[2:39] Good morning. [2:42] Welcome to the Planning Board meeting on Thursday, August 13th, 2026 [2:47] at 9:30. Please silence your cell phones. [2:53] Uh, Mr. Hart, will you have roll call, please? [2:57] » Member Mendelson. >> Here. [2:59] » Member Powell. >> Uh, present. [3:01] » Member Axelrod. >> Here. [3:04] » Uh, Vice Chair Davis. [3:06] » Here. >> Chairperson Rosen. [3:09] » Here. >> Thank you. [3:10] » Thank you. With that, let's all rise for the Pledge of Allegiance. [3:18] I pledge allegiance to the flag of the United States of America and to the [3:23] republic for which it stands, one nation under God, indivisible, with liberty and [3:30] justice for all. [3:35] May I have a call for a motion to accept the agenda as it has been presented? [3:40] » I so call. >> Second. [3:43] » All in favor? I. Any opposed? [3:47] Okay. We're up to swearing in of the public. For those who are giving [3:51] testimony, please stand and raise your right hand to be sworn in and by and [3:57] provide testimony for the application you are affiliated with. Mr. Hart, [4:02] please swear in those giving testimony. >> By the authority vested in me as a [4:06] notary of the state of Florida, do you swear or affirm that the testimony that [4:10] you're about to give is the truth, the whole truth, and nothing but the truth? [4:14] Thank you. >> Thank you. [4:17] Are there any corrections to the minutes from our last meeting of July 9th? [4:23] Hearing none, may I have a motion to approve those minutes as presented? [4:27] » I move that we approve the minutes as presented. [4:30] » Is there a second? >> Second. [4:33] » All in favor? I. There being no unfinished business, we [4:38] will move on to new business. And we are up to development order [4:45] application number PZ-26-7-SPEX, [4:53] Perry Reader. This is an application by Aqua Mandar [4:58] for boat lifts and docks of South Florida for a special exception in order [5:04] to install a 13,000-lb capacity boat lift for the property located at 2916 [5:11] South Ocean Boulevard Townhouse 1. Does any board member have any ex parte [5:18] communications to disclose? >> No. [5:23] » Hearing none at this time, I open the public hearing. Town Planner Allen, [5:28] please present the application. >> Good morning, Ingrid Allen, Town [5:33] Planner. Um, we'll go ahead and start with the [5:35] aerials of the subject property. These start on page 12 of your packets. [5:40] Uh, so as you can see, this is part of the Trafalgar Condominium. And then on [5:44] the west side, there's these uh, three townhouses. This is the subject property [5:49] here. You could see the existing dock dock as well. [5:52] And here's a better look at the dock looking eastward. Again, this is the uh [5:57] property. I put the address on the roof. And this is the area where the proposed [6:01] lift is going to be located. Um so, as indicated, this is a special [6:06] exception. This is going to be a four-piling [6:09] uh 13,000-lb capacity lift. Um there's an existing wood dock, as you can see [6:13] from the aerial. Um the applicant has received both FDEP and Army Corps [6:18] authorizations. Those file numbers are in your staff report, and the [6:22] authorizations are in your backup as well. Uh we'll go ahead and take a look [6:25] at the plans. These are the 11 by 13 sheets that are in your packets. Uh this [6:31] is the survey of the property. Again, this is the subject property here. [6:37] Um here you have the existing conditions. Uh you could see there's an [6:41] existing lift there. Um and here you have the proposed site plan. Again, here [6:48] you have the 13,000-lb capacity lift. Um as you can see uh from the aerials and [6:54] on on the site plan, uh there's the Intracoastal Waterway. Uh so, and I [7:00] indicate this in the staff report, uh this lift is exempt from the waterward [7:04] extension regulations that we have in the code, which is that you can't extend [7:07] more than 25 ft or 25% the width of the waterway, whichever's less. Obviously, [7:12] this doesn't apply here. Um uh any uh lift for accessory marine facilities [7:17] that are on the Intracoastal Waterway are exempt. Um and then we'll go to the [7:21] detail sheet for the actual boat lift. Um I indicate also in the staff report, [7:26] uh we have a regulation in the code about a maximum height for lifting [7:30] devices. Um that max is base flood elevation plus 8 ft. Um the base flood [7:35] elevation for this property is 7 ft, and the top of the lift measures 9.5 ft, so [7:41] they are um in compliance uh with the code. [7:46] Um the planning board has the ability to approve, approve the conditions, or deny [7:51] the request. This again for a special exception. Our [7:55] staff reviewed the applicant's proposed request to include the plan set which [7:59] was date stamped received by the building department on July 16th. [8:02] Um and the application is consistent with the special exception provisions of [8:06] the town code where applicable and consistent with the town's comprehensive [8:10] planning code of ordinances. I'll be glad to address any questions. We also [8:14] have the authorized agent here from the uh applicant so they'll be happy to [8:19] address questions as well. [8:23] » Do any board members have any questions or the staff? [8:29] Go ahead, Eileen. >> You said there was an existing boat [8:31] lift. Is it for that unit or one of the other ones? [8:34] » Um for another unit. >> Uh in that those three? Yeah. Is it next [8:38] to it or the one other the one at the the other end? I couldn't see. [8:41] » To the I'll show you on the aerial. It's not a problem. [8:44] » Oh, I see. That would be difficult. >> If you go to your EC sheet, the 11 by [8:49] 17, you'll see an existing boat lift there. [8:52] » Yeah. >> Uh it's probably for the condominium in [8:55] the middle, unit um number two. If you look at that EC sheet, it shows that [8:59] it's unit number two. Which is uh 2914 [9:05] is the number of that uh the address of that property. [9:08] » Okay. Just And just curiously, how big is that one? [9:11] » Um when you look at the survey, um let's see. It does give [9:17] It looks like it goes out it measures from the property line 20 ft .5 [9:23] 20.5 ft inches from the property line. Um [9:28] I I I don't know that actual it's like a 13,000 lb. I don't know what [9:32] » Right. How much is that? Okay. >> We don't know. [9:34] » Got it. >> on the survey, yeah. [9:35] » Okay. Thank you. Are there any other questions for Ms. [9:40] Allen? [9:42] Okay. Applicant, [9:45] if you want to make your presentation, you may now come forward to do so. [9:50] Please provide your name, business, uh and affiliation with the application. [9:58] Okay. Do board members have any questions for [10:04] the applicant? Okay. Are there any public comments? [10:09] There not being anybody from the public present. [10:12] I think the ghost of public. Okay, we can move on. [10:17] All right. Are there any other questions from the [10:22] from the board for the staff or the applicants? [10:28] With that said, the public hearing is now closed. [10:32] Is there a motion to approve, a motion to approve with conditions, or a motion [10:37] to deny the request? >> I move we approve the request. [10:41] » Is there a second? >> Second. [10:43] » Okay. All those in favor? >> I think Mr. Hart. [10:49] Vice Chair David. >> Yes. [10:50] » Member Mendelson. >> Yes. [10:52] » Member Powell. >> Yes. [10:54] » Member Axelrad. >> Yes. [10:55] » Chairperson Rosen. >> Yes. [10:58] » Motion carries. Thank you. >> Motion is passed. [snorts] [11:01] » The >> That being all that's on the agenda for [11:04] now, we're on to announcements. The next meeting will be September 10th at 9:30. [11:09] » It's my last meeting. >> Um and this meeting is now adjourned at [11:13] 9:38. Thank you.
