[9:54] And my neighbors and I are here tonight [9:57] because departments that this council oversee [10:00] and have direction, the town administrator [10:02] and the court enforcement are not doing their jobs [10:06] and it has and will cost the town money. [10:10] Now in April of 2025, Byrd Enterprise LLC, the owners [10:15] of 180 7 Hampstead Road, the old Holy Cross Catholic Church [10:21] applied for a permit to erect an oversized commercial sign [10:24] with an electronic me board and a residential area. [10:28] Therefore they need to get a variance for it. [10:31] They applied for the variance and after two hearings [10:34] before the ZBA in June of 2025 [10:38] and a decision that only five people have ever thought was [10:41] proper, the applicant, the three members that voted for it [10:45] and bought Robert Mackey the then code enforcement office, [10:49] the variance was granted. [10:52] The reason I mentioned Mr. [10:53] Mackey and what we do find disturbing is that Mr. [10:57] Mackey on town time [10:59] and on town email was working closely with Bird Enterprises [11:03] to get the variance. [11:05] The applicant actually thanked Mr. [11:07] Mackey for shepherding us. Through this process, Mr. [11:11] Mackey insisted on staying on at the code enforcement office [11:14] and that the variance was actually granted. [11:16] We've had concerns which we've expressed [11:18] before about the undue influence on the ZBA by Mr. [11:22] Mackey. After the variance was granted, the Abutters [11:26] and the neighbors moved for reconsideration. [11:29] And after the denial appeal to the Superior Court, [11:33] despite knowledge of the appeal, [11:36] Byrd Enterprise went ahead with erecting the sign. [11:38] The Bork began and was almost completed [11:41] before any permits were granted. [11:44] After numerous complaints, the code enforcement office, [11:47] the town attorney, whom at this time we're not exactly sure [11:50] represents, told the code enforcement [11:53] office to issue the permit. [11:55] Even the sign that was erected was significantly different [11:58] than the one that was applied for in April of 2025. [12:04] A hearing was held early in November, 2025 [12:07] before the Hillsborough Superior Court, [12:09] which Burt Enterprising had not inter having not intervened, [12:12] did not attend again, [12:14] relying on the town's attorney to present his case. [12:18] And a ruling handed down on the 31st of December, [12:21] the court overturned the ZBA a's decision [12:23] and vacated the variance. [12:25] No motion we would consider was made by the town [12:27] and no appeals made to the Superior Court. [12:31] On 30th January, I met [12:32] with the current code enforcement office. [12:34] Carrie Owens about the sign was told that the, was told [12:38] that the town on [12:39] or about the 13th of January of 2026 [12:42] had sent Bird Enterprise a certified letter [12:44] that the silences violation that had 30 days to remove it. [12:49] That time I expressed my understanding [12:51] that this was a difficult situation [12:53] and that all we asked was [12:54] that the town show due diligence in getting the signing [12:56] moved and keeping this informed of progress. [13:35] Yesterday when one of my neighbors was finally able to speak [13:38] to Ms. Owens, she finally agreed [13:40] to send another letter giving Bird Enterprise another 20 [13:43] days to remove the sign. [13:46] Today we find out that Bird Enterprise has again applied [13:49] for variance to have an oversized back lit commercial sign [13:52] in residential area and the town, based on the advice [13:56] of the town's attorney is refusing [13:58] to place any sanctions on Byrd's Enterprise [14:01] until another ZBA hearing is held more than anyone. [14:05] The town attorney having lost that appeal should know [14:09] that no variance can be granted. [14:12] And if one would and one was, it would not stand in appeal. [14:16] The only that was filed is Bird [14:18] Enterprises is waiting to hear us out. [14:20] The sign is still there. [14:22] In fact, today, bird Enterprises was landscaping [14:26] around the sign, the backlight sign shine to her house. [14:30] Despite the promise they'd be off [14:31] by 9:00 PM They're on from dawn to dusk [14:34] saying here these are agencies, [14:36] these are departments you oversee. [14:38] Enough is enough today, the Abutters [14:41] and the Neighbors mail Bird Enterprise, a private ceased [14:44] and desist order requiring the lights be turned off [14:47] upon receipt of the letter and the sign be removed within [14:49] 10 days of the receipt. [14:51] If these demands are not met, we are fully prepared [14:54] to take further action against both Bird Enterprises [14:57] and the town of Dairy for the interference [14:59] with our preschool enjoyment of our properties. And whereas Kaylee Styles is a 10th grade [20:17] student at Pinkerton Academy, [20:18] where she is on the student council, a member [20:20] of the authors club, suicide prevention group, stage crew [20:24] and clarinet choir. [20:25] And where she grew up in Belgium and England [20:27] before moving to New Hampshire about six years ago [20:30] and began in Girl Scouts as part [20:31] of the USA overseas on a military base [20:34] and is now a member of Girl Scout Troop 1 2 1 3 0 earning [20:37] her gold award at a younger age than usual. [20:40] And whereas having a soft spot for animals, [20:42] Kaylee created a pet donation box [20:44] to help the greater Dairy Humane Society. [20:46] She has placed it outside a high traffic pet store [20:48] and has involved Pinkerton Academy Student Council [20:51] to help with the upkeep. [20:52] And whereas Kaylee has also created a website [20:54] for her project Paw Print explaining her efforts in helping [20:57] animals, promoting the need for donations [21:00] and why adoption is so important. I have a couple of items tonight. [47:02] I think the first item that I'd like to tackle this evening [47:06] is the confirmation of our fire chief. [47:09] So for everybody that's in the audience today, the town [47:14] has had an interim fire chief for several months [47:17] based on the retirement of the last chief. [47:20] We've gone through a, an exhaustive process to try to find [47:25] our next fire chief. [47:26] I want to thank a number of people going through the process [47:29] where we started with a public advertisement [47:32] through New Hampshire Municipal, mass Municipal. [47:35] And that was all spearheaded by Catherine St. [47:38] Ledger of the Human Resources Department. [47:40] Did a great job at bringing in as many candidates [47:43] as we could get, prepped some materials [47:46] and then handed it over to a committee comprised [47:51] of four members, one standing chief, a member [47:54] of our current IAFF, a member of the public [47:58] and one of our town councilors, Jack Webb. [48:00] And they did an exhaustive search [48:03] and got some great responses from all [48:06] of the candidates conducted interviews [48:08] and then brought that to me for final disposition. [48:14] With that, we were looking for somebody [48:17] of the highest integrity, who had a great level of expertise [48:21] and who could lead the Dairy Fire Department [48:24] into its future. [48:26] And I am pleased to announce that we have found that person. [48:30] And that person is Greg Laro, [48:33] who is your interim fire chief. [48:35] And at this tonight I'm asking the town council [48:37] to confirm my recommendation through a resolution to make [48:43] Greg the permanent fire chief, [48:45] effective March 26th, 2026. [48:48] And the resolution is in your packet for our reading. [48:52] But I do want to say I see Greg is here [48:54] with his family tonight. [56:34] We're gonna be bringing in a budget that meets the statutory [56:39] tax cap of 3.3%. [56:42] So right now everything's being put together and compiled. [56:45] Counselors, you should be getting your packet by Monday [56:48] or Tuesday of next week. [56:50] So we'll let everybody know relative to that. [56:52] But that segues into, as a reminder, [56:56] this is maybe more for the public. [56:57] We have a number of sessions coming up. [57:00] April 7th is our first, it's a regular council meeting. [57:03] There'll be an overview of the FY 27 budget. [57:07] April 9th is a work session that starts at 6:00 PM [57:11] and that's gonna be the Fire Police [57:14] and Public Works Department presentations [57:18] on April 16th at 6:00 PM as well. [57:21] We'll be doing our second budget workshop at 6:00 PM That [57:24] will be on all of the other departments, finance libraries, [57:28] all the administrative departments. [57:30] Those will all be conducted on that date. [57:33] On April 21st, we'll have another regular town council [57:36] meeting and if there are any cleanup items for the budget, [57:39] those will be taken care of at that point. [57:42] And then finally, April 23rd, we'll be having a, [57:46] the fiscal 27 budget [57:48] and capital improvement plans public hearing. [57:51] And that will be the final presentation on the budget in [57:54] lining up for a vote on or anticipated vote on May 5th. [57:59] So keep everybody in the loop. [58:07] Last item that I wanted to put out to the council today was [58:12] House Bill 1469, which is dealing with Asian spas [58:17] that passed through the house resoundingly at a vote [58:20] of 3 23 to 28. [58:22] Now that will be brought over to the Senate [58:26] and so that will be anticipating the crossover with that. [58:29] But a lot of good work by a lot [58:32] of people in our legislative group, particularly [58:35] Councilor Foot or Rep Foot, [58:37] but many others have been pulling the ship on this and, [58:40] and that will certainly help out the town of dairy [58:42] in its current and future endeavors relative to [58:46] eradicating the issues [58:47] with the Asian spas that we had gone through. [58:49] So that's all good news on that front. [58:52] And other than that, the last piece of items that I have is [58:56] just a reminder that next Saturday [58:59] there'll be the Millennium Annual Cheap Marathon. [59:03] A little bit different route this year that's on April 4th. [59:06] They used to start and finish in the area of Abbott Court. [59:10] But obviously with the construction going on, [59:13] our staff has reached out [59:14] and they're gonna be doing an alternate route this year. [59:17] They'll be starting in Wyndham working their [59:19] way north through dairy. [59:20] So they'll be still using the rail trail on a couple [59:23] of adjacent roads, [59:24] but there won't be the same start finish location that used [59:27] to end in beginning downtown. [59:29] We do have hopes that in two years time when the Abbot Court [59:32] development is done, that can be brought back [59:35] to downtown dairy because it does bring a lot of traffic [59:37] and business to those areas. Charlie did the yeoman's work on all on all [1:00:56] of this Charlie Town counselor, [1:00:58] Charlie Foot slash State Representative Charlie Foot, [1:01:01] and he's put over eight years [1:01:03] of his life into this bill trying [1:01:05] to get these massage parlors cleaned up here in dairy. [1:01:09] And I take absolutely no credit for this whatsoever. [1:01:12] I just threw my weight around it. [1:01:14] Charlie did it. And we are seeing that. [1:01:15] We are seeing the changes. [1:01:17] I was telling the council when I got here this evening, [1:01:19] I drove by one of the former locations [1:01:23] and I happened to look in the window of that building [1:01:26] and it was very clearly in office [1:01:27] and there was a woman at the, you know, [1:01:29] copy machine or something. [1:01:31] And it just made me so happy to see that I don't have [1:01:33] to drive by there and be embarrassed [1:01:37] or feel, feel uncomfortable [1:01:40] that that was in my neighborhood. And so thank you. [1:01:42] So also Chief Fi [1:01:44] and to Administrative Fowler were very instrumental in this. [1:01:46] They, yes, they, they really did a lot of [1:01:48] behind the scenes work as well, which we, you know, [1:01:51] the Chief's Association [1:01:53] and Mr. Fowler wrote a nice letter to the, the committee [1:01:57] to help get it over the, that next hump [1:02:00] and they're on the commission, the IMB Commission, [1:02:03] illicit Massage Business Commission. [1:02:05] So they're very instrumental in this. [1:02:07] So again, a lot of, a lot of teamwork, a lot of, a lot [1:02:10] of part involved. [1:02:22] But the beautiful part of this bill, if it gets [1:02:24] to the governor's desk and then we need to need to get [1:02:28] through the Senate, is that it takes some successes [1:02:31] that we have in dairy and it pushes it out to the rest [1:02:33] of the state so that we're not just pushing out of dairy [1:02:36] for them to go to one dairy. [1:02:38] Hopefully now the state can now push 'em out of this state [1:02:41] and have them go away forever. [1:02:44] And Bev Donovan is very instrumental in this as well. Yes. [1:03:25] First the town [1:03:27] of police department has been using a records management [1:03:31] and a CAD computer, computer-aided dispatch [1:03:34] software package since 2001. [1:03:37] And if you know anything about technology [1:03:39] and software 2001, that's practically prehistoric [1:03:43] in the terms of, of software development. [1:03:47] So I recognized that we needed to [1:03:52] make some effort into modernize [1:03:54] and update our software system. [1:03:57] Now also say that our current vendor is no longer building [1:04:02] or supporting the software system we are using today. [1:04:06] So there will be no further improvements [1:04:08] or enhancements in that, in that software. [1:04:12] So recognizing that it's very difficult [1:04:16] to take on a project of this magnitude [1:04:18] with a tax cap budget. [1:04:21] I I, I met with the police chief in London Dairy [1:04:25] and the police chief in Windham [1:04:27] and I proposed a joint venture to apply [1:04:31] for congressionally direct spending funds from Senator [1:04:35] Shaheen and Congressman Pappas through their offices. [1:04:39] We put together a plan to do just that. [1:04:43] In March of 2025, we submitted a request [1:04:47] Congressional direct spending request through their offices. [1:04:51] Over the past year it was moved [1:04:54] through the appropriations committee in Congress [1:04:56] and was funded to the amount [1:05:01] of $1,039,000. [1:05:05] Now that's a little less than we had applied for, [1:05:08] I should say submitted a request for I, [1:05:12] we actually sought $1.75 million for the three communities. [1:05:17] And the reason for that is when we first started discussions [1:05:21] in 2024 about this project, it involved [1:05:26] local servers in each one of our communities tied together [1:05:29] with a master server tied together over a [1:05:32] dedicated fiber optic network. [1:05:34] All of those things carry some pretty significant costs. [1:05:38] So we were, matter of fact, [1:05:41] it was the day we opened the fire department, [1:05:42] the new fire station in town, we were notified by the [1:05:45] Congressman Pappas's office that our application was [1:05:47] favorably considered and we were, were funded to the tune [1:05:50] of $1,039,000. [1:05:53] So that brings us to tonight, the [1:05:56] process once funded requires [1:05:59] that a federal agency contact us [1:06:01] and tell us that this is the grant [1:06:03] application you need to file. [1:06:05] That's through the cop's office, the Department of Justice. [1:06:09] It's not a competitive grant. [1:06:10] The money's already there waiting for us to apply. [1:06:13] So I seek your approval tonight to apply for those funds [1:06:17] to allow us to move forward with acquiring new software CAD [1:06:21] and RMS for the towns of Derry, London Dairy [1:06:24] and Windham on a joint project that we've developed. [1:09:31] And typically that trends with what the tax cap approval, [1:09:35] which in this case we know the number at 3.3%. [1:09:39] So what I'm recommending today is that the increase [1:09:42] of the town clerk salary would be [1:09:44] to $68,233. [1:09:48] And that would be effective July 1st, 2026. [1:16:56] And what we're doing is developing a community [1:16:59] wildfire protection plan. [1:17:01] And what this will do with, among other things provide help, [1:17:06] provide safety to the community, it'll also provide access [1:17:11] to some grant funds that'll help mitigate [1:17:13] and improve our forest lands to make 'em more fire safe. [1:17:19] In short, the environment is changing. [1:17:22] Our woods are being threatened by different [1:17:25] invasive species, both insects [1:17:27] and flora that are changing how [1:17:33] our brush fire risk is developing dairy is actually [1:17:38] considered by the state of New Hampshire [1:17:39] to be at the highest risk for a se more serious, [1:17:42] not a California style [1:17:44] brush fire, let me get away from that. [1:17:46] But a more serious fire that could threaten property. [1:17:50] So we want to educate, develop this plan [1:17:52] and educate people on how to [1:17:56] mitigate the risks around their home. [1:20:17] We go through the budget, every department [1:20:19] is gonna present on the budget. [1:20:21] You'll hear why there's a expense here, why there isn't, [1:20:24] there's a public hearing for you to comment, express [1:20:28] how you feel about that budget as well for us to hear that [1:20:31] we, we welcome people to be more involved in that process. [1:20:34] So again, we have on April 7th, [1:20:38] we will have the budget presentation for FY 27 [1:20:40] during our council meeting, April 9th [1:20:43] and April 16th, [1:20:44] both at 6:00 PM There will be budget workshops. [1:20:47] April 21st is a regular council meeting, [1:20:49] but if there's anything we need [1:20:51] to address on the council on the budget, we will.
