[2:26] So, Tim, I'll turn some time to you. >> Thank you, Mayor. Uh [2:30] 2 weeks ago in our last meeting, I made a comment with regards to [2:34] the uh data that we have received in our packet. [2:38] And uh I just feel like I may have um overstepped my bounds a little bit. I [2:44] didn't mean to be derogatory. I didn't mean to uh offend anyone, in [2:50] particular the mayor or any of the city staff. I think you guys do a great job, [2:55] and I just did uh I wanted to apologize if there was any offense taken. [3:00] And uh I understand that uh a quick phone call and I could have gotten the [3:05] answers I needed. So, again, I apologize for any discomfort I [3:10] may have caused anyone. Thank you. [3:51] » See none, we'll move forward on the agenda to hear report hear a report from [3:55] the planning commission from uh Lou Best. [4:06] » We held no regular planning commission meeting. We had devoted our time to [4:10] uh a joint work session as most of you are aware with the city council. [4:15] In my view, I thought it was a very productive work session in which we were [4:18] discussing the L Advantage development. Um [4:22] new proposal was presented to us uh that added some additional insight from what [4:28] we've seen in the past. It included an elimination of townhouses [4:33] and adding more patio homes. Uh the number of units was reduced to [4:37] 386. They also added a 2-acre city park [4:42] nestled right in the middle of where the the town home or patio homes will be. [4:47] Uh we discussed several items. We discussed traffic called calming [4:50] measures and there was general good consensus that a four-way stop on 1300 [4:56] North would be very appropriate. It would help a great deal to to control [5:00] the traffic. Uh we also discussed adding a parking [5:05] area for the naturescape playground area just off [5:09] 1025 North. Seemed to be good agreement on that. [5:13] Uh we wanted to make sure that the configuration of the lots under the [5:16] power line conformed with all requirements by uh Rocky Mountain Power. [5:21] Um we also discussed setback requirements for lots of various sizes. [5:27] And I think we can come up with a plan where we can accommodate the smaller [5:31] high-density lots as well as retain setbacks are very similar to what we [5:35] have right now in R-115. By far the greatest concern and the most [5:41] of the discussion focused on traffic on 1300 North. [5:46] Um and what that would pop problem that [5:49] would occur if we did not have a traffic light on that street. [5:55] The options ranged from everything from don't allow the development until a [6:00] traffic light is installed to allow the traffic light allow the [6:06] development to occur and hope and pray that a traffic light will be installed. [6:11] And there were some intermediate suggestions as well. Uh [6:15] the mayor may comment on that, but we left it at there's going to be [6:18] additional dialogue with UDot to see if we can come to some kind of a [6:23] an arrangement or some hint as to what we could anticipate in [6:28] the future so that we can proceed with our decision on this development. [6:32] Um >> Can I ask you something on that one? [6:35] » Yes. >> Um can we require to have them perform a [6:39] traffic circulation study so we have an accurate idea of what those counts will [6:45] be? >> That was brought up. Can somebody with a [6:48] better memory than me talk comment on where we ended up with that? [6:52] » Yeah, well you were there too. I can comment, [6:54] but go ahead. >> Well, [6:57] they did say they would approach UDot about this right from the onset [7:02] uh and consider the [7:06] uh density of this development [7:09] also in concert with Legends that those two are going to funnel into [7:15] that same uh [7:18] roadway and so the last I understand was [7:24] he was going to make some uh overtures to UDot [7:28] and see at least initially you know put a toe in the water and see what things [7:32] feel like. There wasn't an exact commitment to [7:36] uh at this point traffic study because there isn't any traffic. [7:40] » But there but there's not and then they can model [7:45] and estimate what that traffic would what that demand would be. [7:48] » So, I'm not sure how far he was going >> No, and I and I agree with you. I think [7:51] where we left it is that we'll see if UDot will do a traffic study. I don't [7:56] believe we discussed the possibility of us [7:59] » Correct. >> And I don't think I don't think UDot or [8:02] us should do the traffic study. It should be on the developer to provide [8:05] that to us. >> So, [8:07] » And we can't I don't think in good faith create a traffic problem from a [8:12] development and then expect UDot to solve it with a light. [8:16] » And I think there was general consensus that UDot is not going to be necessarily [8:20] inclined to do that until they see some level of urgency that doesn't exist. [8:25] » Maybe I can mention the um [8:29] comments that were made by legal. Liam was with us in that meeting. [8:34] Uh becomes very hard to [8:39] umbrella or prevent a developer from coming in to develop property [8:46] on what UDot may or may not agree to do [8:51] with their road. Even though we as a city want it, we feel like it's needed, [8:56] we feel like the developments of Legends and and this new one is certainly going [9:01] to feed into that. Uh at the end of the day, UDot controls [9:04] that no matter what the developer requests or [9:08] ask. And the developer said in that meeting [9:12] if this development is conditioned on UDot's approval of a light at that [9:18] intersection, they can't do that because their financing will never approve it. [9:23] » Well, that's why I think we I think that the requirement of a traffic circulation [9:27] study should be [9:29] it in the development agreement because then right now we're just dealing in [9:33] abstracts. We don't know. We don't know where they're where it's going to push [9:37] traffic to. >> We don't know. Yeah. [9:38] » And we don't know maybe it won't be an issue, but it [9:41] » Well, you got a fire station right there, too, and that's going to be an [9:43] issue. >> And so I think I think [9:46] if we could have a traffic study, that would answer a lot of those [9:48] » I would have to say this probably consumed 50% of our meeting. [9:52] » It did. >> So I I I'm sorry. [9:54] » And and they are getting ready to submit the development agreement to come [9:57] forward into the planning commission. And these are good things to make sure [10:01] that maybe we ask for. >> And I really I missed it. So I I'm [10:05] sorry. >> thing that Liam did suggest, you know, [10:08] in this range of possibilities the developer wasn't excited about this [10:12] one was that in the development agreement we could allow them to begin [10:17] development and but only allow a certain amount of [10:21] that development to occur before a traffic light was put in. [10:26] » So it becomes phase contained. >> So and we've got that option. He [10:32] I think his response was that that won't fly with us, you know, we can't do that, [10:36] but but we we could put that language, protective language, in our development [10:40] agreement if we choose. >> I might want to mention [10:44] the attitude I received >> [clears throat] [10:48] » myself from the developer was that he was willing to do [10:51] as much as he could to encourage UDOT and [10:56] um in obtaining proper traffic flow and lights and whatever the [11:02] case may be. Um he wasn't objective to go on after [11:06] that. Uh he just was unsure about his [11:09] financing if it became an ultimatum. >> Yeah. So [11:13] » I think I think there's some good cooperation there. [11:15] » No, and I agree with you. I I do think we need to scrutinize very seriously the [11:20] language in the development agreement relative to this, though. [11:24] Because that's our protection. I would hate to see us open [11:27] a monster Pandora's box traffic issue. >> going to see it again before we do, so [11:32] you know what to take back to the planning commission regarding this. [11:36] All right. You know what >> We're all going to scrutinize that [11:41] development agreement. >> All right. You're going to see it first. [11:44] » I would echo what Tim said though, this this developer is for everyone that's [11:48] wondering where this is at. This is the Slater property. It's the one that is [11:52] just to the south west of Legends. [11:57] Butts up next to the sewer plant in Marion Slaterville. But this developer [12:02] has been working with us what Lou for about 9 months? [12:04] » Seems like forever. >> 6 months smart more more than 6 months. [12:08] » And I will have to say he's been very congenial, very cooperative. [12:12] He's He's got a think about his bottom line. That's his area. We've got to [12:18] think about Far West City. And [12:21] » And it maybe it should be noted, I mean all the requests that the work through [12:25] the working sessions we've had, he's gone from 528 [12:30] units to now 386. Like Lou mentioned, he's removed all the [12:36] town homes. I mean he's he's really done a lot to do what we've asked him to do, [12:40] so >> Yeah, I think bottom line I'd just like [12:43] to see us request them to provide us with a traffic circulation study. And I think that we reached general [13:15] consensus on almost every issue we could. So [24:26] just so everyone watching and and everyone that's here [24:30] knows public our public works building contract a [24:35] change order came in due to the need to install and upgrade a [24:39] new primary power system that requires a 600 amp [24:43] service on site. This This change order included the [24:47] enclosure, the installation and the connection. We asked for two bids just [24:52] to ensure that we were in line. This was the cheaper of the two. [24:57] This is regarding the email that was sent out about a month ago to the [25:01] council. Just so we didn't have to slow down any [25:05] work, we asked for approval to move forward. [25:08] It was approved unanimously. So this is just ratifying that approval. [25:13] For the record, the amount of the change order was 28,500 [25:17] dollars with the potential of 10 to 15,000 from Rocky Mountain Power [25:23] once they connect. I get that right, Cody? So just as you look at [26:18] the agendas, we'll do a presentation and discussion, then you'll hold the public [26:21] hearing, and then you'll make a motion on these next several items. [26:25] So this one is page five through seven of the packet, and it's just some [26:29] cleanup journal entries that we cleanup budget adjustments that we needed to [26:33] make. So you can see we're increasing the budget for sales tax and grants. [26:37] Some of that grants is we're just coding some of that storm water stuff currently [26:41] into the street, and so we'll have to [26:44] reconcile that at the end of the year, but I just want to make sure we had a [26:47] little bit of a budget there in case it needed to stay there. And then we had [26:51] never formally adopted the transportation utility fee [26:54] Um fund budget. So it's adopting that budget. And then if you remember when we [26:59] purchased the plow truck, some of those implements rolled over to this fiscal [27:03] year rather than being bought in last fiscal year. [28:54] Cody is here to explain the purpose of this and why. [29:00] » Okay, thank you council and thank you mayor. So, this is page [29:04] 8 through 12 of the packet. So, if you remember, I believe it was last year, it [29:08] might have been 2 years ago, there was a new state law that we have to present [29:11] the path the schedule that's on page 11 for any [29:15] of the municipal officers compensation [29:18] increases. So, that's the large part of this. The other part of it we're [29:21] approving the pay scale and if you look at the pay scale which is on page 12 of [29:26] the packet, the bottom two sections, those are the new positions [29:30] that mayor wanted created. And so, those are the new positions that [29:35] we're proposing with the budget and the corresponding [29:39] increases will take place there. And then one other thing in the ordinance [29:45] if you remember that includes like the officers and things. We've also included [29:50] there as part of the >> [clears throat] [29:52] » compensation policy of the city, it gives you the option as the mayor and [29:57] council to take the average increase as well. And if you remember we talked [30:00] about that with the tentative budget, the average increase was that 5.77%. [30:04] So, that's included in there as well. So I would [44:06] anticipate that we probably will have a few more budget amendments this year [44:09] than we usually do just trying to massage that and get everything in just [44:13] the right place. So, what that means is values went up about 1.5% and so then [53:54] the rate drops so that we get the same amount of money before [53:58] the new growth. [1:34:06] So, we'll be asking a few people from planning commission to help out with [1:34:09] that review of those um proposals to select a contractor. [1:34:14] And then um we are at our last parks committee [1:34:19] parks committee meeting we discussed um you know, we had a lot a great [1:34:24] outcry of support for community members um helping maintain [1:34:30] the pump track when we had our last conversation about the pump track. Uh [1:34:36] the parks committee is going to host a pump track maintenance [1:34:41] um organizing meeting uh sometime in the next month and so all [1:34:46] of those that want to be involved with maintaining the [1:34:51] pump track um we they're invited to come to that meeting and we'll discuss [1:34:56] assignments and uh responsibilities and get those people that uh were so [1:35:02] passionate about the pump track and dedicating time to it put to work. Uh that is for a Those are for [1:38:29] traffic studies being done that we've contracted with um [1:38:33] to look for improvements for traffic study for traffic for improvements on [1:38:38] our roads. Uh maybe future lights and and roundabouts and stuff like that. So, [1:38:44] there's purpose behind that. That's why they're there. [1:38:47] Um I wanted to reply report back on we had I had [1:38:52] asked UDOT for some help on 2700 specific to the 2575 West intersection. [1:39:01] Um This is [1:39:03] Jason, this is where you were famous on the news. [1:39:06] » Oh, yeah. >> Um [1:39:08] I I had asked and and asked them about the condition of or [1:39:14] status of a traffic signal going in there [1:39:18] asking if we could have a roundabout as well. [1:39:26] They will be conducting another traffic study [1:39:29] this fall in that location specifically after school set school is [1:39:34] back in session. Following that traffic study will [1:39:38] determine what the the steps are, whether they authorize a signal. [1:39:43] They basically did say they're not going to put a roundabout there. They they [1:39:47] don't want to consider one there. So, they will consider a traffic signal [1:39:51] there pending the traffic study. So, again, a lot of that's out of our [1:39:56] our control. [1:40:15] Um the next thing from UDot there was also the consideration to move the [1:40:21] school crossing where Hogel's Corner is, to move it back by the canal. [1:40:26] Um and or combine the traffic or the the the crossing at Walk West Junior High [1:40:33] to eliminate the multiple movement on that road. They just simply won't do it. [1:40:38] They they They they They have their reasons. They feel like that it's based [1:40:43] on their studies, uh the intersection of Hogel's Corner [1:40:46] with where the signals already exist, they feel are safer [1:40:50] for the kids to cross where cars are already planning to stop from for the [1:40:55] lights. Um [1:40:57] they have data to to to back that up and support that decision. Again, these are [1:41:02] UDot roads. Those are that's their decisions. We have asked them to [1:41:06] consider these changes. They've refused at that point because for their for [1:41:11] valid reasons that they have data to support. [1:41:15] Um then the question was asked, "What about if we do our tunnel [1:41:20] project and trying to get traffic or trying to get crossings off [1:41:25] that road during heavy traffic areas?" They will [1:41:29] consider it at that point. So, if we can as a as a city put that as a priority [1:41:36] and I think that is a priority by by us to try to [1:41:40] figure out how to budget for and receive grants for [1:41:46] what Utah what those the students from Utah State came out [1:41:50] presented to us to install a tunnel tunnel crossing near the canal. [1:41:57] At that point UDOT would consider maybe allowing that crossing for the students [1:42:02] to move and consolidate to the tunnel. So, there [1:42:07] Did any comments on that? >> And I just also let you know so UDOT has [1:42:14] a uh prioritization and programming schedule [1:42:18] for not just investments in highways, but investments in active transportation [1:42:25] and pedestrian safety. And the 2700 North overpass [1:42:33] that or underpass is on the ranked list for [1:42:38] the active transportation improvement fund, so the A tip [1:42:43] which puts it in which puts it in that um [1:42:49] constrained category that first phase with so [1:42:54] um with the ranking there. It's lower [1:42:57] ranked but we can do things to increase the ranking and then once funding [1:43:03] becomes available, they fund projects based off of them being on this list. [1:43:09] And so that underpass or overpass is on this list for consideration for funding [1:43:14] from UDOT. >> So, I question maybe you don't know [1:43:18] if we were to be able to budget for and raise or raise funds for that project [1:43:24] through other means, would that help them push that up on priority? [1:43:29] » Yes. >> Okay. [1:43:32] And and I bring that up, you know, to go back to the Advantage Development, one [1:43:37] of the things that we worked really hard in that negotiation with them was to was [1:43:43] to create a developer contribution to the [1:43:46] city, which is in the in the [1:43:49] realm of about $4,000 per lot. And on 336 lots, if you do the math, [1:43:56] it's about a $1.5 million chunk to the city. [1:44:01] Um we now have some significant funds we can start in a budget to maybe move this [1:44:06] forward make it a reality sooner sooner than later. [1:44:10] » I think this is one thing that we continue to lobby the region for in the [1:44:13] our meetings with them. And that and you know, it's that is in [1:44:18] the same position as the 2700 >> Mhm. [1:44:21] » North interchanges. It's it's on the list. Now, how the commission decides to [1:44:26] fund it is up to the commission and we need to utilize our partners at the [1:44:32] region to >> office. The last thing from UDot there was they [1:44:49] are conducting currently conducting a traffic study on 2000 [1:44:54] um near where the old where the public works building facilities are across the [1:44:59] street from that church to install a beacon signal [1:45:04] and a and a crossing walk.
