We received a written comment via [5:41] our comment submission form on August [5:42] 8th from Mr. Zane Goodwin. Um the [5:46] comment states [5:48] in the June 9th city council minutes the [5:50] city has stated that the H3 project is [5:52] not considered a land action and that [5:55] this conclusion has been affirmed by the [5:56] city planner planning consultant with [5:58] full council. I'm asking the city to [6:00] revisit whether the that responsibly [6:03] addresses appendix A of the Hollyy [6:05] comprehensive plan. Appendix A section [6:07] three states that the planning [6:09] commission shall review and comment on [6:10] proposed land actions and programs that [6:12] may impact resources on the housing [6:14] register of historical resources. Each [6:17] part of that language matters. It says [6:18] shall not pay. It includes both land [6:21] actions and programs, not just land [6:22] actions. And the threshold is whether [6:24] something may impact a registered [6:26] resource, not whether it physically [6:28] alters and demolishes the historic [6:29] building in it. The house at 791 [6:33] Westport Street is on these register of [6:34] historic resources. The city's earlier [6:36] explanation that there's no permit to [6:38] alter or demolish the building appears [6:40] to address a kind of a separate [6:42] provision concerning alteration of and [6:44] demolition permits. It does not appear [6:46] to answer section three uh subsection 4 [6:50] which separately addresses land actions [6:53] and programs that may impact registered [6:54] historic resources. This question is [6:57] more significant now that the August [6:58] council packet describes the final H [7:00] street design as including substantial [7:02] storm water infrastructure, drainage and [7:04] coverts and added system capacity in an [7:06] area where most no storm facilities [7:09] previously existed. Has the city [7:11] determined whether the H street project [7:13] is a program that may impact the house [7:16] under appendix a section 3 section 4? If [7:19] so, please identify where that [7:21] determination can. If not, I [7:23] respectfully ask that to the project be [7:25] referred to the planning commission for [7:26] review and comments required by P for [7:29] construction. [7:31] >> Okay. [7:33] But I just want to clarify that in that [7:36] June meeting we stated it was a land [7:38] action because the land action was [7:41] created by the adoption of the top plan [7:44] and during that land action it [7:46] identified and which previously I mean [7:48] the land the road had been plotted since [7:50] the 1870s but that very specific action [7:53] was a state requirement to do a [7:55] transportation component and that [7:57] transportation component says these are [7:58] roads [7:59] >> right [8:00] >> and they belong to the city and if we [8:01] use them for roads and we improvements [8:03] for roads then that's not a action or [8:06] program. Um and so that is what I just [8:08] want to provide that kind of clarity [8:09] that is why it's not only in action is [8:11] because the action was the comp plan. [8:13] It's in the comprehensive plan, in the [8:15] transportation plan, and also in that [8:17] section of the plan, it says that we'll [8:19] improve pay. You know, that I'm not I [8:22] don't want to misspe because I know I'm [8:24] not speaking verbatim, but it does state [8:26] that we will improve city roads. And so, [8:30] we're not trying to be dismissive, but [8:32] that is why it is not a new action is [8:34] that it's just literally not classified [8:36] as a land action. So we as you know have lots [9:23] of projects some large some also large [9:27] um and the update on inflow and [9:29] infiltration everything frankly is ready [9:32] to start really fired up infiltration [9:35] DQ approved the final bid documents we [9:38] actually have um gone through we are [9:41] developing our timelines which is what I [9:43] will talk about in the September meeting [9:46] and there are certain things that we're [9:47] required to do so the DQ is the funding [9:50] source We are required to send our bid [9:52] documents to them for approval before we [9:54] actually open the procurement. And so [9:56] they've approved, they like the [9:57] language, we followed all their rules [9:58] and their contract language stuff. Our [10:00] legal council reviewed it. Um we added [10:03] the the things that they asked. They [10:05] reviewed it again. Final approval. When [10:08] you do this level of procurement, there [10:09] are certain timelines that are required. [10:11] So we have to close for a certain amount [10:12] of time. We have to provide our notice [10:15] of intent to award. And then we have to [10:18] give seven days after posting that [10:21] notice of intent to award. And it's [10:22] essentially a period of time where other [10:24] people can like object to our award and we would have to provide our [10:30] tabulations and all the things that we [10:31] use to make our determination for the [10:33] contract we selected and then council [10:37] approves our intent to award. So after [10:40] that 70-day window. Um so that's where [10:43] we're at. All of those things are [10:45] timelined through the end of August and [10:47] interly September. When we have the [10:50] intent to award and we have the bid [10:51] packages, we must submit those back to [10:54] DEEQ. [10:56] Again, that's why the September part [10:57] kind of matters, right? [10:58] >> We have to submit them back to DEEQ [11:00] before we can actually award. And so [11:02] they have to review our bid documents, [11:05] our bids that we receive [11:07] >> and our selection criteria and say like, [11:09] yes, we've done everything with [11:10] Fidelity. And then once they approve the [11:13] contract be selected, we are allowed to [11:15] then have council [11:18] make that final or so lots of things [11:21] going on with INI. Much of it very [11:22] technical, timeline driven, not very [11:25] crowded at all. Um, but that's that's [11:28] rocking and rolling. That's exciting. [11:30] Uh, the H Street project, it's design is [11:32] complete for the H Street project. The [11:34] final design, again, it it did include [11:36] some substantial storm water [11:37] infrastructure. Um, [11:41] sections over there where we have [11:42] already done some like French drains and [11:46] things, [11:46] >> right? [11:47] >> So, um you know, just making sure that [11:50] there's proper pulver works. This also, [11:51] as you all know, includes a repair to [11:54] existing storm water infrastructure [11:56] that's actually pretty substantial. It [11:57] goes like all the way underneath H [11:59] Street and and then to the north like [12:02] 300 feet or so. That's an exaggeration [12:06] for sure. I'm wrong on this photo. Like [12:08] 100 feet, but it's a lot. So the whole [12:10] length of it is quite a bit, [12:11] >> right? [12:12] >> And so that's, you know, those those [12:13] things need to be done while the road [12:15] bed is dug up, [12:16] >> right? [12:17] >> But they're adding cost to the project. [12:19] Some of those project costs there is um [12:22] some opportunity for us to use some [12:24] SDCs, but those are very limited [12:26] opportunities. And so we want to be very [12:28] diligent about our research in that [12:29] regard. We are going to bid on this. We [12:33] would like to we are working on the bid [12:35] language to ensure that we're protecting [12:37] ourselves to have the withhold the right [12:40] to cancel the procurement and move the [12:42] larger procurement or cancel items [12:44] within the scope in order to get things [12:46] within budget. Those are all things that [12:47] we're allowed to do. You just want to be [12:48] very very clear in the invitation to bid [12:51] language and the language in that whole [12:53] big packet so that you are covering [12:55] yourself to do those things once you [12:58] start getting into negotiations with [13:00] their um there's also you know threshold [13:03] things. So if the procurement exceeds [13:06] 250,000 [13:07] to one person then it bumps into a [13:11] higher level of legal review and some [13:13] extra steps. It also bumps it into a [13:15] review that would require us to go [13:17] through a sealed bid more formal [13:19] process. We don't anticipate one [13:21] contractor. It should not be that one [13:23] contractor would exceed that amount, but [13:26] we just want to build in those [13:27] protections in the procurement even [13:28] though we're paying to have to go back [13:29] to bid, you know, [13:32] >> we are um positioning ourselves to [13:35] regroup and do the whole process if it [13:37] turns out that we need to. Um, but that [13:40] one I'm writing now. It's very technical [13:44] soon. We're gonna post that bid soon. [13:46] It's really just about and and frankly [13:48] once I write it, I have to send it to a [13:50] legal team review, but it's ready to go. [13:53] Um, I'll also double check with uh ODOT [13:56] because it is a ODOT grant, [13:58] >> right? [13:58] >> To see if they have any I'll review and [14:01] see if we have to send it for to them [14:02] for review as well. Sometimes that's [14:04] true. Um well 24 of park projects as you [14:09] know it turns out we have to do one more [14:11] pathway and fortunately there was [14:12] leftover grant funds to do so. If you [14:14] haven't seen them yet they should be in [14:15] the park today. It is considered a small [14:18] project. It'll be nice to be able to [14:19] have something that we were easily baked [14:21] to easy to take to procure it. Get it [14:23] turned around and be finished this week. [14:25] Uh that will create a path that goes [14:27] from the updated path that we put in [14:30] last year to one of the benches by the [14:33] new playground. So, it'll just line [14:34] right up. I think the only change order [14:36] we might have now that they're on site [14:38] is that we realized that the bench [14:44] like the bench cement, [14:45] >> they're 4 feet by eight, but APA for a [14:48] walkway is recommended at 5 to six feet. [14:52] So, our path, our existing path is 5t [14:54] wide. The path that we are putting in, [14:56] we can't do path that we're putting in [14:58] to the playground also 5t wide. So we [15:01] may there is funding left over. We may [15:05] if the change order doesn't result in in [15:08] too if it's not too much of a hassle [15:10] actually create like an additional path [15:12] on that back side of an additional foot [15:13] so that it's at least square. So all of my [15:40] hopes and dreams about planting in the [15:42] spring have been not come to fruition [15:44] several times. So this year we are [15:46] planting trees in the fall. Plant them [15:48] not in the fall or spring. It just is [15:50] really hard. It's a lot more effort and [15:52] not the best practice. Um and then also, [15:54] you know, we put in the annual flowers [15:57] under the sign. And so I think it would [15:59] be nice to consider what things are good [16:00] for fall planting and start [16:01] transitioning to those to perennials [16:03] that won't be like the annual invest [16:06] like spending money on all those flowers [16:07] every year um when we could pick other [16:10] more native solutions. As you guys know we [16:38] have different buckets of money for the [16:40] grant. Both of them EPA both of them [16:42] from different granting agencies. We're [16:44] so grateful. [16:46] We are [16:47] um so [16:52] I've sent all of the followup [16:53] documentation to the people that we got [16:55] the $350,000 grant from. but they're a [16:57] pass through an eight. And so we got [16:59] that grant through an organization [17:00] called Philanthropy Northwest who [17:02] essentially was the recipient of the [17:03] grant and they subor these EPA cuts. We [17:06] still have to follow all the EPA rules, [17:07] but they're I talked to them and then [17:09] they talked to the EPA. So I they say [17:11] EPA wants this. I send it to them. Well, [17:13] I had a conference with our pre-awward [17:16] officer with the $700,000 loan and asked [17:20] a million questions and I um we [17:25] discussed that we were hoping to merge [17:27] the cross cutters and say, "Hey, what [17:29] about the rest of this project? Can we [17:31] just add it to this already active [17:33] review?" And she would like to keep them [17:35] separate. Here was the benefit of that [17:37] meeting. [17:38] was with the EPA. [17:40] >> Yeah. [17:41] >> Oh, good. So I feel like the way that [17:43] she was able to address my questions and [17:45] no I mean absolutely I've been the other [17:47] agency has been very helpful but to [17:49] speak directly to the agency that you're [17:51] receiving the money for that like enacts [17:52] the rules uh it was really really [17:55] beneficial. I actually pulled out the [17:57] site plan and showed her the area and [17:59] what would go where, where the grand [18:01] survey like on Google Earth and she [18:05] was optimistic that it was going to be [18:07] easy to get through the process of [18:08] shift. [18:10] >> Again, we cannot hold over to that. [18:13] Right. [18:13] >> Right. [18:14] >> She did not make any promises, but it [18:16] was very um reassuring that it is again [18:20] it's not a high impact project. It is on [18:22] already developed area. is on our public [18:24] works, you know, it's in our public [18:26] workshop. So those things are all voting [18:28] very well for us. So like fingers [18:31] crossed we will get the exemption that [18:32] we're [18:33] >> good [18:33] >> the exemption from the deep dive review. [18:35] This is this is the top this is the [18:37] first review. [18:41] I am actively writing a I also want [18:44] about making sure an engineer record is [18:46] compliant with any of the federal [18:48] recruitment rules because a engineer [18:50] record on a federal grant project. You [18:52] can but there are a lot of rules about [18:54] it. [18:56] >> And so I asked all the questions about [18:58] that so that um we are going to go for [19:01] another engineer record. We are still [19:02] going to work with our current engineer [19:03] record. We're just deepening our bench. [19:05] We've talked about it a lot. I got all [19:07] the information I need. So I'm [19:08] developing that so we can go off for [19:09] engineer engineer of record. I also will [19:11] be calling meeting with our integrator [19:13] of record which is basically our water [19:14] treatment plant programmer to start [19:17] really refining that portion of the [19:18] project. Um as you know we've had some [19:21] hiccups at the water treatment plant as [19:23] of late and they have been frustrating [19:25] and there it's showing its age. The guys [19:27] are really good about keeping it running [19:29] but it is showing its age. So, we're [19:31] trying to position ourselves so that as [19:33] soon as we get through that [19:35] environmental review step, we are ready [19:38] for we are just ready to develop bid [19:40] packages and go to construction. Um, I [19:43] also got approval once there's a couple [19:45] more chat boxes we need to check, but [19:47] some of the things that we will need for [19:48] the water trainer plan, the computer [19:50] components, some of them in talking to [19:53] the integrators, the people who come out [19:54] and do our programming and help us when [19:56] our automations are not working right or [19:58] something's going on. Um they had [20:01] mentioned that there are things that are [20:02] like six months out to order. And so I [20:06] Yeah. And so one of the things that we [20:09] want to do is again with that we want to [20:10] make sure that we're compliant with all [20:12] the rules. There's so many rules of [20:13] federal advance. It's such hard money [20:15] but we're grateful again. um if we could [20:19] purchase those items [20:21] prior to completion of the environmental [20:23] review [20:25] and if they are supply purchases under a [20:27] certain cost threshold which all of them [20:29] should be that is allowance. So once we [20:34] like really have the scope of what we're [20:35] going to need [20:37] >> um in in discussions with the [20:38] integrators, we can actually start [20:40] ordering stuff [20:42] >> and get it on the shelf and be ready [20:43] again. We des we [20:56] did discuss all project activities. Um, [20:59] and so there's going to be kind of a big [21:00] push in early September. One of the [21:03] things that we that is going to be [21:05] asking is to participate in an [21:07] interactive map. Like we want feedback [21:09] from people who see kids walking to [21:12] school, who have kids walking to school, [21:14] drive and pick up their kids, but are [21:15] like navigating that whole drop off [21:17] pickup situation at the elementary [21:19] school in particular. And so this [21:21] interactive map allows community members [21:23] to like go to a easy to access site, [21:26] click on parts of like it's going to be [21:28] like a map of our town and click on [21:29] sections and make your comments on what [21:32] issues you're seeing there. you can just [21:34] like and we also requested if they could [21:36] provide like a short three minute um you [21:39] know one to three minute just like this [21:41] is how it works video so we could [21:43] develop like a landing page on the [21:46] quality website that has some of those [21:48] like supporting materials to help people [21:49] navigate that tool. Um, we are going to [21:56] have enough materials to have a little [21:59] bit of an info booth like coming soon [22:01] and potentially even actually like QR [22:03] codes and postcards and things for [22:05] people to start participating at the [22:07] summer barbecue. Stacy and I [22:18] also discussed, counselor Strauss and I [22:20] also discussed um that we would [22:25] meet up at the school during pick up and [22:27] drop off and literally hand things out [22:30] to people. We're going [22:42] to be doing that. So, we're going to [22:43] really try to get the word out. Um, and [22:45] that project goes on. So, a lot of fall [22:48] stuff coming up. Uh, SMAT, so much so [22:51] much updates, you guys. Smack has been [22:53] hard at work this summer. Um, we [22:55] definitely spent winter and spring [22:59] restructuring. We've talked about how we [23:01] went through the first long session. We [23:03] partnered with a lobbyist, end up not [23:05] being a good fit. got through that long [23:07] session and you know back in 2024 and [23:10] then following that we parted ways with [23:12] that lobbyist and we have essentially [23:14] been restructuring. So we spent 2025 [23:16] getting things back together doing some [23:18] restructuring figuring out what SMAP [23:20] looks like going forward and then we [23:23] started delegating tasks. We have [23:25] started having monthly meetings and we [23:29] are moving forward some with onboarding [23:32] a new lobbyist firm consultants group [23:34] and um really looking into we've been [23:37] providing some council training [23:38] opportunities. So we're really [23:41] I feel like it's rock and rolling and [23:42] our goal is really the next step is that [23:44] we are really trying to [23:46] you know and so the effort of smack is [23:49] to bring advocacy to the issues that [23:53] face small city governments and to do [23:57] that you know we really need our elected [23:59] officials to feel emboldened and like [24:03] they understand how to do that that you [24:05] know if they have an interest in it that [24:07] they're prepared to and that we're, you [24:09] know, really dialed into talking to our [24:11] legislators when we have, you know, [24:12] unfunded mandates and other issues that [24:14] come down from the state that maybe are [24:17] not in alignment with home rule, [24:19] >> right? [24:19] >> So, um, you know, that's really where [24:21] we're at with that. We do have, now that [24:23] we're feeling like we've really [24:25] solidified the restructuring, [24:28] we will be very serious this fall about [24:31] going out and doing recruiting at other [24:32] cities. And that means visiting other [24:34] city councils. So that will be some of [24:37] the city administrators from partner [24:39] cities and some members of council from [24:41] partner cities that that are interested [24:43] in participating in those efforts. [24:45] Um more to come [24:51] barbecue as well. This is our 150th year [24:54] anniversary. We are planning a bunch [24:56] more fun things and we really need [24:58] volunteers. [31:14] » Okay. [31:18] Then the next one is my report. [31:19] Basically, I'm going to focus on the [31:21] Oregon Mayor Association conference I [31:23] just got back from. Um on these [31:26] conferences I I tend to be pretty strict [31:31] on the reason if I'm going to go or not. [31:33] I use my three article rules for [31:36] magazines. It has to have three good [31:38] articles before I'll buy a magazine. [31:40] We'll do the same thing with the [31:41] conferences. But this year there were [31:43] [clears throat] five. So it was a really [31:45] good uh opportunity. [31:49] A little bit less participation from [31:51] some of the mayors around the state. Um [31:52] I think most that's probably due to [31:54] fires. Um but we had sessions on leading [31:58] with purpose, civility, and working [32:00] together uh in the community. Gave more [32:03] community involvement engagement. Uh we [32:06] discussed the 2026 [32:09] uh legislature 27th session. I'm on the [32:13] government affairs committee for LOC. [32:16] And so we had a lot of talk about what [32:18] we're going to focus on, what had some [32:20] wins, some losses this last short [32:23] session. Um, [32:26] so we're going to be discussing some of [32:27] that a little bit later in the meeting. [32:31] The other one is returning stability to [32:33] governance. And what that is is making [32:34] sure that we don't have [32:38] such heated uh arguments. Unfortunately, [32:41] in our organization, we don't. We tend [32:44] to get along pretty well. I'm thankful [32:46] for that. And then the biggest one I [32:49] found be the most interesting was how [32:51] the state and federal courts have [32:52] impacted Oregon cities in the past year. [32:56] And if you've watched the news and read [32:58] the paper, it's been a lot a lot of [33:00] stuff that's come down in the courts um [33:04] positive and negatives. [33:06] uh about [33:09] probably the biggest negatives were a [33:11] lot of uh unfunded mandates uh coming [33:14] down and the court saying uh no you [33:16] can't do that. There were two cases [33:18] where [33:20] they kind of dropped the ball and didn't [33:22] address them. Uh there's some court [33:25] cases coming up uh that probably won't [33:27] be doing anything for the next at least [33:29] year, possibly two that's going to have [33:31] some positive impact on Oregon cities [33:34] and LOC will be sending out some [33:36] information on that hopefully in the [33:38] next month or two. Um, and then part of [33:42] my [33:43] reason for going in is remote expat [33:47] and [33:49] was nice to print off some some pages [33:52] and I got a lot of those distributed. [33:54] Lots of positive responses, [33:59] a lot of responses from communities in [34:01] eastern Oregon, central Oregon, and the [34:04] coastal uh communities. [34:08] And I was surprised when one of the LC [34:11] lobbyists that was there um spoke very [34:14] highly of what Smack's been doing. So I [34:17] think we're we're seeing some uh [34:20] positive return on our investment time [34:23] and money. Uh there was one of the uh [34:26] governors [34:29] oh at the term basically regional [34:31] advisors was there and and spoken very [34:34] highly and said that the governor is [34:36] quite impressed with smack. Um so the [34:39] governor's hearing about it we're making [34:41] decent headway. [34:43] >> So [34:43] >> that's awesome to hear since it's like [34:45] new and we're just pushing it again. [41:30] the proposed street vacation of West A [41:32] and West B Street. [41:36] We received an update on the status of [41:37] the vacation and prepare for executive [41:39] session. [41:41] You would [41:42] >> um yeah, you know, it's really a [41:44] timeline. This application has been a [41:46] bit of a there's some weird stuff going [41:47] on over there talk about. There is the a [41:52] street which has [41:54] an overlying ownership by one party with [41:57] a budding a surrounding ownership of [41:59] another party and then there's also the [42:01] underlying predated ownership of the [42:03] city have a plat predates everything and [42:06] so when we receive information we we do [42:10] our due diligence we work with engineers [42:13] and we take applications but [42:18] there has been some issues about whether [42:20] or not that that a street piece in [42:22] particular um is under question. And so [42:26] we just want to make sure that we're [42:27] doing our absolute due diligence on that [42:30] matter. Um we need to make sure that the [42:33] initial application is valid and we need [42:36] to really hold and discuss with our [42:39] legal counsel before we proceed. And so [42:41] that is why we've really done the [42:43] executive session is to make sure that [42:45] we're talking those issues through. we [42:47] have that opportunity to have, you know, [42:49] council with our legal and that we're [42:50] making all the correct steps because [42:52] that has always been the city's intent that we don't want to have a [42:58] misstep. We want correct information so [43:00] that we can so you guys can make [43:01] informed corrections. [43:04] >> So, are we getting good information from [43:06] the county? [43:08] You know, [43:11] there's there's a lot of research that [43:13] went into this even before the initial [43:14] application and um Audrey spent a lot of [43:18] time on it. So that that area period, it [43:21] has that weird six foot section, [43:22] >> right, [43:23] >> between the and the south property [43:25] owners. That is very unusual. That does [43:27] not happen. So that sixoot section is [43:30] part of the church plot, but it is like [43:33] doesn't make sense, [43:34] >> right? Um so we had to do a ton of [43:37] research on that and then again um you [43:40] know we're getting deed history through [43:42] the engineers. We have contacted the [43:45] county and the county has you know I've [43:49] just been like [43:51] the existence of the row and whether or [43:52] not the afferment and what information [43:54] they have on it. Um what information how [43:56] they interpret the the existing the deed [43:58] record and all those things like that we [44:00] use the county as the agency of record [44:03] with situations. We don't try to make it [44:05] up. They are the agency who determines [44:07] how land is distributed. Also, when we [44:09] do vacations, we must report them with [44:11] the county or they don't exist, [44:14] >> right? [44:15] >> And so, the county is the one that gets [44:16] to determine how those are distributed. [44:18] We don't have the authority to do that. [44:20] We have the authority to vacate or not [44:22] to vacate, period. And so, again, if you [44:26] have an application, it's it's very [44:28] common for our street vacation 99.9% of [44:31] the time to be a central lane split. And [44:33] so when you have an applicant that's a [44:34] property, we took an application of that [44:37] regard. We just want to make sure that [44:38] we're doing [44:40] everything right. That is really what it [44:42] is. We want to make sure that the [44:44] application is valid. We want to make [44:46] sure that we're making the right [44:47] decisions with all of the information [44:50] because [44:53] >> the city doesn't actually benefit from [44:55] anything else for that. So, um I'm my [47:57] assumption is and so the attorney that [48:00] pointed out to me, hey, because we were [48:04] a little lost and so we had a land use [48:07] attorney in Eugene um look at this for [48:10] us. And he wrote back to me and said, "I [48:14] don't know why a street is an issue. It [48:16] was vacated in 1978. Should be a [48:18] non-issue." [48:20] And I was like, [48:24] okay. Um, which makes sense why that is, [48:29] you know, especially when you go log [48:30] into GIS, why that's already adjacent to [48:33] our property and in our labeled [48:35] description of our deed. So [1:00:53] that means that like the guy with [1:00:54] cooking and broom being paid $4 like it [1:00:59] just I'm and [1:01:01] I'm not saying that I don't want to see [1:01:04] or trades people in a brew call or [1:01:05] people making good money but I think [1:01:06] that it makes um I think that it is [1:01:13] perhaps not the most efficient [1:01:15] >> right [1:01:15] >> effective and responsible use of public [1:01:18] funds [1:01:20] frequently I mean even our grants are [1:01:21] often taxpayer dollars [1:01:23] um our project, our money is taxpayer [1:01:25] dollars or it's a feast. Um it is public [1:01:28] money and so that prevailing wage [1:01:31] threshold we see a need for it to be [1:01:33] raised so that that project limit [1:01:36] doesn't get hit until higher. They are [1:01:38] proposing 86,000. The other reason why [1:01:40] this one falls on my radar is because [1:01:42] our tax efforts are coming up with some [1:01:44] policy [1:01:46] priorities and one of them [1:01:51] on their and we also support this. I [1:01:53] will say however that we think 6,000 is [1:01:57] dismal [1:01:59] actually with what it would be if it [1:02:00] would have kept number 10. [1:02:03] >> And so we're our our policy is actually [1:02:06] quite a bit higher above 200,000 because [1:02:10] >> a $50,000 project is like nothing and it [1:02:14] >> might have a ceiling at all. [1:02:19] Um [1:02:20] >> anyway, [1:02:21] >> I think that to to object to and to undo [1:02:25] the existence mining wage is another [1:02:27] discussion. [laughter] [1:02:31] » Yes. I have an example [1:02:43] in my back pocket from Brownsville where [1:02:45] they had a bathroom project that they [1:02:48] had gone in and were going to be where [1:02:51] it was estimated to be, you know, [1:02:53] $49,000. [1:02:55] And so they were advised that they [1:02:57] should just go ahead with the [1:02:58] procurement that would assume a bid [1:03:00] higher than that because one change [1:03:02] order, just one whatever would have put [1:03:04] them in that special in trouble [1:03:06] >> for not following your procurement p [1:03:08] practice and not doing the bullying [1:03:10] prevailing weight. And so when they went [1:03:11] to bid, they they put in a requirements [1:03:13] for prevailing wage and it was a 90 I [1:03:15] would say $96,000 for one per bathroom. [1:03:19] That is the kind of impact [1:03:22] that [1:03:24] this [1:03:25] kind of impact to how much money it cost [1:03:27] to complete a project. And that's also [1:03:29] when you see things where like people [1:03:31] say, I don't understand why the school [1:03:32] can't fix this or the city can't fix [1:03:33] this or why would the project cost that [1:03:35] much. We are subject to much more [1:03:37] scrutiny in our design in our [1:03:40] expectation the things we have to put [1:03:42] into projects but reporting requirements [1:03:44] all those things and we are subject to [1:03:47] this public impairment rule that means [1:03:50] that immediately the trucks [1:03:53] it's it's on average about 40%. is huge [1:03:57] and it's pretty I mean small communities [1:04:00] predominantly are being hammered or and having projects when they can't [1:04:05] complete their water systems or anything [1:04:09] like that because of that. Um [1:04:12] there's two others that are really [1:04:14] important to uh the governing committee. [1:04:16] One is the administrative procedures act [1:04:18] forth and what that is it's the rules [1:04:21] that state agencies must follow [1:04:24] and over the years it has gotten murkier [1:04:27] and murkier and murkier where it was [1:04:30] originally designed for transparency and [1:04:32] it is anything but [1:04:34] um and what that would do is force state [1:04:36] to kind of [1:04:39] I don't say reign in uh agencies [1:04:43] but as would the state legislature, [1:04:47] there's oversight when they create laws, [1:04:49] but once it gets down to an agency who [1:04:52] creates administrative rules, there is [1:04:55] almost zero oversight. And we run into [1:04:58] that as a small committee when you're [1:04:59] trying to [1:05:02] do wells and and and water systems to [1:05:06] where you talk to one person in the [1:05:07] agency and they say one thing and and [1:05:10] another person you talk to says [1:05:11] something completely different and get a [1:05:14] bottleneck. [1:05:16] So that's trying to get that [1:05:18] clearly updated from 1971 to today you [1:05:22] know. Uh then the next one's public [1:05:25] meeting law clarity and that's [1:05:26] predominantly towards uh the Oregon [1:05:29] government ethics commission and [1:05:34] there's never really been an intentions [1:05:36] requirement that the proven intent and [1:05:40] just we think you are that's it. Uh but [1:05:44] there's more than that too. uh the hot [1:05:47] dog rule. Remember guys talking about [1:05:50] that where [1:05:52] um if we have a meeting planning meeting [1:05:54] we can't provide boot because it's [1:05:57] considered payment kind that got a lot [1:06:00] of push back and OGAC resented that so [1:06:04] that that's where they're starting to [1:06:06] realize oh maybe we are overstepping [1:06:09] u so those are the two real big ones uh [1:06:12] that we've talked about.
