[0:00] call the regular meeting order we already upped the pledge [0:05] i pledge allegiance to flag of the united states of america and to the [0:09] republic for which it stands one nation under god indivisible with liberty and [0:15] justice for all [0:19] okay you all have a copy of the agenda are there any additions or corrections [0:22] to the agenda [0:25] okay hearing none is there any you want to do the public hearing first [0:30] for the basic code before you do public comment then you want to go exactly as [0:33] we got it on order here [0:37] yes okay [0:39] how far are we going to go okay so first we're going to do this public hearing [0:42] how are you going to run that i mean then we run into on aven [0:47] to adopt it so how much discussion do you want to do on [0:50] i would say you could see if anyone from the public wants to comment we could [0:54] respond to their comments directly and then the rest of [0:57] the discussion then go into regular business [1:00] so right now we're having the public hearing on the basic code update [1:06] comments this is kind of weird [1:13] this felt weird okay so do you want to go into [1:18] discussing any of the updates on there chris now or do you want to do this by [1:20] the regular meeting [1:24] i would say we can do it during the regular meeting okay [1:27] so this was basically just a formality this [1:31] right six o'clock thanks i think everybody here's for regular meeting [1:34] right dan marlene [1:37] you guys got anything on the basic code [1:41] jay is here for something later on okay so we'll close the public hearing [1:45] public comment period it's not making anything for the public commentators [1:48] it's not already on the agenda okay [1:52] b that's a basic code [1:59] all those formalities back to the basic code [2:02] the planning commission did go [2:06] over some of the sections of the basic code that are related to zoning [2:12] the rest of the basic code update [2:17] planning commission does not have to review its other other rules for the [2:20] city and about every three or four years the [2:23] publisher of our basic code that we use does an update to make sure everything's [2:27] up to up to par with state law and so they [2:30] issue a new update which now we're looking at the two their 2014 update [2:36] and in addition to what they've changed just for state law and other minor [2:40] changes the planning commission has talked about [2:44] some new language pertaining to garages this is in the zoning garages [2:49] and [2:58] garages and dwelling units [3:07] and in the current well current basic code and the proposed [3:11] it's all the same and the proposed code there's not a definition for garage [3:17] so we've had a lot of questions at city hall what's what's allowed for a garage [3:21] and i think it's it would probably work best [3:25] for everyone if that was defined in our old zoning that we had before we [3:30] adopted the basic code we did have garage defined [3:34] and it was defined as a three-car garage as a maximum size well that's [3:39] it doesn't give dimension so that's kind of hard to say well one person's [3:42] three-car garage is different than somebody else's so at the planning [3:45] commission level we talked about actually putting a maximum square foot [3:49] on the garage so right now what's proposed is [3:54] 1200 square foot maximum or 125 percent of the footprint [3:59] of the house whichever is less so if you have a really small house if someone [4:04] just puts up kind of a shoebox house you can't put up a monster [4:08] garage it has to be somewhat in proportion [4:11] so i think this is good language i guess [4:15] the question is is 1200 square foot a good size some three car garages are [4:20] actually a little bigger than that we just got an application one was 1260. [4:26] so i don't know if you want to bump that up [4:29] and then the other thing there's there's something [4:33] in the regular zoning that between the house and the garage can't take up x [4:36] amount of percentage of the lot right so it can't be over 50 [4:40] of hard surface [4:48] what if somebody has two lots right they have two full lots [4:56] well this would be like an average lot is about 8 000 square feet so if you [5:01] have a house that's let's say [5:04] 2000 i mean be real generous and then you have a 1200 square foot [5:08] garage you're still under that 50 so that 50 percent really comes into [5:13] play to make sure somebody doesn't pave their whole lot [5:17] because it's any hard surface it's not just building [5:20] so that's to make sure it's you know not completely impervious and then all [5:24] the water would run on the neighbor so that's what that 50 [5:28] is after it is kind of a catch-all for these other things too for the size of [5:31] house and garage if they really got baked but um [5:36] i think the two things here to consider are [5:38] the 1200 square foot you know do you want to bump that up a [5:43] little and then the other regulation here it does say [5:46] under private garage which is in the residential areas it would be for [5:50] passenger vehicles and trucks not exceeding 12 000 pounds gross weight so [5:54] that's basically saying they can't have their commercial vehicles there [5:58] which makes sense in a residential but [6:02] are we going to be able to enforce that and how many people already have [6:05] commercial vehicles that they store there [6:08] and is that acceptable [6:10] i'd rather see them stored inside right than the outside right [6:16] very good point so if they were allowed in the garage then that's a good thing [6:20] then they're parked inside i do think we should bump that square [6:24] footage up though because more people something these people are building [6:27] right right yeah people are building [6:29] neighborhoods 30 by 40 that's pretty big yeah mine's [6:33] like 24 by 34. i mean i'd rather have that than have a couple of smaller [6:38] storage sheds i'd rather have i mean i think it looks nicer if you've got one [6:41] big garage storage with storage versus a bunch of little [6:45] essentially 35 by 35 is the footprint of my house [6:53] it's pretty big if you were to put parked cars on it [6:59] and the attack would be this would be the maximum for all garages so if [7:02] somebody perhaps wanted to build two smaller garages detached this total [7:06] would be for those combined what's your what's your garage [7:10] i thought it was like 24 by 34. yeah so you're just a good size two-car [7:16] garage and you've got good storage in every size [7:19] well no no not a lot but i mean you have extra extra definitely [7:23] square feet this is allowing an extra [7:27] 400 square feet to that size you're only at two-thirds of the max right now [7:34] and then the other factor is the existing or the older lots in town [7:40] are smaller than the new lots so [7:43] i don't know that we want to get into having [7:47] two different ones the one that's proposed is for one of the vacant lots [7:51] out at prairie meadows and it's a 30 by 42 [7:56] garage which is a pretty decent sized three-car garage it's got some storage [8:00] on each side and an extra 10 foot deep so [8:04] it's amazing how many garages are not even used to store [8:09] cars in and you still have the limiting factor [8:12] of the 125 percent of the footprint of the house yeah so it's not like everyone [8:16] could build a 1300 square foot right so i'm thinking because you do have [8:20] you do have other things in place to control it so [8:24] you're not going to have these big monstrosity [8:27] on the small lots on a small lot with a small house you're [8:31] not going to have this huge grudge because you've got other things that [8:33] control the size [8:38] so cheryl i heard you [8:40] recommend 1300 and i wouldn't go any less than 1300 i don't think [8:47] is this recommendation from eda i mean is this it's a recommendation from [8:51] planning commission but it's going to get changed [9:01] well if you've got somebody else already [9:04] wanting to build a larger garage and you're gonna see that all the time [9:08] everybody's gonna they're [9:31] yeah and and i think at the planning [9:33] commission we were focusing more so on the [9:37] the older lots and i don't know the smaller residential lots i don't know [9:41] within the city so we could either have two different regulations for the [9:45] different sizes because we've got the other 125 percent [9:49] of the footprint and i think that's where the change came in tony is that [9:52] then this would if if it got bumped up it would cover both the new lots [9:58] and the older lots under one regulation which would be simpler to enforce [10:04] okay because as long as you've we're a small town people aren't moving [12:30] here to to live amongst the sidewalks they want [12:33] to have some lawn they want to have some grass [12:36] so i mean a 1200 square foot garage to me seems like [12:40] it's got plenty of room on it but you know if you're talking about a bigger [12:44] lot that's what it is [12:48] because the lots of prairie are bigger than the ones in the city right yeah [12:52] quite a bit tell them how many exceptions are in [12:55] town for example i have a three acre and a one acre lot [12:59] i can only build it you know i could build a large thing but apparently this [13:02] i can only build on either of those i can only put a [13:06] 1200 garage on mine right and i think that [13:11] the houses the newer houses that are built [13:13] are going to have the attached garage so they're going to be [13:19] limited width-wise how how big their garage can [13:22] be yeah because they still have setbacks [13:25] that they have to abide by does this take into account though if it's an [13:29] attached garage or is this just separate garage either or either one [13:39] i think this is gonna i mean i don't think you're gonna have [13:41] issues with 1200 square foot garages in the new development [13:46] necessarily because they're going to be they're [13:49] going to want everybody wants them attached where they wanted to tap it [13:52] somebody's already submitted plans for bigger [13:56] which means people are looking at but there's going [14:00] to be someone that could potentially come to a town and say well i want a [14:03] bigger garage than that but by by limiting that though and they've got the [14:07] space by limiting it you're limiting the value [14:11] then also how much green space do they have remaining [14:15] they meet the 50 rule [14:25] i'm going to say the house is probably 1700 square feet [14:30] 16 or 1700. and there is extra room in that in that [14:36] example extra [14:39] above and beyond three cars so it is a generous size i don't think [14:44] it's so it's it's crazy big but in that case [14:48] um so we're taking we're looking at [14:51] changing this number for one particular [14:56] overall because of prairie meadows because the size of the lots out there [14:59] but i mean we're getting somebody that's coming through and saying they want a [15:02] garage that's how big 6 16. 60 60 so in a year somebody else [15:07] builds and they're going to want one even bigger so we're just going to keep [15:10] upping this i agree we already have an ordinance in place though at that point [15:13] in time you know right now we don't have a defined [15:17] definition and technically because another one the [15:21] permit application has been submitted this adoption of this ordinance will not [15:26] be official until it's published so chances are [15:31] that application will go through because it's grandfathered or whatever term [15:35] you'll use [15:43] and we can change this again at a later date [15:46] if everyone's more comfortable with [15:50] keeping it at the 1200 and we find out we're having more issues [15:53] with that then we could always change it again i'm just thinking more and more [15:57] people if they've got the space want their garages not only their [16:00] vehicles but men put shops in there they you know they like their [16:05] wood shops or their lawnmowers their toys their lawnmowers people are getting [16:08] riding lawn mowers they're getting more and more things that don't fit [16:11] in smaller garages and if they've got the space [16:17] if they make the space constraint i don't understand what the problem is [16:24] because they can't go two-story it's got to stay one story right but i thought [16:28] that was somewhere where it's gotta be one story they can't go two stars [16:30] anymore right right and the garages well there's a height limit i don't know [16:34] they're in height limit [16:38] so they could still do a barn style garage that they could have [16:42] storage up above i believe trusses or something which would be [16:46] so what's your guys's opposition to taking the size up [16:54] i think 1200 square feet is plenty you know if you just did the math [16:58] oh just based on that i mean i mean to you it's plenty but maybe the the guy [17:02] that's building it it just depends where you put it yeah i [17:06] mean i could think i could give you a handful of houses in town but their lots [17:10] aren't big enough their houses aren't big enough to support it's terrible but [17:13] wouldn't make the 125 percent because those lots [17:22] are much smaller than the parameters i guess so even if we set that in and we [17:25] don't want a thousand they wouldn't be able to because their lot wouldn't in [17:28] the size of their house they wouldn't be able i guess [17:35] for example if they were to have something like a lot and a half [17:39] it would allow them to put something a little bit bigger on [17:42] and it wouldn't look it wouldn't take up the entire [17:45] yeah like i have i have a lot in the third my garage could be bigger and i'd [17:48] still make the setbacks and i'd still make everything because i have a lot and [17:50] a third but [17:53] my neighbor has two-thirds of a lot where she wouldn't be able to because [17:57] she wouldn't meet the setbacks she couldn't even have the size of garage [17:59] that i have because she wouldn't make setbacks or the 50 on it or the 50 [18:03] percent and i think we're seeing i see that some [18:06] development out there now i don't think we want to discourage that in any way [18:09] that's what i'm thinking you know we're discouraging and we're trying to hold [18:12] people back going oh we want you to build here but you know you can only [18:15] have a little house with a little garage and you know 1200 is a good size you [18:21] know i guess if you look at what a what a stall would [18:25] be a garage door is what eight wide and a car is 20 you know even if [18:31] you call that 10 and they're maximum 20 foot long that's [18:35] you know 200 square foot per car times three that's [18:40] 600 so everything else is like extra space for getting in and out of the [18:44] doors and the shop and everything you're talking about especially but storing [18:48] stuff in there too well the thing is sitting right inside you can't put a [18:50] basement out in prairie so you gotta you gotta consider the [18:54] people that are space because [18:57] there's no basement so where are you going to store your store in your garage [19:02] and we encourage people to keep that stuff off of their [19:06] out of their yards and off the streets and whatever this way it's [19:10] i don't want to discourage people from building [19:13] you know i could say i'm looking at the tax side of it is [19:16] the guy just a little bit bigger that property has a little more value if the [19:19] house if the house if if the house is big enough to substantiate that that [19:23] size and that's actually a good size house i mean that's the things too that [19:26] has to be a good size house to support [19:29] a 1260 foot garage right right well probably about a [19:34] thousand square foot because 125 times that so a thousand square foot [19:39] is big like if you had a two story um but if it's just a one story it's not [19:43] that big of a house [19:46] so in most cases it's the it's the number you pick the 1200 or the 1300 [19:50] that's going to control unless somebody had a really small house [19:54] like 600 square feet or something then [19:57] they're going to be limited by the 125 or you can change the 125 this is [20:17] he wasn't weighed in i think like i said you don't want to placed on a permanent foundation [26:22] and that they should have a pitched row [26:30] so let me ask a question then just because i want to clarify just because i [26:34] know the question will come up because tony said if you've got so if [26:37] somebody's got two lots like out in prairie some of the people are buying [26:40] two lots does it mean only one dwelling structure [26:44] per partial does that mean only dwelling part dwelling structures can be built on [26:48] a parcel or only one residential on a parcel can a [26:51] person build a garage on a parcel or is that limiting it so they can't can they [26:55] have their garage so you could build a house and this person [26:58] in their house on this parcel if if that was proposed i would [27:03] have them go to the county and combine the two parcels into one person [27:08] okay pretty good process okay okay you're saying if they want to build a [27:11] garage over on yeah yeah yeah so they want you know a bigger lot so they buy [27:14] two of them because they want a bigger lots and then they just get them [27:16] combined we don't have any say in that and [27:19] whether someone can well they're still limited to there that have two what if they want to build a garage on the other [27:33] one yeah like i don't think there's much expense going to the county together [27:38] because otherwise if they were remain two parcels and that person lived there [27:42] with the house in the garage it would be real it'd be easier for them [27:46] to just sell off the parcel with the garage and unfortunately when those [27:50] transactions happen they don't need the city's permission for a real estate [27:53] transaction so by us requiring before we get the building permit that they [27:57] combine the parcels that would [28:00] prevent that and we don't have that was my question [28:03] we don't have any say whether someone can combine two lots i mean if we [28:06] have a you know subdivision or whatever out there and we [28:09] say okay we've got 20 lots and someone says well i'm going [28:12] to buy these two and now we're going down to 19. do we have any control [28:17] saying no we're not allowing that out there or is that just [28:20] a county thing they can just do if you purchase two lots you can't [28:23] control them turning it into one parcel if they request that from economy that's [28:28] what i'm saying i mean we unless there was something like in [28:31] prairie meadows if there was something real specific in the covenants that's [28:34] you know we have our zonings has a minimum lot size i suppose covenants [28:39] could have a maximum to ensure more lots within the [28:42] development some of that gets you know i'd have to look into it it [28:47] gets trickier to enforce so we have to change the covenants and go through with [28:50] that process i'm just asking the general question so [28:53] that if we were to i can't even think of a [28:56] problem but if there was a problem can we say anything does the county consult [29:00] with us you know do they check covenants and say [29:03] oh no we can't do that here because they're saying these lots have to stay [29:07] let's wait for the covenants or whatever or they can just say yep they're two now [29:11] they're one right as long as they meet the criteria for the county and i and i [29:14] have it in my office she sent it to me that it has to be under the same [29:17] ownership um [29:20] and a few other things and then the county will do that for them so [29:24] so is that what the e1 is saying is only a house [29:29] can be built on that where does it say it that you can't put a garage on a lot [29:34] or do we need to clarify that because that is just saying only one dwelling [29:37] zoning is is written but as long as it's worded someplace [30:30] else then i'm fine i just didn't know if this was the only way only place that it [30:33] was worded so then that that's right i mean it would be nice sometimes to just [30:38] say it very clear so then anybody reading it understands that [30:42] and i guess we could even [30:46] add that in here in that e1 so this isn't spelled out to [32:08] adopt a special resolution that says you're going to enact licensing for them [32:13] i don't know that that happened when you adopted the basic code last time so i'm [32:17] not recommending we do that i mean a whole another licensing [32:22] process i don't think is needed i think what [32:26] would be helpful is is to regulate it in a little bit different way [32:31] because the licensing would let's say for um [32:35] the solicitors or you know would give us if they did come in and give us the [32:40] chance to run a background check if it's a food vendor a mobile food truck it [32:44] would give us the chance to to make sure we got a copy of their department of [32:47] health license it would give us a chance to check all [32:51] those things just so [32:53] we didn't have anybody showing up on any weekend [32:57] setting up in town because then we'd have a license and [33:00] we'd have to go through that process another way to do it would just be to [33:04] say to look at what houston [33:07] how it operates now and when do we have transient merchants would be like [33:12] somebody setting up a truck to sell something and agriculture is exempt in [33:16] case anyone was wondering so somebody's selling you know farmer's market type [33:20] stuff that's exempt but if somebody set up shop to sell trinkets
