[0:05] I'd like to call the Dairy Conservation Commission meeting [0:07] to order everybody silence their cell phones, please. [0:13] And we'll stop the meeting with Pledge of Allegiance [0:21] To the Flag Flag of the United States of America [0:24] to your college, which, which stands, one Nation under God, [0:29] indivisible, with liberty and justice for all. [0:39] Hi. Thanks for coming tonight. [0:41] Emergency exits in, in this room are located at the back [0:45] and to my right, if there's an emergency in the building, [0:48] please don't use the elevator. [0:50] Use the stairs. If you need assistance, ask one [0:53] of the commissioners for help. [0:56] We'll stop the evening off [0:58] with introduction of commissioners. [1:02] And I'll council liaison all the way to my right [1:05] Shall I put town Council liaison. [1:07] Good evening. Christopher Warlock. [1:10] Cheryl Holbert. Jay Hildreth. [1:12] Rick Metz. Bob Sperl. [1:16] I lead to both Catherine Arbor. [1:20] Elizabeth Carver. [1:22] And I'm the chair. Rico Za. [1:27] Mr. Chair, apologies. Can we ensure everyone's microphone [1:29] is on [1:36] So your green light on at the bottom, [1:37] everybody's green light on. Yes. Mine [1:40] Is now. It was not [1:41] Before. [1:42] Okay, good. You you got, [1:43] you got everything though, right Owen? [1:45] Yep. Thank you. Alright, thank you. Alright. Chair's report. [1:48] First order of business. Sad but happy. [1:51] Val Conley is moving to where she bought a, her [1:55] and her fiance bought a house in Ware. [1:58] And one of the requirements to, [1:59] to sit on this commission [2:01] is you have to be a resident of town. [2:02] So she, she was gonna try to come to tonight [2:04] and say goodbye, but I, I get that she's busy, [2:07] so we, we wish her well. [2:11] And she says she might see us in the future [2:14] 'cause she may get involved in conservation in her, [2:17] in her new community. So I [2:18] Hope she does. She was [2:20] Excellent. [2:21] Yeah. Val, if you'll, if you are watching, [2:22] we'll miss you terribly and good luck in your, in your new, [2:25] in your new home [2:30] and correspondence. [2:31] We have A letter from [2:36] Jacob and Sarah White regarding a property [2:39] that was recently purchased at [2:43] one feathered Featherbed Lane, 59 dash 69. [2:48] It's basically just a, a description of what [2:52] she's seen on that property over the, the years [2:55] that she's lived there regarding wildlife and, and animals [3:00] and, and stuff like that. [3:01] And she wants us, she's urging us to, [3:05] to just do our due diligence, [3:06] which we don't need to be urged to do that. [3:08] We do our due diligence whether we're urged to or not. [3:11] But I've instructed our land manager, Beth, to [3:16] just reply to that letter and, [3:18] and tell them that we're, we're gonna do everything we can [3:22] to within our purview to make sure that it, [3:24] it helps the community from conservation perspective. [3:27] We have reported alleged violation. [3:29] I'll send that to my left first. You guys can look it over. [3:32] We have a reported alleged violation [3:35] for a property at 54 Beaver Lake Avenue. [3:37] Derry Tax map number 51 lot number 75, [3:41] that's gonna go to my left. [3:43] A reported alleged violation [3:45] for a property at 19 Whitney's Grove Tax map number 15, [3:49] lot number 16 dash four. [3:50] That'll go to my left. And the second [3:55] notice for the same property. [3:56] Those are all going to my left. [3:58] You guys come look at 'em and then send 'em back this way. [4:01] So the people on the other side of the room can [4:04] we have a report? [4:06] Waste Management Division. [4:08] It's a renewal for the groundwater release detention permit [4:11] for b and H Oil at 36 South Main Street. [4:14] Derry received on July 13th. [4:16] They're required to do this as they renew their permits. [4:20] That'll go to my right. We'll go [4:23] the opposite way with that one. [4:29] That's all I have for correspondence. [4:30] We're gonna jump right into site plan review. [4:34] We have the site address, 38 Jackman Road, Jackman Road, [4:38] right of way tax map seven lot 77. [4:42] The owner is Joe Masano from three Ball Avenue Salem. [4:47] Surveyor is Laval and engineer is engineering alliance. [4:52] The presenters are Eric. Is Eric here? Yes. That's okay. [4:56] Eric and Joe. That's, yes. Okay, great. [4:59] So they have some plans for us. We're gonna look this over. [5:01] If you guys could distribute that, that'd be great. Is this [5:03] On or do I have to press a button to turn it on? [5:05] I don't see here. Where's, [5:08] Okay. [5:09] While you're, you know what, while you're doing that, [5:10] we're gonna, I skipped over approval of minutes, [5:12] so we're gonna, we're gonna take a peek at those, but, [5:14] but go ahead and hand those. [5:15] Owen gets, Owen gets that in the back. [5:18] He's got a, he's got a a f up. Everyone look at the minutes. [5:22] Any, is there a motion to approve the minutes? [5:27] So moved. Is there a second? [5:29] Second. Yep. [5:31] Second. Got, we were first by Mr. Met, second by Cheryl. [5:34] All those in favor say aye. [5:36] Aye. Aye. Opposed? [5:40] I that your unanim So I have to sit someone [5:41] I have to, I have to sit someone, right? [5:43] Yeah. [5:45] Oh, thanks. So we have to sit. Good [5:49] Catch. [5:50] Yeah, there we go. [5:56] Thank you. Copy. Oh, thank you. [6:01] Thank you. Thank you. That's right. [6:06] Linda, will you sit for Val tonight? [6:08] Yes, I'll be happy. Okay. Yeah, [6:14] So everyone caught that. [6:15] Linda's gonna sit for Val for the rest [6:17] of the meeting. Okay. [6:22] I think. Okay. This thing's on. Perfect. [6:24] Yeah. Okay guys, state your name for the record [6:26] and run us through this plan. [6:28] You got it. Eric, Brad Nii Engineering Alliance, [6:31] the professional engineer for the project. [6:33] Joseph Masano, owner. [6:35] Perfect. So as you guys mentioned, [6:38] the property's located at 38 Jackman Road tax map seven lot [6:41] 77, the size of the lot's, a little over six acres, [6:45] 6.3 acres. [6:47] So just to give you guys a little idea of [6:48] what has gone on with this project so far. [6:50] So Joe here, the owner had received a variance [6:53] for the property to build a single family [6:55] dwelling on this property. [6:57] As part of that process, we were brought on [6:59] as Jackman Road is a Class six road. [7:01] So it's owned and maintained by the property owners [7:05] that are along Jackman Road. [7:06] And we were brought into bring Jackman Road up to [7:12] the requirements for the, a classics road for the town. [7:17] So we prepared these plans, brought them [7:19] and submitted them to the technical review committee. [7:21] Had a review from the technical review committee [7:23] and then it was brought to our attention [7:25] that the wetland on site at the top of the plan, [7:27] you can see there as a prime wetland. [7:30] And so there was some plan changes that were made. [7:33] We went back for a second technical review committee meeting [7:36] and we added a bunch of information [7:38] that you'll see on the following plans after the cover here. [7:42] And, and really what the, the gist of this project is, is [7:45] that there is, at the top, [7:47] you can see there's a prime wetland [7:48] and then there's a secondary wetland down [7:50] to like the bottom left side of the plan there as well. [7:52] That runs through the middle of the property. [7:54] If we could move to the next sheet. [7:59] Oh, okay. I didn't realize I could do that. My apologies. [8:03] So, just to give you guys an idea, [8:04] these are existing conditions [8:06] as to what's going on out there. [8:07] So if you look true north is, you know, [8:09] straight up and down on this plan here. [8:10] Jackman Road is to the right, [8:11] this is the subject property prime wetland at the top [8:15] and secondary wetland here on the side. [8:18] These plans are oriented a little bit differently just [8:21] to show the Jackman Jackman Road comes [8:23] along the side of the plan here. [8:24] But, so here's Jackman Road [8:26] and then this is Joe's property that he owns here. [8:29] So that wetland at the top of the previous sheet is here. [8:32] And then the secondary one, [8:33] well you'll see on the next sheet is, [8:34] is is off the sheet here. [8:36] But, so we have this wetland here, 150 foot setback [8:39] to the primary wetland and then the 70 foot, 75 foot no cut [8:44] buffer zone is here as well. [8:47] Jackman Road is currently, I guess you could say like eight [8:51] or so feet wide gravel road that comes all the way down [8:54] past the Rockingham recreational trail. [8:57] And then moves a little bit further past along the frontage [9:00] of Joe's property. [9:03] This is just a view of the full property, [9:05] again, Jackman Road here. [9:06] Now this is oriented similar [9:07] to the first plant Jackman Road on this side. [9:08] This gives a view of the entire property here [9:11] with our prime wetland and our secondary wetland. [9:14] On the side here, the grading of the site, [9:16] there's a high point here up along the trail [9:18] and then everything sort of pitches down [9:20] to the prime wetland and then out back this way as well to [9:23] that secondary wetland. [9:25] So what's proposed is a single family dwelling [9:30] there also, you guys will see on these plans, [9:32] there is a secondary building proposing these plans. [9:34] That's a future a DU that is not gonna be built right this, [9:38] you know, at this time under the same [9:39] permit as this building. [9:40] But we showed it on here to show the site impacts that [9:44] would come with that A DU further down the road. [9:47] So again, Jackman Road here [9:48] with our improvements to Jackman Road. [9:52] This will be a 20 foot wide gravel road that'll be designed [9:55] to meet the, the town engineered standards [9:57] for a class six road. [9:59] It'll be two feet of gravel so you know, [10:00] water can directly infiltrate in there. [10:02] So it's not gonna create any additional storm water issues [10:05] for Jackman Road coming down here. [10:07] But you'll see we crossed the re, oops, sorry, [10:09] we crossed the recreational trail here. [10:11] And the only spot [10:13] that we can access the property is [10:15] right along this frontage here. [10:16] This is all owned by the state, [10:17] the Rockingham recreational Trail. [10:19] And then this is Jackman Road. [10:21] So the gravel road will come across here. [10:24] The fire department requested we place a hammerhead [10:26] turnaround here to allow for a fire engine [10:29] to pull in back up and pull out. [10:31] That's what this little area is down here. [10:34] Then we have the driveway access up to the, [10:36] to the single family dwelling. [10:37] Again, another turnaround is required based on the zoning [10:41] code for a fire apparatus here. [10:43] So we've got another one there. [10:48] Again, just kind of reorienting here [10:50] so you can see the full extent of the site. [10:52] So the driveway turns in, single family is here. [10:56] As you guys will notice the driveway access, [10:59] the only place we can really provide it, pulling [11:01] as far away from that prime wetland [11:03] as we can is within the 75 [11:05] to 100 foot buffer to the prime wetland. [11:08] You can see this dash line here is that 150 foot mark. [11:11] And so the entirety of the property front [11:14] of John Jackman Road is within 150 feet of that wetland. [11:17] That's why we have a proposed here during the TRC meeting. [11:21] You know, we were informed that we'll have to request a, [11:26] a special permit from the zoning board [11:27] to construct the driveway there within 75 to 150 feet. [11:33] And we will be doing so after this meeting. [11:35] We were, we'll be applying to get on the planning [11:37] and zoning meetings in September. [11:41] So again, driveway access, [11:42] single family dwelling turnaround, here's [11:45] that secondary A DU future proposed A DU that we mentioned, [11:49] again will not be constructed at the [11:51] same time as this dwelling. [11:52] We we'd, you know, file [11:53] for a separate building permit for that. [11:55] But this just to show again, site impacts, you know, [11:58] we show erosion control barrier around the limit of work. [12:02] And again, we're trying to stay as far away from [12:04] that wetland as we can. [12:07] You know, building is set up on the high spot up away from [12:10] the wetland and we're outside, you know, buildings are [12:13] outside the 150 foot buffer here. [12:17] These are just roadway profiles if you guys [12:20] care for the details of that. [12:21] We're trying to maintain a very similar grading scheme as [12:25] to what's out in Jackman Road. [12:27] Now. We really don't want to change much of [12:29] that grade out there. [12:30] Keep it right about where it's at. [12:32] The only spot where it will change is a little bit right [12:34] here where that turnaround I told you is there's like a drop [12:37] off that drops six or seven feet. [12:39] We're gonna pull that up and then [12:40] after the fire engine turnaround, just grade it back down [12:43] to meet the existing grade in Jackman Road. [12:46] This plan is just a driveway profile. [12:49] Again, similar thing, we want to try to keep these grids [12:51] as similar as we can. [12:53] So the, the driveway grade will be almost [12:55] identical to what's out there. [12:57] There's very like a very minimal fill area. [13:00] Basically most of it. [13:01] Where it comes in is where that connection to the turnaround [13:04] for the fire apparatus is. [13:06] And then the last plan in the set is [13:08] just some construction details. [13:09] It gives you a roadway cross section of [13:11] what the 20 foot roadway will look like, a cross section [13:14] of the driveway, what that's gonna look like, [13:16] and then our erosion control detail. [13:20] So again, we're, we're here [13:21] before you guys tonight mainly for the impacts [13:23] that this is gonna have in the area relative to [13:26] that prime wetland because we do have some work as inside [13:31] that 150 foot buffer of that prime wetland. [13:35] So we'd just like to get you guys' feedback on, on, on that [13:38] and what we may need from you in order to proceed. [13:41] Thank you. [13:44] What, what's the transition on the, on the rec trail? [13:47] How are you gonna handle that? I'm curious. [13:48] Sorry, what was that? What's the [13:50] transition on the rec trail? [13:51] How does the, how do you, how do you transition [13:53] from the class? [13:56] Is that, that's a class six road, right? That's correct. [13:58] So how do you transition a class six road [14:02] through the rec trail and then so you, [14:04] you doing improvements to the rec trail too? [14:07] We are, the only improvement that we have [14:09] for the wreck trail trail that's been coordinated with [14:12] DES is that they requested that we put, and let me go back [14:15] and like they're labeled on the plan here. [14:17] They requested that we put two [14:20] gates one on either side of the wreck trail. [14:23] So right now, you know, there's not much vehicle travel [14:27] that goes on across the rec trail. [14:29] It's really just, you know, anything [14:30] that's coming across the rec trail in this direction. [14:32] So they requested that Joe have custom built gates [14:36] to a specific spec that they gave us [14:38] that he is in the process of having built [14:40] and they want them placed on either side. [14:42] So it'll become, these gates will have locks on them [14:47] and knock boxes on them that allows, you know, police [14:50] and fire to get through through if necessary. [14:52] But the idea here is that this will now, [14:54] those gates will limit or, [14:56] or will be like a sign for anybody using the wreck trail [15:00] that there is gonna be vehicular traffic [15:02] on this road now. But, [15:04] But how, how will hikers [15:05] and bikers be able to navigate that if there's gates walk? [15:09] Like they should be allowed to use the trail [15:12] and how are they gonna use it if there's gates? [15:14] Well they put it's, you're gonna do the 54 inch, [15:16] 54 inch opening. Correct. That is [15:17] Like any other, any other road. [15:19] They're required to do a 54 inch opening for, for the, [15:22] for the ATVs to get [15:23] So able to get through safely. [15:26] Are you working with Mike Weeks? [15:28] I am. Okay. Yes. [15:29] Yeah, Mike Weeks are approved it already and he came out [15:32] and staked it and the gates just got finished being built. [15:35] So Mike works for, I work for the state [15:39] for forest and lands. [15:41] Mike works for parks under the Trails bureau. [15:44] So it's actually not DES, it's DNCR. [15:47] Apologize, I just wanted to to make it clear [15:50] because some people will be like, [15:51] what's DES got to do with it? [15:53] Right. But and those gates Yeah. [15:56] If he's following our standard plan, yeah, it does have a, [15:59] a man pass the [16:01] Side able is still hike through and bike through. [16:04] Okay. During the winter the gate is put in a locked open [16:08] position for the snowmobiles to go through and stuff. [16:11] Good. Okay. The main, the main reason we ask for the gates, [16:15] Mike's probably explained it to you, [16:17] is people find openings on that trail of course. [16:20] And they will be driving pickups and Jeeps [16:22] and everything else down there. So Yeah, of course [16:24] That you don't want there, there was built [16:26] to spec of what Mike sent me. [16:28] Yeah. And then your other discussion about the road being [16:32] accessible for the fire department. [16:34] The fire department always has the ability to use the trail. [16:38] They, they've got keys they can come down in [16:40] emergency down that trail. [16:42] So that's another thing to consider. [16:46] So getting back to the question that I had [16:48] regarding the transition, so, so you're gonna, you have a, [16:51] you have a class six road, two feet of, [16:54] of Crestone or gravel. [16:56] When it, when it goes across the rec trail, does it, [16:59] does it maintain that cross section [17:02] or do how, how, how do you get, [17:04] how do you get your new roadway across the rec trail [17:07] and then have it start as a new roadway? [17:08] So you're redoing the rec trail at that portion also? [17:11] That's an excellent question. [17:12] My understanding is there's just gonna be a [17:14] little bit of regrading out there. [17:15] It's not gonna be the, the two feet [17:17] of crush stone through the rec trail. [17:20] 'cause Joe's gonna be responsible for maintaining the, [17:23] like this entire section of that. [17:25] But the rec trail section is still under the [17:27] state's, state's ownership. [17:29] So it'll be your spec on each. [17:31] And then the, the rec trail is usually like stone dust? [17:33] Correct. That's, that's gonna stay like stone dust. Got it. [17:37] So those, that road is gonna have [17:38] to be plowed in the winter. [17:40] So that area where the intersection is with the rail trail [17:44] won't be interfered with when [17:46] with plow the grading will be compact enough. [17:51] Y Yes, that's correct. So if you look, [17:53] I can show you guys on the grading plan, the wreck trail. [17:56] See this little, these two little dash lines here. [17:59] We, we did this very purposely. [18:00] We tried to keep the grade the same, [18:02] but the actual recreational trail is staying the exact same [18:06] grade that it is now. [18:08] So any change in grade, the little dashed line you can see [18:10] underneath is the grade that's there. [18:12] Now the thick line on top is the proposed grade. [18:15] So we're almost identical in grade. [18:17] And then when we get to the, the recreational trail, [18:19] it's spot on right on top of where it was. [18:22] Did you, did you, have you guys done your, [18:24] your park testing for septic [18:27] There? [18:28] Yes. There was per test done for septic and, [18:31] and yes, it, it's all set. [18:32] The only, so I, let me rephrase that. [18:35] There was an approved septic plan [18:36] that was done for this site. [18:38] The septic location was [18:39] previously, can you guys see the s up here? [18:40] That 150 foot buffer? [18:42] Yeah, the previous septic like, [18:45] like straddled the line on the 150 foot. [18:48] So the test pit that's actually shown on [18:49] here is in the correct location. [18:50] We just rotated this. So there was an approved plan with, [18:53] for the septic, we just have [18:55] to get it updated to show the new location. [18:56] So when was that? When was the, [18:58] so you haven't done a new one yet [18:59] that you're still working off the old one? [19:01] Yes, that's correct. But it's the same test bit. [19:03] So the information we, we didn't do it, the surveyor did, [19:06] but I can get you guys a copy of [19:07] that if you need to see it. Got it. [19:09] And I'm, I'm assuming that the septic area has, [19:14] has the other two bedrooms, the proposed two bedrooms? [19:16] That is correct, yes. It's [19:17] for six bedrooms, not just the four. [19:19] Okay. [19:20] And the pit, the pit tested for six? [19:22] Yes, that is correct. Will there be a septic as well [19:26] for the A DU in that? [19:27] Yeah, it's gonna share the A DU is [19:29] Gonna share that it's gonna share the same septic. [19:30] Yep. And the shortest distance from the required 150 feet is [19:35] 75 to the PRI wetland. [19:37] Yeah. At the end of the driveway, 75 feet did you say, [19:40] So the shortest distance to [19:42] where the driveway comes in, is that what you said? Y [19:44] Yeah, the, the shortest in the, [19:46] in the buffer zone to the prime wetland, [19:48] Yes. [19:49] So for the access driveway, so this, [19:50] this is actually something that we wanted to, [19:53] to ask you guys and, and, [19:54] and we needed to discuss with some of the town officials. [19:57] So what we had done this plan originally [20:01] we had shown we did not have this turnaround [20:03] for the fire department at the end. [20:05] And so everything was outside of the 75 feet. [20:08] So if you look, the 75 foot buffer is this little dash [20:11] is this dash line here. [20:12] And you can see our proposed driveway [20:14] and all that work is between 75 to 150. [20:17] When we added in the required turnaround, that was requested [20:20] by the fire department. [20:21] There's this little small section here [20:23] that's within 75 feet. [20:26] You can see there's some grading [20:27] and it's just the gravel, [20:28] it's the gravel turnaround for the fire department. [20:30] I don't have the exact dimension, [20:31] but if we pulled this, it's, it's about 45 feet where that, [20:36] that section of the grading would come [20:38] down after the turnaround. [20:39] Now is that something that, again, this is more [20:43] of a question to the, to the commission, is that something [20:45] that is allowable or is that something again, [20:47] because it was requested [20:48] by the fire department for us to do that. [20:50] Is that something that's gonna be a a a problem with with [20:53] with the construction of the roadway there or because [20:57] because again, it's, it's the, all the work that's on site [21:00] for the single family is all, you know, outside [21:03] of that 75 feet. [21:04] But that one little section there is within it. [21:10] Any of the other commissioners have questions. Rick, [21:13] Is there a reason you can't pull that turnaround back [21:16] towards the road origin? Towards the trail? [21:19] So I, I don't have it in this set of plans, [21:21] but the, the fire, [21:23] the fire department sent me the parameters [21:25] for the fire engine that needs to be able to make this turn. [21:28] And if you guys look, so it comes in [21:29] and this, this little radius here is how it needs [21:32] to turn up in this direction here, in order for this thing [21:34] to back up and swing out, it has [21:36] to come out to this, this area here. [21:38] If I tried to move this driveway at all, he'd basically, [21:41] now all of his access would be coming from [21:44] the Rockingham rec trail property rather than the right [21:46] of way in Jackman Road. [21:49] So it's, we're kind of tight on this spot here. [21:53] Like I don't think we'd be able to pull that any further in [21:57] So the end, you wouldn't, you wouldn't be able to pull [21:59] that end in to match, to come closer to the edge of the, [22:02] the proposed driveway. [22:05] Unfortunately what I'm saying, not not for not [22:07] for the apparatus to make the maneuver. [22:08] It needs to make. And I, again, I can also provide you guys [22:13] with a plan that shows that it was a request [22:15] from the TRC for that as well. [22:16] But I can, we have a a a, a turning plan [22:19] that shows the movement that needs to make. [22:22] And, and that may, may clarify some of this. [22:27] I would just be curious with within the commission [22:29] of the proposed, I mean [22:30] of the potential impact within 45 feet of prime wetland, [22:34] if there's anything, any concern about that. [22:36] That just seems very close to me. [22:38] I think Prime Wetland, does [22:40] That trigger a DES permit? [22:41] Do you have to, you have to get a permit from DES [22:43] to, 'cause you're inside the prime. [22:46] I think We [22:47] May did mention that. [22:48] Yeah. Yeah. So, [22:50] And then we, so from the commission's perspective, I'm, [22:53] I'm fairly confident that's the case. [22:58] We also have the ability to comment on that permit. [23:03] So, so we're, we're gonna get our first look here. [23:08] I I'm thinking we're gonna see this. [23:09] I think we should do a site visit Mr. Chair. Yeah, I do too. [23:11] Eileen, I I I'm just wondering if we should wait till, [23:15] wait till they have to go to zba. [23:18] No, well they have to still go to zba Right. And planning. [23:22] Okay. They're both gonna have some suggestions. [23:26] I'm, I'm thinking this plan is gonna change somewhat. [23:31] I'm not so sure if it's gonna change a lot, [23:32] but I I'm, I'm gonna, I have a gut feeling [23:35] that it's gonna change somewhat [23:36] after those two boards look at it. [23:39] And I think they're probably gonna come back before us. [23:41] We should probably look at that set of plans [23:45] and then do the site walk based on that set [23:47] of plans rather than this set of plans. [23:50] 'cause I think this set of plans is gonna change [23:52] and could change could change, you know, [23:54] fairly significantly after three other. So for the better [23:58] Or for more impacts, I just think it's gonna change. [24:02] Yeah, I think the lines on the plan are gonna change. [24:06] So I wanna be looking at the lines on the plan [24:08] that are gonna be the permanent lines on the plan as opposed [24:10] to the, the initial lines on the plan. [24:13] That's me as a member and a suggestion. [24:18] That being said, so I I think you are gonna go [24:19] to DES and anything else? [24:23] Yeah, go ahead Bob. [24:25] Midway down the section you're restoring, [24:28] there's a 12 inch pipe going under [24:33] the contours that are on the road. [24:35] Don't give us any indication, [24:37] obviously the pipe is either carrying [24:39] water one side or the other. [24:41] What's happening to that water afterwards? [24:44] My guess would be it runs down the side of the road [24:47] or is it gonna disperse out into one property or the other? [24:50] That's an excellent question. [24:52] So I will pull up and show what we are talking about here. [24:55] So right here at this section of the road, [24:58] so we are actually currently in the process [25:00] of having the surveyor go out [25:02] and get a couple additional spot shots along both sides [25:04] of the stone wall that's out there right [25:06] now where this is shown. [25:07] If you guys walk out there, [25:08] you can see there's like a ditch on, sorry, on this side. [25:11] When you stand out there, there's a little [25:12] ditch on the side of the wall. [25:14] Okay. Basically we would put, you know, [25:17] the opening would be here with, [25:20] we haven't determined if it's gonna be a head wall or a, [25:22] or a, or a level spreader on this side, [25:23] but this would be coming in [25:25] through this way and out this way. [25:27] And again, same thing, level [25:28] spreader or a head wall on this side. [25:29] It just depends on what those, these elevations are. [25:31] We call that out to match. [25:32] But again, the surveyor is currently in the process [25:34] of working to get back out there. [25:36] The idea here is just to make sure that [25:41] that area on this side of the wall where [25:42] that little ditches is not [25:44] ponding on the neighbor's property here, [25:46] outside on Jackman Road. [25:48] So this size of this pipe may change as well. Where, [25:51] Where, is there something there right now? [25:53] Is there some sort of pipe there [25:54] Now? [25:55] There is not. Okay. [25:57] But again, it, we we, [25:58] this was a request from the engineering department to [26:01] assess the area and, [26:03] and mark anywhere that a culvert may be needed. So we [26:07] How long is that pipe? [26:08] How long is it? Yeah, it's about 30 feet. [26:11] Okay, sorry, sorry to interrupt. [26:13] We don't like 12 inch pipes [26:14] We're it's gonna be larger. [26:16] It was requested that it's at least 15 inches from, [26:19] from the engineering department. [26:22] Once we have the survey on what these elevations are. [26:26] So to answer this, it'll be at least 15 inches. [26:29] It not larger. Yeah. [26:32] So I guess from, from my experience on the trail and, [26:36] and being down in there, [26:39] the concern would be any water coming down the road, [26:43] which it already has been, you've been out there, [26:45] so you've seen it runs out onto the trail [26:48] and across into your property would be [26:52] the ditch line, which I don't really remember any kind [26:55] of a ditch line on that side to catch the water [26:58] and go in either direction. [27:00] But it's just a consideration I guess [27:05] is to be, be aware that it will wash coming down there. [27:10] Even your plan shows it [27:12] as a pretty steady slope down through there. [27:16] Yeah, they'll, so, so this, this pitch is, so again, [27:19] and when we have the additional survey information, [27:21] this will show, but you know, this, this grade down here, [27:23] everything kind of pitches, like you said, [27:26] down in this direction and then sort [27:27] of down in away in this direction. [27:29] So the idea here would be anything just [27:31] to prevent any ponding from here to come across. [27:33] But the one thing that, [27:36] and it was part of our, our submission [27:40] to TRC was concerned about runoff from the updated road. [27:44] And so this, [27:47] this 20 foot wide gravel road now with the two feet [27:50] of stone is gonna provide some significant volume [27:53] that's not there now for water to hold. [27:55] So I I, I wouldn't have any major concerns about any water [27:58] coming off the road just [28:01] because the capacity that's gonna be [28:03] provided here is significantly more than what's there now. [28:08] Anyone else? Yes. Will the road be gravel? [28:11] Yes. Okay. Another question I had was, [28:16] I noted in the notes that you had it, [28:18] you had the wetland boundaries flagged [28:22] by a certified wet wetland scientist back in November [28:25] of 2025. [28:27] But I don't see a certified wetland scientist stamp on these [28:30] plans that should be on the plans. [28:37] And I, I also, you know, [28:42] as I shared with the chair, I I would like [28:44] to see a site visit done by the commission out there. [28:50] Any other commissioners have questions for this applicant? [28:54] No. How do you have another trip at TRC? [28:58] Are you back at TRC? Are you done at TRC? [29:01] We are done with TRC. You [29:02] Are? [29:03] So you got planning and zoning? [29:05] Yes, that's correct. So I, [29:10] I don't think we're gonna act [29:12] on anything tonight at least I, I don't think [29:14] that there'll be a, a motion to act on anything tonight. [29:19] Couple of things that I'd like like to note, [29:22] 'cause you'll be back after you go to planting and zoning [29:24] and you, you come back here, we have an invasive, [29:28] an invasive species, some language. [29:31] If it hasn't been provided to you yet, [29:33] we can provide it to you. [29:34] So make sure that you, you get that in your plan set. [29:40] I, I personally would like to see that pipe much bigger. [29:43] Pipes under roads are not just for water. [29:45] It's, they're for animals too. [29:48] And, and some animals are bigger than 12 inches. [29:50] So we, we like to, we like to make those pipes [29:53] as big as they can be. [29:56] Obviously we don't need it, need to be get a car through it. [29:58] We wanna be able to have it not get clogged [30:01] by a basketball or something like that. [30:04] So we, I'd like to see a bigger, bigger pipe under [30:08] that, under that road. [30:10] We'd like to see a stamp from the, [30:12] from the scientists obviously on the plants. [30:14] As Eileen mentioned, I'd like to see the, [30:18] the perk test for the six bedrooms. [30:20] A detail on that. Anything else that people would like [30:24] to see when they're back before us? [30:27] Another, another, just another question I have [30:31] on the layout of the house and, [30:34] and again, you know, sort to speaking to Rick Metz [30:38] who mentioned, you know, pulling things back a bit, one [30:43] of the homes, if if you were [30:45] to have it a different shape instead of as vertical [30:49] as it is, you might be able [30:50] to pull it back even more from the wetland. [30:53] I don't know, is that a already a preconceived plan for, [30:57] for a home to be long like that? [31:01] As vertical as it's shown on page, [31:04] This one page, page Four of eight. [31:09] That's, you know, what we're in the process of now of, [31:12] you know, making plans for you. [31:16] You have some of the section that's going off as [31:20] a attached garage on the house. [31:22] That's why it's, but on page [31:24] might appear a little bit longer [31:26] On page four of eight, could [31:28] you look at that one's four of eight? [31:29] Yep. Yeah. So that's did [31:30] That, if that, if that were to be changed, you know, [31:34] a bit it, it could be pulled back and, [31:37] and then you wouldn't have that grade, the necess [31:41] necessity for such a grade so close to the wetland. [31:45] So, so I, I just wanna point out, so, so this house, [31:49] I mean we could, we could pull it back a little bit further [31:52] in this direction, but the, the, the [31:56] issue is relative to the driveway, it's not so much the, [31:59] the building if you guys look, [32:01] and so the property line [32:03] for 38 Jackman is this black line here [32:05] that comes across here, right? [32:06] Right. And so this is the Jackman road right of way [32:09] where the dash line is, that's the existing gravel road. [32:13] If you look, our 150 foot buffer is this dash line here. [32:17] Right. The entirety [32:19] of this property line is within 150 feet. [32:22] So the, what I had mentioned [32:23] to you guys about this 75 feet is this particular section. [32:27] We're coming into the here basically [32:29] as far down Jackman road as we possibly can [32:31] to turn into the site [32:32] because of where the property is located. [32:34] Okay. And so we're limited, you know, [32:37] we can't turn this driveway up [32:39] and in off the recreational trail up [32:41] here on this property line. [32:42] Okay. So, so this location [32:45] of the driveway really can't change. [32:48] But what, what was being discussed and, and [32:51] and requested is this, [32:53] so this dashed line is the 75 foot buffer [32:56] to the burn wetland, right? [32:58] And what's within 75 feet is a section [33:00] of the fire apparatus turnaround [33:02] for, for the fire department. [33:05] And what was was question was, is there any way [33:08] to pull this outta the 75 feet? [33:10] And, and I can do my best to try to [33:16] rerun the fire apparatus movement, [33:18] although I, I think I've got it kind of tight to [33:20] where it needs to be at the moment. [33:22] But I will do my best to to to try to move that [33:26] and see if we can get out of that 75 foot, 75 foot buffer. [33:29] Okay. And then maybe the, the house itself though, [33:33] if you could reshape that, that house, [33:38] you could, you could potentially, you know, reconfigure it [33:41] so that you could pull it back. [33:43] Well that's outside the 150 feet said The, the, [33:46] the A DU in the house is completely outside the 150 feet. [33:49] Right. But it's still, it's still the, [33:52] the stormwater runoff that will come off that roof is, [33:55] is gonna go down that slope [33:56] and it's gonna head for the wetlands. [33:58] So I'm just looking at that. [34:00] Okay. I mean, we have some room that we can, [34:02] we can slide this back this way if, if needed. [34:06] There's, there's a little bit more room for us to move [34:08] that further away from the wetland for the building. [34:11] It just unfortunately won't have any impact on [34:13] where the driveway is and what's what's, no, [34:15] I'm not, I'm not speaking about the driveway. [34:17] I'm just speaking about the house. Okay. [34:18] Okay. Have you guys done the, as part of your, [34:24] your analysis, have you done [34:25] that protected species analysis? [34:28] Or is that, do you, do you remember if that was in your, [34:32] you do like an animal species analysis of the area? We, [34:35] We have not, I think it, [34:36] it'll probably get triggered by [34:38] DS when they, when they apply to DS, they'll have to do [34:40] It. [34:41] Yes. So when that you'll DES is gonna ask you [34:42] to do like a inventory of protected species, [34:46] just when you come back before us, just, [34:48] just have that for us please. Okay. [34:49] Yeah, Absolutely. Because that kind of determines like [34:52] how big that pipe needs to be. [34:54] Okay. We look at it kind of from two perspectives [34:57] as a wildlife corridor and then as a, as a, as a safety, [35:02] a safety thing for, well, well more like a wildlife corridor [35:06] and then to make sure that the, that the drainage works. [35:09] Anything else from us? And Eileen, I think, we'll, [35:12] we'll be visiting this property [35:13] after we see the kind of the second version. [35:17] Guys, you're probably, I, I'm gonna say just [35:20] to give you guys an idea of what, what, [35:21] what's gonna happen at this board, right? [35:22] So you can plan accordingly. [35:25] You're gonna go, you're gonna go to the other two boards, [35:27] there'll probably be some changes. [35:29] You'll come back to us when you come back to us. [35:32] We're gonna wanna do a site walk and then [35:35] after that site walk, you'll come back to us one more time [35:38] and then we can usually button it up at that third meeting [35:41] based on what you presented, things that we, [35:45] we see at the site walk that we, we may want to add. [35:48] And then that, that last meeting, that third meeting, [35:51] as long as everything goes the way it should, [35:53] we can usually button it up then with all of our, all [35:56] of our kind of concerns [35:59] or, you know, suggestions, whatever it may be. [36:02] So just so you can, in your planning, I know you, [36:04] you're gonna, you're gonna plan this thing out. [36:06] So just so you know what's down the street for us. [36:08] So do do planning [36:09] and zoning, come back to us, give us that, [36:11] show us that revised plan. [36:13] We're gonna meet you at the site, walk the site, [36:16] and then at that next meeting we should be able to, [36:20] to button it all up. [36:21] Okay. Okay. That sound good? Commissioners? [36:23] That all sound right? Yep. Sound good everybody? All right. [36:26] Anything else from you guys? Nope, I think that's it. [36:28] Alright, good. Thank you. Thanks. Thanks. [36:30] Thank you. Thank you very much. Thank you. Thank you. [36:32] Have great day and thank you. Thank you. [36:41] Good. [36:48] Alright, next piece [36:49] of business we have gimme one second. [37:15] Okay, next thing we have is public use of the Cornelius [37:20] and Martin, Fernando and Ball properties. [37:23] And we have representatives from the Ferd [37:25] and Ando family here. [37:28] They're gonna talk to us about some concerns they may have [37:32] regarding the property. [37:33] And Welcome, welcome. [37:39] Just state your name and address for the record [37:41] before you start talking, please. Thank you. Yeah. [37:43] Andrew Chisholm Hamstead, New Hampshire. [37:48] I'm Melissa Fernando, dairy New Hampshire. [37:50] Good to see you guys. Thanks. [37:52] Thanks for having us commissioners. [37:54] So I have [37:58] material here if you'd like to take a look at it. [37:59] I can pass this along. This is the FDA FSMA program, [38:04] which FISMA is the Food Safety Modernization Act, which was [38:08] enforced in 2023. [38:15] So before we start, so just give you a little background, [38:18] Melissa and Andrew Yep. [38:20] Set the communication to the commission regarding [38:25] some concerns they have about the type of use that's being, [38:28] that's happening on the properties that they, they own, that [38:32] we have easements on that other people have easements on, [38:34] but we'll, we'll call it a collection of properties [38:36] that we have. [38:39] We're all, we, we have stake we're stakeholders of them. [38:42] We'll, we'll call it that, right? Yeah. [38:43] Sort of stakeholders. Yeah. [38:45] The, the document he sent out I think has [38:48] to do specifically about dog waste [38:50] and how dog waste affects vegetables and stuff like that [38:53] and how that can really affect their business. [38:56] And obviously we, we know the, for people in the, in [39:01] that farm project is a very, very big part of our community. [39:04] So we wanna accommodate them every way that we can. [39:07] So that's what that book is. [39:09] I expect you to read it all tonight. [39:11] Cover to cover and report back. [39:14] So that's, that's what kind of, that was the catalyst [39:17] to this discussion. [39:18] So we, we want to, we want to get this stuff resolved [39:21] so we can, we can, they can do [39:24] what they do and we do what we do. [39:25] So go ahead, take it away, Andrew. Correct. [39:26] Yeah. So I'll, I'll kind of give you a little history of [39:29] where we are with fisma. [39:31] And again, fisma Food Safety Modernization Act came out in [39:34] 2020, but due to the COVID pandemic, it was not enforced [39:39] and until 2023. [39:42] So 2023 was the first year of enforcement with, with fisma [39:48] FISMA is, is, is put up by the FDA and the USDA [39:53] and the Commissioner [39:54] of Agriculture here in New Hampshire, commissioner Jasper. [39:58] It's required now compliance under, [40:02] for farms of a certain size. [40:04] JNF falls into that the size that is required [40:07] to be in compliance with FISMA inspectors come out, [40:11] take a look at the property [40:12] and make sure that we're in compliance with it. [40:14] That manual that you're looking at there is just kind [40:18] of the, the, the guidelines that we have to follow [40:20] through on that, within those, that manual [40:24] that you have in your hands, there is the restriction for [40:29] public access to the food, food supply. [40:32] And as you know, there's a big [40:35] topic within the country right now about food safety and, [40:39] and, and foodborne pathogens [40:42] that can get into the food supply. [40:43] This is in regards to trying to, to, to mitigate that [40:49] things specifically to the property [40:51] that we're talking about now is walking trails [40:53] that are published in the kiosks at the end of English range [40:57] and Happy Lane Holiday Ave Holiday a the Holiday [41:00] Ave, sorry, holiday Ave. [41:02] There's a kiosk that publishes a, a public walking trail [41:07] that goes directly through the corn fields, [41:10] the pumpkin fields over at the Pingree [41:12] Hill property that we also own. [41:14] It goes around the food corn silage. [41:17] That's a supply for the, the, [41:19] the beef cattle that are over there. [41:21] It goes through the hay silo, it goes [41:23] through an electric fence. [41:25] Those are all the published trails [41:27] that are out there right now to [41:30] remain in compliance with fsma. [41:33] We cannot allow the public to walk through those fields [41:38] and we cannot allow dogs to go free [41:40] through those fields as well. [41:42] We can't enforce that from the farm [41:45] that somebody would be walking through those fields, [41:48] you know, several acres away. [41:52] The other issue with it too, FSMA requires [41:56] we have to publish that the, the corn and all the, the crops [42:00] and every whatnot are, are employee only access in there. [42:04] Our employees that pick through there have to go [42:07] through certain guidelines that can't wear jewelry, watches, [42:11] things like that have to, they have to wash their hands [42:14] and if we do find animal feces, we have [42:17] to rope off a certain area and we can't pick in that area. [42:19] If they're standing water, [42:21] we can't pick in standing water areas. [42:23] So there's a lot now that comes out into these FSMA [42:25] regulations that the published trails [42:30] that are up at the kiosks directly violate all that. [42:34] Right now that's where we are with, with in regard to fsma. [42:40] And again, if this was three years ago, [42:43] we wouldn't be having this conversation, but [42:45] because these rules came out [42:47] and they were all enforced starting in 2023, [42:50] this is now a, a pretty hot topic, [42:52] Right? [42:55] Yeah. So if they were to come out [42:57] and somebody's out there that's not a worker [42:59] that hasn't been through the program [43:01] and has a dog right, we will get fined [43:05] and possibly shut down on that whole field. [43:08] Gotcha. Sure. [43:10] So we weren't aware that there was, [43:11] and again, I mean my dad just passed away, [43:14] so this is all new stuff that we've been having to deal with [43:18] and we weren't aware that there was walking trails [43:20] through any of those fields for the public. [43:23] So that brings up a big issue for us. [43:27] Right. So, and we're sorry [43:29] for your loss about your daddy. Yeah, [43:31] I'm Very sorry. [43:32] He's a great guy. Thank you. He was wonderful. [43:34] So we, we wanna work with the Fernando family [43:36] and get this, get this resolved. [43:38] So Beth [43:39] and I have been talking about this quite a bit lately [43:44] before you folks came. [43:47] Obviously this is probably not a problem just [43:49] with the Ford nano property, I'm sure it's, it's becoming a, [43:52] a, a statewide problem. [43:53] 'cause a lot of, a lot of farms have walking trails [43:56] through 'em and everyone's addressing it at the same time. [43:59] We probably should hand this off to a subcommittee. [44:04] Right. But I think we might do this a little differently if, [44:07] if I can indulge the commissioners [44:09] because I want to, this has to be fast tracked. [44:12] We can't, this can't be like a a six month long process. [44:16] We want to get this thing done now. Yeah. [44:18] We appreciate that FSMA shows up next week. [44:20] We don't want problems for the Fernando farm property. [44:23] So I would, I think we should consider, [44:29] we hand this off to a subcommittee [44:32] and have that subcommittee make binding recommendations [44:36] to the process rather than because of our meeting schedule. [44:40] How, how do people feel about that? [44:42] I think that's a good idea. Yeah. [44:44] Okay. So, so, and I think we could find a, you know, [44:46] sort of a middle road where you can comply [44:49] with the regulations, [44:50] but also the public would have a, [44:52] a revised trail network away from the fields. [44:54] Yeah. Right. Because that needs to happen [44:57] because we purchased, you know, [45:00] that conservation easement with public funds. [45:02] So we need to have a revised trail network [45:04] that would not impact your fields and your food operations. [45:08] Yep. Yeah. We aren't against working [45:11] and letting people go where they can go. [45:14] We just can't have them in where they can Right. [45:16] Obviously Yes. Where they can cause us trouble. [45:18] Correct. Correct. Yes. And where dairy has no dog leash law. [45:22] Yep. Whenever we see people with dogs up there, [45:24] they're never on a leash. [45:26] Of course. Right. So if they, [45:28] And then people don't bring dog waste bags, [45:31] which they should always carry but [45:32] Don't fight. [45:33] Exactly. So God forbid there's a person up there walking [45:36] with a loose dog and we have an inspector go up there. [45:39] Right. We're in a lot of trouble. Right? [45:42] Yeah. And we, so we don't want that. Yeah. [45:44] And we've already, we've Beth has already reached out [45:47] to other stakeholders in this process. [45:49] Salt and the people that hold the easements there. [45:52] I'm gonna let you chime in in in one second, Beth. [45:57] And as, as I kind of think this through, does the comm, [46:01] does the commission, does the commission think we should [46:03] just form a new ad hoc committee right now to address this [46:07] and get it done and give that committee [46:12] the authorization to make the necessary changes [46:17] Draft to the necessary changes [46:20] For Discussion? [46:21] 'cause they would need to be reviewed by counsel both sides. [46:27] 'cause you're gonna be ultimately, [46:30] I'm gonna guess we're be ultimately amending the, [46:34] the easement language. [46:39] Sorry to complicate. [46:40] No, that's precisely what I don't wanna do. Yeah. [46:43] But I, but I think we have the authority to, [46:48] to not make permanent changes, [46:49] but to make emergency changes right now. [46:51] Oh, okay. Yeah. [46:53] That would be my guess. Yeah. [46:54] So, so, so just to address the, the existing problem [46:58] that we have, right? [47:00] We're gonna have to backfill us [47:03] and everybody else that's in this [47:04] that's having this discussion in the state are gonna have [47:07] to backfill the permanent solution. [47:10] But to, to get to a, a a, an immediate right solution. [47:17] I think we should have, we can call it temporary [47:20] or we can call it, we can call it, [47:22] you know, whatever we need to call it. [47:23] But I, but I wanna do some, I want to, I want to act now [47:28] to prevent some, some problems. [47:32] So how do people feel about that? [47:34] Yeah, people feel pretty good about that. Okay. [47:37] So I volunteer to chair that committee. [47:40] I'd like to have Beth join me in that committee. [47:43] Who else is interested in being involved in that committee? [47:45] I would, Eileen I would be interested in. [47:48] And how many can we have Beth? Three. Three [47:50] Up to three? [47:51] Yes. Alright. So it's gonna be myself, Eileen, Bob, [47:54] and Beth and Beth you [47:55] don't count 'cause you're not a sitting. [47:59] So the four of us are, are very quickly gonna come up [48:04] with the, at least a temporary solution. [48:09] And what it will probably be is a sign at the kiosk [48:14] saying [48:19] that, you know, walking within the fields [48:23] or within a certain distance of the fields, right? [48:25] Like we have to probably have like 50 [48:27] Foot setback or something like that. [48:28] There's some manual there. There's some Are there setbacks? [48:32] Yeah, there's setbacks. And there's also, I'm [48:34] Not gonna read it. [48:35] Tell me what it is. Is it 50, is it 50 feet? [48:37] Does it like 50 feet? I don't, off the top of my head. [48:39] I don't remember if it's 50 or 75 feet on on there. [48:41] So whatever it's in there. We're gonna, [48:43] we're gonna dot. Yeah, we'll mimic [48:44] It. [48:45] And then in the back of that there's some [48:47] FSMA put out sign signage that has to go up around the farm, [48:50] around fields [48:51] that are within walking distance of the farm stand. [48:54] But that would also apply in this case as well to the Yeah. [48:56] Published walking jails. [48:58] Yeah. We could put up like the signs that were required [49:00] to have down by the farm says like no [49:05] dogs no authorized. [49:06] Like if you're not an employee you can't come in here. [49:08] Like we could also put some signs up so people kind of know [49:12] where it is we never did before. [49:13] 'cause it wasn't an issue right up there. [49:15] Because normally it's not the place the public goes [49:18] unless they're like out picking [49:21] something they're authorized to do. [49:23] So you're saying that FISMA has the, [49:24] has the regulations right? In that book? [49:27] Yeah, they do. Yeah. So maybe [49:28] We can make this easier than I thought. [49:29] So so why don't we, why don't we consider right now having a [49:32] vote saying that we're gonna adopt the best practices [49:37] in the FIS b re FISMA regulation book. [49:41] And Beth, you can help me with which [49:42] properties are, are the ones we have. [49:43] You can help me with that, right? [49:44] The properties that we have. [49:45] So how do people feel about that? [49:46] Do you want to adopt the FSMA [49:51] regulations in relation to this property? [49:58] Excuse me one second. Just one second. Go [50:00] Ahead. [50:01] While you're doing that, if I could put it in my 2 cents [50:03] that that that would, the commissioner of agriculture here, [50:06] commissioner Jasper would, would be happy with that. [50:08] That I think would check off all the boxes. [50:10] Just adopting the FSMA regulations. [50:13] Are the four properties listed on our agenda, [50:16] are those the only properties affected? [50:19] You mentioned Pingree Hill, is that, is that [50:21] Yeah. [50:22] The old Auburn Road that has the walking trail going [50:24] through like the feed in the silo [50:28] and then through our electric fence. [50:30] So the electric fence obviously would be [50:35] a safety thing for somebody going through there. [50:38] Right. But the other area is where we have corn planted [50:41] and then where the other, the cows feed is, [50:43] there's a walking trail through that [50:45] and then it's the properties off [50:48] English Range Road English range. [50:50] Okay. [51:08] Is that a question? Yep. Bob, [51:12] Is that book yours? [51:13] And you're sharing it with us? [51:15] Yes. Yes. Yeah. So [51:17] Mr. [51:18] Chairman, I'd recommend that we get a copy Yeah. [51:21] For and we can look through town. Okay. [51:24] Yeah, we can get you a copy of that. Yeah. [51:26] I also will 'cause watch here, we can't just look [51:29] through this, browse through it. [51:31] Yeah. Have lot. I use that as an example. [51:33] So you can see how extensive these fees regulations are. [51:37] We need to know what's going on. [51:39] I'm Sure you're sharing it with us, but it Yeah, yeah, [51:42] Yeah, yeah. [51:43] We're, we're pretty well up to speed on it. Yeah. [51:46] It's, it's a tick book. Yeah. [51:48] Alright, so, so after talking to our council liaison, [51:53] we're gonna pivot back to the, to the ad hoc committee [51:56] because we, [51:59] we probably are gonna need approval from, well we, we may [52:02] or may not need approval from someone else. [52:05] And that if, if we just have that ad hoc committee have [52:11] the authority to to, to do it, [52:15] we don't have to wait for another meeting [52:17] to, to vote it through. [52:19] So let's go back to that. [52:21] Let's go back to the ad hoc committee that's gonna work [52:24] with the property owner [52:31] to satisfy the FSMA regulations. [52:41] So I think the motion should be that we authorize [52:48] a, we're gonna call it an emergency committee [52:56] to establish guidelines on which property? [53:00] Beth? [53:01] Yeah. So it's the Fernando property, [53:06] the Cornelius and farm property [53:09] and the Martin farm property. [53:11] So the Fernando property, the Cornelius and property [53:14] and the Martin farm property. Do we do [53:16] We include up farm farms and ball farm also is there [53:21] and I Oh yes you do have, you have active [53:24] crop fields there as well? [53:26] Yeah. So the ball property as well. We [53:29] Include the pingree too, since they mentioned that. [53:31] That's the Martin farm. Yeah. Oh yeah. That's the [53:33] Part. [53:34] Oh, Martin farm is different I think [53:36] than Pingree isn't it? [53:37] Is the ball. Oh, it's the field. [53:40] You get to the top of the hill [53:41] and it's that slope that's facing North River. [53:46] It's Cornfield. Yes. Yeah. [53:52] Just outta curiosity from your knowledge of what that says. [53:57] After the fields have been harvested, [54:00] can public go on them at that point [54:03] Then we get into cover crop [54:05] and a lot of times cover crop is used as feed for the, [54:09] the beef and dairy cows also. [54:11] So you get into kind of a, [54:14] a very small window into when they can, it says, FISMA says [54:17] that during harvest season of the crops and growing season. [54:21] So that would be, you know, we're, yeah, [54:23] we're right in the middle of harvest season right now, [54:25] but you get into cover crop season as well. [54:27] And that's, there's rye up there [54:29] and there's a lot of times there'll be [54:32] different cover crops that's turned into hay silage. Yep. [54:37] Okay. I'm just curious. [54:42] You think you got it? I think so. [54:46] Okay. Commissioners, are we on, [54:49] everybody on board with this? [54:50] We're gonna establish a ad hoc committee to work [54:55] with the Fernando Farm Project [54:57] and establish some guidelines [55:04] on public use on those properties. [55:10] And that committee's gonna have authority [55:12] to make those changes and then we'll work, [55:15] work towards a long term, a longer term. [55:19] That sound good? Yeah. Okay. Alright. [55:22] Mr. Metz, take it away. [55:24] Wait, I'm writing. Okay. [55:32] Tammy, you'll never be able to read this. [55:33] So move [55:36] to establish an emergency ad hoc committee to [55:41] prepare guidelines for the Fernando, Cornelius Martin [55:44] and Ball properties, using the FSMA regulations [55:48] to form guidelines for public access [55:51] to the aforementioned properties [55:55] As motional floors. [55:56] Is there a second? Second. It's second. [55:58] By Cheryl, I'm gonna ask for a roll call on this. [56:02] Starting to my right? [56:05] Yes. Yes, Yes, [56:08] Yes, Yes, [56:10] Yes, yes. [56:12] Chair votes? Yes. Okay. That committee. [56:17] Let's do one more motion on the people on that committee. [56:21] Mr. Foot, will you join us in that committee? Yes. Okay. [56:25] Alright. So motion to have the committee be as such. [56:29] It'll be chaired by Rico, the chairman [56:32] members will be Eileen and Bob [56:35] and liaisons will be Beth and Charlie. [56:39] I get a motion to that. So moved. We a first. [56:42] Is there a second? Second First by Mr. [56:45] Met, second by Cheryl. Les in favor say aye. Aye. Opposed? [56:48] Abstention. Great. Alright, so we'll get it solved. [56:52] Thank Great. Give us a little window to get it done. [56:55] I, we, we just have to check with the powers [56:58] that be on the town side to see how much authority we have. [57:02] But I, I'm assuming that we have all the authority we need. [57:05] Okay. Okay. Yep. Yep. Great. Thank you. [57:07] So Beth, you're be, that's gonna be your point of contact. [57:10] Okay? So work with her, okay? Yep. [57:12] Yep. Thank you. [57:14] Thank you. Thanks. Thank you. Give his book back. [57:19] I know you don't [57:20] Want keep it. I wish you had another one. Do [57:21] You have another one? [57:22] What? No, no, we get, we can get it. [57:23] We gave us that at the [57:24] training meeting. We had to go see if [57:26] You get or see if we, if we can get one back. [57:28] I actually do have my dad's copy. Are [57:29] We giving this back to you or are you Yeah, we can, [57:31] So I could get that and get it to you can [57:33] Give you Phil copy. [57:34] Okay. All right. Thank you so much. Thank you so much. [57:38] Thanks for coming. Thanks. Thanks. [57:46] So the scope of that is, yeah. [57:52] Thank you. Another Thank [57:56] You both. Thank [57:57] You. [57:58] Thank you. Thanks. [58:02] It's like anything Jay. Alright. [58:07] Five minutes of eight. I want everybody to note the time [58:12] 'cause we still have a lot, lot of stuff to cover. [58:15] Is it, is this gentleman? [58:17] Sir, are you here to speak [58:18] on anything or you just observing? [58:20] I came here to ask you speak [58:21] Today. [58:22] Okay. Huh? Wait, [58:24] before you do, why don't you stay over there for a minute? [58:34] Hmm. Right now It's always there. [58:39] Yeah, it's always there. [58:49] I actually, [58:54] who's in charge of, [59:15] Okay. [59:16] We need to have a vote to open a public hearing. [59:19] So we need a motion for that [59:23] Move to open a public hearing. [59:25] Second. Second. Who is the second? Eileen? Second for? [59:28] Alright. Motion by Mr. Metz, second by Eileen. [59:30] We're gonna open a public hearing for how many minutes Mr. [59:33] Metz? [59:35] Max of 15. Okay. [59:36] Alright, so we have a public, [59:37] we're gonna open a public hearing for 15 minutes. [59:39] We have a constituent that'd like to address the commission. [59:42] Come on. Officer state your name [59:43] for the record and your address please. [59:53] Can you hear me all right? You can, yeah. [59:54] Yeah. My name is Greg Boyko. B-O-I-K-O. [59:59] I live at 10 Jo Lane Dairy, New Hampshire. [1:00:02] I've been a resident of dairy for I think, 43 years. [1:00:05] If, if my math's correct, maybe a little longer. [1:00:10] I'm concerned right now about a couple of things. [1:00:13] I actually spent the day on the town forest today [1:00:18] 'cause it's my property abuts the town forest. [1:00:21] And I'm basically concerned about the building activity at, [1:00:26] at the address called 12 Jewel Lane. [1:00:30] I've actually been to DES once. [1:00:32] They said they had nothing on that [1:00:35] and actually talked to the town council, the administrator. [1:00:40] And he got in touch with code enforcements [1:00:44] and they came down [1:00:46] and they assured me that they're on top of it. [1:00:48] And they have also talked to DES [1:00:52] and I don't wanna take a lot of your time. [1:00:55] I'm not prepared, you know, this makes me nervous. [1:00:59] Don't get me wrong. My son is gonna kill me [1:01:01] 'cause I'm gonna have a heart attack. [1:01:02] 'cause my blood pressure's gonna go through the roof. [1:01:05] Well relax. You're gonna have, [1:01:06] you don't have to be nervous here. [1:01:07] We're all friendly so I can go tell, tell us what's up. [1:01:10] When co enforcement people came up there, they, [1:01:13] they made me feel very, very assured. [1:01:15] They said that DES was involved [1:01:18] and they're gonna look into it. [1:01:20] What I'm concerned about right now is, [1:01:24] 'cause I don't know, the answers to these things is who's in [1:01:26] charge of soil erosion? [1:01:31] Who, who monitors that? [1:01:32] Is it during, during, is it during building? [1:01:35] Are they building something there? [1:01:37] They have filled, which I have files here, [1:01:42] I don't wanna swear, but they have filled, well they told me [1:01:46] that they took out 200 loads of fill [1:01:50] and dur from the exit fore project, [1:01:54] which is all like stone and boulders and dur. [1:01:57] So they built a house there. Is that? Yes. [1:01:59] They're, they, they started to build a house. [1:02:01] Oh yeah. So that would be [1:02:02] code enforcement. They're, they're the people. [1:02:03] Right. But they came, but I wanted, I [1:02:05] actually got in touch with DES [1:02:07] and I figured I would, [1:02:09] I would just wanna have an email address [1:02:11] so I can email the whole board [1:02:12] for the exactly the same files that I sent them. [1:02:16] Okay. So you could, you can do that. You can do that. [1:02:18] The email would come to me [1:02:19] and then I would disseminate it [1:02:21] to the, to the commissioners. [1:02:22] We can't, we can't have emails to a lot [1:02:25] of different people at once because [1:02:26] it becomes a public meeting. [1:02:27] Yeah. So you can, you can, you can send it to me [1:02:29] and you can get my email right off. [1:02:31] All I need is that address. Yeah, [1:02:32] you can get it right off the town website. [1:02:33] It's a link. Okay. You can just put, hit the link [1:02:35] and it'll automatically send it to me. [1:02:37] Okay. Yeah. Also, if there's a wetlands permit, [1:02:40] which there should be. [1:02:42] I, I remember us going out there [1:02:44] and there was gonna be some filling of a stream [1:02:47] since there's a wetlands permit. [1:02:49] The DES would also have control over soil erosion. [1:02:52] What I'm finding is a lot of confusion. [1:02:55] The town wanted him to build the house someplace else, [1:02:59] but he decided on a different place. [1:03:01] I know I actually came to this meeting before and spoke [1:03:04] 'cause they wanted to change the [1:03:07] pedestrian easement. Right, [1:03:08] Right, right. [1:03:09] I remember that very well. Yes. Yep. [1:03:11] And I came and spoke in favor of that. [1:03:13] And I wasn't in favor of having the pedestrian easement, [1:03:17] but I'm having a large [1:03:23] change of heart after witnessing what's [1:03:26] like right out my door. [1:03:28] I don't have to go outside. I can just look out my window. [1:03:31] Wow. And I'm, I know I, I'm going to have [1:03:36] to contact an attorney, which I plan [1:03:37] on going to see one anyway. [1:03:41] The 'cause like I said, I'm, I've actually been [1:03:45] to court on this property [1:03:46] before where some people I thought they were [1:03:50] dumping tire rims. [1:03:54] Tire rims. But it turns out they were, they, [1:03:57] the people had stolen the welding tanks from [1:04:01] Wyndham Welding Supply and the kids stole the welding tanks. [1:04:04] 'cause they wanted the nitrous oxide. [1:04:07] And I had to, I was a witness for the, the town prosecutor [1:04:13] subpoenaed me to come to court for that. [1:04:15] So I know that property intimately. [1:04:17] Oh, you have my you have my email address. [1:04:19] You can send me that email. Yeah. [1:04:20] That's all I wanna do. That's [1:04:21] All I wanna do. [1:04:22] Send me that email and if I, and, and, and, [1:04:24] and I'll dis I'll send it [1:04:25] to the appropriate people on our side. That's all I [1:04:27] Really want To, I, I appreciate you coming. [1:04:29] Thanks for coming out and speaking. Thank you very much. [1:04:31] You can come here. You don't have [1:04:32] to be nervous to come here. [1:04:33] We're we're, we're easy, easy to talk to. [1:04:35] I'm sorry. I'm almost 70 years old. [1:04:37] Wet have to be. Sorry about that. Oh, don't [1:04:39] Be don't be sorry. [1:04:40] Please don't be sorry. We're all [1:04:41] Working on that. [1:04:43] Alright. Thank you for coming. [1:04:45] Thank you. I'm just nervous. Yeah, sure [1:04:47] Will be. [1:04:48] Send that email and I'll make sure that I, I look it over. [1:04:50] Okay. Thank you. Thanks for coming. Thank you, sir. [1:04:51] Thank you so much for coming. Thank you. [1:04:53] Thanks. All right. [1:04:55] So we need a motion to close the public hearing. Motion [1:04:57] To close the public hearing. Is there [1:04:58] Second? [1:04:59] Second. First. By Mr. Met. Second by Eileen. [1:05:01] All is in favor, say aye. Aye. Opposed? Abstentions. [1:05:05] Public hearing is closed next door. [1:05:07] Our business is committee and liaison. [1:05:09] Reports up to five minutes. Please go. [1:05:13] Go to the five minutes. 'cause again, it's 8 0 5. [1:05:15] We are gonna have a non-public tonight. The Red Sox are on. [1:05:20] I want at least see the night. Night. [1:05:23] So community gardens. Jay, go ahead. [1:05:26] Okay. Harvesting is in full swing. [1:05:30] Anyone wants some tomatoes help themselves [1:05:34] and we are planning a harvest event. [1:05:38] We're gonna have a me a meeting at the end of this meeting [1:05:41] with our subcommittee briefly to, I [1:05:45] drafted a proposed scheme for the event, [1:05:51] which will include the friends [1:05:53] and family of the gardeners who have plots there. [1:05:58] And we're gonna celebrate the harvest and discuss the season [1:06:04] and just share, share our time [1:06:09] and talk about a few business items [1:06:11] and proposals for the, for the garden that we [1:06:15] might wanna implement [1:06:17] and get the feedback from, from our gardeners. [1:06:22] So that's, that's the latest event. [1:06:24] Meanwhile, we're just in full swing. [1:06:26] The gardens are amazing. [1:06:28] They, the corn is growing 10, 11, 12 [1:06:33] feet high and sunflowers are folding over. [1:06:37] They're so huge and it's a great season. [1:06:40] It's been a good, good season for the weather [1:06:43] and we're, we're grateful for those amendments that we're [1:06:48] put in and we're enjoying [1:06:52] it. That's all. [1:06:56] Any questions for Jay? Thank you Jay. [1:07:00] Thank you. I'll wait. [1:07:04] I'm back. All right. Next report is Mr. Metz personnel [1:07:10] Chairman Bazinga. [1:07:11] And I haven't seen much of each other in the [1:07:12] last couple months, but I miss you. [1:07:13] I miss you. Terrible. We, we need to get, get together [1:07:17] to do bets annual and Tammy's first review. [1:07:20] Yeah. Okay. We only, or one and only review. [1:07:23] Yeah. How about we'll get that [1:07:25] Soon. [1:07:26] How about October for those? We can do that. Okay. October. [1:07:29] October. Okay. Let's schedule it for October. [1:07:34] What else you got Rick? [1:07:36] TRC. The latest TRC came before us tonight. [1:07:41] We do have one on Friday, which is a redo of a property. [1:07:44] I believe we looked at about a year ago. Three. [1:07:47] Poor farm road. So Beth, did I send that to you? [1:07:51] You did, yep. Okay, got it on my calendar. [1:07:52] So it's eight o'clock Friday morning, [1:07:54] so I'll have information on that when we get back. [1:07:59] Alright. Cheryl, public outreach. [1:08:01] So we, we had a tent at the, [1:08:05] at the farmer's market last Wednesday. [1:08:08] And that actually went really, really well. [1:08:10] And I really wanna thank Beth. [1:08:12] I was in between Beth and Linda [1:08:13] and my son was selling bread over there, [1:08:15] so it was really a fun, fun day. [1:08:17] We, we got a good number of names to add to our email list. [1:08:21] It was probably about half a dozen, right? [1:08:22] Beth or so would you say? Yep. About half a dozen. [1:08:24] But they were genuinely in, it was a good half dozen [1:08:27] that are, that seemed gen, [1:08:29] genuinely interested in doing trail maintenance. [1:08:33] A couple of the people were new to the community [1:08:36] and they really had the, the motive of saying, I wanna get [1:08:39] to know people in the community and I care about this. [1:08:42] So those two things go together. [1:08:43] So that's kind of a nice little like hint [1:08:45] for us in the future for outreach. [1:08:47] People that are coming to the community [1:08:48] and this is an interest of theirs. [1:08:50] So you kind of have both things happening there. [1:08:53] A lot of good stories from people and, [1:08:55] and I think we were following up on, you know, expressing [1:08:59] that to them that we, we have a, [1:09:01] a trail cleanup coming in the fall. [1:09:03] Like we had, we had to cancel the one [1:09:04] because of the storm, so that was coming. [1:09:06] So, you know, I think in that way it was really successful [1:09:08] and it was a good idea to be there. [1:09:10] And yeah, looking forward to seeing maybe some [1:09:13] of those people at some events or some child cleanup. [1:09:18] Thank you Cheryl? Eileen State Compliance. [1:09:22] Okay. I Do You rename that committee? Oh [1:09:24] Yes, we did. [1:09:25] Changed that. Is it called though [1:09:28] The Environmental Policy and Training Committee? [1:09:31] Yeah, that sounds better. Okay. I have a few things. [1:09:35] One is, I don't know if everyone saw the N-H-A-C-C [1:09:39] newsletter for this month, [1:09:41] but one of the, one of the hot topics on there was [1:09:46] what is Conservation commission's role in land management? [1:09:49] It said RSA 36 A four specifies any interest in [1:09:53] land acquired in the name of the municipality [1:09:57] by the Conservation Commission, be managed [1:10:00] and controlled end quote by the commission. [1:10:03] When a commission has responsibility for a parcel, [1:10:06] a concrete, individually designed management plan [1:10:09] or stewardship plan is recommended to ensure protection [1:10:13] of its unique natural areas. [1:10:15] The reason I mentioned that is it, it kind [1:10:18] of spurred my interest [1:10:19] because we, [1:10:21] we've started certainly on having an NRI at Broadview [1:10:25] with our BioBlitz. [1:10:27] We should do more of that for our other properties. [1:10:29] We should be engaged in trying [1:10:31] to get some natural resource inventories and some, [1:10:34] and we have for other properties. [1:10:36] We've done forestry management plans as well [1:10:38] for like the Doolittle property [1:10:39] and I think one other that we did some forestry on Yeah. [1:10:43] The one carris over the years [1:10:45] called car, but it's called something [1:10:46] Else now, I think. [1:10:47] Yeah. So we should start getting engaged in, [1:10:49] in doing some of those plans. [1:10:51] And the CW PP is a huge [1:10:52] Version of that. [1:10:53] That's also, yeah. Of that, that's also an excellent start. [1:10:56] Yep. Also very important is upcoming. [1:11:01] We have the annual meeting of the N-H-A-C-C on [1:11:06] Saturday, November 7th, 2026 at Pembroke Academy. [1:11:11] And I've mentioned this for the entire commission, [1:11:15] but especially for new commissioners, [1:11:16] it's very, very important. [1:11:17] They have special sessions just for new commissioners [1:11:21] and you really ought to step aboard and, [1:11:22] and get registered for this. [1:11:25] The town does pay for us to attend, so [1:11:28] please consider attending. [1:11:30] They're gonna be presenting 24 program sessions this year [1:11:34] on a variety of topics. [1:11:35] And the keynote speaker is Anthea LaValley [1:11:39] and Lindsey Ssta from the Hubbard Brook Ecosystem study, [1:11:44] which is an important New Hampshire initiative [1:11:49] that we can learn from. [1:11:50] What was the date of that again? Eileen? What? [1:11:53] November 7th. What was the date again? [1:11:54] The what? The date. [1:11:56] Oh, the date is Saturday November 7th, 2026. [1:12:00] It will be an all day thing from like eight o'clock [1:12:02] to about four and it we'll have lunch [1:12:06] and you'll be able to enroll in three different [1:12:09] courses during the day. [1:12:11] Okay. And they may, [1:12:13] I'm not sure this last year they included some field trips. [1:12:16] I don't know if they'll be doing that again. [1:12:18] It was pretty, you know, pretty successful last year. [1:12:20] So it may include some field trips, I'm not sure. [1:12:25] But please consider putting that in your calendar [1:12:28] and registering for that. [1:12:31] Also of note was for the DES as of July 1st, [1:12:35] wetlands permit application fees increased from $400 to $600 [1:12:41] as a result of the passage of the 26 27 state budget. [1:12:47] Also, DES is launching a modern online portal [1:12:51] that's gonna eventually take the place of one stop. [1:12:54] It's gonna be called the New Hampshire and Viro [1:12:57] and it will still have one stop data [1:12:59] and information that will over time replace one stop [1:13:03] and also New Hampshire online forms websites. [1:13:07] And the first module [1:13:10] that will be in the new system will be the DSS a o OT bureau [1:13:14] of the app Alteration of terrain permits will be the first [1:13:18] to be placed into the new system. [1:13:22] And that's all I have. [1:13:25] Thank you Eileen. Property Management, [1:13:31] Beth and I continue to check boxes. [1:13:36] I have to really thank DPW [1:13:38] and kind of our, our, our renewed relationship with them. [1:13:43] They've, they've become very responsive to [1:13:47] things that we need. [1:13:50] So I'm sure Beth will cover [1:13:53] some of that stuff in her report. [1:13:55] But yeah, we we're continuing to check boxes when people [1:13:58] on our properties when, when there's things that need [1:14:01] to be done and, and a lot of the time we're getting 'em done [1:14:04] for little, little or no cost because of the DPW. [1:14:08] So that's, that's nice. [1:14:10] That's a nice change that we didn't have years ago. [1:14:15] That's all I have. And Bob, you're up with land maintenance? [1:14:19] Yep. We were rained out for all, [1:14:25] but we put one of the other days to good use, [1:14:28] sat the other night and discussed [1:14:30] what we thought should be on the kiosks. [1:14:35] First one being Cornelius in, [1:14:37] but obviously that's gonna change dramatically now. [1:14:40] So that's it. [1:14:44] Thank you Bob. Reporting compliance [1:14:48] and net zero task force of both Val who's, who's gone. [1:14:53] Catherine our newest member has agreed [1:14:55] to jump into those roles. [1:14:58] Catherine, I'm gonna, I'm gonna ask actually, Beth, [1:15:01] can you ask Val if she's willing to have some communication [1:15:05] with Catherine on the, on the reporting compliance [1:15:09] and net zero task force so they can kind [1:15:11] of collaborate on that? [1:15:14] Does that sound good? Yeah. [1:15:15] That way you get it right from Val Val's a really active [1:15:17] commissioner, she'll be missed, [1:15:19] but I'm happy that she's buying a house. [1:15:21] Yeah, sound good? Yeah, so [1:15:24] I've been, I've been communicating [1:15:27] with Val about the guide book. [1:15:29] Oh Good. Awesome. And I'm willing [1:15:31] to take that on as well. Yeah, [1:15:33] Good. [1:15:34] Thank you. I appreciate it. Awesome. [1:15:35] Well And we have Mr. [1:15:39] Foot, the council liaison report. [1:15:42] Thank you Chair. I will yield. It's been a quiet summer. [1:15:45] We're getting back into business September 1st. [1:15:48] Alright, good. Good. Thank you. Land manager report. [1:15:52] Beth, you haven't done anything in the past month, right? [1:15:55] Nothing. [1:15:58] Yeah, so just some upcoming dates. [1:16:01] So the CWPP is gonna be presented [1:16:05] at a public hearing at the town council meeting [1:16:07] on September 15th. [1:16:09] So that's pretty exciting. That's been a long time coming. [1:16:13] The Parkland Medical Center reached out [1:16:16] and they have a group of volunteers who want [1:16:18] to help us poll some bittersweet at Broadview. [1:16:22] And we have a proposed dates for those of Thursday, [1:16:27] September 17th from three to 6:00 PM [1:16:31] and a rain date of the following Tuesday, September 22nd. [1:16:35] And then we also had another group, [1:16:39] Aurora Weatherby, who has been here to speak [1:16:42] before, reached out on behalf [1:16:43] of the Southern New Hampshire chapter [1:16:45] of the Democratic Socialists of America saying [1:16:48] that they have a group of people also who would like [1:16:51] to volunteer and do some trail cleanups. [1:16:53] So we are gonna have them, you know, [1:16:56] we're gonna let everybody on our email list [1:16:59] and those groups know when we have this event, now [1:17:02] that we have the date finalized of September 17th, [1:17:07] we also that that next day on Friday, [1:17:12] September 18th, Matt Tar [1:17:14] with the UNH extension is gonna lead a tour of broad view. [1:17:17] So we'll be very active on broad view that week. [1:17:21] He has been to broad view and given us some guidance before [1:17:25] and so he'll be able to, to come give a tour of the property [1:17:29] and we're still trying [1:17:30] to work out a rain date for that as well. [1:17:34] As Bob mentioned, the trail work at the ball property was [1:17:37] canceled due to thunderstorms, [1:17:39] but that was kind of a blessing [1:17:41] 'cause now we're gonna figure out, you know, [1:17:43] how the trails need to, what, what those need to look like [1:17:46] in regard to these FSMA rules. [1:17:51] And then I wanted to mention to commissioners [1:17:53] who had some concerns about the DES notifications [1:17:57] and not seeing them very often between, you know, [1:18:01] meetings since we're going long. [1:18:03] So I did reach out to DES [1:18:06] and they said that the 20 days mentioned in the notices is [1:18:09] intended for the recipient, not for commissioners. [1:18:12] So you commissioners have as long as you need. [1:18:15] There's no, she said there's no time limit for commissioners [1:18:18] to give comment on those. [1:18:21] And that also, if you want to view [1:18:26] any of those, you know, the notice notifications [1:18:30] as Eileen mentioned, I didn't realize [1:18:32] that one stop was being replaced, [1:18:33] but I can, I can send you the link for, it's just ds nh.gov [1:18:38] and then one stop navigation [1:18:41] and there's a PDF there that'll show you how [1:18:43] to find what you're looking for. [1:18:44] So if you're ever looking for those notifications. [1:18:49] And then as Rick mentioned, there was a tree [1:18:52] that was blocking the trail at Broadview [1:18:55] that was taken care of by DPW. [1:18:57] And I followed up with Clint Havens about that [1:19:01] and he said that they were able to use it [1:19:02] as a training opportunity for some newer employees [1:19:06] who don't have as much experience with a chainsaw. [1:19:09] So that was a great win-win. [1:19:12] And that, and he, I just spoke with him today about, [1:19:15] he was asking no, didn't you have some work that we needed [1:19:17] to do at the ball property? [1:19:19] So they're waiting in the wings ready to help us. Okay. [1:19:25] And, okay, so we had a request from [1:19:28] the main botanical gardens to collect seed [1:19:32] of four leaves milkweed at one [1:19:35] of our conservation properties. [1:19:37] I will not name the conservation property in public just [1:19:40] because this is like a rare and endangered species. [1:19:43] So we want to kind of protect it [1:19:48] and we'll actually I'll be having a conversation [1:19:51] with the women who are in charge of that project [1:19:56] to work out [1:19:58] how we can share about this on our social media [1:20:01] and actually publicize this great thing [1:20:04] without compromising the safety of the, of the plant there [1:20:10] Beth? There's more to that. [1:20:11] There is, yes. They're gonna tell about how they, [1:20:14] they put it in the seed bank and all that stuff. Yeah, [1:20:16] I think that's kind of cool. [1:20:17] So I have a letter here from them, which is, [1:20:23] I, I can read the whole thing. [1:20:25] I suppose I would probably be [1:20:27] No who part was that? [1:20:28] They're gonna, they, they catalog it [1:20:29] and they put it in like the National Seed Bank and [1:20:31] Yeah. [1:20:32] And stuff like that. So if it says if permission were [1:20:34] granted, seed would be grown in our propagation facility [1:20:36] and plants would be added to our sleepiest [1:20:38] conservation collection. [1:20:40] The living collection will conserve [1:20:42] and showcase salu of the diversity of milkweeds. [1:20:46] And so, and it will serve as an [1:20:49] XC two conservation planting. [1:20:51] So that's like when they take it away from the place [1:20:54] where it's naturally growing [1:20:55] and just kind of like conserve it in, you know, [1:20:58] in like a botanical garden the way they're doing. [1:21:02] Yeah. So they're gonna collect seed and, and propagate it [1:21:05] and help further the species [1:21:07] And then the supply us with the report of it, of, [1:21:10] of the process and stuff like that. [1:21:11] Right. Is that at the end of the letter? [1:21:14] That is, yes. [1:21:18] We would be sure to follow up with an annual report [1:21:21] to document what plant material was collected [1:21:23] and any additional information you would like. [1:21:25] So that's that part of that. [1:21:26] Any additional information you would like is part of [1:21:29] what we'll be discussing this coming Thursday. [1:21:32] Yeah, and that'll, we can, well that that'll, we will put [1:21:35] that information in with that property. [1:21:37] So we'll have it kind [1:21:38] of in perpetuity, which is kind of cool. I like that. [1:21:41] Yep. Okay, [1:21:44] so we have a request from a resident who wants [1:21:48] to do a metal detecting at Broadview [1:21:50] and reached out to Counselor Foot who reached out to [1:21:55] Mike Fowler to ask, you know, [1:21:58] what are there rules around this? [1:22:00] And, and do, can we make some rules around this? [1:22:04] So per the town administrator, [1:22:07] the town does not have a formal policy on metal [1:22:10] detecting on town property. [1:22:12] And DCC has every right to create a policy [1:22:17] about that if they would like to. [1:22:20] So my concern about this is when, when it came in, [1:22:23] I originally thought that this is just a person [1:22:25] that's gonna do some metal detecting. [1:22:26] We wanna make sure he is not going to [1:22:29] dig a big hole and return. [1:22:32] One of the things that I thought of was first [1:22:33] as we find something of, of value, either historic [1:22:38] or monetary, who does it belong to? [1:22:39] And then as I thought more about it, [1:22:44] there's probably some eyes on this. [1:22:47] So when we, when we tell this this person what he can [1:22:50] and can't do at our properties, I'm guessing he belongs [1:22:54] to some association of other people that do metal detecting [1:22:57] and that information will get shared. [1:22:59] And so as a catalyst, [1:23:01] I think we should probably develop a policy [1:23:04] and I thought that Bob probably knows, knows [1:23:06] that maybe the state already has a policy [1:23:08] or something like that on metal detecting on state lands. [1:23:11] So I asked Beth to reach out to Bob [1:23:14] and we should adopt, you know, this is an opportunity for us [1:23:18] to adopt some regulations around this. [1:23:21] I think metal detecting is becoming more and more popular. [1:23:24] We don't want people digging giant holes on our properties. [1:23:27] So we, and there's a, what's it called? [1:23:32] The custody rule of, of what's found on the property? [1:23:35] Oh yeah, there's, you know, there's probably some sort of, [1:23:38] there's, there's gotta be some language. [1:23:39] So I'm not, I don't want [1:23:41] to get into it tonight at this meeting, [1:23:42] but I've asked Beth to talk to you [1:23:45] and find out what the state Yeah. [1:23:46] What the state's doing. And then we will bring [1:23:48] that up at the next meeting. [1:23:50] I think to reply to this gentleman, Beth, [1:23:54] maybe we can say we're, we're in the process [1:23:56] of adopting some rules on what's allowed [1:23:58] and as soon as we've adopted those rules, we will give them [1:24:01] to you and, and something like that. [1:24:04] Sound good? Yeah. [1:24:07] Okay. Okay. [1:24:09] Thanks. And then, let's see, we do have, so [1:24:14] I met with the stakeholders involved in the Ashley Drive [1:24:19] easement and we discussed [1:24:22] and agreed upon some language for the [1:24:27] conservation easement that, which [1:24:30] does not have public access, if you remember there. [1:24:33] Or it has public access with permission [1:24:36] of the conservation commission only. [1:24:38] So there's that provision in there, [1:24:41] but we wanted to make sure that it was clearly posted so [1:24:45] that people know, you know, what they are [1:24:47] and are not allowed to do. [1:24:48] So the language for the sign that we came up with [1:24:51] that you can all, you know, discuss is [1:24:57] restricted conservation area [1:25:00] and then a new line, no public access, new line contact, [1:25:05] dairy conservation commission, new line [1:25:07] and then the town phone number. [1:25:10] So I didn't love that, that sign that they came up with. [1:25:13] So I had a suggestion that I'd like to share with you guys. [1:25:18] So where it says no public access, I wanted it to change it [1:25:22] to no public access [1:25:26] without authorization. [1:25:28] And then under that, every conservation commission and the, [1:25:31] and the number, how does that sound to people? [1:25:35] Yeah, so so the way it would work is we would vote on [1:25:38] that tonight, send it back to the stakeholders [1:25:42] and they're either gonna accept it or not accept it. [1:25:44] I think they probably will. [1:25:47] I thought they didn't want public access. [1:25:48] That's what I, that's [1:25:50] what I away from that meeting we had with [1:25:52] Them. [1:25:53] Yeah, they don't But we got a carve out. [1:25:55] Did we? We Did. Okay. Yeah. Yeah. [1:25:57] We got a carve out that with authorization [1:26:01] that we would have access. [1:26:03] Yeah. You remember that? [1:26:04] That was kinda late in the game. I, [1:26:06] Yeah, I didn't, I didn't remember that. It [1:26:07] Was the last one call. [1:26:08] Yeah, it was the last thing and it was, it was sticky. [1:26:10] They didn't want to grant it, but I think [1:26:12] but I, I, I think we, we wanted it so we got it. [1:26:15] We did. Yeah. [1:26:16] So I think we should, it's still gonna say no public assets [1:26:19] without authorization. [1:26:20] So people walk up to the sign, [1:26:22] they know they can't just walk in without calling first and, [1:26:25] and we did reserve it more [1:26:28] for like educational purposes Yes. [1:26:29] And stuff like that. Okay. So no one's gonna research, [1:26:32] no one's gonna be playing paintball back there, but, [1:26:35] But it doesn't preclude that possibility. [1:26:37] If that comes up. It doesn't, that leaves that open. But [1:26:40] We have to authorize it. [1:26:41] But it will, it will allow perhaps more [1:26:44] If we want to authorize It public access than just fish [1:26:48] and game and the DES which were the only other [1:26:53] entities that were allowed on [1:26:54] The property. [1:26:55] So this is what I envision, I envision UNH comes to us [1:26:58] and says, hey, we want to do a wildlife study on [1:27:01] that conservation property in the present [1:27:04] form. It would be excluded. [1:27:06] Right, exactly. And [1:27:08] That's what I was kind of against. [1:27:09] Right? Right. Yes. It was so restrictive. Exactly. [1:27:12] And the way that we, we got it set up, we can then [1:27:15] authorize that and that happens. [1:27:18] We do the fur bearing studies. [1:27:19] We do, we do studies like that. [1:27:20] Yeah. The photography with the cameras. Yep. [1:27:23] Right. So I, I'd like to have a vote tonight that we [1:27:27] send back their recommendation with our added language [1:27:32] of quotes with our authorization [1:27:36] and see how that flies with the other stakeholders. [1:27:38] So I'll take a motion on that if everyone likes that. [1:27:41] Like to hear that motion [1:27:43] Move to approve the signage changes for Ashley Drive. [1:27:47] Second. Alright, so we have a first [1:27:49] and a second to add without authorization. [1:27:54] All those in favor say aye. Aye. [1:27:56] Aye. Aye. Opposed? Abstentions. So motion carries. [1:28:00] So Beth, you can communicate that back to the stakeholders. [1:28:03] Okay. Thank you. [1:28:06] Alright, so the land [1:28:08] and water conservation fund [1:28:11] did a visit at the four properties [1:28:14] that they hold an interest in in dairy. [1:28:17] So that is Coal Marsh, Cornelius [1:28:20] and Weber Forest and Doolittle. [1:28:23] And they said generally we're doing a great job. [1:28:27] So that was good. And there were just a couple [1:28:30] of things like some potential yard waste at Doolittle [1:28:36] and the trail goes through like the Abutters property [1:28:39] at Doolittle rather than like straight down [1:28:43] on just the, the town property. [1:28:45] So that's something that we'll have to address. [1:28:48] And there was some evidence [1:28:50] of recent a TV use at Weber Forest [1:28:54] and then the posted signs that were at Cornelius [1:28:57] and which have been taken down. [1:29:00] But that was also an issue. [1:29:02] But, but all in all, [1:29:06] good job from them. [1:29:10] And let's see, the Cub Scouts [1:29:15] who had reached out about using the campsite at Broadview, [1:29:18] they did a cleanup there. [1:29:20] They cleaned out some of the like metal [1:29:24] and things from the flags [1:29:25] that was in the fire pit from when they [1:29:27] burned the flags there. [1:29:28] Oh, nice. Yeah. [1:29:31] And I did reach out to, so parks [1:29:34] and Rec has discontinued mowing the center path at view [1:29:38] based on your vote at the last meeting. [1:29:42] And we have [1:29:47] one vote and then potentially a discussion. [1:29:51] So the covenant at broad view, I had emailed that [1:29:53] to everybody and if you had a chance to review it, [1:29:57] I'm not sure if tonight is the right night to discuss that, [1:30:00] but that's just still on our docket as far [1:30:02] as discussing the Broadview covenant. [1:30:08] And then you all need to vote to accept a check from [1:30:12] the N-H-A-C-C, which was reimbursement [1:30:15] for some expenses at the BioBlitz. [1:30:20] We got We have that on. [1:30:21] We're gonna put that up on other business. [1:30:23] Oh, okay. Once you're done. Yeah. [1:30:24] Okay, great. I'm done. That was my, that was my last [1:30:27] Two things. [1:30:28] Do you think we're ready to adopt that easement? [1:30:30] Everyone Everyone get a chance to read the easement? Yes. [1:30:35] We have enough people to, is everyone that did read it? [1:30:38] Did they like it? Not enough. [1:30:42] You want to, you wanna have a homework assignment [1:30:44] and we'll bring it up at the next meeting? [1:30:45] Yeah, I think so. Alright. Homework assignment. [1:30:46] Read the easement. We're [1:30:47] gonna bring it up at the next meeting. [1:30:52] Thank you Beth [1:30:53] for the land manager report administrative business. [1:30:55] We have a vacancy as for a full member. [1:30:58] And Linda has shown interest to become, [1:31:01] to go from being an alternate to being a full member. [1:31:05] So Mr. Foote, can you bring that forward at the council? [1:31:09] How do, how do, what do you need from us in order to [1:31:11] move Linda from being an alternate to being a full, [1:31:14] She has to put an application in with Sheila. [1:31:16] Okay. And then it'll come [1:31:17] before our next council meeting, [1:31:19] which if you get it in this week, it'll be September 1st. [1:31:22] Okay. And then we can vote on it then. [1:31:24] Alright. So Linda, you can do that right online? [1:31:25] Yeah, yeah. Just do it online and then Yeah. [1:31:28] You know that we are, we're on board with that, so. Yep. [1:31:32] Sheila will ask me anyways, but [1:31:33] Yeah, so yeah, she'll reach out to you for Right. Your, [1:31:36] Okay. [1:31:37] So do you know how to, you know what to do with that? [1:31:39] Yes, I do. Okay. And that opens up a seat [1:31:41] for an alternate for us again. [1:31:43] So we have a vacancy. [1:31:44] So any commissioner here that has someone that thinks [1:31:48] they would be a good fit in our commission, [1:31:51] please let them know that we have a seat open, [1:31:52] which is a cherished seat in this, in this town. [1:31:56] We, we actually already had someone reach out, out asking [1:31:59] if she could apply to be, [1:32:01] and I said I had to say, you know, that we were full. [1:32:03] So you want read back? [1:32:04] I did plan on reaching back out to her. [1:32:06] Yeah. So we'll reach out. We have, [1:32:07] we have a wait list. I was just [1:32:08] Say this is actually, This is one of the better well [1:32:11] Times for this committee. [1:32:12] Yeah. Being full and, and people Yeah. [1:32:14] We had, we had get chairs [1:32:16] be that I had to get chairs early. [1:32:17] I don't ever remember having to get chairs. Yeah. [1:32:20] So we'll, we'll go to our wait list, Charlie. [1:32:23] And that's 'cause we're busy, right? We are busy. [1:32:26] Good stuff. Okay, so we're gonna move Linda up. [1:32:30] We have a vacancy. Next meeting is September 21st [1:32:35] because the regular Monday is Labor Day. [1:32:38] So we're not meeting on Labor Day. [1:32:41] We have proposed meetings on 10/5 and 10/19. [1:32:45] Neither of those conflict with what's, what's our, [1:32:48] what's the, what's the October holiday? [1:32:51] Columbus. Columbus Day on the next [1:32:52] Week. [1:32:53] 12th. 11th. 12th [1:32:56] Specific. [1:32:57] So we're okay with those two? Yes. [1:33:01] Yep. Okay. All right. So everybody get those on their [1:33:03] calendar 'cause we're gonna start getting busy again. [1:33:06] Columbus day is the 12th. Monday the 12th. Okay, [1:33:08] Good. [1:33:09] So we have one, but before and [1:33:10] after I didn't report [1:33:14] out on land acquisition. [1:33:15] We, we are gonna have a non non-public. [1:33:18] But the one thing that we are working on, [1:33:20] on land acquisition is Beth [1:33:22] and I have a first draft on a letter [1:33:26] that we're gonna be sending to landowners [1:33:30] soliciting property. [1:33:32] So that's gonna be kind of our winter project. [1:33:36] We're gonna be sending solicitation letters to [1:33:40] larger apostles in town explaining the benefits [1:33:45] of land conservation. [1:33:46] And we have a, a first draft on that now. [1:33:49] We'll, we'll keep tweaking that [1:33:51] and then we'll bring it to the commission for approval [1:33:54] before we start using it. [1:33:58] Next other business we have Mr. Metz [1:34:02] Move to move to accept a check in the amount of $260 [1:34:06] and 85 cents from the New Hampshire Association [1:34:09] of Conservation Commissions as reimbursement [1:34:13] for the BioBlitz day. [1:34:15] Is there a second? Second. Second. [1:34:18] Second. By Jay Ann. Cheryl. All those in favor say aye. [1:34:23] Aye. Aye. Opposed? Abstentions. Motion carries. [1:34:27] That goes to Eileen. Yep. Coming way Eileen. Yep. [1:34:32] We like checks, we like bigger [1:34:35] Checks, but that one will, That will too. [1:34:38] Any other business from the commissioners? [1:34:40] Anyone need to talk about is the foot, [1:34:43] Sorry, I just wanna backtrack on the open position. [1:34:46] So for housekeeping issues, so Val would have [1:34:51] to put a letter of resignation in that would've [1:34:53] to be forwarded then that goes in the consent [1:34:55] with the counsel at the meeting. [1:34:57] We'd have to accept the resignation [1:34:58] before that position would then become she didn't [1:35:01] She not cc you on that? I told her to. [1:35:03] I didn't have it. No. Okay. [1:35:05] I'll send she her to CC you on [1:35:07] That one. [1:35:08] Yeah. Then I'll have to go to she. [1:35:08] So send it to me and Sheila. Sheila. [1:35:11] And so I'll forward it. I'll, [1:35:12] she sent it to me. I'll forward it to you. Yep. [1:35:13] And then it'll go on the consents agenda. [1:35:16] The council will vote to accept the resignation [1:35:18] and then that will create the opening. [1:35:20] Okay. Good. So just an FYI. So, [1:35:22] So while, while we're doing that, you can do RN [1:35:24] and then it'll all work out. [1:35:26] Yeah. Any other, other business? [1:35:29] Yes, ahead Jay. Hi. [1:35:30] First, first of all, now that the broad Broadview annex [1:35:35] has a subcommittee, I'm requesting [1:35:37] that we actually put it under the Yes. [1:35:40] Committee and liaison reports [1:35:42] and the agenda as I usually have been coming in under [1:35:45] other business, but [1:35:47] Okay. [1:35:48] Think of could We do that? [1:35:49] Yes. I have several changes [1:35:50] to the agenda subcommittee lines that [1:35:53] Be thinking it'll make things run [1:35:54] smoother, including that. [1:35:55] I just wanted to talk about the recent [1:36:00] plans for the Broadview annex. [1:36:03] That is to mo I came to Beth last week saying we need [1:36:08] to really do the be late [1:36:13] summer fall mowing that is allowed by the [1:36:18] RSA 4 82 A [1:36:20] and E-M-V-W-T 100 900 rules, [1:36:25] which it does allow for mowing doing dry conditions. [1:36:30] Right now. It's since June. [1:36:32] The land is totally inaccessible. [1:36:35] You'd need a machete [1:36:36] and you know, who knows [1:36:39] how many elephants are in the grass there. [1:36:40] They're so long. [1:36:42] But, so we haven't been out there to observe. [1:36:45] So I had, what Beth [1:36:49] and I agreed to is I proposed on the map of the, [1:36:54] the pro the property two paths [1:37:00] converged from the access off of Young Road. [1:37:05] And that since Matt Tar from UNH is coming out in late [1:37:09] September that he would be able [1:37:11] to take a look at at this map [1:37:14] and just get his input on that. [1:37:17] It's all good with the timing [1:37:18] of when we wanna mow Anyhow. So [1:37:20] Before we mow, we want, we wanna talk to Matt [1:37:22] before we mow, is that what you're saying? [1:37:23] Yeah. Okay. Just a good, good idea. [1:37:25] And then I just wanted to point out that, you know, we, [1:37:29] when I started this project, [1:37:31] and now we're a subcommittee, [1:37:32] I've already been doing a management plan [1:37:35] as Eileen had mentioned, something we should all be doing. [1:37:40] So it's, it was a good idea. [1:37:42] All my thoughts needed to go someplace [1:37:45] or they'd go into the atmosphere and disappear. [1:37:49] So that's the latest for that. [1:37:51] So that will provide for early spring access. [1:37:55] And by then also the, we'll be able to plot out where, [1:38:00] where the paths should be more permanently. [1:38:04] And so that the critical time is [1:38:08] sometime in the early summer we need to get a mowing done. [1:38:12] It may require less heavy, [1:38:16] less heavy equipment. [1:38:18] You know, the, the mower [1:38:20] that does the paths on the broad view area may be used [1:38:25] for this annex area. [1:38:27] It's a hope and not, not fully understood yet. We'll see [1:38:33] Jay, who's on you're chair in that committee? [1:38:35] Who's on that committee with you? [1:38:36] Well, we have Christopher. Okay. [1:38:39] Yep. And Eileen. Yep. [1:38:41] Got it. Thank you. Okay. [1:38:45] Any, any other, other business? [1:38:49] If I could request, if anyone has any Trailhead photos, [1:38:53] they could email them to me. [1:38:54] I'd like to make sure we do some more posts. [1:38:56] Yeah, there's some interest from the general population of [1:39:00] what their favorite location is. [1:39:01] Just kind of engage more. Love that. [1:39:03] If anyone has anything like that, that'd be great. Did we, [1:39:06] Did we ever post that training thing with the DPW? [1:39:10] No. Let's do that Linda. Yep. [1:39:12] That, that's that training story from DPW and I heard it. [1:39:15] I loved it. So I think get with Beth [1:39:19] and talk about how that went down [1:39:22] and maybe we can even get some [1:39:24] files. That would be, you know, [1:39:25] Another suggestion I'd make is quite, quite [1:39:29] Often. One [1:39:30] Second. [1:39:31] N-H-A-C-C does newsletters that involve [1:39:33] what different commissions have done interacting, you know, [1:39:36] within their towns with other committees [1:39:38] and other departments. [1:39:40] And I think that'd be a great story to send [1:39:42] to Barbara Richter for dare [1:39:44] to get in one of those newsletters. [1:39:46] So that shared with the whole state [1:39:48] and all the, all the other towns in the, [1:39:51] Like do you have a picture of that tree that they, [1:39:53] that was crossing the path? [1:39:55] I Do. Okay, cool. Yep. So, so maybe the post can [1:39:57] Be, I just got the before and after pictures. Yeah. [1:39:59] Oh, you have before and after? [1:40:00] I do. Yeah. Well I have before pictures [1:40:02] 'cause I had to take pictures is the feeling. [1:40:04] Oh, there's a tree in the trail. [1:40:05] Yeah, let's do that post that they took the tree down, [1:40:07] used as a training off for the town and all that stuff. [1:40:09] I think that would be a, that would be a cool post. [1:40:11] And then Eileen's comment about did we post on the BioBlitz? [1:40:16] I did we post on the bio bl like we [1:40:20] shared about the BioBlitz? [1:40:21] Yes. On Facebook you mean, but you mean to N-H-A-C-C? [1:40:25] No, to our, our, yes. Yeah, we did. [1:40:27] Okay, so let's do, let's do one on, [1:40:29] on the, on the tree thing. [1:40:31] Sure. Thank you. Yeah. [1:40:32] And then Eileen's suggestion is really good. [1:40:36] Yeah. 'cause I, I think it, you know, I, what I love about [1:40:38] that newsletter, it quite often has stories that are shared [1:40:43] for the purpose of other towns to be able to kind of grab [1:40:48] that information and go with that kind [1:40:50] of project in their town, you know, so it's sort [1:40:53] of a replication kind of thing. [1:40:56] You know, towns learn from each other that way. So, [1:41:00] Okay. [1:41:01] If we are done, we are gonna have a, [1:41:04] we're gonna be done by nine. [1:41:06] We are gonna have a non-public, [1:41:07] it's gonna be fairly brief and Mr. [1:41:10] Mets gonna take it away. [1:41:12] Move to go into non-public session per RSA 91. [1:41:15] A three sec. [1:41:16] Section two for the purpose of land acquisition. [1:41:20] Second. Alright, so we have a first [1:41:23] to go into non-public by Mr. [1:41:25] Metz. A second by Cheryl. We need a roll call Vote on this. [1:41:29] Starting to my right? Yes, [1:41:33] yes, yes, yes, [1:41:35] Yes, yes, yes. [1:41:39] Chair votes. Yes. We need a motion to invite, [1:41:45] let's see, we have to invite Catherine. [1:41:47] We have to invite Pam. [1:41:49] We have to invite Charlie if he wants to stay. [1:41:51] We have to invite Beth if she wants to stay. [1:41:53] Do you wanna stay? Sure. Okay. [1:41:56] So I think you can do that all at once. Right? Okay. [1:41:59] Move to, move to invite all those members mentioned. [1:42:02] All right. So as a first, is there a second? Second. [1:42:06] Second by Cheryl. Is that a roll call Charlie? Yeah. [1:42:09] Alright. Roll call again. Yes. Yes, yes, yes, [1:42:13] Yes, yes, yes. [1:42:15] Chair votes? Yes. Okay. [1:42:20] We're non-public Good. We're non-public. [1:42:22] Let us know when we're ready. Owen.
