[0:04] Time is 6:00 pm we'll call the meeting to order the building advisory appeal board. [0:08] first item on the agenda is the minutes, uh, from monday, april 6th, 2026. [0:16] you review the minutes and then I'll entertain a motion. [1:07] I had like to make a motion. Go ahead. I'd like to make a motion that we [1:11] accept the minutes as is from the [1:15] april 6th meeting. Have a motion. Do I have a second? [1:19] second. I have a second. All in favor, please say aye. Aye. All opposed [1:24] that motion carried by vote. Seven zero. Next item on the agenda [1:28] is a hearing concerning dangerous structure located at 1605 acosta. We'll turn it over [1:32] to staff at this time. [1:40] I don't have a lot to say. [1:46] I'd like to think of my thing would work, but maybe it's not. [1:52] oh, so this is 60 0 5 [1:56] acosta. Remember where it is on the map, uh, [2:02] between beltline and carrier, north of marshall, [2:06] south of south of, uh, jefferson. [2:10] this was the house, or probably the first [2:14] we met back in april of 2025 [2:18] and I got progressive pictures. This was the interior at the time. It's worse [2:22] now than I believe, than it was then. [2:27] progressive pictures, uh, [2:31] the grass gets greener, the holes get a little bit bigger. [2:36] there's a dumpster there. At the time, ms. Malone thought she could secure funding [2:40] to get it, uh, financed and it, it, that didn't come through. [2:46] uh, this was after it [2:50] had come through, but, and they, they, the contractor bought [2:54] materials found out that we had to do a lot more, uh, engineering and study [2:59] to get, get it fixed the correct way. [3:03] and so that was even in last month. [3:10] this was saturday? No, this was today actually. Uh, when [3:14] I went there saturday, there was a, a, an engineer walking [3:18] around measuring with this wheel. And I ask him, hey, are you here for the house? He [3:22] says, yes. And he says, the gentleman that's here tonight to speak with you folks, [3:27] I hired him to do an assessment of what it would take to fix it, what [3:32] y'all asked for to be presented at this meeting. So he, [3:36] he was there on saturday and I commented that if [3:40] things didn't get done in the last minute, that things, so many things get done in the last minute, more [3:44] than any other minute in the, in the day. So, so that's good. So, [3:49] uh, these were the rec [3:54] original recommended findings. It's dangerous in, [3:58] in the 29, 18, all those 2, 2, 7, 9, and 11. And, and, [4:02] uh, oh, it's substandard and then dangerous 29, 28. [4:08] and these were the original orders as a 30 day time period that's been pushed back [4:12] now until june. Uh, and then with the [4:16] order was for someone representing the, the company that's, [4:20] that's, that's got the release, the mortgage representative of the mortgage company [4:25] or attorney to present a de more detailed plan. [4:30] and I believe he was here tonight. I, I spoke to him and he's got a, [4:34] a document that I just, I haven't seen it before you guys did. So [4:39] that's what I got. Gotcha. Any questions to my right? [4:45] any questions to my left? No. No. And chad's back. Thank you. Hi, [4:49] chad. We [4:53] do have a speaker card. Uh, kyle, [4:57] if you would come forward, state your name and address for the record, please [5:02] just tell us your position. Hi, good evening. My name is kyle [5:07] piic. Um, I, business address is, I'm with [5:11] the law firm, barrett dafen, and I'm here on behalf of, uh, the mortgage company, mid first [5:15] bank. That's ms. Malone's mortgage company. My business address is 4 0 0 4 [5:20] beltline road in suite 100. And that's addison, texas 7 5 0 0 1. [5:26] um, thank you for, uh, having me tonight and I apologize for, [5:30] for coming on such short notice. My colleague thomas bracket, who's been here several times, [5:35] uh, he, he's just returning from his, uh, 50th birthday and 15th anniversary, [5:39] uh, today. So he asked me to come down here. Um, he had [5:43] let me know what was going on and what was, what went on at the last meeting. Um, the update [5:48] that I'm aware of is that the, um, mid first bank is willing or [5:52] did come forward and, and offer to take on the cost of the repairs. [5:56] um, the latest progress was that on saturday the [6:00] engineer went out and did prepare the, uh, report, which I provided a copy to [6:04] each of you in front there. Um, I do see that the very last [6:08] page, which is the recommendations page, is in the smallest font possible that I [6:12] couldn't even read. So if you'd like, I'm more than happy to provide the electronic [6:17] copy that I have. Um, so you can take a look at that. Um, [6:22] there's not any sort of real plans. It reads like an engineer's report. It's [6:26] very clinical, um, describing exactly, you know, the, what standards [6:30] needs to be done and, and so on and so forth. So I, I think what, uh, your [6:34] honors are looking for is more of a, a realistic prescription [6:38] of this is what we're gonna do, this is how we're gonna fix these problems, [6:43] more of a plan of attack, more so than just a diagnostic, which I think is what the engineer's report [6:47] is. Um, so I understand that I did request from my client as of [6:51] friday that they have the general contractor who's gonna be overseeing this project here tonight. [6:55] and they told me that that wasn't gonna happen at about 4:00 pm today. [6:59] so I'm here hat in hand, well, I should say report in hand. Um, [7:04] just to reaffirm that from what I've been told, they still plan on going forward with [7:08] the repairs, even knowing what they have in this report and that, um, [7:12] I would carry back your, uh, your directions to them with the emphasis [7:17] on the need to get moving on this. Let's, uh, see if the board has [7:21] any questions. Any questions to my right? [7:25] any questions to my left? No, I have a question. [7:31] so what we were looking for is a timeline [7:35] of completion, not necessarily what type of materials, [7:40] um, you would be using because we understand that's gonna be approved [7:44] from the city as what type of materials you're using. [7:48] but more or less a timeline. It could, it, is that something that we can get? [7:52] how long will it take to complete this job? [7:56] uh, I understand tonight. I don't have an answer for you on that. Okay. I know hiring [8:01] the, um, the engineering age for full scope of the work was really a big part of [8:05] that. Mm-hmm . My understanding of it is that the next step will be for them [8:09] to internally, um, pick a contract or sit down with that. So [8:13] if I can carry that specific instruction that that is a mandate [8:17] from the board to have a, um, [8:22] a specific timeline mm-hmm . Um, for next meeting, that that is something [8:26] I will be able to carry back to them. Okay. Thank you. You're very welcome. [8:32] I and I, there's no other questions. Thank you very much. Thank you. Alright. [8:40] uh, so the chair will entertain any motions at this time. I will remind [8:44] the board then our last motion that we just [8:48] approve the minutes on, advised [8:53] the owner or their representative in the order for a detailed [8:57] progress report of all work completed and [9:01] a projected timeline being presented at the may meeting. [9:06] I don't have a timeline. I don't have a, a detailed report of what work [9:11] was accomplished. Uh, so [9:15] just wanna put that out there for y'all's consideration. [9:20] go ahead and, and just to remind the board, so currently the order is [9:25] actually not set to expire until next month. So the board does not have [9:29] to take any action today. The board can choose to take action, however, the board cannot, [9:33] at this time reduce the time that has already been given. Gotcha. [9:38] thank you. So the chair will [9:42] entertain any motions that the board has. [9:47] go ahead. You need to say something. The board is also more than welcome to share their [9:51] thoughts and comments with the, um, [9:56] attorney if they so wish in the public meeting. [10:02] well, what I was gonna say is the order is in place until june 5th. [10:08] our next meeting is june 1st. [10:14] the expectation is that the timeline, [10:18] the detailed timeline that we asked for last [10:23] meeting is presented on june 1st. [10:28] uh, oh, well this says bay meeting right here, [10:32] that last sentence. Right. But they don't have it. [10:36] right. The, the motion, which was made [10:40] last time and put in the order is they were to appear with a timeline at this meeting mm-hmm [10:44] . But the repairs were not required to be completed until june. [10:49] so at this point okay. They have not complied with the order of the board because they [10:53] have not presented a detailed timeline. Gotcha. [11:07] well, it's my opinion that we don't do [11:11] anything. We, we just allow it to carry out [11:18] as is. [11:25] what are you thinking, miss bull? That there's a really annoying noise that we [11:29] just sorry, like a chirping? Yeah, [11:34] something. Uhhuh, uhhuh , uhhuh, , . I don't know, [11:39] I I'm sorry. I have a follow up to the gentleman sir. I'm sorry. She go ahead. Go ahead. [11:44] did you, just to make sure I, you right you in, you guys with the [11:48] homeowner far as funding that, [11:52] right? Yes, that's correct. We, um, mid first has, uh, stepped up and offered [11:56] to undertake the, um, the cost of the repairs. And in doing so, they're [12:01] also taking on the, um, uh, all the [12:05] organization of and the paperwork of, so, so really ms. Malone, I mean, she's [12:09] not outside of it, obviously, she's benefiting from it and, and she's been great throughout the [12:13] process, but it's not as if we're relying on her to find a contractor. In fact, it [12:17] was, it was sort of the opposite. She wanted to use some of the stuff that people she'd been working with [12:22] and, and mid first has a, a required, no, they have their own set [12:26] of vendors and their own procedure to do that with. So, um, I I [12:30] think long story short is that no, yes, they're gonna come forward, essentially put a lien [12:34] on the back end of her current mortgage, but, um, step up and, and get it fixed [12:38] to full compliance. Perfect. Appreciate that. [12:43] any other questions before we sit stand? [12:48] no further questions. Thank you. Thank you. [12:54] so what is the wishes of the board at this point? [13:00] I'm inclined to, uh, I know, [13:04] put on the record instructions, [13:12] no bearing as said. [13:17] um, question, put record. [13:27] yeah. The second motion and not, don't take any action until that [13:32] fourth listen. So the secretary can add that onto the minutes that y'all [13:37] vote on at the next meeting. And if you believe that whatever's on there does [13:41] not sufficiently reflect the conversation, then y'all can make a motion at that time to amend them, [13:45] to ensure that it reflects that opinion. Great. [13:49] thank you. [13:54] so do we vote on the, the dog action or what? So [13:58] there's not actually a motion. Okay. So you have a couple of different options. Okay. You open the floor up for motions. [14:02] okay. If you don't have a motion in a second, then you can just go ahead and consider this item closed [14:07] and then move on to the next matter on the agenda. Or [14:11] if somebody wants to actually take a, make a motion and have a second [14:16] to just say no action or to say whatever y'all want. [14:20] if there's something you want to do, um, y'all can make a motion on that. [14:25] and you can't limit the timeline [14:29] by which they have. But since you were not [14:34] provided a timeline, if y'all wanted to put some type of a requirement [14:39] on them to provide that to code enforcement by a certain date, you could. [14:43] if you just want them, they're already required to show up at the janu the june 1st meeting. [14:47] so y'all could do no action and they, they could come with that there. [14:51] it's, it's really up to your wishes. Mm-hmm . [14:57] I'd like a to make a motion that we take no action. [15:02] so is that a table or is that would be a table? Would that be considered a table? No, [15:06] just no action. Okay. No action. So have a motion that we take no [15:10] action. Uh, do I have a second? I second. Have a second. All [15:14] in favor, please say aye. Aye. Aye. All opposed, [15:18] that motion's carried by a vote of seven zero. [15:25] next item on the agenda is citizens comments. Don't see [15:29] any citizens out there. Next item on the agenda is [15:33] the adjournment. Uh, need a motion to adjourn, please? I make a motion [15:38] that we adjourn. I have a motion and a second to adjourn. All in favor, [15:42] please say aye. A aye. Carrie, seven zero. We are adjourned at six [15:46] 15. Thank you.
