Uh we [1:20] have a public hearing a petition by Sharon M. Morgan Rogers uh for approval [1:25] of a variance uh to article 7.06.3 of the unified development ordinance to [1:31] allow an 8ft high privacy fence to be constructed in a portion of the side and [1:36] rear yard of the property located at 3140 North First Street. We have a staff [1:41] report. >> Oh, [1:46] good evening. >> Okay. Uh my name is Sharon Warden [1:50] Rogers. I'm the property owner at 3140 North First Street, Jacquel. And as you [1:55] know, I am here tonight requesting a twoft height variance on privacy fence [2:00] for a total of 8 ft in height to lessen the impact of flood lights from [2:05] neighboring property. The 8 ft will help with about 2/3 of the light shining in [2:11] my double hung windows on the south side of my house. And the light will also [2:16] allow me to enjoy the property outside both in in the front and the backyard at [2:20] nighttime with less light pollution and illuminating the yard from the [2:24] neighboring flood lights. In the front yard, the flood the variance will also [2:28] help make it safer when I back out of the garage at nighttime without lighting [2:32] um shining into the garage and my eyes as I back out of the garage. The [2:36] location of the fence will have minimal um visibility to passing motorists by on [2:43] First Street and to neighbors across First Street. As the street runs north [2:47] and south and the fence will run east and west, it'll graduate down to an [2:52] allowable 3 ft from the front of the house to the street. I plan to plant [2:57] ornamental grasses and several arborites to lessen any visual impact when [3:02] traveling south on First Street. The speed limit along this part of First [3:07] Street is 45 miles per hour. Those traveling north on First Street will not [3:12] see the fence due to the heavy vegetation on the neighboring property [3:16] to the south. I appreciate you hearing my petition. Just uh briefly [3:25] uh as the addition mentioned um requesting variance on fence height uh [3:32] the max height and for privacy fence residential district 360. [3:37] Um Sharon mentioned the request is to 8ft [3:41] high white vinyl fence along the uh south property line see it here in red [3:47] privacy fence starting in the back going towards the front just to the front of [3:52] the corner of the house which is u that's where in front of the house [3:56] it's got to taper down uh to meet the requirements which they're doing under [4:01] 3t high privacy fence. So, we transitioned there. A couple panels [4:04] transition down instead of an abrupt kind of uh step down there. Look a [4:09] little better. Uh so, as uh mentioned, there's the site on North First Street [4:17] on a large lot. A lot of large lots on that side of First Street. As you can [4:22] see, little closer view. This shows the in [4:26] red line here through the middle of the screen where the closed fence would go [4:29] along the property line. [4:34] It'll be a white vinyl fence in that style. Uh be white vinyl 8 foot high. [4:39] Applicant notes. Uh Reese's name is to help screen additional 2 ft to help [4:45] screen the light intensity for the neighboring property and she provided [4:49] some photos of that light on her property in her home. [4:53] Packets up on the screen here. I captured a few. [4:59] That's inside the house. Also uh as noted the uh the fence will [5:05] not hardly be seen. This is a site there. The fence run along this area [5:11] here. This is looking south on North First Street. Heavy vegetation here. [5:15] Evergreen year on screening. This is a view looking north. This is a [5:20] driveway into the subject site. So as you drive north, you're not able to see [5:24] the fence at all. Heavy vegetation there on the adjoining lot and the fence. of [5:30] course will taper down to 3 ft so it will not be a visibility issue for any [5:34] motors leaving that driveway. [5:44] So what the variance uh the findings we focused on uh additional 2 ft needed to [5:50] help screen the additional illumination from adjacent property to the south. Uh [5:56] fence will run on a soft lot line down and then taper down to 3 ft high privacy [6:01] fence which is allowed to go. Uh as you can see these lots are quite large [6:07] uh 1.4 acres for this one. [6:13] Um large lot to the north [6:19] includes a church [6:23] 8.3 acres uh property south 3100 uh similar in size about 1.4 4 acres and [6:30] the bridging river mist the detention area in that subdivision forest reserve [6:35] to the uh southeast of the site [6:45] and again the visibility of that fence uh would be pretty small uh for traffic [6:50] going north street. So um we believe in all the findings of fact will not be [6:56] detrimental to the surrounding area. Uh there's a hardship regarding this trying [7:01] to screen the light intensity and the fence will not be visible from North [7:06] First Street. We did receive one public response form over the weekend from [7:10] Nicholas and Allison Paxton 3080 North First Street. Uh that's the [7:17] second home to the south. note any support for the variance request down [7:24] here and that's handed out to you tonight. So we recommend approval.
