Thank you. [2:23] I think I saw more five. Just a second ago, maybe he's going to listen. He was moving pretty fast. Oh, my, it's fine. [2:32] Are we ready to go? Okay. So it's 530 on the 10th of August. It will call this meeting of the Planning Commission to order. [2:45] And it looks like we have all members present here except for Aaron. [2:52] So we'll see if he joins us in in a few minutes. [3:00] We'll go on to expertake, communication, say, and disclosure, stairs. [3:05] And so all members are present. [3:08] We'll move on to expertake, communications, and disclosures. [3:12] Anyone with any expertake? [3:17] seeing nothing will move on to approval of the meeting minutes. And we start with July 27th of 2020 sets. [3:27] We have any comments on the July 27th, maybe a minute. [3:36] I'd like to make a motion to please those minutes. [3:38] I guess we're. Okay. [3:41] I need to make the motion to approve and I'll be seconded. [3:44] Any discussion in the comments. [3:48] Seeing enough, all under 10, there will have a vote, all those are vacant, proposed, no [3:59] extensions, then move on to August 3rd, 20, 26, meeting minutes, not in 10 minutes, [4:09] very moved to Bruce. Okay. Second. Okay. Any discussion changes coming at Sunday. [4:19] All right. Seeing none, all those in favor of the students. [4:28] So we're going to presentations. We have [4:34] And [4:38] in founding commission update, there's first, there are two, there's a couple of us. [4:48] What's that? [4:50] Yeah, I like first. [4:52] Yeah, why not? [4:52] Yeah, the major utility overlay went through. [4:56] And if it was a 7.0 vote this time, it was a phone by two. [4:59] There was earlier there. [5:00] So everyone was on board for that coming around. [5:02] And let's see here there was a background that was a letter of recommendation for that, which is for the widening of the resource full of our. [5:12] And then we had a traffic analysis. [5:16] On the area that seems to keep coming back for review over there by the. [5:21] Is that right or where? [5:24] And Zimmerman, all of that kind of alone. [5:27] So there was some discussion about which [5:30] if we should just do the traffic study in the area [5:32] that seems to be keeping a bucket or if we should widen it [5:36] to include all the way up to be in it. [5:39] So right now I think Rose is kind of lucky [5:41] me to see if they have the funding to expand that study. [5:44] Or if we're going to just look for that Zimmerman [5:46] and the traffic study in that little border. [5:50] Let's see here, there was the jar harris, let me give that right. [5:54] It's just a room and if anybody speaks to that. [5:57] There he is. [5:59] Oh, Jerry's. [6:00] Jerry's. [6:01] There we go. [6:01] That works. [6:03] And then there was also a vote. [6:05] I don't know who Sarah is. [6:07] So that's all that happened. [6:11] And then the easier to pay for just the act. [6:13] Just the one thing is that. [6:14] Mr. Winfield asked that the for Oaks come back and so it can you just go see that process [6:22] if you don't mind Andrew when you have something as fair or the county commission. How does that? [6:27] I was that revisited. That's the turnip question. Okay. Okay. [6:32] You're on me. I was generally in brand new application. We've always processed them as brand new. [6:37] Okay. Thank you very much. That was a good brand. That was a good time for sure. [6:39] like it's like vote over and over again, [6:42] and Brad has done that a couple of things. [6:44] He knows the process. [6:46] He knows the process. [6:47] He knows the process. [6:49] Brand new application. [6:51] He's fired another application. [6:52] He's something that everything you did. [6:54] If there's any additives you've had them. [6:56] If they come back saying, [6:57] you want traffic study. [6:59] I never had counting people. [7:00] Right. [7:01] That was a thing. [7:04] Every time. [7:08] not floating at all. I always knew they were coming. Okay. Okay. If that's the [7:15] end of the deal and we want that, we need to say that. Right up front. So the [7:19] developers, they're going to try for a subdivision and create a traffic issue. [7:24] They need to have a traffic study. We already know the basic line of what's going to [7:28] happen with eight houses. You're kidding? [7:30] You call any engineering firm in the state and they can answer that question. So this isn't a big deal. Right. [7:36] Could be if depending on what they come up with, but for eight houses, no, you already know that they [7:41] Egyptian or anything. So with that experience that I've been through. Yes, ma'am. Thank you, ma'am. [7:48] It's not a hard process. It just takes time. Sometimes time is money depending on who the [7:53] developer is and what they're trying to accomplish. So it does get burdensome for that in the day. [7:58] That kind of structure was standard and learned there. [8:00] My foot is such a thing of the land use code today. [8:03] Road department uses, and it talks about what kind of road you need. [8:06] Based on engineering, and it's in real bad need of being updated. [8:13] Back when I was working, it was in bad need of being updated and still not updated. [8:17] And the engineers were all asking for that, so, okay. [8:21] The road department handles all that. [8:23] I don't have any guarantees with the study of a large area in just a subdivision, [8:30] because you have the subdivision of lots, that's 800 trips a day, that's four trips an hour, [8:36] it's about 15 minutes. I think that could be a problem, no, or versus a public reveals. [8:41] Traffic and all these people are going to be killed and all like us are going to do, right? [8:46] Four trips an hour probably not, right? And so what we wanted to do was to look at the [8:53] Some where nothing has been proposed at this point, but we have, [8:58] I'm going to share it with Chris already, [9:02] but she terminated this map that very much could be [9:05] at four or five units per day, [9:07] her versus the one acre density this now. [9:10] It's a, oh, which got Horox doing a traffic analysis. [9:15] As if that area developed at three units per acre, [9:19] which is more than it's currently zone for, [9:22] but less than what the future land use plan is. So we're just looking at a larger area because if you [9:28] just do one-off side of the vision area for four lots, it's going to be one trip per hour, [9:34] this is going to be four trips per hour. This one over here is going to be three trips per hour. [9:41] It's obviously, there's no problem. It's that strong, it's the care of it's back. [9:46] It's a, you put the burden of a whole bunch of improvements on a person who's doing it too [9:52] lots of additional, because all these others came in without that cumulative impact. [9:59] And so that's, as we're trying to do with this. [10:01] Also the same reason that we're in this, this, this, uh, problem first place, right? [10:07] Traffic study was done for that one subdivision, right? [10:11] And then as that subdivision has been there, it's now a thorough way going through. [10:14] So without having done, without having done a larger, [10:17] like where our arterial is going for that area, right? [10:21] We're pushing all of this on something that was never meant to be [10:23] that arterial route. [10:24] Well, what happened with the Zimmerman is there's a section [10:26] of the land use code. [10:27] This is a you can connect, you connect. [10:29] So it had to connect a Zimmerman. [10:31] And it celebrated particularly care for it. [10:33] But we also had tried to require [10:39] And subdivision developers to adults that they're going to have their subdivisions going to cost the problems. [10:48] And there's someone to kick back, that it was just done through traffic studies or horrors. [10:52] But Zimmerman, I mean, it's still in the largest code that if you can connect, you can connect. [10:57] And you don't have to pay or develop beyond your subdivision. [11:03] So, a lot, I'll probably see it out on her village, there's a road that stops it, look at the guy's name that has a big beautiful farm out there, there's stops right there, but it's, and he was concerned that he's what if I don't want my road there as well, first come for serve and that's kind of how that happened. So that's always been a part of our process of procedures. [11:26] Another part of it, it's great that I'm on, but connectivity was every deal and also where the main arteries were by the Belangius plan. [11:36] All right, where are the arteries, where do we want this traffic and have that going to help? [11:40] One of the things I saw that Perkran can still is, we don't have enough connectivity to the highway. [11:46] We've got to build and get some roads across where the Spanish trail will be. [11:50] Yeah, that's a lot of traffic we're driving in various, and I think that was some of the [11:56] conversations that we had about expanding the traffic study, the size of the area, and [12:01] it's sure that we are looking at some of the other areas, the acceleration that we didn't. [12:06] So those needed, is it this subdivision of a lot that should pay for the acceleration of [12:12] the acceleration of the, or should it be much larger area, which then did it's paid for it with [12:18] impact fees and so it was just so because we look yeah it's getting it's getting [12:24] like right since it's been a fairly dry get it yeah yeah yeah yeah yeah yeah [12:33] yeah yeah yeah yeah yeah yeah because that's a dream right now but I was getting [12:35] extended out and yeah yeah but I knew it's the way you're crossing up to [12:39] resources that are widening the shoulders and that's section with it yeah it's going to [12:45] time we get a lot to do this on well we kind of started off the subject care. [12:49] Yeah, I'm sure I'm sure I'm not even going to speak. [12:53] I'm not even going to speak. [12:54] It was a second. [12:56] I'm going to discuss. [12:58] It was like this, yes, I'm actually. [13:02] All right, so. [13:05] Next item is public hearings of which they're known. [13:09] General business action items discussion and consideration of approval. [13:13] We have none, and we move on to the big item, which is workshop, and Henry's done a good job [13:22] for me to give us information. [13:24] I think we have a couple of red line documents here, and I guess it might be easy. [13:30] It's just the term to go to the end room and have them walk us through this. [13:34] So, you look at me with the threshold. [13:37] I know, I don't think anything is going to be ready for public hearing on the 24th, so we want to surprise you. [13:49] I think it's something like a rock wall, right? And so you've got a bunch of different rocks. [13:56] that make the wall. And one of those rocks is the county, [14:02] ladies and gentlemen, ladies and gentlemen, [14:04] that's the largest part of state code. You have the county [14:08] ladies code section eight, which will become section two with the new [14:13] code update. You have the bylaws. And if you just stack those, [14:20] it doesn't wall, but to make a really good wall, and you have the [14:23] in between, which is the Robert's rules of order, so Robert's rules are the default, if you [14:31] know kind of anything other. So if you get by-laws, it defaults by-laws, it's got the code, [14:36] defaults code, state code, defaults the state code, and then when you've got a question, it's not [14:42] just spell out there, probably the order is the mortar in the swall. And so I went through [14:52] all this with, well, hey, I'm just going to do a little primer. [15:00] On Robert's rules of order, and run our code to them, or bylaws to them, and our more problems, [15:14] to the human problems with this all, I guess. And then that brought up some other inconsistencies with the code. [15:25] And so it's difficult, we'll go through this, we'll get far through as we can. [15:31] But I don't think we'll be ready for public hearing on the 24th, but that's up to you enough to me. [15:38] Well, let's just give it a shot. [15:41] Yeah, yeah, things like, in one section it says that you should have at least one, but not more than three planning commissioners who are replaced every year. [15:53] Yeah. Well, then that hasn't been followed for a while. The Bible has, first of all, [16:01] we updated every year, but they haven't been updated since 2021. So, what's happened in the last [16:05] five years and even lots happened just in May of this year, it was stay code. But anyway, just, [16:12] so every kind of has an expectation of the problem I couldn't able to accomplish. So, these are [16:18] of things to look over and see because there's a question on portal, right, which we have [16:28] done in idle and all in the past, if you've had a problem on filling vacant dining commission [16:34] C, since last time we had way more applicants than we have positions for, but I know that [16:49] What happens with the appointed is, yeah, some number that are appointed and what constitutes [16:57] a core and what constitutes being able to pass the measure, so all the stuff's discussed [17:03] because there may be some time when someone's term expires or someone resigns in between the media [17:13] resigned in the meeting before the kind of commission fills that seat. You may have six seats or [17:21] you may have five seats or whatever. So just need to figure out how that's via handle the [17:26] head of the tenant. Anyway, just jump right into this as far as you want to go. So in this, [17:37] on this go through the staff report on discussion items, a new, again, Lands Code 8 is going to [17:50] come to Lands 2 in the new code. We have a mobile and retrieval, 8.1.3F, and by the way, there's [18:04] about if the ordinances that have not been updated into the e-code system, so if you go [18:15] the code online, it's 50 ordinances behind and you can't find the ones that are [18:21] gone. [18:22] Yeah, yes. [18:24] Yes. [18:25] I don't know. [18:26] Yeah, it hasn't been updated since 2023, 2022, I've access to some of those, but what [18:35] for instance, 709, which is the repeal in a place of section 6, the oldies code, but with [18:43] the feature of the oldies code of Spanish valid, and exists. So they just had the redesign that [18:52] last week, because it's nowhere to be found. I mean, you can find it in a minute to that meeting, [18:57] but not assigned copy is how we just had that one from the minutes of meeting and just had that sign. [19:08] So just in a phone room, or in a mess of ways, we're also, we have 50 ordinances in play. [19:16] And some of them don't mean anything, you know, like a decent piece schedule or salary of elected officials, [19:26] some of those things though, but we'd just select some of those that somehow related to [19:31] the time commission, printed that, and certainly those, but there's about 50. [19:38] The 8-1.3F that you're talking about is basically a state reserve of 15. [19:45] Yeah, so they changed the state law in the, they just adopted in May of this year, which added four different [19:54] things, and the renewable, the diesel that's required by state law to have this in there, and [20:00] the ads, the causes for renewable need to be listed, and then also that if we're talking [20:08] about things here in the planning commission that you can't be removed from the planning [20:16] commission, because you talked to Lynn Riggled about, I don't know, right? So it's with [20:24] the safe harbor of the Planning Commission. And then, uh, [20:30] so those were in the minutes, we [20:34] were listed in the area, [20:50] 8.1.3F [20:56] by the Planning Commission member, and maybe the room for the [20:59] commission for cause by two groups vote of the county commission by our [21:02] graduation at the point of turn. Before the open member shall be given written [21:07] notice of cause and opportunity respond. The opportunity to respond is you need to [21:13] grant county that's in the previous code. So we just kept that that issued are [21:20] fifth. That's not a part of the state of return. Yeah, yeah, but that gives you [21:25] It gives a point to wish for those of other programs. [21:27] The ability to respond. [21:29] It is to be in a just majority of the solutions. [21:34] It's even more rigorous. [21:35] We'll do that again. [21:37] Cost for the levels. [21:40] Costs, for which, remember, we used it on page 18 of 29. [21:46] In material that was sent to you. [21:52] Using public funds for a local purpose, [21:54] under L-20A-11 Part 12, that's a local activities act, and then violating the provision of [22:06] an Act, well, Hamilton, Chapter 3, Part 13, Municipal Officers, and Employees, Epics, and Pat. [22:14] When they're making a part for the state, for the county code, they copied and paste the part [22:22] for the municipal code. So it's actually in code. [22:25] I sent email last week to do that. [22:30] Association of Countries, and just ask them if this is going to be changed or not, because there is a [22:35] section in state code that deals with the counties, but it's just black in there, because that's off [22:41] state and state code. Acting with the intent to influence a land use decision or an appeal of a [22:47] pending land use application, the manner that creates actual, impromisible bias. I think that's something [22:55] that we're going to have to ask the attorney to think [22:58] of the definition of impromiscible bias. [23:01] And then the liberation is not possible in the role. [23:04] And it retains all, a member shall refuse himself or herself [23:08] from participating in commenting on or voting [23:11] on a land use application when the member has a conflict [23:14] of interest under tiny officers and employees [23:17] ethics provision or game category ordinance 462. [23:21] When the member has a personal or financial interest [23:23] the application or when the members participation would create actual [23:27] informational bias or an unacceptable risk of improper assault bias in a [23:33] administrative or quasi-dition manner. And much on terms, do you want [23:40] to go to the staff or just go through all of the businesses start with the [23:47] cream, a red line of the day and can include me just go through each part of that [23:51] it still helps. You know, the most complete way would be to just walk through the entire document. [23:58] Yeah, I think that's the end and walk. Yep. Yeah, so just as we do, and I think we'll be good at [24:05] pieces of the main comments that they have issues that want to see amendments. And if they do, let's [24:10] paint them on the floor. Yep. So let's go into the 8.1.2. [24:17] And you're on page 29. [24:31] Yeah. [24:31] This will change is to that, which is in this addendum, because again, we are giving [24:39] into balancing the land use code with the state code, with the bylaws, and then that [24:46] perspective, additional changes. [24:47] but basically, in 8.1.2, we're adding in the blue underwear and text added red strike through [24:56] is deleted. The planning commission has no legislative authority as to the general planning [25:01] amendments that didn't plan amendments to this code. The planning commission reviews and makes [25:06] recommendations for the game, to the county commission, which alone may end up. The planning commission [25:12] tax as the land use authority only as to those specific application, this could assign [25:18] fewer and not as to an application list code of science and not always this authority [25:23] and including the administrative land use authority designated in 8.5. The [25:29] seasonal planning commission acting as the land use authority is an administrative act. [25:34] Now, going through the code, [25:40] there's nothing that is assigned to the 10-intermission as the final authority. [25:46] There's 16 different land use things, and it's in the 10-intermission, it's staff, or it's the pill authority or administrative judge. [25:59] It's certainly to be changed a bit and then there's also six places in the land use code where it just says Commission. [26:15] And it doesn't say plan and commission or commission, but in reading it, it looks like it's kind of commission. [26:21] Okay, so we've got that one and I don't know if you just want to go through all the things or if you want to ask us. [26:28] We should just keep it over through these. [26:30] Okay, and that's something that's not something that's been changed. [26:33] So if you look at this and I did them. [26:36] It's actually going to change that 8.12 to the public commission as a advisory board. [26:41] It's not the land use authority for any land use applications and hold no legislative authority. [26:46] The Commission reviews applications and proposals referred to with the polls, [26:51] following carrying this framework, [26:52] or it makes recommendations to the Commission. [26:55] Together with the other D.D. [26:56] described at 8.14, [26:58] led its 34 each application type of the sign in 9.15 and 8.5. [27:04] In this case, would you add planning commission, [27:07] the word, planning, and run over the commission? [27:11] Because I think that's again, [27:12] we're trying to be planning a good way to clarify for sure. [27:15] clear everything out. I like that. It should take 90 minutes to go to the point in this. Andrew, [27:22] you came up with the proposed text, right? Yes, I believe. And I actually, I like you [27:29] worrying the way it is, I might, I could easily change my mind, quite an information access [27:35] to land use authority only in those specific applications of the code that they're assigned to it. [27:40] The nice thing about that, even if it's never assigned to us, is that if it was assigned to us, [27:47] we wouldn't come back and change this document. So, you know, I think this is clear, [27:53] and then it's nice that if they ever assigned us anything, you know, I think about that. [28:01] Yeah. And I think it's kind of like, it's going to be like, grenade. She's so. [28:08] Right. So it's become later. [28:13] That's going to be a lot of okay. [28:14] Here's the moment, what they've been doing. [28:17] No more. [28:18] It is for me. [28:19] It's a brain. [28:19] It's a brain. [28:20] It's a brain. [28:20] It's a brain. [28:22] It's a brain. [28:24] We can do that. [28:25] But check all right. [28:27] 8.1.3. [28:31] And this is, so we've got the planning commission and system of seven members should be pointed by the kind of commission in addition to seven regular members, the kind of commission may choose a point one or more and we're taking out ex officio leading in are placing what the A's on and then taking out a liaison and just bringing those the A's on. [28:57] between the kind of commission of planning commission LIAs on the board does not count toward the quorum in a vote. [29:03] Here's the thing, ex officio means by right of office. [29:12] So we could say the vice chair of the county commission is an ex officio member of the planning commission. [29:21] and they would be on X-Fishio, they can vote, they can do everything, they can make motion, [29:27] second motion, they can vote all that as an X-Fishio. However, we say that X-Fishio, [29:35] we call it X-Fishio slash the A-Zon, and the A-Zon is something completely different. [29:41] That's the person who goes back and forth like we have here or that brings back the [29:49] you have to be right and so we just try to clarify that it's not an ex officio because if it's [29:58] an ex officio that means like [30:00] If you could always be the vice chair of the kind of commission, but this is, we asons are appointed [30:07] excess officials are by right of that office. So, usually by code, they're usually written in by [30:17] code, so they have to answer that. Yeah, that's in there. Right. That's an ex officio. But we, and the areas [30:23] don't do not that I know of and I've asked for it and in this situation the two which is [30:30] my problem is I don't have an issue with two here as long as that's in code and that's [30:35] qualified we know and we're not gonna have or one or two if they're supposed to be two then there's [30:40] got to be two if they're supposed to be seven is got to be seven of us if we're supposed to have [30:45] a quorum with four that's the number there's no only that five tonight so it's three no no we don't do [30:52] that, okay? You don't do that to an empire and this is the rule book. This is our rule book. [30:58] In my opinion, this has to say one or two, not or more, by the council's win. That's not fair. [31:07] It's not fair to her, him or anybody on this board, all of a sudden, we give them a liaison. [31:13] Well, now we got three, and the next thing I know, they didn't like what we were doing. So they said [31:18] number four down here. Oh, that got a lot of corn. And we can go. That's my point. You see that. So I think and if they don't come from [31:31] on it, it has to come from the county and they have to fuck up and give us a rule. It wonders it too. [31:39] Which is it? But the way this is working is we're going to draw this something that we're going to [31:43] the county and they can do it. If they want to change it, they can change it. But what we send [31:49] to them is got to be what we as a group vote in approval. Okay, so if you want to [31:55] submit that time saying, my opinion of these given a number, it's a number. It's a number. [32:01] So having a decision to deal with one of them we want to proceed. I think that most of these [32:05] are pretty much not a lot of hope. If we've got an area of disagreement, my take is let's result [32:12] down. Sure. And I would say it is the rulebook. But if it's the rulebook said one or two, that's the rule. [32:21] Yeah. I just agree with Brandy, but we should probably, I think, decide it. [32:28] Fine. Yeah. Okay. Yeah. All right. I'll make a motion that we say one. [32:35] We don't have to take more. Okay. Okay, we can do a straw full on any settings. [32:43] What is it? We're not full. [32:45] Get the ball. [32:45] It's a tool. [32:46] What do you want me to bring back next time? [32:49] Yes. [32:49] That's just a word. [32:51] We've got no. [32:52] On that. [32:54] Because we have, [32:56] where we talked about the amount of [32:59] on the commission members listed, [33:01] and there's multiple options for it. [33:05] What if we say one more two? [33:07] Because then that offers the option [33:09] if the commission decides that they no longer want [33:11] two liaison's here, then it's already specified [33:14] that we have one. [33:16] And it's trying to pull that they, [33:18] like I think that we just say one or two. [33:21] And we're two to bring back. [33:24] Yeah. [33:24] Okay. [33:25] I'll just bring that right. [33:28] What do we vote on there? [33:29] Thank you. [33:30] Well, yeah, we have two suggestions here. One was Randy's will just to change it to one, even [33:35] everyone. Now Randy, the only downside for my point of view is the kind of commission gets to decide [33:41] and they've already told us that it's to. So one's free having giving me anything and [33:47] writing that they did that. No, but they assigned us that. There's two of them here. So it's [33:52] obvious that somebody thinks there has to be. And they were directed to be here by the kind of commission. [33:56] All right, you're right, I'm still injured and I'm right because that's okay. There's no war and it's already given me that and there's no rule, Sarah, okay, and there's no rule. [34:08] What is like the traditional practice like all the other airport board and all the other boards, they all have just one, you know, [34:25] So places people can go and go and go and go and read the numbers. [34:29] We don't only want that as to liaison. [34:31] No, we're going to go and go. [34:33] How's it as for us, because it was. [34:37] But are they all? [34:38] But is that because the housing subcommittee is in the option on the, okay, okay. [34:43] So that's going. [34:44] Yeah, yeah. [34:44] There's a couple of other things. [34:47] Where are you? [34:47] Over here. [34:48] Look at the sheet that we have. [34:51] Oh, yeah. [34:52] That's a normal water for all. [34:53] Yeah, that's a good question. [34:56] That's a good question. [34:57] That's a good question. [34:58] Yeah, that's a good question. [34:59] How do you do it? [35:00] There's all kinds of different. [35:03] I guess it's really three options. [35:06] That we're probably discussing one, two or one or two. [35:12] I mean, I mean, it's, again, say one or two. [35:14] And the reason is sometimes counter-commission may have people who say [35:20] I really would like to be on a planning commission. [35:22] sometimes we're going to have to drag somebody down here and they'll drag it by saying [35:27] watch. So I think it gives them the flexibility and there are two people who are interested, [35:33] I think it's great to have them here. So let's do a struggle with that being said, [35:41] oh, withdraw my, you know, because my motion, my book is my opinion. [35:45] just with dry pain. [35:47] Sorry. [35:49] Everybody in favor of one or two. [35:53] We're going to move on. [35:54] Let's move on. [35:56] For even ex officio and adding. [35:59] Keep ladies on. [36:02] The OECIM. [36:04] Thanks. [36:05] Thank you. [36:05] Thank you. [36:09] I'll have to take him out for a beer. [36:13] I drank that. [36:14] I know I'm going to do something I'm going to do for a day off. [36:19] You know what I'm going to do? [36:22] It's like, it's not here. [36:24] All the apple beer is sold out when I come the first day. [36:29] So then we go to this, [36:32] a substantial term of office rate. [36:36] And so the council is term of office. [36:41] at least one and no more than three members [36:45] expired each year, but then passed it. [36:54] We have Commissioner O'Brien and Commissioner Place. [38:00] are the three you'd do? can you house moisture going to have less than four year term moist in that? [38:06] That one pointse it up. Then first on where's the, and then you're gonna go look where the site was, we'd always was. [38:16] If somebody always was on that moment, change, what happened? [38:20] probably a time when too many people would point out. [38:24] yeah, perhaps somebody just screwed up and somebody else on this, [38:31] It's always been annoying. [38:33] I don't know if it affects it, wouldn't it? [38:36] I affect the time I said if I need to fix it, I'll be the one that would lead that back time so that it can fix it. [38:43] Instead, don't give me a five year. [38:45] I don't care. [38:47] I don't care. [38:48] I don't care. [38:49] I don't care. [38:50] I don't care. [38:50] I don't care. [38:52] I don't care. [38:52] I don't care. [38:54] Out of the next. [38:58] Howdy staff needs to notify the kind of commission in September of each year that a term [39:03] expires, this will be done, and you have to note out there, et cetera. [39:09] A liaison member shall be elected by the kind of commission which I'll continue to serve as [39:14] over in place by appointment again, the A's on a set of ex officio, when they down to [39:22] the removal just goes back to the state code and those things are listed there, and then the [39:34] problem there, the chair and vice chair shall be elected annually as the first item of business, [39:41] the first regular meeting of each calendar year. What that said before was that there are [39:50] elected each the first year after there's a change to the planning commission. But then what [40:00] that means is there's to be two-year term, Chair and Vice Chair would serve two years because [40:06] you wouldn't have real access for the Chair, Vice Chair, unless there were changes in the planning [40:11] commission, the planning commission, you don't have a change in every year on the sort of changes [40:16] and I think the reason it reached that way is that there was a time. It actually happened [40:26] because the person who was chair had a secret valid thing that I've always been on before [40:34] the people who were going to join the Planning Commission. It got set up to the County Commission [40:42] who said, we would like to know who voted for whom, but we then had our first meeting of [40:50] the year without our new members in place, so this may have to be read in a different way. [40:59] If we had had the rule under this new thing you do it at the first meeting, we wouldn't have [41:06] people who were new get to vote on the chair and vice chair because because of that bad head of [41:16] the planning commission having that secret ballot they were they want they did not want to appoint [41:22] those people to the saw who voted for them and I think that was the right decision it's [41:28] the reason we ought to always do it. [41:31] My voice will be able to be able to go into that soon. [41:35] So I don't know how we want to change, [41:37] but maybe we want to look to make sure something like that [41:42] doesn't happen again, for instance, meeting guests [41:44] canceled by the County Commission, [41:47] or some reason because the electricity goes out [41:50] or something. [41:54] Yeah. [41:54] It's very new in a question. [41:55] Why, by the question about that, [41:57] and then I have a certain question. [41:58] It seems like in here there were several things written about paper votes and you had a strong [42:06] vote. [42:06] So when that take care of that? [42:09] So now we wouldn't have paper votes and that particular problem wouldn't happen. [42:14] It right. [42:14] I don't think that a problem would not happen, but if any other problem happened, then the commission [42:22] meeting, the county commission, maybe not to happen. [42:26] So I'm not very adamant, obviously. So yesterday's the reason it was in there. [42:30] The thing that you don't want to happen is left over people who are at their terms are expiring. [42:39] They vote for a new chair, the vice chair, it should be. [42:44] Yeah, the nudging seated, convincing as a whole makes that. [42:48] And we'll try to figure if they don't appoint somebody in December and then we go to six and then we go to five or whatever, you know, could. [42:57] Well, I definitely five. [42:59] So item two here says that the former members remain by the planning question. [43:04] I don't know. [43:05] I don't know. [43:06] I don't know. [43:07] But that's going to be the thing. [43:09] If we know somebody's been, they say, hey, [43:18] I don't think it matters a great deal, even if it's left with this 40, I mean, at the old commissioners would put in the chair and the vice chair, and we'd move on and it's not likely to happen. [43:35] If there was an easy word to make yourself, it'd be nice. [43:38] And, you know, because then, you can have the next meeting with the new members and they can decide the editor, chair, to my chair. They can do that. [43:50] I mean, if you remove the chair by 1830, [43:54] I'm not sure if that's not a lot of that. [43:55] It was audit bills. [43:57] Yes. [43:58] And I was going in. [43:59] I talked about this last time that the chair and vice chair [44:04] would be elected as the last item at the first regular [44:07] me. [44:08] So that the chair would conduct the business. [44:12] So we did. [44:14] We did. [44:14] But then, so what happened? [44:16] Like what happened last year was Commissioner Kuso, [44:23] his term was up, and he didn't want to continue on. [44:29] So then what would we have at the beginning of the meeting, we would have to do our report without having a chair in place and tell a last item. [44:38] But that first meeting. [44:39] So we want to make sure that we have a chair advisory base. [44:42] Yeah, okay. [44:44] That's enough. [44:44] Yeah, I think it makes sense. [44:46] So do you like that trick? [44:48] No. [44:49] Wait a sec. [44:50] Yeah. [44:51] Oh, yeah. [44:51] Now I understand why it was. [44:52] Because we didn't just talk to all that. [44:54] Yeah. [44:54] Yeah. [44:56] Because we're going back and catching the bylaws, [44:58] but then the bylaws. [45:00] Should have been that way, should be this way? [45:02] Yeah. Okay, for me, I'm happy to be part of figure out whatever word you might word in, about those situations. [45:10] I've got a lot of answers. [45:12] Yeah. [45:13] I've got an aspect by that, so I'll try to figure it out. [45:17] Sure, Mr. Chairperson. [45:20] We're on the page 17. [45:22] Yes, I'm sorry. [45:22] bit the one chairman to your person and then so responsible and the county was actually responsible [45:31] with the county through the planning department to record the minutes and I do that so I really [45:38] like all these is doing that and I think before there could be a lot of subjectivity will get [45:46] to do so to do. So to do it into the minutes written in a way that if you listen to the [45:53] actually the video, it would be something completely different. Like I'll be even at the same [45:59] meeting, so. I was mentioning that in a first-class relationship. I think that's all we can manage [46:03] a concise, they're all points. They say we go to provide, and we're done a bunch of stuff, [46:10] that we don't need. The more concise in this can be, I'm sure the better we have to defend our [46:16] And by state law, we have to identify how each commissioner voted, so some could do that as a [46:25] rock-hull, though, or at least I could say, chairman of the 90-year-old board, you could just say [46:32] those in favor say I, and I'd say that, okay, that was Christopher Day, that was Christopher, [46:37] I'll find those. You know, so you can just do that. It doesn't have to be that formalty word [46:44] That piece that would have to do at roll call just as long as I did a five-foot-foot-foot-foot-foot. [46:49] Yes, somebody to Robert J. Williams, actually one of the roll call, and demand in the roll call, [46:55] we call it and do it. I think the way you're going to spread that otherwise I wouldn't do it. [46:59] And let's ask for it, then you've got to specify it. [47:03] Well, continue with the current practice. [47:05] Yes, I thought that. [47:09] And then going down on P-13 to 9 Limbers and the public, we participate in Planning Commission meetings by real-time. [47:20] By real-time electronic meetings, it's provided by Utah Code 504-207 in the current ordinances and policies established by the kind of commission that included in the Green County Resolution 2044. [47:33] a member participating by real time electronic means count towards the [47:38] core and they participate in vote. So that's a change from before where they [47:46] weren't allowed to go and weren't considered part of the core. [47:52] And a little more fusel, this goes back to this state code. And I think we [47:59] this already two-thirds authority, they look, they have the safe haven of being able to discuss [48:05] things in the panic there's a meeting without feeling like we're moved, etc. just on [48:15] them, we could go on. And you'll make an opportunity to figure back from the county, [48:20] Well, what's the solution on the necessary items? [48:24] It's basically the second or places that occurs in the public cabin code. [48:29] So Andrew, if we found out that Title 10 Chapter V Part 13 was going to get updated [48:38] to say county officers, instead of municipal, would that require public hearing again? [48:46] Oh, yes. [48:46] Oh, and we adopted it. [48:49] Yes. [48:49] That's part of the age. [48:50] I think it's in. [48:51] Yes, it would, it's all, so this time, two here, it's from stay code. [49:01] And so, if they know, change it in the social session coming up, it will be changed [49:10] until next year, but because it is stay code, as stay code requires this to be in. [49:19] the section of the county code that establishes the planning commission, it will garb onto [49:25] the public dispute. [49:27] I don't think we'd lose anything by just taking that ton of municipal officers and employees [49:36] at fixat. [49:38] This is the code. [49:39] It's required to be a different from the code. [49:41] You can't just say a ton of things after 13 or 13. [49:45] You can't just say employees at fixat. [49:48] No, there she says, by the way, you can prevent a penalty and check the free part, 13, [49:53] when the civil officer is looking at the police, if I think it's an act. [49:56] I guess we just deal with that later. [49:58] Yeah, but we'll just take an opportunity. [50:00] Maybe the statement said, let's say things that don't matter. [50:04] I don't know, maybe I don't see it. [50:05] I'm going to say the same. [50:06] It was just like 17. [50:08] I just said it was going to be a big deal. [50:11] But in this case, not a big deal. [50:13] Yeah, I'm going to take somebody in the business. [50:15] I have a friend who's worth a slain of news, very picky, so I'm doing a lot of everything from you act. I'm going to send this to him and say, hey, do your thing. [50:25] I don't know if I fell asleep during the year. [50:28] But on number four on page 17, which I guess, things, that slide. [50:36] I do where it says the majority of the appointed regular members, [50:41] Austin, particularly according to the business. And then it says an affirmative vote of a majority [50:49] of the appointed regular members shall be necessary to pass the motion. Did you mean members [50:55] and attendance at the meeting? Well, no. So, because I think I did that. I think I was kind of [51:11] If you have five people, then you can do the re-review, but I just met in number of four, it doesn't read that way. [51:20] Yes, he is, I guess, to the core, to the inventory of the inventory of the appointed regular members of the Syrian class. [51:28] And I might say I should be, you know, attended. [51:32] So, this is not based off of who shows up. [51:38] So if you have seven appointed members, but only four show up, pretty can't pass into that. [51:48] So, but if you only have [51:56] appointed members with two not being appointed yet, then three could pass something otherwise you could have. [52:04] This is about a pointed member, it's not, not your. [52:07] Because it can have a horn that can meet, but then when people [52:11] the passing thing, right? [52:13] So I spaced off of the buildings that are there. [52:16] There's, there's a people in the world. [52:19] Yeah, I know. I actually need to pay them. [52:21] Yep. Yep. [52:23] Come on. [52:25] I'm on the phone on page 8, 10, 4, 3, 2, 3, 2, 3. [52:30] Resolution, is it possible we're going to talk about that, we're not going to use all, and while that goes, we get to maintain, updating the code, businesses, 1727204, but back in November last year, [52:53] the legislature had a special meeting, it didn't tell, at least didn't advertise it, [53:01] well, and they changed the statute, they moved everything from 47 to 79, but most people [53:12] were aware of it until like a pop-up sometime later, and they thought, yeah, I knew the change [53:17] of pop-up was gone. So this is just coming into points with that Soviet 79, and when they moved [53:26] from 27 over to 17. It's not a 9th or 9th or 9th or 2th or 2th or 2th, believe. They added some [53:35] extra things and they took some other things out when they did it. So it wasn't this to a [53:40] recodification to new chapter but they actually changed some things. So like in this is since 1727 to [53:48] So for actually becomes a 17, so a 9, 403, the 404 that you're going to think you're going [53:56] to be. [53:58] Plus, it was, it was, it's, it's something 20, something A, I don't know what that, [54:03] to know about A in the before. [54:05] But anyway, we're just not thinking that. [54:08] And if anybody wants, I can email you a 17 page document, as a crosswalk between [54:17] And each of those, if that's something you people are like really interested, reading. [54:22] I think we have to just, especially on the people. [54:24] Yeah. [54:25] Yeah. [54:25] I don't think so. [54:27] I think so. [54:28] Awesome. [54:29] We stopped right now. [54:30] Even actually when we work off on Google. [54:33] It's really hard. [54:35] It's hard. [54:35] It's hard. [54:35] It's really hard. [54:37] It's hard to find the code. [54:37] Yeah. [54:38] Awesome. [54:38] Yeah. [54:39] I know that was part of the, um, you know. [54:43] Yep. [54:43] I know that was part of the. [54:45] house, crosswalk, you know, you can just [54:47] lead it or whatever, if you want to. [54:49] I could have any other words that it's [54:51] made it to. I'm just terrified. I just [54:52] want to go back to four. And I want to [54:54] put, I want to put some numbers in it. [54:59] Majority of the regular planning [55:01] commissions to four. So, we, I, with [55:04] a majority of us is, we have seven people. [55:09] And the majority of us is four. And then it says [55:14] majority of the appointed regular members shall be necessary to pass the motion. That says, [55:21] we need four people, but that's not what the new system is going to do, right? [55:27] Yeah, so if you've become the one that is right throughout the second page on the [55:32] draft, there hasn't been a little there. Yep. [55:38] So again, it's appointed regular members. [55:41] Yeah. So if they're everywhere from seven, or maybe you got instance where you have a wholesale [55:50] resignation and you're down to four, right? Gotcha. And so, yeah, you can quarantine at three [55:59] and you can pass. I promise you're saying. Yeah, good. Okay. And I leave that one a lot. [56:07] I was looking at it kind of as it varies, like I don't know what you think. [56:13] Yeah, and so I was doing a certain thing, so I'm like, okay. [56:16] It's a good table, so that that makes sense. [56:19] I think certainly the same one thing, and then we'll get these things. [56:23] The thing that kind of drew me was, it felt like I was a second son and sitting in the second page, [56:29] what counts as a majority. [56:30] It says that number does not move with attendance. That's the thing. Yeah, if you've got seven, six, five, or four appointed members, yep, that you still regard the sheet for a firm. [56:47] So if you're selling a point of number four show up, every day has to go. [56:56] I'm not sure if you're talking about that. [56:58] The next one is D is as to conduct an annual review. [57:03] I'm just wondering, like, forward the benefit of any new planning commissioners coming in on the future. [57:09] Is there somewhere else that says everything we need to do annually? [57:14] Oh, I'd love to see that. [57:16] Good, that's a good thing, isn't it? [57:17] Like, we have to do our by-laws. [57:20] We have to do, we have to root for the Green County government. [57:23] What else had a 10-sponsored bill? [57:25] I agree here. [57:26] I agree. [57:26] Yeah, this one really means too, very big. [57:29] Yeah, we've heard of it. [57:32] That was, we thought about adding that for the by-laws [57:34] that haven't been changed in a while. [57:36] Oh, yeah. [57:37] You would be, oh, how old are you? [57:39] How old are you? [57:39] I'll do it with me. [57:40] Like, a lot of crosswalk or something. [57:42] Yeah, I'll have it as well. [57:43] I'll have it as an annual training report with solution. [57:45] Don't those of them? [57:46] That's absolutely. [57:47] Yes, because we did, yeah. [57:48] And it says there is also need like four hours of training or any sort of results. [57:55] That's only if you're at a county in the first secret for the last. [58:00] Very kind of is the county of the fifth. [58:02] So you would just have that one that opened meetings. [58:05] Lottery and that stuff. [58:06] Yeah, that's a good thing. [58:07] We'll do that, but together. [58:08] Stopping to do that. [58:09] We're doing a lot of those from Phenis, you know, we do it in one of these guys. [58:16] What was I thinking about? [58:18] Oh, me and Charles were sort of you. [58:21] Phenis, but you're okay with what's going on here. [58:25] Yeah, absolutely. [58:27] And that sentence is very important. [58:30] even. Got it. All right. So where we're now? I think we're [58:35] picking the key in the key. Okay. I'm [58:40] to review and make a recommendation to the [58:42] kind of commission on appropriate delegation of powers. [58:46] To at least the one that does a day-to-day delay in [58:48] your support in the here and act on language applications [58:51] and on an appropriate delegation of power to at least [58:55] the one that fuel authority to hear an act on [58:58] appeal from a decision of a land use authority. So that's what part of I say law, [59:03] sorry, been done. What time are you? [59:06] No. Yeah, so December 14th, 2024, the county passed or this 711, which [59:20] paints the subdivision requirements, because they lot changed the subdivision requirements, [59:25] And I put in timelines, et cetera, for a fast applications had to go through the process, [59:31] but they also took away from the planning commission, the authority to the approved subdivisions, [59:40] so we may have noticed that some of us have come before you. And so the already made that change [59:47] that says that for single family, there's a list of three different ones. I am the final authority [59:57] on those subdivisions. I'll ever. [1:00:00] When that ordinance was adopted, it was not a repeal and replace. So it just added another chapter, [1:00:10] month and tail end of that section. So we still, by policy, we still have some divisions going to a kind of commission, [1:00:21] even though that's the old rules, you know, we always are just buying stuff that do that. [1:00:30] And so, you've already got this in place, but it's required by stick law to say that you have to do this. [1:00:38] Which is one to establish me as the land use authority for subdivisions and things like that. [1:00:46] And we have a print call, is a former Attorney on Buttsman. [1:00:55] Who wrote the book? [1:00:56] He wrote a lot more than it can't say it. [1:00:58] And we hired him as a pill authority. [1:01:02] So he has a grants. [1:01:04] Then we have a go to him and wait for those decisions. [1:01:08] We don't have a board of adjustments. [1:01:10] because some places we have, we do the administrative terms. [1:01:17] So, that's basically what that means, and we already do it. [1:01:20] It just has to be stated in the code that you do that, but you've already met it. [1:01:26] To review a big recognition of Kelli Commission on Application Process, which may include [1:01:30] the designation of a routine land, it's matters that, upon application and proper [1:01:36] notice, we'll receive informal streamlined review and action. The application is uncontested [1:01:42] and shall protect the right of each land use applicant and adversely affect the party to [1:01:50] require formal consideration of an application by land use authority, get the pill and use [1:01:55] authority decision to separate the pill authority. So we have that already, there's so many works [1:02:01] appeal, decision, [1:02:04] that I make, and making anything, that they go to commission, and then to [1:02:10] the field, I think they go to the appeal authority that judge, administrative judge upon that. [1:02:16] But there are some things like miners, other lesions that we may produce for, or where it's for, [1:02:23] flattening the trespass, only the work use, some of the requirements were not making any changes to [1:02:29] side boundary, all the permits are in. This is the interior, a lot, one, between a [1:02:34] couple of lots of people. We can make changes to that. And then G. So, this is just some of the [1:02:45] paragraphs were lettered in somewhere not. Before making a recommendation, the kind of [1:02:53] commission, the general plan, the amendment to the general plan, or the latest regulation, [1:02:57] And the clinic commission is a whole public hearing that is required by 17, 17 and 30 [1:03:03] or 32 and we do that, but it is required to take a requirement to be put into the code [1:03:12] that establishes the clinic commission. [1:03:14] There's a couple of things that are outside of the point one, but they have updated, [1:03:26] so you [1:03:27] talk about citations, so this is the hearing officer that we talked about for a variance is [1:03:33] just updated in a section of code that relates to the same thing with the appeals. We just [1:03:39] updating on that and [1:03:46] let's say that there's more things that we need and they use that [1:03:56] based on a real term, I guess we, I figured this with the latest code, stay code, bylaws, [1:04:04] the servers or the orders, there are a few things that fall up like this thing of a appointed [1:04:10] members of our constitution to the point. So, to Snowler's more work, it is, and then we get [1:04:17] to the bylaws on page 21, [1:04:25] because that is a few were changed very, very much with ink. [1:04:37] A lot of shins, so this is what it changes to the collective annually as the first item of business [1:04:43] that each regular, the first regular meeting each calendar year, and so maybe look at that [1:04:52] a little more depth, you and I can come up with, you know, I mean, one of that, so that reads, [1:04:58] oh, one of three, but it doesn't mean that we don't want it to be as good. Because I guess I know [1:05:04] I know what they say you're talking about there. And to see, we took out a different quest [1:05:12] by the pair of written ballots, maybe use, [1:05:15] so low written ballots, if they can let out. [1:05:16] Thank you. [1:05:18] And Mr. Ho-brain. [1:05:19] Yeah, there's no one here that has any objection [1:05:22] for that, but I don't go sell them, yeah. [1:05:25] I don't think it's legal, right? [1:05:27] Well, I don't know about it. [1:05:29] You can do it, but you have to still [1:05:31] in the minutes, stay, go go, go go. [1:05:34] OK, let's go listen. [1:05:35] That's where we are told what we did now. [1:05:39] And it's kind of crazy to do that. [1:05:40] Yes, I think we'll hear that. [1:05:43] Yeah. [1:05:44] Any officer, elected by the Commission may be removed from that office by two [1:05:49] therence vote. [1:05:50] The total membership of the Commission when in advance went the best interest of the [1:05:54] Commission will be served as five of the would the ladies from. [1:05:58] That we just went over. [1:06:01] I don't want to complain about. [1:06:04] Sir, I'm just saying you were going from one commission over to the next one [1:06:09] on that on, did you want to incidentally, [1:06:12] or specify in which one's plan of commission, [1:06:14] which one's plan of commission? [1:06:16] I think if we're going to do it on one of the documents, [1:06:19] we should just do it on the other side. [1:06:20] The email, though, because it doesn't see, yeah. [1:06:23] But this is the plan of commission, by surprise. [1:06:26] Yeah, yes. [1:06:27] So do you think it's a simple, but... [1:06:30] Yeah, no, no, no, no, no, no, no, no, no. [1:06:32] You go back to kind of a commission. [1:06:34] That's all. [1:06:34] That's not the wrong way. [1:06:35] If I do. [1:06:37] That's a wrong way. [1:06:44] OK. [1:06:45] All check out. [1:06:48] Good. [1:06:49] And, sure. [1:06:51] That's, we don't do all the years. [1:06:55] That's not right. [1:06:55] Something. [1:06:56] I don't. [1:06:56] I don't really. [1:06:57] I don't really. [1:06:58] I don't really. [1:06:59] I mean, I think is the objective and subjective effect. [1:07:06] I think that's a chair person sets the agenda in making us all with the vice chair and staff in doing so as provided in the 5.5 this year. [1:07:21] to encourage, to separate, meet, see, and then we're in the voting on new commissioners, the commission. [1:07:30] We shall go upon the names of the candidates in the alphabetical order by last name. [1:07:37] So first of all, last name is last name. And then again, we're thinking about the written values. [1:07:43] The planning commission by a motion for this to the county commission. [1:07:48] of this that came in pencil, just where it's smithing there, and in the bottom of article [1:07:56] of 5.3 annual training, we've got the open polygmatings requirement that's required [1:08:04] to every year. And then I identified system final workshop that's conducted by the Intelli-Gisiting [1:08:11] found. I don't think we'll do that anymore. I don't know the last time they did it, but it's been [1:08:16] several years enough that if you google it, it doesn't be anywhere. And so I just [1:08:21] choose that I was trading. They had a thesis, those meetings. I don't know, [1:08:25] pizza, I'd like to do it. Everybody went. Everybody went to, I didn't a question on that [1:08:32] 5v.1 opened meetings. I simply think of higher conversation about field trips. [1:08:38] Do you say we were not going to do field trips? Yeah, but like psych visits and stuff. [1:08:45] And so that comes in later under special readings and I can't remember about it, but I'll get to it. [1:08:53] Okay, I remember. Yep, yep. Yeah, the next one is, yeah. [1:08:58] Yeah, social media is workshop, social meetings, workshops, and field trips. [1:09:02] For any purpose, maybe you know, they're the call of the chairperson or the being killing [1:09:07] solution. [1:09:11] If that's done, there'll have to be things that open meeting. We can do that. [1:09:17] There has to be noticed in the bunch of other stuff. So I'll just put it in compliance with open [1:09:20] by being exact. That would be the best way to do that. I like the fact that Jeremy [1:09:24] can say, let's go look at this. Yeah, because I can't think of it off the top of my head. It's [1:09:30] the situation more to be fair to the applicant and give him the most opportunity you may have [1:09:36] to go up and if the public wants to go, get on the horse and ride, let's go, tell him. [1:09:43] Yeah. [1:09:43] Yeah, neighbor was a farmer and the city was putting in a sewer line. [1:09:51] He asked the workers what they're doing and they told him and he said that water doesn't [1:09:55] in the field, and they said, well, we know what we're doing, and we're doing a TV statement. [1:10:02] We have a reverse engineer at New Zealand. [1:10:05] Let's see, the chairperson, the vice chairperson, and Kelly Staff may meet to prepare that agenda and to determine the scheduling order of items. [1:10:17] Because that's a meeting of this not convey, that does not contain a core of the commission. [1:10:23] And it's not a leading or a deliberation in open political meetings at a gender preparation [1:10:30] is limited to use elections, scheduling in order of high-end and the sufficiency of materials [1:10:35] and does not include consideration of the merits of any building we have, of course, you know, [1:10:40] because you may have been doing the nature of our chairs now, I wouldn't move. [1:10:46] The meeting materials, we've got the timing office, having officers to be here, [1:10:52] it's now over there. And then it stayed awesome that it was planning on it for available at [1:10:59] the Grand Canyon Library. I've changed that and said in on the Grand Canyon website at the same time [1:11:06] materials and provide some commission members. When an item is set for public hearing rather than [1:11:12] a public being, the materials for that item will also be available at the Grand Canyon Library by [1:11:18] I'd pay on the Friday before the planning, because you're meeting D. [1:11:21] So, before I was read as if all of our staff reports [1:11:26] directly, the great and delivery in physical [1:11:29] are not performed. [1:11:30] They're not. [1:11:31] It's only if we have a public hearing on something that we put that [1:11:34] over there with the faculty, like the one you [1:11:37] have some probation ailment, you should put there on [1:11:40] first of June at the library. [1:11:43] I don't place it over there. [1:11:45] and we'll probably hold more of a date with it, but it goes there. [1:11:51] Is there a reason we do that? [1:11:54] It's so if somebody doesn't have, [1:11:57] they would relate to electronic means. [1:11:59] They can go over and review it a hard copy or give me, [1:12:06] go out and put it, put care on inside there. [1:12:08] Do you want to go in there? [1:12:09] Yeah, actually, put it for the physical copy there. [1:12:12] Because you can look it up on the computer, [1:12:13] it's great. [1:12:14] Yes, there's somebody who doesn't have access to that, so that's what that's what it is. [1:12:20] So you share your hand them. [1:12:21] Library and library is open and out of five, so people can think of this. [1:12:26] I didn't use to post them out of here. [1:12:29] I remember my stuff was always not here. [1:12:31] Yeah, I thought we could over here. [1:12:35] Or over there. [1:12:36] Yes, I've been here too long. [1:12:38] Yes, we're here. [1:12:39] And the library used to printed that. [1:12:42] I've never had a friend of myself since I was a child. [1:12:46] I just said it over time, sadly. [1:12:47] Make this. [1:12:49] Yeah, we take it over. [1:12:51] It will fall. [1:12:51] Why don't you go ahead and under take it over there? [1:12:53] It only takes a couple of minutes. [1:12:55] I think it's you. [1:12:56] They've got a, like, a board just in, say, [1:13:00] a lobby there for public notices and things. [1:13:03] We should try to do that. [1:13:06] Right. [1:13:08] Question on that real quick. [1:13:09] So, we know materials need to be posted by 5 p.m. the Friday before, but public comment [1:13:19] is due Wednesday before. [1:13:23] And there's a point about that. [1:13:25] There's no brownings. [1:13:27] wife had the same questioning for her. [1:13:31] And so if people want public comment to be put into the packet that's sent out there, [1:13:39] they actually have to have that Wednesday at 5 PM before the Friday before the Friday [1:13:44] Commission meeting. Now, if we have a public hearing, public hearing item is posted 10 days prior [1:13:52] to the meeting. So things that are how public hearings, that's available before [1:14:01] staff report goes out. But yeah, that's definitely a flaw in the system if somebody [1:14:08] just wants to make a comment on an item that's not a public hearing, they will know of that [1:14:15] item until two days after they need a tip. You know, I'm like, come on, it's important. [1:14:23] But it's still how? It's still coming in. It's still coming in. It's still coming in. They can still [1:14:31] Okay, so if you want to include it in the packet, then yeah, and that is on two in this I think the Roberts red lines, I make that more specific. [1:14:51] No, I have a funny question, so I think the. [1:14:57] The county commission I think I don't know. [1:15:00] This is a question, has a system whereby when a system gets on and sends out email to the county, then just [1:15:10] kind of go out to you immediately. We don't have such a system, I think the problem with us is, are [1:15:20] I don't think that I don't think if we send a thing into the planning commission, then it goes out and automatically opt all the planning commissioners are known. [1:15:31] I think that there's less because I think there's a form and I'm talking a little bit verbally, I know, but I'm pretty sure that that's part of the agenda center. [1:15:39] like. So for the first one of the softwares that we had is actually a form and so a little more. [1:15:45] So that one goes to goes to our emails and that would out the commissioner. The commissioners [1:15:52] have got it. Even if they did a little bit different with the commissioners who have decided [1:15:58] about it versus the fighting commission. Because we should email county commissioners directly. [1:16:09] That's fine. You can have discussions with them directly whatever you want having commission members [1:16:14] It's a little bit different to that needs to be [1:16:19] So everybody gets it. It's just a couple [1:16:24] So I think in the robber's red lines. I've got in there that [1:16:31] I've come as limited three minutes or 400 words high and it can be if it's if you want it in the packet [1:16:39] and it's going to come to us, the 5 PM, the Wednesday before the meeting, and that's to the, [1:16:47] but, I mean, portal, it's going on our website, and then I know it sent me, you know, [1:16:55] who else it gets sent to you, but then we went forward those, if they're by Wednesday, [1:16:59] if I've got those doors to the packet. If it's after that, then it's going to email directly to you [1:17:07] or came that out of the meeting and I've actually had, [1:17:10] but I'm going to come in by email at 6 o'clock [1:17:15] and bring a plan to mission meeting [1:17:19] and I'm like, I'm not sure, I'll address. [1:17:23] Well, that's interesting. [1:17:23] Because I usually don't get many public comments [1:17:30] by email and I always thought it was the system. [1:17:33] And what I'm going to do is go on an experiment, and I'm going to put something on that, let's say, something or a meeting and see if we all get it. [1:17:45] That's it. [1:17:45] That's it. [1:17:46] Yeah. [1:17:46] I think we don't think you do. [1:17:50] The county commission does, because our legislative, the planning commission, I believe it just comes to [1:17:58] I'm going to lease it then myself, and then we have that there's handouts that we do. [1:18:06] If it comes after Wednesday at five, if it comes in after Wednesday at five in the packets, [1:18:15] not all done up and everything, I'll include it in there, it's not something like what it [1:18:20] restricts somebody, but I'm saying, if you wanted to do this kind of thing. [1:18:24] And my question, my question is, I don't know, this is, I guess, the decision, or maybe it's all over our hands, but why aren't we on the system that's like the counties, which would allow us, somebody now going to give them the advantage of the doubt, they realize after they see the path and on Friday, right evening, they want to send a comment and why aren't we on the system like the counties has, that it goes tall of it. [1:18:53] If there isn't a political reason, and it's not a bar-fetched category, I'd love to see that because [1:19:03] there. [1:19:04] I think citizens would feel more like, oh, I got to see the packet, and I don't like the way this [1:19:10] thing is going, or I like the way this thing is going, and can then put comments in that [1:19:15] we'd actually get if they can't be at the meeting. [1:19:18] The ICB for things for basically for packets, where there is no hearing. [1:19:27] Yeah. [1:19:27] Because one's one there isn't hearing. [1:19:29] Yeah. [1:19:29] Not together though. [1:19:31] Thank you. [1:19:31] More important. [1:19:32] And time to answer that was because they'd have to use our personal email addresses [1:19:36] since we're volunteered. [1:19:39] I feel like we've got a conversation about this. [1:19:41] And it involved them putting our contact information on the county website. [1:19:48] But I don't have offer, I don't know, I love it, it's one of the reasons for it. [1:19:52] But they don't do that. [1:19:54] You could get us partained to death. [1:19:57] Yeah. [1:19:59] That's a fair term. [1:20:00] Yeah, so it's got to go to everybody, not just one. [1:20:03] Yes, right. [1:20:03] But I will object with. [1:20:06] Yeah. [1:20:06] I'm going to turn it off without saying. [1:20:09] And get the open. [1:20:10] There's a downside to that. [1:20:12] I think it would be different if it went to you guys and it got sent to all of us from [1:20:18] finding in zoning. Then it still stays in that email. Then we can still make sure we're following you. [1:20:26] Well, there was for a little while where if you put on the portal and you posted the combat to the [1:20:43] So okay, so this is my content play. [1:20:48] Oh, it's because of somebody that's a particular share. [1:20:54] That's a question. [1:20:55] So it just seems like on it and live your draft, [1:21:00] right here on page three on your public comment. [1:21:03] If someone sends an apology after. [1:21:10] Well, let's just say, [1:21:11] you're not going to read aloud or summarize any comments of the meeting. That's the second [1:21:16] paragraph. But then on the third paragraph that says, if the submitter wants it, on the record, [1:21:22] it still goes on the record, but we've never seen it. I guess it's your time to say. Yeah, yeah. [1:21:31] So even, so you, you will see it, but you'll see it after meeting. So you will read it out loud. [1:21:37] You're giving it. [1:21:38] Oh, you just have my life here as we come in. [1:21:42] Yep. [1:21:42] And you know, this like make a never to us. [1:21:44] Yes, the person wants it red. [1:21:48] They can either come on by Zoom or come in person and read. [1:21:52] Okay. [1:21:53] There's a minute to comment. [1:21:54] Okay. [1:21:54] But we won't read. [1:21:57] The staff will read the comments. [1:22:00] As long as it doesn't go over to you. [1:22:02] Right. [1:22:02] We can't end up with us. [1:22:05] That right here, on dissertation. [1:22:08] Hot items. [1:22:09] Or at least at least at least at least at least at least. [1:22:12] If we don't have a system of actually getting those comments, [1:22:18] I would probably say if we get, you know, [1:22:21] coming from four or five people, [1:22:24] I'd probably ask the chair, [1:22:26] can we have 10 minutes to read the reading? [1:22:28] and I hate having... [1:22:30] And I'm right y'all, where somebody's testified and you're trying to read a note or something. [1:22:35] Yeah, that's all. Let's attach a note. [1:22:37] Oh, that's fair. It's not fair to the person. [1:22:39] Yes, I think the chair would have come. [1:22:41] Yeah, you never know what to do. You know one of the chair. [1:22:44] We just read it. [1:22:45] There you go. [1:22:47] I don't know. I don't know. [1:22:48] I don't know. I don't know. [1:22:49] I don't know. [1:22:51] We have to be content neutral, but we can, um, [1:22:56] particularly the time that we have in place around commercial first-in-the-minute spin-trades. [1:23:08] But we also have had some of the board meetings lately that people then pull a comment, [1:23:19] So let's tell everybody in, because I got this big list of humans on and on mute and it's from porno. [1:23:32] And so China really bad. [1:23:36] So these are the only, like, the recommendation is that if somebody is on and they've got their hand up, [1:23:45] and they ask them what I don't know what they're going to talk about in the most instances. [1:23:51] They will know that they say, I accept it or come with us. [1:23:54] Well, that's some AI program that's spamming pornography and they may also have the issue [1:24:04] of what if somebody has hate speech. [1:24:08] So we'll make sure that people have an opportunity to come in, but then we're also going to [1:24:15] means someone's hate speech and so we have to be content neutral. So that's why we're not [1:24:21] reading it. We said that to you, I suppose, somebody wants to do some Nazi propaganda, [1:24:27] as the public kind of will send that out to you, because we'll become content neutral. [1:24:32] Well, let's see, oh, here's the be there at this point there. It's so interesting, but [1:24:41] commissioners are encouraged to review meeting with terminals of policy, [1:24:44] I mean, we're a efficient polymedicine and active staff for organizations. [1:24:49] But for me, I should contact the planning director before the meeting, we're going to [1:24:53] technical questions, request for clarification, suspected factual errors at the staff report. [1:25:01] So, everybody has my email, you've got, everybody's called me or texting me, or email me. [1:25:09] If, if you find something that's in the air, if you let me know before the meeting, [1:25:14] and then I can address that versus at the meeting during discussions that I'm trying to look [1:25:19] up the code on my phone or something. So I just added that that if you could do that the [1:25:26] be green. Staff shall endure to respond before the meeting. Staff shall provide any corrections [1:25:33] to staff report in any responses of general significance to the Commission's consideration of the item [1:25:40] to the fall commission and writing for the meeting or the of the start of the height of page 25 voting and this is what we're getting from this. [1:25:52] Wait, I have a comment on what you mean. [1:25:54] I thought those two paragraphs should be those same paragraph. [1:25:59] Do you think that's pretty? [1:26:01] That's pretty. [1:26:01] I don't know, like. [1:26:03] Beans. [1:26:04] Yeah, I think they're, I think there are two parts of the same issue. [1:26:08] I'm sorry I'm not out there, but you can do very well. [1:26:11] Sounds good, [1:26:13] really. [1:26:14] You get rid of the sea as easy as you can to be. [1:26:18] Yeah, it's like the R part and then your response. [1:26:24] So it seems like there's a lot of stuff. [1:26:25] Yeah, perfect. [1:26:27] The only thing we talked about, the traditional variety [1:26:30] in this part, a part of the tuition circuit [1:26:34] system and the majority of the appointed regular members, [1:26:39] The further the majority of the pointed red and the numbers shall be necessary to pass the emotion that's provided in the latest code. [1:26:53] I just have a question. [1:26:55] This is so technical about. [1:26:57] The land use code says 8.1.3 e4 as soon as we have the new land use code. [1:27:03] Does it all change that? [1:27:04] We'll have to change that. [1:27:06] There we can just say that's a variety of land use code. [1:27:08] I'm like otherwise, it's so an inflow thing to change. [1:27:12] You have this another level of air introduction rate, [1:27:19] but I don't [1:27:24] know whether it's those. [1:27:28] And so on 5 or 15, [1:27:35] you can't be a citizen of a county, [1:27:37] you can only be a citizen of a country. [1:27:40] And if we had someone who was a citizen of Canada [1:27:43] and they wanted to make public comment [1:27:46] were not going to disallow them because they're not a citizen. So I think it's probably [1:27:51] what we're intending to mean was public comments to the citizen. So public advocate and [1:27:58] other participation by real time, the public advocates and other others may participate by real [1:28:06] time telecommunications. Can you talk about such and such? And the ordinance is including the [1:28:13] to be a resolution of 244 on one means the minimum number of members required to act as a body [1:28:23] accord requires a majority of the appointed regular commission members just provided it and we can [1:28:31] chase that for later school as well to be present in person or by real time what trying [1:28:36] names, just before COVID, he can listen in on themes or activity, [1:28:45] and then he had COVID, and like the whole legislative area, [1:28:49] so they were able to pass any regulation. [1:28:53] It's a good thing, that thing. [1:28:55] Go editorial there. [1:28:56] Well, they were able to do it. [1:29:01] Let's see commissioner participation in the whole time. [1:29:05] case that we covered that request to withdraw or amend application or petitions, the power [1:29:13] request from the applicant, petitioner, or authorized agent, an application or petition [1:29:19] that may be withdrawn at any time for the commission decides upon the seed. [1:29:25] So, STEM makes the decisions the size of everything. [1:29:30] A [1:29:33] team that is eligible for mission, [1:29:36] consideration. [1:29:39] And I've got to check this because I know there's some things [1:29:43] that are probably this year that we don't have any authority on. [1:29:47] The commission itself consider a specific development proposal, [1:29:50] only upon an application or a petition that the [1:29:54] Department has accepted as complete and scheduled for Commission Action under Lenisco. [1:29:59] Nice. [1:30:00] At all, on this, a lot of times, we're controlling, getting things through, and I know some people have been waiting for the long, many years of project item to come before. [1:30:15] And so there may be some things that may miss on some of that, may be off. [1:30:23] But this is more for me than anybody that I don't put anything. [1:30:30] on the commission agenda unless it's complete. [1:30:36] The question does not conduct a pre-application or use, [1:30:39] and this is out of the line from what happened before, [1:30:42] the commission does not conduct a pre-application review pre-application, [1:30:46] and conceptual interference at the applicant's election, [1:30:49] and are conducted administrative by the planning department, [1:30:53] has provided by the sectional ladies code, [1:30:56] requests for a pre-application or conceptual use, [1:30:58] shall be directed to the planning department, [1:31:01] the chairperson shall not place, or staff shall not schedule a specific development proposal [1:31:06] on the commission agenda before planning to program has accepted the complete application for [1:31:12] that proposal. [1:31:15] Now, if it wasn't illegal to have them found before us, it wasn't, it wasn't [1:31:26] can it expose us to legal challenges? Yes. And so, I'm just like if you don't want to do it, [1:31:35] let's put it in the years we're not going to do it. Instead of me trying to make the ad hoc decision, [1:31:41] okay, this can go about this kid. Nothing else. This section is not limited to commission's [1:31:47] consideration of general planning. All of its 90s code, amendment, work sessions are policy [1:31:53] a procedure all afternoon, application, train, budget, and work program items, can the interviews [1:31:59] or other matters that do not involve upending or perspective when use of application? [1:32:05] No, it doesn't limit any matter referred to the commission by the county commission. [1:32:10] In a comment offered by the Commission, and by an individual member concerning the matter, [1:32:15] not before the Commission under Section A is not a decision-recollation approval or determination [1:32:20] in all the commission. [1:32:22] Just not buying the commission or the county, [1:32:25] I mean, the remote light for anybody in person. [1:32:31] And when I thought people would be perfect to me, [1:32:33] and I would like to. [1:32:35] What do I know? [1:32:37] This well, it goes to us, but the general plan says, [1:32:39] what do I know? [1:32:40] I don't know. [1:32:41] I don't know. [1:32:43] What I know. [1:32:46] It's 27 conflict as interest, [1:32:49] Eric Kuzel, for Kuzel, planning commission members as government by land use code 8.1.3F, [1:32:58] again we're changed. And this section, I mean, we're scratching out with a conflict of interest, [1:33:05] scratching out the required and adding in, when the member has a conflict of interest, [1:33:11] has a personal or financial interest in the land use application or when the members participate [1:33:16] or in-create, actual and permissible bias or unacceptable risk of and permissible bias in [1:33:22] the state of the quasi-judicial manner has provided in 90s count 8.1.3 tasks. Now, in the [1:33:33] embedded traps of product roles, going to a little bit more definition of what that [1:33:40] evil means, where it's actually saying that somebody eats that animal and sets them in the audience. [1:33:51] If they're not using it, it's not that they sit here just being just don't vote, but an intellectual physical. [1:33:57] If you want that, that's the Robert Rose. [1:34:03] Thank you Mr. Shalna, I gave in its part, which means one side of it, communications [1:34:10] of the final section B, communication that occurs in the ordinary course of an image profession [1:34:16] or employment that does not concern the marriage or likely, this position of pending application, [1:34:25] this and I mixed part of communication into the session. [1:34:30] So you want to [1:34:31] spot me be a lot of people, know each other, a lot of people are really [1:34:34] easy to tell. A lot of employees are ready to eat other. And so you always [1:34:44] may have something where, yeah, that's my ex-prison was, and he's ex-husband's [1:34:51] on the right. So I'll even up to you, I'm not anybody's watch card on any of this, so I'll [1:35:01] open up to you as to what you state, expire time, but just realize that there's people who [1:35:20] go to the grocery in Fursi. [1:35:23] I can be by myself. [1:35:27] Anyway, you know, we're there, right? [1:35:29] Right. [1:35:30] Congrats on the job. [1:35:31] But, you know, we bump into each other, but we're not having the [1:35:35] expertise in the coming up with a scheme of how to get something [1:35:39] happening or whatever, right? [1:35:42] So, we're all going to bump into each other at the gas station church. [1:35:47] Other places are in. [1:35:48] I don't know what's that. [1:35:52] I don't know. [1:35:54] I don't know. [1:35:54] I don't know. [1:35:55] I don't know. [1:35:55] No, it's always. [1:35:58] It's a fucking interesting. [1:35:59] I'm just sorry. [1:36:00] This sounds like some people are aware of that. [1:36:03] You know, for some planning commission, policy, [1:36:07] expert recommendations, [1:36:08] cleaning communication with an interest in [1:36:11] the particles running with the merits of a [1:36:13] pending application. [1:36:15] I've just more information on that in [1:36:17] the provot's rules, bread lines that I've got there, that are acquired by a commissioner to [1:36:24] kind of staff regarding factual technical or procedural aspects of an act, and that's part [1:36:29] of communication, of this action, communication between that individual prisoner and staff, [1:36:35] it's not a meeting or a relation, and then you talk over and over for me, and so forth. [1:36:41] Limerd was, and that's part of actually a patient that has spoken at the beginning of the [1:36:45] administration of the item, stating who the communication was with and whether it occurred [1:36:51] and substance to a fair person shall then afford to act in any other party, present an [1:36:59] opportunity to respond, following the disclosure and any response, the member may participate [1:37:05] in the latter, a list of refusal, as a part of the other section. [1:37:10] maintaining public impartiality, [1:37:14] a person member in my seek information, [1:37:18] center of seeking factual technical or procedural information [1:37:21] is not a liberation. [1:37:23] Members shall not deliberate on a matter before the commission [1:37:26] else time will probably be in a members on the solicitor. [1:37:30] The other members of the years, for an important decision on a pending matter, outside of [1:37:35] delegating directly or through staff or a third party, and that is also commended some in [1:37:41] these two handouts to the league. [1:37:44] Now, we're bringing specific cleaning land use application in the plain pollution, meaning [1:37:52] with police staff, the left official online use advocate is a no-one part of pollution [1:37:57] business, and is not by itself caused for a new, let's see, if we fall 10 this failure of [1:38:05] a number to 10, 3, and I'm next to you, executive meetings, maybe cause for a written [1:38:11] that the member's position may be vacated, [1:38:17] the resignation of a removal, the Planning Commission may request [1:38:22] the resignation of members for reasons of the attendance [1:38:25] or other ethical considerations. [1:38:28] The Planning Commission may remove the commission members [1:38:30] or cause by two thirds, [1:38:33] although prior to the expiration of the appointment [1:38:35] term in accordance with the causes and procedures set out [1:38:40] in the land use code, which require a minimalist of cause, and then this was unique to the [1:38:47] great county that I'll take me from another tourist one for the police in the house. [1:38:52] So [1:38:55] that's so far. [1:38:57] And then these additions are on to it. [1:39:01] I was hoping that we could go for public hearing, or I don't know if you want to go through. [1:39:13] this as well, or if it's that's digest some things, look at this stuff and we have another workshop on it's way to work for it to be well. [1:39:23] By recommendation to be. [1:39:25] Because again, this. [1:39:26] You make one change over here. [1:39:29] You know, it's like you do the recipe from Facebook. [1:39:33] You make one change here. [1:39:35] The recursive is there and it doesn't even look like what they have on Facebook, right? [1:39:38] So, Andrew, the things that we've reviewed today and have confirmed this thoughtful or [1:39:45] discussion that that's why we'd like to continue. Can you give us an updated draft and [1:39:51] the next one and then highlight the changes you've made to them? [1:39:55] And then I did. [1:39:56] Does anybody opposed to doing other working meetings next in two weeks? [1:40:02] I think there's some basics and massive, some humor. [1:40:07] Good job. [1:40:08] There's a whole lot. [1:40:10] I don't know if I'm here. [1:40:12] Yes. [1:40:13] Good job. [1:40:16] We could jump through and dump it out. [1:40:19] We'd like to see an interferer. [1:40:22] I'm the ADHD. [1:40:24] So I don't mind that I won't be in town. [1:40:27] Do you want me to look at it? I can start to get on the Zoom. Okay, I am swaying part of the deeper. [1:40:34] Not probably being that same situation. I don't even remember it very now. [1:40:40] Could you be joining by electronic me? I could do that. All you the period of person are probably, you know, [1:40:48] It might be, I guess, if you're on electronically, it might make the review a little bit more difficult. [1:41:00] Yeah, I tend to be near. [1:41:03] But if something happens, because of the upper floor and before, it'll be a warm afternoon. [1:41:10] Some appointments. [1:41:12] But I plan on being here unless something changes. [1:41:15] Okay, well, if you plan on being here, what's plan on doing get extra view in two weeks. [1:41:22] And then, is it going to look like you're going to send changes and we're going to make comments like we did before. [1:41:30] Yeah, well, so what we'll do is, I'll make these changes that we've talked about. [1:41:36] Then we'll just, again, come back and say, go through things and maybe, hey, we've already read this. [1:41:44] So, and I guess that's a question. [1:41:46] If something's in there already, do you want it back again? [1:41:52] I guess it would have to come before public hearing anyway. [1:41:54] So, yes. [1:41:55] I'll keep it in and then I'll maybe have like a green or some other color, [1:41:59] and then I'll show things that come from this meeting. [1:42:02] as in their additions or relations about the green or something, and then we'll talk about [1:42:10] these things from Robert and Wolves, and there's going to be some changes in this stuff already, [1:42:17] so this is this kind of a, hey, this is what we're looking at, but in all change in the next, [1:42:24] if we be there too, but I can have this all out here, no stare too, and then we can have again [1:42:31] page by page with you to go that quickly because we've already got solutions to sign in. [1:42:36] And you're going to send it to the computer for the information. [1:42:40] Yep. [1:42:40] And then you, perfect. [1:42:43] All right. [1:42:45] So I think we'll have to be here a little bit more. [1:42:47] We're at the end of the workshop. [1:42:51] So next we have future considerations. [1:42:54] Okay. [1:42:55] I think the thing that strikes me is, I think this six month more chart and was passed [1:43:02] through data centers, right? [1:43:05] And that means we've got six months to produce something [1:43:10] on data centers that guess through the county commission. [1:43:16] And so I would like to make sure that's the priority. [1:43:19] And I think maybe I heard something about, [1:43:21] well, we might give it to somebody. [1:43:24] It's sunrise, but if it was given to sunrise, [1:43:29] in terms of sense, it ought to be moved to the top of the list because it really is a six [1:43:35] months more dormant and it's an important issue. So that's a big point, and my response [1:43:46] and it's up to the current commission what they want to do, but Washington County has [1:43:53] it's an ordinance, it's really good, and it's been there for a little while, even though [1:43:59] people work aware of it. But it's kind of at that degree of use, sort of times, kind of like [1:44:06] with the sexually oriented businesses in a provost city, and they went through the whole thing [1:44:11] that the state Supreme Court, well, that kind of stuff, right? So then everybody about it, [1:44:15] probably a city security business account. [1:44:20] So my intent is to go through Washington County's [1:44:30] data singer or news, because they have a thing where they've got [1:44:36] only up to certain amount of size, and there's some differences there. [1:44:41] So there's a few things that we aim in to change this. [1:44:45] Some things that are, it's kind of a nice staff, right? [1:44:49] Or something that's don't even require it. [1:44:51] So if the school district has a server and [1:44:55] based on the school district office, [1:44:57] they don't have to come in and get a commission. [1:45:00] Well, then depending upon the size and all of that, then it goes to higher level of approval. So that's kind of where it was going to start with. [1:45:10] And then that's a great idea that you've got to go off of. [1:45:16] Other words, if you know, and you're in your search, eventually there must be a range of these things. [1:45:25] What communities have done, it would be kind of interesting that, I mean, I'd be perfectly [1:45:31] willing to look at theirs and I'd be perfectly willing to look at three or four different [1:45:38] places and it probably, sort of, right, it would be a range of alternatives to almost [1:45:46] bounding them to accepting a fairly big size data center because then we could see the options [1:45:55] And then I assume, since I guess it would be a land use code, we would have certainly a public hearing, but it would be very nice. I believe to have a public workshop, so we could kind of get whatever community input there is about, you know, how many jobs it could create or what it's environmental impacts might be. [1:46:17] So I'd probably recommend both of those things, but I would love to see a kind of range of them if there is a range out there. [1:46:29] Just for a quick, so I don't believe it will send you my question at range. [1:46:34] Yes, yes. [1:46:35] And then the reason this is a representative cutler right now is actually working on that legislation for the definitions. [1:46:41] So until things are defined, even when we were putting forth our moratorium, the hardest part of it, [1:46:47] is the definitions, right? [1:46:48] And so, until the state of Utah really [1:46:51] comes out with those definitions are [1:46:53] and ended up related to one of the big problems, [1:46:56] which deals with size, right? [1:46:58] So, how do you define the sizes of it? [1:47:00] I don't think that you've ever seen anybody [1:47:01] that's going to go ahead and say, [1:47:02] we're going to step out and say this, [1:47:04] because the definitions that we're going to have [1:47:06] might be against what Utah's dictation is. [1:47:08] We can extend that word to word for cause. [1:47:11] That cause would be you that the state is working [1:47:15] you're going to have to afford goods and then move back to what's the, if we think that [1:47:19] or official position, you're correct. You can use that as our boss. We have to think [1:47:25] that on official position. So it would, you know, instead, the other interesting thing [1:47:31] that's happening is I think due to a lot of the public pressure, the technology is changing [1:47:36] in the water requirements or going down in the power of the requirements or going down. [1:47:40] Yes. That whole industry is in a big state of [1:47:44] It is an amazing energy. [1:47:50] Because these right here, they work from it. [1:47:53] Yeah, good. [1:47:55] I mean, everything we do. [1:47:56] A tonicals from those things go everywhere. [1:47:59] It's incredible. [1:48:00] Incredible. [1:48:02] So, you know, it's the bacon theory. [1:48:06] You know, like bacon, you got to raise pigs. [1:48:08] You know what's right there? [1:48:09] So, we'll build those everybody. [1:48:11] We've got to have you in there. [1:48:12] I mean, so I would just say, [1:48:14] Yeah, I would appreciate shame of Washington, Kathy House, and then would it be the place to go to get away to their ordinance? [1:48:23] I think I got it, I guess. [1:48:25] So that would be signing up to the, you know, I think Mission Andrew, I mean, anything else for future? [1:48:31] Can I see what I think? [1:48:32] I would just like to update from sunrise and we're going to. [1:48:37] Yeah, and I did talk with him. [1:48:40] all days ago. And he's got things raised, got to, he's going to do like a couple chapters at a time. [1:48:52] So it's not like again fed through a pyros, he'll start dropping those couple chapters of [1:49:00] as it gets those. So I'll talk with the game and see if he can start dropping [1:49:09] those or be on line or something maybe on his workshop or something. [1:49:14] And even if we could just start reviewing and having our thoughts together, [1:49:18] pretty workshop it. I do think it was helpful that he read or read it, but this is not [1:49:23] policy writing. This is cleaning up. What needs clean that? [1:49:28] It is a lot easier to focus on the code itself when we remember that we're just doing, you know, we're not trying to rewrite anything at this number. [1:49:38] I think Trish raised to concern about speed, and I think separating the policy from the structure of the document is important. [1:49:46] Yes, there's one. There are policy things that need to be addressed. [1:49:51] Absolutely. We can do those at some point in that as well. [1:49:55] But I think speed in order to clean up what's there. [1:49:59] So we don't continue to have to tell people [1:50:01] to come back or to raise admit applications [1:50:04] or that's a big part of it. [1:50:07] So when I used to go around and help communities [1:50:11] with their general plans and subdoving [1:50:16] ordinances and such, I always ask them, [1:50:19] is there something that you're doing that works, [1:50:22] what it's not in the code? [1:50:24] So for us, I went to this one city and it said that there were six copies of the subdivision or part of the subdivision plant. [1:50:31] Right, because it's back when it printed, yeah, these people's right there. [1:50:35] I said, okay, we're on the go and said, well, one bus at the engineer, one bus at the time, one bus at the public works. [1:50:43] One goes to the city attorney and we throw the other two away. [1:50:53] Well, that's what's in the code, so we tell people they have to submit six and then we throw two of them away. [1:50:59] But he okay, they're four lobbies. [1:51:02] And you know, they're even other things. [1:51:05] Mary, I mentioned this to you, I don't long months or a year ago, maybe. [1:51:10] But we actually, in our 90s code, we actually don't allow a street-facing garage door, right? [1:51:16] that was put in years ago and half the houses in this money have street-facing [1:51:21] grudges. No, you didn't have it. You just have to have your garage by feet [1:51:25] back from the house. Yeah, that's right. The only one that ever did, it was Dan [1:51:29] by it. Yeah, that's better. Yeah, that's better. Yeah, that's a stuffy day. [1:51:33] Yeah, you're probably not going to put it on. No, they look like it. [1:51:38] Anyway, that's an example of another one just like you said. That's just [1:51:42] and that's not enforced, it's not going to be enforced without taking it out. [1:51:48] I think Brandon has some things to do with this. [1:51:50] I'll do a pose for sure. [1:51:52] I'm sorry. [1:51:54] So just kind of like being here for seven months, [1:51:58] most of what has come, of course, [1:52:01] are reason requests. [1:52:04] And they sort of get categorically denied right now, [1:52:08] although in the general plan, [1:52:11] you call my Bible, you know, the chapter in the journal plan, that is where the county is intending to go. [1:52:19] So to me, just seven months of observation, that's a big disconnect. [1:52:24] The county says, we're going here, land use, or land owner comes and says, [1:52:30] Like a reason, and they're all denied. So at what point does the, you know, just the code actually be what the county said it was going to be? Is that happening in this rewrite of the land use code? [1:52:46] No, and it's not going to be great with our own commissioners, but until state requires it, so in Nevada, for instance, [1:52:57] your zoning has to be consistent with your general plan. [1:53:00] If you've got this commercial and somebody wants to come in and choose it to commercial, that happens. [1:53:07] because it's state law, and it's been state law since the late 80s in Nevada, and yet others [1:53:16] discretion given to the legislative body, so the council's kind of commissions that they don't [1:53:25] have to be consistent with the general plan. I found until state law changes or until the [1:53:35] and the commission says to them themselves, [1:53:38] we want to be consistent with this. [1:53:41] There are things to say. [1:53:42] By the way, I'm proud of the business. [1:53:44] Anybody's name. [1:53:45] This one is all right. [1:53:46] The general plan is very behind as well. [1:53:49] Right. [1:53:49] It's a 2030 general plan, and we still have 10 sections. [1:53:54] You're not completely filled out yet. [1:53:56] So like 2030 is, that's what we're going to do. [1:53:59] That's not what I mean up. [1:54:01] So I mean, we're kind of telling this those to be. [1:54:03] you look at the future land use map and quite a few is the same, right? [1:54:06] The line that we've set up is actually only three years away. [1:54:11] The future land use plan really has not been integrated into land use. [1:54:15] That's everything. [1:54:16] And so you're that. [1:54:17] It is. [1:54:17] I'm sorry. [1:54:18] Fire is everything. [1:54:19] All right, that's it. I'm wondering that. [1:54:21] But just just watching what has come before us. [1:54:24] They're not having been a part of any of this before. [1:54:28] To me, that's what I'm seeing the most conflict and we will continue to see that [1:54:33] until we have a land use code update. [1:54:36] That is, but we're saying that is not happening this year. [1:54:40] So there's land use code in this general plan. [1:54:43] Yeah, yeah. [1:54:44] But we're not going to write the general plan into the land use code this year. [1:54:48] It works the other way of direction, right? [1:54:51] Your land use code. [1:54:51] You're not going to save the land use code. [1:54:52] No, fine. [1:54:53] But I just could support the general plan. [1:54:57] Yeah, but I'm saying, but we're how that chapter [1:54:59] for land use in the general plan. [1:55:02] So in, that was like the first thing I got handed was that booklet and so in my mind that's like, you know, what we're working towards, but I don't see it's working towards it and all I feel is conflict with every person who comes to our team and wants to do something. [1:55:19] Sarah, I think there's the way I look at it, there's kind of two types of applicants coming in. [1:55:25] Some of them refer to the future ladies' plan, others don't. [1:55:30] And the ones that don't refer to future ladies' plan, [1:55:33] they're referring to what they're not to do, [1:55:37] and that existing line use code. [1:55:40] Those, I mean, we've been evaluating those [1:55:42] and many of those kind of rules. [1:55:44] Once they're referred to, that's not set up in a way [1:55:52] that you can refer to, you're actually able to get what it's in language school. [1:55:56] Because the terms are different. [1:55:58] The math terms are different than what we have in the land use code. [1:56:02] We also can't rewrite our land use code. [1:56:05] When we have so many broken pieces in part, [1:56:09] we need to clean up the code we have to have a viable document to work from to update these. [1:56:16] So that's a policy decision about the county commission. [1:56:21] And if they want to be consistent with the general plan that they adopted, I'm going to [1:56:28] totalise upon that. [1:56:30] But that's a decision of the County Commission, because the state has not made that [1:56:35] decision yet. [1:56:37] But as you can see, as we go through the ladies' code, and the bylaws and all those good [1:56:42] things, there has been a study movement by the state legislature to take away discretion. [1:56:50] because a lot of legislators are realtors, developers, etc. [1:56:59] And some of them comes up against the community [1:57:02] and didn't like the decision that was made. [1:57:06] Then we kind of ended up looking forward to loosen up [1:57:09] fewer of fewer things. [1:57:11] So the decisions don't kind of apply me to actually work. [1:57:14] So the decisions are moving towards staff of a rule [1:57:17] And so just to know, well, let's take you a little bit. [1:57:21] Honestly, I get that and it's some regard right now to what? [1:57:26] I mean, what are survivors or realtors or even property owner? [1:57:30] If you've got a clear set of requirements, you should be able to do it. [1:57:34] Exactly. [1:57:34] But we don't have the clear set of requirements. [1:57:37] That's what I'm talking about. [1:57:41] Yeah, I mean, good points happen in those conversations because [1:57:46] If they are referring to the future landies or the general plan, [1:57:51] oh, the future map, of course you want to approve something because they are already looking [1:57:57] ahead and they understand the purpose of where they're going, but if we don't have a land use code that [1:58:03] talks to that, then we create a situation that doesn't allow the county any kind of [1:58:17] or just feel like something we become the roadblock, [1:58:21] whether or not our antiquated land use code, [1:58:25] but the county's vision, [1:58:26] the county commission's vision of where you want it to go. [1:58:29] So that's why it's like what's a couple of times. [1:58:34] For a while, you're so many years. [1:58:37] I mean, you're seeing it out loud. [1:58:40] Well, just that's just my observation from seven months. [1:58:44] I mean, I mean, I'm not. [1:58:47] See, this, this, this, you know, the future 90s plan of Spanish Valley. [1:58:54] If the bank mission or current commission has buyers or more on that, we need to fix it. [1:59:02] So that's, again, a policy decision by others. [1:59:08] You doubt that this is really, you know, future 90s vision. [1:59:12] if it's not, you go by it or more, [1:59:15] that's condition, where it is, something else. [1:59:18] There's nothing wrong with saying, [1:59:21] okay, here's our five to 10 universities, [1:59:24] and here's our 10 to 20 universities, [1:59:26] our past that's growing your vision. [1:59:29] So, all people are trained equal, [1:59:32] not all properties are not trained equal, [1:59:35] and some property is more mature for development, [1:59:39] although you want this in the future, you don't want it the next 10 years. [1:59:46] So the general plan should be based out into the next five 10 years after that, [1:59:51] which phase is right, and then you're going to have this where you can have this [1:59:55] somebody wants something now, then they need to put in the infrastructure. [2:00:00] But make sure that it works with what you want in the future in that area. [2:00:05] On the traffic studies, all of them be asking. And you said, you know, we've got to decide, we're kind of telling you, we want to be. [2:00:12] That would happen. Or we're okay. And that's when I looked at, oh, and what it was. So, as I talked about [2:00:22] Now, according to Calazvi, in 10,000 square feet, Africa, [2:00:26] Calazvi in 20,000, when it Calazvi in 40,000 instead of 43, [2:00:31] 560 or the half or fourth of that, I looked through the other 29 counties [2:00:40] to see what they have. [2:00:42] In the end, for instance, Utah County. [2:00:45] Almost a million people live there. [2:00:47] There's a 8,000 in the country of the area. [2:00:49] There are minimum lot of size as five acres, [2:00:55] the most of their zoning is 20 acre, plus size is, [2:01:00] that are a rural county, even with a million people, right? [2:01:03] That's the choice that the county has made. [2:01:06] There's no utilities, no more nothing, right? [2:01:11] You get a haul, your trash to the garbage dump or projects. [2:01:16] But otherwise you're in a syndicate tumble. [2:01:18] And I'd always give a good thing to the city today. [2:01:21] But the city could easily can accelerate right here. [2:01:24] Craig County has developed differently and you've got to ask your question, [2:01:29] do you want to continue to do that? [2:01:34] And the fact of that, I saw, when I look at the, whatever the, [2:01:38] it is from development and prosperity value of plan, [2:01:42] you know, it is very, it is kind of big. [2:01:45] says, you know, well, we've got output some more density or the center more density and protect the edges and all we've got to protect some murals now because we all have some murals stuff and some development up close to my lab it makes kind of general sense for the course that's not as only man and there's a lot of values put in there and as somebody said the other day which is exactly what people did they put little tags or pins same where would you like to vote. [2:02:15] I don't like it around the Spanish curial area. [2:02:19] I'd like to hear around these particular major highways, [2:02:24] but it's still vague. [2:02:25] I mean, it's like, well, they're 18th-Hend, [2:02:28] quit here, only 10, quit here. [2:02:31] And so it is, we really, you know, [2:02:34] I had thought what we were going to do after doing [2:02:37] that future land use map was almost immediately [2:02:43] We do something that we get as toward a zoning map. [2:02:47] It's time we did not do it. [2:02:49] We did not get five four. [2:02:51] And I was. [2:02:52] Yeah, yeah. [2:02:53] You told me about it. [2:02:54] Okay. [2:02:54] It's all of it. [2:02:55] Mary's spread the rumor. [2:02:57] She's excited about it. [2:02:59] And I told you. [2:03:00] I told you. [2:03:00] I told you. [2:03:01] I told you. [2:03:02] I told you. [2:03:03] I told you. [2:03:05] I told you. [2:03:05] So maybe that's a good consideration. [2:03:08] I was looking at a realistic timeline for the planning commission. [2:03:10] have these kinds of conversations? Well, I think that would we plan on with [2:03:15] sub-dating land use code first because they would sort of throw from the [2:03:19] memo all on the zoning trade. But then again, that's the question that I have [2:03:24] because I have people telling me to me what in zone change is or whatever I'm [2:03:29] telling you. [2:03:31] Say, well, I don't know nothing. Yeah, could I go to top positions? Well, [2:03:37] you can be combined with the general plan, [2:03:42] but there's no idea how I was going to [2:03:44] That question has come up with a number of times here and there are answers always been the same. [2:03:50] We have a line you scope today. [2:03:52] You need to be compliant with today's 90s. [2:03:55] When we release the new one, that will give you a different option. [2:03:58] You'll have to be coming behind the window. [2:04:00] And the county council can be commissioned. [2:04:03] As well as be cast for me. [2:04:05] Can just say no for no reason. [2:04:07] I just thought about it. [2:04:08] They can just say no or they just say yes. [2:04:11] And that's happened. [2:04:11] as far as sign language? [2:04:12] But I should give thechool [2:04:14] to fore osith, to [2:04:15] make an kind commission, it [2:04:18] has bipartisan wores [2:04:19] on the Future Lunar [2:04:20] East Plan, a [2:04:22] Spanish valley. [2:04:24] We need to fix [2:04:24] that. I don't think [2:04:25] so, Andrew, that was [2:04:26] just an [2:04:27] initial step. I think we need [2:04:28] to go and we conduct this [2:04:30] about this little bit today. [2:04:32] It faced the next step [2:04:33] to go in的是oting [2:04:34] is what I proposed. [2:04:35] I think it's a [2:04:41] very [2:04:41] you take that plateau area of this room and they never [2:04:44] put a little hole. [2:04:45] And I just know, but meaning like she's [2:04:48] in now, I mean, we're not going to put a hard [2:04:50] stuff, everybody in a zone. [2:04:51] And we're having this meeting and you talk about it. [2:04:55] Little, I wouldn't say neighbor was, but I [2:04:57] however you want to define it, peace by peace. [2:05:00] And because what happened with the future, [2:05:01] man, he's put map, future land is plan. [2:05:05] I was at three of those five meetings. [2:05:06] I don't know how many he had. [2:05:08] But the reality is, we didn't have a huge [2:05:11] channel. You know as maybe there was 20 people I think I saw U.S. of, and people, you know, [2:05:17] for I would, I would, I would, I would, but I think I'll see it as being a very intensive [2:05:23] public process. I don't think we should make those decisions. I think the kind of commission should [2:05:27] make those fight, you know, I think those initial, you know, kind of planning should be [2:05:33] zoned by zoned, made of a binding river and then it moves forward, right? And you let people be involved [2:05:39] And then if they're not on ball, say, hey, I mean, believe me, [2:05:42] a couple of my neighbors are very happy with that map. [2:05:44] And I said, well, Eric, I'll use one person, for example, [2:05:46] I've said, you know, there were meetings. [2:05:49] I had no about those meetings. [2:05:51] It's like, so how do you give a little more intentional [2:05:53] and get people involved? [2:05:55] Well, sorry, whatever it might be. [2:05:56] If you've already done all of them, and I remember [2:05:59] because it was very rough and all that, you know, [2:06:02] and I put every time there was a COVID, [2:06:04] I'd scan it and put my opinion or whatever, it's good. [2:06:06] But so the people, I think the people who did that feel like, well, why did I bother to do that because now five years have passed and there's not a zoning map. [2:06:28] Well, so I think this conversation started with a request for an update on landing a soap gun, then why don't we take that as an extra gift if you could give us a [2:06:46] I didn't do this, maybe that's what I see. [2:06:50] Anything else in future consideration? [2:06:52] I just want to keep that at the forefront of our focus this year. [2:06:57] Last year, when I was appointed, our line news update was the focus. [2:07:02] We did not have one line news code conversation last year. [2:07:07] Quite a bit more progress than that. [2:07:08] We made way more. [2:07:10] And our console has to. [2:07:12] I just want to keep that. [2:07:16] everyone's on the bread burner. I don't want it to move to the back burner. I think the county commission that's on board more of this time [2:07:22] do at least we've sheld out the money and we've got the console and we're going to work. [2:07:28] But anything else for future concerns. [2:07:31] If not, all Jenna, what would you own? [2:07:35] Would you want to say thank-you, sir?! [2:07:38] Who's the assertent io? [2:07:39] I'm not going to say thank you seat! [2:07:41] Well, more than four long things goes? [2:07:45] Okay. [2:07:47] Jimmy, is an [2:07:48] Majesty. [2:07:48] Please. I respect the hand. [2:07:50] Thank you. [2:07:50] I respect the hand. [2:07:51] I respect the hand, I respect the hand. [2:07:52] That's what I would be like. [2:07:55] I would be like,
