[31:18] This is the first time that I'm here, and I don't want to make it about me, but I do
[31:23] just want to give you a little background that I did work in the utility end of electric
[31:29] and gas infrastructure here on Long Island.
[31:32] I was a first responder during Hurricane Sandy and quite a few other hurricanes that
[31:37] we've had here.
[31:38] So I know the need of this battery storage that's going on.
[31:44] And so I wanted to find out a little bit more about that and I just wanted to share a story
[31:49] about when I was bringing the crews in to get the electric back on.
[31:53] We would get to a neighborhood and people would come up to you and say, my mother is
[31:58] on life support, can we get the electric on?
[32:01] And because of the way that things were set up, it's like a big Christmas tree and you
[32:06] can't get this on until you get that on and that's a story.
[32:11] Since Hurricane Sandy, I still think about that, so it could be your mother, or it could
[32:16] be your daughter, or it could be a friend, it could be you.
[32:20] So I see the importance in it, and I just wanted to find out and see where we're at and where
[32:27] it's headed.
[32:29] And I appreciate the opportunity to speak.

[32:39] I understand you are in the process of formulating a best code and I appreciate
[32:44] Councilmember Cornrich leadership on that issue.
[32:48] Sure. All of my friends and family who live in Brookhaven feel an outright ban on lithium
[32:55] bests would be ideal. However, we know the state is preparing to bypass local
[33:01] zoning laws, especially those it deems unreasonably burdensome to state
[33:06] climate targets and California is on the same page.
[33:09] Interestingly, the best ordinance for the city of Vacaville, California mitigates that
[33:15] perceived unreasonable burden.
[33:18] It allows consideration of alternative battery technology.
[33:21] That technology must be proven safe and have no risk of thermal runaway.
[33:27] It is very comprehensive and specifically excludes lithium bests and if the state
[33:34] to override the exclusion there are significant protections for the
[33:39] community. My next point relates to the May 2023 best fire in East Hampton. In
[33:45] December that year Governor Huckle declared and I quote,
[33:48] thankfully the fire safety working group analysis shows no notable lasting
[33:52] impacts on the health or safety of the first responders or the communities
[33:56] they serve. I am submitting her press release along with a current Newsday
[34:01] article that paints a very, very different picture. Suffolk County Water Authority is
[34:07] suing the owners of that bus because at least two drinking water wells were found to be
[34:13] contaminated from fire suppression efforts. More than two million gallons of firefighting
[34:19] water over 30 hours were used and became toxic runoff. Understand that was a five
[34:26] megawatts. Those wells have been shut down and more need to be tested. Now there is a
[34:33] water supply and pressure issue. Remediating the disaster, including an
[34:38] underground toxic plume, will cost millions of dollars. There were no
[34:43] protections outlined for the community or its water supply in the East
[34:48] Hampton Best Ordinance. I asked the board to consider using the Vacaville
[34:53] ordinance which I am submitting as a guideline to protect the town of Babylon.
[34:58] Finally, the big industry talking point about these containerized systems is that a fire
[35:03] would not spread due to spacing between the units.
[35:07] Unfortunately, most best components, which can be remotely controlled, are imported,
[35:12] making these systems vulnerable to cyber attacks, so the idea that all containers
[35:17] cannot go on fire simultaneously is just wishful thinking.
[35:21] The reality is potentially a living nightmare.
[35:25] I submit to you a sobering article entitled,
[35:29] It's Time to Treat China's Connected Energy Systems
[35:31] as a National Security Risk.

[35:45] we always appreciate your insight
[35:47] and that which you bring to us,
[35:49] which is pioneering in the waste management space with regard to the battery energy storage
[35:55] systems. We find ourselves as land use authorities having to educate people on these issues because
[36:05] people come to us, we are the closest to the people outside of the village as it goes
[36:11] to levels of government because the state of New York quite simply is not doing their
[36:16] job. The town of Brookhaven does not enact energy policies, not for the federal government
[36:23] or the state government. And the East Hampton fire that was mentioned was actually a prior
[36:32] technology. It was a nickel magnesium technology. But the bigger fire that brought this to
[36:39] a head out in Moss Landing in California was an even different technology. And the
[36:45] The average person who hears these things, who care about their community, don't want
[36:50] to hear, this is the next, next, and the next, next, and there was a gasket that leaked up
[36:56] in Warwick, New York.
[36:58] The state needs to have some skin in the game in this space, and that is not from
[37:04] where they sit in Albany or elsewhere.
[37:07] They need to come down on ground level, meet with the local fire departments and
[37:13] And seriously consider alternatives to lithium ion that are zinc bromine batteries as a potential,
[37:23] I understand.
[37:24] The energy density is not the same as lithium ion, but the fact of the matter is it is
[37:30] the fires that are causing all of the consternation and well-placed consternation in the minds
[37:38] of the residents in every community.
[37:41] So it's incumbent on the state, NYSERDA and LIFA and those people who are in this space
[37:48] who I know are actively prodding these two entities to come down, meet with the local
[37:55] fire departments and be willing to have forums to explain this to people every day when
[38:03] when it comes to this new industry or emerging technology every day that Leipa and NYSERDA
[38:12] sit on their hands is a day lost because social media is certainly not getting out at times
[38:22] the most accurate alternatives like zinc and is really instilling in the minds of folks
[38:29] some very legitimate concerns when it comes to lithium ion so it's incumbent
[38:34] on the state in my opinion these two state agencies to do their jobs do not
[38:39] try to put your work on a town level of government we work hard to get people on
[38:46] the truth as it comes to the issue but we do not set energy policies and we
[38:51] have more than enough to do in this town and I know what I speak for the
[38:55] other supervisors in the county of Suffolk. So hopefully, people will seriously start
[39:03] to consider zinc as an alternative to lithium ion, and the state agencies will start doing
[39:09] their jobs. I'll turn it over to my colleagues.
[39:12] Supervisor, very quickly, this is a quintessential New York story. All we do is get mixed messages
[39:18] from all over New York. They either support it one day, they don't support it one day.
[39:22] this is a very proactive town, not a reactive town.
[39:26] We have approved different applications.
[39:28] We have some battery storage already in place that are on.
[39:32] But I would tell you, we get no support.
[39:36] We don't get, I think the companies themselves,
[39:40] the battery storage companies,
[39:41] need to do a much better job
[39:43] in getting out the message of safety.
[39:46] We've asked them constantly to work
[39:48] with different volunteer fire departments.
[39:50] Sometimes they come down,
[39:52] sometimes they don't and I agree with the supervisor it's not our job to carry
[39:58] their water and right now we're a little bit of a soulmate and we're tired of
[40:03] taking heat and until they do a better job we right now are not doing anything
[40:08] unfortunately so thank you all right any other questions or comments all
