[17:21] Um, Yeah, I want to let you know we've been [17:24] working in the last 2 weeks on the lawsuit against Earthrise. [17:29] And it was filed this afternoon. So, we don't know who the judge is yet. [17:36] We don't have the case number because we have to wait for the clerk to get back [17:41] to us. But, I just [17:45] uh, wanted to inform everyone. I know I think it was listed on the website that [17:50] there would be a solar update. So, the lawsuit was filed. [17:54] Seven counts. It's 68 pages long. [17:59] Four of the seven counts are alleging constitutional violations. [18:05] Two of them are alleging violations by Will County [18:10] of violating the law by its change to the non-contiguous [18:15] portion in its clean energy statute. It's failure to follow the [18:20] LaSalle-Austin factors. I I don't know what that is, but [18:26] we'll find out from John. So, those and then there's one count for [18:31] an injunction. Steve will probably eventually go in for [18:35] a temporary restraining order. [18:39] Uh, and then he goes on with some other things that aren't related, but um, what [18:43] what we'll do is we'll make sure this gets posted. [19:34] And so, all terms of the application were not [19:39] Uh they had delineated all the wetlands. They [19:44] put down farmed wetlands. Farmed wetland is not a proper delineation. It's a It's [19:49] just a state of being, a wetland being farmed. That's all that [19:53] means. Uh also, the all the agreements with the [19:58] road commissioners had not been completed. [20:01] Um and you know, I I don't know if they agreed and if [20:06] Jim agreed, but something a lot of the other road commissioners had not. [20:10] There's no big agreement. Uh and I don't think that he would [20:14] especially agree regarding the safety of the neighborhood's concern. If anyone's [20:18] ever been there, the drainage and flooding. [20:21] There's many houses in there that just every wish flooded. It's like some [20:25] houses look like they have a moat. So anyway, um [20:30] I tried to get him to it. The state's attorney would not assist us. [20:35] Uh when I when I said that all the agreements had not [20:38] been met and therefore we should not uh vote on this, [20:42] uh he agreed that the good faith clause in the [20:48] um you know, that was in the laws that [20:51] were, you know, outlined for uh [20:55] the the solar company to move forward only applied to road commissioners who [21:00] were not responding. So, if they sent letters [21:04] and they got receipts that they had sent letter. [21:08] And And that was good enough. But [21:12] the state's attorney agreed it did not cover those [21:15] road commissioners who were still working things out. [21:20] So, that was not done. And neither was the road bond. But [21:25] they they went ahead and they they ordered that the board passed [21:29] So, uh I had just gone into the land use department uh a couple of days ago. [21:35] Um and I had asked if that permit had been [21:39] um approved. And they said, "Well, they just did a [21:42] test run." I've never heard of a test run. But um [21:47] and then I said "I want to be notified before that [21:51] permit is issued cuz I want to make sure that those uh wetlands are delineated [21:56] and that those road agreements are done." [21:59] Because, you know, once they pass that through the special use permit, there's [22:05] nobody that you elected that is going to be responsible for making sure that they [22:09] stop. And uh I had tried it to re-invoke [22:13] and one of the members of the uh planning [22:18] department uh said that they had to give me a no on [22:21] that. If uh trying to find out or trying to make [22:25] sure that we were notified before the permit was issued. [22:29] And that's where it stands right now. But, they did say I told them this [22:33] agreement that they would let me know before it was issued so that I could [22:37] have time to prepare and look at that stuff. [22:39] » Great. >> Yeah. Um so, I'm going to let Jim give an [23:04] update on that regarding the solar. [23:09] » Okay. It's all new territory for us out here [23:12] in Green Garden with the road commissioners. [23:15] Um I do meet with them quite a bit. Um over it we meet on a monthly basis [23:19] and then we have a special group with Wilton Center, Manhattan, and [23:23] a few other townships that either are going through it or have been through [23:26] it. Um they write me that a road use [23:29] agreement that which Green Garden does not have any road use agreement with [23:33] Earth Rights for the mineral solar facility. [23:36] Um I don't think Earth Rights has a agreement with the [23:42] other ones either. Um [23:45] but as road commissioners we've kind of [23:47] attacked the problem a little bit different. Um [23:51] I've maintained a good line of communication with them. That's what I [23:54] told them. I said, "I don't agree with what you're doing, [23:57] but I think it's good to talk." So, we do talk to them [24:00] sometimes maybe maybe every 2 months. Um [24:05] and they are pretty easy to talk to. Uh I understand they need something from [24:08] me, so they're not going to be short, but um they did call up in the storm and [24:13] asked if we needed any help, which is pretty nice. [24:17] Um but I did send them [24:20] I hired a firm firm uh located in Central Illinois. [24:25] Um they've dealt with wind farms. I figured that firm would be the most [24:29] experienced if they went with Earth Rights. [24:31] Um so, right now we're in the process that [24:34] they have to sign a professional fee agreement, which means I'm not paying [24:37] for any attorney fees or engineering fees. I I can't do it. You know, the [24:42] the way I look at it is progress has to pay for progress. So, until they sign [24:46] that form there's not going to be really any communication as far as the um [24:50] road use agreement. Um [24:54] but that's that's pretty much it as far as um what's going on with the road [24:58] district. And then one other thing is I believe it was last month a state [25:03] legislature did pass a law that really took away a lot of [25:08] ability to hold these people accountable or do what we need [25:12] as far as wind and solar. Prior to that we could really ask for a lot more. Now [25:19] it put something some legislation that's unreasonable. So [25:23] they do as far as they need in solar when they have this state law that they [25:28] can say that what I'm asking for is unreasonable. [25:30] So this is way beyond me. So I'm going to [25:34] turn it over to figure this out, but as far as you guys know there's no road use [25:38] agreement and right now there's no professional agreement that's signed. So [25:43] we're not even starting on [25:46] » Thank you, Jim. Yeah, and that is a big deal because without that we can't move [25:50] forward. [26:01] » Um I think US Solar is the only other one [26:06] that's trying to come into Green Garden. Um [26:10] but they're a small company. They're kind of sitting on the sidelines and [26:13] they're waiting for Earthrise to [26:17] come and make a move. Is is my guess. So I [26:22] They had to have a conversation with every road commissioner. [26:25] Um and they had the same I had the same My [26:29] attorney sent the forms to them to fill out the [26:31] professional fee agreement. So they haven't signed anything, but [26:35] um I don't hear really too much from them. [26:38] » So that means the same thing there that they're kind of in a holding pattern as [26:42] well. And I haven't received any calls as well. [26:46] So hopefully sometimes no news is good [26:50] news, you know, for us and our position. [26:54] Um Okay, any any other comments regarding [26:58] the solar? >> Uh you know, I have one comment. [27:00] I would just like to make uh one suggestion for uh [27:04] road commissioner. >> Sure. [27:06] » So, um since you're kind of like in the seat of [27:09] power, and [27:11] you realize, obviously, many of the road commissioners out here [27:16] realize that Green Garden Green Garden has a lot of problems with [27:21] flooding. It's a mess. And [27:24] I don't even know how to even fix it. You certainly don't have the funding to [27:28] do all the engineering. Maybe you want to [27:31] try to figure out if we can't get them to pay something for some of this [27:35] funding or for the or pay for the engineering [27:39] to fix what's going to come. Because, you know, [27:43] I know they said that they're going to reroute those drain tiles, but when they [27:46] put 300,000 posts [27:50] smashing in the ground with a hammer, uh [27:53] unless it's raining, you're not going to know what's [27:56] happening. And if there's some way that we could [27:59] maybe uh take some of these lands, we let them restore them back to a wetland, [28:06] and maybe allow for some of the water to collect there. [28:11] If we could get some engineers to work out something [28:14] with the farmers, cuz there's a possibility the farmers could get paid [28:18] for that. It's part of your deal. You could use a [28:21] little bit of leverage in your position to maybe uh [28:25] get ahead of some of this flooding that's going to come. [28:30] So, there's a lot of uh in 1845, they passed a law that said that you [28:35] could drain all these wetlands if you were going to grow food. Now, they're [28:39] not growing food on them. [28:42] So, those wetlands should be either restored or at least everything, [28:47] you know, below them, there should be some sort of [28:50] accommodations. A lot right next to the house that you probably know, that the [28:55] gentleman on the property, there's a lot right [28:59] next door to him. That That could be restored to a wetland. [29:04] Just right there, it's it's already, you know, flooding and low. [29:09] And some of these lots could actually be sold [29:12] or bought or partnered for like land bank with developers. [29:17] And some of them can actually be sold for carbon credits. [29:22] So, there's a lot of things that can be done. [29:24] But, I mean, I I don't even know where to begin. It's a mess. [29:29] You know, with all these Nobody has maps of any of these drain tiles. Nobody [29:33] knows what's going on. Maybe, you know, if somebody with these billions of [29:37] dollars would be able to get them to do some comprehensive engineering [29:41] to help out. [29:45] » Excuse me. Um and then the other thing I did say um [30:33] my point was is I've been driving around and looked at [30:36] their project in Gibson City Gibson City Gibson, [30:39] Illinois, wherever that's at. Central Illinois, whatever the name of it is. [30:43] City of Gibson. Anyways, this really looks terrible. [30:48] If you drive by these solar farms, they look awful. It's like someone's not [30:51] taking care of the the vegetation. So, I said [30:55] I said, "Can you guys just do like 12 or 18 rows of corn around the whole [31:00] perimeter? At least give us a counter shield so we don't have to look at the [31:03] stuff." And he liked the idea. So, I don't know, [31:06] but maybe he'll say he has like another idea that sounds pretty good. Like [31:10] either Calvin or Calvin cuz I do talk to the guy. So, I [31:15] He knows I'm not for it, but I still do take his phone calls and I phone call [31:19] him, he'll take my phone call. So, I just think that's a a good way to do [31:23] business. Um [31:45] next item on the agenda under unfinished business is community services. [31:50] Um I've said this before and um [31:54] you know, it don't only go so far. We've had a couple big hurdles prior to all [31:58] this. Solar is one of them. Town hall is the other. [32:01] Always wanted the community services to take a big lift [32:05] and and begin to really um [32:09] develop these. When we had our [32:14] when I when I would consider a a [32:17] minor disaster, for some it was it was more than that, what just happened with [32:22] the storm, it really would have been good if we had [32:26] volunteers set in place already that could help out. Uh I know I [32:32] was told you know, first of all, Jim, I want to [32:36] thank you know, behalf of the township and and everyone here for the great job [32:41] you've done. You volunteered to do that. Um and as correct me if I'm wrong, Jim, [32:46] as a road commissioner, uh road district, you can't really go on [32:50] someone's property and help them pull it to the street [32:54] because of liability reasons. So, that being said, [33:00] community service, disaster relief, that is somewhat of a disaster that would be [33:05] great if we had some volunteers that would be willing to help somebody that [33:10] has a big lot that's, you know, hundreds and hundreds of feet away. And how do [33:15] they bring it forward? And obviously, you call a professional and you pay for [33:18] it. And that's what we That's our responsibility as homeowners. [33:22] But certainly, the elderly and and others [33:26] that just can't afford it, it'd be great if we could come together as a [33:28] community. So, just wanted to bring that up again to [33:32] the board. Um and ask [33:36] uh the community, we'll probably post this [33:38] on our Facebook page and get the word out. We are looking for volunteers that [33:43] we can have in place so that something like that happens [33:46] again, we make a phone call, we have a [33:49] chairperson, and boom, we're we we start making it happen for people. First of all, submit it to Will County Emergency Management Agency, [34:59] and second of all, submit it directly to Anthony DeLuca [35:03] and ask him Tell him so because I've already talked to him. [35:06] And he will escalate it right to the governor. [35:09] And Mokena has, Frankfort has, all the surrounding communities have, but we [35:14] have It has to come to view. >> Not the township has. We started out with working on drain [42:59] tiles, cleaning them out, jetting jetting them. [43:03] And then we had the big storm that was July [43:07] 27th. Um [43:10] once that storm happened, there is a usually network for public works [43:15] departments, road districts. Um and one of the active days called for [43:19] help. So, I believe it was is it in the day 3:30 all of our roads were cleaned [43:25] out so we could traffic move by. So, the following day the 28th we sent a truck [43:29] there to help them out. Um which is nice to help your neighbors [43:33] out and they're out of control in their town, but you can get through one street [43:38] downtown. Not one street. There was trees all over the place. [43:42] So, um I actually went over there with another [43:45] guy following day started cleaning up a [43:47] little bit and then our residents started bringing stuff out to us. [43:52] So, we had to come back home and take care of our own place, but [43:56] today is the first day that everything was cleaned up so we're good, but I know [44:01] other people will be bringing things out later on. So, we ran a double crew from [44:06] July 28th until now. Um what I'll probably do now is weather [44:10] permitting is just run a single curve one day a week just to [44:14] pick up everything else. I put a timeline on the branch pickups just [44:17] because if I don't, you know, somebody's going to be putting their branch stuff [44:21] in November when I'm trying to plow snow. And it did happen last year, [44:24] believe it or not. So, that's why the timeline is there. I'll still pick them [44:28] up, but it's now it's like sitting out there for a week or a week and a half [44:31] before I get it. Um [44:34] but it was it was really good. The guys did a great job. It was hot, humid. [44:39] The residents were great to them. People stopped up all all times thanking [44:44] us which I really appreciate. Water, food, helped team up there. They feed us [44:48] everybody. It was It was actually really fun. It was [44:51] a lot of hard work, but they enjoyed it. Um [44:56] the other thing was is just the buying with the residents. Pat Howsen Farms, [45:01] Scott Pat Howsen. Thanks to him and the farm. [45:05] Um we use a machine. It's a proper bucket and that saves so much time cuz [45:10] we can pick up three 40-ft trees with this thing, put it in [45:13] the truck, and burn it. And ours broke really day number three. He's like, [45:17] "What about my house?" He's like, "I'll route one." He's like, "I'll pull it to [45:20] my house. Pick it up." So, we use that bucket and we [45:24] he doesn't rent farm equipment from us in the township, but it's nice that you [45:27] can have a relationship like that with our [45:29] residents. [45:34] All right. So, the future, um Michelle Road bridge, hopefully I'll I'll talk [45:38] about this in the future, but still got a few more weeks on it at least. [45:42] Um the bridge is tore out. They started construction. [45:46] Um they have like a temporary wall put in. [45:49] It's probably going to be water and the steel. And then I can see that they have [45:53] um all of the area surveyed for where the [45:56] pylons need to be driven. So, I don't know when they're doing that. I called [46:00] on it uh today and the report wasn't in that shape when but there is progress. [46:06] Uh in August, uh as everyone knows, Christy [46:10] may turn our site. Um they're going to start the chip and [46:13] seal. So, probably the third week of August, again depending on weather. And [46:18] the roads that are going to be chip and seal are going to be West the 45th, and [46:23] Colling Road, Runnels Road, and Doralie. Then, the other roads will be [46:28] 80th and 80th Avenue, and then between [46:32] Colling and Hopper. Got it. [46:37] Uh and then uh [46:39] last major road project for um well, whenever they do it in a year, is [46:46] going to be a mill and overlay on Runnels Road. Um that's going to be [46:50] where Links Edge entrance is on Runnels, and it's going to go all the way to just [46:54] a little bit past Wildhorse entrance. That is it. [46:59] Oh, one more One last thing, too, I did uh [47:02] for the uh reports, um I can I filled out the FEMA for the uh branch pickup. Uh [47:50] Sheral Boyd, particularly right now, is starting to fill in. Um [47:54] but the person that is the developer or or [47:59] owns it uh [48:01] is not is not doing any maintenance on it. So, [48:04] we're trying to push him a little bit. Um [48:07] but they're really not getting any work. So, like the light fixtures, [48:10] um they're not working. Um there's got to be another um [48:15] layer of blacktop put on the roads. Um [48:18] so, the way it works from what I understand, [48:20] I'm kind of This is something new to me. It's [48:23] We haven't had a subdivision built here since [48:25] 2005. It is [48:28] as the developer will come in and at a [48:31] certain point after the houses are built, [48:34] they ask the road commissioner to take the roads over. [48:37] Um at that point, I would go in there just [48:40] like a new house, assess everything, like punch list stuff. [48:43] Street lights need to be fixed, whatever lights broke, curb broke. Um and then [48:47] they would put the last layer of asphalt on. [48:50] Um this person that's in Charlotte Boy [48:53] doesn't sound like this is happening. So, one of the residents is very nervous [48:57] about it. Uh he wrote a letter, I can read it, um [49:00] but that's what it's about. So, there's a letter of credit that should be at the [49:03] county. Um [49:06] the original person had one, but this person doesn't seem to be taking it [49:09] over. So, they'll be there once we have a lot with [49:13] the subdivision that's, you know, been destroyed and not finished up. [49:17] So, uh it's from Tyler Ziever. Uh [49:20] he really wants this on the record cuz he's just trying to fix a problem before [49:24] it gets too late. Um I want to bring this to the attention [49:27] of the board. I did some self-research regarding the subdivision in Charlotte [49:31] Boy in Brown Township. From what I have been able to gather [49:35] from public data, the subdivision was sold and the [49:39] new developer was brought in. The biggest concern currently is that there [49:42] is an active legal responsibility to that developer to ensure the final layer [49:49] is completed. That's the asphalt I'm talking about. [50:00] After speaking with the county they said that the letter of credit [50:05] half a million dollars was indifferent and other than the current developer [50:09] and and we're unable to state whether the letter of credit would apply if the [50:13] current developer failed to face obligation. [50:16] And they had stated they are and the model [50:20] multiple times to get the developer to transfer this information but [50:24] have been unable to do so. I wanted to bring this to the attention of Green [50:28] Garden and that they just may at some point become a large liability [50:32] for either Green Garden, the county or the residents of Shepherd Woods. [1:02:36] The uh So, the road district We're pretty good road district in the [1:02:40] county. We're the third biggest one. We have two full-time employees. I do have [1:02:44] some part-timers. So, [1:02:46] uh in that like a storm, I could hire a few more people and [1:02:49] run that double crew. Uh but, I do come get to I do that [1:02:53] branch pick up. If you want to send the branches out, [1:02:58] just put it so the cut edges are close to the street. Basically, I did [1:03:23] The issue I do have is we do put them out. We try to get them [1:03:27] out as soon as possible, but there's just times that it takes us a week. So, [1:03:32] be prepared for them to be out there for a week or, you know, hopefully less. [1:03:36] Um chip and seal or tar and chip [1:03:40] on the country, there's um it's it's not a paved road, so it's what [1:03:45] it is. It's a gravel road, and then we go [1:03:48] through there and take a um it's it's like a [1:03:53] it's an emulsion. It's almost like a pavement. It's very thin. We only spray [1:03:57] that probably like maybe like 4 cm. And then once that goes down, they'll put a [1:04:03] It's called C16, which is a really small chip. And that goes over it. You need to [1:04:08] do that about two times, and then that gravel road will turn to a hard road. [1:04:13] Um we do it three times, but it's still a good It helps out. It's nowhere near [1:04:17] the strength of pavement. So, when you drive down to the gravel roads, you'll [1:04:21] notice they're can get pretty bumpy cuz they're [1:04:23] not known for their stability. Um that's the other reason for the time [1:04:27] zone road, and then so the [1:04:30] it's called A1 application. The [1:04:34] roads after a while that chip wears off, so I respray on it. So, when they start [1:04:37] getting If you notice, they'll get black some. [1:04:40] And when they get real dark black, that means they're wearing down. So, that's [1:04:43] how you can tell. So, I spray over it. Um and then the last question about the [1:04:47] pavement, Bronx Road, that is from Linkside to the [1:04:52] South Division just to your south. Um on Bronx Road, there's an entrance [1:04:56] with a They'll get milled down 2 and 1/2 in. So, just a machine that comes down [1:05:01] and grinds up that first and that layer of pavement. [1:05:04] And then it will go all the way down to Wildgrass [1:05:07] um with pavement at there. And then once that's done, it's prepped for uh [1:05:12] resurfacing. We still put another 2 and 1/2 in the top. [1:05:15] So, that road will be nice when they're done with that section. [1:05:19] » Do we have a date that that's going to happen or [1:05:22] » The So, the the chip and seal project is going to be in August, weather [1:05:26] permitting and weather permitting. The paving project [1:05:30] I can't give you a date because typically it's done by now, but it's the [1:05:34] same contractor that's doing Route 45.
