[0:01] What's about there like the guys that'll be staying there. Good afternoon everybody. [0:06] Please turn your microphones on. [0:10] Tyler, can you hear me OK? Can you hear me? Yes, sir. Both the city and the property owner will be [3:03] allowed to question witnesses and summarize their positions. The authority will make [3:09] findings of fact and act accordingly and or set the case for a status hearing at [3:15] a later date. Findings of fact and action will be mailed to the property owner via [3:22] regular mail and filed in the Blackford County Recorder's Office. If civil penalties [3:27] are assessed today, an invoice of the civil penalty will be included with the hearing [3:33] record. You have the right to appeal any action taken at this hearing. Let me repeat [3:39] that. You have the right to repeal to appeal any action taken at this hearing. So if you have an [3:58] appeal, it's got to go to the Superior Court or the circuit court, your choice, within [4:05] 30 days of today's hearing. Everybody in attendance who expect to participate in [4:12] the hearing today, would you please stand and raise your right hand to be, to be [4:15] sworn in. Please stand. [4:21] Do you solemnly swear or affirm under penalty of perjury that the testimony you are [4:25] about to give today will be the truth, the whole truth, and nothing but the truth? [4:29] If so, say yes. Thank you. Please be seated. When your case is called, please come [4:37] to the podium. OK. So we got that out of the way. The first case up [4:44] board and Tyler. Is case number 6 on your agenda? [4:52] Uh, Rosa Diaz. [4:56] The address is 207 East Main. [5:02] And um [5:05] In the essence of time, I won't repeat everything that I have here, but um, [5:14] In August, Well, way back when, um, we changed the motion from tear down to [5:21] rehabilitate because you want to rehabilitate this and then There's been a couple [5:26] of appearances that have not been made, so we tabled until today. So, uh, Dennis, [5:32] I will let you go first, and then Ms. Diaz, you can go second. Dennis. Um, [5:40] kind of like what he said, we've changed that motion. Um, I know we've had talks [5:46] about You guys starting on that property probably a month or so ago. Um, I've seen [5:51] you cut some brush down and the door was open it, which you addressed it. And got [5:56] it closed, um. What's your guys' time frame on getting that property up and going [6:02] or at least start working on? Yeah, so, um, as you know, we leave houses, that's [6:09] what we do, me and my husband, so we was expecting, expecting to do a closing the [6:16] past month, so I'm forgot. So the people who's gonna do the closing, they didn't [6:22] got the loan, so I can't go to the closing, but I think maybe the next week we're [6:29] gonna do one and I will have enough money to start with that property. So we already [6:35] started on the other one, but I was waiting for the money to start on this month. [6:42] So as far as the other one, was that the one on, uh, was it Chestnut or commercial? [6:49] Yes. OK. Yeah, so hopefully, uh, this week we're gonna do a closing. They are in [6:56] Portland, so we're gonna get the money to rehab this property. So, um, like [7:04] I already sent people who's was cleaning around the property. They mowing and put [7:10] the trees around, uh, but I can't close the door because it's really cold. So, but [7:17] yeah, hopefully we're gonna do that. I'm expecting to do maybe 2 weeks on [7:24] well until I get the money so but my realtor said it's we're gonna do closing this [7:32] week. It is still your intent to go ahead and rehabilitate the home then. So [7:39] if I were, if I were to put a date down here, your projected start date, what would, [7:44] what do you think it would be? So, um, I will get the money this week for my closing. [7:52] So I'm, so within 30 days, yeah, mhm, I'm gonna start out there with the roofing [7:59] and the siding and everything and with the door, obviously, and after that I'm gonna [8:05] do the next, you know, everything interior. What would you expect to have accomplished [8:11] in 30 days from now? So all completed. What do you think? What do you think you would [8:19] have done in 30 days? Yes, mhm, yeah, yeah, all outside. The roof, the tiny [8:26] roofing, yes, you know, the house can look better from the outside and I can continue [8:33] the. My crew keep working inside. [8:41] What do you think your total completion time is gonna be? Do you, could you look [8:45] that far ahead? What do you think? Next summer or? Because I know you're putting [8:50] money into it and you probably want to get it back, so as soon as I can because I'm [8:56] interested to continue with my business with the flipping house. Dennis, what's the [9:03] status of the other properties? Uh, the one that they have worked on, it is pretty [9:09] good shape. They redid the roof, the exterior and stuff, so. [9:17] I'm gonna move that we table this for another 30 days for status, yes, and uh I think [9:24] it would be helpful for us if, if you could just have. A more definitive time frame [9:31] the next time on what you're gonna do and by when. Yeah, so hopefully the next time [9:37] when I leave here, I'm done. Pretty much, can we get like a paper of like each thing [9:45] you're gonna get done in rough, a rough time frame? Don't have to be exact, but just [9:50] that way we, we have it be handwritten. Yeah, it doesn't mean that just something [9:55] we have to look at. Is that possible? Great. OK, so we have a motion. Was that a [10:02] motion, Bob? Yes, we have a motion on the floor to table for 30 days to review this. [10:08] Do you have a second? I second that. Great, thanks, Colleen. We have a motion on [10:12] the floor in 1 2nd. all in favor of Colleen. Bob, and the chairman votes aye. So [10:19] thank you very, very much for your diligence and thank you for coming. We need to [10:24] determine our November meeting, so she'll, um, yeah, are you gonna stick around for [10:29] a while? Are you gonna leave? [10:33] So, well, I was gonna give you a, I was gonna give you a time for the November 10th [10:38] meeting. So you would have to be there at the November meeting. So what's, that's [10:42] what we're trying to decide. So Tyler, I know we have talked about shifting the meeting [10:48] to the morning because we have court dates in the afternoon. That's correct. What [10:53] does your schedule look like? Would, would 10 be acceptable? Let me take a look. [10:59] Do you, uh, November 10th, I believe, is that, is that a Tuesday instead of a Wednesday? [11:05] Tuesday. No, that would be November 10th would be the, our, our start, by the way, [11:12] those cases start at 1 o'clock on November 10th. OK, pulling that up here, and that [11:18] is a Wednesday, correct? That is a Tuesday. That is a Tuesday, yeah, we were gonna [11:23] move it because I'm, so you will move that up a day. We'll move that to a Tuesday [11:30] since Tyler's gonna be in town anyway and a different timeline correct so we will, [11:35] it'll be November 10th. Can I have your pen? Oh, absolutely. I'll be November 10th [11:43] at 10:00 a.m. And that's a Tuesday, not a Wednesday. That is correct. And I let me [11:48] just confirm with my calendar, OK, but [11:57] OK. [12:01] Yeah, I'm gonna just go ahead and block off the whole day. Yeah, I've actually got. [12:09] That whole day is blocked off now. Great. OK, thank you very much. November 10th. [12:16] Yes, I'm sorry, Tyler, what did you say? I was gonna say that whole day is Hartford [12:21] City. So, OK, OK, fantastic. I'll be sending you something in the mail about it too. [12:28] So you're still at the same address 419. Yes, I'm still in Portland, right? OK. Next [12:34] property at Matt Parker, uh, 1102 North High. And that is item number [12:42] 2, board. [12:46] Now, Tyler, I think we discussed this briefly. Was there an issue with the attorney [12:53] there? Could, could you guys update his case? I don't, I don't wanna say there's [12:57] an issue. I, I reached out because that's, that's not a fair characterization. I [13:00] reached out to that attorney, uh, the bankruptcy attorney, I don't know, 30 days [13:05] ago, give or take, maybe it was even before then, um, and I have not received a response [13:12] back. I think I emailed and I may, but I know I called and so I need to circle back [13:18] at this point and, and get where they are at, um, on that. I know we've confirmed [13:24] those bankruptcy proceedings. I know that we've confirmed other things in there. [13:29] I've got the name and the address of. That attorney. I've reached out to the trustee. [13:36] I didn't hear back from the trustee either, so, um, what I need to do is call back [13:41] to that attorney to get a call back. Uh, as well as I'll check the docket again from [13:46] the bankruptcy just to see if anything else has changed in the last 30 days. Yeah, [13:51] uh, Matt, Mr. and Mrs. Parker, I, I sympathize with you because I know you're driving [13:56] down here. Um, we just found this out today. Tyler, is there any way we can do an [14:03] indefinite? On this until you get back with us so that we can contact Mr. and Mrs. [14:08] Parker. I don't see any issue with that that we can tell Mr. and Mrs. Parker, the [14:12] board can tell Mr. and Mrs. Parker, hey, we won't take any action. We will notify [14:17] you and resend you when this gets set back up for hearing. And if we want to have [14:21] an indefinite while we wait for more ideas from the bankruptcy. I don't have any [14:26] issue with that. Let's just make sure we have Mr. Parker and Mrs. Parker's contact [14:30] information, and we do have, and we do have, I have, I don't see any issue with that. [14:35] OK, my apologies, Matt. Is that acceptable to you? Uh, we will contact you when we [14:42] find out more from his attorney and then, uh, perhaps the next go around we can do [14:48] this via Zoom or via phone call to keep you guys from driving. Is that acceptable? [14:53] Please accept my apologies. Wonderful, yeah, it's the trips I. I fully understand. [15:03] I fully understand. Thank you for coming down, and we will, Nikki will probably be [15:08] in contact with you when Tyler lets us know. Thank you so very much. [15:15] Um, yeah, would you make that, make, make a motion for 30 days? No, it would be an [15:21] indefinite at this point until Tyler hears back from the attorney. No pressure, Tyler. [15:28] We defer this indefinitely until we get more information. None, none taken from the [15:35] attorney. Um, OK, so we have a motion on the floor to table indefinitely pending. [15:41] Uh, the, the attorneys, uh, discussions. Do I have a second? We have a motion to [15:48] second. Uh, Colleen. Bob Chairman votes aye, that'd be 30. [16:01] OK. Sandy Martin. I'm so glad you're here, Sandy. [16:09] Item number 12. [16:14] So I'm gonna defer this one to Dennis and perhaps the mayor if you have something [16:20] you wanna throw in. Dennis, go right ahead. Um, I do know that's one of the ones [16:28] out there that's been taken care of and stuff like that. You said you're using it [16:32] as storage. OK. I have noticed you've been keeping that mode and all that, which [16:38] is great for out there. Um, [16:43] And then So we're, we're having discussions on um Other things. So I [16:51] would ask the [16:54] The board to table literally every 30 days we're we're looking to see um. To take [17:01] care of the property overall, um, just in the situation, so we've really haven't [17:07] discussed anything too much in depth, um. So sometimes you just try and solve the [17:13] problem overall. So we're gonna, are you guys able to stay a little bit after? Are [17:19] you able to stay a little bit after? OK, OK, OK. Which, which, um, which, which one [17:24] is this? Uh, I'm sorry, uh, this is item number 12721 Greenboro. Yes sir, yeah. [17:33] So, 30 days, Mayor. [17:39] At least 30. It may be a problem. I've got to go in for surgery. Um, it'll be the [17:44] 5th surgery. I've got a total of 6 I've got to go through. Um, so it may be a problem [17:51] with 30 days. You wanna push that to 60, mirror. Or indefinitely until we have the [17:57] communication, yeah, you know, we've, we've talked at least a couple of times, so [18:02] we're in good communication. I think it's a good situation. Obviously there are extenuating [18:06] circumstances that we don't know that the mayor's asking for, for our, uh, leniency [18:11] here. So with that board, do you have any comments? [18:20] OK. Bob, we have a second. We have a motion in 1 2nd, to table indefinitely pending [18:28] discussions with the mayor. [18:34] OK, Rocco vou Colleen. [18:39] I'll wake her up in a minute. No, no, you're fine. I was roll call vote. You vote [18:46] aye, Bob, and Chairman votes aye, so. [18:52] We will table this indefinitely and the mayor merits in your hands now. Thank you [18:57] very much. Welcome back to Indiana, by the way. [19:03] It gets cold there, you know that, right? I'm sorry. Oh, you're going to Vegas. It [19:10] gets wet out there. OK, well, [19:16] thank you very much. Have a great afternoon. Drive safely going home. If, if I'm, [19:20] well, I'll just, I'll go right ahead, man. I'll just shut up right there, yeah. [19:25] Yeah. Next up is item number 4 on your sheets board. Emily Anderson, [19:34] 525 East Washington. Tina, do you wanna come up with her? Uh, well, I don't know [19:39] that I, if you want me to, um, but the buyer is here now. OK, well, uh, Dennis, I'll [19:45] let Dennis go first, and while you guys are, you guys can do what you guys wanna [19:49] do. How's that? [19:53] If your buyer wants to come out and sign in, that would be helpful. [20:00] You wanna, want me to review or do you wanna speak or you want me to go ahead and [20:03] I mean, sir, this paper right here if you'll sign in for us. I know she's had a timeline [20:08] in place for us, right, right, and she's selling, so, OK, as long as we can get what [20:15] they're going to do, OK, so, um, Emily, are you, oh, you're up there, OK. I know [20:22] you're going to sell or it appears that you may already have that in progress. Um, [20:29] the floor is yours. Go right ahead. So there are 3 liens on my house. Or [20:37] I, I need the market to be able to sell to them. [20:41] Mike asking that they be removed so that I can. He's Is that microphone on? [20:49] Is that mic on? OK, I can barely hear. Yeah. [20:55] The, the gist of it is, Tyler, she is wishing to sell the property. Yeah. [21:03] And [21:05] I want you look like you want to say something, Dennis said that there was lien or [21:09] like we need to remove our stuff on it before she can sell it. Yeah, the title company [21:14] told us we can't close until there are no there's, there's nothing on the property. [21:21] It's the only, uh, setback is the release from this committee, and we've done that. [21:28] Um, I don't, uh, let me, let me, let me catch myself up here real quick. No, no, [21:34] no, no, no, no, no, no. November we removed the tear down order. And changed it to [21:42] a rehab on East Washington. Yes sir, 525 has not been correct, but it was OK. Here, [21:50] here's what I would here's what I'm imagining is what, what's happening when we record [21:55] when they do a title search and the closing company does title searches. They look [21:59] for liens, and it's one of the ways they do that is through the Blackford County [22:02] recorder's office, so they're probably seeing all of these things. Whether or not [22:07] that that got filed as an order as a rehab, even if it did, they probably have no [22:12] idea what that means or what that's there, it's just a cloud on the title. So what [22:17] we would need to do is if, if it's still there, we need to, the board needs to do [22:22] one of two things either release everything and dismiss this case and remove it and [22:27] then file it with the Blackford County Recorder's Office so when they look at it [22:32] they go, oh, OK, that's gone away, um. Otherwise, they will likely not close. [22:40] So [22:43] Does that make, does that make sense? Yes, just a second because the title, the title [22:47] policy or the or the policy, they're not gonna. I'm not giving legal advice. I'm [22:53] just giving the board a background. I can give the board all the legal advice it [22:56] wants, but more likely than not, a, a title policy or insurance company or whoever [23:01] closing agency isn't gonna sign off on selling this with whatever number it comes [23:07] up with, and then they'll have to turn around and worry about it getting. Sure, no, [23:11] I understand. I understand. So, so if it's um. [23:18] Uh, if it's, if it's something that Needs to be done. And the board wants it sold, [23:27] I guess we'd have to. Likely file something with the Blackford County Recorder's [23:34] Office letting them know this case has been released if it has been, OK, but, but [23:40] that doesn't, I don't know what the status of the property is if that's something [23:44] the board wants to do. Well, I'm gonna throw it. I, I know the board has questions [23:49] as I have questions, and there's probably the same question. Bob, I'll relinquish [23:54] the floor to you. Is that something that you would do for us, uh, Tyler? Yeah, I [23:59] mean, it's pretty, yeah, I can get something on, we can get something on file here, [24:03] um. Pretty simple. That's just releasing everything and notifying that that that's [24:08] all been removed. So, that, that shouldn't be a big deal. Um, The question becomes [24:15] in my mind for the board is if we release everything that means the case is over. [24:22] That's my concern is, is the property in a position in which Those things have been [24:28] rehabbed sufficiently. No, they have not, uh, and that was, and, and, and the perspective [24:35] buyer, Mr. Ramirez is here, um. And Emily, perhaps you can answer this since you're [24:42] right here. So the, the Is it going to be restored because I know you've [24:49] done quite a bit of work. Is Mr. Ramirez going to What's restore it? Yes, I believe [24:56] so. I believe so, OK. Um, 10 new windows have been put into [25:04] the house. Yeah, I, I knew you'd done extensive work on it. I can't imagine just [25:09] throwing that away. I'm, I'm trying to figure out how to get some assurance from [25:14] Mr. Ramirez. Yeah, Mr. Ramirez, what is your, [25:22] could you please come up so you can send it to the attorney so you can come on up, [25:28] we'll have a, we'll have a brief hug up here. So, uh, our plan is obviously to complete [25:35] remodel. So obviously not this year. If we get the house, we're gonna remodel completely [25:41] next year, but it's gonna be, I mean, it's this plan to completely remodel outside [25:46] and inside. So do you have other houses here in town? Uh, yes. And have you remodeled [25:52] those? [25:55] 522 South Jefferson, uh, 615 West Kaka, which they [26:03] sold for 29,000. So it's already sold. OK, OK, that's, that's great. So you're already [26:10] doing the work. Gonna take us a while, but next [26:17] I understand. I'm, I'm doing. Are you guys, when you start on that, is it gonna be [26:24] from the outside in? Yeah, from the outside up, our plan is to do the siding and [26:29] obviously the roof first step and then do an inside job trying to do anything yet [26:34] this year. Um, Mm, I don't think so. Our plan is next year because, you know, winter's [26:40] coming and so we have more latitude. So if we were to [26:48] release this, we could always put it back on. Absolutely, yeah, um. [26:56] Do we have your assurance that you are going to go ahead and start it next year then, [27:01] is that correct? Yes, to full, to full restoration. Yeah, if you guys let us to next [27:07] year, yeah, to full restoration. OK, OK. That is what I wanted to hear. That's what [27:11] I want to hear. Well, I move that we instruct our attorney to, uh, Do whatever is [27:17] necessary to release it. Release our claim on the property. OK. We have a motion [27:23] on the floor to empower our attorney to release this so that you can buy it. Do I [27:29] have a second. We have a motion in a second. Colleen, Bob, Chairman votes aye. So [27:36] we will release this. Tyler, you're going to draft that. Are you going to file it? [27:42] Are you going to send it to Nikki to file? I'll have Nikki sign and file it. It'll [27:46] be similar to what she's already filed, and, and, and, and what I would tell, uh, [27:52] what I would tell Ms. Anderson and Mr. Ramirez is if. You and we'll, we'll [28:00] get it done by the end of the week or, or no later than Monday if you go to close [28:04] and there are still remaining issues, please contact. [28:09] Or have the closing agent contact me or whoever and we can get whatever paperwork [28:15] they want and see fit to, OK, or or contact Nikki or me and then we can we can yeah [28:22] we can put you in touch. So the house has been released from our grasp, shall we [28:27] say. And they will file that hopefully within a week you'll be clear to clear to [28:32] go, Tina. I did send the title work to Dan if the attorney needs to look it over [28:37] to see what the liens are. I don't know. Did you hear that, Tyler? Yeah, why don't, [28:41] why don't you just send that over to me, Mayor Dan, just so I can see exactly what [28:45] their issue is and I can draft it accordingly. It shouldn't be. I don't see anything [28:50] major on it. Yeah, I did talk with the title company, uh, Tyler and. Uh, I assured [28:56] them there were no mow liens on the property. I don't know about water liens. They'd, [29:00] they'd have to contact the water department, but, um, sure, this was the only thing [29:04] I knew about on the property. Perfect. Yeah, and we'll get, we'll get something, [29:07] and then, Nikki, I will get you, uh, a Word document version of this so that way, [29:12] um, you'll have it for future use. So, thank you. OK, great. Thank you very, very [29:17] much, and, uh, thank you for doing what you're doing. Hey Ron, yes sir, I'm reiterate [29:22] that thing to understand if I don't think this is gonna happen, but the board can [29:26] oppose the same. Yes, so that is a great point. I don't think it's gonna happen because [29:31] I think these are doesn't like to lose money. Yeah, well, that's, that, that is an [29:35] option. Money is a wonderful motivator, isn't it? Yeah, Emily, we want to compliment [29:40] you on the responsible way that you, you really have over the time. You really have. [29:47] Thank you very much and And you're welcome to come back anytime. [29:53] I mean, we, we, we have a groupie back here so no comment, no, OK, you know, we, [30:01] we need houses to stand and be fixed up, not torn down, and that is, that is a true [30:06] statement. We need good housing here. That's one of our biggest problems. All right, [30:11] thank you very much. You're free to stay, free to go, uh, yeah, thank you. [30:19] Next up, item number 15. [30:25] Mr. Tyra, you wanna come up? [30:31] And the property is 327 East Chestnut Street. There's been a tear down order [30:38] posted. 378. 317 East Chestnut, yeah, what did I say 327 or something [30:46] 0 317 yeah. You were close, uh, yeah, this place, um, [30:54] I was reading the number 15 on the thing that was close enough for me, so we did, [30:59] um. In July, we made a motion to table this for 90 days and it's 90 days. Go [31:07] ahead, Dennis, I'll let you have the floor. Um, I know we've talked before, you cleaned [31:12] the brush up and stuff around that property. Um, I noticed all that was cleaned up. [31:18] Um. I guess what are what are the future plans on this property? Well, I mean, I've [31:25] been working a lot of overtime to replace one piece of glass. I've got like 4 or [31:30] 5 that picture window in front, um, I have a piece of plexiglass and it's just a [31:36] matter of acquiring time and. Going picking up the materials. Um Been kind of busy [31:43] at work quite a bit. I ain't had time to get over there. I said I wanted to be able [31:48] to place one piece of glass and all the windows that have been broke all the time. [31:53] And uh [31:56] I don't plan on turning the water on until spring next year until I get all these [32:01] glasses and paint, so they'll glass in. So I can keep the animals out. Um, so you [32:08] don't plan to tear this down. I don't have an intention to tear it down. I got brand [32:12] new plumbing in and a brand new furnace in. Then there needs to be a form of rehab [32:17] if that's appropriate. As far as how long, how long have you owned this house again? [32:22] How long I owned it about 10 years, 10 years. Has it been lived in at all since you've [32:30] owned it? Yeah, I've had, I've had people rent it out for a little while, um. [32:38] Not more than a month, month and a half. Um, so, as far as from [32:46] here, how long has it been empty? I'm gonna say it's been empty for 3 years, 3 years, [32:52] yeah, I haven't had anybody in there 3 years. What's, uh, obviously I look from the [32:59] outside, uh, what's, I know you've got new plumbing and stuff, what's the condition [33:03] overall inside the property? How are the floors? Well, I mean the floors just need [33:10] to be cleaned up a little better, and I got, like I said, I got a new tile in the [33:15] garage to put in where the two tiles came down on the inside. And so I got, [33:24] well, I don't know my wife has some stuff tucked in there and I gotta get out somebody [33:29] to bring her in. [33:35] Is it rehabbable? In your opinion? You know, that's, uh, do you want to go in it? [33:42] If possible. [33:46] Uh, Mr. Tyler, would it be possible for Dennis to, for you to take him inside to [33:53] inspect the inside of it? Would that be a possibility? That could be a possibility, [33:57] yeah. Would you wanna do that and let us table this thing and let you take a gander [34:04] at it before we. If you, I know you've been busy with work and stuff, um, to rehab [34:10] it, do you have any type of timeline? That's our biggest priority is trying to make [34:16] the housing look better in town and that way the neighbors can You know, not have [34:24] to see overgrown brush and stuff. Well, I mean, yeah, I mean, I, I'm mowing every [34:30] week and stuff and Uh, for the time frame, I'm a one-man Lexus group. [34:39] Do you have anybody else to help me? Do you plan on doing all of this yourself? Yeah, [34:44] I got no choice. [34:48] You have a source for the funds to that's why I'm working the overtime I'm working. [34:59] I would recommend that we let Dave, or yeah, Dave, let Dennis. Table this 30 days [35:06] and let Dennis go in and examine him, get with Mr. Tyre and See what the possibilities, [35:12] the potential is. Any, you guys got a comment on that? No, I agree with you. I, I [35:18] was thinking the same thing. Would you make a motion to that effect? I will make [35:22] a motion. My motion is to um Set 30 days and in that meantime, [35:30] Dennis can go in and check it out and then report to us at the next meeting. I'm [35:35] gonna go get one of my I reluctantly will, will second that motion, uh, but I, I [35:42] just have an uncomfortable feeling that that we're gonna be dealing with this, uh. [35:48] That will mean, sir, that you're gonna have to appear at the November meeting. So, [35:53] Dennis, well, we have a motion on the floor, and we have a 2nd, Colleen. Um, I'll [35:59] roll call vote. I'm sorry. Bob, Chairman votes aye. So Dennis is gonna get you a [36:06] card with his contact information, and you guys can set a time and walk through it, [36:11] and then we'll discuss it on the 10th of November next month. That'd be great. Thank [36:17] you very much, Mr. Tyrone. And he's going to get your, you a card, so he's gonna [36:22] bring that out here. [36:25] OK, but we have one more via phone. [36:32] And this is item number 5. [36:38] 1102 North Monroe. [36:43] They don't. [36:46] OK, I will [36:50] OK, any digit works just give me a call. Thank you. [37:05] Just dialed. Please check the number and dial again and then. [37:10] This one. [37:27] Hello. Hi, Mr. Hartzford. Yes, hi, this is Ron Darviston for the Property Standards [37:33] Board. I've got you on the phone and in I'll do all the, all the introductions here [37:41] at the table is to my, I am the president. Nikki Griders to my right. She is our [37:47] Gal Friday administrative expert over here. Uh, Dennis Maddox is to her right. Uh, [37:54] he is the code enforcement officer. Mr. Bob Kingy and Colleen Dickey, the other two [38:00] board members. And I'm going to [38:05] Dennis, you wanna swing down here so that I, I'll just hand the phone over and I'm [38:10] gonna let Dennis start that and then you guys can discuss, go and if you would put [38:16] it up to the microphone so that Tyler can hear. [38:22] This is for Tom Fletcher. This is for um 111102 North Monroe. [38:31] And uh Mr. Hartzberg, are you are the broker, is that correct? Yes sir, yep, um, [38:39] my name is Jonah Hartzberg. I'm with Hoosier Hub Realty. I am, uh, the realtor for [38:43] John Fletcher, and we actually have, um, we have a buyer under contract on this property. [38:51] Um, I've attempted to, to merge him into this call as well. Uh, he is prepared to [38:57] speak and, and discuss. That's how he's um has full intention to um to demolish and [39:03] clean the property himself uh but but we were not able to get clear title um because [39:10] of the the orders uh that that popped up whenever we were doing underwriting with [39:14] the title company so that's that's why that's why we're here today to discuss it. [39:20] Go ahead, Dennis. You've got it in front of you. I'll let you. So once, uh, once [39:26] we uplift this and the buyer does get possession, what is his time frame on getting [39:32] this property torn down and cleared up? [39:38] Samuel, are you on this call? Yeah, I'm, I'm listening. Yeah, um, I don't know how [39:44] much time they, they can give me, but I work, but I can take, uh, like I can, I can [39:50] do it on weekends, maybe, maybe on 4 weekends I can, I can demolish it and order [39:56] some dumpsters and clean it with, with some of my, my crew. Um, if it's [40:04] possible for them to let me work on weekends, I can do it. I can tear it down and [40:09] clean the property and, and maybe 44 weeks. So this is, once we get it cleared and [40:17] everything, this is something that could be done within the next 1 month, 1 month [40:20] and a half, it could be on the ground. Yes, yes, sir, and I would say, uh, that we [40:27] probably would need, um, 5 business days of clearance of, of coordination with the [40:34] title company to first close before you can take possession, so I would add that [40:39] to it. And my next, my next question is, after this property is removed, what are [40:46] the future plans for this property? [40:51] Yeah, I'm planning on, on building a house there and I, I called the city before [40:55] to, to ask what was the requirements and the price. And I, I spoke with one lady [41:02] there. I, I don't remember her name, but she gave me the prices on the, on the building [41:08] permit, the demolition permit, and And that's, that's the plan, build, build a, build [41:15] a house. [41:18] OK. So, uh this is uh Chairman speaking. We have a tear down order on this house, [41:26] and I'm assuming that As the broker, you're coming up with all sorts of red flags [41:33] as far as trying to get the title transferred. Is that, is that a correct statement? [41:40] Yes, yes, sir, we've been under contract about 1 month. Uh, we've cleared all title, [41:45] um, all title concerns aside from the 4, the 4 city orders on the property from April, [41:52] May, June, and July. OK, so. [41:57] Here's our conundrum, for lack of a better term. We have, we have an order because [42:03] it is, it is gonna come down and we recognize that, which is a plus, we like that. [42:09] Um But in order for us to release those, we have to drop the case. [42:17] Uh, we have to drop the case to clear that because that's got to go through the recorder's [42:22] office so that you can do what you need to do. Now that being said, [42:31] That leaves us a tad bit vulnerable. Not that we wouldn't be willing to do that, [42:37] that's a board decision. I don't, I can't make that individually, and the board may [42:41] elect to do that, but I will give you the caveat that if we do that, I, I'm gonna [42:48] speak for myself that we need a timeline because if the property is transferred and [42:54] it sits in its current condition, there's a very real possibility that we could and [43:00] probably would open this case back up. And it would go to court and we would order [43:07] it down. So do you understand our, our, our situation here? Yeah, yeah, [43:15] I understand, I understand. I will not let that happen if I, if I buy the property, [43:20] that's what I was telling Jonah, that um if I buy the property, I will do my best [43:26] to like clean it and have it ready for, for build something, but I don't wanna pay [43:32] extra fees of having the property without uh demolishing. No, I understand, I understand. [43:41] Tyler, Tyler Rothstein is our attorney. He, I have him on a Zoom call. Tyler, do [43:46] you have any wisdom you want to impart? Well, I can't give uh any, anybody other [43:53] than the board legal advice, right? Um [43:59] Properties can be transferred while having the ownership, but if there is a closing, [44:04] title companies won't insure good title with something like that there. Exactly. [44:09] Well, because this has not come up before, uh, until today, twice now of all things, [44:17] um, I, I've kind of been doing a little bit of research while everybody's been talking. [44:22] Uh, essentially, it comes down to one or two things, and the first thing is we agree [44:27] to recite, uh, [44:31] agree, agree to withdraw everything and rescission it, and, and the board kind of [44:35] crosses their fingers and holds their breath and it gets done or it doesn't or we're [44:40] back in the same boat. Um, or the second thing which I, I don't necessarily recommend [44:45] today to the board. Is it's, I think it may be possible um [44:53] that there is a conditional release. But I have to do more research on whether or [45:00] not how that would look where the buyer seller and the this board would all sign [45:04] some sort of agreement and whether or not a title company would even allow that I [45:09] don't know so uh again I think as we sit here today the only. Real option this board [45:15] has is twofold. Either we say, well, we'll tear it down, we'll get our lien, and [45:22] you can figure it out later. Um, and by the way, uh, because it's recorded, if anybody [45:29] else buys this property. That lien still carries over right and so um. Or the second [45:37] is we dismiss everything, we release the lien, you let me do what we've talked about [45:42] on previous properties, uh, and hold our breath, and if not, we might be here a year [45:47] from now. I don't know. Um, thank you, thank you, Tyler. I'm going to defer to my [45:54] right to the other two board members. Do you guys have a comment? [45:59] Bob, do you have a comment? [46:04] Yeah, I just assume. [46:07] OK, so we've discussed to my right with the other two board members, [46:15] and Mr. Kingry made the comment that he wishes to, uh, withdraw this. And is that [46:23] a motion? So we have a motion to withdraw this. Do I have a second, and we do have [46:29] a second from Ms. Dickey. And before I call for a vote, I will make a comment that [46:37] as a caveat, if we release this, there is a very strong possibility that if it is [46:44] not taken down. We're, we're issuing some grace here and if it's not taking down. [46:51] We could and probably will bring this back up again. So with that being said, I have [46:57] a motion on the floor in a second to withdraw this. Colleen, roll call vote. Ms. [47:04] Dickey votes aye. Mr. Kingry. Mr. Kingry votes aye. The chairman votes aye. So we [47:11] have voted to release this property. Uh, Mr. Rothstein, could you do in a similar [47:17] vein what you've done with the previous property to send to Nikki to send to the [47:21] recorder's office? Yes. [47:25] OK, and, and, and if everybody's still on the line, let them know that it'll be hopefully [47:31] within the week. OK. Did you catch that on the other end? Uh, Mr. our attorney said [47:36] it'd be about a week. Is that acceptable to you guys? [47:42] Yes, yes, we have an active contract to the end of the month, so that should be sufficient [47:47] for sure. OK, do you have any questions for the board? [47:52] I do not. Samuel, do you have any questions? No, no. OK, well, thank you very much. [47:59] Oh, after you guys tear that property down, what, uh, what, what's the time frame [48:05] roughly that building will take place? [48:10] Um [48:13] Well, I asked the lady about the, the timeline of building and she said it, it doesn't [48:20] matter, she said it can take you 1 or 2 or 3 years because I'm, I mean. [48:28] I might build like the outside, like exterior, like the framing and siding, but inside [48:35] will not be finished right away. I'm planning on, on, on building it like on. [48:43] You know, maybe. In 1 year or probably 2 years when it's [48:51] ready to occupy. If that's the case, do you have somebody or yourself that will maintain [48:59] this property throughout the summer as far as keeping the grass mow on it? Oh, absolutely, [49:06] yes, myself. OK. Uh, as a point of information, are you going to be, uh, [49:13] taking the property down? Are you going to hire somebody around here to take it down? [49:20] No, I'm a, I'm a contractor, so I'm gonna bring my crew. I, I work trim carpentry, [49:26] and, and I'm planning on bringing, uh, 5 guys plus me. That will be 6 guys, and I [49:33] will hire, you know, the, the container like the dumpsters. OK, that, that's fantastic. [49:40] Well, where I was going with this is you'll have to obtain a demo permit. From the [49:46] courthouse. Um, it's on the first floor. As you walk into the courthouse, just ask [49:53] for the zoning office. You'll have to get a demolition permit, and the, and the reason [49:58] for that permit is when you apply for that, then that permit goes up to the auditor's [50:05] office, and they will change the status on the property from uh a property with a [50:11] home to a vacant property, and that drastically affects the taxes on the property. [50:18] So, please, please get a demolition permit from the courthouse. OK. OK. Well, thank [50:26] you very, very much. Uh, it's been a pleasure working with you and uh I'll let you [50:30] gentlemen go and Have a great afternoon. [50:36] Thank you very much. Bye-bye. [50:44] OK. So, Tyler, you're going to take care of that, right? I will take care of those. [50:50] Fantastic. Seemed like there was something I wanted to say, but I don't remember [50:54] what it was. [50:56] Oh wait a minute. [50:59] I need to make a note to myself. [51:05] OK. [51:08] Page 2. These are all of the people that are in the audience. So let's start [51:16] down through these guys. I can find them. There we go. Page one is 222 Easton. [51:26] You're laughing. Did you get page 1? Wow, we just zipped through page 1 and 2, didn't [51:31] we? [51:33] We're not done with page 2, are we? Are we on 222 East Elm? Yeah, yeah, yeah. Turn [51:39] it over. [51:43] Oh, there, hey, let's, let's go with the item number one. That's a great place to [51:46] start. How about that? What a concept. Just here to help. Just another service you [51:53] offer, right? I offer, um, at the June meeting we made a motion to change the [52:01] rehabilitation. [52:05] To change rehabilitation to tear down order, and then we Cable net is that property [52:12] down yet? It is down. Yep, it's down and they've got it cleaned up. They've got, [52:17] uh, ropes or stakes where they're gonna put their new property when they start building. [52:23] What's your recommendation? Um, you want to pull it or leave it? I would leave it [52:28] for a little bit, leave it for 30 days, yeah, just to see if we get, I mean. Dealing [52:34] with him, he's done great. He has done great. [52:39] And, and I gotta give kudos to many, many of the people that we deal with. They are [52:43] really great to, to work with. [52:47] You know what, let's close that, OK, because I'm with Nikki. We have a fight on my [52:54] right because it is, it is down and it is cleaned up. So that's the main thing. The [52:59] objective was that. Yeah, good job, Nikki. OK, you don't need a motion for that, [53:04] do you have it removed before there's blood drawn over here, you know, can I get [53:09] a motion to withdraw that, please. We have a motion to withdraw 222 East Elm Street. [53:17] Drive a second. Oh my goodness, um, 4 call vote, Colleen, Bob. [53:26] And chairman votes aye. [53:30] Now can we move on to page 3? Uh, did we talk about 2518? No, no, it's number 3. [53:37] 33 shortest. OK. [53:43] OK. 518 West Kickapoo Street. Tyler, this is the one you and I, uh, Dennis has not [53:50] been in there yet, but go ahead, Dennis, because you had some information. I've talked [53:55] to that, uh. I'm not sure if he's a contractor or what he was. Um, [54:03] I've talked to him a while back. He told me there was a dumpster on site, which is [54:07] there. Um, I've tried to call. There's been no answer, no callback. Um, as of yesterday, [54:15] the dumpster does have Stuff in it so they have been cleaning stuff out of the house [54:21] and it has drywall and stuff in it um just by looking in the windows of the [54:28] property um. I believe that they can turn the property around. OK. [54:37] What is, uh, what's the outside look like? Uh, it's just old brick. Um, they've done [54:44] some cleanup to it. Um, there is a little shed out back which I did tell the guy [54:50] to try to get that removed if anything, because that shed, it's just like a little [54:56] two-door shed that needs to be coming down and he even agreed with it. Yeah. [55:02] Well, but they, they did say by the end of winter or beginning of winter they're [55:08] gonna try to get the bricks all sealed up and everything, get all the outside stuff [55:14] taken care of. I'm gonna try to keep reaching out and seeing if I can get in contact [55:18] with anybody. What's your recommendation for us? [55:24] I would keep moving forward with it. Just keep it on our radar, push it back another [55:29] 30 days, and I will see if I can reach somebody and we'll just keep.
