmark across the river. [1:18:31] We only received the visual simulations yesterday. [1:18:35] In fact, we have not been notified of this public hearing, nor the public hearing on September 6th, and I'll get to that a little bit later. [1:18:46] So we just received the simulations, our initial review finds we were surprised that the buildings, the northern most buildings were so visible from Tivoli landing, which is a public park within the National Historic Landmark District. [1:19:01] We were always under the impression that these buildings would be screened by existing trees. [1:19:06] And the simulations also show that the proposed buildings are substantially larger than the existing structure [1:19:13] that's proposed for demolition. [1:19:16] Given the potential for adverse visual impact on the National Historic Landmark, [1:19:21] and the projects need for US Army Corps of Engineers permit, [1:19:24] a review will be required under the provisions of Section 106 of the National Historic Preservation Act [1:19:30] of 1966. During this review with the National Park Service Determines that the visual impact [1:19:37] would be constitute a direct effect on the National Historic Landmark, then Section 110F [1:19:44] would need to be complied with, and that requires a more stringent look at how the impact [1:19:52] would be avoided or mitigated, and those details will be in our letter. In the statement that [1:19:59] we've already emailed to the supervisor. [1:20:01] We also recommend that if it is not already done so, [1:20:04] the village, the town and or applicants should [1:20:08] apprise the village of Tivoli across the river [1:20:11] so that they're aware of this rezoning petition [1:20:13] and so that they can participate in the review. [1:20:16] As I mentioned previously, we did not receive public notice [1:20:19] of this public hearing. [1:20:20] As a result, our staff hasn't had an opportunity [1:20:22] to really give this the application a thorough review. [1:20:26] given that we respectfully ask that with the upcoming holidays, the town board [1:20:31] keep this public hearing open another 60 days so that we can give this review [1:20:36] that it deserves. Just to conclude, we're well aware of Ulster County's pressing [1:20:43] need for affordable housing. In fact, senior housing, I see the cuts and deems this [1:20:47] critical need in the Hudson Valley and Ulster County. We applaud the [1:20:52] sisters for working to address that need. [1:20:55] That said, the project site is constrained by several things, federal wetlands, a floodplain [1:21:00] steep slopes. [1:21:02] These all limit the suitable areas for building, the sites between the end of a cul-de-sac with [1:21:06] an established neighbor of single-family homes and falling waters preserved. [1:21:11] And finally, to reiterate, being that the site is in the Ulster North, scenic area of statewide [1:21:15] significance and directly opposite the Hudson River National Historic Landmark district, [1:21:20] these reviews are required. And I have to say for 21 years, after leaving here, I went and [1:22:31] managed a housing project of the Dominican Sisters called Bell and Gardens. [1:22:37] Bell and Gardens is for enriched living for seniors. It's affordable housing. [1:22:43] 44% of the housing at the apartments in downtown are below market for Rockland County. [1:22:52] And it's a love and place, but the thing I want to tell you about is the gratitude you've [1:22:58] given on the mansion, how grateful families are, and the young mothers, mostly mothers, [1:23:04] have a place to be. [1:23:06] And then the mothers are so grateful, too, because they have one another, it's one to be [1:23:12] home. [1:23:13] I can remember Angel Love, I can remember her saying to people, you don't want to be living [1:23:20] be with your daughter. You don't want to be having those kids around this way. You can be yourself [1:23:26] and you can live the life you want. I just want to let you know that it really is a wonderful [1:23:31] opportunity to now see your house make a new name. [1:24:41] In fact, the 122 number of proposed residents [1:24:45] is not that much higher than the number of vacationers [1:24:48] or retreatants from way back in the olden days before I started to come. [1:24:53] There was great numbers of sisters that would come up ahead. [1:24:55] At the last meeting, I spoke about the importance of senior housing based on my own mother's experience at Dallard Gardens in Swarmville and have this proposed a project in very much line with our mission and legacy. [1:25:10] Dallard is situated right next to our property at Dominican County. [1:25:16] We are the neighbors in this case, as well as Thor Village, which has been in our position. [1:25:24] We are the neighbors on one side and there are neighbors like you because it's on the other side and for 40 years we have lived in a mutually beneficial peaceful coexistence. [1:25:40] We get along fine. There are no incidents complaints or negative feedback and sometimes someone's family is able to move in. [1:25:49] It's still all just worked. [1:25:51] The residents and their families have helped the local economy. [1:25:57] So it's a win-win. [1:25:58] Thank you very much for your consideration. [1:26:01] Thank you. And those residents at times have had to sit down in that [1:27:17] hospital for about 11 hours before anybody can pick them up to bring them back home again. [1:27:22] We're only talking eight residents, the emergencies, and I'm not talking fire trucks or police [1:27:29] they go down there as well. [1:27:31] This is just yes. [1:27:33] So if you add another now 300 people, or however many are going to occupy these 1202 apartments [1:27:39] to see your people, we're really tapping our sources of emergency care. [1:27:46] We don't have people entering the field for fire trucks and development fire departments [1:27:51] emergency services. This is critical. This is a really bad scene and we've seen cars [1:27:59] from flying out of there at such speed at times and they're vans for emergency reasons [1:28:05] or whatever. There's traffic coming up from the Dominicans there where there is nothing [1:28:10] at this point. We're going to have major head-on collisions, not only on our corner, on [1:28:16] right there at the gate, but out on my W as well, trying to get out of this traffic to go [1:28:22] Kingston away. The turning is impossible on that road on a weekend. You have holidays, [1:28:28] you have summers, you can't get out of that street. Now you've got senior housing and then [1:28:33] all the trucks and facilities that are going to come into this for all of us, for abuse to [1:28:39] describing on this road. So making this lumpy on turns is going to be fatal. If little children [1:28:44] that live right on that corner that are playing out in that throat all time. [1:28:49] There's going to be fatalities and blood on people's hands because these people fly up [1:28:54] and down these roads, they don't consider traffic speeds, even coming out of the dragway [1:29:00] from the Lashar House.
