[9:20] Hey uh good good evening and welcome to the committee of the whole meeting for [9:24] the uh 14th council town of H Valley Goosebay for the month of September. Um [9:30] call the meeting to order and uh we'll start off with finance [9:34] administration policy committee. There's no decisions being made here tonight for [9:38] the interest of the public as discussion on the items that will come forward at [9:41] the at the regular public meeting at the end of the month. So I'll ask uh [9:44] councelor Denise Rumble to bring forward a report from finance administration and [9:49] policy. >> No report um at committee of the whole [9:54] mayor but I will bring forward our information items. [9:58] » Um so our first item that we'll be discussing this evening is policy A0014. [10:06] So, we've done several times where we've reviewed things and brought them into [10:11] line with Towns and Local Service District Act opposed to what we used to [10:17] have in place for the >> I hears music or something. [10:23] » And it stopped. >> Yeah. [10:25] » I don't hear anything. >> Okay. [10:27] » Municipalities Act of uh New uh Newfoundland and Labrador 1999. So this [10:34] one is specific to committee of the whole meetings and reports. [10:40] Policy statement says that on the second Tuesday of each month a public committee [10:44] of the whole meeting will take place. Committee of the whole will include all [10:47] counselors and management who are asked to attend. The committee of the whole [10:51] will allow all recommendations and motions to be presented and provide an [10:54] opportunity for counselors to seek or find clarification prior to the monthly [10:59] meeting. All committees struck by council are required to meet and produce [11:04] a report every month. All reports must be presented at the regular monthly [11:08] meeting. The executive assistant will complete the committee of the whole [11:12] package by Thursday preceding the meeting and publish it in escribe for [11:16] council to access and review. The committee of the whole package will [11:20] include recommendations and motions with briefing notes supporting documentation [11:24] received before the deadline of noon on Wednesday preceding the committee of the [11:28] whole meeting. It is the responsibility of the counselors to review the [11:33] committee of the whole package and to be familiar with all information contained [11:36] within. And it is in if in reviewing the committee of the whole package questions [11:41] arise concerning specific items, it is strongly suggested that counselors [11:45] contact the applicable chairperson for clarification prior to the public [11:49] meeting. The chairperson will request clarifying information by contacting the [11:54] CEO at least 24 hours in advance of the scheduled meeting time. So um because [12:01] prior to the TL SDA we didn't really meet as a committee of [12:09] the whole so this is Naen is this I'm sorry CEO is this a brand new policy or [12:16] it's just a revised >> this is replacing our [12:21] committee policy correct okay so anybody have any questions concerns feedback [12:27] back. I [12:36] mean, there's nothing in that that really stands out unless you [12:40] » you think of anything that What exactly are you looking for feedback on? [12:43] » I have feedback. [laughter] What I'm wondering is um so what we have [12:50] done because we don't have separate meetings. There was a point in time [12:54] where I was somebody would be the chair of the CPD committee. Somebody else [12:59] would be the chair of the now rather than a chair because you're not actually [13:03] chairing a meeting. It's like the finance lead, the you know recreation [13:09] lead. Um in previous council what we did was we rotated the leads so that [13:14] everybody had the opportunity to learn thoroughly about each department. We're [13:19] coming up on our first year and I'm just wondering will we be doing a rotation. [13:24] Um I don't know if that has to be included in the statement. Um if it [13:29] would say something to the effect of you know with each counselor being exposed [13:34] to all departments or at every opportunity. Um so I'm just wondering [13:40] what everybody else feels about that. There was a discussion about having uh [13:45] separate maybe two or three committee meetings per month and I think that's [13:50] we're still trying to uh see how we're going to move forward on [13:55] that. Right. >> Yeah. [13:56] » Yeah. >> I I think council will have to have a [13:58] discussion and decide what they want to do with respect to committees or [14:02] committee leads. Um and Deputy Mayor Wright uh we had some formal [14:08] discussions, informal discussions I should say on that and um without having [14:13] to call a public meeting um because all meetings are supposed to be public uh [14:19] meetings that are related to HR and finance issues uh can be held as uh as [14:25] closed meetings and uh that's something that we're looking to do uh you know [14:32] after this month after after we have the first year in now everybody's got their [14:36] feet wet and uh we should know the rules and procedures right now if not maybe a [14:40] refresher might be required but uh as for committee to hold I think it's [14:45] working okay but we need to have that extra engagement when it comes to [14:48] certain issues that are very sensitive or especially we're getting into [14:51] collective bargaining again this year and we're going to have budgeting coming [14:54] up so those are discussions we're not going to have in public so we'll have to [14:58] have those meetings in in close session so U after this month's meeting, we'll [15:05] we'll convene to try and develop kind of schedule where we can all uh work get [15:10] more information during those during those meetings. [15:13] So, anything else? >> Okay, next one. [15:18] » So, my next one is in regards to and I because I did them out of order is um [15:25] the [15:28] just based the regular council meetings. So our policy statement says all council [15:34] meetings must be held in accordance with the rules and regulations as specified [15:37] under the towns and local service district act. The town council will hold [15:41] one regular meeting monthly meeting per annual resolution as per section 39 [15:48] uh subsection 3. The town council can hold special meetings on any date during [15:53] the month. The special meeting will not replace the regular scheduled public [15:58] council meeting. Special meetings must be advertised at least 24 hours in [16:02] advance to the public and shall be open to the public. All counselors, the CEO [16:08] or designate will attend as well as management who are asked to attend. So [16:14] that's with our regular monthly meetings. And again, anybody have any [16:18] feedback or anything that they think needs to be added suggested? [16:24] » Straightforward. >> Okay. So again, just basic housekeeping [16:29] on some of this. And then my third item up for discussion [16:36] and not the motivation for me thinking that we should shift committees, [16:41] [laughter] but this month um we will once again and [16:47] it's important to um make sure that the public is aware that when we do a bunch [16:54] of uncollectible accounts receivable write offs, it's always done through the [17:01] viewpoint of making sure that we have accurate bookkeeping. So, I cannot [17:07] stress enough when we say that um making writing something off or making it [17:15] listed as uncollectible, what that does is it gives us an [17:19] accurate um financial figure to work with, but it [17:24] doesn't mean that something will never be collected. If the opportunity arises [17:31] to collect, we will still collect. So, what we have is a couple of options in [17:36] front of us. We can approve the write offs. Um, this time I have, I believe [17:41] it's 24 and they're varying from principal and [17:46] interest. Um, I think it's all principal and interest. [17:51] I don't know if there were any other. Um, but if we approve the write- [17:57] off, what that will do is it will ensure that the town's financial statements [18:02] accurately reflect our collectible balances. If we choose not to approve [18:08] this, um it would result in retaining amounts on record that have been [18:12] verified as uncollectible, which is, you know, uh not painting a [18:18] clear picture and it would conflict with our intent on our policy of F-0024. [18:24] We're also about to begin a relationship with a new or we have recently begun a [18:29] relationship with a new um accounting service and we want to make sure that [18:37] their information that we're providing to them is as accurate as possible. So [18:43] everybody good with bringing them forward for uncollectible? [18:47] » Y >> and if that's good with everybody then [18:51] that's it for me. This >> all right. Thank you counselor. The uh first two was [19:12] uh amendments to the um town plan. These were discussed [19:19] um approved the last time around. amendment number six and an amendment [19:23] number eight. Now, I did talk to Mr. Dylan earlier and I thought he was going [19:29] to be here to um to give an outline on that, but those were already approved. [19:35] Um and I don't have any any details on [19:40] either of those, but they were already approved. He just [19:43] said that they were the ones >> you just had to have a motion to [19:46] council. >> We will have there will be a motion at [19:48] the at the public meeting to approve those. [19:51] » Okay. >> Um we have uh Crownlands application. [19:56] I have to go back and forth because the list I have here is mixed up with this [20:01] with the list in the package. So the first one was the Crownlands application [20:08] uh for uh to object to uh [20:14] area of 26262 Hamilton River Road was requested. uh [20:20] the land is zone town center development center development scheme area and the [20:22] scheme area and the proposed use in the proposed use in the application is not [20:25] application is not permitted or permitted or discretionary with the um [20:28] discretionary with the um town center town center development scheme area and [20:33] development scheme area and that was an that was an application for [20:35] application for [20:39] three for a hotel and that's down three for a hotel and that's down [20:44] around the bottom of the hill and it's around the bottom of the hill and it's [20:47] not zoned for uh the land is zone town [20:47] not zoned for that >> you familiar with that area? [20:52] » Google maps shows it as being almost directly across from the tree nursery. [20:57] » Yes. >> So yeah, on that side of the road [21:00] » that came up before for the same reason. >> Yep. So So the recommendation is to [21:05] object to that because it's not a permitted use. That was that's [21:09] Crownlands application 165823. Uh [21:15] let's see. Crownlands application 165841 [21:23] is [21:26] um so the town is requesting that there is no objection to the Crownlands [21:32] application located at 268 Hamilton River Road. Um, that application is for [21:39] a garage and that meets the permitted use. So, I [21:44] got a question on that one. I know in previous years there was an application [21:48] for crown lands for that piece of land and at the time um there was a request [21:55] for I believe 90 meter frontage and the town uh agreed to allow or to not object [22:03] to a 60 meter frontage because there was ever access to the town center that that [22:09] would have been ideal place for a road. There was 30 meter access there whether [22:13] the town applied for that or not. I'm just curious as to the property owner on [22:18] the other side and uh that had applied for 90 frontage [22:25] and were I think uh got 60 because the town was looking at an access road that [22:32] would go into the town center area. something that we should probably check [22:37] out before we make a decision on that. CEO, [22:40] » what was >> I remember that one. [22:42] » What was the What was the prior one applied for? Was it for a garage? [22:46] » It was just for crown land application. That's all it was. There was no use [22:50] because the land application use comes after. I mean, so whatever he [22:59] put there is irrelevant really complies. But do you recall that? [23:03] » I remember applicant's name. So, >> yeah. So the next one is um [23:34] a discretionary land use at 19 just and it's for a forplex uh residential [23:41] multi-unit unit is permitted in that zone. Um so there are no issues with [23:46] that one. So that one will come forward at the public meeting. [23:49] » Just a comment I'd like to make on that as well. When you look at the aerial [23:53] maps of those areas, I think that we should look at as a condition of [23:58] ensuring that landscaping is involved in in those disc because you look at the [24:02] aerial aerial photograph, it's all sand. >> So, if we're going to going to approve [24:07] discretionary land use applications, then the condition in my view [24:11] » should also include a plan for landscaping and timelines associated [24:14] with that. >> I thought it did. [24:17] » I don't know about that subdivision. They might have been under a different [24:21] development agreement back. >> I didn't read anything in [24:24] » there's nothing in the notes. >> There's nothing in the notes that says [24:26] anything about landscaping, but it doesn't mean that we can't put it there. [24:30] » Could it be one of the conditions >> conditions, right? So, [24:33] » uh >> just that should go for all of them. [24:37] » Yeah. And that's why I thought it wasn't our development regulations. [24:39] » And if it's there, we should be enforcing. There is something there [24:42] around residential builds uh that they have to beautify the land landscaping [24:47] but it needs to be enforced. >> Yeah. [24:49] » Yes. Needs to be enforced. >> Yeah. [24:53] » Okay. >> Uh 3.6 is a discretionary land use uh [24:58] application as well. There that is already a forplex housing unit and they [25:05] are applying for a homebased business for short-term rental. So I guess that's [25:09] a Airbnb kind of a situation. Um [25:15] so that one that one meets it is of course it's the the zoning is right. It [25:20] is residential multi-unit um for forplex housing. [25:26] The next one is a discretionary land use at um 15 Lethbridge [25:34] and that is another forplex housing unit that uh [25:41] see and it's the same thing. Um the staff has recommend that the town [25:46] approve that discretionary land use for the 15 Lethbridge for the forplex unit. [25:51] And again, that is in a zone that is specifically designed for mult designed [25:56] for multiplex unit. So there that's that one is all in order as well. [26:02] » And we should include that condition on landscape [26:04] » and the condition on landscaping. And I think I mean we need to we need to do [26:09] something with that landscaping, but we're going to have to enforce the rest [26:14] of the area up there as well because we can't expect a developer to put up a [26:19] forplex unit now to start one now or two in this case because it's the same [26:24] applicant um for two different applications building the same thing and [26:29] we're making it that they have to landscape it but everybody around them [26:33] is >> not doing landscaping. So, we're going [26:36] to have to enforce those yards to be destroyed with sand. [26:38] » So, we're going to have to enforce that as well. [26:41] » Uh 3.8 is um the staff is recommending that council approve a homebased [26:48] business application and that's for a children's entertainment business. Um [26:54] and of course, that's all subject to the town regulations as well. It meets all [26:57] the criteria and that application is owned, the property is owned by the [27:02] applicant. >> Sounds exciting. Sounds exciting. Lots [27:06] of kids events. >> Yeah. [27:09] » And uh coincidentally, that operator has been a regular setup in any of the local [27:16] events over at the Kin Center and and so they're obviously they're doing well. [27:23] uh 3.9. Um [27:27] staff is also recommending that uh the homebased business application be [27:31] approved on on Sanders Street and that's for a clothing alteration homebased [27:38] business. So it's not a matter of a lot of traffic. It's just basically and even [27:43] in the application it says that basically operating [27:46] » I got somewhere else to get my clothes. >> You got someone else? Yeah. But [laughter] it is [28:01] » uh 310 is a discretionary land use application at 10 McKenzie Drive and [28:08] that's to build a garden suite um on the property and in the package it says that [28:16] is it is a permitted use in that zone. I had never heard that term until this [28:21] application. >> Yeah, me either. [28:23] » I think it's in the current regulations and we allowed that to happen in those [28:27] zones. So, I'm not sure if it's permitted under regulations. Why does it [28:30] have to come to council? >> Yeah, because that was that was put in [28:33] the development regulations. The last one we done. [28:35] » Yeah. >> To allow for garden or Yeah. [28:40] » discretionary use in the mixed >> Oh, mixed zone. [28:44] » Yes. >> Glad happy to see that one there. This [28:48] is good. Um the next one is a discretionary land use [28:54] application as well and that's um uh staff is recommending that be approved [29:00] that homebased business be approved as well and that is a speech therapy [29:05] counseling uh homebased business. Um, and I'm not familiar with with those [29:11] people, but I am familiar with the fact that there is a huge demand for speech [29:15] therapy in this in in well in all of Labrador really. So, it's great to see [29:21] that that'll be one more option for uh families to to go to because getting an [29:27] appointment with a speech therapist in this province is basically impossible. [29:32] Uh the only question I have on that there's no existing properties on that [29:37] street. >> Yeah, I I didn't understand that either. [29:41] » The my understanding from reading that is that they own that piece of land. [29:46] They're building a house and they're building [29:50] within the house. One room is going to be for speech therapy. [29:55] » 25% of the house. >> I think it's less than 25%. I think I [29:59] think that's what it said. We don't have any recommendations, but um I just want to [32:17] talk about the garter report just briefly that we did receive a garter [32:21] report for uh August 24th to 31st and one recently. I'll talk about more about [32:27] them in the uh public meeting, but it was uh some good information in there [32:31] and I'm glad to see them coming. Um I want to talk about the bike trail. Uh [32:37] there continues to be problems on the bike trail. Public safety is a huge [32:41] concern and some of our counselors were recently on that trail as of yesterday [32:47] and it's still being abused uh by ATVs and uh vehicles and scooters and rocks [32:55] flicking up, flicking at people. Uh that that pavement is going to be ruined [33:00] ruined ruined. We worked so hard for years to get that upgraded and we got a [33:04] beautiful trail there and I think we [clears throat] need to start uh issuing [33:08] some stiff fines. There's no reason uh people should be on it. There's eight [33:13] signs on that trail uh saying that no ATVs or vehicles or whatever are [33:20] permitted on the trail. So, uh there's no reason there's no excuse for people [33:25] to be abusing that trail. And uh oddly enough, it's adults that are uh causing [33:32] some of the problems on that trail who should know better. Uh there's a lot of [33:35] money, you know, hundreds of thousands of dollars gone into that trail and we [33:39] worked so hard to get it worse, too. And I would like to uh keep it the way it is [33:43] for many years to come. So, uh some enforcement, uh is huge here. Stiff [33:49] fines, you know, start fing. You're not permitted on it. day off or [33:55] you know and get the message out there you know as much as we can. Um [34:00] you know something we've been talking about this for a year so we need to do [34:04] something now. It's time for action for us to uh [34:06] » we need to follow through on the fines. >> Yes. We need to step up because as of [34:10] yesterday there's vehicles on that trail and it's not built for vehicles. So if [34:16] we want to preserve it and save that trail for many years to come then we [34:19] need to step up and do something. I'll talk about that one a little bit more in [34:23] the public uh meeting, but I just wanted to bring that up today. Uh the school [34:26] zone, we've uh the third lane on Millie Mountain. We did uh bring that forward [34:31] again. I don't know CEO, we talked to Minister Bettton about this. If there's [34:36] any update on that, no. So, they wanted us to write a [34:40] letter, fill in the application. [34:47] » I uh did email Jerry Smith. [34:51] who sent me an email a month ago and said that there was no update yet, but [34:55] they were still following up and asked if there was any status updates and I [34:59] never received a response back. So, we should probably email Minister Pentton [35:04] directly again uh because we had that discussion with [35:08] the minister. >> Yeah. Yeah. Yeah. We need to get some [35:12] communications going between staff and the minister's office to find a follow [35:16] up from our meeting. >> Yeah. because they even questioned [35:20] » that it was town that it was the town's responsibility, but it's the road is [35:26] there because the school is there. Yeah. >> So, it's the province's respons and we [35:30] felt that an application wasn't warranted because we felt the province [35:33] should cover the total cost of that. >> But, uh that's where we are. [35:37] » But, I mean, it sounded like he supported it. We just need to have some [35:39] communication to to keep the lines going and and move it forward. [35:43] » Yeah. >> Yeah. [35:45] » Okay. Um, [cough and clears throat] [35:48] I wanted to talk about public safety. I brought this up before, too. Is if we [35:51] can get an update on uh alders and line painting. I don't think there's any [35:56] alders being cut that I can see anyway, but they're they're everywhere. Uh, [36:02] they're overgrown on all the corners. It's hard to see. Lots of complaints out [36:06] there. So, I don't know, CEO, if you can get an update for a public meeting on [36:10] that one to see what else to do. >> Sure. [36:13] » Okay. Line painting if that's any alters. Um, and I just wanted to mention [36:19] that our animal control officer is uh hosting Halloween [36:25] event again in later October. So stay tuned for that. I just want to go back to what councelor deputy mayor was [36:41] saying about the bike path. We've been talking about talking about it and I [36:47] just want to know what do we need to do to put the process in place to initiate [36:52] action. We can talk about it all we want. We have talked about all we want. [36:56] Now do we go to protective services director of protective services and say [37:00] okay we need to get our me out there. We need something that that's we need to be [37:05] doing something instead of just talking about it and saying there's a problem [37:09] because obviously we've said it here several times like for over the last [37:15] year telling everybody in the community that and everybody's talking about it [37:19] that this is what's happening. This is what's happening. But nothing is being [37:22] done about it. And obviously from the people that are still doing it, they [37:26] don't care. They they really don't care whether or not they someone tells them [37:31] to get off. And and I think again we got to start impounding and we got to have [37:37] stiff fonts. If not, it's not nothing is going to change. [37:41] » Yeah, totally agree. >> The signs I mean nothing. We have eight [37:46] signs and they're not >> people are just going to ignoring them. [37:48] They know the signs are there. I mean they they can't miss them. [37:51] » Yeah. >> And uh they're probably trying to avoid [37:54] trying to hit the signs when they're going down on the their vehicles because [37:57] I seen uh uh trucks and cars going down that as well the weekend [38:03] » and uh coming out and seen them going up and I'm like you know I don't know where [38:07] they're branching off to because I went up the other end of town to try to catch [38:10] them I wasn't going to chase them on the trail but they never come through jumped [38:13] off somewhere along the way but uh something got to be done something got [38:18] to be done and it needs to be priority set on that one because we're going to [38:21] have infrastructure that's tore up with I don't know the total amount but there [38:25] was a lot of money went into that. Well, the pictures that I just received this [38:28] evening had boulders on it from motorbikes and things crossing and now [38:33] » it's supposed to be an accessibility trail and I can't see scooters going up [38:37] and down that that path. >> It's not safe. [38:39] » It's not. >> No. [38:41] » Yeah. So, we'll have it have a further discussion [38:46] on that. >> Needs a late day and have it come. um is [38:52] probably just semantics and may have zero impact, but [38:59] I also think we have to stop calling it a bike trail because I have had so many [39:03] people say, "Well, of course bikes are on there." So, councelor Winters just [39:07] said on the bike trail, but then he said it's an accessibility trail. And I [39:11] really think we need to start putting it out there that this is a a pedestrian [39:17] and active use trail or a accessibility trail. I know it's I know it's [39:24] semantics. I know it's not going to Oh, somebody's not going to go, "Oh [39:27] it's not a bike. Sugar, it's not a bike trail. [laughter] [39:31] I'm not going to use it anymore." are. Um, but I really think that the key word [39:38] when councelor Winter said accessibility is that what we really want to push home [39:45] to people is you don't think you're hurting anybody. You think that you're [39:49] only, oh, you know, I'm just taking a shortcut. I'm using the trail network. [39:54] I'm not hurting anybody. As soon as you prevent somebody with [39:59] accessibility issues from accessing a part of our community, you're hurting [40:03] somebody. If somebody's sitting at home and they're too afraid to take their [40:08] walker or take their baby stroller or take their, you know, mobility device [40:14] out because they don't want to be run over, you're hurting somebody. And Like I [40:53] said, it's not that nothing's being done. It's that there are people [40:57] continuously abusing it and there are new people that are abusing. The town, the province got the speed camera down there [43:35] in front of the Gaudy building and more work on on councelor Winter's shoulders [43:41] at the post office handing out handing out what people think is a parcel card [43:48] only to find out that it's a speeding ticket. Um, you know, somebody's going [43:53] in and saying, "Somebody sent me a parcel." And the guy behind the counter [43:57] is saying, "You're not going to be happy about this parcel because it's a [44:00] speeding ticket." You must be very popular, are you? But, uh, I mean, the thing is, if you got to shame [44:25] somebody out for what they're doing, for the fact that they're on the [44:29] four-wheelers on the accessibility trail or they're in a vehicle on the [44:33] accessibility trail, if it takes uh an enforcement officer to do that, and we [44:38] post it on the town website and we're collecting money because of it, [44:44] » you know, $480 for your very first speeding ticket is a lot of money. [44:49] The other option might be something that we could look at as cameras in that [44:53] area. >> Yeah, I think we're going to have to [44:55] have a full discussion on enforcement overall and in in timeline for budgeting [45:01] because we're going to have to make some decisions come the fall.
