[5:23] This is a time for the audience to address the city commission on anything that's not on our regular agenda. [5:28] What anyone would like to come address the commission at this time. [5:32] You a first miss to the Gary, and then you'll be second. [5:34] Jim [5:44] Legary, 342 Burley, [5:49] Brian, may you have a long and prosperous tenure, thank you. [5:59] I'm complaining. I drove down Ridgewood the other day and our people were blowing grass [6:11] into the street. [6:16] I thought that we had done something about that. [6:21] They were reprimanded and corrective action has taken place. [6:26] Is there a way that we could further inhibit the local entrepreneurs that cut grass so [6:38] that we could have obliged them to put bags on their mowers. [6:49] I thought they did already. [6:53] Because there is one that I see, the private long barbers all blow it in the street. [7:04] Well, may I round? [7:06] One of the... [7:08] We'll answer the questions at the end of public comments. [7:10] Okay, that's it for me. [7:15] Thank you. [7:16] Good [7:27] evening, Mike Serbo, City of Hollywood. [7:31] I have a concern, as usual. [7:37] This is regarding 12.45, Richwood Avenue. [7:42] Make you aware that it was recorded in 2007. [7:47] The deed identifies as 12.45, [7:51] five, Ridgewood Avenue, as homestead property. [7:56] I have paperwork here, I'd like to put on file, there's 70 pages, I'll hand that over to the city clerk. [8:05] I'm asking for a factual review of the city records due to the lineup of validation of history. [8:13] First, the city master shows on April 4, 2022, in a deep resolve filed six violations. [8:23] Lean open case closed. [8:26] Brian Walker later signed the sworn app of David, saying the violation still exists and [8:31] it finds continued at $300 a day. [8:34] So I'm asking for what date that was resolved and meant for what records supported. [8:43] the fines to continue. [8:48] In 2021, the water contained seven daily fine categories. [8:53] The January, 2022 lean and the later city displayed carried six electrical system [9:02] hazards is missing from the category. [9:06] So the numbers aren't matching. [9:08] Third, the judgment was $346,450. [9:14] the commission later approved that agreement limiting the city's net revenue sale to 115,000. [9:22] Please state what the city is going to receive, retain, credit it, and [9:26] re-emitted, and the balance that remains, if any. [9:30] Fourth, on August 25th, minutes show that city manager Joe Forte asked whether if he needed approval to bid on this property. [9:42] Yes, the Pouch of Attorney, City Attorney, fifth, an execution of record points to book 87, 57, page two, eight, two, two, but the instrument at the location is separate of $0.723 and $0.60 in legal fees, which is a lien, which I'm not saying that it's invalid for the sale, but I'm asking for the records. [10:12] of that. [10:14] Finally, is the city pursuing this woman's other property, 152, Ridgewood Avenue [10:24] because of the matter at 12.45 because she sold it for less. [10:32] And these are questions. [10:33] She's a very sick woman. [10:36] I'm trying to help relocate her. They'd find home for her cats [10:42] through a lady out of her house. [10:46] I'd like to submit it to the City Clerk, please. [10:50] Thank you, Mike. [10:59] Also, we do have a, it appears your time is up, sir. [11:02] Okay. [11:03] Thank you. [11:06] Any else from the audience like to address the commission? [11:08] Yes, ma'am? [11:12] John, do you have a bell over there? [11:19] This is a supplemental petition, or I'm sorry, [11:22] it's a supplemental to Mike's service. [11:23] You might have, excuse me, excuse me. [11:25] You might be pulling Mike down, there you go. [11:26] Thank you. [11:27] This is a supplemental to Mike's service submission, [11:29] and adds only new information discovered after his packet was prepared. [11:33] On September 8th, 2026, the Volusia County Sheriff Recorded Instrument, 2026-164-188-book 8901, page 4706, titled Release of Levy. [11:46] Concerning 1, 2, 4, 5, Ridgewood Avenue, and this same execution case, the document releases the Sheriff's Levy that had been placed against Miss Young's right title and interest in 1, 2, 4, 5. [12:00] This is not a sheriff's deed, it names no purchaser, states no purchase price, gives no reason for the release and does not state that the judgment was satisfied. [12:10] Because this occurred after Mike's packet was repaired, I am asking the city only three new questions. [12:16] First, did the city, city of attorney, or anyone acting for the city, request, authorize, approve, consent to or otherwise communicate with the sheriff concerning this release of levy. [12:29] Second, what did the sheriff communicate to the city about why the levy was released [12:34] or what occurred with the September 1 execution sale? [12:39] Third, what execution action, if any, does the city now intend to take against 1, 2, 4, [12:46] 5 after this levy was released? [12:48] I am not asking the city for bitter, deed, payment, return of execution or serve distribution [12:54] records. [12:55] Those records are outside the city supplement. [12:57] But please add this official instrument in these three release specific questions to [13:02] view the written reconciliation already requested. [13:06] Thank you. [13:07] Thank you. [13:25] Anyone else from the audience like to address the commission? [13:29] So we'll go ahead and close public comments. [13:32] May I have a moment, please mayor? [13:35] I just need to make some comments to public comments. [13:38] Okay. [13:38] I don't know if the better person to answer my questions is going to be Mr. Walker or Mr. Simpson so you choose who is better suited. [13:53] I would like a quick, very quick synopsis of when this case started, what proceeded through and what happened once it was resolved. [14:06] And another thing I have is, Jonathan, I'm sure that you'll be able to go back and listen for all those records request and we'll provide them under state statute as required. [14:20] Okay. [14:21] Well, I can give you a very quick synopsis of really what happened out at 12.45. [14:28] would have in a tropical gables, the property was cited for numerous violations of not just [14:39] the International Property Maintenance Code, but also the Florida Building Code. [14:43] There were dangerous circumstances with regard to plumbing, with regard to electrical, [14:49] and then there were various violations of the International Property Maintenance Code. [14:52] Some of the violations with the property maintenance code, for example, two of them are referred to. [15:00] 26-61-11, which had to do with trash, and then 26-61-2, which also had to do with trash and littering. Those are fairly easy things to clean up, and so those were removed at a particular time because they were dealt with. It was easier to clean up trash. The more difficult things to deal with are things that are the electrical and the plumbing and those persisted. So the property went to the special master back on [15:30] July 22nd of 2021, is when it went to the special master. [15:35] The special master heard the case and the special master put on the property, [15:42] finds for the various violations. [15:46] Through the years, we tried to help Miss Young, we call her Miss Kim to bring the property into compliance. [15:58] We helped her to get a contractor who would be able to look at what needed to be done, [16:08] how much was that going to cost, and the amount that was needed in order to bring the property into compliance [16:15] exceeded what she felt that she had available. [16:19] In the meantime, things continued to deteriorate. [16:22] The issue was not being resolved so after a period of years, [16:28] the decision was made to try to get a judgment based on what was owed in the leans. [16:38] She was represented by an attorney. [16:42] She had other folks who represented her and this went to the court system in Volusia County. [16:47] So outside of this special master, it went to the actual court system. [16:52] I was there for two of the hearings as was the city attorney. [16:58] One of the things that the judge wanted to make clear was that she was of a clear mind that she understood what was being said to her. [17:06] And the judge came to the conclusion that she did. [17:10] This was something that took place, I believe the going through the court system was at least, I would say, a year or so. [17:22] Longer than that. [17:23] This was not a quick thing going through the court system. [17:28] Eventually, the judgment was given with regard to the leans and then even then, working [17:38] with the sheriff's office, the sheriff's office have their own legal team. [17:42] And their legal team went through everything with a fine tooth comb. [17:48] In fact, that kind of delayed the forward momentum of what was happening because of how careful [17:53] the sheriff's office was. [17:55] So, eventually, the time came that the sheriff was able to say, okay, we can sell the property [18:07] and the property went up for bid. [18:10] And so, there were folks who bid on it and it eventually sold for $225,000. [18:17] But I think the thing to emphasize is that this has been something that took place [18:22] over the course of many years. She was not left without representation. She had an attorney. [18:29] Her attorney was happy with the result. He said that she was happy with the result. [18:34] She willingly signed the agreement. The city could have taken all $225,000. We were entitled [18:41] to the $225,000. Because it was $340,000. [18:46] It was, it was well over somewhere around there, but you as a commission took what could [18:53] be called a merciful step in saying, okay, we're going to restrict how much the city takes. [18:59] You restricted, when you could have taken everything, you restricted it to 115,000. [19:04] She was, she was happy that she got over $100,000 signed off on that agreement. [19:10] She signed off on it, she signed off on it, her attorney felt that she was of right state of mind and she willingly did so and she was happy with the result. [19:19] I just have two other quick questions. Thank you for that quick breakdown. [19:25] Did we ask to bid on that? We did, didn't we? [19:31] And why did we do that? [19:33] We started the bid the the city stopped started and stopped the bid at $50,000 and [19:40] That was kind of to to get the ball rolling. I thought that night [19:46] Mr. Forte explained [19:49] After he asked Mr. Simpson about it that it was to kind of get the ball rolling [19:53] We don't want to bid too high because we don't really want that [19:59] We're not trying to get in the business of owning property [20:04] And the last question I have, because I still have no idea who the, well, you told me the name, but I don't know who the company is, who anything is, did we know this party, whether it's a developer, whatever business he's in, did we know who that was? [20:20] I have no idea who he was, I've never met him before, and being there with Joe Forte, I didn't get the indication that he knew him either. [20:32] There was no indication they didn't act like they knew each other. [20:36] And I think you and I spoke because I wanted to kind of know where this was. [20:41] I think we spoke yesterday during our meeting a little bit, you gave me the run down. [20:48] That you did have a phone call with Mr. Searbone on Friday, correct? [20:52] Was that stuff covered in that call? [20:54] I had an hour and a half phone call with Mr. Servo. [20:58] So I would have thought that would have resolved the issue. [21:00] Just left, but yes, so I had an hour and a half phone call with him and we I'm sorry you're still here. [21:09] I apologize and we did talk about this. [21:13] We went over everything that had been done the process and so I'm going to thank you. [21:22] She's not happy. [21:23] She's sick with cancer and dying and she's probably going to lose her other property too. [21:28] I mean, it's possibly, what you're saying by she's happy with what she's got is not a true statement. [21:38] I mean, I don't know where that comes from, but- [21:40] I'm just conveying what her attorney mentioned to us. [21:44] No, no, public comments is closed, ma'am. [21:51] Public comments are closed. [21:54] Public comments are closed, ma'am. [21:59] So, Walter Snell, it was her attorney. [22:01] Okay, thank you. [22:04] Ma'am, could you please contain yourself? [22:08] Absolutely. [22:09] Thank you. [22:11] So, Jonathan, there were several technical questions asked. [22:16] I would consider those public records requests. [22:18] So, if you could go back and listen to the minutes recording from tonight, [22:22] and answer those individually from both the people that made very specific questions. [22:26] Because I think if we try to answer any of those very specific questions right now, [22:30] We might not get it right, so what would you say, Scott? [22:35] I'm going to say one thing is public records, they ask for public records, [22:39] they extend we have public records, we'll give those. [22:42] We don't answer questions on public records request. [22:45] Thank you. [22:49] Taylor and something else tonight. [22:51] Three things today. [22:53] And we started the process in February of 2024. [22:57] for. And we went to the court three times and the judge gave her opportunities to submit [23:07] plans to the city to rehab the property and did not want to proceed and with it. And [23:15] the city had given her many opportunities to correct the property, tried to work with [23:20] her, and the judge did the same thing. And I think of the second to last hearing, he said, [23:25] I can't hold the city off much longer, they are entitled to what they want to do. [23:31] Please respond to them, get together with them, and try to work with them. [23:36] Not to happen. [23:38] And ultimately, either we leave the property that way, or we have to go to the next step. [23:43] So, thank you. [23:45] So now we move to item 4, which is approval of the minutes of the August 25th, 2026 regular city commission meeting. [23:51] Motion to approve the minutes. [23:55] I was going to say, now that's not a difficult one to get a second on. [24:00] I'll in favour signify by saying aye. [24:02] Aye. [24:03] Any opposed? [24:04] Carried unanimously. [24:05] Now I'll move to item 5 which is at the consent agenda and the action proposed is stated [24:09] for each item on the consent agenda unless the city commission removes an item from the consent [24:13] agenda. [24:14] No discussion on individual items will occur and a single motion will approve all items. [24:18] Is there anyone in the audience who wishes to speak on any item on the consent agenda? [24:24] Seeing none. [24:25] I'll entertain a motion for approval. [24:27] Just one second. [24:29] Do we talk about that, Brian, in the office, the pedestrian, bicycle safety, how does it really, I don't remember talking about that. [24:37] I can, if you'd like, I can, give you a quick summary of the way. [24:41] It's a grant. [24:42] That's, oh, that's the grant, oh, $5,000, yeah, okay, okay, okay, thanks. [24:47] I thought maybe the word grant would refresh your memory. [24:50] Thanks, appreciate it. [24:51] Okay, so do you need to pull an item from the consent agenda, is the Commission want to pull it or we want to approve the consent agenda? [24:58] I'll make a motion to approve. [25:02] Second. [25:03] All those in favor signify by saying aye. [25:06] Aye. [25:06] Any opposed? [25:07] Carried to unanimously. [25:09] We will now move to item six, which is a regular agenda. [25:13] Mayor, sorry, real quick. [25:14] I think we failed Mr. Lagerity because we got wrapped up in the 1245 Ridgewood we didn't answer. [25:21] for his question about the grass clippings and the company being noticed. [25:27] I'm sorry, I just remembered we didn't answer his question. [25:31] Looking out for you even to the end. [25:33] There was a campaign several years ago, St. John's Water Management has the campaign to try and [25:38] keep things out of the river. [25:41] I know a couple years ago, the city commission and the city did an active campaign. [25:47] We put it in water bills, nothing worse than riding a motorcycle or a bicycle down the street when someone just put their grass clippings in a range and you wipe out. [25:57] And so maybe we can look at putting some public information out in the water bills. [26:02] Holly Hill happening news letter, we could put something in there. [26:07] Yes, we'll get on that, this is not here. [26:09] We'll get something out. [26:11] Sorry mayor. [26:12] That's okay. [26:13] You're very welcome, sorry. [26:15] Now we'll move to our regular agenda, which is 2026-R-54. [26:21] Resolution number 2026-R-54 by title only for personally reading. [27:01] Any questions of staff? [27:05] Any from the audience like to talk about this issue? [27:09] Seeing none, close audience participation, entertain the motion for approval. [27:14] Motion to approve. [27:18] Any discussion needed amongst the commission? [27:21] All those in favor signify by saying aye. [27:24] Any opposed? [27:25] Chair unanimously. [28:00] Seeing no one close out, it's participation in a tandem motion for approval. [28:05] Motion to, we got it, we'll hear it. [28:09] I was going to do one, I'm trying to go there. [30:58] And our next meeting will be in two weeks but on Monday, the 21st, instead of Tuesday, [31:04] and that's so we don't conflict with the, with the Lucia County's final hearing of their, [31:11] of their budget. [31:12] it. Other than that, I don't have anything else. Scott, anything to share with us? [31:19] No comments. [31:22] Go ahead and give the floor to Commissioner Curry. [31:24] Thank you. I appreciate that. I really don't have anything. I love seeing the [31:30] participation. So thank you. I want to thank those individuals. Some are still here [31:36] that came to the workshop earlier and we do genuinely want a fix to that problem as [31:45] well. I think you could hear the consensus in the room. I will be unable to attend the [31:52] crime stoppers dinner. I apologize. I will not be in town. [31:59] And that's all I have. [32:00] No. [32:03] JD. [32:06] No. [32:07] I'm good for no. [32:10] I'm fine. [32:13] Commissioner Snow. [32:16] This week is Russia Shana. [32:19] The Jewish New Year said all that is to celebrate. [32:24] I hope it's a wonderful New Year for you. [32:27] If you remember last year we had apples and honey during the mid and that's to celebrate [32:33] a sweet and something good. It should come next year. Thank you, Jamie. You're the best. [32:43] I really appreciate when somebody steps up to fill up position. It's not always easy to get these [32:50] positions available. And moving with the cop is next week. Thursday, April 8th. And that's it. [33:00] Thank you. So there's a lot of things coming up in the next six weeks in our city. There's [33:07] flyers right in front of utility billing, got a movie with the cop, then we've got a blues [33:11] concert. I don't know what else we got. We got the 125th celebration, what car show? [33:33] National [33:33] First, so there's a lot of good things going on in our city. [33:39] The mayor's golf tournament benefiting the food bridge pantry is this Saturday. [33:43] Thank you to many that have made financial contributions. [33:47] That little food pantry distributed over $1.5 million of food to our local community last year. [33:54] So it's amazing. [33:56] And when you do the dollar amount on that, it's almost four times that in dollars that go [34:03] out to the community, so there's no paid employee with that organization, it's all volunteers, [34:10] and they just do a great job, so I'm glad they're here. [34:13] So without anything further, we will stand adjourned.
