Uh my company is 9 Square Design and I'm representing [4:21] Kyle Worm tonight on his project out at uh W1785 Lake Road. Um Kyle sends his [4:28] apologies. He wishes he could be here. He is on business in Nevada, so I'm [4:32] representing him by myself. Um so I guess I'll explain how this kind of [4:36] started. I don't want to get too longwinded, but we went into the zoning [4:40] um office for the county and um I had kind of a discovery meeting with Darren [4:45] and um we realized pretty quickly that we were within the deck is within the 75 [4:49] ft of the back um the the lake line or the shoreline. So, um I had to come up [4:55] with a solution that where we could possibly keep building and move on on [5:00] the project and treat the deck. Um I guess we decided to treat it as a [5:04] separate project so we could start building. So, I separated the two [5:08] projects. We got the permit on the house and we are underway for the construction [5:11] for the um the renovation of the main home right now. And we're just um kind [5:15] of hoping and waiting on the variance. What we're asking for is about two more [5:19] feet of deck toward the lake in the back. Right now, it's about a 5ft 10 [5:24] cantalvered deck that's in disrepair. Um doesn't meet code. I mean, the can lever [5:31] alone wouldn't meet modern codes, but the deck the railing is too uh short and [5:35] uh it's just in this repair. So, it would be we'd be replacing it either [5:38] way. Um and in this process, when I talked to Kyle, he was he wanted to do [5:44] uh the neighbor to the east, I don't know if we have that picture I sent, but [5:47] they have a twotory deck with a full covered roof that goes at the back. [5:50] That's what he originally had wanted, and that's the plan we brought down to [5:53] Darren to submit. And um we've had to uh ditch that plan. But when I t when I sat [5:59] Kyle down, we had a meeting. I got the heart of what he really wanted. I mean, [6:04] he wanted the big large decks, but really what he wanted was a nice a [6:08] bigger space to walk out onto. Um, a better deck, you know, better [6:15] condition and a cover. Um, a little more space and some cover. The sun, I guess, [6:21] just drenches them back there and it's almost unusable in some times of the [6:24] year, the summer months, obviously, when you want to use it the most. So, his [6:28] real concerns were um I forget um a place to go out from his master bedroom [6:32] to have a coffee in the morning or something small. So, the second story [6:35] deck that was proposed to be 8x 28 on the second story was way too big. So, we [6:41] essentially brought that into the master bedroom as a covered porch under the [6:44] main um you can see uh just behind and above the right there that's a small [6:50] 5x12 kind of a breakfast nook uh deck area, coffee area that satisfied that [6:55] requirement. So, we've essentially reduced it to one story with a cover and [6:59] hopefully we can gain that 2'2 in toward the lake. I think we're with we're at 65 [7:04] 63 ft right now. Um, and I guess if we don't get the variance, what we would [7:10] we'd be able to rebuild the deck as it is in the exact configuration with no [7:13] improvements, no cover, no larger size. Um, and I'd have to post it because we [7:18] can't can we cannot leave it can levered the way it is. So, something has to be [7:21] done. So, it's going to be tore off either way. Um, so that's kind of the [7:24] history and um, this is my first meeting for variance, so I apologize. So I [7:29] appreciate your guidance and um, guidance with me on this, but um, I [7:33] guess that's the long and short of what we're trying to trying to achieve. [7:38] And the lot itself is very I don't know if you've seen the plot. It's very one [7:42] at one spot he's 175 ft from the lake and then it hooks in and he's within [7:48] that's where he's 65 63 feet away. So, you know, 75 65 to 75% of the back lot [7:55] almost shoots straight out. It's just that weird shoreline that kind of makes [7:58] it difficult and um to achieve what we're trying to achieve. It's that short [8:02] distance that that curve. And as far as the neighbors, um the one to the east [8:07] has that twotory deck. They're out front of us by 16 ft. So, that's not going to [8:11] their views, nothing's going to hurt them. the the neighbors to the west who [8:15] have been more in communication with theirs around Elmore. They um verbally I [8:19] don't believe have had any issues with the deck that we're proposing and [8:23] they're they're the they're the opposite. They're further back. They're [8:26] quite a ways to the north. So, it isn't going to change much for them either. [8:30] And there's a large tree uh and that will be there forever. But, um I think [8:33] overall for the neighbors, it's not going to have too much of a [8:37] negative effect at all. and then watershed and items like that. We're [8:41] within all other um code compliance with the deck. It's just simply this one ask [8:46] of the the waterfront issue. [8:51] » I'm going to see how that scoop happens. >> And just to clarify right now with the [8:57] canal lever and everything, you're within that 75 ft setback. Um, I'm also [11:26] noting that there's almost a 30 foot elevation change between [11:34] lake level and ground level at the walk out basement. [11:39] So, there's there's a significant elevation change there that it can helps [11:43] with the sightelines. And if I could add to that's I'm glad you went up. Usable [11:47] space is difficult on this lot for the back. So, this is part of the usable [11:50] space. He's trying to get just a little bit, you know, cuz that's important. [11:53] most of it is is and they're going to do some retaining wall work next year, I [11:57] believe, and and do some changes. But that is difficult to deal with with just [12:00] entertainment and casual space. That's what he's trying to gain a little bit [12:04] more that way. But yeah, and certainly those conversations, you know, for [12:08] another time as far as disturbance within that 75 ft and structures. But [12:13] but yeah, I mean I you know talking amongst us here I um it's [12:21] it seems reasonable for uh what what's requested here tonight.
