[39:24] I um [39:26] live back-to-back adjacent to uh the [39:29] Browns, however, my mother is their next [39:31] immediate next-door neighbor, and I [39:33] spend a lot of time at my mother's house [39:35] helping her. We have host family dinners [39:38] where there are children present, and I [39:41] have concerns about um the hobby kennel [39:46] license that they've applied for. [39:48] My understanding under a hobby kennel [39:50] license is that it is not for commercial [39:53] use, it's for private residence. In the [39:56] April meeting, the Browns stated that [39:58] their dogs are not pets, and that they [40:00] are [40:01] uh trained in what's called PSA, which [40:04] is protection services. Um [40:06] it's basically attack protocols. These [40:09] dogs are specially trained to [40:12] um [40:13] protect their owners, and so I think [40:16] that that's an inherent danger for the [40:19] community and for uh their neighbors [40:22] that increase in volume of this type of [40:25] non-pet [40:26] um in inherently increases the dangers. [40:29] Furthermore, they've requested a hobby [40:32] kennel license. However, they own a [40:34] commercial business. They have a [40:36] training business. And they [40:40] my understanding is they don't meet the [40:42] qualifications for a commercial license. [40:46] And I don't think that they should be [40:47] granted a hobby license just because [40:49] they, you know, don't meet the the [40:52] qualifications for a commercial license. [40:54] Um their business includes services of [40:57] training and boarding other people's [41:00] aggressive dogs. So, again, that's an [41:01] increase in quantity and so inherently [41:05] an increase in potential dangers to [41:07] their neighbors, the community, [41:09] livestock, and so on. [41:11] Um the In the April 9th meeting, they [41:13] also stated uh again that their dogs are [41:16] not pets, but they are canneled 100% of [41:18] the time. They disclosed that their dog [41:21] the dog breeds were Malinois, um [41:23] which have a a little uh [41:27] They're often called Maligators for and [41:31] um German Shepherds. And these are very [41:34] um high energy breed dogs. I'm concerned [41:37] that if they, you know, one I want them [41:39] to be canneled all the time, but that [41:41] also leads to barrier frustration and [41:44] Malinois in particular are known to be [41:47] able to climb fences with ease. So, I'm [41:50] asking the commissioners to deny the [41:53] basic the uh hobby license based on the [41:55] fact that they own a business and this [41:57] is doesn't qualify for a hobby kennel, [42:00] in [42:00] uh is my understanding. And in spite of [42:03] all of these considerations, if the [42:05] commissioners do um [42:07] approve to approve the hobby kennel [42:10] license, I would like the structure to [42:13] be a solid wall so little kids can't put [42:15] their arms through the fence, extend 2 [42:18] ft below the ground so the dog can't dig [42:21] through, and have a cantilevered um top [42:25] so they can't escape over the top. [44:04] Uh mitigating nuisance noise, which is [44:06] barking, ensuring that the dog enclosure [44:08] and the kennel are closed to prevent [44:10] commercial kennel activities from [44:12] occurring under a hobby dog conditional [44:14] use permit in an R1 zone, [44:17] and to provide safe [44:19] safety and potentially dangerous animal [44:21] safety from potentially dangerous [44:23] animals. Ordinance number [44:41] 2024-01, [44:43] the single largest dog's bark [44:45] uh [44:46] single large dog's bark averages 80 to [44:49] 100 decibels, which is equivalent to a [44:52] car horn. [44:53] Exceptional loud barks reach 113 to 116 [44:57] decibels. The hobby dog kennel permits [45:00] applicants seeking potential multiplying [45:02] that noise by 10 times in their [45:04] respective zone area. [45:06] So, [45:07] I don't know what [45:09] I guess we're proposing that [45:11] um [45:11] maybe kind of dish it to be that the [45:13] dogs to be housed indoor at night time. [45:16] Uh [45:17] they won't be allowed to bark [45:18] continuously more than 5 minutes or [45:20] intermittently from 5 minutes to 60 [45:23] minutes. [45:24] Outdoor kennels shall not be located [45:26] closer than 50 ft from any side or rear [45:28] property line. And if we were zoned in [45:31] um agricultural, [45:33] that neighbors would be 50 ft, not 27. [45:37] And sound walls are solid fencing with [45:39] blocks or muffles the noise from [45:42] noises or used outdoors. The other [45:44] thing that uh we're asking is that the [45:48] conditions for the property owners [45:50] agreeing not to engage in any activities [45:53] that fall under commercial not kennel [45:55] noises, including but not limited to [45:57] receiving compensation for any services [46:00] or products, boarding or training and [46:02] also they don't allow [46:03] disallowing temporary ownership of dogs [46:06] other than [46:07] um [46:08] disallowing temporary ownership of dogs [46:11] and other pets to circumvent the [46:13] restriction of the public animal [46:15] licenses.
