[0:00] Larry, let's let's try that again. People on YouTube. [0:03] » This conditional use permit was originally issued in 2015. This is going [0:08] to be an amended conditional use permit. Actually, what's going to happen when we [0:13] record this is we're going to resend the 2015 conditional use permit. And then [0:18] this will be the controlling conditional use permit for that property. [0:23] Basically, uh, right now the, uh, conditional use permit has a house, a [0:27] two-story garage with living quarters, a maintenance building with two living [0:32] quarters for on-site caretakers, and then the original one had a meeting and [0:37] entertainment center with six bedrooms. The new amended conditional use permit [0:41] will change number four to a twounit, 8-bedroom guest quarter structure. [0:48] So that that will replace the meeting and entertainment center which was never [0:51] built. >> So we're recommending approval of the [0:55] revised conditional use permit subject to the following conditions. [1:00] One, that the project be constructed generally as shown on the approved site [1:04] plan. Two, that the owner obtain a land disturbance permit from the city prior [1:08] to issuance of a building permit. Three, that the owner obtain a Pelican River [1:13] watershed district permit prior to issuance of a building permit. and four, [1:17] that the facilities are for personal use of the property owner and his guests and [1:21] cannot be rented or leased at any time. And if you read through the application [1:25] packet, they made that clear that that was their intention. [1:29] And they provided a lot of detailed information in the application. [1:36] All right. Uh at this time, I go ahead and open it up for a public comment if [1:40] someone wants to any of you would like to address the commission. [1:49] If you could state your name and address just for the record. Sure. [1:52] » I'm Jesse Umall. My address is 30349 Wrigley Circle in Verus. I am the [1:57] director of residential properties for the Thoraldsons. I've been on the [2:00] property since 1998. So I've seen all of the transitions that we brought before [2:05] you before. Um I was with on the last conditional use permit for Mr. Brandt. [2:11] Um and thes feel that what Ace had put together um his meeting entertainment [2:18] center didn't meet the needs of their family. Um so that's why we went and put [2:23] together a new drawing um for this private residence um for them to meet [2:29] their family's needs. The property was never [2:33] developed for a family. It was more developed for entertainment for one [2:37] person. >> So this family has seven children. We [2:41] have 13 grandchildren, more on the way. So, the bedroom space doesn't even um [2:46] exist for what we need to meet the family's need. Um this house is in a [2:50] trust and their intention is that this gets passed on for generations. So, that [2:54] is why we'd like to come forward and change the change the permit um to this [3:00] new structure. um for the previous conditional use permit, we [3:07] » upgraded our storm water plan to have this structure. So, our our building [3:12] site is already ready for this structure. We just never were able to [3:16] achieve it because Mr. Brandt had passed away. [3:19] » And I'd be happy to answer any questions from the packet that we submitted um to [3:23] you um about the project or the property itself. [3:27] » Okay. We'll let you know if we have any questions. [3:30] » Thank you. Any other public comments? [3:35] All right, seeing none, we'll go ahead and uh close the public hearing and I'm [3:39] going to open it up to the commission for a discussion [3:43] or a motion. [3:47] » Do do most conditional ones have Oh, fine. [3:52] Do you have to have time limits on how long your conditional use permit is [3:56] allowed? They have one year to utilize the [4:01] permit. So they would have to get a building permit for this project prior [4:04] to a oneyear elapse. >> Okay. [4:08] » Okay. Any other questions or discussion? [4:14] » I would make a motion to approve the conditional use permit with the um uh [4:20] restrictions or the guidance from the um staff. [4:24] » I'll second. >> All right. We have a motion and a second [4:26] to approve the conditional use permit using staff recommendations. Any further [4:33] discussion on the motion hearing? None. All those in favor say I. [4:36] » I. Opposed. Same sign. Okay. So, where this will go from here? Uh, this will go [4:42] to the community development committee coming up on Monday the [4:48] » shoot. 9th. Thank you. I was I was thinking 10th, but I know that's the [4:52] city council meeting. Uh so that'll be at 5:00 in that room back there. You [4:57] don't have to be there. You're welcome to be there. Then that then the uh the [5:00] community development committee will discuss and then that'll come to a vote [5:04] at the city council at 5:00 p.m. in these chambers on Tuesday the 10th and [5:08] that's where we'll actually take the action on it, the final action. But this [5:12] recommendation uh will carry forward to the community development committee. All [5:16] right. Any questions? All right. Thanks for being here. [5:20] » Yeah, absolutely. Um, all right. I'm going to without objection, I'm going to [5:24] go ahead and move item uh go to item 4B uh consideration to the final plat of [5:30] Providence Lakes at 1141 US Highway 59. Larry, [5:37] » this is for the 40 unit conditional use permit. [5:39] » You have to abstain. >> Yes. [5:41] » Well, then we can't take action. >> You can once you have a quorum. [5:45] » Oh, >> it still stays intact even if somebody [5:48] » Okay. >> Sweet. [5:50] with that. I forgot about that. Thank you, Larry. [5:53] » Yep. >> So, this is for common interest [5:57] community number 113, Providence Lakes. It's a 40 unit town home development, [6:03] and staff is recommending final plat approval subject to the following four [6:08] conditions. One, that the owner obtain any required Pelican River Watershed [6:12] District permit prior to issuance of a building permit. Two, that the owner [6:17] obtain a land disturbance permit from the city prior to the issuance of any [6:21] building permit. Three, that the owner provide a common interest community [6:26] declaration that is acceptable to the city prior to the city signing the final [6:30] plat. And that the owner provide a utility easement acceptable to the city [6:34] prior to the city signing the final plat. [6:38] There's been a lot of work going on with the city attorney on that regard and I [6:42] think they've come very close to getting the declarations and the easements [6:47] signed. So, we're we're close. [6:52] » I don't think that's in our packet. >> No, [6:54] » the the your recommendations I do not believe are in our packet. [6:57] » I'm sorry. I didn't get the uh staff report ready, but I did get a resolution [7:02] ready for the council. So, that's where those [7:04] » Okay. >> conditions came from. Okay. [7:08] Uh discussion or a motion from >> I just wanted to clarify [7:16] that I mean this is the has this been changed from the original [7:21] plan? >> The original the original conditional [7:24] use permit and plant had 48 units. >> Right. [7:27] » So they have paired it down to make everything fit. So, [7:31] » and if I remember correctly, they were um [7:35] like 24 buildings with two units in each building. So, is that changed correct? [7:40] » That has changed. It's now 20 buildings with 40 units. [7:44] » 20 buildings with >> 40 units. [7:47] » Okay. [7:53] » Did the MDOT stuff get figured out then? >> The access did get figured out. Yes. [8:00] They ended up having to put a a bypass lane in, didn't they? [8:03] » Yes, correct. >> There is going to be a bypass lane. [8:06] » There will be a bypass lane. [8:12] » So, basically everything that the city kind of wanted them to achieve has been [8:16] achieved. >> They're doing they're doing everything [8:18] that we've been asking them to do. >> Okay. [8:22] I'd make a motion to approve per all the things on that paper that we [8:28] don't have in our packet with their >> following the city's staff [8:31] recommendations. >> Staff recommendations. [8:34] » I'll second that. >> All right. We have a motion in a second [8:37] to approve the final plat for Providence Lakes at 1141 US Highway 59 with the [8:45] city's uh word I'm looking for now. It's been a [8:51] long day with the city's uh uh conditions. Thank you. [8:55] » Uh any further discussion on the motion? >> Hearing none. All in favor say I. [9:00] » I. I. >> Post. Same sign. Motion carries. All [9:03] right, Scott. Same same drill. We'll go through the CDC on the 9th and then city [9:08] council on the 10th. >> Thank you. [9:10] » All right. Thanks for being here. All right, let's go ahead and jump to 4A. [9:14] Weber Ford revised site plan. >> That's not in the package. So Weber Ford [9:19] has decided that instead of a one bay car wash, they're going to have two car [9:23] wash bays. >> So their site plan has changed. And if [9:26] you look at the north end of it, you can see the two car wash bays instead of [9:30] one. And that's the only significant change on the whole site plan. [9:35] » I'm sorry, Larry, I didn't hear you. >> Weber Ford is changing their site plan [9:40] because they're adding a second car wash bay. So they need us to approve their [9:44] revised site plan. And if you look at the north end of the building, you can [9:49] see that there's two bays of car wash there instead of just one like the [9:53] original plan head. >> H [9:56] » doesn't expand the footprint much. >> I'm it does not just a very modest [10:01] change. >> Uh I don't see any staff recommendations [10:05] in our packet. Staff is recommending approval of the [10:10] changed site plan for for Weber Ford >> with no different conditions. [10:16] » No other conditions. This is just for the planning [10:21] commission. This won't go to the council. The planning commission needs [10:23] to approve the site plan. >> Gotcha. [10:28] » All right. Any discussion or I'd entertain a motion? [10:33] I'll make a motion to approve the revised site plan. [10:37] » Second. >> All right. We have a motion in a second [10:39] to approve the revised site plan for Weber Ford adding a second uh car wash [10:44] bay. Any discussion on the motion? Hearing none. All in favor say I. [10:48] » I. Post. Same sign. Motion carries. Okay. Um does anybody have anything they [10:54] would like to bring up for the variance or conditional use status report? [11:02] Liz isn't here, so it sounds like we don't. [11:04] » I know. >> And then Larry, was there anything else [11:07] that you had? I >> am going to talk about planning [11:10] commissioner training. If you haven't noticed, you should have an email from [11:14] the League of Cities telling you about a planning commissioner training course [11:18] called uh your role in land use decisionmaking. So, [11:23] » who was that sent by? >> League of Minnesota cities. [11:29] So, if you don't have that, you'll be getting that and you need to go and log [11:32] in and take the course. It's a one-hour course and we will be discussing it at [11:37] the March Planning Commission meeting. [11:43] » I don't. [11:48] » It should be in your city email either yesterday or the day before that. [11:54] If you don't have it, let us know and we'll try and get you access to [11:58] » just the uh came it looks like it came it's from seismic learning no reply at [12:02] seismic.com. >> Okay. [12:04] » And then it says you have on a new account on our learning platform and [12:08] have been assigned land use regulation your role in land use decisionmaking. [12:13] » And then it gives you the link to either [12:18] should have come to our personal emails. your city. [12:21] » Your city email. >> I don't have one of those. [12:24] » I don't access that at all. >> I have one. [12:27] » I did not know I had one. >> Okay. So, you have two tasks before the [12:31] March meeting. One is to call IT support and get access to your city email and [12:35] then >> I used to have an iPad, but I it was so [12:38] complicated because it wasn't >> it wasn't an iPad. It was [12:41] » Oh my gosh. No. >> I think they gave them out like last [12:45] fall. >> They did. I I'll be upfront. I didn't [12:47] really start using mine until I until I was on the city council. even though I [12:50] had it and then I had a real reason but now Larry's giving us a real reason. [12:55] » I just email is that good or bad >> to have the emails depends on your [12:59] perspective >> change from the city email to personal [13:02] email. >> Um the city prefers that they're in the [13:05] city email so you can control what's coming in and going out of those emails. [13:10] » It's probably wise that you segregate those things too. [13:14] » I need to have a re a course on getting >> by all means Dylan. I was looking at [13:18] you. >> What can they do? Can they come in? [13:20] » So, you could either come in and meet with Dwayne Krauss. He's our IT guy. Or [13:26] I can give you his phone number. >> Well, I mean, I know I had it, but when [13:30] I turned in the iPad or the pad >> I stopped using it. [13:34] » If you want to give him a call, I'll give you his phone number. It's [13:37] 21846142. [13:42] And that's his direct [13:50] and he's a nice guy. >> He's a really nice guy. [13:56] » He'll go out of his way to make sure that you've got what you need. [13:59] » Blame. >> So, Dylan, would you mind giving us a [14:03] quick overview on why we might want to use our city accounts instead of [14:07] personal accounts for this business? >> Absolutely. So, uh just a kind of quick [14:12] and dirty is there's a thing called the data practice act. Um if somebody makes [14:16] a data practice act request um they are in that following a a litany [14:23] of rules they are able to access um information that would be city related. [14:29] If you keep city related material on your private email your private email [14:35] becomes accessible which means that if you have things on your private email [14:39] that maybe you don't want the world to see guess what it's now the world gets [14:43] to see. Um, >> ask Hillary, [14:47] » right? So, um, basically you want to keep your city stuff on a city email so [14:53] that your city email is ac gets when it gets accessed um, they get to see that. [15:00] Vice versa, you probably don't want your personal stuff on your city email [15:03] because then your city email is accessible to the public and the public [15:09] gets to see whatever personal stuff you have on your city email as well. Now, I [15:13] will tell you, you can get the Outlook client right on your phone and it work [15:18] functions just like Gmail or any of the others and use that for your city email [15:22] and that's all stays on the server. >> Well, that's where it was Outlook, but I [15:25] mean I never looked at it. >> Yeah, I just I have it on here and and [15:29] that's how I check my city email on the fly is is using that Outlook client and [15:33] it keeps it all on the server and through the city's stuff and that way [15:36] I'm not dealing with my personal stuff. There's also they can if you have it on [15:40] your phone, they can try to pull your phone into a court case too if it should [15:45] go that way your if it's your personal phone. So [15:49] » according to it, so just >> it's always a risk. [15:53] » Yep. >> There's a there's a there's a a balance [15:57] to be had there, right? >> What you're saying is best not to access [16:00] it from your phone. >> What she's saying is it's best not to [16:03] access it at all. Yeah, >> it it is best practice to keep doing [16:09] that's what I've been doing. >> It's best practice to keep it as [16:12] separate as as possible, but obviously you're not going to be able to separate [16:17] it entirely, right? You have to access your city email from something. Um and [16:24] uh you can theoretically, you know, an individual can theoretically try to make [16:29] an argument that because you accessed it from your personal phone or from your [16:32] personal laptop that the other material might be accessible, but your arguments [16:38] get a lot better. Your arguments are pretty good if you keep them separate. [16:43] » You know, which is why like that was one of the discussions that we had early on [16:47] was using that Outlook client actually does keep everything on the server. So, [16:51] it's it's a little harder to argue that I mean, it's not impossible, but it's a [16:56] little harder to argue that there was stuff being stored locally. [17:01] » Y, [17:04] » that makes sense. >> Okay. Anything else from the staff? [17:09] » Nothing else. >> Anything else from the lawyer? [17:12] » No. >> Anything from any of the commissioners? [17:17] » Sorry for being late. >> No worries. I'm happy you're here. You [17:20] don't need to be sorry. All right. Well, with that, we'll go ahead and call this [17:24] meeting adjourned. Thank you. >> Thank you, [17:26] » Larry. I got a question for you.
