[1:56] I spent the last two decades leading teams in difficult environments. [2:00] I did 2 deployments to Iraq, was an infantry officer, got my Ranger tab a bronze *. [2:05] And came home to continue my public service. [2:07] My first job after law school was clerking for a federal judge. I went from there to the United States Department of Justice. [2:12] Before coming here. [2:13] And serving as a deputy District Attorney in Salt Lake County. [2:16] I tried felonies. I built the offices for cybercrime prosecution unit. [2:20] And today I lead cybersecurity. [2:22] And I'm corporate counsel for Woodbury Corporation. [2:25] I serve on 2 Utah Supreme Court advisory committees, including the rules for. [2:29] Professional conduct. [2:30] And I show that not as a resume, but to make a point. [2:40] Over the last few weeks I've been visiting city councils across the across the county. [2:44] West Jordan, Taylorsville, Sandy tonight. [2:46] Holiday. [2:48] Because the DA is a county wide race. [2:50] And its work touches every one of those rooms. [2:53] And that's why I'm here tonight, and that's what I want to keep doing regardless of whether or not I win in November. [2:58] And here's my commitment to holiday. [3:00] The DA's office, as I said, is a county wide race. [3:03] But its work lives in your city. [3:05] When officers refer a case. [3:08] The outcome lands here. [3:09] And holiday. [3:11] When a domestic violence victim calls 911. [3:13] What happens next is partly on the district attorney's office. [3:16] Holiday should not have to wait until a press conference to know what the DA's office is doing about break INS or car prowls in [3:19] your neighborhoods. [3:23] Fentanyl, meth and stolen cars moving up and down the Wasatch corridor. [3:26] And the repeat offenders who drive most of it. [3:28] So I'd like to open a Direct Line. [7:28] Formerly in the history when it was the county land it was zoned. [7:31] R2. [7:32] I'm trying to get it to RM zone. [7:36] With the room zone. [7:37] This allows for. [7:40] Similar heights to R1 and R2. [7:42] And so there would be no height variance. [7:44] From what the current zone is. [7:46] That allows for a little greater density. [7:50] I am AM. [7:52] Interested in doing? [7:54] A little. [7:55] More high end project here. [7:57] And a little history on me. I'm not from Holiday City. [8:00] But about 22 years ago, I drove through here and saw the trees and. [8:03] Found the city and fell in love with it. [8:06] I have now lived here for 20 years. I built a small house on Cottonwood Lane amongst all the big houses. [8:11] And I own a brokerage and I've done developments in holiday. [8:15] I went through this process similarly with the. [8:18] Office building that I own on 53rd South and Highland Dr. which required a rezone to neighborhood commercial. John Tierlink was [8:22] very helpful in that process and so are many of you to get that done. [8:27] As with that, there was some public pushback, but. [8:31] I'm proud of what I built there. [8:33] And we have a building there that's filled with holiday business owners and holiday residences. [8:38] And I think it was something that added the community and that's what we're trying to do here. [8:41] So basically we would effectively. [8:43] Tear down the. [8:44] For homes that are there. [8:46] We're looking to change this to an RM zone which would allow up to 20 units. [8:50] I think that there's an opportunity here. [8:52] For higher quality townhome project in holiday. [8:56] If you see a lot of the townhome projects. [8:58] They are. [8:59] Three story. [9:00] They're much higher density. [9:02] Typical density is 22 to 25 units per acre. This was his much lower density. 18 units for an acre and a quarter is what I'd be. [9:09] Looking to do here. [9:10] You see a lot of these townhomes that are. [9:13] Two car garage on the main. [9:14] You go up to a kitchen and some living area and you go up to a third level for your living space and so. [9:19] With this, you could technically under the ARM zone, put 20 units. Here I'm looking to do 18 units because I believe that you can [9:22] have. [9:25] Some main level living. [9:27] On these units. [9:28] And you can then have. [9:30] Some private yards, which most of the three story townhome units do not have. They don't have private yards. [9:36] So I'm interested with a little less density, a little better project. [9:39] And something that would be a little bit more. [9:41] Conducive to holiday? [9:43] And so we would do a more traditional design on what's there. [9:47] And something that fits in with the holiday village feel. [9:51] A unique opportunity here. [9:53] And then part of the reason this came about was that. [9:57] After meeting with Jared Bunch, trying to determine where the best Access Rd. would be on this for this project. [10:03] He mentioned that the only reason that small one lane Rd. of Highland Drive. [10:07] Is there is because it provides access to those three homes that front on Highland Drive. [10:12] And the project that I'm proposing would. [10:15] Relocate. [10:16] The access to 6060 S. [10:18] The S Boundary St. [10:20] And then we would vacate the access on a Highland Dr. which then provides an opportunity. [10:26] For restructuring that intersection. [10:28] And I've spoken with many of you. I think there's. [10:32] Public and. [10:33] Private sentiment for people to do something better there with the with the traffic. [10:38] And if we can. [10:38] Eliminate that. [10:40] Not my job, your job. That one lane. [10:42] Luzerne of Rd. there. [10:44] And then? [10:45] Redo something with the park. [10:47] That small island and make it more of a park, like some of the drawings that I've put in there. [10:51] Then I I I think it can create a more dramatic entrance to the city. You can put up some better signage. [10:58] One of the original founders. [11:00] Of Holiday City of course was John Holiday, but one of the other guys name was Robert Covington. [11:06] And so. [11:07] These townhomes we would name Covington Park Townhomes. [11:11] In kind of an homage to one of the original founders of Holiday City, and also to put a little pressure on you as the city to make [11:16] it next to a park if it's going to be called Covington Park Townhomes. [11:21] And I just think it can. We can do something really spectacular there. [11:25] Also by doing that. [11:27] There are massive trees there. [11:29] And they're beautiful. [11:30] And they're very. [11:31] Uncapped. [11:32] And and I got a call from Rob Jones, who is in the furthest NN house that. [11:38] This last windstorm, one of the branches fell on the sidewalk. There are a ton of deadfall branches and issues with those trees. [11:44] I immediately went over with the chainsaw, cleaned it up, and trimmed up some of the other trees. [11:48] But if we put a park there. [11:50] I can maintain those large trees as a presence to Holiday city with the large trees and and make a more beautiful entrance. [11:57] And I've also I've spoken with. [11:59] Several of the arborists who. [12:01] Associated with this project and I think we can save and maintain. [12:06] Almost all the trees on the perimeter. [12:08] Clean them up, get rid of a bunch of the deadfall and make it a better project. [12:12] Affordability. [12:14] These will these will land in 8 to 900. [12:16] $1000 range. [12:17] Which? [12:18] For people outside of holiday, that does not seem affordable, but in holiday that's very affordable. [12:22] And I think it's a project that will. [12:26] There are ways you can do mass production projects. [12:29] And. [12:31] Make them cheaper. [12:33] And you, I see a lot of that around. [12:35] In a holiday. [12:36] As well. [12:37] But I'm less concerned with making. [12:41] A larger profit than I am concerned with doing something. [12:44] That is conducive to the holiday village feel and making it a project there. That's right. And there's a picture of kind of what [12:47] the. [12:50] The park may look like in that intersection. [12:53] There's already a lane there and there's a turn lane, so nobody would have to merge going around that. They would just be, they [12:58] would have their own lanes. You could put a yield or a stop sign there and really slow down traffic. [13:03] I think. [13:04] For the subdivision to the north of this. [13:07] They have major ingress and egress problems. You've probably heard of that. [13:10] Continually. [13:12] This has an opportunity. [13:13] Write an opportunity to solve that problem. [13:16] Because we can eliminate one of the lanes, we can get them out further and they're. [13:19] They would cross two lanes to go South instead of three. [13:22] And it would slow down the traffic dramatically and so. [13:25] I'm a huge advocate, obviously selfishly because. [13:29] It would put a park in front of the project instead of a. [13:32] Highland Dr. Lane that people go down 50 miles an hour. [13:35] But also because it's better for the neighbors and I'm. [13:38] I live. [13:40] Here, my kids go to school here. I have an office building here. [13:43] I'm interested in doing something. [13:45] That is, that makes holiday and the and the surrounding neighborhood better. [13:49] And so. [13:51] To the east of this project. [13:52] Are two townhomes. [13:56] Bill is the most adjacent. [13:58] To it. [13:59] And he and I have talked and this is going to add value to his property as well because we'll clean up on the trees on the east [14:03] boundary of. [14:07] My property which? [14:08] Border his property. [14:10] And then I'm going to. [14:11] On my dollar, pay for a nice new fence that will clean up the property and make it better. [14:15] He has issues also with those trees, with every time there's a windstorm. [14:19] Trees branches falling down on issues. [14:22] So. [14:23] I'm excited about it. We've already closed on the front three properties. [14:26] So the opportunity is there to vacate. The Highland Drive will close on the other one soon and. [14:40] I know we're going to get into this more later that. [14:42] There are. [14:43] A lot of neighbors that have concerns about the effect. [14:47] This property will have on traffic. [14:50] But it sounds like what you're saying is that. [14:52] With this. [14:53] Idea of this park that you're willing to work with the Planning Commission? [14:56] To address those issues. Is that, is that right? Yeah, absolutely. OK. [15:02] It's always a concern with traffic, right? Highland drives a massive Rd. [15:05] This will slow down traffic if you do this. [15:07] That's being proposed. [15:09] If he did not, it's still. [15:11] The amount of traffic that this 18 unit. [15:14] Townhome project will drop onto Highland Drive is minuscule compared to what the traffic guard is on there. [15:18] There's plenty of bandwidth to. [15:20] To handle that. [15:20] Right and. [15:21] And the thing you have about this, that's different. [15:24] You know residential development than a commercial development is there. People are not coming and going all the time. [15:29] You'll have once or twice a day someone's coming and going back and forth to work or something. It's just not going to. [15:35] Oh, it's a huge traffic issue there. [15:38] Thank you. [16:09] Enables in terms. [16:11] Of development of the project. [16:13] I just wanted to touch on a couple of the. [16:16] Technical factors, you know. [16:18] Casey mentioned that this would allow up to 20 units depending on site constraints. Good design that he was. [16:26] Talking about that. [16:28] It may not be up to that. [16:30] Maximum amount, but that is what the zone would allow. [16:33] In regards to height between the R2 zone and the RM zone, they do have the same height allowances at 35 feet, so there's not a [16:38] difference in the height between those two. [16:44] Zones. [16:46] Staff recommendation on this is is an approval there was some discussion and Planning Commission about. [16:53] Keeping the. [16:54] Rear parcel that's on the east. [16:57] As an R2 zone and then doing RM on the front. [17:01] Configuring in that way, there's a difference of three fewer units that would be allowed. [17:07] Regulatory wise it's when you have split zoning between a project it it can lead to some complications. [17:14] Where it's because of the. [17:17] Small difference between the number of units that it produces. Staff recommendations for the room zone for the. [17:23] For the full project, all four parcels. [17:27] As Casey mentioned, the. [17:30] Having those 3 parcels. [17:33] Involved in this rezone and the. [17:36] Intended design for the project. [17:39] Enables. [17:40] Access for those to be removed from that bypass lane and accessed off of 6060 S. [17:47] I talking with the city engineer, there would be some potential required improvements. [17:53] On potentially 6060 S and. [17:57] To manage that the change in. [18:00] The Highland Dr. Bypass. [18:03] There is a single lane on that T section. [18:07] Likely that would increase to two lane so that there's a right. [18:10] And the left hand turn lane. [18:12] And then the two lanes on Highland Dr. would start much sooner. [18:17] Because it's. [18:18] Shifting that bypass lane now over to Highland Drive. [18:22] There's capacity on the shoulder there that that. [18:26] Is already paved, so there should be some minimal. [18:29] Paving involved with that, but. [18:31] Some of that will. [18:33] Beyond the responsibility of the developer who is. [18:37] Kind of involved in that. [18:39] In that change. [18:41] The city engineers also suggested potential traffic study. [18:47] Impact involved with that intersection, specifically of how to engineer that to work. [18:52] Correctly. [18:55] The Planning Commission. [18:57] Had a positive record or. [18:59] Positive recommendation. They had two votes. [19:01] And or. Sorry, 5 votes in favor and two votes against. [19:07] They have. [19:08] Their recommendations listed in. [19:10] The staff report that was provided to you. [19:12] And. [19:13] The main. [19:15] Point on this recommendation for a rezone is to provide a transition. [19:21] Type of zone in between. [19:23] The more intense. [19:25] Holiday Crossroads zone that is directly adjacent to this property on the South side. [19:30] And the less intense. [19:32] R2 zoning that's on the north side. [19:34] So RM is kind of the fill in between those two that's an intermediary. [19:39] Buffers between less intense residential uses and more intense commercial uses. [19:47] Safety issues with traffic is obviously a big concern with the residents. [19:52] And I think Casey addressed that a lot with how the traffic can be reconfigured there to. [19:59] Address some of those concerns. [20:00] Residents that are coming out of Diamond Hills. [20:05] Add the. [20:06] Kind of battle that they have to face going through a bypass lane and then getting onto Highland Drive. So they have kind of two. [20:11] Points where where there's traffic conflict. [20:15] So changing the intersection up where it's now all at the T. [20:20] Makes a much more consistent traffic where they can enter traffic more safely. [20:25] And greater. [20:27] Pedestrian and biking safety as well. [20:30] Being separated from Highland Drive. [20:32] There's improvements for cycling and. [20:36] And walking. [20:38] In our Highland Dr. improvements. [20:39] So this would tie into into those improvements. [20:43] If there's any other questions that we can go through those, I'm happy to. [20:50] How address any does they know that there's? [20:52] Probably some. [20:53] Questions from the public that we can definitely. [20:57] Discuss. [20:58] So, so this is in my district and so I have spent a lot of time looking over all of the letters that residents have sent in and [21:03] make sure that I understand. [21:07] Their concerns and want to make sure that we we address the concerns that they have. [21:12] Here. [21:14] A lot of people are concerned. [21:16] In general, independent of this project about the traffic on Highland Drive and pulling out of that Diamond Hills. [21:22] Development. But it sounds like what you're saying and just confirm is that if we get rid of that deluge, run for lack of a better [21:26] term. [21:29] And people have to stop on that tea or slow down if they're coming from the north, but ultimately that. [21:35] Have a calming effect. [21:37] On on traffic. Is that what you're saying? It's call me because you have a more predictable. [21:44] Place for cars to be on that luge run. There can be issues with visibility. You don't know how fast cars are coming through that. [21:52] And and also the double point of of conflict where you're having to enter traffic. [21:57] At that bypass point and then again when you're entering Highland Drive. [22:02] So that reduces those points of conflict to a single one. [22:06] Traffic is more predictable. Cars are already in two lanes. [22:09] Traveling and that's. [22:11] What you then have to navigate through. [22:13] It's reducing conflict points is is a big part of. [22:17] Increasing Traffic Safety so. [22:20] Having fewer intersections where where vehicles have to. [22:23] Navigate. [22:25] Entering traffic is an improvement. [22:27] OK, umm, another concern. [22:30] Umm, that, that we're seeing in a lot of the public comments just deals with the overall capacity. [22:37] To to service the traffic on Highland Dr. Obviously this is a small development that they're concerned deals with. [22:46] That there's the new apartment building to the South and then there's also the holiday hills to the north and the just concern [22:50] about that. Can you can you speak to? [22:54] Highland drives capacity. [22:56] Sure to deal with all of all of this increased traffic with these different. [22:59] Projects. Yeah, I, I. [23:01] I know that as a city, we're all very aware of the traffic that's there. We've managed that intersection and some of the the [23:05] traffic. [23:09] That we have to deal with getting to some of those commercial businesses or. [23:13] Going out. [23:15] Van Wigle. [23:16] Getting in between it's a major Rd. [23:19] In the city. [23:21] That road was built with capacity to manage a lot of come and go. [23:28] Consistent traffic throughout. [23:30] Every day for. [23:32] For the regional. [23:34] Development of the Cottonwood Mall. [23:38] Malls have a tremendous. [23:40] Traffic impact and so that. [23:42] Highland Drive is billed with two. [23:44] And a high enough speed to handle that capacity. [23:49] And that. [23:51] That a development that. [23:54] In the location closer to an intersection. [23:56] And also being on that roadway that already has a lot of capacity. [24:01] A smaller development like this doesn't necessarily impact that. [24:06] The. [24:08] The the Holiday Hills development and Holiday Crossroads development. [24:14] Are both taken into account on the the roadways capacity? [24:19] When developments there are proposed. [24:21] That traffic capacity is looked at as what can the roadway handle and is this development then going to be something that would [24:25] trigger? [24:30] Or caused there to be. [24:32] Necessary improvements to the roadway. [24:35] And our city engineer can go through some of those, um. [24:39] Kind of. [24:39] Ways that you deal with increased capacity it. [24:43] There's a lot of different strategies when you have a roadway that has. [24:47] Reached its capacity. [24:49] But it's typically. [24:50] At the point where there are. [24:52] Ongoing issues. [24:54] It could be things like dedicated turn lanes or. [24:58] Reduce speeds in some areas. [25:00] There's various strategies, so. [25:03] I think that. [25:04] The city engineer is aware of the traffic that's there and the capacity is. [25:09] At its current time, not at. [25:13] It's full amount that it can't handle. [25:16] So and that was taken into account with. [25:19] Those developments already known. [25:21] And then there were people concerned about you. So you said that height, the height standards are the same and the set back [25:26] standards are the same. So it wouldn't bring things closer. [25:34] Somebody there were a couple of concerns about. [25:37] Lighting and dealing with lighting from from parking and we I know we just passed a residential lighting ordinance. [25:44] So how will that affect? [25:48] Affect this new development. [25:49] Yeah. So our new lighting ordinance, we have a standard for R1 and R2 zones and then we have a standard for all other zones and [25:57] that all other zones coverage is things that are commercial all the way down to multi family residential. [26:05] It regulates things from your parking pole lights. [26:09] Landscaping lights and then architectural lights too. [26:13] All of those architectural lights are required to be shielded. They have specific color temperatures that are required. [26:21] And so the. [26:23] The lighting standards that we have passed have improved. [26:27] Lighting within. [26:29] New developments. [26:31] So there's less impact on neighboring properties from lights because of our new lighting ordinance? [26:38] Umm, sorry, I'm just trying to make sure that we cover all the concerns that we've heard thus far. [26:44] There was also concerns about. [26:47] Umm, adequacy of. [26:49] Police and Fire Protection. [26:51] And the Planning Commission found that everything was adequate. And I'm just wondering if you can speak to that at all as well. [26:57] Yeah, I think that. [26:59] So we've review. [27:01] Rezone request and then also review again when development plans go before the Planning Commission for site plans as to what? [43:04] You're totally interested in the rest of the agenda. [43:11] All right. Good evening, Mayor and Council. This is the final budget amendment to fiscal year 2026 budget. [43:17] I'll start with the general fund. [43:20] First, with the revenue side, we are budgeting an increase in sales tax revenue of 220,000. This is just a result of. [43:28] A small spike we've seen in our overall sales tax revenue in fiscal year 2026. [43:33] Additionally, we're budgeting an increase in appropriation of fund balance of 1.8184 million. [43:40] I'll go into the details of that. [43:41] More specifically right now. [43:44] The first section we have relocation costs. [43:47] Rent of the temporary City Hall. [43:50] City Hall, construction site, utilities and then the portable trailer, if the council recalls previous. [43:55] Work sessions. We've discussed that. [43:58] We originally had the intention of. [44:00] Budgeting certain items within our local building authority. [44:04] After conversations with our auditors, we found that we actually need to move those expenses to the general fund. So we're. [44:10] Rather than budgeting them within the LBA, we're now budgeting them within the general fund. [44:15] The benefit of this is that it does open up. [44:18] Some extra dollars within the LBA for our projects that we're working on. [44:22] And those. [44:23] Increases include the relocation costs, the rent of the temporary City Hall. [44:27] The construction site utilities and then the portable trailer which would be located. [44:32] At our regular 4580 S location and. [44:35] Would really work as sort of a hub for any. [44:38] On site activities that we have or. [44:41] A location for our city engineers to work out of. [44:44] When they're monitoring the project. [44:46] So just to summarize, in these first four items are. [44:50] Budget movement as opposed to new budget or additional funds such as moving it from 1:00. [44:55] Organization to the other. [44:57] Correct. So rather than spending, rather than using LBA dollars which came from the capital projects fund or from our bond [45:00] proceeds, we're now using. [45:05] Sales tax dollars just happened to coincide that we did see an increase in our sales tax dollars, otherwise it would have been a [45:09] larger appropriation of general fund fund balance. [45:16] Moving on from those, if there aren't any other questions, we have an increase in our translator fees. [45:21] This has been an ongoing conversation. With the addition of Mill Creek, we've seen a larger increase in the need for translation [45:24] services within our court. [45:28] That's this increase is just recognizing that additional need. [45:32] We have a small adjustment to our unified fire. [45:35] Contract near the end of the previous fiscal well. [45:40] Fiscal budgeting process last year there was a small adjustment that happened to the UFA contract. It's, it's a $2000 adjustment. [45:43] Uh. [45:48] Believe it's more just a rounding error in. [45:50] The initial budget that we had received from. [45:53] UFA. [45:55] Next we have a. [45:56] Decrease in. [45:58] The salaries, wages for full time, this is specifically within the community development department and this is just recognizing [46:02] the fact that we had had a position which was previously supposed to be our part-time building inspector. It was a position we've [46:07] had. [46:12] Difficulty filling. [46:13] And the other side of that is we are increasing our building inspection contracts, so. [46:18] Reducing the salary and then increasing our contracted services by the same amount for a net neutral budget effect. [46:24] But just recognizing. [46:26] That we do have that additional need for inspection services. [46:30] Next we have an increase to. [46:33] Engineering contract this is with Foreskin primarily and this is for right of way and just some General Services that. [46:41] Foregren does for us, just as we're getting close to the end of the year, we have a few items that are. [46:45] That are getting close to fully. [46:47] Appropriating their entire budget. And so we're just trying to create a little bit of room for those projects that are getting a [46:50] little closer. [46:54] Next, we have our credit card processing fees which we're increasing by 9500. If you notice you look at the base budget, it's it's [46:59] quite a bit lower and it's a pretty substantial increase. [47:05] The reason for the pretty big increase pretty late in the. [47:08] Here we had a number of. [47:12] Building permits which? [47:13] Traditionally, if it's over a certain dollar threshold, we require. [47:17] Applicants to pay via check. [47:20] There were just a few permits which were taken via credit card when they should have been checked. [47:25] So because of that, we had to increase this this amount. [47:29] This problem was addressed with an employee who was just unaware of the policy. [47:33] So we've informed them and it it shouldn't happen again. [47:36] Somebody got some airline miles out of it. Don't. [47:38] Somebody did. [47:40] Somebody did. [47:41] And then the next line item, the last two were actually transfers. The first one is 1.2 million of dollars in transfer from the [47:47] general fund to the capital projects fund and this is primarily for Highland Drive. [47:53] With the logic being that. [47:55] With our general fund having a pretty healthy fund balance, we're relatively near the state maximum of 35%. [48:01] Unreserved general fund fund balance as a percentage of general fund revenue. [48:05] So we're trying to preserve. [48:08] In the event that we do have additional fund balance that's unassigned that's above what the state maximum is, we're just [48:12] intending to move that over to capital projects to. [48:17] Start to try to fund our large project in Highland Drive so. [48:20] We may not necessarily transfer the full 1.2 million, but this is to give us the flexibility. If we do have that extra cash, we [48:26] want to be able to move it over to capital projects to meet those needs. I also understand when you're. [48:32] Grant writing for that sort of thing at Scadorny. Have some of your own matching Monday. [48:37] Correct, sitting there. [48:38] It increases your chances, right? [48:39] Yes, yes. [48:41] And then that final transfer for 59,000, this is a transfer which is actually. [48:47] More associated with the fiscal year 2027 budget. [48:50] Along with our spike that we've seen in our sales tax revenue within the general fund in 2026. [48:55] We also have some projects in 2027. [48:58] So we have extra cash in fiscal year 26. So the intention is that we're moving some of that extra cash from the general fund to [49:04] the capital projects fund to meet some of those immediate needs that we're seeing in fiscal year 27. [49:10] And that's the vehicle replacement and then also unrestricted capital projects typically. [49:16] What happens with our unrestricted capital projects? [49:20] It's really meant as a budget that's specifically to use for projects we don't necessarily know are going to come up. It's for
