[5:11] [5:29] Signs or presentations. [5:30] You certainly can have a printed presentation and that [5:33] to Dr. Brown here at the end and the board [5:35] will receive that and ensure that it is in the public record, [5:38] you don't have to fill out a card, [5:40] but a card does help us get specific information [5:43] from a district back to a constituent [5:46] or citizen who wishes to speak. [5:47] Is there anyone here wishes to speak at citizens time [5:49] by a show of hands? [5:50] 1 to 3. [5:52] And what else? [5:53] OK You have Five minutes each saying that to five minutes. [5:56] Please come forward State your name. [5:58] Your name. [5:59] The district that you live or the entity that you represent [6:01] Thank you for being with us State amy Mendelson [6:04] Chili from South Anna. [6:06] I had a couple of things. [6:07] I think I can check. [6:08] One thing off. [6:09] Thank you But I have I just happen to look at this. [6:13] And there are six rezoning cases and that usually [6:16] involves just a single person and having to have a community [6:20] meeting and have rezonings. [6:22] And for ideas or for proffers And we still have by right [6:27] data centers in Hanover. [6:28] So in other words, these people have [6:30] had to put in months of time to get their lot [6:33] for their grandmother but yet we still have [6:36] my right without any scrutiny. [6:39] So I'd like to for you all to consider getting rid of that. [6:42] And then also Appreciate the opportunity [6:44] at the Community development committee meetings [6:46] to hear what's going on. [6:49] But I did notice for the presentation [6:51] that Jay presentation it just seems like it's old information [6:56] when I Googled it or when I've read it in the past, [6:59] a lot of the information that you're hearing [7:01] is between 10 and 7 years old or ten and three years old. [7:05] And so just to consider maybe other sources, [7:08] maybe other legislative reports from other states [7:11] might feel authoritative and give you some more information [7:15] to make decisions for the new. [7:18] Parameters around data centers Thank you. [7:20] Thank you. [7:20] Thanks. [7:21] Next speaker, please. [7:23] Thank you for being with us Rob Wilhoit. [7:32] Chick, how a district. [7:33] I want to lead off with tonight. [7:35] These meetings are important to me [7:37] because I'm missing the wife's birthday dinner with the family [7:40] tonight to be here in front of you all. [7:43] So don't think that I take coming up here [7:45] lightly with that being said. [7:48] The planning commission meeting last week was a mess They [7:53] voted against staff's letter. [7:55] They voted against And this is in regards to Iron Horse. [7:59] They voted against ms.. [8:01] Iverson's recommendations They invoked [8:04] China into the conversation. [8:06] For God's sakes water usage was about as clear as mud. [8:10] They were. [8:11] Numbers flying all around this room last week about gallons [8:14] use this. [8:14] And it was supposed to have been a close loop system. [8:17] So what do they need all this water for? [8:20] So when this gets in front of y'all of course, [8:24] I want to say no. [8:25] But you know even though a project [8:28] checks all the boxes off, that doesn't make it a good project. [8:32] So when it comes in front of you all next month or October, [8:35] I hope you all take that in consideration kind [8:37] of on the lines with the planning commission, [8:43] a lot of them said last week and they've said it in the past, [8:46] y'all the buck stops with your so to me, why do [8:50] we need a planning commission? [8:51] We take care. [8:52] Bunch of money. [8:53] Staff could report directly to you. [8:55] All and then you all could vote from that. [8:57] Because to me if they're saying, Well, [9:00] y'all are political, which you shouldn't be [9:03] this isn't a politics. [9:05] It's zoning But if they're going to take that attitude [9:10] maybe we don't need them. [9:11] Now, that's a pipe dream. [9:13] So I. Recommendation is when each one of y'all come up [9:17] for reelection and you all should inform the general public [9:20] as to who you're going to pick for the planning Commission [9:23] because it's like the election for President Vice president [9:27] Both can run things, but you need to know where they stand [9:33] before they put it into office because we can't get [9:35] rid of the Planning Commission. [9:36] The only way we can do that is. [9:38] Is change all. [9:39] And I'm pretty happy with the board. [9:41] So just some things to consider. [9:44] This was going long. [9:45] One of the other cases night, I'll [9:47] be brief Thank you very much. [9:49] Thank you. [9:49] Mr.. [9:49] Wilhoit. [9:50] Next speaker, please Thank you for being with us Good evening, [10:01] Mark Turner, Beaver damnedest trick Thanks for the time [10:07] this evening, and thank you for creating the Community [10:11] Development Committee that studying data center [10:14] and the future I would have liked to have seen as I said [10:18] last week that two years ago, I think it would have been very [10:21] helpful for you folks and the citizens of Hanover to have [10:26] done that study Two years ago. [10:28] Lot of things were hidden at that time. [10:31] A lot of things are now discovered [10:33] and you're still discovering it. [10:35] And I hope you continue If there's anything [10:38] I can do personally to help you with that effort, [10:41] I'll be glad to do so Now to the other meeting that took place [10:46] last week which was already referenced [10:50] was the Planning Commission. [10:51] Passage of the trade port moving forward to you folks Trade port [10:57] Hanover as i think a lot of you know, [11:00] I've been dealing with this for over Four years now. [11:03] Originally and still commercial and now data [11:06] center for the last Two and a half years. [11:10] I'm disappointed in the vote, but I'm also disappointed [11:13] in the way it was handled. [11:15] The meeting was handled by the commissioners first, [11:19] only two commissioners, Emily acknowledged [11:23] the effort that you folks are doing on the data center study. [11:29] The other five didn't even mention it. [11:32] I thought that was a little weird Second, that also use [11:38] the excuse of moving forward with data centers, [11:41] not just trade Port Hanover, but data centers because it seemed [11:46] like it was their job to support the country in defeating China. [11:51] On AI and technology. [11:53] 3 of the commissioners actually said [11:55] that in their in their talk, I think they were appointed [12:00] to serve the people of Hanover County not the country [12:04] fighting China And that was very well pointed [12:08] out in their discussion. [12:10] I think it's wrong Third, and I know i probably beat this [12:17] to horse to death, but I believe that the planning commission [12:24] accept the as fact, the threats that the developer [12:30] West bellows is still using about developing this. [12:35] If the data centers turn down East Ashland [12:40] I think you're planning director. [12:43] Director of Planning gave a position paper [12:46] to the attorney that said it can't be automatically [12:52] developed by right East Ashland concept [12:56] and for a lot of good reasons. [12:58] I read that letter again this evening [13:01] corresponded with Joanna's as well, and tried to clarify that. [13:06] But based on everything I've heard and seen, [13:09] it can't be developed by. [13:11] Right. [13:12] I think it's a threat. [13:14] I think that the Planning Commission should [13:16] have stood up to that threat. [13:18] But in the end, they all voted the five [13:21] that voted for it said, well, we've [13:23] got a choice, that a center or east Ashland data center, [13:26] if actually that Believe that to be the case. [13:29] But that's exactly why they voted [13:31] for during the whole planning commission meeting [13:37] we had at least 20 speak opposed to the iron Horse project very [13:45] well spoken, very well thought out argument against We [13:53] had a few opposed during the planning commissioners summaries [13:58] before they voted, not a single person [14:00] acknowledged those 20 people that had a good argument. [14:05] They asked. [14:06] They had one person that they acknowledged and thanked, [14:10] and that was a proponent One person. [14:14] And it was very clear that that was made [14:18] for a special acknowledgment. [14:20] That person spoke up and opposed this terrible that the data [14:27] center So I consider, as I think the other gentleman said, [14:32] you have 30s in last week's hearing a joke. [14:36] And I think you need to kind of maybe [14:40] control your planning commissioner [14:43] and if not, replace them. [14:46] Thank you for your time Thank you. [14:48] Anyone further? [14:50] Anyone We will. [14:51] Now closer to the time chair recognizes Ms.. [14:53] Pritchard Thank you, Mr. Chair It was brought to our attention [14:58] earlier that today marks 106 years since women got the right [15:05] to vote in the United States. [15:06] And I've been given some wonderful remarks [15:09] that I intend to read out loud. [15:10] And we will put these in the record, [15:13] you all know that the nation is celebrating our 250th [15:16] anniversary, and Hanover county has been an integral [15:20] part in our nation's history. [15:22] And women in Hanover are a valuable part of the community [15:26] in their homes, places of worship, [15:28] institutions of learning, farms, businesses and various [15:32] civic and public organizations. [15:35] And knowing the story of women in Hanover in riches, [15:39] our understanding of history and provides essential role models [15:43] for everyone and women in the United States have continuously [15:48] worked to gain full rights and responsibilities Public [15:51] or private legal or institutional as citizens [15:55] of the United States on August the 26th, [16:00] Congress designated August 26 as designated by Congress [16:04] as Women's Equality Day to commemorate the date in 1920 [16:09] that the United states certified the 19th Amendment and franchise [16:14] women the right to vote has been a prerequisite [16:18] to stand for public office. [16:19] Elected office and trailblazer such as a K piece [16:24] Deborah Coats, Angela Kelly. [16:26] We speak for all of Prichard Susan P Dibble and Danielle G. [16:30] Floyd won elections to serve on the Hanover County [16:33] Board of Supervisors and the people of Hanover [16:36] elected women into constitutional offices. [16:39] With the election of Lois Boucher [16:42] not as commissioner of the Revenue in 1974 [16:46] until her retirement in 1999. [16:50] And the election of Mackenzie Babbitt [16:52] simcoe to serve as the Commonwealth's attorney. [16:54] And November 20 23, the Service of these women [16:58] continues to demonstrate the meaningful contributions [17:02] possible with broader participate [17:04] nations and a government whose authority comes from the people. [17:09] It represents And. [17:11] Hanover County honors these women [17:13] and honors their lasting service and contributions. [17:17] Thank you Thank you, Miss Purchase. [17:21] Next item on the agenda is planning public hearings Board [17:25] welcomes Mr. Pompei thank you for being with us, [17:27] sir I wish state of what ? [17:32] Thank you, Mr. Chairman The first several public hearings [17:35] relate to accessory family housing [17:37] units and the first public hearing [17:39] is Four one in the Henry district. [17:41] This is a request by ms.. [17:43] Rosen Brooks for an accessory family housing unit [17:46] on her property This unit will be occupied with the applicant's [17:49] adult child. [17:50] And it meets all the. [17:51] You standards for accessory family housing units. [17:54] The property itself is located on River Road just south [17:57] of here east of US route 3O1. [18:02] The property is zoned a one agricultural and within that [18:05] zoning district an accessory family housing unit requires [18:09] a special exception It is in the Kotlin Heights subdivision zone, [18:12] which was recorded in the 1960s. [18:14] So this particular lots non conforming at just over one [18:18] and One and a quarter acres Here is the existing [18:22] house on the right. [18:23] And where the, be located on the property. [18:26] On the sketch plan So you can see [18:28] the unit will be to the left of the main house [18:30] at the end of the driveway way. [18:32] And I'll show you picture of what that unit looks like. [18:35] But again, it will be on the same property behind the home [18:38] showing a driveway and it will be a two story structure with [18:41] a garage below and the unit above [18:45] It will be one bedroom, one bathroom home, [18:48] and Just over 600ft². [18:52] A community meeting was held and no citizens were in attendance [18:57] And then staff is recommending seven conditions. [18:59] Many of these conditions are comparable to what's [19:02] going to adopt with other accessory family housing units [19:04] and some are specific to the unique circumstances [19:07] of this property. [19:08] Limitations on the size, the elevations and colors, [19:12] the materials and colors must align with the primary dwelling [19:16] minimum setback of 15ft is required [19:18] from the side property line. [19:20] 3 feet is the minimum The special exceptions [19:23] valid for three years or until the family member no longer [19:25] resides in the residence of the entrance [19:29] for her permits required for the second entrance. [19:31] The applicant saw the second driveway recently [19:34] in that driveway needs an additional permit and then [19:38] our standard conditions adherence [19:40] to all building inspections and health department requirements, [19:42] adherence to all applicable development regulations [19:45] That concludes staffs Presentation. [19:47] The applicants are here tonight but they [19:49] do not have a presentation planned Thank you. [19:57] You, Mr. Pompei. [19:58] Any questions from respond pack? [20:01] Very well. [20:01] Thank you. [20:02] We will now open the public hearing. [20:03] The African is here. [20:04] For the record is the applicant. [20:06] Thank you Do you have any comments, ma'am ? [20:09] That. [20:10] OK. [20:10] What's the record reflect African does not have [20:12] a presentation or any comments. [20:13] There's anyone here who wishes to speak [20:16] in favor of this application. [20:19] Anyone, Anyone in opposition See, [20:25] now we will close the public hearing. [20:27] This is in the Henry district. [20:28] I move for approval of c 2020 6-00017. [20:33] Second, we have a motion to second in discussion. [20:35] All those in favor please indicate by saying i. [20:38] I oppose motion carries. [20:41] Be well, We're frozen. [20:42] Brooks, Thank you for being here The next public hearing [20:47] is also for an accessory. [20:48] Family housing unit in the Henry district This particular one [20:51] is in the Scotts land in subdivision [20:53] And again, the applicant is requesting [20:55] a special exception to allow. [20:56] Construction of an accessory. [20:58] Family housing unit. [20:59] This particular unit will be occupied by the applicant's [21:01] parents and its design conforms to all [21:04] the use standards in the zoning ordinance for this type of unit. [21:08] The property, again, is in Scott's landing is [21:10] at the end of Scott's Landing Road The property is zoned r c [21:15] and it's about one and a half acres Here's [21:18] the sketch plan and a view of the existing house [21:20] as well as where the unit will be located. [21:23] You can see the existing house in blue on the sketch plan. [21:27] Dark green is where the unit will be located [21:29] It will be located to the side and rear of the main dwelling [21:32] and I'll show some elevations of what that will look like. [21:35] And again, I'll be at the end of the driveway [21:36] with the driveway extended to a garage that's attached [21:39] to the unit These are the elevations the one on the left [21:43] with the garage doors. [21:44] That is what will be visible from the street [21:49] And then the unit entrance will be on the side. [21:51] So the unit itself will be to the rear of the garage. [21:54] So will be seen from the street is the garage. [21:56] Then the unit will be in the rear. [21:58] And the applicant has submitted a letter [21:59] indicating that the HOA has approved [22:02] of the design of this unit. [22:04] The overall structure is shown in this floor plan. [22:07] Again the two car garage at the front and the unit [22:10] outline in red with one bedroom and one [22:14] bath room at about 900ft². [22:18] These are the staff recommending additions. [22:20] Again, these are typical for this type of use. [22:21] Five conditions total limiting the size of the unit, [22:24] requiring that the unit be constructed in accordance [22:27] with those elevations, with materials [22:28] and color similar to the main dwelling. [22:30] Valid for three years or until the family member no longer [22:33] resides in the unit. [22:35] Adherence to all building requirements. [22:36] Health department requirements and all other applicable [22:39] development regulations. [22:41] That concludes staff's presentation. [22:42] The applicants are here tonight to answer questions, [22:45] but do not have a formal presentation. [22:47] Plans Thank you, Mr. Pompei. [22:50] The applicant present Thank you Do [22:53] you have any present presentation that's to reflect? [22:57] The island does not have a presentation, [22:58] but is available to answer questions. [23:00] We're now open. [23:01] The public hearing is anyone here who wishes to speak [23:03] in favor of this application? [23:06] Anyone ? [23:06] Anyone in opposition See now this is in Henry District. [23:11] I move for approval of C 2020 6-00019. [23:15] Second, we have a motion in the second in discussion [23:18] All those in favor please indicate by saying [23:20] i i any opposed motion carries. [23:23] Mr. Pompei The next two cases also [23:31] involve an accessory dwelling accessory family housing unit [23:34] in the Beaver dam district. [23:35] This particular request involves two different applications [23:39] and they'll be a joint presentation [23:40] and a joint public hearing. [23:42] A proper amendment to allow the accessory Family housing unit [23:45] as well as the special exception itself The applicant is [23:49] requesting permission to build an accessory family housing unit [23:52] that will be occupied by the owner's parents The design [23:55] of the unit and location conforms with all the use [23:57] standards and the zoning ordinance This particular case, [24:00] due to the proffers that were accepted in the 1980s when [24:02] the subdivision was originally rezoning and the proffers [24:05] must be amended. [24:07] And then there's that special exception request for [24:09] the accessory family housing. [24:11] The property is zoned R one, and in that zoning district, [24:14] a special exception is required The property is [24:19] outside the suburban service area and an area designated [24:21] rural agricultural and again, the North Oaks Subdivision [24:26] except for the lots that front on Mount Hermon Road [24:28] itself is zoned for one. [24:31] This is a view of the property. [24:33] You can see the driveway in the house to the left. [24:36] I'll show you where the units located, [24:37] but it will be located to the right of the driveway [24:39] behind those trees and there is a condition [24:42] about the trees remaining This is the sketch plan again. [24:45] The unit in red to the right of the driveway [24:49] the main house in a shed are in blue. [24:51] And then that one shared driveway [24:53] will be extended to the unit, which [24:55] will have a garage in the rear So the front elevation [25:00] actually faces the house. [25:02] It'll be a one story structure with a unit [25:04] closer to the road in the garage, in the rear. [25:06] What you will see from North oaks Drive [25:08] is that top elevations will appear like an outbuilding. [25:14] And these are the plans The right will be the wall facing [25:18] the street with the unit closest to the street, one bedroom, [25:21] two bathrooms, approximately 645ft², [25:24] and then a garage in the rear The proffer amendments required [25:29] because the proffers that were approved in the 1980s said that [25:33] no outbuilding may be used as a residence as well as some other [25:36] different features that cannot be used for residential purposes [25:40] This is currently an ordinance requirement [25:42] already restricted by the current zoning requirements. [25:44] So there across that out. [25:46] So that they can request the special exception [25:48] and then living in a trailer camper [25:51] tent basement will already be prohibited because that's [25:54] prohibited by the zoning ordinance that's currently [25:57] in effect The Planning Commission reviewed [25:59] the proper amendment and recommended [26:01] approval to a vote of 7 to 0. [26:02] No members of the public spoke during the public hearing. [26:06] Again, all the proffers will remain the same [26:08] except for the First part of Proffer three [26:11] that will be eliminated And then there [26:14] are six recommended conditions These are very similar to those [26:18] that have been accepted with other cases and the cases [26:21] you review previously tonight, limiting [26:23] the size of the structure, the elevations and colors [26:27] must align with the main building or outbuildings [26:30] in the property. [26:30] So it looks like an outbuilding preserving trees. [26:33] The sketch plan showed that area of the disturbance [26:37] the trees outside that area of disturbance must remain. [26:40] This is valid for three years until the family member no [26:43] longer resides with the unit. [26:45] And that here install building inspections requirements, health [26:48] department regulations and all other applicable regulations [26:52] That concludes staff's presentation. [26:54] I'd be happy to answer any questions the board may have [26:56] any questions for mr. Pompei. [26:59] Seeing none. [27:00] Thank you So what we're going to do, [27:02] ladies and gentlemen, is we're going [27:03] to combine the public hearing for the rezoning [27:06] and the special exception What that means is that if there's [27:09] anyone here to speak in favor or in opposition [27:13] to either the special exception or the rezoning [27:16] they can do that during one public hearing. [27:18] But it will by law require a separate vote for each [27:23] of these proposals Mr.. [27:26] And or Mrs. Martin here. [27:29] Mr.. [27:29] Ms.. [27:30] Martin okay sir, do you have a presentation for me? [27:37] I I just show up. [27:42] But All right. [27:43] Let the record reflect the African [27:44] does not have a presentation. [27:45] But is available for questions Mr.. [27:47] Lipper Yeah. [27:49] Mr.. [27:49] Where's Mr. Oliver Oh, let's see. [27:51] I didn't see that OK. [27:52] Mike. [27:53] I didn't see where i. [27:56] All right, so, Mr. Lepper you're here for the special exception [28:00] The Martins are not here. [28:01] All right, let's the record reflect that neither Mr.. [28:03] Ms.. [28:03] Martin are here. [28:04] Mr. Lippert is present does not have a presentation. [28:07] Oh, now open the public hearing. [28:08] Is there anyone here who wishes to speak in favor? [28:12] Anyone Anyone? [28:14] Speak in opposition Anyone Mr. Lippert, [28:19] you would have 20 minutes of rebuttal. [28:21] But i can't tell you not to use it. [28:22] But I'm not quite sure what you would [28:24] rebut Thank you for being here. [28:28] Public hearing is closed. [28:29] Mr. Stoneman, This is in your district, sir. [28:31] Thank you, Mr. Chair being in the board of the beaver Dam [28:35] District the move that the Board of Supervisors has approved [28:38] are easy. [28:39] 2020 6-000 21 with preference dated July 31st, [28:45] 2026 Second, there's a motion in a second on a rezoning. [28:49] Is there any discussion? [28:50] All those in favor please indicate [28:51] by saying I. I oppose motion carries Next item [28:56] Vice-Chair Stoneman Mr. Chair. [28:58] Thank you I may move that board supervisors Approved S.C. [29:03] 2020 6-00010 with conditions We have a motion. [29:08] Is there a second motion and a second? [29:10] Any discussion ? [29:11] All those in favor, Please indicate by saying I. [29:13] I any opposition motion passes. [29:17] Thank you for being with us, Mr. Palm. [29:19] Pay the next planning public hearing [29:21] is requesting the Cold Harbor district three zone [29:24] ten acres from a 1 2 R six. [29:27] The property is currently ten acres and zoned a one. [29:30] That's the minimum area within the A1 zoning district [29:35] with the minimum lot size that's permitted The applicant is [29:37] interested in a boundary line adjustment, [29:39] so they are requesting rezoning to r six [29:42] to allow just under seven acres to be [29:44] transferred to an adjacent parcel in the future. [29:47] And then the existing home will remain on about three acres. [29:51] No new lots are proposed. [29:52] Again, this is to facilitate a future boundary line adjustment [29:56] The property is located outside the suburban service [29:59] area and an area designated rural agricultural just south [30:02] of Route 360. [30:04] A Again, the property itself is owned [30:06] a one and most surrounding properties [30:08] are zoned a1 Here's an overview. [30:11] The property as it exists today, there's an existing SIMO family [30:14] home off a little Florida road and then there's [30:16] a barn in the field behind the home [30:20] And this shows how the property will be divided again. [30:22] Since ten acres is the minimum lot size in a one, [30:26] a boundary adjustment can't occur without this rezoning [30:29] to allow the home to be on three acres in the front [30:31] and then that barn, which is purple on this map in the seven [30:35] acres roughly surrounding it, will be added to the parcel. [30:38] That's around it to the south and east The planning [30:42] commission held a public hearing on this request [30:44] No members of the public spoke during the public hearing, [30:47] and the Planning Commission recommended [30:48] approval with a vote of 7 to 0. [30:51] There are three different proffers [30:53] The first proffer relates to adherence [30:55] to that conceptual plan. [30:56] I showed you with lot to being required [30:59] to be deeded and combined with the adjacent parcel tree [31:02] preservation and right of way reservation on Little Florida [31:05] Road, which is standard with our six rezoning requests [31:09] That concludes staff's presentation. [31:11] I'd be happy to answer any questions the board may have [31:13] any questions for Mr. Conflict. [31:15] Any questions for Mr. Pompei Mr. Herzberg [31:20] Thank you, Mr. Chairman. [31:21] Sir So the reason it's taken the rezoning application is taking [31:29] place tonight in the if approve of the boundary adjustment [31:35] will not take place right away. [31:37] Is that correct It'll occur later for estate planning. [31:41] The applicant has indicated that, [31:43] yes, this would occur later to accommodate estate planning. [31:47] OK So my question is mainly about the future [31:52] because we could be here 4 or 5 years from now [31:56] The the parcel with the residence on it [32:00] would be the R six. [32:02] Is that right The parcel with the residence on it [32:06] would be Six. [32:07] And then the seven acre area would also be r six. [32:12] So when it's combined with the adjacent parcel [32:15] or the new parcel will have AR6 and a one on it. [32:20] OK So the new. [32:24] So it's going to be just under the seven [32:27] acres is going to have combined with the adjacent parcel. [32:32] But it will not be a one. [32:33] Is that what you're telling me? [32:35] It's a this seven acres. [32:38] It'll be zoned r six. [32:40] OK And then per the proffers, it become bind to this parcel [32:45] that perhaps around it. [32:47] So that would mean one parcel with two [32:52] separate zoning on the parcel? [32:54] That's correct. [32:55] OK And so, um the way our r six reads now with the three [33:05] acre or the 6.9 acre be able to be divided in the future No, [33:12] with the proper condition additions, [33:15] it can't be divided unless a zoning amendment [33:19] and a proper amendment was approved by the board [33:21] of Zoning amendment. [33:24] Currently, this kennedy 6.9 acre AR6 lot be [33:30] divided again No no, not once. [33:34] It's in a subdivision So if they are six is approved, [33:38] this would be considered a subdivide [33:39] And if it's in a subdivision, it has to be at least 25 acres [33:42] to be eligible for AR6. [33:44] That is the answer to the question. [33:46] Thank you very much. [33:48] That's all i have, Mr. Chairman. [33:50] Very well. [33:50] Thank you, Mr. Herzberg. [33:51] Anything further for Mr. Pompei ? [33:54] Thank you. [33:54] You, Mr. Pompei We're now open the public hearing [34:00] Is anyone here for Ms. Kirby? [34:02] Mr. Garber here. [34:03] Anyone for a care to speak, ma'am Okay. [34:06] Well, things are going well tonight [34:08] for those who I understand Let the record reflect the applicant [34:13] is here does not have a presentation [34:14] but available to answer any questions. [34:16] Is there anyone here to speak in favor of this application Anyone [34:22] saying that anyone in opposition saying now we [34:26] will close the public hearing? [34:27] Mr. Herzberg this is in your district, sir. [34:29] Well, thank you very much, Mr. Chairman The application fits [34:33] the area for AR6 is consistent with [34:37] the county comprehensive plan motion to approve [34:40] or easy to 026-00013. [34:45] Second, we have a motion multiple seconds motion to [34:49] properly seconded Is there any discussion? [34:53] Hearing none. [34:54] All those in favor please indicate [34:55] by saying I i any opposed motion carries the next planning public [35:08] hearing is for amendment in the South [35:11] and a district for some property along Ashland Road This is [35:15] a request to amend the proffers to relocate [35:17] an approved shared access within an existing three [35:20] lot subdivision. [35:21] There are no other changes to the proffers except for how [35:24] these lots access Ashland Road. [35:27] When the rezoning was originally approved [35:29] all three lots were required to share a 50 foot access easement [35:33] Three lots in the subdivision. [35:35] Lot two was developed in 2020 and the driveway was [35:38] built directly to ashland Road. [35:39] Outside of that easement. [35:42] Lot one is currently under construction with a house. [35:46] Instead of using the existing shared access [35:48] easement that's proffered, the applicant [35:50] is requesting that lot. [35:52] One and Lot three share a new access easement and the lot [35:56] two would keep its existing entrance is to Ashland Road. [35:59] And I'll show a map that better explains the situation [36:02] and what the applicants are requesting So again, [36:04] this property is on Ashland road. [36:06] All three lots within that subdivision [36:08] are highlighted in red They are zoned R six [36:13] and they were zoned r 6 in 2004 with Crawford conditions [36:19] So this shows how the subdivision is currently platted [36:22] based on the 2004 rezoning. [36:25] 3 lots sharing an access easement and per the proffer [36:30] conditions approved in 2004, all three lots were [36:33] close to share this easement. [36:36] Lot to was constructed and has driveways [36:39] directly to Ashland Road. [36:41] Lot one the applicant or one of the applicants [36:44] is building a house and has a temporary construction entrance [36:48] to Ashland Road and then lot three is currently vacant [36:55] And then this is a zoom in on Lot one. [36:57] And what's being proposed So Lot two, which is over here, [37:01] they would keep their existing driveway. [37:03] This is the proffered 50 foot access easement that [37:06] would be vacated and then Lot one and Lot three [37:11] would share this yellow new access easement which [37:15] is adjacent to a transmission line easement in orange [37:19] So basically moving the access easement from one side a lot [37:23] one to the other side of the lot. [37:24] One and providing access to lot three. [37:27] One of the reasons the applicant has indicated that the easement [37:30] should be vacated is that there these wetlands [37:33] along the western boundary of the lot. [37:36] So to get to the previously approved location both lots [37:40] three and lot one would have to cross wetlands, [37:42] where the proposed entrance is They [37:44] would not have to cross wetlands. [37:46] The applicant held a community meeting in April and citizens [37:51] address concerns about traffic safety [37:54] and having multiple driveways along Ashland Road. [37:56] At that time, the applicant proposing that each of the three [37:59] lots would have their own access since the community meeting, [38:03] the applicant has worked with lot three the lot behind [38:06] to coordinate that shared access that i showed you. [38:09] So if this request is approved, Lot two [38:11] will have access directly to Ashland road and Lot one [38:14] and three Love shared access as the planning commission held [38:17] a public hearing, one speaker had some questions [38:21] and expressed support for the request [38:23] and after the public hearing the Planning Commission recommended [38:26] approval with a vote of 7 to 0. [38:29] So again with the R six rezoning in 2004 six proffers [38:33] were accepted The only proffers this would change [38:35] would be the conceptual plan and the access proffer [38:38] to reflect that new shared driveway for lots one and three [38:43] adjacent to the transmission easement [38:46] that concludes staff's presentation [38:48] The applicants are here tonight. [38:50] They do not have a formal presentation plan [38:52] but they're happy to answer any questions the board may have. [38:55] Very well, thank you, Mr. Pompey. [38:57] And any questions from respond Pay. [38:58] Thank you. [38:59] You, sir The African is present and any presentation [39:05] goes very well Let the record reflect the applicant is present [39:08] and has no presentation. [39:10] But available to answer questions. [39:12] Is anyone here? [39:13] We will now open to public hearings. [39:14] I don't want to hear who wishes to speak [39:16] in favor of this application Please [39:19] come forward State your name. [39:20] The district that you live or the entity that you represent. [39:22] You have three minutes. [39:23] Thank you. [39:24] You, ma'am. [39:25] Amy Mendelson Chilly neighbor to any neighbors [39:27] there I was here 22 years ago, and I think that this is going [39:31] to work out for everybody. [39:32] I just want to caution everybody about ashland Road and traffic [39:36] in general We had a dump truck turn over yesterday [39:39] So as more and more subdivisions become proposed I just [39:42] want everyone to consider possibly trying to limit truck [39:46] traffic I know that they did that on Howard's mill [39:49] and it can be very effective and safe, [39:51] so I appreciate that letting my new neighbors have their access. [39:56] Thank you. [39:56] Thank you, ma'am. [39:57] Anyone else to speak in favor ? [40:00] Very well. [40:00] Anyone to speak in opposition Anyone seeing? [40:04] None. [40:04] We will close the public hearing. [40:06] Combustible. [40:07] This is in your district, ma'am. [40:08] Thank you, Mr. Chair. [40:11] Move Approval of rezoning 2020 6-00020 for zero. [40:22] Arizona two with profit dated July 29th, 2026. [40:28] As preventive as presented. [40:30] Thank you We have a motion to approve rDC 2026 00002. [40:33] Is there a second? [40:35] OK. [40:35] We have a motion, a Second and discussion. [40:38] All those in favor please indicate by saying hi. [40:40] I oppose motion carries. [40:43] I also wanted to make note i didn't see earlier. [40:46] Chief Mike Harmon is in the audience, and chief, [40:48] we're so glad to see you here. [40:51] I don't if you're here for zoning case, [40:53] but the mic is always yours. [40:55] If you've got anything, Chief. [40:56] But thank you for being here and thank [40:58] you for your long and dedicated service to Hanover County. [41:00] It's a pleasure to have you here, sir. [41:03] Mr. Pompei the next planning public hearing is request [41:11] in the Beaver Dam district for a conditional use [41:13] permit to allow a school within an existing church [41:16] This is for independence. [41:18] Christian Church, which is located on Independence Road [41:21] northwest of the town of Ashland Is the property [41:24] is currently zoned a1. [41:25] The existing church pre dates current zoning requirements [41:29] of the church itself does not have a conditional use permit [41:32] in the A1 Zoning district. [41:33] A school requires a conditional use permit, [41:35] so this request is to allow a school within that existing [41:38] church building. [41:39] And here's an overview. [41:40] The property you can see the church, [41:41] the parsonage and the different parcels [41:43] owned by the church itself of course, [41:46] is a church operating here right now [41:48] and could be continue to be used as a church [41:50] as part of this request. [41:53] A school would use some of the school [41:55] or some of the church building during the week [41:59] and then their current plans are to operate Tuesday [42:01] through Thursday with plans to expand [42:03] to five days in the future. [42:05] Classes are 915 to 1:30 p.m. with [42:09] teachers and full operation occurring from 8 a.m. to 5 p.m.. [42:13] Right now, the applicant's proposing 25 students in grades [42:17] kindergarten through fifth grade with a possible expansion up [42:20] to 45 students. [42:22] And they'll be two adults per 16 children, which [42:24] are volunteers and parents. [42:25] So minimal trip generation based on the number of students [42:29] and the conditional use permit allows [42:31] for some expansion based on what the applicant has indicated. [42:34] No changes to the site itself. [42:36] The classes would occur in the existing church building. [42:39] And they would use the existing playground [42:41] And then here is a view of the church building [42:45] facing Independence Road. [42:46] The rear where the classrooms are and then the parking areas [42:49] and playground again exist. [42:51] They'll be used by the school The planning [42:53] Commission held a public hearing on this request. [42:56] No people spoke during the public hearing, [42:58] and the Planning Commission recommended approval [43:00] is a vote of 7 to 0. [43:02] There are five recommended conditions for the school. [43:05] It's limited to kindergarten through fifth grade and any [43:08] expansion requires an amendment limited to 45 students, [43:11] which allows some flexibility for expansion over [43:14] the current operations Hours of operation are 7:30 a.m. [43:17] to 5 p.m. [43:18] Monday through Friday If church events and school events [43:23] will be regularly held simultaneously, [43:25] a site plan amendment will be required to make sure [43:27] there's enough parking on the site. [43:29] And then the standard condition for all are conditional use. [43:31] Permits must comply with all applicable regulations that [43:35] conclude staff presentation. [43:37] There are representatives from the church here tonight. [43:39] They do not have a presentation plan Very well. [43:42] Any questions for Mr. Pompei saying [43:45] that as he can present this? [43:48] Thank you Does anybody know presentation. [43:51] But available for questions. [43:52] Let the record reflect the applicant is present [43:54] does not have a presentation but available for questions. [43:56] We're now open to public hearing. [43:57] Is there anyone here who wishes to speak [43:59] in favor of this application Anyone in opposition [44:03] to go very well. [44:06] Seeing none. [44:07] We will close the public hearing. [44:08] Mr. Stone is in your district, sir Thank you, Mr. Chair. [44:13] I move that the Board of Supervisors [44:14] approve c u p 2020 6-00008 as submitted [44:20] with recommended conditions. [44:21] So I have a motion. [44:22] We have a second. [44:25] Very well. [44:26] Any discussion on a motion? [44:27] Properly seconded Hearing that all those in favor [44:29] please indicate by saying I opposed motion carries Respond. [44:36] I'll pay the next request is an amendment to an existing [44:43] special exception in the South and a district [44:45] to allow structures taller than permitted [44:48] on this particular property. [44:50] It was rezone owned in 2005 to M one limited industrial [44:54] on Lake Ridge Parkway near sliding Hill [44:57] Road in the m1 zoning district. [44:59] The maximum building height is 35ft. [45:02] In 2022, the applicant came forward with a special exception [45:06] request to allow buildings up to 42ft [45:09] in height into industrial buildings [45:12] that are roughly 125,000ft². [45:13] That could be that maximum height of 42ft. [45:17] So the buildings have they constructed the condition that [45:20] was approved with that special exception in 2022, [45:23] says the maximum building height is limited to 42ft, [45:26] include appurtenances The applicant submitted a building [45:30] permit for hvac equipment that will be on the rooftop and will [45:35] exceed that 42ft in height. [45:37] So the requesting an amendment to the special [45:40] exception to allow buildings up to 48ft in height. [45:43] The buildings themselves will not [45:45] change as part of this request. [45:46] It's again to allow that larger and taller HPC equipment [45:50] on the rooftop This property is designated [45:54] industrial or light industrial in the comprehensive plan. [45:57] And again on Lake Ridge Parkway, just north of sliding hill [46:00] Road one unique issue associated with this properties [46:05] at the edge of the industrial area. [46:07] So there's industrial north and east along Lake Ridge Parkway. [46:10] But the stony run condos are immediately [46:12] adjacent to the west. [46:14] And then you have some townhouse units on the opposite side [46:16] of Lake Ridge Parkway to the south Again, [46:20] this property is zoned M1, moving [46:22] north along lake Ridge Parkway. [46:24] There's M M1 and M two. [46:26] Industrial zoning And then when you move south, immediately [46:29] adjacent to the property, there's [46:31] R five, which are old multifamily zoning, [46:33] classified ation This is an overview. [46:36] So again, the buildings are built [46:38] and exist and the Hopkins for proposing new rooftop equipment. [46:42] You can see the stony run condos are to the west [46:47] immediately adjacent to the property. [46:48] And then this is the building where the new units are proposed [46:54] And you can see where those rooftop units will [46:57] be located on the building. [46:58] Again with stony run Commons immediately [47:00] adjacent with the application the applicant [47:03] submitted site line views that show how the property looks [47:07] from different vantage points at ground level, [47:09] and it demonstrates that the units will not [47:11] be visible from ground level But they also completed a drone test [47:18] where they had a mock up of the equipment placed on the roof [47:21] and the drone was able to see what [47:22] the views would be from different vantage points [47:24] off the ground. [47:26] So this is the view from 36 to 42ft above grade, [47:30] which corresponds to the height of nearby [47:33] residential balconies on that stony [47:35] run car condos prior object. [47:38] And you can see that the existing parapet shield [47:42] the units from view You had to go up to 60ft with the drone [47:48] and then you could see the top of the mock up units So with [47:54] this particular case there were two community meetings [47:57] and in the middle that drone test was conducted that helped [48:00] demonstrate what the mock up with the mock up units, [48:04] what the real units could look like once they're actually [48:06] installed with this request. [48:08] All the conditions from the originally approved special [48:11] exception will be the same. [48:14] But the ones that we revise will be the building height one [48:17] to allow building height up to 48ft versus 42ft, [48:21] including any appurtenances. [48:23] And then AC equipment on the roof [48:25] must be screened from public rights of way [48:28] or adjacent properties by the building parapet [48:30] and the drone test in sight line drawings [48:33] demonstrate that that condition will be met, [48:36] that concludes staff's presentation. [48:38] The applicants are present and they do have [48:40] a presentation planned as well. [48:41] You say they do? [48:42] Mr.. [48:42] They do. [48:43] I thank you. [48:43] And here, any questions from Mr. Pompei Oh most of all. [48:49] Mr. Pompei, can you just verify for us that the sheet that shows [48:54] the location of the proposed AC has distances from the edge [48:58] of the building, as well as the dimensions [49:02] of each of the units It's hard to tell on the this level, [49:11] but Ms.. [49:12] Hunter is looking at the actual plan [49:13] to confirm whether that's the case [49:23] We do the full set of plans. [49:25] Do you have the distances and dimensions of the units Just [49:28] make sure we have the documentation Thank you. [49:31] Anything further for Mr. Pompei? [49:33] So, you know, thank you, sir. [49:35] Now open the public hearing. [49:37] The applicant is here Is that correct? [49:39] With the presentation? [49:41] Yes, sir Please come forward. [49:44] You have 20 minutes for presentation [49:46] and then you will have five minutes [49:48] for rebuttal Please state your name. [49:53] The entity that you represent. [49:54] Thank you for being with us. [49:56] Hi My name is Kelsey Hutton. [49:57] And I'm Kyle finn. [49:59] We're with the architecture team for the project [50:01] with Forum Architects. [50:03] The tenant is called Rose and Electric. [50:05] They are an electric subcontractor [50:07] and they'll be occupying this building further office. [50:11] Their very excited to be part of Hanover County in the Richmond [50:14] community project Overview include 28,000ft² [50:21] of office and training space with additional [50:23] space for warehouse use. [50:26] And you see some of the 3D images of the interior space [50:31] And so as mentioned, this is a site plan showing [50:34] the building one location. [50:36] And here is a little bit of a blowup showing those distances [50:39] from the exterior of the building [50:43] as well as the different rooftop units called out. [50:46] And here is an overview of the site line diagrams [50:49] that we made sure to blow them up. [50:50] So they're a little bit more visible. [50:52] So you can see a few of the different areas [50:55] throughout the building one location [50:58] and as some additional information we've provided [51:01] some visual representation of what a similar rooftop would [51:04] look like with the specific model being the green X [51:09] And as mentioned, there are some drone photos as well as these [51:12] are directly on the rooftop. [51:13] During our mock up exercise. [51:15] So you can see the mock up location [51:17] there with the drone photos. [51:19] We isolate add balcony one and balcony [51:23] to as shown on this key, key plan [51:26] here at two corners of the condominium. [51:29] And so if we go back one image, you can actually see. [51:33] So this is at 60ft. [51:35] So this is 20ft above the fourth floor condo balcony a balcony [51:38] one with the mock up image for reference, [51:42] showing the first time that you will see [51:45] the rooftop units on the roof So again, [51:48] 20ft above the balcony, one. [51:51] And then this is from balcony two [51:54] at the balcony level at 41ft. [51:58] And this is looking at the other corner of the building [52:00] and again at 62ft. [52:02] So 28ft above the condo balcony, you can see as well as you [52:06] referenced the image the mock up on the rooftop for that is [52:10] specifically rooftop unit to thank you Thank That concludes [52:18] a presentation that does. [52:19] Thank you very much Thank you. [52:22] I'd like Oh, come on. [52:26] Oh, yeah. [52:27] We still have a possibility. [52:29] Request ready. [52:30] Board members, you have questions? [52:31] Mr.. [52:31] Could you go back to your elevation drawings? [52:35] So just to give a little bit of context [52:37] the reason that I asked them to fire the drawings is [52:40] because there's elevations in these views [52:43] were drawn from the ground. [52:45] And the adjacent structures are four stories tall. [52:47] So we took the drone, flew it up to the fourth floor balcony, [52:52] and they actually had a mock up of each of those on the roof. [52:58] And we move them around It was also some issues [53:03] getting the notifications out. [53:04] So there was no one at the meeting. [53:06] And we all know that telegraph Road shows up. [53:09] So that was another reason for the drone. [53:12] But it was an exercise that I felt was important to and sure, [53:18] those folks that lived in those condos [53:20] so that when I approved this project for rezoning, [53:23] they weren't going to see any of these units [53:26] And so we've now approved that. [53:28] And I thank you for your time. [53:30] Thank you. [53:30] Thank you very much. [53:31] Thank you. [53:31] Anything further for the applicant? [53:33] I okay. [53:34] Thank you. [53:35] Thank you Zero. [53:36] Anyone here to speak in favor of this application? [53:39] Anyone? [53:41] Anyone in opposition ? [53:44] Seeing none. [53:45] We will close the public hearing. [53:46] Mr. Ball, this is in your district now Yes, sir. [53:51] I move approval of see 2020 6-0001A second. [53:59] We have a motion and a second. [54:00] Any discussion? [54:02] All those in favor, please indicate by saying I oppose [54:05] motion carries Mr. Pompei The next public hearing involves [54:15] a proposed industrial project in the Ashland district, [54:18] where the applicants requesting a conditional use permit [54:21] to allow two warehouses larger than 75,000ft², [54:24] an area This area is in the North Lake Industrial Park just [54:29] off of Lake Ridge Parkway, within the suburban service area [54:33] The property is zoned m two and it's been [54:35] zoned M two since 2000. [54:38] Again, it's part of the North Lake Industrial Park. [54:40] All surrounding properties are zoned m to A and B three. [54:44] And for reference, this is just northwest of the Lewis town [54:48] Road interstate 95 interchange. [54:51] The property itself is currently vacant and just under 15 acres, [54:55] but you can see the surrounding area. [54:57] Not only is it zoned for industrial and business use, [55:00] it's been developed for industrial and business use. [55:02] There's an existing industrial warehouse [55:05] immediately to the west and then RV sales to the east. [55:09] This property itself is not access Lake Ridge Parkway but it [55:12] accesses to existing cul de sacs within the North [55:16] Lake Industrial park. [55:18] So again, the applicant is requesting this conditional use [55:20] permit to allow two warehouses larger than permitted which is [55:23] larger than 75,000ft² within the interior of north Lake [55:27] Industrial Park with an ordinance amendment a few years [55:30] ago any warehouse larger than 75,000ft² individually [55:35] or 100,000ft² on a total site must [55:38] get a conditional use permit. [55:39] So in this particular case two buildings were opposed. [55:42] One building 125,000ft² and one building is 108,000ft². [55:47] And this is speculative development in the mBTA zoning [55:51] district When the property was zoned in 2000, [55:55] it was approved with multiple proffered conditions [55:57] So if this property is approved it have [56:00] to adhere to the conditional use permit conditions, as well [56:03] as the proffered conditions This is the sketch plan that [56:07] shows the two buildings north Lake Park Drive is on the left [56:12] and then another called a section [56:15] sunshade lane is on the right. [56:17] And you can see the two buildings adjacent to one [56:19] another, One side of these buildings [56:21] will accommodate the employee parking [56:24] and then the truck parking and loading [56:26] area is on the opposite side of the buildings. [56:29] There's landscaping along North north Lake Park Drive [56:34] as well as the perimeter of the site. [56:36] And then there's additional landscaping [56:38] within the parking areas And this landscaping [56:41] is conditioned as well. [56:44] So it's addressed. [56:45] And required by the recommended conditions [56:48] And then these are the elevations [56:49] is the typical warehouse type building [56:53] similar to what is already in the area because of the size [56:56] of the warehouse as it did trigger local requirements [56:59] for a traffic impact analysis However, that analysis indicated [57:03] that no turn lanes or additional approved ments [57:05] are warranted because of this property. [57:07] Again, it's in the North Lake Industrial park, which does have [57:10] an improved road network to accommodate industrial traffic [57:14] There are some other warehouses that [57:15] are similar immediately adjacent and nearby [57:18] on Lake Ridge Parkway. [57:19] So, for example, this existing building [57:21] looks very similar to the elevations you saw [57:23] for the proposed building And it's also [57:25] similar in size and scale So there's precedent for this type [57:28] of building in the area. [57:30] The planning Commission held a public hearing on this request. [57:33] There were no speakers or in the public hearing, [57:35] and they ultimately recommended approval with conditions [57:38] with a vote of 7 to 0 there are ten recommended conditions [57:42] by staff and a lot of these relate to the site design [57:45] and elements shown on the sketch plan. [57:48] So the property can be used for warehouse and distribution up [57:51] to 233,000ft², a standard condition with industrial zoning [57:57] request is that mechanical square must be screened from [58:00] view monument type signs must be used, [58:03] sidewalks must be provided from the parking areas [58:05] to the building entrances, and then the next several conditions [58:09] relate to the landscaping shown on the sketch plan to ensure [58:12] that that landscaping is installed as the site develops [58:15] including location of landscaping [58:17] and 30% of the landscaping must be native to the area. [58:20] And then the final condition is a standard condition with many [58:23] of our conditional use permits and must adhere [58:26] to all applicable development regulations [58:29] That concludes staff's presentation. [58:31] The applicant's representative is here tonight [58:33] to answer any questions the Board [58:35] may have that they do not have a formal presentation planned. [58:38] Thank you. [58:38] Any questions for Mr. Pompei Thank you, sir. [58:44] The applicant present presentations are. [58:48] Let the record reflect the actions present does not [58:50] have a presentation willing to answer any questions the board [58:52] may have any questions. [58:53] The applicant with board very well [58:56] We're open to public hearings. [58:57] Anyone here to speak in favor of this proposal Anyone? [59:02] Anyone in opposition Seeing none. [59:05] We will close the public hearing This is in the actual district. [59:07] Mr. President. [59:09] Thank you, Mr. Chair Nothing makes [59:11] me happier than to see business go where business belongs Um. [59:15] Lutron already has buildings in North park, [59:20] and they are good corporate citizens [59:24] Their original building is a really [59:27] nice addition to that area. [59:28] Um, I'm told that those native plantings [59:31] will include pollinators which always makes me happy. [59:35] So with that, I move to approve c u p 2020 6-00007. [59:41] Second, we have a motion on the second. [59:43] Any discussion ? [59:44] All those in favor please indicate by saying [59:46] i i any opposed motion carries. [59:49] Mr. Pompei this next planning public hearing and the last one [59:59] scheduled for tonight is a request in the Beaver Dam [1:00:02] district for a conditional use permit to allow a small scale [1:00:05] solar energy facility capable of producing [1:00:08] up to three megawatts of power. [1:00:10] This particular property is located in the Beaver Dam [1:00:13] district, but is just outside the town of Ashland [1:00:16] off of Blunts Bridge Road. [1:00:18] It is in the rural agricultural areas [1:00:21] as designated the comforts of plan [1:00:23] So just outside the suburban service area the property [1:00:27] is zone 1 and many of the properties [1:00:29] immediately adjacent in the county are zoned a1. [1:00:32] Once you get into the town and to the east side, up plants [1:00:36] Bridge Road, there are some residential zone properties, [1:00:38] including the Ashland park subdivision right now, [1:00:42] the front portions of the property are primarily open. [1:00:45] Closest to plants Bridge Road and then [1:00:47] once you get farther west and north, closer to a creek, [1:00:50] there's more wooded property there While the property itself [1:00:55] is 101 acres. [1:00:57] So the couple acreage is 94 acres. [1:01:00] There's an existing house on the property on the southeast corner [1:01:04] that is on the same parcel but is [1:01:06] outside of the conditional use permit area. [1:01:09] And the will remain as a residence [1:01:13] So again, the applicant is requesting this conditional use [1:01:16] permit to allow a three megawatt solar energy facility [1:01:19] based on the zoning ordinance. [1:01:22] That's considered a principal small scale facility requires [1:01:25] a conditional use permit. [1:01:27] And like many other solar facilities, [1:01:29] once it's constructed, it'll be primarily on with employees [1:01:32] visiting for periodic maintenance These types [1:01:35] of facilities are based on comprehensive plan [1:01:37] recommendation as the solar energy storage policy [1:01:40] recommendations in the zoning ordinance, which [1:01:42] has specific use standards, these were developed a few years [1:01:45] ago to provide guidance on how these types of facilities [1:01:49] should operate and look, this is a view of the site [1:01:52] from one Bridge Road. [1:01:53] You can see it's open You can see the existing home that will [1:01:55] remain And then this is the sketch plan that's [1:01:59] required within the conditional use [1:02:01] permit Some of the key features. [1:02:03] It shows the panels towards the middle [1:02:05] of the property and the required perimeter buffers. [1:02:08] Those buffers are required by ordinance [1:02:10] and recommended by the comments of planning and policy [1:02:13] The dark green is existing vegetation that will remain [1:02:16] the lighter green is a planted buffer [1:02:19] and the compound itself will be fenced [1:02:22] And you can see where the stormwater management ponds will [1:02:24] be located at the rear of the property [1:02:27] between the compounds and the required perimeter buffer. [1:02:30] The applicant would like to have the opportunity to log or timber [1:02:34] that wooded property in the future if they choose to. [1:02:37] So with the sketch plan, the area outside [1:02:41] of the perimeter buffer and outside the compound [1:02:43] could be timbered in the future. [1:02:44] That's permitted by right in the A1 zoning district. [1:02:47] But again, those buffers must remain [1:02:51] and the applicant submitted these renderings that show [1:02:53] the view from one spurge road. [1:02:55] Once the required perimeter buffers planted. [1:02:58] And as it grows over time. [1:03:00] So again with this conditional use permit and the sketch plan, [1:03:03] the areas closest to Blunt Springs Road remain open fields [1:03:07] and then you'll have the planted buffer [1:03:09] and then you'll have the panels So with the distance [1:03:12] in the buffer, particularly over time [1:03:13] as the vegetation grows these indicate they'll be minimal. [1:03:17] Divisibility from Blunts Bridge Road [1:03:20] So this particular project aligns with many of the policy [1:03:24] recommendations It's outside of the suburban service area [1:03:26] it's outside of agricultural and fossil districts [1:03:29] and it has some of those design features [1:03:31] that are recommended in the policy, [1:03:33] recommended in the conference of plan and require by ordinance. [1:03:35] So 150 foot wide perimeter buffers. [1:03:38] There is an RPA buffer of 100ft at the rear of the property [1:03:42] and then again retaining that field in the front The proposal [1:03:47] includes the following plans which [1:03:49] are required by the ordinance as well as the policy. [1:03:52] A decommissioning plan or a threatened and endangered [1:03:54] species. [1:03:55] Screening and operations and maintenance plan with facilities [1:03:59] less than five megawatts. [1:04:00] Assigning agreement is optional. [1:04:02] In this case, the applicant chose not [1:04:03] to submit a siting agreement. [1:04:05] If you do not submit a siting agreement the Planning [1:04:08] Commission must find that the facility is in substantial chord [1:04:11] with the comprehensive plan The Planning Commission did make [1:04:14] that finding that it is in accord with the Conference [1:04:17] of plan and although the applicant has not submitted [1:04:20] a signing agreement with the proposed conditions, [1:04:22] they have agreed to a one time payment as recommended [1:04:25] in the policy of $26,070 per megawatt and that payments made [1:04:31] prior to site plan approval There was a community meeting [1:04:36] held in April and there was questions about how the property [1:04:38] would be seeded and stabilized The anticipated [1:04:41] construction timeline, [1:04:43] how the landscaping will be handled after decommissioning [1:04:46] and some questions about the lifespan of the facility [1:04:50] There are 14 recommend the conditions in the staff [1:04:52] report and these align with the policy and the features shown. [1:04:55] The sketch plan again, a facility [1:04:57] that produces up to three megawatts of power [1:04:59] is permitted in the Cup area. [1:05:01] That payment of $26,070 per megawatt prior to site plan [1:05:05] approval, decommission in accordance with the plan that [1:05:08] submitted maintenance and the core of the plan that was [1:05:10] submitted, landscaping provided with a performance agreement [1:05:14] prior to site plan approval. [1:05:17] Land disturbance must be supervised by a third party [1:05:20] as it occurs The hours of clearing, grading and pile [1:05:23] driving activity are limited Anti-reflective coatings [1:05:26] required on the panels. [1:05:28] Road conditions along DuPont's Bridge Road [1:05:30] must be checked before construction [1:05:33] and after construction to make sure there's no damage [1:05:35] caused by the trucks survey. [1:05:37] The construction of this facility lighting [1:05:40] is limited in height and must have house side shields [1:05:42] coordination, fire and EMS The couple expire for five years [1:05:46] unless construction begins a planning inspection must be done [1:05:50] after the facility is completed to ensure that all [1:05:53] these conditions and the features shown in [1:05:55] the sketch plan are adhered to. [1:05:57] And then development will be in accordance [1:06:00] with all federal and state regulations. [1:06:02] That's our standard language. [1:06:03] The one thing that you all have your dyas, [1:06:06] is we do recommend a change to condition 15 legisla lation [1:06:10] regarding solar facilities is changing [1:06:13] and any applications submitted prior to July 1, 2026 [1:06:17] has to meet the current zoning ordinance [1:06:20] requirements that are in place. [1:06:21] So this ordinance or this application [1:06:23] was submitted prior to July first, 2026. [1:06:26] So it has to meet our current zoning ordinance requirements, [1:06:30] staff just recommends with these changing legislative actions [1:06:34] at the General Assembly, that there be the specific sentence [1:06:38] added to that last condition that it must comply [1:06:40] with the current zoning ordinance regulations [1:06:43] and the sketch plan already reflects these regulations. [1:06:46] The conditions already reflect these regulations that [1:06:48] are currently in effect and reflect the expectations [1:06:51] of Hanover County But this just adds clarity [1:06:53] that we as a community if this particular request is approved, [1:06:59] expect it to meet the currently adopted regulations The Planning [1:07:04] Commission held a public hearing There were [1:07:06] two speakers in support and 2 against There [1:07:09] is some support for the pollinator laws [1:07:11] that are proposed as part of this project. [1:07:13] It balances agriculture with development [1:07:16] and stewardship of the land. [1:07:17] The buffers were appreciated and all [1:07:20] generate tax revenue with minimal demands [1:07:23] on public services. [1:07:25] Those in opposition were concerned about visibility. [1:07:27] The timbering and stormwater runoff That [1:07:31] concludes staff's presentation. [1:07:33] The opponents are here tonight and they do have a presentation [1:07:36] planned very well. [1:07:37] Any questions for Mr. Pompei So you can hear Thank you. [1:07:42] Open to public hearing. [1:07:44] You Africans are welcome to come forward. [1:07:45] We have 20 minutes for presentation. [1:07:48] Vice chair will keep that time Mr. Public [1:07:50] can you remind me how to use this Oh, [1:07:54] it's just forward, backward. [1:07:55] And then how do I start ? [1:07:57] OK. [1:07:58] Please state your name and the entity you represent. [1:08:00] Thank you for being with us. [1:08:02] Good evening, Chairman Chairman Davis, members of the board. [1:08:04] My name is Esther Ackerman. [1:08:05] I'm a development manager with Hexagon Energy, [1:08:07] as well as the lead developer on the Blunts Bridge Solar Project. [1:08:10] I want to thank you all for being here this evening. [1:08:12] And thank you, Mr. Pompei, for your presentation plans. [1:08:16] Bridge Solar is a proposed three megawatt project that [1:08:19] is going to be sited on about 26 acres of a larger 100 acre [1:08:23] parcel located just north of the town of Ashland We designed [1:08:26] the project to prioritize view shared and environmentally [1:08:29] friendly choices Since maintaining the area's [1:08:31] rural character matter to both the landowners [1:08:33] as well as all of the surrounding residents [1:08:36] this project will also bring benefits to the county, [1:08:38] including tax revenue from both the land and the project itself [1:08:42] as well as participation in the state's shared solar program, [1:08:45] which allows local Dominion Energy customers to subscribe [1:08:48] to projects such as this one to receive [1:08:50] discount on their electric bill For a quick introduction [1:08:54] into hexagon, [1:08:55] we have over ten years of experience [1:08:57] here, founded and headquartered in Charlottesville, Virginia, [1:09:00] and we have over ten years of experience [1:09:01] developing small projects like these [1:09:03] all across the Commonwealth. [1:09:05] And we have several projects of this size [1:09:07] and other varying sizes already in operation here in Virginia. [1:09:11] It took a great number of people at Hexagon [1:09:12] to bring this project together. [1:09:14] I've highlighted some of them, including myself [1:09:17] on the screen for some background on the landowners [1:09:20] since that's really where the story begins Vincent and Diane [1:09:23] Harris own this property. [1:09:24] It's been in their family for several generations [1:09:27] and they're here with us this evening. [1:09:29] Currently their property split between timber [1:09:32] They're permanent residents and row crops. [1:09:35] Like many landowners with a property of this size [1:09:37] they've been approached on numerous occasions [1:09:39] by various developers looking to buy [1:09:42] their property to develop it into something [1:09:43] like a housing subdivision. [1:09:45] They did not want that and they felt like a small project, [1:09:48] such as this one would allow them to retain ownership [1:09:51] of their land, get a steady revenue stream for the next 35 [1:09:54] years to help maintain that land without having to sell it, [1:09:57] subdivide it or develop it in such [1:09:59] a way that would permanently alter the character [1:10:01] of this neighborhood. [1:10:02] They partnered up with us back in 2024 [1:10:05] to help achieve this goal. [1:10:07] Now, as i mentioned, this project [1:10:09] covers approximately 26 acres of the larger 100 acre parcel. [1:10:13] Those 26 acres included the panels [1:10:15] that you see on your screen as well as the stormwater [1:10:18] ponds and the internal access roads [1:10:21] We had two top priorities when we were designing this project. [1:10:24] The first was to minimize environmental impact [1:10:26] and the second was to minimize future impact I'll touch [1:10:29] on environmental impact in just a moment, [1:10:31] but I'll stay on view shot for a brief moment Our fence line [1:10:35] which is the dotted line that goes around our panels as well [1:10:39] as around the stormwater facilities, [1:10:41] is about 180ft away from the nearest [1:10:44] property boundary to the north. [1:10:45] I'm highlighting it on the screen right now. [1:10:48] In most other areas, though, the fence line is much farther away [1:10:51] from property boundaries For example, [1:10:54] the fence line is about 700ft away from Blunt Bridge [1:10:56] Road to the east, and about 550ft away [1:11:00] from the nearest residence. [1:11:02] We were fortunate that over half of the property as Mr. Pompey [1:11:05] mentioned, is currently in mature timber, [1:11:07] covering essentially the entire area. [1:11:09] That is to the west and north of our panels. [1:11:13] The dark green areas on the map are the 150 foot wide buffer [1:11:17] of that existing vegetation that we're guaranteeing to protect [1:11:20] for the lifetime of this project Now to the east of the panels [1:11:23] and to the south of the panels, we [1:11:25] will have to plant new plantings to be able to create [1:11:27] that same sort of screening. [1:11:29] Thankfully the county solar policy and zoning ordinance [1:11:32] has very robust planting requirements [1:11:34] to ensure that the project remains [1:11:36] invisible throughout its lifetime. [1:11:38] We are also, per the conditions required [1:11:40] to post a surety bond guaranteeing [1:11:41] that the landscaping buffer is maintained [1:11:43] for this project lifetime. [1:11:45] Now, as mentioned by Mr. Pompei, one question [1:11:48] that came up during our Planning Commission hearing [1:11:50] was about the wooded area that sits [1:11:51] between our panels and the 150 foot wide vegetative buffer. [1:11:56] It's labeled on the site plan as tree mass. [1:11:59] That may be tempered by landowner in the future. [1:12:01] That area is covered in loblolly pines that was [1:12:04] that were planted back in the 1970s [1:12:06] with eventual harvest in mind. [1:12:08] And some neighbors had concerns about whether timber [1:12:11] in that area at any point throughout the project's [1:12:13] lifetime could cause stormwater runoff [1:12:15] or erosion control issues. [1:12:17] As it related to our project. [1:12:18] The answer from our perspective is no Our stormwater facilities, [1:12:22] as they relate to the project, were designed to stand [1:12:24] on their own merits and so they're [1:12:27] the existence of those trees or lack thereof, will not impact [1:12:30] their ability to function appropriate Lee However, [1:12:33] despite hexagons confidence in this answer, [1:12:35] the landowner supervisor Stillman [1:12:38] and I did meet to try to find additional ways [1:12:40] to try to address these concerns from these neighboring [1:12:42] landowners. [1:12:43] And we landed on what we felt like was a good compromise [1:12:45] that the landowners are going to work to try to have [1:12:48] that area timbered before construction timbered [1:12:51] and reseeded with new trees before construction [1:12:54] of our project begins. [1:12:55] That way, First off, to intensive land, [1:12:58] disturbing activities are not occurring at the same time. [1:13:00] And then secondly, those seeds have some time [1:13:03] to establish and take and stabilize [1:13:05] the ground cover west of our project [1:13:07] before our construction begins. [1:13:09] I'll also remind everyone again, the timbering [1:13:10] that we're talking about sits outside [1:13:13] of our 150 foot wide buffer. [1:13:14] So that will not be impacted. [1:13:17] Moving on, if you look at the map on the right hand side, [1:13:19] you'll see a red dot at the intersection of Ashland park [1:13:22] Drive and Blunts Bridge Road That dot [1:13:25] is where this photo was taken. [1:13:27] And this photo is actually a rendering [1:13:29] of what the vegetation should look [1:13:30] like throughout the project's lifetime. [1:13:32] It will obviously get taller than this [1:13:34] But thanks to the extensive setbacks and the planting [1:13:36] requirements of the county, the project should [1:13:39] be well shielded from view. [1:13:41] The last thing I'll touch on here is interconnection. [1:13:43] So we plan to interconnect to distribution [1:13:45] lines that run along the property right along the road. [1:13:48] You could see them in that photo actually right there. [1:13:50] And then they're going to distribute [1:13:51] power across Hanover County, running [1:13:53] back to a local substation. [1:13:55] This is not a transmission level project [1:13:57] It does not feed into the larger transmission [1:13:59] lines that crisscross the state and to the power [1:14:01] is generated here. [1:14:02] And it's also used here by businesses and residences. [1:14:05] As I mentioned earlier, this project [1:14:07] is also going to participate in the shared solar program. [1:14:09] That program was created by the state legislature a few years [1:14:12] ago, and it allows local dominion Energy customers who [1:14:15] might not have the ability to put solar on their rooftop [1:14:18] but want to see the benefit of solar Subscribe [1:14:21] to projects like ours to receive discounts on their electric bill [1:14:25] Moving on to environmental consideration, which was also [1:14:28] our priority with the help of third party engineers, [1:14:31] we developed a preliminary stormwater and erosion control [1:14:34] design that shows that we can meet both state [1:14:36] code and county standards. [1:14:38] Our stormwater engineer is here with us [1:14:39] this evening in case you have any specific questions. [1:14:42] The final stormwater and erosion control plans [1:14:44] will be submitted at site plan approval, [1:14:46] but the county requirements here are also very robust. [1:14:49] And then as you might have seen in the conditions, [1:14:51] One of the conditions is that we will have to have a third party [1:14:54] engineer inspect the site weekly throughout the construction [1:14:57] to make sure that any land disturbance [1:14:59] activities are meeting erosion control [1:15:01] standards beyond engineering. [1:15:03] The site itself was also chosen to minimize some [1:15:06] of these environmental risks. [1:15:07] So first off, you'll notice that the project is avoiding [1:15:11] all delineated wetlands. [1:15:12] Those are further to the west on the property [1:15:14] right over here The other thing that I want to point out [1:15:16] is that even though the panels are set back fairly well [1:15:19] off of Blunt's Bridge Road, there seemingly [1:15:21] is more area for us to have set them back further If we [1:15:24] were only prioritizing views. [1:15:26] Shed on Blunt's Bridge Road But as you head from East [1:15:30] to west on the property, as you follow my mouse, [1:15:33] you'll see that right over here, the topographic lines start [1:15:36] to get pretty close together And that just means that the slope [1:15:39] is getting pretty steep. [1:15:40] So if we were to only prioritize the view of Blunt's bridge road [1:15:43] and push our panels further back, [1:15:45] that would require us to build on steeper slopes [1:15:48] and require more grading. [1:15:49] And we just wanted to avoid that. [1:15:50] We wanted to build on a flatter area. [1:15:52] I just point this out because I want [1:15:54] to emphasize that when we were designing [1:15:55] where this was all going to go. [1:15:57] We wanted to prioritize not just view [1:15:58] shed, but also environmental, welfare of the property. [1:16:02] And again this map also just shows [1:16:05] the areas on the property that have a greater than 6% slope. [1:16:08] They're highlighted in purple just, [1:16:10] you know, adding this in here to show just [1:16:12] how flat the areas that we're putting our panels on [1:16:14] are just so we can avoid grading to the greatest extent possible. [1:16:18] The last thing that I'm going to point out [1:16:20] is that we do plan to use a Virginia [1:16:22] native and naturalize grasses as well as pollinator [1:16:24] friendly species as part of our under panel vegetation [1:16:27] It's part of our vegetation management plan [1:16:29] that we submitted as part of our application. [1:16:32] The groundcover choice is going to help reduce soil erosion, [1:16:35] help with onsite water management, [1:16:36] thanks to those deeper root systems, [1:16:38] and then also create habitat for pollinator species [1:16:41] and potentially open up the possibility for some beehives [1:16:44] on the site after construction is complete I've been actively [1:16:48] engaged with the community throughout the development [1:16:50] process reaching out as early as September of 2025. [1:16:53] That was two months before we submitted a permit application. [1:16:56] Just so folks can have some input beforehand [1:16:58] I really enjoyed getting to know this community consistently [1:17:02] People told me that they preferred this kind [1:17:04] of development over this becoming a housing subdivision [1:17:07] since they understood that this property is ripe for that kind [1:17:10] of development. [1:17:11] We hosted a hosted a community meeting back in April. [1:17:14] About 15 people attended and as mentioned by Mr. Pompei, [1:17:17] they asked questions about vegetation [1:17:19] management, decommissioning, height of equipment. [1:17:22] We also attended the Hanover County Public Schools [1:17:24] career expo back in March. [1:17:26] That was super fun getting to know some of the teachers [1:17:28] and students and just telling them [1:17:30] how energy development in the United States works [1:17:32] and maybe some of them might be interested in general energy [1:17:35] development in the future. [1:17:38] I'm not going to go into detail on these next two slides. [1:17:40] I've just included this to highlight our conformance [1:17:42] with both the zoning ordinance, solar policy and Comprehensive [1:17:46] plan the county's comprehensive plans, [1:17:48] specifically calls out consideration [1:17:50] of alternative energy sources and a continuous theme [1:17:53] throughout the comprehensive plan [1:17:55] is maintaining the area's rural character while not impeding [1:17:58] necessary development I hope that this presentation is [1:18:01] shown that we've prioritized those aesthetic. [1:18:03] Consider Asians to fit seamlessly into this area [1:18:06] while promoting economic development [1:18:07] and a landowner's continued ownership of the property. [1:18:11] This list shows the agencies reviews [1:18:13] and studies that need to happen before construction can begin. [1:18:16] Not going to go through each and every single one, [1:18:18] just highlighting the level of diligence [1:18:19] that needs to happen before that shovel can go in the ground. [1:18:23] Construction is estimated to take approx nearly 4 to 6 months [1:18:26] and staff is recommended to few conditions [1:18:28] to keep those disruptions minimized and controlled. [1:18:31] Land disturbance activities, as I said, [1:18:32] will be overseen by a third party [1:18:34] engineer at our own expense and a bond [1:18:36] will be posted with the county to make sure that roads are [1:18:39] promptly repaired if they are impacted by construct then [1:18:42] we'll also coordinate with the local school system [1:18:45] to make sure that our delivery times do not overlap with school [1:18:48] bus pick up and drop off times to help [1:18:50] ease some of that traffic. [1:18:52] Once operational, this project becomes [1:18:54] a quiet and invisible neighbor. [1:18:56] Unlike more intensive development [1:18:57] This project can be decommissioned [1:18:59] and a decommissioning bond will be posted [1:19:01] before construction begins to make sure that [1:19:03] money you need to set aside. [1:19:05] And then it will be updated on a regular basis [1:19:07] to make sure that those funds remain [1:19:09] adequate for decommissioning. [1:19:11] We believe this project offers some real benefits to the county [1:19:14] Solar is a safe, well-established technology [1:19:17] with projects like this one operating without issue. [1:19:19] All across the country and the state The project [1:19:22] generates revenue for Hanover County [1:19:24] without drawing on county resources [1:19:26] like roads, water sewer or schools. [1:19:28] Appreciate it. [1:19:29] Aligns with the county's comprehensive plan and it [1:19:31] protects the view shed and is low impact to the community [1:19:34] And it lets the landowner retain ownership of the property [1:19:37] and avoid further development for decades. [1:19:40] Planning staff included 14 conditions, all of which [1:19:42] we agreed to. [1:19:43] We've been collaborating with them for several months, [1:19:45] since November of 2025 and made adjustments [1:19:48] to the project as needed. [1:19:49] We're going to continue to work collaboratively [1:19:51] with the county moving forward, and so we respectfully [1:19:53] request your approval of our conditional use [1:19:55] permit I'm happy to answer any questions. [1:19:58] Any questions for the applicant will not take [1:20:00] away from your time, ma'am. [1:20:01] Any questions for the applicant So you have a question, Mr. [1:20:08] Could you explain to me what exactly the robust planning look [1:20:14] like the robust plantings So the planting requirements require, [1:20:20] according we're basing them all off of the county requirements, [1:20:23] they require a certain number of both deciduous [1:20:26] and evergreen trees to be planted [1:20:29] within a certain density. [1:20:30] I don't remember the exact numbers, [1:20:32] but within a certain density all along that [1:20:34] 150ft in front of the panels. [1:20:37] On top of that, some of those have to be lower vegetation [1:20:40] that remains fairly low. [1:20:41] Some of it has to be able to grow a little bit higher [1:20:44] So it's a combination of deciduous and evergreen, [1:20:46] to make sure that even in the winter. [1:20:48] This project remains screened So I guess I will take exception [1:20:53] to you're describing that in our ordinance as robust [1:20:57] because I think it's minimal and I'm concerned anything further [1:21:03] for the applicant seeing none. [1:21:05] Thank you. [1:21:06] You, ma'am. [1:21:07] Thank you. [1:21:07] Is there anyone here to speak in favor ? [1:21:10] The Senator. [1:21:11] Please come forward State your name. [1:21:12] The district that you live or the entity that you represent [1:21:19] You have three minutes. [1:21:20] Thank you, sir Rob Wilhoit. [1:21:22] Jacquard, how many district? [1:21:23] I know you all are shocked to see me up here supporting this [1:21:26] but it is a good marriage of keeping agriculture [1:21:30] and production and technology. [1:21:33] I've been told that they are going to have a hay operation [1:21:36] for the doctors horses and eventually they are [1:21:38] going to do some apiary work. [1:21:40] There So agricultural is still be there. [1:21:44] The farm will stay there and they [1:21:47] don't impact the environment. [1:21:48] So this is one I could definitely go rah, [1:21:51] rah, rah to and hope y'all will approve it. [1:21:53] Thank you. [1:21:53] You. [1:21:54] Thank you. [1:21:55] Anyone further in support, please come forward State [1:21:57] your name, the district that you live [1:21:59] or the entity that you represent. [1:22:01] Thank you for being with us Giving [1:22:07] members of the board and Chairman Davis, [1:22:09] my name is Seth Kargbo. [1:22:10] I'm with a nonprofit in Virginia called Energy right [1:22:13] And we're dedicated energy education as well as a support [1:22:16] of public engagement within the county [1:22:19] here tonight to just speak to the role of distributed solar [1:22:22] that this project ties into But first one, I've just come back [1:22:26] up and just talk about these projects [1:22:28] and what they bring to the table In general, [1:22:31] solar provides a pathway to meet our state's growing energy [1:22:33] needs while upholding property rights [1:22:36] in an appropriate environmental safeguards, [1:22:37] as well The participating landowners in this project [1:22:41] are voluntary volunteer. [1:22:42] We chosen to work with the developer [1:22:44] and the developer has been transport with surrounding [1:22:47] landowners about their efforts to mitigate potential impacts [1:22:50] to the neighboring properties. [1:22:52] These projects also deliver broader public benefits. [1:22:54] They diversify our energy supply, [1:22:56] strengthen grid reliability and generate new tax revenue [1:22:59] without adding residential population or new demands [1:23:03] on schools and other public services [1:23:05] What distribute Solar does and how. [1:23:07] So it's part of, rather than feeding into high voltage [1:23:11] transmission lines as esther mentioned, [1:23:13] they these facilities connect directly to local distribution [1:23:16] line system. [1:23:18] This makes full use of the infrastructure [1:23:20] that the county and the utility has already invested in, [1:23:23] and it can reduce the need for costly transmission upgrades. [1:23:26] It also means these projects can typically be sited and brought [1:23:29] online faster than large remote facilities [1:23:32] because those depend on significant new transmission [1:23:34] buildout. [1:23:36] All in all, it helps Hanover keep pace with growing energy [1:23:39] needs in our community and lowers the reliance [1:23:42] on regional infrastructure timelines [1:23:44] and any other unnecessary as I guess you could call it. [1:23:48] But I also just say that Dominion's shared solar program [1:23:52] is something else that i saw that this ties into and just [1:23:55] for people context if you Google just how many homes. [1:23:59] This could benefit, typically between 450 600 homes that could [1:24:03] subscribe to that program. [1:24:05] And that knocks off its subscription base. [1:24:07] So residents receive a letter in the mail Typically once [1:24:11] the site's online or is approaching that I [1:24:14] guess, that switch on date. [1:24:15] But it will reduce bills for those families that subscribe [1:24:19] by about 10 to 15%, which is a huge cost savings, [1:24:22] essentially you're negating a few bills per calendar year. [1:24:26] And so on. [1:24:27] So it's a direct up revenue recruitment system. [1:24:30] I guess you could call it. [1:24:31] But just so you consider this project and the merits [1:24:34] that it brings to the county, thank you for your time [1:24:36] Thank you for being here. [1:24:37] Anyone else and support anyone in opposition support [1:24:42] supporter Opposition Circle. [1:24:42] Yes, sir. [1:24:43] Please come forward. [1:24:44] Thank you for being here Oh, my name [1:24:53] is Vincent Harris I'm one of the owners of the property [1:24:57] 11 The Beaver Dam District. [1:25:00] I don't want to be ridden under it because I suspect many of you [1:25:04] have already seen my presentation [1:25:06] from the planning Commission. [1:25:08] So video perhaps. [1:25:10] But i am very much in support of the project [1:25:14] because as has been already said our goal [1:25:18] was to try to keep the farm up three four times a week. [1:25:23] We receive mail, telephone calls, [1:25:27] ask us to sell our property for a subdivision The property has [1:25:33] been in my family since before the Civil War [1:25:36] and we wish for it to stay. [1:25:37] That way of We will presently using [1:25:42] it for agriculture and timber. [1:25:45] We will continue the timber portion [1:25:48] and we will continue to some of the agriculture [1:25:51] as the previous person spoke about our our daughter in law [1:25:56] has a horse, and she wants us to raise hay on 10 or 15 acres [1:26:01] and we hope to do that. [1:26:03] Once the project is finished I really appreciate [1:26:09] the details that Hexagon has gone through [1:26:13] and the communication that they have provided of to anyone who [1:26:18] will listen, anyone who has questions [1:26:21] I think they're their plan is, is very, very good. [1:26:26] And I am convinced that it meets all of your requirements [1:26:30] and it certainly meets our requirements. [1:26:33] And i will in a moment, I'll get out and let my wife come up. [1:26:38] Who's going to give you a little bit of the history [1:26:40] of how we got where we are. [1:26:44] But I do hope that you will consider this carefully [1:26:48] and approve this so that we can move on with this project [1:26:54] Thank you for your time Thank you, sir. [1:26:57] Anyone else in favor Yes, ma'am. [1:27:00] Thank you for being with us Hello Hello. [1:27:14] Thank you for giving me some time [1:27:16] to give you a little history about this farm A little history [1:27:22] about cross Creek Farm. [1:27:24] Joseph Franklin Cross born in 1834, died December 10th, 1903. [1:27:31] And his wife Virginia, England. [1:27:35] Ginny, who was the daughter of England. [1:27:38] And if you know anything about Ashland, [1:27:40] you probably know the last name England They [1:27:43] married April the eight, 1869. [1:27:47] She died October 28th, 1920. [1:27:51] Joe and jenny bought the farm somewhere around the 1860s. [1:27:58] They are buried in the family cemetery on our property [1:28:03] Their original homestead site is still visible on our property [1:28:10] Their son, one of their sons, Eddie Clifton cross, [1:28:14] was born in 1883. [1:28:17] He was deeded the farm in 1924 by his siblings He married Marla [1:28:24] collins, a neighbor girl who lived in the farm on a farm [1:28:28] next door and 1925 Ed died in 1949. [1:28:37] His widow died and 1974 Benson and I were the next caretakers [1:28:45] of this farm that has been in our family since the 1860 [1:28:53] That's 157 Seven years. [1:28:56] And we want to pass this farm down to our children [1:29:00] and to our two grandchildren, their brothers. [1:29:05] We need your support for this Blunts Bridge Solar Farm project [1:29:10] to allow this farm to be self-sustainable [1:29:13] for future generations of the cross family descendants. [1:29:18] Thank you We really appreciate your support. [1:29:22] Thank you for being with us. [1:29:23] From anyone else in support anyone in opposition ? [1:29:30] Seeing none. [1:29:31] We will close the public hearing. [1:29:33] Mr. Stone, Ministers, in your district, [1:29:34] sir, I don't suspect that the applicant had any rebuttal. [1:29:39] Nothing to rebut. [1:29:39] But just for the record, there's no rebuttal Mr. Stone. [1:29:43] Thank you, Mr. Chair. [1:29:46] I'd like, thank staff for four for their presentation [1:29:49] and this requirement of I just want to commend you. [1:29:52] Our first meeting was probably less than encouraging [1:29:57] and And so you work diligently You've [1:30:01] had a comprehensive approach to this project from the beginning [1:30:05] and then your presentation for me was I [1:30:07] thought was pretty exception. [1:30:08] So I appreciate that you got a lot in [1:30:11] and a short amount of time and brevity is a high value for me [1:30:16] So I do appreciate that. [1:30:18] I do think there's some things like say it conforms to comply [1:30:21] and substantial setbacks from Blunts Bridge Road. [1:30:25] I think are important I like the fact that you're going [1:30:29] to continue to do agricultural activities on the property [1:30:33] makes it makes that a plus for this you [1:30:35] know actually people to be able to use their property [1:30:37] to the highest and best value And I [1:30:39] have a lot of respect for that. [1:30:41] So in the interest of brevity, I'm going to move that the Board [1:30:45] of Supervisors approved c p 2020 5-000 23 and submitted with [1:30:51] recommendation recommended conditions Second, [1:30:54] we have a motion. [1:30:55] The second is a discussion. [1:30:56] Ms.. [1:30:56] Devil Thank you, Mr. Chair Mr. Harris. [1:30:59] Mr.. [1:31:00] Ms.. [1:31:00] Harris. [1:31:02] My heart goes out to you for wanting to keep your farm [1:31:04] and I want you to keep your farm. [1:31:07] But I still take a stand that the screening that [1:31:12] is going to be very disappointing for the people [1:31:15] that live across the street and I'm [1:31:17] not really sure how we could show graphics Three years Five [1:31:25] years, 15 years when we haven't identified exactly [1:31:28] what we're going to plant. [1:31:30] So, um that was evergreen screening and that's [1:31:34] not what's in our ordinance But aside [1:31:37] from that I will be supporting this project because it's more [1:31:40] important that we preserve of your family's farm [1:31:43] and preserve your ability to keep agriculture So [1:31:49] that's my statement, and we'll see how it looks in ten years [1:31:52] and we'll talk then. [1:31:53] I'll call you Mr.. [1:31:55] Very well Any further comments, Mr. Chair Ms.. [1:31:59] Pritchard Thank you, Mr. Chair And Mr. Steinman. [1:32:04] Well, this is not in My district as the crow flies, [1:32:07] it is less than a half a mile from my home. [1:32:10] I have walked the property with Ms.. [1:32:12] Rackham and. [1:32:13] And this is of all the, of all the solar facilities [1:32:17] we've talked about. [1:32:18] This is the poster project for our policy [1:32:22] There is good planting. [1:32:25] There is good location in the middle of a field. [1:32:28] So that there's real sight sight, [1:32:32] one sight distance There's great screening. [1:32:36] You can't see this from the right. [1:32:39] I've walked every bit of this power, [1:32:41] every bit of this property. [1:32:42] And when the plantings are done. [1:32:44] You won't be able to see this I just cannot commend [1:32:49] everybody who worked on this. [1:32:51] And I thank Mr. Steinman I'm on this road [1:32:55] almost every single day, and I look forward [1:32:58] to seeing you be able to keep this land in its rural nature [1:33:05] And I saw the gravestones on your property. [1:33:08] Another crosses I'm right off of England Street. [1:33:12] Congrats your license for all your hard work [1:33:15] Everybody involved. [1:33:16] And thank you, Rebecca, for all the time. [1:33:18] I mean, I'm sorry for all the time there for all the time [1:33:22] that you spent taking us around the property. [1:33:24] I appreciate that. [1:33:26] Anything further? [1:33:28] Yeah, I think this is a poster project for many folks. [1:33:31] We see this often, particularly with solar folks [1:33:34] who want to preserve their farmland [1:33:36] and use a portion thereof for revenue [1:33:40] in order to support this operations [1:33:42] and have a legacy to pass their heritage land down [1:33:47] to future generations. [1:33:48] And so the time that was taken to make [1:33:51] this project come to the board at this point was extensive. [1:33:57] And so i appreciate all the hard work of folks who did that. [1:34:02] And hopefully at this, and I'll be supporting the project, [1:34:05] and hopefully, if this project does pass, [1:34:08] will we'll be able to use this in the future for a case study. [1:34:14] One objection I have, but it won't affect my vote. [1:34:16] I was sure hoping when I saw that tear that that was going [1:34:18] to be Burgundy and orange but it wasn't And while I oppose [1:34:24] the tear will not affect my vote So i'm [1:34:29] somewhat of a Cavalier fan unless they're playing tech. [1:34:32] So with that, we have a motion, which has been properly Second, [1:34:36] I will now call for the vote for the supervisors. [1:34:38] All those in favor, please indicate by saying I, [1:34:41] I any opposition motion carries Congratulations. [1:34:46] Are there any announcements from board members? [1:34:48] Yes, sir. [1:34:48] Mr. Pritchard I'd like to remind you that this Saturday is [1:34:53] at the crack of dawn. [1:34:54] Is the Ashland half marathon sponsored by sports backers [1:34:59] and with two terrific participants, [1:35:01] Dr. Brown and Mr. Kilduff will both be running in that race. [1:35:04] And i don't know if I can in good [1:35:07] conscience invite anybody to come out at 7:00 in the morning. [1:35:10] But please if later on, come and see them before they're done [1:35:14] anything further Ms.. [1:35:16] Pritchard has retired and now doesn't understand that [1:35:19] there are two 7:00 in the day. [1:35:21] And I appreciate that I do not have a relationship [1:35:24] with numbers with seven. [1:35:25] I'm mr. County Administrator. [1:35:28] Mr. County Attorney. [1:35:28] Nothing. [1:35:29] So there's nothing further. [1:35:30] This board will adjourn until 2 p.m. [1:35:32] on Wednesday, September 9th. [1:35:34] In this boardroom. [1:35:35] This board is adjourned We are going home
