[0:00] Good to go. [0:10] Okay. Good evening. I'd like to welcome everybody to the February 18th Planning [0:14] Commission meeting. Uh we'll have a call to order [0:22] and move right in. Um we're going to have our pledge of [0:27] allegiance by Rebecca Howell. if you would come forward and we all [0:33] stand up and give honor to the flag. [0:40] I pledge allegiance to the flag of the United States of America and to the [0:46] republic for which it stands, one nation under God, indivisible, with liberty and [0:53] justice for all. >> Thank you very much, Rebecca. [1:07] We have a full panel. We'll move on. Are there any conflicts of interest? [1:12] » No. >> No. [1:14] » Okay. Uh, we need a motion, a second, and an [1:18] approval for the minutes of the January 21st uh, commission meeting. [1:23] » I'll make a motion to approve item 3.4. I'll [1:27] » second. Heather makes the motion. And I'm sorry [1:30] I didn't catch who did Forest did the second. [1:35] » All in favor? >> I [1:39] » Okay, let's uh move down to the administrative items. Item 4.1, review [1:43] and consideration uh review and consider approval of [1:47] residential plat amendments within Hidden Oak subdivision. And Mike, you [1:52] have this one. >> Yes. And uh with the chair's permission, [1:55] I'm going to remain seated. due to a recent knee surgery. [laughter] [2:00] » Yeah. >> Uh and so Mitch, if you'll advance these [2:04] uh PowerPoint images, [2:08] [clears throat] so this is a uh on for a public hearing. [2:13] Um although this is an unusual um formality, an unusual situation, and [2:19] I'll kind of go through uh uh what is happening here. This is what we call [2:24] Hidden Oaks pods 17 and 18. That's I always think it's interesting to realize [2:29] that a pod is just an acronism for phase of development. This is a development [2:33] that we are well familiar with as a city. Um was approved by the city [2:38] council uh in early 2018 >> and uh Ivory and Perry Holmes are both [2:45] uh development partners within this project. [2:48] » Um next slide. [2:54] This is just the vicinity map within the city u where this project is located. It [3:00] is a larger master development agreement um within the city. Next slide. [3:13] And just looking a little bit closer. This was the map that was shown on the [3:17] um public hearing notice outlining both these two pods. Pod 171 18. You can see [3:22] it crosses Haramman Main Street, part of it. Uh, pod 17 is on the north side. Pod [3:28] 18 is on the south side. Next slide. [3:34] So, here here's the background on this project. Um, the planning commission had [3:38] approved preliminary plat uh for these pods back in June 2022. That approval [3:44] letter was attached in your packet for reference. Uh the master developer, [3:50] which is Ivory Homes, after they acquired um the the rest of the property [3:55] in this in this project, appeared before the city council and petition the [3:59] council for an amendment to the Hidden Oaks master development agreement. Uh [4:04] and Brad Mackey from Ivory can um discuss that in more detail if if the [4:09] commission has any questions or anything maybe that the members of the audience [4:14] might want additional information on. So that amendment was approved. [4:20] Ivory Holmes then uh made adjustments to those preliminary plans that were [4:26] previously approved by the planning commission. Met with our engineering [4:30] department. Engineering approved those plans and then they proceeded to [4:36] construct those plans. Again, all with city engineering approval uh complying [4:42] with the terms of the MDA and our city standards. [4:46] Um, and I just put down Brad as an estimate. Essentially, Ivory is now [4:52] completed with those construction plans. And in order to start selling uh lots [4:59] within these phases, they now need to record the final plat. Unfortunately, [5:06] with all of these changes and the timeline of doing development, that [5:11] planning planning commission preliminary approval had expired and there wasn't a [5:17] an extension requested. Uh, which really is a formality and we I don't think I [5:24] ever recall the city ever denying a request for an extension. Um, but that [5:29] just didn't occur. Now, in discussing what to do about this situation, [5:35] subdivisions built built with city review and approval, but [5:40] the planning commission approval had expired. Commission is is obligated by [5:46] city code to sign the plat. And so, it was my recommendation that we simply [5:52] have the applicant reappear before the planning commission and and renew [5:58] essentially your prior approval. Now, there have been a few minor changes to [6:02] the pods again based on what was approved by the city council in the MDA. [6:08] Um, so as we do require a public hearing for preliminary plats in the city, uh, [6:15] we did send out that notice. I did receive one public comment um, over the [6:21] phone and it is from, uh, Mr. and Mrs. Doxy who own property adjacent to this [6:26] prop um, to this development. And I'll show you in this um the next slide, [6:31] Mitch. Um they are had negotiated an agreement [6:37] with Ivory to secure a private easement through lot 1719 here in phase se um pod [6:45] 17 phase one for a sewer um line easement. Uh I was told that it's along [6:52] the east property line of 1719. And I apologize, this is the exhibit that went [6:57] out in your packet, but the city does currently have in its in its um we have [7:04] right now here in city hall the final plat with the easement. It's a 10 foot [7:09] wide easement um in favor of the doxies uh that runs north and south. Um I'm [7:16] I've been told by Ivory that the uh sewer line stub has been brought to the [7:21] property line. There's no um pipe or anything in that in that uh easement [7:27] currently. That'll be the responsibility of the private party to construct that. [7:31] But they have facilitated that that could be an outfall for sewer uh if and [7:37] when the doxies ever choose to pursue additional development where they would [7:40] need a a sewer outfall. Um so that was the one comment that I had received. Uh [7:46] I had contacted Ivory and just verified that that was still [7:51] their intent and again we verified that that is on the final myar that the city [7:57] is holding uh pending the planning commission review. The next slide is [8:02] just pod 18. Again this is u was placed in your packet. U and then the next [8:09] slide is our recommendations. These recommendations are the same that [8:14] were published in the report except for number three. This is kind of belt and [8:18] suspenders. Again, this has been verified by the applicant. Um, and we we [8:23] verified again on the on the myar, but uh just just to put it on the record [8:28] that as a condition of approval that the final plat um includes a 10- foot wide [8:33] private easement along the east property line of lot 1719 in pod 17 phase one for [8:39] that future sewer connection. [8:43] Thank you, Michael. Um, is the applicant here? And could you [8:48] come forward, please? Just state your name and who you're representing. [8:54] Brad Mackey with Ivory Development. Glad to be here kind of. Um, it's this is a [8:59] weird one because we went through so many hearings and meetings and [9:04] everything along the way and I guess um this was just missed along the way. So, [9:10] um, unfortunate, but it's built and and it's good. And Adam was asking me [9:16] earlier if we were doing any halfacre lots, and I forgot both of these phases [9:22] have halfacre lots. So, um, pod 18 is all halfacre lots. It's probably the [9:30] coolest piece of property, um, that we have in the south south end of the [9:38] valley. I think it's pretty cool. If you drive up there, the views are [9:42] unbelievable. Um, and then Pod 17 also um has some halfacre lots as well. And [9:49] and the views down that little valley are unbelievable. So, it's a great it's [9:55] a great project. Beautiful piece of land, and we're excited to start [9:59] selling. So, if there's any questions you have of me, I'm glad to answer them. [10:07] » I don't have any. Thank you very much. [10:10] » Thank you. Thanks, Brad. >> Okay, this is a public hearing open for [10:13] public hearing. Um, I'll read a statement uh describing the [10:18] public hearings. The purpose of the public comment policy is to allow [10:23] citizens to address items on the agenda. Citizens requesting to address the [10:28] commission will be asked to complete a written comment form and present it to [10:32] the uh deputy city recorder. In general, the chair will allow an individual three [10:38] minutes to address the commission. A spokesperson recognized as representing [10:42] a group in attendance may be allowed up to five minutes. This policy applies to [10:49] all public hearings. So, public hearing is now open. [10:58] Are there any online? [11:03] Okay. Okay. Well, seeing none, hearing none. Um, [11:08] » I'll make a motion to close the public hearing. [11:10] » Second. >> Okay. Motion by Adam, second by Preston. [11:14] All in favor? >> I. [11:18] » Public hearing is closed. >> All right. Let's open it up for [11:22] discussion between the commission members. So, [11:26] or for a motion. >> And there's nothing different than what [11:31] we already approved earlier. I I I think this is a easy one, but [11:38] » just for clarification, there are a few changes. You may recall that there was [11:43] originally in the MDA a plan to do some um some senior style homes that would be [11:52] um I think it was single level on without basement, right? [12:00] And anyway, but again, this was at a a >> they were pad lots. [12:04] » Yeah. >> And now they're just large lots and we [12:08] we are actually down seven units, I think. [12:14] » Okay. >> I remember them changing. [12:15] » Yep. Me, too. [12:20] » All right. Uh >> I'm ready to make a motion. [12:22] » Let's get a motion going. >> I move to approve item 4.1 with staff's [12:27] three recommendations. I'll second [12:30] » motion by Adam, second by Brody. >> Uh, Brody, [12:34] » yes. >> Jackson, [12:37] » yes. >> Heather, [12:38] » yes. >> Adam, [12:40] » yes. >> Preston, [12:42] » yes. >> Forest, [12:43] » yes. >> Seeing everyone voted in the [12:46] affirmative, the motion passes. [12:54] The next item chair and commission comments. [13:01] » I don't have any. >> Uh thank you for following procedure. [13:10] » Hearing no comments. Future meetings. The next meeting is scheduled next city [13:14] council meeting scheduled for February 25th, 2026. The next planning commission [13:20] meeting March 4, 2026. Um, [13:26] move to dismiss. >> Motion to dismiss or to end the meeting. [13:31] [laughter] >> Second. [13:34] » I don't think it's dismiss. What is it? >> To adjourn. [13:37] » Motion to adjurnn. That's what it is. >> Flip the page to read it. [13:41] » Motion to adjurnn. Made by Preston. Second by [13:44] » me. Adam. >> Adam. [13:46] » All in favor? >> All in favor? [13:48] » I. >> We're dismissed. Good job.
