As we gather [1:31] this morning, let us hold a [1:33] moment and each person carries [1:36] responsibilities and concerns [1:41] for # # [1:43] items and each one is [1:45] supported by colleagues, many [1:52] others for this as our item [1:54] continues to cover from the [1:57] recent storm. We remember those [2:00] being affected and thank all who [2:09] are with the recovery.S [2:09] the [2:11] people MAY live in a community [2:13] but fits not whether they know [2:21] each other and have a sympathy [2:39] or know each other, a wisdom and [2:39] this is a kind of community we [2:41] all hope for. Although it is not [2:45] always easy to fully understand [2:46] one another. The compassion and [2:50] wisdom embrace us without the [2:58] distinction we receive that [2:59] compassion with gratitude. MAY [3:00] today's meeting be peaceful and [3:01] productive. MAY the work done [3:08] here contribute to the [3:09] well-being of the people of this [3:10] aina and all beings. In [3:38] gratitude, I recite the sacred [3:39] >>thank you very much. [4:35] >># [4:39] >>chair holeka goro inaba: [4:39] wildfire we [4:45] before we jump into today's [4:48] agenda items, we will [4:48] have some [4:53] presentations this morning. [4:54] >> council member matt [4:55] kanealii-kleinfelder: thank you [5:01] very much, chair. We have all [5:01] been watching ai with interest [5:03] in a myriad of different ways. [5:07] We have two of our county youth, [5:09] one from hilo high school and [5:12] one from kamehameha schools in [5:15] keaau. Were asked to go to [5:18] boston at the edward m kennedy [5:21] center for the U.S. Senate to [5:23] participate in the artificial [5:28] intelligence symposium. It's a [5:30] conference that brought together [5:31] 98 youth from across the nation [5:34] to sit down in the senate [5:36] chambers and discuss how we are [5:38] going to implement ai [5:42] appropriately in the educational [5:45] theatre. By doing so, these [5:48] youth were able to come together [5:50] and create a law that they are [5:55] going to provide to the aasa, [5:58] the school superintendent [6:00] association, which helps then to [6:02] give a backbone to our legal [6:04] framework on how ai will be [6:07] brought into our school in more [6:11] so how we allow it in regard to [6:14] our school, how it fits, what's [6:15] good, what's bad and what works [6:18] and what doesn't work. I wanted [6:20] to recognize to you today. [6:26] Unfortunately one of them is out [6:28] with the flu. One is out today, [6:39] the other one with their son. [6:40] Confirm [6:42] you are here today. If you come [6:43] up to the front. Thank you very [6:44] much. Thank you very much for [6:46] the family for being here. Come [6:54] have a seat. I wanted to give [6:55] you a chance to briefly discuss [6:58] what we both discussed as far as [7:00] what you got out of this. What [7:04] this meant, and specifically, we [7:09] had hawai'I state. We had two [7:10] who were selected to represent [7:14] hawai'I at this symposium. So I [7:16] don't know who wants to go [7:20] first. Maybe you want to lead us [7:50] off. [7:53] >>tell us about this. [7:57] >>hi, I'm kendall and I was [7:58] really honored to be part of [8:02] this. Not only for representing [8:04] hawai'I county but the whole [8:27] state. I collaborated with [8:32] senators and we passed a bill to [8:35] be working across the nation. It [8:38] was really an eye opening [8:40] experience for me. [8:41] >>what was your takeaway and I'm [8:49] sure you are proud of our [8:50] haumana that came with us to [8:51] represent hawai'I. Tell us a [8:53] little bit about your [8:56] experience. [8:58] >>if you use a cellphone, if you [9:02] use the net [9:03] internet, television, [9:09] you are interacting with ai. As [9:14] we go into the future it more [9:16] pervasive. Unfortunately at the [9:21] educational level we missed the [9:21] boat when it came to cellphone [9:22] usage or social media when it [9:34] came to keying. So [9:34] iki. Nationally the [9:35] school system is worried because [9:36] ai is moving so fast and not [9:38] that we are left behind but [9:42] students are using it where it [9:45] is not wise and not serving to [9:53] our values. So, so they went up [9:54] there [9:58] >> we are lucky because this is [10:10] from the entire state up there. [10:11] They represented our interest [10:16] and debated and very proud [10:18] because in the end this bill was [10:21] voted on and passed and now [10:23] being disseminated and [10:26] distributed to 10,000 members of [10:27] the national superintendent's [10:29] association that's going to be [10:31] used as a scaffolding for the [10:34] use of ai within schools because [10:36] until six weeks ago, there was [10:37] no national policy. So every [10:41] school was left to come up with [10:43] their own standards and every [10:46] teacher was trying to figure out [10:47] their whole thing and hundreds [10:49] of thousands of teachers were [10:51] trying to figure this out on [11:16] their own and it was a mess. So [11:18] they said, let's get it out and [11:20] do it nw. [11:21] >>amazing. [11:23] >>I would like to yield to any [11:29] questions from the council for [11:30] comment. [11:30] >> [11:31] >> council member rebecca [11:32] villegas: I just want to say [11:34] mahalo for your leadership, for [11:41] your support of these young [11:41] people validating their insight, [11:42] their wisdom, their knowing. [11:43] Congratulations, kendall. Thank [11:45] you for representing not only [11:48] our county, but our state, and [11:50] your generation to have an [11:52] opportunity o provide insight [11:57] and wisdom to adults, for issues [11:58] that we have created, but you [12:02] will be left to navigate and [12:14] figure out [12:15] >>andre: how to [12:17] and how to make sure [12:19] this technology takes on and [12:24] thank you for making us so [12:24] proud. [12:25] >> [12:26] >> council member james hustace: [12:27] thank you, council member [12:28] kanealii-kleinfelder for [12:31] recognizing kendall, our haumana [12:38] and community. It's important [12:38] that our keiki, are having this [12:39] conversation themselves and [12:40] trying the drive change within [12:41] their own space. That top down [12:42] enforcement and some of these [12:45] policies. I see schools trying [12:47] to grapple with cell phones and [12:49] make some of the transitional [12:52] change. It's a glaring change [12:54] and what they are used to day in [12:55] and day out. It's really great [13:01] for them to get involved in the [13:02] policy themselves and see how [13:03] their appears are being affected [13:12] by it. Thank you for recognizing [13:13] that. [13:23] >>thank you, members, yes. It's [13:25] a conference in maui and there [13:28] is a panel on ai and that needs [13:31] to happen not only in government [13:33] in elected positions but early [13:36] on. A lot of what we do moving [13:37] forward can be informed by these [13:39] great conversations that you [14:28] folks are having. Vice-chai [14:29] thank you very much. We are [14:31] going to proceed into our next [14:33] two presentations and we'll take [14:34] photos with everyone in that [14:37] order t the end. We are going [14:41] right into our -- we are now in [14:44] the month of SEPTEMBER. We have [14:46] had some storms and things that [14:54] needed to be shifted over. We [14:57] have our AUGUST 2026 haweo award [15:00] recipient. I would like to call [15:09] forward or recipient today. [15:11] >>you can come forward. [15:15] >>good morning, chair inaba and [15:16] council members. I believe [15:20] everybody knows me, reynolds, [15:21] the captain of the hamakua [15:25] district. This admonishing we [15:25] would [15:27] -- morning we would like to [15:29] introduce -- a 17 year veteran [15:32] of the department. He's been in [15:43] the district [15:50] but today, we appreciate the [15:52] focus on traffic enforcement and [15:56] keeping our roadways safe. [15:59] During the last fiscal year, he [16:05] issued nearly 400 citations, 117 [16:08] for speeding over 50, for [16:10] seatbelts. He's not stopping [16:12] everybody in the district. When [16:15] it's warranted, he's documented [16:18] the warnings that were given. [16:21] The funny thing is, having been [16:24] the school resource officer for [16:25] eight years, he's now sometimes [16:27] stopping former students as [16:29] young adults. He continues to be [16:42] a mentor to them. He's well [16:53] roundupeded [16:54] rounded and we thank him and his [16:55] family as well for the support. [16:55] During previous years when he [16:58] used to put on fishing [17:00] tournaments, his family would be [17:09] there too to support us. [17:10] >>officer? [17:13] >> hi, good morning council [17:14] members, good morning everyone. [17:17] I'm very umbled to receive this [17:21] award. A lot of us do this as a [17:24] thankless job. We recognize the [17:25] service we do for community [17:27] every day. Thank you for your [17:30] support. I mention on the side [17:34] that he was my mentor. I cannot [17:36] forget my family and a lot of [17:38] times we work long hours with [17:39] law enforcement and sometimes [17:41] away from home. Thank you to my [17:44] family for holding on the fort [17:47] away from home. Love you guys. [17:49] >>yeah, collectively, part of a [17:51] small team. Our brothers and [17:56] sisters in blue, unfortunately [17:59] with the unfortunate increase in [18:02] traffic fatalities, we like to [18:05] do our part with enforcement and [18:06] through education as well. [18:09] Sometimes I do see a lot of [18:11] former community members that [18:15] were at the school and [18:17] communicate. I use discretion [18:23] as well even through education. [18:26] Hopefully that in turn is a [18:28] direct effect of keeping our [18:31] keiki a little bit safer. Thank [18:32] you guys. [18:34] >>mahalo. We'll start off with [18:38] the council member of the [18:39] district. [18:39] >>council member heather l. [18:41] Kimball: I just really want to [18:43] appreciate the importance of [18:59] highlighting this particular [19:02] people are driving and following [19:06] the speed limit. It's a very [19:40] dangerous road. [19:43] >> you have had an opportunity [19:44] to establish the relationship [19:56] and trust. [19:59] >> we don't want to get in [20:01] trouble or busted. But there is [20:13] something even more special and [20:16] you having the opportunity to [20:24] interact and engage with and [20:25] even though they are speeding [20:27] whatnot, that relationship, it [20:30] just landed with me that that's [20:33] a part of an accountability and [20:36] kuleana is not wanting to [20:37] disappoint someone who had been [20:40] a supporter, advisor and mentor [20:45] and that inspires changed [20:46] behavior. Ironically, sometimes [20:48] more profoundly than fear of [20:54] being in trouble. Thank you for [20:57] really authentically connecting [20:58] yourself and your relationships [21:03] in your community that will has [21:06] and will continue to inspire [21:09] greatness and better choices [21:10] from those you've come in [21:12] contact with. Appreciate that. [21:23] I yield. [21:30] >> congratulations to you as [21:31] being the 2026 haweo award [21:32] recipient. We do extend our [21:44] mahalo and to your keiki as [21:45] well. [22:38] >>please rise. [22:39] >>] [22:39] >> [22:43] >> [22:46] >>[Singing hawaiian] [22:58] [Applause]Godoy for her work [23:02] with first responders and bypass [23:03] appreciation week o recognize [23:11] our first responders. Good [23:12] morning. [23:15] >>good morning. Do I need to [23:17] introduce myself [23:17] >> thank you very much first of [23:20] all to the council members for [23:25] the aweo awards. I'm really [23:27] excited. And this important [23:28] contribution that they make to [23:33] our county. It's an annual [23:35] observance that recognizes the [23:37] hard work and rescue and [23:40] community education that is [23:42] provided by the first [23:44] responders. The diligence is [23:46] especially appreciated by this [23:48] and so many of our activities [23:50] with our families and in our [23:52] community is at the beaches and [24:01] at the swimming pools. Our pools [24:04] provide much recognition and [24:11] many benefit from that therapy. [24:14] We thank our police department [24:16] and fire department. They rescue [24:19] people in our waters and our [24:22] pools. I know as a nana, we 3 [24:24] always feel safer when we see [24:32] the lifeguard towers with the [24:32] presence that makes us feel [24:33] safer to enjoy the water [24:34] together. Mahalo also, I want to [24:36] give a shout out to the clerical [24:42] staff, amy bautista, and we met [24:44] and they put their heart into [24:46] wanting to put together [24:47] appreciation kits that were [24:49] things that the life guards [24:51] could use and design the banners [24:53] and just put their whole heart [24:55] and soul into really wanting [24:57] this to be special and wanting [24:58] our life guards to know they are [25:00] appreciated and that they are [25:03] honored. I also want to honor [25:04] battalion chief bradley young [25:08] for his devotion for all the [25:11] life guards that serve under him [25:13] and he's really caring and [25:16] really appreciate him. Mahalo [25:17] holeka and all the council [25:18] members for making this possible [25:21] that we can honor them in a [25:28] special way. [25:29] >> [25:30] >>chair holeka goro inaba: [25:33] thank you. We'll take battalion [25:35] chief, anything you would like [25:38] to say on behalf of the [25:41] lifeguard appreciation week. It [25:52] was week of the 23rd. That's why [25:55] we are meeting today with the [25:57] hurricane that came through. [26:01] >>thank you, as a first [26:02] responder, thank you for aking [26:11] the time to take this special [26:12] celebration for our water safety [26:14] officers and our life guards at [26:16] our county pools. Fighting the [26:17] fight against drowning, the [26:21] number one fatality for our [26:24] youth. Here in hawai'I county, [26:27] half of the drownings are our [26:29] residents. It's really nice to [26:31] have a career fighting the fight [26:44] against those statistics # # # [26:44] and [26:48] really pleased to align this. [26:50] As we are looking to the near [26:52] future, we are learning together [26:58] as a county. [26:59] And natural occurrences we are [27:01] facing and I look forward to [27:03] ensuring that we do everything [27:04] we can to continue our mission [27:10] to serve with aloha. Thank you. [27:11] >> [27:13] >>chair holeka goro inaba: now, [27:15] our parks and recreation, we [27:23] have or deputy director to come [27:30] up to share anything on the [27:38] proclamation for our life [27:38] guards. [27:39] >>lifeguards. [27:39] >>aloha and good morning. On [27:49] behalf of the department of [27:50] parks and recreation, we extend [27:54] our mahalo # [28:02] for this opportunity. [28:11] To express gratitude a [28:15] one of the struggles that our [28:19] department faces is getting more [28:26] lifeguards, but through that, we [28:29] are able to do our best eastern [28:30] ven for [28:31] ocean safety, doing their best [28:33] for the public. I think it's [28:37] really important that everybody [28:39] realizes those who are watching [28:44] online, those who are present [28:49] here, that our essential people, [28:53] our staff, is so important for [28:56] the safety of everyone that uses [29:00] our facilities whether it's our [29:06] pools or ocean and safety is a [29:08] priority. [29:10] We appreciate the collaboration [29:12] that we have with ocean safety [29:14] and we are able to provide the [29:15] necessary space that they need [29:33] and the offices to operate I [29:35] share from the bottom of my [29:55] heart in the position that we [29:58] hold. We are very thankful. [29:59] Mahalo. [30:00] >>mahalo. [30:03] >>I would like to give council [30:07] an opportunity. [30:07] >>vice-chair dennis "fresh" [30:08] onishi: thank you, chair. [30:14] Yeah, I just want to say [30:15] congratulations to ocean safety [30:16] and also with the aquatics pr. I [30:20] work closely with stacy young. I [30:22] want to thank the mayor, our [30:25] finance director, fire [30:28] department chief, will be in [30:31] support of getting more [30:32] lifeguards for our beaches [30:40] island wide. It's really great [30:43] and talking to about the stories [30:46] of bringing someone that was [30:49] drowning and they brought them [30:59] back in nd brought them back to [31:05] life. The percentage I think is [31:08] 90% of the victims that gets [31:09] revived. Thank you for all of [31:11] your hard work and your staff. I [31:12] yield. [31:12] >> [31:13] >> council member james hustace: [31:14] thank you, chair. [31:16] I just want to echo those [31:17] sentiments as well mahalo the [31:20] lifeguards in our community and [31:22] our pools and recreational [31:24] facility and cean safety side [31:26] of things. It is amazing that [31:28] we are in an island community [31:30] and we grapple with those [31:31] challenges of ocean safety and [31:34] we don't necessarily have all [31:37] the skills in community to be [31:38] smart about the ocean and [31:43] awareness of that. So it's [31:45] through your work, your staff [31:51] and the departments in [31:52] community, it's really amazing [31:52] to see that moving forward and [31:54] with the sayre oundation and as [31:57] well as the training education [32:00] with our keiki and foundations [32:01] and other entities like that [32:18] that are active with community [32:19] and keiki and delivering on [32:20] those efforts there so that we [32:20] are safer in those spaces. [32:21] Really look to our loofgdz [32:21] ifeguards to [32:22] lead that charge and really [32:23] amazing in the rescues they [32:25] perform and dangerous too. [32:28] Mahalo to hem in the work they [32:33] do. [32:33] >> council member rebecca [32:36] villegas: I want to express my [32:38] gratitude and congratulations [32:40] and honor you for the work that [33:12] you do. Having grown up in has [33:12] seen -- would like to recognize [33:13] the parks for stepping up and [33:14] leaning in on the resources for [33:15] communities that have become so [33:19] well loved and well used that [33:22] statistically you are to have a [33:24] potential accident. You guys are [33:26] the front lines, men and women [33:30] who interact daily. Visiting our [33:32] beautiful oceans and pools for [33:34] whatever reason. For all they [33:37] have a gazillion different [33:40] reasons I'm sure along with the [33:45] stories of harrowing, saving, [33:47] there are probably some funny [33:51] stories about the humans that [33:56] play about the seas. Just a [34:00] quick shout out, thank you, [34:02] melissa for your heartfelt [34:04] sharing and vulnerability and [34:06] really caring and that struggle [34:14] to find lifeguards for our pools [34:19] is real. People get upset about [34:21] it because sometimes our pools [34:22] have to close. If you have the [34:24] capacity and the time, please [34:26] consider leaning n and joining [34:29] these teams of brave men and [34:31] women serving our community in [37:03] >> # # [37:04] >> aloha, we are back out of [37:05] recess. It is 9:45 A.M.. We will [37:06] take statements from the public. [37:08] >>thank you, chair. [37:12] We have testifiers here and zoom [37:16] and kona and then we'll close [37:20] out with testifiers in hil.T for [37:27] its kona cats sanctuary process. [37:29] This indicates to us that this [37:31] entity has been registered for [37:34] less than two years, and we [37:38] really don't know much or have [37:43] much history about its cat [37:45] sanctuary operation. Not even [37:52] half the cats in hawai'I in a [37:54] very established spay and neuter [37:57] organization in kona who have [38:01] been spay and neutering [38:02] thousands of cats did not know [38:04] about this group, this [38:07] foundation when I sent this [38:09] resolution to its PRESIDENT Two [38:11] weeks ago. Unless this sanctuary [38:17] is being set up to receive the [38:19] many abandoned cats that we cat [38:21] feeders feed in the kona area, [38:23] unless this is being set up to [38:25] receive these abandoned cats [38:26] from the kona district, at least [38:28] the kona district, I really [38:30] think that you should reconsider [38:32] this funding and perhaps not [38:35] fund this entity at this time. [38:41] Thank you. [38:57] >> our nextsimmons. Please [38:58] introduce yourself. [38:59] >> you have three minutes for [39:03] your testimony. [39:05] >>public speaker: aloha, nicole [39:07] simmons, parks and recreation of [39:14] the activities division. I'm [39:14] testifying on behalf of the [39:18] hawai'I kupuna hull [39:21] a festival [39:24] that has been running for 30 [39:30] years for appreciation the [39:32] culture. Our main goal in our [39:32] gigs [39:34] division is to have seniors [39:40] aging in place and for the [39:41] quality of life. I would like [39:48] to mahalo council members inaba, [39:49] onishi and villegas for your [39:49] condominium [40:05] continued support for kupuna [40:06] hula. [40:17] >>thank you, nicole. [40:34] >> [40:36] >>public speaker: good morning, [40:39] my name is julia larson here to [40:42] testify on bills 173 and 175. My [40:46] husband and I live in cola ranch [40:55] zoned agriculture. We have [40:55] operated a tvr since 2017. We [40:57] live at our residence full time [41:04] and rent out our primary [41:05] residence. The income we get is [41:10] to pay for our expenses. The [41:11] main problem is the significant [41:13] taxes that we have experience [41:22] from $6092 in 2018 to $6332 due [41:30] to operating. This is an [41:37] increase of 150%. And an [41:47] increase of 275%. Our taxes [41:48] increase every year because now [41:48] there is no limit on what to be [41:49] charged. We would like the [41:52] council to pass this bill to [41:56] lower the tax classification in [42:01] we are currently in and provide [42:04] amnesty or our homes. Since we [42:07] rent out a portion of our home, [42:11] we should not be penalized for [42:18] this property. We would like [42:19] this council to implement the 3% [42:20] cap that the other homeowners [42:27] receive. We began to rent out in [42:32] 2016 but we were taxes in [42:34] raised taxes in [42:36] 2019. We are not sure if we are [42:39] going to have to payback taxes [42:42] and if we have to pay and [42:45] renewal fees, we have to [42:46] discontinue from operating our [42:53] tvr and will make it difficult [42:53] to meet the monthly expenses. [42:54] The county will lose the tat [42:59] taxes we submit and we employ [43:02] gardeners, cleaners etc and this [43:05] would be impacted if we were o [43:07] stop this tvr. Passing this bill [43:11] will make a huge difference. [43:13] Please pass his bill to lessen [43:16] the tax burden on local [43:18] homeowners by making ends meet. [43:22] We hope the county passes bill [43:44] 173 and considers these [43:44] >> [43:49] >> next speaker, please. [43:49] >>public speaker: [43:50] please [43:51] introduce yourself. Seems like we are having [44:52] some difficulty with stephanie's [44:54] connection. We'll move on to our [44:55] testifiers here in hilo and we [45:03] can circle back to stephanie to [45:03] try again. With that, our first [45:04] testifier in hilo chamber is tom [45:09] testifying on resolution 657 [45:11] followed by lily. When you are [45:14] ready, hit that green button at [45:19] the base of the mic and you have [45:21] three minutes. [45:22] >> [45:24] >>public speaker: aloha, my name [45:28] is tom, in capacity at the west [45:31] hawai'I veterans cemetery to [45:35] express my strong support for [45:38] resolution 657-26. Members of [45:40] the county council, aloha and [45:42] good morning. The medal of honor [45:43] is the highest military [45:51] decoration our nation bestows. [45:52] It is awarded not for doing [45:52] one's duty but for acts of valor [45:56] so extraordinary they defy [46:03] expectation. West hawai'I has a [46:03] direct connection to this on, [46:10] sergeant first class of kukuau [46:16] gave his life. This past [46:18] veterans day he was reen terreed [46:21] here at home. He has the right [46:24] to be buried at the west hawai'i [46:41] veterans cemetery. There are [46:41] memorials honoring the world war [46:45] ii, korean war, each memorial [46:47] has a deep connection and honor [46:50] the memorial walkway and ensure [46:52] the recipients with hawai'I [46:55] island connections has the best [46:57] honor at the hawaiian cemetery. [46:58] The funds will cover [47:00] preparation, excavation, grading [47:02] and foundation work which will [47:04] enable construction to proceed. [47:05] The american allegiance, [47:07] veterans of foreign wars, [47:08] daughters of the american [47:10] revolution, scouts of america [47:14] are pursuing additional funding [47:15] resources. Council member [47:17] hustace from support on this [47:19] resolution is a critical part [47:20] for this completion. I would [47:23] like to recognize chair inaba [47:24] and council member villegas for [47:26] their continued support not only [47:29] to our veterans but also, the [47:32] west hawai'I veterans cemetery. [47:35] I respectfully urge this [47:40] council's approval of this [47:41] resolution. [47:43] >>thank you. [47:54] >> next speaker, please. [47:57] >>public speaker: aloha. I'm [48:03] lily speaking on resolution [48:04] 641-26. An appropriation from [48:04] council member [48:06] kanealii-kleinfelder to my [48:10] family's non-profit foundation. [48:14] For expenses relating to our [48:17] ceremony honoring the [48:18] preservation of the honolulu, [48:21] also known as honolulu landing. [48:23] First and foremost, I ish to [48:29] convey my oana's sincerest [48:30] gratitude to mayor alameda and [48:33] his staff, particularly the [48:35] folks in the ponc division and [48:37] to you, the hawai'I county [48:39] council for graciously approving [48:47] the acquisition of honolulu. My [48:52] maternal grandmother was born [48:55] there and I can recall that she [48:57] fondly spoke of her life there. [49:04] We recently submitted a grant [49:05] application to ponc for [49:06] stewardship funds to continue [49:06] the preservation process and [49:08] maintenance of the property. As [49:10] we explore restoration options [49:17] of the former house dwellings, [49:18] garden and livestock enclosures [49:21] and most important the burials [49:23] that exist there. We hope to [49:27] work very closely with the state [49:30] to see if these are protected. [49:32] We have formed partnership with [49:34] three area non-profits, two of [49:37] whom have also applied for ponc [49:39] funds to help in the undertaking [49:42] of this venture. And to be [49:45] funded and we hope to [49:48] collaborate and provide [49:52] opportunities for high school [49:58] students and other areas in puna [49:59] to help with learning as we seek [50:05] to restore the illage. I would [50:06] like to close with a special [50:06] mahalo to counsel [50:06] cil members [50:07] kierkiewicz and [50:08] kanealii-kleinfelder for your [50:11] funding support, your generous [50:13] funding support of our [50:16] dedication ceremony which will [50:21] occur saturday OCTOBER 17th at [50:24] 10:00 A.M. At the county park at [50:38] the bottom of -- in hawaiian [50:38] beaches. You should have already [50:39] received our invitation and we [50:40] hope to see you. We hope you [50:41] will attend. Thank you. [50:42] >> [50:43] >> thank you for your testimony. [50:45] >> [51:24] >> next speaker, please. Aloha, [51:27] council. I would like to invite [51:31] you to celebrate the fiesta of [51:34] the philippines. The funding [51:36] will support the programming of [51:40] the expenses for this [51:42] celebration. In east hawai'I, [51:44] this tradition has flourished [51:47] bringing together multiple [51:48] filipinos together to share our 3 [51:50] culture and love for the [51:52] traditions and helping filipino [51:54] individuals like me in learning [51:56] and deepening our relationship [51:59] with the homeland. I actually [52:01] learned about the tradition and [52:04] got one myself at the barrio [52:06] fiesta. I visited the tattoo [52:21] artist in the philippines during [52:29] my sabbatical time. This is [52:29] very profound. This brings [52:31] multiple filipino communities [52:33] together to share the culture [52:36] and love of the tradition and [52:38] help individuals. The filipinos [52:39] have contributed to the history [52:42] of hawai'I as a tate but more [52:43] importantly here on the big [52:44] island. The hawai'I association [52:47] of filipino educators have [52:49] formed to ensure that the [52:51] culture is brought into a [52:53] relationship into the university [52:57] curriculum. One MAY see these [52:59] joyous events as a party, I'm [53:02] not going to lie, the filipinos [53:04] throw the best parties and they [53:05] are significant in the lives of [53:07] our students at uh hilo and [53:09] hawai'I island. I fully support [53:29] the funding request for this [53:30] event. [53:33] >>please introduce yourself. [53:34] Please introduce yourself. [53:35] >> you have three minutes for [53:35] your testimony. [53:38] >>public speaker: thank you, I'm [53:48] renee godoy. First I want to [53:52] speak about resolutions 636-26 [53:56] and 656-26, supporting our [53:58] robust couples conference for [53:59] first responders, and I want to [54:02] start with a story of last year. [54:05] We had a couple on the verge of [54:07] divorce. They went to speak to [54:09] one of our chaplains and the [54:11] chaplain said just give this a [54:13] chance, just try this before you [54:16] divorce. They have several [54:18] children, and she didn't want to [54:20] see them in a divorce. They came [54:22] to the conference. It turned [54:24] their marriage around. They came [54:26] in upset and they left happy. So [54:29] that's why we o it. As you [54:31] know, first responders, they [54:34] deal with long shifts, exposures [54:36] to life threatening situations [54:38] and long absences from home ot [54:40] just during their shifts but [54:43] every natural disaster, you do [54:47] not have response at home [54:51] because they are out epi [54:51] nsuring [54:54] the safety of the public. They [54:56] are often not there for the [54:57] holidays and that tends to take [55:01] a toll in a relationship. First [55:02] responders receive hundreds if [55:04] not thousands of hours in [55:13] training on all kinds of stuff. [55:14] I often ask them, okay, how much [55:15] training have you had a good [55:18] partner, a good spouse, a goats [55:20] father and mother, how many [55:22] books have you read on those [55:24] topics and MAY be where you are [55:25] struggling because you have [55:26] thousands of hours in training [55:29] on everything that impacts your [55:31] career, but nothing on how your [55:34] career is impacting the most [55:36] important relationships that are [55:38] in your life. And this is what [55:40] robust ttempts to do. We do [55:42] bring in the people that [55:44] specifically address the unique [55:48] stresses that our first [55:49] responder family is going to [55:55] face in their career. I want to [55:56] thank council member kagiwada [55:59] and hustace for introducing this [56:01] resolution, also thank you to [56:02] their staff members because I [56:04] know, I come up to say we are [56:06] doing all of these awesome [56:08] things and they have to make [56:10] spreadsheets and tables nd all [56:13] of those things. A shout out to [56:18] yours which are shannon andelwin [56:19] and the books that you are 3 [56:21] providing for training that we [56:27] put resources in the hands and [56:28] take with them when they leave [56:29] for the first responders and [56:30] training for the first [56:32] responders and their families. [56:34] Thank you to all of your aids [56:36] that help us with this. Thank [56:37] you very much. Council. [56:39] >> [56:42] >> thank you for your testimony. [56:46] Chair your next testifier is [56:53] dell testifying on resolution [56:55] 609, 602. When you are ready to [56:56] begin, introduce yourself and [57:00] you have three minutes per [57:01] agenda item and you have three [57:04] minutes to transition. [57:04] >>public speaker: I hope to [57:06] transition easy so we don't have [57:09] to stop the clock. Good morning, [57:13] my name is dell. I'm here [57:14] again. I do appreciate what you [57:17] all do, I do. It's hard to thank [57:19] just any one of you because it's [57:29] all of you. I'm here to support [57:40] that. Not only that, I lways [57:40] come before you because this [57:52] chronic issue of staffing and [58:03] vacancies is prevalent. I hear [58:04] it through testimony and through [58:15] some of your comments. So it is [58:16] there. And to ignore it [58:27] sometimes when we be theed and [58:28] pass a million dollar consultant [58:39] fees is kind of unexcusable and [58:39] unacceptable to me. I say this [58:40] because I know this passed to [58:40] support unit but a lot of the [58:40] times when I research, there is [58:40] $40 million that was spent last [58:41] year alone on consultant fees. [58:41] And in the meantime, we've got [58:41] vacancies with the leveled [58:41] ifeguard, [58:42] fire department, police [58:42] department and wastewater. We [58:42] are extending agreements into [58:42] five years for the different [58:43] structure. That's, kind of, [58:43] unacceptable because the cuts [58:43] will be more astronomical if we [58:48] wait that long. So all I'm [58:48] saying is while you look at the [58:57] different ussian [58:58] esolutions like bill [59:00] 163, where is the money coming [59:03] from. Was glad to sit her to [59:05] listening to testimonies [59:08] regarding bill 173. It's true. [59:09] These are just paper things [59:11] coming before us. What are the [59:13] most fiscal responsible thing to [59:16] do. Do we do this for the [59:18] county? Which is why you are [59:20] all here. But do we do it for [59:22] the residents that you represent [59:24] in the county. For me, please [59:31] give pause to them, due to the [59:32] resolutions and communications [59:35] and bills that require fees for [59:36] consultants because we are [59:38] spending way too much for future [59:40] and not dealing with the current [59:43] crisis we have now. So to me, [59:45] no. 1, fill the vacancies. They [59:47] are in all departments. We [59:50] cannot keep on moving things on [59:53] without fixing that problem. We [59:58] can't. We cannot do the [1:00:03] projects without fixing it. And [1:00:06] do away with the 90 days. Just [1:00:08] hire them. We don't have to [1:00:21] worry about the m [1:00:22] >> [1:00:23] >> thank you for your testimony. [1:00:31] Chair, your last testifier at [1:00:32] the beginning of the meeting is [1:00:35] stephanie. Please introduce [1:00:35] yourself. [1:00:36] >> you have three minutes for [1:00:37] your testimony. [1:00:38] >>if you can just introduce 3 [1:00:52] yourself and [1:00:55] on behalf of bills or [1:00:59] communications 1001, first. But [1:01:01] before I do that, I would like [1:01:03] to congratulate those of you who [1:01:07] applied for your jobs as county 3 [1:01:09] council people and were hired [1:01:11] during the primary. I think that [1:01:14] it's wonderful that you can put [1:01:18] your shoulders to the wheel and [1:01:20] focus on your service to the [1:01:21] community instead of the [1:01:24] campaign which I know can be [1:01:30] draining. I really appreciate [1:01:34] what you do. Serving on the puna [1:01:34] community development plan, I [1:01:37] can see how important it is to [1:01:39] have your support and have your [1:01:43] ear when we set priorities as [1:01:44] community development plan [1:01:46] action committees. So that we [1:01:49] can realize and implement some [1:01:50] of the goals and objectives [1:01:52] within our plans and this is not [1:01:55] just for puna, but island wide. [1:01:57] When action committees are not [1:01:59] fully staffed, what my [1:02:01] experience has been as an action [1:02:03] committee member is that we [1:02:07] don't meet quorum, so we can't [1:02:10] proceed and do business because [1:02:13] we only have funding to meet [1:02:15] every other month. If we MISS A [1:02:16] month, we can't vote, but you [1:02:19] know, it's a problem. So today, [1:02:25] I'm very grateful that we have [1:02:36] two nominees here. I met jail [1:02:46] lyn 3 [1:02:46] last year and I was very [1:02:46] impressed with her focus, her [1:02:46] groundedness and willingness to [1:02:46] serve within the hawaiian acres [1:02:46] community. So I mentioned to [1:02:46] her, hey, would you consider [1:02:46] being on the action committee so [1:02:48] we can fill some seats and I'm [1:02:50] just very grateful for her [1:03:02] I would like to testify now on [1:03:13] communications 1002. [1:03:24] I believe I met gary a couple [1:03:24] years ago and I was very [1:03:24] impressed with his passion for [1:03:24] food security. Being on an [1:03:24] island and especially with all [1:03:24] of the funding that's being cut, [1:03:26] gary has some insights that he [1:03:30] can bring to the table on food [1:03:35] security. So I support both of [1:03:36] these folks and I also [1:03:38] appreciate gary for his [1:03:40] willingness to serve. I [1:03:51] wholeheartedly ask that you run [1:03:53] their names through and get them [1:03:55] confirmed for the next action [1:03:57] committee meeting. Mahalo. [1:04:02] >> [1:04:02] >> thank you for your testimony. [1:04:02] >>with that, chair, those are [1:04:02] all the testifiers that you have [1:04:03] at the beginning of the meeting [1:04:08] noting that we have a testifier [1:04:30] for an agenda item. Thank you. [1:04:30] >>thank you. Are there any [1:04:30] discussions to the meeting [1:04:30] minutes of JULY 23, 2025, MAY [1:04:30] 21, 2026, JUNE 3, 2026? Seeing [1:04:30] none, the meeting minutes are [1:04:30] approved. We will proceed with [1:04:30] the course. [1:05:29] >>micah alameda, executive [1:05:31] assistant: mahalo nui, MR. [1:05:34] Chair. Back-to-back days, we [1:05:35] don't do this often. One thing I [1:05:38] appreciate on council, office of [1:05:41] the mayor. One thing I do [1:05:42] appreciate about council days is [1:05:43] the appreciation and their [1:05:47] gratitude that we start off with [1:05:55] honoring officer haweo award and [1:05:56] two youth, and honoring our [1:06:00] lifeguards and fire and in parks [1:06:01] and rec. Starting off with [1:06:04] gratitude is what makes this [1:06:07] county different from other [1:06:09] municipalities across this [1:06:11] current united states. This is [1:06:13] one of the reasons that makes [1:06:15] this the best island I think in [1:06:17] our island chain. I also want to [1:06:19] just share the appreciation we [1:06:21] have for the work that you folks [1:06:22] do. [1:06:25] It's not easy. Many of you have [1:06:29] multiple jobs, young keiki. [1:06:30] This work calls yu. You are [1:06:32] doing this work for the greater [1:06:33] service and as someone who is [1:06:36] also a servant of this work with [1:06:38] young keiki who often take he [1:06:40] backseat to what we do here, [1:06:42] mahalo you guys. It is not [1:06:45] easy, but you folks step forward [1:06:47] every single day. As someone [1:06:48] from the administration who [1:06:49] comes here to bring individuals [1:06:51] every two weeks or monthly, I [1:06:54] never know what to expect. But [1:06:56] I can tell you this, I can [1:07:00] expect gratitude to start as a [1:07:06] foundation. And as a shared [1:07:09] value. Moving right off into it, [1:07:40] I'm going to start with jalyn [1:07:49] comes to us. She used to serve [1:07:50] on the hawaiian acres. She lives [1:07:51] on hawaiian acres. I respect her [1:07:53] for that. It's hard work to live [1:07:55] there the way it is now. Mahalo [1:07:56] for continuing to sustain life [1:07:59] out there in upper puna. She [1:08:02] comes to us with an associate's [1:08:04] degree, self-employed farmer and [1:08:09] as you heard from stephanie, [1:08:10] jalyn is super bright and will [1:08:15] show up for puna. Mahalo and MR. [1:08:16] Chair, back to you. [1:08:18] >>thank you. Would you like to [1:08:20] share anything about this cdp [1:08:38] action committee? [1:08:46] >> thank you. I appreciate being [1:08:47] here. Our roads are a concern in [1:08:50] our county and we have potential [1:08:52] issues and solutions. So, being [1:08:55] able to be part of the solution [1:08:58] is what I'm really grateful for [1:09:00] that opportunity to do and [1:09:02] however, that serves, I'm here [1:09:14] for it. Thank you. [1:09:15] >>klein thank you very much for [1:09:19] being hre. I know you from the [1:09:20] hawaiian corporation where you [1:09:21] are PRESIDENT, correct me if I [1:09:22] am wrong? [1:09:24] >> I have actually recently [1:09:25] resigned from that. [1:09:28] >>I understand. I understand why [1:09:29] you stepped up and why you [1:09:31] stepped down. Why it's [1:09:33] difficult. You are not paid, and [1:09:35] you stand up and do a job and [1:09:42] try to help your community and I [1:09:43] have been to those meetings and [1:09:44] they are brutal especially to [1:09:46] make those meetings an absolute [1:09:50] nightmare. So y point is, do [1:09:51] you understand the issues that [1:09:54] we have in puna, specifically do [1:09:55] you understand some of the road [1:09:57] challenges that we have with the [1:10:01] private subdivisions and their [1:10:02] roads? [1:10:05] You live there, and you know and [1:10:06] that's the difference. Some [1:10:08] people n the committee, some [1:10:10] people in community can speak to [1:10:11] it, but they don't understand [1:10:14] it. Having you on the action [1:10:17] committee will provide not only [1:10:21] a leg up for upper puna in [1:10:24] district 5, given what I'm [1:10:26] seeing today with MR. Rosenberg [1:10:34] and yourself. But also, start [1:10:35] to more of a deeper insight as [1:10:37] to what is needed in puna. The [1:10:39] way I opened is specific because [1:10:43] you stepped up to help community [1:10:45] in the hawaiian corporation and [1:10:46] you stepped down because it was [1:10:49] a lot, but you are stepping back [1:10:51] up to be on the action committee [1:10:53] which is similar but more of a [1:10:55] county driven mechanism. And I [1:10:57] expect great things from you on [1:11:04] this committee. Thank you and to [1:11:05] the administration for bringing [1:11:09] MS. Brendalyn forward. [1:11:20] >>thank you, council member. I [1:11:21] do appreciate that and really do [1:11:32] hope to bring not only [1:11:36] resolutions for our roads but [1:11:37] for our associations as well. I [1:11:37] see a lot of people performing [1:11:37] and come forward with a lot of [1:11:38] great plans and sometimes it [1:11:38] needs a few extra places to make [1:11:38] the action follow through. [1:11:38] >>one question, did shannon help [1:11:39] you get onto the commission, did [1:11:40] she bring you forward? No? [1:11:41] Okay, thank you. [1:11:44] >>thank you, council member, [1:11:44] kierkiewicz. [1:11:45] >> [1:11:45] >> council member ashley [1:11:46] kierkiewicz: thank you. It was [1:11:48] so nice o immediate you earlier [1:11:50] this morning. Thank you for [1:11:52] making the time to volunteer to [1:11:54] support community. While you do [1:11:57] reside in district 5, you do sit [1:11:58] on the puna community [1:12:00] development action committee. So [1:12:02] taking a step back and thinking [1:12:03] about how your community is [1:12:04] integrated with the entire [1:12:06] region and making sure that [1:12:09] there is equitable distribution, [1:12:10] of resources and access 3 [1:12:15] throughout the entire region [1:12:18] which is on oahu. We are going [1:12:21] to be terming out in three [1:12:24] months and new leaders [1:12:27] representing puna, two district [1:12:28] representatives. I have always [1:12:30] had a wonderful relationship [1:12:31] with the action committee and [1:12:32] different projects that you [1:12:34] would like to do or legislation [1:12:36] and often do the action [1:12:37] committee to socialize those [1:12:39] ideas because you are [1:12:44] individuals that live in [1:12:45] community and going to be [1:12:45] impacted by any of those [1:12:46] practices with legislation. I [1:12:50] encourage you and MR. Rosenberg [1:12:57] to develop that position with [1:12:57] those elected officials because [1:12:58] there is partnerships to be [1:12:59] developed. We have the [1:13:01] opportunity to impact and craft [1:13:08] legislation. So lean in those [1:13:09] relationships and you have a [1:13:09] wonderful action committee. I'm [1:13:12] so happy to see stephanie this [1:13:18] morning. You are going to add [1:13:19] incredible value. Thank you for [1:13:19] serving. [1:13:20] >>thank you very much. I [1:13:21] appreciate the advice and [1:13:22] encouragement moving forward [1:13:23] too. [1:13:24] >> council member jenn kagiwada: [1:13:25] thank you. Thank you for [1:13:26] stepping up. I wanted to give [1:13:32] you a shout out. My staff was [1:13:35] very excited to see our name [1:13:35] your name [1:13:37] coming forward and very [1:13:38] knowledgeable about the road and [1:13:39] perfect for the action [1:13:40] committee. Good luck and happy [1:13:43] to support your nomination. [1:13:46] >>thank you, I appreciate that. [1:13:47] Kagiwada. Yes, to speak a little [1:13:50] bit of what you are saying about [1:13:53] really taking into account our [1:13:55] entire community of puna and [1:13:57] it's not just our roads that [1:14:02] connect us, but we are all [1:14:04] really equally affected by the [1:14:06] amount of rain we receive and [1:14:08] drainage that heavily affects [1:14:10] our roads. When I do look at [1:14:18] some of the issues at hawaiian [1:14:19] acres faces and some areas are [1:14:22] facing the same issues and we [1:14:25] can resolve for our future [1:14:26] generations. [1:14:28] >>mahalo again. We didn't see [1:14:30] you in committee until two [1:14:32] weeks. All in favor say, "aye" [1:14:32] >> aye. [1:14:33] >> any opposed? Of confirming [1:14:43] the nomination of jalyn [1:14:44] brendlyn, all in favor say, [1:14:45] "aye" [1:14:45] >> aye. [1:14:47] >> any opposed? Motion carries, [1:14:48] 9 ayes. Micah alameda, [1:15:37] executive assistant: mahalo [1:15:42] chair inaba. It is my pleasure [1:15:47] to recommended gary rosenberg to [1:15:49] the puna community development [1:15:51] plan action committee. He's been [1:15:53] a resident for over 35 years. He [1:15:57] came to me initially as a [1:16:01] referral from MS. Bath who also 3 [1:16:02] referred jalyn. Through that, [1:16:05] actually spoke o MR. Rosenberg [1:16:07] a few times over the phone and [1:16:10] physically when he came into the [1:16:13] office and talking to him over [1:16:15] the phone, I thought he was the [1:16:17] real deal. Through my [1:16:19] conversations with him, I [1:16:22] realized he has a huge passion [1:16:24] and mega force for food security [1:16:26] and very passionate about [1:16:27] agriculture. When he was talking [1:16:29] about raising pigs and working [1:16:31] with students, I said, [1:16:32] kamehameha schools where I went [1:16:38] to school, they have a piggery [1:16:39] and he said I'm already working [1:16:42] with that. He comes to us right [1:16:43] from the farm going straight [1:16:51] back after this. I believe he [1:16:55] would benefit greatly from MR. [1:16:57] Rosenberg's experience. MR. [1:17:18] Chair, back to you. [1:17:21] >> I appreciates [1:17:22] you stepping up. [1:17:24] I'm going to ask you one thing. [1:17:26] You are very animated and very [1:17:29] go get em done when it comes to [1:17:33] doing tings. In the action [1:17:35] committee. You are going to [1:17:52] have to its my only comment and [1:17:54] will do great work. Which is be [1:17:55] ready to simmer down a little [1:17:57] bit and be ready to team play [1:18:17] with your other members. [1:18:18] >> council member ashley [1:18:19] kierkiewicz: I see you out [1:18:19] there. You come to council today [1:18:20] letting us know what you do for [1:18:22] a living and that is working [1:18:25] with with our aina for [1:18:27] communities. He runs the [1:18:29] institute, part of our food [1:18:30] summit panel discussions in [1:18:33] lower puna a couple years ago [1:18:36] for revitalize puna activation. 3 [1:18:39] so incredibly impressed by how [1:18:40] your mind works, the complexity [1:18:43] of it and also the ability to [1:18:45] take those complex ideas and do [1:18:46] something meaningful on the [1:18:48] ground. Bring the wealth of 3 [1:18:49] information and also bring the [1:18:52] passions that you have to the [1:18:52] action committee. I love the [1:18:55] fact that you are a fire [1:18:57] cracker. Sometimes we do need to [1:18:58] shake things up a little bit. [1:19:00] Use that forum as an opportunity [1:19:03] to expound ideas and also to [1:19:05] provide some leadership. As a [1:19:06] committee, you folks could be [1:19:08] writing letters and sending that [1:19:09] to the council for [1:19:11] consideration, to state elected [1:19:15] officials and even to the mayor [1:19:15] of the departments [1:19:16] administration. I think it's [1:19:19] important to you folks to use [1:19:20] that opportunity to send over [1:19:23] ideas and request their presence [1:19:25] at future committee hearings so [1:19:26] they know how they are going to [1:19:29] be putting community ideas into [1:19:30] action. Thank you for taking [1:19:33] time off the farm to fit in [1:19:35] conversations with community and [1:19:37] county government to get the [1:19:38] work done for the people. I'm from the [1:33:11] foundation and irs and [1:33:12] charitable organization. Hawai'I [1:33:15] county is experiencing a [1:33:17] substantial problem with [1:33:20] community cats, feral and stray [1:33:25] cats and that is a problem with [1:33:31] birds, insects and sea turtles. [1:33:36] Hawai'I county's cats have cause [1:33:40] very strong confrontations as a [1:33:42] threat to native species and [1:33:49] those who wish to see feral and [1:33:53] stray cats in a decedent manner [1:34:00] nt manner. [1:34:06] Our current focus is a sanctuary [1:34:09] located in captain cook. The [1:34:13] requested funds will help the [1:34:16] entire island which will help [1:34:17] multiple locations across the [1:34:19] island and the first year [1:34:21] operational plan for the kona [1:34:27] cat commons. However, -- the [1:34:33] community cat situation in [1:34:34] hawai'I county is so severe that [1:34:35] no one intervention by itself [1:34:36] will contain the problem. Thus [1:34:37] the development and operation of [1:34:39] the kona cat commons will serve [1:34:41] as a pilot project for the [1:34:42] county's broader effort to [1:34:45] address the cat situation. The [1:34:48] plan will be the property of [1:34:49] hawai'I county as the owner of [1:34:51] the plan, the county will be [1:34:54] able to use or modify the plan [1:34:57] at its discretion. Currently, [1:34:58] several initiatives are underway [1:35:00] to address the cat issue in our [1:35:02] county. However, these efforts [1:35:05] are uncoordinated and often work [1:35:07] in a counterproductive manner. [1:35:09] Thus one outcome of this project [1:35:12] will be a major step forward in 3 [1:35:13] strengthening and coordinating [1:35:15] the county's island wide efforts [1:35:17] to control the community cat [1:35:25] population in a humane manner. [1:35:26] This will benefit several [1:35:26] constituent [1:35:27] cy [1:35:29] ies across the [1:35:32] hawai'I county island and this [1:35:35] is due to environmental and [1:35:37] toxic consequences of unmanaged [1:35:40] cat population. The process [1:35:42] will help the pro bird community [1:35:45] that is a hreat to the native [1:35:46] species on the island and will [1:35:48] benefit the pro cat members of [1:35:56] the community that seek a humane [1:36:07] way to deal with community cats [1:36:08] and once this becomes [1:36:19] operational, it will benefit big [1:36:20] island opportunities for [1:36:28] students. It's a delightful place [1:44:52] really working with young keiki [1:44:55] to work on a lot of social [1:44:56] emotional skills, which I know [1:45:05] is one of the main things that [1:45:07] kindergarten teachers come in [1:45:10] when new kids come in. They [1:45:12] really want them to have some of [1:45:14] that executive function and [1:45:16] social emotional skills. The ne [1:45:19] thing when we are visiting is [1:45:21] they are in a former medical [1:45:23] building and their outdoor place [1:45:26] is basically mostly their old [1:45:29] parking lot. So it's a paved [1:45:31] space. So [2:13:28] move to amend bill 169 draft 2 [2:13:29] with the contents of [2:13:31] communication 939.6. [2:13:32] >>chair holeka goro inaba: it's [2:13:32] been moved and seconded by [2:13:33] council member hustace and [2:13:37] galimba to amend bill 169 draft [2:13:39] 2 with the contents of [2:13:40] communication. [2:13:41] >> council member james hustace: [2:13:43] no real emarks. Just to make [2:13:47] sure it aligns with the body. [2:13:48] >>chair holeka goro inaba: [2:13:50] thank you. [2:15:22] >>chair holeka goro inaba: it's [2:15:23] been moved and seconded by [2:15:26] council member galimba and [2:15:27] kimball. [2:15:28] >>council member heather l. [2:15:29] Kimball: before discussion of [2:15:31] the amendment that I have, I did [2:15:33] want to call everyone's [2:15:36] attention to communication [2:15:37] 960.5. I thought it might be [2:15:41] helpful for everyone to have an [2:15:46] opportunity to kind of viblz the [2:15:47] sualize [2:15:49] the impact of the operation of 3 [2:15:54] an stvr on a homeowner's [2:15:56] property tax. He's on his way [2:15:59] over for questions. Is an [2:16:00] example property over the course [2:16:04] of ten years where on the green [2:16:06] line at the bottom is where they [2:16:08] are capped at the 3% assessment. [2:16:17] There is no short-term [2:16:18] operation. Indicates the blue [2:16:22] line over that market [2:16:22] valkyrie'sed [2:16:23] value, [2:16:24] that increased over the time [2:16:26] period and you see that massive [2:16:32] jump from about 2500 to almost [2:16:34] 9,000 in terms of their property [2:16:39] tax. We did already take the 3% [2:16:42] cap out of this bill, but I do [2:16:45] think that there is still value [2:16:47] in potentially creating a [2:16:49] different tax class that has a [2:16:52] rate again somewhere between the [2:16:54] long-term rental rate and the [2:16:56] residential rate to provide some [2:16:58] tax relief to these folks [2:16:59] because it is also serving as [2:17:03] their primary residence. Only [2:17:05] people that use it as their [2:17:07] primary residence would be able [2:17:08] to take advantage of that [2:17:10] particular property tax class. [2:17:14] I do have an amendment based on [2:17:22] comments from council member [2:17:23] hustace about potentially [2:17:25] wanting to remove the relief [2:17:27] from liability during the [2:17:30] rollback from the amnesty period [2:17:47] and can put that forward for [2:17:48] discussion. Before I do that, I [2:17:48] want to see if there are any [2:17:49] questions from this body on the [2:17:53] bill or the real property tax [2:17:56] demonstration document. [2:18:00] >> council member jenn kagiwada: [2:18:03] thank you, chair. [2:18:04] -h tax class [2:18:04] currently? [2:18:07] >> I can answer that. This is [2:18:11] based on the green would be the [2:18:13] homeowners tax class, so that [2:18:16] rate, and the calculated tax [2:18:19] with the hosted is there would [2:18:25] be the residential current rate. [2:18:30] >>tier one residential. You [2:18:30] don't have a projection on if [2:18:31] you were to establish this tax [2:18:36] class nd locate the tax amount [2:18:38] as you proposed between the [2:18:41] long-term rental and would you [2:18:43] say between he long-term rental [2:18:47] and the residential tax class [2:18:47] one? [2:18:50] >> no, and the reason for that [2:18:52] is really this graphic was meant [2:18:55] to address the impact for the 3% [2:18:57] cap more than anything else. So [2:19:01] you would just calculate back [2:19:04] from the land value to the [2:19:10] assessed value and apply the [2:19:11] different rate. That's how you [2:19:11] would go [2:19:14] would solve for that. It will [2:19:16] bring it down some but not [2:19:17] significantly because the impact [2:19:18] is 3%. [2:19:20] >>that was my main point with [2:19:22] these questions is even if we [2:19:30] are to create a new tax class [2:19:30] for this group, we probably [2:19:32] wouldn't bring it down [2:19:35] significantly from that blue [2:19:48] trajectory if we remove the 3% [2:19:50] cap. Okay. Yeah, I would like to [2:19:54] see some of those numbers. Maybe [2:19:56] I will try to calculate myself [2:19:58] to see what we can do with some [2:20:00] of those numbers there and see [2:20:05] this could be very impactful to [2:20:06] people. [2:20:06] >> council member matt [2:20:15] kanealii-kleinfelder: to the [2:20:16] maker [2:20:17] maker, and the tax, amazing [2:20:18] people over there. When [2:20:18] potential homeowners enter into [2:20:22] this new tax category, do e [2:20:35] reassess them [2:20:39] that question for me is really [2:20:40] if we reassess, they are going [2:20:41] to spike one time on the way [2:20:42] into the program, yeah? [2:20:49] >> correct. That's assuming if [2:20:50] they are in the homeowner [2:20:51] exemption class now then when [2:20:52] they enroll, they are going into [2:20:54] this new program. But let's say [2:20:56] the program doesn't get created, [2:20:59] they would go into their default [2:21:01] tax class whether that's [2:21:04] residential, the agriculture or [2:21:07] apartment class fits a [2:21:10] condominium. So they would go up [2:21:11] regardless. [2:21:12] >>so no matter what. What I'm [2:21:14] looking at this map, the [2:21:16] homeowner assessment, does it [2:21:18] take into account when they roll [2:21:20] into a new program that's being [2:21:22] proposed and host is there [2:21:26] assessed market value versus the [2:21:28] 3% cap assessment. Hen they [2:21:29] roll into the new program, we [2:21:32] are going to reassess them. [2:21:34] >>technically every year we [2:21:36] provide a market value anyway. [2:21:37] What they lose is that [2:21:40] assessment cap. So their [2:21:42] assessed value becomes the [2:21:43] market value. [2:21:46] >>it's not like a sale. Your [2:21:48] home is reassessed at the [2:21:50] current market value. [2:21:51] >>it's not like that. [2:21:53] >>there is no reassessment of [2:21:56] the current market value. [2:21:57] >>correct. [2:22:04] >>you are with the existing [2:22:04] homeowner. [2:22:11] >>they lose the assessment cap [2:22:16] that goes up every year. They [2:22:20] would lose that. The only cap is [2:22:23] the homeowners tax class and the [2:22:24] affordable rental. [2:22:26] >>okay, so there is no, there [2:22:27] wouldn't be an [2:22:30] spike in their [2:22:36] valuation from moving from class [2:22:36] to class? [2:22:37] >> technically, they lose their [2:22:38] assessed value. So their spike [2:22:39] does go up to market. But the [2:22:42] market doesn't change. The [2:22:44] market is always the same and we [2:22:47] kept it artificially low due to [2:22:49] the assessment cap. Their [2:22:51] taxable value ends up being [2:22:53] less. The testifier earlier was [2:22:55] right, she lost her assessment [2:22:57] cap which increased her taxable [2:22:59] value. [2:23:00] >>immediately. [2:23:01] >>immediately. And per the [2:23:03] code, e can do current year [2:23:06] plus two years back if we find [2:23:08] reviews that shows they were [2:23:11] doing hosted rental or any type [2:23:15] of rental activity within 180 [2:23:17] calendar days. [2:23:20] >>okay, so do you have this [2:23:24] form, this communication 960.5 [2:23:26] in front of us. [2:23:28] >>yes, kit a created it for [2:23:32] council member kimball. [2:23:35] >>so, what I said just now, [2:23:42] sorry, my brain is not, from [2:23:51] what I said just now -- does [2:23:52] that link. [2:23:52] >>academy [2:23:56] >>cada joseph. What you said [2:23:57] that is what is provided. That [2:23:59] bump is what is here at the end [2:24:01] of the raph. So instead of [2:24:04] being assessed at a lower value [2:24:06] because of that 3% cap, that [2:24:07] property is going to bounce up [2:24:11] to arket and be taxed at a [2:24:13] higher level because of the [2:24:17] value that's being taxed is [2:24:18] greater. [2:24:22] >>I would ask them. The graph [2:24:27] shows in 2017, ending in two [2:24:31] very distinct values to 2026. I [2:24:33] guess what I'm getting as is [2:24:35] there a point when they come in [2:24:38] and rollover in the new tax [2:24:40] category. Is there going to be a [2:24:42] spike associated with that [2:24:53] rollover with this graph. [2:24:54] >> [2:24:55] >>council member heather l. [2:24:56] Kimball: when somebody is in a [2:24:57] homeowner tax class and [2:25:00] identified by self reporting or [2:25:01] neighbor reporting them or now [2:25:07] through the registration process [2:25:08] that they are doing a vacation [2:25:13] rental, they lose that 3% cap [2:25:15] and at the end of the year, [2:25:17] that's when it goes to the [2:25:18] market rate. When that happens [2:25:20] is when their identified as [2:25:27] having a short-term rental or [2:25:30] hosted rental. [2:25:32] >>if I can clarify, we do it for [2:25:40] the current year so we don't go [2:25:41] forward. [2:25:43] >>if they are on the green line [2:25:45] and they choose to go to the [2:25:47] next line for creating do they [2:25:49] lose their 3%. [2:25:50] >> council member matt [2:25:50] kanealii-kleinfelder: I'm [2:25:52] looking at this bill because it [2:25:57] creates a new bed-and-breakfast [2:26:01] tax category, not on bill 173? [2:26:08] Thank you. I thought we were. So [2:26:11] we create a new tax class and [2:26:13] someone's homeowner residential [2:26:15] wherever they maybe to a new tax [2:26:17] class, is there a change in [2:26:17] assessment. [2:26:19] >>I see where you are going now. [2:26:22] That would be assuming that we [2:26:24] missed them in the past because [2:26:25] technically right now, if you [2:26:27] are doing a hosted short-term [2:26:30] rental, you hould not be in the [2:26:33] homeowner tax class. Correct. [2:26:36] >>it is happening. Maybe it is [2:26:39] happening somewhere. [2:26:41] >>yeah. So when this gets [2:26:43] created, it would be for next [2:26:44] year. That would be on a go [2:26:47] forward for the next year for [2:26:48] the tax class itself because [2:26:51] it's not technically a tax class [2:26:52] for this current taxing period. [2:26:55] But we would pull them out of [2:26:58] the homeowner tax class now and [2:27:00] adjust currently not complying [2:27:02] with the homeowner program when [2:27:05] they register now the way it is. [2:27:08] Because currently we have no [2:27:17] amnesty that's approved. [2:27:21] >>okay. That was my only [2:27:22] question. Sorry. Roundabout way [2:27:22] of getting there but we got [2:27:22] there. Thank you. [2:27:22] >>chair holeka goro inaba: [2:27:23] other questions on the bill [2:27:25] before we get into amendments? [2:27:31] seeing none, council member [2:27:31] kimball. [2:27:32] >>council member heather l. [2:27:33] Kimball: I did a quick back of [2:27:33] the envelope. If we were to [2:27:36] assume this new tax class would [2:27:38] be 7%, then we are looking at [2:27:41] annual tax, property taxes of [2:27:43] about $6,000. That would be some [2:27:48] savings based on using the [2:27:50] residential tier 1 class for [2:27:53] this particular property as an [2:27:56] example. And then just to [2:27:58] reiterate before we get to the [2:28:00] amendment, there is two pieces [2:28:03] of this, one is this new tax [2:28:05] class rate, but then there is [2:28:08] also this amnesty period. [2:28:10] Again, there are a lot of folks [2:28:11] that perhaps unknowingly, [2:28:13] although the department does do [2:28:15] a lot to try to make sure people [2:28:17] are informed that there is this [2:28:21] tax implication of operating a [2:28:22] short-term rental, there are [2:28:24] folks that don't know and the [2:28:26] amnesty period gives them an [2:28:28] opportunity to say, hey, I don't [2:28:29] want to do this right now and [2:28:31] step back from it before it [2:28:33] triggers that spike and the loss [2:28:37] of the 3%. They can move into a [2:28:41] long-term rental and go forward. [2:28:42] I will leave it there. Council [2:28:44] member hustace has a question [2:28:45] before I introduce the [2:28:46] amendment. [2:28:47] >> council member james hustace: [2:28:52] thanks, chair. We remove the 3% [2:28:54] primarily because the system [2:28:57] that we have in lace does not [2:28:58] allow for additional calculation [2:29:06] in there, is that correct? [2:29:07] Administrator? [2:29:10] >> that's correct. Cada spoke [2:29:13] to the administrator and we [2:29:14] asked for update and have not [2:29:17] had a response if it could be [2:29:17] done. [2:29:18] >>the testifier also mentioned [2:29:20] that piece so that they are [2:29:23] looking for that, but this is [2:29:25] something we are in capable of [2:29:26] doing at the moment. [2:29:28] >>correct. I heard the testifier [2:29:35] they were asking for that. [2:29:42] >>yeah. [2:29:42] >>at what point do we add new [2:29:43] tax classes that break inure [2:29:45] your new [2:29:45] system. [2:29:48] >>you are breaking my staff. [2:29:50] >>as far as that capacity the [2:29:52] ability to have different [2:29:55] metrics there. I'm curious in [2:29:56] that. [2:29:58] >>for the tax classifications, [2:30:01] we can actually more easily add [2:30:10] tax classifications. It's the [2:30:10] ifs thens exceptions that [2:30:11] council added [2:30:14] s to it is what [2:30:18] affects the system for auditing [2:30:21] purposes. Adding the tax class [2:30:23] without a caveat is not a [2:30:25] problem. I'm not encouraging it. [2:30:27] That is possible. Other [2:30:29] counties, there is two that have [2:30:31] more than us currently. [2:30:32] >>two in the state that have 3 [2:30:32] more than us? [2:30:47] >> correct. [2:30:49] >>council member you are where [2:30:52] this committee is as well. Where [2:30:59] you perceive this new tax class [2:30:59] should fall in that range? [2:31:00] >> [2:31:00] >>council member heather l. [2:31:01] Kimball: I think it's [2:31:03] appropriate somewhere in between [2:31:05] the long-term rental rate [2:31:07] because we do want to [2:31:09] incentivize that and the [2:31:13] residential tiers. So seven 1/2, [2:31:14] eight percent, somewhere in that [2:31:15] range would be reasonable to [2:31:22] provide some relief to these [2:31:23] homeowners, but also, not [2:31:26] incentivize hosting rentals over [2:31:29] long-term and affordable [2:31:30] rentals. [2:31:33] >>a question to the body maybe. [2:31:36] Do we see that should have [2:31:38] greater relief than our [2:31:40] agricultural production and [2:31:42] maybe these are rhetorical [2:31:43] questions for the group, but in [2:31:45] terms of that range and that [2:31:47] range between the long-term [2:31:50] rental at 775 and 1110. Kind of [2:31:53] where that, or does it sit [2:31:55] closer to the commercial side in [2:31:58] terms of the output, generation, [2:31:59] impact on communication, just [2:32:02] something to think about for [2:32:07] sure, or should it sit as [2:32:10] commercial. I don't know. And [2:32:11] be one in the same necessarily [2:32:14] because of that type of use in [2:32:20] those spaces. It's questionable [2:32:35] about our preference for ben [2:32:37] find [2:32:37] -- [2:32:38] bona fide agricultural use and [2:32:39] what it means for community and [2:32:39] house negative those [2:32:40] ing for aging kupuna. [2:32:43] Personally up more on the scale [2:32:43] a little bit in terms of the [2:32:45] impact on community, the [2:32:50] generation of taxes, revenue for [2:32:52] families. It catches a little [2:32:53] bit higher typically than I [2:32:56] would see on the agricultural [2:32:57] side. Just something to think [2:33:00] about as well. Putting it out [2:33:02] there for the group. Thank you. [2:33:04] >> [2:33:05] >> council member matt [2:33:09] kanealii-kleinfelder: thank [2:33:09] you. [2:33:12] >>the example that you gave [2:33:16] council member kimball, was what [2:33:19] someone would save by ntering [2:33:25] into the new tax class. [2:33:28] What I see this doing is [2:33:30] allowing people in the [2:33:37] homeowners class to enter into [2:33:37] the bed-and-breakfast home [2:33:40] class. I say that because, this [2:33:42] little section in the [2:33:48] bed-and-breakfast home class is [2:33:49] exclusively reserved for [2:33:49] properties that are used as the [2:33:52] owners principal residence and [2:33:55] registered as a tvr. This is [2:34:02] built for people in a homeowners [2:34:03] class who have the registered or [2:34:04] unregistered tvr, and we are [2:34:05] creating them a tax class. From [2:34:07] the example you gave was if [2:34:12] someone moved from residential, [2:34:29] or a higher dollar amount [2:34:30] assessed tax class, they would [2:34:31] save money on the way in. But a [2:34:31] homeowners exemption category [2:34:32] would have to be spiked with [2:34:34] current market value, and spike [2:34:35] MAY not be the word, just what [2:34:43] is going to happen in my mind. [2:34:44] Homeowners class is going up [2:34:45] when we reassess period, no [2:34:46] matter whachl is that [2:34:47] t. Is that a correct [2:34:47] assessment? [2:34:48] >> no. [2:34:50] >>I want to hear from the [2:34:55] administrator, sorry. [2:34:56] >> [2:34:57] >>lisa muira, real property tax [2:34:57] administrator: I think the graph [2:34:59] would show the homeowners tax [2:35:02] for many years and chose to do [2:35:04] hosted and how it would go up. [2:35:06] In one regard, you are right. It [2:35:08] would save individuals or [2:35:11] property owners oney that have [2:35:13] already been adjusted up to [2:35:17] their tax class. They could save [2:35:20] money by having this [2:35:23] bed-and-breakfast home tax class [2:35:25] because they are already at a 3 [2:35:26] higher rate. I think that's what [2:35:28] you are trying to get at. But I [2:35:31] believe when cada did this, it [2:35:34] was more ooking at how it looks [2:35:35] from the homeowner now and what [2:35:40] it would go up to whether it was [2:35:43] with the 3% cap or not. I think [2:35:44] when you did the 3% cap was [2:35:46] still in the original and we [2:35:49] didn't have the draft, maybe. [2:35:51] But I can see where you are [2:35:53] looking at it from the opposite [2:35:54] side from the individual that [2:35:56] came and testified, her taxes [2:35:59] could potentially come down [2:36:00] because she's already been [2:36:02] removed from the homeowner tax [2:36:04] class. [2:36:07] >>correct. And further, when we [2:36:09] create a tax class, the hope is [2:36:11] people jump in, correct? [2:36:12] >> I believe the intent of this [2:36:17] was to use it as a carat to [2:36:20] encourage people in hosted and [2:36:22] short-term to register with the [2:36:32] planning department. [2:36:33] >>correct. So in this case, [2:36:35] yes, if you were part of the [2:36:37] homeowners tax class, this would [2:36:40] come into effect if passed, then [2:36:42] they can jump in as a potential [2:36:44] savings depending on the rate [2:36:46] that we set for the [2:36:47] bed-and-breakfast home tax [2:36:50] category. But, if you are in [2:36:52] the homeowners exemption [2:36:53] category and were hoping you [2:36:55] were going to jump into the [2:36:58] bed-and-breakfast home category, [2:37:11] there is no savings. That's my [2:37:12] point. I don't want to [2:37:15] misrepresent what we are doing. [2:37:16] >>it would be cheaper if they [2:37:20] did it and we found out them [2:37:23] having to rollback and plus the [2:37:26] two years at the tax rate. It [2:37:33] really depends on the tax rate. [2:37:35] If it's more than ag, this [2:37:37] defaults and they could end up [2:37:48] paying more. [2:37:51] >>they can say they are not [2:37:53] going to do it anymore. [2:37:54] >>that's correct. [2:37:56] >>this is jumping in with the [2:38:02] new tax class or register, one [2:38:03] or the other. Yeah. [2:38:03] >>coming clean. [2:38:16] >>yeah. Thank you. [2:38:18] >> [2:38:19] >> council member rebecca [2:38:19] villegas: something popped [2:38:26] forward to me and essentially [2:38:27] there is hardship. What just [2:38:27] popped into my mind is how much [2:38:29] money are they making? Right. [2:38:31] I always hear people saying I'm [2:38:34] paying my taxes, we already put [2:38:36] all this back in and I can't [2:38:40] help but think how many tens or [2:38:42] hundreds of thousands of dollars [2:38:44] are you making a year. And there [2:38:47] is o way to determine that [2:38:53] because everybody's short-term [2:38:54] vacation rentals charges [2:38:56] different if it's a home, a [2:38:59] room, whatnot. I guess that's [2:39:02] the part that gives me a little [2:39:05] less heartburn as we make [2:39:14] decisions about increased taxes. [2:39:16] For operating this kind of a [2:39:18] business in your home which is a [2:39:19] commercial enterprise out of [2:39:22] your home. Yeah. And the [2:39:24] overall kind of pervasive dance [2:39:34] that we do here at a time when [2:39:42] there is so many conversations [2:39:43] about housing crisis and how we [2:39:43] dissent advise [2:39:47] dissent [2:39:50] dissent [2:40:04] dis -- incentivize this. When [2:40:05] there are so many people that [2:40:06] need homes. And taxes that we [2:40:08] also take into consideration the [2:40:09] balance of it being hardship, [2:40:12] but it's a hardship on making [2:40:18] thousands nd thousands of [2:40:20] dollars. There are those that [2:40:23] do it just to pay their mortgage [2:40:30] and those that accumulate [2:40:31] wealth. We are in a capitalist [2:40:33] country but where is the balance [2:40:36] for the greater good. Just [2:40:38] thoughts bouncing around my [2:40:39] head. I yield. [2:40:40] >> council member jenn kagiwada: [2:40:42] just quick follow-up on the [2:40:44] back of the envelope [2:40:45] calculation. You said you do [2:40:50] that based on a $7. 7 would be [2:40:55] lower than the current long-term [2:40:56] rental rate. [2:40:58] >>so I just want to make sure if [2:41:05] we are putting information out [2:41:06] there, that would not probably [2:41:07] be where we would want to go. We [2:41:09] would want to go more like nine [2:41:09] or high eight. Something like [2:41:11] that. I don't know if you can [2:41:13] quickly do that calculation. [2:41:14] >>chair holeka goro inaba: I [2:41:16] think that's going outside the [2:41:17] scope of what we are trying to [2:41:19] do. We are not setting rates. [2:41:26] She said 7% which I think was a [2:41:27] mistake statement. She meant 7 [2:41:27] $7 [2:41:28] earlier. [2:41:31] >>understood. I think it would [2:41:32] be very helpful to see. We have [2:41:34] this graph in front of us that [2:41:38] makes it look like people in the [2:41:39] homeowner class who are renting [2:41:42] a room in their house would go [2:41:46] to astronomical amount. But [2:41:48] with your proposed additional [2:41:50] tax class, we have the ability [2:41:52] to bring that down to something [2:41:55] more reasonable. I guess we just [2:42:00] don't see that in the graph. [2:42:01] Anyway. Thank you. I'm upport [2:42:08] supportive of the new tax class. [2:42:09] >>chair holeka goro inaba: all [2:42:09] right. Let's jump into the [2:42:10] amendment. [2:42:10] >>council member heather l. [2:42:11] Kimball: motion to amend bill [2:42:15] 173 with the contents of [2:42:15] communication [2:42:16] communication. [2:42:17] >>chair holeka goro inaba: we [2:42:18] have a motion and second by [2:42:19] council member kimball and [2:42:22] galimba to amend with the [2:42:25] contents of communication 960.6. [2:42:25] >>council member heather l. [2:42:26] Kimball: this amendment is [2:42:29] proposed in response to council [2:42:32] member hustace's comments that [2:42:34] he prefer not to see the [2:42:35] rollback. Using the [2:42:37] communication graphic to explain [2:42:40] how that would act as [2:42:43] administrator muira mentioned. [2:42:46] They do current year plus two in [2:42:48] terms of rollback taxes when [2:42:55] someone is found to be in [2:42:55] violation of the tax code. In [2:42:57] this particular example bert [2:42:58] where [2:43:05] the tax difference is $7,000, [2:43:07] it's almost $21,000 in fee in [2:43:11] terms of rollback in addition to [2:43:12] fees. They are liable for the [2:43:14] difference of what was paid in [2:43:17] the past and what was owed if [2:43:21] they had been operating the [2:43:23] vacation rental over the course [2:43:33] of three years approximately. [2:43:37] >> questions on the amendment? [2:43:37] >> council member matt [2:43:38] kanealii-kleinfelder: can you [2:43:45] give us a dollar amount for the [2:43:46] average, the difference in what [2:43:47] we are discussing here? [2:43:47] >>lisa muira, real property tax [2:43:48] administrator: are you referring [2:43:50] to amnesty or the rollback. It [2:43:53] really depends how long someone [2:43:54] has been on the homeowner tax [2:43:56] class and what the value of the [2:43:58] property is. [2:44:00] >>I don't know, I'm trying to [2:44:03] figure it out in my ead what [2:44:06] this would mean to remove [2:44:09] rollback taxes but leave the [2:44:16] waving of penalties and [2:44:18] interest. [2:44:19] >>this is basic benefit of [2:44:24] homeowner or benefit of county? [2:44:28] >> to waive rolling back taxes, [2:44:30] penalties and it, benefit of the [2:44:30] homeowner. [2:44:32] >>this is by removing the word [2:44:34] rollback taxes. So it wouldn't [2:44:37] be waving rollback taxes [2:44:38] anymore. That's what this [2:44:39] amendment does. [2:44:40] >>okay. [2:44:51] >>yeah. It's the amendment. [2:44:52] >>960.6. [2:44:53] >>yes. [2:44:55] >>I have the draft amendment. [2:44:56] So I don't know what you are [2:45:03] talking about. [2:45:04] >>sorry. [2:45:20] >>I didn't put my name. Have [2:45:22] you seen theommunication? [2:45:26] >> not hat one. [2:45:29] >>so that benefits the taxpayer. [2:45:32] >>so the rollback taxes is [2:45:33] substantial. [2:45:34] >>they can be very substantial. [2:45:38] It just depends what the value [2:45:40] is, how long is the homeowner, [2:45:42] one year or two years. If you [2:45:44] are in the example that cada [2:45:46] provided where you have I [2:45:48] believe this is a million dollar [2:45:50] house, the penalty is an [2:45:52] automatic ten percent on the [2:45:56] difference in tax. That would [2:46:00] be $674 for that one year plot [2:46:00] the [2:46:02] -- plus the interest. [2:46:06] >>the rollback tax ould be [2:46:09] substantial. By removing for [2:46:12] people out of bounds saves them [2:46:15] money from moving into the new [2:46:16] program. [2:46:17] >>it saves them from the burden [2:46:22] of being charged the penalty [2:46:33] especially those that realize [2:46:33] they weren't allowed to do a [2:46:36] hosted rental of 180 days that [2:46:37] they rented. [2:46:38] >>okay. [2:46:38] >> [2:46:39] >>chair holeka goro inaba: any [2:46:40] other discussion on the [2:46:41] amendment? [2:46:54] >> I'm not sure how I feel about [2:46:55] this amendment. [2:46:56] >>council member heather l. [2:46:57] Kimball: chair, MAY I add a [2:46:58] little bit more color? [2:47:02] >> sure, go ahead. Appreciating [2:47:04] what council member villegas and [2:47:06] council member said about these [2:47:14] activities that creates a burden [2:47:18] on this and there are people [2:47:21] making lots of money. What also [2:47:22] happens is there is a family [2:47:28] living in a house for 20 years, [2:47:28] their kid goes off to college. [2:47:29] They rent a room for a weekend. [2:47:31] If they do it once, they are in [2:47:34] violation of a homeowners tax [2:47:36] class, even once. You have [2:47:38] people that have minimal [2:47:41] rentals, not making thousands of [2:47:42] dollars, but they didn't know [2:47:44] and they did it once and they [2:47:47] got caught and now liable for [2:47:48] tens of thousands of dollars. So [2:47:51] we would be through this by [2:47:52] keeping the rollback protecting [2:47:56] people that are making money [2:47:58] hand over best, but also, [2:48:00] protecting eople that just made [2:48:02] a one time choice and really got [2:48:05] seriously impacted. Personally, [2:48:06] I would rather just move right [2:48:09] now. This is a one time stamp in [2:48:13] time type thing. Provide that [2:48:15] relief to folks now realizing [2:48:17] they are not going to do it [2:48:18] again and moving forward, they [2:48:25] would have t [2:48:26] >>chair holeka goro inaba: so [2:48:27] you personally then would not be [2:48:33] supporting this amendment? [2:48:34] >> I brought this amendment at [2:48:36] the request of council member [2:48:37] hustace. [2:48:44] >>just so we have the same [2:48:44] understanding. Everyone [2:48:45] understand what we are voting [2:48:48] on? All right. [Roll call] [2:48:48] >> council member michelle m. [2:48:49] Galimba: no. [2:48:50] >> council member james hustace: [2:48:50] aye. [2:48:51] >> council member jenn kagiwada: [2:48:52] no. [2:48:53] >> council member matt [2:48:55] kanealii-kleinfelder: no. [2:48:55] >> council member ashley [2:48:56] kierkiewicz: no. [2:48:57] >>council member heather l. [2:48:59] Kimball: no. [2:49:00] >>vice-chair dennis "fresh" [2:49:03] onishi: no. [2:49:03] >> council member rebecca [2:49:06] villegas: no. [2:49:10] >>chair holeka goro inaba: aye. [2:49:11] Chair, you have two votes in [2:49:12] favor, yourself and council [2:49:16] member hustace, 7 opposed. The [2:49:17] motion fails. [2:49:18] >>chair holeka goro inaba: all [2:49:20] right. Back to the main motion. [2:49:24] Any further discussion? Council [2:49:36] member kanealii-kleinfelder? I [2:49:38] will try not to combine but I [2:49:41] cannot help it. We discussed [2:49:42] bill 147 yesterday which creates [2:49:44] more bed-and-breakfast and the [2:49:46] ability to have more, how does [2:49:47] that play with this? [2:49:55] >> to be determined? I'm [2:49:55] concerned [2:49:59] concerned. Honestly, ill 173 [2:50:06] and bill 175. All at different [2:50:13] stages at council, first [2:50:14] reading, second reading, [2:50:15] committees. They all touch. I'm [2:50:16] concerned about this as a whole. [2:50:18] Without being able to view these [2:50:19] at the same time, it's a little [2:50:22] bit worrisome. Do you share [2:50:23] those concerns at all? [2:50:27] >> I feel sorry for the planning [2:50:29] department, but I don't share [2:50:32] director darrow's concerns [2:50:34] because I'm more worried about [2:50:36] our department right now. It is [2:50:36] concerning [2:50:39] >> from our standpoint, because [2:50:40] there is so much confusion with [2:50:42] the public on what's going on. [2:50:44] The hosted rental registration [2:50:45] started yesterday. We have [2:50:48] already seen an application come [2:50:50] through that is in the homeowner [2:50:52] tax class. They will get [2:50:54] adjusted this year. We are [2:50:56] trying to figure out how this [2:50:58] pans out because we hate to do [2:50:59] something that you will come [2:51:06] back to say, don't worry, this [2:51:07] is approved and we have to undo [2:51:09] what we did. There is [2:51:12] uncertainty right now with the [2:51:14] department and the planning [2:51:16] department until this is figured [2:51:18] out and handled. [2:51:21] >>do you have this secret paper [2:51:24] on these random bills how they [2:51:27] are going to work with each [2:51:34] other, this big whiteboard like [2:51:35] josh green? [2:51:36] >> no, we are always amazed what [2:51:38] comes out of council sometimes [2:51:40] because it is a new idea and the [2:51:43] timing is incredible. We are [2:51:45] trying to keep things straight. [2:51:46] We have been doing a lot of [2:51:48] presentations to realtors on [2:51:50] this because they are equally [2:51:52] confused because there have been [2:51:54] so many changes in the last two [2:51:55] years. That's all I'm saying and [2:51:58] trying our best to keep [2:51:59] everything straight. But I don't [2:52:01] know what you will propose in [2:52:04] the next two weeks. [2:52:09] >>but I'm reminding of last week [2:52:12] ed of last wek, [2:52:15] one of the writers, she handed [2:52:17] to me that things need to be [2:52:19] simple. It's almost codified [2:52:21] when we write legislation that [2:52:23] it needs to be simple, [2:52:24] understandable and clear. If [2:52:27] it's not, then we confuse, [2:52:29] public, ourselves, and you folks [2:52:31] and it gets confusing. Hat's [2:52:34] what I'm worried about ight now [2:52:37] in aving these bills at [2:52:39] different stages that touch each [2:52:42] other and concern the staff, [2:52:45] public and not clear and not [2:52:51] concise. I'm not trying to poke [2:52:52] at you, council member kimball. [2:52:52] I'm just trying to wrap my head [2:52:55] around is saying why [2:52:56] yes to this, no [2:52:59] to this, why to this will affect [2:53:03] that bill 147 without discussing [2:53:05] this. That's how I'm seeing it [2:53:14] right now. Thank you. [2:53:15] >>council member heather l. [2:53:17] Kimball: thank you. I know [2:53:17] council member won't have the [2:53:20] benefit of this history. But 121 [2:53:22] was the bill that included all [2:53:24] the pieces and one piece of [2:53:26] legislation that we now have [2:53:30] addressed separately. So, 121 [2:53:32] have the registration process, [2:53:35] the land use change, the amnesty [2:53:36] period of time and even the [2:53:39] visitor designation areas all in [2:53:41] one bill. And that became [2:53:42] exceedingly complicated, right? [2:53:45] That's why we stopped it. And [2:53:48] so, what has happened since is [2:53:51] that I have pulled apart those [2:53:53] different pieces into their [2:53:55] distinct functions. So pulled [2:53:56] out the realming administration [2:54:02] piece that is independent of [2:54:04] 147, 175, 173. Then we have the [2:54:05] let us piece [2:54:08] land use piece that is 147, [2:54:10] independent from all the others. [2:54:13] Any of these bills can be passed [2:54:31] or not and not have any impact [2:54:31] on any piece around the [2:54:32] short-term vacation rentals. I [2:54:33] will acknowledge that it is [2:54:33] complicated but it is [2:54:34] necessarily so because there are [2:54:35] so many pieces interacting. We [2:54:36] have the registration, the tax [2:54:38] fees. Appreciating that it is [2:54:39] complex, but it is actually, [2:54:41] this is where I moved into [2:54:44] separate bills in response to [2:54:48] this confusion that it was over [2:54:52] 121 which was an omnibus [2:54:54] approach. [2:54:56] >>chair holeka goro inaba: any [2:54:57] further discussion? Okay, I [2:54:59] will share my thoughts. I'm not [2:55:01] a fan of creating another tax [2:55:03] class right now especially [2:55:05] hearing some of the brief [2:55:07] discussion about where the rate [2:55:11] would land because I heard above [2:55:14] ag and in my mind, the benefit [2:55:15] here is for a homeowner who is [2:55:18] doing it on their property. I [2:55:20] would think that we would be [2:55:21] very close to the homeowner tax [2:55:23] class because they live there. [2:55:30] It's their primary residence. [2:55:33] So not too far off 575 which is [2:55:34] what we currently have and [2:55:37] hearing this and won't be a [2:55:40] discussion until next JUNE but [2:55:42] this warrants a discussion [2:55:44] perhaps via another bill on [2:55:46] whether we want to allow [2:55:47] bed-and-breakfast in the [2:55:49] homeowner tax class or not.
